  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-010466-0007-CO \n\nRes. Nº 2026021157\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del doce de junio de dos mil veintiseis .\n\n Recurso de amparo que se tramita en expediente número 26-010466-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la MUNICIPALIDAD DE PUNTARENAS, el MINISTERIO DE SALUD, el MINISTERIO DE AMBIENTE Y ENERGÍA y el SERVICIO NACIONAL DE SALUD ANIMAL (SENASA). \n\nResultando:\n\n 1.- Mediante escrito incorporado al expediente digital a las 13:21 horas del 24 de marzo de 2026, la parte recurrente interpone recurso de amparo en contra de la Municipalidad de Puntarenas, el Ministerio de Salud, el Ministerio de Ambiente y Energía y el SENASA. Expone literalmente lo siguiente: \n\n1. Desde hace aproximadamente dieciséis años vivo en la comunidad de Santa Juana, en Chomes de Puntarenas. Durante todo ese tiempo nunca tuve problemas con aguas pluviales ni con polvo. Sin embargo, hace unos cinco años llegó a la zona el señor Nombre02, quien instaló una chanchera. A partir de ese momento comenzaron los malos olores en la comunidad. \n\n2. Con el paso del tiempo, especialmente desde el año 2023, la situación empeoró. En época de lluvias, empezó a bajar una cantidad excesiva de agua desde esa propiedad, lo que provocó que la alcantarilla no diera abasto. A esto se suma que la Municipalidad de Puntarenas no le da mantenimiento al sistema, lo que agrava aún más el problema. \n\n3. La cantidad de agua ha sido tal que, en varias ocasiones, ha llegado a meterse a mi casa. Por eso, el 7 de agosto de 2024 acudí a la Municipalidad para pedir una inspección en mi vivienda y en el alcantarillado, pero nunca llegaron. \n\n4. La situación se volvió aún más difícil cuando las heces de vacas y cerdos comenzaron a acumularse tanto en la calle como en mi propiedad. El olor es muy fuerte y constante. Traté de hablar directamente con el señor Nombre02 para buscar una solución, pidiéndole que cambiara el drenaje de los cerdos y que quitara las vacas que están frente a mi casa, pero no mostró ninguna disposición para ayudar. \n\n5. Ante esto, los días 2 y 11 de septiembre de 2024 acudí al Ministerio de Salud e interpuse denuncias por los malos olores, las moscas y la acumulación de heces. La situación era —y sigue siendo— muy difícil de soportar, ya que el mal olor se mantiene durante todo el día y la noche. \n\n6. Como el problema continuaba, el 27 de febrero de 2025 presenté una denuncia ante el SINAC, porque estas aguas contaminadas no solo me afectan a mí, sino también al manglar, que es donde terminan. A pesar de esto, tampoco recibí respuesta. \n\n7. Al ver que ninguna institución actuaba, acudí a la Defensoría de los Habitantes, donde me ayudaron a gestionar solicitudes de información a las entidades correspondientes. \n\n8. El día 6 de mayo del año dos mil veinticinco el señor Nombre02 contrato maquinaria con la finalidad de realizar un drenaje exactamente frente a mi casa, la maquinaria contratada fue una vagoneta y un tractor los cuales realizaron dicho drenaje, el cual en invierno se llena y toda esa agua va para la calle por la falta de alcantarillado y también va a caer al estero. \n\n9. El 23 de mayo de 2025 el Ministerio de Salud me informó que se le solicitó al señor Nombre02 eliminar los cerdos. Sin embargo, las vacas continuaron frente a mi casa y no se le dio seguimiento real al problema. \n\n10. La falta de cunetas y el mal estado del alcantarillado ha provocado que el agua contaminada se acumule frente a mi casa. En verano, esos residuos se secan y se convierten en polvo, que cada vez que pasa un carro o una moto entra directamente a mi hogar. \n\n11. El 19 de junio de 2025 volví a ir a la Municipalidad para pedir ayuda, solicitando que se hicieran cunetas y se diera mantenimiento a la alcantarilla, ya que eso evitaría que el agua afecte mi propiedad. Nuevamente, no obtuve respuesta. \n\n12. El 28 de enero de este año tuve que acudir al área de salud de Chomes debido a fuertes alergias y erupciones en la piel. Expliqué que esto está relacionado con el polvo contaminado con heces que constantemente entra a mi casa, pero no se tomó ninguna acción concreta. \n\n13. El 25 de febrero volví a la Municipalidad porque el señor Nombre02 volvió a tener cerdos y las vacas siguen frente a mi casa. El polvo es constante. Me provoca picazón, ardor en la piel y no me deja dormir. Incluso dentro de mi casa, los muebles se llenan de un polvo muy fino. \n\n14. Toda esta situación me ha afectado profundamente. No solo mi salud física ha empeorado, sino también mi estado emocional. Vivo con ansiedad, depresión e insomnio, porque mi casa —que debería ser un lugar seguro— se ha convertido en un espacio donde todos los días estoy expuesta a suciedad, malos olores y afectaciones a mi salud. Todo esto ocurre porque las instituciones, especialmente la Municipalidad de Puntarenas y el Ministerio de Salud, no han actuado de forma efectiva para proteger mis derechos. \n\n(…) \n\nPETITORIA\n\nPor lo expuesto, solicito respetuosamente a la Sala Constitucional de la Corte Suprema de Justicia:\n\n1. Que se declare con lugar el presente recurso de amparo. \n\n2. Que se ordene a la Municipalidad de Puntarenas la construcción e instalación de cunetas, alcantarillado u obras de drenaje necesarias, a fin de evitar que las aguas provenientes de la finca del recurrido continúen afectando la vía pública y la propiedad de la recurrente. \n\n3. Que se ordene a las autoridades recurridas, en el ámbito de sus competencias, adoptar medidas inmediatas, efectivas y de seguimiento, para evitar la contaminación generada por la actividad descrita. \n\n4. Que se ordene al señor Nombre02 cesar la actividad contaminante o adecuarla a las condiciones sanitarias y ambientales necesarias, de forma que no afecte a terceros. \n\n5. Que se declare la violación a los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado”.\n\n2.- Por resolución de las 17:56 horas del 16 de abril de 2026, la Presidencia de la Sala dio curso a este proceso constitucional y se le solicitó informe al alcalde, jefe de la Unidad Técnica de Gestión Vial, ambos de la Municipalidad de Puntarenas, director del Área Rectora de Salud de Montes de Oro, jefe de la Oficina Subregional de Esparza del Área de Conservación Pacífico Central y director regional Pacífico Central de SENASA, sobre los hechos alegados por la parte recurrente. \n\n3.- Mediante escrito incorporado al expediente digital a las 08:44 horas del 22 de abril de 2026, informa bajo juramento Rodolfo Mayorga Castillo, en su condición de jefe de la Oficina Subregional Esparza del Sistema Nacional de Áreas de Conservación del Ministerio de Ambiente y Energía, lo siguiente: \n\n“Antecedentes. 1- Que la oficina recibió queja ambiental, la queja se registró como confidencial, donde se denuncia la presunta contaminación de la contaminación de manglar con aguas residuales de una chanchera, en, en el sector de Santa Juana de Chomes, Puntarenas, específicamente 200m norte de la Escuela de Orocú, coordenadas N-1113883 Y E400042, coordenadas CRMT-05, donde se denuncia al señor Nombre02 y Nombre03. La denuncia fue ingresada mediante el oficio SINAC-ACOPAC-OSRE-RQD003-2025 y el código de SITADA 53661-2025. 2- Que para efecto de investigar los hechos denunciados y al tratarse de una contaminación por aguas residuales por activados agropecuarios, se coordinó la visita con el Ministerio de Salud del cantón de Montes de Oro, oficina que corresponde por razones jurisdiccionales, para efecto de realizar una visita en forma conjunta; la que se realizó en el día 25 de marzo del 2025. (adjunto oficio SINAC-ACOPAC-OSRE-PPC-050- 2025)\n\nObservación: 1- Que de la visita al sitio por parte de los funcionarios del área de Conservación Pacifico Central, destacados en la oficina sub regional de Esparza, Lic. Gerardo Chavarria Amador, en calidad de Jefe de la Oficina y el Técnico, Gabriela Herrera Monge, encargada del programa de Prevención, Protección y Control, genero el oficio SINACACOPAC-OSRE-PPC-050-2025; con relación a los hechos denunciados se indica: a-Que no se identificó contaminación al humedal manglar por efecto del manejo de la porqueriza, la que no está funcionando, situación que se constató en la visita. b- Las personas denunciadas además se dedican a la cría de ganado, en la visita se verifico que el ganado se encuentra en potrero, que los animales entran al corral para alimentarse y beber agua, que el manejo en el corral, es en seco.\n\n Conclusión: La denuncia recibida por queja ambiental, donde se denuncia la presunta contaminación del manglar, con aguas residuales de una chanchera, en el sector de Santa Juana de Chomes, Puntarenas, específicamente 200m norte de la Escuela de Orocú, coordenadas N-1113883 y Dirección01, coordenadas Dirección02, la queja fue atendía oportunamente, según se desprende del oficio SINAC-ACOPAC-OSRE-PPC-050-2025”. \n\n4.- Mediante escrito incorporado al expediente digital a las 12:19 horas del 22 de abril de 2026, informa bajo juramento Carolina Guillén Meléndez, en su condición de directora del Área Rectora de Salud de Montes de Oca, lo siguiente: \n\n“II. SOBRE LAS ACTUACIONES DEL AREA RECTORA DE SALUD DE MONTES DE ORO: \n\nPRIMERO: Que la señora Nombre01 presentó formal denuncia a esta Dependencia, el día 02 de septiembre del 2024, en contra de Nombre03 y Nombre02, por la tenencia de 300 cerdos que estaban ocasionando malos olores, mal manejo de aguas residuales, proliferación de moscas, aves de rapiña y mal manejo de residuos sólidos, de lo cual esta Dependencia le asignó el número de consecutivo N°24137 (Folios Denuncia 24137: 00001,00002, 00003). \n\nSEGUNDO: Que el día 06 de septiembre del 2024, esta Dependencia realizó formal inspección al sitio denunciado, en seguimiento a la denuncia N°24137, verificando que la porqueriza cuenta con CVO por parte de SENASA. Así también, se observó en el momento de la inspección que hay problemas de escurrimiento de agua residual, de lo cual indicaron los propietarios de la porqueriza, fue un punto a solventar solicitado por SENASA, por lo que ya se estaban realizando las mejoras respectivas. En el momento de la inspección no se percibieron malos olores, ni moscas y tampoco aves de rapiña. (Folio Denuncia N°24137: 00004). \n\nTERCERO: Que en seguimiento a la denuncia N°24137, y debido a que es una actividad que cuenta con CVO, se realizó formal inspección al sitio denunciado, nuevamente el día 4 de febrero del 2025, en conjunto con SENASA, de lo cual se identificaron varias deficiencias, como escurrimiento de agua residual e inadecuado manejo de residuos, presencia de moscas, aves de rapiña y malos olores, por lo que SENASA emitió ordenamiento sanitario para despoblamiento total de los cerdos a plazo máximo al mes de marzo del 2025 (Folio Denuncia N°24137: 00006). \n\nCUARTO: Que el día 25 de marzo del 2025, esta Dependencia, en conjunto con el MINAE, realizó formal inspección al sitio denunciado, de lo cual, en esta inspección, se verificó el despoblamiento total de los cerdos en la porqueriza, por lo que no se logró verificar ningún tipo de deficiencia, ya no había generación de aguas residuales ni inadecuado manejo de residuos sólidos, en ese momento ya no existía presencia de animales que pudieran generar las afectaciones. Tampoco hubo presencia de malos olores, ni moscas ni aves de rapiña. (Folio Denuncia N°24137: 00007). \n\nQUINTO: Que el día 23 de mayo del 2025, se notificó a ambos, al Director Regional de SENASA, Dr. Minor Cordero Chavarría, documento CARTA-MSDRRSPC-DARSMO-00230-2025, en donde se indicó el cierre de la denuncia al ya no verificarse las afectaciones denunciadas y se brindaron recomendaciones a seguir, para que una vez se reabra la actividad, sean consideradas (Folios Denuncia N°24137: 00009, 00010, 00011, 00012, 00013), y a