  "body_es_text": "Revisión del Documento\n\n\n\nExp: 25-027108-0007-CO \n\nRes. Nº 2026020237\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del cinco de junio de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE TALAMANCA y el PODER EJECUTIVO. \n\nResultando:\n\n1.- Por medio del escrito agregado al expediente digital a las 2:37 horas de 6 de setiembre de 2025, la recurrente presentó un recurso de amparo en contra la Municipalidad de Talamanca y el Poder Ejecutivo. La recurrente aseguró que en el distrito de Puerto Viejo de Talamanca, provincia de Limón, específicamente en el Dirección01, existe un sistema de alcantarillado que descarga de manera continua aguas sucias hacia la quebrada que desemboca en la playa de Puerto Viejo. Manifestó que un tubo de concreto instalado bajo el puente vierte sin tratamiento aguas contaminadas, que arrastran sólidos, residuos plásticos, basura y materia orgánica, lo que llega a mezclarse directamente con la arena y las aguas del mar. Adujo que la descarga no es un fenómeno intermitente por lluvias, sino un flujo permanente y constante, indicativo de que se trata de aguas pluviales mezcladas con residuales, lo que agrava su peligrosidad. Mencionó que en la zona se percibe además una hediondez constante, caracterizada como olor a aguas negras y materia en descomposición (“floca”). Por último, aseguró que ese daño es progresivo, silencioso y de consecuencias irreversibles si no se adoptan medidas inmediatas. Solicitó que se declare con lugar el recurso.\n\n2.- Mediante auto de las 22:33 horas de 18 de setiembre de 2025, se admitió el recurso de amparo y se dio traslado a las autoridades recurridas, sobre los hechos reclamados. \n\n3.- Por medio del escrito agregado al expediente digital a las 13:56 horas de 24 de setiembre de 2025, informó bajo juramento Franz Tattenbach Capra, en su condición de Ministro de Ambiente y Energía, que: “(…) PRIMERO: En atención al mandato de la Sala, se procedió a solicitar informe a la Dirección de Aguas del MINAE como ente competente informando lo siguiente: Con referencia al oficio DA-UHCAROG-0662-2025 de la Dirección de Aguas del MINAE, se presenta un informe en respuesta al Recurso de Amparo (expediente 25-027108-0007-CO) interpuesto por Nombre01, respecto a la contaminación por aguas residuales en Puerto Viejo de Limón. El documento señala que, si bien el MINAE ha participado en inspecciones conjuntas solicitadas por la Fiscalía Ambiental (como la realizada el 22 de abril de 2024, documentada en el oficio DA-UHCAROG-0249-2024), no se registran denuncias previas de la recurrente ante la Dirección de Agua. Se aclara que el AyA cuenta con un permiso de vertido vigente (expediente 5378-V) para la planta de tratamiento local, la cual aún no opera, y que la problemática de fondo la disposición incorrecta de aguas residuales por parte de la comunidad y la inoperatividad de la planta escapa a las competencias del MINAE, correspondiendo al Ministerio de Salud y al AyA la ejecución de las órdenes sanitarias y la puesta en marcha del sistema de alcantarillado, en cumplimiento de lo ordenado por la Sala Constitucional en el voto 2019007689 (expediente 19-002174-007-CO)(…) SEGUNDO: En atención al mandato de la Sala, se procedió a solicitar informe al Área de Conservación la Amistad Caribe del Sistema Nacional de Áreas de Conservación informando lo siguiente: Mediante el oficio N.º SINAC-ACLAC-DASP-RNVSGM-469-2025, se presenta el informe técnico de inspección realizado el 20 de septiembre de 2025 en el Dirección01, Puerto Viejo de Talamanca, en atención al recurso de amparo N.º 25-027108-0007-C0, donde se constató la existencia de descargas directas de aguas residuales domésticas no tratadas hacia un cuerpo de agua que desemboca en la playa, generando condiciones insalubres con aguas de coloración oscura, olores fétidos, acumulación de desechos sólidos y presencia de personas en situación de indigencia, lo que constituye un riesgo sanitario, social y ambiental que afecta la actividad turística y la imagen de la comunidad. Como parte de las acciones emprendidas por el ACLAC para atender esta problemática, se emitieron los oficios números SINAC-ACLAC-DASP-RNVSGM-470- 2025 dirigido a la Municipalidad de Talamanca, solicitando la coordinación de acciones inmediatas; SINAC-ACLAC-DASP-RNVSGM-471-2025 dirigido al Ministerio de Salud – Área Rectora de Salud de Talamanca, para requerir la atención sanitaria correspondiente; y SINAC-ACLAC-DASP-RNVSGM-474-2025 dirigido al Instituto Costarricense de Acueductos y Alcantarillados (AyA), con el fin de gestionar la puesta en operación total de la planta de tratamiento de aguas. TERCERO: En atención a los hechos expuestos y a la documentación adjunta, se demuestra de manera fehaciente que la Dirección de Agua del MINAE ha actuado en todo momento dentro del estricto marco de sus competencias legales y técnicas, no existiendo omisión alguna por parte de esta institución. Por el contrario, se ha brindado el acompañamiento técnico solicitado en las instancias correspondientes, participando de manera proactiva en las inspecciones conjuntas ordenadas por el Ministerio Público, como la realizada el 22 de abril de 2024, de la cual se levantó el informe técnico DA-UHCAROG-0249-2024. Asimismo, este Ministerio ha cumplido con emitir los permisos de vertido correspondientes al ente responsable, el AyA (expediente 5378-V), y ha aportado los informes técnicos requeridos para los procesos judiciales en curso. La solución de fondo a la problemática planteada que recae en la puesta en operación del sistema de alcantarillado sanitario y en el cumplimiento de las órdenes sanitarias por parte de los particulares escapa al ámbito de competencia del MINAE, correspondiendo su ejecución y fiscalización primaria al Instituto Costarricense de Acueductos y Alcantarillados (AyA) y al Ministerio de Salud, tal como fue establecido por la Sala Constitucional en su resolución N° 2019007689. Por otro lado, el área de conservación la amistad caribe cumplió con su competencia al realizar la inspección, documentar la situación, emitir los informes técnicos correspondientes (Oficios N.º 469, 470, 471 y 474-2025) y requerir formalmente la actuación de las instituciones responsables: el AyA, para la operación de la planta de tratamiento, y el Ministerio de Salud, para el control sanitario. Por lo tanto, el ACLAC desarrolló las acciones de denuncia y coordinación interinstitucional que le competen, trasladando la responsabilidad de solución a las entidades rectoras.” (sic). \n\n4.- Mediante el escrito agregado al expediente digital a las 12:48 horas de 26 de setiembre de 2025, informó bajo juramento Mary Denisse Munive Angermüller, en su condición de Ministra de Salud, que: “(…) La suscrita, atiendo el presente recurso de amparo, con sustento en el informe CARTA-MS-DRRSHC-DARST-3177-2025, de fecha 22 de setiembre del 2025, emitido por la Dra. Jennifer Jones Villiers, Directora de la Dirección del Área Rectora de Salud de Talamanca, sector al cual corresponde a los hechos denunciados por la parte aquí recurrente, donde en síntesis se informa lo siguiente: “(…) En primera instancia cabe destacar que este caso se ha manejado desde el año 2019 bajo el recurso de amparo exp.19-002174-007-CO, resolución N°2019007689 incoado por el Sr. Nombre02, mediante el cual este Ministerio ha mantenido informada a la honorable Sala Constitucional, sobre las acciones realizadas, cuyo cuerpo de agua el cual tiene salida al mar se le habría nombrado en su momento como Quebrada Sin Nombre. A partir de la inauguración de la construcción del puente de ingreso a Puerto Viejo, se le identifica como “Joel Gyal”. (…) Como parte de lo dictado por la Sala Constitucional mediante resolución N°2019007689 del recurso de amparo mencionado, se ordenó a la Municipalidad de Talamanca y el Ministerio de Salud coordinar y ejecutar las acciones pertinentes en aras de brindar una solución temporal para atender el problema indicado, hasta tanto el Instituto Costarricense de Acueductos y Alcantarillados (AyA) pusiera en operación el “Alcantarillado Sanitario, tratamiento y disposición final de las Aguas Residuales de Puerto Viejo”. El cronograma de ejecución proyectaba que la red del alcantarillado sanitario se construiría entre agosto de 2019 y mayo de 2020 y la construcción de la PTAR y la tubería de descarga se enlistó para febrero de 2020 hasta octubre de 2020. Lo anterior, producto del memorando de acuerdo firmado el 01 de abril de 2016 entre el AyA y la Oficina de Naciones Unidas de Servicios para Proyectos (UNOPS). En el 2019 el Ministerio de Salud en coordinación con el AyA y UNOPS realizó una delimitación de las zonas con influencia a dicha quebrada resultando en un total de 37 propiedades entre actividades comerciales, viviendas y servicios. Se definió un método de trabajo y como resultado se determinó en categoría “roja” 4 propiedades con problemas críticos por el estado de los tanques sépticos (y drenajes) y en categoría “gris” un total de 16 propiedades, con problema de aguas grises o jabonosas, las cuales no estaban dirigidas a drenajes, por lo cual descargaban sin ningún tratamiento al aire libre y finalmente a la vía pública o a la Quebrada Sin Nombre. Se giraron las órdenes sanitarias correspondientes a los comercios y viviendas identificados, donde les fue solicitado eliminar las aguas servidas de manera adecuada y sanitariamente, a fin de evitar la contaminación del suelo y cuerpos de agua receptores, así como la formación de criaderos de vectores y enfermedades. Para ello debiesen realizar las labores de mantenimiento o reparación, o bien la instalación de un sistema de tratamiento individual (tanques sépticos y/o drenajes) según fuera el caso, como medida temporal hasta tanto el proyecto de alcantarillado sanitario entrara en operación. Además, se agregó que una vez entrara en funcionamiento el alcantarillado sanitario estarían en la obligación de conectar su sistema de eliminación de excretas y aguas grises a la red. Tomando como base la información oficial sobre la puesta en operación del proyecto de alcantarillado sanitario, se ha determinado un atraso 5 años a los tiempos inicialmente establecidos, ya que aunque la planta de tratamiento de aguas residuales está operativa y las obras de la red con un avance significativo, actualmente siguen con labores de construcción y reparación, donde se ha determinado que tan solo alrededor de una cuarta parte de la totalidad de la población beneficiaria se ha conectado a la red. Esta situación ha potenciado el problema de salud pública y de contaminación ambiental en la comunidad, y ha generado falsas expectativas e incertidumbre, así como un descontento generalizado y enojo entre la población y turismo. Cabe destacar que la Municipalidad de Talamanca no ha participado en ningún trabajo articulado para dar seguimiento a la problemática, ni ha atendido las convocatorias. Solamente ha sido participe de los actos protocolarios de la inauguración del fallido proyecto. Con respecto a los señalamientos sobre la evidencia de que los tanques sépticos y drenajes de la comunidad de Puerto Viejo “no funcionan adecuadamente” y que muchos desfogan a cuerpos receptores que cruzan la comunidad, o descargan a caños construidos para aguas pluviales, la respuesta constante de la Municipalidad es que, al tratarse de una propiedad privada, la situación de contaminación es competencia del Ministerio de Salud y del AyA. Como bien lo expuso la Sala Constitucional en la resolución N°2019007689, “no puede la Municipalidad simplemente esperar a que otros solucionen el problema y desatender sus obligaciones de verificar que las construcciones que se realicen bajo su jurisdicción cumplan