  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-018602-0007-CO \n\nRes. Nº 2026025782\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del diez de julio de dos mil veintiseis .\n\n Recurso de amparo que se tramita en expediente No. 26-018602-0007-CO, interpuesto por Nombre01, cédula de identidad CED02, a favor de Nombre02, cédula de identidad CED03, contra la MUNICIPALIDAD DE OSA.\n\nResultando:\n\n1.- Por escrito recibido en la Secretaría de la Sala el 25 de mayo de 2026 el recurrente interpone recurso de amparo a favor de Nombre02, cédula de identidad CED03 contra la MUNICIPALIDAD DE OSA. Manifiesta que el 25 de julio de 2025, el amparado le otorgó poder especial para realizar ante la Municipalidad de Osa, toda clase de trámites administrativos, gestiones, solicitudes, oficios, recursos y comparecencias relacionados con permisos municipales, concesiones, certificaciones y demás asuntos administrativos vinculados a sus intereses. Señala que el 20 de abril de 2026, remitió a las direcciones electrónicas ...01, ...02 una gestión dirigida a la Ing. Daniela López Rivera, en su condición de coordinadora del Departamento de Zona Marítima Terrestre de la Municipalidad de Osa, titulada: “Solicitud de información y remisión de documentación – Trámite de reclasificación PNE sector Playa Caletas, Bahía Drake” mediante la cual requirió lo siguiente: “Acuso recibo del oficio No. PZM-0102-2026, de fecha 15 de abril del 2026, mediante el cual se informa sobre la remisión de certificaciones de Patrimonio Natural del Estado al SINAC para efectos de su eventual reclasificación. En primer término, agradezco las gestiones realizadas por ese Departamento en relación con el sector de Rocas de Amancio, las cuales resultan de suma relevancia dentro de los procesos que se han venido impulsando. No obstante, en atención al contenido del oficio citado, y específicamente en lo referente al sector de Bahía Drake – Playa Caletas, me permito solicitar formalmente, al amparo de los artículos 27 y 30 de la Constitución Política, se me remita la siguiente información y documentación: 1. Copia íntegra del oficio o nota mediante la cual se comunicó al SINAC la remisión de la sección de certificación correspondiente al sendero ubicado en Playa Caletas, sector Bahía Drake. 2. Copia del acuerdo del Concejo Municipal de la Municipalidad de Osa mediante el cual se haya conocido, aprobado o elevado al SINAC la gestión de reclasificación del Patrimonio Natural del Estado en dicho sector, particularmente aquella promovida con sustento en: • El criterio técnico suscrito por el Ing. Forestal Leonardo Espinosa Zamora • El sustento legal presentado por mi persona, Nombre01 3. Copia del informe técnico elaborado por el Departamento de Zona Marítimo Terrestre, correspondiente a la inspección realizada en el predio conocido como Corcovado Aventuras, ubicado en el sector de Caletas de Drake. 4. Cualquier otro documento, informe, criterio técnico o comunicación oficial que forme parte del expediente administrativo o de la tramitología relacionada con la gestión de clasificación o reclasificación del Patrimonio Natural del Estado en el sector de Dirección01”. Acusa que a la fecha de interposición del presente recurso no ha recibido respuesta.\n\n2.- Mediante resolución de las 13:06 horas del 05 de junio de 2025, se dio curso al presente recurso.\n\n3.- Informan bajo juramento MAINOR ANCHIA ANGULO y DANIELA LÓPEZ RIVERA, por su orden ALCALDE y ENCARGADA A.I. ZONA MARÍTIMO TERRESTRE, AMBOS DE LA MUNICIPALIDAD DE OSA, quienes manifiestan lo siguiente. “… PRIMERO: Que, es importante informar a su autoridad que esta municipalidad mediante oficio PZM-0190-2026 de fecha del día 11 de junio del 2026 del Departamento de Zona Marítimo Terrestre, ha realizado la respuesta formal al recurrente. De igual manera, se remitió al recurrente copia del expediente remitido al SINAC para la recalificación de la concesión N° 605030001804Z00, inscrita a nombre de la sociedad Campamento Corcovado Aventuras S.Nombre03., cédula jurídica CED01, siendo que en mismo cuenta con la información requerida en el recurso de amparo interpuesto. SEGUNDO: Que, sobre este punto, en la resolución N° 2025032397 dictada dentro del expediente N.° 25-029317-0007-CO, la Sala Constitucional se indicó: “De lo planteado por el recurrente cabe indicar que del estudio de los autos se desprende que la gestión antes mencionada fue planteada el 6 de agosto de 2025 y reiterada el 16 de setiembre de 2025, alegando que al 25 de setiembre de 2025 como fecha de interposición de este recurso, -1 mes y 14 días naturales desde que interpuso el trámite en mención- no se le había reinstalado la luminaria solicitada. De esta forma es claro que el plazo transcurrido no resulta excesivo, por lo que lo procedente es rechazar el amparo, por prematuro.” Que, de lo anterior, resulta oportuno señalar a la honorable Sala Constitucional que la gestión del recurrente fue presentada el día 20 de abril del 2026. No obstante, debe considerarse que la administración cuenta con un plazo razonable de diez días hábiles para atender y brindar respuesta a las gestiones que le son planteadas, por lo que no resulta correcto computar una eventual demora desde el mismo día de presentación de la solicitud. En ese sentido, tomando como referencia la fecha de presentación de la gestión, el plazo inicial con que contaba la administración vencía aproximadamente el día 5 de mayo del 2026, en consecuencia, cualquier análisis sobre una eventual dilación debe realizarse a partir de esa fecha, y no desde el 20 de abril del 2026. Así las cosas, al día 11 de junio del 2026, el plazo transcurrido desde el vencimiento del término inicial de respuesta sería de aproximadamente un mes y seis días, lo cual, atendiendo a la naturaleza del asunto, a la necesidad de análisis técnico, a la revisión de documentación legal y a la coordinación interinstitucional requerida con el SINAC, no puede considerarse como un plazo excesivo, irrazonable o desproporcionado. Sobre este aspecto, debe tomarse en consideración el criterio sostenido por la honorable Sala Constitucional en la resolución N.° 2025032397, dictada dentro del expediente N.° 25-029317-0007-CO, en la cual se indicó que el transcurso de un mes y catorce días naturales desde la presentación de una gestión no resultaba excesivo, motivo por el cual se rechazó el recurso de amparo por prematuro. En el presente caso, con mayor razón, si se considera que la eventual demora debe computarse una vez vencido el plazo inicial de respuesta de la administración, el lapso transcurrido no resulta excesivo, además, la gestión planteada no correspondía a una solicitud de simple respuesta inmediata, sino a un trámite vinculado con la recalificación de una concesión, la revisión de documentación técnica y legal, así como la remisión de insumos al SINAC para lo de su competencia. Por consiguiente, no puede afirmarse que exista una omisión arbitraria, silencio administrativo lesivo o una dilación injustificada atribuible a esta municipalidad. Por el contrario, las actuaciones administrativas realizadas demuestran que la gestión fue atendida dentro de un plazo razonable, por lo que el recurso debe ser rechazado, al resultar prematuro. TERCERO: Que el correo oficial para gestiones anta esta municipalidad es ...01 y no el correo ...02, tal y como se evidencia (se inserta imagen) …”. “… Por las razones de hecho y de derecho anteriormente expuestas, solicitamos respetuosamente al honorable tribunal declarar SIN LUGAR el presente recurso de amparo, en virtud de que no se ha configurado una actuación arbitraria, ilegítima o lesiva de derechos fundamentales atribuible a esta administración. Siendo que la gestión fue presentada el día 20 de abril del 2026, y que la administración contaba con un plazo razonable inicial de diez días hábiles para atender la solicitud, por lo que una eventual dilación no podría computarse desde el mismo día de presentación, sino a partir del vencimiento de dicho plazo, aproximadamente el día 5 de mayo del 2026. En ese sentido, al haberse emitido respuesta formal el día 11 de junio del 2026, el plazo transcurrido desde el vencimiento del término inicial de respuesta no resulta excesivo, irrazonable ni desproporcionado, máxime tratándose de una gestión que no correspondía a una simple solicitud de información, además, el criterio sostenido por la honorable Sala Constitucional en la resolución N.° 2025032397, dictada dentro del expediente N.° 25-029317-0007-CO, en la cual se determinó que el transcurso de un mes y catorce días naturales desde a presentación de una gestión no resultaba excesivo, razón por la cual el amparo fue rechazado por prematuro. En el presente caso, con mayor razón, al computarse el plazo desde el vencimiento del término razonable inicial con que contaba la administración, no puede concluirse que exista una dilación constitucionalmente relevante …”.\n\n4.- En los procedimientos seguidos se ha observado las prescripciones legales. Redacta la Magistrada Hess Herrera; y,\n\nConsiderando:\n\nI.- OBJETO DEL RECURSO. El recurrente interpone recurso de amparo a favor de Nombre02 contra la Municipalidad de Osa, por la presunta falta de respuesta a una gestión presentada el 20 de abril de 2026, mediante la cual solicitó información y documentación relacionada con el trámite de reclasificación del Patrimonio Natural del Estado en el sector de Playa Caletas, Bahía Drake.\n\nIII.