Since January 2026, she had reported that the culvert conveyed or accumulated stormwater on her property, causing damage to the dwelling, erosion, sediment transport, soil saturation, and unsanitary conditions. Although Conavi denied diverting the water and explained that in 2020 it had replaced a preexisting culvert because of capacity problems, it also acknowledged that the culvert’s capacity remained insufficient. Conavi had considered installing another culvert, subject to a topographic survey that had not yet been performed. The Chamber ordered Conavi to solve the problem within four months and imposed costs and liability for damages. It denied the amparo as to the Municipalidad de Santa Cruz because it found neither an unattended specific request nor an openly arbitrary delay attributable to that municipality.",

LA SALA CONSTATA QUE EL CONAVI RECONOCE LA CAPACIDAD INSUFICIENTE DE UNA ALCANTARILLA Y NO HA EJECUTADO LOS ESTUDIOS NI LA SOLUCIÓN REQUERIDA. SE DECLARA PARCIALMENTE CON LUGAR SOLO CONTRA EL CONAVI Y SE ORDENA SOLUCIONAR EL PROBLEMA EN CUATRO MESES, CON CONDENATORIA EN COSTAS, DAÑOS Y PERJUICIOS. SE DESESTIMA CONTRA LA MUNICIPALIDAD DE SANTA CRUZ. VCG10/2026\n\n“(…) (…)”",
"body_en_text": "038617-26. ENVIRONMENT. MUNICIPALITY. EXECUTIVE BRANCH. FLOODING ALLEGEDLY CAUSED BY DRAINAGE FROM NATIONAL ROUTE 160. THE CHAMBER FINDS THAT CONAVI ACKNOWLEDGES THE INSUFFICIENT CAPACITY OF A CULVERT AND HAS NOT CONDUCTED THE STUDIES OR IMPLEMENTED THE REQUIRED SOLUTION. THE APPLICATION IS PARTIALLY GRANTED SOLELY AGAINST CONAVI, WHICH IS ORDERED TO REMEDY THE PROBLEM WITHIN FOUR MONTHS AND IS HELD LIABLE FOR COSTS, DAMAGES, AND LOSSES. THE APPLICATION AGAINST MUNICIPALIDAD DE SANTA CRUZ IS DENIED. VCG10/2026\n\n“(…) IV.- THE SPECIFIC CASE. In the matter at hand (sub lite), the amparo applicant states that she owns property located along national route no. 160. She notes that road infrastructure renovation and improvement works were carried out on a section of that route. She asserts that although a culvert system previously existed in the area, the configuration of the drainage system was modified during the works, particularly the discharge direction of the existing culvert, altering the natural behavior of surface runoff, which began to be directed straight toward her property. She maintains that this situation has caused flooding on her property, affecting both the structure of the dwelling and the topography of the land as a result of erosion, sediment transport, and permanent soil saturation. She states that she submitted requests to Municipalidad de Santa Cruz and Conavi seeking the adoption of the corresponding corrective measures. She alleges that the problem persists without an effective solution having been provided to eliminate the cause of the reported damage. She explains that the constant flooding and accumulation of stormwater within the property have created a permanent unsanitary condition that directly affects the occupants’ quality of life.\n\nThe Court finds that the property of the person whose rights are protected (tutelada) is located 3.5 Km from the Río Seco turnoff toward Playa Lagarto, at the intersection with the old road to Paraíso. In approximately 2020, Conavi replaced a culvert located on national route no. 160 near the applicant’s property because the previous culvert lacked sufficient capacity, which sometimes caused stormwater to flow over the road. On 14 January 2026, the protected person sent an email to contraloria.servicios@conavi.go.cr alleging that, as a consequence of works performed on national route no. 160, a culvert had been installed that caused all the water to enter and flood her property. On 3 March 2026, the applicant sent an email to contraloria.servicios@conavi.go.cr stating that her dwelling had been affected by the works performed on national route no. 160, causing it to flood. She therefore requested a solution. On 16 June 2026, the protected person sent an email to contraloria.servicios@conavi.go.cr reporting the problem affecting her property as a consequence of the modifications to the drainage system of national route no. 160. On 26 June 2026, a Conavi official informed the protected person by email that the culvert crossing could not be removed because it had always existed and had merely been replaced due to capacity problems. The official also explained that the water reaching that point comes from a mountain located opposite her property. The