  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-018803-0007-CO \n\nRes. Nº 2026024830\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del dos de julio de dos mil veintiseis .\n\n Recurso de amparo que se tramita en expediente número 26-018803-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], a favor de [Nombre 002], cédula de identidad [Valor 002], contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AyA).\n\nRESULTANDO:\n\n1.- Por escrito presentado en la Secretaría de la Sala a las 17:56 horas del 26 de mayo de 2026, la parte recurrente interpone recurso de amparo contra el AyA. Manifiesta que la amparada es vecina de Desamparados Torremolinos, Calle Fallas, Urbanización el Futuro. Acusa que el Instituto Costarricense de Acueductos y Alcantarillados desde hace ocho meses quita el servicio de agua potable todos los días de lunes a domingo, de 5 a.m. a 12 p.m., a tres alamedas de la Urbanización el Futuro, lo que significa que dichas familias pasan 19 horas sin agua. Alega que la corta de agua reiterada ha provocado que varios miembros de dichas familias, incluidos adultos mayores y niños sean atendidos por la CCSS por diarreas y virus. Añade que las familias afectadas han acudido a las oficinas del AyA en Paseo Colón, pero los funcionarios se burlan o ignoran a los vecinos, sin brindar una solución. Acusa que el AyA cobra altas facturas por el servicio de agua pese a que, durante 19 horas diarias de lunes a domingo, dichas familias no tienen agua, situación que estima inaceptable y violatoria de derechos fundamentales. Solicita que se declare con lugar el recurso con las consecuencias de ley. \n\n2.- Por resolución de Presidencia de las 14:13 horas del 8 de junio de 2026, se dio curso al presente proceso y se le dio traslado al GERENTE GENERAL DEL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.\n\n3.- Por escrito incorporado al expediente digital a las 08:52 horas del 13 de junio de 2026, informa bajo juramento José Darío Guzmán Álvarez, en su condición de Gerente General del Instituto Costarricense de Acueductos y Alcantarillados, que el inmueble del recurrente se ubica en San José, Desamparados, Torremolinos, Urbanización El Futuro. La zona es abastecida por el tanque La Pelota, donde los registros técnicos cercanos demuestran que la presión general en la zona es óptima, oscilando diariamente entre 30 y 60 mca. La única afectación general programada ocurre los jueves debido al cierre preventivo del tanque. Tras una inspección de campo realizada el 9 de junio de 2026 mediante la orden N° 54651129, se constató que no existe un desabastecimiento crónico ni generalizado en las tres alamedas de la urbanización. La interrupción del flujo fue un problema puntual localizado exclusivamente en la última alameda, afectando únicamente a cinco (5) viviendas en total. Señala que no existen reportes previos según el sistema institucional OPEN-SCI no constaban órdenes de servicio ni reportes por fuga o falta de agua asociados al NIS 3325129 en los últimos 8 meses, y al no existir reportes registrados por el usuario, el área de Mantenimiento de Redes y Conexiones no tenía conocimiento previo de la avería local antes de la notificación del recurso de amparo. Debido a ello se realizaron revisiones técnicas y se detectada una anomalía de una obstrucción en la red de distribución de 50 mm el 10 de junio de 2026, por lo que de forma inmediata se desplazó una cuadrilla técnica bajo la orden de servicio N° 54651137 y se intervino y subsanó una obstrucción en la red de distribución restableciendo por completo el suministro continuo y óptimo de agua potable para las cinco viviendas afectadas, incluyendo la del recurrente. Adiciona que la afectación no son cortes selectivos o represalias; las suspensiones responden estrictamente a criterios de operación técnica o mantenimiento programado debidamente comunicados. El informe N° UEN-SCC-GAM-2026-02352 en resumen indica: Que de acuerdo con lo alegado por el recurrente que tres alamedas sufren desabastecimiento crónico de 19:00 horas diarias (de 5:00 a.m. a 12:00 p.m.) desde hace ocho meses. Acusa afectaciones a la salud de menores y adultos mayores, una mala atención de burlas e indiferencia en la Agencia de Paseo Colón y cobros excesivos en la facturación a pesar de la falta de agua. Señala