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos, según lo prevenido en el auto inicial:\n\na) El 20 de abril de 2026, el recurrente remitió a las direcciones electrónicas ...01 y ...02 una gestión dirigida a la Ing. Daniela López Rivera, en su condición de coordinadora del Departamento de Zona Marítima Terrestre de la Municipalidad de Osa, titulada “Solicitud de información y remisión de documentación – Trámite de reclasificación PNE sector Playa Caletas, Bahía Drake”, mediante la cual indicó literalmente lo siguiente: “Acuso recibo del oficio No. PZM-0102-2026, de fecha 15 de abril del 2026, mediante el cual se informa sobre la remisión de certificaciones de Patrimonio Natural del Estado al SINAC para efectos de su eventual reclasificación. En primer término, agradezco las gestiones realizadas por ese Departamento en relación con el sector de Rocas de Amancio, las cuales resultan de suma relevancia dentro de los procesos que se han venido impulsando. No obstante, en atención al contenido del oficio citado, y específicamente en lo referente al sector de Bahía Drake – Playa Caletas, me permito solicitar formalmente, al amparo de los artículos 27 y 30 de la Constitución Política, se me remita la siguiente información y documentación: 1. Copia íntegra del oficio o nota mediante la cual se comunicó al SINAC la remisión de la sección de certificación correspondiente al sendero ubicado en Playa Caletas, sector Bahía Drake. 2. Copia del acuerdo del Concejo Municipal de la Municipalidad de Osa mediante el cual se haya conocido, aprobado o elevado al SINAC la gestión de reclasificación del Patrimonio Natural del Estado en dicho sector, particularmente aquella promovida con sustento en: • El criterio técnico suscrito por el Ing. Forestal Leonardo Espinosa Zamora • El sustento legal presentado por mi persona, Nombre01 3. Copia del informe técnico elaborado por el Departamento de Zona Marítimo Terrestre, correspondiente a la inspección realizada en el predio conocido como Corcovado Aventuras, ubicado en el sector de Caletas de Drake. 4. Cualquier otro documento, informe, criterio técnico o comunicación oficial que forme parte del expediente administrativo o de la tramitología relacionada con la gestión de clasificación o reclasificación del Patrimonio Natural del Estado en el sector de Playa Caletas, Bahía Drake” (ver prueba adjunta).\n\nb) El 11 de junio de 2026, mediante oficio No. PZM-0190-2026, el Departamento de Zona Marítimo Terrestre de la Municipalidad de Osa brindó respuesta formal al recurrente respecto de la gestión planteada el 20 de abril de 2026. Se remitió copia íntegra del oficio No. PZM-0055-2026, enviado el 03 de marzo de 2026, relacionado con la sección de certificación correspondiente al sendero ubicado en Playa Caletas, sector Bahía Drake. Además, se indicó que aún no contaba con la totalidad de los insumos necesarios para la certificación de Bahía Drake y que, dado que el SINAC había señalado que únicamente atendería certificaciones completas, el trabajo del trimestre se encontraba prioritariamente enfocado en el análisis y tramitación de la certificación de Rocas de Amancio. Asimismo, se remitió copia íntegra del expediente enviado al SINAC para la recalificación de la concesión No. 605030001804Z00, el cual contenía, entre otros documentos, el acuerdo de Concejo PCM-N°-1307-2024-2028, el sustento legal incorporado al expediente, el criterio técnico suscrito por el Ing. Forestal Leonardo Espinosa Zamora y el informe técnico elaborado por el Departamento de Zona Marítimo Terrestre (ver informe rendido bajo juramento y prueba adjunta).\n\nc) A las 09:17 horas y 09:18 horas, ambas del 11 de junio de 2026, las autoridades recurridas fueron notificadas de la resolución de curso de este amparo (ver acta de notificación). \n\nd) El 11 de junio de 2026, a las 15:50 horas, desde la cuenta de correo electrónico del Departamento de Zona Marítimo Terrestre de la Municipalidad de Osa, se remitió correo electrónico al señor Nombre01, con copia al Departamento de Zona Marítimo Terrestre y a la Municipalidad de Osa, bajo el asunto “PZM-0190-2026 COPIA DE REMISION CORCOVADO AVENTURA PNE”, mediante el cual se envió el oficio No. PZM-0190-2026 “CAMPAMENTO CORCOVADO AVENTURAS SA - EXP SOLIC RECALIFICACION PNE.pdf” y “PZM-0055-2026 REMISION DE INSUMOS, DRAKE.pdf” (ver informe rendido bajo juramento y prueba adjunta).\n\ne) El correo oficial para gestiones ante la municipalidad recurrida es ...01 y no el correo ...02 (ver informe rendido bajo juramento y prueba adjunta).\n\nIV.- SOBRE EL DERECHO DE PETICIÓN Y PRONTA RESPUESTA. El derecho de petición y pronta respuesta, cobijado en los artículos 27, de la Constitución Política y 32, de la Ley de la Jurisdicción Constitucional, obliga a los funcionarios públicos a resolver las solicitudes de los administrados en el plazo de diez días hábiles a partir de la fecha de presentación de tales gestiones, a falta de que no se hubiere señalado otro plazo para contestar. Sin embargo, el artículo 32, citado dispone, además, que, en la decisión de la petición, la Sala apreciará las razones que se aduzcan para considerar insuficiente ese plazo, atendidas las circunstancias y la índole del asunto, en cuyo caso la Administración siempre está obligada a comunicarle al petente las causas de la demora en pronunciarse. En todo caso, el deber de resolver no implica la obtención de una respuesta favorable o no, pero sí la necesaria congruencia entre el objeto de lo pedido y el de lo contestado.\n\nV.- SOBRE EL CASO CONCRETO. En el presente asunto, la parte recurrente acusa la lesión de los derechos consagrados en los artículos 27 y 30 de la Constitución Política, debido a la falta de respuesta a la gestión presentada el 20 de abril de 2026, mediante la cual solicitó información y documentación relacionada con el trámite de reclasificación del Patrimonio Natural del Estado en el sector de Playa Caletas, Bahía Drake.\n\nDel análisis de los hechos acreditados, se constata que, en efecto, la gestión de información fue remitida el 20 de abril de 2026 a las direcciones electrónicas ...01 y ...02. Asimismo, se tiene por demostrado que las autoridades recurridas fueron notificadas de la resolución de curso de este amparo el 11 de junio de 2026, a las 09:17 horas y 09:18 horas, respectivamente. Posteriormente, ese mismo día, a las 15:50 horas, desde la cuenta de correo electrónico del Departamento de Zona Marítimo Terrestre de la Municipalidad de Osa, se remitió al gestionante el oficio No. PZM-0190-2026, junto con la documentación correspondiente, entre ella el oficio No. PZM-0055-2026 y el expediente relacionado con la solicitud de recalificación del Patrimonio Natural del Estado.\n\nAsí las cosas, si bien la Administración recurrida finalmente atendió la solicitud de información y remitió la documentación requerida, lo cierto es que dicha actuación se produjo con posterioridad a la notificación de la resolución de curso de este proceso constitucional. En consecuencia, la respuesta brindada no desvirtúa la lesión reclamada, sino que evidencia que la gestión fue atendida con ocasión de la interposición y tramitación del presente recurso de amparo. Por ello, procede declarar con lugar el recurso, de conformidad con lo dispuesto en el artículo 52 de la Ley de la Jurisdicción Constitucional.\n\nAhora bien, no pasa inadvertido para esta Sala que la autoridad recurrida indicó que el correo electrónico oficial para la presentación de gestiones ante la Municipalidad de Osa es ...01, y no la dirección ...02. Sin embargo, tal argumento no resulta suficiente para desestimar el recurso en este caso concreto. En primer lugar, porque la gestión también fue remitida a la dirección electrónica oficial ...01. En segundo término, porque la propia Administración recurrida dio trámite material a la solicitud y brindó una respuesta de fondo, con remisión de la información y documentación solicitada. Bajo esas circunstancias, no resulta procedente aplicar un criterio meramente formal para desconocer la gestión planteada, pues la conducta posterior de la Administración evidencia que tuvo conocimiento efectivo de la solicitud y que esta fue finalmente atendida.\n\nEn consecuencia, al haberse acreditado que la información requerida fue entregada únicamente después de la notificación del curso del amparo, corresponde declarar con lugar el recurso, a tenor de lo dispuesto en el artículo 52 de la Ley de la Jurisdicción Constitucional.\n\nVI.- SOBRE LA CONDENATORIA EN COSTAS, DAÑOS Y PERJUICIOS DE CONFORMIDAD CON EL ARTÍCULO 52 DE LA LEY DE LA JURISDICCIÓN CONSTITUCIONAL. Bajo una mejor ponderación, la mayoría de la Sala considera que, en el sub examine, de conformidad con lo dispuesto en el párrafo 1° del artículo 52 de la Ley de la Jurisdicción Constitucional (“Si, estando en curso el amparo, se dictare resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, se declarará con lugar el recurso únicamente para efectos de indemnización y de costas, si fueren procedentes”), la estimatoria debe serlo sin especial condenatoria en costas, daños y perjuicios, con base en las siguientes consideraciones. Si bien hay un texto expreso en la ley que obliga a que la parte dispositiva del fallo indique que se declara con lugar el recurso, cuando estando en curso del amparo se resuelva el agravio, no menos cierto es que ese mismo párrafo in fine refiere que la estimatoria se dicta “únicamente para efectos de indemnización y de costas, si fueren procedentes”. Se subraya que la Ley indica “si fueren procedentes”, lo cual significa que la procedencia o improcedencia de la indemnización y costas depende de una valoración, apreciación o ponderación del Tribunal. En casos como este, el contenido de la pretensión de la persona amparada y la conducta de la autoridad recurrida de reconocer aquella, sugieren que los menoscabos, lesiones o alteraciones alegados no están referidos de modo directo a una repercusión en un derecho constitucional de evidente