la señora Nombre01 se notificó documento CARTA-MS-DRRSPCDARSMO00231-2025, indicándole el cierre de la denuncia, debido a la eliminación de las afectaciones denunciadas (Folio Denuncia N°24137-Confidencial: 00002, 00003). \n\nSEXTO: Que el día 11 de septiembre de 2025, la señora Nombre01 interpuso una nueva denuncia en contra de Nombre02, por problemas de aguas residuales, malos olores, moscas y tenencia de ganado, de lo cual esta Dependencia le asignó el número de consecutivo N°25125 (Folios Denuncia N°25125: 00001, 00002, 00003). \n\nSETIMO: Que debido a que la denuncia involucraba la tenencia de animales, se coordinó con SENASA una inspección al sitio, de lo cual, el día 26 de septiembre del 2025, en conjunto con personeros de SENASA, se realizó formal inspección a la porqueriza denunciada, no logrando verificar malos olores, ni presencia de moscas, ni generación de aguas residuales. En el momento de la inspección no hubo presencia de cerdos en el lugar y con respecto a la tenencia de ganado, SENASA por ser el ente competente en el tema, realizó sus verificaciones. Al no verificar en el momento de la inspección las afectaciones denunciadas, se da por cerrado el caso (Folios Denuncia 25125: 0004). \n\nOCTAVO: Que el día 09 de octubre del 2025, se notificó a la señora Nombre01, documento CARTA-MS-DRRSPC-DARSMO-00522-2025 en donde se le informó sobre el cierre de su denuncia (Folio Denuncia N°25125 - Confidencial: 00002, 00003). Sin embargo, ese mismo día la señora Nombre01, volvió a interponer otra denuncia a esta Dependencia, en contra del señor Nombre02, indicando escurrimiento de agua residual, malos olores por excremento de ganado, aguas estancadas y erosión del suelo. Solicitó que las inspecciones se hicieran en su vivienda para verificar las afectaciones (Folios denuncia N°25133: 00001, 00002, 00003). \n\nNOVENO: Que el día 10 de octubre del 2025, esta Unidad Organizativa realizó formal inspección a la vivienda de la señora Nombre01, tal como lo solicitó, en donde en el momento de la visita, no se percibieron malos olores, ni presencia de excrementos en su vivienda, tampoco se logró verificar escurrimiento de agua residual proveniente de la finca del señor Nombre02. Si se observó erosión en su terreno, en apariencia provocada por agua pluvial, de lo cual se le indicó que se coordinará con la Municipalidad de Puntarenas para una revisión al sitio. También se le recordó a la señora Nombre01 que las afectaciones por el ganado es competencia de SENASA (Folios Denuncia N°25133: 00004).\n\nDECIMO: Que los días 16 de octubre y 05 de noviembre del 2025, esta Dependencia realizó las coordinaciones con la Municipalidad de Puntarenas, para una inspección a la vivienda de la señora Nombre01 (Folios Denuncia N°25133: 00005, 00006). \n\nDECIMO PRIMERO: Que el día 13 de noviembre del 2025, se realizó formal inspección a la vivienda de la señora Nombre01, en coordinación con la Municipalidad de Puntarenas, en donde en el momento de la inspección no se verificó escurrimiento de agua residual, ni malos olores, ni aguas estancadas en la propiedad de la denunciante. En esta inspección y según criterio del Ingeniero de la Municipalidad de Puntarenas, la erosión aparenta ser de agua pluvial, por las evidentes zanjas formadas en el terreno de Nombre01 el cual, por el desnivel del suelo, a su terreno es donde desfogan todas las aguas pluviales de los sectores altos desde el alcantarillado pluvial público, y debido a que la propiedad de la señora Nombre01 se ubica dentro del manglar, agrava la situación de erosión de la tierra. Según informa el Ingeniero Municipal, la Municipalidad hará trabajos en el alcantarillado pluvial en la vía pública en el año 2026 y recomienda a la señora Nombre01, realizar un alcantarillado en su propiedad, para ir evitando la erosión a causa del agua pluvial que baja desde el alcantarillado pluvial público (Folios Denuncia N°25133: 00007, 00008).\n\nEs por lo anteriormente expresado señores Magistrados, que esta representación de Salud considera que no ha sido omisa en su actuar y se ha demostrado que esta autoridad administrativa le ha dado el seguimiento oportuno a las denuncias planteadas por la recurrente, como consta en el expediente administrativo que resguarda esta Área Rectora de Salud de Montes de Oro, asimismo, hace constar que en el presente año 2026 no se ha recibido ninguna otra denuncia interpuesta por la recurrente Nombre01, por lo que al momento de la recepción del presente recurso de amparo, se estima que ya se ha venido dando un seguimiento oportuno sobre las actuaciones de esta ARS en cuanto a las denuncias que aqueja la amparada, de igual manera, esta Área Rectora ha sido diligente al realizar las coordinaciones respectivas con las instancias también competentes en el tema, como lo son SENASA, MINAE y Municipalidad de Puntarenas, dando seguimiento al caso y dando por cerradas las denuncias al respecto en lo que respecta a nuestras competencias. Así las cosas, se desprende con total claridad que de manera efectiva y eficiente esta Área Rectora de Salud no ha violentado ningún derecho fundamental del amparado, y en cuanto a las actuaciones realizadas, las mismas se han venido dando en apego al principio de legalidad instituido en el artículo 11 de la Constitución Política y el artículo 11 de la Ley General de la Administración Pública y dentro del marco que por regulación técnica y legal procede”. \n\n 5.- Mediante escrito incorporado al expediente digital a las 20:45 horas del 23 de abril de 2026, informa bajo juramento Jeffrey Ramírez Castro, en su condición de director de la Unidad Técnica de Gestión Vial de la Municipalidad de Puntarenas, lo siguiente: \n\n“I. SOBRE LOS HECHOS ALEGADOS En relación con los hechos expuestos por la parte recurrente, es importante indicar que estos no reflejan de manera actualizada ni completa las actuaciones realizadas por esta Administración. La recurrente señala una serie de situaciones relacionadas con problemas de escorrentía, acumulación de aguas, malos olores, presencia de animales y falta de mantenimiento de cunetas y alcantarillado en el sector donde habita. No obstante, es necesario aclarar que esta Municipalidad ha tenido conocimiento de la situación y ha realizado gestiones dentro de sus competencias y posibilidades operativas. \n\nII. ACTUACIONES REALIZADAS POR LA MUNICIPALIDAD Al respecto, se hace constar que, a raíz de la situación de la señora Nombre01, se llevaron a cabo dos visitas de inspección en el sitio. En la primera visita se logró constatar que las cunetas existentes se encontraban obstruidas con material (tierra), lo cual impedía el adecuado flujo de aguas pluviales. En dicha ocasión, se le indicó a la recurrente que se procedería a programar la limpieza correspondiente. \n\nNo obstante, debido a limitaciones operativas y de disponibilidad de maquinaria y cronograma, dicha intervención no pudo ejecutarse de forma inmediata, sino hasta el mes de marzo, que por razones específicas de Cronograma de Mantenimiento Vial, le correspondía al distrito de Chomes en el mes de marzo, mes en el cual se logra programar el equipo necesario para la conformación y limpieza de las cunetas en el sector de Chomes y sus localidades. Específicamente en cuanto a lo señalado por la recurrente, las cunetas de su localidad ya fueron intervenidas como corresponde. En cuanto a acciones previas por parte de la Unidad de Gestión Vial de la Municipalidad de Puntarenas, es lo cierto que en el mes de noviembre de 2025, se coordinó una inspección conjunta con el Ministerio de Salud el día 13 de noviembre de 2025, con el fin de verificar las condiciones del sitio. En dicha visita se comprobó que las cunetas se encontraban libres de obstrucciones, así como el adecuado funcionamiento del sistema de aguas pluviales y la alcantarilla existente, constatándose que estos se encontraban limpios y en correcto estado. Por lo anterior, no es lo cierto afirmar que la Municipalidad no haya realizado acciones previas, sino que las mismas se han ejecutado conforme a la Planificación Institucional del Mantenimiento y Conservación de las Vías, así como también conforme a los recursos asignados a cada Distrito del cantón de Puntarenas, procurando atender la situación denunciada dentro de las posibilidades reales de la Administración Municipal. Por otro lado adicionalmente es importante mencionar que según nuestro Plan de Trabajo, en la semana entrante se realizarán obras de mantenimiento cotidiano de la superficie de rodamiento en lastre, en la vía frente a la propiedad de la señora Nombre01, es decir a toda la localidad vecina. \n\nIII. SOBRE LAS COMPETENCIAS INSTITUCIONALES Es importante señalar que algunos de los hechos denunciados por la recurrente, tales como los relacionados con la presencia de animales, malos olores, acumulación de desechos orgánicos y posibles afectaciones a la salud pública, no corresponden de manera exclusiva a la competencia de la Municipalidad, sino que involucran a otras instituciones como el Ministerio de Salud y el Servicio Nacional de Salud Animal (SENASA), cada una dentro de su ámbito legal de acción y competencias. En ese sentido, la Municipalidad ha actuado dentro del marco de sus competencias, particularmente en lo relativo a la atención de la infraestructura vial y sistemas de evacuación de aguas pluviales, no obstante coordina con las demás instituciones para efectos de que se atienda dichas denuncias. \n\nIV. CONSIDERACIONES FINALES De conformidad con lo expuesto, esta Municipalidad ha realizado acciones concretas para atender la situación denunciada, dentro de sus capacidades técnicas, operativas y presupuestarias. Asimismo, se reitera la disposición institucional de continuar coordinando y atendiendo cualquier situación que se presente, en procura de garantizar el bienestar de los habitantes del cantón”. \n\n6.- Mediante escrito incorporado al expediente digital a las 10:09 horas del 24 de abril de 2026, informa bajo juramento Randall Alexis Chavarría Matarrita, en su condición de alcalde de Puntarenas, lo siguiente: \n\nIndica la recurrente que desde que vive en la comunidad de Santa Juana Chomes de Puntarenas, y en época de lluvia baja una cantidad importante lo que provoca que la alcantarilla no de abasto, por otro lado afirma que el día 19 de junio de 2025 solicitó a la Municipalidad de Puntarenas que hicieran cunetas y se diera en mantenimiento a la alcantarilla, ya que con eso evitaría que el agua afecte su propiedad, esto sin obtener respuesta, y que al día de la interposición del recurso no se le había brindado contestación por parte de mi representada;\n\nDe lo anterior se pone en conocimiento a la Sala Constitucional que mediante oficio No. MP-UTGV-OF-0110-04-2026 de fecha 22 de abril de 2026, el Ing. Jeffrey Ramírez Castro en su condición de Director de la Unidad Técnica de Gestión Vial, indicó en lo conducente; “…I. SOBRE LOS HECHOS ALEGADOS En relación con los hechos expuestos por la parte recurrente, es importante indicar que estos no reflejan de manera actualizada ni completa las actuaciones realizadas por esta Administración. La recurrente señala una serie de situaciones relacionadas con problemas de escorrentía, acumulación de aguas, malos olores, presencia de animales y falta de mantenimiento de cunetas y alcantarillado en el sector donde habita. No obstante, es necesario aclarar que esta Municipalidad ha tenido conocimiento de la situación y ha realizado gestiones dentro de sus competencias y posibilidades operativas. II. ACTUACIONES REALIZADAS POR LA MUNICIPALIDAD Al respecto, se hace constar que, a raíz de la situación de la señora Nombre01, se llevaron a cabo dos visitas de inspección en el sitio. En la primera visita se logró constatar que las cunetas existentes se encontraban obstruidas con material (tierra), lo cual impedía el adecuado flujo de aguas pluviales. En dicha ocasión, se le indicó a la recurrente que se procedería a programar la limpieza correspondiente.