La entrega y aceptación se hizo sin los servicios públicos (agua, luz, y caminos), en espera de que estos fueran adquiridos con el pasar del tiempo. Entre el período 2017-2018 se terminó de construir los caminos y se concluyó lo relativo al servicio de electricidad, pero no el de agua. Desde el año 2014 se inició el proyecto hasta la fecha en que se aporta el recurso de amparo, se cuentan con el abastecimiento de agua potable, por lo que recurren a pozos artesanales y a pequeñas nacientes que hay en la zona, para el líquido requerido en las parcelas. Acusan que, si bien han gestionado ante el INDER a lo largo del tiempo, no han tenido respuestas positivas de su parte y la dotación de riqueza hídrica “a” quedado en promesa. En fechas 20 de julio, 12 de agosto, 23 de agosto, todas 2022 se remitieron correos electrónicos al jefe de la Oficina de Upala del INDER (véanse pruebas aportadas). Comentan que en la zona -el distrito de Aguas Claras, Upala- hay 3 asadas. El INDER les ha manifestado estar anuente a ayudarlos y que se está \"detrás del asunto\" (véanse algunas oficios aportados como prueba), pero, a la fecha de la interposición del recurso, no se ha podido solucionar de forma concreta la problemática de la falta de agua. Reclaman que, a la fecha de interposición de este recurso, la situación denunciada continuaba. Estiman que lo expuesto lesiona sus derechos fundamentales, en especial a las personas adultas mayores en estado de vulnerabilidad. Solicitan que se declare con lugar el recurso, con las consecuencias de ley.\n\n 2.- Informan bajo juramento Osvaldo Artavia Carballo, en su Presidente Ejecutivo, y Manrique Antonio Jiménez Castro, en su condición de Jefe de la Oficina Territorial de Upala, ambos del INDER, que:\n\n“No es cierto: Lo correcto es que, mediante el respectivo acuerdo de la Junta Directiva del Inder, en el Artículo No. 2 Sesión Extraordinaria 033-2012, celebrada el 18 de setiembre de 2012, se acordó comprar las fincas que posteriormente conformarían el Asentamiento Los Palmitos de Aguas Claras de Upala, con una inversión de ¢ 1.216.382.024.00 recurso del Inder. Durante los siguientes años 2013, 2014 y 2015, mediante la aplicación del mecanismo establecido en las leyes y reglamentos de la institución, se realizaron varios estudios socioeconómicos que permitieron declarar elegibles del Instituto, en el programa de dotación de tierras, en la modalidad de parcelas, al menos a 45 familias estudiadas, del Grupo denominado Asociación de Agricultores Cerro Mogote, con los respectivos acuerdos de Junta Directiva, los demás agricultores fueron obteniendo esta modalidad de declatoria de elegible durante los años 2016, 2017 y 2018. Los proyectos de caminos y electrificación fueron iniciados y concluidos en los 2017 y 2018, mediante los procesos de licitación correspondientes, con inversiones por más de 370 millones de colones.\n\n(…)\n\nEsta afirmación no es cierta: Advierte que, para la fecha mencionada del 2014, el suscrito jefe de la Oficina de Desarrollo Territorial de Upala, no fungía como tal, pues tal delegación ocurrió a partir del 15 de mayo de 2017. Sin embargo, existen registros que dan fe, de que la puesta en posesión de las primeras parcelas ocurrió en el año 2014, sin embargo, se advirtió que no podían habitar las parcelas, hasta contar con los servicios públicos necesarios. Ahora bien, indistintamente si fue en 2014, 2015 o 2016, el propósito del Inder, es financiar el costo del valor de la infraestructura necesaria para la dotación de un acueducto adecuado a la satisfacción de las necesidades de las familias y del proyecto productivo, como ocurrió con los proyectos de caminos y electrificación que fueron construidos a entera satisfacción de los usuarios durante los años siguientes 2017 y 2018 (y como se acostumbra en la mayoría de los asentamientos del Inder). ¿Qué ocurrió con el acueducto de agua potable?, bien el Inder cuenta con los recursos económicos para financiar la obra, como se dijo antes, sin embargo, no puede decir el Inder, voy a hacer un acueducto, para eso se requiere la participación de otras instituciones públicas, como lo son el ente rector que es El Instituto Costarricense de Acueductos y Alcantarillados, que es la institución comprometida con el bienestar y el desarrollo del país, a través del ejercicio de su rectoría y de la prestación sostenible del servicio de agua potable y del saneamiento mediante el cumplimiento de los requisitos de sus usuarios, otras partes interesadas pertinentes, los legales y reglamentarios para lo cual se apoya en su Sistema de Gestión de Calidad y promueve las mejoras continuas de sus procesos”.\n\nCita la ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados No. 2726 del 27 de agosto de 1961”.\n\nContinúan:\n\n“De acuerdo a la legislación citada y ajustándonos a las indicaciones de Acueductos y Alcantarillados, el proyecto a realizar consistía en las mejoras al Acueducto existente administrado por la Asada de San Isidro de Aguas Claras, quienes, a través de su reforzamiento hídrico, se lograría dotar del agua potable a la población del Asentamiento Los Palmitos, pues existe la capacidad hídrica. Así las cosas, las primeras coordinaciones las realizaron la comunidad con la Asada San Isidro de Aguas Claras, quien dotaría del agua potable al asentamiento. Para estos efectos se cuenta con la anuencia del INDER, para la ejecución de las obras, pero se requiere por parte de la Asada San Isidro de Aguas Claras de la contratación de un Estudio Técnico que determine los requerimientos técnicos y que pueda ser sometido a revisión y aprobación por parte del AyA. En ese sentido podemos ver a folio 103 del expediente administrativo del proyecto de acueducto para el asentamiento Los Palmitos, se puede apreciar según manifestaciones de los representantes de la Asada del Acueducto San Isidro de Aguas Claras, que desde el año 2015, hemos tratado de realizar conjuntamente con el Inder el proyecto del asentamiento, el primer estudio Técnico fue una inversión grande de parte de la Asada y de la gente del asentamiento, pero este no fue avalado por el AyA, se realizó un nuevo estudio técnico que fue donado por el PNUD, pero que no fue aceptado porque había quedado incompleto, porque no cumplía con algunos de los requerimientos y luego por el cambio de la norma técnica en el año 2017. En ese sentido se puede apreciar a folios 1 y 2, del oficio No. UEN-GAR-2018-01004, de fecha 16 de marzo de 2018, del expediente adjunto, los motivos por los cuales el ingeniero Luis Diego Alfaro Artavia UEN Gestión de Acueductos Rurales, considera que el estudio técnico de factibilidad para el mejoramiento de sistema de la ASADA San Isidro de Aguas Claras, con sus respectivos planos elaborados por la empresa Hidrotecnica de la Península y firmados por el Ing. Jonathan Cubero Rojas, no alcanza su aprobación, para ello deberán hacer todas las aclaraciones descritas en el presente informe. Véanse a folio 3, correo electrónico de las gestiones de la Gestora Social del Instituto de Acueductos y Alcantarillados, a la ASADA de San Isidro, como seguimiento al proyecto INDER, donde se advierte que el AyA, debe dar el visto bueno al Estudio Técnico elaborado por el PNUD, para que sea trasladado al INDER y de esta manera continuar con el proceso. Igual el oficio UEN-GAR-2018-02078, de fecha 5 de junio de 2018, dirigido a la ASADA de San Isidro, por parte del Ing. Luis Diego Alfaro Artavia UEN Gestión de Acueductos Rurales, advierte que el estudio técnico de factibilidad para el mejoramiento de sistema de la ASADA San Isidro de Aguas Claras, con sus respectivos planos elaborados por la empresa Hidrotecnica de la Península y firmados por el Ing. Jonathan Cubero Rojas, no alcanza su aprobación. Finalmente mediante el oficio UEN-GAR-2018-03363, de fecha 31 de agosto de 2018, visible a folio 17 del expediente, dirigido a la ASADA de San Isidro, por parte del Ing. Luis Diego Alfaro Artavia UEN Gestión de Acueductos Rurales, anuncia que se procedió nuevamente a la revisión del estudio técnico de factibilidad para el mejoramiento de sistema de la ASADA San Isidro de Aguas Claras, con sus respectivos planos y las aclaraciones aportadas por el Ing. Jonathan Cubero Rojas, vía electrónica el día 16 de agosto de 2018, y se concluye que el estudio técnico y sus correcciones cumple con los requerimientos mínimos para obtener su aprobación. Señalando que los planos del proyecto deberán someterse a la revisión del Departamento de Ingeniería del Instituto de Desarrollo Rural (INDER), por lo que su aprobación quedará sujeta a las modificaciones que se le soliciten (tómese nota  que hay un departamento de Ingeniería del INDER, que conjuntamente con el AyA, da seguimiento y coordina todo lo relativo a este proyecto). Previo a la ejecución se recuerda a la ASADA y /o contratista a cargo del proyecto que deben tramitar la viabilidad ambiental del proyecto ante SETENA y registrar la responsabilidad profesional realizando el trámite de sellado de planos constructivos ante el Colegio Federado de Ingenieros y Arquitectos de Costa Rica (CFIA) y gestionar los permisos para intervenir las rutas nacionales y cantonales ante el CONAVI y las municipalidades respectivas. Véase hasta aquí, que para desarrollar un proyecto de esta naturaleza se deben de considerar muchas variables y viabilidades de orden técnico y legal que deben ser subsanadas por la ASADA, para alcanzar la viabilidad técnica y legal. Mientras esta se desarrolla, los habitantes del asentamiento Los Palmitos, envían notas y solicitudes al presidente de la República y al Inder, manifestando su incomodidad porque las instituciones involucradas desde 6 años, no hemos hecho nada por resolver su situación de falta de agua potable (véanse los folios consecutivos del 18 al 22 del expediente del proyecto). Mediante el oficio OTUP-331-2019, de fecha 29 de julio de 2019 (folios 23 y 24), la Oficina de Desarrollo Territorial Upala, solicitó al Ing. Guillermo Córdoba Madrigal, encargado de los acueductos rurales y miembro de la Comisión Bipartita AyA-INDER, un informe del avance del proyecto del acueducto del asentamiento Los Palmitos. En los meses siguientes se logra obtener bastante avance de parte de la ASADA en cuanto a las gestiones para obtener los permiso municipales y nacionales para ruptura de vías, así como los permisos y la viabilidad por parte de SETENA. Sin embargo el Ing. Guillermo Córdoba Madrigal, en un correo dirigido a todos los involucrados en el proyecto, menciona que desde el punto de vista técnico será necesario una revisión profunda de los planos constructivos, lo cual implica