  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-017594-0007-CO \n\nRes. Nº 2026026416\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del catorce de julio de dos mil veintiseis .\n\n Recurso de amparo interpuesto por [Nombre 001], cédula de identidad número [Valor 001]; contra la ASAMBLEA LEGISLATIVA Y EL ESTADO. \n\nResultando:\n\n1.- Por escrito presentado por Gestión en Línea a las 15:30 horas del 18 de mayo de 2026, la parte recurrente interpone recurso de amparo y manifiesta que: “El presente recurso se fundamenta en la omisión y retraso injustificado en la puesta en agenda, discusión y votación en segundo debate y aprobación del Expediente Legislativo N° 23.166, denominado \"Adición de un nuevo artículo 31 bis a la Ley Orgánica del Ambiente, N° 7554 del 04 de octubre de 1995. Ley para garantizar pasos de fauna en infraestructuras\". I. HECHOS QUE FUNDAMENTAN EL RECURSO PRIMERO: El proyecto de ley 23.166 tiene como objetivo fundamental garantizar la construcción y mantenimiento de pasos de fauna en infraestructuras (carreteras, proyectos urbanísticos, etc.) que afecten la conectividad de los ecosistemas, con el fin de proteger la biodiversidad de nuestro país y evitar la muerte de miles de animales silvestres en nuestras vías. SEGUNDO: El proyecto ha superado las etapas previas de consulta institucional y cuenta con la viabilidad técnica requerida. Tal y como consta en el oficio CARTA-MOPT-SPS2026-296 del Ministerio de Obras Públicas y Transportes (Secretaría de Planificación Sectorial), el proyecto \"atiende las observaciones efectuadas con anterioridad e incluye las recomendaciones que se realizaron. Por lo tanto, reúne el criterio técnico ambiental y biológico emitido por ProGAS\". Asimismo, instituciones como el ICE (Oficio 0060-192- 2026) y el INAMU han manifestado no tener objeciones de fondo o adherirse a los criterios técnicos ambientales correspondientes. Y muchos otros entes públicos y privados consultados y que pueden ser vistos en los diferentes archivos del expediente. TERCERO: A pesar de contar con el respaldo técnico y de cumplir con todos los requerimientos legales y procedimentales para su aprobación final, la Asamblea Legislativa ha omitido someter a votación en segundo debate y aprobación de este proyecto. Esta dilación injustificada perpetúa la fragmentación de hábitats y la muerte de vida silvestre, generando un daño irreversible a nuestra biodiversidad. La urgencia y obligación constitucional de aprobar el Expediente Legislativo N° 23.166 radica en que la implementación de pasos de fauna no es un tema novedoso o de carácter puramente discrecional, sino un estándar técnico y jurídico ya consolidado y exigido tanto por el Poder Ejecutivo a los gobiernos locales, como por los organismos financieros internacionales al Estado costarricense. La omisión de la Asamblea Legislativa de dar el segundo debate a este proyecto genera un vacío legal, una grave asimetría normativa y la vulneración continua al artículo 50 constitucional, sustentado en los siguientes dos pilares.Actualmente existe una grave incongruencia en el ordenamiento jurídico costarricense. El Poder Ejecutivo, mediante el Decreto N° 40139-MOPT (Oficialización de la Norma Técnica para el Desarrollo y Conservación de la Red Vial Cantonal), publicado en La Gaceta el 23 de febrero de 2017, impuso una obligación directa, clara e ineludible a todas las municipalidades del país. El Artículo 17 (Gestión socio ambiental) de dicho cuerpo normativo establece textualmente: \"Las obras de mejoramiento y construcción de obra nueva que se desarrollen en la red vial cantonal se deberán realizar con apego a la normativa vigente en materia ambiental (...) las municipalidades deberán: (...) c) Implementar medidas que faciliten la conectividad y desplazamiento de la fauna silvestre en las rutas cantonales con la finalidad de minimizar la afectación resultante de la fragmentación provocada por las carreteras y su flujo vehicular.