Nº 2026023579\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veintiseis de junio de dos mil veintiseis .\n\n \n\nRecurso de amparo que se tramita en expediente número 26-013846-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra la ASOCIACIÓN DE DESARROLLO INTEGRAL DE LA RESERVA INDÍGENA CABÉCAR NAIRI AWARI, PACUARITO (ADITINA).\n\nResultando:\n\n1.- Por escrito recibido en la Sala el 21 de abril de 2026, la recurrente interpone recurso de amparo contra la Asociación de Desarrollo Integral de la Reserva Indígena Cabécar Nairi Awari, Pacuarito (ADITINA). Menciona que su familia y ella son copropietarios de inmuebles ubicados en Las Brisas, Pacuarito, Siquirres, Limón. Indica que desde hace más de 30 años utilizan de forma continua una fuente de agua (naciente), situada en una finca actualmente perteneciente a la Asociación de Desarrollo Integral Indígena Cabécar Nairi Awari (ADITINA), destinada al consumo humano y subsistencia. Señala que dicho uso ha sido pacífico, continuo e ininterrumpido durante décadas, constituyendo la única fuente sostenible de abastecimiento de agua, la cual además abastece a otros núcleos familiares de la zona. Refiere que el 19 de enero de 2026 la ADITINA emitió un el oficio JD- ADITINA-01-2026, en el que condiciona el acceso al servicio de agua a la colaboración en trabajos determinados. Expone que el 2 de febrero de 2026 su familia respondió formalmente, señalando el uso histórico del recurso y solicitando que el acceso al agua no se someta a condicionamientos, así como la apertura de diálogo; sin embargo, posteriores gestiones, incluyendo un correo de seguimiento en marzo de 2026, no obtuvieron respuesta. Asegura que existe deterioro en la infraestructura del sistema de captación y conducción del agua; además, aduce que se han detectado tuberías abiertas y sin control, lo que ha comprometido la disponibilidad del recurso. También se ha evidenciado presencias de animales en la zona de la naciente y tanque, lo que genera riesgo de contaminación y afectación en la disponibilidad del recurso. Reclama que no ha existido una intervención efectiva de las autoridades competentes, particularmente del Instituto Costarricense de Acueductos y Alcantarillados, pese a tratarse de una situación que compromete el acceso al agua potable y ha generado conflictos comunitarios. Aduce que la problemática ha derivado en limitaciones en el acceso al recurso hídrico, afectando incluso a personas en condición de vulnerabilidad, sin que se haya adoptado una solución estructural. Concluye que la situación descrita evidencia la necesidad de una intervención institucional urgente para garantizar el acceso continuo, seguro y no condicionado al agua para consumo humano. Estima lesionados sus derechos fundamentales. Solicita la intervención de esta Sala.\n\n2.- Mediante resolución de las catorce horas cincuenta y ocho minutos del dos de junio de dos mil veintiséis, se dio curso al presente amparo.\n\n3.- Por memorial de fecha 11 de junio de 2026, Florita Martínez Jiménez, presidenta de la Asociación de Desarrollo Integral de La Reserva Indígena Cabécar de Nairi Awari, Pacuarito, contesta que del oficio enviado por su representada, no deriva en ningún momento que pretendan eliminar o condicionar en ningún momento el uso y disfrute del agua a las familias de la aquí recurrente, solo se les indicó que por estar dicha naciente en una finca que ahora registralmente pertenece a la Asociación de Desarrollo Integral, van a intervenirla para hacer mejoras urgentes que necesita, pues el tanque y otros componentes del mini acueducto que recepta y distribuye el agua, están en muy mal estado y existe un desperdicio contante de agua, lo cual es muy lamentable, ya que en el sector de las Brisas de Pacuarito, no hay servicio de agua de AyA y no existen nacientes cercanas, por lo que es grave que se esté desperdiciando agua, cuanto otras familias la están necesitando. En la nota informan sobre mejoras a dicho mini acueducto y que van a instalar una manguera para proveer de ese líquido vital al Salón Comunal de la Plaza de Tsinikicha y otras casas cercanas que no cuentan con servicio de agua potable, pensando en aprovechar el agua que constantemente se derrama y se desperdicia, por el mal estado de la infraestructura de recepción de agua que existe actualmente, instando a las familias de la recurrente a colaborar en los trabajas que pretenden realizar, por ser ellos también beneficiarios del agua que produce dicha naciente. Nunca fue, ni ha sido, la intención eliminar el servicio