  "body_es_text": "Revisión del Documento\n\n \n\n\n\nExp: 26-018651-0007-CO \n\nRes. Nº 2026025783\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del diez de julio de dos mil veintiseis .\n\n Recurso de amparo que se tramita en el expediente número 26-018651-0007-CO interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra el MINISTERIO DE SALUD.\n\nRESULTANDO:\n\n1.- Por escrito recibido en esta Sala a las 00:00 hrs. del 26 de mayo de 2026, la parte recurrente interpone recurso de amparo y expone que, vive en Abangares, Guanacaste. Indica que, desde hace 10 años, los vecinos colindantes, los cuales son inquilinos, operan un taller de carpintería y mueblería que genera emisiones constantes de aserrín, olores químicos de pinturas y ruidos de herramienta industrial. Señala que esa situación ha deteriorado gravemente su salud y calidad de vida, así como la de su familia, especialmente su suegra, quien tiene un padecimiento en los pulmones, provocando estornudos continuos, resequedad en las vías respiratorias, paladar amargo persistente y mucha tos. Además, alega que su hogar permanece contaminado por el polvo derivado del lijado de maderas e, incluso, se le han dañado electrodomésticos y equipos de trabajo a causa de eso. Explica que a la contaminación ambiental se suma la contaminación sónica por el uso de herramientas y música con volumen excesivo. Manifiesta que, ante esa situación, ha planteado dos denuncias formales ante el Área Rectora de Salud de Abangares, el 20 de enero y el 14 de mayo de 2026 (véase prueba aportada al expediente). Sostiene que anteriormente se han interpuesto otras denuncias, pero no cuenta con las fechas. Además, comenta que otros vecinos han interpuesto denuncias y también han hecho caso omiso a la situación. Esgrime que, en un intento de resolver la problemática de forma pacífica, se intentó dialogar con los inquilinos del terreno vecino. Sin embargo, añade que respondieron con enojo e indiferencia, llegando al punto de burlarse de su situación y amenazando explícitamente con colocar los parlantes sobre la línea de su cerca para aumentar el daño y el ruido, evidenciando una conducta de hostigamiento. Acusa que, a la fecha de interposición de ese recurso, el ministerio recurrido no ha realizado ninguna visita de inspección, no ha efectuado mediciones de ruido ni de partículas y tampoco le han notificado ninguna resolución, dejando su salud y la de su familia en un estado de indefensión. Por los motivos expuestos, solicita que se declare con lugar el recurso.\n\n2.- Mediante auto de las 22:22 hrs. del 09 de junio de 2026 se cursó el presente recurso y se notificó a las autoridades recurridas el 10 de junio de 2026.\n\n3.- Por escrito presentado el 16 de junio de 2026, informan bajo juramento ALEXANDER SÁNCHEZ CABO, en condición de Ministro y RICARDO MARTÍN DÍAZ CAJINA, en condición de Director del Área Rectora de Salud de Abangares, ambos del Ministerio de Salud que: “(…) atendemos el presente recurso con sustento en la información aportada en informe técnico MS-DRRSCH-DARSA-IT-061-2026 del 11 de junio de 2026, mediante el cual indica, en lo que interesa, que se cuenta con cinco denuncias confidenciales, por malos olores, polvo, partículas, ruido y vibraciones, contra los establecimientos [Nombre 002] y [Nombre 003], por lo que no se logra identificar que alguna de estas denuncias haya sido interpuesta por la amparada, la cual, además, no indica su domicilio o dirección exacta para determinar a cuál de las denuncias confidenciales corresponde su reclamo. El Área Rectora de Salud de Abangares ha dispuesto los actos administrativos que corresponden a denuncias que datan desde el 2024, contándose con órdenes sanitarias notificadas sobre ambos establecimientos, cuyo seguimiento se encuentra pendiente; también está pendiente la medición de ruidos, sin embargo estas no se han llevado a cabo por cuanto se cuenta con equipos nuevos que deben ser calibrados, habiéndose solicitado el 5 de junio de 2026, ante el Laboratorio Costarricense de Metrología (LACOMET) la gestión correspondiente. Para la realización de estos actos, se han realizado las inspecciones correspondiente, siendo imposible que se determine si dichas inspecciones han sido llevadas a cabo cerca del domicilio de la amparada, al no señalarse este en el escrito de interposición y al ser de índole confidencial las denuncias interpuestas anteriormente, por lo que no se puede saber si alguna de esas denuncias atendidas corresponde a las referidas por la amparada. Con respecto al daño de electrodomésticos y de equipo de trabajo, eso está fuera de la competencia de la salud pública, lo mismo que las rencillas de las que la amparada refiere haber tenido con los dueños del establecimiento. CONCLUSIÓN De acuerdo con el informe técnico MS-DRRSCH-DARSA-IT-061-2026, el Área Rectora de Salud de Abangares ha atendido denuncias sobre polvo, partículas, ruidos, olores y vibraciones con respecto a los establecimientos [Nombre 003] y [Nombre 002]; sin embargo, por tratarse de denuncias confidenciales en las que se ha resguardado la identidad de los denunciantes y al no indicar la amparada su domicilio o dirección exacta, es imposible determinar si el recurso de amparo versa sobre alguna de las denuncias atendidas; no obstante, como puede apreciarse en dicho informe, el Área Rectora de Salud ha ejercido una serie de actos dentro de su competencia, llegando incluso a notificar órdenes sanitarias a ambos establecimientos, de las cuales está pendiente únicamente el seguimiento de las mismas y la medición de ruidos en tanto no se está a la espera de la calibración de los equipos por parte del LACOMET.”