la UEN-Servicio al Cliente Comercial GAM que el señor [Nombre 001], cédula [Valor 003], titular del NIS 3325129 ubicado en Urbanización El Futuro, lote 23, Desamparados, además informa que al consultar el sistema CRM de AyA en el año 2026, no constaban registros de interacciones, quejas por faltantes de agua o solicitudes de estudios de facturación a nombre del recurrente ni de la señora [Nombre 002]. Agregan que las únicas Inspecciones de Campo fueron las siguiente con los siguientes resultados: 25 de febrero de 2025 (O/S 50940033): Se realizó una revisión al hidrómetro (lectura: 3766m3 El inspector reportó que el medidor \"no registraba\" (descartando fuga interna hacia la propiedad en ese instante) y no había fugas en las conexiones. • 9 de junio de 2026 (O/S 54649551): Inspección reciente lectura: $4154 m3 donde se volvió a confirmar que el hidrómetro no registraba flujo por fugas, la caja de protección estaba en buen estado y el servicio abastece a dos viviendas. Se concluyó que no existen fugas técnicas ni comerciales imputables en el hidrómetro. Resalta que ante el escenario de afectación de la continuidad del servicio regulado por el artículo 97 del Reglamento para la Prestación de los Servicios de AyA (publicado en La Gaceta N° 27 del 9 de febrero de 2021 y sus reformas), se procedió a realizar un ajuste tarifario por el supuesto de \"Afectación por la continuidad del servicio\": Según lo indicado en el artículo anteriormente descrito, se procedió aplicar distribución de consumos a promedio real de 27m³ los periodos de marzo 2025 a agosto 2025, se aplica distribución de consumos a promedio real de 24m³ los periodos de setiembre 2025 a abril 2026, generando un saldo total a favor del usuario por ¢107,834.80 y se procedió a refacturar a consumo real el periodo de mayo 2026 a promedio real de 20m³ quedando la facturación por un monto de ¢35.660.00. Sobre la acción ejecutadas por AYA. Como se ha indicado la Macrozona Oeste GAM, que una vez localizado en la incidencia se ejecutaron las acciones inmediatas orientadas a la atención del desabastecimiento, mediante la intervención y subsanación de una obstrucción en la red de distribución restableciendo por completo el suministro continuo y óptimo de agua potable para las cinco viviendas afectadas, incluyendo la del recurrente. Además, como informó el área de la UEN-Servicio al Cliente Comercial GAM se han cumplido con los protocolos establecidos de recepción, validación y traslado oportuno de las incidencias reportadas por los recurrentes ajustes a las facturaciones afeadas observando para el presente caso se procedió a distribución de consumos a promedio real de 27m³ los periodos de marzo 2025 a agosto 2025, se aplica distribución de consumos a promedio real de 24m³ los periodos de setiembre 2025 a abril 2026, generando un saldo total a favor del usuario por ¢107,834.80 y se procedió a refacturar a consumo real el periodo de mayo 2026 a promedio real de 20m³ quedando la facturación por un monto de ¢35.660.00 según artículo 97 del Reglamento para la Prestación de los Servicios de AyA. En conclusión, se demuestra que la prestación del servicio en la zona donde se ubica la recurrente es afectada por una condición de fuerza o causa mayor, la cuales son atendidas con las condiciones técnicas establecidos por ente Regulador (ARESEP); así como las condiciones técnicas homologadas y reguladas por AyA en el REGLAMENTO PARA LA PRESTACIÓN DE LOS SERVICIOS publicado Diario Oficial La oficial La Gaceta ALCANCE NO 29 A LA GACETA NO 27 Año CXLIII San José, Costa Rica, martes 9 de febrero del 2021. Solicita a la Sala que declare sin lugar el recurso.\n\n4.- Por escrito incorporado al expediente digital a las 07:33 horas del 15 de junio de 2026, se apersona el recurrente con el fin de manifestar que desde el viernes 12 de junio de 2026 hasta el domingo 14 de junio del 2026 se estuvo sin agua las 24 horas y la restablecieron hasta el lunes 15 de junio de 2026, a las 5 a.m. y esto porque existe un recurso de amparo. Solicita a la Sala que declare con lugar el recurso.\n\n5.- En los procedimientos seguidos se han observado las prescripciones legales. \n\n Redacta el Magistrado Salazar Alvarado; y,\n\nCONSIDERANDO: \n\nI.