naturaleza patrimonial (como sí ocurriría, por ejemplo, con una afectación al derecho al salario). Para disipar cualquier duda al respecto, es importante destacar lo dispuesto en el artículo 51 de la misma Ley de la Jurisdicción Constitucional, cuando dispone que: “toda resolución que acoja el recurso condenará en abstracto a la indemnización de los daños y perjuicios causados y al pago de las costas del recurso, y se reservará su liquidación para la ejecución de sentencia”, donde no se prevé la posibilidad de valorar si procede o no lo concerniente a indemnización y costas. Los principios del Derecho Constitucional, los del Público y Procesal General o, en su caso, los del Derecho Internacional o Comunitario y, además, por su orden, la Ley General de la Administración Pública y el Código Procesal Contencioso Administrativo y los demás códigos procesales, son fuente supletoria para la aplicación e interpretación de las normas de la Ley de la Jurisdicción Constitucional -cfr. artículo 14-. Para la jurisdicción contencioso-administrativa, el legislador estableció un precepto plenamente aplicable al caso por analogía, en el artículo 197 del Código Procesal Contencioso Administrativo, que responde a la lógica procesal en cualquier materia. En todo caso, la parte afectada del sub lite preserva la posibilidad de acudir, si a bien lo tiene, a un proceso de conocimiento a fin de demostrar que ha sufrido algún tipo de menoscabo. Con base en lo anterior, es criterio de mayoría resolver este recurso sin condenatoria en costas, daños y perjuicios.\n\nVII.- RAZONES DIFERENTES DEL MAGISTRADO CASTILLO VÍQUEZ. Si bien concuerdo con la mayoría de la Sala, en estimar el presente recurso de amparo, lo cierto es que considero que, si la parte recurrente remitió la gestión a un correo que “no constituye un medio oficial de atención de comunicaciones”, estimo que el reclamo resulta improcedente, con independencia de si le contestaron o no el recibo de su misiva a la parte recurrente, pues se denota que uno de los correos electrónicos a los que el interesado remitió su petición, no constituye un medio oficial para la recepción de tales gestiones. En este caso estimo el recurso, pues la parte recurrente también remitió la gestión en cuestión al correo, que sí es medio oficial, según informó el recurrido, de manera que este estaba conminado a contestar la misma y no lo hizo en forma oportuna.\n\nVIII.- VOTO SALVADO PARCIAL DEL MAGISTRADO SALAZAR ALVARADO, ÚNICAMENTE EN RELACIÓN CON LA NO CONDENATORIA EN COSTAS, DAÑOS Y PERJUICIOS A LA PARTE RECURRIDA. Si bien coincido con el resto de la Sala en declarar con lugar el recurso, me separo del criterio de mayoría en cuanto exime de condenar a la parte recurrida al pago de las costas, daños y perjuicios derivados de la lesión producida a los derechos fundamentales de la parte tutelada.\n\nLa Ley de la Jurisdicción Constitucional, en el artículo 52, dispone que:\n\n“Si, estando en curso el amparo, se dictare resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, se declarará con lugar el recurso únicamente para efectos de indemnización y de costas, si fueren procedentes”.\n\nPor otra parte, en el artículo 51 ibídem, se establece que: \n\n“...toda resolución que acoja el recurso condenará en abstracto a la indemnización de los daños y perjuicios causados y al pago de las costas del recurso, y se reservará su liquidación para la ejecución de sentencia”.\n\nEsta última norma establece el sistema general que regula lo relativo al tema de la indemnización y el pago de las costas, y que la mayoría denomina “forma natural o normal de terminación del proceso, donde hay pronunciamiento sobre el fondo del asunto y reconocimiento de los hechos que han vulnerado los derechos fundamentales…”.\n\nEn criterio de la mayoría, el artículo 51, de cita, regula los supuestos en los que la Sala ha tenido por comprobado el agravio; y, como consecuencia, surge la necesidad de una condenatoria en costas, daños y perjuicios. Sin embargo, a juicio de los suscritos, de la interpretación sistemática de ambas normas, se concluye que, tanto en los casos en que este Tribunal Constitucional constate una lesión a algún derecho fundamental; y, por ende, declare con lugar el recurso, como en aquellos en los que la Administración, por decisión propia, restituya a la persona agraviada en el goce de sus derechos fundamentales, una vez que tenga conocimiento del amparo -supuesto contemplado en el artículo 52, referido-, por imperio de los artículos 50 y 51, de la ley citada, la consecuencia necesaria e ineludible es la condenatoria al infractor a la indemnización de los daños y perjuicios causados y del pago de las costas del recurso. Esta regla no es más que el reconocimiento, a la parte que ha sufrido una vulneración en sus derechos fundamentales, del derecho a una tutela judicial efectiva en torno a la reparación de las consecuencias dañosas derivadas de las actuaciones u omisiones de las autoridades infractoras; y, como medio disuasivo, a fin de que el Estado no incurra nuevamente en las acciones que dieron base a la estimatoria del recurso, tema regulado en el artículo 50, de la ley que rige esta jurisdicción. De modo, que ya sea que la Sala haya tenido por comprobado el agravio y haya entrado a conocer el fondo del asunto, o que la violación haya cesado por decisión de la propia autoridad recurrida, una vez que tuvo conocimiento de la tramitación del amparo, con restitución en el goce de los derechos fundamentales a favor del agraviado (artículo 52), siempre, en cualesquiera de esos supuestos, surge la imperiosa necesidad de una condenatoria en costas, daños y perjuicios al infractor, cuyo fundamento se encuentra en los principios de tutela de los derechos de las personas y en el de que la Administración debe hacerse responsable por los daños y perjuicios que ocasione con su actuar inconstitucional. \n\nAsí, el hecho de que al momento de conocerse y resolverse con lugar el amparo, los efectos del acto impugnado ya hubieren cesado, en los términos de lo dispuesto en los artículos 50 y 52, de la ley de cita, no enerva la procedencia de la condenatoria en costas, daños y perjuicios, pues tal caso forma parte integral del sistema general de condenatoria necesaria en esos extremos, que contiene la Ley de la Jurisdicción Constitucional.\n\nPor otra parte, es claro que el artículo 52, mencionado, se aplica únicamente en los casos en que la Sala, aun cuando no ha conocido, ni se ha pronunciado sobre el fondo del reclamo, ha constatado la vulneración que en sus derechos fundamentales ha sufrido la parte amparada, en virtud de la restitución, que, en el goce de esos derechos, ha acordado a su favor la Administración; situación que, tal y como la afirma la mayoría de la Sala, implica una “terminación anormal del proceso”.\n\nEl legislador estableció y delimitó, de forma precisa, las condiciones en las cuales esta Sala puede decretar esa forma de conclusión anormal del proceso de amparo, así como sus alcances, a saber: 1) que el amparo esté en curso, es decir, que la Administración haya sido debidamente notificada de la resolución que dio curso al amparo; y, 2) que exista una resolución administrativa o judicial que disponga, de forma indubitable, la revocación, detención o suspensión de la actuación impugnada violatoria de derechos fundamentales. Ciertamente, la norma en cuestión contempla una excepción al sistema general de condenatoria en costas, daños y perjuicios, no obstante, la estimatoria del recurso, al disponer que, en los casos allí regulados, se declarará con lugar el recurso “únicamente para efectos de indemnización y de costas, si fueren procedentes”. Como excepción que es, debe ser interpretada restrictivamente; es decir, que solo procede en los supuestos estrictamente contemplados en la norma, no solo por la regla de que las excepciones en derecho deben interpretarse de forma restrictiva, sino también porque las consecuencias de aplicar tal excepción implican, sin lugar a dudas, un menoscabo en el derecho fundamental de las personas a obtener una efectiva tutela judicial frente a los daños y perjuicios sufridos con la lesión a sus derechos constitucionales. \n\nEn mi criterio, tal excepción se debe interpretar en el sentido de que, de conformidad con el sistema general de condenatoria automática en costas, daños y perjuicios ante una violación a derechos fundamentales, esa condenatoria es siempre procedente, aún en el caso de que la parte recurrida dicte una resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, a menos que conste de manera indubitable y clara que en el caso concreto no se causó perjuicio alguno capaz de ser indemnizado. Solo y únicamente en tales supuestos podría eximirse a la Administración recurrida del pago de dichos extremos. Como en este caso, no existe elemento alguno que desvirtúe la presunción del surgimiento, para la parte amparada, de daños y perjuicios económicos derivados de las actuaciones impugnadas -cuya determinación concreta no le corresponde a esta jurisdicción-, la estimatoria de este recurso debe implicar, necesariamente, la condenatoria en costas, daños y perjuicios, y así lo declaro.