  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-004551-0007-CO \n\nRes. Nº 2026025631\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del diez de julio de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre01, cédula de identidad CED02, a favor de Nombre02, cédula de identidad CED03, contra la MUNICIPALIDAD DE OREAMUNO y el MINISTERIO DE AGRICULTURA Y GANADERÍA (MAG). \n\nResultando:\n\n1.- Mediante escrito recibido en la Secretaría de la Sala el 9 de febrero de 2026, el recurrente interpuso recurso de amparo contra la Municipalidad de Oreamuno y Ministerio de Agricultura y Ganadería. Manifiesta que la amparada Nombre02 es propietaria de un lote, número de registro: 252730-000, y vivienda ubicados 350 metros este y 50 metros sur de la Dirección01, Boqueron, Cipreses, Oreamuno, Cartago, en los cuales reside junto con su familia. Alega que el lote colindante ha sido intervenido para actividades agrícolas, realizándose zanjas, canales y otras obras artificiales destinadas a manipular y dirigir el agua pluvial. Como consecuencia de dichas intervenciones, las aguas de lluvia no siguen su escurrimiento natural, sino que son concentradas y dirigidas hacia la propiedad de la amparada y la de otro vecino colindante, Nombre03, provocando inundaciones recurrentes durante lluvias intensas. Producto del manejo artificial de las aguas pluviales proveniente del lote colindante, el agua se acumula y presiona directamente contra la tapia perimetral de la propiedad de la amparada, generando estancamientos constantes y riesgo de daño estructural. Debido a esta situación, y ante la ausencia de una solución efectiva por parte de las autoridades recurridas, la amparada se ha visto obligada a realizar una perforación (hueco) en la tapia, con el único fin de permitir el paso del agua y evitar daños mayores a la estructura, lo cual evidencia la gravedad, continuidad y materialización del daño. Esta situación ha generado afectaciones directas al terreno y a la vivienda, riesgo estructural, deterioro del suelo y condiciones que comprometen la salubridad y la seguridad, constituyendo un daño real, actual y continuo. Afirma que tanto la Municipalidad de Oreamuno como el Ministerio de Agricultura y Ganadería tienen pleno conocimiento de la problemática descrita, ya que han realizado visitas e inspecciones en el sitio. Agrega que en el caso del MAG, ha mantenido comunicación por medio de correos electrónicos con la funcionaria de dicha institución, doña Maritza Araya, jefa de agencia, en los cuales se solicitó formalmente la intervención técnica, se realizaron inspecciones y se indicó que los canales y el manejo del agua estaban \"correctamente realizados\". Pese a lo anterior, las inundaciones y afectaciones continúan ocurriendo, sin que se haya adoptado una solución efectiva ni correctiva por parte de las autoridades recurridas. Añade que la Municipalidad de Oreamuno, aún teniendo conocimiento del caso y siendo responsable del control territorial y la protección de propiedades colindantes, ha omitido ejercer acciones concretas y eficaces para detener la afectación. El MAG ha emitido criterios técnicos que priorizan aspectos productivos, sin valorar adecuadamente el impacto real y lesivo que el manejo artificial de aguas genera sobre derechos fundamentales de terceros.\n\n2.- Por resolución de las 8:55 horas del 17 de febrero de 2026, se dio curso al proceso y se confirió audiencia al alcalde de la Municipalidad de Oreamuno, así como al ministro y jefa de la Agencias de Extensión Agropecuaria de Pacayas, ambos del Ministerio de Agricultura y Ganadería, sobre los hechos alegados por el recurrente.\n\n3.- Por escrito recibido en la Secretaría de la Sala el 27 de febrero de 2026, informa bajo juramento Erick Mauricio Jiménez Valverde, en su condición de alcalde de la Municipalidad de Oreamuno de Cartago, que: “(…) PRIMERO: Visto el recurso presentado por el señor Nombre01 a favor de la señora Nombre02, este gobierno local ignora los hechos alegados por el recurrente. Es completamente falso que el recurrente o la amparada hayan tramitado una denuncia formal en la Municipalidad de Oreamuno sobre los hechos narrados en este recurso de amparo. Se verificaron en los diversos departamentos para verificar sobre la solicitud o denuncia presentada por recurrentes. En este sentido, se les consultó a los departamentos de Desarrollo y Control Urbano, Unidad Técnica y Gestión Vial y la Contraloría de Servicios si tenían conocimiento del caso de los señores recurrentes. No obstante, no existen registros por medio de consecutivos por parte de la Plataforma de Servicios, ni los departamentos mencionados tienen requerimientos bajo esta queja presentada. Luego de una inspección en el lugar de los hechos acaecidos, se determinó que hubo una visita con personeros de MAG y el Departamento de Gestión Ambiental de la Municipalidad de Oreamuno en el mes de octubre del 2025 para verificar la denuncia interpuesta por un vecino colindante de la recurrente. El señor llamado Nombre03, portador de la cédula de identidad: CED01, propietario de la finca del Partido de Cartago, Folio real: 207162, Derecho: 000. También, a principios de febrero de 2026, el gestor ambiental municipal se apersonó al lugar de los hechos y recomendó una solución de como encausar las aguas (entubación) y se trasladara el desfogue a la cuneta. No obstante, los vecinos afectados no se ponen de acuerdo para brindar paso por sus propiedades de los tubos, que en un ámbito privado, tendrán que instalar para recoja las aguas llovidas. SEGUNDO: En la visita de campo se logró determinar que la problemática indicada por los recurrentes es un asunto de naturaleza privada. Efectivamente, la propiedad colindante de la señora Nombre02 pertenece al señor Nombre04, finca del Partido de Cartago, folio real: 271899, Derecho:000, quien es vecino con sembradíos o cultivos en un terreno con declive y las propiedades afectadas reciben el agua de lluvia. TERCERO: En la actualidad, la propiedad perteneciente al señor Nombre04, propietario de la finca mencionada, colindante con la propiedad de la señora Nombre02, realizó una caja de registro de aguas con los sedimentos, pero es insuficiente para detener las aguas corredizas en el terreno de cultivos. Ante esta situación, se recomendó al recurrente interponer una denuncia en el juzgado Agrario quien puede brindar un eventual traslado de aguas que de forma natural escurre por las laderas del terreno CUARTO: Por último, señalo que las afectaciones de la vivienda se generan en la parte trasera de la vivienda de la señora Nombre02 que está muy lejos de la calle principal, según se puede apreciar en las fotografías tomas en sitio. Asimismo, que las condiciones topográficas del terreno obligan a recibir las aguas de los vecinos que están debajo de la propiedad del señor Nombre04. También, se percibió que el señor Nombre04 ha tratado de canalizar las aguas, pero todas ellas fluyen a las propiedades porque no tiene una fuente de agua natural para desahogar las aguas de lluvia QUINTO: También, se apersonaron funcionarios del Ministerio de Agricultura y Ganadería, de la Dirección Regional Central Oriental, Agencia de Extensión Agropecuaria de Pacayas, quien citó en el oficio MAG-DNEA-RDCOR-EAE-PACAYAS-002-2026, del 02 de febrero de 2026, quien hace referencia a la Ley No. 7799; Ley de Uso, Manejo y Conservación de Suelos y el artículo 74 de su reglamento: \"Todos los terrenos adyacentes e inferiores topográficamente, están obligados a recibir las aguas que en forma natural o adecuadamente canalizadas , mediante prácticas o actividades para el manejo, conservación y recuperación de suelos, precipiten y fluyan de las fincas vecinas, sin que los propietarios de éstas puedan cerrar su paso u obstruir su libre escorrentía por medio de barreras u otras obras, de manera que se dé continuidad a las mismas de conformidad con lo establecido con los Planes de Área.