\" Resulta a todas luces ilógico y violatorio del principio de igualdad ante las cargas públicas y del derecho a un ambiente sano, que las vías cantonales (generalmente de menor velocidad, menor tránsito y administradas por gobiernos locales con presupuestos reducidos) tengan una obligación reglamentaria estricta de implementar medidas de conectividad de fauna, mientras que la Red Vial Nacional (administrada por CONAVI/MOPT, caracterizada por vías de alta velocidad, grandes barreras de asfalto y que son las principales causantes de atropellos y fragmentación de ecosistemas) carezca de una ley marco que estandarice esta obligación. La aprobación del proyecto de ley 23.166 viene precisamente a subsanar esta laguna, elevando la obligación a rango de ley para toda infraestructura, eliminando la asimetría actual. Además de la regulación vial cantonal, el Poder Ejecutivo ha reconocido recientemente la imperiosa necesidad de adaptar la infraestructura de servicios para proteger la biodiversidad. Mediante el Decreto N° 44329-MINAE (Oficialización de los Instrumentos para la Prevención y Mitigación de la Electrocución de Fauna Silvestre por Tendidos Eléctricos), publicado a inicios de 2024, el Estado costarricense ya exige la implementación de medidas preventivas y de mitigación para evitar la muerte de fauna silvestre en la infraestructura eléctrica nacional. Resulta un grave contrasentido jurídico que el Estado exija estándares rigurosos para mitigar el impacto de los tendidos eléctricos sobre la fauna, pero simultáneamente carezca de una ley nacional que garantice la construcción de pasos de fauna en la infraestructura vial, siendo las carreteras una de las principales y más letales barreras de fragmentación de hábitats en el país. Aprobar el proyecto 23.166 es el paso necesario para brindar coherencia y homologar la protección de la vida silvestre en toda obra de infraestructura, unificando los esfuerzos del MOPT y del MINAE bajo un mismo paraguas legal. Cumplimiento de los Criterios y Salvaguardas del Banco Interamericano de Desarrollo (BID): La carencia de una legislación nacional sobre pasos de fauna compromete la eficiencia en el desarrollo de la infraestructura del país frente a los estándares internacionales. Los principales financistas de la obra pública en Costa Rica, de manera muy particular el Banco Interamericano de Desarrollo (BID), exigen el cumplimiento de estrictas normativas socioambientales para el desembolso de créditos. Dentro del Marco de Política Ambiental y Social (MPAS) del BID, específicamente en su Norma de Desempeño 6 (Conservación de la Biodiversidad y Gestión Sostenible de los Recursos Naturales Vivos), se establece el mandato de mitigar los impactos directos, indirectos y acumulativos sobre la biodiversidad, exigiendo que los proyectos de infraestructura no generen una pérdida neta en hábitats naturales. Para el financiamiento de carreteras, esto se traduce indefectiblemente en el requerimiento técnico de diseñar y construir pasos de fauna (subterráneos y aéreos) y restaurar corredores biológicos. Al no existir una ley nacional (como la propuesta en el Exp. 23.166) que dicte los lineamientos estandarizados, cada proyecto de infraestructura que busca financiamiento del BID debe negociar y diseñar estas medidas desde cero, lo que genera retrasos millonarios en la preinversión e incertidumbre jurídica. Aprobar esta ley no solo protege nuestra fauna (mandato del Art. 50 Constitucional), sino que alinea automáticamente nuestro marco legal interno con los requisitos ineludibles de la banca multilateral, facilitando la viabilidad financiera de futuros proyectos de infraestructura del Estado. Mantener el proyecto 23.166 paralizado en la corriente legislativa sin someterlo a su votación final, equivale a permitir que el Estado costarricense siga diseñando infraestructura nacional con estándares ambientales inferiores a los que él mismo exige a las municipalidades (Decreto 40139-MOPT) y de espaldas a los lineamientos que la banca internacional (BID) ya obliga a cumplir, perpetuando de facto el daño irreversible a la biodiversidad y violentando el derecho fundamental a un ambiente ecológicamente equilibrado. II. FUNDAMENTOS DE DERECHO Y AGRAVIOS CONSTITUCIONALES 1. Violación al Artículo 50 de la Constitución Política: El Estado costarricense tiene la obligación ineludible de garantizar, defender y preservar un ambiente sano y ecológicamente equilibrado. La inacción legislativa frente a una solución ya estructurada (el proyecto 23.166) constituye una omisión que lesiona este derecho fundamental, pues permite que la infraestructura nacional siga desarrollándose como una barrera mortal para la fauna. 