\n\n4.- En la substanciación de este proceso se han observado las prescripciones de ley.\n\n Redacta el Magistrado Cruz Castro; y,\n\nConsiderando:\n\n I.- DE PREVIO. De previo a analizar el fondo del asunto –por la presunta violación del derecho a un procedimiento pronto y cumplido– debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones– aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos, pautados por la Ley General de la Administración Pública (artículos 261 y 325) o por las leyes sectoriales relativas a los procedimientos administrativos especiales, tanto para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– como para conocer de los recursos administrativos procedentes. Precisamente, en este caso se plantea un supuesto de excepción, pues se está ante la supuesta falta de resolución de una denuncia ambiental interpuesta ante el Área Rectora de Salud de Abangares. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo. \n\nII.- OBJETO DEL RECURSO. La parte recurrente interpone recurso de amparo y expone que, desde hace una década los inquilinos del terreno colindante operan un taller de carpintería y mueblería que genera polvo de aserrín, olores químicos y ruido industrial excesivo. Esta situación ha afectado gravemente su salud y la de su familia, en especial la de su suegra, con enfermedad pulmonar preexistente, causando síntomas respiratorios continuos, y ha provocado daños en electrodomésticos y equipos de trabajo. Los intentos de diálogo fracasaron y derivaron en hostigamiento por parte de los vecinos. Pese a haber interpuesto dos denuncias formales ante el Área Rectora de Salud de Abangares (20 de enero y 14 de mayo de 2026), la autoridad recurrida no ha realizado inspecciones, mediciones ni ha emitido resolución alguna, por lo que solicita que el recurso sea declarado con lugar.\n\nIII.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:\n\nEl 20 de enero de 2026, la amparada interpuso una denuncia formal ante el Área Rectora de Salud de Abangares por las afectaciones generadas por el taller de carpintería y mueblería colindante denominado [Nombre 004] (ver prueba agregada a los autos).\n\nEl 14 de mayo de 2026, la amparada interpuso una segunda denuncia formal ante el Área Rectora de Salud de Abangares por los mismos motivos ((ver prueba agregada a los autos).\n\nEl 05 de junio de 2026, el Área Rectora de Salud de Abangares solicitó ante el Laboratorio Costarricense de Metrología (LACOMET) la calibración de los equipos necesarios para realizar mediciones de ruido (ver informe rendido por parte de las autoridades accionadas).\n\nEl 11 de junio de 2026, la Dirección del Área Rectora de Salud de Abangares emitió el informe técnico MS-DRRSCH-DARSA-IT-061-2026, en el que se indicó que existían cinco denuncias confidenciales contra los establecimientos [Nombre 002] y [Nombre 003], que se habían notificado órdenes sanitarias a ambos establecimientos y que las mediciones de ruido se encontraban pendientes de realización por encontrarse los equipos en proceso de calibración (ver informe rendido por parte de las autoridades accionadas).\n\n \n\nIV.- SOBRE EL DERECHO FUNDAMENTAL A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO. En reiteradas ocasiones este Tribunal ha desarrollado el contenido de este derecho, contemplado en el artículo 50 de la Constitución Política. La protección del ambiente es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los Poderes Públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. El Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado, por lo que, tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.\n\nV.- RESPECTO A LA COMPETENCIA CONSTITUCIONAL EN MATERIA AMBIENTAL. Tal y como ha sido reiterado en la jurisprudencia de esta Sala, la competencia constitucional en materia ambiental no puede extenderse al punto en que se convierta en un verificador de los criterios técnicos vertidos en las normas o por las autoridades administrativas en materia ambiental, sino que se limita a constatar si las dependencias estatales competentes han cumplido la obligación que les impone el artículo 50 de la Constitución Política, de asumir una actuación responsable y oportuna respecto a la protección del ambiente. Se ha sostenido también, que la procedencia del recurso de amparo está condicionada a que se acredite la existencia de una perturbación o amenaza a uno o más de los derechos o garantías contemplados en la Carta Política o en los instrumentos internacionales de derechos humanos suscritos por el país. Esta última circunstancia pone de relieve el carácter eminentemente sumario del proceso de amparo, cuya tramitación no se aviene bien con la práctica de diligencias probatorias lentas y complejas, o con la necesidad de entrar previamente a examinar -con carácter declarativo- si existen en realidad o no derechos de rango infra constitucional que las partes citen como parte del elenco fáctico del recurso de amparo o del informe de ley, según sea el caso, toda vez que es evidente que esa es una competencia de la que esta Sala carece. Ante esta situación, no resulta procedente que la Sala vierta pronunciamiento alguno (positivo o negativo) en estos casos, porque para dilucidar si ha habido infracción o no de derechos fundamentales primero se debe resolver dicho conflicto en el plano de la legalidad.