Nº 2026025719\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del diez de julio de dos mil veintiseis .\n\n \n\n Recurso de amparo que se tramita en expediente nro. 26-016200-0007-CO, interpuesto por [Nombre 001], cédula de identidad nro. [Valor 001], contra el MINISTERIO DE AMBIENTE Y ENERGÍA.\n\nResultando:\n\n1.- Por escrito recibido en la Secretaría de la Sala el 7 de mayo de 2026, el recurrente interpone recurso de amparo. Expone: “I. HECHOS 1. Con fecha 25 de marzo de 2026, en mi calidad de coadyuvante en la Acción de Inconstitucionalidad 25-016939-0007-CO, presenté el oficio AEL-0034-2026 solicitando información pormenorizada y actualizada sobre todos los tanques de almacenamiento de combustibles. 2. El 30 de abril de 2026 recibí el oficio CARTA-DAJ-DGTCCMINAE-2026-0169, el cual es insuficiente, incompleto, evasivo y contrario a las obligaciones constitucionales y legales de la Administración. II. LEGITIMACIÓN ACTIVA Actúo con plena legitimación como coadyuvante formal en el expediente 25-016939-0007-CO. III. FUNDAMENTACIÓN JURÍDICA – LA LEY MARCO DE ACCESO A LA INFORMACIÓN PÚBLICA (N° 10554) La Ley Marco de Acceso a la Información Pública, N° 10554, es el desarrollo legislativo directo del artículo 27 de la Constitución Política. Su artículo 1 establece con claridad meridiana: “El Estado garantiza el cumplimiento efectivo del derecho humano de acceso a la información pública, de forma proactiva, oportuna, oficiosa, completa y accesible, garantizando la transparencia administrativa en el ejercicio de la función pública, fortaleciendo la rendición de cuentas por parte de las autoridades y su debida publicidad en la función pública.” Esta norma consagra los siguientes principios rectores que han sido violentados en el presente caso: • Principio de máxima divulgación (artículo 4): Toda información en poder de la Administración es pública, salvo las excepciones taxativas y debidamente motivadas. • Principio de gratuidad (artículo 5). • Principio de celeridad y buena fe (artículo 6). • Principio de facilitación (artículo 7): La Administración debe entregar la información en la forma más útil y comprensible para el solicitante, sin que este deba demostrar interés especial ni justificar el motivo de su solicitud. La Sala Constitucional ha sostenido de manera reiterada que el acceso a la información pública no es un derecho de segunda categoría, sino un derecho instrumental y habilitante sin el cual resulta imposible ejercer y defender los demás derechos fundamentales, particularmente el derecho a un ambiente sano (artículo 50 constitucional). En el presente caso, la información solicitada es indispensable para cumplir mi rol de coadyuvante en la Acción de Inconstitucionalidad 25-016939-0007-CO y para ejercer control ciudadano sobre la ejecución de la sentencia que declaró inconstitucional el Decreto 43449-MINAE. La respuesta recibida viola abiertamente los artículos 1, 4, 6, 7 y 12 de la Ley 10554 al: • No entregar la información de forma completa y estructurada. • Remitir genéricamente a expedientes anteriores sin sistematizarla. • Calificar la solicitud como “desmesurada” sin demostrar abuso real del derecho. IV. PETITORIA Por todo lo expuesto, solicito respetuosamente a los señores Magistrados: 1. Admitir el presente recurso de amparo y declararlo con lugar. 2. Ordenar al Ministro de Ambiente y Energía y al Director General de la DGTCC la entrega inmediata y completa de la información solicitada en el oficio AEL-0034-2026, en formato digital estructurado y actualizado. 3. Fijar un plazo máximo de tres (3) días hábiles para su cumplimiento, bajo apercibimiento de las sanciones del artículo 71 de la Ley de la Jurisdicción Constitucional. 4. Mantener las medidas cautelares que estime necesarias”. \n\n2.- Mediante resolución de las 15:57 horas del 22 de mayo de 2026, la Presidencia de la Sala dio curso al proceso y solicitó informe al ministro de Ambiente y Energía. \n\n3.- Por escrito incorporado al expediente electrónico el 1° de junio de 2026, informa bajo juramento Mónica Diana Navarro del Valle en su condición de ministra de Ambiente y Energía. Expone: “Sobre los alegatos del recurrente. Según consta en los registros de la Dirección General de Transporte y Comercialización de Combustible (en adelante la DGTCC), el recurrente ha recibido respuesta a la solicitud de información realizada por medio del AEL-0034-2026, la cual fue suministrada de la siguiente manera: Oficio CARTA- DAJ- DGTCC- MINAE-0139-2026 notificado el día 16 de abril del 2026 que le indica que al “día de hoy no sean tramitado nuevos permisos, solicitudes o trámites relacionados para la recalificación, extensión de vida útil o cualquier modalidad equivalente de tanques de almacenamiento de combustibles”; así mismo se le informa que por medio de los oficios DGTCC-DL-2024-110, DGTCCDL-2024-111, DGTCC-DL-2024-112, DGTCC-DL-2024-113, DGTCC-DL-2024-114, DGTCC-DL-2024-115, DGTCC-DL-2024- 116 notificados el día veintiséis de abril y los oficios DGTCC-DL-2024-0093, DGTCC-DL-2024-0094 notificados el día cuatro de junio todos del año dos mil veinticuatro; se le brindó acceso a los expedientes administrativos ES-101044, ES-101111, ES-108013, ES401042, ES-602012, ES-118015, ES-303031- ES-701014 que fueron las únicas estaciones recalificadas según se le informó por medio del Oficio DGTCC-DL-2024-070, y que en el punto segundo le detalla un cuadro de los expedientes que fueron recalificados:\n\nEXPEDIENTE\n\nNOMBRE TITULAR\n\nPROVINCIA\n\nCANTÓN \n\nDISTRITO\n\nES-101044\n\n[Nombre 002]\n\n1\n\n101\n\n10104\n\nES-10111\n\n[Nombre 002]\n\n1\n\n101\n\n10111\n\nES-108013\n\n[Nombre 002]\n\n1\n\n108\n\n10801\n\nES-118015\n\n[Nombre 003].\n\n1\n\n118\n\n11801\n\nES-303031\n\n[Nombre 004].\n\n3\n\n303\n\n30303\n\nES-401042\n\n[Nombre 002]\n\n4\n\n401\n\n40104\n\nES-602012\n\n[Nombre 002]\n\n6\n\n602\n\n60201\n\nES-701014\n\n[Nombre 002]\n\n7\n\n701\n\n70101\n\nAsimismo, se le informa que a la fecha de emisión del oficio, son las únicas estaciones que fueron sometidas al proceso de recalificación y que los expedientes no han tenido ningún tipo de actualización o cambio a la fecha. Que mediante el oficio DGTCC-DL-MINAE-002-2025 notificado el día 9 de enero del dos mil veintiséis, la DGTCC responde una nueva solicitud de certificación de criterios jurídicos, técnicos y de acciones a tomar respecto de estaciones de servicio con tanques de almacenamiento de combustibles recalificados, emitidos por el Ing. Álvaro Andrés Salas Picado, jefe del Departamento de Ingeniería y Fiscalización, una prueba más que el recurrente cuenta y/o conoce la información que supuestamente la Administración ha sido omisa en indicar, Asimismo la DGTCC le vuelve a indicar que no se encuentra ningún trámite en proceso de recalificación y vuelve a detallar la lista de expedientes que fueron recalificados y que el recurrente conoce y tiene acceso. Sin embargo, el recurrente por medio del oficio AEL-0047-2026 del día 16 de abril, nuevamente solicita la información que ya le fue suministrada y que consta en los expedientes administrativos que tiene en su poder; por lo que, nos