Nº 2026025738\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del diez de julio de dos mil veintiseis .\n\n Recurso de amparo que se tramita en el expediente nro. 26-016746-0007-CO, interpuesto por Nombre01, cédula de identidad CED01, contra el SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC) y el MINISTERIO PÚBLICO.\n\nResultando:\n\n1.- Por escrito recibido en la Sala el 12 de mayo de 2026, la persona accionante interpone un recurso de amparo. Manifiesta que, desde el 2005 se encuentra abierto ante la Fiscalía Ambiental el expediente penal número 05-001155-0597-PE, por presuntas afectaciones gravísimas al Humedal Río Carbón – Playa Negra, sin resolución alguna tras veintiún (21) años de mora judicial intolerable e inaceptable. Afirma que, durante estas más de dos décadas, y de manera particularmente intensa y acelerada en los últimos quince (15) años, se ha producido una destrucción sistemática, rutinaria y devastadora del humedal: mansiones de lujo, carreteras pavimentadas, comercios y urbanizaciones ilegales han invadido de forma masiva su integridad territorial, con el agravante de que maquinaria propiedad de la Municipalidad de Talamanca ha sido utilizada directamente para facilitar este desarrollo inmobiliario ilegal. Menciona que, de forma cotidiana y especialmente los fines de semana, es una práctica habitual y perfectamente observable la entrada de camiones cargados de escombros que realizan labores de relleno directo sobre el humedal, tala de vegetación hidrófila y drenajes artificiales que aceleran su colapso ecológico. Alude que, el propio SINAC reconoció en su CARTA-SINAC-SE-DE-PNH-0017-2026 del 07 de mayo de 2026, la continua urbanización ilegal del humedal, pero se ha limitado a una respuesta tibia, insuficiente e inadmisible, negándose a generar la información técnica actualizada y el mapa georreferenciado que el recurrente ha solicitado insistentemente. Arguye que, la negativa categórica, deliberada e intolerable del SINAC y de su Coordinador Nacional de Humedales, resulta extremadamente grave. Esa información técnica es imprescindible e inaplazable no solo para motivar la intervención urgente de la Procuraduría General de la República ante el Juzgado Penal de Bribri, sino fundamentalmente para hacer posible cualquier eventual restauración del ecosistema. Esgrime que, conforme a los principios básicos de la ciencia y la técnica ambiental, resulta fundamental e indispensable obtener un diagnóstico adecuado y una auditoría ambiental completa del estado actual del Humedal Río Carbón – Playa Negra. En particular, el mapa descriptivo y actualizado del Humedal de Playa Negra constituye un insumo de vital importancia para fortalecer la defensa jurídica, técnica y administrativa del ecosistema. Sin este instrumento cartográfico oficial y georreferenciado resulta imposible delimitar con precisión las áreas afectadas, identificar las ocupaciones ilegales, visualizar el avance de la urbanización y sustentar de manera contundente las acciones de protección, desalojo y restauración. Dicho diagnóstico y mapa deben determinar con precisión: “• El grado y tipo de ocupación ilegal del humedal, • El tipo, número, características y valor de las construcciones existentes (incluidas aquellas vinculadas a exfuncionarios municipales), • Las acciones concretas de desalojo, demolición, remoción de escombros, restauración hidrológica, revegetación y recuperación de la funcionalidad ecosistémica.” (sic). Menciona que, el informe técnico oficial del SINAC denominado “Caracterización y delimitación de humedales en la zona marítimo terrestre del litoral del cantón de Talamanca” (ACLAC, junio de 2021). Durante el prolongado período en que el Ministerio de Ambiente y el Área de Conservación La Amistad Caribe archivaron, ocultaron y mantuvieron fuera del conocimiento público y del Sistema Nacional de Información Territorial (SNIT) dicho informe técnico, la Municipalidad de Talamanca emitió, en tiempo récord, una enorme cantidad de permisos de construcción dentro de la integridad misma del Humedal Río Carbón – Playa Negra, permitiendo la urbanización acelerada e ilegal del ecosistema protegido. Pese a que la Sala Constitucional declaró oficial este informe, los daños ambientales graves e irreversibles originados durante su archivo y su posterior desaparición del SNIT subsisten y continúan agravándose hasta la fecha de interposición de este recurso. Estima que, las graves consecuencias legales derivadas de la explotación y desarrollo urbanístico masivo del humedal han provocado que tanto el SINAC como la Municipalidad de Talamanca mantengan un silencio absoluto, lo que evidencia una posible complicidad institucional en la desaparición del humedal del SNIT y en la destrucción sistemática de Playa Negra y toda la zona del Río Carbón. Con base en los alegatos expuestos, estima que, con las actuaciones acusadas, se están vulnerando derechos fundamentales. Solicita que se declare con lugar el recurso con las consecuencias de ley. \n\n2.- Por resolución de las 21:54 horas del 12 de junio de 2026 se dio curso al amparo.\n\n3.- Manifiesta el recurrente: “ESCRITO DE FUNDAMENTACIÓN ADICIONAL Y DENUNCIA DE MORA JUDICIAL por parte del Ministerio Público, específicamente del Fiscal Coordinador de la Fiscalía Adjunta Agrario-Ambiental, Lic. Luis Diego Hernández Araya, en relación con la omisión persistente en la protección del Humedal Río Carbón – Playa Negra (Patrimonio Natural del Estado). Lo hago con fundamento en la Resolución N° 384-2026 de la Unidad de Inspección Fiscal de 5 de junio de 2026 y en toda la documentación técnica y probatoria que ya obra en el expediente, incluyendo el informe oficial del SINAC de junio de 2021 y la CARTA-SINAC-SE-DE-PNH-0017-2026 del 7 de mayo de 2026. I. ANTECEDENTES PROCESALES QUE ACREDITAN LA MORA JUDICIAL Desde el año 2005 se encuentra abierto el expediente penal N° 05- 001155-0017-PE ante la Fiscalía Ambiental por presuntas invasiones, rellenos y afectaciones graves al Humedal Río Carbón – Playa Negra. Han transcurrido veintiún (21) años sin que exista resolución de fondo, condena, absolución o medida efectiva de protección o restauración. El 12 de mayo de 2026 presenté queja formal ante la Unidad de Inspección Fiscal por retraso injustificado (causa administrativa N° 26-000260-1821-DI). El 5 de junio de 2026 dicha queja fue desestimada mediante la Resolución N° 384-2026, bajo el argumento formal de que el quejoso “no es parte procesal” y, por ende, carece de acceso al expediente conforme al artículo 295 del Código Procesal Penal. El informe del Lic. Luis Diego Hernández Araya (27 de mayo de 2026) reconoce que la causa ya se encuentra elevada a juicio y que el imputado se halla en rebeldía. Es decir, el proceso penal ha superado la etapa preparatoria, pero sigue sin resolución efectiva después de más de dos décadas. II. ANÁLISIS CONSTITUCIONAL DE LA MORA JUDICIAL La desestimación formal de la queja por falta de calidad de parte no impide el análisis sustantivo de la mora judicial a la luz de los mandatos constitucionales. El artículo 41 de la Constitución Política garantiza a toda persona el derecho a que se le administre justicia pronta y cumplida. Este derecho adquiere rango reforzado cuando se trata de la protección del ambiente (artículo 50 constitucional), derecho fundamental cuya tutela ha sido calificada por esta Sala como reforzada, con aplicación de los principios de efectividad, no regresión ambiental, precaución e in dubio pro natura. Conforme a reiterada jurisprudencia de esta Sala Constitucional, cuando existe daño ambiental continuo e irreversible —como la urbanización acelerada del Humedal Río Carbón–, los plazos procesales se acortan drásticamente. La mora judicial de veintiún años en el expediente penal N° 05-001155-0017-PE configura una violación flagrante de los artículos 41 y 50 de la Constitución Política, máxime cuando el daño persiste y se agrava cada día. El artículo 295 del Código Procesal Penal, que regula la privacidad de la etapa preparatoria, es una norma de orden procesal ordinario que no puede interpretarse ni aplicarse de manera que vacíe de contenido los derechos fundamentales consagrados en la Constitución. La limitación de acceso al expediente no exime al Ministerio Público de su deber constitucional de impulsar los procesos con la celeridad que exige la tutela efectiva de derechos fundamentales, especialmente cuando existe daño ambiental en curso y el proceso ya se encuentra elevado a juicio. El hecho de que el imputado se encuentre en rebeldía no justifica la inacción de veintiún años. Al contrario, refuerza la obligación del Ministerio Público de adoptar las medidas procesales pertinentes para evitar que la impunidad se convierta en un mecanismo de destrucción ambiental. La Resolución N° 384-2026, al limitarse a un análisis puramente formal, evade el fondo del problema constitucional: la existencia de una mora judicial intolerable que, por su duración y por las consecuencias ambientales irreversibles que genera, constituye una violación continuada de los artículos 41 y 50 de la Constitución Política. Esta Sala ha intervenido reiteradamente en casos de omisión o mora que permiten daño ambiental continuo, ordenando medidas inmediatas de protección y plazos perentorios para la elaboración de estudios técnicos y mapas georreferenciados, especialmente cuando se trata de humedales costeros y la obligación de las autoridades de actualizar información cartográfica oficial. III. VINCULACIÓN CON EL PRESENTE AMPARO La omisión del Lic. Luis Diego Hernández Araya forma parte de un patrón de inacción institucional que ha permitido —y sigue permitiendo— la destrucción acelerada e irreversible del Humedal Río Carbón – Playa Negra, tal como se detalla en el cuerpo del presente amparo y en la documentación técnica que obra en el expediente. La mora judicial en el expediente penal N° 05-001155-0017-PE no solo vulnera el derecho a la tutela judicial efectiva, sino que constituye el mecanismo mediante el cual se perpetúa la violación del artículo 50 constitucional. Mientras el proceso penal permanece estancado, la urbanización ilegal continúa, se emiten permisos y se destruye un ecosistema que forma parte del Patrimonio Natural del Estado”. Además, “I. DE LA EXTREMA GRAVEDAD DE LA SITUACIÓN Y LA NECESIDAD DE INTERVENCIÓN CONSTITUCIONAL El Humedal de Playa Negra se encuentra en una situación de extrema gravedad que exige la intervención prioritaria e inmediata de la jurisdicción constitucional. Esta gravedad no es una apreciación subjetiva. Está acreditada por la existencia de rellenos ilegales documentados, por la persistencia de amenazas sobre un ecosistema costero de alto valor ecológico, y por la insuficiencia de las respuestas administrativas ordinarias para garantizar su protección efectiva. La situación reviste tal entidad que trasciende el ámbito de la tutela administrativa y reclama la actuación de esta Sala Constitucional para evitar daños irreversibles a un bien jurídico de rango constitucional. II. OBJETO DEL PRESENTE MEMORIAL El presente memorial tiene como propósito aportar prueba documental de especial relevancia que acredita agresiones concretas contra el Humedal de Playa Negra y fundamentar la necesidad de que esta Sala Constitucional adopte medidas efectivas de protección, ante la demostrada insuficiencia de los mecanismos ordinarios de tutela ambiental. III. PRUEBA DOCUMENTAL APORTADA (A MAYOR ABUNDAMIENTO) En este acto se aporta como prueba documental el oficio SINACACLAC-PCP-47-2019 de fecha 28 de marzo de 2020, suscrito por funcionarios del Programa de Prevención, Control y Protección Ambiental del Área de Conservación La Amistad Caribe (SINAC), mediante el cual se presenta denuncia formal por relleno de humedal ante la Fiscalía de Bribrí. De dicho documento se desprende lo siguiente: • El día 27 de marzo de 2020, funcionarios del SINAC realizaron una inspección en el sector de Playa Negra, específicamente en las coordenadas E633719 N1068941. • Se constató que se estaba realizando un relleno ilegal de humedal con tierra, por un volumen aproximado de 24 m³, utilizando una vagoneta marca MACK. • El área intervenida corresponde a un humedal de pantano arbustivo, según el Registro Nacional de Humedales del Sistema Nacional de Áreas de Conservación. • En el sitio se observaron especies indicadoras de humedal tales como yolillo (Raphia taedigara), coquito (Elaeis oleifera) y aracea (Homalomena wendlandii), así como presencia de espejos de agua. • Se emitió acta de paralización y medidas cautelares N° SINAC-ACLAC-PCP-016-2020. • Se solicitó la investigación del permiso de uso de suelo otorgado por el Consejo Municipal de Talamanca en un área declarada como humedal, y la restauración del ecosistema a costa del infractor, conforme al artículo 98 de la Ley de Conservación de Vida Silvestre. Esta prueba acredita de manera oficial e indubitable que el Humedal de Playa Negra ha sido objeto de agresiones directas y que persisten condiciones de vulnerabilidad que justifican una protección constitucional reforzada y urgente. IV. FUNDAMENTACIÓN JURÍDICA El derecho a un ambiente sano y ecológicamente equilibrado, consagrado en el artículo 50 de la Constitución Política, impone al Estado la obligación positiva de proteger de manera efectiva los ecosistemas estratégicos. Cuando, como en el presente caso, se acredita la existencia de daños concretos a un humedal costero y la persistencia de amenazas, la jurisdicción constitucional está llamada a intervenir de forma prioritaria para evitar que se consoliden afectaciones irreversibles. La Ley Orgánica del Ambiente y la Ley de Biodiversidad refuerzan esta obligación estatal, especialmente cuando se trata de humedales que prestan servicios ambientales esenciales y que forman parte del patrimonio natural del Estado. La gravedad acreditada del Humedal de Playa Negra exige que esta Sala Constitucional adopte medidas que garanticen una protección efectiva, superando la tutela meramente declarativa y ordenando acciones concretas que prevengan daños irreversibles”.\n\n4.- Informa bajo juramento Carlos Matamoros Ureña, en su condición de fiscal auxiliar de la Fiscalía Ambiental de Limón, lo siguiente: “Vista y analizada que fuera la causa penal 05-001155-0597-PE, que se sigue en contra de Nombre02, canadiense, cédula de residencia CED02, por el delito de Construcción Ilegal en la Zona Marítimo Terrestre, Invasión de Áreas de Protección y Drenaje de Humedal, en Limón, Talamanca, Cahuita, Puerto Viejo, Playa Negra, es que, en primer lugar, se desmiente que la investigación se tramita o se tramitó en éste despacho, sino que ésta fue investigada y acusada por parte de la Fiscalía de Bribri, por parte de la Licda. Hazel Jiménez Villanueva, fiscal auxiliar. En segundo lugar, se aclara que actualmente dicha causa se encuentra en trámite por parte del Tribunal de Juicio de Limón (sede Bribri). Tomando en consideración lo anterior, si bien es un aspecto que deberá ser informado por parte del Tribunal de Juicio, preliminarmente les expongo, que, del examen del expediente, se constata que en la causa se pretende realizar el señalamiento para la realización del Debate Oral y Público, sin embargo, mediante resolución de las once horas con veinte minutos del primero de agosto del dos mil veinticuatro, el Tribunal ordenó la declaratoria de rebeldía y captura del imputado. En seguimiento de dicha orden judicial, se denota que se realizaron diligencias dirigidas a localizar al imputado. En fecha 12 de septiembre de 2024 el Tribunal recibió la respuesta CAP-NEGATIVA No. 149-ORB-2024 emitida por el Organismo de Investigación Judicial, en la cual se informó que no fue posible ubicar al encartado. Posteriormente, en fecha 04 de noviembre de 2025, en coadyuvancia con el Tribunal de Juicio de Limón y de la Fiscalía de Bribri, éste despacho gestionó orden de detención del imputado mediante coordinación con la Fuerza Pública de Talamanca, sin que a la fecha se haya logrado su localización, e incluso, el 05 de noviembre del 2025 el Tribunal de Juicio de Limón, envió una nueva orden de localización y captura del imputado. Asimismo, el Tribunal competente solicitó información migratoria del imputado, determinándose que este se encontraba en territorio nacional. Tal circunstancia fue valorada por el órgano jurisdiccional al momento de mantener la declaratoria de rebeldía. A la fecha de rendición de este informe, el imputado continúa declarado rebelde, encontrándose vigente la orden de captura correspondiente. No se ha recibido información adicional por parte del Organismo de Investigación Judicial ni de la Fuerza Pública que permita establecer su ubicación o ejecutar la orden judicial pendiente. En consecuencia, debe indicarse que la tramitación del proceso se ha visto materialmente limitada por la imposibilidad de hacer comparecer al imputado al proceso penal, situación que ha motivado la declaratoria de rebeldía y la emisión de las respectivas órdenes de captura, respecto de las cuales el Ministerio Público ha realizado las gestiones que se encuentran dentro del ámbito de sus competencias. Por lo anterior, se rechaza que exista una inactividad atribuible al Ministerio Público en relación con la localización del imputado o para la resolución de la situación jurídica ambiental que se investiga, ya que también es preocupación de este despacho. Por lo expuesto, respetuosamente les solicito se tenga por presentado el presente informe y que además se solicite informe al Tribunal de Juicio, quien podrá acreditar lo expuesto. Se rinde la presente con base en las copias del expediente principal y se rinde informe bajo juramento”.\n\n 5.- Informa bajo juramento Giovanna Valverde Stark, en su condición de ministra a.i. del Ministerio de Ambiente y Energía, lo siguiente: “PRIMERO: Que en relación sobre los hechos indicados en el presente recurso de amparo se solicitó informe mediante el oficio CARTA-SINAC-DAJ-0245-2026 de fecha 16 de junio del año 2026, a la señora MSc. Maylin Mora Arias Directora Regional del Área de Conservación la Amistad Caribe y al señor MSc.Rotney Piedra Chacón Coord. Programa Nacional de Humedales Ambos del Sistema Nacional de Áreas de Conservación; en el cual se remite por este medio el oficio mediante el informe CARTA-SINAC-ACLAC-DR-0357-2026 de fecha 17 de junio de 2026, que adjunto como prueba y se indican a continuación: “…En atención a los hechos alegados por el recurrente, contra el Sistema Nacional de Áreas de Conservación, precede indicar: PRIMERO: Contrario a lo manifestado por el recurrente, la respuesta brindada por el Coordinador del Programa Nacional de Humedales no puede calificarse de \"tibia, insuficiente e inadmisible\", pues dicha valoración desconoce por completo la naturaleza jurídica, el alcance competencial y la posición institucional que ocupa dicho Programa dentro de la estructura del SINAC y del MINAE. El Programa Nacional de Humedales fue creado mediante Decreto Ejecutivo N.° 36427, vigente desde el 28 de abril de 2011, con una finalidad eminentemente técnica y asesora: promover, planificar y desarrollar los humedales de Costa Rica, así como ejecutar los acuerdos y lineamientos emanados del Comité Nacional de Humedales. La administración, protección y manejo concreto de los humedales recae, por mandato expreso de dicho Decreto, en el SINAC a través de sus once Áreas de Conservación, cuyos directores ejercen las funciones y competencias que la Ley de Biodiversidad establece en sus artículos 22 al 33. En consecuencia, el Coordinador del Programa Nacional de Humedales no ostenta, ni puede ostentar, las atribuciones propias de un director de Área de Conservación, por lo que se le ha dado respuesta al señor Nombre01 de conformidad con su competencia y la información disponible. Esta situación no es nueva ni desconocida para el señor Nombre01, pues le ha sido explicada en reiteradas oportunidades mediante oficios previos, según consta en el expediente del recurso de amparo N.° 0031-0007-237388745- 2340-F, lo que evidencia que su insistencia no obedece a un vacío de información, sino a una negativa a aceptar la distribución competencial legalmente establecida dentro de la institución. SEGUNDO: Que en múltiples escritos, el denunciante hace referencia al ecosistema de humedal Playa Negra, también conocido como humedal Río Carbón, el cual comprende una extensión amplia. Por ejemplo, en la gestión MLV-009-2026 no se aportan coordenadas, dirección exacta, plano catastrado, punto de referencia verificable, fotografías georreferenciadas ni otros elementos mínimos que permitan ubicar con certeza el sitio donde supuestamente se estarían presentando los hechos denunciados. Sin detrimento de lo anterior, el Reglamento a la Ley Forestal N.° 7575 establece que la Administración Forestal del Estado (AFE), función ejercida por el SINAC, debe investigar toda denuncia presentada y emitir un informe en un plazo máximo de 15 días, prorrogable en casos complejos. Si de la investigación se desprende la necesidad de iniciar acciones administrativas o legales, estas deben promoverse conforme al ordenamiento jurídico. Cuando funcionarios del MINAE-SINAC conocen hechos que podrían constituir delitos ambientales contra humedales, tienen el deber de denunciarlos ante el Ministerio Público. Esta obligación proviene del artículo 281 del Código Procesal Penal, aplicable a los funcionarios públicos que, en ejercicio de sus funciones, tengan conocimiento de delitos perseguibles de oficio. Siendo que los humedales constituyen ecosistemas protegidos por la legislación ambiental costarricense, particularmente por la Ley Orgánica del Ambiente, la Ley de Conservación de la Vida Silvestre y la Ley Forestal, cuando el SINAC detecta rellenos, drenajes, cambios de uso del suelo, tala, construcción u otras actividades que puedan afectar un humedal, no solo puede, sino que debe activar los mecanismos administrativos y, cuando corresponda, penales. Con este antecedente competencial, resulta imprescindible indicar a esta honorable sala que desde el año 2005, esta autoridad realizó la investigación correspondiente, presentó denuncia penal ante el Ministerio Público, bajo el expediente 05-001155-0597-PE. A continuación, se resumen algunas acciones generales realizadas por la institución, dentro de la causa 05-001155-0597-PE. • Desde finales del año 2002, el señor Nombre03, vecino del sector y dirigente comunal, interpuso denuncia ante el Concejo Municipal de Talamanca por las actividades desarrolladas en el terreno en uso del señor Nombre02, al considerar que estaban alterando el equilibrio natural del sitio. Estos hechos quedaron vinculados al expediente N.° 0027-03-TAA del Tribunal Ambiental Administrativo, el cual constituye un antecedente clave, pues demuestra que las presuntas afectaciones al Humedal Río Carbón ya habían sido puestas en conocimiento de autoridades administrativas ambientales desde ese momento. • El 26 de octubre de 2002, funcionarios de la Subregión Talamanca del Área de Conservación La Amistad Caribe, específicamente la Ing. Lucrecia Monterrosa Smith y el Biólogo Donald Campbell Lindo, realizaron una inspección en el terreno en uso del señor Nombre02. En dicha diligencia se determinaron actividades de chapeo, relleno, drenaje y quemas en zona de humedal. Como resultado, se generó comunicación técnica dirigida al entonces Alcalde Municipal de Talamanca, Derloy Mayrie, señalando los hechos encontrados y, en particular, el drenaje del humedal. • El 4 de febrero de 2003, mediante oficio AAA-076-2003, la Procuraduría General de la República se refirió ante el Tribunal Ambiental Administrativo sobre la remoción de vegetación y el cercado de la zona restringida contigua al terreno ocupado por el señor Nombre02. En dicho oficio, con copia al Concejo Municipal de Talamanca, se solicitó levantar el informe previsto en el artículo 13 de la Ley N.° 6043, con el fin de valorar el desalojo de presuntos infractores, la demolición de construcciones si correspondía y la interposición de denuncias ante el Ministerio Público. • El Tribunal Ambiental Administrativo tramitó el expediente N.° 0027-03-TAA contra el entonces Alcalde Municipal de Talamanca, Lic. Rugeli Morales, y contra el señor Nombre02. • En octubre de 2004, el Biól. Juan Sánchez, de la oficina de humedales del SINAC, junto con la señora Vera Montero del SINAC y Anael Fuentes del ACLAC, procedieron a delimitar el área del Humedal Río Carbón. En esta inspección se determinó el carácter de humedal y bosque de la zona, así como actividades desarrolladas por el señor Nombre02, identificado en el documento como “el checo”. Este hito es esencial porque consolida técnicamente la condición ambiental protegida del sitio. • En abril de 2005, el Ing. Marcelo Pacheco, jefe de la Subregión Talamanca del ACLAC, se apersonó al sitio junto con el Lic. Dani Arguello, asesor legal de la Municipalidad de Talamanca, para verificar si continuaban las actividades de construcción y relleno. En la diligencia se constató la presencia de materiales de construcción y signos de labores recientes. • Mediante el oficio SINAC-SE-GASP-165-05, del 13 de julio de 2005, se documentó el informe de inspección sobre la delimitación del Humedal Río Carbón, elaborado por el Biól. Juan Sánchez, del Departamento de Humedales del Sistema Nacional de Áreas de Conservación en ese entonces. te documento fue ofrecido como prueba documental dentro de la denuncia penal, por constituir un insumo técnico clave para acreditar la condición de humedal del área intervenida. • En noviembre de 2005, funcionarios del Comité Local Forestal de Talamanca, del ACLAC y del Ministerio de Salud realizaron una nueva inspección en el terreno citado. En dicha diligencia se comprobó la existencia de cuatro construcciones, huecos para postes eléctricos, zanjas, vegetación quemada y otras anomalías, indicándose además que las construcciones estaban dentro del humedal. También se constató que el camino se encontraba cerrado a partir de la casa del señor Nombre02. • Con base en los antecedentes administrativos, técnicos e interinstitucionales descritos, en el año 2005 se presentó denuncia penal ante el Ministerio Público, dando origen a la causa N.° 05-001155- 0597-PE, por presuntos delitos de drenaje de humedales, tala ilegal y cambio de uso de suelo dentro del área del Humedal Río Carbón, en terrenos en uso de particulares dentro de la Zona Marítimo Terrestre, en el sector de Playa Negra, Puerto Viejo de Talamanca. • Dentro de la denuncia penal se solicitó al Ministerio Público gestionar medidas cautelares ante el Juzgado Penal de Talamanca, incluyendo la paralización inmediata de las obras de construcción, la realización de acciones para devolver el humedal a su estado natural y el derribo de las obras edificadas, si así correspondía. También se pidió requerir prueba documental, inspección ocular, peritajes técnicos y certificaciones a distintas instituciones, incluyendo el Tribunal Ambiental Administrativo, la Municipalidad de Talamanca, el Instituto Geográfico Nacional y el SINAC. Por otra parte, estas actuaciones administrativas son de conocimiento del recurrente, dado que en fecha 04 de julio del año 2025, remitió correo electrónico al licenciado Carlos Matamoros Ureña, con asunto relacionado a ecosistemas de humedal de Playa Negra, tal y como se aprecia en la imagen (…) Figura n°1: Correo electrónico del recurrente solicitando resolver la causa 05-001155-0597-PE Adicionalmente, constan otras atenciones realizadas en el sitio que dieron origen a denuncias interpuestas ante la autoridad judicial, identificadas bajo los siguientes números de expediente: 23-000190-0597-PE; 24-000377-0597-PE; 05-001155-0597-PE; 20-001193-0472-PE; 22-000001-1851-PE; 20-001095-0485-PE. Es decir, la administración forestal del estado ha realizado y diligenciado las acciones administrativas, técnicas y legales para atender los delitos ambientales en el sector de Playa Negra, Puerto Viejo de Talamanca. TERCERO: Que en respuesta a nota MLV-00140-2026, relacionada con denuncia por afectaciones al Humedal Río Carbón, Playa Negra, Puerto Viejo de Talamanca, atendida por el MSc. Rotney Piedra mediante oficio CARTA-SINAC-SE-DE-PNH-0017-2026 del 07 de mayo de 2026., se le indica al denunciante: “dentro del ámbito de sus competencias, ha sido informado que el ACLAC interpuso una causa penal desde el año 2005 con respecto a las presuntas afectaciones al Humedal Río Carbón en el sector de Playa Negra, Puerto Viejo de Talamanca, la cual se tramita bajo el expediente N° 05-001155-0597-PE. Desde entonces, la información técnica generada por el ACLAC ha sido aportada al expediente judicial. Debido a que ya existe una causa penal abierta, el SINAC reitera su disposición activa de coordinar con la Fiscalía Ambiental, el Organismo de Investigación Judicial y cualquier otra autoridad competente para ampliar información, participar en inspecciones de campo, rendir peritajes técnicos, aportar antecedentes institucionales o colaborar en todas las diligencias que sean formalmente requeridas para concretar la resolución de dicho expediente. El Programa Nacional de Humedales estará atento para apoyar al ACLAC en lo que requieran, en tanto el SINAC enfatiza su responsabilidad institucional, la cual se ejerce dentro del marco legal vigente y en coordinación con las instancias judiciales y de investigación correspondientes. Por último, en relación con la generación de un mapa del humedal, se indica que la información disponible a la fecha se encuentra en el Registro Nacional de Humedales y puede ser consultado mediante el visor del Sistema Nacional de Información Territorial (SNIT). De acuerdo con la Ley Marco de Acceso a la Información Pública (Ley N.