con los requisitos de seguridad y salubridad necesarios para asegurar así el bienestar (…). No es cierto que, por tratarse de propiedad privada, la municipalidad no pueda hacer nada al respecto, pues existe la obligación de los vecinos de ajustar las construcciones a la autorización respectiva y el deber de la municipalidad de velar porque así lo hubieran hecho. En este caso, la Municipalidad no ha verificado que las construcciones que existen efectivamente se ajusten conforme lo autorizó y si esa autorización efectivamente indicó que debía existir un tratamiento adecuado de las aguas negras”. El Ministerio de Salud ha dado un seguimiento al estado de cumplimiento de los actos administrativos girados en el 2019. Como resultado a inicios del 2024 se comprobó que solamente 6 de los casos que realizaban descargas en la vía pública fueron cerrados por acatamiento a lo ordenado, quedando demostrado un incumplimiento en la mayoría de viviendas notificadas y algunos comercios. Cabe destacar que una gran mayoría de las viviendas que tienen sistemas de tratamiento de aguas residuales en malas condiciones de funcionamiento, son construcciones hechizas, donde generalmente utilizan alcantarillas de concreto como solución al tanque séptico, lo cual está prohibido de acuerdo con la legislación vigente. Estas personas generalmente son de escasos recursos, y con la llegada del COVID-2019 no han podido cumplir con lo ordenado. En el 2024, a través de un nuevo informe con cronogramas de ejecución aportados por el AyA y la UNOPS en respuesta a las órdenes sanitarias MS-DRRSHC-DARST- OS-063-2024 y MS-DRRSHC-DARST-OS-064-2024 que les fueron giradas, informaron que para el 30 de julio de 2024 estarían finalizando la construcción de las obras por parte del contratista; y de manera paralela la habilitación de sectores a conectarse al nuevo alcantarillado a fin de reducir las descargas contaminantes a cuerpos de agua y vía pública. Tomando como referencia lo indicado, entre mayo y junio del 2024 se giraron nuevas órdenes sanitarias a los propietarios de las edificaciones que hasta la fecha seguían descargando aguas residuales sin ningún tratamiento al sector de la Quebrada Sin Nombre (Joel Gyal), mediante la cual se les ordenaba que en el plazo de 3 meses deberían conectarse a la red del alcantarillado sanitario, una vez el AyA les diera el visto bueno. En abril del 2025 se tuvo una reunión con los responsables del proyecto, es decir con el AyA y la UNOPS, con el fin de determinar el estado de avance del mismo, donde se comprobó que el proyecto no ha sido concluido, permanecen realizando reparaciones en algunos tramos de la red que presentaban defectos, ocasionados por el contratista original. Según la información brindada, para abril del 2025, de los 573 beneficiarios que cubrirá el proyecto, solamente se habían conectado 110. El sector donde se ubican las viviendas y comercios ubicados dentro de la zona de influencia de la Quebrada Sin Nombre (Joel Gyal) (categorizado como sector 4), no habían sido notificados formalmente al momento, para proceder con la conexión a la red del alcantarillado, por lo cual no se han integrado al sistema. De esta forma no han cumplido al cronograma aportado, por lo cual las viviendas y algunos comercios a los cuales se les ordenó realizar la conexión no han podido realizarla, porque no han sido notificados de manera oficial. Esta situación ha sido constatada mediante visitas realizadas en agosto del 2025 S-0156-2025, MS-DRRSHC-DARST-OS-0157-2025, MS-DRRSHC-DARST-OS-0158-2025, tanto a la UNOPS como al AyA, mediante las cuales se les ordena que en el plazo de un mes a partir de notificados los actos, se realicen todas las acciones requeridas, tanto para la finalización del proyecto, como para la interconexión prioritaria de las edificaciones que realizan descargas sin ningún tratamiento a la vía pública o al cuerpo de agua supracitado, así como brindar el debido acompañamiento técnico a las viviendas y comercios que continúan aportando descargas de aguas residuales, para que se conecten a la red. A su vez, se les ordena realizar el trámite de solicitud del Permiso Sanitario de Funcionamiento de la planta de tratamiento de aguas residuales, ante el Área Rectora de Salud de Talamanca ya que se encuentra operando. En respuesta a la orden sanitaria la UNOPS interpuso un recurso de revocatoria con la apelación en subsidio, la cual en este momento está en curso su resolución ante el despacho legal de la Dirección Regional Huetar Caribe. Cabe destacar que las órdenes sanitarias han sido incumplidas por lo cual se ha dado el seguimiento correspondiente y se procederá con la aplicación de las medidas especiales que nos faculta la Ley General de Salud (…)” (sic). \n\n5.- Mediante el escrito agregado al expediente digital a las 11:56 horas de 29 de setiembre de 2025, informó bajo juramento Rugeli Morales Rodríguez, en su condición de Alcalde de la Municipalidad de Talamanca, que: “(…) Debe enfatizarse que, de conformidad con lo dispuesto en la Ley General de Salud, Ley N.° 5395, el control, regulación, prevención y sanción en materia de vertidos de aguas residuales y servidas constituye una competencia exclusiva del Ministerio de Salud. A su vez, el Instituto Costarricense de Acueductos y Alcantarillados (AyA), en su condición de ente encargado del servicio público de agua potable y saneamiento, ostenta deberes específicos en la materia. En consecuencia, la Municipalidad de Talamanca carece de competencia legal para intervenir en el control sanitario de dichos vertidos, limitándose sus atribuciones al mantenimiento ordinario de la infraestructura vial y pluvial. En este sentido, resulta improcedente pretender imputar a la Municipalidad responsabilidad por hechos que, conforme al marco legal vigente, recaen única y exclusivamente en el Ministerio de Salud y en el Instituto Costarricense de Acueductos y Alcantarillados (AyA). Por lo anterior, la Municipalidad de Talamanca no ha incurrido en acción u omisión alguna que pueda generar una lesión actual o inminente a derechos fundamentales de los recurrentes, por lo que corresponde declarar el recurso SIN LUGAR, con fundamento en los artículos 21 y 50 de la Constitución Política, en concordancia con los artículos 4, 7, 282 y 284 de la Ley General de Salud, y la jurisprudencia reiterada de esa Honorable Sala Constitucional en materia de competencias diferenciadas entre entes locales y autoridades sanitarias nacionales (…) La problemática planteada por la recurrente ha sido conocida por la Sala Constitucional de la Corte Suprema de Justicia en los expedientes 19-002174-0007-CO donde de forma reiterada se ha instado gestiones de incumplimiento que han sido rechazadas por parta de esta autoridad judicial, siendo la ultima la Res. Nº 2024016382, de las nueve horas veinte minutos del catorce de junio de dos mil veinticuatro (…) Como Corporación Municipal, hemos estado atentos a la terminación y implementación de las obras relacionadas con el “Alcantarillado sanitario, tratamiento y disposición de las aguas residuales de Puerto Viejo de Limón”, sin embargo, mantenemos nuestra posición de que obligatoriamente, se debe esperar que entre en funcionamiento el sistema de tratamiento de aguas negras y residuales, -cuyo proyecto se encuentra en ejecución-, a fin de poder evidenciar si del sistema municipal quedan falencias por resolver o es simplemente darle el mantenimiento rutinario, de forma tal que al mar desfoguen únicamente aguas pluviales y de escorrentía natural, sin afectar el ecosistema de las aguas marinas, tesis que ha ratificado la honorable Sala Constitucional. En virtud de lo anterior, debe señalarse que existe una imposibilidad material y jurídica para la Municipalidad de Talamanca de asumir responsabilidad en los hechos señalados, toda vez que, conforme al informe técnico emitido por el personal municipal y del mismo informe rendido por el Ministerio de Salud dentro del presente proceso, lo que efectivamente se acredita es la existencia de un desfogue de aguas servidas o negras a través de la tubería o salida pluvial del puente denominado “Joel Gyal Bridge”. Tal circunstancia, por su naturaleza y efectos, no corresponde a un problema de mantenimiento rutinario o de limpieza atribuible a la Municipalidad, sino que constituye un asunto vinculado a la gestión y control de vertidos de aguas residuales, materia cuya competencia exclusiva corresponde al Ministerio de Salud, en su condición de autoridad rectora en salud pública y ambiental, conforme lo disponen los artículos 1, 4, 7, 282 y 284 de la Ley General de Salud, Ley N.º 5395, así como el artículo 50 de la Constitución Política” (sic). \n\n6.- Por medio de constancia de 1° de octubre de 2025 se indicó que no consta que el Director de la Unidad Técnica de Gestión Vial de la Municipalidad de Talamanca rindiera el informe solicitado por la Sala.\n\n7.- En los procedimientos seguidos se ha observado las prescripciones legales. \n\nRedacta el Magistrado Araya García; y,\n\nConsiderando:\n\n I.- Cuestión preliminar. En vista de que el Director de la Unidad Técnica de Gestión Vial de la Municipalidad de Talamanca omitió rendir el informe dentro del plazo fijado por este Tribunal en la resolución de 22:33 horas de 18 de setiembre de 2025, y de conformidad con el artículo 45 de la Ley de la Jurisdicción Constitucional, se procede a analizar la constitucionalidad con base en lo expuesto por la recurrente y demás autoridades recurridas.\n\nII.- Objeto del recurso. La recurrente aseguró que existe una problemática en virtud de aguas negras que discurren hacia la playa Puerto Viejo, lo que pone en riesgo la seguridad y vida de turistas nacionales e internacionales. Afirmó que, aunque la situación es conocida por las autoridades desde hace varios años, a la fecha de presentación del recurso no ha sido solucionada. \n\nIII.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:\n\n1) Las autoridades del Ministerio de Salud señalan que “En primera instancia cabe destacar que este caso se ha manejado desde el año 2019 bajo el recurso de amparo exp.19-002174-007-CO, resolución N°2019007689 incoado por el Sr. Nombre02, mediante el cual este Ministerio ha mantenido informada a la honorable Sala Constitucional, sobre las acciones realizadas, cuyo cuerpo de agua el cual tiene salida al mar se le habría nombrado en su momento como Quebrada Sin Nombre. A partir de la inauguración de la construcción del puente de ingreso a Puerto Viejo, se le identifica como “Joel Gyal”. (…) Como parte de lo dictado por la Sala Constitucional mediante resolución N°2019007689 del recurso de amparo mencionado, se ordenó a la Municipalidad de Talamanca y el Ministerio de Salud coordinar y ejecutar las acciones pertinentes en aras de brindar una solución temporal para atender el problema indicado, hasta tanto el Instituto Costarricense de Acueductos y Alcantarillados (AyA) pusiera en operación el “Alcantarillado Sanitario, tratamiento y disposición final de las Aguas Residuales de Puerto Viejo”. El cronograma de ejecución proyectaba que la red del alcantarillado sanitario se construiría entre agosto de 2019 y mayo de 2020 y la construcción de la PTAR y la tubería de descarga se enlistó para febrero de 2020 hasta octubre de 2020. Lo anterior, producto del memorando de acuerdo firmado el 01 de abril de 2016 entre el AyA y la Oficina de Naciones Unidas de Servicios para Proyectos (UNOPS). En el 2019 el Ministerio de Salud en coordinación con el AyA y UNOPS realizó una delimitación de las zonas con influencia a dicha quebrada resultando en un total de 37 propiedades entre actividades comerciales, viviendas y servicios. Se definió un método de trabajo y como resultado se determinó en categoría “roja” 4 propiedades con problemas críticos por el estado de los tanques sépticos (y drenajes) y en categoría “gris” un total de 16 propiedades, con problema de aguas grises o jabonosas, las cuales no estaban dirigidas a drenajes, por lo cual descargaban sin ningún tratamiento al aire libre y finalmente a la vía pública o a la Quebrada Sin Nombre. Se giraron las órdenes sanitarias correspondientes a los comercios y viviendas identificados, donde les fue solicitado eliminar las aguas servidas de manera adecuada y sanitariamente, a fin de evitar la contaminación del suelo y cuerpos de agua receptores, así como la formación de criaderos de vectores y enfermedades. Para ello debiesen realizar las labores de mantenimiento o reparación, o bien la instalación de un sistema de tratamiento individual (tanques sépticos y/o drenajes) según fuera el caso, como medida temporal hasta tanto el proyecto de alcantarillado sanitario entrara en operación. Además, se agregó que una vez entrara en funcionamiento el alcantarillado sanitario estarían en la obligación de conectar su sistema de eliminación de excretas y aguas grises a la red. Tomando como base la información oficial sobre la puesta en operación del proyecto de alcantarillado sanitario, se ha determinado un atraso 5 años a los tiempos inicialmente establecidos, ya que aunque la planta de tratamiento de aguas residuales está operativa y las obras de la red con un avance significativo, actualmente siguen con labores de construcción y reparación, donde se ha determinado que tan solo alrededor de una cuarta parte de la totalidad de la población beneficiaria se ha conectado a la red. Esta situación ha potenciado el problema de salud pública y de contaminación ambiental en la comunidad, y ha generado falsas expectativas e incertidumbre, así como un descontento generalizado y enojo entre la población y turismo” (ver informe y prueba aportada al expediente).\n\n2) Las autoridades de la Municipalidad de Talamanca indican que “Como Corporación Municipal, hemos estado atentos a la terminación y implementación de las obras relacionadas con el “Alcantarillado sanitario, tratamiento y disposición de las aguas residuales de Puerto Viejo de Limón”, sin embargo, mantenemos nuestra posición de que obligatoriamente, se debe esperar que entre en funcionamiento el sistema de tratamiento de aguas negras y residuales, -cuyo proyecto se encuentra en ejecución-, a fin de poder evidenciar si del sistema municipal quedan falencias por resolver o es simplemente darle el mantenimiento rutinario, de forma tal que al mar desfoguen únicamente aguas pluviales y de escorrentía natural, sin afectar el ecosistema de las aguas marinas, tesis que ha ratificado la honorable Sala Constitucional. En virtud de lo anterior, debe señalarse que existe una imposibilidad material y jurídica para la Municipalidad de Talamanca de asumir responsabilidad en los hechos señalados, toda vez que, conforme al informe técnico emitido por el personal municipal y del mismo informe rendido por el Ministerio de Salud dentro del presente proceso, lo que efectivamente se acredita es la existencia de un desfogue de aguas servidas o negras a través de la tubería o salida pluvial del puente denominado “Joel Gyal Bridge”. Tal circunstancia, por su naturaleza y efectos, no corresponde a un problema de mantenimiento rutinario o de limpieza atribuible a la Municipalidad, sino que constituye un asunto vinculado a la gestión y control de vertidos de aguas residuales, materia cuya competencia exclusiva corresponde al Ministerio de Salud, en su condición de autoridad rectora en salud pública” (ver informe y prueba aportada al expediente).\n\n3) El 22 de abril de 2024, las autoridades recurridas realizaron una inspección conjunta con la Fiscalía Agrario Ambiental, en virtud de la investigación por los hechos descritos en el recurso que existe en esa fiscalía (ver informe y prueba aportada al expediente).\n\n4) En abril de 2025, el Ministerio de Salud comprobó que el proyecto instaurado por el ICAA y UNOPS para atender la situación denunciada no ha sido concluido y que permanecen realizando reparaciones en algunos tramos de la red que presentaban defectos, ocasionados por el contratista original. Según la información brindada, para abril del 2025, de los 573 beneficiarios que cubrirá el proyecto, solamente se habían conectado 110 (ver informe y prueba aportada al expediente).\n\n5) Mediante el oficio N.º SINAC-ACLAC-DASP-RNVSGM-469-2025, se presenta el informe técnico de inspección realizada el 20 de setiembre de 2025 por parte del Área de Conservación la Amistad Caribe del Sistema Nacional de Áreas de Conservación, en el que se indica “se constató la existencia de descargas directas de aguas residuales domésticas no tratadas hacia un cuerpo de agua que desemboca en la playa, generando condiciones insalubres con aguas de coloración oscura, olores fétidos, acumulación de desechos sólidos y presencia de personas en situación de indigencia, lo que constituye un riesgo sanitario, social y ambiental que afecta la actividad turística y la imagen de la comunidad. Como parte de las acciones emprendidas por el ACLAC para atender esta problemática, se emitieron los oficios números SINAC-ACLAC-DASP-RNVSGM-470- 2025 dirigido a la Municipalidad de Talamanca, solicitando la coordinación de acciones inmediatas; SINAC-ACLAC-DASP-RNVSGM-471-2025 dirigido al Ministerio de Salud – Área Rectora de Salud de Talamanca, para requerir la atención sanitaria correspondiente; y SINAC-ACLAC-DASP-RNVSGM-474-2025 dirigido al Instituto Costarricense de Acueductos y Alcantarillados (AyA), con el fin de gestionar la puesta en operación total de la planta de tratamiento de aguas” (ver informe y prueba aportada al expediente digital). \n\n IV.- Hecho no probado. Se estima como no demostrado el siguiente hecho, de relevancia para esta resolución: Único.- que la recurrente haya presentado una denuncia por los hechos descritos en el recurso ante las autoridades recurridas. \n\n V.- Sobre el caso concreto. Tal y como afirmaron las autoridades recurridas en los informes rendidos bajo juramento, ya esta Sala Constitucional conoció la situación sobre la problemática en virtud de aguas negras que discurren hacia la playa Puerto Viejo, al resolver el recurso de amparo No. 19-002174-0007-CO. Así, en la sentencia No. 2019-007689 de las 09:15 horas de 3 de mayo de 2019, se dispuso:\n\n“(…) I.- Objeto. El recurrente alegó que en la entrada principal a Puerto Viejo existe una enorme laguna de aguas negras que discurren hacia la playa, lo que pone en riesgo la seguridad y vida de turistas nacionales e internacionales. Pese a que el problema es público y notorio desde hace varios años, las autoridades recurridas no lo han solucionado (…). \n\nV.- Sobre fondo. Sobre la disposición de aguas negras, la Ley Constitutiva del AYA (Ley No. 2726 de 14 de abril de 1961 y sus reformas) dispone que dicha institución fue creada con el siguiente objeto: “Artículo 1.- Con el objeto de dirigir, fijar políticas, establecer y aplicar normas, realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el suministro de agua potable y recolección y evacuación de aguas negras y residuos industriales líquidos, lo mismo que el aspecto normativo de los sistemas de alcantarillado pluvial en áreas urbanas, para todo el territorio nacional se crea el Instituto Costarricense de Acueductos y Alcantarillados, como institución autónoma del Estado.” Por lo que le corresponde, según el mandato del artículo 2 de ese mismo cuerpo normativo, el dirigir y vigilar todo lo concerniente para proveer a los habitantes de un servicio de agua potable, recolección y evacuación de aguas negras y residuos industriales líquidos y de aguas pluviales en las áreas urbanas. Por otra parte, en cuanto a la municipalidad se refiere, existe, por una parte, una obligación de vigilar que exista una adecuada red de alcantarillado que permita la correcta disposición de aguas residuales y, por otra parte, tampoco puede desentenderse de sus cometidos al aprobar las construcciones. En este sentido, le corresponde realizar las inspecciones para que la evacuación de aguas negras se haga conforme lo autorizado. En efecto, el artículo 169 de la Constitución Política le otorga a las municipalidades la competencia para planificar y vigilar el desarrollo urbano de su localidad, como derivación de su deber de administrar los intereses y servicios locales en cada cantón. Es, además, determinante lo dispuesto en el artículo 1 de la Ley de Construcciones, según el cual: “Artículo 1.- Las Municipalidades de la República son las encargadas de que las ciudades y demás poblaciones reúnan las condiciones necesarias de seguridad, salubridad, comodidad y belleza en sus vías públicas y en los edificios y construcciones que en terrenos de las mismas se levanten sin perjuicio de las facultades que las leyes conceden en estas materias a otros órganos administrativos”. Sobre este mismo particular, el artículo 87 de la citada ley establece lo siguiente:“Artículo 87 .- La municipalidad ejercerá vigilancia sobre las obras que se ejecuten en su jurisdicción, así como sobre el uso que se les dé. Además, tendrá la misión de vigilar la observancia de los preceptos de esta Ley [...]”. En razón de lo anterior, corresponde a cada municipalidad verificar que las construcciones que se realicen bajo su jurisdicción cumplan los requisitos de seguridad y salubridad necesarios para asegurar así el bienestar de sus ocupantes. Así como establecer una política integral de planteamiento urbano, que garantice un desarrollo urbano en congruencia con el funcionamiento eficiente de un sistema de provisión de agua potable y de recolección, tratamiento y disposición final de las aguas residuales. A lo anterior, se agrega que el artículo 280 de la Ley General de Salud establece expresamente que estará a cargo de las municipalidades la limpieza de las alcantarillas. Esa misma normativa legal dispone, en su artículo 2, que le corresponde al Poder Ejecutivo, a través del Ministerio de Salud, la definición de la política nacional de salud, la normación, planificación y coordinación de todas las actividades públicas y privadas relativas a salud, así como la ejecución de aquellas actividades que le competen conforme a la ley y en el artículo 341 de la referida ley se establece, dentro de las atribuciones del Ministerio de Salud, la de ordenar y tomar las medidas especiales que habilita esa normativa para evitar el riesgo o daño a la salud de las personas o que éstos se difundan o se agraven y para inhibir la continuación o reincidencia en la infracción de los particulares. En cuanto al tema específico a que se refiere este amparo, la Ley General de Salud, en su Libro 1, Título 3, Capítulo 3, dispone -en lo conducente- lo siguiente: “De las obligaciones y restricciones para la evacuación sanitaria de excretas y aguas servidas Artículo [...] 287.- Toda persona, natural o jurídica, propietaria de viviendas o de establecimientos o edificios en que las personas desarrollen sus actividades, responderá de que tales bienes dispongan de un sistema de disposición de excretas y de aguas negras y servidas aprobado por el Ministerio y los usuarios de viviendas, establecimientos o edificios estarán obligados a mantener dicho sistema en buenas condiciones de funcionamiento.” “Artículo 288.