encontramos ante una solicitud de información desmesurada, por cuanto pretende que la Administración complete un cuadro que le detalle los tanques de almacenamiento que hayan sido recalificados o cuya vida útil haya sido extendida durante los últimos diez (10) años (período 2016-2026), para lo cual se deberá de realizar una revisión de cada uno de los expedientes que le fueron enviados, revisión que debe atenderse de manera conjunta con el Departamento de Ingeniería y Fiscalización y el Departamento Administrativo, pues se solicitan aspectos de diversa índole, por lo que el día cinco de mayo del presente año se le notifica el oficio CARTADGTCC-DAJ-MINAE-2026-0169, que justifica que no existen omisiones, inconsistencias o bien datos insuficientes, incompletos evasivo y contrario a las obligaciones constitucionales y legales de la administración, según lo indica el administrado. La Ley Marco de Acceso a la información Pública, N° 10554, tiene por objeto garantizar el cumplimiento efectivo del derecho humano de acceso a la información pública, de forma proactiva, oportuna, oficiosa, completa y accesible, garantizando la transparencia administrativa en el ejercicio de la función pública, fortaleciendo la rendición de cuentas por parte de las autoridades y su debida publicidad en la función pública, mismo que este Ministerio ha cumplido en tiempo y forma, pero el recurrente continua solicitando información que consta en los expedientes que tiene en su poder. Es importante indicar que esta honorable Sala ha indicado por medio de la Resolución número 01747 emitido el día 9 de Marzo de 1999, que: “… “… EJERCICIO ABUSIVO Y TORCIDO DEL DERECHO DE PETICIÓN. La Sala también ha tenido oportunidad de pronunciarse en casos calificados, de uso abusivo y perverso del derecho. En esos casos, efectivamente, una persona afirma ser afectada por la autoridad pública, a la que atribuye haberle violado su derecho de petición, pero a través de las circunstancias que rodean el caso planteado, se llega a comprobar que la administración está siendo sometida a peticiones repetitivas, desmesuradas, absurdas o incluso ofensivas, motivo por el cual la jurisprudencia protege a la administración y la autoridad que la encabeza, en el tanto su quehacer, de principio destinado al cumplimiento de fines públicos, valga decir, dirigidos a satisfacer necesidades de la comunidad, no puede quedar cautivo del capricho de una persona que se dedica a hostigarla con aquel tipo de peticiones. El derecho de petición está concebido -no puede entenderse de otra manera- para la satisfacción de una necesidad personal de quien lo ejerce, sin que sea necesario que haya sido explicitado en su gestión. Hay situaciones, sin embargo, en que resulta claro que existe un designio de perturbar el normal quehacer de la administración, por lo que no puede esperarse que esta S. brinde la protección constitucional que está prevista para la hipótesis primeramente señalada…” Como se ha demostrado, la Administración ha cumplido en tiempo y forma con cada una de las solicitudes realizadas por el recurrente, él cual tiene acceso a los expedientes administrativos que le permite completar el cuadro de información que pretende; si la Administración asigna profesionales de los Departamentos de Ingeniería y Administrativo para que realicen la revisión de los expedientes administrativos esto afectaría el servicio público, ya que esto implica dejar de atender trámites y solicitudes diarias de la DGTC (…) Una vez analizados los alegatos de la recurrente y rendido el informe de los hechos que demuestran que la consulta fue atendida en tiempo y forma por este Ministerio, le solicitamos respetuosamente a esta honorable Sala que se declare sin lugar el presente Recurso de Amparo”. \n\n4.- Por escrito incorporado al expediente electrónico el 2 de junio de 2026, el recurrente indica: “I. PRECISIÓN SOBRE LOS HECHOS Y LO REALMENTE SOLICITADO Desde el oficio AEL-0034-2026 del 25 de marzo de 2026, este recurrente solicitó, en su calidad de coadyuvante en la Acción de Inconstitucionalidad 25-016939-0007- CO, información actualizada y completa sobre: 1. Todos los tanques de almacenamiento de combustibles que hayan sido recalificados o cuya vida útil haya sido extendida durante los últimos diez años (2016-2026), con datos pormenorizados por cada tanque (identificación, capacidad, fechas, ubicación exacta con coordenadas, empresa propietaria, funcionarios responsables, base normativa y técnica, observaciones ambientales, etc.). 2. El listado completo y actualizado de todos los trámites que se encuentren actualmente en proceso de recalificación o extensión de vida útil. No se solicitó información antigua, sino información actualizada a la fecha, precisamente porque la Acción de Inconstitucionalidad 25-016939-0007-CO está en curso y esta información es indispensable para ejercer adecuadamente mi rol de coadyuvante y controlar el cumplimiento de la sentencia que declaró inconstitucional el Decreto 43449-MINAE. La respuesta de la Administración (CARTA-DAJ-DGTCCMINAE-2026-0169 y los oficios anteriores del 2024) se limita a remitir información antigua, expedientes individuales sin sistematizar y la afirmación genérica de que “no hay trámites nuevos”. No se ha entregado la información actualizada que expresamente se solicitó. II. REFUTACIÓN AL INFORME DE LA MINISTRA La Ministra pretende acreditar ante esta Sala que la Administración “ha cumplido en tiempo y forma” y que este recurrente “ya tiene la información”. Tal afirmación es inexacta por las siguientes razones: • La información entregada corresponde principalmente a oficios del año 2024 (DGTCC-DL-2024-110 al 116, DGTCC-DL-2024-070, etc.). No constituye una respuesta actualizada al año 2026. • No se entregó ningún informe consolidado, ni cuadro actualizado, ni los datos específicos solicitados (coordenadas geográficas, funcionarios que autorizaron cada recalificación, observaciones ambientales, consultas interinstitucionales, etc.). • La Administración reconoce que hay tanques ya recalificados, pero no entrega la información detallada y actualizada sobre ellos, tal como fue requerido. • Calificar la solicitud como “desmesurada” no es válido cuando se trata de información de alto interés público ambiental y directamente vinculada a una Acción de Inconstitucionalidad en trámite. La Sala Constitucional ha sido clara: el derecho de acceso a la información pública exige que la Administración entregue la información en la forma más útil y comprensible (principio de facilitación – art. 7 Ley 10554), no que obligue al ciudadano a reconstruir la información a partir de expedientes dispersos. III. VIOLACIONES CONSTITUCIONALES La conducta de la Administración viola: • Los artículos 27 y 30 de la Constitución Política. • Los principios de máxima divulgación, facilitación, celeridad y buena fe de la Ley 10554. • El derecho a un ambiente sano y ecológicamente equilibrado (artículo 50 constitucional), al impedirme ejercer mi rol de coadyuvante con información completa y actualizada. IV. PETITORIA Por todo lo expuesto, solicito respetuosamente a esta Honorable Sala: 1. Tener por rendida la presente réplica. 