"summary_en": "The Constitutional Chamber (Sala Constitucional) granted the amparo application against the Municipality of Paraíso for suspending an older adult’s drinking-water service based on the entire debt accumulated since 2021 and without ensuring an alternative water source. The Chamber held that disconnection for nonpayment may be based only on failure to pay the latest overdue monthly bill; historical obligations and other municipal charges must be pursued through ordinary collection procedures. It found it disproportionate to deprive a person of an essential service to compel payment of debts spanning several years, particularly when the affected person is an older adult. Moreover, any suspension must be accompanied by a public tap or other water outlet located no more than fifty meters from the residence, in a safe and materially accessible place. Hydraulic-renovation work did not excuse the Municipality from arranging alternative supply. The suspension order was annulled, without preventing a new measure limited to the latest unpaid bill and accompanied by the required public water source.",

"excerpt_en": "It follows from the foregoing that the authority to suspend drinking-water service rests on the failure to pay the latest overdue monthly bill on time, and not on the accumulated historical balance, which must be pursued through the ordinary collection procedures available to the Administration. Depriving an older adult of a service essential to health and life in order to compel payment of obligations spanning several years is a disproportionate and unreasonable measure in relation to the legitimate objective of securing payment for the service.\n\nIn this case, the respondent Municipality suspended the service for the entire amount owed, when suspension was permissible only for the latest unpaid bill, and it also failed to place a public water source no more than 50 meters from the protected person’s residence. Both circumstances constitute a violation of the protected person’s fundamental rights, requiring annulment of the suspension order, without prejudice to the Administration’s ability to issue a new one limited solely to the latest unpaid bill and accompanied by the public water source, under the terms stated in this judgment. The protected person must also be allowed to pay the latest monthly bill without making that payment conditional on payment of the accumulated debt or other charges, without prejudice to the Municipality’s pursuit of any legally appropriate collection actions through ordinary procedures. Finally, as stated in judgment No. 2026-015401, any dispute concerning the existence, amount, or validity of the debt is a matter of ordinary legality outside this jurisdiction. (…)”",

LA MUNICIPALIDAD DE PARAÍSO DE CARTAGO, SUSPENDIÓ EL SUMINISTRO DE AGUA POTABLE A UNA PERSONA ADULTA MAYOR POR OBLIGACIONES ACUMULADAS DESDE 2021 Y NO INSTALÓ UNA FUENTE PÚBLICA, ALEGANDO QUE EL SECTOR ESTABA SIENDO INTERVENIDO MEDIANTE UN PROYECTO HIDRÁULICO. LA SALA CONSIDERÓ QUE LA SUSPENSIÓN SOLO PUEDE SUSTENTARSE EN EL ÚLTIMO RECIBO MENSUAL VENCIDO Y NO PAGADO; LA DEUDA HISTÓRICA DEBE RECLAMARSE POR LAS VÍAS ORDINARIAS DE COBRO. PRIVAR DEL AGUA PARA EXIGIR OBLIGACIONES DE VARIOS AÑOS RESULTA DESPROPORCIONADO, ESPECIALMENTE TRATÁNDOSE DE UNA PERSONA ADULTA MAYOR. ADEMÁS, LA SUSPENSIÓN REQUIERE GARANTIZAR UNA FUENTE PÚBLICA SEGURA Y ACCESIBLE A NO MÁS DE 50 METROS DE LA VIVIENDA. SE ANULÓ EL CORTE Y SE ORDENÓ PERMITIR EL PAGO SEPARADO DEL ÚLTIMO RECIBO, RESTABLECER EL SERVICIO SI ESTE NO ESTÁ INCUMPLIDO Y ASEGURAR EL ABASTECIMIENTO ALTERNATIVO MIENTRAS CORRESPONDA. VCG10/2026\n\n“(…) "body_en_text": "038811-26. PUBLIC SERVICES. MINORITIES. THE MUNICIPALIDAD DE PARAÍSO DE CARTAGO SUSPENDED THE DRINKING-WATER SUPPLY TO AN OLDER ADULT BECAUSE OF OBLIGATIONS ACCUMULATED SINCE 2021 AND DID NOT INSTALL A PUBLIC WATER SOURCE, ALLEGING THAT THE AREA WAS UNDERGOING WORK AS PART OF A HYDRAULIC PROJECT. THE CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) HELD THAT SUSPENSION MAY BE BASED ONLY ON THE MOST RECENT OVERDUE AND UNPAID MONTHLY BILL; THE HISTORICAL DEBT MUST BE CLAIMED THROUGH ORDINARY COLLECTION PROCEDURES. DEPRIVING A PERSON OF WATER TO COMPEL PAYMENT OF OBLIGATIONS ACCUMULATED OVER SEVERAL YEARS IS DISPROPORTIONATE, ESPECIALLY WHEN THE PERSON IS AN OLDER ADULT. MOREOVER, SUSPENSION REQUIRES THAT A SAFE AND ACCESSIBLE PUBLIC WATER SOURCE BE PROVIDED NO MORE THAN 50 METERS FROM THE HOME. THE SERVICE-CUTOFF ORDER WAS ANNULLED, AND THE MUNICIPALITY WAS ORDERED TO ALLOW SEPARATE PAYMENT OF THE MOST RECENT BILL, RESTORE SERVICE IF THAT BILL IS NOT OUTSTANDING, AND ENSURE AN ALTERNATIVE SUPPLY FOR AS LONG AS NECESSARY. VCG10/2026\n\n“(…) IV.