Consecuentemente, el requerimiento de que la gestión se formalice con el cumplimiento de los requisitos de identificación, presentación de planos y registro oficial que el manual técnico exige, resulta una medida proporcional, razonable y necesaria para salvaguardar la seguridad jurídica y el control interno de la infraestructura registral y ambiental del país.\n\nDado que el recurrente obtuvo una respuesta oportuna y debidamente justificada en la que se le orientó de forma correcta sobre el procedimiento técnico aplicable para canalizar su pretensión, no se constata vulneración alguna a los derechos de petición ni de acceso a la información pública. El descontento del amparado respecto de la inexistencia de una plataforma digitalizada para este trámite específico constituye un asunto de mera legalidad y de oportunidad administrativa que desborda la competencia de esta jurisdicción constitucional, correspondiendo a la Administración Activa el diseño y despliegue de sus sistemas informáticos según su disponibilidad presupuestaria.",

  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-012584-0007-CO \n\nRes. Nº 2026019182\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del veintinueve de mayo de dos mil veintiseis .\n\n Recurso de amparo que se tramita en expediente número 26-012584-0007-CO, interpuesto por Nombre01, cédula de identidad CED02, contra el MINISTERIO DE AMBIENTE ENERGÍA (MINAE).\n\nResultando:\n\n 1.- Por escrito recibido en la Secretaría de la Sala a las 08:47 horas del 13 de abril de 2026, el recurrente interpone recurso de amparo contra el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC) y manifiesta que el 10 de abril de 2026, remitió vía correo electrónico a la dirección: ...01, una gestión en la que solicitó lo siguiente: \"(...) me puedan indicar si la propiedad 2-111640-000 con el plano A-53447-2025 ubicado en Alajuela, San Carlos, Quesada en Dulce Nombre, propiedad a nombre de Nombre02 cedula número CED01, se encuentra dentro de algún área protegida y/o administrada por esta institución. Lo anterior para fines de diligencias de información posesoria. (sic) (...)\". (véase copia con el respectivo acuse de recibido, aportada como prueba). Indica que el 13 de abril siguiente, la autoridad recurrida le contestó que dicha gestión sólo puede hacerse de manera presencial-físico (véase copia aportada como prueba). Reclama que, a la fecha de interposición de este recurso, no se le había dado acceso alguno a la información solicitada, lo cual estima viola sus derechos fundamentales, por existir una plataforma digital desde hace años, sin haber razón para obligarle a la presencialidad.\n\n 2.- Informa bajo juramento David Chavarría Morales, en condición de Director Ejecutivo del Sistema Nacional de Áreas de Conservación (SINAC), lo siguiente: \n\n“…\n\nI CUESTIONES PREVIAS \n\nCon ocasión de la admisión del recurso de amparo interpuesto, esta Administración procedió a la inmediata implementación de los mecanismos internos de actuación previstos para tales supuestos, con el objeto de asegurar la emisión de una respuesta institucional oportuna, eficaz y ajustada a los plazos perentorios establecidos por el ordenamiento jurídico. En ese contexto, se requirió formalmente la remisión de antecedentes, informes y documentación de respaldo a las dependencias y órganos con competencia funcional y material en relación con la materia objeto de controversia. Como resultado de dichas gestiones, se recibió el informe técnico-administrativo correspondiente por parte del funcionario Steven Céspedes, del cual se colige como se desarrollará de manera pormenorizada en el análisis subsecuente que la actuación de la Administración ha observado criterios de diligencia reforzada, razonabilidad y proactividad administrativa, ejerciendo sus competencias dentro del marco constitucional y legal aplicable, y en pleno respeto de las atribuciones y potestades que le han sido conferidas por el ordenamiento jurídico vigente. \n\nI SOBRE LAS ACTUACIONES DE MI REPRESENTADA SOBRE LOS SEÑALAMIENTOS OBJETO DEL AMPARO: \n\nPRIMERO: Efectivamente el aquí recurrente remitió un correo electrónico con solicitud de tramite al correo institucional del funcionario Steven Céspedes Hidalgo, el día 10 de abril del 2026, mediante el cual solicitó se le indicara si la finca identificada con plano A-53447-2025 y finca 2-111640-000, ubicada en provincia de Alajuela, cantón San Carlos, distrito Quesada, Dulce Nombre, se encontraba dentro de algún área protegida y/o bajo administración del SINAC, indicando que la consulta era requerida para diligencias de información posesoria. \n\nSEGUNDO: En respuesta a la solicitud del recurrente mediante correo electrónico de fecha 13 de abril de 2026, se informó al solicitante que la gestión requerida debía realizarse mediante el canal formal correspondiente, señalándose que debía presentarse de manera presencial, debido a la naturaleza técnica de la consulta. Respuesta que además en su escrito de presentación del amparo, el recurrente admite haber recibido e inclusive aporta prueba de la atención a su correo de solitud. \n\nTERCERO: Indica el recurrente en el punto cuarto de su solitud de amparo: “Por muchos años he insistido a esta institución en la necesidad de habilitar un medio digital para hacer las diferentes solicitudes, inclusive basta con un correo electrónico; y desde hace años han indicado que están implementando una plataforma digital”. Es importante señalar que para el trámite que pretende el recurrente solicitar, no se encuentra hoy en el Sistema Nacional de Áreas de Conservación o por medio de la AFE, una plataforma digital que permita el desarrollo digital de estos trámites. Y que su tramitación está sujeta a lo establecido en Manual de Procedimientos para la Resolución de Visados y Certificaciones de Planos R-SINAC-037-2009 Publicada en La Gaceta N° 134 del 13/07/2009. \n\nI SOBRE EL USO DEL CORREO ELECTRÓNICO INSTITUCIONAL \n\nEs oportuno señalar que la Sala Constitucional ha desarrollado una línea jurisprudencial clara respecto del ejercicio del derecho de petición y pronta respuesta mediante medios electrónicos. En la sentencia N.