\n\nNo obstante, debido a limitaciones operativas y de disponibilidad de maquinaria y cronograma, dicha intervención no pudo ejecutarse de forma inmediata, sino hasta el mes de marzo, que por razones específicas de Cronograma de Mantenimiento Vial, le correspondía al distrito de Chomes en el mes de marzo, mes en el cual se logra programar el equipo necesario para la conformación y limpieza de las cunetas en el sector de Chomes y sus localidades. Específicamente en cuanto a lo señalado por la recurrente, las cunetas de su localidad ya fueron intervenidas como corresponde. En cuanto a acciones previas por parte de la Unidad de Gestión Vial de la Municipalidad de Puntarenas, es lo cierto que en el mes de noviembre de 2025, se coordinó una inspección conjunta con el Ministerio de Salud el día 13 de noviembre de 2025, con el fin de verificar las condiciones del sitio. En dicha visita se comprobó que las cunetas se encontraban libres de obstrucciones, así como el adecuado funcionamiento del sistema de aguas pluviales y la alcantarilla existente, constatándose que estos se encontraban limpios y en correcto estado. Por lo anterior; no es lo cierto afirmar que la Municipalidad no haya realizado acciones previas, sino que las mismas se han ejecutado conforme a la Planificación Institucional del Mantenimiento y Conservación de las Vías, así como también conforme a los recursos asignados a cada Distrito del cantón de Puntarenas, procurando atender la situación denunciada dentro de las posibilidades reales de la Administración Municipal. Por otro lado adicionalmente es importante mencionar que según nuestro Plan de Trabajo, en la semana entrante se realizarán obras de mantenimiento cotidiano de la superficie de rodamiento en lastre, en la vía frente a la propiedad de la señora Nombre01, es decir a toda la localidad vecina. III. SOBRE LAS COMPETENCIAS INSTITUCIONALES Es importante señalar que algunos de los hechos denunciados por la recurrente, tales como los relacionados con la presencia de animales, malos olores, acumulación de desechos orgánicos y posibles afectaciones a la salud pública, no corresponden de manera exclusiva a la competencia de la Municipalidad, sino que involucran a otras instituciones como el Ministerio de Salud y el Servicio Nacional de Salud Animal (SENASA), cada una dentro de su ámbito legal de acción y competencias. En ese sentido, la Municipalidad ha actuado dentro del marco de sus competencias, particularmente en lo relativo a la atención de la infraestructura vial y sistemas de evacuación de aguas pluviales, no obstante coordina con las demás instituciones para efectos de que se atienda dichas denuncias. IV. CONSIDERACIONES FINALES De conformidad con lo expuesto, esta Municipalidad ha realizado acciones concretas para atender la situación denunciada, dentro de sus capacidades técnicas, operativas y presupuestarias. Asimismo, se reitera la disposición institucional de continuar coordinando y atendiendo cualquier situación que se presente, en procura de garantizar el bienestar de los habitantes del cantón…”.\n\n7.- En los procedimientos seguidos se ha observado las prescripciones legales.\n\n Redacta el Magistrado Rueda Leal; y,\n\n Considerando:\n\n I.- Objeto del recurso. La recurrente señala que desde hace varios años sufre afectaciones en su vivienda ubicada en Santa Juana de Chomes, Puntarenas, derivadas de la actividad agropecuaria desarrollada por el señor Nombre02 en una propiedad cercana, lo que ha generado malos olores, acumulación de heces de animales y escorrentías de aguas contaminadas que, en época lluviosa, ingresan a su propiedad debido a la falta de capacidad del alcantarillado. Aduce que la situación se ha agravado por la falta de mantenimiento del sistema pluvial por parte de la Municipalidad de Puntarenas, así como por la inexistencia de cunetas adecuadas, lo que provoca que las aguas contaminadas se acumulen frente a su vivienda y, en época seca, se transformen en polvo que ingresa constantemente a su hogar. Indica que, pese a múltiples gestiones realizadas ante la Municipalidad de Puntarenas, el Ministerio de Salud, el SINAC y otras instancias, no ha recibido una respuesta efectiva ni se han adoptado medidas concretas para solucionar el problema. Finalmente, sostiene que las condiciones descritas han generado afectaciones directas a su salud, incluyendo alergias, erupciones cutáneas, ansiedad, depresión e insomnio, así como un deterioro en su calidad de vida, por lo que estima vulnerados sus derechos fundamentales a la salud y a un ambiente sano.\n\nII.- Cuestión preliminar. De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la sentencia nro. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción pues se está ante una serie de denuncias interpuestas ante las autoridades recurridas por una situación de contaminación. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.\n\nIII.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la parte recurrida haya omitido referirse a ellos según lo prevenido en el auto inicial:\n\na) El 2 de septiembre de 2024, la recurrente interpuso una denuncia ante el Área Rectora de Salud de Montes de Oro contra Nombre03 y Nombre02 por la tenencia de aproximadamente 300 cerdos, malos olores, manejo inadecuado de aguas residuales, proliferación de moscas, presencia de aves de rapiña y manejo inadecuado de residuos sólidos, la cual fue registrada bajo el consecutivo nro. 24137 (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\nb) El 6 de septiembre de 2024, personal del Área Rectora de Salud de Montes de Oro inspeccionó la propiedad denunciada y constató que la porqueriza contaba con Certificado Veterinario de Operación emitido por SENASA, así como la existencia de escurrimiento de aguas residuales y la ejecución de mejoras orientadas a corregir esa situación (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\nc) El 27 de febrero de 2025, la Oficina Subregional de Esparza del Área de Conservación Pacífico Central registró una denuncia ambiental confidencial relacionada con una presunta contaminación de manglar por aguas residuales provenientes de una chanchera ubicada en Santa Juana de Chomes, Puntarenas, la cual fue tramitada mediante el oficio SINAC-ACOPAC-OSRE-RQD-003-2025 y el código SITADA 53661-2025 (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\nd) El 4 de febrero de 2025, funcionarios del Ministerio de Salud y de SENASA realizaron una inspección conjunta en la propiedad denunciada, durante la cual verificaron escurrimiento de aguas residuales, manejo inadecuado de residuos, presencia de moscas, aves de rapiña y malos olores, por lo que SENASA ordenó el despoblamiento total de los cerdos a más tardar en marzo de 2025 (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\ne) El 25 de marzo de 2025, funcionarios del Área Rectora de Salud de Montes de Oro y del Área de Conservación Pacífico Central inspeccionaron la propiedad denunciada y verificaron el despoblamiento total de la porqueriza, sin constatar generación de aguas residuales, manejo inadecuado de residuos sólidos, malos olores, presencia de moscas ni aves de rapiña (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\nf) El 25 de marzo de 2025, funcionarios de la Oficina Subregional de Esparza del Área de Conservación Pacífico Central inspeccionaron el sitio objeto de denuncia y verificaron que la porqueriza no se encontraba en funcionamiento, que no existía contaminación del humedal manglar atribuible a esa actividad y que los animales de ganado permanecían en potrero y eran manejados en seco dentro del corral destinado para alimentación y suministro de agua (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\ng) El 23 de mayo de 2025, el Área Rectora de Salud de Montes de Oro comunicó a SENASA el cierre de la denuncia sanitaria nro. 24137 y notificó a la promovente que las afectaciones denunciadas habían cesado, emitiendo recomendaciones para ser observadas en caso de reanudarse la actividad porcina (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\nh) El 11 de septiembre de 2025, la accionante interpuso una nueva denuncia ante el Área Rectora de Salud de Montes de Oro por problemas relacionados con aguas residuales, malos olores, presencia de moscas y tenencia de ganado, la cual fue registrada bajo el consecutivo nro. 25125 (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\ni) El 26 de septiembre de 2025, funcionarios del Ministerio de Salud y de SENASA realizaron una inspección conjunta en la propiedad denunciada y no verificaron malos olores, presencia de moscas, generación de aguas residuales ni existencia de cerdos en el lugar (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\nj) El 9 de octubre de 2025, el Área Rectora de Salud de Montes de Oro notificó a la tutelada el cierre de la denuncia nro. 25125 y, ese mismo día, esta interpuso una nueva denuncia por escurrimiento de aguas residuales, malos olores asociados a excremento de ganado, aguas estancadas y erosión del suelo, solicitando que las inspecciones se realizaran en su vivienda (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\nk) El 10 de octubre de 2025, personal del Área Rectora de Salud de Montes de Oro inspeccionó la vivienda de la amparada y constató erosión del terreno aparentemente provocada por aguas pluviales, sin verificar malos olores, presencia de excrementos ni escurrimiento de aguas residuales provenientes de la propiedad vecina (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\nl) Los días 16 de octubre y 5 de noviembre de 2025, el Área Rectora de Salud de Montes de Oro coordinó con la Municipalidad de Puntarenas la realización de una inspección conjunta en la vivienda de la recurrente para valorar las condiciones denunciadas (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\nm) El 13 de noviembre de 2025, funcionarios del Ministerio de Salud y de la Municipalidad de Puntarenas inspeccionaron la vivienda de la recurrente y no verificaron escurrimiento de aguas residuales, malos olores ni aguas estancadas; asimismo, constataron procesos de erosión asociados al desfogue de aguas pluviales provenientes de sectores más altos y al desnivel existente en el terreno (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\nn) En fecha indeterminada, personal de la Municipalidad de Puntarenas inspeccionó el sector donde reside la recurrente y constató que las cunetas existentes se encontraban obstruidas con material terroso que impedía el adecuado flujo de las aguas pluviales, por lo que se programaron labores de limpieza e intervención dentro de las actividades de mantenimiento vial correspondientes al distrito de Chomes (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\no) En marzo de 2026, la Municipalidad de Puntarenas ejecutó labores de conformación y limpieza de cunetas en el sector de Chomes, incluyendo las cunetas ubicadas en la localidad donde reside la recurrente, conforme al cronograma institucional de mantenimiento vial correspondiente a ese distrito (véanse los informes de las autoridades recurridas y la prueba aportada al expediente digital).\n\nIV.- Sobre las denuncias relacionadas con la actividad agropecuaria desarrollada en una propiedad vecina. La recurrente reclama que la actividad agropecuaria desarrollada en una propiedad cercana a su vivienda ha generado malos olores, presencia de moscas, acumulación de excretas, escurrimiento de aguas residuales y eventuales afectaciones al ambiente y a su salud. Sostiene que, pese a las múltiples denuncias formuladas ante distintas instituciones, estas no adoptaron medidas efectivas para atender la situación denunciada.