una revisión de escritorio y posteriormente una visita de campo, por lo que se le estará informando al consultor todos los detalles que deberán ser corregidos para que el Inder pueda licitar la obra. Se estará programando una visita para el mes de enero de 2020. Véase folio 25. Con motivo de la pandemia de COVID-19, la Oficina de Desarrollo Territorial Upala tomó la decisión de comprar un tanque de agua e instalarlo en un vehículo para repartir agua potable a todas las familias del asentamiento que así lo requerían y como medida paliativa se realizó un diseño de emergencia con la ASADA, para la dotación de unas fuentes públicas de agua potable en lugares estratégicos del asentamiento, el proyecto se presentó a la gerencia del Inder, pero no fue aprobado, la entrega de agua sí se realizó entre dos y tres veces por semana al asentamiento durante la pandemia (Véanse folios del 33 al 52 del expediente). Entre octubre de 2020 y febrero de 2021, continuando con la coordinación con la ASADA San Isidro de Aguas Claras, la Oficina de Desarrollo Territorial Upala, realizó la gestión para otorgar un crédito a la ASADA, mediante el Programa de Crédito Rural del Inder, para otorgar un crédito a la ASADA para la compra de un lote, donde se instalaría un tanque de captación. (Véanse folios del 55 al 60 del expediente). El 9 de junio de 2021, se realizó una reunión virtual con la participación de miembros de la ASADA de San Isidro, representantes del Asentamiento Los Palmitos, El Jefe de la Oficina del Inder Upala y el Ing. Guillermo Córdoba, del Departamento de Acueductos Rurales del Inder. En síntesis se hizo una valoración del avance del proyecto, y se determinó que existe debilidad en algunas acciones tales como por ejemplo que una servidumbre pasa por una propiedad privada y se debe de obtener los permisos, no se han podido gestionar los permisos constructivos porque todavía la Comisión AyA- INDER, no ha obtenido de parte de la empresa que elaboró el Estudio Técnico, no se ha responsabilizado en la corrección de los planos originales, les falta mucho detalle y sin eso no se puede realizar la licitación. Tampoco quiere firmar las modificaciones si otro ingeniero las realiza, tampoco la inscripción de la responsabilidad profesional. El ingeniero Córdoba manifiesta que el proyecto tiene un valor aproximado de 600 millones de colones y que se va a acompañar el proyecto durante la ejecución con el apoyo del AyA. (Véase minuta completa en folios del 61 al 65). El 18 de agosto de 2021, se realizó una reunión virtual con la participación con la participación de miembros de la ASADA de San isidro, el jefe de la Oficina del Inder Upala y el Ing. Guillermo Córdoba, del Departamento de Acueductos Rurales del Inder. En síntesis, se hizo una valoración del avance del proyecto, y se comentaron las debilidades que persisten. Por ejemplo que el tanque no cabe en el terreno que se compró, se debe de hacer un nuevo plano y comprar más terreno. Respecto a los planos el Ing. Guillermo Córdoba informa que puede colaborar con los servicios de un dibujante, la Asada cubre los costos de hospedaje y alimentación, respecto al consultor que contrato el PNUD, no se hace responsable de las correcciones, la ASADA debe definir si lo demanda o toma otras acciones con él. (Véase minuta completa en folios del 66 al 69).\n\n(…)\n\nNo es cierto este hecho. El correo de referencia dirigido al jefe de la Oficina de Desarrollo Territorial Upala, en 20 de Julio de 2022, inicialmente lo enviaron a la mayor parte de Departamentos del Inder, incluida la Contraloría de servicios y se les contestó a todos incluidos los habitantes del asentamiento, mediante el oficio INDERGG-DRT-RDHN-OTUP-0217›2022 el 01 de agosto de 2022, informándose detalladamente todas las situaciones que han ocurrido. (Véanse folios del 70 al 79). En varias ocasiones hemos tratado de obtener contacto con la Asada de San Isidro, peor se nos ha manifestado incluso por parte de los miembros del asentamiento que ellos han manifestado que no están interesados en continuar con el proyecto. Los habitantes del asentamiento nos han manifestado durante los meses de octubre y noviembre que existe mucho interés de parte de las otras ASADAS Río Negro y Aguas Claras en dotar de agua al asentamiento, para tratar el tema hemos coordinado con la Licda. Leslie Campos Castro, quien es la Ejecutivo Especialista del Fortalecimiento de las Asada de Acueductos y Alcantarillados de la Región Chorotega, porque estas ASADAS pertenecen a esa región y nos ha manifestado un gran interés por realizar las coordinaciones correspondientes para conocer las factibilidades de las dos ASADAS y ver la posibilidad de apoyar el proyecto. Sin embargo, por las fechas de fin e inicio de año y las agendas, la sesión de trabajo se pudo realizar hasta el 8 de febrero de 2023. En esa oportunidad participaron los representantes del AyA, Región Chorotega, representantes de las ASADAS Río Negro y Aguas Claras y miembros de la comunidad, se determinó que una de las ASADAS, cuenta con un estudio y que se podría considerar mucha viabilidad para desarrollar el proyecto, se coordinó realizar una nueva reunión con la participación del Ing. Guillermo Córdoba, para que valore las ofertas y la viabilidad del proyecto. La minuta de la sesión de trabajo se compartió con todos los interesados (Véanse folios consecutivos del 80 al 87, del expediente del proyecto.) En los folios siguientes del 89 al 93, se aprecian una seguidilla de correos electrónicos que nos involucran al Inder y a la ORAC del AyA Chorotega, para coordinar la siguiente reunión con el Ing. Guillermo Córdoba del Departamento de Acueductos del Inder. Esa reunión se realizó el día 12 de abril de 2023, de manera virtual, en esa sesión de trabajo, el Ing. Guillermo Córdoba manifestó que previamente se debía agotar el recurso con la ASADA San Isidro, porque se había avanzado mucho con ellos y recomendó que se debía pedir la intervención del Ingeniero Héctor Paniagua Alfaro, encargado de la ORAC San Carlos, para que interviniera ante la ASADA San Isidro, para tratar de motivarlos a retornar las riendas del proyecto. (véase folio 101). Esta gestión la realizó mediante un correo electrónico la Lcda. Liany Alfaro García, Ejecutivo Experto Fortalecimiento de la Asadas, ORAC Chorotega. Véanse folios 95 y 94 del expediente del proyecto. Mediante el oficio GSD-UEN-GAR-2023-01406, del 10 de mayo de 2023, suscrito por el ing. Héctor Paniagua Alfaro, dirigido a la ASADA San isidro, instándolos a continuar con el proceso del proyecto del Acueducto para el asentamiento Los Palmitos, ofreciéndoles asesoría técnica y apoyo desde esa instancia. (Véase folio 102 del expediente del proyecto). El 25 de mayo de 2023, mediante un correo electrónico dirigido al Ing. Héctor Paniagua, encargado de la ORAC San Carlos de Acueductos y Alcantarillados y haciendo referencia de contestación al oficio GSD-UEN-GAR-2023-01406, del 10 de mayo de 2023, manifiestan los representantes de la ASADA San Isidro de Aguas Claras, manifiestan los motivos por los cuales no van a continuar con el proyecto y es que no se encuentran en disposición de asumir los costos económicos que eso implica, además la Asamblea no les da permiso de nuevo en un proyecto incierto. (Véase documento visible a folio103 del expediente del proyecto). Véanse las apreciaciones del Ing. Guillermo Córdoba de Acueductos Rurales del Inder, ante esta posición de la ASADA San Isidro de Aguas Claras, que perdió el interés por continuar con el proyecto. (Folio 106 del expediente del proyecto).\n\nSOBRE EL FONDO DEL ASUNTO.\n\nDel relato continuo del avance del proyecto queda más que demostrado el gran interés que el Instituto de Desarrollo Rural y en especial La Oficina de Desarrollo Rural Territorial Upala, han mostrado para materializar este proyecto tan importante para la población del asentamiento Los Palmitos de Aguas Claras de Upala, como para el desarrollo de los proyectos productivos de la Oficina Territorial, sin embargo también está demostrado que no es un asunto que dependa exclusivamente del Instituto de Desarrollo Rural, como lo hacen ver los recurrentes, pues se trata como se ha dicho de etapas y procesos de viabilidad tanto técnicas como legales, que se deben ir desarrollando para ejecutar el proyecto, un dato importante a considerar es que este proyecto de mejoras al Acueducto existente administrado por la Asada de San Isidro de Aguas Claras, quienes, a través de su reforzamiento hídrico, se realizaría desde las fuentes de captación, abarcando y renovando el acueducto actual hasta llegar al asentamiento Los Palmitos, lo cual consistía en una gran oportunidad para toda la población beneficiaria del acueducto y no solamente al asentamiento, la inversión estimada superaba los 800 millones de colones. Lo anterior no quiere decir que el proyecto se terminó aquí, ahora debemos iniciar con una nueva ASADA, y nuevamente con el estudio técnico de factibilidad para el mejoramiento de sistema de la ASADA, toda vez que técnica, Jurídica y administrativamente corresponde así, en especial cuando el proyecto se financia con recursos públicos y debe de someterse a los procesos de licitación del estado”.\n\n \n\n Solicitan que se declare sin lugar el recurso.\n\n 3.- En los procedimientos seguidos se ha observado las prescripciones legales.\n\n Redacta la Magistrada Picado Brenes; y,\n\n CONSIDERANDO:\n\n I.- OBJETO DEL RECURSO. Los/as recurrentes manifiestan que durante los años 2013, 2014 y 2015 se hizo la adjudicación y entrega de aproximadamente 53 parcelas en el Asentamiento Los Palmitos en Aguas Claras, Upala. La entrega y aceptación se hizo sin los servicios públicos (agua, luz, y caminos), en espera de que estos fueran adquiridos con el pasar del tiempo. Entre el período 2017-2018 se terminó de construir los caminos y se concluyó lo relativo al servicio de electricidad, pero no el de agua. Desde el año 2014 se inició el proyecto hasta la fecha en que se aporta el recurso de amparo, se cuentan con el abastecimiento de agua potable, por lo que recurren a pozos artesanales y a pequeñas nacientes que hay en la zona para el líquido requerido en las parcelas. Acusan que, si bien han gestionado ante el INDER a lo largo del tiempo, no han tenido respuestas positivas de su parte y la dotación de riqueza hídrica ha quedado en promesa. En fechas 20 de julio, 12 de agosto, 23 de agosto, todas 2022 se remitieron correos electrónicos al jefe de la Oficina de Upala del INDER. Comentan que en la zona -el distrito de Aguas Claras, Upala- hay 3 asadas. El INDER les ha manifestado estar anuente a ayudarlos y que se está \"detrás del asunto\", pero, a la fecha de la interposición del recurso no se ha podido solucionar de forma concreta la problemática de la falta de agua. Reclaman que, a la fecha de interposición de este recurso, la situación denunciada continuaba.