  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-006706-0007-CO \n\nRes. Nº 2026016167\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del siete de mayo de dos mil veintiseis .\n\n \n\nRecurso de amparo que se tramita en expediente nro. 26-006706-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la ASOCIACIÓN ACUEDUCTO DE CASCAJAL DE CORONADO y el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).\n\nResultando:\n\n1.- Por escrito incorporado al expediente el 2 de abril de 2026, la accionante interpone recurso de amparo. Manifiesta que el 10 de octubre de 2024 se gestionó ante la Junta Directiva de la Asociación Acueducto de Cascajal de Coronado una gestión relacionada con la finca inscrita bajo la matrícula 705630, ubicada frente a la escuela de Cascajal. Menciona que la solicitud pretendía obtener la carta de disponibilidad hídrica, la instalación de un medidor y el acceso al servicio de agua potable para dicha propiedad. Menciona que en la exposición de motivos se destacó que el distrito de Cascajal cuenta con recursos hídricos abundantes incluidos ríos, quebradas y acuífero, situación que contrasta con la posición de la Asada, según la cual no existe disponibilidad para admitir nuevos abonados. Se señaló además que la carencia de agua potable afecta directamente el derecho fundamental a la salud, a la vida y a un desarrollo digno. La solicitud se sustentó también en jurisprudencia reiterada de la Sala Constitucional, la cual ha reconocido que el acceso al agua potable constituye parte del núcleo esencial de los derechos fundamentales. Afirma que solicitó a la asociación emitir carta de disponibilidad de agua, instalar el medidor y garantizar el acceso inmediato al servicio, además de indicar plena disposición para atender cualquier requerimiento administrativo o económico asociado. Señala que el 6 de febrero de 2025, mediante el oficio nro. ASADA ND 2025 02 0602, la Asada de Cascajal emitió una respuesta negativa a la gestión presentada respecto de la finca en referencia. En su comunicación, la asociación indicó, en primer término, que el AyA actúa como ente rector del sector y que su coordinación resulta necesaria para la emisión de nuevas disponibilidades de agua. Asimismo, señaló que, conforme al reglamento de Asadas, la entrega de disponibilidad únicamente procede cuando existe viabilidad técnica y capacidad de infraestructura suficientes. A ello agregó que, según informes técnicos previos emitidos por el AyA identificados como UEN GAR 2018 03743 y GSD UEN GAR 2020 04005, el acuerdo administrado por la Asada de Cascajal presenta un déficit hídrico, razón por la cual debe abstenerse de aprobar nuevas disponibilidades hasta contar con nuevas fuentes de abastecimiento. Con base en dichos elementos, la Asada concluyó que “no tiene capacidad hídrica que permita otorgar la disponibilidad de agua potable solicitada”. Considera que la decisión de la Asada de Cascajal lesiona su derecho fundamental de acceso al agua potable. Además, apunta que no se han adoptado medidas para garantizar el suministro mínimo vital mientras ejecuta soluciones de fondo. Considera que no se ofrecen medidas paliativas idóneas, se impone una denegación absoluta del acceso y mantiene a la recurrente en estado de indefensión frente a un servicio esencial, parámetros que la Sala ha considerado inaceptables en materia de servicios públicos esenciales. Menciona que el ICAA ordenó a la Asada desde 2020 buscar nuevas fuentes de abastecimiento con carácter urgente, sin que se haya acatado y solventado este aspecto. Considera que los precedentes de la Sala Constitucional confirman que las explicaciones técnicas o la falta de infraestructura no eximen a los operadores de su deber positivo de garantizar, al menos, el suministro mínimo vital inmediato y de ejecutar, en plazos perentorios, las obras o gestiones necesarias para normalizar el servicio. Apunta que el 24 de setiembre de 2020, el ICAA -en su condición de ente rector- emitió el oficio GSD-UEN-GAR-2020-04005 a la Asada de Cascajal con una orden técnica inequívoca: concentrarse en buscar nuevas fuentes de abastecimiento e incorporarlas con carácter urgente al sistema, para evitar afectaciones a la calidad y continuidad del servicio. Este mandato positivo es el eje de la corrección exigida por la autoridad técnica y no puede ser sustituido por una negativa indefinida a nuevas disponibilidades. Afirma que el propio oficio consigna, además, que pese al déficit diagnosticado, la Asada informó 40 disponibilidades otorgadas el año previo, lo que evidencia incoherencia operativa y la urgencia de gestiones efectivas para ampliar la capacidad hídrica. Señala que desde la orden técnica de 24 de setiembre de 2020, cuyo eje fue concentrarse en buscar e incorporar, con carácter urgente, nuevas fuentes de abastecimiento para asegurar la calidad y continuidad del servicio, las gestiones emprendidas por la ASADA si bien pudieron existir, no han producido un resultado suficiente y verificable que materialice aquella directriz en términos de nuevas fuentes efectivamente incorporadas ni de capacidad hídrica/hidráulica aumentada para atender la demanda en Cascajal. El transcurso de varios años sin un resultado eficaz frente al mandato rector del AyA revela una insuficiencia persistente en la gestión correctiva, que agrava la afectación al derecho fundamental de la recurrente, al impedirle el uso habitacional digno de su inmueble por carecer de acceso efectivo a agua potable. En este contexto, el énfasis constitucional debe colocarse en el deber incumplido en sus resultados de ampliar la oferta mediante fuentes seguras y mejoras de capacidad, pues esa es la solución estructural expresamente prescrita por la autoridad técnica desde 2020. Considera que el parámetro constitucional exige soluciones de expansión y reforzamiento del sistema, no la perpetuación de restricciones para viabilizar nuevas disponibilidades de manera compatible con el derecho fundamental al agua. Puntualiza que la propietaria soporta la carga financiera del lote, pero no puede extraer utilidad alguna ni desarrollar en él sus actividades básicas de subsistencia y proyecto de vida. Solicita la intervención de la Sala. \n\n2.- Mediante resolución de las 14:12 horas del 24 de marzo de 2026, la Presidencia de la Sala le previno a la recurrente aportar “CERTIFICACIÓN DE PERSONERÍA JURÍDICA VIGENTE DE LA \"ASOCIACIÓN ACUEDUCTO DE CASCAJAL DE CORONADO\", así como la DIRECCIÓN EXACTA del lugar señalado por su representante legal o agente residente para efectos de notificación”. \n\n3.- Por escrito incorporado al expediente el 2 de abril de 2026, la accionante aporta la documentación requerida. \n\n4.- Mediante resolución de las 15:49 horas del 6 de abril de 2026, la Presidencia de la Sala le dio curso al proceso y confirió audiencia a Rodolfo Arguello Rodríguez en su condición de presidente de la Asociación Acueducto de Cascajal de Coronado. Además, solicitó informe al jefe de la Unidad de Gestión de Acueductos Rurales del Instituto Costarricense de Acueducto y Alcantarillados (ICAA). \n\n5.- Por escrito incorporado al expediente electrónico el 13 de abril de 2026, informa bajo juramento Rafael Barboza Topping en su condición de la UEN Gestión de Asadas del Instituto Costarricense de Acueductos y Alcantarillados. Expone: “Primero: No nos consta. Sin embargo, se aclara al Tribunal Constitucional en lo que corresponde a las solicitudes de constancias de disponibilidad de servicios, según lo establece el oficio de la ORAC Metropolitana No. GSD-UEN-GAR-2026- 01577 de la siguiente forma: No nos consta. “Las solicitudes de disponibilidad de servicios y conexión permanente deben ser presentadas por las personas interesadas directamente ante la ASADA, como operador delegado, por lo que la Oficina Regional de Acueductos Comunales de la Región Metropolitana (ORAC Metropolitana), no lleva un registro ni control de dichas gestiones. De acuerdo con las pruebas aportadas por la recurrente, el 10 de octubre de 2024 el señor Octavio Barquero Alvarado, actuando “en condición personal”, dirigió una nota a la ASADA de Cascajal de Coronado, con el asunto “Solicitud formal de instalación de medidor y disponibilidad de agua”, en el que solicita “el acceso inmediato al servicio de agua potable, disponibilidad de agua e instalación de medidor de la finca con número de matrícula 705630, una vez cumplidos los requisitos que me sean indicados”. Señala que le “confiere autorización y poder especial de representación para los efectos de los términos indicados en este oficio al licenciado Eddie Alfonso Dinarte Corea…” Valga señalar que dicha nota no cuenta con la firma respectiva, en las pruebas no se muestra copia del poder autenticado por un abogado y de acuerdo con la certificación literal de la propiedad, la propiedad sobre la cual se hace referencia en dicha solicitud pertenece a la señora [Nombre 001]. Se debe recordar que las solicitudes de disponibilidad y conexión deben ser presentadas por la persona que figure como propietaria registral, junto con los requisitos respectivos a cada trámite. Las manifestaciones contenidas en la nota del 10 de octubre de 2024, aportadas por la recurrente como prueba, sobre la supuesta \"abundancia hídrica\" de la zona, no invalidan los estudios técnicos formales que acreditan el déficit hídrico que impide atender la demanda de nuevas disponibilidades y servicios, ya que esto podría poner en riesgo el abastecimiento de los abonados existentes. La existencia de recursos naturales como presencia de ríos y quebradas no equivale a disponibilidad hídrica utilizable para consumo humano. El aprovechamiento del agua para el suministro del servicio público de abastecimiento de agua potable requiere fuentes legalizadas (para el caso de las ASADAS se debe tramitar la asignación de caudal ante la Dirección de Aguas del MINAE), aforadas, con captación, conducción, almacenamiento, potabilización para su posterior distribución por medio de una red de acueducto. La ASADA no debe captar agua superficial o subterránea sin permisos ambientales, permisos de los propietarios, legalización de terrenos, e inversiones que requieren una serie de estudios de complejidad técnica, financiera y legal.” Segundo: Cierto con rectificaciones. No lleva razón la recurrente en cuanto a que el AyA o la ASADA de Cascajal con la denegación relativa a la solicitud de constancia de disponibilidad de servicios haya violentado algún derecho fundamental de la recurrente, lo anterior de acuerdo con lo dispuso el informe para la ASADA de Cascajal de Coronado mediante oficio de la ORAC Metropolitana No. GSD-UEN-GAR-2026-01577, mismo que estableció: “De acuerdo con las pruebas aportadas por la recurrente, es cierto que la ASADA Cascajal emitió el 06 de febrero de 2026 una nota de respuesta al señor Octavio Barquero Alvarado, en la que le aclara que la ASADA “no tiene capacidad hídrica que permita otorgar la disponibilidad de agua potable que nos está solicitando, por lo que su solicitud es denegada”. Es importante indicar, que la ASADA debe verificar el cumplimiento de requisitos legales, entre los cuales está revisar la solicitud sea formulada por la persona propietaria del inmueble, o bien por quien actúe en su representación legal, acreditando para ello el respectivo poder. Mediante el oficio ASADA-ND-2025-02- 0602, la ASADA de Cascajal emitió respuesta formal y motivada denegando la solicitud de disponibilidad de agua potable, con fundamento en los informes GSD-UEN-GAR-2020-04005 y UEN-GAR-2018-03743 por lo tanto, no existe vulneración al derecho de petición ni omisión de respuesta, ni tampoco consta en el recurso interpuesto y pruebas aportadas, que haya alguna gestión presentada ante la ASADA por parte de la recurrente. Es cierto que la Sala Constitucional ha reconocido el derecho humano al agua potable, sin embargo, éste no es derecho irrestricto, sino que está sujeto al cumplimiento de requisitos legales y al análisis de factibilidad técnica. En cuanto a la instrucción por parte de AyA a la ASADA de buscar nuevas fuentes de abastecimiento, esto no es corresponde a una acción de resultado inmediato, sino que la ASADA debe hacer una serie de gestiones que requieren disponibilidad financiera, permisos ambientales, capacidad técnica, viabilidad legal. Por su parte, la ORAC Metropolitana ha planteado la necesidad de que la ASADA Cascajal de Coronado sea asumida por el AyA. Sobre ese tema, el 28 de noviembre de 2022, mediante el memorando SG-GSGAM-2022-02123 e informe UEN-OS-GAM-2022- 00175, la Subgerencia Sistemas. GAM, indicó que: a. No se encuentra ninguna objeción en incluir los sectores de Cascajal y Montserrat en los proyectos anteriormente citados. b. Se considera que la duración de este proyecto corresponde a 10 años. c) Actualmente los sistemas GAM más cercanos a estas comunidades presentan déficit hídrico. Asimismo, el 20 de junio de 2023, mediante el memorando UEN-OSEP-GAM-2023- 00117, la UEN Optimización de Sistemas Ejecución Proyectos GAM, remitió la iniciativa del proyecto para el abastecimiento de Cascajal y Monserrat de Vázquez de Coronado, para que sea incluida dentro del portafolio de iniciativas de la Institución y para iniciar el proceso de traslado a la Subgerencia SAID. En cuanto a las medidas paliativas como el suministro de agua por medio de camiones cisterna, es importante aclarar que, de acuerdo con la normativa vigente, dichas medidas pueden ser aplicadas en casos de racionamientos y aplica para los servicios ya existentes. Se reitera que la ASADA tiene actualmente una limitación técnicamente debidamente fundamentada para la emisión de nuevas disponibilidades y servicios.” Fundamentos de Derecho I-En cuanto al Servicio Público de agua potable: En principio debemos de decir que el Estado por excelencia se encarga de velar por el Derecho a la Salud: básicamente establece el derecho a la vida como un derecho fundamental que esta tutelado por la Constitución Política en su artículo 21, establece el agua como elemento esencial para la vida, es indispensable para poder cumplir con otros derechos como el Derecho a la salud, por ende, dando a entender que sin agua no habría salud, aseo, y satisfacción de muchas otras necesidades. Debemos tener claro que el Ente que por ley es rector en materia de suministro de agua potable y alcantarillado, es el AyA, en razón de que el Instituto Costarricense de Acueductos y Alcantarillados por su Ley Constitutiva en sus artículos 1 y 2, establece claramente sus competencias, y está obligado a dirigir, administrar y operar todo lo referente al suministro de agua potable en el territorio nacional, y teniendo las facultades para delegar la administración, operación y mantenimiento de los sistemas de Acueductos. Para el cualquier caso en general se requiere de viabilidad técnica y legal, así como que exista disponibilidad de servicios, de acuerdo con lo que disponen los artículos 6 y 9 del Reglamento de Prestación de Servicios del AyA, tal y como podemos ver: “Artículo 6.- De los servicios. AyA prestará los servicios de abastecimiento de agua para uso poblacional y saneamiento de aguas residuales dentro del área de cobertura, siempre que cuente con factibilidad técnica y legal. Los sistemas e instalaciones internos necesarios para el disfrute de los servicios son responsabilidad del usuario. Artículo 9.