  "body_es_text": "\n\nExp: 26-019514-0007-CO \n\nRes. Nº 2026024858\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del dos de julio de dos mil veintiseis .\n\n \n\n Recurso de amparo que se tramita en expediente N° 26-019514-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el MINISTERIO DE SALUD.\n\nRESULTANDO:\n\n1.- Por escrito presentado en la Secretaría de la Sala a las 14:29 horas del 01 de junio de 2026, la parte recurrente interpone recurso de amparo contra el Ministerio de Salud, y manifiesta que el antiguo Relleno Sanitario de Río Azul corresponde a un sitio de disposición final de residuos sólidos debidamente clausurado, el cual se encuentra sujeto a obligaciones permanentes de monitoreo, mantenimiento y control ambiental, debido a la continua generación de lixiviados, biogás, asentamientos diferenciales y riesgos geotécnicos propios de este tipo de infraestructura. Indica que el Ministerio de Salud mantuvo vigente un contrato para la ejecución de obras de cierre técnico, post cierre, mantenimiento y control ambiental del sitio, el cual concluyó el 30 de noviembre de 2025. No obstante, tras la finalización de dicho contrato, no existe información pública conocida que permita acreditar la implementación de un mecanismo alternativo de mantenimiento y monitoreo geotécnico, ni el tratamiento adecuado de lixiviados, la conservación de drenajes, la estabilización de taludes o el mantenimiento integral de la planta de tratamiento. Asegura que diversos informes técnicos han advertido históricamente la existencia de riesgos asociados a la infiltración de aguas pluviales, la generación de lixiviados, la erosión superficial y la inestabilidad de taludes, así como la necesidad de ejecutar obras permanentes de mantenimiento y vigilancia. Señala que la ausencia de dichas labores puede provocar la saturación de los taludes del relleno sanitario, incrementando significativamente el riesgo de deslizamientos, derrumbes o fallas geotécnicas, con potencial afectación a las comunidades vecinas y al ambiente. Añade que la falta de operación y mantenimiento de la planta de tratamiento de lixiviados podría generar descargas sin el debido tratamiento hacia cuerpos receptores cercanos, incluida la quebrada Churuca, con el consiguiente riesgo de contaminación ambiental. Agrega que las comunidades de Río Azul, Tirrases y sectores circundantes han soportado durante décadas los impactos ambientales derivados de la operación histórica del relleno sanitario, por lo que existe un interés legítimo, actual y directo en que se garantice una adecuada gestión del post cierre del sitio. Indica que desde el 10 de diciembre de 2025, y a la fecha de interposición de este recurso no se tiene conocimiento de la presentación de nuevos Informes de Regencia Ambiental del Relleno Sanitario de Río Azul, lo cual agrava la situación denunciada, al impedir la verificación técnica del estado de los taludes, el manejo de lixiviados, el funcionamiento de la planta de tratamiento, el mantenimiento de drenajes y caminos internos, así como el cumplimiento de las demás obligaciones propias del cierre técnico y post cierre. Por lo expuesto, solicita a esta Sala que se le ordene a la autoridad recurrida informar cuáles medidas de mantenimiento, monitoreo y control se han ejecutado, realizar una inspección técnica en el sitio, así como medidas preventivas para evitar daños ambientales o riesgos para las comunidades vecinas.\n\n2.- Mediante la resolución de las 10:51 horas del 11 de junio de 2026, la Presidencia de esta Sala dio curso a este proceso y concedió audiencia al Ministro de Salud, sobre los hechos alegados por la parte recurrente.\n\n3.- Por escrito incorporado al expediente digital el 18 de junio de 2026, informa bajo juramento Alexander Sánchez Cabo, en su condición de Ministro de Salud, que según el oficio N°CARTA-MS-DSA-0153-2026, suscrito por el Dr. Christian Valverde Alpízar, Director Regional de Rectoría de la Salud Brunca con recargo de Director General de Salud y recargo de la Dirección de Salud Ambiental, y el Ing. Ricardo Morales Vargas, jefe de la Unidad de Normalización en Salud Ambiental, de la Dirección de Salud Ambiental:\n\n“En atención a lo solicitado en resolución electrónica de la Sala Constitucional, de fecha 11 de junio 2026, agradecemos la interposición de sus buenos oficios a fin de que solicite a dicha Sala, desestimar dicho recurso, por cuanto:\n\n1. Desde noviembre de 2025 se encuentra en el Sistema de Compras Públicas SICOP la licitación pública 2025XE-000008-0009200001, tramitada como licitación de emergencia. Se adjunta a continuación imagen de la actividad procesal generada por el Ministerio de Salud (Anexo 1).\n\n2. Debido a objeciones de potenciales oferentes, se dio trámite de éstas por la Contraloría General de la República, determinándose finalmente que debería tramitarse una licitación ordinaria.\n\n3. De forma previa y diligente se procedió concurrentemente a tramitar licitación ordinaria, 2025LY-000003-0009200001, la que se encuentra en periodo de evaluación de ofertas (Anexo 2), como se evidencia en el SICOP, por un monto aproximado de novecientos cuarenta y dos millones, presupuesto anual, contrato que puede ser ampliado por un plazo de 48 meses. Se adjuntan términos de referencia de ésta para su conocimiento. (MS-DSA-002-2026)\n\n4. Es importante acotar que, en ambas licitaciones, al igual a la que venció recientemente, se han incorporado los ítems que el recurrente señala, a saber, obligaciones permanentes de monitoreo, mantenimiento y control ambiental, debido a la continua generación de lixiviados, biogás, asentamientos diferenciales y riesgos geotécnicos propios de este tipo de infraestructura.