  "body_es_text": "Revisión del Documento\n\n\n\nExp: 23-030219-0007-CO \n\nRes. Nº 2024000324\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas quince minutos del diez de enero de dos mil veinticuatro .\n\n Acción de inconstitucionalidad promovida por Nombre01, mayor, casado una vez, abogado, carné 31370, cédula de identidad número CED01, vecino de Home Creek del cantón de Talamanca, contra los ordinales 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, ll, 12, 13, 14, 15, 16, 17, 18, y 19 del Plan Regulador Costero de Talamanca -distrito Cahuita-. \n\nResultando:\n\n 1.- Por escrito recibido en la Secretaría de la Sala el 6 de diciembre de 2023, se solicita que se declaren inconstitucionales los ordinales 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, ll, 12, 13, 14, 15, 16, 17, 18, y 19 del Plan Regulador Costero de Talamanca -distrito Cahuita-, por considerarlos violatorios del principio de legalidad, debido proceso e igualdad. Señala que la municipalidad de Talamanca inició un proceso para realizar un Plan Regulador Costero del distrito de Cahuita, se presentó la moción por medio de un diputado en la Comisión de Hacendarios de la Asamblea Legislativa para que se aprobara una partida específica a nombre de la municipalidad de Talamanca para financiar la realización del Plan Regulador, con lo establecido en el Código Municipal y se solicitó el giro de dichos recursos. En año 2014, la municipalidad de Talamanca priorizó el uso de dichos recursos para la construcción del Plan Regulador Costero del distrito de Cahuita, iniciando con una sesión de representantes de las organizaciones formales existentes, a quienes se les informó de las intenciones de la municipalidad. Con fecha 13 de octubre de 2017, se firmó el Convenio de Cooperación entre el Instituto Nacional de Vivienda y Urbanismo y la municipalidad de Talamanca para que esta entidad pública se encargara de la construcción del Plan Regulador Costero del distrito de Cahuita, convenio que fue firmado por el entonces alcalde de la municipalidad de Talamanca, Marvin Antonio Gómez Bran y la presidenta ejecutiva del Instituto Nacional de Vivienda y Urbanismo Sonia Montero Díaz, y establecieron las condiciones que debería cumplir el Plan Regulador Costero del distrito de Cahuita y las obligaciones de las partes. En seguimiento a este proceso, la municipalidad indicó que abrió un proceso participativo en el año 2014 y 2015 con organizaciones sociales y actores sociales de los pueblos costeros del distrito Cahuita realizando reuniones por medio de la Comisión de Ordenamiento Territorial creada por el Consejo Municipal y, además, indicaron que un grupo de estudiantes realizaron su Trabajo Comunal Universitario con entrega de volantes informativos sobre la propuesta de construcción de un Plan Regulador Costero. Con fecha del 15 de junio del año 2023, la municipalidad de Talamanca volvió a retomar el proceso del Plan Regulador Costero del distrito de Cahuita con la documentación de propuesta de Plan Regulador Costero del INVU, el cual se construyó, según lo establecido en el convenio firmado el 13 de octubre de 2017, utilizando estudios desde el año 2014, los cuales a su criterio son diferentes a la actualidad, ya que han pasado casi 10 años desde los primeros estudios de zonificación. Al hacer un análisis del convenio firmado el 13 de octubre del año 2017 entre la municipalidad de Talamanca y el Instituto Nacional de Vivienda y Urbanismo se logró corroborar en la cláusula sétima del plazo, que el convenio tenía una vigencia de 12 meses a partir de su firma y aprobación por parte de la Junta Directiva del INVU y del Consejo Municipal del cantón de Talamanca, así como el respectivo refrendo de las asesorías jurídicas de ambas instituciones. Así las cosas, demuestra que para el año 2023, todas las gestiones realizadas por la municipalidad de Talamanca y el Instituto Nacional de Vivienda v Urbanismo carecían de validez, ya que el convenio estaba vencido entre ambas instituciones y no contaban con un nuevo convenio vigente. Por otra parte, el convenio no fue firmado por la asesoría jurídica de ambas instituciones, solo firmó el alcalde y la presidente del INVU. Ahora bien, considera que todo lo presentado por el INVU y la Municipalidad de Talamanca para la aprobación del Plan Regulador Costero del cantón de Talamanca, distrito Cahuita en el año 2023 violenta el debido proceso y el principio de legalidad establecido en nuestra Constitución Política de la República de Costa Rica. Seguidamente, en la cláusula octava, el convenio da la opción de prorroga tácitamente por un periodo de 8 meses, salvo que alguna de las partes presente con treinta días naturales de anticipación, alguna solicitud al respecto. Con respecto a esta cláusula, afirma que tampoco se presentó en tiempo y forma una extensión de prórroga. En el convenio firmado, en la cláusula segunda, indica lo siguiente: la propuesta de zonificación del Plan Regulador Costero se prepara a escala 1.2.00 como máximo, se contará con seis zonas de uso de la tierra, a cada una de las cuales se asocian áreas detalladas de uso de la tierra, tal como se presentan en el cuadro, según capítulo 6 del Manual para elaboración de planes reguladores costeros en la zona marítimo terrestre: l. Zona de Desarrollo Turístico 2. Zona Mixta 3. Zona especial 4. Zona para la comunidad 5. Zona futura 6. Zona de protección. Sin embargo, el plan regulador aprobado por la municipalidad de Talamanca en su artículo 2 presenta una distribución de 10 zonas completamente diferentes a las firmadas y tipificadas en el convenio: l. Área Núcleo para la comunidad. 