"summary_en": "The Constitutional Chamber (Sala Constitucional) granted an amparo application filed by a person who had complained to the Ministry of Environment and Energy (MINAE) about a company allegedly operating without measures to mitigate chemical pollution, affecting both the applicant and a nearby stream. The Chamber ordered the Minister and the Director of Water, both of MINAE, to issue the appropriate instructions and undertake, within their respective powers, every action necessary to address the environmental complaint filed on 7 April 2026. They were also required to formally inform the amparo applicant, within no more than three days after notification of the judgment, of the actions taken. In a separate note, Justice Castillo Víquez reiterated his view that, except for legal-constitutional disputes recognized by the Chamber itself as exceptional amparo matters, claims concerning prompt and effective administrative justice belong before the administrative-litigation jurisdiction, notwithstanding Law No. 9097's provision allowing judicial protection of the right of petition through amparo.",

RGS09/2026\n\n“(…) Note by Justice Castillo Víquez concerning prompt and effective administrative justice. I have supported this Court’s position that, when a person seeking judicial relief alleges a violation of the right to prompt and effective justice in administrative proceedings, the Administrative-Litigation Courts, and not this Chamber, must hear the legal dispute. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right may receive judicial protection through the amparo proceeding provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in cases where the petitioner considers that the Administration’s material conduct, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to alter its line of precedent, because, pursuant to section 7 of its Law, this Court alone has authority to define its own jurisdiction. Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances and that may properly be heard within this jurisdiction through the constitutional guarantee afforded by amparo proceedings, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 at 8:55 a.m. on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution (values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
