"summary_en": "The Constitutional Chamber (Sala Constitucional) granted an amparo proceeding filed on behalf of an older adult because the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) responded belatedly to a sewage overflow in front of her home in the Leyva Urcuyo residential development in Tibás. The affected person had reported the problem to ICAA on 28 May, 11 June, and 28 July 2026, and the Ministry of Health requested institutional intervention on 13 August 2026. Although ICAA initially maintained that the matter was outside its responsibility, it inspected the sewer network after receiving notice of the amparo and found two blockages that caused wastewater to emerge through the inspection box. The institute removed the blockages on 10 and 11 September and later confirmed that the system was operating normally. Because the problem was addressed only in connection with the proceeding, the Chamber granted the amparo under Article 52 of the Constitutional Jurisdiction Law, without a special award of costs, damages, or compensation.",

It should be noted that, in a communication dated 13 August 2026, the Ministry of Health requested ICAA's intervention because an inspection box was found to be full of water and fecal matter, a condition that, according to the complainant, had existed since May and had been reported to ICAA on 28 May, 11 June, and 28 July 2026. Despite this, the respondent institute replied that addressing the situation did not fall within its responsibility. However, after the respondent authority was notified of the order admitting the proceeding for consideration, ICAA inspected the location and found two blockages in the sanitary sewer network, which caused wastewater to emerge through the inspection box located in front of the protected person's home.\n\nThe Chamber determines that the facts alleged by the protected party were addressed as a result of this proceeding, because ICAA performed the relevant maintenance work in the affected area and removed the detected blockages only after it received notice of this amparo on 8 September 2026. CON LUGAR POR LA FALTA DE RESPUESTA OPORTUNA. VCG10/2026\n\n“(…) "body_en_text": "036882-26. ENVIRONMENT. OLDER ADULT ALLEGES THAT A SEWER INSPECTION CHAMBER COLLECTS RAW SEWAGE, OVERFLOWS, AND AFFECTS THE PIPES IN HER HOME. GRANTED DUE TO THE FAILURE TO PROVIDE A TIMELY RESPONSE. VCG10/2026\n\n“(…) III.- THE SPECIFIC CASE. After analyzing the evidence submitted by the parties and the reports provided under oath by the respondent authorities, it has been established that, through official letter CARTA-MS-DRRSCS-DARS-T-0677-2026 dated 13 August 2026, the Ministerio de Salud requested that the director of the ICAA’s UEN – Recolección y Tratamiento intervene regarding the apparent malfunction of the sewer system in a residential development in Tibás, because it had been confirmed that a sewer inspection chamber (caja de registro) was full of water and fecal matter. According to the complainant, this had been occurring since May, and she had brought it to the ICAA’s attention on 28 May, 11 June, and 28 July 2026. By memorandum DRyT-OMSR-2026-00475 dated 18 August 2026, the ICAA informed the Ministerio de Salud that the site had been inspected pursuant to service order no. 55056051, and it was found that wastewater was being unlawfully discharged into a manhole located in a public roadway. It also clarified that the pipes should not have been in use because they were not interconnected with the sanitary sewer network under its administration, and for that reason it considered that the Ministry was responsible for ensuring the proper disposal and treatment of the wastewater. On 22 August 2026, the person whose rights are protected (amparada) hired a company to unclog the sewer network, and the following was recorded: “An attempt was made to unclog it [desaqueo (sic)] toward the inside of the house, but this was unsuccessful because the network is obstructed from the sidewalk outward, toward the street.” On 10 September 2026, ICAA personnel conducted an inspection at Urbanización Leyva Urcuyo and found that the sanitary sewer network had two obstructions, which caused wastewater to flow out through the sewer inspection chamber located in front of the protected person’s home. On 10 and 11 September 2026, the respondent authority performed maintenance work in the affected area, thereby removing the obstructions that had previously been detected. On 14 September 2026, the ICAA inspected the affected site and determined that both the service connection (acometida) for the amparo applicant’s property and the sanitary sewer network were operating normally.\n\nAccordingly, the report submitted by the respondent authority and the evidence entered into the record confirm the amparo applicant’s allegations concerning the sanitary sewer system at Urbanización Leyva Urcuyo. It should be noted that, in a communication issued on 13 August 2026, the Ministerio de Salud requested the ICAA’s intervention because it had been confirmed that a sewer inspection chamber was full of water and fecal matter. According to the complainant, this had been occurring since May, and she had brought it to the ICAA’s attention on 28 May, 11 June, and 28 July 2026. Despite this, the respondent institute replied that addressing the situation did not fall within its authority. However, after the respondent authority was notified of the order admitting the proceeding, the ICAA inspected the site in question and found that the sanitary sewer network had two obstructions, which caused wastewater to flow out through the sewer inspection chamber located in front of the amparo applicant’s home.\n\nThe Chamber finds that the facts alleged by the protected party were addressed as a result of this proceeding, because it was only after notice of this amparo proceeding—8 September 2026—that the ICAA performed the corresponding maintenance work in the affected area and removed the obstructions that had been detected. In light of the foregoing, this amparo proceeding must be granted in accordance with Article 52 of the Ley de la Jurisdicción Constitucional, without a special award of costs, damages, or losses, as stated in the operative portion of this judgment and the reasons that follow.