- Todo propietario queda obligado a conectar el sistema de eliminación de excretas de aguas negras y servidas de su propiedad al alcantarillado sanitario en los lugares en que éste estuviera en funcionamiento, salvo en los casos de excepción que los reglamentos pertinentes reconozcan como procedentes.” Asimismo, de dicha normativa se colige la obligación de las autoridades del Ministerio de Salud de velar por la aplicación y el control del cumplimiento de las disposiciones de esa ley y de su reglamentación, sin perjuicio de las facultades y obligaciones que leyes especiales otorguen e impongan a otros organismos públicos dentro de sus respectivos campos de acción (artículo 337). Se corrobora, así, las distintas funciones y obligaciones que el ordenamiento jurídico le impone al Instituto Costarricense de Acueductos y Alcantarillados, al Ministerio de Salud y a las municipalidades, en materia de recolección, tratamiento y disposición final de las aguas residuales. Funciones y obligaciones que, además -y como ya se adelantó en el considerando anterior-, se deben ejercer de forma coordinada, para asegurar así la eficiencia y eficacia administrativas (ver en este sentido la sentencia número 2008-11796 de las 15:12 horas del 29 de julio de 2008). \n\nVI.- Sobre las actuaciones del Instituto Costarricense de Acueductos y Alcantarillados. Esta Sala, por medio de la resolución no. 2006-008635 de las 15:30 horas del 20 de junio del 2006, declaró con lugar otro recurso de amparo interpuesto contra del instituto aquí recurrido sobre la misma problemática de contaminación ambiental. Del informe rendido por parte de esta autoridad recurrida, el cual es dado bajo la solemnidad del juramento con las consecuencias legales que ello implica, así como de la prueba aportada en autos se desprende que se encuentra en proceso el proyecto para la construcción del alcantarillado sanitario para la comunidad de Puerto Viejo, denominado \"Alcantarillado Sanitario, tratamiento y disposición final de las Aguas Residuales de Puerto Viejo\", producto del Memorando de Acuerdo firmado el 01 de abril de 2016 entre el Instituto Costarricense de Acueductos y Alcantarillados y la Oficina de Naciones Unidas de Servicios para Proyectos (UNOPS), con la finalidad de ejecutar dos proyectos de mejoras de sistemas de abastecimiento de agua potable y el proyecto de saneamiento en Puerto Viejo de Limón. De igual forma, se comprobó que, entre las acciones realizadas atinentes al proyecto en cuestión, se tienen: (a) en cuanto a la adquisición de terrenos, se cuentan con todos los terrenos requeridos para la construcción de las obras; (b) en cuanto al estudio de impacto ambiental, está concluido, pero se encuentra en revisión por parte de la UNOPS previa presentación a la SETENA; (c) en cuanto a los estudios básicos de las zonas de interés del proyecto -geotécnica, hidrología, topografía detallada, geología y forestal- se encuentran concluidos; (d) en cuanto al diseño de las estaciones de bombeo, las líneas de impulsión de aguas crudas y la red de alcantarillado sanitario se encuentra concluido; (e) en cuanto a la construcción de estaciones de bombeo, líneas de impulsión de aguas crudas y la red de alcantarillado sanitario, los términos de referencia para su contratación se encuentran concluidos y se está en inicios de contratación para la construcción de las obras; (f) en cuanto al diseño y construcción de la planta de tratamiento de aguas residuales y tubería de descarga, los términos de referencia para su contratación se encuentran concluidos y se está en inicios de contratación para el diseño y la construcción de las obras. No obstante, se verificó que el Instituto de Acueductos y Alcantarillados cuenta con cronograma para la ejecución de la construcción de la red de alcantarillado sanitario desde agosto de 2019 hasta mayo de 2020 y la construcción de la planta de tratamiento de aguas residuales y las tuberías de descarga desde febrero de 2020 hasta octubre de 2020. De lo anteriormente expuesto, se verifica que el AYA ya cuenta con un proyecto en vía de ejecución para construir al sistema de alcantarillado. Ahora bien, tal como lo aclara el mismo instituto, mientras, se construye el alcantarillado, las demás, instituciones no pueden simplemente esperar la solución sin tomar ninguna medida al respecto, por lo que deberá el instituto recurrido coordinar con la Municipalidad de Talamanca y el Ministerio de Salud las acciones pertinentes en aras de brindar una solución temporal que atienda el problema indicado, lo anterior pese a lo señalado en cuanto al proyecto de construcción del sistema de alcantarillado. \n\nVII.- Sobre las actuaciones de la Municipalidad de Talamanca. De las pruebas allegadas a los autos, se tiene que señalar, que hay evidencia de que los tanques sépticos de Puerto Viejo no funcionan adecuadamente y que algunos desfogan a cuerpos receptores que cruzan la comunidad o, inclusive a caños construidos para aguas pluviales. Ante tal situación, la Municipalidad de Talamanca indica que, en la actualidad, se está desarrollando el plan regulador del distrito de Cahuita por el INVU, que involucra a la localidad de Puerto Viejo, siendo que se encuentra en un 40% de avance, que al tratarse de una propiedad privada, la situación de contaminación que alega el recurrente es competencia del Ministerio de Salud y que el AYA está desarrollando un proyecto de alcantarillado sanitario. Sin embargo, conforme se indicó, no puede la municipalidad simplemente esperar a que otros solucione el problema y desatender sus obligaciones de verificar que las construcciones que se realicen bajo su jurisdicción cumplan los requisitos de seguridad y salubridad necesarios para asegurar así el bienestar de sus ocupantes y de establecer una política integral de planteamiento urbano, que garantice un desarrollo urbano en congruencia con el funcionamiento eficiente de un sistema de provisión de agua potable y de recolección, tratamiento y disposición final de las aguas residuales. No es cierto que, por tratarse de propiedad privada, la municipalidad no pueda hacer nada al respecto, pues existe la obligación de los vecinos de ajustar las construcciones a la autorización respectiva y el deber de la municipalidad de velar porque así lo hubieran hecho. En este caso, la Municipalidad no ha verificado que las construcciones que existen efectivamente se desarrollaron conforme lo autorizó y si esa autorización efectivamente indicó que debía existir un tratamiento adecuado de las aguas negras. En consecuencia, el amparo debe declararse con lugar contra la Municipalidad de Talamanca y ordenarle que verifique lo anterior y dicte las órdenes que sean necesarias para solucionar los problemas detectados. \n\nVIII.- Sobre las actuaciones del Ministerio de Salud. En cuanto al Área de Salud se refiere, indica en su informe que ha dictado varias órdenes sanitarias. Sin embargo, dado el informe del AYA es muy claro que existen tanques sépticos que funcionan de manera irregular. En consecuencia, el Ministerio de Salud no ha cumplido a cabalidad con su obligación de velar porque las aguas negras se dispongan de manera adecuada mientras se construye el alcantarillado. Al igual que la municipalidad, el Área de Salud no puede simplemente esperar que alcantarillado se construya, sino que debe dictar las órdenes sanitarias que sean necesarias con el fin de evitar la disposición irregular de las aguas negras. En consecuencia, el amparo procede también en cuanto al Ministerio de Salud se refiere (…)\n\nPor tanto:\n\nSe declara con lugar el recurso. En consecuencia, se le ordena a Yamileth Astorga Espeleta en su condición de Presidenta Ejecutiva y a Manuel Antonio Salas Pereira, en su condición de Gerente General, ambos del Instituto Costarricense de Acueductos y Alcantarillados, a Marvin Antonio Gómez Bran en su condición de Alcalde Municipal de Talamanca, y a Jennifer Jones Villiers en su condición de Directora del Área Rectora de Salud de Talamanca del Ministerio de Salud, o a quienes ocupen esos cargos, que emitan las órdenes y lleven a cabo las actuaciones respectivas, cada uno en cumplimiento de sus funciones asignadas por ley, para que en el plazo de TRES MESES, contado a partir de la notificación de esta sentencia, se brinde una solución, al problema de contaminación que aqueja a los habitantes de Puerto Viejo. Asimismo, mientras se logra esta solución definitiva, el Instituto Costarricense de Acueductos y Alcantarillados deberá coordinar con esas otras instituciones –Municipalidad de Talamanca y Ministerio de Salud- la solución temporal o provisional del problema de contaminación acusado. Se advierte que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Talamanca, al Instituto Costarricense de Acueductos y Alcantarillados y al Estado, al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese esta resolución a Yamileth Astorga Espeleta en su condición de Presidenta Ejecutiva y a Manuel Antonio Salas Pereira, en su condición de Gerente General, ambos del Instituto Costarricense de Acueductos y Alcantarillados, a Marvin Antonio Gómez Bran en su condición de Alcalde Municipal de Talamanca, y a Jennifer Jones Villiers en su condición de Directora del Área Rectora de Salud de Talamanca del Ministerio de Salud, o a quienes ocupen esos cargos de manera personal (…)” (sic) (el resaltado no pertenece al original). \n\n VI.- La recurrente lo que plantea en el presente proceso es el incumplimiento de la orden dada por este Tribunal desde el año 2019. En efecto, nótese que en la sentencia citada se ordenó a las autoridades recurridas “se brinde una solución, al problema de contaminación que aqueja a los habitantes de Puerto Viejo. Asimismo, mientras se logra esta solución definitiva, el Instituto Costarricense de Acueductos y Alcantarillados deberá coordinar con esas otras instituciones –Municipalidad de Talamanca y Ministerio de Salud- la solución temporal o provisional del problema de contaminación acusado”, cuyo plazo de concreción debía ser, como máximo, de 3 meses, pero ya han transcurrido aproximadamente 7 años y la problemática de contaminación con aguas negras en la playa Puerto Viejo continúa. La relación de hechos probados denota que las autoridades del Ministerio de Salud han realizado acciones tendientes a dar cumplimiento a lo dispuesto en la sentencia No. 2019-007689 de las 09:15 horas de 3 de mayo de 2019; sin embargo, a la fecha la problemática persiste y autoridades de la Municipalidad de Talamanca consideran que la situación debe ser resuelta por otras instancias, obviando la orden brindada por esta Sala. \n\nVII.- De otra parte, es importante subrayar que la recurrente no alegó y mucho menos demostró que ella haya interpuesto alguna denuncia posteriormente, y no se haya atendido; tampoco expuso algún hecho nuevo que ameritara un análisis y resolución mediante un nuevo proceso. Asimismo, si bien Nombre01 no figura como recurrente y/o tutelado en el recurso de amparo No. 19-002174-0007-CO, lo cierto es que inequívocamente acude a favor de un ambiente sano y ecológicamente equilibrado, por lo que se admite la defensa por intereses difusos y al tratarse de una afectación ambiental de carácter general y no particular (ver en similar sentido la sentencia 2026-014321 de las 09:20 horas de 24 de abril de 2026, entre otras). Por consiguiente, dado que ya este Tribunal vertió un pronunciamiento sobre la problemática de contaminación de aguas en Puerto Viejo, lo que procede es desglosar las presentes diligencias para que se tramiten en el recurso de amparo No. 19-002174-0007-CO, como una gestión de desobediencia. \n\nVIII.- Conclusión. Desglósense el escrito agregado al expediente digital a las 2:37 horas de 6 de setiembre de 2025, así como el resto de los memoriales aportados a este proceso, para que se tramiten como una gestión de desobediencia en el recurso de amparo No. 19-002174-0007-CO. Archívese el presente asunto. \n\nIX.- Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia.   "body_en_text": "Exp: 25-027108-0007-CO\n\nRes. Nº 2026020237\n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours thirty minutes on the fifth of June, two thousand twenty-six.