"summary_en": "The Constitutional Chamber (Sala Constitucional) granted the amparo proceeding only against the Municipalidad de La Unión because it had failed to enforce effectively the closure of an allegedly unauthorized construction. The Chamber held that the municipality’s duty does not end when closure seals are placed: it must conduct continuing inspections, secure the physical cessation of work, request assistance from the Fuerza Pública, and report any disobedience or breaking of seals to the Ministerio Público. It ordered an on-site inspection within three business days, those enforcement measures if construction was found to be continuing, and a final decision within two months in the administrative sanctioning and regularization procedure. The Chamber denied amparo relief against CNFL because an inspection found no defect in the public network and placed responsibility for internal electrical installations on the property holders. Private disputes involving boundaries, falling earth, the septic tank, noise, and use of the communal easement were left to the appropriate ordinary jurisdiction.",

SE DECLARA CON LUGAR EL RECURSO DE AMPARO, ÚNICAMENTE EN\nCONTRA DE LA MUNICIPALIDAD DE LA UNIÓN. SE ORDENA AL ALCALDE MUNICIPAL, Y AL\nDIRECTOR DE DESARROLLO Y CONTROL URBANO, AMBOS DE LA MUNICIPALIDAD DE LA UNIÓN,\nADOPTAR EN FORMA INMEDIATA LAS SIGUIENTES DISPOSICIONES: 1) REALIZAR DENTRO DE\nLOS TRES DÍAS HÁBILES SIGUIENTES A LA NOTIFICACIÓN DE ESTA SENTENCIA UNA\nINSPECCIÓN TÉCNICA PRESENCIAL EN LA FINCA EN CUESTIÓN, A EFECTO DE CONSTATAR LA\nSITUACIÓN FÍSICA DE LA OBRA CLANDESTINA DENUNCIADA Y VERIFICAR LA COLOCACIÓN DE\nSELLOS DE PARALIZACIÓN EFECTIVA DE LOS TRABAJOS; 2) DE CONSTATARSE LA\nCONTINUACIÓN MATERIAL DE LOS TRABAJOS CONSTRUCTIVOS O LA VULNERACIÓN DE LOS\nSELLOS DE CLAUSURA, PROCEDER DE FORMA INMEDIATA A INTERPONER LA RESPECTIVA\nDENUNCIA PENAL ANTE EL MINISTERIO PÚBLICO Y COORDINAR EL AUXILIO DE LA FUERZA\nPÚBLICA PARA GARANTIZAR LA PARALIZACIÓN ININTERRUMPIDA DE LAS FAENAS; Y 3)\nCONTINUAR Y RESOLVER CON CELERIDAD EL PROCEDIMIENTO ADMINISTRATIVO\nSANCIONATORIO Y DE REGULARIZACIÓN PREVISTO EN LOS ARTÍCULOS 93 Y CONCORDANTES\nDE LA LEY DE CONSTRUCCIONES, DICTANDO EL ACTO FINAL QUE EN DERECHO PROCEDA\nDENTRO DEL PLAZO DE DOS MESES CONTADO A PARTIR DE LA NOTIFICACIÓN DE ESTE\nPRONUNCIAMIENTO. RGS09/2026\n\n“(…) (…)”",
"body_en_text": "35708-26. ALLEGES THAT A REPORTED, ALLEGEDLY UNAUTHORIZED CONSTRUCTION PROJECT WAS CLOSED; HOWEVER, CONSTRUCTION CONTINUES. THE AMPARO APPLICATION IS GRANTED SOLELY AGAINST THE MUNICIPALIDAD DE LA UNIÓN. THE MUNICIPAL MAYOR AND THE DIRECTOR OF URBAN DEVELOPMENT AND CONTROL, BOTH OF THE MUNICIPALIDAD DE LA UNIÓN, ARE ORDERED TO ADOPT THE FOLLOWING MEASURES IMMEDIATELY: 1) WITHIN THREE BUSINESS DAYS FOLLOWING NOTICE OF THIS JUDGMENT, CONDUCT AN ON-SITE TECHNICAL INSPECTION OF THE PROPERTY IN QUESTION TO ASCERTAIN THE PHYSICAL STATUS OF THE REPORTED UNAUTHORIZED CONSTRUCTION PROJECT AND VERIFY THE PLACEMENT OF SEALS EFFECTIVELY HALTING THE WORK; 2) IF IT IS DETERMINED THAT CONSTRUCTION WORK HAS PHYSICALLY CONTINUED OR THAT THE CLOSURE SEALS HAVE BEEN BREACHED, IMMEDIATELY FILE THE APPROPRIATE CRIMINAL COMPLAINT WITH THE MINISTERIO PÚBLICO AND COORDINATE ASSISTANCE FROM THE FUERZA PÚBLICA TO ENSURE THE UNINTERRUPTED HALTING OF THE WORK; AND 3) EXPEDITIOUSLY CONTINUE AND RESOLVE THE ADMINISTRATIVE SANCTIONING AND REGULARIZATION PROCEEDING PROVIDED FOR IN ARTICLES 