San José, a las nueve horas veinte minutos del veintidos de julio de dos mil veintiseis .\n\nAcción de inconstitucionalidad promovida por [Nombre 001], cédula [Valor 001], en su condición de vicepresidenta, [Nombre 002], cédula [Valor 002], en su condición de vocal 2, [Nombre 003], con cédula [Valor 003], en su condición de tesorera y [Nombre 004], cédula [Valor 004], en su condición de vocal 3, todos de la ASOCIACIÓN DE DESARROLLO INTEGRAL DE LA RESERVA INDÍGENA DE TALAMANCA (BRIBRI); para que se declaren inconstitucionales el artículo 1° párrafo 2 de la Ley Indígena N.° 6172, artículo 5 del Decreto Ejecutivo N.° 13572, artículo 3 del Decreto Ejecutivo N.° 16307 y artículo 3 del Decreto Ejecutivo N.° 16306 y Decreto Ejecutivo N.° 5904-G. \n\n Resultando:\n\n 1.- Por escrito agregado al Sistema de Gestión de Despachos Judiciales de esta Sala a las 13:11 horas del 30 de mayo de 2026, los representantes de la Asociación accionante manifiestan que el pueblo Bríbri de Talamanca constituye una comunidad indígena ancestral cuya presencia en la región antecede a la colonización y cuyos derechos territoriales y de autonomía han sido históricamente reconocidos por el Estado costarricense. Afirma que, entre 1976 y 1985, el Estado emitió diversos decretos ejecutivos y normas que redefinieron y fragmentaron los territorios indígenas de Talamanca sin realizar consulta previa, libre e informada a los pueblos afectados, segregando a la comunidad Bríbri de Alto Coén de su territorio ancestral e incorporándola administrativamente al territorio Cabécar. Según los accionantes, esa reorganización territorial se consolidó mediante los decretos ejecutivos n.° 5904-G, 6036-G, 13572, 16306 y 16307, así como mediante la Ley Indígena n.° 6172. Sostiene que dichas disposiciones desconocieron la identidad histórica, cultural y territorial de la comunidad Bríbri de Alto Coén. Refieren que la comunidad de Alto Coén ha mantenido ininterrumpidamente su identidad Bríbri mediante el uso de su idioma, sus costumbres, su cosmovisión y sus estructuras sociales tradicionales. Señalan que los conflictos se intensificaron a partir de 2017, cuando la Asociación de Desarrollo Integral del Territorio Cabécar de Talamanca (ADITICA) comenzó a ejercer actos de administración sobre el territorio, incluyendo el nombramiento de docentes interculturales cabécares y el reclamo de tierras consideradas por la comunidad como parte de su territorio Bríbri. Asimismo, denuncian que funcionarios del INDER y representantes de ADITICA instalaron mojones identificando el área como “Territorio del Estado” y que se han otorgado derechos de posesión sobre tierras utilizadas tradicionalmente por la comunidad para el acceso a recursos naturales esenciales para su subsistencia y cultura. Los accionantes fundamentan su planteamiento en diversos instrumentos internacionales de derechos humanos relativos a la libre determinación de los pueblos indígenas, la igualdad y la no discriminación, entre ellos la Carta de las Naciones Unidas, la Declaración Universal de Derechos Humanos, el Convenio n.° 107 de la OIT y el Pacto Internacional de Derechos Económicos, Sociales y Culturales. Argumentan que las normas impugnadas vulneran el derecho a la consulta previa, libre e informada, el principio de igualdad y no discriminación y el derecho a la libre determinación de los pueblos indígenas, además de propiciar un proceso de asimilación forzada de la comunidad Bríbri de Alto Coén dentro del territorio Cabécar. Con fundamento en lo anterior, solicitan que se declare la inconstitucionalidad de las normas impugnadas, que se adopten medidas para garantizar la supervivencia cultural y territorial del pueblo Bríbri de Alto Coén y que se ordene la realización de una pericia antropológica destinada a acreditar la identidad histórica y cultural de esa comunidad. \n\n 2.- Para efectos de admisibilidad, los miembros representantes de la Asociación referida señalan que su legitimación deriva del artículo 75, párrafo 2° de la Ley de la Jurisdicción Constitucional en tanto acuden en defensa de los intereses difusos que afectan al colectivo Bríbri de Alto Coén, sus comunidades aledañas y sus estructuras comunitarias. \n\n3.