- OBJETO DEL RECURSO. La parte recurrente indica que el Instituto Costarricense de Acueductos y Alcantarillados desde hace ocho meses quita el servicio de agua potable todos los días de lunes a domingo, de las 5:00 a las 24:00 horas, a tres alamedas de la Urbanización el Futuro, lo que significa que dichas familias pasan diecinueve horas sin agua. Alega que han acudido al AyA pero no les han ayudado. \n\nII.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial: \n\na) El inmueble del recurrente se ubica en San José, Desamparados, Torremolinos, Urbanización El Futuro, y esa zona es abastecida por el tanque La Pelota, donde los registros técnicos cercanos demuestran que la presión general en la zona es óptima, oscilando diariamente entre 30 y 60 mca (ver informe rendido bajo juramento).\n\nb) La única afectación general programada ocurre los días jueves debido al cierre preventivo del tanque (ver informe rendido bajo juramento).\n\nc) Tras una inspección de campo realizada el 9 de junio de 2026 mediante la orden N° 54651129, se constató que no existe un desabastecimiento crónico ni generalizado en las tres alamedas de la urbanización (ver informe rendido bajo juramento).\n\nd) La interrupción del flujo fue un problema puntual localizado exclusivamente en la última alameda, afectando únicamente a cinco viviendas en total (ver informe rendido bajo juramento).\n\ne) No existen reportes previos según el sistema institucional OPEN-SCI por fuga o falta de agua asociados al NIS 3325129 en los últimos ocho meses, de manera que al no existir reportes registrados por el usuario, el área de Mantenimiento de Redes y Conexiones no tenía conocimiento previo de la avería local (ver informe rendido bajo juramento).\n\nf) Se realizaron revisiones técnicas y se detectada una anomalía de una obstrucción en la red de distribución de 50 mm el 10 de junio de 2026, por lo que de forma inmediata se desplazó una cuadrilla técnica bajo la orden de servicio N° 54651137 y se intervino y subsanó una obstrucción en la red de distribución restableciendo por completo el suministro continuo y óptimo de agua potable para las cinco viviendas afectadas, incluyendo la del recurrente (ver informe rendido bajo juramento).\n\ng) Las suspensiones responden estrictamente a criterios de operación técnica o mantenimiento programado debidamente comunicados (ver informe rendido bajo juramento).\n\nIII.- SOBRE EL DERECHO FUNDAMENTAL AL SUMINISTRO DE AGUA POTABLE. Este Tribunal ha dispuesto, en otros asuntos similares, que como parte del Derecho de la Constitución existe un derecho fundamental al suministro de agua potable, siendo que específicamente en Sentencia N° 2003-4654 de las quince horas con cuarenta y cuatro minutos del veintisiete de mayo de dos mil tres, se dispuso, en lo conducente: \n\n“V.- La Sala reconoce, como parte del Derecho de la Constitución, un derecho fundamental al agua potable, derivado de los derechos fundamentales a la salud, la vida, al medio ambiente sano, a la alimentación y la vivienda digna, entre otros, tal como ha sido reconocido también en instrumentos internacionales sobre Derechos Humanos aplicables en Costa Rica: así, figura explícitamente en la Convención sobre la Eliminación de todas las formas de discriminación contra la mujer (art. 14) y la Convención sobre los Derechos del Niño (art. 24); además, se enuncia en la Conferencia Internacional sobre Población y el Desarrollo de El Cairo (principio 2), y se declara en otros numerosos del Derecho Internacional Humanitario. En nuestro Sistema Interamericano de Derechos Humanos, el país se encuentra particularmente obligado en esta materia por lo dispuesto en el artículo 11.1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales (\"Protocolo de San Salvador\" de 1988), el cual dispone que: “Artículo 11. Derecho a un medio ambiente sano 1. Toda persona tiene derecho a vivir en un medio ambiente sano y a contar con servicios públicos básicos”. Además, recientemente, el Comité de Derechos Económicos, Culturales y Sociales de la ONU reiteró que disponer de agua es un derecho humano que, además de ser imprescindible para llevar una vida saludable, es un requisito para la realización de todos los demás derechos humanos. VI.