\n\nVI.- SOBRE LA OBLIGACIÓN OBJETIVA DEL ESTADO DE TUTELAR LA VIDA HUMANA. Este Tribunal Constitucional ha reconocido la obligación objetiva del Estado de tutelar la vida humana y se ha pronunciado sobre las omisiones administrativas que atentan contra la seguridad vial y la integridad física de las personas. Sobre el particular, cabe referir lo dispuesto en sentencia Nº2008-18443 de las 18:01 horas del 11 de diciembre de 2008, donde se indicó: \n\n“Previo análisis del caso concreto, conviene indicar lo dicho por esta Sala en cuanto a la obligación objetiva del Estado de tutelar la vida humana, en el sentido que ha sido usual que el derecho a la vida, frecuentemente analizado junto con el derecho a la integridad física, haya sido entendido como un derecho de contenido negativo, es decir, que su objeto se limitaba a la pretensión contra el Estado de que se abstuviera de realizar acciones dirigidas a eliminar la existencia física de las personas, por ejemplo, la tortura o la pena de muerte, o bien, que castigara a las personas, públicas y privadas, que atentaran contra la vida e integridad de los otros, a través del sistema penal. No obstante, la tendencia actual es imponer al Estado diversas conductas positivas, en el sentido de que no debe perturbar la existencia física de las personas y, además, debe actuar en tutela de su protección, ante los múltiples peligros que la acechan, bien sea que ellos provengan de acciones del Estado mismo o de otras personas, e inclusive, de la misma naturaleza. De ahí que, por ejemplo, los temas ambientales han pasado a ser, al menos en nuestro país, un asunto de índole constitucional, puesto que el derecho a un ambiente sano y ecológicamente equilibrado fue elevado a rango de derecho fundamental. Ahora bien, es menester aclarar que la existencia objetiva de una obligación del Estado en lo referente a la protección del derecho a la vida no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los organismos judiciales, que se tome una medida determinada, pero sí a que se tomen las medidas idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades públicas. En consecuencia, se trata de que el Estado adquiere la obligación de regular las áreas de la vida social de las cuales puedan surgir peligros para la existencia física de los habitantes de su territorio, ya sea través de la ley, de reglamentos, de acuerdos o de otras medidas relacionadas con la organización y los procedimientos administrativos y del derecho subjetivo de las personas a que así se proceda, en forma diligente. Así, la posibilidad de exigir judicialmente, a través de amparo, un tipo específico de actividad prestacional por parte del Estado en cumplimiento de su deber de protección a la vida e integridad física de sus habitantes, es restringida a la clara verificación de un peligro inminente contra esos derechos de las personas, de forma tal que si, por ejemplo, una determinada comunidad estimara necesario contar con un hospital para la atención de sus pobladores (o de cualquier otra obra pública) no es por la vía del amparo que se debe exigir, sino a través de los mecanismos previamente establecidos y ante los órganos y entes competentes, quienes deberán atender la petición y resolver su procedencia técnica, que no implica necesariamente una respuesta positiva. De lo anterior, se desprende que la injerencia de la jurisdicción constitucional solamente es viable ante la inercia comprobada del Estado, a través de sus órganos competentes en atender las demandas que en ejercicio de sus derechos realicen los habitantes del país (ver en este sentido la sentencia número 2003-11519 de las diez horas con treinta minutos del diez de octubre de dos mil tres)”.\n\n \n\nVII.- SOBRE EL CASO CONCRETO. Después de analizar los elementos probatorios aportados, este Tribunal acredita la lesión a los derechos fundamentales de la parte amparada. De los informes rendidos por los representantes de las autoridades recurridas -que se tienen dados bajo juramento con las consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción- y la prueba aportada para la resolución del asunto ha sido debidamente acreditado que, la amparada interpuso dos denuncias formales ante el Área Rectora de Salud de Abangares, el 20 de enero y el 14 de mayo de 2026, en las que alertó sobre las afectaciones a su salud y la de su familia derivadas de la operación de un taller de carpintería y mueblería colindante, el cual genera emisiones constantes de aserrín, olores químicos y ruido industrial excesivo.\n\nPese a lo anterior, a la fecha de resolución del presente recurso, la autoridad recurrida no ha dado respuesta efectiva a dichas denuncias. Si bien el Área Rectora de Salud de Abangares alega haber atendido cinco denuncias confidenciales contra los establecimientos [Nombre 002] y [Nombre 003], y haber notificado órdenes sanitarias a ambos establecimientos, lo cierto es que el seguimiento de dichas órdenes se encuentra pendiente. Asimismo, las mediciones de ruido no han sido realizadas, aduciéndose que los equipos destinados para tal efecto requieren calibración, gestión que apenas fue solicitada ante el LACOMET el 05 de junio de 2026, es decir, con posterioridad a la interposición de este recurso de amparo.