de agua para las familias de la aquí recurrente, ni condicionarlo a realizar trabajos, lo que pretendimos fue contar con la colaboración de ellos en las mejoras que pretendemos realizar en esa infraestructura, las cuales necesita, para lograr un mejor aprovechamiento del recurso hídrico, muy escaso en la zona de Tsinikicha, Las Brisas de Pacuarito, Siquirres, Limón y proveer de ese líquido vital a familias indígenas que lo necesitan y también al Salón Comunal de la comunidad indígena de Tsinikicha, lugar de encuentro y reuniones de nuestra gente, que de momento no cuenta con el servicio de agua potable. El problema que se suscita es que, la aquí recurrente y su familia, si bien en el recurso que aquí nos ocupa, indican que el acceso al agua es un derecho humano, pretenden que la naciente sea de uso exclusivo de ellos y que el agua que produce esa naciente no sea compartida con otras familias y mucho menos si son indígenas; situación que esta Asociación no puede aceptar, pues consideramos, al igual que la recurrente, que el acceso al agua es un derecho humano y por ende debe aplicar para todos y todas, sin ninguna distinción. No se acepta que la recurrente y su familia sostengan que la naciente les pertenece, pues el agua no tiene dueño, es de todos y todas y por ese motivo no quieren que se siga desperdiciando, producto del mal estado que presenta hoy la infraestructura de captación y distribución ubicada en dicha naciente; agua, que en lugar de ser desperdiciada, la que podemos aprovechar para otros fines, como es el caso del Salón Comunal de Tsinikicha y en beneficio de otras familias ajenas a la de la aquí recurrente. Consideran que, con nuestras actuaciones, en ningún momento hemos lesionado ningún derecho fundamental de la recurrente, ni de su familia, pues lo que pretendemos es mejorar una infraestructura vieja, que tiene más de 30 años de existir sin ningún mantenimiento adecuado, lo que conlleva un pésimo aprovechamiento del recurso hídrico. Cumplimos con notificar a la familia de la aquí recurrente de nuestras pretensiones en cuanto a mejorar dicho mini acueducto y consideramos oportuno requerir su colaboración en las mejoras a realizar, por ser ellos beneficiarios del agua, sin embargo, ellos reaccionaron negativamente, pues consideran que la naciente les pertenece, por el uso que le han dado por años y que no tienen por qué compartir el agua con ninguna otra familia, lo cual considera esta Asociación de Desarrollo Integral Indígena, que no es de recibo, pues el acceso al agua, como bien lo afirma la misma recurrente, es un derecho humano y por ende pertenece a todas y todos, motivo por el que estimamos que tenemos derecho a realizar las mejoras que requiere el mini acueducto que refiere la recurrente, para lograr un mejor aprovechamiento del recurso hídrico y compartido entonces con familias indígenas que lo necesitan y también proveyendo de agua a un lugar de encuentro y reunión de familias indígenas, como lo es el Salón Comunal de Tsinikicha; sin que con ello se afecte el aprovechamiento de agua que por años han disfrutado la recurrente y sus familiares. Todo lo afirmado por la recurrente en cuanto a afectaciones o limitaciones en el servicio de agua, presencia de animales en sitio y otras situaciones que pudiesen comprometer dicho servicio, son precisamente las situaciones que pretenden eliminar con la mejora que pretendemos realizar en dicho mini acueducto, ya que su infraestructura actual está en muy mal estado y la captación de agua no cuenta con una protección adecuada, lo que compromete la potabilidad del recurso. El uso de dicha naciente ha sido siempre artesanal, sin ninguna intervención estatal, como ocurre con muchos otros mini acueductos que existen a lo largo y ancho de los territorios indígenas, lo que requiere es una mejora estructural y un mantenimiento adecuado, que es precisamente lo que nosotros pretendemos hacer, sin embargo, las familias de la recurrente se oponen a colaborar con esos trabajos, porque consideran que la naciente les pertenece, y lo ven como un condicionamiento a continuar aprovechando el producto hídrico. Nosotros como Gobierno Local del Territorio Indígena Cabécar de Nairi Awari, por disposición del Decreto Ejecutivo No. 13568 de 30 de abril de 1982, el cual establece que las Asociaciones de Desarrollo Integral tienen la representación legal de las Comunidades Indígenas y actúan como gobierno local de éstas y, en uso de las facultades legales que nos confiere le legislación indígena vigente mediante la Ley No. 