- Del anterior marco normativo se deriva una serie de derechos fundamentales ligados a la obligación del Estado de brindar los servicios públicos básicos, que implican, por una parte, que no puede privarse ilegítimamente de ellos a las personas, pero que, como en el caso del agua potable, no puede sostenerse la titularidad de un derecho exigible por cualquier individuo para que el Estado le suministre el servicio público de agua potable, en forma inmediata y dondequiera que sea, sino que, en la forma prevista en el mismo Protocolo de San Salvador, esta clase de derechos obligan a los Estados a adoptar medidas, conforme lo dispone el artículo primero del mismo Protocolo (…)”.\n\n IV.- SOBRE EL FONDO. En el sub lite, la parte recurrente alega que el Instituto Costarricense de Acueductos y Alcantarillados desde hace ocho meses quita el servicio de agua potable todos los días de lunes a domingo, de las 5:00 a las 24:00 horas, a tres alamedas de la Urbanización el Futuro, lo que significa que dichas familias pasan diecinueve horas sin agua. Alega que han acudido al AyA pero no les han ayudado. Al respecto, la Sala tiene por demostrado que el inmueble del recurrente se ubica en San José, Desamparados, Torremolinos, Urbanización El Futuro, y esa zona es abastecida por el tanque La Pelota, donde los registros técnicos cercanos demuestran que la presión general en la zona es óptima, oscilando diariamente entre 30 y 60 mca. La única afectación general programada ocurre los días jueves debido al cierre preventivo del tanque. Tras una inspección de campo realizada el 9 de junio de 2026 mediante la orden N° 54651129, se constató que no existe un desabastecimiento crónico ni generalizado en las tres alamedas de la urbanización. La interrupción del flujo fue un problema puntual localizado exclusivamente en la última alameda, afectando únicamente a cinco viviendas en total. No existen reportes previos según el sistema institucional OPEN-SCI por fuga o falta de agua asociados al NIS 3325129 en los últimos ocho meses, de manera que al no existir reportes registrados por el usuario, el área de Mantenimiento de Redes y Conexiones no tenía conocimiento previo de la avería local. Se realizaron revisiones técnicas y se detectada una anomalía de una obstrucción en la red de distribución de 50 mm el 10 de junio de 2026, por lo que de forma inmediata se desplazó una cuadrilla técnica bajo la orden de servicio N° 54651137 y se intervino y subsanó una obstrucción en la red de distribución restableciendo por completo el suministro continuo y óptimo de agua potable para las cinco viviendas afectadas, incluyendo la del recurrente. Las suspensiones responden estrictamente a criterios de operación técnica o mantenimiento programado debidamente comunicados. Ante este panorama, estima la Sala que se debe declarar sin lugar el recurso. Como puede apreciarse de los autos, la parte recurrente nunca denunció la situación ante el AyA. Al menos eso se indica bajo juramento. De hecho, en su escrito de interposición, el amparado omite aportar algún tipo de prueba documental que permita desacreditar lo informado bajo juramento. Ahora bien, ciertamente con ocasión del amparo los funcionarios del AyA se apersonaron a la zona afectada y lograron detectar la obstrucción que estaba causando el problema de desabastecimiento; empero, como se dijo, el AyA apenas tuvo conocimiento de la situación en virtud de este amparo ya que el interesado no presentó las denuncias correspondientes ante las instancias competentes del AyA. Debe recordarse que esta Sala no es una instancia tramitadora de denuncias, siendo que los administrados deben acudir ante la Administración para procurar resolver sus problemas, y no puede esta Sala intervenir en su favor para que las situaciones sean atendidas. El tutelado debió haber cumplido con los requisitos establecidos por el AyA para programar una visita de campo y así poder inspeccionar la zona y remediar el problema. Como ello no fue así, estima la Sala que no se conculcaron los derechos fundamentales del promovente. En todo caso, según se informa bajo juramento, el 10 de junio de 2026 se desplazó una cuadrilla técnica bajo la orden de servicio N° 54651137 y se intervino y subsanó una obstrucción en la red de distribución restableciendo por completo el suministro continuo y óptimo de agua potable para las cinco viviendas afectadas, incluyendo la del recurrente. Ergo, lo correspondiente es declarar sin lugar el amparo, como en efecto se dispone. \n\nV.