"summary_en": "The Constitutional Chamber (Sala Constitucional) partially granted the amparo application filed by residents of Playa Negra de Talamanca. It found the Mayor’s Office response to persistent stormwater drainage problems and deteriorated roads insufficient; those problems had been reported since September 2021 and April 2022, respectively. Although the Municipality arranged limited channel-cleaning work through the Comisión Nacional de Emergencias, those measures did not establish that an integrated, effective, and definitive solution had been adopted. The Chamber treated as uncontested the grievances that the Mayor’s Office had not disputed on their substance and concluded that the prolonged municipal omission violated the fundamental rights of the protected persons. It ordered the mayor, within the scope of his authority, to undertake all necessary measures to resolve both problems within nine months of notification. The amparo was denied as to the other challenged authorities, while the Municipal Council was reminded of its duty to ensure that the complaint filed on 2 September 2026 is addressed within a reasonable period.",

PARCIALMENTE CON LUGAR, ÚNICAMENTE, RESPECTO\nA LA OMISIÓN DEL ALCALDE DE TALAMANCA DE ATENDER DOS PROBLEMÁTICAS DENUNCIADAS\nPOR LOS RECURRENTES RELACIONADAS CON LA EVACUACIÓN DE AGUAS PLUVIALES Y EL MAL\nESTADO DE LOS CAMINOS EN LA ZONA DE PLAYA NEGRA DE TALAMANCA. SE LE ORDENA AL\nALCALDE DE TALAMANCA, QUE GIRE LAS ÓRDENES PERTINENTES Y LLEVE A CABO TODAS LAS\nACTUACIONES QUE ESTÉN DENTRO DEL ÁMBITO DE SUS COMPETENCIAS PARA QUE, DENTRO\nDEL PLAZO MÁXIMO DE NUEVE MESES, CONTADO A PARTIR DE LA NOTIFICACIÓN DE LA\nPRESENTE SENTENCIA, SE ATIENDAN Y RESUELVAN, DE MANERA DEFINITIVA, LOS\nPROBLEMAS RELACIONADOS CON LA EVACUACIÓN DE AGUAS PLUVIALES Y EL ESTADO DE LOS\nCAMINOS EN LA ZONA DE PLAYA NEGRA DE TALAMANCA. RGS09/2026\n\n“(…)
"body_en_text": "036730-26. RESIDENTS OF PLAYA NEGRA DE TALAMANCA ALLEGE PROBLEMS WITH STORMWATER DRAINAGE, ROAD DETERIORATION, AND THE DANGEROUS CONDITION OF TREES. PARTIALLY GRANTED, SOLELY WITH RESPECT TO THE FAILURE OF THE MAYOR OF TALAMANCA TO ADDRESS TWO PROBLEMS REPORTED BY THE AMPARO APPLICANTS CONCERNING STORMWATER DRAINAGE AND THE POOR CONDITION OF THE ROADS IN THE PLAYA NEGRA DE TALAMANCA AREA. THE MAYOR OF TALAMANCA IS ORDERED TO ISSUE THE APPROPRIATE INSTRUCTIONS AND TAKE ALL ACTIONS WITHIN THE SCOPE OF HIS AUTHORITY SO THAT, WITHIN A MAXIMUM PERIOD OF NINE MONTHS FROM NOTIFICATION OF THIS JUDGMENT, THE PROBLEMS CONCERNING STORMWATER DRAINAGE AND THE CONDITION OF THE ROADS IN THE PLAYA NEGRA DE TALAMANCA AREA ARE ADDRESSED AND DEFINITIVELY RESOLVED. RGS09/2026\n\n“(…) The amparo applicants, residents of Playa Negra de Talamanca, contend that the respondent authorities have failed to address problems reported for several years concerning stormwater drainage, road deterioration, and the dangerous condition of trees. (…)”\n\n“(…) … this Chamber finds that the conduct of the respondent Mayor’s Office demonstrates an insufficient response to problems that were duly reported by the residents and whose persistence has been established in the case record. Although the record shows that the Municipality arranged for the CNE to perform certain specific channel-cleaning work in the area, it is also true that those actions do not establish the adoption of a comprehensive and effective solution aimed at correcting the reported problems concerning stormwater drainage or road deterioration. Indeed, the evidence submitted supports the conclusion that these problems continue to affect the community several years after the initial reports were filed.\n\nConsequently, taking into consideration that the reports concerning stormwater drainage were filed beginning in September 2021 and those concerning the condition of the roads beginning in April 2022; that, by the date this amparo proceeding was filed, an excessive period had elapsed without proof of a definitive solution to those problems; that the Mayor’s Office did not contest the substance of those grievances, which must therefore be deemed undisputed facts; and that the reported conditions continue to affect the residents of Playa Negra, this Chamber concludes that the municipal omission violates the fundamental rights of the persons protected by the amparo (tutelados) and warrants granting the amparo in this respect.\n\nAccordingly, the Mayor of Talamanca must be ordered to adopt, within the scope of his authority, all measures necessary to address and definitively resolve the problems concerning stormwater drainage and the poor condition of the roads in the community of Playa Negra, within the period to be specified in the operative portion of this judgment. (…)”\n\n“(…) … the record shows that an intervention by the Comisión Nacional de Emergencias was carried out in 2025 in response to a specific request made by the Municipalidad de Talamanca itself, consisting of removing sedimented material and debris from the channel, for a total of sixty hours of actual work.\n\nIn that regard, the applicants must be advised that this Constitutional Chamber (Sala Constitucional) is not a body responsible for processing complaints; this criterion has been upheld in extensive case law (see, among others, Sentencia No. 2018-3787 at 09:15 hrs. on 6 March 2018 and Sentencia No. 2022-26246 at 09:45 hrs. on 4 November 2022).\n\nIn view of the foregoing, because it has been ruled out that the aforementioned authorities engaged in any arbitrary act or omission to the detriment of the applicants’ fundamental rights, the application must be denied as to those authorities. However, as regards the Concejo Municipal, it must be advised that it has a duty to take the appropriate steps to ensure that the complaint filed on 2 September 2026 is addressed within a reasonable period.