\n\nWrit of amparo (recurso de amparo) filed by Nombre01, national identity card (cédula de identidad) CED01, against the MUNICIPALIDAD DE TALAMANCA and the PODER EJECUTIVO.\n\nRecitals:\n\n1.- By means of the brief added to the digital case file (expediente digital) at 2:37 hours on September 6, 2025, the petitioner filed a writ of amparo against the Municipalidad de Talamanca and the Poder Ejecutivo. The petitioner stated that in the district of Puerto Viejo de Talamanca, province of Limón, specifically at Dirección01, there is a sewer system (sistema de alcantarillado) that continuously discharges dirty water into the stream (quebrada) that flows out to the beach of Puerto Viejo. She stated that a concrete pipe installed beneath the bridge pours untreated contaminated water carrying solids, plastic waste, garbage, and organic matter, which flows directly into the sand and the seawater. She argued that the discharge is not an intermittent phenomenon caused by rainfall but rather a permanent and constant flow, indicating that it consists of stormwater (aguas pluviales) mixed with wastewater (aguas residuales), which aggravates its hazardousness. She noted that the area is also characterized by a constant stench, described as the smell of sewage (aguas negras) and decomposing matter (\"floca\"). Finally, she asserted that this damage is progressive, silent, and of irreversible consequence if immediate measures are not adopted. She requested that the petition be granted.\n\n2.- By means of an order issued at 22:33 hours on September 18, 2025, the writ of amparo was admitted and the respondent authorities were served with notice of the facts alleged.\n\n3.- By means of the brief added to the digital case file at 13:56 hours on September 24, 2025, Franz Tattenbach Capra, in his capacity as Minister of MINAE, reported under oath that: \"(…) FIRST: In response to the mandate of the Sala, the Dirección de Aguas of MINAE was requested to provide a report as the competent authority, which reported the following: With reference to official communication DA-UHCAROG-0662-2025 from the Dirección de Aguas of MINAE, a report is submitted in response to the writ of amparo (case file 25-027108-0007-CO) filed by Nombre01, regarding wastewater contamination in Puerto Viejo de Limón. The document indicates that, although MINAE has participated in joint inspections requested by the Fiscalía Ambiental (such as the one conducted on April 22, 2024, documented in official communication DA-UHCAROG-0249-2024), no prior complaints from the petitioner are on record at the Dirección de Aguas. It is clarified that AyA holds a valid discharge permit (permiso de vertido) (case file 5378-V) for the local treatment plant, which is not yet in operation, and that the underlying problem—the improper disposal of wastewater by the community and the non-operation of the treatment plant—falls outside MINAE's jurisdiction, as the Ministerio de Salud and AyA are responsible for enforcing sanitary orders (órdenes sanitarias) and putting the sewer system into operation, in compliance with what was ordered by the Sala Constitucional in Voto 2019007689 (case file 19-002174-007-CO)(…) SECOND: In response to the mandate of the Sala, the Área de Conservación la Amistad Caribe of SINAC was requested to provide a report, which reported the following: By means of official communication SINAC-ACLAC-DASP-RNVSGM-469-2025, the technical inspection report carried out on September 20, 2025 at Dirección01, Puerto Viejo de Talamanca, is submitted in response to writ of amparo No. 25-027108-0007-CO, in which it was confirmed that direct discharges of untreated domestic wastewater into a body of water flowing into the beach were occurring, generating unsanitary conditions with dark-colored water, foul odors, accumulation of solid waste, and the presence of homeless persons, which constitutes a sanitary, social, and environmental risk affecting tourism activity and the community's image. As part of the actions taken by ACLAC to address this problem, official communications SINAC-ACLAC-DASP-RNVSGM-470-2025 were issued to the Municipalidad de Talamanca, requesting the coordination of immediate actions; SINAC-ACLAC-DASP-RNVSGM-471-2025 to the Ministerio de Salud – Área Rectora de Salud de Talamanca, to request the corresponding sanitary attention; and SINAC-ACLAC-DASP-RNVSGM-474-2025 to the Instituto Costarricense de Acueductos y Alcantarillados (AyA), in order to manage the full commissioning of the wastewater treatment plant (planta de tratamiento de aguas residuales, PTAR). THIRD: In light of the facts stated and the attached documentation, it is conclusively demonstrated that the Dirección de Aguas of MINAE has at all times acted strictly within the bounds of its legal and technical competences, with no omission whatsoever on the part of this institution. On the contrary, technical support has been provided as requested through the appropriate channels, with proactive participation in the joint inspections ordered by the Ministerio Público, such as the one carried out on April 22, 2024, from which technical report DA-UHCAROG-0249-2024 was produced. Likewise, this Ministry has fulfilled its obligation to issue the corresponding discharge permits to the responsible entity, AyA (case file 5378-V), and has provided the technical reports required for the ongoing judicial proceedings. The fundamental solution to the problem raised—which rests in the commissioning of the sanitary sewer system (alcantarillado sanitario) and compliance with sanitary orders by private parties—falls outside MINAE's jurisdiction, as its execution and primary oversight correspond to the Instituto Costarricense de Acueductos y Alcantarillados (AyA) and the Ministerio de Salud, as established by the Sala Constitucional in its ruling No. 2019007689. Moreover, ACLAC fulfilled its competence by conducting the inspection, documenting the situation, issuing the corresponding technical reports (official communications No. 469, 470, 471 and 474-2025), and formally requesting action from the responsible institutions: AyA, for the operation of the treatment plant, and the Ministerio de Salud, for sanitary oversight. Therefore, ACLAC carried out the reporting and inter-institutional coordination actions within its purview, transferring responsibility for a solution to the governing entities.\" (sic).\n\n4.- By means of the brief added to the digital case file at 12:48 hours on September 26, 2025, Mary Denisse Munive Angermüller, in her capacity as Minister of Health (Ministra de Salud), reported under oath that: \"(…) I, the undersigned, respond to the present writ of amparo, based on report CARTA-MS-DRRSHC-DARST-3177-2025, dated September 22, 2025, issued by Dr. Jennifer Jones Villiers, Director of the Área Rectora de Salud de Talamanca, the sector to which the facts reported by the petitioner pertain, which summarizes the following: \"(…) First, it should be noted that this case has been handled since 2019 under writ of amparo case file 19-002174-007-CO, ruling No. 2019007689, filed by Mr. Nombre02, through which this Ministry has kept the honorable Sala Constitucional informed of the actions taken, and the body of water that flows to the sea was at the time referred to as Quebrada Sin Nombre. Since the inauguration of the bridge at the entrance to Puerto Viejo, it has been identified as 'Joel Gyal.' (…) As part of what was ordered by the Sala Constitucional in ruling No. 2019007689 under the aforementioned writ of amparo, the Municipalidad de Talamanca and the Ministerio de Salud were ordered to coordinate and execute the appropriate actions in order to provide a temporary solution to address the indicated problem, until such time as the Instituto Costarricense de Acueductos y Alcantarillados (AyA) put the 'Alcantarillado Sanitario, tratamiento y disposición final de las Aguas Residuales de Puerto Viejo' into operation. The implementation schedule projected that the sanitary sewer network would be constructed between August 2019 and May 2020, and that construction of the PTAR and the discharge pipe was scheduled for February 2020 through October 2020. This was the result of the memorandum of agreement signed on April 1, 2016 between AyA and the United Nations Office for Project Services (UNOPS). In 2019, the Ministerio de Salud, in coordination with AyA and UNOPS, carried out a delimitation of the areas with influence on said stream, identifying a total of 37 properties including commercial establishments, residences, and services. A working method was defined, and as a result, 4 properties were classified as 'red' due to critical problems with the condition of their septic tanks (tanques sépticos) (and drainage systems), and a total of 16 properties were classified as 'grey,' with greywater (aguas grises) or soapy-water problems, which were not directed to drainage systems and therefore discharged untreated into the open air and ultimately into the public roadway or into the Quebrada Sin Nombre. The corresponding sanitary orders were issued to the identified commercial establishments and residences, requesting that used water (aguas servidas) be properly and sanitarily disposed of, in order to prevent contamination of soil and receiving bodies of water, as well as the breeding of disease vectors. To do so, they were required to carry out maintenance or repair work, or install an individual treatment system (septic tanks and/or drainage systems) as appropriate, as a temporary measure until the sanitary sewer project came into operation. Additionally, it was noted that once the sanitary sewer became operational, they would be obligated to connect their sewage and greywater disposal systems to the network. Based on official information regarding the commissioning of the sanitary sewer project, a delay of 5 years relative to the originally established timeline has been determined; although the PTAR is operational and the network works have advanced significantly, construction and repair work is ongoing, and it has been determined that only approximately one quarter of the total beneficiary population has connected to the network. This situation has exacerbated the public health and environmental contamination problem in the community, and has generated false expectations and uncertainty, as well as widespread discontent and anger among the population and tourists. It should be noted that the Municipalidad de Talamanca has not participated in any coordinated effort to follow up on the problem, nor has it responded to summons. It has only participated in the ceremonial inauguration events of the failed project. With regard to the observations that the evidence shows the septic tanks and drainage systems in the community of Puerto Viejo 'are not functioning properly' and that many overflow into receiving bodies of water that cross the community, or discharge into channels built for stormwater, the Municipalidad's constant response is that, since it involves private property, the contamination is the responsibility of the Ministerio de Salud and AyA. As the Sala Constitucional stated in ruling No. 2019007689, 'the Municipalidad cannot simply wait for others to solve the problem and neglect its obligations to verify that construction carried out under its jurisdiction meets the safety and public health requirements necessary to ensure well-being (…). It is not true that, because the property is private, the municipality cannot do anything about it, since there is an obligation on residents to bring their constructions into compliance with the respective authorization, and a