\n\nComo razón adicional, cabe destacar que la dinámica y esencia misma de los procesos de amparo, no tiene por objeto primario el análisis de la existencia o no de daños y perjuicios, sino, de la existencia o no de acciones u omisiones que puedan generar o producir un quebranto al régimen de los derechos fundamentales de las personas. Desde esa arista, el análisis que realiza esta sede, se concentra en dicha verificación, empero, no ingresa a la ponderación de si esas cuestiones han generado o no lesiones en el ámbito eminentemente patrimonial de las personas amparadas. Si bien el precitado precepto 52, de la LJC, en su ámbito gramatical, estatuye que dicha condena (en daños, perjuicios y costas) opera, de ser procedente, no estimamos los suscritos que dicho examen de pertinencia pueda, a priori, excluirse de manera automática en este tipo de procesos, en la medida en que, es dentro de otro proceso ordinario, que se ha de definir si dentro de la relación jurídica analizada en el recurso de amparo, las conductas u omisiones imputables a la Administración (o sujeto de derecho privado, cuando corresponda), se han constituido como causa adecuada de lesiones de orden patrimonial, que sean jurídicamente indemnizables. A modo de referencia, los numerales 179 al 184, del Código Procesal Contencioso Administrativo, Ley N° 8508, define un proceso especial que tiene por objeto la definición de los efectos económicos derivados de condenas dictadas en estos procesos. A la luz del canon 179 ejusdem, ese proceso tiene por objeto lo siguiente: \n\n“ARTÍCULO 179.- Corresponde al Juzgado de lo Contencioso-Administrativo, la ejecución de las sentencias dictadas por la Jurisdicción Constitucional, en procesos de hábeas corpus y de amparo contra sujetos de Derecho público, únicamente en lo relativo a la demostración, la liquidación y el cumplimiento de indemnizaciones pecuniarias”.\n\nEs claro que ese proceso se direcciona al análisis del antecedente necesario emitido por esta Sala en cuanto a una condena en abstracto en esos rubros, pues no procedería ese tipo de pretensiones dentro de ese tipo de causas, cuando la sentencia dictada dentro del proceso de amparo, estableciere, de manera expresa, la improcedencia de daños, perjuicios y/o costas, así como cuando no exista pronunciamiento expreso en cuanto a este particular. Es decir, el proceso especial en sede contencioso administrativa, requiere, a modo de requisito sine qua non, de condena o pronunciamiento expreso por parte de esta Sala Constitucional. En ese orden, a nuestro juicio, al tenor del mencionado ordinal 52, de la LJC, la dispensa en esa condena patrimonial precisa de la acreditación, en cada caso, de situaciones a partir de las cuales, es estime, motivadamente, la inexistencia de lesiones patrimoniales, aún potenciales, derivadas o asociadas a los hechos analizados. Por ende, se trata de una excepción, que, como tal, requiere de aplicación calificada y debidamente fundamentada de manera casuística. La sola circunstancia que, en el curso del trámite, la Administración dicte resolución o se emita sentencia judicial que revoque, detenga o suspenda la actuación impugnada, no descarta, per se, que, de previo a esa cesación por causa propia o ajena al ente accionado, la indolencia acusada o perturbación reprochada, haya llegado a ocasionar daños y perjuicios. Sin embargo, tal cuestión de fondo, en lo relativo a la efectividad de las lesiones, su cuantía, reclamo oportuno, etc., son ponderaciones que escapan a la naturaleza de estos procesos y respecto de la cual, en orden a lo regulado por el mandato 52 aludido, son propias de una condena en abstracto que luego constituye base de análisis en la Jurisdicción Contencioso Administrativa. La tutela que se pretende en estos procesos de orden constitucional no precisa de la demostración de daños y perjuicios, pues, se insiste, no es su objeto o ratio primaria. Así, no corresponde a la persona amparada el reclamo o demostración de daños, siendo que lo que busca es el resguardo de sus derechos fundamentales. Luego, si esas conductas administrativas le han producido lesiones, es un extremo que, por tesis de principio y salvo casos excepcionales, no forman parte de la base de análisis de este tipo de causas. Nótese que, en el supuesto regulado en ese mandato, la Sala Constitucional no hace un análisis de fondo de la situación a tutelar, dada la terminación del amparo o habeas corpus por la circunstancia sobrevenida ya citada. Ergo, en estos casos, por imperativo legal, no se ingresa a valorar si hay o no infracción, con lo cual, mucho menos puede definirse si a partir de lo denunciado por el requirente, puede haber o no situaciones de posible reparación civil. De esa manera, la dispensa de condena a que alude esa norma, es de orden excepcional, no de principio. Por tanto, en esos supuestos, la norma impone la condena en abstracto, para que sea dentro de otro proceso plenario, que se analice su procedencia. De otro modo, de aplicarse como regla esa liberación de daños, perjuicios y costas, se estaría poniendo en riesgo la tutela de la situación jurídica de la persona que, pese a esa respuesta sobrevenida de la parte reclamada, pudo haber sufrido lesiones en su esfera patrimonial, en detrimento de lo estatuido por el precepto 45, de la Constitución Política, y desconociendo la potencial responsabilidad de la Administración, tal y como lo impone el artículo 9 ejusdem. Además, no debe dejarse de lado que fue en virtud de una acción de esa índole, que se adoptó una conducta que hace cesar las conductas que, en teoría, amenazan o conculcan los derechos fundamentales de la persona. Es decir, a efectos de obtener el resguardo de esos derechos, la persona optó por la tutela judicial, y fue por esa virtud, que se produce el cese de la perturbación reprochada. Se insiste, si la permanencia de la amenaza o deterioro de su situación en tanto se hizo cesar por las causas aludidas en la norma bajo examen, generó daños y perjuicios, es un tema que, salvo prueba en contrario, debe ser analizado dentro de un proceso ordinario, pero que, se reitera, en modo alguno, debe negarse, como presupuesto, por la sola concreción del supuesto de hecho regulado en el mencionado ordinal 52, de la LJC. Por ende, con el respeto de siempre en cuanto a la postura de mayoría, externo mi voto y reitero que la estimatoria de este recurso debe implicar, necesariamente, la condenatoria en abstracto en costas, daños y perjuicios.\n\nIX.- VOTO SALVADO DE LA MAGISTRADA GARRO VARGAS, RESPECTO A LA PARTE DISPOSITIVA DE ESTA SENTENCIA. Dice el artículo 52 de la Ley de la Jurisdicción Constitucional (LJC): “Si, estando en curso el amparo, se dictare resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, se declarará con lugar el recurso únicamente para efectos de indemnización y de costas, si fueren procedentes”.\n\nMi interpretación sobre esa norma es la siguiente: Esa “resolución” es todo acto válido y eficaz por el cual la autoridad competente restituye en el goce del derecho conculcado. La frase “si fueren procedentes” se refiere a las costas. Es más, el artículo 197 del Código Procesal Contencioso-Administrativo, citado por la mayoría, sobre la base del artículo 14 de la LJC, justamente se refiere sólo a estas: a las costas.\n\nCiertamente, a tenor del artículo 48 de la Constitución Política (CP), el contenido esencial del derecho al recurso de amparo no es de carácter indemnizatorio sino restitutorio; sin embargo, el artículo 51 de la LJC señala: “Toda resolución que acoja el recurso condenará en abstracto a la indemnización de los daños y perjuicios causados y al pago de las costas del recurso, y se reservará su liquidación para la ejecución de sentencia”.\n\nSi el derecho ha sido violado y la Sala así lo constata, aún en caso de que haya sido restituido, podrían haber surgido daños y perjuicios. Por tal motivo, cabe la condenatoria en abstracto de estos. Si no se hiciera así, si no se diera tal condenatoria, en el caso de que sí se hubieren dado, no habría título – derivado de este proceso– para reclamarlos, con lo que se podría violar el artículo 41 de la CP. Si a pesar de que se haya dictado la condenatoria en abstracto, no se han ocasionado los daños y perjuicios, el juez en la vía ordinaria así lo declarará, pues sólo a él corresponde tener por probado la existencia real y la magnitud de los mismos.\n\nCon la tesis defendida por la mayoría estimo que, contrario a lo que se busca, se estaría incentivando que la Administración respete los derechos sólo ante la existencia de un recurso de amparo. Resta decir que el artículo 52 de la LJC prevé la posibilidad de que, si se estima que es lo justo, la Sala condene en costas, aun cuando el derecho haya sido restituido.\n\nEn razón de lo anterior, salvo parcialmente el voto respecto de la parte dispositiva y ordeno la condenatoria en daños y perjuicios, pero no la condenatoria en costas.\n\nX.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, deberá retirarlos del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\nSe declara con lugar el recurso, sin especial condenatoria en costas, daños y perjuicios. El magistrado Castillo Víquez da razones diferentes. El magistrado Salazar Alvarado salva parcialmente el voto, únicamente para efectos indemnizatorios, e impone a la parte accionada el pago de las costas, daños y perjuicios. La magistrada Garro Vargas salva parcialmente el voto y ordena la condenatoria en daños y perjuicios, pero no en costas. San José, at nine hours and twenty-five minutes on the tenth of July, two thousand twenty-six.\n\nWrit of amparo (recurso de amparo) processed under case file No. 26-018602-0007-CO, filed by Nombre01, national identity number (cédula de identidad) CED02, on behalf of Nombre02, national identity number CED03, against the MUNICIPALIDAD DE OSA.\n\nRecitals:\n\n1.