2. Incongruencia con la Normativa Vigente (Decreto N° 40139-MOPT): Resulta inadmisible que a nivel cantonal ya exista una obligación expresa y a nivel nacional se retrase su adopción por ley. El Decreto Ejecutivo N° 40139-MOPT (Oficialización de la Norma Técnica para el Desarrollo y Conservación de la Red Vial Cantonal), en su artículo 17, inciso c), ya obliga a las municipalidades a: \"Implementar medidas que faciliten la conectividad y desplazamiento de la fauna silvestre en las rutas cantonales con la finalidad de minimizar la afectación resultante de la fragmentación provocada por las carreteras y su flujo vehicular\". El proyecto 23.166 viene a estandarizar y elevar a rango de ley esta obligación indispensable, abarcando toda infraestructura. Decreto N° 44329-MINAE (Oficialización de los Instrumentos para la Prevención y Mitigación de la Electrocución de Fauna Silvestre por Tendidos Eléctricos), publicado a inicios de 2024 3. Incumplimiento de Estándares Internacionales y Financieros (Criterios del BID): La implementación de pasos de fauna no es un capricho, sino un estándar técnico exigido a nivel internacional. Entidades financieras multilaterales como el Banco Interamericano de Desarrollo (BID) ya exigen dentro de sus salvaguardas ambientales y sociales la incorporación de pasos de fauna y corredores biológicos como requisito indispensable para el financiamiento de infraestructura vial y desarrollo. Costa Rica, como país que se precia de su imagen verde, no puede operar al margen de estos estándares internacionales. 4. Acuerdos Internacionales y Leyes Nacionales: La falta de reglamentación general sobre pasos de fauna atenta contra los compromisos adquiridos por Costa Rica mediante el Convenio sobre la Diversidad Biológica (ratificado por Ley N° 7416), la Ley de Biodiversidad (N° 7788) y la Ley de Conservación de la Vida Silvestre (N° 7317). Todas estas normas exigen la protección de los ecosistemas, la cual es imposible si nuestras carreteras continúan siendo trampas mortales por falta de un mandato legal claro que obligue a la SETENA, al CONAVI y a los desarrolladores a construir infraestructuras de mitigación. III. PETITORIA Por lo anteriormente expuesto, con fundamento en los artículos 33 y siguientes de la Ley de la Jurisdicción Constitucional, solicito a esta Honorable Sala: 1. Se declare CON LUGAR el presente Recurso de Amparo por la omisión en la protección del derecho a un ambiente sano y ecológicamente equilibrado (Art. 50 Constitucional). 2. Se ordene al Directorio de la Asamblea Legislativa y a los órganos legislativos competentes que, de forma inmediata y prioritaria, procedan a agendar y someter a votación en segundo debate el Expediente Legislativo N° 23.166. 3. Se condene al Estado al pago de las costas, daños y perjuicios causados por esta omisión, en todos lo proyectos que como ya han ocurrido en otros recursos se requiere de estas infraestructuras para proteger la vida silvestre.” (sic). \n\n2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y,\n\nConsiderando:\n\n I.- OBJETO DEL RECURSO. La recurrente pretende acusar en esta vía la supuesta la omisión y retraso injustificado en la puesta en agenda, discusión y votación en segundo debate y aprobación del Expediente Legislativo N° 23.166, denominado \"Adición de un nuevo artículo 31 bis a la Ley Orgánica del Ambiente, N° 7554 del 04 de octubre de 1995. Ley para garantizar pasos de fauna en infraestructuras\". Señala que el proyecto de ley 23.166 tiene como objetivo fundamental garantizar la construcción y mantenimiento de pasos de fauna en infraestructuras (carreteras, proyectos urbanísticos, etc.) que afecten la conectividad de los ecosistemas, con el fin de proteger la biodiversidad del país y evitar la muerte de miles de animales silvestres en las vías. El proyecto ha superado las etapas previas de consulta institucional y cuenta con la viabilidad técnica requerida. Pese a esto, la Asamblea Legislativa ha omitido someter a votación en segundo debate y la respectiva aprobación de ese proyecto. Estima que esa dilación injustificada perpetúa la fragmentación de hábitats y la muerte de vida silvestre, generando un daño