"summary_en": "The Constitutional Chamber (Sala Constitucional) partially granted the amparo application filed by residents of Montealegre, San Rafael de Alajuela, because the Municipality of Alajuela responded inadequately to complaints concerning noise, dust, road deterioration, and pedestrian risks caused by heavy traffic associated with the Tajo Santa Marta quarry. The municipality directed the complainants to other municipal offices without transferring or comprehensively processing their complaint. It later acknowledged the road's lack of sidewalks, limited width, and dead-end configuration, but did not conduct the road-capacity studies and risk analysis needed to decide the underlying matter. The Chamber ordered the municipality, within two months, to carry out those studies, obtain the necessary municipal determinations, and issue a decision on the merits. It also ordered the local government to pay costs and damages. The amparo was dismissed or denied as to SETENA, MINAE, and the Ministry of Health because those authorities had addressed the complaints through decisions, inspections, and enforcement measures.",

"excerpt_en": "First, the Court observes that, in response to the applicants' initial complaint, the Environmental Management Subprocess of the respondent municipality merely informed them that matters concerning the operating hours of the reported quarry activity fell within the jurisdiction of that municipality's Business Licensing Area and Fiscal and Urban Control Process. There is no evidence that it forwarded the complaint to those offices so that the local government could properly consider and decide it. Accordingly, the respondent authority did not properly process the complaint, since that response did nothing to resolve the underlying situation brought to the municipality's attention.\n\nThus, more than one year after the initial complaint, this Chamber does not find it established that the respondent municipality coordinated, arranged, or carried out the necessary actions to produce the referenced technical studies, or that it secured the involvement of the other competent municipal offices so the matter could be addressed as required by law. Ultimately, it has not been shown that the respondent local government decided the applicants' complaints on the merits.\n\nConsequently, the amparo is granted as to this issue, on the terms stated in the operative portion of this ruling.",

LA SALA CONSTATA QUE LA MUNICIPALIDAD NO TRAMITÓ INTEGRALMENTE LAS DENUNCIAS NI REALIZÓ LOS ESTUDIOS NECESARIOS PARA RESOLVERLAS. SE DECLARA PARCIALMENTE CON LUGAR SOLO CONTRA LA MUNICIPALIDAD DE ALAJUELA Y SE ORDENA, EN DOS MESES, REALIZAR LOS ESTUDIOS, OBTENER LOS PRONUNCIAMIENTOS MUNICIPALES Y DICTAR UNA RESOLUCIÓN DE FONDO. SE CONDENA AL GOBIERNO LOCAL AL PAGO DE COSTAS, DAÑOS Y PERJUICIOS. VCG10/2026\n\n“(…) "body_en_text": "038596-26. MUNICIPALITY. RESIDENTS REPORT NOISE, DUST, AND RISKS FROM HEAVY TRAFFIC ASSOCIATED WITH A QUARRY ON A RESIDENTIAL STREET. THE CHAMBER FINDS THAT THE MUNICIPALITY NEITHER FULLY PROCESSED THE COMPLAINTS NOR CONDUCTED THE STUDIES NECESSARY TO RESOLVE THEM. THE APPLICATION IS PARTIALLY GRANTED SOLELY AGAINST THE MUNICIPALIDAD DE ALAJUELA, WHICH IS ORDERED, WITHIN TWO MONTHS, TO CONDUCT THE STUDIES, OBTAIN THE MUNICIPAL DETERMINATIONS, AND ISSUE A DECISION ON THE MERITS. THE LOCAL GOVERNMENT IS ORDERED TO PAY COSTS AND DAMAGES. VCG10/2026\n\n“(…) IV.- THE SPECIFIC CASE. In the matter at hand, the amparo applicants state that they are residents of barrio Montealegre, in San Rafael de Alajuela. They contend that the community’s main thoroughfare is a residential street without the structural capacity to support dump-truck or heavy-machinery traffic. They report that, for years, the respondent municipality has allowed the continuous passage of such trucks and machinery associated with the extractive project known as Tajo Santa Marta, operated by Granja Avícola Santa Marta S. A. They explain that this has occurred without prior technical studies concerning road capacity or the risk of urban impact. They assert that the local government itself has acknowledged the problem described, principally through official letter no. MA-SGV-0354-2026. They argue that heavy traffic even occurs at night, without any control by the authorities. They add that the street has deteriorated and that the necessary repairs to ensure safe travel through the area have not been performed. They indicate that the project’s environmental impact assessment (estudio de impacto ambiental) dates from 2006 and has not been updated to address population growth or changes in the surrounding area. They state that the MINAE authorities have failed to conduct actual field inspections, limiting themselves to receiving semiannual reports from the company itself; they likewise allege that the Ministerio de Salud has not conducted inspections either, despite complaints concerning noise, dust emissions, vibrations, and so forth. They allege that the circumstances described pose a risk to the community’s population.