  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-013095-0007-CO \n\nRes. Nº 2026026845\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del diecisiete de julio de dos mil veintiseis .\n\n Recurso de amparo que se tramita en expediente número 26-013095- 0007-CO, interpuesto por Nombre02, a favor de CALA DE PALMAS SOCIEDAD ANÓNIMA, contra la MUNICIPALIDAD DE GARABITO. \n\nResultando:\n\n1.- Por escrito agregado al expediente digital de la Sala el 15:44 horas de 15 de abril de 2026, el recurrente interpone recurso de amparo contra la Municipalidad de Garabito. Manifiesta que es representante de la Sociedad CALA DE PALMAS S.A. Menciona que la sociedad amparada es propietaria de los inmuebles matrícula folio real PRN01 y PRN02, los cuales colindan con Dirección05. Señala que en dicha calle colindante existía una alcantarilla que cumplía una función indispensable para prevenir inundaciones, proteger bienes inmuebles y resguardar la seguridad de las personas. No obstante, reclama que el alcalde de Garabito, sin mediar proceso administrativo previo, decidió de forma unilateral cambiar el sistema de recolección y conducción de las aguas pluviales que discurren en dicha área. Indica que una de las propiedades de su representada se localiza en el área geográfica más baja de la zona, por lo que, por el principio de gravedad, las aguas pluviales que se recogen en toda esa área discurrirán hacia la playa por ese terreno. Alega que la comunicación previa se realizó únicamente mediante publicaciones en redes sociales (Facebook), lo cual no constituye un medio válido de notificación administrativa. Aduce que la eliminación de la alcantarilla ha generado un riesgo grave de inundaciones tanto a las propiedades de su representada como a las demás 50 casas que se comunican a través del camino en el que se eliminó esa estructura. Refiere que la afectación se da desde la óptica ambiental y del peligro que representa para la integridad física de las personas que habitan en la zona. Afirma que, tras la eliminación de la alcantarilla, se creó una especie de represa, creando un tapón que inunda toda el área. Denuncia que no existió un estudio técnico que avale la actuación del alcalde recurrido; tampoco se llevaron a cabo las coordinaciones institucionales que por ley debieron realizarse, lo que generó que el impacto en el entorno sea claro y notorio. Expone que la impericia con la que actuó el alcalde recurrido se puede evidenciar de tres maneras, a saber, con el cambio del entorno paisajístico, con la inundación que se causa por la eliminación de la alcantarilla y con la destrucción de una vía pública. Señala que con la actuación del municipio recurrido no solamente se expone a la pérdida de bienes materiales, sino que además se pone en riesgo vidas humanas, ya que, con la eliminación de la alcantarilla y el bloqueo del paso del agua se genera una presión hidráulica en esa área, y al estar frente al mar, se crea el escenario perfecto para que sean víctimas de un fenómeno meteorológico. Alega que no existe un expediente administrativo en el que conste que se les haya comunicado a los vecinos de la zona sobre las obras que se ejecutaron en esa área, lo que lo lleva a afirmar que tampoco existió un estudio hidrológico o de riesgo, que identificara los potenciales peligros de las obras ejecutadas. Menciona que \"La Laguna Pochotal tiene su ubicación en el extreme oeste y la intervención que realiza el alcalde en la eliminación de la alcantarilla esta se localiza al sur, ósea (sic) FISICAMENTE ES IMPOSIBLE, que se drene de un extreme al otro, ya que en medio no hay drenajes, no hay canales, además físicamente es imposible que el agua circule hacia arriba y transversalmente y se drene la Laguna Pochotal, tal cual busca argumentar en redes sociales el alcalde municipal\". Estima que con los hechos apuntados se lesionaron derechos fundamentales. Solicita la intervención de esta Sala. \n\n2.- En resolución de las 11:56 horas de 12 de mayo de 2026, se da curso al proceso y se solicita informe al Alcalde y al encargado del Departamento de la Zona Marítima Terrestre, ambos de la Municipalidad de Garabito, sobre los hechos alegados por el recurrente. \n\n3.- Mediante escrito agregado al expediente digital a las 15:05 horas el 21 de mayo de 2026, informa bajo juramento Francisco José González Madrigal, en su condición de Alcalde de la Municipalidad de Garabito, que “(…) PRIMERO: Efectivamente se logra constar que las fincas PRN03 y PRN04, son propiedad de la sociedad denominada CALA DE PALMAS S.A, titular de la cédula jurídica 3-101-338004, ambos colindan con Dirección05, camino código CC. 6-11-017 y que por consiguiente se encuentra en administración de éste ente municipal, declarada desde el año 1994, en importante mencionar que, dicha calle es el único acceso a la zona pública de la Playa Hermosa, Jaco, Garabito, al Refugio Nacional de Vida Silvestre Playa Hermosa Punta Mala, hoteles, alojamientos turísticos y viviendas, todo incluido en ese tramo de camino. Ampliando lo anterior, es menester de la recurrida mencionar que, respecto a la Dirección03, ésta se encuentra dentro de los 50 metros dela zona pública. SEGUNDO: Es cierto que en dicha calle se localizaba una alcantarilla, en lo que no lleva razón la recurrente es que, se hubiese colocado para cumplir una función indispensable de prevenir inundaciones, proteger bienes inmuebles y resguardar la seguridad de las personas. En algún momento la vía pública presentó socavamiento y erosión dada la recanalización de la Quebrada Zapote hacia la playa en vez de su curso natural hacia el Estero Los Diegos, situación que provocó la atención de los primeros impactos por parte de la Comisión Nacional de Emergencias, debido a que la colocación de la alcantarilla a la que hace referencia la recurrente erosionó la vía pública, dicha situación fue analizada por Honorable Sala Constitucional mediante el expediente 25-025749-0007-CO. Posteriormente, la colocación de dicha alcantarilla por parte de Administraciones pasadas, estaba provocando la desecación de la Laguna Pochotal, situación que demanda ante el Tribunal Contencioso Administrativo y se tramitó bajo el expediente judicial número 21-008119-1027-CA-5. En dicho proceso mediante la Sentencia No. 2024004850 de las trece horas con treinta y nueve minutos del veintinueve de julio del dos mil veinticuatro, se ordena tanto al Ministerio del Ambiente y Energía y el SINAC, que adopten todas aquellas acciones y planes de ordenamiento a fin de prevenir y combatir la contaminación o la degradación del ecosistema de la Laguna Pochotal, acción que debe imponer la adecuada coordinación con la Municipalidad de Garabito y el SETENA para evitar daños mayores y se procure el resguardo ambiental del ecosistema en cuestión. Así las cosas, ésta Administración en cumplimiento de la Sentencia del Tribunal contencioso Administrativo y del artículo 50 de la Constitución Política, en defensa del ambiente, procedió el 07 de enero del año en curso a la eliminación de la alcantarilla, en la cual desembocaban una serie de canales artificiales que estaban drenando los humedales de la zona, específicamente Laguna Pochotal. Todo lo anterior procurando con esa intervención de retiro la recuperación de los espejos de agua, es indispensable acotar que, la Laguna Pochotal es u humedal de mucha importancia para la conservación de aves, tanto como hábitat, así como zona de alimentación, especialmente durante las épocas de las migraciones, conectando con otras áreas como el Refugio Playa Hermosa – Punta Mala. No es de recibir por parte de la recurrente las manifestaciones que la Municipalidad de forma unilateral decide cambiar el sistema de recolección y conducción de las aguas pluviales que discurren en dicha área, en el tanto existe una sentencia del Tribunal Contencioso Administrativo que así nos obliga, no solo a ésta corporación Municipal, sino a otras instituciones como SETENA, MINAE, SINAC, etc. TERCERO: La administración decide informar por medio de las redes sociales, la intervención que realizaría, la cual fue de tanta importancia que dos días después de haberse retirado la alcantarilla que estaba desecando el humedal denominado Laguna Pochotal, en el ecosistema se logró constatar la presencia de aves en el espejo de agua que recién se comenzaba a recuperar Es importante indicar que las imágenes aportadas por el recurrente no se visualizan, por tal razón no nos referiremos, ya que imposible. CUARTO: En cuanto a este hecho, desconoce ésta Corporación Municipal si lo manifestado por el recurrente es cierto o no, toda vez que no se logra determinar en las imágenes que aporta. Por otro lado, tal y como se indicó en los acápites anteriores, la decisión de retiro de la alcantarilla obedece a una sentencia del Tribunal Contencioso Administrativo. Aunado a lo anterior, el causal de las inundaciones son un conjunto de canalizaciones y alteraciones a los cuerpos de agua, mismos que agradeceríamos a ésta Sala que ordene su eliminación para lograr recuperar el sistema hidrológico de la Laguna, el humedal yl el manglar; que son necesarios para adaptación del cambio climático, abastecimiento de agua potable e integridad del ecosistema. Ahora bien, en cuanto a la supuesta y eventual afectación que reclama la sociedad recurrente, es importante señalar, que en las propiedades a saber PRN03 y PRN04, no existen construcciones, ni tampoco hay construcciones cercanas a la Laguna Pochotal. Es indispensable que se mencione por parte de ésta representación que, la única excepción a la Ley de zona Marítimo Terrestre, lo es la Ciudad de Jacó, por lo que, en Playa Hermosa es aplicable la Ley 6043, por lo que en este caso, y en cuanto a todas las propiedades que se encuentran en dicho sector, al incorporar áreas de dominio público de la Zona Restringida, en la zona marítimo terrestre, tienen un vicio de nulidad absoluta, por contravenir los principios de Inalienabilidad e Imprescriptibilidad de los bienes demaniales. Así las cosas, la Procuraduría General de