\n\nLa justificación ofrecida por la autoridad recurrida en cuanto a la imposibilidad de vincular las denuncias de la amparada con las tramitadas en sede administrativa, debido al carácter confidencial de estas y a la falta de indicación del domicilio exacto en el escrito de interposición, no resulta admisible desde la perspectiva constitucional. Nótese que en el expediente de este proceso constan las pruebas necesarias, base sobre la cual bien pudieron haber extendido el informe requerido por este Tribunal Constitucional.\n\nEn este sentido, tal y como lo ha sostenido este Tribunal en la sentencia No. 2008-18443, el Estado tiene la obligación objetiva de actuar de forma diligente en tutela de los derechos a la vida y a la integridad física de sus habitantes, lo que incluye atender de manera oportuna y efectiva las denuncias ambientales que puedan comprometer la salud de las personas. La injerencia de la jurisdicción constitucional es viable precisamente ante la inercia comprobada del Estado en atender las demandas que en ejercicio de sus derechos formulen los habitantes del país.\n\nEn el caso concreto, la situación denunciada afecta de manera directa y continuada el derecho de la amparada y su familia a un ambiente sano y ecológicamente equilibrado, tutelado por el artículo 50 de la Constitución Política, así como su derecho a la salud y a la vida. Por las razones expuestas, lo procedente es declarar con lugar el presente proceso de amparo, tal como se indica en la parte dispositiva de esta sentencia. \n\n VIII.- NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.\n\nIX.- NOTA DEL MAGISTRADO SALAZAR ALVARADO. Considero que en asuntos ambientales, si ya ha habido intervención de la Administración Pública, su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que se acusa la aparente omisión en la resolución, por parte del Ministerio de Salud, en atender una denuncia por afectaciones de polvo, olores químicos y ruido industrial excesivo en la propiedad colindante con su vivienda, lo que afecta el derecho a disfrutar de un ambiente sano, ecológicamente equilibrado y de un nivel digno de calidad de vida de la parte recurrente.\n\nX.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPOR TANTO:\n\nSe declara CON LUGAR el recurso. Consecuentemente, se ordena a ALEXANDER SÁNCHEZ CABO, en condición de Ministro y a RICARDO MARTÍN DÍAZ CAJINA, en condición de Director del Área Rectora de Salud de Abangares, ambos del Ministerio de Salud o a quienes ocupen esos cargos que, dentro del plazo de UN MES, a partir de la notificación de esta sentencia, coordinen y tomen las medidas necesarias a efectos de que se realicen las inspecciones y mediciones técnicas en el área de influencia del taller de carpintería y mueblería denunciado ([Nombre 004]), adopten las medidas sanitarias que correspondan conforme a los resultados obtenidos y notifiquen a la amparada las resoluciones que se emitan en atención a sus denuncias. Se advierte a la autoridades recurridas que, de conformidad con el artículo 71 de la Ley de esta jurisdicción, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. San José, at nine hours and twenty-five minutes on the tenth of July, two thousand twenty-six.\n\nWrit of amparo (recurso de amparo) processed under case file number 26-018651-0007-CO, filed by [Nombre 001], national identity document (cédula de identidad) [Valor 001], against the MINISTERIO DE SALUD.\n\nWHEREAS:\n\n1.- By written submission received by this Chamber at 00:00 hrs. on May 26, 2026, the petitioning party filed a writ of amparo and stated that she lives in Abangares, Guanacaste. She indicated that for the past ten years, the neighboring tenants have been operating a carpentry and furniture workshop that continuously emits sawdust, chemical odors from paints, and industrial tool noise. She noted that this situation has severely deteriorated her health and quality of life, as well as that of her family, especially her mother-in-law, who has a pre-existing lung condition, causing continuous sneezing, dryness of the respiratory tract, a persistent bitter taste in the mouth, and persistent coughing. She further alleged that her home is permanently contaminated by dust from wood sanding, and that her household appliances and work equipment have even been damaged as a result. She explained that the environmental contamination is compounded by noise contamination from the use of tools and excessively loud music. She stated that, in response to this situation, she filed two formal complaints with the Health Governing Area (Área Rectora de Salud) of Abangares, on January 20 and May 14, 2026 (see evidence attached to the case file). She maintained that other complaints had previously been filed, though she does not have the dates for those. She also noted that other neighbors have filed complaints, which have likewise been ignored. She argued that, in an attempt to resolve the situation peacefully, she tried to engage in dialogue with the tenants of the neighboring property. However, she added that they responded with anger and indifference, going so far as to mock her situation and explicitly threatening to place speakers along her fence line in order to increase the damage and the noise, thereby displaying a pattern of harassment. She alleged that, as of the date of filing of this writ, the respondent ministry had not conducted any inspection visit, had not carried out any noise or particulate measurements, and had not notified her of any ruling, leaving her health and that of her family in a state of defenselessness. For the foregoing reasons, she requested that the writ be granted.