\" Además, la Ley de Aguas No. 276 de acuerdo con los artículos 94, 97 y 98 menciona que estos conflictos deberán resolverse en los juzgados Agrarios del Ministerio Público, quienes solicitarán los criterios técnicos correspondientes para buscar una solución a los vecinos afectados. En lo que respecta, la Municipalidad estaría dispuesto asesorar y supervisar el eventual entubamiento en la vía pública (cunetas) ante una eventual servidumbre de aguas y la remisión de las aguas pluviales a la cuneta. SEXTO: Por último, señalo con todo respecto a los magistrados de la Sala Constitucional, que no existe violación de derechos fundamentales, siendo este un tema de legalidad ordinaria y no un asunto de constitucionalidad. Debiendo las partes acudir a la vía judicial competente como el juzgado Agrario para que resuelva este conflicto vecinal sobre las aguas naturales que corren por la topografia del terreno hacia las propiedades colindantes del señor Nombre04 (…)”.\n\n4.- Por escrito recibido mediante Gestión en Línea de la Sala el 27 de febrero de 2026, informan bajo juramento Víctor Julio Carvajal Porras y Maritza Araya Mora, por su orden ministro y jefa de la Agencia de Extensión Agropecuaria de Pacayas, ambos del Ministerio de Agricultura y Ganadería, que: “(…) PRIMERO: El día 6 de octubre del 2025, se recibió una comunicación en el WhatsApp personal de la Jefe Agencia de Extensión Agropecuaria de Pacayas, por parte de una funcionaria de la Municipalidad de Oreamuno, mediante el cual realizaba el reporte de la inundación de unas casas en Boquerón, por agua que provenía de una parcela agrícola. Con base en lo reportado, se coordinó una visita conjunta con funcionarios de la Municipalidad de Oreamuno, la cual se realizó el día 8 de octubre del 2025. SEGUNDO: La finca en la que se realizó la inspección, en ese momento, tenía zanahoria sembrada. En la inspección se encontró una porción de terreno sembrado, 1700 m2 aproximadamente, este terreno no posee un cuerpo de agua cercano, por lo que dirigen las aguas por medio de una zanja con gavetas y que termina en un tanque en la esquina inferior, que funciona de gaveta, el cual tiene una boca en donde el agua da hacia los vecinos ubicados topográficamente abajo. En el momento de la inspección ya se encontraba construida una tapia y ésta poseía el boquete mencionado en el recurso de amparo presentado. TERCERO: Para la atención del caso se pudo averiguar que, como parte de los antecedentes, la Municipalidad de Oreamuno había realizado una inspección a finales de octubre 2025, debido a que el vecino, que puso la primera denuncia a principios de octubre, volvió a tener afectación por las aguas. Quienes acudieron a la inspección realizaron su reporte vía correo electrónico, el cual transcribimos en el siguiente párrafo. Este correo fue copiado el 30 de octubre al MAG, y en el mismo, el funcionario de la Municipalidad de Oreamuno solicita a la Agencia de Extensión Agropecuaria de Pacayas que se dé seguimiento al caso. “Según lo solicitado se realizó inspección por reporte de incidencia Nº 2025-10-29-02240 relacionada con el ingreso de aguas a la propiedad del Señor Nombre03, portador de la cédula CED01 en la comunidad de Boquerón, distrito Cipreses. Finca folio real 3-207162-000 y catastro Nº C-0787913-2002. En el sitio se indica por parte del afectado que durante las lluvias de días anteriores han estado experimentando afectación por ingreso de agua a su propiedad; la cual proviene de una parcela colindante con su propiedad y dedicada a la producción agrícola, cuyas conservaciones están canalizadas directamente hacia las viviendas colindantes. Afirman los vecinos, que en ocasiones anteriores ha conversado con el propietario de la parcela, pero sin embargo no se ha logrado su colaboración al respecto. Se logra observar al momento de la inspección, que no existen daños estructurales a la vivienda, ni afectación a los enseres de esta. No obstante, se recomienda al afectado acudir al MAG para lo que corresponda”. CUARTO: Por parte del MAG, se han realizado varias visitas al sitio a saber: • 8 de octubre del 2025, ya antes mencionada, • 3 de noviembre del 2025, • 7 de noviembre del 2025, • 5 de febrero del año en curso, La parcela posee obras de conservación de suelo; siembra contra pendiente, utiliza gavetas para la deposición de sedimentos, en todos los linderos inferiores tiene sembrada una cerca viva como protección y amarre de los taludes, la parte más próxima a las casas la destinó a frutales, con cobertura de gramíneas, para evitar una mayor afectación, sin embargo, su terreno posee una pendiente que implica que por gradiente el agua se dirija hacia niveles más bajos, haciendo inevitable que se tenga que sacar las aguas de lluvia por las fincas aledañas, que se encuentran topográficamente abajo, es decir a las fincas de los afectados. QUINTO: En las distintas inspecciones que ha realizado el personal del MAG, se han realizado recomendaciones para mejorar algunos aspectos de manejo de agua, mismas que han sido acatadas por el denunciado, sin embargo, el problema real del terreno, es que por las características de la finca denunciada, esta no tiene donde depositar las aguas de lluvia canalizadas, por lo que topográficamente, la escorrentía va hacia las casas vecinas, no existiendo algún gravamen legal sobre las fincas vecinas a favor de la finca denunciada de salida o servidumbre de aguas, siendo que en estas fincas vecina se encuentran construidas viviendas, incluida la de doña Nombre02 , la cual fue recientemente construida. SEXTO: Como parte de la atención del caso, por parte del MAG, se ha tenido intercambio de correos electrónicos con el Recurrente, señor Nombre01, el último correo fue enviado día 8 de diciembre del 2025, mismo del que no se obtuvo respuesta alguna. SÉTIMO: Como parte de la atención de este caso, y en procura de obtener una solución al mismo, se han mantenido conversaciones en forma personal con otros afectados, pero no se llega a un acuerdo, pues evidentemente no quieren recibir las aguas en sus propiedades. Dentro de estas conversaciones, están las mantenidas con el dueño de la propiedad, don Nombre04, quien indicó que estaba dispuesto a dar los materiales necesarios para sacar las aguas por la propiedad de don Nombre01, pero los mismos no llegaron a un acuerdo. OCTAVO: Debido a que el hoy recurrente, vía correo de fecha 18 de noviembre, hace referencia a la Ley de Aguas N.º 276 (1942) (artículos 94, 97 y 98); en esa misma fecha la Agencia del MAG, realizó una consulta a Dirección de Aguas, cuya respuesta textual fue la siguiente: “Este tipo de temas se conocen y se resuelven en el juzgado agrario del Ministerio Público, quienes eventualmente nos pedirán criterio a nosotros para determinar el tipo de cauce relacionado con el asunto” Además, indicaron que podrían hacer una inspección, previa solicitud de uno de los afectados, información que le fue suministrada al Recurrente, vía correo electrónico. NOVENO: Adicionalmente y como parte de la atención de este caso, se realizó el planteamiento del mismo a la Unidad de Suelos del Instituto de Innovación y Transferencia en Tecnología Agropecuaria (INTA), en fecha 20 de noviembre del 2025, el cual al día siguiente emitió respuesta indicando: se recibió respuesta en el que se indica: “…Diríamos que, en este caso, lo mejor es hacer del conocimiento lo que dice este Decreto (De la Ley 7779) en lo que respecta al manejo, canalización y disposición final de las aguas pluviales y remitirlo a la Municipalidad y Dirección de Aguas y que se pronuncien”. También el 20 de noviembre del 2025 hice la consulta a la Asesoría Legal del MAG acerca de similitudes y diferencias entre lo que dicta la Ley de Aguas y Ley 7779 y respondió entre otras conclusiones lo siguiente, mediante CARTA-MAG-DM-DAJ-0036-2026 del 16 de enero del 2026: “…No se advierte una incongruencia normativa entre la Ley de Aguas y el Reglamento a la Ley de Uso, Manejo y Conservación de Suelos; por el contrario, se evidencia una complementación normativa, siendo la Ley de Aguas el parámetro interpretativo principal en materia de servidumbres de aguas”. DECIMO: El pasado 09 de febrero del 2026, se remitió por parte de la Agencia del MAG, el Oficio MAG-DNEA-RDCOR-AEA-PACAYAS 