- THE SPECIFIC CASE. After analyzing\nthe evidence submitted, this Court finds that the protected person is\na resident of the “Calle El Calvario” area in the canton of Paraíso. It may\nalso be inferred that, on an undetermined date, the drinking-water service\nassociated with meter N.°0000035672, corresponding to the protected party, was\nsuspended by the Acueducto Municipal. That action was taken because the\nsubscriber’s account was delinquent. In this regard, according to the account\nstatement issued by the Administración Tributaria Municipal, the protected\nperson has had overdue obligations for drinking-water service since 2021,\nresulting in prolonged delinquency over several years. It is also established\nthat, when the events alleged by the amparo applicant occurred, the Calle El\nCalvario area was undergoing work as part of a comprehensive hydraulic-\ninfrastructure renewal project promoted by the Acueducto Municipal. This\nprevented the installation of a public water source for use by the protected\nperson.\n\nV.- Regarding the installation of a public water\nsource, this Chamber ruled in judgment number 2020-17717 at 09:20\non 18 September 2020 as follows:\n\n“(…) Under circumstances similar to the facts under\nreview here, this Chamber, by decision 2019021906, the following (sic):\n\n“Now, taking the cited precedent into consideration,\nalthough suspension of water service due to an outstanding debt is reasonable,\nsuch action must be accompanied by the installation of a public water source\nno more than 50 meters away; this is necessary to safeguard the protected\nperson’s right of access to drinking water. In this regard, the Chamber ruled\nas follows in judgment n.º 2018-004812 at 9:30 on 23 March 2018:\n\n“V. Without detracting from the foregoing, this Court\nhas established that, if the regular supply is to be suspended, the company or\nentity responsible must make a public water source available to the interested\nperson at a distance of 50 meters, where that person may obtain this vital\nliquid. Because the right to health, derived from Article 21 of the\nConstitución Política, is implicated, drinking-water service must be within\neveryone’s reach (judgment 2003-01185 at nine forty in the morning on\n14 February 2003). In other words, when the drinking-water supply to domestic\nconsumers is interrupted for nonpayment, the user must have a free source of\nsupply, namely a public water source that is accessible so that, through\nreasonable diligence, the user may obtain water for minimum essential\nactivities (to that effect, see judgment N° 2017-16420 at 09:15 hrs. on\n13 October 2017)” (…)”\n(emphasis not in the original).\n\nSubsequently, in judgment No. 2022-004589 at 09:15\non 25 February 2022, this Chamber held, in relevant part:\n\n“VII.- Regarding the public water source, on\n21 January 2022 a public water source was installed beside the home where the\nprotected party resides. Subsequently, on 28 January 2022, officials from the\nMunicipalidad de Oreamuno conducted an inspection and determined that an\nillegal connection existed, so the water connection was removed and the public\nwater source was relocated to a distance of 76 meters. Contrary to the\napplicant’s assertion, the public water source was initially installed beside\nthe property where she resides and was later relocated to a distance of\n76 meters. Although there is no evidence permitting the conclusion that the\nevents occurred as the protected party alleged, the fact remains that the\npublic water source was relocated in clear violation of this Court’s\njurisprudential rule on the matter: the public water source must be located no\nmore than 50 meters away. Accordingly, the Constitutional Chamber must also\nintervene with respect to this specific issue” (emphasis not in the original).\n\nLater, by decision No. 2022-005659 at 09:20\non 11 March 2022, this Court ruled as follows:\n\n“[I]t is established that the applicant’s\ndrinking-water service was suspended at 9:54 on 14 February 2022 because of\nnonpayment of the bill for January 2022. Since 15 January 2022, the respondent\nofficials had, as required, installed a public water source at NIS CED01, at a\ndistance of 50 meters south and 15 meters west of the applicant’s property. In\nthis respect, the respondent Institute acted in accordance with the applicable\nrules when it suspended service for nonpayment for the preceding month;\nhowever, the public water source was installed more than 50 meters from the\nproperty, thereby violating her fundamental rights. In view of the foregoing,\nthis amparo proceeding must be granted”\n(emphasis not in the original).