\n\nSobre este particular, conviene recordar que esta Sala ha reconocido de forma reiterada que la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado constituyen bienes jurídicos especialmente protegidos por el ordenamiento constitucional. En esa línea, se ha señalado que corresponde al Estado adoptar las medidas necesarias para prevenir daños ambientales y resguardar las condiciones que permitan a las personas disfrutar de un estado de bienestar físico, psíquico y social, de conformidad con el principio precautorio que informa la materia ambiental (véase –entre otras– la sentencia nro. 1998-000180 de las 16:24 horas del 13 de enero de 1998). Ahora bien, esa obligación de protección no implica que toda denuncia relacionada con eventuales afectaciones ambientales o sanitarias conlleve, por sí sola, una lesión a derechos fundamentales ni que la jurisdicción constitucional pueda sustituir a las autoridades técnicas en la determinación de las medidas concretas que deban adoptarse en cada caso. Lo que sí resulta exigible es que los órganos competentes atiendan las denuncias planteadas, realicen las verificaciones que correspondan y adopten las medidas que estimen pertinentes dentro del ámbito de sus competencias. De este modo, la intervención de esta jurisdicción se justifica cuando se acredita una inercia administrativa manifiesta o una omisión comprobada en el cumplimiento de los deberes de fiscalización y protección que pesan sobre las autoridades públicas.\n\nPrecisamente bajo esa perspectiva corresponde examinar las actuaciones desplegadas por las autoridades sanitarias y ambientales recurridas frente a las denuncias formuladas por la accionante.\n\nAl analizar los elementos incorporados al expediente, se observa que la situación denunciada fue conocida por las autoridades competentes desde septiembre de 2024. En efecto, el 2 de septiembre de ese año la accionante interpuso una denuncia ante el Área Rectora de Salud de Montes de Oro por la existencia de aproximadamente 300 cerdos, malos olores, manejo inadecuado de aguas residuales, proliferación de moscas, presencia de aves de rapiña y manejo inadecuado de residuos sólidos. Tal denuncia dio lugar a una inspección efectuada el 6 de septiembre de 2024, durante la cual se constató la existencia de escurrimiento de aguas residuales y la ejecución de mejoras dirigidas a corregir esa situación.\n\nPosteriormente, el seguimiento administrativo continuó. Así, el 4 de febrero de 2025 funcionarios del Ministerio de Salud y de SENASA realizaron una nueva inspección conjunta en la propiedad denunciada. En esa oportunidad se verificó la existencia de varias deficiencias sanitarias, entre ellas escurrimiento de aguas residuales, manejo inadecuado de residuos, presencia de moscas, aves de rapiña y malos olores. Tales hallazgos motivaron la adopción de medidas correctivas concretas por parte de SENASA, entidad que ordenó el despoblamiento total de los cerdos a más tardar en marzo de 2025.\n\nAunado a ello, consta que el 25 de marzo de 2025 funcionarios del Ministerio de Salud y del Área de Conservación Pacífico Central realizaron una nueva inspección en la propiedad cuestionada. En esa ocasión se verificó el despoblamiento total de la porqueriza y no se constató generación de aguas residuales, manejo inadecuado de residuos sólidos, malos olores, presencia de moscas ni aves de rapiña. Ese mismo día, funcionarios de la Oficina Subregional de Esparza del Área de Conservación Pacífico Central inspeccionaron el sitio en atención a la denuncia ambiental relacionada con una eventual afectación al manglar y determinaron que la porqueriza no se encontraba en funcionamiento y que no existía contaminación del humedal manglar atribuible a esa actividad.\n\nA partir de esos hallazgos, el Área Rectora de Salud dispuso el cierre de la denuncia sanitaria inicialmente planteada, al estimar que las situaciones que habían motivado su intervención habían sido corregidas. Sin embargo, el expediente también demuestra que las autoridades continuaron atendiendo las nuevas inconformidades formuladas por la promovente. En ese sentido, el 11 de septiembre de 2025 se interpuso una nueva denuncia relacionada con aguas residuales, malos olores, presencia de moscas y tenencia de ganado. Dicha gestión motivó una nueva inspección conjunta efectuada el 26 de septiembre de 2025 por funcionarios del Ministerio de Salud y de SENASA, quienes no verificaron malos olores, presencia de moscas, generación de aguas residuales ni existencia de cerdos en el lugar. Posteriormente, el 9 de octubre de 2025 la accionante formuló una nueva denuncia relacionada con escurrimiento de aguas residuales, malos olores asociados al excremento de ganado, aguas estancadas y erosión del suelo. En atención a esa gestión, el 10 de octubre de 2025 personal del Área Rectora de Salud inspeccionó directamente la vivienda de la amparada. Durante esa diligencia no se verificaron malos olores, presencia de excrementos ni escurrimiento de aguas residuales provenientes de la propiedad vecina, aunque sí se observó erosión en el terreno, aspecto que posteriormente fue objeto de coordinación con la Municipalidad de Puntarenas para su valoración.\n\nEn virtud de los hechos descritos, esta Sala descarta la lesión de los derechos fundamentales, ya que las autoridades sanitarias y ambientales conocieron oportunamente las denuncias formuladas por la accionante y desplegaron diversas actuaciones dirigidas a verificar las condiciones denunciadas. Nótese que realizaron inspecciones sucesivas en la propiedad objeto de queja, coordinaron actuaciones conjuntas entre las instituciones competentes y adoptaron medidas correctivas cuando identificaron incumplimientos que así lo ameritaban. Particularmente, las inspecciones efectuadas en febrero de 2025 permitieron corroborar la existencia de deficiencias sanitarias asociadas a la actividad porcina desarrollada en el lugar. A partir de esos hallazgos, SENASA ordenó el despoblamiento total de los cerdos, medida cuya ejecución fue posteriormente verificada por las autoridades competentes. Asimismo, las inspecciones realizadas el 25 de marzo de 2025 permitieron constatar que la porqueriza ya no se encontraba en funcionamiento y que no existían aguas residuales, malos olores, moscas, aves de rapiña ni manejo inadecuado de residuos sólidos asociados a esa actividad.\n\nDe igual manera, las diligencias efectuadas por las autoridades ambientales en atención a la denuncia relacionada con una eventual afectación al humedal manglar no permitieron acreditar la existencia de contaminación atribuible a la actividad agropecuaria denunciada. Por el contrario, la inspección realizada el 25 de marzo de 2025 permitió verificar que la porqueriza no se encontraba en funcionamiento y que no se identificó contaminación del humedal manglar atribuible a la actividad agropecuaria denunciada. Tal circunstancia reviste especial importancia, pues uno de los ejes centrales del reclamo consiste precisamente en la supuesta contaminación ambiental derivada de las actividades desarrolladas en la propiedad vecina.\n\nPor otra parte, aun después del cierre de la denuncia inicial, las nuevas gestiones planteadas por la promovente continuaron siendo atendidas mediante inspecciones posteriores. Sin embargo, tales verificaciones tampoco permitieron corroborar la persistencia de las condiciones que dieron origen a las primeras denuncias. En efecto, durante las inspecciones realizadas en septiembre y octubre de 2025 no se verificaron malos olores, presencia de moscas, generación de aguas residuales ni existencia de cerdos en el lugar. Asimismo, la inspección efectuada directamente en la vivienda de la amparada no permitió constatar escurrimientos de aguas residuales provenientes de la propiedad vecina ni otras condiciones que permitieran asociar las afectaciones denunciadas con una actividad contaminante activa.\n\nEn consecuencia, de los elementos probatorios acreditados en el expediente no se desprende la existencia de una omisión por parte de las autoridades recurridas en el ejercicio de sus competencias de fiscalización y control. Por el contrario, las actuaciones acreditadas reflejan una intervención administrativa continua, caracterizada por la atención de las denuncias formuladas, la realización de inspecciones en sitio, la coordinación entre instituciones y la adopción de medidas correctivas orientadas a verificar y atender las situaciones denunciadas. En realidad, lo que se evidencia en el presente asunto es la disconformidad de la recurrente con las conclusiones alcanzadas por las autoridades sanitarias y ambientales a partir de las inspecciones y valoraciones técnicas efectuadas en el ejercicio de sus competencias. Sin embargo, tal discrepancia no resulta suficiente para acreditar una lesión a los derechos fundamentales invocados ni habilita a esta jurisdicción para sustituir el criterio técnico de los órganos competentes cuando, como ocurre en este caso, consta que la situación denunciada fue objeto de investigación, seguimiento y valoración por parte de las instituciones llamadas a intervenir. Por consiguiente, al no encontrarse acreditada una inercia administrativa ni una situación actual que evidencie una afectación atribuible a la actuación u omisión de las autoridades sanitarias y ambientales recurridas, no se advierte una lesión a los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado. Ergo, se declara sin lugar el recurso en lo atinente a este extremo del recurso. \n\nV.- En cuanto a la problemática relacionada con las aguas pluviales. La recurrente acusa que la falta de mantenimiento del sistema de aguas pluviales existente en el sector donde reside ha provocado que una cantidad considerable de agua proveniente de propiedades ubicadas en zonas más altas desemboque en las inmediaciones de su vivienda, situación que, según afirma, ha generado procesos de erosión en el terreno, afectaciones a su propiedad y otras consecuencias perjudiciales para su salud y calidad de vida. Asimismo, sostiene que la Municipalidad de Puntarenas no adoptó oportunamente las medidas necesarias para corregir esa problemática.\n\nAl analizar los elementos incorporados al expediente, esta Sala observa que la situación denunciada fue objeto de conocimiento y valoración por parte de las autoridades competentes. En efecto, durante la inspección realizada el 13 de noviembre de 2025 por funcionarios del Ministerio de Salud y de la Municipalidad de Puntarenas se constató la existencia de procesos de erosión en la propiedad de la recurrente. Asimismo, se determinó que, debido al desnivel del terreno, a dicha propiedad desfogaban aguas pluviales provenientes de sectores superiores a través del alcantarillado pluvial público, circunstancia que se veía agravada por la ubicación del inmueble dentro del manglar.\n\nAhora bien, en vista de que con anterioridad al dictado de la resolución de curso del presente proceso constitucional la autoridad municipal accionada ejecutó, en marzo de 2026, labores de conformación y limpieza de cunetas en el sector donde reside la recurrente, esta Sala estima que la situación que motivó el reclamo fue atendida antes de que la Municipalidad tuviera conocimiento formal de la presente acción constitucional. Nótese que tales obras guardan relación directa con la problemática identificada durante las inspecciones efectuadas por las autoridades competentes, las cuales permitieron determinar la existencia de procesos de erosión asociados al desfogue de aguas pluviales provenientes de sectores superiores.\n\nDe este modo, aun cuando el expediente evidencia que existía una situación relacionada con el manejo de las aguas pluviales en el sector, también demuestra que la corporación municipal adoptó medidas dirigidas a atenderla y ejecutó las labores correspondientes con anterioridad a la notificación de la resolución que dio curso al presente recurso. Por ello, al momento de examinar el fondo del asunto, la situación que la accionante reputaba lesiva de sus derechos fundamentales había sido intervenida mediante las obras ejecutadas por la corporación municipal, de manera que no se constata una afectación actual susceptible de ser tutelada por medio del recurso de amparo.