002-2026, dirigido a la Comisión Municipal de Emergencias de Oreamuno, en el que se evidencia el esfuerzo realizado por la Agencia de Extensión Agrícola del MAG de Pacayas, para darle seguimiento y solución al caso, ya que existe la preocupación de afectación de viviendas y vidas humanas, sin embargo, la solución se sale de las competencias del MAG, ya que no somos un ente sancionatorio, ni impositivo, somos un ente que emite recomendaciones, como lo hemos hecho, por lo que no tenemos potestad en determinar u ordenar, cuál de las fincas de los vecinos, debe de recibir las aguas de la parcela denunciada, que permita sacar las aguas fluviales al cordón de caño o cuneta de la vía pública. CONSIDERACIONES SOBRE EL CASO La atención de este tipo de casos y en especial el presente por parte de la Agencia de Extensión Agropecuaria en Pacayas, que se refiere al manejo de las aguas de lluvia y degradación del suelo; se hace en sustento a lo estipulado en la Ley número 7779; Ley de Uso, Manejo y Conservación de Suelos, y específicamente en el artículo 74 del Reglamento de la Ley 7779, que señala: “…Todos los terrenos adyacentes e inferiores topográficamente, están obligados a recibir las aguas que en forma natural o adecuadamente canalizadas, mediante prácticas y actividades para el manejo, conservación y recuperación de suelos, se precipiten y fluyan de las fincas vecinas, sin que los propietarios de éstas puedan cerrar su paso u obstruir su libre escorrentía por medio de barreras u otras obras, de manera que se dé continuidad a las mismas de conformidad con lo establecido en los Planes por Área.” Como se informó, se han realizado esfuerzos y acercamientos con el denunciado y con los afectados, para tratar de solucionar el caso, en el marco de las competencias del MAG, no obstante, por las características del terreno, independientemente del uso que se realice a la finca, se debe de realizar el desagüe en otra finca, siendo otra autoridad la que decida y ordene cual de ella debe ser la receptora de las aguas. La legislación como se indicó, no faculta al Ministerio de Agricultura y Ganadería a ordenar a una finca determinada, recibir la escorrentía pluvial proveniente de otra finca, por lo que consideramos que el caso debe ser sometido por los afectados a la vía ordinaria judicial. Es de suma importancia para la resolución del presente caso, considerar que, como se explicó, dada la topografía y que no hay un cuerpo de agua cercano, aún y cuando el dueño dedique la parcela a otros usos, llámese reforestación o bien que siembre un cultivo perenne, igualmente, el agua deberá salir por alguna parte inferior, en virtud de que el agua no desaparece, puede infiltrase una porción, sin embargo, en un evento de alta precipitación como los ocurridos en el mes de octubre del 2025 indudablemente, el agua llegará a salir por las zonas topográficamente inferiores, las obras de conservación de suelo existentes lo que evitan es la erosión y pérdida del recurso suelo (…)”.\n\n5.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Araya García; y,\n\nConsiderando:\n\nI.- Objeto del recurso. El recurrente alega que la tutelada Nombre02 es propietaria de un lote y vivienda ubicado en Boquerón, Cipreses, Oreamuno, Cartago, y el lote colindante ha sido intervenido con obras destinadas a manipular y dirigir el agua pluvial. Indica que ello provoca que las aguas de lluvia se concentren y dirijan hacia su propiedad, generando inundaciones recurrentes, estancamientos y riesgo de daño estructural. Refiere que, pese al conocimiento de la Municipalidad de Oreamuno y del Ministerio de Agricultura y Ganadería, las afectaciones continúan sin una solución efectiva. Estima lesionados sus derechos fundamentales.\n\nII.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:\n\na) El 6 de octubre de 2025, la jefa de la Agencia de Extensión Agropecuaria de Pacayas recibió una comunicación por parte de la Municipalidad de Oreamuno, por el reporte de una inundación a unas casas en Boquerón, por agua que provenía de una parcela agrícola (ver informe del ministro del MAG).\n\nb) El 8 de octubre de 2025, personeros del Ministerio de Agricultura y Ganadería y del Departamento de Gestión Ambiental de la Municipalidad de Oreamuno realizaron una inspección en el lugar denunciado, por una acusación interpuesta por un vecino colindante de la tutelada (ver informe de las autoridades de la Municipalidad de Oreamuno).\n\nc) La propiedad colindante de la amparada tiene sembradío o cultivos en un terreno con declive y las propiedades afectadas -entre ellas la de la tutelada- reciben el agua de lluvia (ver informe de las autoridades de la Municipalidad de Oreamuno).\n\nd) En fechas 8 de octubre, 3 y 7 de noviembre, todos de 2025, y 5 de febrero de 2026, el Ministerio de Agricultura y Ganadería ha realizado varias visitas al sitio denunciado, constatando lo siguiente: “(…) La parcela posee obras de conservación de suelo; siembra contra pendiente, utiliza gavetas para la deposición de sedimentos, en todos los linderos inferiores tiene sembrada una cerca viva como protección y amarre de los taludes, la parte más próxima a las casas la destinó a frutales, con cobertura de gramíneas, para evitar una mayor afectación, sin embargo, su terreno posee una pendiente que implica que por gradiente el agua se dirija hacia niveles más bajos, haciendo inevitable que se tenga que sacar las aguas de lluvia por las fincas aledañas, que se encuentran topográficamente abajo, es decir a las fincas de los afectados (…)” (ver informe del ministro del MAG). \n\ne) En las distintas inspecciones que ha realizado el personal del MAG, se han realizado recomendaciones para mejorar algunos aspectos de manejo de agua, mismas que han sido acatadas por el denunciado y propietario del inmueble; sin embargo, el problema del terreno es que “por las características de la finca denunciada, esta no tiene donde depositar las aguas de lluvia canalizadas, por lo que topográficamente, la escorrentía va hacia las casas vecinas, no existiendo algún gravamen legal sobre las fincas vecinas a favor de la finca denunciada de salida o servidumbre de aguas, siendo que en estas fincas vecina se encuentran construidas viviendas, incluida la de doña Nombre02 , la cual fue recientemente construida” (ver informe del ministro del MAG).\n\nf) El 5 de noviembre de 2025, la secretaria de la Región de Desarrollo Central Oriental del MAG le informó a la jefa de la Agencia de Extensión Agropecuaria de Pacayas del MAG, lo siguiente: “(…) Por este medio me permito informarle que el día de hoy se presentó a la Dirección Regional el señor: Nombre01 (cedula CED04, teléfono Telf05) vecino de Boquerón Cipreses, a solicitar una visita ya que tiene un problema de aguas, por parte del vecino el señor productor Nombre04, quien está utilizando una parte del terreno que antes no cultivaba. Informa que cortó árboles, y está sembrando en un terreno más abajo el cual colinda con varias viviendas y el desfogue del agua que libera está causando problemas debido al desvió de las aguas internas de la finca que realizó el señor (…)” (ver prueba aportada al expediente).