duty on the municipality to ensure that they have done so. In this case, the Municipalidad has not verified that the existing constructions actually comply with what it authorized, or whether that authorization actually stipulated that there should be proper treatment of sewage.' The Ministerio de Salud has monitored compliance with the administrative acts issued in 2019. As a result, at the beginning of 2024, it was confirmed that only 6 of the cases that had been discharging onto public roads had been closed due to compliance with the orders, demonstrating non-compliance on the part of the majority of the notified residences and some commercial establishments. It should be noted that a large majority of the residences that have wastewater treatment systems in poor operating condition are informally built structures, where concrete culverts (alcantarillas de concreto) are generally used as a substitute for the septic tank, which is prohibited under current legislation. These individuals are generally of limited means, and with the arrival of COVID-2019 they have been unable to comply with what was ordered. In 2024, through a new report with implementation schedules provided by AyA and UNOPS in response to sanitary orders MS-DRRSHC-DARST-OS-063-2024 and MS-DRRSHC-DARST-OS-064-2024 issued to them, they reported that by July 30, 2024, the contractor would be completing construction of the works; and, in parallel, that sections would be enabled for connection to the new sewer system in order to reduce contaminating discharges into bodies of water and onto public roads. Taking the above as a reference, between May and June 2024, new sanitary orders were issued to property owners who were still discharging wastewater without any treatment into the area of the Quebrada Sin Nombre (Joel Gyal), ordering them to connect to the sanitary sewer network within a period of 3 months, once AyA gave its approval. In April 2025, a meeting was held with those responsible for the project, i.e., AyA and UNOPS, to determine the state of progress, where it was found that the project has not been completed and that repairs are still being carried out on some sections of the network that presented defects caused by the original contractor. According to the information provided, as of April 2025, of the 573 beneficiaries to be covered by the project, only 110 had connected. The sector in which the residences and commercial establishments located within the area of influence of the Quebrada Sin Nombre (Joel Gyal) are situated (classified as sector 4) had not been formally notified at that time to proceed with connection to the sewer network, and therefore had not been integrated into the system. In this way, they have not complied with the submitted schedule, and therefore the residences and some commercial establishments that were ordered to connect have been unable to do so because they have not been officially notified. This situation was confirmed through visits conducted in August 2025, S-0156-2025, MS-DRRSHC-DARST-OS-0157-2025, MS-DRRSHC-DARST-OS-0158-2025, to both UNOPS and AyA, ordering them to complete, within one month of being notified of the acts, all actions required for the completion of the project as well as the priority interconnection of the structures that are discharging without any treatment into the public roadway or into the aforementioned body of water, and to provide the necessary technical assistance to the residences and commercial establishments that continue to contribute wastewater discharges so that they can connect to the network. They are also ordered to process the application for the health operating permit (Permiso Sanitario de Funcionamiento) for the PTAR before the Área Rectora de Salud de Talamanca, since it is already in operation. In response to the sanitary order, UNOPS filed a motion for revocation with a subsidiary appeal (recurso de revocatoria con la apelación en subsidio), which is currently being resolved by the legal office of the Dirección Regional Huetar Caribe. It should be noted that the sanitary orders have not been complied with, and therefore the appropriate follow-up has been conducted and special enforcement measures authorized by the Ley General de Salud will be applied (…)\" (sic).\n\n5.- By means of the brief added to the digital case file at 11:56 hours on September 29, 2025, Rugeli Morales Rodríguez, in his capacity as Mayor (Alcalde) of the Municipalidad de Talamanca, reported under oath that: \"(…) It must be emphasized that, pursuant to the provisions of the Ley General de Salud, Ley N.° 5395, the control, regulation, prevention, and sanctioning of wastewater and sewage discharges constitutes an exclusive competence of the Ministerio de Salud. In turn, the Instituto Costarricense de Acueductos y Alcantarillados (AyA), in its capacity as the entity responsible for the public service of drinking water and sanitation, holds specific duties in this area. Consequently, the Municipalidad de Talamanca lacks legal authority to intervene in the sanitary control of such discharges, with its powers limited to the routine maintenance of road and stormwater infrastructure. Accordingly, it is improper to seek to attribute responsibility to the Municipalidad for acts that, under the applicable legal framework, rest solely and exclusively with the Ministerio de Salud and the Instituto Costarricense de Acueductos y Alcantarillados (AyA). For the foregoing reasons, the Municipalidad de Talamanca has not committed any act or omission that could cause present or imminent harm to the petitioner's fundamental rights, and therefore the petition should be denied, based on Articles 21 and 50 of the Constitución Política, in conjunction with Articles 4, 7, 282, and 284 of the Ley General de Salud, and the consistent jurisprudence of this honorable Sala Constitucional regarding differentiated competences between local governments and national sanitary authorities (…) The problem raised by the petitioner has been considered by the Sala Constitucional de la Corte Suprema de Justicia in case files 19-002174-0007-CO, where enforcement motions (gestiones de incumplimiento) have been repeatedly filed and rejected by this judicial authority, the most recent being Res. Nº 2024016382, issued at nine hours twenty minutes on the fourteenth of June, two thousand twenty-four (…) As a Municipal Corporation, we have been attentive to the completion and implementation of the works related to the 'Alcantarillado sanitario, tratamiento y disposición de las aguas residuales de Puerto Viejo de Limón'; however, we maintain our position that it is mandatory to wait for the sewage and wastewater treatment system—whose project is currently under execution—to come into operation, in order to determine whether there are remaining deficiencies in the municipal system to be resolved, or whether it simply requires routine maintenance, so that only stormwater and natural runoff flow to the sea without affecting the marine ecosystem, a position that has been affirmed by the honorable Sala Constitucional. In view of the foregoing, it must be noted that there is a material and legal impossibility for the Municipalidad de Talamanca to assume responsibility for the acts described, given that, according to the technical report issued by municipal staff and the same report submitted by the Ministerio de Salud in this proceeding, what is effectively established is the existence of an overflow of wastewater or sewage through the pipe or stormwater outlet of the bridge known as 'Joel Gyal Bridge.' Such circumstance, by its nature and effects, does not correspond to a routine maintenance or cleaning problem attributable to the Municipalidad, but rather constitutes a matter related to the management and control of wastewater discharges, a matter whose exclusive competence belongs to the Ministerio de Salud, in its capacity as the governing authority in public and environmental health, as provided in Articles 1, 4, 7, 282, and 284 of the Ley General de Salud, Ley N.º 5395, as well as Article 50 of the Constitución Política\" (sic).\n\n6.- By means of a certification dated October 1, 2025, it was noted that there is no record of the Director of the Unidad Técnica de Gestión Vial of the Municipalidad de Talamanca having submitted the report requested by the Sala.\n\n7.- The legal requirements applicable to the proceedings have been observed.\n\nThe opinion is authored by Justice (Magistrado) Araya García; and,\n\nConsidering:\n\nI.- Preliminary matter. Given that the Director of the Unidad Técnica de Gestión Vial of the Municipalidad de Talamanca failed to submit the report within the deadline set by this Tribunal in the ruling issued at 22:33 hours on September 18, 2025, and in accordance with Article 45 of the Ley de la Jurisdicción Constitucional, the constitutional analysis proceeds on the basis of what was set forth by the petitioner and the other respondent authorities.\n\nII.- Subject matter of the petition. The petitioner stated that there is a problem arising from sewage flowing toward the beach of Puerto Viejo, which poses a risk to the safety and lives of domestic and international tourists. She stated that, although the situation has been known to the authorities for several years, it had not been resolved as of the date the petition was filed.\n\nIII.- Established facts. For the purposes of deciding this matter, the following facts are considered to have been duly established:\n\n1) The authorities of the Ministerio de Salud indicate that \"First, it should be noted that this case has been handled since 2019 under writ of amparo case file 19-002174-007-CO, ruling No. 2019007689, filed by Mr. Nombre02, through which this Ministry has kept the honorable Sala Constitucional informed of the actions taken, and the body of water that flows to the sea was at the time referred to as Quebrada Sin Nombre. Since the inauguration of the bridge at the entrance to Puerto Viejo, it has been identified as 'Joel Gyal.' (…) As part of what was ordered by the Sala Constitucional in ruling No. 2019007689 under the aforementioned writ of amparo, the Municipalidad de Talamanca and the Ministerio de Salud were ordered to coordinate and execute the appropriate actions in order to provide a temporary solution to address the indicated problem, until such time as the Instituto Costarricense de Acueductos y Alcantarillados (AyA) put the 'Alcantarillado Sanitario, tratamiento y disposición final de las Aguas Residuales de Puerto Viejo' into operation. The implementation schedule projected that the sanitary sewer network would be constructed between August 2019 and May 2020, and that construction of the PTAR and the discharge pipe was scheduled for February 2020 through October 2020. This was the result of the memorandum of agreement signed on April 1, 2016 between AyA and the United Nations Office for Project Services (UNOPS). In 2019, the Ministerio de Salud, in coordination with AyA and UNOPS, carried out a delimitation of the areas with influence on said stream, identifying a total of 37 properties including commercial establishments, residences, and services. A working method was defined, and as a result, 4 properties were classified as 'red' due to critical problems with the condition of their septic tanks (and drainage systems), and a total of 16 properties were classified as 'grey,' with greywater or soapy-water problems, which were not directed to drainage systems and therefore discharged untreated into the open air and ultimately into the public roadway or into the Quebrada Sin Nombre. The corresponding sanitary orders were issued to the identified commercial establishments and residences, requesting that wastewater be properly and sanitarily disposed of, in order to prevent contamination of soil and receiving bodies of water, as well as the breeding of disease vectors. To do so, they were required to carry out maintenance or repair work, or install an individual treatment system (septic tanks and/or drainage systems) as appropriate, as a temporary measure until the sanitary sewer project came into operation. Additionally, it was noted that once the sanitary sewer became operational, they would be obligated to connect their sewage and greywater disposal systems to the network. Based on official information regarding the commissioning of the sanitary sewer project, a delay of 5 years relative to the originally established timeline has been determined; although the PTAR is operational and the network works have advanced significantly, construction and repair work is ongoing, and it has been determined that only approximately one quarter of the total beneficiary population has connected to the network. This situation has exacerbated the public health and environmental contamination problem in the community, and has generated false expectations and uncertainty, as well as widespread discontent and anger among the population and tourists\" (see report and evidence submitted to the case file).