\n\nII.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:\n\na)    Mediante acuerdo de la Junta Directiva del Inder, en el artículo No. 2, Sesión Extraordinaria 033-2012, celebrada el 18 de setiembre de 2012, se acordó comprar las fincas que posteriormente conformarían el Asentamiento Los Palmitos de Aguas Claras de Upala, con una inversión de ¢ 1.216.382.024.00 recurso del Inder (véase el informe adjunto).\n\nb)   Durante los años 2013, 2014 y 2015, mediante la aplicación del mecanismo establecido en las leyes y reglamentos del Inder, se realizaron varios estudios socioeconómicos que permitieron declarar elegibles del Instituto, en el programa de dotación de tierras, en la modalidad de parcelas, al menos a 45 familias estudiadas del Grupo denominado Asociación de Agricultores Cerro Mogote, con los respectivos acuerdos de Junta Directiva. Los demás agricultores fueron obteniendo dicha modalidad de declatoria de elegible durante los años 2016, 2017 y 2018 (véase el informe adjunto).\n\nc)    Los proyectos de caminos y electrificación fueron iniciados y concluidos por el Inder en los años 2017 y 2018, mediante los procesos de licitación correspondientes, con inversiones por más de 370 millones de colones (véase el informe adjunto).\n\nd)   El proyecto a realizar para dotar de agua potable al Asentamiento Los Palmitos de Aguas Claras de Upala consiste en las mejoras al acueducto existente administrado por la Asada de San Isidro de Aguas Claras, el cual  a través de su reforzamiento hídrico lograría dotar del agua potable a la población del asentamiento debido a que existe la capacidad hídrica (véase el informe adjunto).\n\ne)    Para la ejecución de las obras se requería de la contratación de un estudio técnico un por parte de la Asada San Isidro de Aguas Claras que determine los requerimientos técnicos y, que pueda ser sometido a revisión y aprobación por parte del AyA (véase el informe adjunto).\n\nf)     El primer estudio técnico elaborado fue una inversión grande de parte de la Asada y de las personas del asentamiento; empero, el mismo no fue avalado por el AyA. Por tal razón, se realizó un nuevo estudio técnico que fue donado por el PNUD, pero que no fue aceptado porque había quedado incompleto, toda vez que no cumplía con algunos de los requerimientos; después, por el cambio de la norma técnica en el año 2017 (véase el informe adjunto).\n\ng)   En oficios Nos. UEN-GAR-2018-01004 del 16 de marzo de 2018 y UEN-GAR-2018-02078 del 05 de junio de 2018, denominados “Revisión de Estudio Técnico ASADA San Isidro de Peñas Blancas” y “Revisión de Estudio Técnico”, dirigidos a la Hidrotecnica de la Península S.A, y a la ASADA de San Isidro, respectivamente, el Ing. Luis Diego Alfaro Artavia, UEN Gestión de Acueductos Rurales del AyA consideró que el estudio técnico de factibilidad para el mejoramiento de sistema de la ASADA San Isidro de Aguas Claras, con sus respectivos planos, elaborados por la empresa Hidrotecnica de la Península y firmados por el Ing. Jonathan Cubero Rojas, no alcanzaron su aprobación. Para ello, debían hacer todas las aclaraciones descritas en dicho informe (véase el informe y la prueba adjunta).  \n\nh)   En oficio UEN-GAR-2018-03363 del 31 de agosto de 2018, denominado “Revisión de Estudio Técnico”, dirigido a la ASADA de San Isidro de Aguas Claras, el Ing. Luis Diego Alfaro Artavia, UEN Gestión de Acueductos Rurales del AyA, anunció que se procedió nuevamente a la revisión del estudio técnico de factibilidad para el mejoramiento de sistema de la ASADA San Isidro de Aguas Claras con sus respectivos planos y las aclaraciones aportadas por el Ing. Jonathan Cubero Rojas, vía electrónica el 16 de agosto de 2018, concluyéndose que el estudio técnico y sus correcciones cumple con los requerimientos mínimos para obtener su aprobación. Además, señaló que los planos del proyecto deberán someterse a la revisión del Departamento de Ingeniería del Inder, por lo que su aprobación quedará sujeta a las modificaciones que se le soliciten. Asimismo, se recordó que previo a la ejecución se recordó a la ASADA y /o contratista a cargo del proyecto que deberán tramitar la viabilidad ambiental del proyecto ante SETENA y registrar la responsabilidad profesional realizando el trámite de sellado de planos constructivos ante el Colegio Federado de Ingenieros y Arquitectos de Costa Rica (CFIA), así como gestionar los permisos para intervenir las rutas nacionales y cantonales ante el CONAVI y las municipalidades respectivas (véase el informe y la prueba adjunta).\n\ni)     Mediante oficio OTUP-331-2019 del 29 de julio de 2019, la Oficina de Desarrollo Territorial Upala del Inder solicitó al Ing. Guillermo Córdoba Madrigal, encargado de los acueductos rurales y miembro de la Comisión Bipartita AyA-INDER, un informe del avance del proyecto del acueducto del asentamiento Los Palmitos (véase el informe y la prueba adjunta).\n\nj)     En correo electrónico del 20 de noviembre de 2019, el Ing. Guillermo Córdoba Madrigal mencionó que desde el punto de vista técnico sería necesario una revisión profunda de los planos constructivos, lo cual implicaba una revisión de escritorio y posteriormente una visita de campo, de manera que se le estaría informando al consultor todos los detalles que debían ser corregidos para que el Inder pudiese licitar la obra (véase el informe y la prueba adjunta).\n\nk)   Con motivo de la pandemia de COVID-19, la Oficina de Desarrollo Territorial Upala tomó la decisión de comprar un tanque de agua e instalarlo en un vehículo para repartir agua potable a todas las familias del asentamiento que así lo requerían y como medida paliativa se realizó un diseño de emergencia con la ASADA para la dotación de unas fuentes públicas de agua potable en lugares estratégicos del asentamiento; sin embargo dicho proyecto no fue aprobado por la gerencia del Inder (véase el informe y la prueba adjunta).\n\nl)     Entre los meses de octubre de 2020 y febrero de 2021, continuando con la coordinación con la ASADA San Isidro de Aguas Claras, la Oficina de Desarrollo Territorial Upala realizó la gestión para otorgar un crédito a la ASADA mediante el Programa de Crédito Rural del Inder para la compra de un lote donde se instalaría un tanque de captación (véase el informe y la prueba adjunta).\n\nm) El 09 de junio de 2021 se realizó una reunión virtual con la participación de miembros de la ASADA de San Isidro, representantes del Asentamiento Los Palmitos, el Jefe de la Oficina del Inder en Upala y el Ing. Guillermo Córdoba, Departamento de Acueductos Rurales y miembro de la Comisión Bipartita AyA-INDER, en la cual se hizo una valoración del avance del proyecto y se determinó que existe debilidad en algunas acciones tales como, por ejemplo, que una servidumbre pasa por una propiedad privada y se debe de obtener los permisos; que no se han podido gestionar los permisos constructivos porque todavía la Comisión AyA- INDER no ha obtenido de parte de la empresa que lo elaboró el estudio técnico; que no se ha responsabilizado en la corrección de los planos originales; que les falta mucho detalle y sin eso no se puede realizar la licitación. Tampoco quiere firmar las modificaciones si otro ingeniero las realiza ni la inscripción de la responsabilidad profesional. Aunado a lo anterior, el Ing. Córdoba manifestó que el proyecto tiene un valor aproximado de 600 millones de colones y que se va a acompañar el proyecto durante la ejecución con el apoyo del AyA (véase el informe y la prueba adjunta).\n\nn)   El 18 de agosto de 2021, se realizó una reunión virtual con la participación con la participación de miembros de la ASADA de San Isidro, el jefe de la Oficina del Inder Upala y el Ing. Guillermo Córdoba, donde se hizo una valoración del avance del proyecto y se comentaron las debilidades que persisten, por ejemplo, que el tanque no cabe en el terreno que se compró y, que se debe de hacer un nuevo plano y comprar más terreno. Respecto a los planos, el Ing. Guillermo Córdoba informó que puede colaborar con los servicios de un dibujante, siendo que la Asada cubría los costos de hospedaje y alimentación (véase el informe y la prueba adjunta).\n\no)   El 20 de julio de 2022, Mirey Lara, de la Asociación Palmitos, remitió un correo electrónico al jefe de la Oficina de Desarrollo Territorial Upala respecto a la necesidad que sufre el Asentamiento Los Palmitos en Aguas Claras de Upala de Agua Potable. Dicho correo también fue enviado a la Contraloría de Servicios del Inder (véase el informe y la prueba adjunta).\n\np)   Mediante oficio INDERGG-DRT-RDHN-OTUP-0217-2022 del 1º de agosto de 2022, la Contraloría de Servicios del Inder emitió respuesta al correo remitido el 1º de julio de 2022, en el cual detalló todas las situaciones que han ocurrido en relación al proceso de infraestructura del Inder (véase el informe y la prueba adjunta).\n\nq)   Los habitantes del asentamiento informaron al Inder durante los meses de octubre y noviembre de 2022 que existía mucho interés de parte de las ASADAS Río Negro y Aguas Claras en dotar de agua a dicha comunidad. Al efecto, se ha coordinado con la Licda. Leslie Campos Castro, quien es la Ejecutivo Especialista del Fortalecimiento de las Asada de Acueductos y Alcantarillados de la Región Chorotega, quien ha manifestado un gran interés por realizar las coordinaciones correspondientes para conocer las factibilidades de las dos ASADAS y ver la posibilidad de apoyar el proyecto (véase el informe adjunto).\n\nr)     El 08 de febrero de 2023, se realizó una sesión de trabajo donde participaron los representantes del AyA, Región Chorotega, representantes de las ASADAS Río Negro y Aguas Claras, así como los miembros del asentamiento, en la cual se determinó que una de las ASADAS cuenta con un estudio y que se podría considerar mucha viabilidad para desarrollar el proyecto. Por tal motivo, se coordinó una nueva reunión con la participación del Ing. Guillermo Córdoba; ello, con el fin de que valore las ofertas y la viabilidad del proyecto. La minuta de la sesión de trabajo se compartió con todos los interesados (véase el informe y la prueba adjunta). \n\ns)    El 12 de abril de 2023, se realizó una reunión con el Ing. Guillermo Córdoba del Departamento de Acueductos del Inder de manera virtual, ocasión en que el Ing. Guillermo Córdoba manifestó que previamente se debía agotar el recurso con la ASADA San Isidro, porque se había avanzado mucho con ellos y recomendó que se debía pedir la intervención del Ing. Héctor Paniagua Alfaro, encargado de la ORAC San Carlos para que interviniera ante la ASADA San Isidro y así tratar de motivarlos a retornar las riendas del proyecto. Esa gestión la realizó la Lcda. Liany Alfaro García, Ejecutivo Experto Fortalecimiento de la Asadas, ORAC Chorotega mediante un correo electrónico (véase el informe adjunto).