"summary_en": "The Constitutional Chamber (Sala Constitucional) granted an amparo proceeding brought by owners of properties adjoining a company’s operating site. They had complained to MINAE that stormwater runoff carried asphalt, cement, and fuel residues toward their properties and the El Rastro stream. The Chamber found that the environmental complaint, filed on 7 April 2026, had remained unattended for months. Only after the amparo was filed did the authorities conduct an on-site inspection, order an immediate halt to washing concrete mixers, issue an administrative order concerning wastewater discharges, and refer the matter to the Área Rectora de Salud Siquirres to verify the wastewater treatment system and sanitary operating permit. Although those later measures addressed the reported situation, the authorities did not establish that they had properly informed the amparo applicant of the actions taken. The Chamber held that the earlier inaction was incompatible with the administrative principles of effectiveness, continuity, and coordination and ordered a formal response within three days.",

"body_en_text": "036607-26. ALLEGES THAT HE REPORTED TO MINAE A COMPANY OPERATING WITHOUT ENVIRONMENTAL MITIGATION MEASURES FOR CHEMICAL POLLUTION, WHICH AFFECTS BOTH THE AMPARO APPLICANT AND A NEARBY STREAM. GRANTED. THE MINISTER AND THE DIRECTORATE OF WATER, BOTH OF THE MINISTRY OF ENVIRONMENT AND ENERGY, ARE ORDERED TO ISSUE THE APPROPRIATE ORDERS AND CARRY OUT ALL ACTIONS WITHIN THE SCOPE OF THEIR RESPECTIVE AUTHORITY SO THAT, WITHIN A MAXIMUM PERIOD OF THREE DAYS FROM NOTICE OF THIS JUDGMENT, THEY FORMALLY INFORM THE APPLICANT OF THE ACTIONS TAKEN TO ADDRESS THE ENVIRONMENTAL COMPLAINT FILED ON 7 APRIL 2026. RGS09/2026\n\n“(…) The applicants allege that they own two properties located in [Nombre 009], which adjoin a property occupied by the company [Nombre 008] (CHEC) de Costa Rica. They allege that the company operates at that facility without adequate environmental mitigation measures. Whenever rainfall occurs in the area, runoff water (aguas de escorrentía) carries pollutants from the CHEC facility onto their properties and into a stream named El Rastro, causing large volumes of water to become seriously contaminated with asphalt, cement, and fuel residues. They assert that this situation causes severe and ongoing ecological damage to the stream, disrupts the local aquatic ecosystem, and exposes their family and surroundings to chemical pollution that is extremely hazardous to public health. (…)”\n\n“(…) That being the case, the record shows that—following the filing of this amparo proceeding—the respondent authorities conducted an on-site inspection, ordered the immediate suspension of the washing of concrete mixers, issued an administrative order concerning wastewater discharges, and referred the case to the Área Rectora de Salud Siquirres so that it could verify and inspect the existence and validity of the Wastewater Treatment System and the Sanitary Operating Permit.\n\nConsequently, it has been established that the applicant’s complaint concerns a problem reported months earlier, involving environmental matters that had not been addressed—an omission incompatible with the principles of administrative effectiveness, continuity, and coordination. Although the reported situation was addressed following the filing of the amparo, it has not been established that the applicant was duly informed of the actions taken, despite having reported the problem on 7 April 2026.\n\nTherefore, the application is granted, as set forth in the operative portion of this judgment.
