"summary_en": "The Constitutional Chamber (Sala Constitucional) partially granted the amparo proceeding concerning noise pollution at Club de Tiro Rancho Arizona. During the proceeding, the Santo Domingo Health Area conducted a new measurement, obtained 55.6 dB(A), deemed the health order complied with, and closed the file. However, it did not formally notify the applicant of the final outcome of her complaint, violating the rights recognized in Articles 41 and 50 of the Constitution; the Chamber therefore ordered the head of the Health Area to communicate that outcome. The Chamber considered the administration’s decision to wait for the resolution of appeals, given the dispute over whether the area was residential or mixed use and the applicable noise limits, to concern ordinary legality. It also rejected objections about subsequent technical and procedural matters and did not order cancellation of the health permit or permanent closure of the establishment.",

Reference to an in-person meeting held on 15 December 2025 does not establish that this obligation was met, since the administrative procedure had not yet concluded at that time. Nor does the record show that, after the 17 May 2026 measurement and the decision deeming the health order complied with and closing the file, the applicant was formally informed of the outcome of her complaint. Accordingly, a violation of the rights recognized in Articles 41 and 50 of the Constitution is established.",

"body_en_text": "035619-26.\nALLEGES THE PERSISTENCE OF NOISE POLLUTION AT AN ESTABLISHMENT\nTHAT HAS A HEALTH ORDER THAT THE RESPONDENT HAS NOT EXECUTED.\nPARTIALLY GRANTED, ORDERING THE DIRECTOR OF THE HEALTH AREA OF\nSANTO DOMINGO OF THE MINISTRY OF HEALTH TO FORMALLY NOTIFY THE\nAPPLICANT OF THE FINAL OUTCOME OF THE COMPLAINT REGARDING NOISE\nPOLLUTION FILED AGAINST THE ESTABLISHMENT.\nRGS09/2026\n\n“(…)\nThe applicant alleges that the Ministry of Health did not effectively\nenforce the health order that suspended the shooting activity of\nClub de Tiro Rancho Arizona, despite complaints of noncompliance. (…)”\n\n“(…)\nThe fundamental rights to health and to a healthy and ecologically\nbalanced environment are recognized in the Constitution (Articles\n21, 50, 73 and 89 of the Political Constitution), as well as in the\ninternational rules applicable within the domestic legal system. (…)”\n\n“(…)\nDuring the amparo proceeding, the Health Area of Santo Domingo\nconducted a new measurement, obtained a result of 55,6 dB(A), and,\nby means of acts notified on 19 May 2026, deemed the health order\ncomplied with and closed the file. That action formally resolved the\nhealth-related matter that remained pending when the application\nwas filed.\n\nHowever, the record does not show that the final outcome of the\ncomplaint regarding noise pollution was formally communicated to\nthe applicant. The reference to an in-person meeting held on 15\nDecember 2025 does not establish that this obligation was fulfilled,\nbecause at that time the administrative proceeding had not yet\nconcluded. Nor does the record show that, after the measurement was\ntaken on 17 May 2026 and the decision was issued deeming the health\norder complied with and ordering the file closed, the applicant was\nformally notified of the resolution of her complaint. Accordingly,\na violation of the rights recognized in Articles 41 and 50 of the\nPolitical Constitution is established.\n\nAs to the applicant’s statements regarding the enforceability of the\nadministrative act, the record shows that the closure order notified\nto the owner of Rancho Arizona on 2 December 2025 was challenged by\nthe interested party. That circumstance does not in itself make\nexecution of the order impossible. However, the administration\nmaintains that, because documentation had been submitted concerning\na dispute over whether the area where both the applicant’s property\nand the shooting area are located is for residential or mixed use—a\ndistinction it considered relevant because the noise limit differs\nin each case—it deemed it advisable to await resolution of the\nchallenges. Thus, the Chamber notes that, in this respect, the\nadministration’s decision was based on that criterion of convenience\nand opportunity. Any discussion of the matter would therefore concern\nordinary legality and would not be a matter for this jurisdiction.\n\nVII.- Lastly, the applicant’s objections to the methodology used for\nthe May measurement, the number of plans admitted, the calculation\nof subsequent challenges, and the closure of the file raise disputes\nconcerning subsequent actions and matters of technical and procedural\nlegality that exceed the scope of the original matter, without\nprejudice to the corresponding ordinary avenues. Nor is it appropriate\nfor this Chamber to directly order cancellation of the health permit\nor permanent closure without a current technical finding to justify\nit. Accordingly, the application is denied as to this point. (…)”"