º 2008-009670, de las 09:55 horas del 13 de junio de 2008, la Sala expresó: \n\n“(…) En el marco de la sociedad de la información y el conocimiento, los derechos fundamentales pueden ser ejercidos a través de las nuevas tecnologías de la información. En lo que al derecho de petición y pronta respuesta se refiere, la utilización de los medios electrónicos le da nuevos matices, los cuales deben ser ponderados. Siempre teniendo en consideración su eficacia progresiva y expansiva, pero también, tomando en cuenta el carácter no absoluto de los derechos fundamentales, es posible concluir que, para el ejercicio del derecho de petición y pronta respuesta, empleando los medios que las nuevas tecnologías facilitan, es importante que el requerimiento sea canalizado a través de una página web de libre acceso del ente o el órgano público. Adicionalmente, ese dominio electrónico debe contar con un hipervínculo direccionado hacia un correo electrónico dispuesto específicamente para recibir solicitudes, sea sobre un tema particular o bien que sirva como buzón para todo tipo de gestiones (…)”. \n\nA partir de este panorama jurisprudencial, se desprende que las solicitudes o gestiones efectuadas por medio electrónico deben dirigirse al correo institucional oficial habilitado por la Administración para tales fines. En consecuencia, la dirección electrónica utilizada por la persona recurrente no corresponde a un canal oficial para la atención de solicitudes externas, y no puede estimarse configurada una violación al derecho de petición ni al derecho de acceso a la información pública, pues el requerimiento no fue formulado mediante los medios reconocidos formalmente por la institución para tales efectos. \n\nLa dirección ...01 corresponde a un correo institucional de uso funcional, destinado primordialmente a comunicación administrativa interna y coordinación operativa, y no se encuentra definido como canal oficial para recepción de solicitudes formales de información técnica, certificaciones o verificaciones territoriales. \n\nLas gestiones de esta naturaleza deben tramitarse: por los canales administrativos oficialmente habilitados, con identificación del interesado, y mediante el procedimiento establecido por la institución. Sin embargo, el funcionario Céspedes, le brindo una respuesta clara y concisa de cómo debía presentar su trámite. \n\nEn consecuencia, no existió omisión, negativa ni dilación indebida, sino la orientación correcta al administrado respecto del medio idóneo para plantear su gestión. \n\nVI. SOBRE EL DERECHO DE ACCESO A LA INFORMACIÓN PÚBLICA \n\nEl derecho fundamental de acceso a la información pública, consagrado en el artículo 30 de la Constitución Política, no tiene carácter absoluto, y su ejercicio puede estar sujeto a regulaciones razonables de carácter procedimental, siempre que no se desnaturalice su contenido esencial. \n\nEn el presente caso: No se negó el acceso a la información solicitada, no se guardó silencio administrativo, no se condicionó el derecho a requisitos arbitrarios, sino que se indicó el procedimiento administrativo idóneo para evacuar una consulta de alto contenido técnico. Sin embargo, tal espectro de control jurisdiccional se circunscribe a la inactividad propiamente, mas no prejuzga sobre el fondo del asunto pendiente ante el órgano o ente público, cuyo conocimiento podría, inclusive, no ser de conocimiento de esta jurisdicción. \n\nPor lo que la revisión que debe efectuar el juzgador en los denominados amparos de legalidad, con el mayor de los respetos se limita a verificar la inactividad de la Administración, cuando teniendo bajo su cargo dar respuesta al administrado, en virtud de un plazo legal o reglamentariamente establecido, aquella no brinde la obligada respuesta, sin que esa jurisdicción prejuzgue sobre el fondo de lo solicitado o pretendido por el administrado. Situación que como ya el mismo recurrente acepto y se demostró la situación de indefensión o vulneración a su derecho de respuesta no se dio por haber recibido no solo respuesta de la administración, sino que se le indico la forma en que este debía dirigir su solitud. Puede que la forma de tramitar estos procedimientos y según Manual de Procedimientos para la Resolución de Visados y Certificaciones de Planos R-SINAC-037-2009, no sea del agrado del recurrente sin embargo, esta se ajusta a Derecho, por lo que pretender que la Sala instruya al SINAC a habilitar un medio digital para recibir tramites tal como lo ha solicitado en su petitoria es algo que sobrepasa el derecho de respuesta que le asiste por disposición constitucional al amparado. \n\nV. RAZONABILIDAD Y PROPORCIONALIDAD DE LA ACTUACIÓN ADMINISTRATIVA \n\nLa exigencia de un canal formal responde