- By a written submission received at the Chamber's Secretariat on May 25, 2026, the petitioner files a writ of amparo on behalf of Nombre02, national identity number CED03, against the MUNICIPALIDAD DE OSA. The petitioner states that on July 25, 2025, the protected party granted him a special power of attorney (poder especial) to carry out, before the Municipalidad de Osa, all manner of administrative proceedings (trámites administrativos), petitions, requests, official communications, appeals, and appearances related to municipal permits, concessions (concesiones), certifications, and other administrative matters connected to his interests. The petitioner further states that on April 20, 2026, he sent to electronic addresses ...01 and ...02 a request addressed to Ing. Daniela López Rivera, in her capacity as coordinator of the Maritime-Terrestrial Zone Department (Departamento de Zona Marítima Terrestre) of the Municipalidad de Osa, entitled: \"Request for information and submission of documentation – Reclassification proceedings for State Natural Heritage, Playa Caletas sector, Bahía Drake,\" through which he requested the following: \"I acknowledge receipt of official communication No. PZM-0102-2026, dated April 15, 2026, which notifies the forwarding of State Natural Heritage (Patrimonio Natural del Estado) certifications to SINAC for purposes of their eventual reclassification. First and foremost, I express my appreciation for the steps taken by that Department in connection with the Rocas de Amancio sector, which are of great relevance within the processes that have been underway. Nevertheless, in light of the content of the aforementioned communication, and specifically with respect to the Bahía Drake – Playa Caletas sector, I hereby formally request, pursuant to Articles 27 and 30 of the Political Constitution (Constitución Política), that the following information and documentation be forwarded to me: 1. A complete copy of the official communication or memorandum by which SINAC was notified of the submission of the certification section corresponding to the trail located at Playa Caletas, Bahía Drake sector. 2. A copy of the resolution of the Municipal Council (Concejo Municipal) of the Municipalidad de Osa by which the reclassification request for the State Natural Heritage in that sector was received, approved, or elevated to SINAC, particularly the one promoted on the basis of: • The technical opinion signed by Ing. Forestal Leonardo Espinosa Zamora • The legal grounds submitted by me, Nombre01 3. A copy of the technical report prepared by the Maritime-Terrestrial Zone Department, corresponding to the inspection carried out on the property known as Corcovado Aventuras, located in the Caletas de Drake sector. 4. Any other document, report, technical opinion, or official communication forming part of the administrative file or proceedings related to the classification or reclassification of the State Natural Heritage in the Dirección01 sector.\" The petitioner alleges that as of the date of filing of this writ he has received no response.\n\n2.- By resolution issued at 13:06 hours on June 5, 2025, this writ was admitted for processing.\n\n3.- MAINOR ANCHIA ANGULO and DANIELA LÓPEZ RIVERA, in their respective capacities as MAYOR (ALCALDE) and ACTING HEAD OF THE MARITIME-TERRESTRIAL ZONE (ENCARGADA A.I. ZONA MARÍTIMO TERRESTRE), BOTH OF THE MUNICIPALIDAD DE OSA, submit the following sworn report: \"… FIRST: It is important to inform Your Honor that this municipality, by means of official communication PZM-0190-2026, dated June 11, 2026, from the Maritime-Terrestrial Zone Department, has provided a formal response to the petitioner. Likewise, the petitioner was sent a copy of the file forwarded to SINAC for the reclassification (recalificación) of concession No. 605030001804Z00, registered in the name of the company Campamento Corcovado Aventuras S.Nombre03., legal entity number CED01, which contains the information requested in the writ of amparo filed. SECOND: On this point, in resolution Nº 2025032397 issued within case file No. 25-029317-0007-CO, the Constitutional Chamber stated: 'With regard to what was raised by the petitioner, it should be noted that a review of the record reveals that the aforementioned request was submitted on August 6, 2025, and reiterated on September 16, 2025, alleging that as of September 25, 2025, the date on which this writ was filed—1 month and 14 calendar days after the request in question was submitted—the requested lighting fixture had not been reinstalled. It is therefore clear that the time elapsed was not excessive, which is why the appropriate course of action is to dismiss the writ of amparo as premature.' That being said, it is appropriate to point out to the honorable Constitutional Chamber that the petitioner's request was submitted on April 20, 2026. However, it must be taken into account that the administration has a reasonable period of ten business days (días hábiles) to address and respond to requests submitted to it, and therefore it is not correct to begin calculating an eventual delay from the very day the request was submitted. In this regard, taking the date of submission of the request as the starting point, the initial period available to the administration expired approximately on May 5, 2026; consequently, any analysis of an eventual delay must be conducted from that date, and not from April 20, 2026. That being the case, as of June 11, 2026, the time elapsed since the expiration of the initial response period would be approximately one month and six days, which, given the nature of the matter, the need for technical analysis, the review of legal documentation, and the inter-institutional coordination required with SINAC, cannot be considered an excessive, unreasonable, or disproportionate delay. On this point, consideration must be given to the position maintained by the honorable Constitutional Chamber in resolution Nº 2025032397, issued within case file No. 25-029317-0007-CO, in which it was held that the passage of one month and fourteen calendar days from the submission of a request was not excessive, which was the reason the writ of amparo was dismissed as premature. In the present case, all the more so, if one considers that any eventual delay must be calculated from the moment the administration's initial reasonable response period expires, the time elapsed is not excessive; furthermore, the request submitted was not a simple request requiring an immediate response, but rather a proceeding connected to the reclassification of a concession, the review of technical and legal documentation, and the submission of materials to SINAC for matters within its competence. Accordingly, it cannot be said that there exists an arbitrary omission, injurious administrative silence, or an unjustified delay attributable to this municipality. On the contrary, the administrative actions taken demonstrate that the request was addressed within a reasonable period, and therefore the writ must be dismissed as premature. THIRD: The official email address for communications with this municipality is ...01 and not the address ...02, as evidenced by (image inserted) …\". \"… For the foregoing factual and legal reasons, we respectfully request that the honorable tribunal declare this writ of amparo WITHOUT MERIT (SIN LUGAR), given that no arbitrary, unlawful, or rights-violating conduct attributable to this administration has occurred. The request was submitted on April 20, 2026, and the administration had an initial reasonable period of ten business days to address the request, such that any eventual delay could not be calculated from the day of submission itself, but rather from the expiration of that period, approximately May 5, 2026. In that regard, given that a formal response was issued on June 11, 2026, the time elapsed since the expiration of the initial response period is not excessive, unreasonable, or disproportionate, particularly given that the matter was not a simple request for information; furthermore, the position maintained by the honorable Constitutional Chamber in resolution Nº 2025032397, issued within case file No. 25-029317-0007-CO, in which it was determined that the passage of one month and fourteen calendar days from the submission of a request was not excessive, which is why the writ of amparo was dismissed as premature. In the present case, all the more so, when the period is calculated from the expiration of the administration's reasonable initial response period, it cannot be concluded that a constitutionally significant delay exists …\".\n\n4.- The prescribed legal procedures have been observed throughout the proceedings. The opinion is authored by Magistrada Hess Herrera; and,\n\nConsidering:\n\nI.- SUBJECT MATTER OF THE WRIT. The petitioner files a writ of amparo on behalf of Nombre02 against the Municipalidad de Osa, alleging the failure to respond to a request submitted on April 20, 2026, through which information and documentation were requested in connection with the reclassification proceedings for the State Natural Heritage in the Playa Caletas, Bahía Drake sector.\n\nIII.- ESTABLISHED FACTS. The following facts are deemed duly established for purposes of the decision in this matter, either because they have been duly substantiated or because the respondent failed to address them, as required by the initial order:\n\na) On April 20, 2026, the petitioner sent to electronic addresses ...01 and ...02 a request addressed to Ing. Daniela López Rivera, in her capacity as coordinator of the Maritime-Terrestrial Zone Department of the Municipalidad de Osa, entitled \"Request for information and submission of documentation – Reclassification proceedings for State Natural Heritage, Playa Caletas sector, Bahía Drake,\" in which he stated verbatim the following: \"I acknowledge receipt of official communication No. PZM-0102-2026, dated April 15, 2026, which notifies the forwarding of State Natural Heritage certifications to SINAC for purposes of their eventual reclassification. First and foremost, I express my appreciation for the steps taken by that Department in connection with the Rocas de Amancio sector, which are of great relevance within the processes that have been underway. Nevertheless, in light of the content of the aforementioned communication, and specifically with respect to the Bahía Drake – Playa Caletas sector, I hereby formally request, pursuant to Articles 27 and 30 of the Political Constitution, that the following information and documentation be forwarded to me: 1. A complete copy of the official communication or memorandum by which SINAC was notified of the submission of the certification section corresponding to the trail located at Playa Caletas, Bahía Drake sector. 