"summary_en": "The Constitutional Chamber (Sala Constitucional) partially granted the amparo proceeding because of delays by the Tribunal Ambiental Administrativo in processing and deciding complaints concerning alleged harm to natural resources and activities subject to environmental oversight. It held that the claim was not governed by the ten-day deadline applicable to the right of petition because the matters required investigation, evidence, and, where appropriate, adversarial proceedings. The controlling standard was the right to prompt and effective justice under Article 41 of the Constitution, read together with the environmental protection guaranteed by Article 50. The Chamber did not determine whether environmental damage occurred, whether the reported persons were liable, or whether any activity required environmental feasibility approval. It ordered immediate action in files 019-25-01-TAA, 262-24-01-TAA, and 171-25-03-TAA, with final decisions within six months. For file 243-04-02-TAA, it ordered that the hearing occur no later than 5 November 2026 and that a final decision be issued within the following two months. It also granted relief regarding file 066-22-03-TAA to the extent provided by Article 52 of the Ley de la Jurisdicción Constitucional.",

ACUSA QUE EL TRIBUNAL\nAMBIENTAL ADMINISTRATIVO MANTIENE SIN RESOLUCIÓN VARIOS EXPEDIENTES RELATIVOS A\nDENUNCIAS POR SUPUESTAS AFECTACIONES A RECURSOS NATURALES Y ACTIVIDADES\nSOMETIDAS A CONTROL AMBIENTAL. SE DECLARA PARCIALMENTE CON LUGAR EL RECURSO. SE\nORDENA A LA PRESIDENTA DEL TRIBUNAL AMBIENTAL ADMINISTRATIVO, Y LA\nVICEPRESIDENTA Y ENCARGADA DEL GRUPO 03, AMBAS DEL TRIBUNAL AMBIENTAL\nADMINISTRATIVO, QUE GIREN LAS ÓRDENES PERTINENTES, PROMUEVAN LOS ACUERDOS\nNECESARIOS Y LLEVEN A CABO LAS ACTUACIONES COMPRENDIDAS DENTRO DE SUS\nCOMPETENCIAS PARA QUE, DE FORMA INMEDIATA, SE IMPULSE LA TRAMITACIÓN DE LOS\nEXPEDIENTES 019-25-01-TAA, 262-24-01-TAA Y 171-25-03-TAA, SE PROCURE MEDIANTE\nCOORDINACIÓN Y SEGUIMIENTO EFECTIVO LA OBTENCIÓN DE LOS INFORMES PENDIENTES Y\nSE DICTE Y COMUNIQUE LA RESOLUCIÓN DEFINITIVA QUE EN DERECHO CORRESPONDA EN\nCADA UNO DE ELLOS, DENTRO DEL PLAZO DE SEIS MESES, CONTADO A PARTIR DE LA\nNOTIFICACIÓN DE ESTA SENTENCIA. EN CUANTO AL EXPEDIENTE 243-04-02-TAA, DEBERÁN\nREALIZARSE LAS ACTUACIONES DENTRO DE SUS COMPETENCIAS PARA QUE LA AUDIENCIA\nAGENDADA SE CELEBRE EL 5 DE NOVIEMBRE DE 2026, SI NO SE HUBIERE CELEBRADO\nANTES, Y SE DICTE Y COMUNIQUE LA RESOLUCIÓN DEFINITIVA DENTRO DEL PLAZO DE DOS\nMESES, CONTADO A PARTIR DE LA CELEBRACIÓN DE DICHA AUDIENCIA. RGS09/2026\n\n“(…) "body_en_text": "036732-26. THE APPLICANT ALLEGES THAT THE TRIBUNAL\nAMBIENTAL ADMINISTRATIVO HAS LEFT SEVERAL CASE FILES CONCERNING\nCOMPLAINTS OF ALLEGED HARM TO NATURAL RESOURCES AND ACTIVITIES\nSUBJECT TO ENVIRONMENTAL OVERSIGHT UNRESOLVED. THE AMPARO APPLICATION IS\nPARTIALLY GRANTED. THE PRESIDENT OF THE TRIBUNAL AMBIENTAL ADMINISTRATIVO,\nAND THE VICE PRESIDENT AND HEAD OF GROUP 03, BOTH OF THE TRIBUNAL AMBIENTAL\nADMINISTRATIVO, ARE ORDERED TO ISSUE THE APPROPRIATE INSTRUCTIONS, SECURE\nTHE NECESSARY AGREEMENTS, AND CARRY OUT THE ACTIONS WITHIN THEIR\nPOWERS SO THAT THE PROCESSING OF CASE FILES 019-25-01-TAA, 262-24-01-TAA,\nAND 171-25-03-TAA PROCEEDS IMMEDIATELY; THE OUTSTANDING REPORTS ARE\nOBTAINED THROUGH EFFECTIVE COORDINATION AND FOLLOW-UP; AND THE LEGALLY\nAPPROPRIATE FINAL DECISION IN EACH CASE IS ISSUED AND COMMUNICATED\nWITHIN SIX MONTHS FROM NOTICE OF THIS JUDGMENT. WITH RESPECT TO CASE FILE\n243-04-02-TAA, THEY SHALL TAKE THE ACTIONS WITHIN THEIR POWERS SO THAT\nTHE SCHEDULED HEARING IS HELD ON 5 NOVEMBER 2026, UNLESS IT HAS BEEN HELD\nEARLIER, AND THE FINAL DECISION IS ISSUED AND COMMUNICATED WITHIN TWO\nMONTHS FROM THE DATE OF THAT HEARING. RGS09/2026\n\n“(…) The amparo applicant alleges that the\nTribunal Ambiental Administrativo has left case files 019-25-01-TAA,\n066-22-03-TAA, 262-24-01-TAA, 171-25-03-TAA, 172-25-01-TAA,\n222-14-03-TAA, and 243-04-02-TAA, concerning complaints of alleged harm\nto natural resources and activities subject to environmental oversight,\nwithout a final decision… (…)”\n\n“(…) The relief sought does not consist of\nobtaining preexisting information or a response to a straightforward request.