6172, el Convenio 169 de la Organización Internacional del Trabajo (OIT) y la jurisprudencia concordante de la Sala Constitucional contenidos en los votos: 05-6856 y 2005- 9535, para administrar este territorio y representar a las comunidades indígenas Cabécar de Nairi Awari, tenemos la obligación de proteger ese recurso hídrico, mejorar su captación y administrarlo de la mejor manera posible, sin desperdicios y proveyendo de agua a la mayor cantidad de personas posible, con o sin la colaboración de la recurrente y su familia y/o de instituciones públicas, porque es nuestra obligación legal velar por el desarrollo de nuestras comunidades indígenas y defender sus derechos, sin dejar de lado la provisión de agua para la recurrente y su familia, tal y como la han disfrutado por años.\n\n4.- En los procedimientos seguidos se ha observado las prescripciones legales.\n\n Redacta la Magistrada Hess Herrera; y,\n\nConsiderando:\n\nI.- CUESTIÓN PREVIA: De previo a la valoración del fondo del presente asunto, debe indicarse que la Ley de la Jurisdicción Constitucional en su artículo 57 dispone que el recurso de amparo procede contra las acciones u omisiones de sujetos de derecho privado, pero únicamente cuando éstos actúen o deban actuar en ejercicio de funciones o potestades públicas, o, se encuentren, de derecho o de hecho, en una posición de poder frente a la cual los remedios jurisdiccionales comunes resulten claramente insuficientes o tardíos para garantizar los derechos o libertades fundamentales a que se refiere el artículo 2, inciso a) de la misma Ley. En el caso concreto se estima que el recurso es admisible, por cuanto en la situación que se pone en conocimiento de esta Sala se evidencia que la Asociación recurrida se encuentran en una posición de poder frente a la cual los remedios jurisdiccionales comunes resultan tardíos para garantizar los derechos constitucionales que se acusan conculcados o amenazados de vulnerar. Por ese motivo, se hace necesario tramitar el recurso.\n\nII.- OBJETO DEL RECURSO. - Indica la recurrente que desde hace más de 30 años utilizan de forma continua una fuente de agua (naciente), situada en una finca actualmente perteneciente a la Asociación de Desarrollo Integral Indígena Cabécar Nairi Awari (ADITINA). Refiere que el 19 de enero de 2026 la ADITINA emitió un el oficio JD- ADITINA-01-2026, en el que condiciona el acceso al servicio de agua a la colaboración en trabajos determinados. Expone que, el 2 de febrero de 2026 su familia respondió formalmente, señalando el uso histórico del recurso y solicitando que el acceso al agua no se someta a condicionamientos; sin embargo, acusa que no obtuvieron respuesta.\n\nIII.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos: \n\na) Que la fuente de agua (naciente) de la cual la parte recurrente se abaste, se encuentra situada en una finca perteneciente a la Asociación de Desarrollo Integral Indígena Cabécar Nairi Awari (ADITINA). (hecho no controvertido)\n\nb) El 19 de enero de 2026 la Asociación recurrida mediante oficio ID-ADITINA-OF-01-2026 comunicó a la parte recurrente lo siguiente: “(…) Estimado señores: Reciba un cordial saludo de parte de nuestra organización lo siguiente es para dar una información de que como Junta Directiva ADITINA hemos tomado el acuerdo, que la naciente que actualmente están utilizando para el abastecimiento de su casa, se encuentra en la propiedad de la ADI, por lo cual se realizará una reparación a la naciente y conexión de manguera esto para el salón comunal. Por lo tanto, si ocupa que se le brinde el servicio de agua nos colabore al trabajo que se ha de realizar en estos días.” (ver documento).\n\nc) El 02 de febrero de 2026 la parte recurrente presentó -documento físico- ante la Asociación recurrida, sus consideraciones respecto al oficio ID-ADITINA-OF-01-2026. (ver documento).\n\nd) El 11 de marzo de 2026 la parte accionante remitió correo electrónico a la organización recurrida, indicando en lo que interesa: “(…) Por medio del presente correo deseamos dar seguimiento al oficio entregado por nuestra familia el día 2 de febrero de 2026, relacionado con el abastecimiento de agua proveniente de la naciente ubicada en la finca actualmente administrada por esa Asociación. Dicho documento fue presentado como respuesta al oficio jD-ADITINA-OF-01-2026, en el cual expusimos el uso histórico y continue que nuestra familia ha realizado de esa fuente de agua por más de treinta años para consumo humano y necesidades básicas. Hasta la fecha no hemos recibido respuesta formal a dicho documento, por lo que respetuosamente solicitamos nos puedan informar, cual sería la posición o valoración de esa Junta Directiva al respecto. Reiteramos nuestra disposición al diálogo respetuoso y a la búsqueda de una solución justa y armoniosa para todas las partes, procurando siempre el bienestar de la comunidad y el respeto al derecho humano al agua.” (ver documentación).