2. A copy of the resolution of the Municipal Council of the Municipalidad de Osa by which the reclassification request for the State Natural Heritage in that sector was received, approved, or elevated to SINAC, particularly the one promoted on the basis of: • The technical opinion signed by Ing. Forestal Leonardo Espinosa Zamora • The legal grounds submitted by me, Nombre01 3. A copy of the technical report prepared by the Maritime-Terrestrial Zone Department, corresponding to the inspection carried out on the property known as Corcovado Aventuras, located in the Caletas de Drake sector. 4. Any other document, report, technical opinion, or official communication forming part of the administrative file or proceedings related to the classification or reclassification of the State Natural Heritage in the Playa Caletas, Bahía Drake sector\" (see attached evidence).\n\nb) On June 11, 2026, by means of official communication No. PZM-0190-2026, the Maritime-Terrestrial Zone Department of the Municipalidad de Osa provided a formal response to the petitioner regarding the request submitted on April 20, 2026. A complete copy of official communication No. PZM-0055-2026, sent on March 3, 2026, related to the certification section corresponding to the trail located at Playa Caletas, Bahía Drake sector, was forwarded. In addition, it was indicated that the totality of the inputs necessary for the Bahía Drake certification had not yet been obtained, and that, given that SINAC had stated it would only process complete certifications, the work for the quarter was primarily focused on the analysis and processing of the Rocas de Amancio certification. Likewise, a complete copy of the file sent to SINAC for the reclassification of concession No. 605030001804Z00 was forwarded, which contained, among other documents, the Municipal Council resolution PCM-N°-1307-2024-2028, the legal grounds incorporated into the file, the technical opinion signed by Ing. Forestal Leonardo Espinosa Zamora, and the technical report prepared by the Maritime-Terrestrial Zone Department (see sworn report and attached evidence).\n\nc) At 09:17 hours and 09:18 hours, both on June 11, 2026, the respondent authorities were notified of the resolution admitting this writ of amparo for processing (see notification record).\n\nd) On June 11, 2026, at 15:50 hours, from the email account of the Maritime-Terrestrial Zone Department of the Municipalidad de Osa, an email was sent to Mr. Nombre01, with a copy to the Maritime-Terrestrial Zone Department and to the Municipalidad de Osa, under the subject line \"PZM-0190-2026 COPIA DE REMISION CORCOVADO AVENTURA PNE,\" through which official communication No. PZM-0190-2026 \"CAMPAMENTO CORCOVADO AVENTURAS SA - EXP SOLIC RECALIFICACION PNE.pdf\" and \"PZM-0055-2026 REMISION DE INSUMOS, DRAKE.pdf\" were transmitted (see sworn report and attached evidence).\n\ne) The official email address for communications with the respondent municipality is ...01 and not the address ...02 (see sworn report and attached evidence).\n\nIV.- ON THE RIGHT OF PETITION AND TIMELY RESPONSE. The right of petition and timely response (derecho de petición y pronta respuesta), protected under Article 27 of the Political Constitution and Article 32 of the Law on Constitutional Jurisdiction (Ley de la Jurisdicción Constitucional), obligates public officials to resolve requests submitted by citizens within ten business days from the date the requests are submitted, in the absence of any other specified response period. However, the aforementioned Article 32 also provides that, in deciding on the petition, the Chamber shall assess the reasons put forward to consider that period insufficient, taking into account the circumstances and the nature of the matter; in which case the Administration is always obligated to notify the petitioner of the reasons for the delay in rendering a decision. In any event, the duty to resolve does not imply the obtainment of a favorable or unfavorable response, but it does require necessary congruence between the subject matter of what was requested and the subject matter of the response provided.\n\nV.- ON THE SPECIFIC CASE. In the present matter, the petitioning party (parte recurrente) alleges a violation of the rights enshrined in Articles 27 and 30 of the Political Constitution, on account of the failure to respond to the request submitted on April 20, 2026, through which information and documentation were requested in connection with the reclassification proceedings for the State Natural Heritage in the Playa Caletas, Bahía Drake sector.\n\nFrom an analysis of the established facts, it is confirmed that the information request was indeed sent on April 20, 2026, to electronic addresses ...01 and ...02. It is likewise established that the respondent authorities were notified of the resolution admitting this writ of amparo for processing on June 11, 2026, at 09:17 hours and 09:18 hours, respectively. Subsequently, on that same day, at 15:50 hours, from the email account of the Maritime-Terrestrial Zone Department of the Municipalidad de Osa, official communication No. PZM-0190-2026 was sent to the requester, along with the corresponding documentation, including official communication No. PZM-0055-2026 and the file related to the reclassification request for the State Natural Heritage.\n\nThat being so, although the respondent Administration ultimately addressed the request for information and forwarded the required documentation, the fact remains that this action occurred after the notification of the resolution admitting this constitutional proceeding for processing. Consequently, the response provided does not negate the alleged violation; rather, it demonstrates that the request was addressed by reason of the filing and processing of this writ of amparo. Therefore, the writ must be granted, in accordance with Article 52 of the Law on Constitutional Jurisdiction.\n\nIt has not gone unnoticed by this Chamber that the respondent authority indicated that the official email address for the submission of requests to the Municipalidad de Osa is ...01, and not the address ...02. However, this argument is insufficient to dismiss the writ in this specific case. First, because the request was also sent to the official electronic address ...01. Second, because the respondent Administration itself processed the request on the merits and provided a substantive response, forwarding the requested information and documentation. Under those circumstances, it is not appropriate to apply a purely formal criterion to disregard the request submitted, since the Administration's subsequent conduct demonstrates that it had effective knowledge of the request and that the latter was ultimately addressed.\n\nAccordingly, having established that the requested information was delivered only after notification of the admission of the writ of amparo, the writ must be granted, pursuant to Article 52 of the Law on Constitutional Jurisdiction.\n\nVI.- ON THE AWARD OF COSTS, DAMAGES, AND LOSSES IN ACCORDANCE WITH ARTICLE 52 OF THE LAW ON CONSTITUTIONAL JURISDICTION. Upon more careful consideration, the majority of the Chamber holds that, in the sub examine, pursuant to the first paragraph of Article 52 of the Law on Constitutional Jurisdiction (\"If, while a writ of amparo is in progress, an administrative or judicial resolution is issued that revokes, stays, or suspends the challenged action, the writ shall be granted solely for purposes of indemnification and costs, if applicable\"), the granting decision (estimatoria) shall be issued without a special award of costs (condenatoria en costas), damages, and losses, based on the following considerations. Although there is an express statutory provision requiring that the operative part of the judgment state that the writ is granted whenever the grievance is remedied while the writ of amparo is in progress, it is equally true that that same final clause provides that the granting decision is issued \"solely for purposes of indemnification and costs, if applicable.