2. Declarar con lugar el recurso de amparo. 3. Ordenar al Ministerio de Ambiente y Energía y a la DGTCC la entrega inmediata y completa de la información actualizada solicitada en el oficio AEL-0034- 2026, en formato digital estructurado, debidamente firmada y con todos los datos requeridos. 4. Fijar un plazo máximo de tres (3) días hábiles para su cumplimiento, bajo apercibimiento de las sanciones del artículo 71 de la Ley de la Jurisdicción Constitucional. 5. Mantener las medidas cautelares que estime pertinentes. Quedo a disposición de esta Sala para cualquier aclaración adicional”. \n\n5.- En los procedimientos seguidos se ha observado las prescripciones legales.\n\n Redacta el Magistrado Rueda Leal; y,\n\nConsiderando:\n\n I.- Objeto del recurso. El recurrente alega que el 25 de marzo de 2026 gestionó ante el ministerio recurrido el oficio AEL-0034-2026 en el que solicitó: “1. Un informe completo y sin omisión alguna sobre todos los tanques de almacenamiento de combustibles que hayan sido recalificados o cuya vida útil haya sido extendida durante los últimos diez (10) años (período 2016-2026). El informe deberá contener, como mínimo, la siguiente información pormenorizada por cada tanque: - Identificación completa del tanque (número de serie, capacidad, fecha de instalación original y fecha de recalificación). - Ubicación exacta (provincia, cantón, distrito, coordenadas geográficas y estación de servicio o instalación correspondiente). - Nombre completo de la empresa propietaria o operadora. - Nombre y cargo de cada funcionario público o privado que autorizó, revisó o emitió criterio técnico para la recalificación. - Base normativa y técnica invocada en cada caso (incluyendo el Decreto 43449-MINAE y las normas INTE aplicadas). - Fecha exacta de la autorización y vigencia otorgada. - Cualquier otro dato relevante: informes técnicos, dictámenes, inspecciones, posibles observaciones ambientales o de la DGTCC, y si se realizó o no consulta con entes hídricos o de salud. 2. Un listado completo, actualizado y detallado de todos los permisos, solicitudes o trámites que se encuentren actualmente en proceso ante el MINAE, la Dirección General de Transporte y Comercialización de Combustibles (DGTCC) u otras dependencias bajo su rectoría, para la recalificación, extensión de vida útil o cualquier modalidad equivalente de tanques de almacenamiento de combustibles. Este listado deberá incluir, sin excepción: nombre de la empresa solicitante, ubicación exacta de los tanques, fecha de presentación de la solicitud, estado actual del trámite, funcionarios involucrados en su revisión, y cualquier criterio técnico o ambiental preliminar emitido hasta la fecha. Esta doble solicitud responde a la necesidad imperiosa de conocer no solo lo ya ejecutado bajo un marco declarado inconstitucional, sino también lo que se pretende continuar ejecutando, para prevenir riesgos ambientales graves y garantizar que la Administración actúe con plena sujeción a la resolución de la Sala Constitucional. Solicito que ambos informes sean entregados en formato PDF, debidamente firmados por la autoridad competente, en un plazo no mayor a diez (10) días hábiles contados a partir de la recepción de la presente, conforme al principio de celeridad y buena fe que rige la Administración Pública”. Aduce que el 30 de abril de 2026 recibió el oficio CARTA-DAJ-DGTCC-MINAE-2026-0169 que contiene una respuesta que estima insuficiente, incompleta, evasiva y contraria a las obligaciones constitucionales y legales de la administración. Solicita la intervención de la Sala.\n\nII.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:\n\na) El 25 de marzo de 2026, el recurrente gestionó ante el Ministerio de Ambiente y Energía el oficio AEL-0034-2026 en el que solicitó: “1. Un informe completo y sin omisión alguna sobre todos los tanques de almacenamiento de combustibles que hayan sido recalificados o cuya vida útil haya sido extendida durante los últimos diez (10) años (período 2016-2026). El informe deberá contener, como mínimo, la siguiente información pormenorizada por cada tanque: - Identificación completa del tanque (número de serie, capacidad, fecha de instalación original y fecha de recalificación). - Ubicación exacta (provincia, cantón, distrito, coordenadas geográficas y estación de servicio o instalación correspondiente). - Nombre completo de la empresa propietaria o operadora. - Nombre y cargo de cada funcionario público o privado que autorizó, revisó o emitió criterio técnico para la recalificación. - Base normativa y técnica invocada en cada caso (incluyendo el Decreto 43449-MINAE y las normas INTE aplicadas). - Fecha exacta de la autorización y vigencia otorgada. - Cualquier otro dato relevante: informes técnicos, dictámenes, inspecciones, posibles observaciones ambientales o de la DGTCC, y si se realizó o no consulta con entes hídricos o de salud. 2. Un listado completo, actualizado y detallado de todos los permisos, solicitudes o trámites que se encuentren actualmente en proceso ante el MINAE, la Dirección General de Transporte y Comercialización de Combustibles (DGTCC) u otras dependencias bajo su rectoría, para la recalificación, extensión de vida útil o cualquier modalidad equivalente de tanques de almacenamiento de combustibles. Este listado deberá incluir, sin excepción: nombre de la empresa solicitante, ubicación exacta de los tanques, fecha de presentación de la solicitud, estado actual del trámite, funcionarios involucrados en su revisión, y cualquier criterio técnico o ambiental preliminar emitido hasta la fecha. Esta doble solicitud responde a la necesidad imperiosa de conocer no solo lo ya ejecutado bajo un marco declarado inconstitucional, sino también lo que se pretende continuar ejecutando, para prevenir riesgos ambientales graves y garantizar que la Administración actúe con plena sujeción a la resolución de la Sala Constitucional. Solicito que ambos informes sean entregados en formato PDF, debidamente firmados por la autoridad competente, en un plazo no mayor a diez (10) días hábiles contados a partir de la recepción de la presente, conforme al principio de celeridad y buena fe que rige la Administración Pública” (véase prueba aportada).