"summary_en": "The Constitutional Chamber (Sala Constitucional) reads Articles 21 and 50 of the Political Constitution together and recognizes that life, health, and the right to a healthy and ecologically balanced environment are closely connected. It explains that protecting life encompasses physical, mental, and environmental dimensions and therefore requires the protection of the environment and natural resources. In particular, the quality and quantity of water resources must be conserved to ensure drinking water for human consumption, hygiene, food, and hydration, because contamination can cause serious harm to public health. Through the bodies designated for that purpose, the State must adopt and enforce the measures necessary to guarantee access to this resource for everyone. The Chamber reiterates case law from 2007, 2021, and 2025 holding that the right to water may be protected through an amparo proceeding. The supplied excerpt contains neither the operative order nor the disposition of the specific amparo application.",

"body_en_text": "ARTICLES 21 AND 50 OF THE POLITICAL CONSTITUTION\n\n“(…) V.- ON THE RIGHT TO DRINKING WATER. The relationship between Articles 21 and 50 of the Political Constitution gives rise to the rights of persons to life, health, and a healthy and ecologically balanced environment. These rights are closely linked, since life, as the supreme value of the Political Constitution, entails special protection, because without life, the protection of all other fundamental rights would be of little use. Accordingly, life must be protected in all its dimensions, including physical, mental, and environmental well-being, and it is precisely here that the importance of protecting the environment and natural resources arises, in order to safeguard people’s well-being. That well-being is achieved, among other means, through the protection and preservation of the quality and quantity of water resources, so that the water is safe for human consumption, thereby protecting people’s health. Because water is a necessary resource for hygiene, food, and drinking, its contamination can cause serious harm to public health. In this regard, the State must provide the aforementioned protection and preservation through the bodies designated for that purpose, which must adopt the measures necessary to guarantee access to this resource for all persons and ensure compliance with those measures. In this context, the right to water arises, and this Constitutional Court may protect that right through an amparo proceeding (Judgment N° 2007-005482 issued at 14:39 on 24 April 2007, reiterated in Judgment N° 2021-005089 issued at 09:15 on 12 March 2021 and recently in Judgment N° 2025-002839 issued at 09:20 on 31 January 2025.