\n\nIV.- HECHOS NO PROBADOS. - No se tienen por demostrados los siguientes hechos de interés:\n\na) Que la parte recurrente forme parte de la Asociación de Desarrollo Integral de la Reserva Indígena Cabécar Nairi Awari, Pacuarito (ADITINA).\n\nb) Que la parte recurrente haya presentado denuncia y/o queja ante el Instituto Costarricense de Acueductos y Alcantarillados.\n\nc) Que la Asociación recurrida haya comunicado expresamente a la parte amparada, que vayan a suspenderle o eliminarle el acceso al agua potable. \n\nV.- SOBRE EL FONDO. - Del informe rendido por la representante de la autoridad recurrida -que se tiene dado bajo fe de juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y del elenco probatorio, se tiene por acreditado que la fuente de agua (naciente) de la cual la parte recurrente se abaste, se encuentra situada en una finca perteneciente a la Asociación de Desarrollo Integral Indígena Cabécar Nairi Awari (ADITINA). Asimismo, se tiene que, el 19 de enero de 2026 la Asociación recurrida mediante oficio ID-ADITINA-OF-01-2026 comunicó a la parte recurrente lo siguiente: “(…) Estimado señores: Reciba un cordial saludo de parte de nuestra organización lo siguiente es para dar una información de que como Junta Directiva ADITINA hemos tomado el acuerdo, que la naciente que actualmente están utilizando para el abastecimiento de su casa, se encuentra en la propiedad de la ADI, por lo cual se realizará una reparación a la naciente y conexión de manguera esto para el salón comunal. Por lo tanto, si ocupa que se le brinde el servicio de agua nos colabore al trabajo que se ha de realizar en estos días.” Por lo anterior, el 02 de febrero de 2026 la parte recurrente presentó -documento físico- ante la Asociación recurrida, sus consideraciones respecto al oficio ID-ADITINA-OF-01-2026. De igual forma, el 11 de marzo de 2026 la parte accionante remitió correo electrónico a la organización recurrida, indicando en lo que interesa: “(…) Por medio del presente correo deseamos dar seguimiento al oficio entregado por nuestra familia el día 2 de febrero de 2026, relacionado con el abastecimiento de agua proveniente de la naciente ubicada en la finca actualmente administrada por esa Asociación. Dicho documento fue presentado como respuesta al oficio jD-ADITINA-OF-01-2026, en el cual expusimos el uso histórico y continue que nuestra familia ha realizado de esa fuente de agua por más de treinta años para consumo humano y necesidades básicas. Hasta la fecha no hemos recibido respuesta formal a dicho documento, por lo que respetuosamente solicitamos nos puedan informar, cual sería la posición o valoración de esa Junta Directiva al respecto. Reiteramos nuestra disposición al diálogo respetuoso y a la búsqueda de una solución justa y armoniosa para todas las partes, procurando siempre el bienestar de la comunidad y el respeto al derecho humano al agua.” \n\nAsí las cosas, se descarta la lesión a los derechos fundamentales del amparado, por los siguientes motivos: a) Respecto a la falta de respuesta de las gestiones presentadas en fechas 02 de febrero de 2026 y 11 de marzo de 2026, no consta que la parte recurrente forme parte de la Asociación de Desarrollo Integral de la Reserva Indígena Cabécar Nairi Awari, Pacuarito (ADITINA). Por otra parte, de la lectura de las gestiones, tampoco se evidencia requerimiento alguno de información que amerite brindar una respuesta en los términos que se reclaman, sino que, por el contrario, señalan el uso histórico del recurso y solicitan que el acceso al agua no se someta a condicionamientos, pese a que, la naciente de agua se encuentra en territorio de la Asociación. Es decir, muestran su inconformidad con los trabajos y obras que pretende realizar la organización accionada respecto a la naciente de agua. B) Por último, no consta que la Asociación recurrida haya comunicado expresamente a la parte amparada, que vayan a suspenderle o eliminarle el acceso al agua potable. En ese sentido, la parte accionante pretende cuestionar las actuaciones de la Asociación recurrida, a partir de reclamos sobre hechos futuros e inciertos. Por lo expuesto, se declara sin lugar el recurso. \n\nVI.