\n\ng) El 7 de noviembre de 2025, el recurrente le envía correo electrónico a la jefa de la Agencia de Extensión Agropecuaria de Pacayas del MAG, indicándole lo siguiente: “(…) Primero agradecerte lo que fue la visita al sitio, ya por tercera vez. Como te indique por llamada telefónica, te agradecería por favor que me hagas las anotaciones de las recomendaciones que le indicaron al propietario del terreno superior dónde estamos teniendo problemas, me indicaste que si bien tienen infraestructura hecha, no está del todo bien y por eso esta cayendo mas agua de lo que deberia en los lotes inferiores. Así que dicho lo anterior te solicito amablemente me indiques las recomendaciones con aspectos técnicos, esto para que mi persona y los vecinos tengamos respaldo. Reitero, la información que solicito amablemente es de la visita del día de hoy, 7/11/2025 (…)” (ver prueba aportada al expediente). \n\nh) El 11 de noviembre de 2025, la jefa de la Agencia de Extensión Agropecuaria de Pacayas del MAG le contestó al accionante, lo siguiente: “(…) La primera la realicé el 8 de octubre, tras una solicitud de la Comisión Municipal de Emergencia (CME) debido a un incidente en una casa de habitación, en esa oportunidad fui acompañada de Jessica Aguilar, funcionaria de la Municipalidad de Oreamuno en el Departamento de Protección al Ambiente, a quién también copio en este correo. Ese día fuimos atendidos primeramente por quién puso la denuncia ante la CME, donde se observó la vivienda afectada y luego nos dirigimos a la finca de don Nombre04, y fuimos atendidos por don Nombre05. La segunda visita el 3 de noviembre, fuimos atendidos por don Nombre06 y la tercera visita el pasado 7 de noviembre fuimos atendidos por el dueño de la finca, don Nombre04, el cual nos acompañó a la finca, éstas visitas las realicé acompañada el Ing. Rodrigo Mora Mora. En las ocasiones se realizó un recorrido por el área sembrada, la finca no tiene salida a algún cuerpo de agua (rio, quebrada, acequia) y la pendiente natural del terreno que se encuentra cultivado no permite enviarla a otro lugar que no sea la parte inferior de la misma donde se encuentran las casas. Dentro de las recomendaciones que se le hacen a don Nombre04 son medidas sobre la conservación de suelos: uso de codal para trazar las zanjas, que en realidad se encuentran en forma transversal, es decir, no se encuentran a favor de pendiente, lo que indica que existe una conciencia de conservación, tienen 3 gavetas (2 en block y cemento y 1 en tierra) que se les solicita mantener limpias y vigilantes de las mismas. La porción más inferior del terreno don Nombre04 lo dejó como contención en donde tiene árboles frutales. En conversación telefónica esta mañana con don Nombre04 me comunica que tomaron la decisión de no volver a sembrar hortalizas en una franja de terreno que sube y lo van a utilizar para árboles frutales. Como le indiqué vía telefónica la finca posee obras y sistemas que evitan la pérdida de suelo, que deben mantener y asistir, sin embargo, esto no evita la presencia de agua, y esta debe ser canalizada adecuadamente para evitar daños; esto lo indica el artículo 74 del reglamento de la Ley 7779 (…)” (ver prueba aportada al expediente).\n\ni) El 13 de noviembre de 2025, el recurrente le contestó el correo electrónico a la jefa de la Agencia de Extensión Agropecuaria de Pacayas del MAG, debido a su disconformidad con la respuesta brindada (ver prueba aportada al expediente).\n\nj) El 14 de noviembre de 2025, la jefa de la Agencia de Extensión Agropecuaria de Pacayas del MAG procedió a comunicarle al accionante lo siguiente: “(…) Como respuesta a su correo le indico que de nuestra parte voy notificar a Dirección de Aguas, ya que usted menciona la Ley de Aguas N.° 276 (1942) ellos son los que manejan esa ley en su quehacer, a nosotros como Agencia de Extensión Agropecuaria nos interviene la Ley de uso, manejo y conservación de suelos Ley 7779 (1998) y a esta ley es la que me he referido en todo el proceso. Sin embargo, me permito manifestar que esta es un situación compleja, que puede llevar tiempo y en la que pueden intervenir varias instituciones, en ese caso, en última instancia será el juzgado agrario quien determine lo que deben de hacer (…)” (ver prueba aportada al expediente).\n\nk) El 18 de noviembre de 2025, la jefa de la Agencia de Extensión Agropecuaria de Pacayas del MAG le envió correo electrónico al recurrente y le informó, lo siguiente: “(…) Este tipo de temas se conocen y se resuelven en el juzgado agrario del Ministerio Público, quienes eventualmente nos pedirán criterio a nosotros para determinar el tipo de cauce relacionado con el asunto. Así entonces, nosotros podríamos adelantar en este asunto haciendo una evaluación del cauce, hablando del reservorio y certificar que se trate de una estructura antrópica y no uno natural, y que eventualmente sea incorporado a un proceso agrario. Para esto únicamente requerimos que alguien interesado solicite formalmente el criterio de naturaleza para poder asignar el recurso.\" Por lo tanto, usted o alguno de los involucrados son los que deben de realizar la solicitud de inspección a Dirección de Aguas. De igual manera crea que de mi parte estoy tratando de agotar todas las vías; ahora con Asesoría Legal del MAG y la Unidad de Investigación en manejo y conservación de suelos del INTA. Me disculpa que le vuelva a insistir que es más económico y rápido que se pongan de acuerdo entre vecinos; en lugar de terminar en el Juzgado Agrario (…)” (ver prueba aportada al expediente).\n\nl) El 24 de febrero de 2026 se notificó la resolución de curso de este amparo a las autoridades recurridas de la Municipalidad de Oreamuno y del Ministerio de Agricultura y Ganadería (ver actas de notificación).\n\n III.- Hecho no probado. No se tiene por demostrado el siguiente hecho de relevancia.\n\n Único.- El accionante o la tutelada hayan interpuesto las denuncias respectivas ante la Municipalidad de Oreamuno. \n\nIV.- Caso concreto. Del análisis de los hechos acreditados y de los informes rendidos por las autoridades recurridas, esta Sala no constata la lesión de derechos fundamentales alegada. En efecto, se encuentra demostrado que tanto la Municipalidad de Oreamuno como el Ministerio de Agricultura y Ganadería han atendido la situación denunciada mediante inspecciones, visitas de campo, recomendaciones técnicas y gestiones orientadas a procurar una solución al problema del manejo de las aguas pluviales. Asimismo, las autoridades técnicas determinaron que la finca denunciada cuenta con obras de conservación de suelos y que, debido a las características topográficas del terreno y a la inexistencia de un cauce natural cercano para el desfogue, las aguas de lluvia necesariamente deben escurrir hacia propiedades ubicadas topográficamente en un nivel inferior. También indicaron que la dificultad principal radica en la falta de acuerdo entre los propietarios de los inmuebles involucrados respecto al paso de las obras requeridas para conducir las aguas hasta la cuneta de la vía pública. \n\nDe igual manera, consta que las autoridades recurridas han sostenido de forma consistente que carecen de competencia para imponer u ordenar cuál de las fincas vecinas debe recibir las aguas pluviales o establecer las servidumbres necesarias para su evacuación, por tratarse de una materia que corresponde dilucidar ante las instancias jurisdiccionales competentes. En particular, se informó que el MAG no posee potestades sancionatorias ni impositivas en esta materia, limitándose su actuación a la emisión de criterios y recomendaciones técnicas, mientras que la propia municipalidad indicó que el conflicto reviste una naturaleza eminentemente privada y relacionada con la determinación de derechos y obligaciones entre propietarios colindantes. \n\nBajo ese entendido, lo expuesto por el recurrente revela una controversia de legalidad ordinaria vinculada con el encauzamiento y recepción de aguas pluviales entre fundos vecinos, así como con la eventual constitución o definición de servidumbres de aguas, aspectos cuya resolución excede el ámbito tutelar del recurso de amparo. Corresponde a la jurisdicción ordinaria competente determinar los derechos de las partes involucradas y, de ser procedente, ordenar las medidas necesarias para solucionar el conflicto. Por consiguiente, al no acreditarse una omisión arbitraria o ilegítima de las autoridades recurridas ni una vulneración de derechos fundamentales atribuible a estas, lo procedente es declarar sin lugar el recurso.\n\n V.- Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en Sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\nSe declara sin lugar el recurso.- \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo.   "body_en_text": "Exp: 26-004551-0007-CO\n\nRes. Nº 2026025631\n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours and twenty-five minutes on the tenth of July, two thousand twenty-six.