\n\n2.- By procedural order issued at 22:22 hrs. on June 9, 2026, the present writ was admitted and the respondent authorities were notified on June 10, 2026.\n\n3.- By written submission filed on June 16, 2026, ALEXANDER SÁNCHEZ CABO, in his capacity as Minister, and RICARDO MARTÍN DÍAZ CAJINA, in his capacity as Director of the Health Governing Area of Abangares, both of the Ministerio de Salud, reported under oath as follows: \"(…) we respond to the present writ on the basis of the information contained in technical report MS-DRRSCH-DARSA-IT-061-2026 of June 11, 2026, which states, in the relevant part, that five confidential complaints are on file regarding bad odors, dust, particulates, noise, and vibrations against the establishments [Nombre 002] and [Nombre 003], making it impossible to identify whether any of these complaints was filed by the protected party (amparada), who also did not provide her address or exact location in order to determine which of the confidential complaints corresponds to her claim. The Health Governing Area of Abangares has issued the administrative acts (actos administrativos) corresponding to complaints dating back to 2024, including sanitary orders (órdenes sanitarias) notified to both establishments, the follow-up on which is still pending; the noise measurements are also pending, as the available equipment has not yet been calibrated — a calibration request was submitted to the Costa Rican Metrology Laboratory (LACOMET) on June 5, 2026. The corresponding inspections have been conducted in connection with these acts, but it is impossible to determine whether those inspections took place near the protected party's residence, since her address was not indicated in the filing and the previously submitted complaints are confidential in nature, making it impossible to know whether any of the complaints already addressed correspond to those mentioned by the protected party. Regarding the damage to household appliances and work equipment, that matter falls outside the scope of public health authority, as do the disputes that the protected party reports having had with the owners of the establishment. CONCLUSION: Pursuant to technical report MS-DRRSCH-DARSA-IT-061-2026, the Health Governing Area of Abangares has addressed complaints concerning dust, particulates, noise, odors, and vibrations with respect to the establishments [Nombre 003] and [Nombre 002]; however, because these complaints are confidential in nature — the identities of the complainants having been protected — and because the protected party did not indicate her address or exact location, it is impossible to determine whether this writ of amparo relates to any of the complaints already addressed; nonetheless, as can be seen in that report, the Health Governing Area has carried out a series of acts within its jurisdiction, going so far as to notify sanitary orders to both establishments, with only the follow-up on those orders and the noise measurements remaining pending, the latter because the equipment is awaiting calibration by LACOMET.\"\n\n4.- The procedural requirements prescribed by law have been observed throughout the course of these proceedings.\n\nDrafted by Justice Cruz Castro; and,\n\nConsidering:\n\nI.- PRELIMINARY MATTER. Before analyzing the merits of the case — regarding the alleged violation of the right to prompt and complete proceedings — it should be clarified that, pursuant to ruling No. 2008-02545 of 8:55 hours on February 22, 2008, this Chamber has, with some exceptions, referred to the contentious-administrative jurisdiction (jurisdicción contencioso administrativa) those matters in which it is disputed whether the public administration has complied with the time limits set by the Ley General de la Administración Pública (articles 261 and 325) or by sector-specific laws governing special administrative procedures, both for issuing a final act concluding an administrative proceeding — initiated ex officio or at the request of a party — and for processing the applicable administrative appeals. This case falls precisely within one of those exceptions, as it involves the alleged failure to resolve an environmental complaint filed with the Health Governing Area of Abangares. Having clarified this point, the Chamber proceeds to address the specific situation raised in this writ of amparo.\n\nII.