- Del principio rector para otorgar el servicio de agua. La prestación del servicio de agua en las áreas de cobertura existente se brindará bajo el principio de que el consumo humano es prioritario. En el caso de sistemas deficitarios, AyA deberá prever las condiciones hídricas e hidráulicas necesarias; tendientes a otorgar la disponibilidad y eventual conexión del servicio; para solicitudes que respondan al desarrollo máximo de crecimiento.” (Ver Reglamento de Prestación de Servicios AyA) En tal sentido según se indicó y de acuerdo con lo establecido por el oficio No. GSDUEN-GAR-2026-01577, la ASADA de Cascajal de Coronado, es el operador autorizado en dicha comunidad y cuenta con Convenio de Delegación para la administración, operación, mantenimiento y desarrollo del sistema, firmado con AyA, desde el 11 de marzo del año 2003, siendo el operador habilitado para prestación del servicio en dicha comunidad. II-De las constancias de disponibilidad de servicios: Resulta indispensable aclarar que, para el otorgamiento de las constancias de disponibilidad de servicios, se debe destacar lo que establece el Reglamento de Prestación de Servicios del AyA acuerdo de Junta Directiva No. 2020-442, en sus artículos: 7.72, 7.73, 8, 14 y 30 tal como se puede observar: “7.72 Inspección técnica: Revisión especializada que realiza AyA y/o el operador delegado, en cuanto al funcionamiento y uso de los sistemas de agua, saneamiento y medición, ubicados en vía pública, en servidumbres de paso o en fincas y edificaciones privadas, conforme lo establece el artículo 5 inciso i) de la Ley Constitutiva de AyA (Ley Nº 2726). Corresponde también a las inspecciones que realiza AyA como parte de su deber de fiscalización, en las distintas etapas de la construcción de las obras primarias, a cargo de un desarrollador. 7.73. Inspección técnica para abastecimiento: Revisión que el operador efectúa de oficio o a solicitud del usuario, con el fin de actualizar la base de datos en cuanto al catastro, uso del servicio y datos básicos de éste. Artículo 8- De los servicios. AyA prestará los servicios de abastecimiento de agua para uso poblacional y saneamiento de aguas residuales dentro de la zona de cobertura, siempre que el área cuente con factibilidad técnica y legal. Los sistemas e instalaciones internos necesarios para el disfrute de los servicios son responsabilidad del usuario Artículo 14- De las condiciones para la prestación de los servicios. AyA prestará sus servicios una vez comprobada la factibilidad técnica en inmuebles construidos o por edificar, dedicados a la residencia de personas, para actividades comerciales o industriales que cumplan con los requisitos y usos autorizados en este reglamento Los servicios de agua potable y de saneamiento los otorgará el AyA sobre calle o vía pública o sobre servidumbre de tubería y de paso inscrita a favor del AyA o inscrita a favor de terceros, según aplique de acuerdo con lo establecido en el artículo 16 de este reglamento. Lo anterior, siempre que existan redes del AyA en funcionamiento. Si la red pública no alcanza hasta el punto de conexión, el AyA en un plazo que no supere los 15 días propondrá al propietario o poseedor la construcción de una extensión de ramal u otros componentes del sistema hidráulico, en observancia de los requerimientos detallados por AyA en el artículo 39 de este reglamento mediante el estudio técnico respectivo. En casos muy calificados, especialmente por condiciones socioeconómicas y de riesgo sanitario, de conformidad con las disposiciones que emita el AyA, podrá realizar la extensión de ramal y/u otros componentes hidráulicos, a fin de garantizar el acceso al agua potable y saneamiento en su dimensión de derecho humano y en acatamiento a su obligación legal de garantizar la prestación de los servicios en todo el territorio nacional. La calificación especial deberá ser debidamente fundamentada por las Subgerencias Operativas de Gestión de Sistemas GAM y Periféricos o por la Subgerencia de Gestión de Sistemas Delegados, según corresponda, mediante una resolución administrativa, la cual será emitida en un plazo de 20 días hábiles, a partir de generada la solicitud. Artículo 30- De los requisitos de admisibilidad y condiciones para la solicitud de la constancia de disponibilidad de servicios. La solicitud de la constancia de disponibilidad de servicios debe realizarla el propietario del inmueble o su representante legal, conforme lo dispone el artículo 15 de este Reglamento, ante las plataformas físicas digitales o virtuales que le ofrezca el prestador del servicio público. Para tales efectos se deben presentar de forma física o digital, los siguientes requisitos: a) Formulario de solicitud proporcionado por AyA, física o digitalmente disponible en la página WEB de AyA y en la plataforma APC-R, completo y firmado por el propietario registral, poseedor, representante o autorizado legal, de acuerdo con la forma de presentación, en donde se indicará el propósito de la disponibilidad y una descripción detallada del proyecto. b) Presentación de documento de identificación del propietario del inmueble o su representante legal. AyA eximirá al solicitante de la presentación de este requisito al contar con la factibilidad tecnológica para su verificación. De acuerdo con la verificación de las condiciones necesarias para la aprobación de los servicios indicada de manera general en el artículo 15 de este Reglamento, le corresponde a AyA verificar los requisitos ahí desglosados, así como las condiciones generales ahí establecidas para todos los trámites.” Para el caso concreto de las ASADAS, según lo dispuesto por el Reglamento de Prestación de Servicios del AyA, debe aplicar lo que determinan los artículos 5, 39 y 46 incisos a), b) y c) del Reglamento de las ASADAS Decreto Ejecutivo No.42582- S-MINAE, tal como se indica: “Artículo 5. De la prestación de servicios a las personas usuarias. Los servicios que brinden las ASADAS se regirán, entre otros por el Reglamentopara la Prestación de los Servicios de AyA, el Reglamento para la Suspensión de Servicios de Cobro Administrativo del Instituto Costarricense de Acueductos y Alcantarillados, Reglamento para la Prestación de Servicios de Agentes Recaudadores del Instituto Costarricense de Acueductos y Alcantarillados, el Reglamento Técnico: Prestación de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes (AR-PSAyA-2015), el Canon por Concepto de Aprovechamiento de Aguas (Decreto Nº32868). Además, por la Ley de Promoción de la Igualdad Social de la Mujer No. 7142, la Ley de Protección al Ciudadano contra el Exceso de Requisitos y Trámites Administrativos (Ley 8220), la Ley General de Control Interno No. 8292, y cualquier normativa que dentro de nuestro ordenamiento jurídico aplique, por integración de normas. Artículo 39. Prestación de los servicios. Corresponde a la ASADA brindar y velar por la adecuada prestación de los servicios de abastecimiento de agua potable y saneamiento de aguas residuales en la zona de la competencia delegada, según el Reglamento de Prestación de Servicios del AyA. Artículo 46. Otorgamiento de Servicios. La ASADA deberá llevar a cabo las acciones pertinentes para garantizar que todas las nuevas o futuras conexiones de servicios a los sistemas, se otorguen de acuerdo con sus capacidades hídrica e hidráulica. Cuando sea necesario, la persona interesada en el nuevo servicio, a su costa deberá realizar las mejoras requeridas para aumentar su capacidad para que las prestaciones de los servicios cumplan los principios de cantidad, calidad y continuidad, ajustándose a la normativa técnica, así como a las disposiciones emitidas o validadas por AyA, observando lo siguiente: a. Constancia de Capacidad Hídrica: La ASADA podrá emitirla siguiendo las disposiciones que para tal efecto regula el Reglamento para la Prestación de los Servicios de AyA b. Certificación de Disponibilidad de Servicios: La ASADA podrá emitirla siguiendo las disposiciones que para tal efecto regula el Reglamento para la Prestación de los Servicios de AyA c. Vigencia y prórroga: Los plazos de vigencia, así como las prórrogas de la Constancia de Capacidad Hídrica y la Certificación de Disponibilidad de Servicios se regirá por lo dispuesto en el Reglamento para la Prestación de los Servicios de AyA.” De acuerdo con lo anterior, para poder otorgar la constancia de disponibilidad de servicios por parte de la ASADA de Cascajal de Coronado, dicho operador delegado requiere comprobada factibilidad técnica y legal de acuerdo con la normativa supra citada, a fin de valorar el caso en concreto. Dicha factibilidad técnica ha sido reiterada por el Tribunal Constitucional a través de su sentencia No. 2023-007599 según vemos: “Al respecto, la Sala Constitucional ha reconocido, reiteradamente, que el ICAA, las ASADAS y las municipalidades que prestan el servicio de suministro de agua potable, de previo a aprobar o rechazar las solicitudes de disponibilidad de agua potable que les sean formuladas, están en plena capacidad de exigir el cumplimiento de requisitos establecidos en el ordenamiento jurídico, y ponderar razones de orden legal y técnico. Así las cosas, si bien existe un derecho fundamental al agua que puede ser exigido a la Administración correspondiente, la prestación del servicio bien puede sujetarse al cumplimiento de los requisitos establecidos para su otorgamiento y a que exista posibilidad material de suministro. De acuerdo con lo señalado anteriormente, resulta evidente que la razón por la cual no se le ha brindado la disponibilidad de agua potable y alcantarillado se debe a la existencia de una imposibilidad técnica, debido a que se determinó que no existía disponibilidad de agua potable por falta de capacidad hídrica del acueducto de Puriscal en el sector de Piedades, con lo cual la denegatoria que reclama el recurrente no ha sido arbitraria. Recuérdese que las autoridades encargadas tienen la obligación de ir expandiendo su infraestructura para garantizar a la población el acceso al servicio y para el sub examine, se aprecia que, en el año 2020, se diseñó un proyecto de ampliación del acueducto administrado por la ASADA de Grifo Alto, con la finalidad de abastecer los sectores de Calle Máquina, Cuesta de Guerra, Calle Principal y Ojo de Agua; no obstante, no fue posible disponer del pozo que abastecería de agua la comunidad Es decir, que se han intentado tomar medidas, empero, la imposibilidad aún se mantiene y, la jurisprudencia de esta Sala como una justificante para la no procedencia de otorgar el servicio. Lo anterior, no obsta para que si la parte accionante considera que las actuaciones de la ASADA o el ICAA tendientes a satisfacer la obligación de ampliación del acueducto no han sido conforme a la normativa infra constitucional, ello podrá ser discutido ante la jurisdicción contenciosa administrativa.” (Ver sentencia de las 09 horas 20 minutos del uno de marzo de dos mil veintitrés No. 2023-007599) De acuerdo con lo establecido por la ORAC Metropolitana mediante oficio No. GSDUEN-GAR-2026-01577, se concluye que la ASADA de Cascajal de Coronado no cuenta con factibilidad técnica para poder considerar otorgar constancias de disponibilidad. III-Del otorgamiento de los servicios permanentes: En complemento con lo anteriormente citado de las constancias de disponibilidad de servicio también resulta de vital importancia recalcar sustancialmente el trámite requerido para el otorgamiento de los servicios permanentes de existir disponibilidad de servicios previamente otorgada por la ASADA y dentro del plazo de vigencia, de acuerdo con los artículos 39 y 46 del Reglamento de las ASADAS, así como por los artículos 67 y 68 del Reglamento de Prestación de Servicios según vemos a continuación: “Artículo 67- De las condiciones generales para el trámite de una conexión permanente. Para el otorgamiento del servicio, el inmueble para el cual se solicita debe contar previamente con la disponibilidad de servicios positiva y asociada a los fines, naturaleza y propósitos para lo que fue aprobada. En caso de que se detecten movimientos registrales relacionados con la titularidad del inmueble, AyA tramitará la solicitud respecto al titular legitimado para tal efecto. Ante variaciones catastrales, tales como modificación de áreas y/o linderos que pueden incidir en el caudal y número de servicios definidos para el otorgamiento de la constancia de disponibilidad de servicios, deberá el interesado realizar el trámite señalado en el artículo 30 de este reglamento. Artículo 68- De los requisitos y condiciones para la solicitud de conexiones permanentes en terrenos inscritos. Para la solicitud de una conexión permanente, el propietario del inmueble, o el solicitante autorizado o su representante legal, conforme lo dispone el artículo 15 de este Reglamento, deberá presentar ante las plataformas físicas o virtuales que AyA o el operador delegado ofrezca, ya sea forma física o digital, los siguientes requisitos: a. Formulario de solicitud, proporcionado por AyA, completo y firmado por el propietario, el solicitante autorizado, o su representante legal. b. Documento de identificación del propietario, solicitante autorizado o su representante legal. De existir acceso a la plataforma tecnológica del Registro Civil en el que se despliegue la foto y firma del interesado, AyA lo eximirá de la presentación de este requisito y únicamente será necesario que proporcione el número de identificación de la cédula de identidad. c. Plano catastrado. En caso de que el inmueble no cuente con plano catastrado, o bien, se encuentre en proceso de una segregación o fraccionamiento, deberá de presentar un plano de agrimensura que cumpla con lo estipulado en el Artículo N°2 inciso q) del Decreto Ejecutivo No. 34331, Reglamento de la Ley de Catastro Nacional vigente con su respectiva minuta de presentación y el correspondiente sello del Colegio Federado de Ingenieros y Arquitectos (CFIA) conforme a lo dispuesto en el Reglamento Especial del Administrador de Proyectos de Topografía (APT) del CFIA vigente y sus reformas o las normativas que los sustituya. De existir factibilidad tecnológica, AyA eximirá al solicitante de la presentación de este requisito. d. Número de Proyecto tramitado ante la plataforma Administración de Proyectos de Construcción (APC) del CFIA, debidamente aprobado con el fin de que AyA constate la existencia del requisito del permiso de construcción vigente, en caso de que se trate de un inmueble por edificar. El permiso deberá ser coincidente con el caudal y fines para el que se aprobó la disponibilidad. e. El pago de la tarifa de conexión, conforme a lo establecido en el artículo 76 de este reglamento. f. En el caso de solicitudes de nuevos servicios, para actividades que generen aguas residuales de tipo especiales, el interesado deberá presentar, una declaración jurada en la que indique que la descarga al alcantarillado sanitario, cumplirá con el reglamento y nota de aprobación del Ministerio de Salud, que describa el tipo de actividad a desarrollar, así como la cantidad y calidad de la descarga a verter; asimismo la especificación del sistema de tratamiento para cumplir con la normativa ambiental vigente. g. En aquellos casos en que se deba brindar el servicio público, en territorios del país con características especiales, bajo la modalidad de territorios administrados por el Estado o sus instituciones con régimen jurídico especial como en la zona marítimo terrestre, en las zonas fronterizas, en las zonas en arriendo, en los territorios indígenas, en los polos de desarrollo turístico, en las áreas dentro del derecho de vía férrea, entre otros, los solicitantes deberán presentar la autorización expresa del Ente correspondiente, según la norma que los regule. De acuerdo con la verificación de las condiciones necesarias para la aprobación de los servicios indicada de manera general en el artículo 