\n\nWrit of amparo (recurso de amparo) filed by Nombre01, national identity card (cédula de identidad) CED02, on behalf of Nombre02, cédula de identidad CED03, against the MUNICIPALIDAD DE OREAMUNO and the MINISTERIO DE AGRICULTURA Y GANADERÍA (MAG).\n\nBackground:\n\n1.- By written submission received at the Court's Secretariat on February 9, 2026, the petitioner filed a writ of amparo against the Municipalidad de Oreamuno and the Ministerio de Agricultura y Ganadería. He states that the protected party Nombre02 is the owner of a lot (lote) and dwelling located 350 meters east and 50 meters south of Dirección01, Boqueron, Cipreses, Oreamuno, Cartago, where she resides with her family. He alleges that the adjacent lot has been altered for agricultural activities, with drainage ditches (zanjas), channels (canales), and other artificial works constructed to manipulate and redirect rainwater. As a result of these interventions, rainwater no longer follows its natural runoff (escurrimiento natural) course but is instead concentrated and directed toward the protected party's property and that of an adjacent neighbor, Nombre03, causing recurrent flooding during heavy rainfall. As a result of the artificial stormwater management (manejo de aguas pluviales) on the adjacent lot, water accumulates and presses directly against the perimeter wall (tapia) of the protected party's property, causing constant ponding and a risk of structural damage. Due to this situation, and in the absence of an effective solution from the respondent authorities, the protected party has been compelled to create a hole in the perimeter wall for the sole purpose of allowing water to pass through and preventing further structural damage, which demonstrates the seriousness, continuity, and materialization of the harm. This situation has caused direct damage to the land and the dwelling, as well as structural risk, soil deterioration, and conditions that compromise sanitation and safety, constituting real, present, and ongoing harm. He states that both the Municipalidad de Oreamuno and the Ministerio de Agricultura y Ganadería are fully aware of the described problem, having conducted site visits and inspections. He adds that, in the case of the MAG, he has maintained email communication with the agency official Ms. Maritza Araya, head of the agency, in which formal technical intervention was requested, inspections were carried out, and it was indicated that the channels and water management were \"correctly implemented.\" Notwithstanding the foregoing, the flooding and damage continue to occur, without either respondent authority having adopted an effective or corrective solution. He further states that the Municipalidad de Oreamuno, despite being aware of the case and being responsible for territorial oversight and the protection of neighboring properties, has failed to take concrete and effective action to stop the damage. The MAG has issued technical criteria that prioritize productive considerations, without adequately assessing the real and harmful impact that the artificial water management generates on the fundamental rights of third parties.\n\n2.- By resolution at 8:55 a.m. on February 17, 2026, the proceedings were initiated and a hearing was granted to the mayor (alcalde) of the Municipalidad de Oreamuno, as well as to the minister and head of the Agricultural Extension Agency (Agencia de Extensión Agropecuaria) of Pacayas, both of the Ministerio de Agricultura y Ganadería, regarding the facts alleged by the petitioner.\n\n3.- By written submission received at the Court's Secretariat on February 27, 2026, Erick Mauricio Jiménez Valverde, in his capacity as mayor of the Municipalidad de Oreamuno de Cartago, reports under oath as follows: \"(…) FIRST: Having reviewed the writ filed by Mr. Nombre01 on behalf of Ms. Nombre02, this local government is unaware of the facts alleged by the petitioner. It is entirely false that the petitioner or the protected party ever filed a formal complaint with the Municipalidad de Oreamuno regarding the events described in this writ of amparo. A review was conducted across the various departments to determine whether any request or complaint from the petitioners had been submitted. The departments of Urban Development and Control, the Technical Unit and Road Management, and the Office of the Comptroller of Services were consulted as to whether they were aware of the petitioners' case. However, no records exist through the Service Platform's sequential tracking numbers, nor do any of the aforementioned departments have any pending matter arising from this complaint. Following an on-site inspection, it was determined that in October 2025 a visit had taken place involving officials from the MAG and the Environmental Management Department of the Municipalidad de Oreamuno to investigate a complaint filed by a neighbor adjacent to the protected party. That individual is Nombre03, holder of national identity card CED01, owner of the property registered in the Partido de Cartago, real property folio (folio real): 207162, Right: 000. Also, in early February 2026, the municipal environmental officer visited the site and recommended a solution for channeling the water through pipe installation (entubamiento) and redirecting the outflow to the roadside drainage ditch (cuneta). However, the affected neighbors could not reach an agreement on granting access through their private properties for the pipes that they would need to install at their own expense in order to collect the rainwater. SECOND: The field visit established that the problem described by the petitioners is a matter of a private nature. Indeed, the property adjacent to Ms. Nombre02 belongs to Mr. Nombre04, registered in the Partido de Cartago, folio real: 271899, Right: 000, who has crops or plantings on sloped terrain, and the affected properties receive the rainwater. THIRD: At present, the property belonging to Mr. Nombre04, which is adjacent to Ms. Nombre02's property, has a water-and-sediment collection box (caja de registro de aguas) installed, but it is insufficient to stop the runoff (escorrentía) on the cultivated terrain. Given this situation, it was recommended that the petitioner file a complaint before the agrarian court (juzgado agrario), which may order the redirection of water that naturally flows down the slopes of the terrain toward the adjacent properties of Mr. Nombre04. FOURTH: Finally, I note that the impacts on the dwelling occur at the rear of Ms. Nombre02's home, which is far from the main road, as can be seen in photographs taken on site. Furthermore, the topographic conditions of the terrain cause it to receive water from the neighboring properties situated uphill from Mr. Nombre04's property. It was also observed that Mr. Nombre04 has attempted to channel the water, but all of it flows onto neighboring properties because there is no natural body of water (cuerpo de agua) available to discharge the rainwater. FIFTH: Officials from the Ministerio de Agricultura y Ganadería, Dirección Regional Central Oriental, Agencia de Extensión Agropecuaria de Pacayas also visited the site. They cited official communication MAG-DNEA-RDCOR-EAE-PACAYAS-002-2026, dated February 2, 2026, which references Ley No. 7799, Ley de Uso, Manejo y Conservación de Suelos and Article 74 of its regulations: \"All topographically adjacent and lower-lying terrain is obligated to receive water that, either naturally or through properly channeled means — via soil management, conservation, and recovery practices or activities — drains and flows from neighboring properties, without the owners of those properties being able to block its passage or obstruct its free runoff through barriers or other works, so as to ensure continuity in accordance with the provisions set forth in the Area Plans.