\n\nt)     Mediante oficio GSD-UEN-GAR-2023-01406 del 10 de mayo de 2023, dirigido a la ASADA San Isidro de aguas Claras, el ing. Héctor Paniagua Alfaro, UEN Gestión de Acueductos Rurales del AyA instó a dicha asociación a continuar con el proceso del proyecto del acueducto para el asentamiento Los Palmitos, ofreciéndoles asesoría técnica y apoyo desde esa instancia (véase el informe adjunto).\n\nu)   El 25 de mayo de 2023, la Junta Directiva de la ASADA San Isidro de Aguas Claras, remitió un correo electrónico al Ing. Héctor Paniagua, en el cual manifestaron los motivos por los cuales no van a continuar con el proyecto de dotar de agua potable al Asentamiento Los Palmitos, pues  no se encuentran en disposición de asumir los costos económicos que eso implica. Además, detallaron que la Asamblea no lee dará permiso para invertir en un proyecto que es incierto (véase el informe adjunto).\n\nIII.- HECHO NO PROBADO. No se estima demostrado el siguiente hecho de relevancia para esta resolución:\n\nÚnico. Que el Inder haya resuelto de forma definitiva el problema de abastecimiento de agua potable del Asentamiento Los Palmitos de Aguas Claras de Upala.\n\n IV.- SOBRE EL FONDO. En el sub lite, del estudio del expediente y del informe rendido bajo juramento por la autoridad recurrida, se tiene por acreditado que mediante acuerdo de la Junta Directiva del Inder, en el artículo No. 2, Sesión Extraordinaria 033-2012, celebrada el 18 de setiembre de 2012, se acordó comprar las fincas que posteriormente conformarían el Asentamiento Los Palmitos de Aguas Claras de Upala, con una inversión de ¢ 1.216.382.024.00 recurso del Inder. Consta que los proyectos de caminos y electrificación fueron iniciados y concluidos por el Inder en los años 2017 y 2018, mediante los procesos de licitación correspondientes, con inversiones por más de 370 millones de colones.\n\nAhora bien, del informe adjunto se corrobora que el proyecto a realizar para dotar de agua potable al Asentamiento Los Palmitos de Aguas Claras de Upala consiste en las mejoras al acueducto existente administrado por la Asada de San Isidro de Aguas Claras, el cual  a través de su reforzamiento hídrico lograría dotar del agua potable a la población del asentamiento debido a que existe la capacidad hídrica. Para la ejecución de las obras se requería de la contratación de un estudio técnico un por parte de la Asada San Isidro de Aguas Claras que determine los requerimientos técnicos y, que pueda ser sometido a revisión y aprobación por parte del AyA. En ese línea de ideas, del elenco de hechos probados se determinaron  las siguiente actuaciones: En oficios Nos. UEN-GAR-2018-01004 del 16 de marzo de 2018 y UEN-GAR-2018-02078 del 05 de junio de 2018, denominados “Revisión de Estudio Técnico ASADA San Isidro de Peñas Blancas” y “Revisión de Estudio Técnico”, dirigidos a la Hidrotecnica de la Península S.A, y a la ASADA de San Isidro, respectivamente, el Ing. Luis Diego Alfaro Artavia, UEN Gestión de Acueductos Rurales del AyA consideró que el estudio técnico de factibilidad para el mejoramiento de sistema de la ASADA San Isidro de Aguas Claras, con sus respectivos planos, elaborados por la empresa Hidrotecnica de la Península y firmados por el Ing. Jonathan Cubero Rojas, no alcanzaron su aprobación. Para ello, debían hacer todas las aclaraciones descritas en dicho informe. En oficio UEN-GAR-2018-03363 del 31 de agosto de 2018, denominado “Revisión de Estudio Técnico”, dirigido a la ASADA de San Isidro de Aguas Claras, el Ing. Luis Diego Alfaro Artavia, UEN Gestión de Acueductos Rurales del AyA, anunció que se procedió nuevamente a la revisión del estudio técnico de factibilidad para el mejoramiento de sistema de la ASADA San Isidro de Aguas Claras con sus respectivos planos y las aclaraciones aportadas por el Ing. Jonathan Cubero Rojas, vía electrónica el 16 de agosto de 2018, concluyéndose que el estudio técnico y sus correcciones cumple con los requerimientos mínimos para obtener su aprobación. Además, señaló que los planos del proyecto deberán someterse a la revisión del Departamento de Ingeniería del Inder, por lo que su aprobación quedará sujeta a las modificaciones que se le soliciten. Asimismo, se recordó que previo a la ejecución se recordó a la ASADA y /o contratista a cargo del proyecto que deberán tramitar la viabilidad ambiental del proyecto ante SETENA y registrar la responsabilidad profesional realizando el trámite de sellado de planos constructivos ante el Colegio Federado de Ingenieros y Arquitectos de Costa Rica (CFIA), así como gestionar los permisos para intervenir las rutas nacionales y cantonales ante el CONAVI y las municipalidades respectivas. Mediante oficio OTUP-331-2019 del 29 de julio de 2019, la Oficina de Desarrollo Territorial Upala del Inder solicitó al Ing. Guillermo Córdoba Madrigal, encargado de los acueductos rurales y miembro de la Comisión Bipartita AyA-INDER, un informe del avance del proyecto del acueducto del asentamiento Los Palmitos. En correo electrónico del 20 de noviembre de 2019, el Ing. Guillermo Córdoba Madrigal mencionó que desde el punto de vista técnico sería necesario una revisión profunda de los planos constructivos, lo cual implicaba una revisión de escritorio y posteriormente una visita de campo, de manera que se le estaría informando al consultor todos los detalles que debían ser corregidos para que el Inder pudiese licitar la obra. Con motivo de la pandemia de COVID-19, la Oficina de Desarrollo Territorial Upala tomó la decisión de comprar un tanque de agua e instalarlo en un vehículo para repartir agua potable a todas las familias del asentamiento que así lo requerían y como medida paliativa se realizó un diseño de emergencia con la ASADA para la dotación de unas fuentes públicas de agua potable en lugares estratégicos del asentamiento; sin embargo dicho proyecto no fue aprobado por la gerencia del Inder. Entre los meses de octubre de 2020 y febrero de 2021, continuando con la coordinación con la ASADA San Isidro de Aguas Claras, la Oficina de Desarrollo Territorial Upala realizó la gestión para otorgar un crédito a la ASADA mediante el Programa de Crédito Rural del Inder para la compra de un lote donde se instalaría un tanque de captación. El 09 de junio de 2021 se realizó una reunión virtual con la participación de miembros de la ASADA de San Isidro, representantes del Asentamiento Los Palmitos, el Jefe de la Oficina del Inder en Upala y el Ing. Guillermo Córdoba, Departamento de Acueductos Rurales y miembro de la Comisión Bipartita AyA-INDER, en la cual se hizo una valoración del avance del proyecto y se determinó que existe debilidad en algunas acciones tales como, por ejemplo, que una servidumbre pasa por una propiedad privada y se debe de obtener los permisos; que no se han podido gestionar los permisos constructivos porque todavía la Comisión AyA- INDER no ha obtenido de parte de la empresa que lo elaboró el estudio técnico; que no se ha responsabilizado en la corrección de los planos originales; que les falta mucho detalle y sin eso no se puede realizar la licitación. Tampoco quiere firmar las modificaciones si otro ingeniero las realiza ni la inscripción de la responsabilidad profesional. Aunado a lo anterior, el Ing. Córdoba manifestó que el proyecto tiene un valor aproximado de 600 millones de colones y que se va a acompañar el proyecto durante la ejecución con el apoyo del AyA. El 18 de agosto de 2021, se realizó una reunión virtual con la participación con la participación de miembros de la ASADA de San Isidro, el jefe de la Oficina del Inder Upala y el Ing. Guillermo Córdoba, donde se hizo una valoración del avance del proyecto y se comentaron las debilidades que persisten, por ejemplo, que el tanque no cabe en el terreno que se compró y, que se debe de hacer un nuevo plano y comprar más terreno. Respecto a los planos, el Ing. Guillermo Córdoba informó que puede colaborar con los servicios de un dibujante, siendo que la Asada cubría los costos de hospedaje y alimentación. El 20 de julio de 2022, Mirey Lara, de la Asociación Palmitos, remitió un correo electrónico al jefe de la Oficina de Desarrollo Territorial Upala respecto a la necesidad que sufre el Asentamiento Los Palmitos en Aguas Claras de Upala de Agua Potable. Dicho correo también fue enviado a la Contraloría de Servicios del Inder. Mediante oficio INDERGG-DRT-RDHN-OTUP-0217-2022 del 1º de agosto de 2022, la Contraloría de Servicios del Inder emitió respuesta al correo remitido el 1º de julio de 2022, en el cual detalló todas las situaciones que han ocurrido en relación al proceso de infraestructura del Inder.\n\nEn el informe adjunto, los representantes de la autoridad recurrida subrayaron que los habitantes del asentamiento informaron al Inder durante los meses de octubre y noviembre de 2022 que existía mucho interés de parte de las ASADAS Río Negro y Aguas Claras en dotar de agua a dicha comunidad. Al efecto, se ha coordinado con la Licda. Leslie Campos Castro, quien es la Ejecutivo Especialista del Fortalecimiento de las Asada de Acueductos y Alcantarillados de la Región Chorotega, quien ha manifestado un gran interés por realizar las coordinaciones correspondientes para conocer las factibilidades de las dos ASADAS y ver la posibilidad de apoyar el proyecto. En ese contexto, se coteja que el 08 de febrero de 2023 se realizó una sesión de trabajo donde participaron los representantes del AyA, Región Chorotega, representantes de las ASADAS Río Negro y Aguas Claras, así como los miembros del asentamiento, en la cual se determinó que una de las ASADAS cuenta con un estudio y que se podría considerar mucha viabilidad para desarrollar el proyecto. Por tal motivo, se coordinó una nueva reunión con la participación del Ing. Guillermo Córdoba; ello, con el fin de que valore las ofertas y la viabilidad del proyecto. La minuta de la sesión de trabajo se compartió con todos los interesados. El 12 de abril de 2023, se realizó una reunión con el Ing. Guillermo Córdoba del Departamento de Acueductos del Inder de manera virtual, ocasión en que el Ing. Guillermo Córdoba manifestó que previamente se debía agotar el recurso con la ASADA San Isidro, porque se había avanzado mucho con ellos y recomendó que se debía pedir la intervención del Ing. Héctor Paniagua Alfaro, encargado de la ORAC San Carlos para que interviniera ante la ASADA San Isidro y así tratar de motivarlos a retornar las riendas del proyecto. Esa gestión la realizó la Lcda. Liany Alfaro García, Ejecutivo Experto Fortalecimiento de la Asadas, ORAC Chorotega mediante un correo electrónico. Mediante oficio GSD-UEN-GAR-2023-01406 del 10 de mayo de 2023, dirigido a la ASADA San Isidro de aguas Claras, el ing. Héctor Paniagua Alfaro, UEN Gestión de Acueductos Rurales del AyA instó a dicha asociación a continuar con el proceso del proyecto del acueducto para el asentamiento Los Palmitos, ofreciéndoles asesoría técnica y apoyo desde esa instancia. No obstante, el 25 de mayo de 2023 la Junta Directiva de la ASADA San Isidro de Aguas Claras remitió un correo electrónico al Ing. Héctor Paniagua, en el cual manifestaron los motivos por los cuales no van a continuar con el proyecto de dotar de agua potable al Asentamiento Los Palmitos, pues  no se encuentran en disposición de asumir los costos económicos que eso implica. Además, detallaron que la Asamblea no lee dará permiso para invertir en un proyecto que es incierto.