15 de este Reglamento, le corresponde a AyA verificar los requisitos ahí desglosados, así como las condiciones generales ahí establecidas para todos los trámites. Cuando el administrado se apersone ante el AyA a solicitar el servicio de saneamiento y/o agua para uso poblacional en una parcela agrícola, forestal o pecuaria, y para efectos de construir las viviendas o edificaciones que autoriza el Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones del INVU vigente, deberá el cumplir con los requisitos que para tal fin se solicitan en la presente normativa para cada supuesto. Cumplida la presentación de la totalidad de requisitos; la Institución contará con un plazo de 15 días hábiles para la resolución de la solicitud. Lo anterior se destaca en relación con el hecho segundo relativo con la obligación indispensable de contar con una constancia de disponibilidad de servicios para los servicios permanentes. Tal y como lo disponen los artículos 67 y 68 del Reglamento de Prestación de Servicios del AyA, reiterando para el caso en concreto no se cumple con los presupuestos establecidos por dicha normativa. IV- Imposibilidad material: Así también y considerando que nos encontramos ante una imposibilidad material para poder otorgar una constancia de disponibilidad de servicio según lo destacan los informes técnicos GSD-UEN-GAR-2020-04005 y No. GSD-UEN-GAR-2026- 01577: “…Considerando lo anterior y sin tener nueva información oficial por parte de la Asada que se refiera a la incorporación de nuevas fuentes, se les solicita lo antes posible referirse a las recomendaciones emitidas en el informe citado anteriormente y abstenerse de inmediato de emitir nuevas disponibilidades y nuevos servicios en tanto no se tenga una respuesta clara por parte de la Asada del estado de situación actual con respecto a las fuentes de abastecimiento...” De acuerdo con lo anterior se aclara al Tribunal Constitucional que debido a la ausencia de nuevas fuentes de abastecimiento existe una imposibilidad material para considerar otorgar constancias de disponibilidad de servicios. Es importante destacar lo que determinó la Sala Constitucional en lo que respecta a las obligaciones de los interesados para los casos que se requieren efectuar mejoras al sistema, según podemos ver: “Es evidente entonces que la razón por la cual no se pueden brindar las certificaciones de disponibilidad de agua potable de interés para el recurrente y su representada, es porque no se ha cumplido con los requisitos de ley exigidos a la fecha por la normativa vigente en la materia, con lo cual la denegatoria que reclama el recurrente, no ha sido arbitraria ni excesiva, sino que se debe a la existencia de una imposibilidad jurídica que es precisamente la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva y también por imposibilidad técnica, lo cual se estima razonable, al ser necesario que exista una infraestructura básica para brindar el servicio de agua potable. Sobre el particular, debe recordarse que la Sala no tiene competencia para superar requisitos o exigencias legalmente establecidas para el otorgamiento de un servicio público, como pareciera ser la pretensión de fondo del recurrente en este amparo.” (ver Sentencia de la Sala Constitucional No. 2018-012899) Reiteramos que el rechazo alegado se fundamenta en la ausencia de recurso hídrico en virtud de que se requieren nuevas fuentes, de acuerdo con lo establecido por la ORAC Metropolitana a través de su informe técnico No. GSD-UEN-GAR2026-01577. V-En cuanto a asuntos de mera legalidad: Consideramos que este asunto es de mera legalidad por cuanto nos encontramos dentro del cuadro fáctico presentado por la parte recurrente y su elenco probatorio, principalmente relativo a la: solicitud de constancia de disponibilidad de servicios y solicitud de servicio permanente, esta última sin contar con constancia de disponibilidad de servicios. Los cuales son hechos que se deben de conocer en la sede administrativa y/o vía ordinaria según lo requerido por la recurrente, ya que en ningún momento mi representada le está denegando el derecho al acceso al servicio de agua potable y/o alcantarillado de manera antojadiza, sino más bien para que la interesada cumpla con los requisitos establecidos por los artículos 30, 37, 67 y 68 del Reglamento de Prestación de Servicios del AyA, acuerdo de Junta Directiva No. 2020-442. Como puede apreciarse la administración no ha restringido ni violentado ningún derecho fundamental en perjuicio del recurrente. Lo anterior no constituye la vulneración de los derechos fundamentales, a la salud o la vida, o a la falta de respuesta para el administrado. Por tal motivo es preciso aclarar que en tal escenario la Sala Constitucional en su jurisprudencia ha indicado que existen procedimientos que no son de conocimiento de la jurisdicción constitucional, es decir, aquellos casos que se tratan de asuntos de mera legalidad y no de constitucionalidad, deben ser discutidos en la vía ordinaria correspondiente. En este sentido la sentencia No. 2001-06683 de la Sala Constitucional señala que: ““Único. Esta Sala ha manifestado en múltiples ocasiones que los hechos que motivan este recurso son asuntos de mera legalidad, discutibles en la vía administrativa y contencioso-administrativa, de manera que esas pretensiones deben rechazarse de plano, de conformidad con la potestad que a este Tribunal confiere el artículo 9 de la Ley de la Jurisdicción Constitucional, en relación con los artículos 59 y 60 de la Ley Reguladora de la Jurisdicción de lo Contencioso-Administrativo. (...)Tales procedimientos administrativos están encaminados a determinar la existencia del hecho denunciado, para lo cual, la prueba que aportan las partes y la recolectada de oficio, según las potestades conferidas por la propia Ley General de Administración Pública, son los elementos de convicción indispensables para fundar un acto administrativo conforme al ordenamiento jurídico. De la normativa ut retro citada se concluye, que el ente regulador debe establecer un equilibrio procesal entre las garantías de los usuarios de los servicios regulados, con relación a los intereses de los prestatarios de los servicios públicos, buscando la prevalencia de la verdad real, más que de la verdad formal, como erróneamente lo interpreta la autoridad recurrida, eso sí, siempre en resguardo del bloque de legalidad, del debido proceso y demás garantías contempladas en nuestro ordenamiento”. (el destacado no es nuestro) VI-En lo que respecta a las actuaciones de mi representada: Por último, en lo que corresponde al Instituto Costarricense de Acueductos y Alcantarillados dentro de las presentes diligencias relacionadas con la ASADA de Cascajal de Coronado, tal y como consta en el oficio número: GSD-UEN-GAR-2026- 01577, se ha cumplido con las obligaciones ordinarias según vemos: “…En cuanto a la instrucción por parte de AyA a la ASADA de buscar nuevas fuentes de abastecimiento, esto no es corresponde a una acción de resultado inmediato, sino que la ASADA debe hacer una serie de gestiones que requieren disponibilidad financiera, permisos ambientales, capacidad técnica, viabilidad legal. Por su parte, la ORAC Metropolitana ha planteado la necesidad de que la ASADA Cascajal de Coronado sea asumida por el AyA. Sobre ese tema, el 28 de noviembre de 2022, mediante el memorando SG-GSGAM-2022-02123 e informe UEN-OS-GAM-2022- 00175, la Subgerencia Sistemas...” (ver informe de la ORAC Metropolitana No. GSD-UEN-GAR-2026-01577) Todo lo anterior dentro de lo que corresponde a las competencias rectoras a nivel nacional del suministro del abastecimiento agua potable, y más específicamente lo que dispone la Ley Constitutiva de AyA en sus artículos 1, y 2, artículos 14, 30, 37, 67 y 68 del Reglamento de Prestación de Servicios del AyA, así como los artículos: 4, 5, 39 y 46 del Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales (ASADAS), y sin la vulneración de los derechos fundamentales del recurrente, dicha comprobación de factibilidad no conlleva a la vulneración de derechos fundamentales, tal y como ha sido reafirmado por la Sala Constitucional para dicho acueducto mediante sentencia de las nueve horas veinte minutos del veintiséis de mayo de dos mil veintitrés No. 2023-012181 según vemos: “Esta Sala ha considerado que, si bien existe un derecho fundamental al agua potable, su ejercicio no es indiscriminado al punto de que exista una obligación de los entes que prestan ese servicio de brindarlo en cualquier condición y oportunidad. Se ha reconocido, reiteradamente, que el Instituto Costarricense de Acueductos y Alcantarillados, las asociaciones administradoras de acueductos y alcantarillados y las municipalidades que prestan el servicio de suministro de agua potable, de previo a aprobar o rechazar las solicitudes de disponibilidad de agua potable que les sean formuladas, están en plena capacidad de exigir el cumplimiento de requisitos establecidos en el ordenamiento jurídico y ponderar razones de orden legal y técnico (véanse, por ejemplo, las sentencias No. 2009-003825 de las 16:49 hrs. del 10 de marzo de 2009 y No. 2010-010768 de las 10:52 hrs. del 18 de junio de 2020). La verificación del cumplimiento de requisitos legales o técnicos para obtener el servicio público en cuestión les corresponde a las autoridades administrativas respectivas, sin que esta Sala pueda incursionar en la materia, porque es propia de la legalidad ordinaria y ajena a su competencia. En el sub lite, del informe rendido por la autoridad recurrida y de la prueba aportada a los autos, ha sido debidamente acreditado que el rechazo a la disponibilidad de agua que reprocha la parte recurrente, no ha sido dictado de forma arbitraria o antojadiza, sino que, obedece a la falta real y actual de capacidad hídrica del acueducto. Aunado a lo indicado, se explica la razón por la cual, no se está en capacidad de atender el caso como el de los tutelados; lo anterior, por cuanto el sector donde se ubica la propiedad, no cuenta con capacidad hídrica; situación que, ha sido evidenciada y documentada mediante informes técnicos emitidos por la UEN Gestión de Acueductos Rurales del Instituto Costarricense de Acueductos y Alcantarillados, en los cuales, además se le indica expresamente a la ASADA recurrida, abstenerse de emitir nuevas disponibilidades o servicios. Por otra parte, aún y cuando, los recurrentes alegan que anteriormente, se les había expedido constancia de disponibilidad de agua, lo cierto es que, según informa la autoridad recurrida, la misma fue emitida para un acto concreto, a decir, trámite de crédito bancario, la cual, además tenía un plazo de vigencia. Es decir, el caso de los amparados fue analizado nuevamente y se determinó la imposibilidad técnica de brindarle el servicio de agua, para los fines solicitados. En este contexto, se impone advertir que este Tribunal no puede usurpar las atribuciones del instituto recurrido en su rol de Administración activa, y previa comprobación de los requisitos legales y reglamentarios del caso, ordenar que el servicio pretendido le sea otorgado. Así las cosas, esta Sala no logra acreditar ninguna omisión o actuación arbitraria por parte de las autoridades accionadas. Por las razones anteriores, lo procedente es declarar sin lugar el presente recurso en todos sus extremos.” (Ver sentencia de la Sala Constitucional No. 2023-012181) En conclusión, podemos afirmar lo siguiente: 1- Según el informe No. GSD-UEN-GAR-2026-01577 y sus anexos, existe una recomendación desde el 24 de setiembre del 2020 para la ASADA de Cascajal de Coronado de no otorgar constancias de disponibilidad de servicios hasta tanto no se busquen fuentes de abastecimiento, dicha recomendación se encuentra vigente. 2- De acuerdo con lo establecido por la ORAC Metropolitana mediante oficio GSD-UEN-GAR2026-01577 y sus anexos, no se tiene conocimiento que dicha ASADA haya incorporado nuevas fuentes, 3-No se cuenta con factibilidad técnica demostrada para otorgar solicitud del recurrente, 4-No existe trámite pendiente de mi representada con la recurrente. Por las razones expuestas podemos afirmar que mi representada no ha caído en omisiones de sus responsabilidades, así como tampoco ha violentado los derechos fundamentales del recurrente, ni mucho menos el derecho a la salud o la vida del recurrente. VII- Petitoria: Con fundamento en las razones de hecho y de derecho expuestas, solicito lo siguiente: Se declare sin lugar el presente recurso de amparo en todos sus extremos, se archive el expediente y no se condene al AyA en costas, daños y perjuicios, ya que reiteramos que con el actuar de la Administración no se han violentado los derechos fundamentales del recurrente, y se han realizado todas las gestiones conforme a nuestra competencia para brindar una solución definitiva a la situación”. \n\n6.- Por escrito incorporado al expediente electrónico el 14 de abril de 2026, contesta la audiencia Rodolfo Argüello Rodríguez en su condición de presidente de la Junta Directiva de la Asociación de Acueducto de Cascajal de Coronado. Expone: “PRIMERO: Es falso en la forma en que viene expuesto. En octubre de 2024, la recurrente no tenía la posibilidad de gestionar una solicitud de disponibilidad hídrica, pues la titularidad de la propiedad la ostentó el señor Octaviano Barquero Alvarado, hasta el 15 de abril de 2025, quien mediante oficio de fecha 22 de noviembre de 2024 y formulario de solicitud de fecha 4 de febrero de 2025, plantea solicitud en el sentido alegado por la recurrente. SEGUNDO: Es falso en la forma que viene expuesto. Los fundamentos de la pretensión alegados por la recurrente, son los expuestos por el señor Barquero Alvarado, no por ella y a los cuales se dio debida respuesta mediante oficio No. ASADA ND 2025 02 0602 de 6 de febrero 2025, denegando la solicitud interpuesta con sustento en las directrices concretas dictadas por el órgano rector del sector -el Instituto Costarricense de Acueductos y Alcantarillados-mediante informe técnico No. UEN-GHAR-2018-03743, suscrito por el Ing. Esteban Ramírez Gutiérrez y mediante comunicación cursada a la Junta Directiva de la ASADA de Cascajal de Coronado, mediante oficio No. GSD-UEN-GAR-2020-04005, suscrito por Adriana María Rojas Ugalde, de la UEN Gestión de Acueductos Rurales, que instruyeron a los miembros de la Junta Directiva de la ASADA a abstenerse de otorgar nuevas disponibilidades o servicios, dado el déficit hídrico que presentaba el acueducto y hasta que no existiesen nuevas fuentes de abastecimiento, pues ello iría en detrimento del servicio público que se brinda a los abonados actuales. TERCERO: Es falso. La narrativa de la recurrente dirigida a señalar una “una insuficiencia persistente” en la gestión de la ASADA, se sustenta en la apreciación subjetiva del señor Alvarado Barquero de que la zona de Cascajal cuenta con abundantes recursos hídricos, pero omitiendo, que la mayoría de ellos son utilizados por el Instituto de Acueductos y Alcantarillados para suplir las necesidades de los habitantes de la Gran Área Metropolitana y que las escasas fuentes que suplen el suministro que brinda la ASADA que presido, se dedican a mantener el servicio de los abonados o usuarios existentes y que es en defensa del derecho fundamental al acceso al agua potable de ellos, que no se pueden otorgar nuevas disponibilidades ni servicios de acueducto, solo para satisfacer las expectativas de quien no lo es (…) PETITORIA Con sustento en los argumentos expuestos y la prueba aportada, solicito se declare sin lugar el recurso interpuesto, por no haber incurrido la ASADA que presido, en violación alguna a los derechos fundamentales de la recurrente”. \n\n7.