la República, mediante el dictamen C-132-2019, señala que, cuando la Municipalidad tenga cuestionamientos fundados en estudios de asientos registrales y de la eventual titulación, acerca de la validez de inscripciones, titulaciones y escrituras a favor de un particular sobre inmuebles inscritos previo a la entrada en vigencia del Transitorio III de la Ley 4558 que incorporan áreas de dominio público de la zona restringida en la zona marítimo terrestre, ha de interponerse ante la jurisdicción Contencioso Administrativa y civil de hacienda, la acción de nulidad y solicitar las medidas cautelares procedentes, mismas que están considerando mi representada en presentar. Siguiendo ésa misma línea, todas las propiedades a las que hicimos referencia, podrían tener una nulidad absoluta, al haberse inscrito bienes demaniales como propiedad privada, y que incluso no tienen construcción, por lo que NO existen ninguna afectación a los bienes inmuebles propiedades del recurrente, mucho menos a la integridad física de persona, el señor Nombre02 en su condición de secretario de la plaza recurrente, está reclamando contra una acción respaldada en una sentencia judicial (2024004850 de las trece horas con treinta y nueve minutos del veintinueve de julio del dos mil veinticuatro, del Tribunal contencioso Administrativo) y el retiro de la alcantarilla por parte de mi representada se realizó en procura de la protección del medio ambiente, sin tener un riesgo real. Claramente la recurrente, desconoce la sentencia judicial a la que se hace referencia en este informe, toda vez que indica que “obligatoriamente otras instituciones tuvieron que haber intervenido”, y sí hubo intervención de otras instituciones, incluso se adjunta a este informe el oficio CARTA-SINAC-ACOPAC-DR-0587-2025, del 26 de agosto del 2025, en el cual en resumen dicha dirección NO tiene ningún inconveniente para que se realicen las obras requeridas, también, contaba ésta administración con el oficio CARTAMOPT-DVOP-MRPC-2026-01, del 14 de enero del 2025, en el cual e confirma que la competencia sobre el camino con código PRN05, es competencia de la Municipalidad de Garabito. QUINTO: En cuanto a la foto a la que hace referencia el recurre, es indispensable mencionar que ésta representación se encuentra impedida en referirse, por cuanto no permite identificar claramente sus elementos y no es clara para la respectiva valoración, es decir, no se logra. Sin embargo, se informa a ésta Honorable Sala que, los propietarios de varias fincas, coordinaron entre ellos y realizaron en sus inmuebles un canal de evacuación pluvial, que recolecta las aguas de la Dirección01 y las lleva hasta el estero Los Diegos, ese canal va sobre terreno privados de manera interna y no hay afectación a la Laguna ni al cauce de dominio público, dicho canal de aproximadamente de 3 kilómetros. SEXTO: Señala la recurrente tres cargos específicos a saber: 1. Cambio del entorno paisajístico y entrada de maquinaria a la playa. 2. Inundaciones causadas por la remoción de la alcantarilla con responsabilidad directa del alcalde municipal. 3. Destrucción de vía pública con riesgos para la vida de los vecinos por presión hidráulica. Cargo 1. La recurrente afirma que la Ley 6043 prohíbe cambiar el entorno de la playa, sin embargo, la actuación del alcalde no tuvo como objeto modificar el entorno de la playa, sino ejecutar trabajos sobre un camino público de administración de mi representada en cumplimiento del mandato judicial. La zona de trabajo es infraestructura vial municipal, no zona pública marítimo terrestre. Si la maquinaria transitó en algún momento por zonas adyacentes fue con el propósito exclusivo y técnicamente necesario de ejecutar la obra ordenada. De la lectura de la sentencia 2024004850 de las trece horas con treinta y nueve minutos del veintinueve de julio del dos mil veinticuatro, del Tribunal contencioso Administrativo), se determina que ordena adoptar acciones para prevenir la degradación del ecosistema de la Laguna Pochotal y para ejecutar esa orden se requería el uso de maquinaria, la administración no podía cumplir una sentencia judicial con escoba y pala. Cargo 2. La existencia de agua en la zona (ya que es un humedal), no prueba por sí sola que la causa sea la remoción de la alcantarilla, es decir, no demuestra la recurrente que la alcantarilla fuera la única o principal vía de drenaje. Lo pertinente era aportar un informe técnico de ingeniería o hidrología que explicara el comportamiento hídrico natural de la zona y demostrara que el agua proviene de escorrentía natural de las tierras altas, independientemente de la alcantarilla. Aún si hubiere algún efecto hídrico, la responsabilidad no recae en mi representada por cuanto actúa en cumplimiento de una orden judicial. La fuente de la obligación es el Tribunal Contencioso Administrativo, y no solo está involucrada la Municipalidad de Garabito sino diferentes instituciones, en caso de haber daño resarcible, el análisis de la responsabilidad es institucional y debe ventilarse en la vía contencioso administrativa de daños, no en un amparo. Cargo 3. Sobre el presunto riesgo de vida por presión hidráulica, es especulativo, la recurrente está realizando un escenario hipotético de desastre meteorológico a futuro, el amparo tutela derechos amenazados de forma cierta, actual e inminente, no escenarios conjeturales. Además, precisamente la Laguna Pochotal sin la alcantarilla que desvía sus aguas recupera su función natural de regulación hídrica, lo que a largo plazo reduce el riesgo hidráulico en la zona costera. Integralmente, deja claro ésta representación que, la recurrente invierte la lógica de la situación: la alcantarilla que se removió era precisamente el elemento artificial que alteraba el ciclo hídrico natural de la Laguna Pochotal, degradando el ecosistema que la sentencia de marras ordenó proteger. El recurrido no creó un riesgo; actuó para eliminar la causa de un daño ambiental ya declarado judicialmente. Las eventuales consecuencias de adaptación hídrica que pueda presentarse en el proceso de restauración del espejo de agua no son imputables a una actuación arbitraria, sino al cumplimiento de una obligación constitucional de protección ambiental (artículo 50 de la Constitución Política). SETIMO: Debemos indicar que, al existir una sentencia del Tribunal Contencioso Administrativo, en la cual ordena al Estado por medio del MINAE y el SINAC, en coordinación con la Municipalidad de Garabito y SETENA, enfocada en que se adopten todas aquellas acciones y planes de ordenamiento a fin de prevenir y combatir la contaminación o la degradación del ecosistema de la Laguna Pochotal, para evitar daños mayores, sin obviar la evaluación del impacto ambiental, la remoción de la alcantarilla NO fue una decisión discrecional del Alcalde, sino el cumplimiento de una obligación jurídica impuesta por el Poder Judicial. El Alcalde Municipal no podía notificar previamente ni abrir procedimiento administrativo previo porque estaba vinculado por una orden judicial de acatamiento obligatorio, el hecho denegarse o dilatar la ejecución habría configurado desacato. Indica la recurrente que existió una violación a varios principios constitucionales, a lo que mi representada se referirá de la siguiente manera: i. Debido Proceso; la remoción de la alcantarilla fue una obra realizada sobre una vía pública de administración cantonal, es decir, en bienes del dominio público Dirección04, la recurrente no tiene derecho subjetivo consolidado sobre infraestructura pública. El debido proceso lo que protege son derechos e intereses legítimos propios, no el mantenimiento indefinido de una obra de dominio público. ii. Tutela Administrativa / Tutela Ilusoria; no hay indefensión cuando existe una sentencia previa que ordenó la actuación, precisamente la existencia del proceso contencioso administrativo demuestra que hubo un procedimiento, solo que la recurrente no fue parte en ese expediente posiblemente lo desconociera, pero eso no convierte a la actuación de la Municipalidad en arbitraria. iii. Participación Ciudadana; ésta participación no otorga derecho de veto sobre la ejecución de sentencias judiciales firmes, mi representada no puede someter el cumplimiento de una orden judicial a consulta vecinal como pretendía la recurrente. iv. Confianza Legítima; en cuanto a este principio, es necesario que la Administración haya generado una expectativa válida, estable y lícita. La colocación, cambio o remoción de una alcantarilla sobre un bien de dominio público no genera un derecho adquirido a la recurrente, especialmente cuando su existencia era incompatible con una sentencia judicial, por cuanto provocaba daño al medio ambiente. La actuación del alcalde Municipal no fue arbitraria como lo ha querido hacer ver la recurrente a lo largo de este recurso y mucho menos violatoria de derechos fundamentales; sino, más bien, fue en cumplimiento de una obligación impuesta por sentencia, sobre bienes de dominio público, en tutela del interés colectivo ambiental. Así las cosas, no existía margen para notificación previa ni procedimiento administrativo autónomo, pues la fuente de la obligación era judicial, no discrecional. OCTAVO: La recurrente señala en este hecho una premisa falsa: que mi representada actuó de manera autónoma y caprichosa, la realidad jurídica es la opuesta señores honorables de ésta Sala; como se ha venido exponiendo en los acápites anteriores existe una sentencia del Tribunal Contencioso Administrativo que ordenó la actuación y eso lo cambia todo. Invoca el representante de la plaza Cala de Palmas S.A, el artículo 128 de la Ley General de la Administración pública para sostener que sin expediente el acto es nulo, este argumento se vuelve en contra de ella, toda vez que, el expediente existe, además, hay dos expedientes judiciales sobre este mismo tema, los cuales indico: 24-008119-1027-CA y 26-000400-0007-CO. Esos expedientes contienen los hechos, las pruebas, los fundamentos técnicos y la norma aplicada. La Municipalidad no estaba