- SUBJECT MATTER OF THE WRIT. The petitioning party filed a writ of amparo and stated that for the past decade, tenants of the adjacent property have been operating a carpentry and furniture workshop that generates sawdust emissions, chemical odors, and excessive industrial noise. This situation has severely affected her health and that of her family, particularly her mother-in-law, who has a pre-existing pulmonary condition, causing continuous respiratory symptoms, as well as damage to household appliances and work equipment. Attempts at dialogue failed and led to harassment by the neighbors. Despite having filed two formal complaints with the Health Governing Area of Abangares (January 20 and May 14, 2026), the respondent authority has not conducted inspections or measurements, nor has it issued any ruling; she therefore requests that the writ be granted.\n\nIII.- PROVEN FACTS. The following facts are deemed duly established as material to the resolution of this matter, either because they have been demonstrated by evidence or because the respondent authority failed to address them, as warned in the initial procedural order:\n\nOn January 20, 2026, the protected party filed a formal complaint with the Health Governing Area of Abangares regarding the impacts generated by the neighboring carpentry and furniture workshop known as [Nombre 004] (see evidence attached to the record).\n\nOn May 14, 2026, the protected party filed a second formal complaint with the Health Governing Area of Abangares for the same reasons (see evidence attached to the record).\n\nOn June 5, 2026, the Health Governing Area of Abangares submitted a request to the Costa Rican Metrology Laboratory (LACOMET) for the calibration of the equipment required to carry out noise measurements (see report submitted by the respondent authorities).\n\nOn June 11, 2026, the Directorate of the Health Governing Area of Abangares issued technical report MS-DRRSCH-DARSA-IT-061-2026, stating that five confidential complaints had been filed against the establishments [Nombre 002] and [Nombre 003], that sanitary orders had been notified to both establishments, and that the noise measurements were pending completion because the equipment was in the calibration process (see report submitted by the respondent authorities).\n\nIV.- ON THE FUNDAMENTAL RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT. This Tribunal has on numerous occasions elaborated on the content of this right, recognized in Article 50 of the Constitution. Environmental protection is an appropriate mechanism for safeguarding and improving the quality of life of all persons, which necessitates the intervention of the Public Powers to address factors that may disrupt environmental balance and hinder individuals from developing and living in a healthy environment. The State is the guarantor of the protection and stewardship of the environment and natural resources. In this regard, monitoring and oversight of environmental matters and activities constitutes an essential State function; consequently, with respect to environmental protection, the roles of policy direction, control, and oversight in environmental matters fall to the State, carried out through its various administrative agencies.\n\nV.- ON CONSTITUTIONAL JURISDICTION IN ENVIRONMENTAL MATTERS. As this Chamber has consistently held in its jurisprudence, constitutional jurisdiction in environmental matters cannot be extended to the point of becoming a reviewer of the technical criteria set forth in regulations or applied by administrative authorities in environmental matters; rather, it is limited to determining whether the competent State agencies have fulfilled the obligation imposed upon them by Article 50 of the Constitution to act responsibly and in a timely manner with respect to environmental protection. It has also been held that the admissibility of a writ of amparo is conditioned upon establishing the existence of a disturbance of or threat to one or more of the rights or guarantees set forth in the Constitution or in the international human rights instruments ratified by the country. This latter circumstance underscores the eminently summary nature of the amparo proceeding, whose processing is not well suited to slow and complex evidentiary proceedings, or to the prior need to examine — with declaratory effect — whether infra-constitutional rights cited by the parties as part of the set of facts underpinning the writ of amparo or the statutory report actually exist, since it is evident that this falls outside the competence of this Chamber. In this situation, it is not appropriate for the Chamber to issue any pronouncement whatsoever (whether positive or negative) in these cases, because in order to determine whether fundamental rights have been violated, the dispute must first be resolved at the level of ordinary legality.\n\nVI.- ON THE STATE'S OBJECTIVE OBLIGATION TO PROTECT HUMAN LIFE. This Constitutional Tribunal has recognized the State's objective obligation to protect human life and has ruled on administrative omissions that jeopardize road safety and the physical integrity of persons. In this regard, it is pertinent to cite ruling Nº 2008-18443 of 18:01 hours on December 11, 2008, in which the following was stated:\n\n\"Before analyzing the specific case, it is useful to recall what this Chamber has stated regarding the State's objective obligation to protect human life. The right to life, frequently analyzed together with the right to physical integrity, has commonly been understood as a right of negative content — that is, its scope was limited to a claim against the State to refrain from taking actions aimed at eliminating the physical existence of persons, such