\" Furthermore, the Ley de Aguas No. 276, pursuant to Articles 94, 97, and 98, provides that these disputes are to be resolved before the agrarian courts of the Ministerio Público, which will request the corresponding technical criteria to seek a solution for the affected neighbors. In this regard, the Municipalidad would be willing to advise and supervise any eventual pipe installation on the public right-of-way (cunetas) in the event of a water easement (servidumbre de aguas) and the discharge of stormwater into the roadside drainage ditch. SIXTH: Finally, with all due respect to the Justices (magistrados) of the Sala Constitucional, I submit that no violation of fundamental rights exists, as this is a matter of ordinary law and not a constitutional matter. The parties should resort to the competent judicial forum, such as the agrarian court, to resolve this neighbor dispute over the natural waters that flow across the terrain's topography toward the adjacent properties of Mr. Nombre04 (…)\".\n\n4.- By written submission received through the Court's Online Management System on February 27, 2026, Víctor Julio Carvajal Porras and Maritza Araya Mora, respectively minister and head of the Agencia de Extensión Agropecuaria de Pacayas, both of the Ministerio de Agricultura y Ganadería, report under oath as follows: \"(…) FIRST: On October 6, 2025, a communication was received via the personal WhatsApp account of the head of the Agencia de Extensión Agropecuaria de Pacayas, from an official of the Municipalidad de Oreamuno, reporting the flooding of certain homes in Boquerón caused by water coming from an agricultural parcel. Based on this report, a joint visit was coordinated with officials from the Municipalidad de Oreamuno, which took place on October 8, 2025. SECOND: At the time of the inspection, the property under examination had carrots planted on it. The inspection found a cultivated portion of land of approximately 1,700 m², which has no nearby body of water, and therefore directs its water through a ditch with sediment traps (gavetas) that ends in a tank at the lower corner, which also functions as a sediment trap and has an opening from which water flows toward the topographically lower-lying neighboring properties. At the time of the inspection, a perimeter wall was already in place, and it had the hole mentioned in the writ of amparo. THIRD: In investigating the case background, it was found that the Municipalidad de Oreamuno had carried out an inspection in late October 2025, because the neighbor who had filed the initial complaint in early October experienced renewed flooding. Those who attended the inspection submitted their report by email, which is transcribed in the following paragraph. This email was copied to the MAG on October 30, and in it the Municipalidad de Oreamuno official asked the Agencia de Extensión Agropecuaria de Pacayas to follow up on the case. \"As requested, an inspection was conducted pursuant to incident report No. 2025-10-29-02240 relating to water intrusion onto the property of Mr. Nombre03, holder of national identity card CED01, in the community of Boquerón, district of Cipreses. Property folio real 3-207162-000, cadastral registry (catastro) No. C-0787913-2002. At the site, the affected party indicated that during the preceding days of rain they had been experiencing water intrusion onto their property, which originates from an adjacent parcel dedicated to agricultural production, whose drainage structures are channeled directly toward the neighboring dwellings. The neighbors state that on prior occasions they have spoken with the owner of the parcel but have been unable to obtain his cooperation in the matter. At the time of the inspection, no structural damage to the dwelling was observed, nor was there any impact on its contents. Nevertheless, the affected party is advised to contact the MAG for any applicable measures.\" FOURTH: On the part of the MAG, several visits have been conducted at the site, specifically on: • October 8, 2025, as mentioned above; • November 3, 2025; • November 7, 2025; • February 5 of the current year. The parcel has soil conservation (conservación de suelos) works in place: contour planting (siembra contra pendiente), use of sediment traps for sediment deposition; a living fence (cerca viva) has been planted along all lower boundaries for protection and anchoring of the slopes (taludes); the portion closest to the homes has been dedicated to fruit trees with grass cover, to avoid greater impact. However, the terrain has a slope (pendiente) that causes water to be directed by gradient toward lower levels, making it unavoidable that rainwater must exit through the adjacent properties situated topographically below — that is, the properties of the affected parties. FIFTH: During the various inspections conducted by MAG personnel, recommendations were made to improve certain aspects of water management, and these were complied with by the reported party and property owner. However, the real problem with the terrain is that \"due to the characteristics of the reported property, it has nowhere to discharge its channeled rainwater, so topographically, the runoff flows toward the neighboring homes; there is no legal encumbrance (gravamen legal) on the neighboring properties in favor of the reported property granting an outlet or water easement, and these neighboring properties have dwellings built on them, including that of Ms. Nombre02, which was recently constructed\" (see MAG minister's report). SIXTH: As part of the case management, the MAG has exchanged emails with the petitioner, Mr. Nombre01; the last email was sent on December 8, 2025, and received no reply. SEVENTH: As part of the management of this case, and in pursuit of a solution, personal conversations have been held with other affected parties, but no agreement has been reached, as they evidently do not wish to receive the water on their properties. Among these conversations was one held with the property owner, Mr. Nombre04, who indicated he was willing to provide the necessary materials to route the water through Mr. Nombre01's property, but no agreement was reached. EIGHTH: Because the petitioner, in an email dated November 18, referenced the Ley de Aguas N.º 276 (1942) (Articles 94, 97, and 98), on that same date the MAG Agency submitted a query to the Dirección de Aguas, whose verbatim response was as follows: \"These types of matters are heard and resolved by the agrarian court of the Ministerio Público, which will eventually request our technical opinion to determine the type of watercourse relevant to the matter.\" They also indicated that they could conduct an inspection upon formal request from one of the affected parties, which information was communicated to the petitioner by email. NINTH: Additionally, as part of the management of this case, the matter was referred to the Soil Unit of the Instituto de Innovación y Transferencia en Tecnología Agropecuaria (INTA) on November 20, 2025, which responded the following day, stating: \"…We would say that, in this case, the best course of action is to bring to the attention of the parties involved what this Decree (of Ley 7779) provides with respect to the management, channeling, and final disposal of stormwater, and to refer the matter to the Municipalidad and the Dirección de Aguas so that they may issue their rulings.\" Also on November 20, 2025, a query was submitted to the MAG's Legal Advisory Office regarding the similarities and differences between the Ley de Aguas and Ley 7779, which responded, among other conclusions, as follows, through CARTA-MAG-DM-DAJ-0036-2026 of January 16, 2026: \"…No regulatory inconsistency is identified between the Ley de Aguas and the Regulations to the Ley de Uso, Manejo y Conservación de Suelos; on the contrary, regulatory complementarity is evident, with the Ley de Aguas serving as the primary interpretive framework in matters of water easements.