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. San José, at nine hours twenty minutes on the twenty-sixth of June, two thousand twenty-six.\n\nAmparo appeal (recurso de amparo) processed under case number 26-013846-0007-CO, filed by Nombre01, national identification number CED01, against the ASOCIACIÓN DE DESARROLLO INTEGRAL DE LA RESERVA INDÍGENA CABÉCAR NAIRI AWARI, PACUARITO (ADITINA).\n\nBackground:\n\n1.- By written submission received at the Court on April 21, 2026, the petitioner files an amparo appeal against the Asociación de Desarrollo Integral de la Reserva Indígena Cabécar Nairi Awari, Pacuarito (ADITINA). She states that she and her family are co-owners of properties located in Las Brisas, Pacuarito, Siquirres, Limón. She indicates that for more than 30 years they have continuously used a spring (naciente), located on a property currently belonging to the Asociación de Desarrollo Integral Indígena Cabécar Nairi Awari (ADITINA), for human consumption and subsistence. She notes that such use has been peaceful, continuous, and uninterrupted for decades, constituting the only sustainable water supply source, which also serves other family groups in the area. She states that on January 19, 2026, ADITINA issued official memorandum JD-ADITINA-01-2026, in which it conditions access to the water service upon collaboration in specified work activities. She explains that on February 2, 2026, her family formally responded, noting the historical use of the resource and requesting that access to water not be made subject to conditions, as well as requesting the opening of a dialogue; however, subsequent efforts, including a follow-up email in March 2026, received no response. She asserts that there is deterioration in the infrastructure of the water collection and conveyance system; she further argues that open and uncontrolled pipes have been detected, which has compromised the availability of the resource. The presence of animals in the area of the spring and tank has also been noted, creating a risk of contamination and affecting the availability of the resource. She claims that the competent authorities have not intervened effectively, particularly ICAA, despite a situation that compromises access to drinking water and has generated community conflicts. She argues that the problem has resulted in limitations on access to the water resource, affecting even persons in vulnerable conditions, without any structural solution having been adopted. She concludes that the described situation demonstrates the need for urgent institutional intervention to guarantee continuous, safe, and unconditioned access to water for human consumption. She considers her fundamental rights to have been violated. She requests the intervention of this Court.\n\n2.- By resolution issued at fourteen hours fifty-eight minutes on the second of June, two thousand twenty-six, the present amparo appeal was admitted for processing.\n\n3.- By memorial dated June 11, 2026, Florita Martínez Jiménez, president of the Asociación de Desarrollo Integral de La Reserva Indígena Cabécar de Nairi Awari, Pacuarito, responds that the memorandum sent by her organization does not at any point intend to eliminate or condition the use and enjoyment of water by the families of the petitioner; they were only informed that, since the spring is located on a property now registered as belonging to the Asociación de Desarrollo Integral, the association will be carrying out urgent improvements it requires, since the tank and other components of the small aqueduct (mini acueducto) that collects and distributes the water are in very poor condition and there is a constant waste of water, which is deeply regrettable, given that in the Las Brisas de Pacuarito area there is no water service from AyA and there are no nearby springs, making it serious that water is being wasted when other families need it. The notice informs of improvements to the small aqueduct and of the installation of a pipe to supply that vital resource to the community hall (Salón Comunal) of the Plaza de Tsinikicha and other nearby homes that do not have drinking water service, with the intention of making use of water that is constantly spilling over and being wasted due to the poor condition of the existing water collection infrastructure, and urging the petitioner's family to collaborate in the planned work, as they are also beneficiaries of the water produced by the spring. It was never, nor has it ever been, the intention to eliminate