San José, a las nueve horas veinticinco minutos del veintiuno de julio de dos mil veintiseis .\n\n Recurso de amparo que se tramita en expediente número 26-024187-0007-CO, interpuesto por Nombre03, pasaporte Identificacion01, contra la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO (ASADA) DE LA FLORIDA DE GUATUSO.\n\nResultando:\n\n \n\n1.- Por escrito presentado por Gestión en Línea y que fue incorporado al expediente electrónico a las 12:41 horas de 6 de julio de 2026, el recurrente interpone recurso de amparo contra la Asociación Administradora del Acueducto y Alcantarillado Sanitario (ASADA) de La Florida de Guatuso. Manifiesta que, el 11 de diciembre de 2025, interpuso una solicitud formal de disponibilidad de agua potable ante la ASADA recurrida, para el inmueble inscrito a nombre de la empresa Healing Waters Rio Celeste LLC SRL bajo la finca folio real número PRN01, situado en el distrito de Katira, cantón de Guatuso. Alega que, como resultado de su gestión, la Junta Directiva de la ASADA emitió el acto N° 02-2026, aprobado en la sesión N° 159 de 8 de enero de 2026 y notificado el día 15 del mismo mes, mediante el cual se denegó la factibilidad técnica y la disponibilidad del servicio alegando una supuesta falta de capacidad hidráulica al no existir tuberías de distribución frente a la propiedad. Asimismo, señala que, como parte del trámite, el fontanero de la ASADA elaboró un informe el 17 de diciembre de 2025, que no pudo completarse con coordenadas geográficas ni fotografías debido a que otros propietarios impidieron el ingreso a la servidumbre agrícola que da acceso al terreno. Acusa el recurrente que el acto denegatorio resulta arbitrario y discriminatorio, por cuanto la ASADA sí otorgó la factibilidad técnica, conectividad e instalación del servicio de agua potable a varios propietarios colindantes cuyos terrenos se encuentran en idénticas condiciones técnicas y acceden por la misma servidumbre de paso. Al efecto, cita el acto administrativo N° 065-2025 ALF extendido a favor de Nombre02 (finca PRN02); la existencia del medidor activo número 61790 a nombre de Nombre01; y la aprobación del servicio número 013-2025 ASADA del 25 de noviembre de 2025 otorgada a la Asociación de Iglesias Las Sendas Antiguas de Costa Rica (finca PRN03). Sostiene que la decisión de la autoridad recurrida carece de criterios técnicos reales y lesiona sus derechos fundamentales a la igualdad, al agua potable como bien esencial para la vida, y al buen y eficiente funcionamiento de los servicios públicos. Solicita la intervención de esta Sala.\n\n 2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada. \n\n Redacta el Magistrado Castillo Víquez; y,\n\nConsiderando:\n\n I.- OBJETO DEL RECURSO. El recurrente reclama que, de forma arbitraria, la ASADA recurrida le ha denegado el servicio de agua potable, bajo el argumento de una supuesta falta de capacidad hidráulica al no existir tuberías de distribución frente a la propiedad. Ello, a pesar de que la entidad recurrida sí otorgó la factibilidad técnica, conectividad e instalación del servicio de agua potable a varios propietarios colindantes cuyos terrenos se encuentran en idénticas condiciones técnicas.\n\nII.- SOBRE EL CASO CONCRETO. Visto el escrito de interposición de este recurso, se le hace ver al parte recurrente que, si bien es cierto, según este Tribunal ha reconocido, existe un derecho fundamental al agua potable, su ejercicio no es indiscriminado. Consecuentemente, la postura de esta Sala, en lo referente a la instalación del respectivo servicio, es que los entes que lo prestan no tienen obligación de brindarlo en cualquier condición y oportunidad. Por el contrario, el Instituto Costarricense de Acueductos y Alcantarillados, las asociaciones administradoras de acueductos y alcantarillados y las municipalidades que también suministran agua, pueden rechazar válidamente cualquier solicitud para la instalación respectiva, si existen razones técnicas o legales que así lo justifican. De esta forma, en sentencia N° 2014-9134 de las 14:05 horas del 19 de junio de 2014, este Tribunal resolvió lo siguiente:\n\n“(…) Esta Sala ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos —sea sujeto público o sujeto privado— está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos del veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro). Resulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes. Ahora bien, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio (…)”\n\nAsimismo, en el pronunciamiento N° 2010-11815 de las 9:15 horas del 9 de julio de 2010, esta Sala dispuso lo siguiente:\n\n“(…) Señala el recurrente que el 10 de mayo del año en curso la amparada adquirió la finca inscrita al Folio Real número PRN04, la cual desde el año 2007 contaba con una hipoteca de primer grado. Indica que para ese momento el lote sí contaba con la certificación de disponibilidad de agua potable. No obstante, en fecha reciente cuando solicitó ante el Banco HSBC, la novación de deudor sobre dicha propiedad, esta entidad bancaria le ha retrasado su trámite, por cuanto señala que “El terreno valorado constituye una garantía hipotecaria de muy mala calidad, hasta tanto no resuelve su problema de agua”. Agrega el recurrente que al solicitar información en la oficina regional del Acueducto en Sardinal, se le indicó que Acueductos y Alcantarillados, no contaba con los recursos económicos para proveer el agua y que no se resolvería la situación del proyecto hasta que esa institución no indicara que existía disponibilidad de agua. En razón de lo anterior, reclama el recurrente que al momento de constituir la hipoteca sobre la propiedad en cuestión, ésta contaba con la disponibilidad de agua y a la fecha ya no la tiene, lo cual ha su juicio ha lesionado sus derechos fundamentales, por cuanto pretende construir allí su casa de habitación.