- Mediante resolución de las once horas diecisiete minutos del dieciocho de junio de dos mil veintiséis, se previno a la asociación referida lo siguiente: “que, dentro del plazo de tres días contado a partir del día siguiente a la notificación de esta resolución, y bajo apercibimiento de denegar el trámite de la acción en caso de incumplimiento, aporte el escrito de interposición de la acción debidamente firmado por la presidenta de la Asociación, Hiden Cristina Mayorga Escalante, quien ostenta su representación judicial y extrajudicial. Asimismo, deberá aportar copia íntegra de los estatutos de la Asociación. Del mismo modo y sin perjuicio de lo anterior, conforme al artículo 4 de la Ley número 3245 del 3 de diciembre de 1963, se le previene adicionalmente que dentro del mismo plazo, agregue y cancele el timbre del Colegio de Abogados por la suma de doscientos setenta y cinco colones, correspondiente a la autenticación de esa firma, bajo el apercibimiento –en este caso- de no oír al omiso mientras no cumpla lo ordenado, sin retroacción de términos.”\n\n4.- Los accionantes, quienes se identifican como directivos y miembros activos vinculados a la Asociación de Desarrollo Integral de la Reserva Indígena Bríbri de Talamanca (ADITIBRI), comparecen dentro de la acción de inconstitucionalidad expediente n.° 26-019344-0007-CO para atender una prevención formulada por la Sala Constitucional. Explican que previamente promovieron una acción similar bajo el expediente n.° 26-012625-0007-CO, la cual fue rechazada porque la presidenta de la asociación se negó a firmar el escrito, alegando razones de orden interno. Sostienen que esa negativa no obedeció a ningún impedimento legal y que posteriormente la asamblea de la organización acordó retirarle las credenciales y desafiliarla, lo que generó conflictos internos actualmente discutidos en otro proceso judicial. Señalan que, ante la persistente negativa de la presidenta a firmar la nueva gestión, decidieron presentar la acción en calidad de directivos activos y representantes de los intereses colectivos del pueblo Bríbri de Alto Coén, con el fin de evitar mayores dilaciones en el acceso a la justicia constitucional. La acción impugna diversas normas relacionadas con la delimitación de los territorios indígenas de Talamanca, concretamente el Decreto Ejecutivo n.° 5904-G de 1976, la Ley Indígena n.° 6172 de 1977, el Decreto Ejecutivo n.° 13572 de 1982 y los Decretos Ejecutivos n.° 16306 y 16307 de 1985. Los accionantes sostienen que estas disposiciones segregaron a la comunidad Bríbri de Alto Coén de su territorio ancestral y la incorporaron al territorio Cabécar de Talamanca sin haber realizado una consulta previa, libre e informada al pueblo Bríbri afectado. Afirman que desde la ratificación del Convenio n.° 107 de la OIT el Estado ya estaba obligado a consultar a los pueblos indígenas sobre medidas que afectaran sus tierras, cultura y organización territorial. Según exponen, la comunidad de Alto Coén ha mantenido históricamente su identidad Bríbri, reflejada en su idioma, tradiciones, organización social, educación, prácticas culturales y relación con el territorio. Indican que durante décadas la comunidad ni siquiera tuvo conocimiento de que el Estado la había colocado dentro de la jurisdicción administrativa Cabécar, situación que comenzó a generar conflictos a partir de 2017 cuando la Asociación de Desarrollo Integral Cabécar de Talamanca (ADITICA) empezó a reclamar competencias sobre la zona, incluyendo decisiones relacionadas con educación y administración territorial. También denuncian que en 2021 funcionarios públicos y representantes de ADITICA colocaron mojones identificando el lugar como “Territorio del Estado” sin consulta previa a la comunidad. Los accionantes sostienen que las normas impugnadas vulneran el derecho a la libre determinación de los pueblos indígenas, el derecho a la consulta previa, libre e informada, el principio de igualdad y no discriminación y la prohibición de asimilación forzada. Alegan que la inclusión de Alto Coén dentro del territorio Cabécar ha favorecido actuaciones de terceros que buscan ejercer posesión sobre tierras utilizadas históricamente por la comunidad Bríbri para obtener agua, madera, plantas medicinales, recursos alimentarios y materiales de construcción tradicionales. A su juicio, ello amenaza la supervivencia cultural del pueblo Bríbri de Alto Coén y constituye una forma de discriminación y asimilación prohibida por instrumentos internacionales de derechos humanos. Como fundamento jurídico invocan la Carta de las Naciones Unidas, la Declaración Universal de Derechos Humanos, el Convenio n.