irreversible a la biodiversidad. Además, genera un vacío legal. Acusa que al no existir una ley nacional (como la propuesta en el Expediente 23.166) que dicte los lineamientos estandarizados, cada proyecto de infraestructura que busca financiamiento del BID debe negociar y diseñar estas medidas desde cero, lo que genera retrasos millonarios en la pre-inversión e incertidumbre jurídica. Aprobar esta ley no solo protege la fauna conforme al artículo 50 Constitucional, sino que alinea automáticamente el marco legal interno con los requisitos ineludibles de la banca multilateral, facilitando la viabilidad financiera de futuros proyectos de infraestructura del Estado. Solicita que se ordene al Poder Legislativo proceder de inmediato a agendar y someter a votación en segundo debate el Expediente Legislativo N° 23.166.\n\nII.- INADMISIBILIDAD DEL AMPARO. Vistos los reclamos y pretensiones de la recurrente es preciso señalar en primer término que, no le corresponde a esta Sala sustituir las competencias constitucionalmente asignadas al Poder Legislativo a efecto de determinar cuáles leyes deben promulgarse, su contenido y el orden en la agenda del Plenario Legislativo, toda vez que, esa labor corresponde al Poder Legislativo en ejercicio de su libertad de configuración de las leyes. Bajo tales circunstancias, si la amparada estima que el citado proyecto de ley debe aprobarse en segundo debate, así deberá gestionarlo ante la propia Asamblea Legislativa. En consecuencia, el amparo resulta inadmisible. \n\nIII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a la parte recurrente que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\nSe rechaza de plano el recurso.\n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at nine hours and twenty-five minutes on the fourteenth of July, two thousand twenty-six.\n\nWrit of amparo (recurso de amparo) filed by [Nombre 001], holder of national identity card (cédula de identidad) number [Valor 001]; against the ASAMBLEA LEGISLATIVA AND THE STATE.\n\nBackground:\n\n1.- By written submission filed through Gestión en Línea at 15:30 hours on May 18, 2026, the petitioner files a writ of amparo and states that: \"This writ is based on the unjustified omission and delay in scheduling, debating, and bringing to a vote in second reading (segundo debate) and approving Legislative Bill (Expediente Legislativo) N° 23.166, entitled 'Addition of a new Article 31 bis to the Ley Orgánica del Ambiente, N° 7554 of October 4, 1995. Law to Guarantee Wildlife Crossings in Infrastructure.' I. FACTS UNDERLYING THE WRIT FIRST: Legislative Bill 23.166 has as its fundamental objective to guarantee the construction and maintenance of wildlife crossings (pasos de fauna) in infrastructure (roads, urban development projects, etc.) that affect ecosystem connectivity (conectividad de los ecosistemas), in order to protect the biodiversity (biodiversidad) of our country and prevent the death of thousands of wild animals on our roads. SECOND: The bill has completed the prior stages of institutional consultation and has the required technical viability. As stated in letter CARTA-MOPT-SPS2026-296 from the Ministry of Public Works and Transportation (Sectoral Planning Secretariat), the bill 'addresses the previously made observations and incorporates the recommendations provided. Therefore, it meets the technical environmental and biological criteria issued by ProGAS.' Likewise, institutions such as ICE (Letter 0060-192-2026) and INAMU have stated that they have no substantive objections or that they adhere to the corresponding technical environmental criteria. And many other public and private entities were consulted, as can be seen in the various files of the legislative docket. THIRD: Despite having technical support and meeting all legal and procedural requirements for final approval, the Asamblea Legislativa has omitted to submit this bill to a vote in second reading and approval. This unjustified delay perpetuates habitat fragmentation (fragmentación de hábitats) and the death of wildlife, causing irreversible damage to our biodiversity. The urgency and constitutional obligation to approve Legislative Bill N° 23.166 lies in the fact that the implementation of wildlife crossings is not a novel matter or one