a criterios de principio de legalidad, directriz o DE Número R-SINAC-037-2009. \n\nAtender verificaciones técnicas territoriales por correo electrónico simple podría generar: \n\n-Respuestas sin respaldo documental. \n\n-Ausencia de registro administrativo. \n\n-Imposibilidad de control interno. \n\n-Eventuales responsabilidades personales indebidas. \n\nEn tal sentido, la actuación desplegada fue razonable, proporcional, objetiva y ajustada al principio de legalidad, sin afectación ilegítima de derechos fundamentales. \n\nVI. SOBRE UN EVENTUAL FALLO CON LUGAR \n\nPara el caso de que esa Honorable Sala estime que la solicitud debió canalizarse con una mayor flexibilidad procedimental, se solicita respetuosamente considerar que: \n\nNo existió mala fe. \n\nNo existió negativa definitiva. \n\nNo existió conducta obstructiva. \n\nEl actuar del funcionario se ajustó a prácticas administrativas institucionales vigentes y a instrucciones jerárquicas tal como el Manual de Procedimientos para la Resolución de Visados y Certificaciones de Planos R-SINAC-037- 2009.\n\nEn consecuencia, de declararse con lugar el recurso, sus efectos deberían ser de carácter correctivo o instructivo, sin atribución de responsabilidad personal al funcionario informante quien carece de potestad decisoria para modificar los canales oficiales de atención al público y como se demostró en este informe siempre atendió las consultas realizadas de manera oportuna e inclusive en reiteradas oportunidades tal como lo describe en su informe el cual se adjunta como prueba o la Administración…”.\n\nSolicita que se desestime el recurso planteado.\n\n 3.- En los procedimientos seguidos se ha observado las prescripciones legales.\n\n Redacta el Magistrado Salazar Alvarado; y,\n\n Considerando:\n\n I.- Objeto del recurso. El recurrente interpone recurso de amparo contra el Sistema Nacional de Áreas de Conservación (SINAC), acusando la vulneración de sus derechos fundamentales de petición, pronta respuesta y acceso a la información pública (artículos 27 y 30, de la Constitución Política). Manifiesta que el 10 de abril de 2026 formuló una consulta vía correo electrónico ante un funcionario de la entidad recurrida, con el objeto de determinar si un inmueble específico se encuentra afecto por algún área silvestre protegida, requerimiento necesario para el trámite de unas diligencias de información posesoria. Reclama que la autoridad recurrida rechazó evacuar el fondo de su gestión por esa vía, obligándolo a sustanciar el trámite de forma presencial y física de conformidad con un manual interno, lo cual considera un obstáculo arbitrario y una desatención a los principios de modernización tecnológica de la Administración Pública.\n\nII.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:\n\na) El 10 de abril de 2026, el recurrente remitió un correo electrónico a la dirección particular-funcional ...01, mediante el cual solicitó formalmente que se le indicara si la finca inscrita en el Partido de Alajuela bajo el folio real N° 2-111640-000, amparada al plano catastrado A-53447-2025, se encuentra ubicada dentro de un área silvestre protegida o administrada por el SINAC (ver prueba documental aportada por el recurrente y admitido por la autoridad recurrida).\n\nb) La dirección ...01 corresponde a un correo institucional de uso funcional, destinado primordialmente a comunicación administrativa interna y coordinación operativa, y no se encuentra definido como canal oficial para recepción de solicitudes formales de información técnica, certificaciones o verificaciones territoriales. \n\nc) El 13 de abril de 2026, el funcionario institucional Steven Céspedes Hidalgo brindó respuesta al recurrente, indicándole que por la naturaleza técnica de la verificación territorial y conforme a los canales oficiales vigentes, la solicitud debía plantearse bajo la modalidad presencial-física (los autos).\n\nd) El trámite formal para la expedición de certificaciones de afectación y visados de planos ante el SINAC se rige por lo dispuesto en el Manual de Procedimientos para la Resolución de Visados y Certificaciones de Planos, aprobado mediante la Resolución N° R-SINAC-037-2009, publicada en el Diario Oficial La Gaceta N° 134 del 13 de julio de 2009. (informe bajo juramento del director ejecutivo del SINAC).\n\ne) A la fecha de interposición del presente recurso, el SINAC no dispone de un módulo transaccional automatizado o ventanilla electrónica habilitada para la recepción y emisión digital de esta específica modalidad de certificaciones territoriales de afectación de áreas protegidas. (informe rendido bajo juramento por la autoridad recurrida).\n\n III.- Sobre el contenido esencial del derecho de petición y pronta respuesta frente a los canales de tramitación formal. Esta Sala ha establecido de manera reiterada que los derechos fundamentales consagrados en los artículos 27 y 30, de la Constitución Política imponen a la Administración la obligación imperativa de recibir las gestiones de los administrados, procesarlas y resolverlas de manera oportuna, congruente y clara. Sin embargo, este derecho no reviste un carácter absoluto ni confiere al ciudadano la potestad irrestricta de imponer a los órganos públicos el uso de vías informales, canales particulares o medios de su exclusiva conveniencia que se aparten de los procedimientos legal y reglamentariamente establecidos.