\n\nThose considerations apply to the case under review,\nbecause this Court finds no reason to depart from the position stated in the\njudgments partially transcribed above, nor any grounds for assessing the\nsituation presented differently, since in the present matter, as in the cited\nprecedents, the public water source was installed at a distance greater than\nthe fifty meters that this jurisdiction has deemed reasonable. In light of the\nforegoing, the violation of the protected party’s fundamental rights in this\nrespect is established and, consequently, the application is granted, with the\nconsequences to be stated in the operative portion of this judgment”\n(emphasis in the original).\n\nBased on the foregoing, the alleged violation is\nestablished because, under the applicable rules and the constitutional\njurisprudence cited above, although the Administration is authorized to\nsuspend drinking-water service for nonpayment, that measure must be accompanied\nby the installation of a public water source or water tap (paja de agua)\nenabling the user to meet basic needs. In this specific case, it was not\nestablished that the respondent authorities had installed a water tap or\nadopted any other measure enabling the protected person to obtain water as a\nresult of the service suspension. Although the respondent authorities stated\nthat hydraulic-infrastructure renewal work was being performed in the area,\nthat circumstance did not relieve them of compliance with that obligation,\nbecause they were required to adopt the measures and undertake the coordination\nnecessary to guarantee an alternative water source while the work was being\nperformed. Consequently, because it was not shown that such a supply had been\nprovided, the violation of fundamental rights is established and the\napplication is granted.\n\nMoreover, the maximum distance of fifty meters is not\na purely numerical parameter. This Chamber so clarified in judgment\nN.° 2026-015401 at 9:20 on 30 April 2026, in which it stated:\n\n“(…) The jurisprudential parameter concerning distance\nis not merely a numerical formula, but rather a concrete manifestation of the\nprinciple of physical accessibility of the right to water. In other words, the\nmere existence of a water outlet within a radius of fifty meters is\ninsufficient if, in order to use it, the person must face objective risks,\novercome physical obstacles, or bear disproportionate burdens incompatible\nwith reasonable diligence. The constitutional standard requires a nearby and\ngenuinely usable water source. (…)”.\n\nLikewise, that same judgment stated:\n\n“(…) The Chamber has repeatedly held that disconnection\nof the supply for nonpayment is permissible only for failure to make timely\npayment of the most recent overdue monthly amount; accumulated amounts\ncorresponding to prior periods are debts enforceable through ordinary legal\ncollection procedures, but do not, by themselves, authorize depriving a person\nof the essential drinking-water service.\n\nIn the matter under review (sub examine), the proven\nfacts show that the municipal debt included not only charges related to water\nservice but also taxes and other municipal services, in connection with which\na payment arrangement had even been formalized in December 2020. The record\nalso shows that various partial payments were made during 2021. However, the\nMunicipalidad does not establish with precision that the suspension ordered on\n20 July 2022 was based strictly on nonpayment of the most recent monthly bill\nfor drinking-water service. Nor does it show that restoration of the service\ndepends exclusively on payment of that most recent overdue amount. Rather, it\nmay reasonably be inferred from the sequence of events that restoration is\nconditioned upon payment of the accumulated historical debt or full compliance\nwith the payment arrangement, which is incompatible with current\nconstitutional doctrine. The Administration may not use suspension of\ndrinking-water service as an indirect means of exerting pressure to collect\npast obligations or other taxes unrelated to the most recent payable bill.”\n\nConsequently, the public water source to be installed\nmust be located no more than fifty meters from the protected person’s home and\nmust also be in a safe and physically accessible place; furthermore, suspension\nis permissible only for nonpayment of the most recent service bill.\n\nVI.- SCOPE OF SERVICE SUSPENSION FOR NONPAYMENT. The\nviolation is not limited to the failure to install the public water source.\nThe report submitted and the documentation provided show that the suspension\norder was issued because of the entire debt accumulated since 2021, which as\nof 23 September 2026 amounted to ¢[Valor 002], and not solely because of the\nmost recent overdue and unpaid monthly bill. On this issue, this Chamber held\nas follows in judgment N.