º 10554), no obliga a generar nuevos productos técnicos por solicitud particular” Se muestra entonces que, la respuesta brindada por el señor Piedra es correcta y congruente con la solicitud del recurrente, la competencia institucional, la información pública disponible y el acceso a la información con que cuenta la administración. CUARTO: Que respecto a la solicitud de un mapa actualizado, georreferenciado y oficial sobre la afectación del Humedal Río Carbón – Playa Negra, se reitera lo indicado en la CARTA-SINAC-SE-DE-PNH-0017-2026, en el sentido de que la información cartográfica oficial disponible sobre humedales forma parte del Registro Nacional de Humedales y puede ser consultada públicamente mediante el visor del Sistema Nacional de Información Territorial (SNIT), creado mediante Decreto Ejecutivo N.° 37773-JP-H-MINAE-MICITT. Así lo estipula, el artículo 8 de la Ley N.° 10554, que señala que la Administración puede orientar al administrado hacia las plataformas oficiales de acceso a información pública cuando los datos solicitados ya se encuentren disponibles institucionalmente, sin que ello implique, en todos los casos, la obligación de generar nuevos estudios técnicos o productos cartográficos específicos a solicitud de parte. Así también, mediante oficio CARTA-SINAC-ACLAC-DR-DT-DRFVS-PH-0030-2026, se le respondió al denunciante la consulta MLV-009-2026, respecto de elaboración de un nuevo mapa histórico, reconstrucción cronológica de ocupación, análisis retrospectivo de imágenes, registros catastrales o estudios ambientales con fines probatorios, no es información disponible a la fecha; lo solicitado constituye un producto técnico nuevo, que excede el alcance de una solicitud ordinaria de información pública. En caso de requerirse un producto pericial o probatorio dentro de la investigación judicial, este deberá ser solicitado por la autoridad competente. En ese sentido, esta Administración no está obligada a generar un nuevo mapa personalizado, con superposición de capas, análisis hidrológico o valoración ecológica específica, a solicitud particular; cuando la información cartográfica disponible se encuentra publicada en medios oficiales. QUINTO: Que, el Decreto Ejecutivo N.° 37773-JP-H-MINAE-MICITT, del 7 de mayo de 2013, publicado en La Gaceta N.° 134 del 12 de julio de 2013 oficializa el Sistema Nacional de Información Territorial (SNIT) como la plataforma oficial de Costa Rica para publicar y consultar información geográfica y territorial georreferenciada, y es administrado por el Instituto Geográfico Nacional del Registro Nacional. En esta plataforma se puede encontrar publicada la siguiente información: Cartografía oficial (mapas base del territorio). Límites administrativos: provincias, cantones, distritos y centros poblados. Información catastral y territorial. Red vial y transporte. Hidrografía y recursos hídricos: ríos, quebradas, lagos, cuencas. Cobertura forestal y uso del suelo. Información ambiental: áreas protegidas, humedales, corredores biológicos, zonas de vida y otros elementos ambientales. Información topográfica y de relieve. Mosaico de ortofotos e imágenes satelitales de los periodos 2005-2008 (escala 1:1000 y 1:5000) y 2014-2017 (escala 1:1000 y 1:5000). Capas temáticas generadas por instituciones públicas. El SNIT es, entonces el medio oficial para publicar información geoespacial; sin embargo, la responsabilidad sobre la oficialidad y actualización de cada capa corresponde a la institución que la genera y publica. Por ejemplo, para el caso del Registro Nacional de Humedales (partiendo como base el Inventario Nacional de Humedales del año 2018), es el SINAC como autoridad técnica responsable quien remite la información para su actualización y publicación periódica. El informe mencionado por el denunciante, denominado “Caracterización y delimitación de humedales en la zona marítimo terrestre del litoral del cantón de Talamanca” (ACLAC, junio de 2021), no fue nunca publicado en el SNIT como lo indica erróneamente el denunciante. Siendo que para que sus resultados sean publicados, debe cumplir con el debido proceso y rigor técnico a nivel interno institucional y que establece la normativa vigente. Así lo indicó la Sala Constitucional en resolución 2024010951 bajo expediente 24-005929-0007-CO, en el cual se ordenó: “Se declara parcialmente con lugar el recurso. Se ordena a Maylin Mora Arias, en su condición de directora regional a.i. del Área de Conservación La Amistad Caribe del Sistema Nacional de Áreas de Conservación, o a quien ocupe ese cargo, que gire las órdenes pertinentes, lleve a cabo todas las actuaciones que estén dentro del ámbito de sus competencias y coordine lo necesario, para que, dentro de los TRES MESES siguientes al cumplimiento de la orden que se le dio en la sentencia nro. 2024003959 de las 9:16 horas de 16 de febrero de 2024 dictada en el expediente 23-014549-0007-CO de las 9:30 horas de 16 de febrero de 2024, a saber: “concluir, en el plazo de TRES MESES, contado a partir de la notificación de esta sentencia, el trámite para complementar la certificación de Patrimonio Natural del Estado en la Zona Marítimo Terrestre del Cantón de Talamanca con la “Caracterización y delimitación de humedales en la zona marítimo terrestre del litoral del cantón de Talamanca” de junio de 2021”, se revise la delimitación y los alcances del Patrimonio Natural del Estado contemplado en la certificación SINAC-ACLAC-DR-PNE-C-011-2017 y, con elementos actuales y precisos, así como el debido sustento técnico, se expida una certificación actualizada, que abarque y delimite la totalidad de las franjas de Patrimonio Natural del Estado en la Zona Marítimo Terrestre del cantón de Talamanca” En cumplimiento de lo anterior, se emitió la certificación SINAC-ACLAC-DRFVS-PNE-C-014-2025 actualizada al año 2025. En la figura n°1 se muestra el compilado del patrimonio natural del estado en el cantón de Talamanca, donde se encuentra incluido el área referida por el denunciante, conocido como humedal Playa Negra. (…) Figura n°2: Mapa de bosques y humedales delimitados en la ZMT de Talamanca Fuente: certificación SINAC-ACLAC-DRFVS-PNE-C-014-2025 actualizada al año 2025. En ese sentido, la Certificación de Patrimonio Natural del Estado, está regulada por el Poder Ejecutivo por medio del Decreto Ejecutivo No. 36786 “Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica”, el cual rige desde el 11 de noviembre del 2011, la cual es la norma legal que lo sustenta. El “Informe Técnico Clasificación y Delimitación del Patrimonio Natural del Estado en la Zona Marítimo Terrestre del Litoral del Cantón de Talamanca”, SINAC-ACLAC-DRFVS-PH-006-2025, es el resultado del ejercicio, revisión, clasificación, delimitación y caracterización técnica de la Zona Marítimo Terrestre del litoral de Talamanca, el cual constituye el Estudio Técnico que antecede o fundamenta la emisión de una Certificación de Patrimonio Natural del Estado, según lo establece la norma legal, es decir el Decreto Ejecutivo No. 36786 y que permite la emisión de la Certificación del Patrimonio Natural del Estado, a nivel oficial. Nótese que la norma legal Decreto Ejecutivo No.36786, es para elaborar un Informe de nivel técnico con base en el Manual y la Directriz SINAC-IRT-001-2016; la norma es taxativa en cuanto a requisitos y procedimiento a seguir. La norma Decreto Ejecutivo No. 36786, establece lo siguiente: “I.-Objetivos. i. Identificar dentro de la Zona Marítimo Terrestre aquellos terrenos que clasifiquen como bosques, de aptitud forestal (suelos Clase VII y VIII), humedales (manglares, esteros, rías, marismas, lagunas costeras, pantanos, bosques anegados, salitrales), para certificarlos e incorporarlos como parte del Patrimonio Natural del Estado (PNE). ii. Delimitar de conformidad con el artículo 33 de la Ley Forestal, las áreas de protección”. La norma legal, Decreto Ejecutivo No. 36.786, establece el siguiente procedimiento general: V.-Unidades por clasificar VI.-Procedimientos generales aplicables a las unidades por clasificar. VII.-Procedimiento para clasificar el bosque en la ZMT VIII.-Parámetros para la definición de terrenos de aptitud forestal sin bosque (Clases VII y VIII) IX-Procedimiento para la definición de humedales X.-Procedimiento para la definición de las áreas de protección. XI.-Elaboración de la Certificación. XII.-Para el Registro y control de las Certificaciones” Conforme a lo anterior la administración categóricamente ha demostrado bajo el principio de legalidad, que cumplió con los requisitos y procedimientos establecidos bajo los instrumentos jurídicos válidos y eficaces al momento de la emisión del documento Certificación del Patrimonio Natural del Estado SINAC-ACLAC-DRFVS-PNE-C-014-2025, de marzo del 2025. Así también, es importante hacer de conocimiento de esta honorable sala que, mediante informe SINAC-ACLAC-DRFVS-PH-006-2025 en atención a la resolución Nº2024-003959 del Expediente Nº23-014549-0007-CO en el cual el denunciante es parte, se atendió lo relacionado a la Caracterización y delimitación de humedales en la zona marítimo terrestre del litoral del cantón de Talamanca, por lo que este mapeo se encuentra debidamente actualizado y protegido mediante la determinación del Patrimonio Natural del Estado. En síntesis, la delimitación del área correspondiente al humedal Playa Negra- Río Carbón se encuentra debidamente incluido tanto en la certificación del Patrimonio Natural del Estado del cantón de Talamanca, como en la información publicada en el SNIT, a la cual el recurrente tiene y ha tenido acceso de manera pública e inmediata. Seguido se muestra un diagrama de lo indicado. (…) Figura °4: Diagrama de ubicación de los humedales del sector de Playa Negra y PNE en ZMT de Talamanca, sector Playa Negra. Fuente: oficina de PNE-ACLAC, 2026 Resulta de vital importancia, recalcar que la misma Sala Constitucional mediante resolución N.° 2025030106, dictada dentro del expediente N.° 25-024124-0007-CO, recurso de amparo interpuesto por el propio señor Nombre01 contra el Sistema Nacional de Áreas de Conservación, declaró sin lugar el recurso y tuvo por válida la orientación brindada por el SINAC respecto al uso de plataformas oficiales como el Sistema Nacional de Información Territorial (SNIT) y el Sistema Integrado de Trámite de Denuncias Ambientales (SITADA). De conformidad con dicho criterio, la información cartográfica oficial disponible sobre humedales, Patrimonio Natural del Estado, capas ambientales, delimitaciones e información territorial vinculada con el humedal Playa Negra o Río Carbón se encuentra disponible para consulta pública y gratuita en el visor del Sistema Nacional de Información Territorial (SNIT). Por tanto, la remisión a dicha plataforma no constituye una denegatoria de información, sino la orientación al medio oficial de acceso público correspondiente. Así también lo indica el artículo 8 de la Ley N.° 10554 (Ley Marco de Acceso a la Información Pública), el derecho de acceso comprende la información pública existente en poder de la Administración, pero no implica la obligación de generar nuevos estudios, peritajes o productos técnicos inéditos a solicitud particular. Sin perjuicio de lo anterior, el SINAC mantiene plena disposición de colaborar técnicamente con las autoridades competentes en el marco de la causa penal N.° 05-001155-0597-PE o ante requerimientos formalmente planteados conforme al ordenamiento jurídico aplicable. SEXTO: Que lo relacionado a permisos de construcción y ordenamiento territorial fuera de áreas silvestres protegidas y patrimonio natural del Estado es resorte municipal, por lo que el SINAC no administra ni custodia el registro de permisos municipales de construcción, usos de suelo, licencias constructivas o autorizaciones urbanísticas. Dicha información debe ser requerida ante la Municipalidad de Talamanca, como autoridad competente en materia de permisos constructivos y ordenamiento territorial local, o bien, ante las demás instituciones que correspondan según la naturaleza del trámite. Evidentemente, el marco normativo del SINAC le permite brindar información únicamente dentro del marco de sus competencias y de los registros que custodia. SÉPTIMO: Que, el área de conservación cuenta con la certificación del patrimonio natural del estado, actualizada al año 2025, la cual permitió identificar y delimitar el patrimonio natural del estado compuesto por bosques, humedales, terrenos de aptitud forestal y áreas de protección, sitios donde generan acciones de control y protección para evitar las invasiones al patrimonio y/o actividades prohibidas por la normativa ambiental. En caso de ocurrir posibles ilícitos la autoridad forestal del estado, realiza la inspección correspondiente y se presenta la denuncia penal ante el Ministerio Público. En ese sentido, la actuación institucional se resume de la siguiente manera: Recibir y tramitar la denuncia. Realizar inspecciones e investigación técnica. Emitir informes técnicos y legales. Adoptar medidas cautelares o administrativas cuando procedan. Presentar denuncia penal ante el Ministerio Público cuando los hechos puedan constituir delito ambiental. Dar seguimiento a los procedimientos administrativos de su competencia. OCTAVO: Que, sin perjuicio de las actuaciones desarrolladas en sede judicial, el SINAC mantiene sus competencias administrativas de seguimiento, fiscalización y apoyo técnico ambiental sobre el ecosistema referido, dentro del marco legal aplicable y de conformidad con los requerimientos institucionales o judiciales que correspondan. Asimismo, el SINAC reitera su disposición de participar en inspecciones de campo, emitir criterios técnicos y aportar información institucional en las diligencias formalmente solicitadas por las autoridades competentes. CONCLUSIONES. El Sistema Nacional de Áreas de Conservación (SINAC), en su condición de Administración Forestal del Estado, ha ejercido de manera diligente y oportuna las competencias cnicas y legales que le confiere el ordenamiento jurídico para la atención, investigación y seguimiento de los presuntos ilícitos ambientales denunciados en el sector de Playa Negra–Río Carbón, Puerto Viejo de Talamanca. La información pública que obra en poder de la Administración y que resulta pertinente para la atención de la gestión formulada ha sido puesta a disposición del interesado, incluyendo aquella contenida en la plataforma oficial del Sistema Nacional de Información Territorial (SNIT), creada mediante el Decreto Ejecutivo N.° 37773-JP-H-MINAE-MICITT, la cual constituye el medio oficial para la consulta de información geoespacial y cartográfica de acceso libre y gratuito. En consecuencia, la respuesta brindada por el funcionario actuante resulta ajustada a derecho, congruente con el contenido de la solicitud planteada, con las competencias institucionales del SINAC y con los principios de transparencia y acceso a la información pública, al orientar al administrado hacia las fuentes oficiales donde se encuentra disponible la información requerida. No existe obligación legal para esta Administración de generar información nueva, elaborar cartografía específica, producir mapas personalizados con superposición de capas temáticas, efectuar análisis hidrológicos particulares o desarrollar valoraciones ecológicas individualizadas a solicitud de un administrado, cuando la información oficial existente se encuentra debidamente sistematizada y disponible a través de los mecanismos institucionales de consulta pública. El derecho de acceso a la información pública comprende el acceso a la información existente en poder de la Administración, pero no impone el deber de crear documentos, estudios o productos técnicos inexistentes. De conformidad con los registros institucionales disponibles, la delimitación y ubicación del humedal Playa Negra–Río Carbón se encuentra incorporada en el caso del área correspondiente a la Zona Marítima Terrestre en la certificación oficial del Patrimonio Natural del Estado correspondiente al cantón de Talamanca, así como en las capas geoespaciales oficiales publicadas en el SNIT, información que ha permanecido accesible al público de forma permanente y sin restricciones. La remisión a la información disponible en el Sistema Nacional de Información Territorial (SNIT) no constituye una negativa o restricción al derecho de acceso a la información pública, sino la indicación del medio oficial de consulta dispuesto por el Estado para garantizar el acceso eficiente, transparente y oportuno a la información territorial y ambiental administrada por las instituciones competentes. autorizaciones relacionadas con el ordenamiento territorial fuera de las Áreas Silvestres Protegidas y del Patrimonio Natural del Estado, la competencia principal corresponde a las municipalidades y demás entes con potestades urbanísticas y territoriales. En virtud del principio de legalidad, el SINAC no administra, custodia ni genera los registros municipales asociados a dichas autorizaciones, por lo que únicamente puede suministrar información relativa a los ámbitos materiales que se encuentran bajo su competencia legal. Del análisis del expediente administrativo y de los antecedentes institucionales se desprende que el SINAC ha cumplido con las obligaciones que le corresponden dentro de su ámbito competencial, incluyendo la recepción y tramitación de denuncias, la realización de inspecciones de campo e investigaciones técnicas, la emisión de informes técnicos y legales, la adopción de medidas administrativas cuando ha correspondido, la interposición de denuncias ante el Ministerio Público al identificarse posibles ilícitos ambientales y el seguimiento de los procedimientos administrativos de su competencia. Sin perjuicio de las actuaciones que actualmente se desarrollan o hayan sido trasladadas a conocimiento de las autoridades judiciales competentes, el SINAC mantiene plenamente vigentes sus potestades de fiscalización, seguimiento, control y apoyo técnico respecto del ecosistema humedal Playa Negra–Río Carbón, en el marco de las competencias que le confieren la Ley Forestal, la Ley Orgánica del Ambiente, la Ley de Conservación de la Vida Silvestre y demás normativa aplicable. Finalmente, el SINAC reitera su disposición permanente de colaborar con las autoridades administrativas y judiciales competentes, mediante la participación en inspecciones de campo, la emisión de criterios técnicos especializados y el suministro de la información institucional que sea requerida formalmente para el esclarecimiento de los hechos y la protección efectiva de los recursos naturales y ecosistemas involucrados. Todo esto refleja que según lo manifestado por la parte recurrente, no corresponde a un tema interinstitucional que resuelva el Sistema Nacional de Áreas de Conservación y que rendidos los presentes oficios adjuntos de prueba y en virtud de lo indicado; se solicita se declare sin lugar el recurso de amparo interpuesto por la parte recurrente, por cuanto las actuaciones de mi representada no han configurado vulneración a derecho fundamental alguno respecto a los hechos alegados”.\n\n6.- Manifiesta el recurrente: “OBJETO DEL PRESENTE MEMORIAL Mediante este escrito aporto como prueba documental nueva y de suma relevancia los siguientes documentos, que evidencian la persistencia de una omisión institucional grave, fragmentaria e insuficiente por parte del Sistema Nacional de Áreas de Conservación (SINAC), que agrava el riesgo de daño irreparable al ecosistema del humedal y viola los derechos constitucionales consagrados en el artículo 50 de la Constitución Política: 1. CARTA-SINAC-SE-DE-PNH-0027-2026 de 22 de junio de 2026, suscrita por el MSc. Rotney Piedra Chacón, Coordinador del Programa Nacional de Humedales. 2. Respuesta del suscrito a la referida carta (solicitud de ampliación e investigación administrativa integral del 24 de junio de 2026). 3. Informe de Caracterización y Delimitación de Humedales en la Zona Marítimo Terrestre del Litoral del Cantón de Talamanca, elaborado por el SINAC en junio de 2021 (Bach. Oscar Fonseca Rivera y Geógrafo Francisco Domínguez Barros). II. ANÁLISIS DE LA PRUEBA APORTADA A. Sobre la CARTA-SINAC-SE-DE-PNH-0027-2026 (22 de junio de 2026) El Programa Nacional de Humedales reconoce la complejidad de los casos de humedales en el Área de Conservación La Amistad Caribe y señala que se encuentra trabajando en una “hoja de ruta” conjunta con el ACLAC. Sin embargo: • Se limita a remitirse a una causa penal N° 05-00155-0597-PE de 2005, sin aportar un diagnóstico actualizado del estado del ecosistema. • Declara expresamente que no posee competencias legales para ordenar, ejecutar o imponer medidas administrativas preventivas, correctivas o de restauración sobre sitios específicos, trasladando toda responsabilidad al ACLAC. • No establece plazos concretos ni acciones efectivas de coordinación para la protección integral del humedal. Esta respuesta confirma una actitud omisiva y fragmentaria que contraviene el deber constitucional de protección efectiva del ambiente. B. Sobre el Informe de Caracterización y Delimitación de Humedales (SINAC, junio 2021) Este documento oficial del propio SINAC, elaborado hace apenas cinco años, abarca expresamente la Llanura costera Río CarbónPuerto Viejo y constituye prueba irrefutable de lo siguiente: • El área presenta suelos predominantemente hidromórficos (Entisoles, Inceptisoles e Histosoles) con régimen de humedad ácuico, drenaje lento a nulo y riesgo de inundación severo a muy severo. • La vegetación dominante es hidrófila y característica de humedales: Raphia taedigera (yolillo), Pterocarpus officinalis (sangrillo), aráceas, Cyclanthus bipartitus, entre otras especies obligadas o facultativas de humedal. • Se documentan múltiples intervenciones humanas (construcciones, lotificaciones, rellenos y obras) dentro o en el borde de áreas con características de humedal. • El informe enfatiza la fragilidad hidrológica del sistema: alterar un sector afecta a otros, y la protección debe realizarse bajo un enfoque ecosistémico integral. Este informe demuestra que el SINAC ya tenía conocimiento técnico detallado de la presencia, extensión y vulnerabilidad de estos humedales desde 2021. Resulta particularmente grave que, a pesar de contar con esta información oficial interna, la respuesta de junio de 2026 se limite a citar un expediente penal de 2005 sin actualizar ni aplicar el conocimiento técnico ya generado por la institución. C. Sobre la respuesta del suscrito (24 de junio de 2026) Ante la insuficiencia de la posición del SINAC, se solicitó formalmente la realización de una investigación administrativa integral, detallada y exhaustiva del Humedal Río Carbón – Playa Negra como unidad ecológica indivisible, que actualice el informe de 2021 e incluya la cuantificación actual de la afectación (superior a 30-40 hectáreas de integridad perdida), los impactos acumulativos y un plan de acción con plazos definidos. III. FUNDAMENTACIÓN JURÍDICA CONSTITUCIONAL La prueba aportada acredita la violación de los siguientes derechos y principios constitucionales: • Artículo 50 de la Constitución Política: Derecho a un ambiente sano y ecológicamente equilibrado. El Estado tiene el deber de protegerlo de manera efectiva y no meramente formal. • Principio de prevención y precaución, así como el principio in dubio pro natura. • Deber de celeridad y eficacia de la Administración Pública (artículos 15, 16 y 269 de la Ley General de la Administración Pública). • Derecho a la tutela judicial efectiva y a la protección oportuna de derechos fundamentales (artículos 27, 41 y 48 de la Constitución Política). La actitud del SINAC —que reconoce la complejidad del caso pero se declara incompetente para actuar directamente y se remite a un expediente penal de más de 21 años— configura una omisión de protección que coloca en riesgo inminente e irreparable el ecosistema del humedal, en clara contradicción con la jurisprudencia reiterada de esta Sala Constitucional en materia de protección ambiental y humedales”. Además: “I. OBJETO DE LA PRESENTE RÉPLICA Mediante la presente escrito se formula réplica al informe rendido por la Dirección Ejecutiva del Sistema Nacional de Áreas de Conservación mediante la CARTA-SINAC-SE-DE-0760-2026 de 18 de junio de 2026, el cual incorpora y avala el informe de insumos de la Dirección Regional del Área de Conservación La Amistad Caribe (CARTA-SINAC-ACLAC-DR-0357-2026 de 17 de junio de 2026). El objeto de esta réplica es señalar que el informe de la Dirección Ejecutiva no desvirtúa los hechos alegados en el recurso de amparo, omite referirse al estado actual de afectación del humedal y mantiene una postura que resulta insuficiente para acreditar el cumplimiento de las obligaciones constitucionales y legales de protección del ecosistema. II. SÍNTESIS DE LOS ARGUMENTOS DEL INFORME DE LA DIRECCIÓN EJECUTIVA El informe de la Dirección Ejecutiva sostiene, en lo esencial, que: • La respuesta del Coordinador del Programa Nacional de Humedales no puede calificarse de insuficiente porque dicho Programa tiene funciones técnicas y asesoras, correspondiendo la ejecución a las Áreas de Conservación. • Desde el año 2005 existe la causa penal N° 05-001155-0597-PE y se han realizado actuaciones administrativas e investigaciones. • La información cartográfica se encuentra disponible en el Sistema Nacional de Información Territorial (SNIT) y en la certificación de Patrimonio Natural del Estado actualizada al año 2025 (SINAC-ACLAC-DRFVS-PNE-C-014-2025), que incorporó el informe técnico de caracterización de junio de 2021. • No existe obligación de generar nuevos productos técnicos o mapas personalizados a solicitud particular, conforme al artículo 8 de la Ley N° 10554. • Los permisos de construcción corresponden a la Municipalidad de Talamanca cuando se encuentran fuera de áreas silvestres protegidas y del Patrimonio Natural del Estado. • El SINAC ha cumplido con sus competencias al recibir denuncias, realizar inspecciones, emitir informes y presentar denuncias penales cuando corresponde. • Se solicita declarar sin lugar el recurso de amparo. III. FUNDAMENTOS DE LA RÉPLICA 3.1. Omisión de protección efectiva y deber derivado del artículo 50 de la Constitución Política El artículo 50 de la Constitución Política reconoce el derecho a un ambiente sano y ecológicamente equilibrado. Este derecho impone al Estado obligaciones de protección activa, que incluyen la adopción de medidas preventivas, de control y de restauración cuando se acredite o se alegue de manera verosímil la afectación de un ecosistema protegido. El informe de la Dirección Ejecutiva se limita a describir actuaciones realizadas hace más de veinte años y a remitir a la existencia de una causa penal iniciada en 2005. No acredita que se hayan adoptado medidas efectivas para detener la destrucción que se alega como continuada y acelerada en los últimos años, ni presenta información sobre el estado actual del humedal. Esta omisión de actuación concreta resulta incompatible con el deber de protección que deriva del artículo 50 constitucional. 