\n\nb) Por oficio CARTA-DGTCC-DAJ-MINAE-2026-0169 del 30 de abril de 2026, la autoridad recurrida contestó al recurrente: “En atención al oficio AEL-0047-2026, recibida el día 16 de abril, le informo: Primero: Que el objeto de la Ley Marco de Acceso a la Información Pública, N° N° 10554, indicado en el artículo 1, que establece: “…el Estado garantice el cumplimiento efectivo del derecho humano de acceso a la información pública, de forma proactiva, oportuna, oficiosa, completa y accesible, garantizando la transparencia administrativa en el ejercicio de la función pública, fortaleciendo la rendición de cuentas por parte de las autoridades y su debida publicidad en la función pública…” Segundo: Que la Administración ha atendido y contestado en tiempo y forma cada uno de los requerimientos de información recibidos, que en los expedientes administrativos enviados mediante los oficios DGTCC-DL-2024-110, DGTCC-DL-2024-111, DGTCC-DL-2024112, DGTCC-DL-2024-113, DGTCC-DL-2024-114, DGTCC-DL2024-115, DGTCC-DL-2024-116 todos notificados el día veintiséis de abril del veinticuatro; DGTCC-DL-MINAE-002-2025 notificado el día nueve de enero del dos mil veinticinco, DGTCC-DL-MINAE051-2025 notificado el día ocho de abril del dos mil veinticinco, consta la información solicitada. Tercero: Que la atención de la información solicitada, corresponde a un gran trabajo logístico e interdisciplinario, pues prácticamente la respuesta corresponde a la revisión de los expedientes con los que usted cuenta, revisión que debe atenderse de manera conjunta con el Departamento de Ingeniería y Fiscalización y el Departamento Administrativo, pues se solicitan aspectos de diversa índole. Cuarto; Que nos encontramos ante una solicitud de información desmesurada y el tiempo requerido para estudiar detalladamente todos los expedientes administrativos (los cuales usted tiene en su poder una copia) y completar el cuadro con la información solicitada para fines desconocidos, requerirá que la Administración destine a funcionarios para atender una sola solicitud, pues como Administración, se debe cumplir con la atención de las necesidades de todos los administrado y no podrá quedarse atendiendo un solo trámite de este calibre, pues se tendría que dejar el resto de trámites en pausa, lo que causaría indefensión y dilación por la no atención de sus gestiones. Quinto: Que al respecto la Sala Constitucional mediante la resolución R-9003-2012 del 29 de junio del 2012, ha dicho: “Ejercicio abusivo del derecho de acceso a la información justifica denegación. “(…) En esos casos, efectivamente, una persona afirma ser afectada por la autoridad pública, a la que atribuye haberle violado su derecho de petición, pero a través de las circunstancias que rodean el caso planteado, se llega a comprobar que la administración está siendo sometida a peticiones repetitivas, desmesuradas, absurdas o incluso ofensivas, motivo por el cual la jurisprudencia protege a la administración y la autoridad que la encabeza, en el tanto su quehacer, de principio destinado al cumplimiento de fines públicos, valga decir, dirigidos a satisfacer necesidades de la comunidad, no puede quedar cautivo del capricho de una persona que se dedica a hostigarla con aquel tipo de peticiones. (…)”. Al revisar los oficios mencionados se determina que no existe omisiones e inconsistencias que deban ser aclaradas, por cuanto no existe aspectos confusos o mal redactados, se hizo referencia expresa a cada una de las consultas, la Administración ha brindado respuesta oportuna a todas las solicitudes recibidas, por lo anterior no es viable que se destine a funcionarios para atender una sola solicitud, por cuanto el administrado cuenta con el acceso a los expedientes administrativos en los que consta la información que nuevamente está solicitando” (véase prueba aportada por la recurrente). \n\nIII.- Sobre el caso concreto. En el sub lite, el recurrente alega que el 25 de marzo de 2026 gestionó ante el ministerio recurrido el oficio AEL-0034-2026 en el que solicitó: “1. Un informe completo y sin omisión alguna sobre todos los tanques de almacenamiento de combustibles que hayan sido recalificados o cuya vida útil haya sido extendida durante los últimos diez (10) años (período 2016-2026). El informe deberá contener, como mínimo, la siguiente información pormenorizada por cada tanque: - Identificación completa del tanque (número de serie, capacidad, fecha de instalación original y fecha de recalificación). - Ubicación exacta (provincia, cantón, distrito, coordenadas geográficas y estación de servicio o instalación correspondiente). - Nombre completo de la empresa propietaria o operadora. - Nombre y cargo de cada funcionario público o privado que autorizó, revisó o emitió criterio técnico para la recalificación. - Base normativa y técnica invocada en cada caso (incluyendo el Decreto 43449-MINAE y las normas INTE aplicadas). - Fecha exacta de la autorización y vigencia otorgada. - Cualquier otro dato relevante: informes técnicos, dictámenes, inspecciones, posibles observaciones ambientales o de la DGTCC, y si se realizó o no consulta con entes hídricos o de salud. 2. Un listado completo, actualizado y detallado de todos los permisos, solicitudes o trámites que se encuentren actualmente en proceso ante el MINAE, la Dirección General de Transporte y Comercialización de Combustibles (DGTCC) u otras dependencias bajo su rectoría, para la recalificación, extensión de vida útil o cualquier modalidad equivalente de tanques de almacenamiento de combustibles. Esta doble solicitud responde a la necesidad imperiosa de conocer no solo lo ya ejecutado bajo un marco declarado inconstitucional, sino también lo que se pretende continuar ejecutando, para prevenir riesgos ambientales graves y garantizar que la Administración actúe con plena sujeción a la resolución de la Sala Constitucional. Solicito que ambos informes sean entregados en formato PDF, debidamente firmados por la autoridad competente, en un plazo no mayor a diez (10) días hábiles contados a partir de la recepción de la presente, conforme al principio de celeridad y buena fe que rige la Administración Pública”. Aduce que el 30 de abril de 2026 recibió el oficio CARTA-DAJ-DGTCC-MINAE-2026-0169 que contiene una respuesta que estima insuficiente, incompleta, evasiva y contraria a las obligaciones constitucionales y legales de la administración. Solicita la intervención de la Sala.\n\nAl respecto, de la relación de hechos probados se desprende que por oficio CARTA-DGTCC-DAJ-MINAE-2026-0169 del 30 de abril de 2026, la autoridad recurrida contestó al recurrente: “En atención al oficio AEL-0047-2026, recibida el día 16 de abril, le informo: Primero: Que el objeto de la Ley Marco de Acceso a la Información Pública, N° N° 10554, indicado en el artículo 1, que establece: “…el Estado garantice el cumplimiento efectivo del derecho humano de acceso a la información pública, de forma proactiva, oportuna, oficiosa, completa y accesible, garantizando la transparencia administrativa en el ejercicio de la función pública, fortaleciendo la rendición de cuentas por parte de las autoridades y su debida publicidad en la función pública…” Segundo: Que la Administración ha atendido y contestado en tiempo y forma cada uno de los requerimientos de información recibidos, que en los expedientes administrativos enviados mediante los oficios DGTCC-DL-2024-110, DGTCC-DL-2024-111, DGTCC-DL-2024112, DGTCC-DL-2024-113, DGTCC-DL-2024-114, DGTCC-DL2024-115, DGTCC-DL-2024-116 todos notificados el día veintiséis de abril del veinticuatro; DGTCC-DL-MINAE-002-2025 notificado el día nueve de enero del dos mil veinticinco, DGTCC-DL-MINAE051-2025 notificado el día ocho de abril del dos mil veinticinco, consta la información solicitada. Tercero: Que la atención de la información solicitada, corresponde a un gran trabajo logístico e interdisciplinario, pues prácticamente la respuesta corresponde a la revisión de los expedientes