\n\n5. A la fecha, y de conformidad con visitas realizadas al sitio en acompañamiento de empresas oferentes según se estableció en los términos del cartel, no se ha evidenciado ningún asentamiento diferencial o problema de manejo de aguas residuales\n\n6. De forma perentoria el Ministerio de Salud, a través de la Dirección de Salud Ambiental y la División Administrativa operan las obras monitoreo post-cierre del Relleno Sanitario Río Azul, incluyendo la operación de la planta de tratamiento de aguas residuales, que trata los lixiviados del relleno sanitario.\n\n7. Además, se ha gestionado Convenio Interinstitucional con el Ministerio de Seguridad Pública, quienes operan en el sitio una Dirección Regional, lo que permite controlar la seguridad en el sitio.\n\n8. No se omite manifestar que en respuesta solicitud previa, incoada por esa Sala, se generó respuesta al Sr. Nombre01, oficio DSA-UNSA-0170-2026 en que se remitió como adjunto información del estado actual de la estabilidad del terreno, Informe Técnico de Topografía IT-MS-DSA-UGSA-560-2026, mismo que se adjunta nuevamente para mejor resolver.\n\n9. Se notificó asimismo a esa Dirección de Asuntos Jurídicos sobre lo actuado, mediante DSA-UNSA-0171-2026, en fecha 3 de junio 2026. 10. Se concluye que la Administración ha dado curso a las necesidades de monitoreo ambiental, seguridad de la infraestructura, tratamiento de lixiviados, tratamiento de información topográfica disponible, de forma diligente; tramitando las licitaciones mencionadas (…)” (SIC).\n\n \n\nConsidera que las actuaciones desplegadas se han realizado en estricto apego al ordenamiento jurídico vigente. Recalca que, una vez concluida la vida útil de un relleno sanitario, se debe implementar de un programa o plan de acción que garantice su cierre técnico. Solicita se declare sin lugar el recurso.\n\n4.- Por escrito incorporado al expediente digital el 19 de junio de 2026, la parte recurrente replica el informe rendido por la autoridad recurrida.\n\n 5.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Araya García; y,\n\nCONSIDERANDO:\n\nI.- OBJETO DEL RECURSO. La parte recurrente alega que el Ministerio de Salud ha omitido sus obligaciones permanentes de monitoreo, mantenimiento y control ambiental, debido a la continua generación de lixiviados, biogás, asentamientos diferenciales y riesgos geotécnicos en el Relleno Sanitario Río Azul. Considera que tal negligencia afecta la salud de los vecinos y genera una afectación ambiental.\n\nII.- HECHOS PROBADOS. Se estiman como debidamente demostrados los siguientes hechos de importancia para la resolución del presente asunto:\n\na) El antiguo Relleno Sanitario de Río Azul, como sitio final de residuos sólidos, se encuentra clausurado, por lo que el Ministerio de Salud mantuvo un contrato para la ejecución de las obras de cierre técnico, post – cierre, mantenimiento y control ambiental del sitio (hecho no controvertido).\n\nb) El Ministerio de Salud inició el procedimiento de licitación ordinaria N°2025LY-000003-0009200001, la cual que se encuentra en periodo de evaluación de ofertas, estableciendo las obligaciones permanentes de monitoreo, mantenimiento y control ambiental, debido a la continua generación de lixiviados, biogás, asentamientos diferenciales y riesgos geotécnicos propios de ese tipo de infraestructura (véase informe rendido y prueba aportada por la autoridad recurrida).\n\nc) La Dirección de Salud Ambiental y la División Administrativa del Ministerio de Salud operan las obras monitoreo post – cierre del Relleno Sanitario Río Azul, incluida la operación de la planta de tratamiento (véase informe rendido y prueba aportada por la autoridad recurrida).\n\nd) Según las visitas de campo realizadas, el Relleno Sanitario Río Azul no evidencia asentamientos diferenciales ni problemas de manejo de aguas residuales (véase informe rendido y prueba aportada por la autoridad recurrida).\n\n III.- SOBRE EL DERECHO A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO. En reiteradas ocasiones, la jurisprudencia de esta Sala ha reconocido que la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos tanto a nivel constitucional como a través de la normativa internacional. Se ha indicado que el ejercicio legítimo de ese derecho requiere que los recursos sean utilizados de manera racional, y que corresponde al Estado la protección del ambiente, según el principio precautorio que rige en materia ambiental. Este principio obliga al Estado a disponer todo lo que sea necesario, dentro del ámbito permitido por la ley, a efectos de impedir que se produzcan daños irreversibles al ambiente, para cuyo efecto es responsable de lograr las condiciones sociales propicias a fin de que cada persona pueda disfrutar de su salud, entendido este derecho como una situación de bienestar físico, psíquico (o mental) y social (véase Sentencia Nº 1998-180 de las 16:24 horas del 13 de enero de 1998). La