of a purely discretionary nature, but rather a technical and legal standard already consolidated and required both by the Executive Branch (Poder Ejecutivo) of local governments and by international financial organizations of the Costa Rican State. The Asamblea Legislativa's failure to give this bill its second reading creates a legal gap (vacío legal), a serious normative asymmetry, and the ongoing violation of Constitutional Article 50, grounded in the following two pillars. There currently exists a serious inconsistency in the Costa Rican legal system. The Executive Branch, through Decree N° 40139-MOPT (Officializing the Technical Standard for the Development and Conservation of the Cantonal Road Network (red vial cantonal)), published in La Gaceta on February 23, 2017, imposed a direct, clear, and unavoidable obligation on all municipalities in the country. Article 17 (Socio-Environmental Management) of that regulatory body states verbatim: 'Works for the improvement and construction of new infrastructure carried out on the cantonal road network shall be executed in compliance with current environmental regulations (...) municipalities must: (...) c) Implement measures that facilitate connectivity and movement of wildlife along cantonal roads in order to minimize the impact resulting from the fragmentation caused by roads and their vehicular traffic.' It is manifestly illogical and in violation of the principle of equality before public burdens and of the right to a healthy environment, that cantonal roads (generally lower speed, lower traffic, and managed by local governments with reduced budgets) should bear a strict regulatory obligation to implement wildlife connectivity measures, while the National Road Network (managed by CONAVI/MOPT, characterized by high-speed roads, large asphalt barriers, and which are the primary cause of wildlife collisions and ecosystem fragmentation) lacks a framework law standardizing this obligation. The approval of Legislative Bill 23.166 is precisely meant to remedy this gap, elevating the obligation to the rank of law for all infrastructure, and eliminating the current asymmetry. In addition to cantonal road regulation, the Executive Branch has recently recognized the pressing need to adapt service infrastructure to protect biodiversity. Through Decree N° 44329-MINAE (Officializing the Instruments for the Prevention and Mitigation of Electrocution of Wildlife by Power Lines (tendidos eléctricos)), published in early 2024, the Costa Rican State already requires the implementation of preventive and mitigation measures to prevent the death of wildlife in national electrical infrastructure. It is a serious legal contradiction that the State should demand rigorous standards to mitigate the impact of power lines on wildlife, while simultaneously lacking a national law guaranteeing the construction of wildlife crossings in road infrastructure, given that roads are one of the primary and most lethal barriers to habitat fragmentation in the country. Approving Bill 23.166 is the necessary step to provide coherence and align wildlife protection across all infrastructure works, unifying the efforts of MOPT and MINAE under a single legal framework. Compliance with the Criteria and Safeguards (salvaguardas) of the Inter-American Development Bank (IDB): The lack of national legislation on wildlife crossings compromises the efficiency of the country's infrastructure development relative to international standards. The main financiers of public works in Costa Rica, and particularly the IDB, require compliance with strict social and environmental regulations for the disbursement of loans. Within the IDB's Environmental and Social Policy Framework (Marco de Política Ambiental y Social, MPAS), specifically in its Performance Standard 6 (Conservation of Biodiversity and Sustainable Management of Living Natural Resources), the mandate is established to mitigate direct, indirect, and cumulative impacts on biodiversity, requiring that infrastructure projects produce no net loss in natural habitats. For road financing, this invariably translates into the technical requirement to design and construct wildlife crossings (underground and overhead) and to restore biological corridors (corredores