official therefore stated that the possibility was being considered of installing another culvert crossing that would carry some of the water toward the cantonal road, with Municipalidad de Santa Cruz managing that water through a drainage ditch. The official further stated that a topographic survey would be conducted to determine whether the elevations permitted the installation of a new culvert crossing. In written submission CARTA-CONAVI-CA-DIE-GCSV-DRCH-477-2026 of 13 August 2026, Conavi states: “(…) the first visit took place on 17 March of this year. On that date, Ms. ([Nombre 001]) was informed by telephone that the culvert crossing could not be sealed off or closed because it had been designed for the construction of the road and installed during its construction. She was also informed that a technical visit would be scheduled with the Department of the Road Management Technical Unit of Municipalidad de Santa Cruz to assess the possibility of diverting stormwater along the Cantonal Road—which could provide relief and reduce the amount of stormwater on the property in question—provided that the topography of the area permitted it and that the Road Management Department of Municipalidad de Santa Cruz agreed to assume responsibility for managing that stormwater. On 26 June of this year, Ms. Mora was informed by email that a visit to the area had already been conducted with Eng. Víctor Obando of the Road Management Technical Unit of Municipalidad de Santa Cruz, and that Eng. Obando had stated that if the topography permitted some of the stormwater to be diverted to the Cantonal Road, the Municipality would construct an earthen drainage ditch to carry the water to the river located along the Cantonal Road (email attached). That same day, Ms. ([Nombre 001]) was contacted by telephone and the contents of the email were explained to her. She was also informed that the maintenance contract for the National Road Network in Zone 2-3 (Santa Cruz) would end in mid-July of this year and that the topographic survey could not be conducted until the new multiyear maintenance contract had commenced, at which point the survey could be scheduled. The Administration expects the new contract to be active beginning next September (…) coordination with Eng. Víctor Obando of the Road Management Technical Unit of Municipalidad de Santa Cruz was conducted by telephone. The email sent to Ms. Mora on 26 June of this year shows that Eng. Víctor Obando was copied.”\n\nIn light of the foregoing, the Court finds that Conavi violated the fundamental rights of the protected person. The matter was reported to that Council in January 2026, when it was alleged that the culvert located near the applicant’s property was causing flooding that affected the property. In this regard, although Conavi maintains that the problem was not caused by a diversion of the water, but rather that the culvert in question had existed for many years and was merely replaced in 2020 because of insufficient capacity, it is equally true that Conavi also acknowledges that the capacity of that culvert is insufficient. In this respect, the email sent to the protected person on 26 June 2026 stated that consideration was being given to installing another culvert crossing that would carry some of the water toward the cantonal road, with Municipalidad de Santa Cruz managing that water through a drainage ditch; this requires a topographic survey, which has not been conducted.\n\nIn short, although Conavi has taken actions related to the complaints submitted by the protected person, it is equally true that the reported problem concerning the capacity of the culvert crossing located near her property has not been shown to have been resolved. The amparo application must therefore be granted as to Conavi.\n\nV.- Finally, the Chamber does not find any act or omission by Municipalidad de Santa Cruz that violated the fundamental rights of the protected party in the terms asserted in the amparo application. In this regard, neither the applicant’s statements nor the evidence indicate that any specific request submitted to that local government went unanswered. Moreover, although the record shows that Conavi coordinated an inspection with the municipal authority, that inspection dates from June 2026; therefore, when this matter was filed—31 July 2026—no manifestly arbitrary period had elapsed. Accordingly, the application is denied as to Municipalidad de Santa Cruz. (…)”"