construyendo un acto administrativo discrecional nuevo; estaba ejecutando una sentencia judicial, pretender la recurrente que debía mi representada abrir un expediente administrativo paralelo para ejecutar lo que un Tribunal ya resolvió es jurídicamente absurdo y vaciaría de contenido la cosa juzgada. Respecto del artículo 33 de LGAP, sobre la motivación obligatoria, afirmamos que dicha motivación es la propia sentencia del TCA. No existe motivación más sólida en derecho que una orden judicial. Indica la recurrente que hay una Ausencia de estudios hidrológicos, sin embargo, el principio precautorio opera ante ausencia de certeza científica y en el caso en concreto NO hay ausencia de certeza, toda vez que, hay una sentencia judicial que determinó que la Laguna Pochotal estaba siendo degradada y ordenó su recuperación. Esa determinación judicial se funda en criterios técnicos y científicos ya valorados en el proceso contencioso administrativo. La recurrente no puede invocar el principio precautorio para paralizar la ejecución de una sentencia cuyo sustento técnico ya fue evaluado por un tribunal competente. Existe error conceptual grave, al usar como argumento el recurrente la presunta violación al Principio de No Regresión Ambiental, este principio prohíbe retroceder en el nivel de protección ambiental ya alcanzado. La alcantarilla que se removió era precisamente el instrumento que mantenía degradado el ecosistema de la Laguna Pochotal, incluso a los dos días ya se lograba ver el avance en la recuperación del espejo de agua, pues se visualizó presencia de aves en dicho lugar. Quien violaba la no regresión ambiental era la alcantarilla misma, al desviar aguas que debían alimentar la laguna. El alcalde no regresó en materia ambiental; avanzó, en cumplimiento del mandato constitucional del artículo 50 y de la sentencia judicial. El artículo 16 de la LGAP, exige que los actos se basen en hechos ciertos y verdaderos, los hechos en este caso fueron establecidos por el propio TCA en sentencia y la Municipalidad no necesitaba re-demostrar lo que ya fue probado judicialmente. Es constitucionalmente inaceptable, exigir estudios técnicos propios para ejecutar una sentencia equivale a someter la cosa juzgada a revisión administrativa. No existe en el caso en concreto, responsabilidad personal del alcalde, toda vez que, este no incurrió en dolo o culpa grave en una actuación ilegítima. Reiteramos que, si hay responsabilidad institucional por eventuales daños colaterales del proceso de restauración ambiental, esa discusión corresponde a la vía contencioso-administrativa de daños y perjuicios, con prueba técnica pericial. No es materia de amparo constitucional. La parte recurrente pretende que la honorable Sala declare inconstitucional la ejecución de una sentencia judicial firme dictada por un tribunal de la República. NOVENO: La recurrente afirma que el Alcalde carece de competencia funcional, pero está equivocada, ya que es lo contrario, esto con fundamento del artículo 169 de la Constitución Política y el Código Municipal, que establecen que las municipalidades administran los intereses y servicios locales, incluyendo la infraestructura vial cantonal. La alcantarilla removida estaba en un camino público de administración municipal, el alcalde actuó sobre tres títulos de competencia simultáneos a saber: a) Dentro de su territorio. b) Sobre bienes de en su administración. c) En cumplimiento de una orden judicial. Sobre la propiedad privada, la recurrente no acredita en este recurso que la alcantarilla se encontraba en terreno de su propiedad, una alcantarilla en vía pública es una infraestructura pública, no hay derecho de propiedad privada que oponer. DECIMO: Pretende la recurrente hacer incurrir en error a la Honorable Sala, señalando que el área está fuera de influencia de la Laguna Pochotal, sin embargo, la delimitación del área de influencia de un ecosistema no la determina un vecino colindante con una ilustración (imposible de visualizar), adjunta. Esa es una determinación técnica que corresponde a SINAC, MANE y SETENA, instituciones que participaron en el proceso contencioso administrativo. Si el TCA ordenó actuar para recuperar la laguna, es porque técnica y jurídicamente quedó establecido que la intervención era necesaria y pertinente. Una ilustración aportada por la parte interesada no desvirtúa una sentencia. El alcalde municipal mediante una publicación por redes sociales de la Municipalidad publicó que las aves habían retronado a la Laguna Pochotal dos días después de haber removida la alcantarilla, pero no es prueba de arbitrariedad, sino prueba de que la restauración ambiental está funcionando. La recurrente pretende que proteger un ecosistema declarado degradado judicialmente constituye abuso de poder. Todo lo anterior sirve de fundamento para que la Sala rechace de plano ese razonamiento. CONCLUSIONES. – La parte recurrente pretende que esta Sala Constitucional declare inconstitucional la ejecución de una sentencia firme del Tribunal Contencioso Administrativo, dictada en tutela del derecho constitucional a un ambiente sano y ecológicamente equilibrado que garantiza el artículo 50 de la Constitución Política, mi representada con el presente informe ha demostrado que: • La remoción de la alcantarilla no fue una decisión discrecional ni arbitraria del alcalde municipal, sino el cumplimiento de una obligación jurídica impuesta por sentencia judicial. • La actuación se ejecutó sobre infraestructura ubicada en un camino público de administración cantonal, dentro de la competencia funcional plena de la Municipalidad de Garabito conforme al artículo 169 constitucional. • No existe derecho fundamental vulnerado, pues no acredita la recurrente un derecho subjetivo consolidado sobre infraestructura pública, ni demuestra afectación cierta, actual y directa a ningún derecho constitucional tutelable mediante amparo. • Los argumentos de ausencia de expediente, falta de estudios técnicos y violación al principio precautorio quedan desvirtuados por la existencia del expediente judicial del proceso contencioso administrativo, cuya sentencia firme constituye el fundamento legal, técnico y científico de toda la actuación municipal. • Acoger este recurso equivaldría a subordinar la ejecución de sentencias judiciales firmes al veto de particulares con intereses privados, vaciando de contenido la cosa juzgada y premiando el incumplimiento de órdenes judiciales”. Solicita se declare sin lugar el recurso. \n\n4.- Mediante escrito agregado al expediente digital a las 15:05 horas el 21 de mayo de 2026, informa bajo juramento Yajaira Valverde Acuña, en su condición de encarga a.i. de la Zona Marítima Terrestre de la Municipalidad de Garabito, que “(…) Ubicación de la alcantarilla: De acuerdo al oficio MG-ST-TOP-2025-059-BBA, el cual adjunto; la alcantarilla objeto del presente recurso de amparo, se localiza en el derecho de vía y no en la zona pública de la zona marítimo terrestre de Garabito, por tanto, no es competencia de este sub proceso; sin embargo, y tal y como se indica en la página tres (3) del citado recurso “por principio de gravedad las aguas pluviales que se recogen de toda esa área discurrirán hacia la playa”, bajo esa premisa resulta necesario emitir el siguiente criterio: Criterio técnico sobre aguas pluviales que desfogan al mar dentro de la Zona Marítimo Terrestre. I. Antecedentes PRIMERO: Que corresponde a la Municipalidad, mediante el Subproceso de Zona Marítimo Terrestre, ejercer las competencias de administración, vigilancia y protección de los bienes demaniales ubicados dentro de la Zona Marítimo Terrestre. SEGUNDO: Que se requiere emitir criterio técnico respecto a las aguas pluviales que descargan o desfogan hacia el mar y su eventual incidencia sobre el espacio territorial comprendido dentro de la Zona Marítimo Terrestre. TERCERO: Que las aguas pluviales, aunque constituyen escorrentías naturales derivadas de precipitaciones, pueden generar procesos de erosión, arrastre de sedimentos, modificación de cauces naturales, afectación a ecosistemas costeros y alteraciones físicas sobre bienes de dominio público cuando no existe un adecuado manejo hidráulico, en el caso que nos ocupa la ubicación de la alcantarilla delimita con El Refugio Natural Punta Mala, esta área silvestre fue creada mediante Decreto Ejecutivo N- 27210, del 16 de abril de 1998, y ampliado, según Decreto N°-33044, del 03 de mayo del 2002, es fundamental en la conservación y protección de la playa de anidación para la tortuga lora (Lepidochelys olivacea). Posteriormente, en el año 2002, dicha área protegida amplio sus límites originales para la protección de otras especies y ecosistemas de importancia biológica y por su ubicación este refugio puede verse seriamente afectado por el desfogue de la citada alcantarilla. II. Marco jurídico aplicable Constitución Política de Costa Rica Artículo 50: “Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado…” Ley sobre la Zona Marítimo Terrestre N.° 6043 Artículo 1: “La zona marítimo terrestre constituye parte del patrimonio nacional, pertenece al Estado y es inalienable e imprescriptible…” Este artículo establece la naturaleza demanial de la Zona Marítimo Terrestre y la obligación estatal de protección y conservación de sus recursos Artículo 3: “Corresponde a las municipalidades velar directamente por el cumplimiento de las normas referentes al dominio, desarrollo y aprovechamiento de la zona marítimo terrestre…” Esta disposición atribuye competencia directa a la Municipalidad para realizar labores de vigilancia, control y emisión de criterios técnicos sobre situaciones que puedan afectar la integridad física y ambiental de la ZMT. Artículo 7: “Los terrenos situados en la Zona Marítimo Terrestre no pueden ser objeto de informaciones posesorias y los particulares no podrán apropiarse de ellos ni legalizados a su nombre…” Este artículo reafirma el carácter de dominio público de la ZMT y la obligación de la Administración de resguardar su integridad y uso conforme al interés general. Artículo 9:“La zona marítimo terrestre es la franja de doscientos metros de ancho a lo largo de los litorales…” Ley Orgánica del Ambiente N.