93 AND RELATED PROVISIONS OF THE LEY DE CONSTRUCCIONES, ISSUING THE FINAL DECISION REQUIRED BY LAW WITHIN TWO MONTHS OF NOTICE OF THIS RULING. RGS09/2026\n\n“(…) Effective protection of the rights to safety, the environment, and good administration requires the municipal corporation to verify in practice strict compliance with its stop-work orders. In this regard, this Constitutional Court has repeatedly held that municipalities have a constitutional and legal obligation to exercise proper and continuous oversight of urban planning and construction matters within their cantons. Imposition of a closure order does not exhaust the municipal entity’s duty, because it retains the inescapable authority and duty to ensure that the noncompliant person rigorously obeys that order. When work is unlawfully resumed or seals are breached, the local authority cannot hide behind inaction or refer the person concerned to resolve the situation through civil proceedings; on the contrary, it is authorized and required to seek assistance from the Fuerza Pública to halt the work in practice and immediately file the corresponding criminal complaint concerning the alleged offense of disobeying an authority or breaching seals. Municipal police power requires the adoption of immediate and effective measures to physically halt the work, with the support of the public-security authorities if necessary. (…)”\n\n“(…) Regarding the claim brought against Compañía Nacional de Fuerza y Luz S.A., this Chamber concludes that no violation of fundamental rights occurred. The respondent entity demonstrated that, once the physical address of the site had been corrected, it conducted the corresponding technical inspection on 25 August 2026 and determined that there was no unlawful diversion of electricity or irregularity in the property’s metering equipment. The expert examination, for its part, ruled out active short circuits or overloads in the public distribution grid, establishing with technical clarity that the wiring identified consisted of private internal electrical branches and installations belonging to the residents of the undivided property themselves. Under Article 15 of the Norma Técnica AR-NT-SUCOM issued by the Autoridad Reguladora de los Servicios Públicos (ARESEP), the distribution company’s responsibility ends at the point of delivery and metering of electricity, while the technical duty to properly install, preserve, and maintain the internal networks rests exclusively with the subscribers and property owners. Because no danger originates in the public grid operated under concession and no improper omission is attributable to the supplying company, the dispute concerning the condition of the private installation falls within the private sphere between the parties; accordingly, the amparo must be denied with respect to CNFL. (…)”\n\n“(…) As for the applicant’s allegations concerning the purported encroachment across property boundaries, collapse of soil from adjoining land, impact on the septic tank, noise, and incompatibility among co-owners regarding use of the communal easement (servidumbre comunal) on property 22386, it must be recalled that the constitutional jurisdiction is not an ordinary forum for adjudicating neighborhood, property, or co-ownership disputes. Any claims for damages between private parties or disputes concerning possession must be brought in the appropriate ordinary judicial proceedings. (…)”"