2. Área Residencia Comunitaria. 3. Base para Pescadores Artesanales. 4. Pueblo Costero. 5. Área para desarrollo Futuro. 6. Área Mixta para el turismo y la comunidad. 7. Área para Cooperativas. 8. Área para viabilidades. 9. Área para protección. 10. Área planificada para el desarrollo turístico baja densidad. En términos generales, lo firmado en el convenio con las cláusulas que debía llevar el Plan Regulador Costero es completamente diferente a lo realizado por el INVU y la municipalidad de Talamanca y publicado en el diario oficial la Gaceta. Sobre el principio de legalidad cita un extracto de la sentencia de la Sala Constitucional nro. 6351-2011, que recoge lo afirmado por el voto 440-1998. Sobre el principio de igualdad hace referencia a la jurisprudencia de esta Sala sin citar su precedente. Agrega que, en atención al artículo 82 de la Ley de Jurisdicción Constitucional y al amparo del presupuesto de periculum in mora -ampliamente desarrollado por esta Sala-, solicita se decrete en efecto suspensivo la aplicación del Plan Regulador Costero de Talamanca Distrito Cahuita, hasta que se resuelva la presente acción de inconstitucionalidad. El fundamento de dicha petición cautelar se encuentra en la posibilidad de existir una afectación a todas las personas que cuentan con una propiedad en la Zona Marítimo Terrestre y abusivo de la norma impugnada. Solicita, respetuosamente a este Tribunal, se declare la inconstitucionalidad de los artículos del Plan Regulador Costero de Talamanca, distrito Cahuita, aprobado por la municipalidad de Talamanca, en razón de la evidente violación a los principios constitucionales de legalidad, debido proceso, igualdad ante la ley, así como los preceptos que fungen como parámetros de constitucionalidad de proporcionalidad y razonabilidad, y los artículos 11, 33, 46, 50, 57, 63 y 68 de la Constitución Política.\n\n 2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n \n\n Redacta el Magistrado Castillo Víquez; y,\n\nConsiderando:\n\n I.- Sobre la inadmisibilidad de esta acción de inconstitucionalidad. Del escrito de interposición se desprende que, lejos de fundamentar y cuestionar las normas en cuestión, lo impugnado realmente por el gestionante, es lo actuado por la municipalidad de Talamanca y el INVU, en relación con el convenio interinstitucional que se había suscrito para elaborar el plan regulador en cuestión, cuestionando la vigencia y alcances del convenio, aspectos todos que son cuestiones de mera legalidad y no de constitucionalidad. Debe tomar en consideración el accionante, que el planteamiento de una acción de inconstitucionalidad tiene como fin, en principio, verificar si una disposición general contraría alguna disposición o principio contenido en la Constitución Política o los tratados y convenios internacionales, en cualquier caso, no el revisar si la interpretación o la aplicación de esa disposición a una situación en particular resulta lesiva de un derecho fundamental, pues de ello se ocupa la vía del amparo, cuando lo impugnado es de relevancia constitucional. \n\nFinalmente, el propio accionante aporta como prueba la sentencia nro. 2023-31756, de las 9:30 horas del 7 de diciembre de 2023, emitida por esta propia Sala en la que se tuvo por demostrado que el plan regulador en cuestión no fue debidamente consultado a los pueblos indígenas, motivo por el cual se anuló la audiencia pública llevada a cabo el pasado 04 de agosto de 2023; y se ordenó al alcalde y presidenta del Concejo Municipal, ambos de la municipalidad de Talamanca, girar las órdenes que estén dentro del ámbito de sus competencias y coordinar lo necesario para que, dentro del plazo máximo de tres meses, contado a partir de la notificación de esa sentencia, se programe una nueva audiencia pública para el proyecto del Plan Regulador Costero del Distrito de Cahuita del Cantón de Talamanca y se convoque con la debida antelación, a los miembros de la Asociación de Desarrollo Integral del Territorio Indígena de Keköldi “ADI Keköldi”. De manera que, el objeto de impugnación no ha sido debidamente aprobado y carece de toda validez actualmente, por lo que no resulta admisible el control de admisibilidad del mismo por prematuro. San José, at nine hours and fifteen minutes on January tenth, two thousand twenty-four.\n\nAn unconstitutionality action brought by Nombre01, of legal age, married once, attorney, bar number 31370, identity card number CED01, resident of Home Creek in the canton of Talamanca, against sections 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, ll, 12, 13, 14, 15, 16, 17, 18, and 19 of the Plan Regulador Costero de Talamanca -Distrito Cahuita-.