\n\nEn consecuencia, procede desestimar este extremo del recurso.\n\nVI.- Nota del magistrado Salazar Alvarado. En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente incoó una denuncia ambiental que no ha sido resuelta en forma definitiva, con violación del derecho a disfrutar de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.\n\nVII.- Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en Sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI. \n\nPor tanto:\n\nSe declara sin lugar el recurso.   "body_en_text": "Document Review\n\nExp: 26-010466-0007-CO\n\nRes. Nº 2026021157\n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine-thirty in the morning on the twelfth of June, two thousand twenty-six.\n\nAmparo appeal (recurso de amparo) filed under case number 26-010466-0007-CO, brought by Nombre01, national identification number CED01, against the MUNICIPALIDAD DE PUNTARENAS, the MINISTERIO DE SALUD, the MINISTERIO DE AMBIENTE Y ENERGÍA, and the SERVICIO NACIONAL DE SALUD ANIMAL (SENASA).\n\nBackground:\n\n1.- By means of a brief filed in the digital case file (expediente digital) at 13:21 hours on March 24, 2026, the petitioner filed an amparo appeal against the Municipalidad de Puntarenas, the Ministerio de Salud, the Ministerio de Ambiente y Energía, and SENASA. The petitioner states, verbatim, as follows:\n\n1. For approximately sixteen years I have lived in the community of Santa Juana, in Chomes de Puntarenas. Throughout that entire time I never had problems with stormwater (aguas pluviales) or dust. However, about five years ago, Nombre02 arrived in the area and installed a pig farm (chanchera). From that moment on, foul odors began to affect the community.\n\n2. Over time, especially since 2023, the situation worsened. During the rainy season, an excessive amount of water began to flow down from that property, which caused the storm sewer system (alcantarillado) to overflow. This is compounded by the fact that the Municipalidad de Puntarenas does not maintain the system, which further aggravates the problem.\n\n3. The volume of water has been such that on several occasions it has entered my home. For this reason, on August 7, 2024, I went to the Municipalidad to request an inspection of my home and the storm sewer system, but no one ever came.\n\n4. The situation became even more difficult when feces from cows and pigs began to accumulate both on the street and on my property. The odor is very strong and constant. I tried to speak directly with Nombre02 to find a solution, asking him to change the drainage from the pigs and to remove the cows that are in front of my house, but he showed no willingness to help.\n\n5. In response, on September 2 and 11, 2024, I went to the Ministerio de Salud and filed complaints regarding the foul odors, the flies, and the accumulation of feces. The situation was—and continues to be—very difficult to endure, as the foul smell persists throughout the day and night.\n\n6. As the problem continued, on February 27, 2025, I filed a complaint with SINAC, because these contaminated waters affect not only me but also the mangrove, which is where they ultimately drain. Despite this, I again received no response.\n\n7. Seeing that no institution was taking action, I went to the Defensoría de los Habitantes, where they helped me submit requests for information to the relevant agencies.\n\n8. On May 6, two thousand twenty-five, Nombre02 hired machinery to construct drainage works (drenaje) directly in front of my house; the machinery hired consisted of a dump truck and a tractor, which carried out said drainage works, which in the rainy season fill up and all that water flows into the street due to the lack of a storm sewer system, and also drains into the estuary.\n\n9. On May 23, 2025, the Ministerio de Salud informed me that Nombre02 had been asked to remove the pigs. However, the cows remained in front of my house and no meaningful follow-up was given to the problem.\n\n10. The lack of roadside drainage ditches (cunetas) and the poor condition of the storm sewer system has caused contaminated water to accumulate in front of my house. In the dry season, those residues dry up and turn into dust, which enters my home directly every time a car or motorcycle passes.\n\n11. On June 19, 2025, I went back to the Municipalidad to ask for help, requesting that drainage ditches be built and that the storm sewer system be maintained, as that would prevent the water from affecting my property. Again, I received no response.\n\n12. On January 28 of this year I had to go to the Chomes health clinic due to severe allergies and skin rashes. I explained that this is related to the dust contaminated with feces that constantly enters my home, but no concrete action was taken.\n\n13. On February 25, I went back to the Municipalidad because Nombre02 had pigs again and the cows remain in front of my house. The dust is constant. It causes me itching, burning skin, and does not let me sleep. Even inside my home, the furniture fills up with a very fine dust.\n\n14. This entire situation has profoundly affected me. Not only has my physical health deteriorated, but also my emotional well-being. I live with anxiety, depression, and insomnia, because my home—which should be a safe place—has become a space where every day I am exposed to filth, foul odors, and health impacts. All of this occurs because the institutions, especially the Municipalidad de Puntarenas and the Ministerio de Salud, have not acted effectively to protect my rights.\n\n(…)\n\nPETITION\n\nFor the foregoing reasons, I respectfully ask the Sala Constitucional de la Corte Suprema de Justicia:\n\n1. That the present amparo appeal be granted.\n\n2. That the Municipalidad de Puntarenas be ordered to construct and install drainage ditches, storm sewers, or other necessary drainage works, so as to prevent the waters originating from the respondent's property from continuing to affect the public road (vía pública) and the petitioner's property.\n\n3. That the respondent authorities, within the scope of their respective competencies, be ordered to adopt immediate, effective, and ongoing follow-up measures to prevent the contamination generated by the described activity.\n\n4. That Nombre02 be ordered to cease the polluting activity or to bring it into compliance with the required sanitary and environmental conditions, so that it does not affect third parties.\n\n5. That the violation of the fundamental rights to health and to a healthy and ecologically balanced environment be declared.\n\n2.- By resolution of 17:56 hours on April 16, 2026, the President of the Sala admitted this constitutional proceeding and requested reports from the mayor, the head of the Technical Road Management Unit (Unidad Técnica de Gestión Vial), both of the Municipalidad de Puntarenas, the director of the Área Rectora de Salud de Montes de Oro, the head of the Esparza Sub-Regional Office of the Pacific Central Conservation Area, and the Pacific Central Regional Director of SENASA, regarding the facts alleged by the petitioner.\n\n3.- By means of a brief filed in the digital case file at 08:44 hours on April 22, 2026, Rodolfo Mayorga Castillo, in his capacity as head of the Esparza Sub-Regional Office of the Sistema Nacional de Áreas de Conservación of the Ministerio de Ambiente y Energía, reports under oath as follows:\n\n\"Background. 1- The office received an environmental complaint, registered as confidential, alleging the presumed contamination of a mangrove wetland (humedal manglar) with wastewater (aguas residuales) from a pig farm, in the sector of Santa Juana de Chomes, Puntarenas, specifically 200 meters north of the Escuela de Orocú, coordinates N-1113883 and E400042, CRMT-05 coordinate system, naming Nombre02 and Nombre03. The complaint was entered under document SINAC-ACOPAC-OSRE-RQD003-2025 and SITADA code 53661-2025. 2- In order to investigate the reported facts, and given that contamination from wastewater originating from agricultural activities was involved, the visit was coordinated with the Ministerio de Salud of the canton of Montes de Oro, the jurisdictionally competent office, in order to conduct a joint site inspection, which took place on March 25, 2025. (Attached: document SINAC-ACOPAC-OSRE-PPC-050-2025)\n\nFindings: 1- The site visit conducted by staff of the Pacific Central Conservation Area assigned to the Esparza Sub-Regional Office—Lic. Gerardo Chavarría Amador, as Office Chief, and technician Gabriela Herrera Monge, in charge of the Prevention, Protection, and Control program—generated document SINAC-ACOPAC-OSRE-PPC-050-2025; with respect to the reported facts, the following is noted: a- No contamination of the mangrove wetland was identified as a result of management of the pigsty (porqueriza), which was not in operation, as confirmed during the visit. b- The persons named in the complaint are also engaged in cattle ranching; during the visit it was verified that the cattle are kept in a pasture (potrero), that the animals enter the corral to eat and drink water, and that corral management is conducted using dry methods.\n\nConclusion: The complaint received as an environmental complaint, alleging the presumed contamination of the mangrove with wastewater from a pig farm, in the sector of Santa Juana de Chomes, Puntarenas, specifically 200 meters north of the Escuela de Orocú, coordinates N-1113883 and Dirección01, Dirección02 coordinates, was handled in a timely manner, as evidenced by document SINAC-ACOPAC-OSRE-PPC-050-2025.\"\n\n4.- By means of a brief filed in the digital case file at 12:19 hours on April 22, 2026, Carolina Guillén Meléndez, in her capacity as director of the Área Rectora de Salud de Montes de Oca, reports under oath as follows:\n\n\"II. ON THE ACTIONS OF THE ÁREA RECTORA DE SALUD DE MONTES DE ORO:\n\nFIRST: Nombre01 filed a formal complaint with this Office on September 2, 2024, against Nombre03 and Nombre02, regarding the keeping of 300 pigs that were causing foul odors, improper management of wastewater, proliferation of flies, birds of prey, and improper management of solid waste, for which this Office assigned consecutive number N°24137 (Complaint File 24137: 00001, 00002, 00003).\n\nSECOND: On September 6, 2024, this Office conducted a formal inspection of the reported site in follow-up to complaint N°24137, verifying that the pigsty holds a Veterinary Operating Certificate (CVO) issued by SENASA. It was also observed at the time of the inspection that there are wastewater runoff problems, which the owners of the pigsty indicated was an issue flagged by SENASA for resolution, and that the respective improvements were already under way. At the time of the inspection, no foul odors, flies, or birds of prey were perceived. (Complaint File N°24137: 00004).\n\nTHIRD: In follow-up to complaint N°24137, and because it is an activity holding a CVO, a formal inspection was again conducted at the reported site on February 4, 2025, jointly with SENASA, during which several deficiencies were identified, such as wastewater runoff, improper waste management, presence of flies, birds of prey, and foul odors; SENASA therefore issued a sanitary order (ordenamiento sanitario) for the total depopulation of the pigs by a maximum deadline of March 2025 (Complaint File N°24137: 00006).