° 107 de la OIT, el Pacto Internacional de Derechos Económicos, Sociales y Culturales, la jurisprudencia de la Corte Interamericana de Derechos Humanos en el caso Flor Freire vs. Ecuador y precedentes de la Sala Constitucional relacionados con igualdad y no discriminación. Argumentan que el Estado costarricense incumplió obligaciones internacionales al delimitar territorios indígenas sin consulta y al mantener vigente una normativa que, según afirman, continúa produciendo efectos discriminatorios contra la comunidad Bríbri de Alto Coén. En consecuencia, solicitan que se declare la inconstitucionalidad de las normas impugnadas; que se adopten medidas para garantizar la supervivencia del pueblo Bríbri de Alto Coén y su acceso a los recursos naturales vinculados a su territorio ancestral; y que se practique una pericia antropológica y cultural centrada en los habitantes mayores de la comunidad para acreditar su identidad histórica y cultural Bríbri. Asimismo, sostienen que actúan en defensa de intereses difusos y colectivos de la comunidad indígena de Alto Coén y de las comunidades aledañas\n\n5.- Mediante escrito presentado ante la Sala Constitucional el veintitrés de junio de dos mil veintiséis, Hiden Cristina Mayorga Escalante, mayor, abogada, portadora de la cédula de identidad N.° 701060227, vecina del territorio indígena Bríbri de Talamanca, Limón, en su condición de Presidenta en ejercicio con facultades de Apoderada General de la Asociación de Desarrollo Integral Indígena del territorio indígena Bríbri de Talamanca (ADITIBRI), en atención a la resolución de las once horas diecisiete minutos del dieciocho de junio de dos mil veintiséis, manifiesta que no ha tenido participación alguna en la estructuración, revisión y aprobación de la acción de inconstitucionalidad que ocupa a esta Sala, por cuanto la gestión no fue oportunamente rubricada por ella, dado que quienes la firmaron hicieron caso omiso a las observaciones que en su momento formuló. Expone tres razones que fundamentan su negativa a firmar la acción. En primer lugar, indica que de conformidad con la Ley sobre Desarrollo de la Comunidad N.° 3859 y su Reglamento, el presidente de las asociaciones de desarrollo ostenta un poder general y no generalísimo, siendo este último el instrumento de representación requerido para la interposición de una acción de inconstitucionalidad en la que se discuten intereses difusos o colectivos como en el presente caso, condición que únicamente puede otorgar la Asamblea General debidamente instalada y avalada por el quórum mayoritario de los afiliados activos, situación que echa de menos en este asunto. En segundo lugar, señala que la temática sometida al conocimiento de la Sala trasciende los intereses particulares de cualquier persona u órgano de dirección, por lo que de conformidad con el artículo 6 del Convenio N.° 169 de la OIT, debe consultarse de manera previa e informada a la población indígena involucrada en la controversia, agotando toda posibilidad de solución amigable del conflicto en observancia de los principios cosmogónicos que integran el derecho consuetudinario compartido por ambos pueblos, situación que a su criterio no se ha instrumentalizado. En tercer lugar, advierte que exponer a la junta directiva que preside y a la población que representa a una eventual condena en costas por la inobservancia de formalidades esenciales desde la interposición de la acción resulta inaceptable, por tratarse de etapas procedimentales que deben agotarse previamente y que no cuentan con plan remedial alguno. En consecuencia, la compareciente declara que no procederá a firmar la acción de inconstitucionalidad en los términos consignados por la Sala, sin perjuicio de valorar la pertinencia de presentar la gestión correspondiente una vez superadas las falencias que denuncia. Aclara expresamente que su manifestación no constituye una renuncia al ejercicio de las acciones constitucionales que pudieran corresponder a ADITIBRI ni un desistimiento respecto de la defensa de los derechos e intereses colectivos del pueblo Bríbri de Talamanca, sino que responde a la convicción de que cualquier gestión de esta naturaleza debe sustentarse en procedimientos participativos, transparentes y respetuosos de los derechos colectivos de los pueblos indígenas potencialmente afectados.\n\n 6.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n \n\n Redacta el Magistrado Castillo Víquez; y,\n\nConsiderando:\n\n I.- OBJETO DE LA ACCIÓN.- Se impugnan los artículos 1° párrafo 2 de la Ley Indígena N.° 6172, artículo 5 del Decreto Ejecutivo N.° 13572 , artículo 3 del Decreto Ejecutivo N.° 16307 y artículo 3 del Decreto Ejecutivo N.° 16306 y Decreto Ejecutivo N.° 5904-G.\n\nII.