3.2. Insuficiencia de la remisión a la causa penal de 2005 frente a hechos de carácter continuado El informe destaca la causa penal N° 05-001155-0597-PE y menciona otras denuncias presentadas en años posteriores. Sin embargo, no se acredita en el informe que dicha causa haya avanzado de manera efectiva ni que se hayan impuesto medidas cautelares o de restauración que hayan impedido la continuación de los hechos denunciados. La existencia de múltiples expedientes penales a lo largo de más de dos décadas, sin que se demuestre una resolución efectiva o una detención de las afectaciones, no acredita protección actual. Los hechos que se alegan en este amparo tienen carácter continuado. La remisión exclusiva a una causa penal antigua no satisface la obligación de adoptar medidas oportunas y eficaces para la protección del ecosistema. 3.3. Sobre la certificación de Patrimonio Natural del Estado y la información disponible en el SNIT El informe señala que el área del humedal se encuentra incluida en la certificación de Patrimonio Natural del Estado actualizada al año 2025 y que la información cartográfica está disponible en el SNIT. La certificación de Patrimonio Natural del Estado es un acto de identificación y delimitación. Su emisión no sustituye por sí sola las obligaciones de fiscalización, control y adopción de medidas materiales para impedir la destrucción del ecosistema delimitado. El informe no acredita que, tras la emisión de dicha certificación o con anterioridad a ella, se hayan realizado acciones concretas de control que hayan impedido los rellenos, drenajes y construcciones que se alegan como hechos actuales. La disponibilidad de información en el SNIT constituye un medio de acceso público. Sin embargo, cuando en un proceso de amparo se solicita un insumo técnico específico para acreditar el estado actual de afectación y sustentar medidas de protección judicial, la mera remisión a plataformas generales no resulta suficiente si la institución posee la información base necesaria para elaborar o facilitar dicho insumo. 3.4. Sobre la obligación de aportar insumos técnicos en el marco del amparo El informe sostiene que no existe obligación legal de generar nuevos productos técnicos o mapas personalizados a solicitud particular. En el contexto de un recurso de amparo por presunta vulneración del artículo 50 de la Constitución Política, las autoridades tienen el deber de colaborar con la jurisdicción constitucional aportando los elementos que permitan verificar los hechos alegados y adoptar las medidas que resulten procedentes. El recurrente ha solicitado de manera reiterada un mapa actualizado de afectación del humedal. El SINAC elaboró en el año 2021 un informe técnico de caracterización que incluye la llanura costera Río Carbón-Puerto Viejo y que sirvió de base para la certificación de Patrimonio Natural del Estado de 2025. La negativa a facilitar un análisis actualizado a partir de la información ya disponible en poder de la institución dificulta el ejercicio de la tutela judicial efectiva. 3.5. Sobre la competencia municipal y la protección de áreas dentro del Patrimonio Natural del Estado y el humedal El informe indica que los permisos de construcción fuera de áreas silvestres protegidas y del Patrimonio Natural del Estado corresponden a la Municipalidad de Talamanca. Los hechos alegados se refieren a rellenos, drenajes y construcciones que se realizan dentro del área del humedal y del Patrimonio Natural del Estado. Cuando las afectaciones ocurren dentro de zonas sujetas a protección especial, el SINAC tiene competencia para realizar inspecciones, adoptar medidas administrativas, solicitar la anulación de actos que resulten incompatibles con la protección del área y presentar las denuncias que correspondan. El informe no acredita que se hayan ejercido estas competencias de manera efectiva frente a las ocupaciones y afectaciones específicas que se denuncian en el sector de Playa Negra / Río Carbón en los últimos años. 3.6. Incoherencias entre el informe de la Dirección Ejecutiva y el informe de insumos de la ACLAC El informe de la Dirección Ejecutiva reproduce y avala sustancialmente los argumentos del informe de insumos de la ACLAC. Ambos documentos: • Enfatizan actuaciones realizadas entre 2002 y 2005 y la existencia de la causa penal de 2005, sin acreditar control efectivo sobre los hechos que se alegan como continuados. • Justifican la respuesta institucional por razones de distribución competencial interna, sin asumir una responsabilidad integral de protección del ecosistema. • Presentan la certificación de Patrimonio Natural del Estado de 2025 como elemento de protección, sin demostrar que dicha certificación haya impedido o detenido las afectaciones que se alegan como actuales. • Omiten referirse de manera concreta al estado actual del humedal, a la magnitud de la afectación alegada y a las medidas específicas adoptadas en los últimos años para su protección. Estas coincidencias entre ambos informes evidencian que la posición de la Dirección Ejecutiva no aporta elementos nuevos que permitan desvirtuar los alegatos del recurso de amparo”. “Por medio de la presente, y con fundamento en los artículos 1, 2, 27, 30, 48 y 50 de la Constitución Política, así como en los artículos 2, 9, 15, 29, 30, 48 y 75 de la Ley de la Jurisdicción Constitucional, me permito remitir como prueba documental adicional el Informe de Inspección SINAC-SE-GASP-005, de fecha 13 de enero de 2009, elaborado por el Biólogo Juan Sánchez Ramírez, entonces Coordinador del Programa Nacional de Humedales y Zona Marítimo Terrestre de la Gerencia de Áreas Silvestres Protegidas del SINAC. Este informe constituye una pieza de prueba de alta relevancia técnica y jurídica, por las siguientes razones: Primero. Se trata de un documento oficial del Estado, elaborado por la institución competente en materia de conservación de humedales y áreas silvestres protegidas. En él se documenta, de forma detallada y con sustento técnico de campo, la existencia de daños ambientales graves y sistemáticos en el sector de Playa Negra y zonas aledañas al río Carbón, dentro y en las inmediaciones del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo (REGAMA). Entre los daños constatados se encuentran: tala de vegetación de humedal (incluyendo yolillo), drenaje y relleno de humedales, construcciones ilegales en la Zona Marítimo Terrestre (ZMT), invasión de áreas de protección de cauces públicos y cambio de uso de suelo en zonas de bosque y humedal. Segundo. El informe evidencia que, ya en el año 2008, las autoridades competentes —incluida la Fiscalía Ambiental— tenían conocimiento institucional de estas afectaciones, toda vez que se hace referencia a denuncias previas que no habían recibido respuesta efectiva. Esto acredita un patrón histórico de omisión estatal en la protección de este ecosistema, el cual persiste hasta la actualidad. Tercero. Los hallazgos técnicos contenidos en este documento resultan directamente pertinentes para acreditar la persistencia, gravedad y continuidad de las afectaciones ambientales que se denuncian en el presente proceso constitucional. La situación descrita en 2008 no solo no ha sido resuelta, sino que refleja una problemática estructural que afecta un ecosistema de alto valor ecológico, incluyendo áreas de anidación de tortugas marinas y humedales de importancia para la biodiversidad del Caribe Sur. Cuarto. Este informe refuerza la necesidad de que la Sala Constitucional adopte medidas de protección efectivas para evitar la continuación de un daño ambiental que, por su naturaleza, puede tornarse irreversible. Lo anterior, de conformidad con las atribuciones conferidas a esta Sala por el artículo 48 de la Constitución Política y los artículos 29, 30 y 48 de la Ley de la Jurisdicción Constitucional, que facultan al Tribunal Constitucional para dictar, en cualquier etapa del proceso, las medidas que resulten necesarias para proteger los derechos fundamentales amenazados o vulnerados, incluyendo aquellas orientadas a la tutela del derecho a un ambiente sano y ecológicamente equilibrado consagrado en el artículo 50 de la Constitución Política. Por las razones expuestas, solicito respetuosamente a la Sala Constitucional: 1. Tener por recibida esta prueba documental adicional y ordenar su incorporación al expediente N° 26-016746-0007-CO. 2. Valorar el contenido del Informe SINAC-SE-GASP-005 como elemento de convicción sobre la existencia de un daño ambiental grave, persistente y de conocimiento institucional desde hace más de quince años. 3. Adoptar, de conformidad con sus atribuciones constitucionales, las medidas que resulten necesarias para garantizar la protección efectiva del humedal de Playa Negra y del ecosistema del río Carbón, incluyendo, de ser procedente, el dictado de medidas de protección constitucional o cautelares”. “Por medio de la presente, y con fundamento en los artículos 1, 2, 27, 30, 48 y 50 de la Constitución Política, así como en los artículos 2, 9, 15, 29, 30, 48 y 75 de la Ley de la Jurisdicción Constitucional, me permito remitir como prueba documental adicional los siguientes informes técnicos oficiales: 1. Informe SINAC-SE-GASP-165-05 de fecha 13 de julio de 2005, elaborado por el Biólogo Juan Sánchez Ramírez. 2. Informe SINAC-SE-GASP-005 de fecha 13 de enero de 2009, elaborado por el Biólogo Juan Sánchez Ramírez. 3. Informe TAA-DT-272-2024 de fecha 27 de agosto de 2024 y oficio O-906-2024-TAA de 22 de octubre de 2024. 4. Informe TAA-DT-333-2024 de fecha 9 de octubre de 2024. Estos documentos, en su conjunto, constituyen prueba de alta relevancia técnica y jurídica, por las siguientes razones: Primero. Desde el año 2005, el Estado costarricense, a través del Sistema Nacional de Áreas de Conservación (SINAC), tenía conocimiento técnico detallado de la existencia, extensión y valor ecológico del humedal de Playa Negra (denominado en ese entonces Humedal Río Carbón). El Informe SINAC-SE-GASP-165-05 ya documentaba: • La presencia de un complejo de humedales interconectados (humedal de yolillo, bosque anegado, ríos Carbón, Hotel y Hone). • La existencia de un bosque costero que funciona como zona de protección y ecotono. • Evidencia de intervenciones humanas, incluyendo rellenos para construcción y corta y quema de yolillo. • La importancia del sitio como área de anidación de cuatro especies de tortugas marinas (Baula, Carey, Verde y Cabezona), siendo una de las más importantes del Caribe Sur. • La presión ejercida por la bananera colindante mediante fumigaciones con agroquímicos. • La recomendación expresa de no otorgar concesiones ni desarrollar infraestructura en la zona por su fragilidad y angostura de la franja disponible. Segundo. El Informe SINAC-SE-GASP-005 de 2009 confirmó y actualizó los hallazgos de 2005, documentando daños adicionales como drenaje de humedales, construcciones ilegales en la Zona Marítimo Terrestre y omisión de las autoridades en dar seguimiento a las denuncias previas. Esto evidencia que, ya en 2009, el Estado tenía conocimiento reiterado de la problemática sin que se adoptaran medidas efectivas de protección. Tercero. Los informes del Tribunal Ambiental Administrativo de 2024 (TAA-DT-272-2024 y TAA-DT-333-2024) demuestran que los daños ambientales persisten y se han agravado después de casi veinte años. Estos informes acreditan: • La existencia de más de cien fincas inscritas dentro o traslapadas con los límites probables del humedal. • La insuficiencia de la delimitación oficial del Registro Nacional de Humedales (RNH), que subestima la extensión real del ecosistema. • La construcción de caminos con escombros dentro del humedal, quema de yolillo, estructuras operando pese a sellos de clausura municipal, y pérdida progresiva de cobertura vegetal entre 2005 y 2023, según análisis de ortofotos e imágenes satelitales. • La solicitud expresa de medidas cautelares urgentes y de delimitación correcta del humedal por parte del ACLAC y SINAC. Cuarto. La continuidad del mismo técnico (Juan Sánchez Ramírez) elaborando informes desde 2005 hasta 2024, y la persistencia de los mismos problemas a lo largo de más de dos décadas, configura un patrón claro de conocimiento institucional y omisión prolongada del Estado en el cumplimiento de su deber constitucional de proteger el ambiente (artículo 50 de la Constitución Política). Esta situación ha permitido que un ecosistema de alto valor ecológico —incluyendo hábitat crítico para tortugas marinas en peligro de extinción— sufra un deterioro continuo y potencialmente irreversible. Quinto. Los informes aportados refuerzan de manera contundente la necesidad de que la Sala Constitucional adopte medidas de protección efectivas y urgentes, incluyendo la delimitación técnica del humedal y la suspensión de actividades que lo afectan. Lo anterior, de conformidad con las atribuciones conferidas a esta Sala por el artículo 48 de la Constitución Política y los artículos 29, 30 y 48 de la Ley de la Jurisdicción Constitucional, que facultan al Tribunal Constitucional para dictar, en cualquier etapa del proceso, las medidas que resulten necesarias para tutelar los derechos fundamentales amenazados o vulnerados. Sexto. Dada la magnitud, complejidad técnica y persistencia temporal del daño ambiental acreditado en los informes aportados, resulta altamente pertinente y necesario que el Departamento de Ciencias Forenses del Organismo de Investigación Judicial (OIJ) asuma la valoración integral del daño causado al humedal de Playa Negra. Esta valoración debe incluir la cuantificación técnica del daño ecológico, la determinación de las medidas de restauración necesarias y la supervisión técnica de su ejecución. La intervención del Departamento de Ciencias Forenses del OIJ aportaría rigor científico independiente, objetividad técnica y mayor fuerza probatoria a las medidas de protección que eventualmente ordene la Sala Constitucional, garantizando que la restauración del ecosistema se realice con base en criterios científicos especializados y bajo supervisión institucional especializada. Por las razones expuestas, solicito respetuosamente a la Sala Constitucional: 1. Tener por recibidas estas pruebas documentales adicionales y ordenar su incorporación al expediente N° 26-016746-0007- CO. 2. Valorar el conjunto de los informes técnicos (2005, 2009 y 2024) como elementos de convicción sobre el conocimiento institucional, la persistencia y el agravamiento de daños ambientales graves en el humedal de Playa Negra durante más de veinte años. 3. Adoptar, de conformidad con sus atribuciones constitucionales, las medidas que resulten necesarias para garantizar la protección efectiva del humedal de Playa Negra y del ecosistema del río Carbón, incluyendo, de ser procedente: • El dictado de medidas de protección constitucional o cautelares. • Ordenar la delimitación técnica y precisa del humedal de Playa Negra por parte de las autoridades competentes. • Solicitar al Departamento de Ciencias Forenses del Organismo de Investigación Judicial (OIJ) que realice la valoración integral del daño ambiental causado, determine las medidas de restauración necesarias y supervise técnicamente su ejecución”. “Por medio de la presente, y con fundamento en los artículos 1, 2, 27, 30, 48 y 50 de la Constitución Política, así como en los artículos 2, 9, 15, 29, 30, 48 y 75 de la Ley de la Jurisdicción Constitucional, me permito remitir como prueba documental adicional el oficio O-906- 2024-TAA de fecha 22 de octubre de 2024, suscrito por el Biólogo Juan Sánchez Ramírez del Tribunal Ambiental Administrativo, junto con el Informe de Inspección TAA-DT-272-2024 de fecha 27 de agosto de 2024. Este documento constituye una pieza de prueba de alta relevancia técnica, jurídica y actual, por las siguientes razones: Primero. Se trata de un documento oficial reciente, elaborado por el Tribunal Ambiental Administrativo, órgano del Estado con competencia técnica y legal en materia ambiental. En él se documenta, de manera detallada y con sustento técnico de campo (incluyendo muestreos de suelo que evidencian gleyzación e hidromorfismo, georreferenciación con GPS, fotografías y análisis catastral), la existencia de daños ambientales graves y actuales en el sector de Playa Negra, específicamente en terrenos asociados a la propiedad representada por el plano catastrado N° 7-495915-1998 y zonas aledañas al río Carbón. Los daños constatados en la inspección de agosto de 2024 incluyen: • Drenaje y relleno de humedales mediante caminos construidos con escombros. • Corta y quema de vegetación de humedal, incluyendo yolillo. • Presencia de construcciones y lotificaciones dentro del ecosistema de humedal. • Estructuras que operan pese a contar con sellos de clausura municipal. • Invasión y afectación de áreas de protección de cauces. Segundo. El informe acredita que los daños ambientales persisten y continúan realizándose en la actualidad. La inspección fue realizada el 14 de agosto de 2024. Esto demuestra que la afectación al humedal de Playa Negra no es un hecho histórico aislado, sino una problemática actual, continua y en curso, a pesar de las denuncias y reportes técnicos existentes desde hace más de quince años (incluido el Informe SINAC-SE-GASP-005 de 2009). Tercero. El Tribunal Ambiental Administrativo, en ejercicio de sus funciones institucionales, ha solicitado formalmente a la Fiscalía Agrario Ambiental la apertura de un expediente de investigación y, de manera expresa y fundamentada, ha pedido la adopción de medidas cautelares urgentes, entre las que destacan: • Paralización inmediata de obras y actividades. • Eliminación de rellenos, drenajes, construcciones y puentes dentro del humedal. • Advertencias a la Municipalidad de Talamanca y a la SETENA para que no otorguen permisos ni viabilidades ambientales en la zona. • Delimitación correcta del humedal por parte del ACLAC y el SINAC, conforme a lo expuesto en el capítulo de recomendaciones del informe técnico. Esta solicitud institucional de medidas cautelares y de delimitación del humedal refuerza la gravedad de la situación y la urgencia de una intervención efectiva por parte de las autoridades. Cuarto. El informe también pone en evidencia problemas estructurales de ordenamiento territorial, tales como traslapes catastrales, fincas inscritas dentro de áreas de humedal, y la existencia de construcciones que operan al margen de la legalidad. Todo ello configura un escenario de grave deterioro ambiental y de omisión persistente del Estado en el cumplimiento de su deber constitucional de protección del ambiente, consagrado en el artículo 50 de la Constitución Política. Quinto. Este documento, por su carácter reciente (2024) y por provenir de un órgano técnico especializado como el Tribunal Ambiental Administrativo, refuerza de manera contundente la necesidad de que la Sala Constitucional adopte medidas de protección efectivas para evitar la continuación de un daño ambiental que, por su naturaleza, puede tornarse irreversible. Lo anterior, de conformidad con las atribuciones conferidas a esta Sala por el artículo 48 de la Constitución Política, que garantiza el derecho al recurso de amparo para la protección de los derechos fundamentales, y los artículos 29, 30 y 48 de la Ley de la Jurisdicción Constitucional, que facultan expresamente al Tribunal Constitucional para dictar, en cualquier etapa del proceso y aun de oficio, las medidas cautelares o de protección que resulten necesarias para tutelar los derechos fundamentales amenazados o vulnerados, incluyendo el derecho a un ambiente sano y ecológicamente equilibrado reconocido en el artículo 50 de la Constitución Política. Por las razones expuestas, solicito respetuosamente a la Sala Constitucional: 1. Tener por recibida esta prueba documental adicional y ordenar su incorporación al expediente N° 26-016746-0007-CO. 2. Valorar el contenido del oficio O-906-2024-TAA y del Informe TAA-DT-272-2024 como elementos de convicción sobre la existencia de un daño ambiental grave, actual y persistente en el humedal de Playa Negra. 3. Adoptar, de conformidad con sus atribuciones constitucionales, las medidas que resulten necesarias para garantizar la protección efectiva del humedal de Playa Negra y del ecosistema del río Carbón, incluyendo, de ser procedente: a) El dictado de medidas de protección constitucional o cautelares. b) Ordenar la delimitación correcta y técnica del humedal de Playa Negra por parte del ACLAC y el SINAC, conforme a los principios preventivo e in dubio pro natura”. “I. OBJETO DEL PRESENTE ESCRITO El presente memorial tiene por finalidad incorporar y explicar de manera minuciosa, pormenorizada y técnicamente rigurosa el contenido, alcances, metodología, hallazgos fácticos y relevancia jurídico-constitucional del informe técnico-científico titulado “Evaluación Preliminar del Brazo Este del Estero de Hone Creek Afuera del Parque Nacional Cahuita (Humedal Entre La Barra y El Hotel Perla Negra)”, elaborado por el experto en humedales Michael J. Barry (Naples, Florida, Estados Unidos), con fecha 8 de octubre de 2003. Este informe constituye prueba documental de alto valor probatorio que acredita la existencia, extensión, características ecológicas, fragilidad hidrológica y las perturbaciones ilegales ya existentes en el humedal objeto de protección en este expediente. Solicito respetuosamente que sea incorporado como prueba para mejor resolver o nueva prueba conforme a la Constitución Política, la Ley de la Jurisdicción Constitucional (N° 7135) y la jurisprudencia reiterada de esta Sala en materia ambiental. II. CREDENCIALES DEL AUTOR Y CONTEXTO DE ELABORACIÓN El informe fue elaborado por Michael J. Barry, profesional con más de 13 años de experiencia especializada en humedales del sur de Florida. Su trayectoria incluye asistencia técnica a propietarios privados y al gobierno de Florida en procesos de desarrollo compatible con la protección de humedales, así como participación directa en la restauración de la orilla oeste del pantano de los Everglades tras el fracaso de un desarrollo masivo en los años setenta (más de 300 km de caminos y 50 km de canales y zanjos) que provocó daños graves y costosos, ahora asumidos por los contribuyentes estadounidenses. El autor visitó el sitio por primera vez en 1991 y realizó trabajo de campo intensivo entre agosto de 1999 y diciembre de 2000, con visitas complementarias en julio de 2002 y julio de 2003. Su motivación fue estrictamente técnica y de conservación: ante el interés de desarrollo detectado en la zona, aportó listas de plantas, mapas y observaciones fundadas en su experiencia para proteger el humedal, el arrecife coralino y la calidad de vida de la costa atlántica. El informe es preliminar por limitaciones técnicas de la época, pero el autor lo presenta con total honestidad científica. III. METODOLOGÍA CIENTÍFICA EMPLEADA (OBJETIVA Y REPLICABLE) El trabajo incluyó caminatas sistemáticas desde la playa hacia el interior, exploración desde atrás del humedal (entre la quebrada del Hotel y el Río Hone), uso de kayak en el centro del estero, visitas nocturnas y registro detallado de especies dominantes. Las plantas desconocidas fueron colectadas e identificadas con claves y literatura especializada (Holdridge & Poveda 1975, Nombre04 1978, Nombre05 1983, Sánchez 1983, Nombre06 et al. 2000, Henderson et al. 1995, entre otras). La delineación del humedal se realizó fundamentalmente mediante las comunidades vegetales indicadoras de zonas ecológicas, complementada con observaciones de hidrología (inundación permanente o estacional, suelos con alto contenido orgánico). Se utilizó de manera central la lista nacional de especies de humedales del Servicio de Pesca y Vida Silvestre de EE.UU. (Reed et al. 1988), estándar internacional que asigna rangos de probabilidad: OBL (obligada – prácticamente solo en humedales) y FACW (facultativa mojada – más frecuente en humedales). Para especies no incluidas en esa lista se verificó su afinidad con humedales mediante fuentes regionales. La cartografía se elaboró con mapa topográfico oficial de Costa Rica, imagen LANDSAT 1995 y fotografías aéreas de 1976 y 1992 (rectificadas), digitalizadas en ArcView. El autor reconoce limitaciones de acceso y resolución de imágenes de la época y recomienda actualización con GPS y agrimensor, pero expresa alta confianza en los límites este y del lado de la playa. Esta metodología es objetiva, reproducible y alineada con los estándares científicos internacionales de delineación de humedales aplicables bajo la Convención RAMSAR y la legislación costarricense. IV. ALCANCES Y HALLAZGOS PRINCIPALES DEL INFORME El informe delimita el brazo este del estero del Río Hone (fuera del Parque Nacional Cahuita) en aproximadamente 89 hectáreas, en forma de triángulo con base en el Río Hone y vértice en el extremo este del potrero antiguo (familia Nombre07). Hidrológica y ecológicamente es inseparable del brazo oeste protegido dentro del Parque: cualquier alteración en un lado afecta al otro, especialmente si implica drenaje. Aunque el informe data de octubre de 2003 —hace más de veintidós años—, su valor como línea base científica original sigue siendo referencia obligada en junio de 2026. En ese momento se estableció con precisión técnica una extensión aproximada de 89 hectáreas de humedal afectado, cifra que representa la magnitud concreta del bien jurídico que se encuentra bajo amenaza persistente. Esta extensión medida en 2003 constituye el punto de partida indispensable para cualquier valoración actual de los impactos acumulados. Se identifican tres zonas principales (ver Figura 2 del informe): 1. Fango / Zona más profunda (~21,5 ha) Inundada todo el año (excepto bordes en sequías extremas). Barro suave y profundo con alto contenido orgánico. Dominantes: Pasto alemán (Echinochloa polystachya), caña brava (Gynerium sagittatum), zacate de pará, arroz del pantano, palma de yolillo (Raphia taedigera) en bordes. Otras: Nombre08 (Annona glabra), sotacaballo (Zygia latifolia), Nombre09 (Pterocarpus officinalis), cativo, huesillo, helecho de cuero (Acrostichum aureum). Rangos Nombre10 1988: Mayoría OBL y FACW. Fauna: Jacanas, garzas, cormoranes, posible caimán/cocodrilo. 2. Zona de Nombre09 (la más extensa, ~51 ha) Inundada al menos 6 meses al año. Dominantes: Nombre09 (Pterocarpus officinalis) y yolillo (Raphia taedigera); coquito (Elaeis oleifera) en bordes. Sotobosque abundante de aráceas (Homalomena wendlandii), lirio de paz y lengua de buey. En el potrero viejo del extremo este persisten remanentes de sangrillo, coquito y yolillo que confirman su carácter original de humedal, aunque hoy domine pasto alemán. Rangos Reed: Mayoría OBL y FACW. Fauna: Monos congos, iguanas, boas, basiliscos, alta diversidad de ranas. 