"summary_en": "The Constitutional Chamber (Sala Constitucional) granted the amparo application concerning the serious problems affecting Barrio La Esperanza, in La Teresa, La Rita district of Pococí, Limón, because adequate infrastructure for stormwater disposal did not exist. It ordered the President of the Municipal Council and the Coordinator of the Public Works Department of the Municipalidad de Pococí, acting within their respective powers, to take the appropriate measures, coordinate their work, and issue the necessary orders to definitively resolve the stormwater drainage problem. Compliance must occur within eighteen months after notification of the judgment. In a separate note, Justice Castillo Víquez reiterated his position on the allocation of jurisdiction between the Constitutional Chamber and the administrative-litigation courts when a person alleges infringement of the right to prompt and effective administrative justice, while preserving the constitutional exceptions that the Chamber itself has recognized as cognizable through the amparo guarantee proceeding.",

ACUSA QUE EL BARRIO LA\nESPERANZA, EN LA TERESA, LA RITA DE POCOCÍ EN LIMÓN ENFRENTA PROBLEMAS GRAVES\nPOR LA INEXISTENCIA DE INFRAESTRUCTURA ADECUADA PARA LA EVACUACIÓN DE AGUAS\nPLUVIALES. RGS09/2026\n\n“(…) NOTA DEL MAGISTRADO\nCASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y\nCUMPLIDA. GRANTED, ORDERING THE PRESIDENT OF THE MUNICIPAL COUNCIL AND THE COORDINATOR OF THE PUBLIC WORKS DEPARTMENT, BOTH OF THE MUNICIPALIDAD DE POCOCÍ, TO TAKE THE APPROPRIATE ACTIONS, COORDINATE, AND ISSUE THE NECESSARY ORDERS, ALL WITHIN THE SCOPE OF THEIR POWERS, SO THAT, WITHIN 18 MONTHS FROM SERVICE OF THIS JUDGMENT, THE PROBLEM RELATED TO THE STORMWATER DRAINAGE SYSTEM IN BARRIO LA ESPERANZA DE LA TERESA, DISTRITO LA RITA, IS DEFINITIVELY RESOLVED. RGS09/2026\n\n“(…) NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE. I have supported this Court’s position that, when a litigant alleges an infringement of the right to prompt and effective justice in administrative proceedings, the Administrative-Litigation Courts, rather than this Chamber, must hear the legal dispute. However, the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, established that this right may be judicially protected through the amparo proceeding provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in cases where the petitioner considers that the Administration’s material conduct, administrative acts, or response is affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to modify its line of precedent, as, pursuant to Article 7 of its Law, this Court has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances that may properly be heard in this jurisdiction through the constitutional guarantee proceeding of amparo, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 at 8:55 a.m. on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