\n\n En la especie, considera esta Sala que la inercia que reclaman los/as parte recurrentes en el escrito de interposición, bajo las circunstancias que se constatan en los autos, efectivamente constituye una vulneración abierta y grosera de los derechos fundamentales de los vecinos del Asentamiento Los Palmitos de Aguas Claras de Upala. Al respecto, adviértase que de los autos a todas luces se verifica la falta del servicio de agua potable en el sector indicado. En ese sentido, si bien se demostró que se han realizado algunas actuaciones desde el año 2018, por ejemplo, estudio, reuniones y coordinaciones entre instituciones competentes; ello, con el fin de encontrar una solución a la problemática descrita, lo cierto del caso es que  no consta fehacientemente que el Inder haya realizado los esfuerzos suficientes para solventar de manera definitiva al problema de abastecimiento de agua potable que sufre el Asentamiento Los Palmitos de Aguas Claras de Upala. Así las cosas, procede declarar con lugar el recurso, en los términos que se dirán en la parte dispositiva de este pronunciamiento. \n\nV.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPOR TANTO:\n\n Se declara con lugar el recurso. Se ordena a  Osvaldo Artavia Carballo, en su condición de Presidente Ejecutivo, y a Manrique Antonio Jiménez Castro, en su condición de Jefe de la Oficina Territorial de Upala, ambos del Instituto de Desarrollo Rural, o a quienes en sus lugares  ocupen tales cargos, que dispongan de forma coordinada, así como demás órganos competentes, las órdenes y medidas necesarias a fin de dar solución definitiva al problema de abastecimiento de agua potable en el Asentamiento Los Palmitos de Aguas Claras de Upala; ello, dentro de un término de VEINTICUATRO MESES, contado a partir de la notificación de la sentencia. The delivery and acceptance were made without public services (water, electricity, and roads), in the hope that these would be acquired over time. Between the 2017-2018 period, the construction of roads was completed and the matter of electricity service was concluded, but not that of water. From the year 2014 when the project began until the date the amparo action was filed, they lack a potable water supply, resorting to artisanal wells and small springs (pequeñas nacientes) existing in the area for the liquid required on the plots. They allege that, although they have petitioned INDER over time, they have not had positive responses from it and the provision of water resources has remained a promise. On July 20, August 12, and August 23, all in 2022, emails were sent to the head of the Upala Office of INDER (see evidence provided). They comment that in the area—the district of Aguas Claras, Upala—there are 3 ASADAs. INDER has stated it is willing to help them and that it is \"on top of the matter\" (see some official letters provided as evidence), but, as of the date the action was filed, the problem of the lack of water could not be resolved concretely. They claim that, as of the date of filing this action, the denounced situation continued. They consider that the foregoing violates their fundamental rights, especially those of elderly persons in a state of vulnerability. They request that the action be granted, with the consequences of law.\n\n**2.-** Osvaldo Artavia Carballo, in his capacity as Executive President, and Manrique Antonio Jiménez Castro, in his capacity as Head of the Territorial Office of Upala, both of INDER, report under oath that:\n\n\"This is not true: The correct fact is that, by means of the respective agreement of the Board of Directors of Inder, in Article No. 2, Extraordinary Session 033-2012, held on September 18, 2012, it was agreed to purchase the properties that would later form the Los Palmitos Settlement of Aguas Claras of Upala, with an investment of ¢ 1,216,382,024.00 from Inder resources. During the subsequent years 2013, 2014, and 2015, through the application of the mechanism established in the laws and regulations of the institution, several socioeconomic studies were conducted that allowed declaring eligible by the Institute, in the land grant program, in the form of plots, at least 45 families studied from the Group called Asociación de Agricultores Cerro Mogote, with the respective Board of Directors agreements; the remaining farmers obtained this form of eligibility declaration during the years 2016, 2017, and 2018. The road and electrification projects were initiated and completed in 2017 and 2018, through the corresponding bidding processes, with investments of more than 370 million colones.\n\n(…)\n\nThis statement is not true: Note that, for the mentioned date of 2014, the undersigned head of the Territorial Development Office of Upala did not serve as such, as that delegation occurred starting May 15, 2017. However, there are records attesting that the placement in possession of the first plots occurred in 2014; nevertheless, it was warned that they could not inhabit the plots until they had the necessary public services. Now, regardless of whether it was 2014, 2015, or 2016, the purpose of Inder is to finance the cost of the necessary infrastructure to provide an adequate aqueduct to satisfy the needs of the families and the productive project, as happened with the road and electrification projects that were built to the full satisfaction of the users during the subsequent years 2017 and 2018 (and as is customary in most Inder settlements). What happened with the potable water aqueduct? Well, Inder has the economic resources to finance the work, as stated before; however, Inder cannot simply say, 'I am going to build an aqueduct'; for that, the participation of other public institutions is required, such as the governing body which is the Instituto Costarricense de Acueductos y Alcantarillados, which is the institution committed to the well-being and development of the country, through the exercise of its stewardship and the sustainable provision of potable water service and sanitation by complying with the requirements of its users and other relevant interested parties, and the legal and regulatory requirements, for which it relies on its Quality Management System and promotes the continuous improvement of its processes.\"\n\nThey cite the Constitutive Law of the Instituto Costarricense de Acueductos y Alcantarillados No. 2726 of August 27, 1961.\"\n\nThey continue:\n\n\"In accordance with the cited legislation and adjusting to the indications of Acueductos y Alcantarillados, the project to be carried out consisted of improvements to the existing aqueduct administered by the ASADA of San Isidro de Aguas Claras, which, through its water resource reinforcement, would manage to provide potable water to the population of the Los Palmitos Settlement, since the water capacity exists. Thus, the initial coordinations were carried out by the community with the ASADA San Isidro de Aguas Claras, which would provide potable water to the settlement. For these purposes, there is the consent of INDER for the execution of the works, but the ASADA San Isidro de Aguas Claras is required to contract a Technical Study that determines the technical requirements and that can be submitted for review and approval by AyA. In this regard, we can see at folio 103 of the administrative file for the aqueduct project for the Los Palmitos settlement, it can be seen according to statements from the representatives of the ASADA of the San Isidro de Aguas Claras Aqueduct, that since 2015, we have tried to jointly carry out the settlement project with Inder. The first technical study was a large investment by the ASADA and the people of the settlement, but it was not endorsed by AyA; a new technical study was carried out that was donated by PNUD, but it was not accepted because it was incomplete, because it did not meet some of the requirements, and later due to the change in the technical standard in 2017. In this regard, it can be seen in folios 1 and 2 of official letter No. UEN-GAR-2018-01004, dated March 16, 2018, of the attached file, the reasons why the engineer Luis Diego Alfaro Artavia, UEN Gestión de Acueductos Rurales, considers that the technical feasibility study for the improvement of the system of the ASADA San Isidro de Aguas Claras, with its respective plans prepared by the company Hidrotecnica de la Península and signed by Eng. Jonathan Cubero Rojas, does not attain his approval; for this, they must make all the clarifications described in that report. See folio 3, an email of the efforts of the Social Manager of the Instituto de Acueductos y Alcantarillados to the ASADA of San Isidro, as a follow-up to the INDER project, where it is warned that AyA must give its approval to the Technical Study prepared by PNUD, so that it can be transferred to INDER and thus continue the process. Likewise, official letter UEN-GAR-2018-02078, dated June 5, 2018, addressed to the ASADA of San Isidro by Eng. Luis Diego Alfaro Artavia, UEN Gestión de Acueductos Rurales, warns that the technical feasibility study for the improvement of the system of the ASADA San Isidro de Aguas Claras, with its respective plans prepared by the company Hidrotecnica de la Península and signed by Eng. Jonathan Cubero Rojas, does not attain his approval. Finally, through official letter UEN-GAR-2018-03363, dated August 31, 2018, visible at folio 17 of the file, addressed