\n\nWhereas:\n\n1.- By a document received in the Secretariat of the Chamber on December 6, 2023, it is requested that sections 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, ll, 12, 13, 14, 15, 16, 17, 18, and 19 of the Plan Regulador Costero de Talamanca -Distrito Cahuita- be declared unconstitutional, considering them violative of the principle of legality, due process, and equality. It points out that the municipality of Talamanca initiated a process to create a Plan Regulador Costero for the district of Cahuita; a motion was presented by a deputy in the Comisión de Hacendarios of the Asamblea Legislativa for a specific budget line item to be approved in the name of the municipality of Talamanca to finance the creation of the Plan Regulador, in accordance with what is established in the Código Municipal, and the disbursement of said resources was requested. In 2014, the municipality of Talamanca prioritized the use of said resources for the construction of the Plan Regulador Costero of the district of Cahuita, beginning with a session of representatives from existing formal organizations, who were informed of the municipality's intentions. On October 13, 2017, the Convenio de Cooperación was signed between the Instituto Nacional de Vivienda y Urbanismo and the municipality of Talamanca so that this public entity would be in charge of building the Plan Regulador Costero of the district of Cahuita, an agreement that was signed by the then-mayor of the municipality of Talamanca, Marvin Antonio Gómez Bran, and the executive president of the Instituto Nacional de Vivienda y Urbanismo, Sonia Montero Díaz, and they established the conditions that the Plan Regulador Costero of the district of Cahuita should fulfill and the obligations of the parties. In follow-up to this process, the municipality indicated that it opened a participatory process in 2014 and 2015 with social organizations and social actors from the coastal towns of the Cahuita district, holding meetings through the Comisión de Ordenamiento Territorial created by the Consejo Municipal, and, additionally, they indicated that a group of students carried out their Trabajo Comunal Universitario, delivering informational flyers about the proposal for the construction of a Plan Regulador Costero. On June 15, 2023, the municipality of Talamanca resumed the process of the Plan Regulador Costero of the district of Cahuita with the proposal documentation for the Plan Regulador Costero from the INVU, which was built, according to what was established in the agreement signed on October 13, 2017, using studies from 2014, which in its opinion are different from the current situation, since almost 10 years have passed since the first zoning studies. Upon analyzing the agreement signed on October 13, 2017, between the municipality of Talamanca and the Instituto Nacional de Vivienda y Urbanismo, it was possible to corroborate in the seventh clause regarding the term that the agreement had a duration of 12 months from its signing and approval by the Junta Directiva of the INVU and the Consejo Municipal of the canton of Talamanca, as well as the respective countersignature by the legal advisory offices of both institutions. Thus, it demonstrates that by 2023, all actions taken by the municipality of Talamanca and the Instituto Nacional de Vivienda y Urbanismo lacked validity, since the agreement between both institutions had expired and they did not have a new, valid agreement. On the other hand, the agreement was not signed by the legal advisory office of both institutions; only the mayor and the president of the INVU signed. Now, it considers that everything presented by the INVU and the Municipality of Talamanca for the approval of the Plan Regulador Costero of the canton of Talamanca, district of Cahuita in 2023 violates due process and the principle of legality established in our Constitución Política de la República de Costa Rica. Next, in the eighth clause, the agreement provides the option for tacit extension for a period of 8 months, unless one of the parties presents a request in this regard with thirty calendar days' notice. Regarding this clause, it affirms that an extension of the term was also not presented in a timely manner. In the signed agreement, in the second clause, it indicates the following: the zoning proposal for the Plan Regulador Costero is prepared at a scale of 1:2000 maximum, with six land-use zones, each of which is associated with detailed land-use areas, as presented in the table, according to chapter 6 of the Manual para elaboración de planes reguladores costeros en la zona marítimo terrestre: l. Zona de Desarrollo Turístico 2. Zona Mixta 3. Zona especial 4. Zona para la comunidad 5. Zona futura 6. Zona de protección. However, the regulatory plan approved by the municipality of Talamanca in its article 2 presents a distribution of 10 zones completely different from those signed and typified in the agreement: l. Área Núcleo para la comunidad. 