3. Zona Intermedia / Transicional (~16 ha) Inundada de 0 a 6 meses. Franja de transición. Dominantes: Nombre09 en el borde + árboles de bosque alto (guácimo colorado, guarumo, higuerón). Presencia de heliotropo (Hedychium coronarium – invasora). Rangos Reed: Mezcla de FACW y OBL. Zonas costeras de buffer (mayoritariamente dentro de los 50 metros de la zona marítimo-terrestre): Bosque de arena con uva del mar (Coccoloba uvifera), almendro del mar, majagua y jengibre cañagria (Costus woodsonii – endémica regional que merece conservación). Playa típica del Caribe con railroad vine y arbustos protegidos por la ley marítima. Perturbaciones documentadas con nexo causal claro (evidencia de extrema gravedad): • Potreros antiguos: El del extremo este fue abierto antes de 1976 sobre zona de sangrillo/coquito/yolillo. Hoy dominado por zacates pero todavía inundado la mayoría del año; sin zanjos ni relleno. Hidrología intacta y recuperable. • Represa, zanjo y relleno ilegal cerca de la barra (la más grave): Extranjero construyó casitas dentro de los 50 m marítimoterrestres, cortó árboles (debilitando el buffer de arena), rellenó con tractor arena de playa sin permiso del MINAE ni municipalidad, y construyó represa + zanjo perpendicular desde la casa hasta el centro del fango donde entra la quebrada del Hotel. El autor entrevistó al dueño en 2000, le advirtió los riesgos y sugirió medidas correctivas; el dueño se negó. El autor denunció ante el MINAE de Cahuita que las obras parecían ilegales. Efecto medible en diciembre de 2002: Tras fuertes lluvias + tormentas y mareas altas, el agua del humedal este y la quebrada del Hotel salió directamente al mar en dos lugares nuevos de la playa – hecho que nunca había ocurrido en los últimos 50 años según memoria local y evidencia de vegetación antigua. Esto prueba causalidad directa entre la represa + corte de árboles y la ruptura del buffer natural. Demuestra la fragilidad extrema del sistema. • Bananera aguas arriba: Zanjos y control del río alteraron la hidrología (menos agua en sequía, pulsos mayores en lluvia), eliminaron el filtro natural del llano e incrementaron nutrientes, sedimentos y químicos hacia el estero y arrecifes. El humedal de este informe es el último filtro antes del mar. Recomendaciones técnicas del experto (vigentes y urgentes): Dejar el humedal y el franjo de arena forestada completamente sin desarrollar. Remover la represa y relleno ilegal. Detener deforestación y mejoras en el buffer de arena. Prevenir drenaje directo al mar. El terreno más adentro (junto al camino interior) podría ser más sostenible con estudio hidrológico previo. V. VALOR PROBATORIO, ANÁLISIS DE LA CONVENCIÓN DE RAMSAR, JURISPRUDENCIA CONSTITUCIONAL, ROL DEL SINAC Y ANÁLISIS TÉCNICO DE RESTAURACIÓN DE HUMEDALES Este informe acredita de manera objetiva: 1. Que el área de ~89 hectáreas constituye humedal según estándares científicos internacionales (muchas especies OBL y FACW según Nombre10 1988) y nacionales. 2. La existencia de perturbaciones ilegales ya ejecutadas con daño ambiental medible y causalidad probada (represa de 2002 y sus efectos). 3. La indivisibilidad hidrológica del sistema: cualquier alteración aquí amenaza directamente el Parque Nacional Cahuita, los arrecifes y las pesquerías. 4. Las medidas técnicas idóneas de protección y restauración. Análisis específico de la Convención de Ramsar y designaciones en Costa Rica Costa Rica ratificó la Convención Relativa a los Humedales de Importancia Internacional, especialmente como Hábitat de Aves Acuáticas (Convención de Ramsar, Irán, 1971) mediante la Ley N° 7224. Actualmente cuenta con doce sitios designados de importancia internacional que cubren aproximadamente el 11 % del territorio nacional. Entre ellos destacan, en la provincia de Limón y el Caribe Sur: el Refugio Nacional de Vida Silvestre Mixto Jairo Mora Sandoval Gandoca-Manzanillo (designado el 11 de diciembre de 1995), el Humedal Caribe Noreste (designado el 20 de marzo de 1996) y las Turberas de Talamanca (designado el 2 de febrero de 2003, con porciones en Limón). Aunque el humedal específico de Playa Negra (Brazo Este del Estero de Hone Creek, ~89 hectáreas) no figura como sitio Ramsar designado individualmente, los principios de la Convención son de aplicación directa y vinculante porque forma parte de un sistema hidrológico y ecológico continuo e indivisible con el brazo oeste protegido dentro del Parque Nacional Cahuita y con la red más amplia de humedales del Caribe costarricense, incluyendo conexiones con sitios Ramsar cercanos como Gandoca-Manzanillo. La Convención obliga a la conservación y al uso sabio de los humedales (artículos 3 y 4), entendiendo por uso sabio aquel que permite obtener beneficios para la humanidad manteniendo las características ecológicas naturales. Cualquier alteración de la hidrología (represa, zanjo) o de las comunidades vegetales indicadoras de humedal viola estos principios internacionales y el deber de no degradar el carácter ecológico del sistema. Jurisprudencia constitucional sobre humedales y protección ambiental La Sala Constitucional ha desarrollado una jurisprudencia consolidada y robusta en torno al artículo 50 de la Constitución Política, reconociendo el derecho a un ambiente sano y ecológicamente equilibrado como derecho fundamental de incidencia colectiva. En sentencias reiteradas (entre ellas la N° 2006- 17126 y desarrollos posteriores), la Sala ha extraído del artículo 50 los principios de prevención, precaución (vinculado al artículo 15 de la Declaración de Río), no regresión ambiental, in dubio pro natura y objetivación de la tutela ambiental (exigencia de estudios técnicos y científicos suficientes, individualizados y previos). Recientemente, en casos como la sentencia N° 2026-14917 (relacionada con la cuenca del Tempisque y humedales asociados), la Sala enfatizó la necesidad de evaluaciones interinstitucionales integradas que consideren los impactos acumulativos, la conectividad ecológica de humedales y la interacción entre intervenciones autorizadas e ilegales. Se ha declarado violación al artículo 50 por omisiones en la protección, estudios incompletos o falta de medidas efectivas de restauración. La jurisprudencia también vincula expresamente estos principios con la Convención de Ramsar (Ley N° 7224), la Ley Orgánica del Ambiente (N° 7554) y la Ley de Biodiversidad (N° 7788), exigiendo al Estado no solo abstenerse de degradar, sino adoptar medidas activas de conservación y restauración cuando existen perturbaciones documentadas. Rol del SINAC y omisión prolongada El Sistema Nacional de Áreas de Conservación (SINAC) tiene la responsabilidad primaria, como ente técnico-científico del MINAE, en la protección, manejo y restauración de humedales y áreas silvestres protegidas, incluyendo la fiscalización y remoción de obras ilegales que alteran la hidrología. La persistencia, más de dos décadas después de las observaciones del informe de 2003 y de la denuncia ante el MINAE de Cahuita en el año 2000, de la represa, el zanjo y el relleno ilegal —sin que se hayan adoptado medidas efectivas de restauración hidrológica— configura una omisión prolongada del SINAC que ha permitido efectos regresivos en las características ecológicas del humedal de aproximadamente 89 hectáreas. Esta realidad hace imperativa una valoración integral actualizada del terreno. Análisis técnico de experto en restauración de humedales Desde la perspectiva de la restauración ecológica de humedales (disciplina consolidada a nivel global y con lecciones directas del caso de los Everglades mencionado por el propio autor del informe), la prioridad absoluta es la restauración hidrológica. La remoción inmediata de la represa y el zanjo perpendicular permitiría restablecer el flujo natural de lámina de agua hacia el estero del Río Hone, recuperando el hidroperíodo original (inundación permanente en el fango, estacional en las zonas de Nombre09 e intermedia) que sustenta las especies indicadoras obligadas (OBL) y facultativas mojadas (FACW) documentadas en los Cuadros 1-3. Una vez restaurada la hidrología, la recuperación de la vegetación puede ser mayoritariamente pasiva mediante la recolonización natural de yolillo (Raphia taedigera), Nombre09 (Pterocarpus officinalis) y coquito (Elaeis oleifera), complementada con siembras activas de propágulos locales en sectores más degradados. El monitoreo debe incluir transeptos permanentes de vegetación, medición continua de niveles de agua y calidad, y evaluación de suelos orgánicos. Los impactos acumulativos durante los más de 22 años transcurridos desde la línea base de 2003 incluyen probable reducción de la cobertura de especies obligadas de humedal, alteración del régimen de inundación, incremento en la carga de nutrientes y sedimentos hacia los arrecifes de Cahuita, y debilitamiento del buffer de arena forestada. Estos efectos regresivos, consentidos por la falta de actuación efectiva del SINAC, solo pueden cuantificarse con precisión mediante la valoración integral del terreno solicitada, que combine la extensión original de 89 hectáreas con el estado actual de la hidrología, la biodiversidad y la funcionalidad ecológica. La experiencia internacional (incluyendo la restauración de Everglades) demuestra que postergar la corrección hidrológica multiplica exponencialmente los costos y reduce las probabilidades de recuperación exitosa. Actuar ahora, con base en el informe técnico de 2003 actualizado mediante valoración integral, es la única vía científicamente sólida y jurídicamente exigible para revertir la regresión y cumplir con los principios de Ramsar y la jurisprudencia constitucional costarricense”. “En cumplimiento de lo dispuesto por la Sala Constitucional en el trámite del presente recurso de amparo, y en ejercicio del derecho de petición y acceso a la información consagrado en los artículos 27 y 30 de la Constitución Política, el suscrito solicitó a la Municipalidad de Talamanca el listado de permisos de uso de suelo otorgados en los sectores de Playa Negra y Río Carbón durante los últimos diez años. En respuesta, mediante oficio SCMT-151-2026 de 25 de junio de 2026 (recibido en atención al oficio MLV-00228-2026 y conocido por el Concejo Municipal en sesión ordinaria 112 del 18 de junio de 2026), la Secretaría del Concejo Municipal remitió un extenso listado que detalla más de cuarenta permisos de uso de suelo en la zona marítimo terrestre (ZMT) de los referidos sectores. Las aprobaciones se concentran principalmente en el año 2016 (con un notable cúmulo en marzo) y continúan de forma sostenida hasta 2026, incluyendo múltiples “actualizaciones de plano”. Cabe destacar que la municipalidad trasladó a la Alcaldía la solicitud de permisos de construcción (oficio SCMT-INT-107-2026), por lo que el listado aportado se refiere específicamente a permisos de uso de suelo. I. CONTENIDO Y ALCANCES DEL LISTADO APORTADO El documento municipal revela un patrón sistemático y sostenido de otorgamiento de permisos de uso de suelo en una zona de alta sensibilidad ecológica: • Concentración temporal: Notable acumulación de aprobaciones en marzo de 2016 (al menos ocho permisos en días cercanos), con continuos otorgamientos en años posteriores (2017, 2018, 2019, 2020, 2022, 2023 y 2026). • Alcance geográfico: La gran mayoría de los permisos se ubican específicamente en Playa Negra de Puerto Viejo y sectores aledaños a Río Carbón, área objeto de protección en este amparo por constituir humedal de importancia ecológica. • Naturaleza de los actos: Permisos de uso de suelo en la ZMT (demanio público conforme a la Ley N° 6043), muchos con “actualizaciones de plano”, lo que evidencia procesos de desarrollo o consolidación de ocupaciones preexistentes. • Volumen: Más de cuarenta autorizaciones individuales en un período de diez años en un espacio limitado y frágil, sin que el listado municipal evidencie evaluaciones de impacto acumulado ni consideraciones específicas sobre la integridad del humedal. Este patrón constituye prueba documental objetiva de una presión de desarrollo continua y persistente sobre el ecosistema que el presente amparo busca proteger. II. FUNDAMENTACIÓN JURÍDICA Y ANÁLISIS DE IMPACTOS AMBIENTALES A. Constitución Política y Ley de la Jurisdicción Constitucional El artículo 50 de la Constitución Política reconoce el derecho fundamental a un ambiente sano y ecológicamente equilibrado, imponiendo al Estado el deber de garantizarlo, defenderlo y preservarlo. La Ley de la Jurisdicción Constitucional (Ley N° 7135), en sus artículos 1, 2 y 4, establece que el recurso de amparo procede para proteger los derechos y libertades fundamentales, incluyendo el derecho al ambiente sano. Esta Sala ha desarrollado jurisprudencia consolidada según la cual, cuando existe amenaza o vulneración de este derecho con riesgo de daño irreparable o de difícil reparación, procede la adopción inmediata de medidas cautelares. La prueba aportada demuestra que la situación no es estática ni meramente histórica: el otorgamiento continuo de más de cuarenta permisos de uso de suelo hasta el año 2026 configura un riesgo actual, inminente y persistente de afectación al humedal, lo que hace imperativa la intervención de esta Sala para ordenar medidas precautorias efectivas, conforme al principio de tutela judicial efectiva que informa la Ley de la Jurisdicción Constitucional. B. Derecho Ambiental – Ley Orgánica del Ambiente N° 7554 y principios rectores • Artículo 2: El ambiente es patrimonio común de la Nación y su conservación es de utilidad pública e interés social. • Artículo 17: Toda actividad que altere o destruya elementos del ambiente requiere Evaluación de Impacto Ambiental previa, con aprobación indispensable antes de iniciar las obras. • Principios de prevención, precaución e in dubio pro natura: Cuando existan indicios razonables de daño ambiental, deben adoptarse medidas protectoras sin esperar certeza científica absoluta. El listado aportado evidencia que más de cuarenta permisos han sido otorgados en un ecosistema de humedal sin que conste evaluación de impacto acumulado. Esta omisión resulta especialmente grave porque los humedales son ecosistemas altamente sensibles y de recuperación lenta. C. Impactos ambientales previsibles sobre el ecosistema del humedal La cantidad y continuidad de permisos de uso de suelo en la zona marítimo terrestre de Playa Negra y Río Carbón generan un conjunto de impactos ambientales que, por su carácter acumulativo y sinérgico, pueden estar causando una degradación progresiva y potencialmente irreversible del humedal: • Alteración del régimen hidrológico: Las construcciones y movimientos de tierra modifican los patrones naturales de drenaje, infiltración y flujo de agua, reduciendo la capacidad del humedal para regular inundaciones y mantener su función de esponja natural. • Pérdida y fragmentación de hábitat: Cada nuevo permiso reduce la superficie de vegetación nativa y humedal, fragmentando corredores biológicos y afectando la fauna y flora características de estos ecosistemas. • Aumento de sedimentación y contaminación: Las obras generan arrastre de sedimentos y, si las edificaciones carecen de sistemas adecuados de tratamiento de aguas residuales, se produce contaminación por nutrientes y patógenos que altera la calidad del agua y favorece procesos de eutrofización. • Reducción de servicios ecosistémicos: Los humedales proporcionan purificación de agua, captura de carbono, protección costera y soporte a la biodiversidad. La acumulación de permisos debilita progresivamente estos servicios e incrementa la vulnerabilidad de la zona ante el cambio climático. • Efecto regresivo: El otorgamiento sostenido de permisos en un área bajo protección constitucional y legal representa una acción regresiva que contraviene el principio de no regresión en materia ambiental. En lugar de avanzar hacia mayor protección del humedal, se permite un proceso de ocupación y transformación que dificulta —y en muchos casos imposibilita— su recuperación futura. Estos impactos derivan directamente del volumen y la continuidad de las autorizaciones documentadas y se agravan por la condición de humedal costero, ecosistema reconocido internacionalmente por su alto valor ecológico y fragilidad (Convención de Ramsar, Ley N° 7224). D. Urgencia de medidas precautorias La Ley de la Jurisdicción Constitucional faculta a esta Sala para ordenar medidas cautelares cuando exista peligro inminente de daño irreparable o de difícil reparación a un derecho fundamental. En el presente caso se configura claramente este supuesto: • El humedal ya se encuentra en situación de extrema gravedad. • Las autorizaciones continúan hasta 2026, demostrando que la amenaza es actual y persistente. • Los impactos descritos son acumulativos y, una vez materializados, su reversión resulta técnicamente compleja, costosa y, en muchos casos, imposible en plazos razonables. • El principio in dubio pro natura obliga a inclinar la balanza a favor de la protección del ecosistema. Por tanto, resulta imperativo que esta Sala ordene medidas cautelares urgentes para detener el avance de la degradación mientras se resuelve el fondo del amparo”.\n\n 7.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Rueda Leal; y,\n\nConsiderando:\n\n I.- Objeto del recurso. La parte recurrente acusa mora judicial en el expediente 05-001155-0597-PE, sobre presuntas afectaciones al humedal río Carbón-Playa Negra. Afirma que camiones entras de forma cotidiana a dejar escombros y relleno. Considera que la respuesta del SINAC es insuficiente.\n\nII.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial: \n\na) En el expediente 05-001155-0597-PE se sigue una causa penal en contra de Nombre02, canadiense, por el delito de Construcción Ilegal en la Zona Marítimo Terrestre, Invasión de Áreas de Protección y Drenaje de Humedal, en Limón, Talamanca, Cahuita, Puerto Viejo, Playa Negra. (Ver informe rendido).\n\nb) Ese expediente está actualmente ante el Tribunal de Juicio de Limón, sede Bribri. (Ver informe rendido).\n\nc) Mediante resolución de las 11:20 horas del 1 de agosto de 2024, ese tribunal declaró rebelde al imputado y ordenó su captura. (Ver informe rendido).\n\nIII.- Sobre el caso concreto. En el sub examine, el parte recurrente acusa mora judicial en el expediente 05-001155-0597-PE, sobre presuntas afectaciones al humedal río Carbón-Playa Negra. Afirma que camiones entras de forma cotidiana a dejar escombros y relleno. Considera que la respuesta del SINAC es insuficiente.\n\nEn lo que respecta a la mora judicial, la Sala tuvo por probado que, en el el expediente 05-001155-0597-PE se sigue una causa penal en contra de Nombre02, canadiense, por el delito de Construcción Ilegal en la Zona Marítimo Terrestre, Invasión de Áreas de Protección y Drenaje de Humedal, en Limón, Talamanca, Cahuita, Puerto Viejo, Playa Negra. Ese expediente está actualmente ante el Tribunal de Juicio de Limón, sede Bribri. Mediante resolución de las 11:20 horas del 1 de agosto de 2024, ese tribunal declaró rebelde al imputado y ordenó su captura. \n\nAnte reclamo, relacionados con mora judicial en procesos penales, la Sala ha indicado:\n\n“II.- SOBRE EL CASO CONCRETO. En la especie, esta Sala ha dicho que, en materia penal, y en aplicación de lo dispuesto en el artículo 174 del Código Procesal Penal, si en la tramitación de algún asunto, recurso o gestión se ha producido algún retardo, la parte interesada puede presentar un pronto despacho y, de no obtener respuesta dentro del plazo legalmente establecido, interponer la respectiva denuncia ante la Inspección Judicial, la Inspección Fiscal o la Corte Plena, según corresponda. En este caso, la parte recurrente ni siquiera menciona que haya planteado dicha gestión, de modo que deberá -si a bien lo tiene- solicitar el pronto despacho respectivo, a fin de que las autoridades penales competentes dispongan lo que en derecho corresponda. En consecuencia, el recurso es inadmisible y así se declara”. (Sentencia nro. 2025008180 de las 9:20 horas del 14 de marzo de 2025).\n\nEse criterio es aplicable al sub lite, por lo que podrá el interesado acudir a las vías respectivas. En todo caso, la Sala nota que el imputado en ese proceso se encuentra actualmente rebelde y con orden de captura, lo que impide un pronto avance del proceso. Por los motivos expuestos, se declara sin lugar este extremo del recurso.\n\nIV.- Atinente a alegado daño ambiental al humedal de playa Negra, este Tribunal determina que el recurrente tiene actualmente otro proceso en trámite, relacionado con ese tema. En efecto, en la resolución de curso de las 7:41 horas del 9 de octubre de 2025, este Tribunal dio trámite al amparo 25-027587-0007-CO, interpuesto por el recurrente. En esa resolución se indicó:\n\n“…los hechos alegados por la parte recurrente, en resumen: que el humedal de Playa Negra, ubicado en Puerto Viejo, Talamanca, forma parte de la cuenca del río Carbón, colindante con el Parque Nacional Cahuita. Este ecosistema, descrito en la “Evaluación Preliminar del Brazo Este del Estero de Hone Creek Afuera del Parque Nacional Cahuita (Humedal Entre La Barra y El Hotel Perla Negra)” y el oficio SINAC-SE-GASP-165-2005 (13 de julio de 2005), alberga biodiversidad protegida, incluyendo especies en peligro como tortugas marinas (Baula, Carey, Verde y Cabezona), monos, cocodrilos, nutrias y aves migratorias. Además, cumple funciones críticas de regulación hidrológica y es un sitio de anidación clave para tortugas marinas, según el biólogo Didiher Chacón de la Asociación ANAI. Señala que desde el 28 de octubre de 2005, el Comité Local Forestal de Talamanca (CLFT), coordinado por el Ing. Gustavo Alvarado Salazar, documentó actividades ilegales en la propiedad del señor Pool Pavel Jareslav en Playa Negra, incluyendo drenaje de humedales, rellenos con cientos de vagonetas de arena y lastre, construcciones sin permiso, corta de árboles y obstrucción de la zona pública (oficio SINAC-SE-GASP-165-2005). Estas actividades, realizadas con maquinaria pesada, incluyendo equipos de la Municipalidad de Talamanca, han persistido por más de 20 años sin una restauración efectiva, como lo confirma la causa penal 24-00377- 0597-PE, pendiente desde 2004. Afirma que el 9 de agosto de 2025, presentó ante la autoridad recurrida el oficio AEL-0313-2025, mediante el cual solicitó un informe de seguimiento y copia integral del informe SINAC-ACLAC-DASP-RNVSGM136-2024 (26 de marzo de 2024), referente al drenaje y relleno del humedal presuntamente por la Municipalidad de Talamanca. En respuesta, la Licda. Maylin Mora Arias trasladó los oficios CARTA-SINAC-ACLAC-DASP-RNVSGM-421- 2025 y CARTA-SINAC-ACLAC-DASP-RNVSGM-416-2025 (26 de agosto de 2025), que confirman la ampliación de la denuncia y el depósito adicional de lastre, pero limitan la acción del SINAC a la paralización de actividades y la remisión del caso al Ministerio Público, sin adoptar medidas precautorias ni correctivas inmediatas. Agrega que el oficio CARTA-SINACACLAC-DASPRNVSGM-416-2025 y las imágenes del 26 de agosto de 2025 evidencian la extensión del relleno con lastre, agravando el daño al humedal. El informe SINACSE-GASP-165- 2005 detalla la presencia de plantas indicadoras de humedal (yolillo, majagua, araceas), suelos fangosos y fauna amenazada, así como la intervención humana mediante rellenos y drenajes que han alterado las condiciones naturales del ecosistema. La falta de una caracterización y delimitación actualizada del humedal, a pesar de los antecedentes de 2004 y 2005, perpetúa el riesgo de un daño irreversible. Indica que la causa penal 24- 00377-0597-PE, en trámite desde 2004, no ha logrado la restauración del humedal, y las acciones del SINAC se han limitado a informes sin medidas efectivas. Enfatiza que la autoridad recurrida ha omitido adoptar medidas precautorias y correctivas inmediatas para proteger y restaurar el humedal de Playa Negra, Puerto Viejo, Talamanca, un ecosistema de alto valor ecológico, a pesar de contar con indicios, pruebas y antecedentes documentados desde 2004, incluyendo el oficio SINAC-SE-GASP-165-2005 y los informes recientes del SINAC. Esta omisión viola derechos fundamentales garantizados por los artículos 21, 33, 46 y 50 de la Constitución Política, así como la normativa ambiental vigente, incluyendo la Ley de Biodiversidad (Ley N° 7788), la Ley Orgánica del Ambiente (Ley N° 7554), la Ley Forestal (Ley N° 7575) y el Decreto Ejecutivo N° 39838-MINAE sobre protección de humedales”. \n\nAsimismo, la Sala observa la similitud de pretensiones en ese y este proceso. Así, por ejemplo, en el expediente 25-027587-0007-CO, el accionante solicitó “…la delimitación y caracterización actualizada del humedal de Playa Negra…” y la “…suspensión de cualquier actividad de drenaje o relleno en el humedal y el retiro total del lastre depositado…”. Por su parte, en este amparo, el recurrente pretende un “…Mapa descriptivo y georreferenciado actualizado del Humedal de Playa Negra…” y la “…suspensión inmediata y total de toda actividad de relleno, extracción, tala y obras urbanísticas en el humedal…”. Incluso, en el expediente 25-027587-0007-CO reclama por las actividades ilegales en la propiedad de Pavel Jareslav, que es la persona imputada en el expediente penal, cuya mora acusa aquí. En ese tanto, por economía procesal y a los efectos de evitar resoluciones contradictorias, se dispone el archivo de este expediente, en lo que respecta a ese reclamo. Podrá el justiciable plantear los argumentos que estime prudentes en el expediente señalado.\n\nFinalmente, se explica al amparado que el numeral 38 de la Ley de la Jurisdicción Constitucional exige que el recurrente exprese en su escrito de interposición “…con la mayor claridad posible, el hecho o la omisión que lo motiva, el derecho que se considera violado o amenazado, el nombre del servidor público o del órgano autor de la amenaza o del agravio, y las pruebas de cargo…”. (El subrayado es agregado).\n\nAl respecto, la Sala observa que el escrito de interposición del recurrente no señala expresamente la autoridad recurrida y, además, contiene párrafos incomprensibles, propios de la versión preliminar de un texto (Por ejemplo: “7. Características técnicas del Humedal Río Carbón – Playa Negra [Texto completo de la ficha técnica tal como estaba en la versión anterior – desde “El humedal objeto de protección…” hasta “…El Humedal de Playa Negra es un área sumamente vulnerable, extremadamente frágil y por demás hermosa.”]”; “9. Imprecisión estructural y deficiencias graves del Sistema Nacional de Información Territorial (SNIT) respecto del Patrimonio Natural del Estado [Texto completo tal como estaba en la versión anterior – desde “La imprecisión crónica…” hasta el final del punto 9.]”; “III. DERECHOS VIOLADOS (Se mantiene igual – texto completo del recurso original)”; “IV. IMPERIOSA NECESIDAD DE MEDIDAS CAUTELARES AMBIENTALES (Se mantiene igual – texto completo del recurso original)”; “V. PRUEBAS (Se incorporan brutalmente todas las pruebas y detalles relevantes del recurso de amparo original, fortalecidas y ampliadas con los elementos técnicos y probatorios de extrema gravedad construidos)”).\n\nAdemás, vistos los múltiples escritos del justiciable y, en caso de que a bien lo tenga, podrá el interesado plantear los agravios que estime ante esta jurisdicción, en cuyo caso deberá cumplir los requisitos de ley mencionados, o en la vía administrativa o de legalidad que estime pertinente. En ese sentido, se explica que el proceso de amparo, por tratarse de una vía sumaria, es incompatible con actividad probatoria compleja, pues un amplio debate probatorio y análisis exhaustivo desnaturaliza la rapidez y protección directa de los derechos fundamentales. \n\nV.- Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel u objetos o pruebas contenidos en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados en un plazo máximo de 30 días hábiles, contado a partir de la notificación de esta sentencia. Se advierte que será destruido todo material que no sea recogido dentro de ese lapso, con base en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\" (aprobado por la Corte Plena en el artículo XXVI de la sesión nro. 27-11 de 22 de agosto de 2011 y publicado en el Boletín Judicial nro. 19 del 26 de enero de 2012) y en el artículo LXXXI de la sesión del Consejo Superior del Poder Judicial nro. 43-12 de 3 de mayo de 2012.\n\nPor tanto:\n\n Archívese el expediente en lo que respecta al presunto daño ambiental al humedal de Playa Negra. San José, at nine hours twenty-five minutes on the tenth of July, two thousand and twenty-six.\n\nAmparo action (recurso de amparo) filed under case number 26-016746-0007-CO, brought by Nombre01, national identification number (cédula de identidad) CED01, against the SISTEMA NACIONAL DE ÁREAS DE CONSERVACIÓN (SINAC) and the MINISTERIO PÚBLICO.