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Debe prevenir esta Sala a las partes que, de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo de treinta días hábiles después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión N°27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial N°19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N°43-12 celebrada el 03 de mayo del 2012, artículo LXXXI. \n\nPOR TANTO: \n\nSe declara sin lugar el recurso.-\n\n \n\n \n\n \n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at 9:25 a.m. on 2 July 2026.\n\nAmparo proceeding processed in case file number 26-018803-0007-CO, filed by [Nombre 001], identity card [Valor 001], on behalf of [Nombre 002], identity card [Valor 002], against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (AyA).\n\nBACKGROUND:\n\n1.- In a written submission filed with the Chamber’s Secretariat at 17:56 on 26 May 2026, the applicant files an amparo proceeding against AyA. The applicant states that the person on whose behalf the amparo is brought lives in Desamparados Torremolinos, Calle Fallas, Urbanización el Futuro. The applicant alleges that, for the past eight months, the Costa Rican Institute of Aqueducts and Sewers has cut off the drinking-water service every day, Monday through Sunday, from 5 a.m. to 12 p.m., to three alamedas in Urbanización el Futuro, which means those families go 19 hours without water. The applicant alleges that the repeated water shutoffs have caused several members of those families, including older adults and children, to receive care from the CCSS for diarrhea and viruses. The applicant adds that the affected families have gone to AyA’s offices in Paseo Colón, but the officials mock the residents or ignore them without providing a solution. The applicant alleges that AyA charges high bills for the water service even though those families have no water for 19 hours a day, Monday through Sunday, a situation the applicant considers unacceptable and in violation of fundamental rights. The applicant asks that the proceeding be granted, with the legal consequences that follow.\n\n2.- By order of the Presidency issued at 14:13 on 8 June 2026, these proceedings were initiated and notice was given to the GENERAL MANAGER OF THE COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.\n\n3.- In a written submission added to the digital case file at 08:52 on 13 June 2026, José Darío Guzmán Álvarez, in his capacity as General Manager of the Costa Rican Institute of Aqueducts and Sewers, reports under oath that the applicant’s property is located in San José, Desamparados, Torremolinos, Urbanización El Futuro. The area is supplied by the La Pelota tank, where nearby technical records show that general pressure in the area is optimal, ranging daily from 30 to 60 mca. The only scheduled general impact occurs on Thursdays because the tank is preventively shut down. Following a field inspection carried out on 9 June 2026 under order N° 54651129, it was confirmed that there is no chronic or widespread shortage in the urbanization’s three alamedas. The flow interruption was a specific problem located exclusively in the last alameda, affecting only five (5) homes in total. He states that there are no prior reports: according to the institutional OPEN-SCI system, there were no service orders or reports of leaks or lack of water associated with NIS 3325129 in the last 8 months, and because the user had filed no reports, the Network and Connections Maintenance Area had no prior knowledge of the local breakdown before notice of the amparo proceeding. Accordingly, technical inspections were carried out, and an obstruction anomaly in the 50 mm distribution network was detected on 10 June 2026. A technical crew was immediately dispatched under service order N° 54651137, and an obstruction in the distribution network was addressed and remedied, fully restoring a continuous and optimal drinking-water supply to the five affected homes, including the applicant’s. He adds that the impact did not involve selective shutoffs or reprisals; suspensions are based strictly on technical operating criteria or duly communicated scheduled maintenance. Report N° UEN-SCC-GAM-2026-02352 states, in summary, that according to the applicant’s allegations, three