\n\nFOURTH: On March 25, 2025, this Office, jointly with MINAE, conducted a formal inspection of the reported site, during which the total depopulation of the pigs from the pigsty was verified, so that no deficiencies of any kind could be confirmed; there was no longer any generation of wastewater or improper management of solid waste, and at that point there were no animals present that could produce the reported impacts. There was also no presence of foul odors, flies, or birds of prey. (Complaint File N°24137: 00007).\n\nFIFTH: On May 23, 2025, both the Regional Director of SENASA, Dr. Minor Cordero Chavarría, and document CARTA-MSDRRSPC-DARSMO-00230-2025 were notified, indicating the closure of the complaint given that the reported impacts could no longer be verified, and recommendations were provided for consideration once the activity is reopened (Complaint Files N°24137: 00009, 00010, 00011, 00012, 00013); and Nombre01 was notified by document CARTA-MS-DRRSPCDARSMO00231-2025, advising her of the closure of the complaint due to the elimination of the reported impacts (Complaint File N°24137-Confidential: 00002, 00003).\n\nSIXTH: On September 11, 2025, Nombre01 filed a new complaint against Nombre02, regarding problems of wastewater, foul odors, flies, and keeping of livestock, for which this Office assigned consecutive number N°25125 (Complaint Files N°25125: 00001, 00002, 00003).\n\nSEVENTH: Because the complaint involved the keeping of animals, a site inspection was coordinated with SENASA; on September 26, 2025, jointly with SENASA officials, a formal inspection was conducted at the reported pigsty, and no foul odors, presence of flies, or generation of wastewater could be verified. At the time of the inspection there were no pigs on the premises, and with respect to the keeping of livestock, SENASA, as the competent authority on the matter, conducted its own verification. As the reported impacts could not be verified at the time of the inspection, the case was closed (Complaint Files 25125: 0004).\n\nEIGHTH: On October 9, 2025, Nombre01 was notified by document CARTA-MS-DRRSPC-DARSMO-00522-2025, informing her of the closure of her complaint (Complaint File N°25125 - Confidential: 00002, 00003). However, on that same day, Nombre01 filed yet another complaint with this Office against Nombre02, alleging wastewater runoff, foul odors from livestock excrement, stagnant water, and soil erosion. She requested that the inspections be conducted at her home in order to verify the reported impacts (Complaint Files N°25133: 00001, 00002, 00003).\n\nNINTH: On October 10, 2025, this Organizational Unit conducted a formal inspection of Nombre01's home, as she had requested, and at the time of the visit no foul odors or presence of excrement were perceived at her home, nor was any wastewater runoff coming from Nombre02's property verified. Erosion was observed on her land, apparently caused by rainwater, and she was informed that coordination would be made with the Municipalidad de Puntarenas for a review of the site. Nombre01 was also reminded that impacts caused by livestock fall within the jurisdiction of SENASA (Complaint Files N°25133: 00004).\n\nTENTH: On October 16 and November 5, 2025, this Office carried out coordination with the Municipalidad de Puntarenas for an inspection of Nombre01's home (Complaint Files N°25133: 00005, 00006).\n\nELEVENTH: On November 13, 2025, a formal inspection of Nombre01's home was conducted in coordination with the Municipalidad de Puntarenas, during which no wastewater runoff, foul odors, or stagnant water was verified on the complainant's property. During this inspection and according to the assessment of the Municipalidad de Puntarenas engineer, the erosion appears to be caused by rainwater, as evidenced by the obvious gullies formed on Nombre01's land which, due to the slope of the terrain, receives all the stormwater flowing from the higher-lying areas through the public stormwater drainage system; and since Nombre01's property is located within the mangrove area, this further aggravates the soil erosion. According to the Municipal Engineer's report, the Municipalidad will carry out works on the public stormwater drainage system in 2026 and recommends that Nombre01 install drainage infrastructure on her property in order to progressively mitigate the erosion caused by the stormwater flowing down from the public stormwater drainage system (Complaint Files N°25133: 00007, 00008).\n\nFor the foregoing reasons, Your Honors, this Health representation considers that it has not been remiss in its actions and has demonstrated that this administrative authority has provided timely follow-up to the complaints filed by the petitioner, as documented in the administrative file held by this Área Rectora de Salud de Montes de Oro. It is likewise noted that in the current year 2026 no further complaint has been received from petitioner Nombre01, so that at the time of receipt of the present amparo appeal it is considered that timely follow-up has already been provided regarding the actions of this ARS with respect to the complaints raised by the protected party; likewise, this Área Rectora has been diligent in carrying out the respective coordination with the other agencies also competent in this matter, such as SENASA, MINAE, and the Municipalidad de Puntarenas, providing follow-up to the case and closing the respective complaints insofar as our competencies are concerned. Based on the foregoing, it is entirely clear that this Área Rectora de Salud has effectively and efficiently not violated any fundamental right of the protected party, and that the actions taken have been carried out in adherence to the principle of legality established in Article 11 of the Constitución Política and Article 11 of the Ley General de la Administración Pública and within the framework prescribed by applicable technical and legal regulation.\"\n\n5.- By means of a brief filed in the digital case file at 20:45 hours on April 23, 2026, Jeffrey Ramírez Castro, in his capacity as director of the Technical Road Management Unit of the Municipalidad de Puntarenas, reports under oath as follows:\n\n\"I. ON THE ALLEGED FACTS In relation to the facts set forth by the petitioner, it is important to note that these do not accurately or fully reflect the actions taken by this Administration. The petitioner describes a series of situations related to runoff (escorrentía) problems, water accumulation, foul odors, presence of animals, and lack of maintenance of drainage ditches and the storm sewer system in the sector where she lives. However, it must be clarified that this Municipalidad has been aware of the situation and has taken steps within its competencies and operational capacity.\n\nII. ACTIONS TAKEN BY THE MUNICIPALIDAD In this regard, it is noted that, as a result of Nombre01's situation, two site inspection visits were conducted. During the first visit it was found that the existing drainage ditches were blocked with material (soil), which prevented the adequate flow of stormwater. On that occasion, the petitioner was informed that the corresponding cleaning would be scheduled.\n\nHowever, due to operational limitations and availability of machinery and scheduling, this intervention could not be carried out immediately, but rather was deferred to the month of March, which, for reasons specific to the Road Maintenance Schedule, was the month assigned to the Chomes district—the month in which the necessary equipment could be scheduled for the shaping and cleaning of the drainage ditches in the Chomes sector and its localities. Specifically with respect to what the petitioner has indicated, the drainage ditches in her locality have already been attended to as required. As for prior actions by the Road Management Unit of the Municipalidad de Puntarenas, it is indeed the case that in November 2025, a joint inspection was coordinated with the Ministerio de Salud on November 13, 2025, in order to verify the site conditions. During that visit it was confirmed that the drainage ditches were free of obstructions, and that the stormwater drainage system and the existing storm drain were functioning properly, having been found clean and in correct condition. For the foregoing reasons, it is not accurate to state that the Municipalidad has taken no prior action; rather, such actions have been carried out in accordance with the Institutional Plan for Road Maintenance and Conservation, as well as in accordance with the resources allocated to each district within the canton of Puntarenas, with the aim of addressing the reported situation within the real operational capacity of the Municipal Administration. Furthermore, it is important to mention that according to our Work Plan, in the coming week routine maintenance works on the gravel road surface will be carried out on the road in front of Nombre01's property, that is to say, throughout the neighboring locality.\n\nIII. ON INSTITUTIONAL COMPETENCIES It is important to note that some of the facts reported by the petitioner—such as those related to the presence of animals, foul odors, accumulation of organic waste, and possible public health impacts—do not fall exclusively within the competence of the Municipalidad, but rather involve other institutions such as the Ministerio de Salud and the Servicio Nacional de Salud Animal (SENASA), each within their own legal framework and area of competence. In that regard, the Municipalidad has acted within the scope of its competencies, particularly with respect to road infrastructure and stormwater drainage systems, and nonetheless coordinates with other institutions to ensure that such complaints are addressed.\n\nIV. FINAL CONSIDERATIONS In accordance with the foregoing, this Municipalidad has taken concrete actions to address the reported situation, within its technical, operational, and budgetary capacities. It likewise reaffirms its institutional commitment to continue coordinating and addressing any situation that may arise, in pursuit of ensuring the well-being of the canton's residents.\"\n\n6.- By means of a brief filed in the digital case file at 10:09 hours on April 24, 2026, Randall Alexis Chavarría Matarrita, in his capacity as mayor of Puntarenas, reports under oath as follows:\n\nThe petitioner states that since she has lived in the community of Santa Juana de Chomes, Puntarenas, during the rainy season a significant volume of water flows down, which causes the storm sewer system to overflow; she further states that on June 19, 2025, she asked the Municipalidad de Puntarenas to build drainage ditches and maintain the storm sewer system, as this would prevent the water from affecting her property, without receiving any response, and that as of the date the appeal was filed, no reply had been provided by the institution I represent;\n\nIn this regard, the Sala Constitucional is hereby informed that through document No. MP-UTGV-OF-0110-04-2026 dated April 22, 2026, Engineer Jeffrey Ramírez Castro, in his capacity as Director of the Technical Road Management Unit, stated, in the relevant part: \"…I. ON THE ALLEGED FACTS In relation to the facts set forth by the petitioner, it is important to note that these do not accurately or fully reflect the actions taken by this Administration. The petitioner describes a series of situations related to runoff problems, water accumulation, foul odors, presence of animals, and lack of maintenance of drainage ditches and the storm sewer system in the sector where she lives. However, it must be clarified that this Municipalidad has been aware of the situation and has taken steps within its competencies and operational capacity. II. ACTIONS TAKEN BY THE MUNICIPALIDAD In this regard, it is noted that, as a result of Nombre01's situation, two site inspection visits were conducted. For the foregoing reasons, it is not accurate to state that the Municipalidad has taken no prior action; rather, such actions have been carried out in accordance with the Institutional Plan for Road Maintenance and Conservation, as well as in accordance with the resources allocated to each district within the canton of Puntarenas, with the aim of addressing the reported situation within the real operational capacity of the Municipal Administration. Furthermore, it is important to mention that according to our Work Plan, in the coming week routine maintenance works on the gravel road surface will be carried out on the road in front of Nombre01's property, that is to say, throughout the neighboring locality. III. ON INSTITUTIONAL COMPETENCIES It is important to note that some of the facts reported by the petitioner—such as those related to the presence of animals, foul odors, accumulation of organic waste, and possible public health impacts—do not fall exclusively within the competence of the Municipalidad, but rather involve other institutions such as the Ministerio de Salud and the Servicio Nacional de Salud Animal (SENASA), each within their own legal framework and area of competence. In that regard, the Municipalidad has acted within the scope of its competencies, particularly with respect to road infrastructure and stormwater drainage systems, and nonetheless coordinates with other institutions to ensure that such complaints are addressed. IV. FINAL CONSIDERATIONS In accordance with the foregoing, this Municipalidad has taken concrete actions to address the reported situation, within its technical, operational, and budgetary capacities. It likewise reaffirms its institutional commitment to continue coordinating and addressing any situation that may arise, in pursuit of ensuring the well-being of the canton's residents…\".