obligación objetiva del Estado en materia de protección ambiental no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los organismos judiciales, que se tome una medida determinada, pero sí a que se adopten las que sean idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades públicas, o bien, de personas físicas y jurídicas. De este modo, el Estado adquiere la obligación de regular las áreas de la vida social de las cuales puedan surgir peligros para la existencia física de los habitantes de su territorio así como también aquellas que vulneren el ambiente, lo cual puede hacer a través de leyes, reglamentos, acuerdos u otras medidas relacionadas con la organización y los procedimientos administrativos. En consecuencia, la posibilidad de exigir judicialmente, a través del recurso de amparo, un tipo específico de actividad prestacional por parte del Estado en cumplimiento de su deber de protección a la vida, salud o derecho al ambiente en beneficio de sus habitantes, está restringida a la clara verificación de un peligro inminente contra esos derechos de las personas. De lo que se desprende que la injerencia de la jurisdicción constitucional solamente es viable ante la inercia comprobada del Estado, a través de sus órganos competentes, en atender las demandas que en ejercicio de sus derechos realicen los habitantes del país.\n\n IV.- SOBRE EL FONDO. En el sub lite, la parte recurrente cuestiona que la autoridad sanitaria ha omitido sus obligaciones permanentes de monitoreo, mantenimiento y control ambiental, debido a la continua generación de lixiviados, biogás, asentamientos diferenciales y riesgos geotécnicos en el Relleno Sanitario Río Azul.\n\n Al respecto, la autoridad recurrida, en su informe rendido bajo la solemnidad del juramento -con oportuno apercibimiento de las consecuencias, incluso penales, previstas en el artículo 44, de la Ley que rige esta Jurisdicción- reconoce que si bien en la actualidad, el procedimiento de licitación ordinaria N°2025LY-000003-0009200001, se encuentra en periodo de evaluación de ofertas, siendo que se requiere del manejo posterior al cierre del relleno sanitario, aclara que la Dirección de Salud Ambiental y la División Administrativa del Ministerio de Salud operan las obras monitoreo post – cierre, incluida la operación de la planta de tratamiento. Además, según las visitas de campo realizadas, el Relleno Sanitario Río Azul no evidencia asentamientos diferenciales ni problemas de manejo de aguas residuales.\n\nAnte este panorama, resulta claro que la cartera ministerial recurrida, como máxima autoridad sanitaria, tiene la obligación de velar por la aplicación y el control del cumplimiento de las disposiciones de Ley General de Salud y de su reglamentación. En este sentido, se constata que sí se ha mantenido un control y vigilancia sobre el Relleno Sanitario Río Azul, en el tanto se consolida el procedimiento licitatorio establecido para continuar con las labores permanentes de monitoreo, mantenimiento y control ambiental, debido a la continua generación de lixiviados, biogás, asentamientos diferenciales y riesgos geotécnicos propios de ese tipo de infraestructura. Ahora bien, para la resolución del sub examine, es importante traer a colación los principios constitucionales en materia ambiental. Así, en la Sentencia N°2021-024807 de las 09:20 horas del 05 de noviembre de 2021, esta Sala precisó:\n\n“En este orden de ideas, la doctrina especializada ha señalado que el principio preventivo demanda que, cuando haya certeza de posibles daños al ambiente, la actividad afectante deba ser prohibida, limitada, o condicionada al cumplimiento de ciertos requerimientos. En general, este principio aplica cuando existen riesgos claramente definidos e identificados al menos como probables; asimismo, tal principio resulta útil cuando no existen informes técnicos o permisos administrativos que garanticen la sostenibilidad de una actividad, pero hay elementos suficientes para prever eventuales impactos negativos. Por otra parte, el principio precautorio señala que, cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente. De lo anterior, se advierte que el principio parte de una incertidumbre científica razonable en conjunto con la amenaza de un daño ambiental grave e irreversible. En términos generales, una diferencia relevante entre el principio preventivo y el precautorio radica en el nivel de conocimiento y certeza de los riesgos que una actividad u obra provoque. Mientras que en el primero existe tal certeza, en el segundo lo que se advierte es un estado de duda resultado de informaciones científicas o estudios técnicos”.