\n\nEn este sentido, la jurisprudencia constitucional ha delineado que, para el correcto ejercicio del derecho de petición por medios tecnológicos, las solicitudes deben canalizarse formalmente a través de las plataformas institucionales o buzones electrónicos corporativos oficializados por el ente público para la atención externa, y no mediante las cuentas de correo electrónico asignadas de forma individual y funcional a los servidores públicos para su coordinación operativa interna. \n\nEn la Sentencia N° 2008-009670 de las 09:55 horas de 13 de junio de 2008, al referirse al derecho de petición y el empleo de medios electrónicos (aplicable mutatis mutandis al derecho de acceso a la información administrativa), explicó lo siguiente: \n\n“(…) En el marco de la sociedad de la información y el conocimiento, los derechos fundamentales pueden ser ejercidos a través de las nuevas tecnologías de la información. En lo que al derecho de petición y pronta respuesta se refiere, la utilización de los medios electrónicos le da nuevos matices, los cuales, deben ser ponderados. Siempre teniendo en consideración su eficacia progresiva y expansiva, pero también, tomando en cuenta el carácter no absoluto de los derechos fundamentales, es posible concluir que, para el ejercicio del derecho de petición y pronta respuesta, empleando los medio s que las nuevas tecnologías facilitan, es importante, que el requerimiento sea canalizado a través de una página web de libre acceso del ente o el órgano público. Adicionalmente, ese dominio electrónico debe contar con un hipervínculo direccionado hacia un correo electrónico dispuesto, específicamente, para recibir solicitudes, sea sobre un tema particular o bien que sirva como buzón para todo tipo gestiones (…)” (el énfasis no pertenece al original). \n\nParalelamente, en cuanto a solicitudes que son remitidas a correos no oficiales, pero su recibido se acusa o se inicia la tramitación de su respuesta, este Tribunal, en la Sentencia N° 2019-2204 de las 09:15 horas de 8 de febrero de 2019, señaló: \n\n“(… ) Ahora bien, en vista de lo expuesto y luego de analizar los elementos aportados a los autos, la Sala considera que el reclamo del recurrente en este sentido, resulta procedente, toda vez, que si bien el correo electrónico al que el interesado remitió su petición, no constituye un medio oficial para la recepción de tales gestiones, lo cierto es que la parte recurrida admitió que ha procedido a tramitar dicha solicitud, siendo que al momento que la recibió, tuvo conocimiento de ella (… ) Así las cosas, la administración recurrida se dio por conocedora de la gestión, y proveyó lo correspondiente para brindar la respuesta requerida (… )”(el énfasis no pertenece al original).\n\nIV.- Caso concreto. Alega el amparado que se han conculcado sus derechos constitucionales al compelérsele a formular su petición de manera presencial. No obstante, al confrontar los hechos con el marco normativo y los informes rendidos bajo juramento, este Tribunal constata que no se configura la alegada lesión. En primer término, se descarta la existencia de un silencio administrativo o de una conducta omisiva por parte del SINAC, por cuanto el funcionario técnico atendió de forma sumamente célere -apenas tres días después de recibida- la comunicación del recurrente, ofreciéndole una respuesta expresa, congruente y debidamente fundada en el ordenamiento, aun cuando la dirección de correo electrónico al que se remitió la solicitud no es un medio oficial para el envío de ese tipo de gestiones.\n\nEn segundo término, la remisión del administrado a los canales físicos y formales previstos en la Resolución N° R-SINAC-037-2009 no obedece al capricho de la autoridad recurrida, sino al estricto cumplimiento del Principio de Legalidad (artículos 11, de la Constitución Política y 11, de la Ley General de la Administración Pública). La emisión de un pronunciamiento o certificación técnica sobre si un bien inmueble afecta el patrimonio natural del Estado reviste una delicada trascendencia jurídica, con repercusiones directas sobre el derecho de propiedad y la protección ambiental (artículo 50 constitucional), máxime cuando dicha información está destinada a surtir efectos en un proceso judicial de información posesoria. Consecuentemente, el requerimiento de que la gestión se formalice con el cumplimiento de los requisitos de identificación, presentación de planos y registro oficial que el manual técnico exige, resulta una medida proporcional, razonable y necesaria para salvaguardar la seguridad jurídica y el control interno de la infraestructura registral y ambiental del país.\n\nV.- Conclusión. Dado que el recurrente obtuvo una respuesta oportuna y debidamente justificada en la que se le orientó de forma correcta sobre el procedimiento técnico aplicable para canalizar su pretensión, no se constata vulneración alguna a los derechos de petición ni de acceso a la información pública. El descontento del amparado respecto de la inexistencia de una plataforma digitalizada para este trámite específico constituye un asunto de mera legalidad y de oportunidad administrativa que desborda la competencia de esta jurisdicción constitucional, correspondiendo a la Administración Activa el diseño y despliegue de sus sistemas informáticos según su disponibilidad presupuestaria. Por las razones expuestas, el recurso deviene en infundado y debe ser desestimado.\n\n VI.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\n Se declara sin lugar el recurso.