\n\n7.- The required legal procedures have been observed throughout the proceedings.\n\nDrafted by Justice Rueda Leal; and,\n\nConsidering:\n\nI.- Object of the appeal. The petitioner states that for several years she has suffered impacts at her home located in Santa Juana de Chomes, Puntarenas, resulting from the agricultural activity conducted by Nombre02 on a nearby property, which has generated foul odors, accumulation of animal feces, and runoff of contaminated water that, during the rainy season, enters her property due to the insufficient capacity of the storm sewer system. She argues that the situation has been aggravated by the lack of maintenance of the stormwater drainage system by the Municipalidad de Puntarenas, as well as by the absence of adequate drainage ditches, which causes contaminated water to accumulate in front of her home and, during the dry season, to turn into dust that constantly enters her house. She states that, despite numerous steps taken before the Municipalidad de Puntarenas, the Ministerio de Salud, SINAC, and other agencies, she has not received an effective response nor have concrete measures been adopted to resolve the problem. Finally, she maintains that the conditions described have caused direct impacts to her health, including allergies, skin rashes, anxiety, depression, and insomnia, as well as a deterioration in her quality of life, and therefore considers her fundamental rights to health and to a healthy environment to have been violated.\n\nII.- Preliminary matter. Before analyzing the merits of the case—with respect to the alleged violation of the right to prompt and effective proceedings—it must be clarified that, beginning with judgment No. 2008-02545 of 8:55 hours on February 22, 2008, this Chamber has, with some exceptions, referred to the administrative contentious jurisdiction (jurisdicción contencioso administrativa) those matters in which it is disputed whether the public administration has or has not complied with the deadlines established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific statutes governing special administrative procedures, for the issuance of a final act in a proceeding—initiated ex officio or at a party's request—or for the resolution of applicable administrative appeals. In this case, precisely, an exception applies, as what is at issue is a series of complaints filed before the respondent authorities concerning a contamination situation. With that point clarified, the Chamber proceeds to resolve the specific situation raised in this amparo appeal.\n\nIII.- Proven facts. Of relevance to the resolution of this matter, the following facts are deemed to have been duly established, either because they have been substantiated as such or because the respondent party has failed to address them as required by the initial order:\n\na) On September 2, 2024, the petitioner filed a complaint before the Health Governing Area (Área Rectora de Salud) of Montes de Oro against Nombre03 and Nombre02 concerning the keeping of approximately 300 pigs, foul odors, improper management of wastewater (aguas residuales), proliferation of flies, presence of birds of prey (aves de rapiña), and improper management of solid waste (residuos sólidos); the complaint was registered under case No. 24137 (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\nb) On September 6, 2024, staff from the Health Governing Area of Montes de Oro inspected the reported property and found that the piggery (porqueriza) held a Veterinary Operating Certificate (Certificado Veterinario de Operación) issued by SENASA, and also confirmed the existence of wastewater runoff and the implementation of improvements aimed at correcting that situation (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\nc) On February 27, 2025, the Esparza Sub-regional Office of the Área de Conservación Pacífico Central registered a confidential environmental complaint relating to alleged contamination of a mangrove (manglar) by wastewater from a pig farm (chanchera) located in Santa Juana de Chomes, Puntarenas, which was processed under official communication SINAC-ACOPAC-OSRE-RQD-003-2025 and SITADA code 53661-2025 (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\nd) On February 4, 2025, officials from the Ministry of Health and SENASA conducted a joint inspection at the reported property, during which they verified wastewater runoff, improper waste management, the presence of flies, birds of prey, and foul odors; as a result, SENASA ordered the complete depopulation (despoblamiento) of all pigs no later than March 2025 (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\ne) On March 25, 2025, officials from the Health Governing Area of Montes de Oro and from the Área de Conservación Pacífico Central inspected the reported property and verified the complete depopulation of the piggery, finding no wastewater generation, improper solid waste management, foul odors, presence of flies, or birds of prey (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\nf) On March 25, 2025, officials from the Esparza Sub-regional Office of the Área de Conservación Pacífico Central inspected the site subject to the complaint and verified that the piggery was not in operation, that there was no contamination of the mangrove wetland (humedal manglar) attributable to that activity, and that the livestock remained in the pasture and were managed on dry ground inside the enclosure used for feeding and watering (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\ng) On May 23, 2025, the Health Governing Area of Montes de Oro notified SENASA of the closure of sanitary complaint No. 24137 and informed the petitioner that the conditions complained of had ceased, issuing recommendations to be observed in the event that pig-farming activity resumed (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\nh) On September 11, 2025, the petitioner filed a new complaint before the Health Governing Area of Montes de Oro regarding problems related to wastewater, foul odors, the presence of flies, and the keeping of livestock, which was registered under case No. 25125 (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\ni) On September 26, 2025, officials from the Ministry of Health and SENASA conducted a joint inspection at the reported property and found no foul odors, flies, wastewater generation, or pigs on the premises (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\nj) On October 9, 2025, the Health Governing Area of Montes de Oro notified the petitioner of the closure of complaint No. 25125, and that same day she filed a new complaint regarding wastewater runoff, foul odors associated with livestock excrement, stagnant water, and soil erosion, requesting that inspections be carried out at her residence (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\nk) On October 10, 2025, staff from the Health Governing Area of Montes de Oro inspected the petitioner's home and found erosion of the terrain apparently caused by rainwater, without verifying foul odors, the presence of excrement, or wastewater runoff originating from the neighboring property (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\nl) On October 16 and November 5, 2025, the Health Governing Area of Montes de Oro coordinated with the Municipality of Puntarenas to conduct a joint inspection at the petitioner's home in order to assess the reported conditions (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\nm) On November 13, 2025, officials from the Ministry of Health and the Municipality of Puntarenas inspected the petitioner's home and found no wastewater runoff, foul odors, or stagnant water; they also identified erosion processes associated with the discharge of stormwater (aguas pluviales) from higher-lying areas and with the grade differential of the terrain (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\nn) On an undetermined date, staff from the Municipality of Puntarenas inspected the area where the petitioner resides and found that the existing drainage ditches (cunetas) were blocked by earthen material that prevented the adequate flow of stormwater; cleaning and remediation work was therefore scheduled as part of the road-maintenance activities for the district of Chomes (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\no) In March 2026, the Municipality of Puntarenas carried out grading and cleaning work on the drainage ditches in the Chomes area, including those located in the locality where the petitioner resides, in accordance with the institutional road-maintenance schedule for that district (see the reports of the respondent authorities and the evidence submitted to the digital case file).\n\nIV.- Regarding the complaints related to the agricultural and livestock activity conducted on a neighboring property. The petitioner claims that the agricultural and livestock activity conducted on a property near her home has generated foul odors, the presence of flies, accumulation of excrement, wastewater runoff, and potential harm to the environment and to her health. She maintains that, despite the multiple complaints filed with various institutions, those institutions failed to adopt effective measures to address the reported situation.\n\nOn this point, it is appropriate to recall that this Court has consistently recognized that public health and the right to a healthy and ecologically balanced environment constitute legally protected interests (bienes jurídicos) that enjoy special protection under the constitutional order. Along these lines, it has been held that the State is obliged to adopt the measures necessary to prevent environmental harm and to safeguard the conditions that enable individuals to enjoy a state of physical, mental, and social well-being, in accordance with the precautionary principle (principio precautorio) that governs environmental matters (see, among others, judgment No. 1998-000180 of 16:24 hours on January 13, 1998). However, that obligation of protection does not mean that every complaint related to potential environmental or sanitary harm is, in and of itself, a violation of fundamental rights, nor does it mean that constitutional jurisdiction can substitute for the technical authorities in determining the specific measures to be adopted in each case. What is required is that the competent bodies address the complaints filed, carry out the appropriate verifications, and adopt the measures they deem pertinent within the scope of their competencies. Accordingly, the intervention of this jurisdiction is justified when a manifest administrative inaction (inercia administrativa) or a proven omission in the fulfillment of the oversight and protection duties incumbent upon public authorities is established.