\n\nBackground:\n\n1.- By written petition received at the Chamber on May 12, 2026, the petitioner files an amparo action. The petitioner states that, since 2005, criminal case file (expediente penal) number 05-001155-0597-PE has been open before the Environmental Prosecutor's Office (Fiscalía Ambiental), concerning alleged serious harm to the Humedal Río Carbón – Playa Negra wetland (humedal), with no resolution after twenty-one (21) years of intolerable and unacceptable judicial delay (mora judicial). The petitioner asserts that, over the course of more than two decades, and in a particularly intense and accelerated manner during the last fifteen (15) years, there has been systematic, routine, and devastating destruction of the wetland: luxury mansions, paved roads, commercial establishments, and illegal housing developments have massively encroached upon its territorial integrity, compounded by the fact that machinery owned by the Municipalidad de Talamanca has been used directly to facilitate this illegal real-estate development. The petitioner notes that, on a daily basis and especially on weekends, it is a habitual and readily observable practice for trucks loaded with debris to enter the area and carry out direct fill operations (relleno) on the wetland, along with clearing of hydrophilic vegetation and artificial drainage works that are accelerating its ecological collapse. The petitioner refers to the fact that SINAC itself acknowledged, in its CARTA-SINAC-SE-DE-PNH-0017-2026 of May 7, 2026, the ongoing illegal urbanization of the wetland, yet has limited itself to a tepid, insufficient, and inadmissible response, refusing to generate the updated technical information and georeferenced map that the petitioner has persistently requested. The petitioner argues that the categorical, deliberate, and intolerable refusal of SINAC and its National Wetlands Coordinator is extremely serious. That technical information is indispensable and cannot be deferred, not only to motivate the urgent intervention of the Procuraduría General de la República before the Juzgado Penal de Bribri, but fundamentally to make any eventual restoration of the ecosystem possible. The petitioner contends that, in accordance with the basic principles of environmental science and technology, it is essential and indispensable to obtain a proper diagnosis and complete environmental audit of the current condition of the Humedal Río Carbón – Playa Negra. In particular, the descriptive and up-to-date map of the Playa Negra wetland constitutes a critically important input for strengthening the legal, technical, and administrative defense of the ecosystem. Without this official, georeferenced cartographic instrument, it is impossible to precisely delineate the affected areas, identify illegal occupations, visualize the advance of urbanization, or substantiate in a conclusive manner the actions required for protection, eviction, and restoration. This diagnosis and map must determine with precision: \"• The degree and type of illegal occupation of the wetland, • The type, number, characteristics, and value of existing structures (including those linked to former municipal officials), • The specific actions for eviction, demolition, debris removal, hydrological restoration, revegetation, and recovery of ecosystem functionality.\" (sic). The petitioner mentions the official technical report of SINAC entitled \"Characterization and delineation of wetlands in the maritime-terrestrial zone (zona marítimo terrestre) of the coastline of the canton of Talamanca\" (ACLAC, June 2021). During the prolonged period in which the Ministry of the Environment and the Área de Conservación La Amistad Caribe filed away, concealed, and kept outside of public knowledge and the Sistema Nacional de Información Territorial (SNIT) the said technical report, the Municipalidad de Talamanca issued, in record time, a large number of construction permits within the territorial boundaries of the Humedal Río Carbón – Playa Negra, thereby enabling the accelerated and illegal urbanization of the protected ecosystem. Despite the fact that the Sala Constitucional declared this report official, the serious and irreversible environmental damage that originated during the period it was filed away and its subsequent removal from the SNIT persists and continues to worsen up to the date of filing of this action. The petitioner considers that the serious legal consequences arising from the large-scale exploitation and urban development of the wetland have caused both SINAC and the Municipalidad de Talamanca to maintain complete silence, which evidences possible institutional complicity in the disappearance of the wetland from the SNIT and in the systematic destruction of Playa Negra and the entire Río Carbón area. Based on the foregoing allegations, the petitioner considers that the challenged conduct is violating fundamental rights. The petitioner requests that the action be declared meritorious with all legal consequences.\n\n2.- By ruling issued at 21:54 hours on June 12, 2026, the amparo action was admitted for processing.\n\n3.- The petitioner states: \"SUPPLEMENTAL BRIEF AND NOTICE OF JUDICIAL DELAY on the part of the MINISTERIO PÚBLICO, specifically of the Coordinating Prosecutor of the Adjunct Agrarian-Environmental Prosecutor's Office, Lic. Luis Diego Hernández Araya, in relation to the persistent omission in the protection of the Humedal Río Carbón – Playa Negra (Natural Heritage of the State (Patrimonio Natural del Estado)). This is submitted on the basis of Resolution No. 384-2026 of the Fiscal Inspection Unit of June 5, 2026, and on all the technical and evidentiary documentation already forming part of the case file, including the official SINAC report of June 2021 and the CARTA-SINAC-SE-DE-PNH-0017-2026 of May 7, 2026. I. PROCEDURAL BACKGROUND ESTABLISHING THE JUDICIAL DELAY Since 2005, criminal case file No. 05-001155-0017-PE has been open before the Fiscalía Ambiental for alleged invasions, fill operations, and serious harm to the Humedal Río Carbón – Playa Negra. Twenty-one (21) years have elapsed without any decision on the merits, conviction, acquittal, or effective protective or restorative measure. On May 12, 2026, I filed a formal complaint before the Fiscal Inspection Unit for unjustified delay (administrative cause No. 26-000260-1821-DI). On June 5, 2026, said complaint was dismissed by Resolution No. 384-2026, on the formal ground that the complainant \"is not a party to the proceedings\" and, therefore, lacks access to the case file pursuant to Article 295 of the Código Procesal Penal. The report of Lic. Luis Diego Hernández Araya (May 27, 2026) acknowledges that the case has already been elevated to trial and that the accused is a fugitive (en rebeldía). That is to say, the criminal proceedings have progressed past the preliminary stage, yet remain without effective resolution after more than two decades. II. CONSTITUTIONAL ANALYSIS OF THE JUDICIAL DELAY The formal dismissal of the complaint for lack of standing as a party does not preclude substantive analysis of the judicial delay in light of constitutional mandates. Article 41 of the Constitución Política guarantees every person the right to have justice administered promptly and completely. This right is afforded heightened status when it concerns environmental protection (Article 50 of the Constitución Política), a fundamental right whose enforcement has been characterized by this Chamber as reinforced, with application of the principles of effectiveness, environmental non-regression (no regresión ambiental), precaution, and in dubio pro natura. In accordance with the reiterated case law of this Sala Constitucional, where continuous and irreversible environmental harm exists—such as the accelerated urbanization of the Humedal Río Carbón—procedural timeframes are drastically shortened. The twenty-one-year judicial delay in criminal case file No. 05-001155-0017-PE constitutes a flagrant violation of Articles 41 and 50 of the Constitución Política, particularly given that the harm persists and worsens every day. Article 295 of the Código Procesal Penal, which governs the confidentiality of the preliminary stage, is an ordinary procedural rule that cannot be interpreted or applied in a manner that empties of content the fundamental rights enshrined in the Constitution. The restriction on access to the case file does not exempt the MINISTERIO PÚBLICO from its constitutional duty to advance proceedings with the speed required for the effective protection of fundamental rights, especially where ongoing environmental harm exists and the proceedings have already been elevated to trial. The fact that the accused is a fugitive does not justify twenty-one years of inaction. On the contrary, it reinforces the obligation of the MINISTERIO PÚBLICO to adopt the appropriate procedural measures to prevent impunity from becoming a mechanism for environmental destruction. Resolution No. 384-2026, by limiting itself to a purely formal analysis, evades the substance of the constitutional problem: the existence of an intolerable judicial delay which, due to its duration and the irreversible environmental consequences it generates, constitutes an ongoing violation of Articles 41 and 50 of the Constitución Política. This Chamber has repeatedly intervened in cases of omission or delay that allow continuous environmental harm, ordering immediate protective measures and peremptory deadlines for the preparation of technical studies and georeferenced maps, especially where coastal wetlands are concerned and where authorities are obligated to update official cartographic information. III. CONNECTION TO THE PRESENT AMPARO ACTION The omission of Lic. Luis Diego Hernández Araya forms part of a pattern of institutional inaction that has allowed—and continues to allow—the accelerated and irreversible destruction of the Humedal Río Carbón – Playa Negra, as detailed in the body of this amparo action and in the technical documentation forming part of the case file. The judicial delay in criminal case file No. 05-001155-0017-PE not only violates the right to effective judicial protection (tutela judicial efectiva), but also constitutes the mechanism through which the violation of Article 50 of the Constitución Política is perpetuated. While the criminal proceedings remain stalled, illegal urbanization continues, permits are issued, and an ecosystem that forms part of the Natural Heritage of the State is being destroyed.\" Furthermore, \"I. THE EXTREME SERIOUSNESS OF THE SITUATION AND THE NEED FOR CONSTITUTIONAL INTERVENTION The Playa Negra wetland is in an extremely serious situation that demands the priority and immediate intervention of constitutional jurisdiction. This seriousness is not a subjective assessment. It is established by the existence of documented illegal fill operations, by the persistence of threats to a high-value coastal ecosystem, and by the inadequacy of ordinary administrative responses to guarantee its effective protection. The situation is of such magnitude that it transcends the scope of administrative enforcement and calls for action by this Sala Constitucional to prevent irreversible harm to a legally protected interest of constitutional rank. II. PURPOSE OF THIS BRIEF The purpose of this brief is to submit documentary evidence of particular relevance that establishes specific aggressions against the Playa Negra wetland and to ground the need for this Sala Constitucional to adopt effective protective measures, given the demonstrated insufficiency of ordinary environmental enforcement mechanisms. III. DOCUMENTARY EVIDENCE SUBMITTED (BY WAY OF ADDITIONAL SUPPORT) Submitted herewith as documentary evidence is official communication SINAC-ACLAC-PCP-47-2019, dated March 28, 2020, signed by officials of the Prevention, Control, and Environmental Protection Program of the Área de Conservación La Amistad Caribe (SINAC), by which a formal complaint regarding the filling of a wetland was lodged with the Fiscalía de Bribrí. From that document the following is apparent: • On March 27, 2020, SINAC officials carried out an inspection in the Playa Negra sector, specifically at coordinates E633719 N1068941. • It was confirmed that an illegal wetland fill operation was being conducted using earth, with an approximate volume of 24 m³, using a MACK-brand truck. • The affected area corresponds to a shrub swamp (pantano arbustivo) wetland, according to the National Wetland Registry of SINAC. • At the site, wetland indicator species were observed, including yolillo (Raphia taedigara), coquito (Elaeis oleifera), and aracea (Homalomena wendlandii), as well as the presence of standing water. • Work-stoppage notice and precautionary measures (acta de paralización y medidas cautelares) No. SINAC-ACLAC-PCP-016-2020 were issued. • Investigation was requested into the land-use permit issued by the Consejo Municipal de Talamanca in an area declared as a wetland, and ecosystem restoration at the offender's expense, pursuant to Article 98 of the Ley de Conservación de Vida Silvestre. This evidence establishes in an official and indisputable manner that the Playa Negra wetland has been the subject of direct aggressions and that conditions of vulnerability persist that justify reinforced and urgent constitutional protection. IV. LEGAL GROUNDS The right to a healthy and ecologically balanced environment, enshrined in Article 50 of the Constitución Política, imposes upon the State the positive obligation to effectively protect strategic ecosystems. When, as in the present case, the existence of concrete harm to a coastal wetland and the persistence of threats are established, constitutional jurisdiction is called upon to intervene on a priority basis to prevent irreversible harm from becoming entrenched. The Ley Orgánica del Ambiente and the Ley de Biodiversidad reinforce this state obligation, especially with respect to wetlands that provide essential environmental services (servicios ambientales) and that form part of the Natural Heritage of the State. The established seriousness of the situation of the Playa Negra wetland requires this Sala Constitucional to adopt measures guaranteeing effective protection, going beyond merely declaratory enforcement and ordering concrete actions to prevent irreversible harm.\"\n\n4.- Carlos Matamoros Ureña, in his capacity as assistant prosecutor (fiscal auxiliar) of the Fiscalía Ambiental de Limón, reports under oath as follows: \"Having reviewed and analyzed criminal case file 05-001155-0597-PE, brought against Nombre02, a Canadian national, residence identification number (cédula de residencia) CED02, for the offenses of Illegal Construction in the maritime-terrestrial zone, Invasion of Protected Areas, and Wetland Drainage, in Limón, Talamanca, Cahuita, Puerto Viejo, Playa Negra, I first wish to clarify that it is incorrect to state that the investigation is or was handled by this office; rather, it was investigated and prosecuted by the Fiscalía de Bribri, by Licda. Hazel Jiménez Villanueva, assistant prosecutor. Second, it is clarified that the case is currently being handled by the Tribunal de Juicio de Limón (Bribri division). In light of the foregoing, while this is a matter that should be reported by the Tribunal de Juicio, I can preliminarily state that, upon reviewing the case file, it is apparent that the case was expected to be scheduled for the Oral and Public Trial (Debate Oral y Público); however, by ruling issued at eleven hours and twenty minutes on the first of August, two thousand and twenty-four, the Tribunal ordered the declaration of fugitive status (rebeldía) and the arrest of the accused. In follow-up to that judicial order, it is noted that steps were taken to locate the accused. On September 12, 2024, the Tribunal received CAP-NEGATIVA No. 149-ORB-2024 issued by the Organismo de Investigación Judicial, informing that it had not been possible to locate the accused. Subsequently, on November 4, 2025, in coordination with the Tribunal de Juicio de Limón and the Fiscalía de Bribri, this office arranged for a detention order for the accused through coordination with the Fuerza Pública de Talamanca, without having achieved his location to date; moreover, on November 5, 2025, the Tribunal de Juicio de Limón issued a new order for the location and arrest of the accused. Likewise, the competent Tribunal requested immigration information regarding the accused, determining that the accused was within national territory. This circumstance was considered by the jurisdictional body when maintaining the declaration of fugitive status. As of the date of this report, the accused remains declared a fugitive, with the corresponding arrest warrant in force. No additional information has been received from the Organismo de Investigación Judicial or the Fuerza Pública that would allow for the establishment of the accused's whereabouts or the execution of the pending judicial order. Consequently, it must be noted that the processing of the case has been materially limited by the impossibility of compelling the accused to appear in the criminal proceedings, a situation that has led to the declaration of fugitive status and the issuance of the corresponding arrest warrants, with respect to which the MINISTERIO PÚBLICO has carried out all steps within the scope of its competencies. For the foregoing reasons, the assertion that there is any inactivity attributable to the MINISTERIO PÚBLICO in relation to the location of the accused or the resolution of the environmental legal situation under investigation is rejected, as this matter is also of concern to this office. For the above reasons, I respectfully request that this report be accepted as duly submitted and that a report also be requested from the Tribunal de Juicio, which will be able to corroborate the foregoing. This report is rendered on the basis of copies of the main case file and is submitted under oath.\"\n\n5.- Giovanna Valverde Stark, in her capacity as acting minister (ministra a.i.) of the Ministry of Environment and Energy, reports the following under oath: \"FIRST: With respect to the facts alleged in the present amparo appeal (recurso de amparo), a report was requested through official letter CARTA-SINAC-DAJ-0245-2026 dated June 16, 2026, addressed to MSc. Maylin Mora Arias, Regional Director of the Área de Conservación La Amistad Caribe, and to MSc. Rotney Piedra Chacón, Coordinator of the Programa Nacional de Humedales, both of the Sistema Nacional de Áreas de Conservación; the report is hereby transmitted through official letter CARTA-SINAC-ACLAC-DR-0357-2026, dated June 17, 2026, attached as evidence and set forth as follows: '…In response to the facts alleged by the appellant against the Sistema Nacional de Áreas de Conservación, it is appropriate to state: FIRST: Contrary to what the appellant has stated, the response provided by the Coordinator of the Programa Nacional de Humedales cannot be characterized as 'lukewarm, insufficient, and inadmissible,' since such an assessment entirely disregards the legal nature, the scope of competence, and the institutional position that said Program occupies within the structure of SINAC and MINAE. The Programa Nacional de Humedales was created by Decreto Ejecutivo N.° 36427, in force since April 28, 2011, with an eminently technical and advisory purpose: to promote, plan, and develop the wetlands (humedales) of Costa Rica, and to implement the agreements and guidelines issued by the Comité Nacional de Humedales. The specific administration, protection, and management of wetlands falls, by express mandate of that Decree, on SINAC through its eleven Áreas de Conservación, whose directors exercise the functions and powers established by the Ley de Biodiversidad in its articles 22 through 33. Consequently, the Coordinator of the Programa Nacional de Humedales does not hold, nor can hold, the powers belonging to a director of an Área de Conservación; therefore, Nombre01 has been provided a response consistent with the Coordinator's competence and the available information. This situation is neither new nor unknown to Nombre01, as it has been explained on repeated occasions through prior official correspondence, as recorded in the amparo appeal file N.° 0031-0007-237388745-2340-F, which demonstrates that his insistence does not stem from a lack of information, but rather from a refusal to accept the legally established distribution of competences within the institution. SECOND: In multiple written submissions, the complainant refers to the Playa Negra wetland ecosystem, also known as the Río Carbón wetland, which covers a broad area. For example, in submission MLV-009-2026, no coordinates, exact address, cadastral survey plan (plano catastrado), verifiable reference point, georeferenced photographs (fotografías georreferenciadas), or other minimum elements are provided that would allow the site where the alleged facts are purportedly occurring to be identified with certainty. Notwithstanding the foregoing, the Reglamento a la Ley Forestal N.° 7575 establishes that the State Forestry Administration (Administración Forestal del Estado, AFE), a function exercised by SINAC, must investigate every complaint filed and issue a report within a maximum period of 15 days, extendable in complex cases. If the investigation reveals the need to initiate administrative or legal actions, these must be pursued in accordance with the legal framework. When officials of MINAE-SINAC become aware of facts that could constitute environmental crimes against wetlands, they have a duty to report them to the Ministerio Público. This obligation derives from Article 281 of the Code of Criminal Procedure (Código Procesal Penal), applicable to public officials who, in the exercise of their functions, become aware of offenses prosecutable ex officio. Since wetlands constitute ecosystems protected by Costa Rican environmental legislation—particularly the Ley Orgánica del Ambiente, the Ley de Conservación de la Vida Silvestre, and the Ley Forestal—when SINAC detects fill operations (rellenos), drainage (drenajes), land-use change (cambios de uso del suelo), logging (tala), construction, or other activities that may affect a wetland, it not only may but must activate the administrative and, where appropriate, criminal mechanisms. With this jurisdictional background in mind, it is essential to inform this Honorable Chamber that since 2005, this authority conducted the corresponding investigation and filed a criminal complaint (denuncia penal) with the Ministerio Público under case file 05-001155-0597-PE. The following is a summary of some of the general actions taken by the institution within case 05-001155-0597-PE.\n\n• Since the end of 2002, Nombre03, a local resident and community leader, filed a complaint with the Concejo Municipal de Talamanca regarding the activities being carried out on land used by Nombre02, on the grounds that they were disrupting the natural balance of the site. These facts were linked to file N.° 0027-03-TAA of the Tribunal Ambiental Administrativo, which constitutes a key precedent, as it demonstrates that the alleged damages to the Río Carbón wetland had already been brought to the attention of administrative environmental authorities at that time.\n\n• On October 26, 2002, officials from the Talamanca Sub-region of the Área de Conservación La Amistad Caribe—specifically Eng. Lucrecia Monterrosa Smith and Biologist Donald Campbell Lindo—conducted an inspection of the land used by Nombre02. During that inspection, brush-clearing (chapeo), filling, drainage, and burning activities were identified within a wetland zone. As a result, a technical communication was issued to the then Mayor of Talamanca, Derloy Mayrie, noting the findings and, in particular, the drainage of the wetland.\n\n• On February 4, 2003, through official letter AAA-076-2003, the Procuraduría General de la República addressed the Tribunal Ambiental Administrativo regarding the removal of vegetation and the fencing of the restricted zone adjacent to the land occupied by Nombre02. In that official letter, with a copy to the Concejo Municipal de Talamanca, it was requested that the report provided for in Article 13 of Ley N.° 6043 be prepared, with the aim of assessing the eviction of alleged violators, the demolition of structures if warranted, and the filing of complaints with the Ministerio Público.\n\n• The Tribunal Ambiental Administrativo processed file N.° 0027-03-TAA against the then Mayor of Talamanca, Lic. Rugeli Morales, and against Nombre02.\n\n• In October 2004, Biologist Juan Sánchez of SINAC's wetlands office, together with Vera Montero of SINAC and Anael Fuentes of ACLAC, proceeded to delimit the area of the Río Carbón wetland. In this inspection, the wetland and forest character of the area was established, along with activities carried out by Nombre02, identified in the document as \"el checo.\" This milestone is essential because it technically consolidates the protected environmental status of the site.\n\n• In April 2005, Eng. Marcelo Pacheco, head of the ACLAC Talamanca Sub-region, visited the site along with Lic. Dani Arguello, legal advisor to the Municipalidad de Talamanca, to verify whether construction and filling activities were ongoing. During the inspection, the presence of construction materials and signs of recent work were confirmed.\n\n• Through official letter SINAC-SE-GASP-165-05, dated July 13, 2005, the inspection report on the delimitation of the Río Carbón wetland was documented; this report was prepared by Biologist Juan Sánchez of what was then the Wetlands Department of the Sistema Nacional de Áreas de Conservación. This document was offered as documentary evidence within the criminal complaint, as it constitutes a key technical input to establish the wetland status of the affected area.\n\n• In November 2005, officials from the Comité Local Forestal de Talamanca, ACLAC, and the Ministerio de Salud conducted a new inspection of the aforementioned land. During that inspection, the existence of four structures, holes for electrical posts, ditches, burned vegetation, and other anomalies were confirmed, and it was noted that the structures were located within the wetland. It was also confirmed that the road was blocked starting from Nombre02's house.\n\n• Based on the administrative, technical, and inter-institutional background described above, in 2005 a criminal complaint was filed with the Ministerio Público, giving rise to case N.° 05-001155-0597-PE, for alleged offenses of wetland drainage, illegal logging, and land-use change within the area of the Río Carbón wetland, on land used by private individuals within the Maritime-Terrestrial Zone (Zona Marítimo Terrestre, ZMT), in the Playa Negra sector of Puerto Viejo de Talamanca.\n\n• Within the criminal complaint, the Ministerio Público was requested to seek precautionary measures (medidas cautelares) before the Juzgado Penal de Talamanca, including the immediate suspension of construction works, the undertaking of actions to restore the wetland to its natural state, and the demolition of any erected structures, if warranted. It was also requested that documentary evidence, an ocular inspection, expert assessments (peritajes técnicos), and certifications be obtained from various institutions, including the Tribunal Ambiental Administrativo, the Municipalidad de Talamanca, the Instituto Geográfico Nacional, and SINAC.