"summary_en": "The Constitutional Chamber (Sala Constitucional) partially granted the amparo application because the response to illegal street races and clandestine nighttime vehicle competitions on National Route No. 27, near PriceSmart in Santa Ana, was insufficient. It reiterated that noise pollution is a form of environmental pollution capable of violating the fundamental rights to health, tranquility, privacy, a healthy and ecologically balanced environment, and peaceful enjoyment of one’s surroundings. Although the Ministry of Public Works and Transportation and the Fuerza Pública had conducted monitoring, patrols, controls, and coordination, the Chamber found that those actions had not produced a real and effective solution and therefore amounted to insufficient protection. It ordered both institutions to coordinate the adoption and implementation, within three months after notification, of a comprehensive, effective, and verifiable plan, each acting within its legal authority. The amparo was denied as to the Municipalidad de Santa Ana and the Ministry of Health because no constitutionally blameworthy omission was established.",

SE DECLARA CON LUGAR EL\nRECURSO, ÚNICAMENTE CONTRA EL MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES Y LA\nFUERZA PÚBLICA. EN CONSECUENCIA, SE ORDENA AL MINISTRO DE OBRAS PÚBLICAS Y\nTRANSPORTES Y AL DIRECTOR GENERAL A.I. DE LA FUERZA PÚBLICA, QUE GESTIONEN LO\nNECESARIO, DENTRO DEL ÁMBITO DE SUS COMPETENCIAS, PARA QUE, DE FORMA COORDINADA\nENTRE AMBAS INSTITUCIONES, DENTRO DEL PLAZO DE TRES MESES, CONTADOS A PARTIR DE\nLA NOTIFICACIÓN DE ESTA SENTENCIA, SE ADOPTE E IMPLEMENTE UN PLAN INTEGRAL,\nEFECTIVO Y VERIFICABLE DE ATENCIÓN DE LA CONTAMINACIÓN SÓNICA GENERADA POR LAS\nCARRERAS ILEGALES DE VEHÍCULOS EN LA RUTA NACIONAL N° 27, ESPECÍFICAMENTE EN\nLAS INMEDIACIONES DE PRICESMART, ADOPTANDO LAS MEDIDAS DE FISCALIZACIÓN,\nCONTROL Y COORDINACIÓN INSTITUCIONAL QUE RESULTEN NECESARIAS PARA GARANTIZAR\nUNA SOLUCIÓN EFECTIVA A LA PROBLEMÁTICA DENUNCIADA. RGS09/2026\n\n“(…) "body_en_text": "036731-26. THEY ALLEGE THAT THEY ARE RESIDENTS OF SANTA ANA AND THAT ILLEGAL STREET RACES (PIQUES ILEGALES) ARE REPEATEDLY HELD AT NIGHT ON ROUTE 27, ENDANGERING THE SURROUNDING POPULATION. THE APPLICATION IS GRANTED SOLELY AGAINST THE MINISTRY OF PUBLIC WORKS AND TRANSPORTATION AND THE FUERZA PÚBLICA. CONSEQUENTLY, THE MINISTER OF PUBLIC WORKS AND TRANSPORTATION AND THE ACTING DIRECTOR GENERAL OF THE FUERZA PÚBLICA ARE ORDERED, WITHIN THE SCOPE OF THEIR AUTHORITY, TO MAKE THE NECESSARY ARRANGEMENTS SO THAT, THROUGH COORDINATED ACTION BETWEEN BOTH INSTITUTIONS AND WITHIN THREE MONTHS OF SERVICE OF THIS JUDGMENT, A COMPREHENSIVE, EFFECTIVE, AND VERIFIABLE PLAN IS ADOPTED AND IMPLEMENTED TO ADDRESS THE NOISE POLLUTION GENERATED BY ILLEGAL VEHICLE RACING ON NATIONAL ROUTE N° 27, SPECIFICALLY IN THE VICINITY OF PRICESMART, INCLUDING SUCH OVERSIGHT, CONTROL, AND INTER-AGENCY COORDINATION MEASURES AS MAY BE NECESSARY TO ENSURE AN EFFECTIVE SOLUTION TO THE REPORTED PROBLEM. RGS09/2026\n\n“(…) The amparo applicant states that illegal street races and clandestine vehicle competitions are repeatedly and openly held at night in the community of Santa Ana, along National Route N° 27. (…)” … “(…) She recounts that these activities generate excessive and persistent noise pollution, seriously disrupting the peace, rest, and physical and mental health of the population, including older adults, children, and persons with preexisting health conditions. (…)”\n\n“(…) First, it bears recalling that this Chamber has repeatedly held that noise pollution constitutes a form of environmental pollution capable of directly affecting various fundamental rights, including the rights to health, peace and quiet, privacy, a healthy and ecologically balanced environment, and, in general, the peaceful enjoyment of the surroundings in which people live. (…)” … “(…) This Chamber has likewise recognized that noise pollution is not merely a subjective annoyance, but a form of environmental harm with real consequences for the physical and mental health of those who experience it. Public authorities therefore have a duty to take effective, coordinated, and sufficient action to prevent, control, and eradicate it when it has been fully established. (…)”\n\n“(…) This Chamber observes that the actions taken by MOPT have remained primarily at the follow-up, monitoring, and occasional-control stage, without evidence that comprehensive, permanent, and effective measures have been adopted to eradicate the source of the reported pollution. In this regard, the Fuerza Pública, for its part, has argued that the possible existence and persistence of the problem does not mean that the Fuerza Pública has failed to take police action. On the contrary, objective evidence demonstrates preventive planning, police presence, patrols, responses to reports, and inter-agency coordination, and that the Fuerza Pública will continue its efforts to address the situation within the scope of its authority and will maintain coordination with the Policía Municipal, Policía de Tránsito, and other competent authorities. When there are gatherings of vehicles, possible illegal street races, or other conduct that may pose a risk to persons or disturb public order, the Fuerza Pública may take preventive action and undertake the necessary inter-agency coordination. Nevertheless, consideration must be given to the legal limits on the Fuerza Pública’s authority to impose penalties relating to the regulation of vehicle traffic for certain traffic violations, such as speeding.\n\nIt must be emphasized that the constitutional obligation of the competent authorities is not satisfied merely by conducting periodic visits, sporadic controls, or preparatory actions. On the contrary, when the persistence of environmental harm affecting the peace and health of members of the public has been established, sufficient action must be taken to achieve a real and effective solution to the problem. In this case, the continuation of the illegal races and the noise associated with them demonstrates that the measures implemented thus far have failed to achieve that objective. This Chamber therefore considers that, although it cannot be said that there has been complete administrative inaction, the response to the reported problem has nonetheless been insufficient, thereby perpetuating the infringement of the fundamental rights of persons residing in the area. (…)”\n\n“(…) Consequently, the appropriate course is to grant the amparo proceeding in part, solely as against the Ministry of Public Works and Transportation and the Fuerza Pública, so that those institutions adopt and implement a comprehensive, effective, and verifiable plan to address the noise pollution generated by illegal vehicle racing on National Route N° 27, specifically in the vicinity of PriceSmart. Each institution shall act within the limits of its authority and adopt such oversight, control, and inter-agency coordination measures as may be necessary to ensure an effective solution to the reported problem. As regards the Municipalidad de Santa Ana and the Ministry of Health, the application must be denied because it has been established that they acted within the scope of their authority and that no constitutionally objectionable omission is attributable to those entities.