° 2026-015401 at 9:20 on 30 April 2026:\n\n“(…) Although this Court has recognized that the\nentities administering the service are authorized to suspend it when the user\nis delinquent, that power is not absolute and may not be exercised in an\nunreasonable or disproportionate manner or in a manner that infringes the\nessential content of the right to water. Accordingly, every suspension measure\nmust reconcile the Administration’s interest in collection with the enhanced\nprotection warranted by access to this vital liquid. (…) The Chamber has\nrepeatedly held that disconnection of the supply for nonpayment is permissible\nonly for failure to make timely payment of the most recent overdue monthly\namount; accumulated amounts corresponding to prior periods are debts\nenforceable through ordinary legal collection procedures, but do not, by\nthemselves, authorize depriving a person of the essential drinking-water\nservice. (…) The Administration may not use suspension of drinking-water\nservice as an indirect means of exerting pressure to collect past obligations\nor other taxes unrelated to the most recent payable bill. (…)”.\n\nThat position is consistent with this Court’s prior\njurisprudence. In judgment N.° 2017-013012 at 9:30 on 18 August 2017, the\nChamber reiterated the ruling in judgment N.° 2016-1843 at 10:20 on\n5 February 2016 in the following terms:\n\n“IV.- SUSPENSION OF DRINKING-WATER SUPPLY SERVICE. This\nChamber has also clarified in its jurisprudence that, even though access to\ndrinking water is both a service and a fundamental right, it is subject to\npayment, and therefore the user’s delinquency may authorize the service\nprovider to suspend it. Nevertheless, when a basic and essential service such\nas drinking-water supply is disconnected, this Chamber has held that a series\nof minimum requirements and safeguards must be met. (…) More recently, in\njudgment No. 2011-006855 at 11:21 hrs. on 27 May 2011, this Chamber reiterated:\n‘The jurisprudential line of this Constitutional Chamber clearly establishes\nthat, although the Instituto Costarricense de Acueductos y Alcantarillados may\ndisconnect drinking-water supply service because of current delinquency, it\nmust at the same time guarantee the supply of water through an easily\naccessible public water source (…)’”.\n\nSubsequently, in judgment N.° 2017-011001 at 9:30 on\n14 July 2017, when applying that jurisprudential line, this Court expressly\nconsidered that the suspension was based on a single unpaid bill and held as\nfollows:\n\n“(…) it has been duly established that the service was\nsuspended at 10:55 on 5 June of the current year because one bill remained\nunpaid on that date, having been overdue since 26 May 2017. The Chamber\nlikewise finds that, when the service was disconnected, the corresponding\npublic water source was installed (…), thereby guaranteeing access to\ndrinking-water service. (…)”.\n\nSimilarly, in decision N.° 2022-005659, cited above,\nthe suspension of service “for nonpayment for the preceding month” was found to\ncomply with the applicable rules. It follows from the foregoing that the power\nto suspend drinking-water service rests on failure to make timely payment of\nthe most recent overdue monthly bill, and not on the accumulated historical\nbalance, which must be claimed through the ordinary collection procedures\navailable to the Administration. Depriving an older adult of a service\nessential to health and life in order to compel payment of obligations\naccumulated over several years is a disproportionate and unreasonable measure\nin relation to the legitimate purpose of ensuring payment for the service.\n\nIn this specific case, the respondent Municipalidad\nsuspended service because of the entire amount owed, when it was permissible\nto do so only because of the most recent unpaid bill, and it also failed to\ninstall the public water source no more than 50 meters from the protected\nperson’s home. Both circumstances constitute a violation of the protected\nparty’s fundamental rights. The suspension order must therefore be annulled,\nwithout prejudice to the Administration’s authority to issue a new order\nlimited exclusively to the most recent unpaid bill and accompanied by the\npublic water source, under the terms stated in this judgment. The protected\nperson must likewise be allowed to pay the most recent monthly bill without\nthat payment being conditioned upon payment of the accumulated debt or other\ncharges, without prejudice to the Municipalidad’s exercise, through ordinary\nprocedures, of any collection actions available under the law. Finally, as\nstated in judgment N.° 2026-015401, any dispute concerning the existence,\namount, or enforceability of the debt is a matter of ordinary legality outside\nthis jurisdiction. (…)”"