\n\nII.- Como la inconformidad del recurrente lo es con el hecho, de que para el mes de junio de este año, el lote referido no cuenta con la certificación de disponibilidad de agua potable correspondiente, ya que según le indicó el propio Instituto recurrido (ver folio número 24 del expediente), ello se debe a los estudios básicos e informe técnico que contan en el oficio número OCS-INSP-2010-074, situación que constituye un deferendo de legalidad que resulta ajena al ámbito de competencia de esta Sala, razón por la cual no podría esta jurisdicción venir a valorar en este caso, los aspectos técnicos o científicos requeridos para otorgar o denegar la disponibilidad de agua en disputa, así como tampoco podría determinar la procedencia o no de la referida denegatoria impugnada. Para ello deberá acudir el recurrente a plantear los reclamos que estime pertinente, ante las propias autoridades recurridas, para que allí se resuelva lo que en derecho corresponde y no ante esta Sala. En virtud de lo expuesto el amparo resulta inadmisible, como en efecto se declara (…)”\n\nPor último, en el fallo N° 2017-3922 de las 14:30 horas del 14 de marzo de 2017, esta Sala resolvió lo siguiente:\n\n“(…) Según narra el recurrente, la autoridad recurrida le ha negado una disponibilidad para un servicio de agua en un local comercial que pretenden construir. Al revisar el caso, se concluye que son dos los elementos que llevan al Tribunal a rechaza de plano este recurso: en primer lugar debe observarse que se trata de un local comercial que pretende levantarse de modo que no se pone en riesgo la salud y el acceso al agua potable para las necesidades básicas de las personas, lo cual aleja el caso del ámbito de los derechos fundamentales a la salud. En segundo lugar, si bien existe un derecho fundamental al agua potable, no es contrario a ello que el Estado y las instituciones provean ese servicio, dentro del margen de sus capacidades técnicas y de acuerdo con reglas generales de ordenación.- En la sentencia 2016-5326 se dijo:\n\n'IV.- Sobre el derecho al agua y los requisitos exigibles en la solicitud de servicios de agua. La jurisprudencia de la Sala es reiterada en reconocer el denominado derecho fundamental al agua, por el cual debe concederse a todas las personas la posibilidad de acceder en condiciones de igualdad a los servicios de agua potable, toda vez que la misma resulta esencial para la vida y la salud humanas. No obstante, este carácter de derecho fundamental no implica un acceso irrestricto a los servicios de agua, ya que la administración válidamente puede establecer requisitos generales de necesario cumplimiento por cada solicitante para valorar su particular requerimiento. Así, en sentencia número 2006-1898, de las nueve horas cincuenta y tres minutos del 17 de febrero de 2006 – reiterada, entre otras, por sentencias números 2007-13310, de las diez horas cincuenta y siete minutos del 14 de setiembre de 2007, y 2008-16311, de las diecisiete horas treinta minutos del 30 de octubre de 2008- estableció la Sala que:\n\n'El recurrente alega (…) que pese a las solicitudes y esfuerzos hechos, el Instituto recurrido se ha negado a brindarles el servicio de agua potable aduciendo que se trata de un precario y que sus habitantes no cuentan con un plano de segregación que establezca que son propietarios de los inmuebles. Al respecto, se encuentra acreditado en autos, con base en el informe rendido bajo juramento por la autoridad recurrida, que existe una imposibilidad para instalar servicios de agua potable domiciliaria en la comunidad que habita el recurrente por dos motivos específicos: la falta de una infraestructura adecuada y de presentación de solicitudes con cumplimiento de requisitos legales por parte de los interesados (...). Esta Sala, en la sentencia No. 2004-12185 de las 13:31 horas del 29 de octubre del 2004, en un caso similar al presente, señaló que no era posible obligar al Instituto Costarricense de Acueductos y Alcantarillados a eludir lo dispuesto en su Reglamento de Prestación de Servicios a los Clientes ni en la Ley General de Agua Potable. De ahí que, en el tanto el amparado, no reúna las condiciones y requisitos ahí exigidos, aunque el servicio de agua potable debe estar al alcance de toda persona por tratarse de un servicio esencial, no se le puede proveer de manera regular. Dada la existencia de esos dos motivos objetivos por los cuales no es posible suministrar un servicio de agua potable regular al