\n\nIt is precisely from that perspective that the actions taken by the respondent sanitary and environmental authorities in response to the petitioner's complaints must be examined.\n\nUpon analyzing the elements incorporated into the case file, it is clear that the reported situation came to the attention of the competent authorities as early as September 2024. Indeed, on September 2 of that year the petitioner filed a complaint before the Health Governing Area of Montes de Oro regarding the existence of approximately 300 pigs, foul odors, improper wastewater management, proliferation of flies, presence of birds of prey, and improper solid waste management. That complaint gave rise to an inspection conducted on September 6, 2024, during which wastewater runoff was confirmed and improvements aimed at correcting that situation were noted.\n\nAdministrative follow-up continued thereafter. On February 4, 2025, officials from the Ministry of Health and SENASA conducted a new joint inspection at the reported property. On that occasion, several sanitary deficiencies were verified, including wastewater runoff, improper waste management, the presence of flies, birds of prey, and foul odors. Those findings prompted the adoption of concrete corrective measures by SENASA, which ordered the complete depopulation of all pigs no later than March 2025.\n\nIn addition, on March 25, 2025, officials from the Ministry of Health and the Área de Conservación Pacífico Central conducted a new inspection at the property in question. On that occasion, the complete depopulation of the piggery was verified, and no wastewater generation, improper solid waste management, foul odors, presence of flies, or birds of prey were found. That same day, officials from the Esparza Sub-regional Office of the Área de Conservación Pacífico Central inspected the site in response to the environmental complaint concerning a possible impact on the mangrove and determined that the piggery was not in operation and that there was no contamination of the mangrove wetland attributable to that activity.\n\nBased on those findings, the Health Governing Area ordered the closure of the initially filed sanitary complaint, having determined that the situations that had prompted its intervention had been corrected. However, the case file also demonstrates that the authorities continued to address the new complaints filed by the petitioner. In that regard, on September 11, 2025, a new complaint was filed concerning wastewater, foul odors, the presence of flies, and the keeping of livestock. That complaint prompted a new joint inspection conducted on September 26, 2025, by officials from the Ministry of Health and SENASA, who found no foul odors, flies, wastewater generation, or pigs on the premises. Subsequently, on October 9, 2025, the petitioner filed a new complaint regarding wastewater runoff, foul odors associated with livestock excrement, stagnant water, and soil erosion. In response to that complaint, on October 10, 2025, staff from the Health Governing Area inspected the petitioner's home directly. During that inspection, no foul odors, excrement, or wastewater runoff originating from the neighboring property were verified, although erosion of the terrain was observed, a matter that was subsequently coordinated with the Municipality of Puntarenas for assessment.\n\nIn light of the foregoing facts, this Court finds no violation of fundamental rights, since the sanitary and environmental authorities promptly took cognizance of the complaints filed by the petitioner and carried out various actions aimed at verifying the reported conditions. It is worth noting that successive inspections were conducted at the property subject to the complaint, joint actions were coordinated among the competent institutions, and corrective measures were adopted whenever violations warranting such measures were identified. In particular, the inspections carried out in February 2025 confirmed the existence of sanitary deficiencies associated with the pig-farming activity at the location. Based on those findings, SENASA ordered the complete depopulation of all pigs, a measure whose implementation was subsequently verified by the competent authorities. Likewise, the inspections conducted on March 25, 2025, confirmed that the piggery was no longer in operation and that there was no wastewater, foul odors, flies, birds of prey, or improper solid waste management associated with that activity.\n\nSimilarly, the proceedings carried out by the environmental authorities in response to the complaint relating to a possible impact on the mangrove wetland did not establish the existence of contamination attributable to the reported agricultural and livestock activity. On the contrary, the inspection conducted on March 25, 2025, confirmed that the piggery was not in operation and that no contamination of the mangrove wetland attributable to the reported agricultural and livestock activity was identified. This circumstance is of particular importance, since one of the central elements of the claim is precisely the alleged environmental contamination stemming from the activities conducted on the neighboring property.\n\nFurthermore, even after the closure of the initial complaint, the new petitions filed by the petitioner continued to be addressed through subsequent inspections. However, those verifications likewise did not confirm the persistence of the conditions that gave rise to the first complaints. Indeed, during the inspections conducted in September and October of 2025, no foul odors, flies, wastewater generation, or pigs were found at the location. Likewise, the inspection conducted directly at the petitioner's home did not reveal wastewater runoff originating from the neighboring property or other conditions that would link the reported harm to an active source of contamination.\n\nConsequently, the evidentiary record does not establish any omission on the part of the respondent authorities in the exercise of their oversight and control competencies. On the contrary, the established actions reflect a continuous administrative response, characterized by the handling of the complaints filed, the conduct of on-site inspections, inter-institutional coordination, and the adoption of corrective measures aimed at verifying and addressing the reported situations. What this case actually reveals is the petitioner's disagreement with the conclusions reached by the sanitary and environmental authorities on the basis of the inspections and technical assessments conducted in the exercise of their competencies. However, such disagreement is not sufficient to establish a violation of the invoked fundamental rights, nor does it authorize this jurisdiction to substitute its judgment for that of the competent technical bodies when, as in this case, the record shows that the reported situation was investigated, monitored, and assessed by the institutions called upon to intervene. Therefore, since neither administrative inaction nor a current situation demonstrating harm attributable to the conduct or omission of the respondent sanitary and environmental authorities has been established, no violation of the fundamental rights to health and to a healthy and ecologically balanced environment is found. Accordingly, the petition is dismissed with respect to this aspect of the claim.\n\nV.- Regarding the problem related to stormwater. The petitioner alleges that the lack of maintenance of the stormwater drainage system in the area where she resides has caused a considerable volume of water from properties located in higher-lying areas to flow toward the vicinity of her home, a situation that, she contends, has caused soil erosion, damage to her property, and other harmful consequences for her health and quality of life. She also maintains that the Municipality of Puntarenas did not timely adopt the measures necessary to correct that problem.\n\nUpon analyzing the elements incorporated into the case file, this Court observes that the reported situation was examined and assessed by the competent authorities. Indeed, during the inspection conducted on November 13, 2025, by officials from the Ministry of Health and the Municipality of Puntarenas, erosion processes were found on the petitioner's property. It was also determined that, due to the grade differential of the terrain, stormwater from higher-lying areas drained onto the petitioner's property through the public stormwater drainage system (alcantarillado pluvial), a situation made worse by the location of the property within the mangrove.\n\nHowever, given that prior to the issuance of the order giving course to the present constitutional proceeding, the respondent municipal authority carried out, in March 2026, grading and cleaning work on the drainage ditches in the area where the petitioner resides, this Court considers that the situation giving rise to the claim was addressed before the Municipality had formal notice of the present constitutional action. It is worth noting that such works are directly related to the problem identified during the inspections carried out by the competent authorities, which determined the existence of erosion processes associated with the discharge of stormwater from higher-lying areas.\n\nThus, even though the case file shows that a situation related to stormwater management in the area did exist, it also demonstrates that the municipal corporation adopted measures to address it and carried out the corresponding work prior to notification of the order giving course to the present petition. Therefore, at the time of examining the merits of the matter, the situation that the petitioner considered to be a violation of her fundamental rights had already been addressed through the works carried out by the municipal corporation, such that no current harm susceptible of protection through the amparo petition (recurso de amparo) is established.\n\nAccordingly, this aspect of the petition must be dismissed.\n\nVI.- Note by Justice Salazar Alvarado. In environmental matters, it is also the view of the undersigned that where the Public Administration has already intervened, knowledge of and resolution of the matter falls within the contentious-administrative jurisdiction (jurisdicción contenciosa administrativa). However, I do consider the merits of the matter when other rights of persons affected by the source of contamination are also at stake, including the right to health, quality of life, and the right to enjoy a healthy and pollution-free environment (article 50 of the Political Constitution), as is the case here, in which the petitioning party filed an environmental complaint that has not been definitively resolved, in violation of the right to enjoy a healthy and ecologically balanced environment and a dignified quality of life.\n\nVII.- Documentation submitted to the case file. The parties are hereby advised that any documents submitted in paper form, as well as any objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, must be retrieved from the court offices within a maximum period of thirty business days counted from notification of this judgment.
