"summary_en": "The Constitutional Chamber (Sala Constitucional) granted the amparo application against the Municipalidad de Moravia for failing to provide adequate oversight of buildings within the Río Ipís protection area. It held that 1965 aerial photographs and evidence that some buildings may predate forestry legislation are relevant, but do not justify a general conclusion foreclosing all present-day environmental oversight. The principle against retroactive application of the law likewise does not relieve the municipality of its current powers and duties. It must individually examine each building’s age, construction status, current legal status, subsequent alterations, and possible environmental impacts, coordinating with other competent authorities when appropriate. The Chamber clarified that an amparo proceeding is not the proper avenue to order demolition directly or to negate acquired rights, because those determinations require the corresponding administrative procedures, with due process and the right of defense. It ordered the technical and legal assessment to be completed within six months and, if irregularities or impacts are found, the appropriate legal procedures to be initiated or pursued.",

VCG10/2026\n\n“(…) (…)”",
"body_en_text": "037620-26. ENVIRONMENT. MUNICIPALITY. PETITION. IT IS ALLEGED THAT THE MUNICIPALIDAD DE MORAVIA FAILED TO ADOPT MEASURES TO PROTECT THE PROTECTION AREA (ÁREA DE PROTECCIÓN) OF THE RÍO IPÍS, DESPITE HAVING ACKNOWLEDGED THE EXISTENCE OF BUILDINGS WITHIN THAT AREA. IT IS CONSIDERED THAT THE AGE OF THE STRUCTURES AND THEIR EXISTENCE PRIOR TO THE FORESTRY LEGISLATION DO NOT EXEMPT THE ADMINISTRATION FROM CONDUCTING AN INDIVIDUALIZED ASSESSMENT OF THEIR LEGAL AND ENVIRONMENTAL STATUS, INCLUDING POSSIBLE SUBSEQUENT ALTERATIONS AND IMPACTS ON THE SURROUNDING ENVIRONMENT. THE AMPARO APPLICATION IS GRANTED, AND AN ORDER IS ISSUED TO CONDUCT, WITHIN SIX MONTHS, A TECHNICAL AND LEGAL ASSESSMENT OF THE BUILDINGS AND, IF IRREGULARITIES ARE DETECTED, TO INITIATE OR PROMOTE THE CORRESPONDING LEGAL PROCEEDINGS. VCG10/2026\n\n“(…) VI.- THE SPECIFIC CASE. In the matter under consideration, the amparo applicant complains that, despite requests submitted by residents of Moravia concerning structures located near the Río Ipís, and although the matter is fully known to the local authorities, the Municipalidad de Moravia has taken no action concerning the inspection, control, and sanctioning of the buildings located along the banks of that tributary. In this regard, based on the established facts and all the evidence in the record, it has been established that the respondent municipal corporation acknowledges the existence of buildings within the protection area of the Río Ipís and, for that purpose, even states that it obtained aerial photographs from the Instituto Geográfico Nacional corresponding to 1965 and concluded on the basis of those photographs that the structures predate the 1969 Ley Forestal. Based on that information, the municipal departments have considered it impossible to apply subsequent forestry regulations retroactively. Nevertheless, in this Court’s view, that response is insufficient in light of the content of Article 50 of the Constitution. Certainly, those 1965 photographs, as well as the various materials available to the municipality for establishing that buildings existed prior to the Ley Forestal, are relevant to determining the age of certain structures; however, it is also true that this does not exhaust the analysis that the Administration must conduct. Thus, the existence of structures predating the forestry legislation does not permit the conclusion, without an individualized investigation, that all works currently in existence are exactly the same as those observed in 1965; that they were not subsequently expanded or altered; that they have the corresponding titles and permits; or that their continued presence does not currently cause any impact requiring prevention, mitigation, or interinstitutional coordination measures. In this regard, it is pertinent to recall what this Court stated in Judgment N° 2025-035949 at 09:30 on 31 October 2025, which determined that the Municipalidad de Moravia had failed to properly address the requests initiated concerning the issue discussed here.\n\nIn their report, as previously indicated, the authorities of the respondent municipality attempt to justify their position by invoking the non-retroactivity of the law; however, in accordance with the statements in Reason V of this judgment, that principle does not relieve the Municipalidad of its present responsibilities. Thus, it must be borne in mind that determining that a specific building constitutes a consolidated legal situation that cannot be disregarded through the retroactive application of a subsequent rule is one thing, while asserting that this circumstance precludes all current environmental inspection is another. With sufficient technical and legal support, and in coordination with the competent national authorities when necessary, the Administration must determine the status of each structure and which measures are appropriate to protect the Río Ipís and its riverbank area. It must be clarified that it is not for this Chamber, in these summary proceedings, to order the demolition of the buildings at issue or itself declare that they lack acquired rights, because those matters require the conduct of the corresponding administrative proceedings, with respect for due process and the right of defense of any persons who may be affected. Nevertheless, what must be protected is the right of the amparo applicant and the community to have the municipal authority refrain from limiting itself to a general conclusion based exclusively on the presumption of rights acquired before the forestry law entered into force and instead effectively exercise its environmental investigation, inspection, and protection powers.\n\nGiven these circumstances, it is considered in this case that the Municipalidad de Moravia has not carried out the corresponding inspection, control, and sanctioning actions regarding the buildings constructed along the bank of the Río Ipís. This amparo proceeding must therefore be granted, ordering the Municipalidad, within a reasonable period, to conduct an individualized technical and legal assessment of the buildings located within the protection area of the Río Ipís in the reported sector; to determine, for each building, its age, current structural and legal status, any subsequent alterations, and the existence of environmental impacts; to coordinate with any authority having jurisdiction over matters exceeding its powers; and, if irregularities or impacts are verified, to initiate or promote the legally appropriate proceedings. All of this shall be done without prejudging the outcome of those proceedings or disregarding the guarantees arising from Articles 34 and 39 of the Constitución Política. (…)”"