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Castillo Víquez; y,\n\nConsiderando:\n\n I.- Cuestión previa. Tratándose de recursos de amparo dirigidos contra sujetos privados, previo al análisis de fondo acerca de la violación constitucional alegada, debe examinarse si, en la especie, se está o no ante alguno de los supuestos que hacen admisible tal recurso, y, en caso afirmativo, dilucidar si es o no admisible. Indica la Ley de la Jurisdicción Constitucional en el artículo 57 que procede el recurso de amparo contra las acciones u omisiones de sujetos de derecho privado, cuando estos actúen o deban actuar en ejercicio de funciones o potestades públicas, o se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a) de la misma Ley. En el caso concreto, se cumple uno de estos presupuestos, ya que se trata de sujetos de derecho privado que están actuando en ejercicio de funciones o potestades públicas al prestar un servicio público, motivo por el que el recurso se admite para su análisis por parte de este Tribunal.\n\nII.- Objeto del recurso. La recurrente manifiesta que el 10 de octubre de 2024 se gestionó ante la Junta Directiva de la Asociación Acueducto de Cascajal de Coronado una solicitud de disponibilidad de agua para la finca inscrita bajo la matrícula 705630, ubicada frente a la escuela de Cascajal. Señala que el 6 de febrero de 2025, mediante el oficio nro. ASADA ND 2025 02 0602, la Asada de Cascajal contestó que “no tiene capacidad hídrica que permita otorgar la disponibilidad de agua potable solicitada”. Considera que la decisión de la Asada de Cascajal lesiona su derecho fundamental de acceso al agua potable. Apunta que desde 2020, el ICAA había ordenado a la Asada recurrida que debía buscar nuevas fuentes de abastecimiento; sin embargo, esto no ocurrió. Solicita la intervención de la Sala. \n\nIII.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:\n\na) Por oficio del 22 de noviembre de 2024 y formulario del 4 de febrero de 2025, el señor Octaviano Barquero Alvarado solicitó disponibilidad hídrica para la finca situada en Cascajal de Coronado, frente a la ermita de Cascajal, matrícula 705630-000 plano SJ-2145843-2019 (véase contestación y prueba aportada).\n\nb) Por oficio ASADA-ND-2025-02-0602 del 6 de febrero de 2025, la asociación recurrida contestó: “En atención a su solicitud, para que la Asada le otorgue una disponibilidad de agua para construcción de casa en la finca situada en Cascajal de Coronado, frente a la ermita de Cascajal, matrícula 705630-000 plano SJ-2145843-2019, le informamos que actualmente la Asada debe cumplir y coordinar con Acueductos y Alcantarillados la emisión de nuevas disponibilidades o nuevos servicios por las condiciones siguientes: 1.- De conformidad con lo establecido en la Ley Constitutiva del Instituto de Acueductos y Alcantarillados (No. 2726 de 1 de abril de 1961), esa Institución es el ente rector en la prestación del servicio de agua potable en el país. 2.- Que según lo establecido en el artículo 21, inc. 19) del Reglamento de las Asociaciones Administradoras de Sistemas de Acueducto y Alcantarillado Comunales, es un deber de las ASADAS otorgar el sello de disponibilidad hídrica, siempre que exista viabilidad técnica, infraestructura y que no vaya en detrimento de la calidad del servicio que se presta. 3.- Que mediante informe técnico No. UEN-GAR-2018-03743, suscrito por el Ing. Esteban Ramírez Gutiérrez y oficio No. GSD-UEN-GAR-2020-04005, suscrito por Adriana María Rojas Ugalde (se adjunta copia de este último oficio), ambos de la UEN Gestión de Acueductos Rurales, se estableció que la ASADA de Cascajal de Coronado presenta déficit hídrico, por lo que debe abstenerse de emitir nuevas disponibilidades ni servicios, hasta que existan nuevas fuentes de abastecimiento, para no comprometer el servicio que se brinda a los actuales abonados. Es por todo lo anterior, que nos vemos en la necesidad de comunicarle que actualmente la Asada. no tiene capacidad hídrica que permita otorgar la disponibilidad de agua potable que nos está solicitando, por lo que su solicitud es denegada” (véase prueba aportada).\n\nIV.- Sobre el caso concreto. En el sub lite, la recurrente manifiesta que el 10 de octubre de 2024 se gestionó ante la Junta Directiva de la Asociación Acueducto de Cascajal de Coronado una solicitud de disponibilidad de agua para la finca inscrita bajo la matrícula 705630, ubicada frente a la escuela de Cascajal. Señala que el 6 de febrero de 2025, mediante el oficio nro. ASADA ND 2025 02 0602, la Asada de Cascajal contestó que “no tiene capacidad hídrica que permita otorgar la disponibilidad de agua potable solicitada”. Considera que la decisión de la Asada de Cascajal lesiona su derecho fundamental de acceso al agua potable. Apunta que desde 2020, el ICAA había ordenado a la Asada recurrida que debía buscar nuevas fuentes de abastecimiento; sin embargo, esto no ocurrió. Solicita la intervención de la Sala.\n\nDel estudio de los autos se tiene por demostrado, que por oficio ASADA-ND-2025-02-0602 del 6 de febrero de 2025, la asociación recurrida contestó: “En atención a su solicitud, para que la Asada le otorgue una disponibilidad de agua para construcción de casa en la finca situada en Cascajal de Coronado, frente a la ermita de Cascajal, matrícula 705630-000 plano SJ-2145843-2019, le informamos que actualmente la Asada debe cumplir y coordinar con Acueductos y Alcantarillados la emisión de nuevas disponibilidades o nuevos servicios por las condiciones siguientes: 1.- De conformidad con lo establecido en la Ley Constitutiva del Instituto de Acueductos y Alcantarillados (No. 2726 de 1 de abril de 1961), esa Institución es el ente rector en la prestación del servicio de agua potable en el país. 2.- Que según lo establecido en el artículo 21, inc. 19) del Reglamento de las Asociaciones Administradoras de Sistemas de Acueducto y Alcantarillado Comunales, es un deber de las ASADAS otorgar el sello de disponibilidad hídrica, siempre que exista viabilidad técnica, infraestructura y que no vaya en detrimento de la calidad del servicio que se presta. 3.- Que mediante informe técnico No. UEN-GAR-2018-03743, suscrito por el Ing. Esteban Ramírez Gutiérrez y oficio No. GSD-UEN-GAR-2020-04005, suscrito por Adriana María Rojas Ugalde (se adjunta copia de este último oficio), ambos de la UEN Gestión de Acueductos Rurales, se estableció que la ASADA de Cascajal de Coronado presenta déficit hídrico, por lo que debe abstenerse de emitir nuevas disponibilidades ni servicios, hasta que existan nuevas fuentes de abastecimiento, para no comprometer el servicio que se brinda a los actuales abonados. Es por todo lo anterior, que nos vemos en la necesidad de comunicarle que actualmente la Asada no tiene capacidad hídrica que permita otorgar la disponibilidad de agua potable que nos está solicitando, por lo que su solicitud es denegada”.\n\nAl respecto, las autoridades recurridas informan que, debido a la ausencia de nuevas fuentes de abastecimiento, existe una imposibilidad material para considerar otorgar constancias de disponibilidad de servicios. \n\nSobre el particular, esta Sala ha indicado que el ICAA, las asociaciones administradoras de acueductos y alcantarillados, las municipalidades y demás instituciones que prestan el servicio de suministro de agua potable, pueden rechazar las solicitudes de servicio de agua potable que les sean formuladas, o bien condicionarlas si existen razones técnicas o legales que así lo justifican. Así, en la sentencia nro. 2025041174 de las 10:10 horas del 11 de diciembre de 2025 se dispuso: \n\n“V.- Sobre el fondo. En el caso bajo estudio, el recurrente impugna la denegatoria del servicio de agua potable para su propiedad ubicada en Esterillos, así como el criterio técnico que sustentó dicha decisión. Debe recordarse que la constancia de disponibilidad de servicios consiste en verificar y comunicar la existencia real y actual de capacidad hídrica e hidráulica.\n\nLa Sala constató que, la autoridad recurrida informó al gestionante las razones por las cuales no era posible otorgar el servicio solicitado, señalándole que el balance hídrico del sistema PC-A28 es negativo; es decir, que en este momento no existe recurso hídrico disponible para reservar caudal. Asimismo, se le indicó que contra dicho acto administrativo podía interponer los recursos correspondientes, garantía que el recurrente ejerció, teniendo acceso al expediente y a los informes técnicos que respaldan la decisión. De ello se desprende que no le asiste razón al amparado al alegar lesión a su derecho al agua ni a su derecho al debido proceso\n\nEsta Sala ha reiterado en múltiples ocasiones que, cuando existe una imposibilidad técnica para conectar el servicio requerido, no se vulnera derecho fundamental alguno, pues tal situación obedece a la ausencia de condiciones técnicas para la instalación del servicio y no a un actuar arbitrario de la Administración (véanse, entre otras, las Sentencias N° 2007-03355 de las 13:37 horas del 9 de marzo de 2007; N° 2007-010341 de las 14:45 horas del 20 de julio de 2007; y N° 2017-011477 de las 9:15 horas del 21 de julio de 2017).\n\nResulta evidente que el Instituto no puede brindar el servicio solicitado por la parte accionante, por cuanto ello no es técnicamente factible; por ende, no es posible acoger la solicitud en los términos pretendidos. En consecuencia, la denegatoria del servicio de agua potable a la propiedad del tutelado se encuentra debidamente motivada para los efectos de esta jurisdicción constitucional, pues existen razones técnicas que la justifican, específicamente la insuficiencia de capacidad hídrica del acueducto.\n\nAdemás, es preciso indicar que el cumplimiento de requisitos legales o técnicos para obtener la disponibilidad del servicio de agua corresponde ser analizado por las autoridades administrativas o jurisdiccionales ordinarias, sin que, en principio, esta Sala pueda incursionar en esa materia, por tratarse de asuntos de legalidad ordinaria ajenos a su competencia. De modo que, si el accionante se encuentra inconforme con los argumentos expuestos por la autoridad recurrida, o considera que podían adoptarse otras medidas para permitirle el acceso al servicio —como la disponibilidad condicionada, el uso de camiones cisterna u otras alternativas—, puede plantear las alegaciones pertinentes ante las instancias administrativas o judiciales competentes, sedes en las que podrá discutir de manera amplia el fondo del asunto y hacer valer sus pretensiones.\n\nPor lo expuesto, se descarta, prima facie, la existencia de circunstancias que ameriten la intervención de esta jurisdicción constitucional en relación con estos extremos, razón por la cual corresponde declarar sin lugar el recurso”.\n\nAsí las cosas, el Tribunal estima que estas consideraciones son aplicables al caso en estudio, pues se trata del mismo tipo de reclamo. En ese tanto, como se explicó en el antecedente de cita, en este momento existe una imposibilidad técnica que no permite el otorgamiento del servicio requerido, pues no existe capacidad hídrica que permita otorgar la disponibilidad de agua, de manera que no es posible acreditar una actuación ilegítima o arbitraria por parte de los recurridos. \n\nAhora, cabe también resaltar que la verificación del cumplimiento de requisitos legales o técnicos para obtener la disponibilidad del servicio de agua corresponde a las autoridades administrativas o jurisdiccionales comunes, sin que, en principio, esta Sala pueda incursionar en la materia, pues se trata de aspectos de legalidad ordinaria ajenos a su competencia. De este modo, si la parte accionante se encuentra inconforme con las razones esgrimidas por la parte accionada, deberá plantear los alegatos que correspondan ante las instancias comunes competentes, sedes en las que podrá discutir de forma amplia el fondo del asunto y hacer valer sus pretensiones. \n\nEn virtud de lo expuesto, a priori se descarta alguna situación que amerite la intervención de esta jurisdicción constitucional, por lo que se declara sin lugar el recurso. \n\nV.- Voto salvado de los magistrados Cruz Castro y Rueda Leal, con redacción del primero. Disentimos del criterio de mayoría. En el presente caso, se valida la negativa de la Administración de brindar un servicio esencial, con base en consideraciones técnicas relativas a la insuficiencia de la infraestructura hídrica; sin embargo, se omite ponderar adecuadamente que el acceso al agua potable constituye un derecho fundamental, indispensable para la vida, la salud y la dignidad humana.\n\nEl artículo 21 de la Constitución Política protege la vida humana, y este Tribunal ha reconocido que el acceso al agua para consumo humano es un presupuesto material de ese derecho. Asimismo, el artículo 50 constitucional impone al Estado el deber de garantizar el bienestar de todos los habitantes, lo cual incluye necesariamente el acceso efectivo, suficiente y continuo al agua potable. En el ámbito internacional, instrumentos como el Pacto Internacional de Derechos Económicos, Sociales y Culturales –interpretado por el Comité DESC en su Observación General No. 15– reconocen el derecho humano al agua, obligando a los Estados a adoptar medidas positivas para su plena realización. Hay una obligación reforzada impuesta al Estado en un estado social y democrático de derecho, por esta razón el suministro de agua, es una obligación prioritaria de los poderes públicos.\n\nDesde esta perspectiva, la invocación de limitaciones técnicas no puede erigirse en una justificación absoluta para desatender una necesidad básica de subsistencia. La Administración no puede limitarse a constatar la insuficiencia del sistema; tiene el deber jurídico de planificar, prever y ejecutar las acciones necesarias para garantizar progresivamente el acceso al servicio al agua, especialmente cuando se trata de consumo humano.\n\nEl enfoque mayoritario normaliza una omisión estructural: acepta que la falta de infraestructura exonera al Estado de su obligación, cuando precisamente esa carencia evidencia un incumplimiento de su deber de previsión. No se trata de obligar a lo imposible, sino de exigir que la Administración adopte medidas razonables, alternativas o progresivas para no dejar en desprotección a las personas.\n\nEl agua no es un servicio cualquiera, es un derecho humano esencial, por ello, la autoridad accionada no puede desentenderse de su deber de garantizarlo, escudándose en limitaciones técnicas sin ofrecer soluciones efectivas.\n\nPor estas razones, estimamos que el recurso debió declararse con lugar, al menos para ordenar a la Administración la adopción de medidas concretas y progresivas que garantice, en un plazo razonable, el acceso efectivo al agua potable de la parte amparada. El agua es un bien y un derecho fundamental cuya vigencia debe asegurarse efectivamente, es un deber ineludible.\n\nVI.- Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.\n\nPor tanto:\n\nSe declara sin lugar el recurso. San José, at nine hours thirty minutes on the seventh of May, two thousand twenty-six.\n\nWrit of amparo (recurso de amparo) processed under case file no. 26-006706-0007-CO, filed by [Nombre 001], national identity card [Valor 001], against the ASOCIACIÓN ACUEDUCTO DE CASCAJAL DE CORONADO and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).\n\nRecitals (Resultando):\n\n1.