\" TENTH: On February 9, 2026, the MAG Agency issued official communication MAG-DNEA-RDCOR-AEA-PACAYAS 002-2026, addressed to the Comisión Municipal de Emergencias de Oreamuno, evidencing the efforts made by the MAG's Agencia de Extensión Agrícola de Pacayas to follow up on and seek a resolution to the case, given the concern about impacts on homes and human lives. However, the solution falls outside the MAG's competencies, as it is not a sanctioning or enforcement body; rather, it issues recommendations, as it has done, and therefore has no authority to determine or order which neighboring property must receive the water from the reported parcel in order to discharge the stormwater to the drainage channel or roadside drainage ditch on the public road. CONSIDERATIONS ON THE CASE: The handling of this type of case, and this case in particular, by the Agencia de Extensión Agropecuaria in Pacayas — relating to rainwater management and soil degradation — is carried out pursuant to the provisions of Ley número 7779, Ley de Uso, Manejo y Conservación de Suelos, and specifically Article 74 of the Regulations to Ley 7779, which provides: \"…All topographically adjacent and lower-lying terrain is obligated to receive water that, either naturally or through properly channeled means — via soil management, conservation, and recovery practices and activities — drains and flows from neighboring properties, without the owners of those properties being able to block its passage or obstruct its free runoff through barriers or other works, so as to ensure continuity in accordance with the provisions established in the Area Plans.\" As reported, efforts and outreach have been made with the reported party and the affected parties to try to resolve the case within the framework of the MAG's competencies. Nevertheless, given the characteristics of the terrain, regardless of the use made of the property, drainage must take place onto another property, and it is for another authority to decide and order which one must receive the water. As indicated, the legislation does not empower the Ministerio de Agricultura y Ganadería to order a specific property to receive stormwater runoff from another property; therefore, the affected parties should submit the case to the ordinary judicial process. It is critically important for the resolution of this case to consider that, as explained, given the topography and the absence of a nearby body of water, even if the owner were to dedicate the parcel to other uses — such as reforestation or the planting of perennial crops — the water would still need to exit through some lower area, because water does not simply disappear; a portion may infiltrate the soil; however, during a high-precipitation event such as those that occurred in October 2025, the water will undoubtedly reach the topographically lower areas. The existing soil conservation works serve only to prevent erosion and the loss of the soil resource (…)\".\n\n5.- The legal requirements applicable to the proceedings have been observed.\n\nThe opinion is drafted by Justice Araya García; and,\n\nConsidering:\n\nI.- Subject matter of the writ. The petitioner alleges that the protected party Nombre02 is the owner of a lot and dwelling located in Boquerón, Cipreses, Oreamuno, Cartago, and that the adjacent lot has been altered with works designed to manipulate and redirect stormwater. He states that this causes rainwater to be concentrated and directed toward her property, generating recurrent flooding, ponding, and the risk of structural damage. He asserts that, despite the awareness of the Municipalidad de Oreamuno and the Ministerio de Agricultura y Ganadería, the damage continues without an effective solution. He considers his fundamental rights to have been violated.\n\nII.- Established facts. For the purposes of deciding this matter, the following facts are deemed duly proven:\n\na) On October 6, 2025, the head of the Agencia de Extensión Agropecuaria de Pacayas received a communication from the Municipalidad de Oreamuno reporting the flooding of certain homes in Boquerón caused by water originating from an agricultural parcel (see MAG minister's report).\n\nb) On October 8, 2025, officials from the Ministerio de Agricultura y Ganadería and the Environmental Management Department of the Municipalidad de Oreamuno conducted an inspection at the reported site, following a complaint filed by a neighbor adjacent to the protected party (see report from the Municipalidad de Oreamuno authorities).\n\nc) The property adjacent to the protected party has crops or plantings on sloped terrain, and the affected properties — including that of the protected party — receive the rainwater (see report from the Municipalidad de Oreamuno authorities).\n\nd) On October 8, November 3 and 7, all of 2025, and February 5, 2026, the Ministerio de Agricultura y Ganadería conducted several visits to the reported site, finding the following: \"(…) The parcel has soil conservation works in place: contour planting, use of sediment traps for sediment deposition; a living fence has been planted along all lower boundaries for protection and anchoring of the slopes; the portion closest to the homes has been dedicated to fruit trees with grass cover, to avoid greater impact. However, the terrain has a slope that causes water to be directed by gradient toward lower levels, making it unavoidable that rainwater must exit through the adjacent properties situated topographically below — that is, the properties of the affected parties (…)\" (see MAG minister's report).\n\ne) During the various inspections conducted by MAG personnel, recommendations were made to improve certain aspects of water management, all of which were complied with by the reported party and property owner. However, the real problem with the terrain is that \"due to the characteristics of the reported property, it has nowhere to discharge its channeled rainwater, so topographically, the runoff flows toward the neighboring homes; there is no legal encumbrance on the neighboring properties in favor of the reported property granting an outlet or water easement, and these neighboring properties have dwellings built on them, including that of Ms. Nombre02, which was recently constructed\" (see MAG minister's report).\n\nf) On November 5, 2025, the secretary of the MAG's Dirección Regional Central Oriental informed the head of the MAG's Agencia de Extensión Agropecuaria de Pacayas as follows: \"(…) I write to inform you that today Mr. Nombre01 (national identity card CED04, telephone Telf05), a resident of Boquerón Cipreses, came to the Regional Office to request a visit, as he has a water problem caused by his neighbor, the producer Mr. Nombre04, who is using a portion of land that was not previously cultivated. He reports that Mr. Nombre04 cut down trees and is now planting on land lower down that is adjacent to several homes, and the water discharge he is releasing is causing problems due to the internal diversion of water within the property carried out by Mr. Nombre04 (…)\" (see evidence submitted to the file).\n\ng) On November 7, 2025, the petitioner sent an email to the head of the MAG's Agencia de Extensión Agropecuaria de Pacayas, stating the following: \"(…) First, I want to thank you for the site visit, which was now the third one. As I mentioned to you by phone, I would appreciate it if you could send me written notes of the recommendations that were communicated to the owner of the upper plot where we are experiencing problems. You told me that although they have infrastructure in place, it is not entirely adequate, which is why more water than there should be is falling onto the lower lots. With that said, I kindly ask you to provide me with the recommendations along with the technical details, so that I and the neighbors have a record. I reiterate that the information I am requesting relates to today's visit, November 7, 2025 (…)\" (see evidence submitted to the file).