- SOBRE LA INADMISIBILIDAD DE LA ACCIÓN DE INCONSTITUCIONALIDAD. La presente acción de inconstitucionalidad fue interpuesta por varios miembros de la junta directiva de la Asociación de Desarrollo Integral de la Reserva Indígena de Talamanca Bríbri (ADITIBRI), quienes suscriben el escrito de interposición en su condición de directivos activos de esa organización. Mediante resolución de las once horas diecisiete minutos del dieciocho de junio de dos mil veintiséis, la Sala previno a la parte accionante para que compareciera a firmar el escrito de la acción la presidenta de la Asociación, en su calidad de representante legal de la organización. En respuesta a esa prevención, Hiden Cristina Mayorga Escalante, presidenta en ejercicio de ADITIBRI con facultades de Apoderada General, se apersonó mediante escrito del veintitrés de junio de dos mil veintiséis y manifestó expresamente que no procederá a firmar la acción de inconstitucionalidad, por cuanto no tuvo participación alguna en su estructuración, revisión y aprobación, y porque a su criterio la gestión adolece de formalidades esenciales que deben ser subsanadas previamente. Lo anterior pone de manifiesto que los gestionantes carecen de toda potestad legal para representar judicial o extrajudicialmente a la Asociación de Desarrollo Integral de la Reserva Indígena de Talamanca Bríbri (ADITIBRI), a través de la cual se pretende accionar este proceso. En efecto, la representación legal de esa organización recae en su presidenta, quien no solo no suscribió el escrito de interposición sino que, requerida expresamente por esta Sala para hacerlo, manifestó su negativa a hacerlo. Los restantes miembros de la junta directiva que suscribieron la acción no ostentan individualmente facultades de representación judicial de la asociación, ni acreditan haber sido autorizados para ello por el órgano competente. En esas condiciones, la acción carece de uno de los presupuestos procesales indispensables para su tramitación, cual es que quien la promueve cuente con capacidad para actuar en nombre de la persona jurídica cuyos intereses pretende defender. En razón de lo expuesto, la acción es inadmisible y debe ser rechazada de plano.\n\n III.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. San José, at nine hours and twenty minutes on the twenty-second of July, two thousand and twenty-six.\n\nAction of unconstitutionality (acción de inconstitucionalidad) filed by [Nombre 001], national identity card [Valor 001], in her capacity as vice-president, [Nombre 002], national identity card [Valor 002], in his/her capacity as second board member (vocal 2), [Nombre 003], national identity card [Valor 003], in her capacity as treasurer, and [Nombre 004], national identity card [Valor 004], in his/her capacity as third board member (vocal 3), all members of the ASOCIACIÓN DE DESARROLLO INTEGRAL DE LA RESERVA INDÍGENA DE TALAMANCA (BRIBRI); requesting that the following be declared unconstitutional: Article 1, paragraph 2 of the Ley Indígena N.° 6172, Article 5 of Decreto Ejecutivo N.° 13572, Article 3 of Decreto Ejecutivo N.° 16307, Article 3 of Decreto Ejecutivo N.° 16306, and Decreto Ejecutivo N.° 5904-G.\n\nResultando:\n\n1.- By written filing submitted to the Judicial Case Management System (Sistema de Gestión de Despachos Judiciales) of this Chamber at 13:11 hours on May 30, 2026, the representatives of the petitioner Association state that the Bríbri people of Talamanca constitute an ancestral indigenous community whose presence in the region predates colonization and whose territorial and autonomy rights have been historically recognized by the Costa Rican State. They assert that, between 1976 and 1985, the State issued various executive decrees and regulations that redefined and fragmented the indigenous territories of Talamanca without conducting prior, free, and informed consultation (consulta previa, libre e informada) with the affected peoples, thereby segregating the Bríbri community of Alto Coén from its ancestral territory and administratively incorporating it into the Cabécar territory. According to the petitioners, this territorial reorganization was consolidated through Decretos Ejecutivos N.° 5904-G, 6036-G, 13572, 16306, and 16307, as well as through the Ley Indígena N.° 6172. They maintain that these provisions disregarded the historical, cultural, and territorial identity of the Bríbri community of Alto Coén. They state that the community of Alto Coén has continuously maintained its Bríbri identity through the use of its language, customs, cosmovision (cosmovisión), and traditional social structures. They note that conflicts intensified starting in 2017, when the Asociación de Desarrollo Integral del Territorio Cabécar de Talamanca (ADITICA) began exercising administrative acts over the territory, including the appointment of Cabécar intercultural teachers and the claim of lands considered by the community to be part of its Bríbri territory. They also report that officials of INDER and representatives of ADITICA installed boundary markers (mojones) identifying the area as \"Territorio del Estado\" and that possession rights have been