- By written submission incorporated into the case file on April 2, 2026, the petitioner files the writ of amparo. She states that on October 10, 2024, a request was submitted to the Board of Directors (Junta Directiva) of the Asociación Acueducto de Cascajal de Coronado concerning the property registered under parcel number (matrícula) 705630, located across from the Cascajal school. She mentions that the request sought to obtain a water availability letter (carta de disponibilidad hídrica), the installation of a meter (medidor), and access to potable water service for said property. She mentions that the statement of grounds highlighted that the Cascajal district possesses abundant water resources, including rivers, streams, and an aquifer (acuífero), a situation that contrasts with the ASADA's position that there is no available capacity to admit new subscribers (abonados). It was further noted that the lack of potable water directly affects the fundamental right to health, to life, and to dignified development. The request was also supported by the reiterated jurisprudence of the Constitutional Chamber (Sala Constitucional), which has recognized that access to potable water constitutes part of the essential core of fundamental rights. She affirms that she requested the association to issue a water availability letter, to install the meter, and to guarantee immediate access to the service, while also indicating her full willingness to meet any associated administrative or financial requirements. She states that on February 6, 2025, through official communication no. ASADA ND 2025 02 0602, the ASADA of Cascajal issued a negative response to the request submitted regarding the aforementioned property. In its communication, the association indicated, first, that AyA acts as the governing body (ente rector) of the sector and that its coordination is necessary for the issuance of new water availability letters. It also noted that, pursuant to the ASADA regulations, the granting of availability is permitted only when there is sufficient technical feasibility and infrastructure capacity. It further added that, according to prior technical reports issued by AyA identified as UEN GAR 2018 03743 and GSD UEN GAR 2020 04005, the system administered by the ASADA of Cascajal presents a water deficit (déficit hídrico), and therefore it must refrain from approving new availabilities until new supply sources are secured. On the basis of those elements, the ASADA concluded that it \"does not have the water capacity to grant the requested potable water availability.\" She considers that the decision of the ASADA of Cascajal infringes upon her fundamental right of access to potable water. Furthermore, she notes that no measures have been adopted to guarantee the minimum vital supply (suministro mínimo vital) while structural solutions are being implemented. She considers that no adequate palliative measures are offered, that an absolute denial of access is imposed, and that the petitioner is left in a state of defenselessness with respect to an essential service — parameters that the Chamber has deemed unacceptable in the area of essential public services. She mentions that ICAA ordered the ASADA as far back as 2020 to urgently seek new supply sources, without that instruction having been complied with or resolved. She considers that the precedents of the Constitutional Chamber confirm that technical explanations or the lack of infrastructure do not exempt operators from their positive duty to guarantee, at a minimum, the immediate minimum vital supply and to carry out, within strict deadlines, the works or administrative steps necessary to normalize the service. She points out that on September 24, 2020, ICAA — in its capacity as governing body — issued official communication GSD-UEN-GAR-2020-04005 to the ASADA of Cascajal with an unequivocal technical order: to focus on seeking new supply sources and incorporating them into the system on an urgent basis, in order to prevent disruptions to the quality and continuity of the service. This positive mandate is the cornerstone of the corrective action required by the technical authority and cannot be replaced by an indefinite refusal to grant new availabilities. She affirms that the communication itself also records that, despite the diagnosed deficit, the ASADA reported 40 availabilities granted the previous year, which evidences operational inconsistency and the urgency of effective efforts to expand water capacity. She states that since the technical order of September 24, 2020 — whose core objective was to urgently seek and incorporate new supply sources to ensure the quality and continuity of the service — the steps taken by the ASADA, although they may have existed, have not produced a sufficient and verifiable result that materializes that directive in terms of new supply sources effectively incorporated or of increased water/hydraulic capacity to meet demand in Cascajal. The passage of several years without an effective result in response to AyA's governing mandate reveals a persistent insufficiency in corrective management, which aggravates the harm to the petitioner's fundamental right by preventing her from making dignified residential use of her property due to lack of effective access to potable water. In this context, the constitutional emphasis must be placed on the duty — unfulfilled in its results — to expand supply through secure sources and system capacity improvements, as that is the structural solution expressly prescribed by the technical authority since 2020. She considers that the constitutional standard requires solutions for expanding and strengthening the system, not the perpetuation of restrictions, in order to make new availabilities viable in a manner compatible with the fundamental right to water. She emphasizes that the property owner bears the financial burden of the lot but is unable to derive any benefit from it or carry out basic subsistence activities and life plans on it. She requests the intervention of the Chamber.\n\n2.- By means of a resolution issued at 14:12 hours on March 24, 2026, the Presidency of the Chamber required the petitioner to provide a \"VALID CERTIFICATE OF LEGAL STANDING (CERTIFICACIÓN DE PERSONERÍA JURÍDICA VIGENTE) OF THE 'ASOCIACIÓN ACUEDUCTO DE CASCAJAL DE CORONADO'\", as well as the EXACT ADDRESS of the location indicated by its legal representative or registered agent for notification purposes.\n\n3.- By written submission incorporated into the case file on April 2, 2026, the petitioner provides the required documentation.\n\n4.- By means of a resolution issued at 15:49 hours on April 6, 2026, the Presidency of the Chamber admitted the case for processing and granted a hearing to Rodolfo Arguello Rodríguez in his capacity as president of the Asociación Acueducto de Cascajal de Coronado. In addition, it requested a report from the head of the Rural Aqueduct Management Unit of the Instituto Costarricense de Acueductos y Alcantarillados (ICAA).\n\n5.- By written statement incorporated into the electronic case file on April 13, 2026, Rafael Barboza Topping, acting in his capacity with the UEN Gestión de Asadas of the Instituto Costarricense de Acueductos y Alcantarillados, reports under oath. He states: \"First: This is not within our knowledge. However, by way of clarification to the Tribunal Constitucional regarding requests for service availability certificates (constancias de disponibilidad de servicios), the matter is governed by ORAC Metropolitana Office No. GSD-UEN-GAR-2026-01577, as follows: This is not within our knowledge. 'Requests for service availability and permanent connection must be submitted directly to the ASADA by the interested parties, as the ASADA is the delegated operator; therefore, ORAC Metropolitana does not maintain a registry or record of such proceedings. Based on the evidence provided by the appellant, on October 10, 2024, Mr. Octavio Barquero Alvarado, acting \"in a personal capacity,\" addressed a letter to the ASADA of Cascajal de Coronado, with the subject line \"Formal request for meter installation and water availability,\" in which he requests \"immediate access to the potable water service, water availability, and meter installation for the property bearing cadastral registration number 705630, once I have fulfilled the requirements indicated to me.\" He states that he \"grants authorization and special power of legal representation for the purposes set forth in this letter to attorney Eddie Alfonso Dinarte Corea…\" It should be noted that said letter does not bear the corresponding signature, the evidence does not include a copy of a power of attorney authenticated by an attorney, and according to the certified literal extract (certificación literal) of the property, the property referenced in the request belongs to [Nombre 001]. It must be recalled that requests for availability and connection must be submitted by the person registered as the property owner, together with the respective requirements for each procedure. The statements contained in the October 10, 2024 letter, submitted by the appellant as evidence, regarding the alleged \"water abundance\" of the area, do not invalidate the formal technical studies establishing the water deficit (déficit hídrico) that prevents the granting of new availability certificates and services, as this could jeopardize the supply to existing subscribers. The existence of natural resources such as rivers and streams does not equate to usable water availability (disponibilidad hídrica) for human consumption. The use of water for the provision of the public potable water supply service requires legalized sources (in the case of ASADAs, the flow allocation must be processed before the Dirección de Aguas of MINAE), gauged, with intake, conveyance, storage, and purification (potabilización) infrastructure for subsequent distribution through an aqueduct network. The ASADA must not draw surface or groundwater without environmental permits, permits from landowners, land title legalization, and investments that require a series of technically, financially, and legally complex studies.' Second: True, with qualifications. The appellant is incorrect in asserting that AyA or the ASADA of Cascajal, by denying the request for a service availability certificate, violated any fundamental right of the appellant, in accordance with the report issued for the ASADA of Cascajal de Coronado through ORAC Metropolitana Office No. GSD-UEN-GAR-2026-01577, which established: 'Based on the evidence provided by the appellant, it is true that ASADA Cascajal issued a response letter on February 6, 2026 to Mr. Octavio Barquero Alvarado, clarifying that the ASADA \"does not have the water capacity to grant the potable water availability you are requesting, and your request is therefore denied.\" It is important to note that the ASADA must verify compliance with legal requirements, among which is verifying that the request has been submitted by the registered owner of the property, or by a duly authorized legal representative, with the corresponding power of attorney on record. Through Office ASADA-ND-2025-02-0602, the ASADA of Cascajal issued a formal, reasoned response denying the request for potable water availability, based on reports GSD-UEN-GAR-2020-04005 and UEN-GAR-2018-03743; therefore, there is no violation of the right to petition, nor any failure to respond, nor does the appeal filed and the evidence submitted show that any proceeding was filed before the ASADA by the appellant. It is true that the Sala Constitucional has recognized the human right to potable water; however, this is not an unrestricted right, but one subject to compliance with legal requirements and a technical feasibility analysis. Regarding AyA's instruction to the ASADA to seek new supply sources, this is not an immediately achievable action; rather, the ASADA must undertake a series of measures requiring financial resources, environmental permits, technical capacity, and legal viability. For its part, ORAC Metropolitana has raised the need for ASADA Cascajal de Coronado to be assumed by AyA. On that matter, on November 28, 2022, through memorandum SG-GSGAM-2022-02123 and report UEN-OS-GAM-2022-00175, the GAM Systems Management Sub-Directorate indicated that: a. No objection is found to including the Cascajal and Montserrat sectors in the previously mentioned projects. b. The estimated duration of this project is 10 years. c) The GAM systems currently closest to these communities are experiencing a water deficit. Likewise, on June 20, 2023, through memorandum UEN-OSEP-GAM-2023-00117, the UEN Optimización de Sistemas Ejecución Proyectos GAM forwarded the project initiative for the supply of Cascajal and Monserrat de Vázquez de Coronado, to be included in the Institution's project initiative portfolio and to begin the transfer process to the SAID Sub-Directorate. Regarding palliative measures such as water supply by tanker trucks, it is important to clarify that, pursuant to current regulations, such measures may be applied in cases of rationing and apply only to existing services. It is reiterated that the ASADA currently has a technically and duly grounded limitation for issuing new availability certificates and services.'\n\nLegal Grounds\n\nI — Regarding the Public Service of Potable Water: At the outset, it must be stated that the State, above all, is responsible for safeguarding the Right to Health: it establishes the right to life as a fundamental right protected by the Political Constitution in its article 21, and establishes water as an essential element of life, indispensable for fulfilling other rights such as the Right to Health, thereby making clear that without water there would be no health, sanitation, or satisfaction of many other needs. It must be understood that the entity designated by law as the governing authority (ente rector) in matters of potable water supply and sewerage is AyA, given that the Instituto Costarricense de Acueductos y Alcantarillados, under its Constituent Law in articles 1 and 2, clearly establishes its competencies and is required to direct, administer, and operate everything relating to potable water supply throughout the national territory, with authority to delegate the administration, operation, and maintenance of aqueduct systems. In any given case, technical and legal feasibility is required, as is the existence of service availability, pursuant to articles 6 and 9 of AyA's Service Provision Regulations (Reglamento de Prestación de Servicios del AyA), as can be seen: \"Article 6.- Services. AyA shall provide water supply services for residential use and wastewater sanitation services within its coverage area, provided that technical and legal feasibility exists. The internal systems and installations required to enjoy the services are the responsibility of the user. Article 9.- Guiding principle for granting water service. The provision of water service in existing coverage areas shall be governed by the principle that human consumption is a priority. In the case of deficit systems, AyA shall ensure the necessary hydrological and hydraulic conditions, aimed at granting availability and eventual connection of the service, for requests corresponding to the maximum growth development.\" (See AyA Service Provision Regulations) In that regard, as stated above and in accordance with Office No. GSD-UEN-GAR-2026-01577, the ASADA of Cascajal de Coronado is the authorized operator in that community and holds a Delegation Agreement (Convenio de Delegación) for the administration, operation, maintenance, and development of the system, signed with AyA since March 11, 2003, and is the enabled operator for service provision in said community.