\n\nV.- First, with respect to Setena, it has been established that the Tajo Santa Marta project has environmental authorization granted by Setena through decision no. 1022-2006-SETENA of 30 May 2006. On 20 May 2025, Setena received a complaint from the applicants concerning heavy-vehicle traffic on the main street of barrio Montealegre. On 17 June 2025, Setena conducted an on-site inspection. Through decision no. 1023-2025-SETENA at 13:31 on 2 July 2025, the respondent authority ruled: “After analyzing the complaint, evidence submitted in response, case file, and inspection report, this department determines as follows: Analysis of Fact 1. The main street of Barrio Montealegre is a dead-end road used exclusively for residential purposes, built through the joint efforts of residents and with the support of the Municipalidad de Alajuela, without infrastructure or a design capable of supporting heavy traffic. Conclusion: The reported fact is rejected. The street is public and is not for exclusively residential use. Analysis of Fact 2. For nearly 10 years, this road has been frequently used by dump trucks and heavy machinery associated with Granja Santa Marta, which extracts materials along the bank of the Río Virilla. Conclusion: This point is provided for reference; as stated above, the street in question is a public street. It connects to Route 122, which was assessed in the EsIA as a possible route of ingress to and egress from the property where the AP is located. Analysis of Fact 3. The mining concession is under EXPEDIENTE MINERO N.º 2678, and the Environmental Impact Study was processed under EXPEDIENTE SETENA FEAP-0633-2004. Conclusion: Correct. According to the SETENA database, it is current in its obligation (sic) before this Secretariat. Analysis of Fact 4. This situation has caused serious adverse effects: - Environmental pollution (airborne dust, diesel fumes, and noise beginning at 4:00 a.m.). - Risk to pedestrian safety, including that of children and older adults, due to the absence of sidewalks. - Aggravation of chronic respiratory and allergic illnesses among the most vulnerable population. - Depreciation of residents’ residential property. Conclusion: Rejected. Points 1 and 3: The AOP is located more (sic) than 350 meters from the point where the complainants are located, and it is also situated in a canyon more (sic) than 15–20 meters deep; as indicated in the evidence submitted in response (see photograph 3 of the document filed under correspondence 05408-2025), the developer waters the ingress and egress road. With respect to truck emissions and noise, SETENA does not have jurisdiction to regulate whether the trucks that come to purchase or ‘Haul’ the material comply with the rules established for this matter. Point 2: While it is true that the road used for ingress to and egress from the Property is narrow, it apparently lacks an appropriate roadway design because it does not appear to be wide enough for two heavy vehicles to pass simultaneously, and it also lacks sidewalks on which pedestrians can travel safely. This issue must be taken up with the Municipalidad de Alajuela so that it can conduct the relevant studies and thereby ensure that the road has the elements necessary to provide safe passage for both persons and vehicles. Point 4. This is not a matter that SETENA can assess, nor are these issues required to be addressed in preparing the EsIA. Analysis of Fact 5. main road that could be used to enter the extraction site without affecting a residential area. According to information from residents, that road is located on property associated with the project’s shareholders, making the use of this community street as the principal heavy-traffic route even less justifiable. Conclusion: Rejected. While it is true that the property containing the AP is large and apparently fronts on a public street at more (sic) than one point, the ingress and egress route approved in the EsIA is the one currently (sic) in operation; it must also be taken into account that this route must likewise