\n\n2) The authorities of the Municipalidad de Talamanca indicate that \"As a Municipal Corporation, we have been attentive to the completion and implementation of the works related to the 'Alcantarillado sanitario, tratamiento y disposición de las aguas residuales de Puerto Viejo de Limón'; however, we maintain our position that it is mandatory to wait for the sewage and wastewater treatment system—whose project is currently under execution—to come into operation, in order to determine whether there are remaining deficiencies in the municipal system to be resolved, or whether it simply requires routine maintenance, so that only stormwater and natural runoff flow to the sea without affecting the marine ecosystem, a position that has been affirmed by the honorable Sala Constitucional. In view of the foregoing, it must be noted that there is a material and legal impossibility for the Municipalidad de Talamanca to assume responsibility for the acts described, given that, according to the technical report issued by municipal staff and the same report submitted by the Ministerio de Salud in this proceeding, what is effectively established is the existence of an overflow of wastewater or sewage through the pipe or stormwater outlet of the bridge known as 'Joel Gyal Bridge.' Such circumstance, by its nature and effects, does not correspond to a routine maintenance or cleaning problem attributable to the Municipalidad, but rather constitutes a matter related to the management and control of wastewater discharges, a matter whose exclusive competence belongs to the Ministerio de Salud, in its capacity as the governing authority in public health\" (see report and evidence submitted to the case file).\n\n3) On April 22, 2024, the respondent authorities conducted a joint inspection with the Fiscalía Agrario Ambiental, pursuant to the investigation into the facts described in the petition that is pending before that office (see report and evidence submitted to the case file).\n\n4) In April 2025, the Ministerio de Salud confirmed that the project established by ICAA and UNOPS to address the reported situation has not been completed and that repairs are still being carried out on some sections of the network that presented defects caused by the original contractor. According to the information provided, as of April 2025, of the 573 beneficiaries to be covered by the project, only 110 had connected (see report and evidence submitted to the case file).\n\n5) By means of official communication SINAC-ACLAC-DASP-RNVSGM-469-2025, the technical inspection report carried out on September 20, 2025 by ACLAC of SINAC is submitted, in which it is stated that \"the existence of direct discharges of untreated domestic wastewater into a body of water flowing into the beach was confirmed, generating unsanitary conditions with dark-colored water, foul odors, accumulation of solid waste, and the presence of homeless persons, which constitutes a sanitary, social, and environmental risk affecting tourism activity and the community's image. As part of the actions taken by ACLAC to address this problem, official communications SINAC-ACLAC-DASP-RNVSGM-470-2025 were issued to the Municipalidad de Talamanca, requesting the coordination of immediate actions; SINAC-ACLAC-DASP-RNVSGM-471-2025 to the Ministerio de Salud – Área Rectora de Salud de Talamanca, to request the corresponding sanitary attention; and SINAC-ACLAC-DASP-RNVSGM-474-2025 to the Instituto Costarricense de Acueductos y Alcantarillados (AyA), in order to manage the full commissioning of the water treatment plant\" (see report and evidence submitted to the digital case file).\n\nIV.- Unestablished fact. The following fact, relevant to this ruling, is considered not to have been established: Sole item.— That the petitioner filed a complaint regarding the facts described in the petition before the respondent authorities.\n\nV.- On the Specific Case. As the respondent authorities affirmed in the reports rendered under oath, this Constitutional Chamber has already examined the situation concerning the problem of sewage (aguas negras) flowing toward Puerto Viejo beach, having resolved writ of amparo (recurso de amparo) No. 19-002174-0007-CO. Thus, in Judgment No. 2019-007689 of 09:15 hours of May 3, 2019, it was ordered:\n\n\"(…) I.- Subject Matter. The petitioner alleged that at the main entrance to Puerto Viejo there exists an enormous sewage lagoon that flows toward the beach, thereby endangering the safety and lives of both national and international tourists. Despite the fact that the problem has been public and well-known for several years, the respondent authorities have not resolved it (…).\n\nV.- On the Merits. Regarding the disposal of sewage, the Ley Constitutiva del AYA (Law No. 2726 of April 14, 1961 and its amendments) provides that said institution was created with the following purpose: 'Article 1.- For the purpose of directing, setting policies, establishing and applying standards, carrying out and promoting the planning, financing, and development of, and resolving all matters related to the supply of potable water and the collection and evacuation of sewage and liquid industrial waste, as well as the regulatory aspect of stormwater (aguas pluviales) drainage systems in urban areas, throughout the entire national territory, the Instituto Costarricense de Acueductos y Alcantarillados is hereby created as an autonomous state institution.' Accordingly, it falls upon that institution, pursuant to the mandate of Article 2 of that same body of law, to direct and oversee all matters related to providing residents with a potable water service, as well as the collection and evacuation of sewage and liquid industrial waste and stormwater in urban areas. With regard to the municipality, there exists, on one hand, an obligation to monitor the existence of an adequate sewer network that allows for the proper disposal of wastewater (aguas residuales), and, on the other hand, the municipality may not disregard its duties when approving construction. In this regard, it is responsible for conducting inspections to ensure that sewage evacuation is carried out in accordance with what was authorized. Indeed, Article 169 of the Political Constitution grants municipalities the competence to plan and oversee the urban development of their locality, as a derivative of their duty to administer local interests and services in each canton. Also determinative is the provision of Article 1 of the Ley de Construcciones, which reads as follows: 'Article 1.- The Municipalities of the Republic are responsible for ensuring that cities and other populated areas meet the necessary conditions of safety, healthfulness, comfort, and beauty in their public thoroughfares and in the buildings and structures erected on their land, without prejudice to the powers granted by law to other administrative bodies in these matters.' On this same point, Article 87 of the aforementioned law establishes the following: 'Article 87.- The municipality shall exercise oversight over works carried out within its jurisdiction, as well as over the use given to them. It shall also have the mission of overseeing compliance with the provisions of this Law [...].' For the foregoing reasons, it is the responsibility of each municipality to verify that construction carried out within its jurisdiction meets the safety and healthfulness requirements necessary to ensure the well-being of its occupants, as well as to establish a comprehensive urban planning policy that guarantees urban development in accordance with the efficient functioning of a potable water supply system and a wastewater collection, treatment, and final disposal system. In addition to the foregoing, Article 280 of the Ley General de Salud expressly provides that the cleaning of sewers shall be the responsibility of municipalities. That same statute provides, in its Article 2, that it falls upon the Executive Branch, through the Ministry of Health, to define national health policy, and to regulate, plan, and coordinate all public and private activities related to health, as well as to carry out those activities falling within its competence under the law; and Article 341 of the referenced law establishes, among the attributions of the Ministry of Health, that of ordering and taking the special measures authorized by that statute to prevent risk or harm to the health of persons, or to prevent their spread or worsening, and to prevent the continuation or recurrence of violations by private parties. With respect to the specific subject matter of this amparo proceeding, the Ley General de Salud, in Book 1, Title 3, Chapter 3, provides—in the relevant part—the following: 'On the Obligations and Restrictions for the Sanitary Evacuation of Excreta (excretas) and Wastewater. Article [...] 287.- Every natural or juridical person who is the owner of dwellings, establishments, or buildings in which persons carry out their activities shall be responsible for ensuring that such properties have a system for the disposal of excreta and sewage and wastewater approved by the Ministry, and the users of such dwellings, establishments, or buildings shall be obligated to maintain said system in proper working condition.' 'Article 288.- Every owner is obligated to connect the excreta and sewage and wastewater elimination system on their property to the sanitary sewer system (alcantarillado sanitario) wherever such system is in operation, except in cases of exception that the relevant regulations recognize as warranted.' Likewise, from said regulations it follows that the authorities of the Ministry of Health are obligated to oversee the application and enforcement of the provisions of that law and its regulations, without prejudice to the powers and obligations that special laws confer upon and impose on other public bodies within their respective spheres of action (Article 337). This confirms the various functions and obligations that the legal framework imposes upon the Instituto Costarricense de Acueductos y Alcantarillados, the Ministry of Health, and the municipalities with respect to the collection, treatment, and final disposal of wastewater. These functions and obligations must, moreover—as was already noted in the preceding section—be exercised in a coordinated manner so as to ensure administrative efficiency and effectiveness (see in this regard Judgment No. 2008-11796 of 15:12 hours of July 29, 2008).