\n\n \n\nAsí, el principio precautorio en materia ambiental obliga al Estado a actuar en aquello casos en que exista un riesgo ante un daño ambiental grave e irreversible, motivo por el cual la incertidumbre no puede utilizarse como argumento para no adoptar las acciones pertinentes. No obstante, conviene señalar que aunque el principio precautorio esté ligado a una incerteza científica, ello no implica que pueda ser empleado ilimitadamente, por cuanto se exige contar con un grado de identificación del peligro o del riesgo de forma cierta, real e inminente, lo que evidentemente varía en atención de las particularidades propias del caso concreto. Con la aclaración anterior, es importante señalar que los potenciales peligros expuestos por el recurrente -respecto a la salud de los vecinos y las eventuales afectaciones ambientales-, se tratan de hechos futuros e inciertos, sin una base objetiva clara. Nótese, que según lo indicado bajo la solemnidad del juramento, por parte de la autoridad recurrida, de las visitas de campo realizadas, el Relleno Sanitario Río Azul no evidencia asentamientos diferenciales ni problemas de manejo de aguas residuales, y se mantiene en monitoreo de la Dirección de Salud Ambiental y la División Administrativa del Ministerio de Salud. \n\nBajo esa inteligencia, al no evidenciarse una lesión a derecho fundamental alguno, lo procedente es declarar sin lugar el recurso en todos sus extremos, como en efecto se dispone.\n\nV.- RAZONES DIFERENTES DEL MAGISTRADO SALAZAR ALVARADO. Con el debido respeto, concuerdo con el voto de mayoría que declara sin lugar el recurso; sin embargo, lo fundamento con las siguientes razones:\n\nLa protección a un ambiente sano y ecológicamente equilibrado, en el Ordenamiento Jurídico Costarricense, está tutelado no solo en el artículo 50, de la Constitución Política, sino también en una serie de leyes y decretos ejecutivos (reglamentos) vigentes, tales como la Ley Orgánica del Ambiente, Ley N° 7554 de 4 de octubre de 1995; la Ley de Biodiversidad, Ley N° 7788 de 30 de abril de 1998; la Ley de Conservación de la Vida Silvestre, Ley N° 7317 de 21 de octubre de 1992; y el Decreto Ejecutivo N° 31849 de 24 de mayo de 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), para citar solo algunos. Esto hace necesario, en materia ambiental, separar el control de constitucionalidad del control de legalidad. En este sentido, es criterio del suscrito que esta Sala, por vía de amparo, solo debe conocer un asunto en que se alega violación al derecho a un ambiente sano y ecológicamente equilibrado, si la Administración no ha intervenido aún y cuando la violación a ese derecho sea manifiesta y evidente, de fácil constatación, de cierta importancia o gravedad y que afecte, de forma directa, a alguna persona o comunidad en concreto. De lo contrario, el tema debe plantearse y discutirse en la vía de legalidad. Por ello, el simple incumplimiento de obligaciones y deberes impuestos legalmente a las diversas administraciones públicas en materia ambiental es propio de ser conocido en la vía de legalidad –administrativa o jurisdiccional-, donde, con mucha mayor amplitud, podrán fiscalizarse los incumplimientos u omisiones que se acusen. Debe tenerse presente que el recurso de amparo es un proceso sumario, informal, sencillo y rápido, de manera tal, que desde el momento mismo en que la Administración interviene en un asunto ambiental, en ejercicio de sus competencias, y sustancia un procedimiento, con el dictado de actos administrativos, su conocimiento resulta ajeno al ámbito de acción de esta jurisdicción especializada. Por ello, la revisión de las actuaciones administrativas llevadas a cabo en torno a un tema ambiental que requiera, para su correcta valoración, de un proceso de conocimiento pleno, solo es posible en la jurisdicción ordinaria, toda vez que el diseño del proceso de amparo es incompatible con la contrastación o revisión de criterios técnicos o jurídicos elaborados al amparo de las normas legales o reglamentarias vigentes o con la evacuación de nuevos y mayores elementos de convicción necesarios para la contrastación o revisión de los criterios que ya consten en el expediente administrativo del caso. Lo contrario implicaría transformar el amparo en un proceso ordinario de pleno conocimiento, con lo cual se desnaturalizaría y se tornarían nugatorios los fines para los cuales ha sido diseñado, con lo cual, perdería su condición de instrumento para la tutela eficaz de los derechos fundamentales. Como consecuencia de lo anterior, estimo que cuando un ente u órgano público ha intervenido, en diversas formas, o ha dictado actos administrativos en relación con un asunto ambiental, su conocimiento y fiscalización corresponde a la jurisdicción de lo contencioso administrativo. Es, precisamente, la verificación de la existencia de esa intervención administrativa lo que determina que el asunto sea competencia de la vía legalidad. En consecuencia, este recurso debió haberse rechazado de plano, ya que su objeto es una cuestión propia de ser discutida, analizada y resuelta en la vía de legalidad. Empero, como no se hizo así, lo procedente es declararlo sin lugar, sin hacer pronunciamiento alguno con respecto al fondo de la cuestión planteada por corresponderle a la jurisdicción ordinaria, en específico, a la contencioso administrativa, determinar si las actuaciones y conductas administrativas acusadas se ajustan o no, en sustancia, a lo preceptuado en el ordenamiento jurídico de rango legal, en cuanto a la protección, tutela y conservación del derecho a un ambiente sano y ecológicamente equilibrado.\n\nVI.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes, que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del Despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta Sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPOR TANTO:\n\n Se declara sin lugar el recurso.   "body_en_text": "Exp: 26-019514-0007-CO\n\nRes. Nº 2026024858\n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours and twenty-five minutes on the second of July, two thousand twenty-six.\n\nWrit of amparo (recurso de amparo) filed under expediente N° 26-019514-0007-CO by Nombre01, national identification number CED01, against the MINISTERIO DE SALUD.\n\nBACKGROUND:\n\n1.- By written petition submitted to the Clerk's Office of this Chamber at 14:29 hours on June 1, 2026, the petitioner filed a writ of amparo against the Ministerio de Salud, and states that the former Relleno Sanitario de Río Azul constitutes a duly closed solid-waste final disposal site subject to permanent obligations of environmental monitoring, maintenance, and control, owing to the ongoing generation of leachate (lixiviados), biogas (biogás), differential settlements (asentamientos diferenciales), and geotechnical risks (riesgos geotécnicos) inherent to this type of infrastructure. The petitioner indicates that the Ministerio de Salud maintained a contract for the execution of technical closure (cierre técnico), post-closure (post cierre), maintenance, and environmental control works at the site, which expired on November 30, 2025. However, following the termination of that contract, no publicly available information is known to verify the implementation of an alternative geotechnical maintenance and monitoring mechanism, adequate leachate treatment, drainage upkeep, slope (taludes) stabilization, or comprehensive maintenance of the treatment plant (planta de tratamiento). The petitioner asserts that various technical reports have historically documented risks associated with stormwater infiltration, leachate generation, surface erosion, and slope instability, as well as the need for permanent maintenance and surveillance works. The petitioner indicates that the absence of such activities may lead to saturation of the sanitary landfill's (relleno sanitario) slopes, significantly increasing the risk of landslides, collapses, or geotechnical failures, with potential adverse effects on neighboring communities and the environment. The petitioner adds that the failure to operate and maintain the leachate treatment plant could result in untreated discharges into nearby receiving bodies of water, including the quebrada Churuca, with the consequent risk of environmental contamination. The petitioner further notes that the communities of Río Azul, Tirrases, and surrounding areas have borne for decades the environmental impacts resulting from the historical operation of the sanitary landfill, and that there is a legitimate, current, and direct interest in ensuring proper post-closure management of the site. The petitioner states that since December 10, 2025, and as of the date of filing this writ, no new Environmental Oversight Reports (Informes de Regencia Ambiental) for the Relleno Sanitario de Río Azul have come to public knowledge, which worsens the situation reported by preventing technical verification of the condition of the slopes, leachate management, operation of the treatment plant, maintenance of drainage systems and internal roads, and compliance with the other obligations inherent to technical closure and post-closure. In view of the foregoing, the petitioner requests that this Chamber order the respondent authority to report on what maintenance, monitoring, and control measures have been implemented, to conduct a technical inspection of the site, and to adopt preventive measures to avoid environmental harm or risks to neighboring communities.\n\n2.- By resolution issued at 10:51 hours on June 11, 2026, the President of this Chamber admitted this proceeding and granted the Minister of Health an opportunity to be heard regarding the facts alleged by the petitioner.\n\n3.- By written submission incorporated into the digital file on June 18, 2026, Alexander Sánchez Cabo, in his capacity as Minister of Health, reports under oath that, according to official communication N° CARTA-MS-DSA-0153-2026, signed by Dr. Christian Valverde Alpízar, Regional Director of Health Governance for the Brunca Region also serving as Director General of Health and head of the Dirección de Salud Ambiental, and by Engineer Ricardo Morales Vargas, head of the Unidad de Normalización en Salud Ambiental of the Dirección de Salud Ambiental:\n\n\"In response to the request set forth in the electronic resolution of the Sala Constitucional dated June 11, 2026, we appreciate your intercession in asking said Chamber to dismiss this writ, on the following grounds:\n\n1. Since November 2025, public tender 2025XE-000008-0009200001 has been available in the public procurement system SICOP, processed as an emergency tender (licitación de emergencia). Attached below is a screenshot of the procedural activity generated by the Ministerio de Salud (Anexo 1).\n\n2. Due to objections raised by prospective bidders, these were processed by the Contraloría General de la República, which ultimately determined that an ordinary public tender (licitación ordinaria) should be conducted.