have been accepted by the Municipality when it granted the operating permits and municipal business licenses. Because it is a public cantonal street, the Municipality must rule on the matter, since one of the complaints (observed on the day of the Inspection with the residents) is that the public street appears to have sustained structural damage (alligator cracking, blowups, fatigue, etc.) because it was not designed for truck traffic. Analysis of Fact 6. Failure to comply with duties of transparency and participation under Decreto Ejecutivo Nº 43898-MINAE: Tajo Santa Marta has not complied with that decree, particularly Article 17, which requires a public hearing when significant environmental impacts are anticipated, as well as the conspicuous placement of an informational sign at the project site. No public hearing has ever been convened in Barrio Montealegre, nor has any visible sign been installed to provide information about the project’s nature, scope, or responsible parties. This omission prevents residents from exercising their right to participate and to obtain clear information about the activities conducted. Conclusion: Rejected. The complaint does not contain sufficient evidence demonstrating that the Socioeconomic study and its perception section were not conducted. It must be taken into account that the case file was approved approximately 19 years ago (Environmental Authorization (License) was granted through Decision No. 1022-2006-SETENA of 30 May 2006). THEREFORE. THE PLENARY COMMISSION RULES. At Ordinary Session Nº 035 of this Secretariat, held on 2 JULY 2025, under Article Nº. 022, it resolves: FIRST: To reject the complaint filed with SETENA on 20 May, for which the case (priv. 374), formal complaint regarding environmental risks, was assigned consecutive number 04690- 2025-intranet, dated 02 June 2025.” On 22 July, residents of the barrio Montealegre community filed an application for reconsideration (recurso de revocatoria), which was decided through decision no. 1573-2025-SETENA at 9:25 on 30 October 2025, stating: “The Application for Reconsideration filed by the appearing parties from Barrio Montealegre against the ruling set forth in Decision No. 1023-2025-SETENA of 2 July 2025 is Denied, and that decision remains unaltered.”\n\nAgainst this background, prima facie, no circumstances warranting the intervention of this constitutional jurisdiction with respect to that authority are found.\n\nIn this regard, the respondent addressed the complaint filed by the applicants, conducted the corresponding inspections, and issued the relevant decisions. Specifically, through the aforementioned decision no. 1023-2025-SETENA at 13:31 on 2 July 2025, the respondent authority considered and decided the petitioners’ claims on the merits. They were also able to challenge the decision, which was subsequently affirmed through decision 1573-2025-SETENA at 9:25 on 30 October 2025.\n\nIt should be noted, however, that this Chamber is not competent to review the merits of the determination made by the respondent authority or to decide specifically whether the complaint should or should not have been granted. Accordingly, if the applicants disagree with Setena’s rulings in the decisions at issue, they must bring the matter before the competent ordinary administrative or judicial bodies, where they may fully litigate its merits.\n\nTherefore, the application is denied with respect to this issue.\n\nVI.- With respect to the MINAE authorities, the case record establishes that, on 13 February 2026, the residents of barrio Montealegre filed a complaint with the Dirección de Geología y Minas of MINAE. Through decision no. 0102-2026 at 11:38 on 24 March 2026, the Dirección de Geología y Minas of MINAE stated: “In accordance with the foregoing clarification, mining concession N°2678 is currently in force and may therefore operate normally. As to the violations described, they have already been remedied; otherwise, a recommendation for cancellation would be appropriate, following which the minister would decide whether to grant a reasonable period for compliance or approve the cancellation. Moreover, a ‘preventive suspension’ must be based on qualifying grounds. Given the filing submitted without any evidence of risk to the environment, health, or safety, the DGM cannot impose such a measure. Upon review of the mining file, no conduct warranting intervention by the DGM was found, and the complainants have submitted no documentary evidence demonstrating any violation or harm. This does not relieve the concession