\n\nFurthermore, the appellant is aware of these administrative actions, given that on July 4, 2025, he sent an email to Lic. Carlos Matamoros Ureña regarding the Playa Negra wetland ecosystems, as shown in the image (…)\n\nFigure No. 1: Email from the appellant requesting resolution of case 05-001155-0597-PE\n\nAdditionally, other interventions carried out at the site gave rise to complaints filed before the judicial authority, identified under the following case file numbers: 23-000190-0597-PE; 24-000377-0597-PE; 05-001155-0597-PE; 20-001193-0472-PE; 22-000001-1851-PE; 20-001095-0485-PE. That is to say, the state forestry administration has carried out and processed the administrative, technical, and legal actions to address environmental crimes in the Playa Negra sector of Puerto Viejo de Talamanca.\n\nTHIRD: In response to note MLV-00140-2026, relating to a complaint regarding damage to the Río Carbón wetland in Playa Negra, Puerto Viejo de Talamanca, addressed by MSc. Rotney Piedra through official letter CARTA-SINAC-SE-DE-PNH-0017-2026 of May 7, 2026, the complainant was informed: \"within the scope of his competences, it has been informed that ACLAC filed a criminal case since 2005 with respect to the alleged damages to the Río Carbón wetland in the Playa Negra sector of Puerto Viejo de Talamanca, which is being processed under file N° 05-001155-0597-PE. Since then, the technical information generated by ACLAC has been contributed to the judicial file. Since an open criminal case already exists, SINAC reiterates its active willingness to coordinate with the Fiscalía Ambiental, the Organismo de Investigación Judicial, and any other competent authority to expand information, participate in field inspections, provide expert assessments, contribute institutional background, or collaborate in all proceedings formally required to achieve the resolution of that file. The Programa Nacional de Humedales will remain attentive to support ACLAC in whatever is needed, while SINAC emphasizes its institutional responsibility, which is exercised within the applicable legal framework and in coordination with the corresponding judicial and investigative bodies. Lastly, regarding the generation of a wetland map, it is noted that the information available to date is contained in the Registro Nacional de Humedales and can be consulted through the Sistema Nacional de Información Territorial (SNIT) viewer. The Ley Marco de Acceso a la Información Pública (Ley N.º 10554) does not require the generation of new technical products upon private request.\" It is thus demonstrated that the response provided by Mr. Piedra is correct and consistent with the appellant's request, the institutional competence, the available public information, and the access to information held by the administration.\n\nFOURTH: Regarding the request for an updated, georeferenced, and official map of the impacts on the Río Carbón–Playa Negra wetland, what was stated in CARTA-SINAC-SE-DE-PNH-0017-2026 is reiterated, to the effect that the official cartographic information available on wetlands is part of the Registro Nacional de Humedales and may be publicly consulted through the SNIT viewer, created by Decreto Ejecutivo N.° 37773-JP-H-MINAE-MICITT. This is stipulated by Article 8 of Ley N.° 10554, which provides that the Administration may direct the petitioner toward official public-information access platforms when the requested data are already available institutionally, without that entailing, in all cases, the obligation to generate new technical studies or specific cartographic products at the request of a party. Similarly, through official letter CARTA-SINAC-ACLAC-DR-DT-DRFVS-PH-0030-2026, the complainant was provided a response to query MLV-009-2026, stating that the preparation of a new historical map, chronological reconstruction of occupancy, retrospective image analysis, cadastral records, or environmental studies for evidentiary purposes is not information available at this time; what has been requested constitutes a new technical product that exceeds the scope of an ordinary public-information request. Should an expert or evidentiary product be required within the judicial investigation, it must be requested by the competent authority. In that regard, this Administration is not obligated to generate a new customized map, with layer overlays, hydrological analysis, or specific ecological assessment, upon private request, when the available cartographic information is already published on official platforms.\n\nFIFTH: Decreto Ejecutivo N.° 37773-JP-H-MINAE-MICITT, of May 7, 2013, published in La Gaceta N.° 134 of July 12, 2013, establishes the Sistema Nacional de Información Territorial (SNIT) as the official platform of Costa Rica for publishing and consulting georeferenced geographic and territorial information, and is administered by the Instituto Geográfico Nacional of the Registro Nacional. The following information is published on this platform:\n\nOfficial cartography (base maps of the territory).\nAdministrative boundaries: provinces, cantons, districts, and population centers.\nCadastral and territorial information.\nRoad network and transportation.\nHydrography and water resources: rivers, streams (quebradas), lakes, and watersheds.\nForest cover (cobertura forestal) and land use.\nEnvironmental information: protected areas, wetlands, biological corridors, life zones, and other environmental features.\nTopographic and relief information.\nMosaic of orthophotos (ortofotos) and satellite images for the periods 2005-2008 (scale 1:1000 and 1:5000) and 2014-2017 (scale 1:1000 and 1:5000).\nThematic layers generated by public institutions.\n\nThe SNIT is thus the official medium for publishing geospatial information; however, responsibility for the official status and updating of each layer belongs to the institution that generates and publishes it. For example, in the case of the Registro Nacional de Humedales (based on the National Wetlands Inventory of 2018), it is SINAC, as the responsible technical authority, that submits the information for periodic updating and publication. The report mentioned by the complainant, entitled \"Caracterización y delimitación de humedales en la zona marítimo terrestre del litoral del cantón de Talamanca\" (ACLAC, June 2021), was never published on the SNIT, as the complainant erroneously states. For its results to be published, it must comply with the due process and technical rigor required at the internal institutional level and established by current regulations. This was affirmed by the Sala Constitucional in resolution 2024010951 under file 24-005929-0007-CO, in which it ordered:\n\n\"The appeal is declared partially upheld. Maylin Mora Arias, in her capacity as acting regional director (a.i.) of the Área de Conservación La Amistad Caribe of the Sistema Nacional de Áreas de Conservación, or whoever holds that position, is hereby ordered to issue the relevant instructions, carry out all actions within the scope of her competences, and coordinate whatever is necessary so that, within THREE MONTHS following compliance with the order given in judgment no. 2024003959 of 9:16 hours of February 16, 2024, issued in file 23-014549-0007-CO at 9:30 hours of February 16, 2024, namely: 'to conclude, within a period of THREE MONTHS, counted from the notification of this judgment, the process to supplement the State Natural Heritage (Patrimonio Natural del Estado) certification for the Maritime-Terrestrial Zone of the Canton of Talamanca with the \"Caracterización y delimitación de humedales en la zona marítimo terrestre del litoral del cantón de Talamanca\" of June 2021,' the delimitation and scope of the State Natural Heritage contemplated in certification SINAC-ACLAC-DR-PNE-C-011-2017 are reviewed and, with current and precise elements, as well as the appropriate technical support, an updated certification is issued that encompasses and delimits all State Natural Heritage strips in the Maritime-Terrestrial Zone of the Canton of Talamanca.\"\n\nIn compliance with the foregoing, certification SINAC-ACLAC-DRFVS-PNE-C-014-2025, updated to 2025, was issued. Figure No. 1 shows a compilation of the State Natural Heritage in the Canton of Talamanca, which includes the area referred to by the complainant, known as the Playa Negra wetland.\n\n(…) Figure No. 2: Map of forests and wetlands delimited in the ZMT of Talamanca\nSource: certification SINAC-ACLAC-DRFVS-PNE-C-014-2025, updated to 2025.\n\nIn that regard, the State Natural Heritage Certification is regulated by the Executive Branch through Decreto Ejecutivo No. 36786, the \"Manual para la clasificación de tierras dedicadas a la conservación de los recursos naturales dentro de la Zona Marítimo Terrestre en Costa Rica,\" which has been in force since November 11, 2011, and constitutes the legal norm underpinning it. The \"Technical Report on Classification and Delimitation of the State Natural Heritage in the Maritime-Terrestrial Zone of the Litoral of the Canton of Talamanca,\" SINAC-ACLAC-DRFVS-PH-006-2025, is the result of the exercise, review, classification, delimitation, and technical characterization of the Maritime-Terrestrial Zone of the Talamanca coast, and constitutes the Technical Study that precedes and underpins the issuance of a State Natural Heritage Certification, as established by the applicable legal norm, namely Decreto Ejecutivo No. 36786, and which enables the issuance of the State Natural Heritage Certification at the official level. Note that Decreto Ejecutivo No. 36786 is the legal norm for preparing a technical-level report based on the Manual and Directriz SINAC-IRT-001-2016; the norm is exhaustive with respect to the requirements and procedures to be followed.\n\nDecreto Ejecutivo No. 36786 establishes the following: \"I. Objectives. i. To identify, within the Maritime-Terrestrial Zone, those lands classified as forests, of forestry aptitude (aptitud forestal) (Class VII and VIII soils), and wetlands (mangroves, estuaries (esteros), rias, salt marshes (marismas), coastal lagoons, swamps (pantanos), flooded forests, and salt flats (salitrales)), in order to certify them and incorporate them as part of the State Natural Heritage (PNE). ii. To delimit, in accordance with Article 33 of the Ley Forestal, the protection areas (áreas de protección).\"\n\nThe legal norm, Decreto Ejecutivo No. 36.786, establishes the following general procedure: V. Units to be classified; VI. General procedures applicable to the units to be classified; VII. Procedure for classifying forest in the ZMT; VIII. Parameters for defining forestry-aptitude land without forest cover (Classes VII and VIII); IX. Procedure for defining wetlands; X. Procedure for defining protection areas; XI. Preparation of the Certification; XII. Registry and control of Certifications.\n\nIn accordance with the foregoing, the administration has categorically demonstrated, under the principle of legality, that it complied with the requirements and procedures established under the valid and effective legal instruments at the time of issuance of the State Natural Heritage Certification SINAC-ACLAC-DRFVS-PNE-C-014-2025, of March 2025. It is also important to bring to this Honorable Chamber's attention that through report SINAC-ACLAC-DRFVS-PH-006-2025, in compliance with resolution Nº2024-003959 of file Nº23-014549-0007-CO, in which the complainant is a party, the matter relating to the characterization and delimitation of wetlands in the Maritime-Terrestrial Zone of the litoral of the Canton of Talamanca was addressed, and therefore this mapping is duly updated and protected through the determination of the State Natural Heritage. In summary, the delimitation of the area corresponding to the Playa Negra–Río Carbón wetland is duly included both in the State Natural Heritage certification for the Canton of Talamanca and in the information published on the SNIT, to which the appellant has and has had public and immediate access. A diagram of the foregoing is shown below.\n\n(…) Figure No. 4: Location diagram of the wetlands in the Playa Negra sector and PNE in the ZMT of Talamanca, Playa Negra sector.\nSource: PNE-ACLAC office, 2026\n\nIt is of vital importance to emphasize that the Sala Constitucional itself, through resolution N.° 2025030106, issued in file N.° 25-024124-0007-CO—an amparo appeal filed by Nombre01 against the Sistema Nacional de Áreas de Conservación—dismissed the appeal and upheld as valid the guidance provided by SINAC regarding the use of official platforms such as the Sistema Nacional de Información Territorial (SNIT) and the Sistema Integrado de Trámite de Denuncias Ambientales (SITADA). In accordance with that ruling, the official cartographic information available on wetlands, State Natural Heritage, environmental layers, delimitations, and territorial information linked to the Playa Negra or Río Carbón wetland is available for free public consultation in the SNIT viewer. Therefore, the referral to that platform does not constitute a denial of information, but rather guidance toward the corresponding official public-access medium. Article 8 of Ley N.° 10554 (Ley Marco de Acceso a la Información Pública) likewise provides that the right of access encompasses public information existing in the Administration's possession, but does not imply an obligation to generate new studies, expert assessments, or previously nonexistent technical products upon private request. Notwithstanding the foregoing, SINAC remains fully willing to collaborate technically with the competent authorities within the framework of criminal case N.° 05-001155-0597-PE, or in response to requests formally submitted in accordance with the applicable legal framework.\n\nSIXTH: Matters relating to construction permits and land-use planning (ordenamiento territorial) outside of protected wildlife areas (áreas silvestres protegidas) and State Natural Heritage are within municipal jurisdiction; therefore, SINAC neither administers nor maintains the registry of municipal construction permits, land uses, building licenses, or urban authorizations. Such information must be requested from the Municipalidad de Talamanca, as the competent authority in matters of construction permits and local land-use planning, or from such other institutions as may be appropriate depending on the nature of the proceeding. Evidently, SINAC's regulatory framework enables it to provide information only within the scope of its competences and the records it maintains.\n\nSEVENTH: The conservation area possesses the State Natural Heritage certification, updated to 2025, which made it possible to identify and delimit the State Natural Heritage comprising forests, wetlands, forestry-aptitude lands, and protection areas—sites where monitoring and protection actions are carried out to prevent encroachments on the heritage and/or activities prohibited by environmental regulations. Should possible unlawful acts occur, the state forestry authority carries out the corresponding inspection and files a criminal complaint with the Ministerio Público. In that regard, the institutional action is summarized as follows:\n\nReceiving and processing the complaint.\nConducting inspections and technical investigations.\nIssuing technical and legal reports.\nAdopting precautionary or administrative measures when appropriate.\nFiling a criminal complaint with the Ministerio Público when the facts may constitute an environmental crime.\nFollowing up on administrative proceedings within its competence.\n\nEIGHTH: Without prejudice to the actions taken in judicial proceedings, SINAC maintains its administrative competences for monitoring, oversight, and technical environmental support over the referenced ecosystem, within the applicable legal framework and in accordance with any institutional or judicial requirements that may arise. Likewise, SINAC reiterates its willingness to participate in field inspections, issue technical opinions, and contribute institutional information in proceedings formally requested by the competent authorities.\n\nCONCLUSIONS.\n\nThe Sistema Nacional de Áreas de Conservación (SINAC), in its capacity as State Forestry Administration, has diligently and promptly exercised the technical and legal competences conferred upon it by the legal framework for the handling, investigation, and follow-up of the alleged environmental crimes reported in the Playa Negra–Río Carbón sector of Puerto Viejo de Talamanca.\n\nThe public information held by the Administration that is relevant to addressing the submitted request has been made available to the interested party, including information contained on the official SNIT platform, created by Decreto Ejecutivo N.° 37773-JP-H-MINAE-MICITT, which constitutes the official medium for consulting geospatial and cartographic information that is freely and publicly accessible.\n\nConsequently, the response provided by the acting official is in conformity with the law, consistent with the content of the request submitted, with SINAC's institutional competences, and with the principles of transparency and public access to information, by directing the petitioner toward the official sources where the requested information is available.\n\nThere is no legal obligation for this Administration to generate new information, prepare specific cartography, produce customized maps with thematic layer overlays, conduct particular hydrological analyses, or develop individualized ecological assessments at the request of a petitioner, when the existing official information is duly systematized and available through the institutional public-consultation mechanisms.\n\nThe right of access to public information encompasses access to information existing in the Administration's possession, but does not impose the duty to create non-existent documents, studies, or technical products.\n\nIn accordance with the available institutional records, the delimitation and location of the Playa Negra–Río Carbón wetland is incorporated—with respect to the area corresponding to the Maritime-Terrestrial Zone—in the official State Natural Heritage certification for the Canton of Talamanca, as well as in the official geospatial layers published on the SNIT, information that has remained permanently and unreservedly accessible to the public.\n\nThe referral to the information available on the Sistema Nacional de Información Territorial (SNIT) does not constitute a denial of or restriction on the right of access to public information, but rather an indication of the official consultation medium established by the State to ensure efficient, transparent, and timely access to the territorial and environmental information administered by the competent institutions.\n\nauthorizations relating to land-use planning outside of Protected Wildlife Areas and State Natural Heritage, primary competence belongs to municipalities and other entities with urban and territorial powers. By virtue of the principle of legality, SINAC does not administer, maintain, or generate the municipal records associated with such authorizations, and therefore can only provide information relating to the substantive areas that fall within its legal competence.\n\nFrom the analysis of the administrative file and the institutional background, it is evident that SINAC has fulfilled the obligations corresponding to it within its area of competence, including the receipt and processing of complaints, the conduct of field inspections and technical investigations, the issuance of technical and legal reports, the adoption of administrative measures when warranted, the filing of complaints with the Ministerio Público upon identification of possible environmental crimes, and the monitoring of administrative proceedings within its competence.\n\nWithout prejudice to the proceedings currently underway or that have been referred to the competent judicial authorities, SINAC fully retains its oversight (fiscalización), monitoring, control, and technical support powers with respect to the Playa Negra–Río Carbón wetland (humedal) ecosystem, within the framework of the competencies conferred upon it by the Ley Forestal, the Ley Orgánica del Ambiente, the Ley de Conservación de la Vida Silvestre, and other applicable regulations.\n\nFinally, SINAC reiterates its standing willingness to collaborate with the competent administrative and judicial authorities, through participation in field inspections, the issuance of specialized technical opinions (criterios técnicos especializados), and the provision of institutional information formally requested for the clarification of the facts and the effective protection of the natural resources and ecosystems involved.\n\nAll of this reflects that, according to what the petitioning party (parte recurrente) has stated, this is not an inter-institutional matter to be resolved by the Sistema Nacional de Áreas de Conservación, and that, having submitted the present attached official communications (oficios) as evidence and in light of the foregoing, it is requested that the writ of amparo (recurso de amparo) filed by the petitioning party be dismissed (sin lugar), inasmuch as the actions of the represented institution have not constituted a violation of any fundamental right with respect to the alleged facts.\"\n\n6.- The appellant states: \"OBJECT OF THIS BRIEF\n\nThrough this filing, I submit as new and highly relevant documentary evidence the following documents, which demonstrate the persistence of a serious, fragmented, and inadequate institutional omission on the part of SINAC, which heightens the risk of irreparable harm to the wetland (humedal) ecosystem and violates the constitutional rights enshrined in Article 50 of the Political Constitution:\n\n1. CARTA-SINAC-SE-DE-PNH-0027-2026 of June 22, 2026, signed by MSc. Rotney Piedra Chacón, Coordinator of the National Wetlands Program.\n2. The undersigned's reply to the aforementioned letter (request for expansion and comprehensive administrative investigation of June 24, 2026).\n3. Report on the Characterization and Delimitation of Wetlands in the Maritime-Terrestrial Zone (Zona Marítimo Terrestre, ZMT) of the Coastal Strip of the Canton of Talamanca, prepared by SINAC in June 2021 (Bach. Oscar Fonseca Rivera and Geographer Francisco Domínguez Barros).\n\nII. ANALYSIS OF THE SUBMITTED EVIDENCE\n\nA. On CARTA-SINAC-SE-DE-PNH-0027-2026 (June 22, 2026)\n\nThe National Wetlands Program acknowledges the complexity of the wetland cases in ACLAC and states that it is working on a joint \"roadmap\" with ACLAC. However:\n\n• It merely refers to criminal case N° 05-00155-0597-PE of 2005, without providing an updated assessment of the state of the ecosystem.\n• It expressly declares that it lacks the legal authority (competencias legales) to order, execute, or impose preventive, corrective, or restorative administrative measures at specific sites, transferring all responsibility to ACLAC.\n• It establishes no concrete timelines or effective coordination actions for the comprehensive protection of the wetland.\n\nThis response confirms an omissive and fragmented institutional stance that runs counter to the constitutional duty of effective environmental protection.\n\nB. On the Report on the Characterization and Delimitation of Wetlands (SINAC, June 2021)\n\nThis official document from SINAC itself, prepared just five years ago, expressly covers the Río Carbón–Puerto Viejo coastal plain and constitutes irrefutable proof of the following:\n\n• The area presents predominantly hydromorphic soils (suelos hidromórficos) (Entisoles, Inceptisoles e Histosoles) with an aquic moisture regime, slow-to-nil drainage, and severe to very severe flood risk.\n• The dominant vegetation is hydrophilic and characteristic of wetlands: Raphia taedigera (yolillo), Pterocarpus officinalis (sangrillo), araceae, Cyclanthus bipartitus, among other obligate or facultative wetland species.\n• Multiple human interventions have been documented (constructions, lot subdivisions (lotificaciones), fill operations (rellenos), and works) within or at the edges of areas with wetland characteristics.\n• The report emphasizes the hydrological fragility of the system: altering one sector affects others, and protection must be carried out under a comprehensive ecosystemic approach (enfoque ecosistémico integral).\n\nThis report demonstrates that SINAC had already possessed detailed technical knowledge of the presence, extent, and vulnerability of these wetlands since 2021. It is particularly alarming that, despite having this internal official information, the June 2026 response merely cites a 2005 criminal case file without updating or applying the technical knowledge already generated by the institution.\n\nC. On the undersigned's reply (June 24, 2026)\n\nIn light of the insufficiency of SINAC's position, a formal request was made for the conduct of a comprehensive, detailed, and exhaustive administrative investigation of the Humedal Río Carbón – Playa Negra as an indivisible ecological unit, to update the 2021 report and to include the current quantification of the impact (in excess of 30-40 hectares of lost integrity), the cumulative impacts, and an action plan with defined timelines.\n\nIII. CONSTITUTIONAL LEGAL GROUNDS\n\nThe submitted evidence establishes the violation of the following constitutional rights and principles:\n\n• Article 50 of the Political Constitution: The right to a healthy and ecologically balanced environment. The State has the duty to protect it in an effective manner, not merely a formal one.\n• The principles of prevention and precaution, as well as the in dubio pro natura principle.\n• The duty of promptness and effectiveness of the Public Administration (Articles 15, 16, and 269 of the Ley General de la Administración Pública).\n• The right to effective judicial protection and the timely safeguarding of fundamental rights (Articles 27, 41, and 48 of the Political Constitution).\n\nSINAC's attitude—acknowledging the complexity of the case while declaring itself incompetent to act directly and referring to a criminal case file more than 21 years old—constitutes a failure to protect (omisión de protección) that places the wetland ecosystem at imminent and irreparable risk, in clear contradiction with the reiterated jurisprudence of this Constitutional Chamber (Sala Constitucional) in matters of environmental protection and wetlands.\"\n\nAdditionally: \"I. OBJECT OF THIS REPLY\n\nThrough this filing, a reply is submitted to the report rendered by the Executive Directorate of SINAC through CARTA-SINAC-SE-DE-0760-2026 of June 18, 2026, which incorporates and endorses the input report from the Regional Directorate of ACLAC (CARTA-SINAC-ACLAC-DR-0357-2026 of June 17, 2026). The purpose of this reply is to note that the Executive Directorate's report does not refute the facts alleged in the writ of amparo (recurso de amparo), omits any reference to the current state of impact on the wetland, and maintains a position that is insufficient to establish compliance with the constitutional and legal obligations to protect the ecosystem.\n\nII. SUMMARY OF THE ARGUMENTS IN THE EXECUTIVE DIRECTORATE'S REPORT\n\nThe Executive Directorate's report essentially argues that:\n\n• The response from the Coordinator of the National Wetlands Program cannot be characterized as insufficient, because that Program has technical and advisory functions, while execution falls to the Conservation Areas.\n• Since 2005, criminal case N° 05-001155-0597-PE has been active and administrative actions and investigations have been carried out.\n• Cartographic information is available in the National Territorial Information System (Sistema Nacional de Información Territorial, SNIT) and in the State Natural Heritage (Patrimonio Natural del Estado) certification updated to the year 2025 (SINAC-ACLAC-DRFVS-PNE-C-014-2025), which incorporated the technical characterization report of June 2021.\n• There is no obligation to generate new technical products or customized maps upon individual request, pursuant to Article 8 of Ley N° 10554.\n• Construction permits for areas outside protected wildlife areas and the State Natural Heritage fall under the jurisdiction of the Municipality of Talamanca.