\" It is emphasized that the Law states \"if applicable,\" which means that the applicability or inapplicability of the indemnification and costs depends on an assessment, appreciation, or weighing by the Tribunal. In cases such as this one, the content of the protected party's (parte amparada) claim and the respondent authority's conduct in acknowledging it suggest that the alleged harms, injuries, or disruptions do not relate directly to a repercussion on a constitutional right of an evidently patrimonial nature (as would be the case, for example, with an interference with the right to a salary). To dispel any doubt in this regard, it is important to highlight the provision of Article 51 of the same Law on Constitutional Jurisdiction, which states that: \"every resolution granting the writ shall order in the abstract the indemnification of the damages and losses caused and the payment of the costs of the writ, and shall reserve their liquidation for the enforcement of judgment,\" where no possibility is contemplated of assessing whether or not indemnification and costs are applicable. The principles of Constitutional Law, those of General Public and Procedural Law or, as applicable, those of International or Community Law, and furthermore, in order, the General Law on Public Administration (Ley General de la Administración Pública) and the Code of Administrative Contentious Procedure (Código Procesal Contencioso Administrativo) and the other procedural codes, are supplementary sources for the application and interpretation of the provisions of the Law on Constitutional Jurisdiction—cf. Article 14. For the administrative contentious jurisdiction, the legislature established a provision fully applicable to the present case by analogy, in Article 197 of the Code of Administrative Contentious Procedure, which reflects the procedural logic applicable in any area of law. In any event, the affected party in the sub lite retains the possibility of resorting, if they so choose, to ordinary proceedings in order to demonstrate that they have suffered some form of harm. Based on the foregoing, it is the majority's view that this writ should be resolved without an award of costs, damages, and losses.\n\nVII.- SEPARATE REASONS OF MAGISTRATE CASTILLO VÍQUEZ. Although I concur with the majority of the Chamber in granting this writ of amparo, I am of the view that, if the petitioning party sent the request to an email address that \"does not constitute an official means for receiving communications,\" the claim is improper, regardless of whether or not the petitioner was sent an acknowledgment of receipt of their communication, since it is evident that one of the email addresses to which the interested party sent their petition does not constitute an official means for the receipt of such requests. I grant the writ in this case because the petitioning party also sent the request in question to the email address that is, according to the respondent's own report, the official means, such that the respondent was under an obligation to respond and failed to do so in a timely manner.\n\nVIII.- PARTIAL DISSENTING VOTE (VOTO SALVADO PARCIAL) OF MAGISTRATE SALAZAR ALVARADO, SOLELY WITH RESPECT TO THE NON-AWARD OF COSTS, DAMAGES, AND LOSSES TO THE RESPONDENT PARTY. Although I concur with the rest of the Chamber in granting the writ, I dissent from the majority's position insofar as it exempts the respondent party (parte recurrida) from being ordered to pay the costs, damages, and losses arising from the violation inflicted upon the fundamental rights of the protected party.\n\nThe Law on Constitutional Jurisdiction, in Article 52, provides:\n\n\"If, while a writ of amparo is in progress, an administrative or judicial resolution is issued that revokes, stays, or suspends the challenged action, the writ shall be granted solely for purposes of indemnification and costs, if applicable.\"\n\nFurthermore, Article 51 of the same Law establishes:\n\n\"…every resolution granting the writ shall order in the abstract the indemnification of the damages and losses caused and the payment of the costs of the writ, and shall reserve their liquidation for the enforcement of judgment.\"\n\nThis latter provision establishes the general framework governing the subject of indemnification and the payment of costs, which the majority refers to as the \"natural or normal manner of conclusion of the proceedings, in which there is a ruling on the merits and recognition of the facts that have violated fundamental rights….\"\n\nIn the majority's view, the aforementioned Article 51 governs the cases in which the Chamber has found the grievance to be established and, as a consequence, the need for an award of costs, damages, and losses arises. However, in the view of the undersigned, a systematic interpretation of both provisions leads to the conclusion that, both in cases where this Constitutional Tribunal finds a violation of a fundamental right and, as a consequence, grants the writ, and in cases where the Administration, of its own accord, restores the aggrieved party to the enjoyment of their fundamental rights once it has become aware of the writ—the scenario contemplated in the aforementioned Article 52—by operation of Articles 50 and 51 of the cited Law, the necessary and unavoidable consequence is an order against the violator to indemnify the damages and losses caused and to pay the costs of the writ. This rule is nothing more than the recognition, in favor of the party who has suffered a violation of their fundamental rights, of the right to effective judicial protection (tutela judicial efectiva) with respect to the reparation of the harmful consequences arising from the actions or omissions of the offending authorities; and, as a deterrent, so that the State does not again engage in the conduct that gave rise to the granting of the writ—a matter regulated in Article 50 of the Law governing this jurisdiction. Thus, regardless of whether the Chamber has found the grievance to be established and has examined the merits of the matter, or whether the violation has ceased by the respondent authority's own decision upon becoming aware of the processing of the writ, with the restoration of the aggrieved party to the enjoyment of their fundamental rights (Article 52), an order against the violator for costs, damages, and losses is always imperative in either scenario, grounded in the principles of protection of persons' rights and in the principle that the Administration must be held accountable for the damages and losses it causes through its unconstitutional conduct.\n\nThus, the fact that, at the time the writ is considered and granted, the effects of the challenged act may have already ceased, in the terms of Articles 50 and 52 of the cited Law, does not negate the applicability of the award of costs, damages, and losses, since such a case forms an integral part of the general system of mandatory awards under those headings contained in the Law on Constitutional Jurisdiction.\n\nFurthermore, it is clear that the aforementioned Article 52 applies exclusively in cases where the Chamber, even without having examined or ruled on the merits of the claim, has found the violation suffered by the protected party in their fundamental rights, by virtue of the Administration's decision to restore that party to the enjoyment of those rights—a situation which, as the majority of the Chamber affirms, constitutes an \"abnormal conclusion of the proceedings.\"\n\nThe legislature established and precisely delineated the conditions under which this Chamber may decree such a form of abnormal conclusion of the writ of amparo proceedings, as well as its scope, namely: 1) that the writ be in progress, meaning that the Administration has been duly notified of the resolution admitting the writ for processing; and, 2) that there exists an administrative or judicial resolution that unambiguously orders the revocation, stay, or suspension of the challenged action that violates fundamental rights. Certainly, the provision in question contemplates an exception to the general system of awards of costs, damages, and losses, notwithstanding the granting of the writ, by providing that, in the cases it governs, the writ shall be granted \"solely for purposes of indemnification and costs, if applicable.\" As an exception, it must be interpreted restrictively; that is, it applies only in the circumstances strictly contemplated by the provision, not only because of the rule that exceptions in law must be interpreted restrictively, but also because the consequences of applying such an exception undoubtedly entail a diminishment of the fundamental right of individuals to obtain effective judicial protection against the damages and losses suffered as a result of the violation of their constitutional rights.\n\nIn my view, this exception must be interpreted to mean that, in accordance with the general system of automatic awards of costs, damages, and losses in the event of a violation of fundamental rights, such an award is always applicable, even in the event that the respondent party issues an administrative or judicial resolution revoking, staying, or suspending the challenged action, unless it is clear and unambiguous in the specific case that no compensable harm of any kind was caused. Only in such circumstances could the respondent Administration be exempted from paying those amounts. Since in this case there is no element that rebuts the presumption that compensable economic damages and losses arose for the protected party from the challenged actions—the concrete determination of which does not fall within the jurisdiction of this court—the granting of this writ must necessarily entail an award of costs, damages, and losses, and I so declare.\n\nAs an additional reason, it is worth noting that the nature and very essence of amparo proceedings do not have as their primary object the analysis of whether damages and losses (daños y perjuicios) exist, but rather whether there are actions or omissions that may generate or cause a breach of the fundamental rights regime of individuals. From that perspective, the analysis conducted by this court focuses on that verification; however, it does not extend to weighing whether those matters have generated or caused injuries in the strictly patrimonial sphere of the protected parties.