\n\nII — Regarding Service Availability Certificates: It is essential to clarify that, for the issuance of service availability certificates, the relevant provisions are those of AyA's Service Provision Regulations, Board of Directors Agreement No. 2020-442, in its articles 7.72, 7.73, 8, 14, and 30, as can be seen: \"7.72 Technical inspection: Specialized review conducted by AyA and/or the delegated operator regarding the operation and use of water, sanitation, and metering systems located on public roads, in right-of-way easements (servidumbres de paso), or on private properties and buildings, as provided in article 5, subparagraph i) of AyA's Constituent Law (Ley Nº 2726). This also refers to inspections carried out by AyA as part of its oversight duty, at the various stages of construction of primary works under a developer's responsibility. 7.73. Technical inspection for supply: A review conducted by the operator on its own initiative or at the user's request, in order to update the database with respect to the cadastral registry, service use, and basic service data. Article 8.- Services. AyA shall provide water supply services for residential use and wastewater sanitation services within the coverage area, provided that the area has technical and legal feasibility. The internal systems and installations required to enjoy the services are the responsibility of the user. Article 14.- Conditions for service provision. AyA shall provide its services upon verification of technical feasibility for built or to-be-built properties intended for residential use, or for commercial or industrial activities that comply with the requirements and uses authorized under these regulations. Potable water and sanitation services shall be provided by AyA on public roads or streets or on a pipeline and right-of-way easement (servidumbre de tubería y de paso) registered in favor of AyA or registered in favor of third parties, as applicable pursuant to article 16 of these regulations. The foregoing applies only when AyA networks are in operation. If the public network does not reach the connection point, AyA shall, within no more than 15 days, propose to the owner or possessor the construction of a branch line extension (ramal) or other components of the hydraulic system, in compliance with the requirements detailed by AyA in article 39 of these regulations through the corresponding technical study. In highly qualified cases, particularly on socioeconomic and sanitary risk grounds, and in conformity with provisions issued by AyA, it may carry out the branch line extension and/or other hydraulic components in order to guarantee access to potable water and sanitation as a human right and in compliance with its legal obligation to guarantee service provision throughout the national territory. The special qualification must be duly substantiated by the GAM and Peripheral Systems Management Operating Sub-Directorates or by the Delegated Systems Management Sub-Directorate, as applicable, through an administrative resolution, to be issued within 20 business days from the generation of the request. Article 30.- Admissibility requirements and conditions for the request for a service availability certificate. The request for a service availability certificate must be made by the property owner or their legal representative, pursuant to article 15 of these Regulations, through the physical, digital, or virtual platforms offered by the public service provider. For such purposes, the following requirements must be submitted in physical or digital form: a) Request form provided by AyA, physically or digitally available on AyA's website and on the APC-R platform, fully completed and signed by the registered owner, possessor, representative, or legally authorized party, in accordance with the form of submission, indicating the purpose of the availability and a detailed description of the project. b) Presentation of an identification document of the property owner or their legal representative. AyA shall exempt the applicant from submitting this requirement upon having the technological capability to verify it. In accordance with the verification of the conditions required for service approval as generally set forth in article 15 of these Regulations, AyA is responsible for verifying the requirements listed therein, as well as the general conditions established therein for all proceedings.\" For the specific case of ASADAs, pursuant to AyA's Service Provision Regulations, the provisions of articles 5, 39, and 46, subparagraphs a), b), and c) of the ASADA Regulations, Executive Decree No. 42582-S-MINAE, shall apply, as follows: \"Article 5. Service provision to users. The services provided by ASADAs shall be governed, among others, by the Regulations for the Provision of AyA Services, the Regulations for the Administrative Collection and Service Suspension of the Instituto Costarricense de Acueductos y Alcantarillados, the Regulations for the Provision of Services by Collection Agents of the Instituto Costarricense de Acueductos y Alcantarillados, the Technical Regulation: Provision of Aqueduct, Sanitary Sewerage, and Hydrant Services (AR-PSAyA-2015), the Fee for Water Use (Decreto Nº32868). Also by the Law on the Promotion of Women's Social Equality No. 7142, the Law on Protection of Citizens against Excess Requirements and Administrative Procedures (Ley 8220), the General Law on Internal Control No. 8292, and any other regulations within our legal system that may apply, by integration of norms. Article 39. Service provision. The ASADA is responsible for providing and ensuring the adequate provision of potable water supply and wastewater sanitation services in the area of delegated competence, pursuant to AyA's Service Provision Regulations. Article 46. Service Granting. The ASADA shall carry out the relevant actions to ensure that all new or future service connections to the systems are granted in accordance with its water and hydraulic capacities. When necessary, the person seeking the new service shall, at their own expense, carry out the improvements required to increase capacity so that service provision complies with the principles of quantity, quality, and continuity, in conformity with technical regulations and provisions issued or validated by AyA, observing the following: a. Water Capacity Certificate (Constancia de Capacidad Hídrica): The ASADA may issue it in accordance with the provisions regulating this matter in the AyA Service Provision Regulations. b. Service Availability Certification: The ASADA may issue it in accordance with the provisions regulating this matter in the AyA Service Provision Regulations. c. Validity and extension: The validity periods, as well as the extensions, of the Water Capacity Certificate and the Service Availability Certification shall be governed by the AyA Service Provision Regulations.\" Based on the foregoing, in order for the ASADA of Cascajal de Coronado to issue a service availability certificate, said delegated operator requires demonstrated technical and legal feasibility pursuant to the above-cited regulations, in order to assess the specific case. Said technical feasibility has been reaffirmed by the Sala Constitucional through its judgment No. 2023-007599, as follows: \"In this regard, the Sala Constitucional has repeatedly recognized that ICAA, the ASADAs, and the municipalities providing potable water supply services are fully capable of requiring compliance with requirements established under the legal system, and of weighing legal and technical considerations, prior to approving or rejecting potable water availability requests submitted to them. That being the case, while a fundamental right to water exists that may be asserted against the relevant Administration, the provision of the service may well be subject to compliance with the requirements established for its granting and to the material possibility of supply. Based on the foregoing, it is evident that the reason potable water and sewerage availability has not been granted is the existence of a technical impossibility, as it was determined that there was no potable water availability due to insufficient water capacity in the Puriscal aqueduct in the Piedades sector, with the result that the denial complained of by the appellant has not been arbitrary. It must be recalled that the responsible authorities are obligated to expand their infrastructure to guarantee the population's access to the service; and for the case at hand, it can be seen that in 2020 an expansion project was designed for the aqueduct administered by the ASADA of Grifo Alto, with the purpose of supplying the Calle Máquina, Cuesta de Guerra, Calle Principal, and Ojo de Agua sectors; however, it was not possible to secure the well that would supply water to the community. In other words, measures have been attempted, but the impossibility persists, and this Chamber's case law serves as justification for not granting the service. This does not preclude the plaintiff party from challenging, before the administrative-contentious jurisdiction, any actions by the ASADA or ICAA directed at fulfilling the obligation to expand the aqueduct, if such actions are considered inconsistent with sub-constitutional regulations.\" (See judgment of 9:20 a.m. on March 1, 2023, No. 2023-007599) Based on what was established by ORAC Metropolitana through Office No. GSD-UEN-GAR-2026-01577, it is concluded that the ASADA of Cascajal de Coronado does not have the technical feasibility to consider issuing service availability certificates.\n\nIII — Regarding the Granting of Permanent Services: As a complement to the foregoing discussion on service availability certificates, it is also vitally important to emphasize the procedure required for the granting of permanent services, should service availability have been previously granted by the ASADA and remain within its validity period, pursuant to articles 39 and 46 of the ASADA Regulations, as well as articles 67 and 68 of the Service Provision Regulations, as follows: \"Article 67.- General conditions for the processing of a permanent connection. For the granting of the service, the property for which it is requested must previously hold a positive service availability certificate associated with the purposes, nature, and goals for which it was approved. Should any registral changes (movimientos registrales) relating to property ownership be detected, AyA shall process the request with respect to the duly authorized titleholder. Upon cadastral variations, such as changes to areas and/or boundaries that may affect the flow rate and number of services defined for the granting of the service availability certificate, the interested party must carry out the procedure set forth in article 30 of these regulations. Article 68.- Requirements and conditions for the request for permanent connections to registered properties. For a permanent connection request, the property owner, or the authorized applicant or their legal representative, pursuant to article 15 of these Regulations, must submit the following requirements before the physical or virtual platforms offered by AyA or the delegated operator, in physical or digital form: a. Completed request form provided by AyA, signed by the owner, the authorized applicant, or their legal representative. b. Identification document of the owner, the authorized applicant, or their legal representative. Where access to the Civil Registry's technology platform displaying the photograph and signature of the interested party exists, AyA shall exempt them from presenting this requirement, and it shall only be necessary for them to provide their national identity card (cédula de identidad) number. c. Cadastral map (plano catastrado). Should the property not have a cadastral map, or should it be in the process of a segregation or subdivision (fraccionamiento), a survey plan (plano de agrimensura) must be submitted that complies with the provisions of Article N° 2, subparagraph q) of Executive Decree No. 34331, the current Regulations of the National Cadastre Law, with its corresponding filing minute (minuta de presentación) and the corresponding seal of the Colegio Federado de Ingenieros y Arquitectos (CFIA), in conformity with the CFIA's current Special Regulations for the Topography Project Administrator (APT) and its amendments, or the regulations that replace them. Where technological feasibility exists, AyA shall exempt the applicant from presenting this requirement. d. Project Number processed before the CFIA's Construction Project Administration (APC) platform, duly approved, so that AyA may verify the existence of a valid construction permit, in the event the property is to be built. The permit must be consistent with the flow rate and purposes for which the availability was approved. e. Payment of the connection fee, as established in article 76 of these regulations. f. In the case of requests for new services for activities that generate special-type wastewater, the interested party must submit a sworn statement indicating that the discharge into the sanitary sewer system will comply with the regulations, and an approval note from the Ministerio de Salud describing the type of activity to be carried out as well as the quantity and quality of the discharge to be released; also, a specification of the treatment system required to comply with current environmental regulations. g. In those cases where the public service must be provided in areas of the country with special characteristics, under the modality of territories administered by the State or its institutions under a special legal regime — such as the maritime-terrestrial zone, border zones, leased zones, indigenous territories, tourism development poles, areas within the railway right-of-way, among others — applicants must submit the express authorization of the corresponding entity, pursuant to the applicable regulations. In accordance with the verification of the conditions required for service approval as generally set forth in article 15 of these Regulations, AyA is responsible for verifying the requirements listed therein, as well as the general conditions established therein for all proceedings. When an applicant approaches AyA to request sanitation and/or water services for residential use on an agricultural, forestry, or livestock parcel, for the purpose of building the homes or structures authorized by the current National Subdivision and Development Control Regulations (Reglamento para el Control Nacional de Fraccionamientos y Urbanizaciones) of INVU, compliance with the requirements requested for each scenario in these regulations must be met. Once all requirements have been fully submitted, the Institution shall have 15 business days to resolve the request. The foregoing is highlighted in connection with the second point regarding the indispensable obligation to hold a service availability certificate for permanent services. As set forth in articles 67 and 68 of AyA's Service Provision Regulations, it is reiterated that in the specific case at hand the conditions established by said regulations are not met.