° 7554 En aplicación de los principios preventivo y precautorio, la Administración Pública debe adoptar medidas dirigidas a evitar afectaciones ambientales cuando exista posibilidad de deterioro de recursos naturales o bienes públicos. Ley General de la Administración Pública Artículo 113:“La Administración deberá servir con objetividad los intereses generales…” La actuación administrativa debe orientarse a la protección del interés público y a la conservación adecuada de los bienes sometidos a administración estatal. III. Análisis técnico De conformidad con la normativa citada, las aguas pluviales que descargan o desfogan hacia el mar pueden producir efectos físicos y ambientales sobre el espacio correspondiente a la Zona Marítimo Terrestre, particularmente cuando dichas descargas generan procesos erosivos en playa o zona costera, provocan arrastre y depósito de sedimentos, transportan residuos sólidos o contaminantes, alteran drenajes naturales existentes afectan ecosistemas costeros o marinos o modifican las condiciones naturales del dominio público. Debe considerarse que la existencia de una descarga pluvial hacia el mar no constituye por sí misma una condición irregular, debido a que puede responder a procesos naturales de drenaje; sin embargo, cuando existan obras artificiales, canalizaciones, modificaciones de cauces o intervenciones humanas que alteren las condiciones naturales del área, corresponde a la Administración efectuar la valoración técnica y jurídica correspondiente. En virtud de las competencias atribuidas a la Municipalidad mediante la Ley N.° 6043, el Subproceso de Zona Marítimo Terrestre se encuentra facultado para valorar los posibles efectos sobre bienes de dominio público y emitir recomendaciones dirigidas a garantizar la conservación y protección de la Zona Marítimo Terrestre. IV. Conclusión técnica Con fundamento en la Constitución Política, la Ley sobre la Zona Marítimo Terrestre N.° 6043, la Ley Orgánica del Ambiente N.° 7554 y la Ley General de la Administración Pública, este Subproceso concluye que: La Zona Marítimo Terrestre constituye un bien de dominio público sujeto a protección especial por parte de la Administración. La Municipalidad posee competencia legal para analizar y emitir criterios técnicos respecto de situaciones que puedan afectar las condiciones físicas, ambientales o funcionales de la Zona Marítimo Terrestre. Las descargas de aguas pluviales hacia el mar deben valorarse desde una perspectiva técnica y preventiva a efectos de determinar si producen alteraciones al dominio público o impactos ambientales relevantes”. Solicita se declare sin lugar el recurso. \n\n5.- En los procedimientos seguidos se han observado las prescripciones legales. \n\n Redacta el Magistrado Araya García; y,\n\nConsiderando:\n\n I.- Cuestión Preliminar. De previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe aclararse que, a partir de la sentencia No. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa -con algunas excepciones-, aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -instruido de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en este caso, se plantea un supuesto de excepción, pues, se está ante una denuncia interpuesta por la eliminación de una alcantarilla, la cual, presuntamente, afecta la integridad física de las personas, el ambiente y los bienes de los vecinos de la zona, que no ha sido resuelta. Aclarado el punto, se entra a resolver la situación concreta planteada en este amparo.\n\n II.- Objeto del recurso. Alega el recurrente en su condición de representante de Cala de Palmas S.A., que la Municipalidad de Garabito por decisión unilateral y sin estudios técnicos previos, eliminó una alcantarilla destinada al manejo de aguas pluviales, generando un riesgo de inundaciones que amenaza la integridad física de las personas, el ambiente y los bienes de los vecinos de la zona, lo que estima lesivo de sus derechos fundamentales.\n\n III.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:\n\n1) El recurrente es el representante legal de Cala de Palmas S.A., la cual es propietaria de las fincas No. PRN03 y No. PRN06 ambas colindan con Dirección05 (ver informe rendido por la autoridad recurrida). \n\n2) En algún momento la vía pública presentó socavamiento y erosión dada la recanalización de la Quebrada Zapote hacia la playa en vez de su curso natural hacia el Estero Los Diegos (ver informe rendido por la autoridad recurrida).\n\n3) La colocación de la alcantarilla provocaba la desecación de la Laguna Pochotal, situación que fue denunciada ante el Tribunal Contencioso Administrativo y se tramitó bajo el expediente judicial número 21-008119-1027-CA-5 (ver informe rendido por la autoridad recurrida).\n\n4) Mediante la Sentencia No. 2024004850 de las 13:39 horas de 29 de julio de 2024 el Tribunal Contencioso Administrativo ordenó al Ministerio del Ambiente y Energía y el SINAC, que adopten todas aquellas acciones y planes de ordenamiento a fin de prevenir y combatir la contaminación o la degradación del ecosistema de la Laguna Pochotal, acción que debe imponer la adecuada coordinación con la Municipalidad de Garabito y el SETENA para evitar daños mayores y se procure el resguardo ambiental del ecosistema en cuestión (ver informe rendido por la autoridad recurrida).\n\n5) La Municipalidad de Garabito informó a los vecinos de la zona por medio de las redes sociales, la intervención que realizaría (ver informe rendido por la autoridad recurrida).\n\n6) El 7 de enero de 2026, la autoridad recurrida realizó la eliminación de la alcantarilla, en la cual desembocaban una serie de canales artificiales que estaban drenando los humedales de la zona, específicamente Laguna Pochotal (ver informe rendido por la autoridad recurrida).\n\n IV.- Sobre el caso concreto. En el sub lite, la parte recurrente acusa que la Municipalidad de Garabito por decisión unilateral y sin estudios técnicos previos, eliminó una alcantarilla destinada al manejo de aguas pluviales, generando un riesgo de inundaciones que amenaza la integridad física de las personas, el ambiente y los bienes de los vecinos de la zona, lo que estima lesivo de sus derechos fundamentales. \n\nAl respecto, esta Sala verifica que, en el caso concreto, efectivamente, se tiene conocimiento que la sociedad Cala de Palmas S.A., representada por el recurrente, es propietaria de las fincas No. PRN03 y No. PRN04, ambas colindantes con una Dirección05. Asimismo, la referida vía presentó problemas de socavamiento y erosión como consecuencia de la recanalización de la Quebrada Zapote hacia la playa, en lugar de seguir su curso natural hacia el Estero Los Diegos. Igualmente, consta que la alcantarilla existente en el sitio contribuía al proceso de desecación de la Laguna Pochotal, circunstancia que es de conocimiento de las autoridades jurisdiccionales debido a que se formuló una denuncia ante el Tribunal Contencioso Administrativo dentro del expediente judicial No. 21-008119-1027-CA-5. En ese proceso, mediante sentencia No. 2024004850 de las 13:39 horas del 29 de julio de 2024, se ordenó al Ministerio de Ambiente y Energía y al Sistema Nacional de Áreas de Conservación adoptar las medidas y acciones necesarias para prevenir y combatir la contaminación y degradación del ecosistema de la Laguna Pochotal, en coordinación con la Municipalidad de Garabito y la Secretaría Técnica Nacional Ambiental, a fin de evitar mayores afectaciones y garantizar la protección de dicho humedal. Posteriormente, la Municipalidad de Garabito informó a los vecinos de la zona, por medio de redes sociales, sobre las obras que serían ejecutadas. Finalmente, el 7 de enero de 2026 procedió a eliminar la alcantarilla en la que desembocaban diversos canales artificiales que drenaban los humedales del sector, particularmente la Laguna Pochotal.\n\n En consecuencia, este Tribunal descarta la lesión de los derechos fundamentales de la parte amparada. Nótese que, la autoridad recurrida actúa en cumplimiento de una sentencia dictada por parte del Tribunal Contencioso Administrativo. Asimismo, esta Sala no puede calificar como arbitraria una actuación administrativa ejecutada en cumplimiento de una sentencia judicial firme, pues la administración se encuentra obligada a acatar las resoluciones emanadas de la autoridad jurisdiccional competente. Máxime en este caso en el que se protege el humedal. Cualquier desacuerdo con el contenido o alcance de dicha orden debe ventilarse ante la jurisdicción que la emitió y no mediante el recurso de amparo. Aunado a lo anterior, de los autos no se evidencia que exista actuación o denuncia alguna pendiente de resolver. Bajo ese orden de ideas, considera esta Sala que el recurso debe ser declarado sin lugar. \n\nV.