\n\nAlthough the aforementioned provision 52 of the LJC, on its plain textual reading, establishes that such a judgment — for damages, losses, and costs — operates where applicable, the undersigned do not consider that such a relevance assessment can be automatically excluded a priori in these types of proceedings, insofar as it is within separate ordinary proceedings that it must be determined whether, in the legal relationship analyzed in the amparo petition (recurso de amparo), the conduct or omissions attributable to the Administration (or a private-law entity [sujeto de derecho privado], where applicable) have constituted an adequate cause of patrimonial injuries that are legally compensable.\n\nBy way of reference, Articles 179 through 184 of the Código Procesal Contencioso Administrativo, Ley N° 8508, establish a special proceeding whose purpose is to determine the economic effects arising from judgments issued in these proceedings.\n\nIn light of Article 179 ejusdem, that proceeding has the following purpose:\n\n\"ARTICLE 179. — The Juzgado de lo Contencioso-Administrativo is responsible for enforcing judgments rendered by the Jurisdicción Constitucional in habeas corpus and amparo proceedings against public-law entities, solely with respect to the demonstration, liquidation, and fulfillment of monetary indemnifications.\"\n\nIt is clear that this proceeding is directed at the analysis of the necessary antecedent issued by this Sala Constitucional by way of an abstract judgment (condena en abstracto) on those items, since such claims would not be admissible in those proceedings when the judgment rendered in the amparo proceeding expressly establishes the inadmissibility of damages, losses, and/or costs, or when there is no express ruling on this particular matter.\n\nThat is to say, the special proceeding in the Jurisdicción Contencioso Administrativa requires, as a sine qua non condition, an express judgment or ruling by this Sala Constitucional.\n\nIn that regard, in our view, pursuant to the aforementioned Article 52 of the LJC, exemption from such a patrimonial judgment requires that, in each case, circumstances be established from which the absence of patrimonial injuries — even potential ones — arising from or associated with the facts under review can be found with adequate motivation. Therefore, it is an exception that, as such, requires qualified and duly reasoned application on a case-by-case basis.\n\nThe mere fact that, during the course of the proceedings, the Administration issues a resolution or a judicial judgment is rendered that revokes, halts, or suspends the challenged conduct does not, per se, rule out that, prior to such cessation — whether caused by the respondent entity itself or by an external cause — the alleged indolence or reproached interference may have given rise to damages and losses.\n\nHowever, such a substantive matter — regarding the actual existence of injuries, their amount, timely claim, etc. — involves considerations that fall outside the nature of these proceedings and, pursuant to the provisions of the aforementioned Article 52, are proper to an abstract judgment that subsequently serves as the basis for analysis in the Jurisdicción Contencioso Administrativa.\n\nThe protection sought in these constitutional proceedings does not require proof of damages and losses, since, as has been stressed, that is not their primary object or ratio.\n\nThus, it is not incumbent upon the protected party to claim or prove damages; what they seek is the protection of their fundamental rights.\n\nWhether those administrative acts have caused injuries to the party is a matter that, as a general principle and except in exceptional cases, does not form part of the basis for analysis in this type of proceeding.\n\nIt should be noted that, in the scenario governed by that provision, the Sala Constitucional does not conduct a substantive analysis of the situation to be protected, given that the amparo or habeas corpus proceeding has terminated due to the supervening circumstance already mentioned.\n\nErgo, in these cases, by legal mandate, the court does not assess whether a violation has occurred, and therefore even less can it determine whether, based on what the petitioner has alleged, there may or may not be situations of possible civil reparation.\n\nIn this way, the exemption from judgment referred to in that provision is exceptional in character, not one of general application.\n\nTherefore, in those cases, the provision mandates the abstract judgment, so that its applicability may be analyzed in separate full adversarial proceedings.\n\nOtherwise, if such an exemption from damages, losses, and costs were applied as a general rule, the legal protection of a party who, despite that supervening response from the respondent, may have suffered injuries in their patrimonial sphere would be jeopardized — to the detriment of what is established by Article 45 of the Constitución Política, and disregarding the potential liability of the Administration, as imposed by Article 9 ejusdem.\n\nFurthermore, it must not be overlooked that it was by virtue of such an action that conduct was adopted that brings about the cessation of the behavior that, in theory, threatens or violates the individual's fundamental rights.\n\nThat is to say, in order to obtain the protection of those rights, the individual opted for judicial protection, and it was by virtue of that action that the cessation of the reproached interference occurred.\n\nIt bears repeating that whether the persistence of the threat or deterioration of the party's situation — until it was brought to an end by the causes referred to in the provision under examination — gave rise to damages and losses is a matter that, absent proof to the contrary, must be analyzed within ordinary proceedings, but which, it is reiterated, must under no circumstances be denied as a prerequisite solely because the factual scenario regulated by the aforementioned Article 52 of the LJC has materialized.\n\nTherefore, with the customary respect for the majority position, I express my vote and reiterate that upholding this petition must necessarily entail an abstract judgment for costs, damages, and losses.\n\nIX. — DISSENTING VOTE OF JUSTICE GARRO VARGAS WITH RESPECT TO THE OPERATIVE PART OF THIS JUDGMENT. Article 52 of the Ley de la Jurisdicción Constitucional (LJC) provides: \"If, while the amparo proceeding is in progress, an administrative or judicial resolution is issued that revokes, halts, or suspends the challenged conduct, the petition shall be declared well-founded solely for purposes of indemnification and costs, if applicable.\"\n\nMy interpretation of that provision is as follows: That \"resolution\" encompasses any valid and effective act by which the competent authority restores the enjoyment of the violated right. The phrase \"if applicable\" refers to costs. Moreover, Article 197 of the Código Procesal Contencioso-Administrativo, cited by the majority on the basis of Article 14 of the LJC, refers precisely only to these: to costs.\n\nCertainly, pursuant to Article 48 of the Constitución Política (CP), the essential content of the right to the amparo remedy is not indemnificatory in nature but rather restitutory; however, Article 51 of the LJC provides: \"Any resolution granting the petition shall impose in the abstract an obligation to indemnify for the damages and losses caused and to pay the costs of the proceeding, and their liquidation shall be reserved for the enforcement stage.\"\n\nIf the right has been violated and the Sala Constitucional so finds, even if it has been restored, damages and losses may have arisen. For that reason, an abstract judgment for such damages and losses is appropriate.\n\nIf this were not done — if such a judgment were not issued — and damages and losses had in fact occurred, there would be no legal title — derived from this proceeding — to claim them, which could violate Article 41 of the CP.\n\nIf, despite the abstract judgment having been issued, no damages and losses have been caused, the judge in the ordinary proceedings will so declare, since it is solely within that forum's authority to find proven the actual existence and extent thereof.\n\nWith the thesis defended by the majority, I believe that, contrary to what is sought, it would be encouraging the Administration to respect rights only in the face of an amparo petition.\n\nIt remains to be said that Article 52 of the LJC provides for the possibility that, if deemed just, the Sala Constitucional may impose costs, even when the right has been restored.\n\nFor the foregoing reasons, I partially dissent from the operative part of the judgment and order the judgment for damages and losses, but not for costs.\n\nX. — DOCUMENTATION SUBMITTED TO THE CASE FILE. The petitioning party is hereby notified that if it has submitted any paper documents, as well as objects or evidence contained in any additional electronic, computer-based, magnetic, optical, telematic, or new-technology device, it must retrieve them from the court within a maximum period of 30 business days counted from notification of this judgment. Otherwise, all material not retrieved within this period will be destroyed, pursuant to the provisions of the \"Reglamento sobre Expediente Electrónico ante el Poder Judicial,\" approved by the Corte Plena in session No. 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial No. 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in session No. 43-12 held on May 3, 2012, Article LXXXI.\n\nPor tanto:\n\nThe petition is declared well-founded, without a specific judgment for costs, damages, and losses. Justice Castillo Víquez provides different reasons. Justice Salazar Alvarado partially dissents, solely for indemnification purposes, and orders the respondent party to pay costs, damages, and losses.