con los que usted cuenta, revisión que debe atenderse de manera conjunta con el Departamento de Ingeniería y Fiscalización y el Departamento Administrativo, pues se solicitan aspectos de diversa índole. Cuarto; Que nos encontramos ante una solicitud de información desmesurada y el tiempo requerido para estudiar detalladamente todos los expedientes administrativos (los cuales usted tiene en su poder una copia) y completar el cuadro con la información solicitada para fines desconocidos, requerirá que la Administración destine a funcionarios para atender una sola solicitud, pues como Administración, se debe cumplir con la atención de las necesidades de todos los administrado y no podrá quedarse atendiendo un solo trámite de este calibre, pues se tendría que dejar el resto de trámites en pausa, lo que causaría indefensión y dilación por la no atención de sus gestiones. Quinto: Que al respecto la Sala Constitucional mediante la resolución R-9003-2012 del 29 de junio del 2012, ha dicho: “Ejercicio abusivo del derecho de acceso a la información justifica denegación. “(…) En esos casos, efectivamente, una persona afirma ser afectada por la autoridad pública, a la que atribuye haberle violado su derecho de petición, pero a través de las circunstancias que rodean el caso planteado, se llega a comprobar que la administración está siendo sometida a peticiones repetitivas, desmesuradas, absurdas o incluso ofensivas, motivo por el cual la jurisprudencia protege a la administración y la autoridad que la encabeza, en el tanto su quehacer, de principio destinado al cumplimiento de fines públicos, valga decir, dirigidos a satisfacer necesidades de la comunidad, no puede quedar cautivo del capricho de una persona que se dedica a hostigarla con aquel tipo de peticiones. (…)”. Al revisar los oficios mencionados se determina que no existe omisiones e inconsistencias que deban ser aclaradas, por cuanto no existe aspectos confusos o mal redactados, se hizo referencia expresa a cada una de las consultas, la Administración ha brindado respuesta oportuna a todas las solicitudes recibidas, por lo anterior no es viable que se destine a funcionarios para atender una sola solicitud, por cuanto el administrado cuenta con el acceso a los expedientes administrativos en los que consta la información que nuevamente está solicitando”.\n\nAsí las cosas, se constata la lesión a los derechos fundamentales de la parte recurrente, pues no se le brindó la información que solicitó, sino que la autoridad recurrida se limitó a indicarle que en otras ocasiones le habían remitido los expedientes administrativos donde puede buscar e identificar los datos que requiere. \n\nEn un asunto similar al que nos ocupa, esta Sala en la sentencia nro. 2026014425 de las 9:20 horas del 24 de abril de 2026 resolvió: \n\n“La falta de recurso material y/o humano no es una justificación para la lesión o amenaza de un derecho fundamental. Si la asociación necesitaba tiempo para facilitar la información así debió responder al amparado, detallando las razones, y definiendo el plazo en el cual le entregaría. Tampoco resulta legítimo que la ASADA pretenda trasladar al administrado el costo de obtener la información en el Registro Nacional, pues se trata de datos que, si bien pueden ser de difícil recopilación, sí se encuentran en los libros y registros de la ASADA”. \n\nTales consideraciones son aplicables al sub lite, pues la autoridad recurrida le denegó la información con el argumento de que recabarla requiere un gran trabajo.\n\nEn consecuencia, lo procedente es declarar con lugar el recurso, en los términos que se dictarán en la parte dispositiva de esta sentencia.\n\nIV.- Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.\n\nPor tanto:\n\nSe declara con lugar el recurso. Se le ordena a Mónica Diana Navarro del Valle en su condición de ministra de Ambiente y Energía, o a quien ocupe ese cargo, que gire las órdenes pertinentes y lleve a cabo todas las actuaciones que estén dentro del ámbito de sus competencias respectivas, para que en el plazo máximo de UN MES, contado a partir de la notificación de esta sentencia, se brinde a la parte recurrente la información solicitada el 25 de marzo de 2026. Lo anterior se dispone con la advertencia de reservar los datos sensibles y de acceso restringido, protegidos por la Ley de Protección de la Persona frente al Tratamiento de sus Datos Personales y demás normativa atinente, en caso de haberlos. Se advierte a las autoridades recurridas, que de acuerdo con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de la vía contencioso-administrativa. San José, at 9:25 a.m. on 10 July 2026.\n\nAmparo proceeding filed under case no. 26-016200-0007-CO by [Nombre 001], identity card no. [Valor 001], against the MINISTRY OF ENVIRONMENT AND ENERGY.\n\nBackground:\n\n1.- In a brief received by the Chamber’s Secretariat on 7 May 2026, the applicant files an amparo proceeding. The applicant states: “I. FACTS 1. On 25 March 2026, in my capacity as an assisting party in the Action of Unconstitutionality 25-016939-0007-CO, I submitted official letter AEL-0034-2026 requesting detailed and updated information about all fuel storage tanks. 2. On 30 April 2026, I received official letter CARTA-DAJ-DGTCCMINAE-2026-0169, which is insufficient, incomplete, evasive, and contrary to the Administration’s constitutional and legal obligations. II. ACTIVE STANDING I act with full standing as a formal assisting party in case file 25-016939-0007-CO. III. LEGAL GROUNDS – THE FRAMEWORK LAW ON ACCESS TO PUBLIC INFORMATION (NO. 10554) The Framework Law on Access to Public Information, No. 10554, directly implements Article 27 of the Political Constitution through legislation. Article 1 states in no uncertain terms: ‘The State guarantees the effective fulfillment of the human right of access to public information in a proactive, timely, ex officio, complete, and accessible manner, guaranteeing administrative transparency in the exercise of public service, strengthening accountability by the authorities and due publicity in public service.’ This provision establishes the following guiding principles, which have been violated in this case: • Principle of maximum disclosure (Article 4): All information held by the Administration is public, except for the exhaustive and duly reasoned exceptions. • Principle of gratuity (Article 5). • Principle of promptness and good faith (Article 6). • Principle of facilitation (Article 7): The Administration must provide the information in the most useful and understandable form for the requester, who need not demonstrate any special interest or justify the reason for the request. The Constitutional Chamber (Sala Constitucional) has repeatedly held that access to public information is not a second-tier right, but an instrumental and enabling right without which it is impossible to exercise and defend other fundamental rights, particularly the right to a healthy environment (Article 50 of the Constitution). In this case, the requested information is essential to fulfill my role as an assisting party in the Action of Unconstitutionality 25-016939-0007-CO and to exercise citizen oversight of compliance with the judgment that declared Decreto 43449-MINAE unconstitutional. The response received openly violates Articles 1, 4, 6, 7, and 12 of Law 10554 because it: • Does not provide the information in a complete and structured form. • Makes generic references to earlier case files without organizing the information. • Describes the request as ‘excessive’ without demonstrating actual abuse of the right. IV. RELIEF SOUGHT For all the foregoing reasons, I respectfully request that the honorable Justices: 1. Admit this amparo proceeding and grant it. 2. Order the Minister of Environment and Energy and the Director General of DGTCC to provide immediately and in full the information requested in official letter AEL-0034-2026, in an updated, structured digital format. 