- Nota del magistrado Rueda Leal. Debo advertir que desde la sentencia nro. 2019002355 de las 9:30 de 12 de febrero de 2019, mi postura ha sido la siguiente en relación con los recursos de amparo cuando estos han sido planteados a favor de una persona jurídica:\n\n“…en la Opinión Consultiva 22-16 del 26 de febrero de 2016, la Corte Interamericana de Derechos Humanos indicó que si bien algunos Estados reconocen el derecho de petición a personas jurídicas con condiciones especiales, como lo son los sindicatos, partidos políticos o representantes de pueblos indígenas, comunidades afrodescendientes o grupos específicos, lo cierto es que “El artículo 1.2 de la Convención Americana sólo consagra derechos a favor de personas físicas, por lo que las personas jurídicas no son titulares de los derechos consagrados en dicho tratado”. Por otro lado, en la misma opinión consultiva, la Corte Interamericana dispuso que, en ciertos contextos particulares, las personas físicas pueden llegar a ejercer sus derechos a través de personas jurídicas (verbigracia, a través de un medio de comunicación, como acaeció en el caso Nombre01 y otros contra Venezuela); empero, a efectos de que ello sea tutelable ante el sistema interamericano, “el ejercicio del derecho a través de una persona jurídica debe involucrar una relación esencial y directa entre la persona natural que requiere protección por parte del sistema interamericano y la persona jurídica a través de la cual se produjo la violación, por cuanto no es suficiente con un simple vínculo entre ambas personas para concluir que efectivamente se están protegiendo los derechos de personas físicas y no de las personas jurídicas. En efecto, se debe probar más allá de la simple participación de la persona natural en las actividades propias de la persona jurídica, de forma que dicha participación se relacione de manera sustancial con los derechos alegados como vulnerados.” (énfasis agregado) (OC. 22/16)”. \n\nEn el sub lite, si bien el recurso de amparo es interpuesto a favor de Cala de Palmas S. A., de la lectura del escrito de interposición se desprende que hay una serie de personas físicas que se ven afectadas por la situación reclamada, de modo que existe una relación esencial entre la argüida afectación a una persona jurídica y la eventual lesión a una física, lo que justifica el análisis de lo alegado con miras a determinar si se ha dado o no una vulneración a algún derecho fundamental. Justamente, a partir de la fundamentación de esta sentencia, concuerdo con la desestimación del amparo.\n\nVI.- Documentación aportada al expediente. Se previene a la parte que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 de 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial número 19 de 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI.\n\nPor tanto:\n\nSe declara sin lugar el recurso. San José, at 9:25 a.m. on 17 July 2026.\n\nAmparo proceeding filed in case number 26-013095-0007-CO by Nombre02 on behalf of CALA DE PALMAS SOCIEDAD ANÓNIMA, against the MUNICIPALITY OF GARABITO.\n\nBackground:\n\n1.- In a submission added to the Chamber’s digital case file at 15:44 on 15 April 2026, the applicant files an amparo proceeding against the Municipality of Garabito. He states that he is the representative of CALA DE PALMAS S.A. He says the company protected by the amparo owns the properties registered under real folio numbers PRN01 and PRN02, which border Dirección05. He points out that a culvert on that adjoining street served an essential function in preventing flooding, protecting real property, and safeguarding people’s safety. Nevertheless, he complains that the mayor of Garabito unilaterally decided, without any prior administrative proceeding, to change the system for collecting and conveying the stormwater flowing through that area. He indicates that one of his client’s properties is located in the lowest geographic area of the zone, so, by the principle of gravity, stormwater collected throughout the area will flow toward the beach across that land. He alleges that prior notice was given only through social media posts (Facebook), which is not a valid means of administrative notification. He argues that removing the culvert has created a serious risk of flooding both to his client’s properties and to the other 50 houses connected by the road where the structure was removed. He says the harm concerns both the environment and the danger posed to the physical integrity of people living in the area. He asserts that removing the culvert created a kind of dam, forming a blockage that floods the entire area. He alleges that no technical study supported the challenged mayor’s actions; nor was the interagency coordination required by law carried out, resulting in a clear and noticeable impact on the surroundings. He explains that the challenged mayor’s incompetence is evident in three ways: the change to the landscape, the flooding caused by removing the culvert, and the destruction of a public road. He points out that the actions of the challenged municipality expose people not only to the loss of material possessions but also put human lives at risk, since removing the culvert and blocking the water’s passage creates hydraulic pressure in that area and, given its location in front of the sea, creates the perfect conditions for people to become victims of a meteorological event. He alleges that there is no administrative case file showing that the area’s neighbors were notified about the works carried out there, leading him to assert that no hydrological or risk study was conducted to identify the potential dangers of those works. He states that “Laguna Pochotal is located at the extreme west and the intervention carried out by the mayor in removing the culvert is located to the south, that is (sic), IT IS PHYSICALLY IMPOSSIBLE to drain from one extreme to the other, since there are no drains or channels in between; it is also physically impossible for the water to flow upward and transversely and drain Laguna Pochotal, as the municipal mayor seeks to argue on social media.” He considers that the facts described violated fundamental rights. He requests the intervention of this Chamber.\n\n2.- By order issued at 11:56 a.m. on 12 May 2026, the proceeding was admitted and a report was requested from the Mayor and the person in charge of the Maritime Terrestrial Zone Department, both of the Municipality of Garabito, regarding the facts alleged by the applicant.\n\n3.- In a submission added to the digital case file at 15:05 on 21 May 2026, Francisco José González Madrigal, in his capacity as Mayor of the Municipality of Garabito, reports under oath that “(…) FIRST: It has indeed been established that properties PRN03 and PRN04 are owned by the company CALA DE PALMAS S.A., corporate identification number 3-101-338004, and both border Dirección05, road code CC. 6-11-017, which has consequently been administered by this municipal entity since 1994. It is important to mention that this street is the only access to the public area of Playa Hermosa, Jaco, Garabito, the Playa Hermosa Punta Mala National Wildlife Refuge, hotels, tourist accommodations, and residences, all located along that stretch of road. To expand on the foregoing, the respondent must mention that Dirección03 is within the 50-meter public zone. SECOND: It is true that there was a culvert on that street. The applicant is mistaken, however, in claiming it was installed to serve an essential function in preventing flooding, protecting real property, and safeguarding people’s safety. At one point the public road suffered subsidence and erosion because Quebrada Zapote was rerouted toward the beach instead of following its natural course toward Estero Los Diegos. This situation prompted the National Emergency Commission to address the initial impacts, because the installation of the culvert referred to by the applicant eroded the public road. That situation was reviewed by the Honorable Constitutional Chamber in case 25-025749-0007-CO. Subsequently, the installation of that culvert by prior administrations was causing Laguna Pochotal to dry out. This situation was brought before the Administrative Litigation Court and processed under judicial case number 21-008119-1027-CA-5. In that proceeding, Judgment No. 2024004850, issued at 13:39 on 29 July 2024, ordered both the Ministry of Environment and Energy and SINAC to adopt all actions and planning measures needed to prevent and combat pollution or degradation of the Laguna Pochotal ecosystem. This action must ensure proper coordination with the Municipality of Garabito and SETENA to prevent further harm and safeguard the environment of the ecosystem in question. Accordingly, in compliance with the Administrative Litigation Court’s judgment and Article 50 of the Constitution, and in defense of the environment, this Administration removed the culvert on 7 January of this year. A series of artificial channels that were draining the area’s wetlands, specifically Laguna Pochotal, emptied into it. The removal intervention sought to restore the water surfaces. It is essential to note that Laguna Pochotal is a wetland of great importance for bird conservation, both as habitat and as a feeding area, especially during migration periods, and is connected to other areas such as the Playa Hermosa – Punta Mala Refuge. The applicant’s statements that the Municipality unilaterally decided to change the system for collecting and conveying stormwater flowing through that area cannot be accepted, since an Administrative Litigation Court judgment requires us to do so—not only this municipal corporation but also other institutions such as SETENA, MINAE, SINAC, etc. THIRD: The Administration decided to inform the public through social media about the intervention it would carry out. Its importance was such that, two days after removal of the culvert that was drying out the wetland called Laguna Pochotal, birds were observed in the ecosystem’s water surface, which had only just begun to recover. It is important to indicate that the images submitted by the applicant are not visible, so we will not address them, as that is impossible. FOURTH: As to this allegation, this municipal corporation does not know whether what the applicant says is true, since that cannot be determined from the images he submitted. Moreover, as indicated in the preceding sections, the decision to remove the culvert followed a judgment of the Administrative Litigation Court. In addition, the cause of the flooding is a set of channels and alterations to water bodies. We would ask this Chamber to order their removal so that the hydrological system of the lagoon, the wetland, and the mangrove can be restored; these are necessary for climate-change adaptation, drinking-water supply, and ecosystem integrity. As for the alleged and potential harm claimed by the applicant company, it is important to point out that there are no buildings on properties PRN03 and PRN04, and no buildings near Laguna Pochotal. This representative must emphasize that the only exception to the Maritime Terrestrial Zone Law is the City of Jacó. Accordingly, Law 