to the ASADA of San Isidro by Eng. Luis Diego Alfaro Artavia, UEN Gestión de Acueductos Rurales, he announces that the technical feasibility study for the improvement of the system of the ASADA San Isidro de Aguas Claras, with its respective plans and the clarifications provided by Eng. Jonathan Cubero Rojas electronically on August 16, 2018, was reviewed again, and it is concluded that the technical study and its corrections meet the minimum requirements to obtain his approval. He points out that the project plans must be submitted for review by the Engineering Department of the Instituto de Desarrollo Rural (INDER), so their approval will be subject to the modifications requested (take note that there is an Engineering Department of INDER, which jointly with AyA follows up on and coordinates everything related to this project). Prior to execution, the ASADA and/or contractor in charge of the project is reminded that they must process the environmental feasibility (viabilidad ambiental) of the project before SETENA and register the professional responsibility by carrying out the process of sealing construction plans before the Colegio Federado de Ingenieros y Arquitectos de Costa Rica (CFIA), and manage the permits to intervene national and cantonal routes before CONAVI and the respective municipalities. See so far, that to develop a project of this nature, many variables and technical and legal feasibilities must be considered that must be resolved by the ASADA to achieve technical and legal feasibility. While this is being developed, the inhabitants of the Los Palmitos settlement send notes and requests to the President of the Republic and to Inder, expressing their discomfort because the institutions involved, for 6 years, have done nothing to resolve their lack of potable water situation (see consecutive folios 18 to 22 of the project file). Through official letter OTUP-331-2019, dated July 29, 2019 (folios 23 and 24), the Territorial Development Office Upala requested Eng. Guillermo Córdoba Madrigal, responsible for rural aqueducts and member of the Bipartite Commission AyA-INDER, a report on the progress of the aqueduct project for the Los Palmitos settlement. In the following months, significant progress is achieved by the ASADA regarding procedures to obtain municipal and national permits for road disruption, as well as permits and feasibility from SETENA. However, Eng. Guillermo Córdoba Madrigal, in an email addressed to all those involved in the project, mentions that from a technical point of view, a deep review of the construction plans will be necessary, which implies a desktop review and subsequently a field visit, so the consultant will be informed of all the details that must be corrected for Inder to tender the work. A visit will be scheduled for the month of January 2020. See folio 25. Due to the COVID-19 pandemic, the Territorial Development Office Upala made the decision to purchase a water tank and install it in a vehicle to distribute potable water to all the families of the settlement who required it, and as a palliative measure, an emergency design was carried out with the ASADA for the provision of public sources of potable water in strategic locations of the settlement. The project was presented to the management of Inder, but it was not approved. The distribution of water was indeed carried out between two and three times a week to the settlement during the pandemic (See folios 33 to 52 of the file). Between October 2020 and February 2021, continuing the coordination with the ASADA San Isidro de Aguas Claras, the Territorial Development Office Upala made the effort to grant a credit to the ASADA through the Rural Credit Program of Inder, to grant a credit to the ASADA for the purchase of a lot where a collection tank would be installed. (See folios 55 to 60 of the file). On June 9, 2021, a virtual meeting was held with the participation of members of the ASADA of San Isidro, representatives of the Los Palmitos Settlement, the Head of the Inder Upala Office, and Eng. Guillermo Córdoba, from the Rural Aqueducts Department of Inder. In summary, an assessment of the project's progress was made, and it was determined that there is weakness in some actions, such as, for example, that an easement (servidumbre) passes through a private property and permits must be obtained; construction permits have not been able to be processed because the AyA-INDER Commission has not yet obtained from the company that prepared the Technical Study a commitment to take responsibility for the correction of the original plans; they lack much detail, and without that, the tender cannot be carried out. It also does not want to sign the modifications if another engineer carries them out, nor the registration of professional responsibility. Engineer Córdoba states that the project has an approximate value of 600 million colones and that the project will be supported during execution with the help of AyA. (See the complete minutes in folios 61 to 65). On August 18, 2021, a virtual meeting was held with the participation of members of the ASADA of San Isidro, the head of the Inder Upala Office, and Eng. Guillermo Córdoba, from the Rural Aqueducts Department of Inder. In summary, an assessment of the project's progress was made, and the weaknesses that persist were discussed. For example, that the tank does not fit on the purchased land; a new plan must be made and more land purchased. Regarding the plans, Eng. Guillermo Córdoba informs that he can collaborate with the services of a draftsman; the ASADA covers the costs of lodging and food. Regarding the consultant that PNUD contracted, he does not take responsibility for the corrections; the ASADA must define whether it sues him or takes other actions against him. (See the complete minutes in folios 66 to 69).\n\n(…)\n\nThis fact is not true. The reference email addressed to the head of the Territorial Development Office Upala, on July 20, 2022, was initially sent to most Departments of Inder, including the Services Comptroller, and a reply was given to all, including the inhabitants of the settlement, through official letter INDERGG-DRT-RDHN-OTUP-0217›2022 on August 1, 2022, reporting in detail all the situations that have occurred. (See folios 70 to 79). On several occasions, we have tried to make contact with the ASADA of San Isidro, but we have been told, including by members of the settlement, that they have stated they are not interested in continuing the project. The inhabitants of the settlement have informed us during the months of October and November that there is much interest on the part of the other ASADAs, Río Negro and Aguas Claras, in providing water to the settlement. To address the issue, we have coordinated with Licda. Leslie Campos Castro, who is the Specialist Executive for Strengthening the ASADAs of Acueductos y Alcantarillados of the Chorotega Region, because these ASADAs belong to that region, and she has expressed great interest in carrying out the corresponding coordination to determine the feasibilities of the two ASADAs and see the possibility of supporting the project. However, due to the year-end and year-start dates and schedules, the working session could not be held until February 8, 2023. On that occasion, representatives of AyA, Chorotega Region, representatives of the ASADAs Río Negro and Aguas Claras, and members of the community participated; it was determined that one of the ASADAs had a study and that considerable feasibility for developing the project could be considered. It was coordinated to hold a new meeting with the participation of Eng. Guillermo Córdoba, so that he could assess the offers and the feasibility of the project. The minutes of the working session were shared with all interested parties (See consecutive folios 80 to 87 of the project file). In the following folios 89 to 93, a string of emails can be seen involving Inder and the ORAC of AyA Chorotega, to coordinate the next meeting with Eng. Guillermo Córdoba of the Aqueducts Department of Inder. That meeting was held on April 12, 2023, virtually. In that working session, Eng. Guillermo Córdoba stated that the resource with the ASADA San Isidro should first be exhausted, because much progress had been made with them, and recommended that the intervention of Engineer Héctor Paniagua Alfaro, head of the ORAC San Carlos, be requested so that he could intervene with the ASADA San Isidro to try to motivate them to retake the reins of the project (see folio 101). This procedure was carried out via email by Lcda. Liany Alfaro García, Expert Executive, Strengthening of the ASADAs, ORAC Chorotega. See folios 95 and 94 of the project file. Through official letter GSD-UEN-GAR-2023-01406, dated May 10, 2023, signed by Eng. Héctor Paniagua Alfaro, addressed to the ASADA San Isidro, urging them to continue the process of the Aqueduct project for the Los Palmitos settlement, offering technical advice and support from that body. (See folio 102 of the project file). On May 25, 2023, by email addressed to Eng. Héctor Paniagua, head of the ORAC San Carlos of Acueductos y Alcantarillados, and referring in reply to official letter GSD-UEN-GAR-2023-01406 of May 10, 2023, the representatives of the ASADA San Isidro de Aguas Claras state the reasons why they will not continue the project, which is that they are not in a position to assume the economic costs that this entails; furthermore, the Assembly does not give them permission again for an uncertain project. (See document visible at folio 103 of the project file). See the assessments of Eng. Guillermo Córdoba of Rural Aqueducts of Inder, given this position of the ASADA San Isidro de Aguas Claras, which lost interest in continuing the project. (Folio 106 of the project file).\n\nREGARDING THE MERITS OF THE MATTER.