granted over lands traditionally used by the community for access to natural resources essential to their subsistence and culture. The petitioners base their claims on various international human rights instruments relating to the self-determination of indigenous peoples, equality, and non-discrimination, including the Charter of the United Nations, the Universal Declaration of Human Rights, ILO Convention No. 107, and the International Covenant on Economic, Social and Cultural Rights. They argue that the challenged norms violate the right to prior, free, and informed consultation, the principle of equality and non-discrimination, and the right to self-determination of indigenous peoples, while also fostering a process of forced assimilation (asimilación forzada) of the Bríbri community of Alto Coén within the Cabécar territory. On the basis of the foregoing, they request that the unconstitutionality of the challenged norms be declared, that measures be adopted to guarantee the cultural and territorial survival of the Bríbri people of Alto Coén, and that an anthropological expert assessment be ordered to certify the historical and cultural identity of that community.\n\n2.- For purposes of admissibility, the representative members of the aforementioned Association state that their standing derives from Article 75, paragraph 2 of the Ley de la Jurisdicción Constitucional, insofar as they appear in defense of the diffuse interests (intereses difusos) affecting the Bríbri collective of Alto Coén, its neighboring communities, and its community structures.\n\n3.- By means of a ruling issued at eleven hours and seventeen minutes on the eighteenth of June, two thousand and twenty-six, the aforementioned association was put on notice (prevenida) of the following: \"that, within a period of three days counted from the day following notification of this ruling, and under warning that the action will be denied if this requirement is not met, the filing of the action must be duly signed by the president of the Association, Hiden Cristina Mayorga Escalante, who holds its judicial and extrajudicial representation. Likewise, a complete copy of the Association's bylaws (estatutos) must be submitted. In addition, and without prejudice to the foregoing, pursuant to Article 4 of Law No. 3245 of December 3, 1963, the party is additionally put on notice that within the same period, it must attach and pay the Bar Association stamp tax (timbre del Colegio de Abogados) in the amount of two hundred and seventy-five colones, corresponding to the authentication of that signature, under the warning—in this case—that the party in default shall not be heard until compliance is achieved, without retroactive extension of deadlines.\"\n\n4.- The petitioners, who identify themselves as directors and active members affiliated with the Asociación de Desarrollo Integral Indígena del territorio indígena Bríbri de Talamanca (ADITIBRI), appear within the action of unconstitutionality, case file No. 26-019344-0007-CO, to respond to a notice issued by the SALA CONSTITUCIONAL. They explain that they previously filed a similar action under case file No. 26-012625-0007-CO, which was rejected because the president of the association refused to sign the filing, citing reasons of an internal nature. They maintain that this refusal was not based on any legal impediment and that the assembly of the organization subsequently resolved to revoke her credentials and disaffiliate her, which generated internal conflicts currently being addressed in separate legal proceedings. They state that, faced with the president's continued refusal to sign the new filing, they decided to present the action in their capacity as active directors and representatives of the collective interests of the Bríbri people of Alto Coén, in order to avoid further delays in accessing constitutional justice. The action challenges various norms related to the delimitation of the indigenous territories of Talamanca, specifically Decreto Ejecutivo N.° 5904-G of 1976, the Ley Indígena N.° 6172 of 1977, Decreto Ejecutivo N.° 13572 of 1982, and Decretos Ejecutivos N.