3. Set a maximum period of three (3) business days for compliance, under warning of the sanctions provided for in Article 71 of the Law on Constitutional Jurisdiction. 4. Maintain any interim measures deemed necessary.”\n\n2.- By resolution issued at 3:57 p.m. on 22 May 2026, the President of the Chamber admitted the proceeding and requested a report from the Minister of Environment and Energy.\n\n3.- In a brief added to the electronic case file on 1 June 2026, Mónica Diana Navarro del Valle, in her capacity as Minister of Environment and Energy, submits a sworn report. She states: “Regarding the applicant’s arguments. The records of the Directorate General of Fuel Transportation and Marketing (hereinafter, DGTCC) show that the applicant received a response to the information request made through AEL-0034-2026, which was provided as follows: Official letter CARTA-DAJ-DGTCC-MINAE-0139-2026, notified on 16 April 2026, informed him that ‘as of today no new permits, applications, or proceedings related to the reclassification, extension of useful life, or any equivalent category of fuel storage tanks have been processed’; he was also informed that, by means of official letters DGTCC-DL-2024-110, DGTCCDL-2024-111, DGTCC-DL-2024-112, DGTCC-DL-2024-113, DGTCC-DL-2024-114, DGTCC-DL-2024-115, DGTCC-DL-2024-116, notified on 26 April, and official letters DGTCC-DL-2024-0093 and DGTCC-DL-2024-0094, notified on 4 June, all in 2024, he was given access to administrative case files ES-101044, ES-101111, ES-108013, ES401042, ES-602012, ES-118015, ES-303031, ES-701014. By official letter DGTCC-DL-MINAE-002-2025, notified on 9 January 2026, DGTCC responded to a new request for certification of legal and technical criteria and actions to be taken regarding service stations with reclassified fuel storage tanks, issued by Eng. Álvaro Andrés Salas Picado, head of the Department of Engineering and Inspection. This is further proof that the applicant has and/or knows the information that he claims the Administration has failed to provide. DGTCC again informed him that no reclassification proceeding was in progress and again detailed the list of reclassified case files, which the applicant knows about and can access. However, by official letter AEL-0047-2026 dated 16 April, the applicant again requested information that had already been provided to him and is contained in the administrative case files in his possession. We are therefore faced with an excessive information request, since he seeks to have the Administration complete a table detailing fuel storage tanks that have been reclassified or whose useful life has been extended during the last ten (10) years (2016–2026), which would require reviewing each of the case files sent to him. That review would have to be carried out jointly by the Department of Engineering and Inspection and the Administrative Department, because the request covers different types of matters. Accordingly, on 5 May of this year he was notified of official letter CARTA-DGTCC-DAJ-MINAE-2026-0169, which explains that there are no omissions or inconsistencies, nor insufficient or incomplete data that are evasive and contrary to the Administration’s constitutional and legal obligations, as the applicant claims. The purpose of the Framework Law on Access to Public Information, No. 10554, is to guarantee the effective fulfillment of the human right of access to public information in a proactive, timely, ex officio, complete, and accessible manner, guaranteeing administrative transparency in the exercise of public service, strengthening accountability by the authorities and due publicity in public service. This Ministry has complied with that purpose in a timely and proper manner, but the applicant continues to request information contained in the case files in his possession. It is important to note that this honorable Chamber stated in Resolution No. 01747, issued on 9 March 1999, that: ‘… … ABUSIVE AND IMPROPER EXERCISE OF THE RIGHT TO PETITION. The Chamber has also had occasion to rule in cases involving a qualified, abusive, and perverse use of the right. In such cases, a person claims to have been affected by a public authority, which the person accuses of violating the right to petition; however, the circumstances surrounding the case establish that the Administration is being subjected to repetitive, excessive, absurd, or even offensive requests. For that reason, case law protects the Administration and the authority heading it, since its work, which is in principle aimed at fulfilling public purposes—that is, meeting the needs of the community—cannot be held captive to the whim of a person who devotes himself to harassing it with such requests. The right to petition is conceived—and can be understood in no other way—for the purpose of meeting the personal need of the person exercising it, even if that need has not been expressly stated in the request. There are situations, however, in which it is clear that the intent is to disrupt the Administration’s normal work; the constitutional protection provided for the first situation cannot be expected from this Court…’ As has been demonstrated, the Administration has complied in a timely and proper manner with each request made by the applicant, who has access to the administrative case files that enable him to complete the information table he seeks. If the Administration assigns professionals from the Engineering and Administrative Departments to review the administrative case files, this would affect public service, as they would have to stop handling the daily proceedings and requests of DGTC (…) After analyzing the applicant’s arguments and submitting the report on the facts demonstrating that this Ministry addressed the request in a timely and proper manner, we respectfully ask this honorable Chamber to dismiss the present amparo proceeding.”\n\n4.- In a brief added to the electronic case file on 2 June 2026, the applicant states: “I. CLARIFICATION OF THE FACTS AND WHAT WAS ACTUALLY REQUESTED Since official letter AEL-0034-2026 dated 25 March 2026, this applicant has requested, in his capacity as an assisting party in the Action of Unconstitutionality 25-016939-0007-CO, updated and complete information about: 1. All fuel storage tanks that have been reclassified or whose useful life has been extended during the last ten years (2016–2026), with detailed information for each tank (identification, capacity, dates, precise location with coordinates, owning company, officials responsible, legal and technical basis, environmental observations, etc.). 