biológicos). In the absence of a national law (such as the one proposed in Exp. 23.166) establishing standardized guidelines, each infrastructure project seeking IDB financing must negotiate and design these measures from scratch, generating multi-million-dollar delays in pre-investment (pre-inversión) and legal uncertainty. Approving this law not only protects our wildlife (mandate of Constitutional Art. 50), but also automatically aligns our domestic legal framework with the unavoidable requirements of multilateral banking, facilitating the financial viability of future State infrastructure projects. Keeping Bill 23.166 stalled in the legislative process without subjecting it to a final vote is equivalent to allowing the Costa Rican State to continue designing national infrastructure to environmental standards lower than those it itself requires of municipalities (Decree 40139-MOPT) and in disregard of the guidelines that international banking (IDB) already requires to be met, perpetuating de facto irreversible damage to biodiversity and violating the fundamental right to an ecologically balanced environment. II. LEGAL GROUNDS AND CONSTITUTIONAL GRIEVANCES 1. Violation of Article 50 of the Political Constitution: The Costa Rican State has the unavoidable obligation to guarantee, defend, and preserve a healthy and ecologically balanced environment. Legislative inaction in the face of an already-structured solution (Bill 23.166) constitutes an omission that infringes this fundamental right, as it allows national infrastructure to continue being developed as a deadly barrier for wildlife. 2. Inconsistency with Current Regulations (Decree N° 40139-MOPT): It is inadmissible that an express obligation already exists at the cantonal level while its adoption by law is being delayed at the national level. Executive Decree N° 40139-MOPT (Officializing the Technical Standard for the Development and Conservation of the Cantonal Road Network), in its Article 17, paragraph c), already obligates municipalities to: 'Implement measures that facilitate connectivity and movement of wildlife along cantonal roads in order to minimize the impact resulting from the fragmentation caused by roads and their vehicular traffic.' Bill 23.166 is intended to standardize and elevate this indispensable obligation to the rank of law, encompassing all infrastructure. Decree N° 44329-MINAE (Officializing the Instruments for the Prevention and Mitigation of Electrocution of Wildlife by Power Lines), published in early 2024. 3. Non-Compliance with International and Financial Standards (IDB Criteria): The implementation of wildlife crossings is not a whim, but a technical standard required at the international level. Multilateral financial entities such as the IDB already require, as part of their environmental and social safeguards, the incorporation of wildlife crossings and biological corridors as an indispensable requirement for the financing of road infrastructure and development. Costa Rica, as a country that prides itself on its green image, cannot operate outside of these international standards. 4. International Agreements and National Laws: The lack of general regulations on wildlife crossings undermines the commitments undertaken by Costa Rica through the Convention on Biological Diversity (ratified by Ley N° 7416), the Ley de Biodiversidad (N° 7788), and the Ley de Conservación de la Vida Silvestre (N° 7317). All of these norms require the protection of ecosystems, which is impossible if our roads continue to be death traps due to the lack of a clear legal mandate obligating SETENA, CONAVI, and developers to construct mitigation infrastructure. III. PRAYER FOR RELIEF For the foregoing reasons, pursuant to Articles 33 and following of the Ley de la Jurisdicción Constitucional, I respectfully request that this Honorable Court: 1. GRANT the present Writ of Amparo based on the omission in protecting the right to a healthy and ecologically balanced environment (Constitutional Art. 50). 2. Order the Board of the Asamblea Legislativa (Directorio de la Asamblea Legislativa) and the competent legislative bodies to, immediately and as a priority, schedule and bring to a vote in second reading Legislative Bill N° 23.166. 