\n• SINAC has fulfilled its competencies by receiving complaints, conducting inspections, issuing reports, and filing criminal complaints when appropriate.\n• The dismissal of the writ of amparo is requested.\n\nIII. GROUNDS FOR THE REPLY\n\n3.1. Failure to provide effective protection and the duty arising from Article 50 of the Political Constitution\n\nArticle 50 of the Political Constitution recognizes the right to a healthy and ecologically balanced environment. This right imposes on the State obligations of active protection, which include the adoption of preventive, control, and restorative measures whenever the impact on a protected ecosystem is established or credibly alleged.\n\nThe Executive Directorate's report merely describes actions carried out more than twenty years ago and refers to the existence of a criminal case initiated in 2005. It does not establish that effective measures have been adopted to halt the destruction alleged to be ongoing and accelerating in recent years, nor does it provide information on the current state of the wetland. This failure to take concrete action is incompatible with the duty of protection derived from Article 50 of the Constitution.\n\n3.2. Insufficiency of the reference to the 2005 criminal case in light of conduct of a continuing nature\n\nThe report highlights criminal case N° 05-001155-0597-PE and mentions other complaints filed in subsequent years. However, the report does not establish that this case has progressed effectively, nor that precautionary or restorative measures have been imposed that prevented the continuation of the alleged conduct. The existence of multiple criminal case files spanning more than two decades, without demonstrated effective resolution or cessation of the impacts, does not establish current protection. The conduct alleged in this amparo proceeding is of a continuing nature. Exclusive reference to an old criminal case does not satisfy the obligation to adopt timely and effective measures for the protection of the ecosystem.\n\n3.3. On the State Natural Heritage certification and the information available in the SNIT\n\nThe report indicates that the wetland area is included in the State Natural Heritage certification updated to the year 2025 and that cartographic information is available in the SNIT. The State Natural Heritage certification is an act of identification and delimitation. Its issuance does not, in itself, substitute for the obligations of oversight, control, and adoption of material measures to prevent the destruction of the delimited ecosystem. The report does not establish that, following the issuance of that certification or prior to it, concrete control actions were taken that prevented the fill operations, drainage, and construction alleged as current facts. The availability of information in the SNIT constitutes a means of public access. However, when an amparo proceeding specifically requests a technical input to establish the current state of impact and support judicial protective measures, a mere referral to general platforms is insufficient when the institution possesses the underlying information necessary to prepare or provide that input.\n\n3.4. On the obligation to provide technical inputs in the context of the amparo proceeding\n\nThe report argues that there is no legal obligation to generate new technical products or customized maps upon individual request. In the context of a writ of amparo for the alleged violation of Article 50 of the Political Constitution, the authorities have a duty to cooperate with the constitutional jurisdiction by providing the elements necessary to verify the alleged facts and adopt the appropriate measures. The appellant has repeatedly requested an updated map of the wetland's impact. SINAC prepared in 2021 a technical characterization report that covers the Río Carbón–Puerto Viejo coastal plain and served as the basis for the 2025 State Natural Heritage certification. The refusal to facilitate an updated analysis based on information already available and in the institution's possession hinders the exercise of effective judicial protection.\n\n3.5. On municipal jurisdiction and the protection of areas within the State Natural Heritage and the wetland\n\nThe report states that construction permits outside protected wildlife areas and the State Natural Heritage fall under the jurisdiction of the Municipality of Talamanca. The alleged facts refer to fill operations, drainage, and construction carried out within the wetland area and the State Natural Heritage. When impacts occur within areas subject to special protection, SINAC has jurisdiction to conduct inspections, adopt administrative measures, request the annulment of acts incompatible with the protection of the area, and file the appropriate complaints. The report does not establish that these competencies have been effectively exercised in response to the specific occupations and impacts alleged in the Playa Negra / Río Carbón sector in recent years.\n\n3.6. Inconsistencies between the Executive Directorate's report and ACLAC's input report\n\nThe Executive Directorate's report substantially reproduces and endorses the arguments in ACLAC's input report. Both documents:\n\n• Emphasize actions taken between 2002 and 2005 and the existence of the 2005 criminal case, without demonstrating effective control over the conduct alleged to be ongoing.\n• Justify the institutional response on the basis of internal jurisdictional distribution, without assuming comprehensive responsibility for the protection of the ecosystem.\n• Present the 2025 State Natural Heritage certification as a protective element, without demonstrating that said certification has prevented or halted the impacts alleged to be current.\n• Fail to address in concrete terms the current state of the wetland, the extent of the alleged impact, or the specific measures adopted in recent years for its protection.\n\nThese commonalities between both reports make clear that the Executive Directorate's position contributes no new elements that would refute the allegations of the writ of amparo.\"\n\n\"By means of this filing, and pursuant to Articles 1, 2, 27, 30, 48, and 50 of the Political Constitution, as well as Articles 2, 9, 15, 29, 30, 48, and 75 of the Ley de la Jurisdicción Constitucional, I hereby submit as additional documentary evidence Inspection Report SINAC-SE-GASP-005, dated January 13, 2009, prepared by Biologist Juan Sánchez Ramírez, then Coordinator of the National Program for Wetlands and the Maritime-Terrestrial Zone of the Protected Wildlife Areas Division of SINAC.\n\nThis report constitutes a piece of evidence of high technical and legal value, for the following reasons:\n\nFirst. It is an official State document, prepared by the institution with jurisdiction over the conservation of wetlands and protected wildlife areas. It documents, in detail and with field-based technical support, the existence of serious and systematic environmental damage in the Playa Negra sector and surrounding areas near Río Carbón, within and in the vicinity of the Gandoca-Manzanillo National Wildlife Refuge (REGAMA). Among the documented damages are: felling of wetland vegetation (including yolillo), drainage and filling of wetlands, illegal construction in the Maritime-Terrestrial Zone, encroachment upon public watercourse buffer zones (áreas de protección de cauces públicos), and land-use change (cambio de uso del suelo) in forest and wetland areas.\n\nSecond. The report demonstrates that, as early as 2008, the competent authorities—including the Environmental Prosecutor's Office (Fiscalía Ambiental)—had institutional knowledge of these impacts, as reference is made to prior complaints that had received no effective response. This establishes a historical pattern of State omission in the protection of this ecosystem, which persists to the present day.\n\nThird. The technical findings contained in this document are directly relevant to establishing the persistence, severity, and continuity of the environmental impacts alleged in these constitutional proceedings. The situation described in 2008 has not only gone unresolved, but reflects a structural problem affecting a high ecological value ecosystem, including sea turtle nesting areas and wetlands of importance for biodiversity in the southern Caribbean.\n\nFourth. This report reinforces the need for the Sala Constitucional to adopt effective protective measures to prevent the continuation of environmental damage that, by its nature, may become irreversible. Adopt, in accordance with its constitutional powers, the measures necessary to guarantee effective protection of the Playa Negra wetland and the Río Carbón ecosystem, including, if appropriate, the issuance of constitutional or precautionary protective measures.\"\n\n\"By means of this filing, and pursuant to Articles 1, 2, 27, 30, 48, and 50 of the Political Constitution, as well as Articles 2, 9, 15, 29, 30, 48, and 75 of the Ley de la Jurisdicción Constitucional, I hereby submit as additional documentary evidence the following official technical reports:\n\n1. Report SINAC-SE-GASP-165-05 dated July 13, 2005, prepared by Biologist Juan Sánchez Ramírez.\n2. Report SINAC-SE-GASP-005 dated January 13, 2009, prepared by Biologist Juan Sánchez Ramírez.\n3. Report TAA-DT-272-2024 dated August 27, 2024, and official communication O-906-2024-TAA of October 22, 2024.\n4. Report TAA-DT-333-2024 dated October 9, 2024.\n\nThese documents, taken together, constitute evidence of high technical and legal value, for the following reasons:\n\nFirst. Since 2005, the Costa Rican State, through SINAC, had detailed technical knowledge of the existence, extent, and ecological value of the Playa Negra wetland (then referred to as Humedal Río Carbón). Report SINAC-SE-GASP-165-05 already documented:\n\n• The presence of an interconnected complex of wetlands (yolillo wetland, flooded forest, and the Carbón, Hotel, and Hone rivers).\n• The existence of a coastal forest functioning as a buffer zone and ecotone (ecotono).\n• Evidence of human interventions, including fill operations for construction and the cutting and burning of yolillo.\n• The importance of the site as a nesting area for four species of sea turtles (Baula, Carey, Verde, and Cabezona), making it one of the most significant in the southern Caribbean.\n• Pressure from a neighboring banana plantation through agrochemical spraying.\n• The express recommendation not to grant concessions or develop infrastructure in the area due to its fragility and the narrowness of the available strip.\n\nSecond. Report SINAC-SE-GASP-005 of 2009 confirmed and updated the findings of 2005, documenting additional damage such as wetland drainage, illegal construction in the Maritime-Terrestrial Zone, and the failure of authorities to follow up on prior complaints. This demonstrates that, by 2009, the State had repeated knowledge of the problem without effective protective measures being adopted.\n\nThird. The reports from the Administrative Environmental Tribunal (Tribunal Ambiental Administrativo) of 2024 (TAA-DT-272-2024 and TAA-DT-333-2024) demonstrate that the environmental damage persists and has worsened after nearly twenty years. These reports establish:\n\n• The existence of more than one hundred registered parcels within or overlapping the probable boundaries of the wetland.\n• The insufficiency of the official delimitation of the National Wetland Registry (Registro Nacional de Humedales, RNH), which understates the actual extent of the ecosystem.\n• The construction of roads with rubble within the wetland, burning of yolillo, structures operating despite municipal closure orders (sellos de clausura municipal), and progressive loss of vegetation cover between 2005 and 2023, based on orthophoto and satellite imagery analysis.\n• The express request for urgent precautionary measures and for the correct delimitation of the wetland by ACLAC and SINAC.\n\nFourth. The continuity of the same technician (Juan Sánchez Ramírez) preparing reports from 2005 through 2024, and the persistence of the same problems over more than two decades, establishes a clear pattern of institutional knowledge and prolonged State omission in fulfilling its constitutional duty to protect the environment (Article 50 of the Political Constitution). This situation has allowed a high ecological value ecosystem—including critical habitat for endangered sea turtles—to suffer continuous and potentially irreversible deterioration.\n\nFifth. The submitted reports powerfully reinforce the need for the Sala Constitucional to adopt effective and urgent protective measures, including the technical delimitation of the Playa Negra wetland and the suspension of activities affecting it. This, in accordance with the powers conferred on this Chamber by Article 48 of the Political Constitution and Articles 29, 30, and 48 of the Ley de la Jurisdicción Constitucional, which expressly authorize the Constitutional Tribunal to issue, at any stage of the proceedings, the measures necessary to protect threatened or violated fundamental rights.\n\nSixth. Given the magnitude, technical complexity, and temporal persistence of the environmental damage established in the submitted reports, it is highly pertinent and necessary for the Department of Forensic Sciences (Departamento de Ciencias Forenses) of the Judicial Investigation Agency (Organismo de Investigación Judicial, OIJ) to undertake a comprehensive assessment of the damage caused to the Playa Negra wetland. This assessment must include the technical quantification of the ecological damage, the determination of the necessary restoration measures, and the technical supervision of their implementation. The involvement of the OIJ's Department of Forensic Sciences would contribute independent scientific rigor, technical objectivity, and greater probative weight to the protective measures that the Sala Constitucional may eventually order, ensuring that ecosystem restoration is carried out on the basis of specialized scientific criteria and under specialized institutional supervision.\n\nFor the foregoing reasons, I respectfully request that the Sala Constitucional:\n\n1. Accept these additional documentary evidence submissions and order their incorporation into case file N° 26-016746-0007-CO.\n2. Assess the set of technical reports (2005, 2009, and 2024) as evidence of institutional knowledge, the persistence, and the worsening of serious environmental damage in the Playa Negra wetland over more than twenty years.\n3. Adopt, in accordance with its constitutional powers, the measures necessary to guarantee effective protection of the Playa Negra wetland and the Río Carbón ecosystem, including, if appropriate:\n\n• The issuance of constitutional or precautionary protective measures.\n• Ordering the technical and precise delimitation of the Playa Negra wetland by the competent authorities.\n• Requesting that the OIJ's Department of Forensic Sciences carry out a comprehensive assessment of the environmental damage caused, determine the necessary restoration measures, and technically supervise their implementation.\"\n\n\"By means of this filing, and pursuant to Articles 1, 2, 27, 30, 48, and 50 of the Political Constitution, as well as Articles 2, 9, 15, 29, 30, 48, and 75 of the Ley de la Jurisdicción Constitucional, I hereby submit as additional documentary evidence official communication O-906-2024-TAA dated October 22, 2024, signed by Biologist Juan Sánchez Ramírez of the Administrative Environmental Tribunal, together with Inspection Report TAA-DT-272-2024 dated August 27, 2024.\n\nThis document constitutes a piece of evidence of high technical, legal, and current relevance, for the following reasons:\n\nFirst. It is a recent official document, prepared by the Administrative Environmental Tribunal, a State body with technical and legal jurisdiction in environmental matters. It documents, in detail and with field-based technical support (including soil sampling demonstrating gleization (gleyzación) and hydromorphism (hidromorfismo), GPS georeferencing (georreferenciación), photographs, and cadastral analysis), the existence of serious and current environmental damage in the Playa Negra sector, specifically on land associated with the property represented by cadastral plan N° 7-495915-1998 and areas adjacent to Río Carbón. The damage documented in the August 2024 inspection includes:\n\n• Drainage and filling of wetlands through roads built with rubble.\n• Cutting and burning of wetland vegetation, including yolillo.\n• Presence of constructions and lot subdivisions within the wetland ecosystem.\n• Structures operating despite municipal closure orders.\n• Encroachment upon and impact to watercourse buffer zones.\n\nSecond. The report establishes that the environmental damage persists and continues to occur at the present time. The inspection was conducted on August 14, 2024. This demonstrates that the impact on the Playa Negra wetland is not an isolated historical event but a current, continuous, and ongoing problem, notwithstanding the complaints and technical reports that have existed for more than fifteen years (including Report SINAC-SE-GASP-005 of 2009).\n\nThird. The Administrative Environmental Tribunal, in the exercise of its institutional functions, has formally requested that the Agrarian-Environmental Prosecutor's Office (Fiscalía Agrario Ambiental) open an investigation case file and has, in an express and reasoned manner, requested the adoption of urgent precautionary measures, which include:\n\n• Immediate suspension of works and activities.\n• Removal of fill operations, drainage works, constructions, and bridges within the wetland.\n• Warnings to the Municipality of Talamanca and to SETENA that no permits or environmental viability approvals be granted in the area.\n• Correct delimitation of the wetland by ACLAC and SINAC, in accordance with the recommendations chapter of the technical report.\n\nThis institutional request for precautionary measures and wetland delimitation reinforces the gravity of the situation and the urgency of effective intervention by the authorities.\n\nFourth. The report also highlights structural land-use planning (ordenamiento territorial) problems, such as cadastral overlaps, parcels registered within wetland areas, and the existence of constructions operating outside the bounds of legality. All of this constitutes a scenario of serious environmental deterioration and persistent State omission in fulfilling its constitutional duty to protect the environment, enshrined in Article 50 of the Political Constitution.\n\nFifth. This document, given its recent date (2024) and its origin from a specialized technical body such as the Administrative Environmental Tribunal, powerfully reinforces the need for the Sala Constitucional to adopt effective protective measures to prevent the continuation of environmental damage that, by its nature, may become irreversible. This, in accordance with the powers conferred on this Chamber by Article 48 of the Political Constitution, which guarantees the right to the writ of amparo for the protection of fundamental rights, and Articles 29, 30, and 48 of the Ley de la Jurisdicción Constitucional, which expressly authorize the Constitutional Tribunal to issue, at any stage of the proceedings and even on its own motion, the precautionary or protective measures necessary to safeguard threatened or violated fundamental rights, including the right to a healthy and ecologically balanced environment recognized in Article 50 of the Political Constitution.\n\nFor the foregoing reasons, I respectfully request that the Sala Constitucional:\n\n1. Accept this additional documentary evidence and order its incorporation into case file N° 26-016746-0007-CO.\n2. Assess the content of official communication O-906-2024-TAA and Report TAA-DT-272-2024 as evidence of the existence of serious, current, and persistent environmental damage in the Playa Negra wetland.\n3. Adopt, in accordance with its constitutional powers, the measures necessary to guarantee effective protection of the Playa Negra wetland and the Río Carbón ecosystem, including, if appropriate:\na) The issuance of constitutional or precautionary protective measures.\nb) Ordering the correct and technical delimitation of the Playa Negra wetland by ACLAC and SINAC, in accordance with the precautionary principle and the in dubio pro natura principle.\"\n\n\"I. OBJECT OF THIS BRIEF\n\nThis brief is intended to incorporate and explain, in a meticulous, detailed, and technically rigorous manner, the content, scope, methodology, factual findings, and constitutional-legal relevance of the technical-scientific report entitled \"Evaluación Preliminar del Brazo Este del Estero de Hone Creek Afuera del Parque Nacional Cahuita (Humedal Entre La Barra y El Hotel Perla Negra)\" [Preliminary Assessment of the Eastern Branch of the Hone Creek Estuary Outside Parque Nacional Cahuita (Wetland Between La Barra and Hotel Perla Negra)], prepared by wetland expert Michael J. Barry (Naples, Florida, United States of America), dated October 8, 2003. This report constitutes documentary evidence of high probative value that establishes the existence, extent, ecological characteristics, hydrological fragility, and the illegal disturbances already present in the wetland subject to protection in this case file. I respectfully request that it be incorporated as evidence for better adjudication (prueba para mejor resolver) or as new evidence in accordance with the Political Constitution, the Ley de la Jurisdicción Constitucional (N° 7135), and the reiterated jurisprudence of this Chamber in environmental matters.\n\nII. CREDENTIALS OF THE AUTHOR AND CONTEXT OF PREPARATION\n\nThe report was prepared by Michael J. Barry, a professional with more than 13 years of specialized experience in wetlands of southern Florida.\n\nHis background includes technical assistance to private landowners and the Florida government in development processes compatible with the protection of wetlands (humedales), as well as direct participation in the restoration of the western shore of the Everglades swamp following the failure of a massive development project in the 1970s (more than 300 km of roads and 50 km of canals and ditches) that caused severe and costly damage, now borne by American taxpayers. The author first visited the site in 1991 and conducted intensive fieldwork between August 1999 and December 2000, with follow-up visits in July 2002 and July 2003. His motivation was strictly technical and conservation-oriented: faced with the development interest detected in the area, he contributed plant lists, maps, and observations grounded in his expertise to protect the wetland, the coral reef, and the quality of life of the Atlantic coast. The report is preliminary due to the technical limitations of the time, but the author presents it with full scientific honesty.\n\nIII. SCIENTIFIC METHODOLOGY EMPLOYED (OBJECTIVE AND REPLICABLE)\n\nThe work included systematic walks from the beach toward the interior, exploration from behind the wetland (between the Hotel stream and the Río Hone), use of a kayak in the center of the estero, nocturnal visits, and detailed recording of dominant species. Unknown plants were collected and identified using keys and specialized literature (Holdridge & Poveda 1975, Nombre04 1978, Nombre05 1983, Sánchez 1983, Nombre06 et al. 2000, Henderson et al. 1995, among others). Wetland delineation was carried out primarily through plant communities indicative of ecological zones, supplemented by hydrological observations (permanent or seasonal flooding, soils with high organic content). Central use was made of the national wetland species list of the U.S. Fish and Wildlife Service (Reed et al. 1988), an international standard that assigns probability rankings: OBL (obligate — occurring almost exclusively in wetlands) and FACW (facultative wet — more frequent in wetlands). For species not included in that list, their wetland affinity was verified through regional sources. Cartography was produced using the official Costa Rican topographic map, a 1995 LANDSAT image, and aerial photographs from 1976 and 1992 (rectified), digitized in ArcView. The author acknowledges limitations of access and image resolution at the time and recommends updating with GPS and a land surveyor, but expresses high confidence in the eastern and beach-side boundaries. This methodology is objective, reproducible, and aligned with international scientific standards for wetland delineation applicable under the RAMSAR Convention and Costa Rican legislation.\n\nIV. SCOPE AND MAIN FINDINGS OF THE REPORT\n\nThe report delineates the eastern arm of the estero of the Río Hone (outside Parque Nacional Cahuita) at approximately 89 hectares, in the shape of a triangle with its base at the Río Hone and its vertex at the eastern end of the old pasture (Nombre07 family). Hydrologically and ecologically it is inseparable from the western arm protected within the Park: any alteration on one side affects the other, especially if it involves drainage. Although the report dates from October 2003 — more than twenty-two years ago — its value as an original scientific baseline remains an obligatory reference as of June 2026. At that time, an approximate area of 89 hectares of affected wetland was established with technical precision, a figure that represents the concrete magnitude of the legal interest under persistent threat. This area, measured in 2003, constitutes the indispensable starting point for any current assessment of cumulative impacts.\n\nThree main zones are identified (see Figure 2 of the report):\n\n1. Mud Flat / Deepest Zone (~21.5 ha)\nFlooded year-round (except edges during extreme droughts). Soft, deep mud with high organic content. Dominants: German grass (Echinochloa polystachya), caña brava (Gynerium sagittatum), pará grass, swamp rice, yolillo palm (Raphia taedigera) on edges. Others: Nombre08 (Annona glabra), sotacaballo (Zygia latifolia), Nombre09 (Pterocarpus officinalis), cativo, huesillo, leather fern (Acrostichum aureum). Nombre10 1988 rankings: Majority OBL and FACW. Fauna: Jacanas, herons, cormorants, possible caiman/crocodile.\n\n2. Nombre09 Zone (the most extensive, ~51 ha)\nFlooded at least 6 months per year. Dominants: Nombre09 (Pterocarpus officinalis) and yolillo (Raphia taedigera); coquito (Elaeis oleifera) on edges. Abundant understory of aroids (Homalomena wendlandii), peace lily, and ox-tongue. In the old pasture at the eastern end, remnants of sangrillo, coquito, and yolillo persist, confirming its original wetland character, even though German grass now dominates. Reed rankings: Majority OBL and FACW. Fauna: Howler monkeys, iguanas, boa constrictors, basilisk lizards, high diversity of frogs.\n\n3. Intermediate / Transitional Zone (~16 ha)\nFlooded 0 to 6 months. Transitional strip. Dominants: Nombre09 at the edge + tall forest trees (guácimo colorado, guarumo, higuerón). Presence of white ginger lily (Hedychium coronarium — invasive). Reed rankings: Mix of FACW and OBL.\n\nCoastal buffer zones (mostly within the 50 meters of the maritime-terrestrial zone (zona marítimo-terrestre, ZMT)):\nSand forest with sea grape (Coccoloba uvifera), beach almond, majagua, and cañagria ginger (Costus woodsonii — a regional endemic deserving conservation). Typical Caribbean beach with railroad vine and shrubs protected by maritime law.\n\nDocumented disturbances with clear causal nexus (evidence of extreme severity):\n\n• Old pastures: The one at the eastern end was cleared before 1976 over a sangrillo/coquito/yolillo zone. Today dominated by grasses but still flooded most of the year; no ditches or fill. Hydrology intact and recoverable.