\n\nIV — Material Impossibility: Also, and given that we are faced with a material impossibility (imposibilidad material) for granting a service availability certificate, as highlighted in technical reports GSD-UEN-GAR-2020-04005 and No. GSD-UEN-GAR-2026-01577: \"…Considering the foregoing, and in the absence of new official information from the ASADA regarding the incorporation of new sources, they are requested to address as soon as possible the recommendations issued in the aforementioned report and to immediately refrain from issuing new availability certificates and new services until a clear response has been received from the ASADA regarding the current state of affairs with respect to its supply sources…\" Based on the foregoing, the Tribunal Constitucional is advised that due to the absence of new supply sources there exists a material impossibility for considering the granting of service availability certificates. It is important to highlight what the Sala Constitucional determined with respect to the obligations of interested parties in cases where system improvements are required, as follows: \"It is therefore evident that the reason the potable water availability certificates of interest to the appellant and their represented party cannot be issued is because the legal requirements currently demanded by the applicable regulations have not been met, meaning that the denial complained of by the appellant has not been arbitrary or excessive, but is rather due to the existence of a legal impossibility, which is precisely the failure to comply with requirements established in the relevant regulations, and also due to a technical impossibility, which is considered reasonable given that basic infrastructure must exist to provide the potable water service. In this regard, it must be recalled that the Chamber does not have jurisdiction to override legally established requirements or conditions for the granting of a public service, which appears to be the underlying claim of the appellant in this writ of amparo (recurso de amparo).\" (See Judgment of the Sala Constitucional No. 2018-012899) We reiterate that the denial alleged is based on the absence of water resources, since new sources are required, as established by ORAC Metropolitana through its technical report No. GSD-UEN-GAR-2026-01577.\n\nV — Regarding Matters of Mere Legality: We consider this matter to be one of mere legality (mera legalidad), given the factual scenario presented by the appellant and her supporting evidence, primarily relating to: the request for a service availability certificate and the request for permanent service, the latter without a service availability certificate. These are matters that must be addressed in the administrative venue and/or the ordinary courts as required by the appellant, since at no point has my represented party denied the appellant's right of access to the potable water and/or sewerage service in a capricious manner, but rather requires the interested party to comply with the requirements established by articles 30, 37, 67, and 68 of AyA's Service Provision Regulations, Board of Directors Agreement No. 2020-442. As can be seen, the administration has not restricted or violated any fundamental right to the detriment of the appellant. The foregoing does not constitute a violation of fundamental rights to health or to life, or a failure to respond to an administrative petition. For this reason, it must be clarified that in such a scenario the Sala Constitucional has indicated in its case law that there are proceedings that are not within the jurisdiction of the constitutional courts, that is, cases involving matters of mere legality rather than constitutionality, which must be debated in the corresponding ordinary courts. In this regard, Judgment No. 2001-06683 of the Sala Constitucional states that: \"Sole Point. This Chamber has stated on multiple occasions that the facts giving rise to this appeal are matters of mere legality, debatable in the administrative and administrative-contentious (contencioso-administrativo) venue, so that those claims must be rejected outright, in accordance with the authority conferred upon this Tribunal by article 9 of the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), in conjunction with articles 59 and 60 of the Law Regulating the Administrative-Contentious Jurisdiction (Ley Reguladora de la Jurisdicción de lo Contencioso-Administrativo).\n\n(...)Such administrative proceedings (procedimientos administrativos) are aimed at determining whether the reported facts exist, and for this purpose, the evidence submitted by the parties and that collected ex officio, pursuant to the powers conferred by the Ley General de Administración Pública itself, are the indispensable elements of conviction needed to support an administrative act (acto administrativo) in accordance with the legal order (ordenamiento jurídico). From the regulations cited above, it is concluded that the regulatory body (ente regulador) must establish a procedural balance between the guarantees afforded to users of regulated services and the interests of public service providers (prestatarios de los servicios públicos), seeking the prevalence of substantive truth (verdad real) over formal truth (verdad formal), as the respondent authority erroneously interprets it, while always safeguarding the rule of law (bloque de legalidad), due process (debido proceso), and the other guarantees provided for in our legal order.\" (emphasis not ours)\n\nVI — Regarding the actions of my client: Finally, with respect to ICAA (Instituto Costarricense de Acueductos y Alcantarillados) within the present proceedings (diligencias) related to the ASADA of Cascajal de Coronado, as evidenced in official communication number GSD-UEN-GAR-2026-01577, the ordinary obligations have been met, as follows: \"…As for AyA's instruction to the ASADA to seek new supply sources (fuentes de abastecimiento), this does not correspond to an action with immediate results; rather, the ASADA must carry out a series of steps that require financial resources, environmental permits (permisos ambientales), technical capacity, and legal viability. For its part, the ORAC Metropolitana has raised the need for the ASADA Cascajal de Coronado to be taken over by AyA. On this matter, on November 28, 2022, through memorandum SG-GSGAM-2022-02123 and report UEN-OS-GAM-2022-00175, the Subgerencia Sistemas…\" (see ORAC Metropolitana report No. GSD-UEN-GAR-2026-01577)\n\nAll of the foregoing falls within the governing competencies (competencias rectoras) at the national level for the supply of drinking water (abastecimiento de agua potable), and more specifically within what is established by the Ley Constitutiva de AyA in Articles 1 and 2, Articles 14, 30, 37, 67, and 68 of the Reglamento de Prestación de Servicios del AyA, as well as Articles 4, 5, 39, and 46 of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueductos y Alcantarillados Comunales (ASADAS), and without violating the fundamental rights of the appellant (recurrente); such feasibility verification (comprobación de factibilidad) does not entail a violation of fundamental rights, as has been reaffirmed by the Sala Constitucional with respect to said water system (acueducto) in its ruling handed down at nine hours and twenty minutes on May 26, 2023, No. 2023-012181, as follows:\n\n\"This Court has held that, although there is a fundamental right to drinking water, its exercise is not unconditional to the point of imposing an obligation on the entities that provide this service to supply it under any circumstances and at any time. It has been repeatedly recognized that ICAA, the community aqueduct and sewerage managing associations, and the municipalities that provide drinking water supply services are fully empowered, prior to approving or rejecting drinking water availability requests (solicitudes de disponibilidad de agua potable) submitted to them, to require compliance with the requirements established in the legal order and to weigh legal and technical considerations (see, for example, rulings No. 2009-003825 of 16:49 hrs. on March 10, 2009, and No. 2010-010768 of 10:52 hrs. on June 18, 2020). Verifying compliance with the legal or technical requirements to obtain the public service in question falls to the respective administrative authorities, and this Court may not venture into that domain, as it belongs to ordinary legality and falls outside its jurisdiction. In the case at hand (sub lite), from the report submitted by the respondent authority and the evidence introduced into the record, it has been duly established that the denial of water availability (disponibilidad de agua) challenged by the appellant was not issued arbitrarily or capriciously, but rather is attributable to a real and current lack of water capacity (capacidad hídrica) in the water system. In addition to the foregoing, it is explained why it is not possible to address a case such as that of the protected parties (tutelados); this is because the sector where the property is located lacks water capacity; a situation that has been evidenced and documented through technical reports issued by the Rural Aqueduct Management Business Unit (UEN Gestión de Acueductos Rurales) of ICAA, in which the respondent ASADA is expressly instructed to refrain from issuing new availability certificates or services. Furthermore, even though the appellants allege that an availability certificate (constancia de disponibilidad de agua) had previously been issued to them, the fact is, according to the respondent authority's report, that it was issued for a specific purpose — namely, a bank credit application — and had a limited validity period. That is, the case of the parties seeking amparo protection (amparados) was re-examined, and the technical impossibility of providing water service for the requested purposes was determined. In this context, it must be noted that this Court cannot usurp the powers of the respondent institution in its role as active Administration (Administración activa) and, prior to verifying the legal and regulatory requirements of the case, order that the requested service be granted. Under these circumstances, this Court finds no omission or arbitrary action on the part of the respondent authorities. For the foregoing reasons, the appropriate course of action is to dismiss the present appeal in all its aspects.\" (See Sala Constitucional ruling No. 2023-012181)\n\nIn conclusion, we may state the following:\n\n1- According to report No. GSD-UEN-GAR-2026-01577 and its annexes, since September 24, 2020 there has been a recommendation to the ASADA of Cascajal de Coronado not to issue service availability certificates until new supply sources are identified; said recommendation remains in effect.\n\n2- According to what has been established by the ORAC Metropolitana through official communication GSD-UEN-GAR-2026-01577 and its annexes, there is no indication that said ASADA has incorporated new sources,\n\n3- There is no demonstrated technical feasibility (factibilidad técnica) to grant the appellant's request,\n\n4- There is no pending process on the part of my client with the appellant.\n\nFor the reasons set forth, we can affirm that my client has not failed in any of its responsibilities, nor has it violated the fundamental rights of the appellant, much less the appellant's right to health or life.\n\nVII — Prayer for Relief: Based on the factual and legal grounds set forth, I respectfully request the following: that the present constitutional protection appeal (recurso de amparo) be dismissed in all its aspects, that the file be archived, and that AyA not be ordered to pay costs, damages, or losses, since we reiterate that through the Administration's actions the fundamental rights of the appellant have not been violated, and all steps within our competence to provide a definitive solution to the situation have been taken.\"\n\n6.- By a written submission incorporated into the electronic case file (expediente) on April 14, 2026, Rodolfo Argüello Rodríguez, in his capacity as president of the Board of Directors (Junta Directiva) of the Asociación de Acueducto de Cascajal de Coronado, responds to the hearing. He states: \"FIRST: The allegations are false as presented. In October 2024, the appellant had no standing to file a request for a water availability certification (disponibilidad hídrica), since ownership of the property was held by Mr. Octaviano Barquero Alvarado until April 15, 2025, who, by means of an official letter (oficio) dated November 22, 2024, and an application form dated February 4, 2025, submitted a request along the lines alleged by the appellant. SECOND: The allegations are false as presented. The grounds for the claim asserted by the appellant are those put forward by Mr. Barquero Alvarado, not by her, and those grounds were duly addressed by official letter No. ASADA ND 2025 02 0602 of February 6, 2025, denying the request based on the specific guidelines issued by the sector's governing body (ente rector) — the Instituto Costarricense de Acueductos y Alcantarillados — through technical report No. UEN-GHAR-2018-03743, signed by Engineer Esteban Ramírez Gutiérrez, and through a communication addressed to the Board of Directors of the ASADA de Cascajal de Coronado by official letter No. GSD-UEN-GAR-2020-04005, signed by Adriana María Rojas Ugalde of the UEN Gestión de Acueductos Rurales, which instructed the members of the ASADA's Board of Directors to refrain from issuing new water availability certifications or services given the water deficit (déficit hídrico) affecting the water supply system (acueducto), and until new supply sources were secured, as doing otherwise would be detrimental to the public service being provided to current subscribers (abonados). THIRD: This is false. The appellant's narrative, aimed at pointing to 'a persistent insufficiency' in the ASADA's management, rests on Mr. Alvarado Barquero's subjective view that the Cascajal area has abundant water resources, while omitting that most of those resources are used by the Instituto de Acueductos y Alcantarillados to meet the water needs of residents of the Gran Área Metropolitana, and that the scarce sources that supply the service provided by the ASADA I lead are dedicated to maintaining service for existing subscribers or users, and that it is in defense of their fundamental right to access potable water that no new water availability certifications or water supply services can be granted, merely to satisfy the expectations of someone who is not a subscriber (…) PRAYER FOR RELIEF: Based on the foregoing arguments and the evidence submitted, I request that this Court declare the writ without merit, as the ASADA I lead has not violated any of the appellant's fundamental rights.\"\n\n7.- The legal requirements have been observed in the proceedings conducted.\n\nDrafted by Justice Castillo Víquez; and,\n\nConsidering:\n\nI.- Preliminary matter. In the case of amparo writs (recursos de amparo) filed against private parties, prior to any analysis of the merits of the alleged constitutional violation, it must be examined whether, in the present case, one of the circumstances that makes such a writ admissible is present, and, if so, whether it is in fact admissible. The Ley de la Jurisdicción Constitucional provides in article 57 that an amparo writ lies against acts or omissions of private-law subjects when they act, or are required to act, in the exercise of public functions or powers, or when they occupy, in law or in fact, a position of power against which common judicial remedies are clearly insufficient or untimely to guarantee the rights or fundamental freedoms referred to in article 2, subparagraph a), of the same Law. In the present case, one of these prerequisites is met, since the respondents are private-law subjects acting in the exercise of public functions or powers by providing a public service, which is why the writ is admitted for analysis by this Constitutional Chamber.