2. Área Residencia Comunitaria. 3. Base para Pescadores Artesanales. 4. Pueblo Costero. 5. Área para desarrollo Futuro. 6. Área Mixta para el turismo y la comunidad. 7. Área para Cooperativas. 8. Área para viabilidades. 9. Área para protección. 10. Área planificada para el desarrollo turístico baja densidad. In general terms, what was signed in the agreement with the clauses that the Plan Regulador Costero should include is completely different from what was done by the INVU and the municipality of Talamanca and published in the official newspaper La Gaceta. Regarding the principle of legality, it cites an excerpt from ruling of the Sala Constitucional no. 6351-2011, which echoes what was affirmed by Voto 440-1998. Regarding the principle of equality, it refers to the jurisprudence of this Chamber without citing its precedent. It adds that, in attention to article 82 of the Ley de la Jurisdicción Constitucional and under the protection of the presupposition of periculum in mora -widely developed by this Chamber-, it requests that the application of the Plan Regulador Costero de Talamanca Distrito Cahuita be decreed with suspensive effect until this unconstitutionality action is resolved. The basis for said precautionary request lies in the possibility of harm to all people who own property in the Zona Marítimo Terrestre and the abusive nature of the contested norm. It respectfully requests this Court to declare the unconstitutionality of the articles of the Plan Regulador Costero de Talamanca, district of Cahuita, approved by the municipality of Talamanca, due to the evident violation of the constitutional principles of legality, due process, equality before the law, as well as the precepts that serve as parameters of constitutionality of proportionality and reasonableness, and articles 11, 33, 46, 50, 57, 63, and 68 of the Constitución Política.\n\n2.- Article 9 of the Ley de la Jurisdicción Constitucional empowers the Chamber to dismiss an action outright or on the merits, at any time, including from its presentation, any motion brought before it that proves to be manifestly unfounded, or when it considers that there are sufficient grounds for dismissal, or that it is a simple reiteration or reproduction of an equal or similar previous motion that was rejected.\n\nPrepared by Judge Castillo Víquez; and,\n\nConsidering:\n\nI.- On the inadmissibility of this unconstitutionality action. From the filing brief, it is clear that, far from substantiating and questioning the norms in question, what the petitioner is actually challenging are the actions of the municipality of Talamanca and the INVU, in relation to the inter-institutional agreement that had been signed to prepare the regulatory plan in question, questioning the validity and scope of the agreement, all aspects that are matters of mere legality and not of constitutionality. The petitioner must take into consideration that the purpose of filing an unconstitutionality action is, in principle, to verify whether a general provision contravenes any provision or principle contained in the Constitución Política or international treaties and conventions, and in any case, it is not to review whether the interpretation or application of that provision to a particular situation is harmful to a fundamental right, as that is addressed through the amparo process, when what is being challenged is of constitutional relevance.\n\nFinally, the petitioner himself provides as evidence ruling no. 2023-31756, of 9:30 a.m. on December 7, 2023, issued by this very Chamber, in which it was proven that the regulatory plan in question was not duly consulted with the indigenous peoples, which is why the public hearing held on August 4, 2023, was annulled; and the mayor and president of the Concejo Municipal, both of the municipality of Talamanca, were ordered to issue the orders within the scope of their competencies and coordinate what is necessary so that, within a maximum period of three months, counted from the notification of that ruling, a new public hearing is scheduled for the project of the Plan Regulador Costero del Distrito de Cahuita del Cantón de Talamanca, and the members of the Asociación de Desarrollo Integral del Territorio Indígena de Keköldi (“ADI Keköldi”) are summoned with due notice. Therefore, the object of challenge has not been duly approved and currently lacks all validity, and its admission for review is consequently inadmissible as premature. Consequently, the appropriate course is the outright dismissal of this unconstitutionality action.\n\nII.- Documentation provided to the case file. The parties are warned that if they have provided any paper document, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new technology-produced device, these must be removed from the office within a maximum period of 30 working days counted from the notification of this ruling. Tourism Development Zone 2. Mixed Zone 3. Special Zone 4. Community Zone 5. Future Zone 6. Protection Zone.