alamedas have suffered a chronic shortage of 19:00 hours per day (from 5:00 a.m. to 12:00 p.m.) for eight months. The applicant alleges health impacts on minors and older adults, poor treatment involving mockery and indifference at the Paseo Colón Agency, and excessive billing despite the lack of water. UEN-Servicio al Cliente Comercial GAM states that Mr. [Nombre 001], identity card [Valor 003], the account holder for NIS 3325129 at Urbanización El Futuro, lot 23, Desamparados, further reports that a search of AyA’s CRM system for 2026 found no records of interactions, complaints about water shortages, or requests for billing reviews in the name of the applicant or Ms. [Nombre 002]. They add that the only field inspections were the following, with these results: 25 February 2025 (O/S 50940033): The water meter was inspected (reading: 3766m3). The inspector reported that the meter “was not registering” (thereby ruling out an internal leak into the property at that time), and there were no leaks in the connections. • 9 June 2026 (O/S 54649551): Recent inspection, reading: $4154 m3, which again confirmed that the water meter was not registering flow due to leaks; the protective box was in good condition, and the service supplies two homes. It was concluded that there were no technical or commercial leaks attributable to the water meter. He emphasizes that, given the impact on service continuity regulated by Article 97 of the AyA Regulation for the Provision of Services (published in La Gaceta N° 27 on 9 February 2021, as amended), a tariff adjustment was made on the basis of “Impact on service continuity”: As provided in the aforementioned article, consumption was allocated at an actual average of 27m³ for the periods from March 2025 to August 2025; consumption was allocated at an actual average of 24m³ for the periods from September 2025 to April 2026, generating a total credit balance in the user’s favor of ¢107,834.80; and the May 2026 period was rebilled based on actual consumption at an actual average of 20m³, leaving a bill in the amount of ¢35.660.00. Regarding the actions taken by AyA: As indicated by the GAM Western Macrozone, once the incident was located, immediate measures were taken to address the shortage by addressing and remedying an obstruction in the distribution network, fully restoring a continuous and optimal drinking-water supply to the five affected homes, including the applicant’s. In addition, as reported by UEN-Servicio al Cliente Comercial GAM, the established protocols for receiving, validating, and promptly forwarding incidents reported by applicants have been followed, along with adjustments to the affected bills. In this case, consumption was allocated at an actual average of 27m³ for the periods from March 2025 to August 2025; consumption was allocated at an actual average of 24m³ for the periods from September 2025 to April 2026, generating a total credit balance in the user’s favor of ¢107,834.80; and the May 2026 period was rebilled based on actual consumption at an actual average of 20m³, leaving a bill in the amount of ¢35.660.00, pursuant to Article 97 of the AyA Regulation for the Provision of Services. In conclusion, it is shown that service provision in the area where the applicant lives is affected by a force or major-cause condition, which is addressed under the technical conditions established by the regulatory authority (ARESEP), as well as the technical conditions standardized and regulated by AyA in the REGULATION FOR THE PROVISION OF SERVICES published in the Official Gazette, Official Gazette Supplement NO. 29 TO GAZETTE NO. 27, Year CXLIII, San José, Costa Rica, Tuesday, 9 February 2021. He asks the Chamber to dismiss the proceeding.\n\n4.- In a written submission added to the digital case file at 07:33 on 15 June 2026, the applicant appears to state that from Friday 12 June 2026 through Sunday 14 June 2026, there was no water for 24 hours, and service was restored only on Monday 15 June 2026, at 5 a.m., because an amparo proceeding had been filed. The applicant asks the Chamber to grant the proceeding.\n\n5.- The legal requirements have been observed in the proceedings.\n\nDrafted by Justice Salazar Alvarado; and,\n\nREASONS:\n\nI.