"summary_en": "The Constitutional Chamber (Sala Constitucional) granted the amparo application because the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) had taken a disproportionately long time to decide a request for new drinking-water service. The applicant submitted the request on 22 May 2026, but when she filed the amparo, the installation had not occurred and no final decision had been issued. The text states that the file was scheduled for a feasibility inspection on 10 June 2025; that date is preserved exactly as it appears in the source. Only after the amparo proceeding began did ICAA require the protected person, through official letter UEN-SCMED-GAM-DyNS-2026-348 dated 9 September 2026, to provide a municipal construction permit matching the project. The Chamber found a violation of her fundamental rights and ordered the competent ICAA authorities to issue a final decision on the request and notify her within no more than one month after notice of the judgment.",

VCG10/2026\n\n“(…) "body_en_text": "036844-26. PUBLIC SERVICES. SHE ALLEGES THAT SHE REQUESTED A NEW DRINKING-WATER SERVICE FROM THE RESPONDENT; HOWEVER, THE CORRESPONDING INSTALLATION HAS NOT BEEN CARRIED OUT. THE AMPARO APPLICATION IS GRANTED. THE EXECUTIVE PRESIDENT AND THE HEAD OF THE GUADALUPE AGENCY, BOTH OF THE INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, ARE ORDERED TO COORDINATE AS APPROPRIATE, TAKE THE NECESSARY MEASURES, AND ISSUE THE CORRESPONDING ORDERS WITHIN THE SCOPE OF THEIR RESPECTIVE AUTHORITY SO THAT, WITHIN A MAXIMUM PERIOD OF ONE MONTH FROM NOTICE OF THIS JUDGMENT, A FINAL DECISION IS ISSUED ON THE REQUEST SUBMITTED BY THE AMPARO APPLICANT AND SHE IS DULY NOTIFIED. VCG10/2026\n\n“(…) V.- THE SPECIFIC CASE. In the case at hand, the amparo applicant alleges that, on 22 May 2026, she submitted an application for new drinking-water service to ICAA; however, as of the filing of the amparo application, the corresponding installation had not been carried out. She considers the time elapsed to be disproportionate.\n\nThe record establishes that, on 22 May 2026, the applicant submitted an application for new drinking-water service to ICAA. On 10 June 2025, the case file was scheduled for a feasibility inspection. The ICAA authorities were notified of the order admitting this proceeding on 8 and 14 September 2026. On 9 September 2026, ICAA notified the person whose rights are protected of official communication no. UEN-SCMED-GAM-DyNS-2026-348, issued on that same date, in which she was directed to “1-Submit the construction permit issued by the corresponding municipal authority, which must match the project for which the certificate of availability was requested (…)”.\n\nIn this regard, a violation of the fundamental rights of the person whose rights are protected is established, because the respondent authority has incurred a disproportionate delay in deciding the application for new drinking-water service submitted in May of this year.\n\nIndeed, it should be noted that it was only in connection with the processing of this amparo proceeding (more than three months after the request was submitted) that the applicant was directed to provide additional documentation; ultimately, however, there is no record that the respondent office issued a final decision on the application in question.\n\nAccordingly, the amparo application is granted on the terms stated in the operative portion of this decision.