- \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at nine hours thirty minutes on the twenty-ninth of May of two thousand twenty-six.\n\nConstitutional protection petition (recurso de amparo) processed under case file number 26-012584-0007-CO, filed by Nombre01, national identity card (cédula de identidad) CED02, against the MINISTERIO DE AMBIENTE ENERGÍA (MINAE).\n\nBackground:\n\n1.- By written submission received at the Chamber Secretariat at 08:47 hours on April 13, 2026, the petitioner filed a constitutional protection petition against the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC), stating that on April 10, 2026, he sent an email to the address ...01, with a request in which he asked the following: \"(...) please inform me whether property 2-111640-000 with survey plan A-53447-2025 located in Alajuela, San Carlos, Quesada in Dulce Nombre, registered in the name of Nombre02, national identity card number CED01, falls within any protected area (área protegida) and/or is administered by this institution. The foregoing is for the purposes of possessory information proceedings (diligencias de información posesoria). (sic) (...)\". (see copy with the respective acknowledgment of receipt (acuse de recibido), submitted as evidence). He states that on April 13 of that same year, the respondent authority replied that such a request can only be made in person, physically (see copy submitted as evidence). He alleges that, as of the date of filing of this petition, he had not been granted access to any of the requested information, which he considers a violation of his fundamental rights, given that a digital platform has existed for years and there is no reason to require in-person attendance.\n\n2.- David Chavarría Morales, in his capacity as Executive Director of the Sistema Nacional de Áreas de Conservación (SINAC), reports under oath as follows:\n\n\"…\n\nI. PRELIMINARY MATTERS\n\nUpon admission of the constitutional protection petition filed, this Administration immediately activated the internal operational mechanisms established for such situations, with the aim of ensuring a timely, effective, and legally compliant institutional response within the strict deadlines set forth in the legal framework. In that context, a formal request was made to the relevant departments and bodies having functional and substantive competence over the subject matter at issue, for the submission of background information, reports, and supporting documentation. As a result of those steps, the relevant technical-administrative report was received from official Steven Céspedes, from which it may be inferred — as will be set out in detail in the analysis that follows — that the Administration's conduct has met criteria of heightened diligence, reasonableness, and administrative proactivity, exercising its powers within the applicable constitutional and legal framework, and in full respect of the attributions and authority conferred upon it by the applicable legal order.\n\nI. REGARDING THE ACTIONS OF THE ENTITY I REPRESENT WITH RESPECT TO THE MATTERS RAISED IN THE PETITION:\n\nFIRST: The petitioner herein did indeed send an email with a processing request to the institutional email account of official Steven Céspedes Hidalgo on April 10, 2026, asking to be informed whether the property identified by survey plan A-53447-2025 and property registration number 2-111640-000, located in the province of Alajuela, canton of San Carlos, district of Quesada, Dulce Nombre, was within any protected area and/or under the administration of SINAC, stating that the inquiry was needed for possessory information proceedings.\n\nSECOND: In response to the petitioner's request, by email dated April 13, 2026, the applicant was informed that the requested procedure had to be carried out through the corresponding formal channel, and that it was required to be submitted in person, due to the technical nature of the inquiry. The petitioner, moreover, admits in the written submission of his constitutional protection petition to having received this response, and even submits evidence of the attention given to his request email.\n\nTHIRD: The petitioner states in point four of his constitutional protection petition: \"For many years I have urged this institution to enable a digital means for submitting various requests — even a simple email would suffice — and for years they have indicated that they are implementing a digital platform.\" It is important to note that, for the type of procedure the petitioner seeks to file, no digital platform currently exists within the Sistema Nacional de Áreas de Conservación or through AFE that would allow these procedures to be processed digitally. Their processing is governed by the provisions of the Manual de Procedimientos para la Resolución de Visados y Certificaciones de Planos R-SINAC-037-2009, published in La Gaceta N° 134 of 13/07/2009.