- SUBJECT OF THE PROCEEDING. The applicant states that, for the past eight months, the Costa Rican Institute of Aqueducts and Sewers has cut off the drinking-water service every day, Monday through Sunday, from 5:00 to 24:00, to three alamedas in Urbanización el Futuro, which means those families go nineteen hours without water. The applicant alleges that they have gone to AyA but have not been helped.\n\nII.- FACTS FOUND. The following facts, relevant to deciding this matter, are considered duly established, either because they have been proven or because the respondent failed to address them, as required by the initial order:\n\na) The applicant’s property is located in San José, Desamparados, Torremolinos, Urbanización El Futuro, and that area is supplied by the La Pelota tank, where nearby technical records show that general pressure in the area is optimal, ranging daily from 30 to 60 mca (see report submitted under oath).\n\nb) The only scheduled general impact occurs on Thursdays because the tank is preventively shut down (see report submitted under oath).\n\nc) Following a field inspection carried out on 9 June 2026 under order N° 54651129, it was confirmed that there is no chronic or widespread shortage in the urbanization’s three alamedas (see report submitted under oath).\n\nd) The flow interruption was a specific problem located exclusively in the last alameda, affecting only five homes in total (see report submitted under oath).\n\ne) According to the institutional OPEN-SCI system, there were no prior reports of leaks or lack of water associated with NIS 3325129 in the last eight months. A technical crew was immediately dispatched under service order N° 54651137, and an obstruction in the distribution network was addressed and remedied, fully restoring a continuous and optimal drinking-water supply to the five affected homes, including the applicant’s (see report submitted under oath).\n\ng) The suspensions are based strictly on technical operating criteria or duly communicated scheduled maintenance (see report submitted under oath).\n\nIII.- ON THE FUNDAMENTAL RIGHT TO THE SUPPLY OF DRINKING WATER. In other similar matters, this Court has held that the Constitution’s body of law includes a fundamental right to the supply of drinking water. Specifically, in Judgment N° 2003-4654, issued at 15:44 on 27 May 2003, it held, in relevant part:\n\n“V.- The Chamber recognizes, as part of the Constitution’s body of law, a fundamental right to drinking water, derived from the fundamental rights to health, life, a healthy environment, food, and decent housing, among others, as has also been recognized in international human rights instruments applicable in Costa Rica. Thus, it is expressly set out in the Convention on the Elimination of All Forms of Discrimination against Women (Art. 14) and the Convention on the Rights of the Child (Art. 24); it is also set out in the Cairo International Conference on Population and Development (principle 2), and declared in numerous other instruments of international humanitarian law. Within the Inter-American Human Rights System, the country is particularly bound in this area by Article 11.1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (the 1988 “Protocol of San Salvador”), which provides: ‘Article 11. Right to a healthy environment. 1. Everyone has the right to live in a healthy environment and to have access to basic public services.’ In addition, the UN Committee on Economic, Social and Cultural Rights recently reiterated that access to water is a human right which, besides being essential to living a healthy life, is a requirement for the realization of all other human rights. VI.- The foregoing legal framework gives rise to a series of fundamental rights connected to the State’s obligation to provide basic public services. On the one hand, people may not be unlawfully deprived of those services; on the other, in the case of drinking water, it cannot be maintained that every individual holds an enforceable right to have the State provide drinking-water service immediately and wherever they may be. Rather, as provided in the same Protocol of San Salvador, these rights require States to adopt measures, as set out in Article 1 of that Protocol (…)”.\n\nIV.