\nThe applicant seeks the completion of investigations that require the taking\nof evidence and, where appropriate, adversarial proceedings. Therefore, the\nprincipal standard is Article 41 of the Constitution, in conjunction with\nArticle 50, rather than the ten-day period governing the right of petition\nunder Article 32 of the Ley de la Jurisdicción Constitucional. The\nenvironmental dimension of the claim prevents its reduction to an ordinary\ndispute over administrative deadlines: the delay may undermine the\neffectiveness of the protection of natural resources.\n\nThe constitutional analysis is\nlimited to determining whether the authority processed and resolved the\ncomplaints within a reasonable period. It is not appropriate here to determine\nthe liability of the persons against whom the complaints were filed, declare\nthat environmental damage exists, or decide whether each activity required\nenvironmental approval (viabilidad ambiental). Those matters must be\ndetermined in the competent proceedings, with due respect for the right of\ndefense. (…)”\n\n“(…) The references to\namparo proceedings N° 25-010935-0007-CO and N° 25-027496-0007-CO are\nnot, by themselves, sufficient to establish that their subject matter is\nidentical to the entirety of the delay examined here. The analysis of this\nissue concerns the prolongation of the investigations reflected in the current\nreports, particularly the periods following the steps taken in November and\nDecember 2025; it does not review what was decided in those proceedings.\n\nAccordingly, the amparo application\nmust be granted on these three issues. The Tribunal must take the necessary\nsteps to advance and coordinate the proceedings, complete the investigation,\nand issue and communicate the legally appropriate decision within a maximum\nperiod of six months. This period reflects the need to obtain specialized\ninput and, where appropriate, bring charges and hold a hearing. Preparatory\nsteps must begin immediately and may not be deferred until that period\nexpires. (…)”\n\n“(…) The supervening nullity\ndeclared in September 2026 and the new statement of charges constitute acts\nadvancing the case file. They are not equivalent to the issuance of a final\ndecision and do not eliminate the delay that had already occurred. The duty to\npreserve the validity of the proceeding must be fulfilled in a timely manner;\notherwise, each procedural correction would operate as a new starting point\nthat would make it impossible to review the duration of the administrative\naction.\n\nNor does the date on which the\napplicant joined the proceeding alter the length of time for which a complaint\nrelated to environmental protection has remained unresolved. The protected\ninterest extends beyond his individual position as an intervening supporting\nparty (coadyuvante). The violation arises from the absence of a timely\nadministrative determination, and establishing that violation does not require\nthe alleged harm attributed to the persons against whom the complaints were\nfiled to be treated as proven.\n\nConsequently, this issue must be\ngranted, and the hearing scheduled for 5 November 2026 must be held, unless it\nhas been held earlier, and the final decision must be issued and communicated\nwithin one month following the hearing, with due respect for due process. The\nnew hearing notice does not, by itself, satisfy the object of the amparo\napplication; therefore, there has not been a complete cessation of the conduct\nthat would make Article 52 of the Ley de la Jurisdicción Constitucional\napplicable. (…)”\n\n“(…) The amparo application must be\npartially granted because of the delays established in case files\n019-25-01-TAA, 262-24-01-TAA, 171-25-03-TAA, and 243-04-02-TAA,\nas well as with respect to 066-22-03-TAA to the extent provided in Article\n52 of the Ley de la Jurisdicción Constitucional. The orders are directed to\nthose who exercise responsibility for presiding over and managing the matters,\nso that they act within the scope of their powers and secure any necessary\nagreements of the collegial body. The ruling granting relief concerns the duty\nto process and resolve the matters in a timely manner. It does not require the\ncomplaints to be upheld, a particular sanction to be imposed, or indispensable\nevidence to be dispensed with. (…)”"