\n\n3. Proactively and concurrently, ordinary public tender 2025LY-000003-0009200001 was also initiated; it is currently in the bid evaluation stage (Anexo 2), as shown in SICOP, for an approximate annual budget of nine hundred forty-two million [colones], under a contract that may be extended for a period of 48 months. The terms of reference for this tender are attached for reference. (MS-DSA-002-2026)\n\n4. It is important to note that, in both tenders—as in the one that recently expired—the items identified by the petitioner have been incorporated, namely, permanent obligations of environmental monitoring, maintenance, and control, owing to the ongoing generation of leachate, biogas, differential settlements, and geotechnical risks inherent to this type of infrastructure.\n\n5. To date, and based on site visits conducted in the presence of prospective bidders as stipulated in the terms of the bidding specifications (cartel), no differential settlements or wastewater management problems have been observed.\n\n6. Without delay, the Ministerio de Salud, through the Dirección de Salud Ambiental and the División Administrativa, is operating the post-closure monitoring works at the Relleno Sanitario Río Azul, including the operation of the wastewater treatment plant, which treats the sanitary landfill's leachate.\n\n7. Furthermore, an inter-institutional agreement has been arranged with the Ministerio de Seguridad Pública, whose personnel operate a Regional Directorate at the site, thereby enabling security control over the facility.\n\n8. It should further be noted that in response to a prior request from this Chamber, a reply was sent to Mr. Nombre01 via official communication DSA-UNSA-0170-2026, to which was attached information on the current state of ground stability, specifically Technical Topography Report IT-MS-DSA-UGSA-560-2026, which is again attached hereto for a better resolution of this matter.\n\n9. The Dirección de Asuntos Jurídicos was likewise notified of the actions taken by way of communication DSA-UNSA-0171-2026, dated June 3, 2026. 10. It is concluded that the Administration has diligently addressed the environmental monitoring, infrastructure safety, leachate treatment, and topographic data processing needs by processing the aforementioned tenders (…)\" (SIC).\n\nHe considers that the actions taken have been carried out in strict compliance with the applicable legal framework. He emphasizes that once a sanitary landfill reaches the end of its operational life, a program or action plan must be implemented to ensure its technical closure. He requests that the writ be dismissed.\n\n4.- By written submission incorporated into the digital file on June 19, 2026, the petitioner filed a reply to the report submitted by the respondent authority.\n\n5.- The legal requirements applicable to these proceedings have been duly observed.\n\nThe opinion is authored by Justice Araya García; and,\n\nCONSIDERING:\n\nI.- SUBJECT MATTER OF THE WRIT. The petitioner alleges that the Ministerio de Salud has failed to fulfill its permanent obligations of environmental monitoring, maintenance, and control, owing to the ongoing generation of leachate, biogas, differential settlements, and geotechnical risks at the Relleno Sanitario Río Azul. The petitioner maintains that such negligence affects the health of neighboring residents and causes environmental harm.\n\nII.- PROVEN FACTS. The following facts are deemed duly established as relevant to the resolution of this matter:\n\na) The former Relleno Sanitario de Río Azul, as a solid-waste final disposal site, is closed, and the Ministerio de Salud maintained a contract for the execution of technical closure, post-closure, maintenance, and environmental control works at the site (undisputed fact).\n\nb) The Ministerio de Salud initiated ordinary public tender N° 2025LY-000003-0009200001, which is currently in the bid evaluation stage, establishing permanent obligations of environmental monitoring, maintenance, and control, owing to the ongoing generation of leachate, biogas, differential settlements, and geotechnical risks inherent to this type of infrastructure (see the report submitted and evidence provided by the respondent authority).\n\nc) The Dirección de Salud Ambiental and the División Administrativa of the Ministerio de Salud are operating the post-closure monitoring works at the Relleno Sanitario Río Azul, including the operation of the treatment plant (see the report submitted and evidence provided by the respondent authority).\n\nd) Based on field visits conducted, the Relleno Sanitario Río Azul shows no differential settlements or wastewater management problems (see the report submitted and evidence provided by the respondent authority).\n\nIII.- ON THE RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT. On repeated occasions, the jurisprudence of this Chamber has recognized that public health and the right to a healthy and ecologically balanced environment are protected both at the constitutional level and through international norms. It has been established that the legitimate exercise of that right requires that resources be used rationally, and that it falls to the State to protect the environment in accordance with the precautionary principle (principio precautorio) that governs environmental matters. This principle obliges the State to take all necessary measures, within the bounds permitted by law, to prevent irreversible damage to the environment; to that end, the State is responsible for fostering the social conditions that allow each person to enjoy health, understood