\n\nVI.- On the Actions of the Instituto Costarricense de Acueductos y Alcantarillados. This Chamber, through Resolution No. 2006-008635 of 15:30 hours of June 20, 2006, granted another writ of amparo filed against the respondent institution on the same issue of environmental contamination. From the report rendered by this respondent authority, given under the solemnity of oath with the legal consequences that entails, as well as from the evidence submitted in the record, it is evident that the project for the construction of the sanitary sewer system for the community of Puerto Viejo is in progress, under the name \"Alcantarillado Sanitario, tratamiento y disposición final de las Aguas Residuales de Puerto Viejo,\" as a result of the Memorandum of Agreement signed on April 1, 2016 between the Instituto Costarricense de Acueductos y Alcantarillados and the United Nations Office for Project Services (UNOPS), for the purpose of carrying out two water supply system improvement projects and a sanitation project in Puerto Viejo de Limón. Likewise, it was confirmed that among the actions taken in connection with the project in question are the following: (a) regarding land acquisition, all land required for the construction of the works has been obtained; (b) regarding the environmental impact study, it has been completed but is under review by UNOPS prior to submission to SETENA; (c) regarding the basic studies of the project's areas of interest—geotechnics, hydrology, detailed topography, geology, and forestry—these have been completed; (d) regarding the design of pumping stations, raw water force mains, and the sanitary sewer network, the design has been completed; (e) regarding the construction of pumping stations, raw water force mains, and the sanitary sewer network, the terms of reference for contracting have been completed and procurement for the construction of the works is beginning; (f) regarding the design and construction of the wastewater treatment plant and discharge pipeline, the terms of reference for contracting have been completed and procurement for the design and construction of the works is beginning. Nevertheless, it was verified that the Instituto de Acueductos y Alcantarillados has a schedule for executing the construction of the sanitary sewer network from August 2019 to May 2020, and the construction of the wastewater treatment plant and discharge pipelines from February 2020 to October 2020. From the foregoing, it is confirmed that AYA already has a project in the process of execution to build the sewer system. However, as the institution itself clarifies, while the sewer system is being built, the other institutions cannot simply wait for a solution without taking any measures in that regard; therefore, the respondent institution must coordinate with the Municipalidad de Talamanca and the Ministry of Health on the appropriate actions in order to provide a temporary solution to the indicated problem, notwithstanding what has been set out with regard to the sewer system construction project.\n\nVII.- On the Actions of the Municipalidad de Talamanca. From the evidence submitted in the record, it must be noted that there is evidence that the septic tanks (tanques sépticos) in Puerto Viejo are not functioning properly and that some discharge into receiving bodies of water that cross the community or even into drainage channels built for stormwater. Faced with this situation, the Municipalidad de Talamanca indicates that a zoning plan (plan regulador) for the district of Cahuita is currently being developed by INVU, which includes the locality of Puerto Viejo, that this plan is 40% complete, that since the property in question is private, the contamination problem alleged by the petitioner falls within the competence of the Ministry of Health, and that AYA is developing a sanitary sewer project. However, as indicated, the municipality cannot simply wait for others to resolve the problem and neglect its obligations to verify that construction carried out within its jurisdiction meets the safety and healthfulness requirements necessary to ensure the well-being of its occupants, and to establish a comprehensive urban planning policy that guarantees urban development in accordance with the efficient functioning of a potable water supply and a wastewater collection, treatment, and final disposal system. It is not correct that, because the property is private, the municipality can do nothing about the matter, since residents are obligated to bring construction into compliance with the relevant authorization, and the municipality has a duty to verify that they have done so. In this case, the Municipality has not verified that the existing structures were actually developed in accordance with its authorization, nor whether that authorization in fact required the proper treatment of sewage. Consequently, the amparo must be granted against the Municipalidad de Talamanca, which must be ordered to verify the foregoing and to issue the orders necessary to resolve the detected problems.\n\nVIII.- On the Actions of the Ministry of Health. With regard to the Área de Salud, it states in its report that it has issued several health orders (órdenes sanitarias). However, given that the AYA report makes it very clear that septic tanks are functioning irregularly, the Ministry of Health has not fully complied with its obligation to ensure that sewage is disposed of in an appropriate manner while the sewer system is being built. Like the municipality, the Área de Salud cannot simply wait for the sewer system to be built, but must issue the health orders necessary to prevent the irregular disposal of sewage. Consequently, the amparo also proceeds with regard to the Ministry of Health (…)\n\nPor tanto:\n\nThe writ is granted. Accordingly, Yamileth Astorga Espeleta in her capacity as Executive President and Manuel Antonio Salas Pereira in his capacity as General Manager, both of the Instituto Costarricense de Acueductos y Alcantarillados, Marvin Antonio Gómez Bran in his capacity as Municipal Mayor of Talamanca, and Jennifer Jones Villiers in her capacity as Director of the Área Rectora de Salud de Talamanca of the Ministry of Health, or whoever occupies those positions, are hereby ordered to issue the orders and carry out the respective actions, each in fulfillment of their legally assigned functions, so that within THREE MONTHS, counted from the notification of this judgment, a solution is provided to the contamination problem afflicting the residents of Puerto Viejo. Likewise, while this definitive solution is achieved, the Instituto Costarricense de Acueductos y Alcantarillados must coordinate with those other institutions—the Municipalidad de Talamanca and the Ministry of Health—on the temporary or provisional solution to the alleged contamination problem. It is hereby warned that, in accordance with Article 71 of the Ley de la Jurisdicción Constitucional, a prison sentence of three months to two years, or a fine of twenty to sixty days, shall be imposed on any person who receives an order that they must comply with or enforce, issued in an amparo proceeding, and who fails to comply with or enforce it, provided the offense is not more seriously penalized elsewhere. The Municipalidad de Talamanca, the Instituto Costarricense de Acueductos y Alcantarillados, and the State are condemned to pay the costs, damages, and losses caused by the acts underlying this ruling, to be assessed in enforcement proceedings before the administrative court. This resolution is to be personally notified to Yamileth Astorga Espeleta in her capacity as Executive President and Manuel Antonio Salas Pereira in his capacity as General Manager, both of the Instituto Costarricense de Acueductos y Alcantarillados, Marvin Antonio Gómez Bran in his capacity as Municipal Mayor of Talamanca, and Jennifer Jones Villiers in her capacity as Director of the Área Rectora de Salud de Talamanca of the Ministry of Health, or to whoever occupies those positions (…)\" (sic) (emphasis not in the original).\n\nVI.- What the petitioner raises in the present proceeding is non-compliance with the order issued by this Tribunal in 2019. Indeed, it is noted that the cited judgment ordered the respondent authorities to \"provide a solution to the contamination problem afflicting the residents of Puerto Viejo. Likewise, while this definitive solution is achieved, the Instituto Costarricense de Acueductos y Alcantarillados must coordinate with those other institutions—the Municipalidad de Talamanca and the Ministry of Health—on the temporary or provisional solution to the alleged contamination problem,\" the deadline for which was to be a maximum of 3 months; however, approximately 7 years have now elapsed and the sewage contamination problem at Puerto Viejo beach continues. The recital of proven facts shows that the authorities of the Ministry of Health have taken actions aimed at complying with what was ordered in Judgment No. 2019-007689 of 09:15 hours of May 3, 2019; however, to date the problem persists, and the authorities of the Municipalidad de Talamanca consider that the situation should be resolved by other bodies, disregarding the order issued by this Chamber.\n\nVII.- Furthermore, it is important to emphasize that the petitioner neither alleged nor demonstrated that she subsequently filed any complaint that went unaddressed; nor did she set forth any new fact that would warrant analysis and resolution through a new proceeding. Similarly, although Nombre01 does not appear as a petitioner and/or protected party in writ of amparo No. 19-002174-0007-CO, she unequivocally comes forward in defense of a healthy and ecologically balanced environment, and therefore the defense of diffuse interests (intereses difusos) is admitted, since this involves an environmental harm of a general rather than individual nature (see, in a similar vein, Judgment 2026-014321 of 09:20 hours of April 24, 2026, among others). Consequently, given that this Tribunal has already issued a ruling on the water contamination problem in Puerto Viejo, the appropriate course of action is to sever the present proceedings so that they may be processed in writ of amparo No. 19-002174-0007-CO as a contempt proceeding (gestión de desobediencia).\n\nVIII.- Conclusion. The brief filed in the digital case file at 2:37 hours of September 6, 2025, together with the remaining submissions made in this proceeding, are hereby severed so that they may be processed as a contempt proceeding in writ of amparo No. 19-002174-0007-CO. The present matter is ordered archived.\n\nIX.- Documentation Submitted to the Record. The parties are hereby notified that if they have submitted any document on paper, as well as objects or evidence contained in any additional device of an electronic, computer-based, magnetic, optical, telematic, or new-technology nature, such items must be retrieved from the court office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the \"Reglamento sobre Expediente Electrónico ante el Poder Judicial,\" approved by the Full Court in Session No. 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial No. 19 of January 26, 2012, as well as the agreement approved by the Superior Council of the Judiciary in Session No. 43-12 held on May 3, 2012, Article LXXXI.\n\nPor tanto:\n\nThe brief filed in the digital case file at 2:37 hours of September 6, 2025, together with the remaining submissions made in this proceeding, are hereby severed so that they may be processed as a contempt proceeding in writ of amparo No. 19-002174-0007-CO.