2. A complete and updated list of all proceedings currently underway for reclassification or extension of useful life. He did not request old information, but information updated as of the present, precisely because the Action of Unconstitutionality 25-016939-0007-CO is pending and this information is essential to properly perform my role as an assisting party and to oversee compliance with the judgment that declared Decreto 43449-MINAE unconstitutional. The Administration’s response (CARTA-DAJ-DGTCCMINAE-2026-0169 and the earlier official letters from 2024) merely refers him to old information, individual case files without organizing them, and the generic statement that ‘there are no new proceedings.’ The updated information expressly requested has not been provided. II. REBUTTAL TO THE MINISTER’S REPORT The Minister seeks to show this Chamber that the Administration ‘has complied in a timely and proper manner’ and that this applicant ‘already has the information.’ That statement is inaccurate for the following reasons: • The information provided consists mainly of official letters from 2024 (DGTCC-DL-2024-110 through 116, DGTCC-DL-2024-070, etc.). It is not a response updated through 2026. • No consolidated report, updated table, or specific requested data were provided (geographic coordinates, officials who authorized each reclassification, environmental observations, interagency consultations, etc.). • The Administration acknowledges that tanks have already been reclassified but does not provide the detailed and updated information about them, as requested. • Describing the request as ‘excessive’ is not valid when it concerns information of significant public environmental interest and is directly connected to a pending Action of Unconstitutionality. The Constitutional Chamber has been clear: the right of access to public information requires the Administration to provide information in the most useful and understandable form (principle of facilitation – Art. 7 Law 10554), not to force citizens to reconstruct the information from scattered case files. III. CONSTITUTIONAL VIOLATIONS The Administration’s conduct violates: • Articles 27 and 30 of the Political Constitution. • The principles of maximum disclosure, facilitation, promptness, and good faith under Law 10554. • The right to a healthy and ecologically balanced environment (Article 50 of the Constitution), by preventing me from performing my role as an assisting party with complete and updated information. IV. RELIEF SOUGHT For all the foregoing reasons, I respectfully request that this Honorable Chamber: 1. Take note that this reply has been submitted. 2. Grant the amparo proceeding. 3. Order the Ministry of Environment and Energy and DGTCC to provide immediately and in full the updated information requested in official letter AEL-0034-2026, in a structured digital format, duly signed and containing all the required data. 4. Set a maximum period of three (3) business days for compliance, under warning of the sanctions provided for in Article 71 of the Law on Constitutional Jurisdiction. 5. Maintain any interim measures deemed appropriate. I remain available to this Chamber for any further clarification.”\n\n5.- The legal requirements have been observed in the proceedings.\n\nJustice Rueda Leal drafts the judgment; and,\n\nReasons:\n\nI.- Object of the proceeding. The applicant alleges that on 25 March 2026 he submitted official letter AEL-0034-2026 to the respondent ministry, requesting: “1. A complete report, without any omissions, on all fuel storage tanks that have been reclassified or whose useful life has been extended during the last ten (10) years (2016–2026). At a minimum, the report must contain the following detailed information for each tank: - Complete identification of the tank (serial number, capacity, original installation date, and reclassification date). - Exact location (province, canton, district, geographic coordinates, and corresponding service station or facility). - Full name of the owning or operating company. - Name and position of every public or private official who authorized, reviewed, or issued a technical opinion on the reclassification. - Legal and technical basis invoked in each case (including Decreto 43449-MINAE and the INTE standards applied). - Exact date of authorization and period of validity granted. - Any other relevant information: technical reports, opinions, inspections, possible environmental or DGTCC observations, and whether consultation took place with water or health authorities. 2. A complete, updated, and detailed list of all permits, applications, or proceedings currently underway before MINAE, the Directorate General of Fuel Transportation and Marketing (DGTCC), or other departments under its authority, for the reclassification, extension of useful life, or any equivalent category of fuel storage tanks. This list must include, without exception: the name of the applicant company, the exact location of the tanks, the date the application was submitted, the current status of the proceeding, the officials involved in its review, and any preliminary technical or environmental opinion issued to date. This dual request responds to the urgent need to know not only what has already been carried out under a framework declared unconstitutional, but also what is intended to continue, in order to prevent serious environmental risks and ensure that the Administration acts in full compliance with the Constitutional Chamber’s ruling. I request that both reports be delivered in PDF format, duly signed by the competent authority, within no more than ten (10) business days of receipt of this request, in accordance with the principle of promptness and good faith governing the Public Administration.” He alleges that on 30 April 2026 he received official letter CARTA-DAJ-DGTCC-MINAE-2026-0169, which contains a response he considers insufficient, incomplete, evasive, and contrary to the Administration’s constitutional and legal obligations. He requests the Chamber’s intervention.\n\nII.- Facts found. The following facts are considered duly established and relevant to the decision in this matter:\n\na) On 25 March 2026, the applicant submitted official letter AEL-0034-2026 to the Ministry of Environment and Energy, requesting: “1. A complete report, without any omissions, on all fuel storage tanks that have been reclassified or whose useful life has been extended during the last ten (10) years (2016–2026). I request that both reports be delivered in PDF format, duly signed by the competent authority, within no more than ten (10) business days of receipt of this request, in accordance with the principle of promptness and good faith governing the Public Administration” (see evidence submitted).