6043 applies in Playa Hermosa. In this case, and as to all properties in that sector, incorporating public-domain areas of the Restricted Zone into the maritime terrestrial zone renders them absolutely void for contravening the principles of inalienability and imprescriptibility applicable to public-domain property. Accordingly, by opinion C-132-2019, the Procuraduría General de la República states that when a municipality has well-founded questions, based on studies of registry entries and potential title, concerning the validity of registrations, titles, and deeds in favor of a private party for properties registered before Transitory III of Law 4558 entered into force, which incorporate public-domain areas of the Restricted Zone into the maritime terrestrial zone, an action for nullity must be brought before the administrative-litigation and civil-hacienda jurisdiction, and the appropriate interim measures requested. My client is considering filing such an action. Along the same lines, all the properties to which we referred could be absolutely void because public-domain property was registered as private property, and they do not even have buildings. Therefore, there is NO harm to the applicant’s real property, much less to anyone’s physical integrity. Mr. Nombre02, in his capacity as secretary of the applicant company, is challenging an action supported by a judicial judgment (2024004850, issued at 13:39 on 29 July 2024 by the Administrative Litigation Court), and my client removed the culvert to protect the environment, in the absence of any real risk. The applicant clearly does not know about the judicial judgment referenced in this report, since he says that ‘other institutions necessarily had to have intervened.’ Other institutions did intervene; this report even includes letter CARTA-SINAC-ACOPAC-DR-0587-2025, dated 26 August 2025, which, in summary, states that the directorate has NO objection to the required works being carried out. This Administration also had letter CARTAMOPT-DVOP-MRPC-2026-01, dated 14 January 2025, which confirms that the Municipality of Garabito is responsible for road code PRN05. FIFTH: As to the photograph referred to by the applicant, this representative must point out that it cannot be addressed because its elements cannot be clearly identified and it is not clear enough for proper assessment; that is, it cannot be made out. However, we inform this Honorable Chamber that the owners of several properties coordinated among themselves and constructed a stormwater evacuation channel on their properties. It collects water from Dirección01 and carries it to Estero Los Diegos. The channel runs internally over private land and does not affect the lagoon or a public-domain watercourse. It is approximately 3 kilometers long. SIXTH: The applicant identifies three specific claims: 1. Change to the landscape and entry of machinery onto the beach. 2. Flooding caused by removal of the culvert, for which the municipal mayor is directly responsible. 3. Destruction of a public road, creating risks to neighbors’ lives due to hydraulic pressure. Claim 1. The applicant asserts that Law 6043 prohibits changing the beach’s surroundings. However, the mayor’s actions were not intended to modify the beach’s surroundings, but to carry out works on a public road administered by my client, in compliance with the judicial order. The work area is municipal road infrastructure, not the public maritime terrestrial zone. If machinery at any point crossed adjacent areas, it did so solely and as technically necessary to carry out the ordered work. A reading of judgment 2024004850, issued at 13:39 on 29 July 2024 by the Administrative Litigation Court, shows that it ordered the adoption of measures to prevent degradation of the Laguna Pochotal ecosystem. Carrying out that order required machinery; the Administration could not comply with a judicial judgment using a broom and shovel. Claim 2. The presence of water in the area, since it is a wetland, does not by itself prove that the culvert’s removal caused it. That is, the applicant does not show that the culvert was the only or main drainage route. The appropriate evidence would have been a technical engineering or hydrology report explaining the area’s natural water behavior and showing that the water comes from natural runoff from higher land, regardless of the culvert. Even if there were some effect on water flow, my client is not responsible because it acted in compliance with a judicial order. The source of the obligation is the Administrative Litigation Court. In addition to the Municipality of Garabito, various other institutions are involved. If there is compensable harm, institutional liability must be examined and litigated through the administrative-litigation route for damages, not through an amparo. Claim 3. The alleged risk to life from hydraulic pressure is speculative. The applicant is describing a hypothetical future meteorological disaster. Amparo protects rights that are threatened in a certain, current, and imminent manner, not conjectural scenarios. Moreover, Laguna Pochotal, precisely because it no longer has the culvert diverting its waters, is recovering its natural water-regulation function, which reduces hydraulic risk in the coastal area over the long term. Taken as a whole, this representative makes clear that the applicant has reversed the logic of the situation: the culvert that was removed was precisely the artificial element that altered Laguna Pochotal’s natural hydrological cycle, degrading the ecosystem that the aforementioned judgment ordered protected. The respondent did not create a risk; it acted to eliminate the cause of environmental harm already declared by a court. Any effects on water adaptation that may arise during the restoration of the water surface are not attributable to arbitrary conduct, but to compliance with the constitutional duty to protect the environment (Article 50 of the Constitution). SEVENTH: We must indicate that a judgment of the Administrative Litigation Court ordered the State, through MINAE and SINAC, in coordination with the Municipality of Garabito and SETENA, to adopt all actions and planning measures needed to prevent and combat pollution or degradation of the Laguna Pochotal ecosystem and avoid further harm, without omitting environmental impact assessment. Removal of the culvert was NOT a discretionary decision by the Mayor, but compliance with a legal obligation imposed by the Judiciary. The Municipal Mayor could not give prior notice or initiate a prior administrative proceeding because he was bound by a judicial order that had to be obeyed. Refusal or delay in carrying it out would have constituted contempt. The applicant alleges that several constitutional principles were violated, to which my client responds as follows: i. Due process: Removal of the culvert was work carried out on a public road administered by the canton, that is, on public-domain property at Dirección04. The applicant has no vested subjective right to public infrastructure. Due process protects one’s own rights and legitimate interests, not the indefinite maintenance of a public-domain structure. ii. Administrative protection / illusory protection: There is no lack of defense when a prior judgment ordered the action. The existence of the administrative-litigation proceeding itself shows that there was a proceeding; the applicant simply was not a party to that case and may have been unaware of it, but that does not make the Municipality’s conduct arbitrary. iii. Citizen participation: Such participation does not grant a right to veto the execution of final judicial judgments. My client cannot make compliance with a judicial order subject to neighborhood consultation, as the applicant sought. iv. Legitimate expectations: For this principle to apply, the Administration must have created a valid, stable, and lawful expectation. The installation, replacement, or removal of a culvert on public-domain property does not give the applicant an acquired right, especially when the culvert’s existence was incompatible with a judicial judgment because it caused environmental harm. The Municipal Mayor’s actions were not arbitrary, as the applicant has sought to portray throughout this proceeding, and much less did they violate fundamental rights. Rather, they complied with an obligation imposed by judgment, concerning public-domain property, to protect the collective environmental interest. Accordingly, there was no basis for prior notice or an autonomous administrative proceeding, since the source of the obligation was judicial, not discretionary. EIGHTH: In this allegation, the applicant advances a false premise: that my client acted autonomously and capriciously. The legal reality is the opposite, honorable members of this Chamber: as explained in the preceding sections, an Administrative Litigation Court judgment ordered the action, and that changes everything. The representative of Cala de Palmas S.A. invokes Article 128 of the General Law on Public Administration to argue that the act is void without a case file. This argument turns against her, since the case file exists, and there are also two judicial case files on this same matter, namely 24-008119-1027-CA and 26-000400-0007-CO. Those files contain the facts, evidence, technical grounds, and applicable law. The Municipality was not creating a new discretionary administrative act; it was enforcing a judicial judgment. To claim that my client had to open a parallel administrative case file to carry out what a court had already decided is legally absurd and would deprive res judicata of its substance. As to Article 33 of the LGAP, concerning the duty to give reasons, we assert that the judgment of the Administrative Litigation Court itself provides those reasons. There is no stronger legal basis than a judicial order. The applicant alleges an absence of hydrological studies. However, the precautionary principle applies where