as a state of physical, psychological (or mental), and social well-being (see Sentencia Nº 1998-180 of 16:24 hours on January 13, 1998). The objective obligation of the State with respect to environmental protection does not necessarily entail a subjective right of individuals to demand, through judicial bodies, that a specific measure be adopted; it does, however, entail the right that appropriate measures be taken to safeguard that right when public authorities, or natural or legal persons, engage in manifestly negligent conduct. In this manner, the State acquires the obligation to regulate those areas of social life from which dangers to the physical existence of its inhabitants may arise, as well as those that may harm the environment, which it may accomplish through laws, regulations, agreements, or other measures relating to administrative organization and procedures. Consequently, the ability to judicially demand, through the writ of amparo, a specific type of performance by the State in fulfillment of its duty to protect the life, health, or right to a healthy environment of its inhabitants is limited to clear verification of an imminent danger to those rights. It follows that intervention by the constitutional jurisdiction is only viable in the face of demonstrated inaction by the State, through its competent bodies, in addressing the claims that inhabitants of the country make in the exercise of their rights.\n\nIV.- ON THE MERITS. In the sub lite, the petitioner questions the health authority's failure to fulfill its permanent obligations of environmental monitoring, maintenance, and control, owing to the ongoing generation of leachate, biogas, differential settlements, and geotechnical risks at the Relleno Sanitario Río Azul.\n\nIn this regard, the respondent authority, in its report submitted under the solemnity of oath—with timely notice of the consequences, including criminal ones, set forth in article 44 of the Law governing this Jurisdiction—acknowledges that while ordinary public tender N° 2025LY-000003-0009200001 is currently in the bid evaluation stage, and post-closure management of the sanitary landfill is required, the Dirección de Salud Ambiental and the División Administrativa of the Ministerio de Salud are operating the post-closure monitoring works, including the operation of the treatment plant. Moreover, based on field visits conducted, the Relleno Sanitario Río Azul shows no differential settlements or wastewater management problems.\n\nIn light of this situation, it is clear that the respondent ministerial portfolio, as the highest health authority, bears the obligation to oversee the application and enforcement of the provisions of the Ley General de Salud and its regulations. In this regard, it is established that monitoring and oversight of the Relleno Sanitario Río Azul have indeed been maintained while the tendering procedure established to continue the permanent environmental monitoring, maintenance, and control activities—necessitated by the ongoing generation of leachate, biogas, differential settlements, and geotechnical risks inherent to this type of infrastructure—is being consolidated. For the resolution of the sub examine, it is important to recall the constitutional principles applicable to environmental matters. Thus, in Sentencia N° 2021-024807 of 09:20 hours on November 5, 2021, this Chamber specified:\n\n\"In this regard, specialized doctrine has noted that the preventive principle (principio preventivo) requires that, when there is certainty of possible damage to the environment, the affecting activity must be prohibited, restricted, or made subject to compliance with certain requirements. In general, this principle applies when risks are clearly defined and identified as at least probable; this principle is likewise useful when there are no technical reports or administrative permits guaranteeing the sustainability of an activity, yet there are sufficient elements to foresee eventual negative impacts. On the other hand, the precautionary principle holds that, when there is a threat of serious and irreversible harm, lack of absolute scientific certainty shall not be used as grounds for postponing cost-effective measures to prevent environmental degradation. From the foregoing, it is evident that this principle rests on reasonable scientific uncertainty together with the threat of serious and irreversible environmental harm. In general terms, a relevant distinction between the preventive principle and the precautionary principle lies in the degree of knowledge and certainty regarding the risks that an activity or project may cause. In the former, such certainty exists; in the latter, what exists is a state of doubt arising from scientific information or technical studies.