\n\n• Dam, ditch, and illegal fill near the sandbar (the most serious): A foreign national built small houses within the 50-meter ZMT, cut trees (weakening the sand buffer), filled with beach sand using a tractor without a permit from MINAE or the municipality, and constructed a dam and a ditch perpendicular from the house to the center of the mud flat where the Hotel stream enters. The author interviewed the owner in 2000, warned him of the risks, and suggested corrective measures; the owner refused. The author reported to the MINAE office in Cahuita that the works appeared illegal. Measurable effect in December 2002: Following heavy rains, storms, and high tides, water from the eastern wetland and the Hotel stream exited directly to the sea at two new locations on the beach — an event that had never occurred in the previous 50 years according to local memory and evidence from ancient vegetation. This proves direct causality between the dam and tree removal and the rupture of the natural buffer. It demonstrates the extreme fragility of the system.\n\n• Upstream banana plantation: Ditches and river controls altered the hydrology (less water during the dry season, larger pulses during the rainy season), eliminated the natural filter of the floodplain, and increased nutrients, sediments, and chemicals flowing toward the estero and the reefs. The wetland described in this report is the last filter before the sea.\n\nTechnical recommendations of the expert (current and urgent):\nLeave the wetland and the forested sand strip completely undeveloped. Remove the dam and illegal fill. Stop deforestation and improvements in the sand buffer. Prevent direct drainage to the sea. The land farther inland (next to the interior road) could be more sustainable, subject to a prior hydrological study.\n\nV. EVIDENTIARY VALUE, ANALYSIS OF THE RAMSAR CONVENTION, CONSTITUTIONAL JURISPRUDENCE, THE ROLE OF SINAC, AND TECHNICAL ANALYSIS OF WETLAND RESTORATION\n\nThis report objectively certifies:\n\n1. That the area of ~89 hectares constitutes a wetland according to international scientific standards (many OBL and FACW species per Nombre10 1988) and national standards.\n2. The existence of illegal disturbances already carried out, with measurable environmental damage and proven causality (the 2002 dam and its effects).\n3. The hydrological indivisibility of the system: any alteration here directly threatens Parque Nacional Cahuita, the reefs, and the fisheries.\n4. The appropriate technical measures for protection and restoration.\n\nSpecific analysis of the Ramsar Convention and designations in Costa Rica\n\nCosta Rica ratified the Convention on Wetlands of International Importance especially as Waterfowl Habitat (Ramsar Convention, Iran, 1971) through Ley N° 7224. It currently has twelve internationally designated sites covering approximately 11% of the national territory. Among these, in the province of Limón and the South Caribbean, the following stand out: the Refugio Nacional de Vida Silvestre Mixto Jairo Mora Sandoval Gandoca-Manzanillo (designated on 11 December 1995), the Humedal Caribe Noreste (designated on 20 March 1996), and the Turberas de Talamanca (designated on 2 February 2003, with portions in Limón).\n\nAlthough the specific wetland of Playa Negra (Eastern Arm of the Hone Creek Estero, ~89 hectares) does not appear as an individually designated Ramsar site, the principles of the Convention are directly and bindingly applicable because it forms part of a continuous and indivisible hydrological and ecological system with the western arm protected within Parque Nacional Cahuita and with the broader network of Costa Rican Caribbean wetlands, including connections with nearby Ramsar sites such as Gandoca-Manzanillo. The Convention obligates conservation and the wise use of wetlands (Articles 3 and 4), with wise use understood as that which allows benefits to be obtained for humanity while maintaining natural ecological characteristics. Any alteration of the hydrology (dam, ditch) or of the plant communities indicative of wetland violates these international principles and the duty not to degrade the ecological character of the system.\n\nConstitutional jurisprudence on wetlands and environmental protection\n\nThe Sala Constitucional has developed consolidated and robust jurisprudence around Article 50 of the Constitución Política, recognizing the right to a healthy and ecologically balanced environment as a fundamental right of collective scope. In repeated rulings (including N° 2006-17126 and subsequent developments), the Sala has derived from Article 50 the principles of prevention, precaution (linked to Article 15 of the Rio Declaration), environmental non-regression, in dubio pro natura, and objectification of environmental protection (requiring sufficient, individualized, and prior technical and scientific studies). Recently, in cases such as ruling N° 2026-14917 (related to the Tempisque basin and associated wetlands), the Sala emphasized the need for integrated inter-institutional assessments that consider cumulative impacts, the ecological connectivity of wetlands, and the interaction between authorized and illegal interventions. Violations of Article 50 have been declared for omissions in protection, incomplete studies, or lack of effective restoration measures. The jurisprudence also expressly links these principles to the Ramsar Convention (Ley N° 7224), the Ley Orgánica del Ambiente (N° 7554), and the Ley de Biodiversidad (N° 7788), requiring the State not only to refrain from degrading, but to adopt active conservation and restoration measures when disturbances are documented.\n\nRole of SINAC and prolonged omission\n\nThe Sistema Nacional de Áreas de Conservación (SINAC) bears primary responsibility, as the technical-scientific body of MINAE, for the protection, management, and restoration of wetlands and protected wild areas, including oversight and removal of illegal works that alter hydrology. The persistence — more than two decades after the observations in the 2003 report and the complaint filed with the MINAE office in Cahuita in the year 2000 — of the dam, the ditch, and the illegal fill, without any effective hydrological restoration measures having been adopted, constitutes a prolonged omission by SINAC that has permitted regressive effects on the ecological characteristics of the approximately 89-hectare wetland. This reality makes a comprehensive updated assessment of the land imperative.\n\nTechnical analysis by a wetland restoration expert\n\nFrom the perspective of ecological wetland restoration (a discipline consolidated globally and with direct lessons from the Everglades case mentioned by the report's own author), the absolute priority is hydrological restoration. The immediate removal of the dam and the perpendicular ditch would allow the natural sheet flow toward the Río Hone estero to be reestablished, recovering the original hydroperiod (permanent flooding in the mud flat, seasonal flooding in the Nombre09 and intermediate zones) that sustains the obligate (OBL) and facultative wet (FACW) indicator species documented in Tables 1-3. Once hydrology is restored, vegetation recovery can be largely passive through the natural recolonization of yolillo (Raphia taedigera), Nombre09 (Pterocarpus officinalis), and coquito (Elaeis oleifera), supplemented by active planting of local propagules in more degraded sectors. Monitoring must include permanent vegetation transects, continuous measurement of water levels and quality, and assessment of organic soils.\n\nCumulative impacts over the more than 22 years elapsed since the 2003 baseline include the probable reduction in cover of obligate wetland species, alteration of the flooding regime, increased nutrient and sediment loads on the Cahuita reefs, and weakening of the forested sand buffer. These regressive effects, tolerated through SINAC's failure to act effectively, can only be quantified precisely through the comprehensive land assessment requested, combining the original 89-hectare extent with the current state of hydrology, biodiversity, and ecological functionality. International experience (including Everglades restoration) demonstrates that delaying hydrological correction exponentially multiplies costs and reduces the probability of successful recovery. Acting now, on the basis of the 2003 technical report updated through a comprehensive assessment, is the only scientifically sound and legally enforceable pathway to reverse the regression and comply with the principles of Ramsar and Costa Rican constitutional jurisprudence.\"\n\n\"In compliance with the ruling of the Sala Constitucional in the processing of the present amparo (constitutional protection) proceeding, and in the exercise of the right of petition and access to information enshrined in Articles 27 and 30 of the Constitución Política, the undersigned requested from the Municipalidad de Talamanca the list of land-use permits (permisos de uso de suelo) granted in the sectors of Playa Negra and Río Carbón during the last ten years. In response, through official communication SCMT-151-2026 of 25 June 2026 (received in response to official communication MLV-00228-2026 and noted by the Concejo Municipal at ordinary session 112 of 18 June 2026), the Secretaría del Concejo Municipal transmitted an extensive list detailing more than forty land-use permits in the ZMT of the aforementioned sectors. The approvals are concentrated mainly in 2016 (with a notable cluster in March) and continue on a sustained basis through 2026, including multiple \"plan updates.\" It should be noted that the municipality transferred to the Alcaldía the request for construction permits (official communication SCMT-INT-107-2026), so the list provided refers specifically to land-use permits.\n\nI. CONTENT AND SCOPE OF THE LIST PROVIDED\n\nThe municipal document reveals a systematic and sustained pattern of granting land-use permits in an area of high ecological sensitivity:\n\n• Temporal concentration: A notable accumulation of approvals in March 2016 (at least eight permits on closely spaced dates), with continuous grants in subsequent years (2017, 2018, 2019, 2020, 2022, 2023, and 2026).\n\n• Geographical scope: The vast majority of the permits are located specifically in Playa Negra de Puerto Viejo and sectors adjacent to Río Carbón, the area subject to protection in this amparo proceeding for constituting a wetland of ecological importance.\n\n• Nature of the acts: Land-use permits in the ZMT (public domain in accordance with Ley N° 6043), many with \"plan updates,\" evidencing processes of development or consolidation of pre-existing occupations.\n\n• Volume: More than forty individual authorizations over a ten-year period in a limited and fragile space, with no evidence in the municipal list of cumulative impact assessments or specific considerations regarding the integrity of the wetland.\n\nThis pattern constitutes objective documentary evidence of continuous and persistent development pressure on the ecosystem that the present amparo proceeding seeks to protect.\n\nII. LEGAL BASIS AND ANALYSIS OF ENVIRONMENTAL IMPACTS\n\nA. Constitución Política and the Ley de la Jurisdicción Constitucional\n\nArticle 50 of the Constitución Política recognizes the fundamental right to a healthy and ecologically balanced environment, imposing on the State the duty to guarantee, defend, and preserve it. The Ley de la Jurisdicción Constitucional (Ley N° 7135), in its Articles 1, 2, and 4, establishes that the amparo proceeding is available to protect fundamental rights and freedoms, including the right to a healthy environment. This Sala has developed consolidated jurisprudence according to which, when there is a threat or violation of this right with a risk of irreparable or difficult-to-repair harm, the immediate adoption of precautionary measures is warranted. The evidence presented demonstrates that the situation is neither static nor merely historical: the continuous granting of more than forty land-use permits through the year 2026 constitutes a current, imminent, and persistent risk of harm to the wetland, making the intervention of this Sala imperative to order effective precautionary measures, in accordance with the principle of effective judicial protection that informs the Ley de la Jurisdicción Constitucional.\n\nB. Environmental Law — Ley Orgánica del Ambiente N° 7554 and Governing Principles\n\n• Article 2: The environment is the common heritage of the Nation, and its conservation is a matter of public utility and social interest.\n• Article 17: Any activity that alters or destroys elements of the environment requires a prior environmental impact assessment (evaluación de impacto ambiental), with indispensable approval before works may begin.\n• Principles of prevention, precaution, and in dubio pro natura: When there are reasonable indications of environmental harm, protective measures must be adopted without awaiting absolute scientific certainty.\n\nThe list provided demonstrates that more than forty permits have been granted in a wetland ecosystem without any cumulative impact assessment being on record. This omission is particularly serious because wetlands are highly sensitive ecosystems with slow recovery rates.\n\nC. Foreseeable Environmental Impacts on the Wetland Ecosystem\n\nThe quantity and continuity of land-use permits in the ZMT of Playa Negra and Río Carbón give rise to a set of environmental impacts that, by virtue of their cumulative and synergistic nature, may be causing progressive and potentially irreversible degradation of the wetland:\n\n• Alteration of the hydrological regime: Construction and earthworks (movimientos de tierra) modify natural drainage patterns, infiltration, and water flow, reducing the wetland's capacity to regulate flooding and maintain its function as a natural sponge.\n\n• Loss and fragmentation of habitat: Each new permit reduces the surface area of native vegetation and wetland, fragmenting biological corridors and affecting the fauna and flora characteristic of these ecosystems.\n\n• Increased sedimentation and pollution: Works generate sediment runoff and, if the buildings lack adequate wastewater treatment systems, contamination by nutrients and pathogens occurs, altering water quality and favoring eutrophication processes.\n\n• Reduction of ecosystem services: Wetlands provide water purification, carbon capture, coastal protection, and biodiversity support. The accumulation of permits progressively weakens these services and increases the area's vulnerability to climate change.\n\n• Regressive effect: The sustained granting of permits in an area under constitutional and legal protection constitutes a regressive action that contravenes the principle of non-regression in environmental matters. Instead of advancing toward greater protection of the wetland, a process of occupation and transformation is being allowed that makes future recovery difficult — and in many cases impossible.\n\nThese impacts derive directly from the volume and continuity of the documented authorizations and are aggravated by the condition of a coastal wetland, an ecosystem internationally recognized for its high ecological value and fragility (Ramsar Convention, Ley N° 7224).\n\nD. Urgency of Precautionary Measures\n\nThe Ley de la Jurisdicción Constitucional empowers this Sala to order precautionary measures when there is imminent danger of irreparable or difficult-to-repair harm to a fundamental right. The present case clearly meets this requirement:\n\n• The wetland is already in a situation of extreme severity.\n• Authorizations continue through 2026, demonstrating that the threat is current and persistent.\n• The described impacts are cumulative and, once materialized, their reversal is technically complex, costly, and in many cases impossible within reasonable timeframes.\n• The principle in dubio pro natura requires tipping the balance in favor of ecosystem protection.\n\nTherefore, it is imperative that this Sala order urgent precautionary measures to halt the advance of the degradation while the merits of the amparo proceeding are resolved.\"\n\n7.- The legal requirements have been observed in the proceedings conducted.\n\nDrafted by Justice Rueda Leal; and,\n\nConsidering:\n\nI.- Subject of the writ (recurso). The petitioner (recurrente) alleges judicial delay (mora judicial) in case file (expediente) 05-001155-0597-PE, concerning alleged damage to the río Carbón-Playa Negra wetland (humedal). The petitioner states that trucks enter on a daily basis to dump rubble and fill material. The petitioner considers SINAC's response to be insufficient.\n\nII.- Proven facts. The following facts are deemed duly established as relevant to the decision in this matter, either because they have been substantiated or because the respondent failed to address them, as required by the initial order:\n\na) In case file 05-001155-0597-PE, a criminal case (causa penal) is being prosecuted against Nombre02, a Canadian national, for the offenses of Illegal Construction in the Maritime Terrestrial Zone (Zona Marítimo Terrestre), Invasion of Protection Areas, and Wetland Drainage, in Limón, Talamanca, Cahuita, Puerto Viejo, Playa Negra. (See report submitted.)\n\nb) That case file is currently before the Tribunal de Juicio de Limón, sede Bribri. (See report submitted.)\n\nc) By order issued at 11:20 hours on August 1, 2024, that court declared the defendant (imputado) a fugitive (rebelde) and ordered his arrest. (See report submitted.)\n\nIII.- On the specific case. In the sub examine, the petitioner alleges judicial delay in case file 05-001155-0597-PE, concerning alleged damage to the río Carbón-Playa Negra wetland. The petitioner states that trucks enter on a daily basis to dump rubble and fill. The petitioner considers SINAC's response to be insufficient.\n\nWith regard to the judicial delay, the Court found it proven that, in case file 05-001155-0597-PE, a criminal case is being prosecuted against Nombre02, a Canadian national, for the offenses of Illegal Construction in the Maritime Terrestrial Zone, Invasion of Protection Areas, and Wetland Drainage, in Limón, Talamanca, Cahuita, Puerto Viejo, Playa Negra. That case file is currently before the Tribunal de Juicio de Limón, sede Bribri. By order issued at 11:20 hours on August 1, 2024, that court declared the defendant a fugitive and ordered his arrest.\n\nWith respect to claims related to judicial delay in criminal proceedings, the Court has stated:\n\n\"II.- ON THE SPECIFIC CASE. In the present matter, this Court has held that, in criminal matters, and pursuant to article 174 of the Código Procesal Penal, if a delay has occurred in the processing of any matter, appeal, or motion, the interested party may file an expedited processing request (pronto despacho) and, if no response is received within the legally established time limit, file the corresponding complaint before the Inspección Judicial, the Inspección Fiscal, or the Corte Plena, as applicable. In this case, the petitioner does not even mention having filed such a motion, and must therefore—if so desired—file the corresponding pronto despacho, so that the competent criminal authorities may take whatever action the law requires. Accordingly, the writ is inadmissible and is so declared.\" (Judgment No. 2025008180 of 9:20 hours of March 14, 2025.)\n\nThat standard applies to the sub lite, and the interested party may therefore pursue the appropriate channels. In any event, the Court notes that the defendant in those proceedings is currently a fugitive with an outstanding arrest warrant, which prevents the case from advancing promptly. For the reasons stated, this ground of the writ is denied.\n\nIV.- Regarding the alleged environmental damage to the Playa Negra wetland, this Court finds that the petitioner currently has another proceeding pending that is related to that matter. Indeed, by the order of course issued at 7:41 hours on October 9, 2025, this Court admitted amparo (constitutional protection writ) 25-027587-0007-CO, filed by the petitioner. In that order, the Court stated:\n\n\"…the facts alleged by the petitioner, in summary: that the Playa Negra wetland, located in Puerto Viejo, Talamanca, forms part of the río Carbón watershed, bordering the Parque Nacional Cahuita. This ecosystem, described in the 'Preliminary Assessment of the Eastern Branch of the Hone Creek Estero Outside the Parque Nacional Cahuita (Wetland Between La Barra and El Hotel Perla Negra)' and in official memorandum SINAC-SE-GASP-165-2005 (July 13, 2005), harbors protected biodiversity, including endangered species such as sea turtles (Leatherback, Hawksbill, Green, and Loggerhead), monkeys, crocodiles, otters, and migratory birds. Furthermore, it performs critical hydrological regulation functions and is a key nesting site for sea turtles, according to biologist Didiher Chacón of the Asociación ANAI. The petitioner notes that since October 28, 2005, the Comité Local Forestal de Talamanca (CLFT), coordinated by Engineer Gustavo Alvarado Salazar, documented illegal activities on the property of Mr. Pool Pavel Jareslav in Playa Negra, including wetland drainage, filling with hundreds of truckloads (vagonetas) of sand and gravel fill (lastre), unauthorized construction, tree felling (corta de árboles), and obstruction of the public zone (zona pública) (official memorandum SINAC-SE-GASP-165-2005). These activities, carried out with heavy machinery, including equipment from the Municipalidad de Talamanca, have persisted for more than 20 years without effective restoration, as confirmed by criminal case 24-00377-0597-PE, pending since 2004. The petitioner states that on August 9, 2025, the petitioner submitted to the respondent authority official memorandum AEL-0313-2025, requesting a follow-up report and a full copy of report SINAC-ACLAC-DASP-RNVSGM136-2024 (March 26, 2024), concerning the drainage and filling of the wetland allegedly by the Municipalidad de Talamanca. In response, Attorney Maylin Mora Arias forwarded official memoranda CARTA-SINAC-ACLAC-DASP-RNVSGM-421-2025 and CARTA-SINAC-ACLAC-DASP-RNVSGM-416-2025 (August 26, 2025), which confirm the expansion of the complaint and the additional deposit of gravel fill, but limit SINAC's action to halting activities and referring the matter to the Ministerio Público, without adopting immediate precautionary measures (medidas precautorias) or corrective measures. The petitioner adds that official memorandum CARTA-SINAC-ACLAC-DASP-RNVSGM-416-2025 and the images dated August 26, 2025 evidence the extent of the gravel fill operation, aggravating the damage to the wetland. Report SINAC-SE-GASP-165-2005 details the presence of wetland indicator plants (yolillo, majagua, araceae), muddy soils, and threatened fauna, as well as human intervention through fill operations (rellenos) and drainage that have altered the natural conditions of the ecosystem. The absence of an updated characterization and delineation of the wetland, despite the 2004 and 2005 background, perpetuates the risk of irreversible damage. The petitioner indicates that criminal case 24-00377-0597-PE, pending since 2004, has not achieved the restoration of the wetland, and SINAC's actions have been limited to reports without effective measures. The petitioner emphasizes that the respondent authority has failed to adopt immediate precautionary and corrective measures to protect and restore the Playa Negra wetland, Puerto Viejo, Talamanca, an ecosystem of high ecological value, despite having had indications, evidence, and documented background since 2004, including official memorandum SINAC-SE-GASP-165-2005 and SINAC's recent reports. This omission violates fundamental rights guaranteed by articles 21, 33, 46, and 50 of the Constitución Política, as well as applicable environmental regulations, including the Ley de Biodiversidad (Ley N° 7788), the Ley Orgánica del Ambiente (Ley N° 7554), the Ley Forestal (Ley N° 7575), and Decreto Ejecutivo N° 39838-MINAE on wetland protection.\"\n\nLikewise, the Court notes the similarity of the claims in that proceeding and this one. For example, in case file 25-027587-0007-CO, the petitioner (accionante) requested \"…the updated delineation and characterization of the Playa Negra wetland…\" and the \"…suspension of any drainage or filling activity in the wetland and the complete removal of the deposited gravel fill….\" In this amparo, the petitioner seeks \"…an updated descriptive and georeferenced (georreferenciado) map of the Playa Negra Wetland…\" and the \"…immediate and complete suspension of all filling, extraction, logging, and urban development activities in the wetland….\" Furthermore, in case file 25-027587-0007-CO, the petitioner raises claims regarding the illegal activities on the property of Pavel Jareslav, who is the defendant in the criminal case file for whose delay the petitioner complains here. Accordingly, in the interest of judicial economy (economía procesal) and to avoid contradictory rulings, this case file is ordered archived with respect to that claim. The party may present the arguments deemed appropriate in the indicated case file.\n\nFinally, the petitioner is advised that Section 38 of the Ley de la Jurisdicción Constitucional requires the petitioner to state in the filing \"…as clearly as possible, the act or omission giving rise to the writ, the right considered to have been violated or threatened, the name of the public official or body responsible for the threat or grievance, and the supporting evidence….\" (Emphasis added.)\n\nIn this regard, the Court observes that the petitioner's filing does not expressly identify the respondent authority and, moreover, contains incomprehensible paragraphs typical of a preliminary draft text (for example: \"7. Technical characteristics of the Humedal Río Carbón – Playa Negra [Full text of the technical data sheet as it appeared in the previous version – from 'El humedal objeto de protección…' to '…El Humedal de Playa Negra es un área sumamente vulnerable, extremadamente frágil y por demás hermosa.']\"; \"9. Structural imprecision and serious deficiencies of the Sistema Nacional de Información Territorial (SNIT) with respect to the Natural Heritage of the State [Full text as it appeared in the previous version – from 'La imprecisión crónica…' to the end of point 9.]\"; \"III. RIGHTS VIOLATED (Kept the same – full text of the original writ)\"; \"IV. IMPERATIVE NEED FOR ENVIRONMENTAL PRECAUTIONARY MEASURES (medidas cautelares) (Kept the same – full text of the original writ)\"; \"V. EVIDENCE (All evidence and relevant details from the original amparo writ are brutally incorporated, strengthened and expanded with technical and evidentiary elements of extreme gravity)\").\n\nMoreover, having reviewed the party's multiple filings, and if so desired, the interested party may bring before this Court any grievances deemed appropriate, in which case the party must comply with the legal requirements mentioned, or pursue the administrative or legality channels deemed relevant. In this regard, it is explained that the amparo proceeding, being a summary proceeding (vía sumaria), is incompatible with complex evidentiary activity, as extensive evidentiary debate and exhaustive analysis would undermine the speed and direct protection of fundamental rights.\n\nV.- Documentation submitted to the case file. The parties are advised that, should any paper documents, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device have been submitted, these must be retrieved within a maximum period of 30 business days from the notification of this judgment. All materials not retrieved within that period will be destroyed, pursuant to the \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\" (approved by the Corte Plena in Article XXVI of session No. 27-11 of August 22, 2011, and published in the Boletín Judicial No. 19 of January 26, 2012) and pursuant to Article LXXXI of Consejo Superior del Poder Judicial session No. 43-12 of May 3, 2012.\n\nPor tanto:\n\nThe case file is ordered archived with respect to the alleged environmental damage to the Playa Negra wetland.
