"summary_en": "The Constitutional Chamber (Sala Constitucional) granted the amparo proceeding only against the Ministerio de Obras Públicas y Transportes and the Fuerza Pública in response to recurrent nighttime illegal street races on National Route No. 27 near PriceSmart, which endanger nearby Santa Ana residents and generate noise pollution. It ordered the Minister of Public Works and Transportation and the acting Director General of the Fuerza Pública, within their respective powers and in coordination with each other, to arrange for the adoption and implementation of a comprehensive, effective, and verifiable plan addressing that pollution. The plan must be implemented within three months after notice of the judgment and include the necessary enforcement, control, and interinstitutional coordination measures to achieve an effective solution. In a separate note, Justice Castillo Víquez reiterated his view that disputes concerning prompt and effective administrative justice generally belong before the administrative-litigation jurisdiction, except for constitutional disputes that the Chamber itself has recognized as proper subjects of amparo.",

RGS09/2026\n\n“(…) NOTA DEL MAGISTRADO\nCASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y\nCUMPLIDA. "body_en_text": "036731-26. THEY ALLEGE THAT THEY ARE RESIDENTS OF SANTA ANA AND THAT ILLEGAL STREET RACES ARE REPEATEDLY HELD AT NIGHT ON ROUTE 27, ENDANGERING THE SURROUNDING POPULATION. THE AMPARO APPLICATION IS GRANTED SOLELY AGAINST THE MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES AND THE FUERZA PÚBLICA. CONSEQUENTLY, THE MINISTER OF OBRAS PÚBLICAS Y TRANSPORTES AND THE ACTING DIRECTOR GENERAL OF THE FUERZA PÚBLICA ARE ORDERED TO TAKE THE NECESSARY STEPS, WITHIN THE SCOPE OF THEIR AUTHORITY, SO THAT, THROUGH COORDINATION BETWEEN BOTH INSTITUTIONS, WITHIN THREE MONTHS OF SERVICE OF THIS JUDGMENT, THEY ADOPT AND IMPLEMENT A COMPREHENSIVE, EFFECTIVE, AND VERIFIABLE PLAN TO ADDRESS THE NOISE POLLUTION CAUSED BY ILLEGAL VEHICLE RACES ON NATIONAL ROUTE N° 27, SPECIFICALLY IN THE VICINITY OF PRICESMART, ADOPTING SUCH OVERSIGHT, CONTROL, AND INTER-INSTITUTIONAL COORDINATION MEASURES AS MAY BE NECESSARY TO ENSURE AN EFFECTIVE SOLUTION TO THE PROBLEM REPORTED. RGS09/2026\n\n“(…) NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND EFFECTIVE ADMINISTRATIVE JUSTICE. I have supported this Court’s position that, when a person seeking judicial relief alleges a violation of the right to prompt and effective justice in administrative proceedings, jurisdiction over the legal dispute lies with the Administrative-Litigation Courts, rather than with this Chamber. However, with the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is eligible for judicial protection through the amparo proceeding provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in those cases in which the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not mean that this Court must alter its line of precedent, since, pursuant to Article 7 of its Law, this Court has exclusive authority to define its own jurisdiction. Accordingly, except for those legal-constitutional disputes that this Constitutional Chamber (Sala Constitucional) itself has recognized as exceptional circumstances that may properly be heard within this jurisdiction through the amparo constitutional guarantee proceeding, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 at 8:55 a.m. on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction (jurisdicción de lo contencioso-administrativo). All of this is consistent with Article 25 of the Convención Americana sobre Derechos Humanos, constitutional law (its values, principles, and rules), and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