° 16306 and 16307 of 1985. The petitioners maintain that these provisions segregated the Bríbri community of Alto Coén from its ancestral territory and incorporated it into the Cabécar territory of Talamanca without conducting prior, free, and informed consultation with the affected Bríbri people. They assert that from the ratification of ILO Convention No. 107, the State was already obligated to consult with indigenous peoples concerning measures affecting their lands, culture, and territorial organization. As they explain, the community of Alto Coén has historically maintained its Bríbri identity, reflected in its language, traditions, social organization, education, cultural practices, and relationship with the territory. They indicate that for decades the community was not even aware that the State had placed it within the Cabécar administrative jurisdiction, a situation that began to generate conflicts starting in 2017, when the Asociación de Desarrollo Integral Cabécar de Talamanca (ADITICA) began asserting competencies over the area, including decisions related to education and territorial administration. They also report that in 2021, public officials and representatives of ADITICA placed boundary markers identifying the location as \"Territorio del Estado\" without prior consultation with the community. The petitioners maintain that the challenged norms violate the right to self-determination of indigenous peoples, the right to prior, free, and informed consultation, the principle of equality and non-discrimination, and the prohibition of forced assimilation. They allege that the inclusion of Alto Coén within the Cabécar territory has favored the actions of third parties seeking to claim possession of lands historically used by the Bríbri community for obtaining water, timber, medicinal plants, food resources, and traditional building materials. In their view, this threatens the cultural survival of the Bríbri people of Alto Coén and constitutes a form of discrimination and assimilation prohibited by international human rights instruments. As legal grounds they invoke the Charter of the United Nations, the Universal Declaration of Human Rights, ILO Convention No. 107, the International Covenant on Economic, Social and Cultural Rights, the jurisprudence of the Inter-American Court of Human Rights in the case Flor Freire v. Ecuador, and precedents of the SALA CONSTITUCIONAL relating to equality and non-discrimination. They argue that the Costa Rican State failed to comply with international obligations by delimiting indigenous territories without consultation and by maintaining in force regulations that, as they assert, continue to produce discriminatory effects against the Bríbri community of Alto Coén. Consequently, they request that the unconstitutionality of the challenged norms be declared; that measures be adopted to guarantee the survival of the Bríbri people of Alto Coén and their access to the natural resources linked to their ancestral territory; and that an anthropological and cultural expert assessment focused on the community's elder residents be conducted to certify their historical and cultural Bríbri identity. They likewise maintain that they act in defense of the diffuse and collective interests of the indigenous community of Alto Coén and of neighboring communities.\n\n5.- By means of a written submission presented before the SALA CONSTITUCIONAL on the twenty-third of June, two thousand and twenty-six, Hiden Cristina Mayorga Escalante, of legal age, attorney, holder of national identity card No. 701060227, resident of the indigenous Bríbri territory of Talamanca, Limón, in her capacity as President in office with powers of General Attorney-in-Fact (Apoderada General) of the Asociación de Desarrollo Integral Indígena del territorio indígena Bríbri de Talamanca (ADITIBRI), in response to the ruling issued at eleven hours and seventeen minutes on the eighteenth of June, two thousand and twenty-six, states that she had no participation whatsoever in the drafting, review, and approval of the action of unconstitutionality before this Chamber, since the filing was not timely signed by her, given that those who signed it disregarded the observations she had raised at the time. She sets forth three reasons underlying her refusal to sign the action. First, she indicates that pursuant to the Ley sobre Desarrollo de la Comunidad N.° 3859 and its Regulations, the president of development associations holds a general power of attorney (poder general) and not a special unlimited power of attorney (poder generalísimo), the latter being the required instrument of representation for the filing of an action of unconstitutionality in which diffuse or collective interests are at stake as in the present case, a condition that can only be granted by the General Assembly duly convened and endorsed by the majority quorum of active members, a circumstance she finds lacking in this matter. Second, she notes that the subject matter submitted to the Chamber transcends the particular interests of any individual or governing body, so that pursuant to Article 6 of ILO Convention No. 169, the indigenous population involved in the dispute must be