\n\nFrom the continuous account of the project's progress, it is more than demonstrated the great interest that the Instituto de Desarrollo Rural and, especially, the Territorial Rural Development Office Upala have shown to materialize this project, so important for the population of the Los Palmitos de Aguas Claras de Upala settlement as well as for the development of the productive projects of the Territorial Office. However, it is also demonstrated that it is not a matter that depends exclusively on the Instituto de Desarrollo Rural, as the petitioners make it seem, since it involves, as stated, stages and processes of both technical and legal feasibility, which must be gradually developed to execute the project. An important fact to consider is that this project of improvements to the existing Aqueduct administered by the ASADA of San Isidro de Aguas Claras, which, through its water resource reinforcement, would be carried out from the catchment sources, encompassing and renovating the current aqueduct until reaching the Los Palmitos settlement, constituted a great opportunity for the entire beneficiary population of the aqueduct and not just for the settlement; the estimated investment exceeded 800 million colones. The foregoing does not mean that the project ended here; now we must start with a new ASADA, and again with the technical feasibility study for the improvement of the ASADA's system, since technically, legally, and administratively this is appropriate, especially when the project is financed with public resources and must be submitted to the state's bidding processes.\"\n\nThey request that the action be denied.\n\n**3.-** In the proceedings carried out, the legal requirements have been observed.\n\nDrafted by Judge Picado Brenes; and,\n\n**WHEREAS:**\n\n**I.- PURPOSE OF THE ACTION.** The petitioners state that during the years 2013, 2014, and 2015, the adjudication and delivery of approximately 53 plots took place in the Los Palmitos Settlement in Aguas Claras, Upala. The delivery and acceptance were made without public services (water, electricity, and roads), in the hope that these would be acquired over time. Between the 2017-2018 period, the construction of roads was completed and the matter of electricity service was concluded, but not that of water. From the year 2014 when the project began until the date the amparo action was filed, they lack a potable water supply, resorting to artisanal wells and small springs existing in the area for the liquid required on the plots. They allege that, although they have petitioned INDER over time, they have not had positive responses from it and the provision of water resources has remained a promise. On July 20, August 12, and August 23, all in 2022, emails were sent to the head of the Upala Office of INDER. They comment that in the area—the district of Aguas Claras, Upala—there are 3 ASADAs. INDER has stated it is willing to help them and that it is \"on top of the matter,\" but, as of the date the action was filed, the problem of the lack of water could not be resolved concretely. They claim that, as of the date of filing this action, the denounced situation continued.\n\n**II.- PROVEN FACTS.** For the decision of this matter, the following facts are deemed duly proven, either because they have been accredited as such or because the respondent omitted to refer to them as provided in the initial order:\n\na) By agreement of the Board of Directors of Inder, in Article No. 2, Extraordinary Session 033-2012, held on September 18, 2012, it was agreed to purchase the properties that would later form the Los Palmitos Settlement of Aguas Claras of Upala, with an investment of ¢ 1,216,382,024.00 from Inder resources (see the attached report).\n\nb) During the years 2013, 2014, and 2015, through the application of the mechanism established in the laws and regulations of Inder, several socioeconomic studies were conducted that allowed declaring eligible by the Institute, in the land grant program, in the form of plots, at least 45 families studied from the Group called Asociación de Agricultores Cerro Mogote, with the respective Board of Directors agreements. The remaining farmers obtained said form of eligibility declaration during the years 2016, 2017, and 2018 (see the attached report).\n\nc) The road and electrification projects were initiated and completed by Inder in the years 2017 and 2018, through the corresponding bidding processes, with investments of more than 370 million colones (see the attached report).\n\nd) The project to be carried out to provide potable water to the Los Palmitos Settlement of Aguas Claras of Upala consists of improvements to the existing aqueduct administered by the ASADA of San Isidro de Aguas Claras, which through its water resource reinforcement would manage to provide potable water to the settlement population because the water capacity exists (see the attached report).\n\ne) For the execution of the works, the contracting of a technical study by the ASADA San Isidro de Aguas Claras was required to determine the technical requirements, which could be submitted for review and approval by AyA (see the attached report).\n\nf) The first technical study prepared was a large investment by the ASADA and the people of the settlement; however, it was not endorsed by AyA. For this reason, a new technical study was carried out that was donated by PNUD, but it was not accepted because it had been left incomplete, since it did not meet some of the requirements; later, due to the change in the technical standard in 2017 (see the attached report).\n\ng) In official letters No. UEN-GAR-2018-01004 of March 16, 2018, and No. UEN-GAR-2018-02078 of June 5, 2018, called \"Review of Technical Study ASADA San Isidro de Peñas Blancas\" and \"Review of Technical Study,\" addressed to Hidrotecnica de la Península S.A. and to the ASADA of San Isidro, respectively, Eng. Luis Diego Alfaro Artavia, UEN Gestión de Acueductos Rurales of AyA, considered that the technical feasibility study for the improvement of the system of the ASADA San Isidro de Aguas Claras, with its respective plans, prepared by the company Hidrotecnica de la Península and signed by Eng. Jonathan Cubero Rojas, did not attain its approval. For this, they had to make all the clarifications described in that report (see the report and the attached evidence).\n\nh) In official letter UEN-GAR-2018-03363 of August 31, 2018, called \"Review of Technical Study,\" addressed to the ASADA of San Isidro de Aguas Claras, Eng. Luis Diego Alfaro Artavia, UEN Gestión de Acueductos Rurales of AyA, announced that the technical feasibility study for the improvement of the system of the ASADA San Isidro de Aguas Claras, with its respective plans and the clarifications provided by Eng. Jonathan Cubero Rojas electronically on August 16, 2018, was reviewed again, concluding that the technical study and its corrections met the minimum requirements to obtain its approval. Furthermore, he pointed out that the project plans must be submitted for review by the Engineering Department of Inder, so their approval will be subject to the modifications requested. Likewise, it was reminded that prior to execution, the ASADA and/or contractor in charge of the project must process the environmental feasibility of the project before SETENA and register the professional responsibility by carrying out the process of sealing construction plans before the Colegio Federado de Ingenieros y Arquitectos de Costa Rica (CFIA), as well as manage the permits to intervene national and cantonal routes before CONAVI and the respective municipalities (see the report and the attached evidence).\n\ni) Through official letter OTUP-331-2019 of July 29, 2019, the Inder Territorial Development Office Upala requested Eng. Guillermo Córdoba Madrigal, responsible for rural aqueducts and member of the Bipartite Commission AyA-INDER, a report on the progress of the aqueduct project for the Los Palmitos settlement (see the report and the attached evidence).\n\nj) In an email dated November 20, 2019, Eng.\n\nGuillermo Córdoba Madrigal mentioned that from a technical standpoint a thorough review of the construction plans would be necessary, which entailed a desktop review and subsequently a field visit, so that the consultant would be informed of all the details that needed to be corrected so that INDER could tender the work (see the report and attached evidence).\n\nk)   Due to the COVID-19 pandemic, the Upala Territorial Development Office made the decision to purchase a water tank and install it on a vehicle to distribute potable water to all the families of the settlement (asentamiento) that required it, and as a palliative measure an emergency design was carried out with the ASADA for the provision of public potable water sources (fuentes públicas de agua potable) in strategic locations of the settlement (asentamiento); however, said project was not approved by INDER’s management (see the report and attached evidence).\n\nl)     Between the months of October 2020 and February 2021, continuing the coordination with the ASADA San Isidro de Aguas Claras, the Upala Territorial Development Office undertook efforts to grant a loan to the ASADA through INDER’s Rural Credit Program (Programa de Crédito Rural) for the purchase of a lot where a collection tank (tanque de captación) would be installed (see the report and attached evidence).\n\nm) On June 9, 2021, a virtual meeting was held with the participation of members of the ASADA of San Isidro, representatives of the Los Palmitos Settlement (Asentamiento Los Palmitos), the Head of INDER’s Office in Upala, and Engineer Guillermo Córdoba of the Rural Aqueducts Department (Departamento de Acueductos Rurales) and member of the AyA-INDER Bipartite Commission (Comisión Bipartita AyA-INDER), in which an assessment of the project’s progress was made and it was determined that there are weaknesses in some actions, such as, for example, that an easement (servidumbre) crosses a private property and permits must be obtained; that construction permits have not been processed because the AyA-INDER Commission has not yet obtained them from the company that prepared the technical study; that it has not taken responsibility for the correction of the original plans; that they lack much detail and without that the tender cannot be carried out. Nor does it want to sign the modifications if another engineer makes them, nor the registration of professional responsibility. In addition to the above, Eng. Córdoba stated that the project has an approximate value of 600 million colones and that the project will be supported during execution with the assistance of AyA (see the report and attached evidence).\n\nn)   On August 18, 2021, a virtual meeting was held with the participation of members of the ASADA of San Isidro, the head of the INDER Upala Office, and Eng. Guillermo Córdoba, where an assessment of the project’s progress was made and the persisting weaknesses were discussed, for example, that the tank does not fit on the land that was purchased and that a new plan must be made and more land purchased. Regarding the plans, Eng. Guillermo Córdoba reported that he could collaborate with the services of a draftsperson, with the ASADA covering the lodging and food costs (see the report and attached evidence).