- ON THE MERITS. In this case, the applicant alleges that, for the past eight months, the Costa Rican Institute of Aqueducts and Sewers has cut off the drinking-water service every day, Monday through Sunday, from 5:00 to 24:00, to three alamedas in Urbanización el Futuro, which means those families go nineteen hours without water. The applicant alleges that they have gone to AyA but have not been helped. In this regard, the Chamber finds it established that the applicant’s property is located in San José, Desamparados, Torremolinos, Urbanización El Futuro, and that the area is supplied by the La Pelota tank, where nearby technical records show that general pressure in the area is optimal, ranging daily from 30 to 60 mca. The only scheduled general impact occurs on Thursdays because the tank is preventively shut down. Following a field inspection carried out on 9 June 2026 under order N° 54651129, it was confirmed that there is no chronic or widespread shortage in the urbanization’s three alamedas. The flow interruption was a specific problem located exclusively in the last alameda, affecting only five homes in total. According to the institutional OPEN-SCI system, there were no prior reports of leaks or lack of water associated with NIS 3325129 in the last eight months. Therefore, because the user had filed no reports, the Network and Connections Maintenance Area had no prior knowledge of the local breakdown. Technical inspections were carried out, and an obstruction anomaly in the 50 mm distribution network was detected on 10 June 2026. A technical crew was immediately dispatched under service order N° 54651137, and an obstruction in the distribution network was addressed and remedied, fully restoring a continuous and optimal drinking-water supply to the five affected homes, including the applicant’s. The suspensions are based strictly on technical operating criteria or duly communicated scheduled maintenance. In light of this, the Chamber considers that the proceeding must be dismissed. As can be seen from the case file, the applicant never reported the situation to AyA. At least, that is what is stated under oath. Indeed, in the written application, the amparo applicant fails to provide any documentary evidence that would discredit the information submitted under oath. Now, it is true that, in connection with the amparo, AyA officials went to the affected area and were able to detect the obstruction causing the shortage. However, as stated, AyA learned of the situation only through this amparo because the interested party had not filed the corresponding complaints with AyA’s competent offices. It should be remembered that this Chamber is not an office for processing complaints; persons subject to administrative authority must go to the Administration to seek to resolve their problems, and this Chamber cannot intervene on their behalf to have situations addressed. The person seeking protection should have complied with AyA’s requirements to schedule a field visit so that the area could be inspected and the problem remedied. Since that did not happen, the Chamber considers that the applicant’s fundamental rights were not violated. In any event, according to the report submitted under oath, on 10 June 2026 a technical crew was dispatched under service order N° 54651137, and an obstruction in the distribution network was addressed and remedied, fully restoring a continuous and optimal drinking-water supply to the five affected homes, including the applicant’s. Ergo, the proceeding must be dismissed, as is hereby ordered.\n\nV.- DOCUMENTATION SUBMITTED TO THE CASE FILE. This Chamber must advise the parties that, if they submitted any paper documents, as well as objects or evidence stored on any additional device, or in electronic, computer, magnetic, optical, telematic, or new-technology media, these must be collected from the court office within thirty business days after receipt of notice of this judgment. Otherwise, all such items will be destroyed pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court in session N°27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin N°19 of 26 January 2012, as well as the agreement approved by the Judicial Branch’s Superior Council at session N°43-12 held on 03 May 2012, Article LXXXI.\n\nTHEREFORE:\n\nThe proceeding is dismissed.-\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