\n\nHowever, the regulatory plan approved by the Municipality of Talamanca in its Article 2 presents a distribution of 10 zones completely different from those signed and typified in the agreement: l. In general terms, what was signed in the agreement with the clauses the Coastal Regulatory Plan was supposed to contain is completely different from what was carried out by INVU and the Municipality of Talamanca and published in the official gazette La Gaceta. Regarding the principle of legality, he cites an excerpt from judgment of the Constitutional Chamber No. 6351-2011, which recapitulates what was affirmed in vote 440-1998. Regarding the principle of equality, he refers to the jurisprudence of this Chamber without citing its precedent. He adds that, in accordance with Article 82 of the Law of Constitutional Jurisdiction and under the assumption of periculum in mora—extensively developed by this Chamber—he requests that the application of the Coastal Regulatory Plan of Talamanca, Cahuita District, be decreed with suspensive effect until this action of unconstitutionality is resolved. The basis for this precautionary petition lies in the possibility of an affectation to all persons who own property in the Maritime-Terrestrial Zone and the abusive nature of the challenged norm. He respectfully requests this Tribunal to declare the unconstitutionality of the articles of the Coastal Regulatory Plan of Talamanca, Cahuita District, approved by the Municipality of Talamanca, due to the evident violation of the constitutional principles of legality, due process, equality before the law, as well as the precepts that serve as parameters of constitutionality of proportionality and reasonableness, and Articles 11, 33, 46, 50, 57, 63, and 68 of the Political Constitution.\n\n**2.-** Article 9 of the Law of Constitutional Jurisdiction empowers the Chamber to reject outright or on the merits, at any time, even from its presentation, any petition brought before it that proves to be manifestly inadmissible, or when it considers that there are sufficient elements of judgment to reject it, or that it is a mere reiteration or reproduction of a previous, identical or similar petition that was rejected.\n\nDrafted by Magistrate **Castillo Víquez**; and,\n\n**Considering:**\n\n**I.- On the inadmissibility of this action of unconstitutionality.** From the filing brief, it is clear that, far from substantiating and questioning the norms in question, what is actually challenged by the petitioner is the actions taken by the Municipality of Talamanca and INVU, in relation to the inter-institutional agreement that had been signed to prepare the regulatory plan in question, questioning the validity and scope of the agreement, all of which are matters of mere legality and not constitutionality. The claimant must take into consideration that the filing of an action of unconstitutionality is intended, in principle, to verify whether a general provision contravenes any provision or principle contained in the Political Constitution or international treaties and agreements, and, in any case, not to review whether the interpretation or application of that provision to a particular situation proves harmful to a fundamental right, as that is addressed through the amparo remedy, when what is challenged is of constitutional relevance.\n\nFinally, the claimant himself provides as evidence judgment No. 2023-31756, of 9:30 a.m. on December 7, 2023, issued by this very Chamber in which it was established that the regulatory plan in question was not duly consulted with the indigenous peoples, for which reason the public hearing held on August 4, 2023, was annulled; and the mayor and president of the Municipal Council, both of the Municipality of Talamanca, were ordered to issue the orders within the scope of their competencies and coordinate what is necessary so that, within a maximum period of three months, counted from the notification of that judgment, a new public hearing is scheduled for the Coastal Regulatory Plan project of the Cahuita District of the Canton of Talamanca and the members of the Association for the Integrated Development of the Keköldi Indigenous Territory “ADI Keköldi” are convened with due advance notice. Therefore, the object of challenge has not been duly approved and currently lacks all validity, making the admissibility review of the same impossible due to prematurity. Consequently, the appropriate action is the outright rejection of this action of unconstitutionality.\n\n**II.- Documentation provided to the case file.** The parties are warned that if they have provided any paper document, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or one produced by new technologies, these must be withdrawn from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all material not withdrawn within this period will be destroyed, in accordance with the provisions of the \"Regulation on the Electronic Case File before the Judicial Branch,\" approved by