as torture or the death penalty, or to punish through the criminal justice system those public officials and private individuals who threaten the life and integrity of others. Nevertheless, the current trend is to impose upon the State various positive obligations, in the sense that it must not only refrain from disturbing the physical existence of persons but must also act to protect them from the many dangers that threaten them, whether those dangers arise from the State's own actions, from the actions of other persons, or even from nature itself. This is why, for example, environmental issues have become, at least in our country, a matter of constitutional significance, since the right to a healthy and ecologically balanced environment has been elevated to the status of a fundamental right. It must be clarified, however, that the objective existence of a State obligation with respect to the protection of the right to life does not necessarily entail a subjective right of individuals to demand, through judicial bodies, that a specific measure be adopted; it does, however, entail the right to have appropriate measures taken in protection of that right, in the face of manifestly negligent conduct by public authorities. Consequently, the State acquires the obligation to regulate those areas of social life from which dangers to the physical existence of its inhabitants may arise, whether through legislation, regulations, agreements, or other measures relating to the organization and administrative procedures, together with individuals' subjective right to have this done diligently. Thus, the ability to judicially demand, through a writ of amparo, a specific type of State performance in fulfillment of its duty to protect the life and physical integrity of its inhabitants is restricted to the clear verification of an imminent danger to those rights, such that, for example, if a particular community were to consider it necessary to have a hospital for the care of its residents (or any other public works project), this is not the avenue through which that demand should be pursued — it should be pursued through the previously established mechanisms and before the competent bodies and entities, which must address the request and resolve its technical feasibility, which does not necessarily entail a positive response. From the foregoing, it follows that the intervention of constitutional jurisdiction is only viable in the face of demonstrated inaction by the State, through its competent bodies, in addressing the demands that the country's inhabitants exercise in pursuit of their rights (see in this regard ruling number 2003-11519 of ten hours and thirty minutes on the tenth of October, two thousand three).\"\n\nVII.- ON THE SPECIFIC CASE. After analyzing the evidentiary elements submitted, this Tribunal finds that the fundamental rights of the protected party have been violated. From the reports submitted by the representatives of the respondent authorities — which are treated as sworn statements with the legal consequences, including criminal ones, provided in Article 44 of the Act governing this Jurisdiction — and from the evidence submitted for resolution of the matter, it has been duly established that the protected party filed two formal complaints with the Health Governing Area of Abangares, on January 20 and May 14, 2026, alerting the authorities to the health impacts suffered by herself and her family as a result of the operation of a neighboring carpentry and furniture workshop that continuously emits sawdust, chemical odors, and excessive industrial noise.\n\nNotwithstanding the foregoing, as of the date of this ruling, the respondent authority has not provided an effective response to those complaints. While the Health Governing Area of Abangares claims to have addressed five confidential complaints against the establishments [Nombre 002] and [Nombre 003] and to have notified sanitary orders to both establishments, the fact remains that the follow-up on those orders is still pending. Likewise, the noise measurements have not been carried out, on the grounds that the equipment required for that purpose needs calibration — a calibration request that was only submitted to LACOMET on June 5, 2026, that is, after the filing of this writ of amparo.\n\nThe justification offered by the respondent authority regarding the impossibility of linking the protected party's complaints to those processed in the administrative forum, due to their confidential nature and the failure to indicate an exact address in the filing, is not admissible from a constitutional standpoint. It should be noted that the present case file contains the necessary evidence, on the basis of which the respondent could well have prepared the report required by this Constitutional Tribunal.\n\nIn this regard, as this Tribunal held in ruling No. 2008-18443, the State has the objective obligation to act diligently in the protection of the rights to life and physical integrity of its inhabitants, which includes addressing environmental complaints in a timely and effective manner when those complaints may compromise the health of persons. The intervention of constitutional jurisdiction is precisely warranted in the face of demonstrated State inaction in addressing the demands that the country's inhabitants exercise in pursuit of their rights.