\n\nI. REGARDING THE USE OF INSTITUTIONAL EMAIL\n\nIt is appropriate to note that the Sala Constitucional has developed a clear line of jurisprudence regarding the exercise of the right of petition (derecho de petición) and prompt response (pronta respuesta) through electronic means. In Judgment No. 2008-009670, issued at 09:55 hours on June 13, 2008, the Chamber stated:\n\n\"(…) Within the framework of the information and knowledge society, fundamental rights may be exercised through new information technologies. With respect to the right of petition and prompt response, the use of electronic means introduces new dimensions that must be weighed. Always bearing in mind its progressive and expansive effectiveness, but also taking into account the non-absolute nature of fundamental rights, it may be concluded that, for the exercise of the right of petition and prompt response using the means afforded by new technologies, it is important that the request be channeled through a freely accessible website of the public entity or body. Additionally, that electronic domain must include a hyperlink directed to an email address established specifically to receive requests, whether on a particular topic or serving as a general inbox for all types of submissions (…).\"\n\nBased on this jurisprudential landscape, it follows that requests or submissions made by electronic means must be directed to the official institutional email address enabled by the Administration for such purposes. Consequently, the email address used by the petitioner does not constitute an official channel for handling external requests, and no violation of the right of petition or the right of access to public information (derecho de acceso a la información pública) can be found, since the request was not submitted through the means formally recognized by the institution for such purposes.\n\nThe address ...01 corresponds to a functional-use institutional email account, intended primarily for internal administrative communication and operational coordination, and is not designated as an official channel for receiving formal requests for technical information, certifications, or territorial verifications.\n\nMatters of this nature must be processed through officially enabled administrative channels, with identification of the interested party, and following the procedure established by the institution. Nonetheless, official Céspedes provided the petitioner with a clear and concise response explaining how he should submit his request.\n\nAccordingly, there was no omission, refusal, or undue delay, but rather the proper guidance given to the member of the public (administrado) regarding the appropriate channel for submitting the request.\n\nVI. REGARDING THE RIGHT OF ACCESS TO PUBLIC INFORMATION\n\nThe fundamental right of access to public information, enshrined in Article 30 of the Constitución Política, is not absolute in character, and its exercise may be subject to reasonable procedural regulations, provided that its essential content is not undermined.\n\nIn the present case: access to the requested information was not denied, administrative silence (silencio administrativo) was not maintained, the right was not conditioned on arbitrary requirements; rather, the appropriate administrative procedure was indicated for addressing a highly technical inquiry. However, such scope of jurisdictional review is limited strictly to inaction per se, and does not prejudge the merits of the matter pending before the public entity (ente público) or body, the resolution of which might not even fall within this jurisdiction's purview.\n\nTherefore, the review that the adjudicator must conduct in the so-called constitutional protection petitions based on legality (amparos de legalidad) is limited, with the utmost respect, to verifying the inaction of the Administration when, having the obligation to respond to a member of the public within a legally or regulatorily established time period, it fails to provide the required response, without this jurisdiction prejudging the merits of what is requested or sought by that person. The petitioner himself has already acknowledged, and it has been demonstrated, that the situation of defenselessness or violation of his right to a response did not arise, since he not only received a response from the Administration, but was also informed of the manner in which he should submit his request. The procedure for handling these matters under the Manual de Procedimientos para la Resolución de Visados y Certificaciones de Planos R-SINAC-037-2009 may not be to the petitioner's liking; however, it complies with the law, and seeking to have the Chamber instruct SINAC to enable a digital channel for receiving applications, as requested in the petition, goes beyond the right of response afforded to the petitioner by constitutional provision.\n\nV. REASONABLENESS AND PROPORTIONALITY OF THE ADMINISTRATIVE ACTION\n\nThe requirement of a formal channel is grounded in the Principle of Legality (principio de legalidad), and in directive or Executive Decree (DE) No. R-SINAC-037-2009.\n\nAttending to technical territorial verifications via simple email could give rise to:\n\n-Responses without documentary support.\n\n-Absence of an administrative record.\n\n-Impossibility of internal oversight.\n\n-Potential improper personal liability.\n\nIn that regard, the conduct carried out was reasonable, proportionate, objective, and consistent with the Principle of Legality, without illegitimate infringement of fundamental rights.\n\nVI. REGARDING A POSSIBLE RULING IN FAVOR OF THE PETITION\n\nIn the event that this Honorable Chamber finds that the request should have been handled with greater procedural flexibility, it is respectfully requested to consider that:\n\nThere was no bad faith.\n\nThere was no definitive refusal.\n\nThere was no obstructive conduct.