the water service for the families of the petitioner, nor to condition it on performing work; what was sought was to have their collaboration in the planned improvements to the infrastructure — which are necessary — in order to achieve better use of the water resource, which is very scarce in the area of Tsinikicha, Las Brisas de Pacuarito, Siquirres, Limón, and to provide that vital resource to indigenous families who need it and also to the Salón Comunal of the indigenous community of Tsinikicha, a meeting and gathering place for their people, which currently does not have drinking water service. The problem that arises is that the petitioner and her family, while in the appeal before this Court they state that access to water is a human right, seek to have the spring for their exclusive use and to prevent the water it produces from being shared with other families, and even less so if those families are indigenous — a situation that this Association cannot accept, since it considers, as does the petitioner, that access to water is a human right and must therefore apply to everyone, without any distinction. It is not accepted that the petitioner and her family maintain that the spring belongs to them, since water has no owner — it belongs to everyone — and for that reason the Association does not want it to continue to be wasted as a result of the poor condition of the collection and distribution infrastructure located at the spring; water that, rather than being wasted, can be put to use for other purposes, such as the Salón Comunal of Tsinikicha and for the benefit of other families beyond that of the petitioner. The Association considers that, through its actions, it has at no point violated any fundamental right of the petitioner or her family, since what it seeks is to improve an aging infrastructure that has existed for more than 30 years without adequate maintenance, resulting in very poor use of the water resource. The Association fulfilled its obligation to notify the petitioner's family of its intentions regarding the improvement of the small aqueduct, and considered it appropriate to request their collaboration in the planned improvements, as they are beneficiaries of the water; however, they responded negatively, since they consider the spring to belong to them by virtue of the years of use and do not see why they should share the water with any other family. This Asociación de Desarrollo Integral Indígena considers such a position unacceptable, since access to water, as the petitioner herself affirms, is a human right and therefore belongs to everyone. For this reason, the Association considers that it has the right to carry out the improvements the small aqueduct requires, in order to achieve better and shared use of the water resource with indigenous families who need it, and also to supply water to a meeting and gathering place for indigenous families, such as the Salón Comunal of Tsinikicha — without thereby affecting the water use that the petitioner and her family have enjoyed for years. All that the petitioner alleges regarding disruptions or limitations in the water service, the presence of animals on site, and other situations that could compromise said service are precisely the situations the Association seeks to eliminate through the planned improvement to the small aqueduct, since its current infrastructure is in very poor condition and the water intake does not have adequate protection, which compromises the potability of the resource. The use of the spring has always been artisanal, without any state intervention, as is the case with many other small aqueducts throughout indigenous territories; what is needed is a structural improvement and adequate maintenance, which is precisely what the Association intends to carry out. However, the petitioner's family opposes collaborating in this work because they consider the spring to belong to them, and they view the request as a condition on continuing to benefit from the water resource. As the local government of the Cabécar de Nairi Awari Indigenous Territory, by virtue of Decreto Ejecutivo No. 13568 of April 30, 1982, which establishes that Integral Development Associations hold the legal representation of Indigenous Communities and act as their local government, and in the exercise of the legal powers conferred by current indigenous legislation through Ley No. 6172, Convention No. 169 of the International Labour Organization (ILO), and the concordant jurisprudence of the Sala Constitucional contained in votes 05-6856 and 2005-9535, to administer this territory and represent the Cabécar Nairi Awari indigenous communities, the Association has the obligation to protect this water resource, improve its collection, and manage it in the best possible way — without waste and supplying water to the greatest number of people possible — with or without the collaboration of the petitioner and her family and/or public institutions, because it is the Association's legal obligation to ensure the development of its indigenous communities and to defend their rights, while continuing to provide water to the petitioner and her family as they have enjoyed for years.