there is no scientific certainty, and in this specific case there is NO lack of certainty, since a judicial judgment determined that Laguna Pochotal was being degraded and ordered its restoration. That judicial determination is based on technical and scientific criteria already assessed in the administrative-litigation proceeding. The applicant cannot invoke the precautionary principle to halt enforcement of a judgment whose technical basis has already been evaluated by a competent court. The applicant makes a serious conceptual error by relying on an alleged violation of the Principle of Environmental Non-Regression. This principle prohibits backsliding from the level of environmental protection already achieved. The culvert that was removed was precisely the instrument keeping the Laguna Pochotal ecosystem degraded. In fact, after only two days, progress in restoring the water surface could already be seen, as birds were observed there. The culvert itself violated environmental non-regression by diverting water that should have fed the lagoon. The Mayor did not cause environmental backsliding; he made progress in compliance with the constitutional mandate in Article 50 and the judicial judgment. Article 16 of the LGAP requires that acts be based on certain and true facts. In this case, the facts were established by the Administrative Litigation Court itself in its judgment, and the Municipality did not need to prove again what had already been judicially established. It is constitutionally unacceptable to require independent technical studies to enforce a judgment; that would subject res judicata to administrative review. There is no personal liability on the part of the Mayor in this case, since he did not act with intent or gross negligence in carrying out an unlawful act. We reiterate that if there is institutional liability for collateral harm resulting from the environmental restoration process, that dispute belongs in the administrative-litigation route for damages, with expert technical evidence. It is not a matter for constitutional amparo. The applicant seeks to have the Honorable Chamber declare unconstitutional the enforcement of a final judicial judgment issued by a court of the Republic. NINTH: The applicant claims the Mayor lacks functional authority, but is mistaken. To the contrary, Article 169 of the Constitution and the Municipal Code establish that municipalities administer local interests and services, including cantonal road infrastructure. The removed culvert was on a public road administered by the Municipality. The Mayor acted under three concurrent grounds of authority: a) Within his territory. b) Over property under his administration. c) In compliance with a judicial order. As for private property, the applicant does not establish in this proceeding that the culvert was on its property. A culvert on a public road is public infrastructure; there is no private property right to assert against it. TENTH: The applicant seeks to mislead the Honorable Chamber by claiming that the area lies outside Laguna Pochotal’s area of influence. However, the area of influence of an ecosystem is not determined by an adjoining neighbor with an attached illustration that cannot be seen. That is a technical determination for SINAC, MANE, and SETENA, institutions that participated in the administrative-litigation proceeding. If the Administrative Litigation Court ordered action to restore the lagoon, it is because the intervention was found technically and legally necessary and appropriate. An illustration submitted by an interested party does not overturn a judgment. In a social media post, the Municipal Mayor stated that birds had retroned to Laguna Pochotal two days after the culvert was removed. That is not evidence of arbitrariness, but evidence that environmental restoration is working. The applicant claims that protecting an ecosystem judicially declared degraded constitutes abuse of power. All of the above supports the Chamber’s summary rejection of that argument. CONCLUSIONS. – The applicant seeks to have this Constitutional Chamber declare unconstitutional the enforcement of a final judgment of the Administrative Litigation Court, issued to protect the constitutional right to a healthy and ecologically balanced environment guaranteed by Article 50 of the Constitution. Through this report, my client has demonstrated that: • Removal of the culvert was not a discretionary or arbitrary decision by the Municipal Mayor, but compliance with a legal obligation imposed by judicial judgment. • The action was carried out on infrastructure located on a public road administered by the canton, within the Municipality of Garabito’s full functional authority under Article 169 of the Constitution. • No fundamental right was violated, since the applicant does not establish a vested subjective right to public infrastructure or demonstrate certain, current, and direct harm to any constitutional right that can be protected by amparo. • The arguments concerning the absence of a case file, lack of technical studies, and violation of the precautionary principle are refuted by the existence of the judicial case file for the administrative-litigation proceeding, whose final judgment provides the legal, technical, and scientific basis for all municipal action. • Granting this application would be tantamount to subordinating enforcement of final judicial judgments to a veto by private parties with private interests, depriving res judicata of its substance and rewarding noncompliance with judicial orders.” He requests that the amparo application be dismissed.\n\n4.- In a submission added to the digital case file at 15:05 on 21 May 2026, Yajaira Valverde Acuña, in her capacity as acting head of the Maritime Terrestrial Zone of the Municipality of Garabito, reports under oath that “(…) Location of the culvert: According to letter MG-ST-TOP-2025-059-BBA, attached herewith, the culvert at issue in this amparo application is located within the road right-of-way and not in the public area of Garabito’s maritime terrestrial zone. It is therefore outside this sub-process’s jurisdiction. However, as stated on page three (3) of the cited application, ‘by the principle of gravity, stormwater collected throughout that area will flow toward the beach.’ On that premise, it is necessary to provide the following opinion: Technical opinion on stormwater discharging into the sea within the Maritime Terrestrial Zone. I. Background FIRST: The Municipality, through the Maritime Terrestrial Zone Sub-Process, is responsible for administering, monitoring, and protecting public-domain property located within the Maritime Terrestrial Zone. SECOND: A technical opinion is required regarding stormwater that drains or discharges toward the sea and its potential effect on the territorial area within the Maritime Terrestrial Zone. THIRD: Stormwater, although it consists of natural runoff from precipitation, can cause erosion, sediment transport, modification of natural watercourses, harm to coastal ecosystems, and physical changes to public-domain property when hydraulic management is inadequate. In the case before us, the culvert’s location borders El Refugio Natural Punta Mala. This protected wild area was established by Executive Decree N-27210, dated 16 April 1998, and expanded under Decree N°-33044, dated 3 May 2002. It is fundamental to conserving and protecting the nesting beach of the olive ridley turtle (Lepidochelys olivacea). Later, in 2002, that protected area expanded its original boundaries to protect other species and ecosystems of biological importance. Because of its location, this refuge could be seriously affected by the discharge from the cited culvert. II. Applicable Legal Framework Constitution of Costa Rica Article 50: ‘Every person has the right to a healthy and ecologically balanced environment…’ Maritime Terrestrial Zone Law No. 6043 Article 1: ‘The maritime terrestrial zone is part of the national heritage, belongs to the State, and is inalienable and imprescriptible…’ This article establishes the public-domain nature of the Maritime Terrestrial Zone and the State’s duty to protect and conserve its resources. Article 3: ‘The municipalities are directly responsible for ensuring compliance with the rules governing the ownership, development, and use of the maritime terrestrial zone…’ This provision gives the Municipality direct authority to monitor and control, and to issue technical opinions on matters that could affect the physical and environmental integrity of the Maritime Terrestrial Zone. Article 7: ‘Land located in the Maritime Terrestrial Zone may not be subject to possessory-information proceedings, and private parties may not appropriate it or have it legalized in their name…’ This article reaffirms the public-domain nature of the Maritime Terrestrial Zone and the Administration’s duty to protect its integrity and ensure that it is used in accordance with the public interest. Article 9: ‘The maritime terrestrial zone is a strip two hundred meters wide along the coastlines…’ Organic Environmental Law No. 7554 In applying the preventive and precautionary principles, the Public Administration must take measures to prevent environmental harm when natural resources or public property may deteriorate. General Law on Public Administration Article 113: ‘The Administration must serve the general interests objectively…’ Administrative action must be directed toward protecting the public interest and properly conserving property administered by the State. III. Technical Analysis Under the cited legislation, stormwater that drains or discharges toward the sea may cause physical and environmental effects on the area within the Maritime Terrestrial Zone, particularly when such discharges cause erosion on the beach or coastal area, lead to sediment transport and deposition, carry solid waste or contaminants, alter existing natural drainage, affect coastal or marine ecosystems, or modify the natural conditions of public-domain property. It must be considered that a stormwater discharge into the sea is not in itself irregular, as it may result from natural drainage processes. However, when artificial works, channels, changes to watercourses, or human interventions alter the area’s natural conditions, the Administration must carry out the corresponding technical and legal assessment. In view of the authority granted to the Municipality under Law No. 6043, the Maritime Terrestrial Zone Sub-Process is empowered to assess potential effects on public-domain property and issue recommendations to ensure the conservation and protection of the Maritime Terrestrial Zone. IV. Technical Conclusion Based on the Constitution, the Maritime Terrestrial Zone Law No. 6043, the Organic Environmental Law No. 7554, and the General Law on Public Administration, this Sub-Process concludes that: The Maritime Terrestrial Zone is public-domain property subject to special protection by the Administration. The Municipality has legal authority to analyze and issue technical opinions regarding situations that may affect the physical, environmental, or functional conditions of the Maritime Terrestrial Zone. Stormwater discharges into the sea must be assessed from a technical and preventive perspective to determine whether they alter public-domain property or cause significant environmental impacts.” She requests that the amparo application be dismissed.