holder of responsibility for complying with its obligations and mining regulations, nor does it relieve the DGM of its inspection and oversight duties. FOURTH: The complaint filed by the residents of Barrio Montealegre, San Rafael de Alajuela, must be rejected because the alleged facts were not established, since it was based on violations that clearly had been remedied. Nevertheless, based on the DGM’s inspection duty, the Departamento de Control Minero must be ordered to conduct a routine field inspection within no more than 30 business days. Furthermore, from a reading of the filing submitted, the alleged harm to the life, safety, and right to a healthy environment of that community cannot be understood, since the filing is based on a review of technical documents. THEREFORE. THE DIRECCIÓN DE GEOLOGÍA Y MINAS RULES FIRST: Based on the reasons stated in this decision, the complaint filed by the Residents of Barrio Montealegre, San Rafael de Alajuela, is rejected. The Departamento de Control Minero is also ordered to conduct a routine inspection of concession N°2678 within no more than 30 business days.” On 5 June 2026, the Departamento de Control Minero of MINAE conducted an on-site inspection; however, “no irregularities concerning the matter at issue were observed, and inspection and oversight activities were carried out regarding the project.” The MINAE authorities were served with the order initiating these proceedings on 29 July 2026.\n\nAccordingly, a priori, no omission susceptible to being declared in this summary amparo proceeding is found.\n\nIn this regard, it has been established that the complaint filed by the petitioners was addressed and decided by the respondent authority through determination no. 0102-2026 at 11:38 on 24 March 2026, issued by the Dirección de Geología y Minas, which explained that no irregularities or violations related to the reported activity had been found at that time. It is further noted that the Departamento de Control de Minas of the respondent ministry subsequently conducted an on-site inspection on 5 June 2026, with the following result: “no irregularities concerning the matter at issue were observed, and inspection and oversight activities were carried out regarding the project.”\n\nIt should likewise be noted that reviewing the merits of the determination made by the respondent authority in the decisions at issue exceeds this Chamber’s authority in these summary proceedings. Thus, if the applicants continue to disagree with those determinations, they must submit the relevant arguments to the competent ordinary bodies.\n\nTherefore, the application is denied with respect to this issue.\n\nVII.- As to the Área Rectora de Salud de Alajuela 2 of the Ministerio de Salud, it has been established that, on 15 May 2025, the applicants filed a complaint with the Área Rectora de Salud Alajuela 2 of the Ministerio de Salud concerning the activities of Tajo Santa Marta. On 11 August 2025, the Área Rectora de Salud Alajuela 2 issued health order no. MS-DRRSCN-DARSA2-OS-0227- 2025 to the establishment “Tajo Santa Marta.” That instrument stated: “(…) Compliance period: 30 business days following service (…) In response to health complaint N° 208-2025, concerning physical and sanitary matters such as the generation of dust and noise and safety conditions associated with the transportation and hauling of materials from Tajo Santa Marta, an inspection was conducted on 26 June by an official of the Área Rectora de Salud Alajuela 2 (…) this health order is issued, and the Tajo Santa Marta establishment is ordered to do the following: a) Submit and implement on site an updated Occupational Health Plan. b) Submit and implement on site an updated Emergency Response Plan. c) Submit and implement on site an updated Waste Management Plan (including certificates from the authorized waste managers retained). d) Submit in writing a dust-containment plan for material-transport vehicles and for risks on public and private roads. The plan must identify those responsible for ensuring compliance, include a log of operating hours, and ensure that the dump trucks’ covers are properly secured and in good working condition. e) Provide, submit, and implement a training procedure for internal and external drivers concerning awareness, use of engine brakes, the maximum permitted speed, the importance of complying with the dust-containment plan measures, schedules, and posting the rules in a visible location. f) Submit to the Ministerio de Salud, within no more than 10 business days, a corrective-action