\n\nh) On November 11, 2025, the head of the MAG's Agencia de Extensión Agropecuaria de Pacayas replied to the petitioner as follows: \"(…) The first visit was conducted on October 8, following a request from the Municipal Emergency Commission (Comisión Municipal de Emergencia, CME) due to an incident at a private home; on that occasion I was accompanied by Jessica Aguilar, an official from the Municipalidad de Oreamuno in the Environmental Protection Department, who is also copied on this email. That day we were first attended to by the person who filed the complaint with the CME, where we observed the affected dwelling, and then proceeded to Mr. Nombre04's property, where we were attended by Mr. Nombre05. The second visit, on November 3, we were attended by Mr. Nombre06, and the third visit, on November 7, we were attended by the owner of the property, Mr. Nombre04, who accompanied us onto the parcel; these visits were conducted with the assistance of Engineer Rodrigo Mora Mora. On each occasion a walk-through of the planted area was carried out. The parcel has no outlet to any body of water (river, stream, irrigation canal (acequia)), and the natural slope of the cultivated terrain does not allow the water to be directed anywhere other than the lower portion, where the homes are located. The recommendations made to Mr. Nombre04 consist of soil conservation measures: use of a level tool to lay out the ditches, which are in fact oriented transversally — that is, they do not run in the direction of the slope — indicating an awareness of conservation; there are 3 sediment traps (2 in block and cement, and 1 earthen), which they are asked to keep clean and to monitor regularly. The lower portion of the terrain, Mr. Nombre04 has designated as a containment area planted with fruit trees. In a telephone conversation this morning with Mr. Nombre04, he told me that they have decided not to plant vegetables again on a strip of land running uphill and will use it for fruit trees instead. As I mentioned to you by phone, the parcel has works and systems in place that prevent soil loss, which must be maintained and attended to; however, these do not prevent the presence of water, which must be adequately channeled to avoid damage — as Article 74 of the regulations to Ley 7779 provides (…)\" (see evidence submitted to the file).\n\ni) On November 13, 2025, the petitioner replied by email to the head of the MAG's Agencia de Extensión Agropecuaria de Pacayas, expressing disagreement with the response provided (see evidence submitted to the file).\n\nj) On November 14, 2025, the head of the MAG's Agencia de Extensión Agropecuaria de Pacayas communicated the following to the petitioner: \"(…) In response to your email, I inform you that on our end I will notify the Dirección de Aguas, since you mention the Ley de Aguas N.° 276 (1942) — they are the body responsible for administering that law; as the Agencia de Extensión Agropecuaria, our mandate falls under the Ley de uso, manejo y conservación de suelos, Ley 7779 (1998), which is the law I have referred to throughout this process. That said, I must note that this is a complex situation that may take time and may require the involvement of several institutions; in that case, as a final resort, it will be the agrarian court that determines what must be done (…)\" (see evidence submitted to the file).\n\nk) On November 18, 2025, the head of the MAG's Agencia de Extensión Agropecuaria de Pacayas sent an email to the petitioner informing him as follows: \"(…) These types of matters are heard and resolved by the agrarian court of the Ministerio Público, which will eventually request our technical opinion to determine the type of watercourse relevant to the matter. Thus, we could move this matter forward by conducting an assessment of the watercourse, examining the reservoir, and certifying whether the structure is man-made as opposed to natural, so that it may eventually be incorporated into an agrarian proceeding. For this we only require that someone with an interest in the matter formally request the nature assessment so that we can allocate the resource.\" Therefore, you or one of the parties involved must submit the inspection request to the Dirección de Aguas. Likewise, please know that on my end I am trying to exhaust all available avenues; I am now consulting with the MAG's Legal Advisory Office and the INTA's Soil Management and Conservation Research Unit. I apologize for insisting once more that it would be faster and less costly for the neighbors to reach an agreement among themselves, rather than ending up before the agrarian court (…)\" (see evidence submitted to the file).\n\nl) On February 24, 2026, the resolution initiating this writ of amparo was served on the respondent authorities of the Municipalidad de Oreamuno and the Ministerio de Agricultura y Ganadería (see service records).\n\nIII.- Unproven fact. The following relevant fact is not deemed proven.\n\nSole item.- That the petitioner or the protected party filed the respective complaints with the Municipalidad de Oreamuno.\n\nIV.- Specific Case. Based on an analysis of the established facts and the reports submitted by the respondent authorities, this Court finds no violation of the fundamental rights alleged. Indeed, it has been established that both the Municipality of Oreamuno and the Ministry of Agriculture and Livestock have addressed the reported situation through inspections, field visits, technical recommendations, and efforts aimed at finding a solution to the stormwater management (manejo de las aguas pluviales) problem. Likewise, the technical authorities determined that the reported property (finca) has soil conservation works (obras de conservación de suelos) in place, and that, due to the topographic characteristics of the land and the absence of a nearby natural watercourse (cauce natural) for drainage (desfogue), rainwater must necessarily flow toward properties located at a lower topographic elevation. They also indicated that the principal difficulty lies in the lack of agreement among the owners of the properties involved regarding the passage of the works required to channel the water to the roadside ditch (cuneta) of the public road.\n\nLikewise, the record shows that the respondent authorities have consistently maintained that they lack jurisdiction to impose or order which of the neighboring properties must receive the stormwater, or to establish the easements (servidumbres) necessary for its drainage, as this is a matter to be resolved before the competent judicial bodies. In particular, it was reported that MAG has no sanctioning or imposing powers in this area, its role being limited to issuing technical opinions and recommendations, while the municipality itself indicated that the dispute is essentially private in nature and concerns the determination of rights and obligations between adjoining property owners.\n\nAgainst this background, what the petitioner (recurrente) describes reveals an ordinary-law dispute (controversia de legalidad ordinaria) connected with the channeling and reception of stormwater between neighboring estates (fundos vecinos), as well as the possible establishment or definition of water easements (servidumbres de aguas), matters whose resolution falls outside the scope of the writ of amparo (recurso de amparo). It is for the competent ordinary courts to determine the rights of the parties involved and, where appropriate, to order the necessary measures to resolve the dispute. Accordingly, since no arbitrary or illegitimate omission on the part of the respondent authorities has been established, nor any violation of fundamental rights attributable to them, the appropriate ruling is to deny the writ.\n\nV.- Documentation Submitted to the Case File. The parties are hereby notified that, if they have submitted any documents in paper form, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the court office (despacho) within a maximum period of thirty business days counted from the notification of this judgment (sentencia). Otherwise, all material not retrieved within this period will be destroyed, pursuant to the \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", approved by the Corte Plena in Session N° 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial N° 19 of January 26, 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial in Session N° 43-12 held on May 3, 2012, Article LXXXI.\n\nPor tanto:\n\nThe writ is denied.-\n\n\n\n\nFernando Castillo V.\n\nPresident\n\n\nFernando Cruz C.\n\n\nPaul Rueda L.\n\nLuis Fdo.