\n\n5.- The legal requirements have been observed in these proceedings.\n\nJustice Araya García drafted the opinion; and,\n\nReasons:\n\nI.- Preliminary Issue. Before addressing the merits—concerning the alleged violation of the right to a prompt and duly completed proceeding—it must be clarified that, since Judgment No. 2008-02545, issued at 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction—with some exceptions—matters in which there is a dispute over whether the Public Administration has complied with the time limits set by the General Law on Public Administration (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, whether for issuing a final act to resolve an administrative proceeding—initiated ex officio or at a party’s request—or for hearing the available administrative remedies. This case presents an exception, since it concerns a complaint about the removal of a culvert that allegedly affects the physical integrity of people, the environment, and the property of area residents, and that has not been resolved. Having clarified this point, the Chamber turns to the specific situation raised in this amparo.\n\nII.- Subject of the application. The applicant, in his capacity as representative of Cala de Palmas S.A., alleges that the Municipality of Garabito unilaterally removed a culvert intended to manage stormwater, without prior technical studies, creating a risk of flooding that threatens the physical integrity of people, the environment, and the property of area residents, which he considers harmful to his fundamental rights.\n\nIII.- Facts found. The following facts are considered duly established and relevant to the decision in this matter:\n\n1) The applicant is the legal representative of Cala de Palmas S.A., which owns properties No. PRN03 and No. PRN06, both bordering Dirección05 (see report submitted by the challenged authority).\n\n2) At some point, the public road suffered subsidence and erosion because Quebrada Zapote was rerouted toward the beach instead of following its natural course toward Estero Los Diegos (see report submitted by the challenged authority).\n\n3) The culvert’s installation was causing Laguna Pochotal to dry out. This situation was reported to the Administrative Litigation Court and processed under judicial case number 21-008119-1027-CA-5 (see report submitted by the challenged authority).\n\n4) By Judgment No. 2024004850, issued at 13:39 on 29 July 2024, the Administrative Litigation Court ordered the Ministry of Environment and Energy and SINAC to adopt all actions and planning measures needed to prevent and combat pollution or degradation of the Laguna Pochotal ecosystem. This action must ensure proper coordination with the Municipality of Garabito and SETENA to prevent further harm and safeguard the environment of the ecosystem in question (see report submitted by the challenged authority).\n\n5) The Municipality of Garabito informed area residents through social media about the intervention it would carry out (see report submitted by the challenged authority).\n\n6) On 7 January 2026, the challenged authority removed the culvert into which a series of artificial channels that were draining the area’s wetlands, specifically Laguna Pochotal, emptied (see report submitted by the challenged authority).\n\nIV.- The specific case. In this case, the applicant alleges that the Municipality of Garabito unilaterally removed a culvert intended to manage stormwater, without prior technical studies, creating a risk of flooding that threatens the physical integrity of people, the environment, and the property of area residents, which he considers harmful to his fundamental rights.\n\nIn this regard, the Chamber verifies that, in the specific case, it is indeed known that Cala de Palmas S.A., represented by the applicant, owns properties No. PRN03 and No. PRN04, both adjoining Dirección05. The road in question also suffered subsidence and erosion as a result of rerouting Quebrada Zapote toward the beach, rather than allowing it to follow its natural course toward Estero Los Diegos. It is also established that the culvert at the site contributed to the drying of Laguna Pochotal, a matter known to the judicial authorities because a complaint was filed before the Administrative Litigation Court in judicial case No. 21-008119-1027-CA-5. In that proceeding, Judgment No. 2024004850 of 29 July 2024, issued at 13:39, ordered the Ministry of Environment and Energy and the National System of Conservation Areas to adopt the measures and actions needed to prevent and combat pollution and degradation of the Laguna Pochotal ecosystem, in coordination with the Municipality of Garabito and the National Environmental Technical Secretariat, to prevent further harm and ensure protection of that wetland. The Municipality of Garabito later informed area residents through social media about the works to be carried out. Finally, on 7 January 2026, it removed the culvert into which various artificial channels that drained the sector’s wetlands, particularly Laguna Pochotal, emptied.\n\nAccordingly, this Court finds no violation of the fundamental rights of the party protected by the amparo. The challenged authority acted in compliance with a judgment issued by the Administrative Litigation Court. This Chamber also cannot characterize as arbitrary administrative action carried out in compliance with a final judicial judgment, since the Administration must obey rulings issued by the competent judicial authority. This is especially so in this case, which concerns protection of the wetland. Any disagreement with the content or scope of that order must be brought before the jurisdiction that issued it, and not through an amparo application. In addition, the case file does not show that any action or complaint remains pending resolution. For these reasons, the Chamber considers that the amparo application must be dismissed.\n\nV.- Note of Justice Rueda Leal. I must point out that, since Judgment No. 2019002355, issued at 9:30 on 12 February 2019, my position regarding amparo applications filed on behalf of a legal entity has been as follows:\n\n“…in Advisory Opinion 22-16 of 26 February 2016, the Inter-American Court of Human Rights indicated that, although some States recognize the right to petition for legal entities under special conditions, such as trade unions, political parties, or representatives of Indigenous peoples, Afro-descendant communities, or specific groups, the fact is that ‘Article 1.2 of the American Convention grants rights only to natural persons; legal entities are therefore not holders of the rights enshrined in that treaty.’ On the other hand, in the same advisory opinion, the Inter-American Court held that, in certain particular contexts, natural persons may come to exercise their rights through legal entities (for example, through a media outlet, as occurred in the case of Nombre01 et al. v. Venezuela); however, for this to be subject to protection before the inter-American system, ‘the exercise of the right through a legal entity must involve an essential and direct relationship between the natural person requiring protection from the inter-American system and the legal entity through which the violation occurred, since a mere link between the two persons is not sufficient to conclude that the rights of natural persons, rather than those of legal entities, are in fact being protected. Indeed, more must be proven than the natural person’s mere participation in the legal entity’s own activities; that participation must be substantially related to the rights alleged to have been violated.’ (emphasis added) (OC. 22/16)”.\n\nIn the case at hand, although the amparo proceeding was brought on behalf of Cala de Palmas S. A., it is clear from reading the filing that a number of natural persons are affected by the situation complained of. There is therefore an essential relationship between the alleged effect on a legal entity and the possible injury to a natural person, which justifies examining the allegations to determine whether a fundamental right has been violated. Indeed, based on the reasoning of this judgment, I agree with the dismissal of the amparo.\n\nVI.- Documents submitted to the case file. The party is advised that any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device that may have been submitted, must be collected from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, all material not collected within that period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe application is dismissed.