\"\n\nThus, the precautionary principle in environmental matters obliges the State to act in cases where a risk of serious and irreversible environmental harm exists, which is why uncertainty cannot be invoked as grounds for failing to adopt the pertinent actions. Nevertheless, it should be noted that although the precautionary principle is linked to scientific uncertainty, this does not mean it may be invoked without limitation, as it requires that the danger or risk be identified to a certain, real, and imminent degree, which obviously varies according to the specific circumstances of each case. With this clarification in mind, it is important to note that the potential dangers raised by the petitioner—with respect to the health of neighboring residents and possible environmental impacts—are future and uncertain events without a clear objective basis. It is notable that, as stated under the solemnity of oath by the respondent authority, field visits to the Relleno Sanitario Río Azul revealed no differential settlements or wastewater management problems, and the site remains under monitoring by the Dirección de Salud Ambiental and the División Administrativa of the Ministerio de Salud.\n\nAccordingly, since no violation of any fundamental right is apparent, the appropriate course of action is to dismiss the writ in all its aspects, as is hereby ordered.\n\nV.- SEPARATE REASONS OF JUSTICE SALAZAR ALVARADO. With due respect, I agree with the majority opinion dismissing the writ; however, I ground my agreement on the following reasons:\n\nThe protection of a healthy and ecologically balanced environment within the Costa Rican legal order is safeguarded not only in article 50 of the Constitución Política, but also through a series of laws and executive decrees (regulations) currently in force, such as the Ley Orgánica del Ambiente, Ley N° 7554 of October 4, 1995; the Ley de Biodiversidad, Ley N° 7788 of April 30, 1998; the Ley de Conservación de la Vida Silvestre, Ley N° 7317 of October 21, 1992; and Decreto Ejecutivo N° 31849 of May 24, 2004, Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), to cite just a few. This makes it necessary, in environmental matters, to separate constitutional review from legality review. In this regard, it is my view that this Chamber, by way of the writ of amparo, should only entertain a case alleging a violation of the right to a healthy and ecologically balanced environment if the Administration has not yet intervened and if the violation of that right is manifest and evident, easily verifiable, of some importance or gravity, and directly affects a specific person or community. Otherwise, the matter must be raised and resolved through the legality track. For this reason, mere non-compliance with obligations and duties legally imposed on the various public administrations in environmental matters is properly cognizable in the legality track—administrative or judicial—where non-compliance and omissions can be reviewed with far greater scope. It must be borne in mind that the writ of amparo is a summary, informal, simple, and expeditious proceeding, such that from the very moment the Administration intervenes in an environmental matter, in the exercise of its competencies, and conducts a procedure through the issuance of administrative acts, review of that matter falls outside the scope of this specialized jurisdiction. For this reason, review of administrative actions taken in connection with an environmental matter that, for proper assessment, requires full-cognizance proceedings is only possible before the ordinary courts, since the design of the amparo proceeding is incompatible with the comparison or review of technical or legal criteria developed under applicable statutory or regulatory norms, or with the gathering of new and additional elements of proof necessary to compare or review the criteria already on record in the administrative file. To hold otherwise would transform the writ of amparo into an ordinary full-cognizance proceeding, which would alter its essential nature and render nugatory the purposes for which it was designed, causing it to lose its character as an instrument for the effective protection of fundamental rights. As a consequence of the foregoing, I believe that when a public body or agency has intervened in various capacities, or has issued administrative acts in connection with an environmental matter, review and oversight of those acts fall within the jurisdiction of the administrative contentious courts. It is precisely the verification of the existence of such administrative intervention that determines that the matter falls within the competence of the legality track. Consequently, this writ should have been rejected at the outset, since its subject matter is a question that must be argued, analyzed, and resolved through the legality track. However, since that course was not taken, the appropriate outcome is to dismiss the writ, without making any ruling on the merits of the question raised by the petitioner, as it falls to the ordinary courts—specifically, the administrative contentious courts—to determine whether the administrative actions and conduct challenged are or are not, in substance, consistent with the provisions of the statutory legal order with respect to the protection, guardianship, and conservation of the right to a healthy and ecologically balanced environment.\n\nVI.- DOCUMENTATION SUBMITTED TO THE FILE. The parties are hereby notified that if any paper documents, objects, or evidence contained in any additional electronic, computing, magnetic, optical, telematic, or new-technology device have been submitted, they must be retrieved from the Office within a maximum period of thirty business days, counted from notification of this Judgment.