\n\n4.- The prescribed legal procedures have been observed in the proceedings followed.\n\nDrafted by Magistrate Hess Herrera; and,\n\nConsidering:\n\nI.- PRELIMINARY MATTER: Before assessing the merits of this case, it should be noted that the Ley de la Jurisdicción Constitucional in article 57 provides that the amparo appeal lies against actions or omissions of private-law subjects, but only when they act or must act in the exercise of public functions or powers, or are, by law or in fact, in a position of power in relation to which ordinary judicial remedies prove clearly insufficient or untimely to guarantee the rights or fundamental freedoms referred to in article 2, subsection a) of the same Law. In the specific case, the appeal is deemed admissible, given that the situation brought to the attention of this Court shows that the respondent Association is in a position of power in relation to which ordinary judicial remedies would be untimely to guarantee the constitutional rights alleged to have been violated or threatened. For that reason, it is necessary to process the appeal.\n\nII.- SUBJECT MATTER OF THE APPEAL. - The petitioner states that for more than 30 years they have continuously used a spring, located on a property currently belonging to the Asociación de Desarrollo Integral Indígena Cabécar Nairi Awari (ADITINA). She states that on January 19, 2026, ADITINA issued memorandum JD-ADITINA-01-2026, in which it conditions access to the water service upon collaboration in specified work activities. She explains that on February 2, 2026, her family formally responded, noting the historical use of the resource and requesting that access to water not be made subject to conditions; however, she claims they received no response.\n\nIII.- PROVEN FACTS. The following facts are considered duly established as relevant to the resolution of this matter:\n\na) That the spring from which the petitioning party draws water is located on a property belonging to the Asociación de Desarrollo Integral Indígena Cabécar Nairi Awari (ADITINA). (undisputed fact)\n\nb) On January 19, 2026, the respondent Association, through memorandum ID-ADITINA-OF-01-2026, communicated the following to the petitioning party: \"(…) Dear Sirs: We extend a warm greeting from our organization. The following is to provide information that the Board of Directors (Junta Directiva) of ADITINA has resolved that the spring you are currently using to supply your home is located on ADI property, and therefore repairs will be carried out on the spring along with the connection of a pipe for the community hall. Therefore, if you require that water service be provided to you, please collaborate in the work to be carried out in the coming days.\" (see document).\n\nc) On February 2, 2026, the petitioning party submitted — in physical form — to the respondent Association their considerations regarding memorandum ID-ADITINA-OF-01-2026. (see document).\n\nd) On March 11, 2026, the petitioning party sent an email to the respondent organization, stating in relevant part: \"(…) By means of this email we wish to follow up on the memorandum submitted by our family on February 2, 2026, regarding the supply of water from the spring located on the property currently administered by your Association. Said document was submitted in response to memorandum jD-ADITINA-OF-01-2026, in which we set forth the historical and continuous use that our family has made of that water source for more than thirty years for human consumption and basic needs. To date we have not received a formal response to that document, and we therefore respectfully request that you inform us of the position or assessment of the Board of Directors in that regard. We reiterate our willingness to engage in respectful dialogue and to seek a fair and harmonious solution for all parties, always promoting community welfare and respect for the human right to water.