\n\nThe official's conduct was in conformity with current institutional administrative practices and hierarchical instructions, including the Manual de Procedimientos para la Resolución de Visados y Certificaciones de Planos R-SINAC-037-2009.\n\nConsequently, should the petition be granted, its effects should be corrective or instructional in nature, without assigning personal liability to the reporting official, who lacks the decision-making authority to modify official public-service channels, and who, as demonstrated in this report, always responded to inquiries promptly and on multiple occasions, as described in his report, which is attached as evidence, or the Administration…\".\n\nIt is requested that the petition be dismissed.\n\n3.- The legally prescribed procedures have been observed in the proceedings followed.\n\nDrafted by Associate Justice Salazar Alvarado; and,\n\nConsidering:\n\nI.- Subject of the petition. The petitioner files a constitutional protection petition against the Sistema Nacional de Áreas de Conservación (SINAC), alleging the violation of his fundamental rights of petition, prompt response, and access to public information (Articles 27 and 30 of the Constitución Política). He states that on April 10, 2026, he submitted an inquiry via email to an official of the respondent entity, for the purpose of determining whether a specific property is affected by any protected wildlife area (área silvestre protegida), a requirement necessary for processing possessory information proceedings. He alleges that the respondent authority refused to address the substance of his request through that channel, compelling him to process the matter in person and physically in accordance with an internal manual, which he considers an arbitrary obstacle and a disregard for the principles of technological modernization of the Public Administration.\n\nII.- Proven facts. The following facts are deemed duly established as relevant to the resolution of this matter, either because they have been established in evidence or because the respondent failed to address them as required by the initial order:\n\na) On April 10, 2026, the petitioner sent an email to the personal-functional address ...01, formally requesting confirmation of whether the property registered in the Partido de Alajuela under property registration number (folio real) N° 2-111640-000, covered by cadastral survey plan (plano catastrado) A-53447-2025, is located within a protected wildlife area or is administered by SINAC (see documentary evidence submitted by the petitioner and acknowledged by the respondent authority).\n\nb) The address ...01 corresponds to a functional-use institutional email account, intended primarily for internal administrative communication and operational coordination, and is not designated as an official channel for receiving formal requests for technical information, certifications, or territorial verifications.\n\nc) On April 13, 2026, institutional official Steven Céspedes Hidalgo responded to the petitioner, indicating that due to the technical nature of the territorial verification and in accordance with the official channels in force, the request had to be submitted in person, physically (court file).\n\nd) The formal procedure for the issuance of impact certifications and plan endorsements (visados de planos) before SINAC is governed by the provisions of the Manual de Procedimientos para la Resolución de Visados y Certificaciones de Planos, approved by Resolution N° R-SINAC-037-2009, published in the Official Gazette La Gaceta N° 134 of July 13, 2009. (sworn report of the Executive Director of SINAC).\n\ne) As of the date of filing of the present petition, SINAC does not have an automated transactional module (módulo transaccional automatizado) or enabled electronic service window (ventanilla electrónica) for the digital receipt and issuance of this specific type of territorial certification concerning the impact on protected areas. (sworn report rendered by the respondent authority).\n\nIII.- On the essential content of the right of petition and prompt response vis-à-vis formal processing channels. This Chamber has repeatedly established that the fundamental rights enshrined in Articles 27 and 30 of the Constitución Política impose on the Administration the imperative obligation to receive the requests of members of the public, to process them, and to resolve them in a timely, congruent, and clear manner. However, this right is not absolute in character, nor does it confer on citizens the unrestricted power to impose on public bodies the use of informal channels, private means, or methods of their exclusive convenience that depart from legally and regulatorily established procedures.\n\nIn this regard, constitutional jurisprudence has established that, for the proper exercise of the right of petition through technological means, requests must be formally channeled through the institutional platforms or corporate electronic inboxes officially designated by the public entity for external service, and not through email accounts assigned individually and functionally to public servants (servidores públicos) for their internal operational coordination.