plan identifying the actions, deadlines, and responsible persons for each item.” In August and October 2025, the health authorities conducted inspections related to the health order issued. Through decision no. CARTA-MS-DRRSCN-DARSA2-099-2025 of 12 January 2026, the Área Rectora de Salud Alajuela 2 closed and archived the complaint because the items specified in the health order had been fulfilled. On 1 August 2026, in connection with this application, the respondent Área Rectora de Salud conducted an on-site inspection; however, the quarry was closed and no activity was recorded. On 3 August 2026, the health authority conducted another on-site inspection, recording that “from 09:50 a.m. to 12:00 noon, a maximum of 5 dump trucks entered and departed, all with their covers in place. Some covers fully cover the surface of the dump-truck bed, while others do not cover 100% of the bed; some are heavy-duty covers, while others are shade cloth that, if not properly secured, may allow material or dust to escape. The matter of covers is regulated by the Policía de Tránsito; however, it is unknown whether specific characteristics are required. The Quarry was subsequently visited (its sanitary operating permit was verified as current). Fernando Zeledón received the inspectors on site and stated that the gate is now kept closed to place greater pressure on external drivers to reduce their speed. He also stated that, as during the previous inspection, no vehicle is allowed to leave the quarry without its cover in place, and that it is difficult for them to control drivers once they leave the quarry property. He indicated that the issue of engine-brake use has improved and that some residents have informed him of this. He stated that the brochure setting out the rules drivers must follow continues to be distributed and that the signs requested by the Ministerio de Salud more than one year ago are posted in an accessible, clearly visible location: ‘use of a tarp is mandatory’ and the speed limit. The security guard at the entrance stated that he has seen drivers remove the tarp after leaving the quarry; the reason for this conduct is unknown. It was verified on site and with a resident that watering is performed with the water tanker to contain dust, as previously requested. This is normally done 2 to 4 times per day, at 6:30 a.m., 9:00 a.m., 1:00 p.m., and 3:00 p.m. The 10:00 a.m. water tanker was observed on the street from the quarry to the end of the street in Barrio Montealegre.”\n\nIn this regard, this Court likewise does not find that the respondent health authority failed to address the complaint filed by the applicants. It is observed that, in connection with the complaint at issue, the Área Rectora de Salud de Alajuela 2 issued health order no. MS-DRRSCN-DARSA2-OS-0227-2025 of 11 August 2025, requiring the reported quarry to comply with various measures to remedy problems related to dust generation, noise, and other safety matters.\n\nThe respondent authority subsequently conducted inspections to verify compliance with the order and issued decision no. CARTA-MS-DRRSCN-DARSA2-099-2025 of 12 January 2026 after confirming that the cited administrative act had been complied with. It should also be emphasized that additional inspections were conducted in connection with the processing of this application, and no new, evident instance of noncompliance can be inferred from them. Nor does the record contain any new express complaint filed by the applicants with the health authority regarding any particular matter. Accordingly, no inaction by the respondent authority in addressing the petitioners’ allegations can be established.\n\nAny disagreement with the health order issued or with the acts undertaken to verify compliance must be addressed before the competent ordinary administrative or judicial bodies, since such matters exceed the summary nature of this amparo proceeding.\n\nConsequently, the application is denied with respect to this particular issue.\n\nVIII.