\" (see documentation).\n\nIV.- UNPROVEN FACTS. - The following facts of interest are not considered established:\n\na) That the petitioning party is a member of the Asociación de Desarrollo Integral de la Reserva Indígena Cabécar Nairi Awari, Pacuarito (ADITINA).\n\nb) That the petitioning party has filed a complaint and/or grievance with ICAA.\n\nc) That the respondent Association has expressly communicated to the protected party (parte amparada) that it will suspend or eliminate access to drinking water.\n\nV.- ON THE MERITS. - From the report submitted by the representative of the respondent authority — which is considered to have been given under oath (fe de juramento), with the consequences, including criminal ones, provided for in article 44 of the Law governing this Jurisdiction — and from the body of evidence (elenco probatorio), it is established that the spring from which the petitioning party draws water is located on a property belonging to the Asociación de Desarrollo Integral Indígena Cabécar Nairi Awari (ADITINA). It is likewise established that on January 19, 2026, the respondent Association, through memorandum ID-ADITINA-OF-01-2026, communicated the following to the petitioning party: \"(…) Dear Sirs: We extend a warm greeting from our organization. The following is to provide information that the Board of Directors of ADITINA has resolved that the spring you are currently using to supply your home is located on ADI property, and therefore repairs will be carried out on the spring along with the connection of a pipe for the community hall. Therefore, if you require that water service be provided to you, please collaborate in the work to be carried out in the coming days.\" In light of the foregoing, on February 2, 2026, the petitioning party submitted — in physical form — to the respondent Association their considerations regarding memorandum ID-ADITINA-OF-01-2026. Similarly, on March 11, 2026, the petitioning party sent an email to the respondent organization, stating in relevant part: \"(…) By means of this email we wish to follow up on the memorandum submitted by our family on February 2, 2026, regarding the supply of water from the spring located on the property currently administered by your Association. Said document was submitted in response to memorandum jD-ADITINA-OF-01-2026, in which we set forth the historical and continuous use that our family has made of that water source for more than thirty years for human consumption and basic needs. To date we have not received a formal response to that document, and we therefore respectfully request that you inform us of the position or assessment of the Board of Directors in that regard. We reiterate our willingness to engage in respectful dialogue and to seek a fair and harmonious solution for all parties, always promoting community welfare and respect for the human right to water.\"\n\nThat being so, a violation of the fundamental rights of the protected party is ruled out, for the following reasons: a) Regarding the failure to respond to the submissions presented on February 2, 2026 and March 11, 2026, there is no evidence that the petitioning party is a member of the Asociación de Desarrollo Integral de la Reserva Indígena Cabécar Nairi Awari, Pacuarito (ADITINA). Furthermore, a reading of the submissions does not reveal any request for information that would require a response in the terms claimed; rather, on the contrary, they set forth the historical use of the resource and request that access to water not be made subject to conditions, notwithstanding the fact that the spring is located on the Association's territory — that is, they express their disagreement with the work and construction that the respondent organization intends to carry out regarding the spring. B) Lastly, there is no evidence that the respondent Association has expressly communicated to the protected party that it will suspend or eliminate access to drinking water. In this regard, the petitioning party seeks to challenge the actions of the respondent Association based on claims concerning future and uncertain events. For the foregoing reasons, the appeal is denied.\n\nVI.- DOCUMENTATION SUBMITTED TO THE FILE. The petitioning party is advised that if any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device have been submitted, these must be retrieved from the office within a maximum period of 30 business days counted from notification of this judgment.