\n\nb) By official letter CARTA-DGTCC-DAJ-MINAE-2026-0169 dated 30 April 2026, the respondent authority replied to the applicant: “Regarding official letter AEL-0047-2026, received on 16 April, I inform you as follows: First: The purpose of the Framework Law on Access to Public Information, No. 10554, set out in Article 1, is to provide that ‘…the State guarantees the effective fulfillment of the human right of access to public information in a proactive, timely, ex officio, complete, and accessible manner, guaranteeing administrative transparency in the exercise of public service, strengthening accountability by the authorities and due publicity in public service…’ Second: The Administration has handled and answered each information request received in a timely and proper manner; the requested information is contained in the administrative case files sent by official letters DGTCC-DL-2024-110, DGTCC-DL-2024-111, DGTCC-DL-2024112, DGTCC-DL-2024-113, DGTCC-DL-2024-114, DGTCC-DL2024-115, DGTCC-DL-2024-116, all notified on 26 April 2024; DGTCC-DL-MINAE-002-2025, notified on 9 January 2025; and DGTCC-DL-MINAE051-2025, notified on 8 April 2025. Third: Providing the requested information entails substantial logistical and interdisciplinary work, since responding would essentially require reviewing the case files you have, a review that must be carried out jointly by the Department of Engineering and Inspection and the Administrative Department, because the request concerns different types of matters. Fourth: We are faced with an excessive information request, and the time required to study all the administrative case files in detail (copies of which you have) and complete the requested table for unknown purposes would require the Administration to assign officials to handle a single request. As an Administration, we must attend to the needs of all members of the public and cannot devote ourselves to handling a single proceeding of this magnitude, as that would require pausing the other proceedings, causing a denial of procedural protection and delays in handling your submissions. Fifth: In this regard, the Constitutional Chamber stated in resolution R-9003-2012 of 29 June 2012: ‘Abusive exercise of the right of access to information justifies denial. “(…) In such cases, a person claims to have been affected by a public authority, which the person accuses of violating the right to petition; however, the circumstances surrounding the case establish that the Administration is being subjected to repetitive, excessive, absurd, or even offensive requests. For that reason, case law protects the Administration and the authority heading it, since its work, which is in principle aimed at fulfilling public purposes—that is, meeting the needs of the community—cannot be held captive to the whim of a person who devotes himself to harassing it with such requests. (…)”’ Upon reviewing the aforementioned official letters, it is determined that there are no omissions or inconsistencies requiring clarification, since nothing is confusing or poorly written and each inquiry was expressly addressed. The Administration has responded promptly to all requests received; therefore, it is not feasible to assign officials to handle a single request, given that the member of the public has access to the administrative case files containing the information he is requesting again” (see evidence submitted by the applicant).\n\nIII.- The case at hand. In this case, the applicant alleges that on 25 March 2026 he submitted official letter AEL-0034-2026 to the respondent ministry, requesting: “1. A complete report, without any omissions, on all fuel storage tanks that have been reclassified or whose useful life has been extended during the last ten (10) years (2016–2026). The Administration has responded promptly to all requests received; therefore, it is not feasible to assign officials to handle a single request, given that the member of the public has access to the administrative case files containing the information he is requesting again.”\n\nAccordingly, it is established that the fundamental rights of the applicant have been violated, since the requested information was not provided; instead, the respondent authority merely told him that it had previously sent him the administrative case files where he could search for and identify the data he needs.\n\nIn a similar case, this Chamber held in judgment no. 2026014425, issued at 9:20 a.m. on 24 April 2026:\n\n“Lack of material and/or human resources is not a justification for violating or threatening a fundamental right. If the association needed time to provide the information, it should have so informed the amparo applicant, giving the reasons and specifying the period within which it would provide the information. Nor is it legitimate for the ASADA to shift to the member of the public the cost of obtaining the information from the National Registry, since although the data may be difficult to compile, it is contained in the ASADA’s books and records.”\n\nThose considerations apply to this case, since the respondent authority denied the information on the grounds that compiling it would entail substantial work.\n\nConsequently, the amparo proceeding must be granted on the terms set out in the operative part of this judgment.\n\nIV.- Documents submitted to the case file. The parties are advised that if they submitted any paper document, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected within a maximum period of 30 business days from notification of this judgment. Any material not collected within that period will be destroyed, pursuant to the “Regulations on Electronic Case Files before the Judiciary” (approved by the Full Court in Article XXVI of session no. 27-11 of 22 August 2011 and published in Judicial Bulletin no. 19 of 26 January 2012) and Article LXXXI of session no. 43-12 of the Superior Council of the Judiciary of 3 May 2012.\n\nTherefore:\n\nThe amparo proceeding is granted. Mónica Diana Navarro del Valle, in her capacity as Minister of Environment and Energy, or whoever holds that office, is ordered to issue the relevant instructions and carry out all actions within the scope of her respective powers so that, within a maximum period of ONE MONTH from notification of this judgment, the information requested by the applicant on 25 March 2026 is provided. This order is made subject to the reservation of sensitive and restricted-access data protected by the Law on the Protection of Individuals with regard to the Processing of Their Personal Data and other applicable regulations, if any. The respondent authorities are advised that, pursuant to Article 71 of the Law on Constitutional Jurisdiction, a person who receives an order to be complied with or enforced, issued in an amparo proceeding, and fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State is ordered to pay the costs, damages, and losses caused by the facts underlying this declaration, to be calculated in enforcement proceedings in the administrative-litigation jurisdiction.