\n\nIn Judgment No. 2008-009670 issued at 09:55 hours on June 13, 2008, in addressing the right of petition and the use of electronic means (applicable mutatis mutandis to the right of access to administrative information), the Chamber explained the following:\n\n\"(…) Within the framework of the information and knowledge society, fundamental rights may be exercised through new information technologies. With respect to the right of petition and prompt response, the use of electronic means introduces new dimensions that must be weighed. Always bearing in mind its progressive and expansive effectiveness, but also taking into account the non-absolute nature of fundamental rights, it may be concluded that, for the exercise of the right of petition and prompt response using the means afforded by new technologies, it is important that the request be channeled through a freely accessible website of the public entity or body. Additionally, that electronic domain must include a hyperlink directed to an email address established specifically to receive requests, whether on a particular topic or serving as a general inbox for all types of submissions (…)\" (emphasis not in original).\n\nIn parallel, regarding requests sent to non-official email addresses where receipt is acknowledged or processing of the response is initiated, this Court, in Judgment No. 2019-2204 issued at 09:15 hours on February 8, 2019, stated:\n\n\"(…) Now, in light of the foregoing and after analyzing the elements submitted to the record, the Chamber considers that the petitioner's claim in this regard is well-founded, insofar as, while the email address to which the interested party sent the petition does not constitute an official channel for receiving such requests, the fact remains that the respondent party admitted to having proceeded to process said request, having become aware of it upon receiving it (…). In those circumstances, the respondent Administration acknowledged the submission and took the necessary steps to provide the required response (…)\" (emphasis not in original).\n\nIV.- Specific case. The petitioner alleges that his constitutional rights were violated by being compelled to submit his request in person. However, when the facts are weighed against the legal framework and the sworn reports, this Court finds that the alleged infringement is not established. In the first place, the existence of administrative silence or of an omissive course of conduct on the part of SINAC is ruled out, since the technical official responded with remarkable promptness — just three days after receipt — to the petitioner's communication, providing an express response that was congruent and duly grounded in the applicable legal order, even though the email address to which the request was sent is not an official channel for the submission of such matters.\n\nSecond, referring the member of the public to the physical and formal channels set forth in Resolution N° R-SINAC-037-2009 is not the product of the respondent authority's caprice, but rather the strict compliance with the Principle of Legality (Articles 11 of the Constitución Política and 11 of the Ley General de la Administración Pública). The issuance of a technical ruling or certification regarding whether a property affects the natural heritage of the State (patrimonio natural del Estado) carries considerable legal significance, with direct repercussions on property rights and environmental protection (Article 50 of the Constitution), especially when the information is intended to produce effects in judicial possessory information proceedings. Consequently, the requirement that the matter be formalized by complying with the identification requirements, submission of survey plans, and official registration demanded by the technical manual constitutes a proportionate, reasonable, and necessary measure to safeguard legal certainty (seguridad jurídica) and internal oversight of the country's registry and environmental infrastructure.\n\nV.- Conclusion. Given that the petitioner received a timely and duly justified response in which he was correctly guided regarding the applicable technical procedure for channeling his claim, no violation of the rights of petition or access to public information is found. The petitioner's dissatisfaction with the absence of a digitalized platform for this specific procedure constitutes a matter of mere legality and administrative expediency that falls outside the competence of this constitutional jurisdiction, with the design and deployment of its computer systems being the responsibility of the Active Administration (Administración Activa) according to its budgetary availability. For the foregoing reasons, the petition is unfounded and must be dismissed.\n\nVI.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are hereby notified that if they have submitted any paper documents, as well as objects or evidence contained in any additional electronic, computing, magnetic, optical, telematic, or new-technology device, these must be collected from the court office within a maximum period of thirty business days counted from the notification of this judgment. Otherwise, all material not collected within this period will be destroyed, pursuant to the provisions of the \"Reglamento sobre Expediente Electrónico ante el Poder Judicial,\" approved by the Corte Plena at Session N° 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial N° 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at Session N° 43-12 held on May 3, 2012, Article LXXXI.\n\nTherefore:\n\nThe petition is dismissed.-\n\nFernando Castillo V.\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\nLuis Fdo.