consulted in a prior and informed manner, exhausting every possibility of amicable resolution of the conflict in observance of the cosmogonic principles that form part of the customary law (derecho consuetudinario) shared by both peoples, a situation which in her view has not been implemented. Third, she warns that exposing the board of directors (junta directiva) she presides over and the population she represents to a potential award of costs (condena en costas) due to non-compliance with essential formalities from the outset of the action is unacceptable, as these are procedural stages that must be exhausted beforehand and for which no remedial plan exists. Consequently, the appearing party declares that she will not proceed to sign the action of unconstitutionality in the terms set out by the Chamber, without prejudice to assessing the appropriateness of filing the corresponding motion once the deficiencies she identifies have been remedied. She expressly clarifies that her statement does not constitute a waiver of the constitutional actions that may correspond to ADITIBRI, nor a withdrawal (desistimiento) with respect to the defense of the collective rights and interests of the Bríbri people of Talamanca, but rather reflects her conviction that any proceeding of this nature must be grounded in participatory, transparent procedures that are respectful of the collective rights of the potentially affected indigenous peoples.\n\n6.- Article 9 of the Ley de la Jurisdicción Constitucional empowers the Chamber to summarily reject (rechazar de plano) or reject on the merits, at any time, even upon filing, any matter brought before it that is manifestly inadmissible, or when it considers that there are sufficient grounds for rejection, or when it constitutes the mere reiteration or reproduction of a previously rejected identical or similar matter.\n\nThe opinion is drafted by Justice Castillo Víquez; and,\n\nConsiderando:\n\nI.- SUBJECT MATTER OF THE ACTION.- The following are challenged: Article 1, paragraph 2 of the Ley Indígena N.° 6172, Article 5 of Decreto Ejecutivo N.° 13572, Article 3 of Decreto Ejecutivo N.° 16307, Article 3 of Decreto Ejecutivo N.° 16306, and Decreto Ejecutivo N.° 5904-G.\n\nII.- ON THE INADMISSIBILITY OF THE ACTION OF UNCONSTITUTIONALITY. The present action of unconstitutionality was filed by several members of the board of directors of the Asociación de Desarrollo Integral de la Reserva Indígena de Talamanca Bríbri (ADITIBRI), who signed the filing in their capacity as active directors of that organization. By ruling issued at eleven hours and seventeen minutes on the eighteenth of June, two thousand and twenty-six, the Chamber put the petitioning party on notice to have the president of the Association, in her capacity as legal representative of the organization, appear to sign the filing. In response to that notice, Hiden Cristina Mayorga Escalante, President in office of ADITIBRI with powers of General Attorney-in-Fact, appeared by written submission of the twenty-third of June, two thousand and twenty-six, and expressly stated that she will not proceed to sign the action of unconstitutionality, as she had no participation whatsoever in its drafting, review, and approval, and because in her view the filing lacks essential formalities that must first be remedied. The foregoing makes clear that the petitioners have no legal authority whatsoever to represent the Asociación de Desarrollo Integral de la Reserva Indígena de Talamanca Bríbri (ADITIBRI), through which they seek to bring this proceeding, whether judicially or extrajudicially. Indeed, the legal representation of that organization is vested in its president, who not only did not sign the filing but, when expressly required by this Chamber to do so, manifested her refusal. The remaining members of the board of directors who signed the action do not individually hold powers of judicial representation of the association, nor do they demonstrate that they have been authorized to act in that capacity by the competent body. Under these circumstances, the action lacks one of the indispensable procedural prerequisites for its processing, namely that the party bringing it must have the capacity to act on behalf of the legal entity whose interests it seeks to defend. For the reasons set forth, the action is inadmissible and must be summarily rejected.\n\nIII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are hereby put on notice that if they have submitted any document in paper form, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the office within a maximum period of 30 business days counted from notification of this judgment.