- Finally, with respect to the Municipalidad de Alajuela, the case record establishes that, on 15 May 2025, residents of barrio Montealegre filed a complaint with the respondent municipality concerning the problem of heavy traffic on that community’s main road. Through official letter no. MA-SGA-406-2025 of 26 May 2025, the Subproceso de Gestión Ambiental of the respondent municipality answered the applicants as follows: “(…) Operating hours and commercial licenses of establishments. To obtain information concerning the operating hours of commercial establishments in the community, you must contact the Área de Actividad de Patentes (…) Furthermore, if you wish to request a review of the current status of the business licenses and the establishments’ proper operation, a formal request must be submitted to the Proceso de Control Fiscal y Urbano (…).” On 21 January 2026, residents of barrio Montealegre filed a complaint with the respondent municipality concerning the problem of heavy traffic on that community’s main road. Through official letter no. MA-SGV-0354-2026 of 28 April 2026, the Subproceso de Gestión Vial of the respondent municipality answered the petitioners as follows: “(…) ROAD LIMITATIONS FOR HEAVY TRAFFIC. The road limitations that can be identified from a descriptive and objective perspective are as follows: • A roadway width that, in combination with vehicles on the road, may prevent two large vehicles from passing simultaneously at certain points. • Absence of sidewalks, requiring pedestrians and vehicular traffic to share the roadway directly. • Dead-end street configuration. Nevertheless, it is expressly clarified that: A technical determination of suitability, unsuitability, or a formal restriction concerning heavy traffic can be made only through properly prepared road-capacity studies and risk analyses, which are not currently contained in the case file. OBSERVED TRAFFIC. During the technical visit: No heavy-machinery traffic was observed at the time of the inspection, which indicates that the passage of this type of vehicle is not continuous. Based on the available information, the frequency of heavy-equipment traffic can be characterized as medium to low, and no road saturation was observed at the time of the visit.”\n\nAgainst this background, omissions warranting the intervention of this Constitutional Court are found with respect to the respondent municipality.\n\nFirst, it is observed that, in response to the applicants’ initial complaint, the Subproceso de Gestión Ambiental of the respondent municipality merely informed them that matters concerning the operating hours of the reported quarry activity fell within the authority of the Área de Actividad de Patentes and the Proceso de Control Fiscal y Urbano of that municipality. There is no evidence that it forwarded the complaint to those offices so that the local government could duly consider and decide it. Accordingly, the respondent authority did not properly process the complaint, since that response did nothing to resolve the underlying situation being brought to the municipality’s attention.\n\nIt is further observed that, when subsequently addressing the situation reiterated by the applicants in January of the current year, the respondent municipality merely prepared official letter no. MA-SGV-0354-2026 of 28 April 2026, in which the local government’s Subproceso de Gestión Vial stated: “(…) ROAD LIMITATIONS FOR HEAVY TRAFFIC. Nevertheless, it is expressly clarified that: A technical determination of suitability, unsuitability, or a formal restriction concerning heavy traffic can be made only through properly prepared road-capacity studies and risk analyses, which are not currently contained in the case file (…).” Thus, the underlying situation was not addressed and resolved on that occasion either.\n\nAccordingly, it should be noted that the official letter at issue identifies risk conditions associated with heavy-vehicle traffic on the street in question arising from its width, lack of sidewalks, and street configuration. It also expressly states that determining “suitability, unsuitability, or a formal restriction concerning heavy traffic” — precisely the situation alleged by the persons whose rights are protected (tutelados) — requires road-capacity studies and risk analyses. There is no evidence that the municipality took any steps whatsoever to procure such studies in order to address and resolve the merits of the matter at issue.\n\nThus, more than one year after the initial complaint, this Chamber does not find it established that the respondent municipality coordinated, arranged, or carried out the corresponding actions to obtain the referenced technical studies, or that it arranged for the other competent municipal offices to intervene and address the matter as required by law. Ultimately, therefore, it has not been shown that the respondent local government decided the merits of the complaints filed by the applicants.\n\nConsequently, the application is granted with respect to this issue, on the terms set forth in the operative portion of this decision. (…)”"