3. Condemn the State to pay the costs, damages, and losses caused by this omission, in all projects that, as has already occurred in other writs, require such infrastructure to protect wildlife.\" (sic).\n\n2.- Article 9 of the Ley de la Jurisdicción Constitucional empowers the Court to reject outright or on the merits, at any time, even from the moment of filing, any petition presented for its consideration that proves to be manifestly inadmissible, or when it considers that sufficient elements of judgment exist to reject it, or that it constitutes a mere repetition or reproduction of a previously rejected petition that is equal or similar.\n\nThe opinion is authored by Justice Castillo Víquez; and,\n\nConsidering:\n\nI.- SUBJECT MATTER OF THE WRIT. The petitioner seeks to challenge through this proceeding the alleged unjustified omission and delay in scheduling, debating, and bringing to a vote in second reading and approving Legislative Bill N° 23.166, entitled \"Addition of a new Article 31 bis to the Ley Orgánica del Ambiente, N° 7554 of October 4, 1995. Law to Guarantee Wildlife Crossings in Infrastructure.\" The petitioner states that Legislative Bill 23.166 has as its fundamental objective to guarantee the construction and maintenance of wildlife crossings in infrastructure (roads, urban development projects, etc.) that affect ecosystem connectivity, in order to protect biodiversity in the country and prevent the death of thousands of wild animals on the roads. The bill has completed the prior stages of institutional consultation and has the required technical viability. Despite this, the Asamblea Legislativa has omitted to submit that bill to a vote in second reading and its corresponding approval. The petitioner considers that this unjustified delay perpetuates habitat fragmentation and the death of wildlife, causing irreversible damage to biodiversity. It also creates a legal gap. The petitioner alleges that, in the absence of a national law (such as the one proposed in Legislative Bill 23.166) establishing standardized guidelines, each infrastructure project seeking IDB financing must negotiate and design these measures from scratch, generating multi-million-dollar delays in pre-investment and legal uncertainty. Approving this law not only protects wildlife pursuant to Constitutional Article 50, but also automatically aligns the domestic legal framework with the unavoidable requirements of multilateral banking, facilitating the financial viability of future State infrastructure projects. The petitioner requests that the Legislative Branch be ordered to immediately schedule and bring to a vote in second reading Legislative Bill N° 23.166.\n\nII.- INADMISSIBILITY OF THE WRIT OF AMPARO. Having examined the claims and requests of the petitioner, it must first be noted that it is not the role of this Court to substitute itself for the constitutionally assigned powers of the Legislative Branch in determining which laws should be enacted, their content, and the order of the agenda of the Legislative Plenary (Plenario Legislativo), given that this task belongs to the Legislative Branch in the exercise of its legislative discretion (libertad de configuración de las leyes). Under these circumstances, if the petitioner considers that the aforementioned bill should be approved in second reading, she must pursue that matter before the Asamblea Legislativa itself. Consequently, the writ of amparo is inadmissible.\n\nIII.- DOCUMENTATION SUBMITTED TO THE RECORD. The petitioner is hereby notified that, should any paper documents, objects, or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or technology-produced device have been submitted, these must be retrieved from the court office within a maximum period of 30 working days from the notification of this judgment. Failing that, all material not retrieved within this period will be destroyed, pursuant to the provisions of the \"Reglamento sobre Expediente Electrónico ante el Poder Judicial,\" approved by Corte Plena in session N° 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in session N° 43-12 held on May 3, 2012, Article LXXXI.\n\nPor tanto:\n\nThe writ is rejected outright.\n\n\n\nFernando Castillo V.\nPresident\n\n\nFernando Cruz C.\n\n\nPaul Rueda L.\nLuis Fdo.
