"summary_en": "In his note to Decision 38617-2026, Justice Salazar Alvarado explains that, as a matter of principle, disputes concerning action or inaction by the Public Administration in the repair, construction, modification, or demolition of infrastructure raise questions of legality that should be litigated before the ordinary jurisdiction. He nevertheless recognizes an exception when the administrative conduct infringes other fundamental rights protected by the constitutional jurisdiction or affects vulnerable groups. He considers that exception applicable to the described case, in which the amparo applicant attributes the diversion of surface runoff toward her property to modifications to the drainage system along national route no. 160. According to the allegations summarized in the note, the change caused flooding, damage to the dwelling, erosion, sediment transport, topographic alteration, and permanent soil saturation. The supplied excerpt contains only this judicial note and does not disclose the disposition adopted by the majority of the Constitutional Chamber (Sala Constitucional).",

"body_en_text": "VII.- NOTE BY JUSTICE SALAZAR ALVARADO. As a matter of principle, I consider that cases related to action or inaction by the Public Administration concerning the repair, construction, modification, or demolition of any infrastructure project should be dismissed because such omission raises an issue of legality that must be addressed by the ordinary courts, before which the interested person may more fully present their objections. However, when that administrative conduct, whether by omission or otherwise, results in a violation of other fundamental rights protected under this constitutional jurisdiction, or affects groups considered vulnerable, I do examine the merits of the matter, because such a situation constitutes an exception to my position on this issue, as occurs in this case, in which the amparo applicant alleges that she owns property located along national route no. 160. She states that road-infrastructure renovation and improvement work was performed on a section of that route. She asserts that, although a drainage system previously existed in the area, the configuration of that system was modified during the work, particularly the discharge direction of the existing culvert, altering the natural flow of surface runoff, which began to be channeled directly toward her property. She maintains that this situation has caused flooding on her property, affecting both the structure of the dwelling and the topography of the land as a result of erosion, sediment transport, and permanent soil saturation.\n\nVCG10/2026"