\n\nII.- Subject matter of the writ. The appellant states that on October 10, 2024, a request for a water availability certification for the property registered under registration number (matrícula) 705630, located across from the school in Cascajal, was filed before the Board of Directors of the Asociación Acueducto de Cascajal de Coronado. She notes that on February 6, 2025, by means of official letter No. ASADA ND 2025 02 0602, the ASADA de Cascajal responded that it \"does not have the water capacity to grant the requested potable water availability certification.\" She contends that the ASADA de Cascajal's decision violates her fundamental right of access to potable water. She further notes that since 2020, ICAA had ordered the respondent ASADA to seek new water supply sources; however, this did not occur. She requests the intervention of the Constitutional Chamber.\n\nIII.- Established facts. The following facts, relevant to the decision in this matter, are deemed duly proven, either because they have been so established in the record, or because the respondent authority failed to address them, as required by the initial order:\n\na) By official letter of November 22, 2024, and application form of February 4, 2025, Mr. Octaviano Barquero Alvarado requested a water availability certification for the property located in Cascajal de Coronado, across from the chapel (ermita) of Cascajal, registration number 705630-000, cadastral plan (plano) SJ-2145843-2019 (see response and submitted evidence).\n\nb) By official letter ASADA-ND-2025-02-0602 of February 6, 2025, the respondent association replied: \"In response to your request for the ASADA to grant water availability for the construction of a house on the property located in Cascajal de Coronado, across from the chapel of Cascajal, registration number 705630-000, cadastral plan SJ-2145843-2019, we inform you that the ASADA must currently comply with and coordinate with Acueductos y Alcantarillados regarding the issuance of new water availability certifications or new services under the following conditions: 1.- In accordance with the provisions of the Ley Constitutiva del Instituto de Acueductos y Alcantarillados (No. 2726 of April 1, 1961), that Institution is the governing body for the provision of potable water service in the country. 2.- As established in article 21, item 19) of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueducto y Alcantarillado Comunales, it is a duty of ASADAS to issue the water availability seal (sello de disponibilidad hídrica), provided that technical feasibility, infrastructure, and no detriment to the quality of the service currently provided all exist. 3.- By means of technical report No. UEN-GAR-2018-03743, signed by Engineer Esteban Ramírez Gutiérrez, and official letter No. GSD-UEN-GAR-2020-04005, signed by Adriana María Rojas Ugalde (a copy of the latter is attached), both from the UEN Gestión de Acueductos Rurales, it was established that the ASADA de Cascajal de Coronado presents a water deficit and must therefore refrain from issuing new water availability certifications or services until new supply sources exist, so as not to compromise the service provided to current subscribers. For all of the foregoing reasons, we find it necessary to inform you that the ASADA currently does not have the water capacity to grant the potable water availability certification you are requesting, and therefore your request is denied\" (see submitted evidence).\n\nIV.- On the merits. In the case at hand (sub lite), the appellant states that on October 10, 2024, a request for a water availability certification for the property registered under registration number 705630, located across from the school in Cascajal, was filed before the Board of Directors of the Asociación Acueducto de Cascajal de Coronado. She notes that on February 6, 2025, by means of official letter No. ASADA ND 2025 02 0602, the ASADA de Cascajal responded that it \"does not have the water capacity to grant the requested potable water availability certification.\" She contends that the ASADA de Cascajal's decision violates her fundamental right of access to potable water. She further notes that since 2020, ICAA had ordered the respondent ASADA to seek new water supply sources; however, this did not occur. She requests the intervention of the Constitutional Chamber.\n\nFrom the review of the record, it is established that by official letter ASADA-ND-2025-02-0602 of February 6, 2025, the respondent association replied: \"In response to your request for the ASADA to grant water availability for the construction of a house on the property located in Cascajal de Coronado, across from the chapel of Cascajal, registration number 705630-000, cadastral plan SJ-2145843-2019, we inform you that the ASADA must currently comply with and coordinate with Acueductos y Alcantarillados regarding the issuance of new water availability certifications or new services under the following conditions: 1.- In accordance with the provisions of the Ley Constitutiva del Instituto de Acueductos y Alcantarillados (No. 2726 of April 1, 1961), that Institution is the governing body for the provision of potable water service in the country. 2.- As established in article 21, item 19) of the Reglamento de las Asociaciones Administradoras de Sistemas de Acueducto y Alcantarillado Comunales, it is a duty of ASADAS to issue the water availability seal, provided that technical feasibility, infrastructure, and no detriment to the quality of the service currently provided all exist. 3.- By means of technical report No. UEN-GAR-2018-03743, signed by Engineer Esteban Ramírez Gutiérrez, and official letter No. GSD-UEN-GAR-2020-04005, signed by Adriana María Rojas Ugalde (a copy of the latter is attached), both from the UEN Gestión de Acueductos Rurales, it was established that the ASADA de Cascajal de Coronado presents a water deficit and must therefore refrain from issuing new water availability certifications or services until new supply sources exist, so as not to compromise the service provided to current subscribers. For all of the foregoing reasons, we find it necessary to inform you that the ASADA currently does not have the water capacity to grant the potable water availability certification you are requesting, and therefore your request is denied.\"\n\nIn this regard, the respondent authorities report that, due to the absence of new supply sources, there is a material impossibility of considering the issuance of service availability certificates (constancias de disponibilidad de servicios).\n\nOn this point, this Constitutional Chamber has held that ICAA, community water supply and sewerage managing associations, municipalities, and other institutions that provide potable water supply services may reject potable water service requests submitted to them, or condition such requests, when there are technical or legal reasons that justify doing so. Thus, in Ruling No. 2025041174 of 10:10 a.m. of December 11, 2025, it was held:\n\n\"V.- On the merits. In the case under review, the petitioner challenges the denial of potable water service for his property located in Esterillos, as well as the technical rationale that supported that decision. It should be recalled that the service availability certificate consists in verifying and communicating the actual, present existence of water and hydraulic capacity.\n\nThe Constitutional Chamber found that the respondent authority informed the applicant of the reasons why it was not possible to grant the requested service, indicating that the water balance (balance hídrico) of system PC-A28 is negative; that is, there is currently no available water resource from which to reserve flow capacity (caudal). He was also informed that he could file the corresponding administrative appeals against that administrative act, a remedy which the petitioner exercised, having had access to the case file and the technical reports supporting the decision. It follows that the protected party (amparado) has no grounds for alleging a violation of his right to water or his right to due process.\n\nThis Constitutional Chamber has reiterated on multiple occasions that when there is a technical impossibility to connect the requested service, no fundamental right is violated, since such a situation stems from the absence of technical conditions for the installation of the service and not from arbitrary conduct by the Administration (see, among others, Rulings No. 2007-03355 of 1:37 p.m. of March 9, 2007; No. 2007-010341 of 2:45 p.m. of July 20, 2007; and No. 2017-011477 of 9:15 a.m. of July 21, 2017).\n\nIt is clear that the Instituto cannot provide the service requested by the petitioner, as it is not technically feasible to do so; therefore, it is not possible to grant the request in the terms sought. Consequently, the denial of potable water service to the protected party's property is duly reasoned for the purposes of this constitutional jurisdiction (jurisdicción constitucional), since there are technical reasons that justify it, specifically the insufficient water capacity of the water supply system.\n\nFurthermore, it must be noted that the review of compliance with legal or technical requirements to obtain service availability is a matter for ordinary administrative or judicial authorities, and this Constitutional Chamber may not, as a general rule, intervene in such matters, as they involve issues of ordinary legality (legalidad ordinaria) outside its jurisdiction. Therefore, if the petitioner is dissatisfied with the arguments set forth by the respondent authority, or considers that other measures could have been adopted to allow access to the service — such as a conditional availability certification, the use of water tanker trucks, or other alternatives — he may raise the relevant claims before the competent administrative or judicial bodies, where he may fully litigate the merits of the matter and assert his claims.\n\nFor the foregoing reasons, the existence of circumstances warranting the intervention of this constitutional jurisdiction is prima facie ruled out in relation to these matters, and the writ must accordingly be declared without merit.\"\n\nThat being so, this Tribunal finds that these considerations apply to the case under study, as it involves the same type of claim. Accordingly, as explained in the foregoing precedent, there is at this time a technical impossibility that prevents granting the requested service, since there is no water capacity to issue a water availability certification, and therefore it is not possible to establish an unlawful or arbitrary act on the part of the respondents.\n\nMoreover, it should also be emphasized that the verification of compliance with legal or technical requirements to obtain service availability is a matter for common administrative or judicial authorities, and this Constitutional Chamber may not, as a general rule, intervene in such matters, as they involve aspects of ordinary legality outside its jurisdiction. Accordingly, if the petitioner is dissatisfied with the grounds put forward by the respondents, she should raise the corresponding arguments before the competent ordinary bodies, where she may fully litigate the merits of the matter and assert her claims.\n\nIn light of the foregoing, any situation warranting the intervention of this constitutional jurisdiction is ruled out a priori, and the writ is therefore declared without merit.\n\nV.- Dissenting opinion (voto salvado) of Justices Cruz Castro and Rueda Leal, drafted by the former. We dissent from the majority opinion. In the present case, the Administration's refusal to provide an essential service is upheld based on technical considerations relating to the insufficiency of the water infrastructure; however, the majority fails to adequately weigh the fact that access to potable water constitutes a fundamental right, indispensable to life, health, and human dignity.\n\nArticle 21 of the Constitución Política protects human life, and this Tribunal has recognized that access to water for human consumption is a material precondition of that right. Similarly, article 50 of the Constitution imposes on the State the duty to guarantee the well-being of all inhabitants, which necessarily includes effective, adequate, and continuous access to potable water. At the international level, instruments such as the International Covenant on Economic, Social and Cultural Rights — interpreted by the Committee on Economic, Social and Cultural Rights (Comité DESC) in its General Comment No. 15 — recognize the human right to water, obligating States to adopt positive measures for its full realization. There is a heightened obligation imposed on the State in a social and democratic rule of law, and for this reason the supply of water is a priority obligation of the public authorities.\n\nFrom this perspective, the invocation of technical limitations cannot be erected as an absolute justification for disregarding a basic subsistence need. The Administration cannot merely take note of the inadequacy of the system; it has a legal duty to plan, anticipate, and carry out the actions necessary to progressively guarantee access to water service, especially when it concerns human consumption.\n\nThe majority approach normalizes a structural omission: it accepts that the lack of infrastructure relieves the State of its obligations, when precisely that deficiency evidences a failure of its duty of foresight. The issue is not one of compelling the impossible, but of requiring the Administration to adopt reasonable, alternative, or progressive measures so as not to leave persons without protection.\n\nWater is not an ordinary service — it is an essential human right, and therefore the respondent authority cannot shirk its duty to guarantee it by hiding behind technical limitations without offering effective solutions.\n\nFor these reasons, we believe the writ should have been declared with merit, at least in order to order the Administration to adopt specific and progressive measures to ensure, within a reasonable period of time, effective access to potable water for the protected party. Water is a fundamental good and right whose effective force must be assured — it is an inescapable duty.\n\nVI.- Documentation submitted to the case file. The parties are hereby notified that, if they have submitted any paper documents or objects or evidence contained in any additional device of an electronic, computer-related, magnetic, optical, telematic, or new-technology nature, these must be retrieved within a maximum period of 30 business days from the notification of this ruling. It is hereby warned that any materials not collected within that period will be destroyed, pursuant to the \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\" (approved by Corte Plena under item XXVI of session No. 27-11 of August 22, 2011, and published in Boletín Judicial No. 19 of January 26, 2012) and pursuant to item LXXXI of session No. 43-12 of the Consejo Superior del Poder Judicial of May 3, 2012.\n\nPor tanto:\n\nThe writ is declared without merit. Justices Cruz Castro and Rueda Leal dissent, declare the amparo proceeding with merit, and order the adoption of specific measures and that the protected party be given a definite date by which water supply will be satisfied.\n\nFernando Castillo V.\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