\n\nIn the specific case at hand, the situation complained of directly and continuously affects the protected party's and her family's right to a healthy and ecologically balanced environment, protected under Article 50 of the Constitution, as well as their right to health and to life. For the foregoing reasons, the proper course of action is to grant the present writ of amparo, as indicated in the operative part (parte dispositiva) of this ruling.\n\nVIII.- NOTE BY JUSTICE CASTILLO VÍQUEZ, REGARDING THE RIGHT TO PROMPT AND COMPLETE ADMINISTRATIVE JUSTICE. I have supported this Tribunal's position that when a litigant (justiciable) alleges a violation of the right to prompt and complete justice in the administrative forum, the body competent to hear the legal dispute is the Contentious-Administrative Courts and not this Chamber. However, with the recent enactment of Law No. 9097, the Ley de Regulación del Derecho de Petición, it has been established that this right is amenable to judicial protection by means of the writ of amparo established by Article 32 of the Ley de la Jurisdicción Constitucional, in relation to Article 27 of the Constitution of the Republic of Costa Rica, in those cases where the petitioner considers that the Administration's material actions, its administrative acts, or its response are affecting his or her fundamental rights. In my view, the newly enacted legislation does not require this Tribunal to modify its line of jurisprudence; pursuant to Article 7 of its own Act, it is for this Tribunal alone to define the scope of its own jurisdiction. Therefore, save for those constitutional-legal disputes that this Chamber itself has recognized as exceptional cases — which do fall within the scope of this jurisdiction through the constitutional guarantee proceeding of the writ of amparo — in all other cases, and for the reasons set forth by this Tribunal (ruling No. 2008-02545 of 8:55 hours on February 22, 2008), the competent bodies are the judges of the contentious-administrative jurisdiction, all of which is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and norms), and the relevant statutory provisions, based on a logical, systemic, and teleological interpretation of the legal order.\n\nIX.- NOTE BY JUSTICE SALAZAR ALVARADO. I am of the view that in environmental matters where the Public Administration has already intervened, the power to hear and resolve such matters lies with the contentious-administrative jurisdiction. Nonetheless, I do proceed to examine the merits of the case when other rights of the persons affected by the source of contamination are at stake, including health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Constitution), as is the case here, in which an apparent failure on the part of the Ministerio de Salud to address a complaint concerning impacts from dust, chemical odors, and excessive industrial noise originating from the property adjacent to the petitioner's home is alleged, thereby affecting the petitioner's right to enjoy a healthy, ecologically balanced environment and a dignified quality of life.\n\nX.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that, if any paper documents, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or technologically produced device have been submitted, such items must be retrieved from the office within a maximum period of 30 business days from notification of this ruling. Otherwise, any material not retrieved within this period will be destroyed, pursuant to the provisions of the \"Reglamento sobre Expediente Electrónico ante el Poder Judicial,\" approved by the Corte Plena in session No. 27-11 on August 22, 2011, Article XXVI, and published in Boletín Judicial number 19 on January 26, 2012, as well as pursuant to the agreement approved by the Consejo Superior del Poder Judicial in session No. 43-12 held on May 3, 2012, Article LXXXI.\n\nTHEREFORE:\n\nThe writ is hereby GRANTED. Consequently, ALEXANDER SÁNCHEZ CABO, in his capacity as Minister, and RICARDO MARTÍN DÍAZ CAJINA, in his capacity as Director of the Health Governing Area of Abangares, both of the Ministerio de Salud, or whoever may hold those positions, are hereby ordered to, within ONE MONTH from notification of this ruling, coordinate and take the necessary measures to ensure that inspections and technical measurements are conducted in the area of influence of the reported carpentry and furniture workshop ([Nombre 004]), adopt the appropriate sanitary measures in accordance with the results obtained, and notify the protected party of any rulings issued in response to her complaints. The respondent authorities are warned that, pursuant to Article 71 of the Act governing this jurisdiction, a sentence of three months to two years' imprisonment, or twenty to sixty day-fines, shall be imposed upon any person who receives an order that must be complied with or enforced, issued in a writ of amparo proceeding, and fails to comply with it or to cause it to be complied with, provided that the offense is not more severely punishable under another provision. The State is condemned to pay court costs, damages, and losses caused by the facts underlying this declaration, to be assessed in contentious-administrative enforcement of judgment proceedings.