\n\no)   On July 20, 2022, Mirey Lara, of the Asociación Palmitos, sent an email to the head of the Upala Territorial Development Office regarding the need for potable water suffered by the Los Palmitos Settlement (Asentamiento Los Palmitos) in Aguas Claras de Upala. Said email was also sent to INDER’s Services Comptroller’s Office (Contraloría de Servicios) (see the report and attached evidence).\n\np)   Through official communication INDERGG-DRT-RDHN-OTUP-0217-2022 of August 1, 2022, INDER’s Services Comptroller’s Office (Contraloría de Servicios) issued a response to the email sent on July 1, 2022, in which it detailed all the situations that have occurred in relation to INDER’s infrastructure process (see the report and attached evidence).\n\nq)   The inhabitants of the settlement (asentamiento) informed INDER during the months of October and November 2022 that there was significant interest on the part of the ASADAS Río Negro and Aguas Claras in providing water to said community. To that effect, coordination has been carried out with Licda. Leslie Campos Castro, who is the Executive Specialist for the Strengthening of the ASADAs of Aqueducts and Sewers (Ejecutivo Especialista del Fortalecimiento de las Asada de Acueductos y Alcantarillados) of the Chorotega Region, who has expressed great interest in carrying out the corresponding coordination to understand the feasibilities of the two ASADAs and to see the possibility of supporting the project (see the attached report).\n\nr)     On February 8, 2023, a working session was held with the participation of representatives of AyA, Chorotega Region, representatives of the ASADAS Río Negro and Aguas Claras, as well as members of the settlement (asentamiento), in which it was determined that one of the ASADAS has a study and that considerable viability could be considered for developing the project. For this reason, a new meeting was coordinated with the participation of Eng. Guillermo Córdoba, in order for him to assess the offers and the viability of the project. The minutes of the working session were shared with all interested parties (see the report and attached evidence).\n\ns)    On April 12, 2023, a virtual meeting was held with Eng. Guillermo Córdoba of INDER’s Aqueducts Department (Departamento de Acueductos), an occasion on which Eng. Guillermo Córdoba stated that the resource with the ASADA San Isidro had to be exhausted beforehand, because much progress had been made with them, and he recommended that the intervention of Eng. Héctor Paniagua Alfaro, head of the ORAC San Carlos, should be requested so that he could intervene before the ASADA San Isidro and thus try to motivate them to take up the reins of the project again. Héctor Paniagua Alfaro, UEN Rural Aqueduct Management (UEN Gestión de Acueductos Rurales) of AyA, urged said association to continue with the aqueduct project process for the Los Palmitos settlement (asentamiento), offering them technical advice and support from that office (see the attached report).\n\nu)   On May 25, 2023, the Board of Directors (Junta Directiva) of the ASADA San Isidro de Aguas Claras sent an email to Eng. Héctor Paniagua, in which they stated the reasons why they are not going to continue with the project to provide potable water to the Los Palmitos Settlement (Asentamiento Los Palmitos), as they are not in a position to assume the economic costs that this entails. Additionally, they detailed that the Assembly will not give them permission to invest in a project that is uncertain (see the attached report).\n\nIII.- UNPROVEN FACT. The following fact of relevance to this resolution is not deemed proven:\n\nSole. That INDER has definitively resolved the problem of potable water supply for the Los Palmitos Settlement (Asentamiento Los Palmitos) of Aguas Claras de Upala.\n\n IV.- ON THE MERITS. In the case at hand (sub lite), from the study of the case file and the report rendered under oath by the appealed authority, it is taken as accredited that by agreement of INDER’s Board of Directors (Junta Directiva), in Article No. 2, Extraordinary Session 033-2012, held on September 18, 2012, it was agreed to purchase the farms that would later form the Los Palmitos Settlement (Asentamiento Los Palmitos) of Aguas Claras de Upala, with an investment of ¢ 1,216,382,024.00 in INDER funds. It is inferred that during the years 2013, 2014, and 2015, through the application of the mechanism established in INDER’s laws and regulations, several socioeconomic studies were carried out that allowed at least 45 studied families from the Group called Asociación de Agricultores Cerro Mogote to be declared eligible by the Institute, under the land allocation program in the parcel modality, with the respective agreements of the Board of Directors (Junta Directiva). The other farmers obtained that modality of eligibility declaration during the years 2016, 2017, and 2018. It is recorded that the road and electrification projects were initiated and completed by INDER in the years 2017 and 2018, through the corresponding tender processes, with investments of more than 370 million colones.\n\nNow then, from the attached report it is corroborated that the project to be carried out to provide potable water to the Los Palmitos Settlement (Asentamiento Los Palmitos) of Aguas Claras de Upala consists of improvements to the existing aqueduct managed by the ASADA of San Isidro de Aguas Claras, which, through its hydrological reinforcement (reforzamiento hídrico), would be able to provide potable water to the settlement’s (asentamiento) population because the hydrological capacity exists. For the execution of the works, the contracting of a technical study by the ASADA San Isidro de Aguas Claras was required to determine the technical requirements and so that it could be submitted for review and approval by AyA. The first technical study prepared was a large investment on the part of the ASADA and the people of the settlement (asentamiento); however, it was not endorsed by AyA. For that reason, a new technical study was carried out, which was donated by UNDP, but it was not accepted because it was incomplete, since it did not meet some of the requirements; later, due to the change of the technical standard in the year 2017. In that line of thought, from the list of proven facts, the following actions were determined: In official communications Nos. UEN-GAR-2018-01004 of March 16, 2018, and UEN-GAR-2018-02078 of June 5, 2018, titled “Review of Technical Study ASADA San Isidro de Peñas Blancas” and “Review of Technical Study,” addressed to Hidrotecnica de la Península S.A., and to the ASADA of San Isidro, respectively, Eng. Luis Diego Alfaro Artavia, UEN Rural Aqueduct Management (UEN Gestión de Acueductos Rurales) of AyA, considered that the technical feasibility study for the improvement of the system of the ASADA San Isidro de Aguas Claras, with its respective plans, prepared by the company Hidrotecnica de la Península and signed by Eng. However, on May 25, 2023, the Board of Directors (Junta Directiva) of the ASADA San Isidro de Aguas Claras sent an email to Eng. Héctor Paniagua, in which they stated the reasons why they are not going to continue with the project to provide potable water to the Los Palmitos Settlement (Asentamiento Los Palmitos), as they are not in a position to assume the economic costs that this entails. Additionally, they detailed that the Assembly will not give them permission to invest in a project that is uncertain.\n\n In this case, this Chamber (Sala) considers that the inertia claimed by the appealing parties in the filing brief, under the circumstances verified in the case file, effectively constitutes an open and gross violation of the fundamental rights of the residents of the Los Palmitos Settlement (Asentamiento Los Palmitos) of Aguas Claras de Upala. In this regard, it should be noted that from the case file the lack of potable water service in the indicated sector is clearly verified. In that sense, although it was demonstrated that some actions have been carried out since 2018, for example, a study, meetings, and coordination among competent institutions, with the aim of finding a solution to the described problem, the truth of the matter is that it is not reliably proven that INDER has made sufficient efforts to definitively solve the potable water supply problem suffered by the Los Palmitos Settlement (Asentamiento Los Palmitos) of Aguas Claras de Upala. This being the case, it is appropriate to grant the appeal (recurso), under the terms that will be stated in the operative part of this ruling.\n\nV.- DOCUMENTATION PROVIDED TO THE CASE FILE. The parties are forewarned that if they have provided any paper document, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic device or one produced by new technologies, these must be retrieved from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the \"Regulation on Electronic Case Files before the Judicial Branch\" (Reglamento sobre Expediente Electrónico ante el Poder Judicial), approved by the Full Court (Corte Plena) in session N° 27-11 of August 22, 2011, article XXVI and published in Judicial Bulletin (Boletín Judicial) number 19 of January 26, 2012, as well as the agreement approved by the Superior Council of the Judicial Branch (Consejo Superior del Poder Judicial), in session N° 43-12 held on May 3, 2012, article LXXXI.\n\nTHEREFORE:\n\n The appeal (recurso) is granted. It is ordered that Osvaldo Artavia Carballo, in his capacity as Executive President, and Manrique Antonio Jiménez Castro, in his capacity as Head of the Territorial Office of Upala, both of the Rural Development Institute (Instituto de Desarrollo Rural, INDER), or whoever occupies those positions in their stead, issue in a coordinated manner, as well as the other competent bodies, the orders and measures necessary to definitively solve the potable water supply problem in the Los Palmitos Settlement (Asentamiento Los Palmitos) of Aguas Claras de Upala; this, within a term of TWENTY-FOUR MONTHS, counted from the notification of the judgment. The foregoing, with the warning that disobedience to the orders of this Chamber is criminally sanctioned pursuant to the provisions of article 71 of the Law of Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional). The Rural Development Institute (Instituto de Desarrollo Rural) is condemned to pay the damages caused by the facts that have given rise to this declaration, which shall be liquidated in the execution of the judgment of the contentious-administrative jurisdiction.