accionante: su falta de cumplimiento de requerimientos para la conexión de un servicio nuevo, empezando, por la presentación de la solicitud y la existencia de una infraestructura adecuada en la zona, no existe motivo alguno para entender que la denegatoria de la prestación del servicio regular por parte del Instituto recurrido se deba al hecho que el amparado y sus vecinos no cuentan con títulos de propiedad sobre los inmuebles que poseen. A lo anterior cabe agregar que con base en el artículo 33 del Reglamento referido, la falta de un título de propiedad no parece ser un obstáculo para solicitar la conexión de un servicio nuevo de agua potable, en tanto se cumplan los requerimientos que indica esa norma. En todo caso, se encuentra acreditado también que aunque no se ha suministrado el servicio regular de agua potable, el recurrente y demás vecinos cuentan con fuente pública que el Instituto instaló para que puedan abastecerse, para sus necesidades básicas. De ahí que considere este Tribunal que ha sido la propia omisión del recurrente y de los vecinos de la localidad, quienes no acreditan haber presentado las solicitudes para la instalación de un servicio nuevo de agua potable en la comunidad donde habitan, la que ha impedido que se valore su situación a efectos de determinar si, cumpliendo, sobre todo los requerimientos del artículo 33 del Reglamento de Prestación de Servicios a los Clientes, las limitaciones de infraestructura pueden ser superadas en su caso y se les puede proveer de un servicio regular de agua potable.'\n\nSe entiende entonces, que si bien existe un derecho fundamental al agua que puede ser exigido a la administración correspondiente, la prestación del servicio bien puede sujetarse al cumplimiento de los requisitos establecidos para su otorgamiento y a que exista posibilidad material de suministro, esto es, que no existan situaciones técnicas que imposibiliten o desaconsejen a la administración a brindar el servicio de agua potable, situación que determina que la administración carece de la obligación de prestar el servicio de agua potable en caso de existir razones técnicas que lo desaconsejen o imposibiliten, debiendo informar adecuadamente al gestionante las razones por las cuales no puede atenderse su solicitud.\n\n(…) De lo anterior se desprende que, si como la persona recurrente lo señala, la Municipalidad le explicó ampliamente las razones de grave escasez que impiden ofrecer el servicio que pide, no hay lesión a los derechos fundamentales de comercio y empresa porque, dicha negativa no es arbitraria sino que se justifica válidamente, precisamente en ese fundamento técnico. De modo que la Sala no puede resolver en el sentido que pide la tutelada y lo correcto es rechazar el recurso, tal y como se hace (…)”\n\nEn este sentido, se hace énfasis en que la verificación del cumplimiento de requisitos legales o técnicos para obtener el servicio de agua es una labor que le corresponde a las autoridades administrativas competentes, sin que esta Sala pueda incursionar en la materia, porque se trata de aspectos de legalidad ordinaria ajenos a su ámbito de acción. Así, en referencia al caso concreto, vistos los reclamos del promovente, es preciso señalar que, aun cuando el recurrente invoque una supuesta violación del derecho a gozar de los servicios públicos, en realidad pretende que esta Sala analice la legalidad y procedencia técnica de la decisión adoptada por la ASADA de denegar la solicitud de disponibilidad de agua interpuesta por este. De tal forma que lo planteado por el petente en realidad alberga una simple discrepancia con dicho criterio, por lo que conocer este amparo por el fondo significaría reconducir a la vía del amparo una discusión propia de la legalidad ordinaria, que no está relacionada directamente con una eventual vulneración de algún derecho fundamental, puesto que la Sala no puede hacer las veces de alzada en la materia expuesta y revisar si la decisión cuestionada se ajusta o no a los hechos, los criterios técnicos aplicables y la normativa legal vigente. Aunado a lo anterior, en referencia a que la ASADA sí otorgó la factibilidad técnica, conectividad e instalación del servicio de agua potable a varios propietarios colindantes cuyos terrenos se encuentran en idénticas condiciones técnicas, no puede alegarse lesión al principio de igualdad, pues no se acredita que el aval del servicio se haya brindado con ocasión de gestiones interpuestas en el mismo momento que el recurrente y en idénticas condiciones técnicas. Así las cosas, deberá el petente acudir ante la vía de legalidad respectiva, a fin de plantear allí las gestiones que estime pertinentes para que se resuelva lo que en derecho corresponda. En consecuencia, el recurso es inadmisible y así se declara.\n\nIII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI. \n\nPor tanto:\n\n Se rechaza de plano el recurso. \n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at 9:25 a.m. on 21 July 2026.\n\nAmparo proceeding handled in case file number 26-024187-0007-CO, filed by Nombre03, passport Identificacion01, against the ASSOCIATION ADMINISTERING THE WATER SUPPLY AND SANITARY SEWER SYSTEM (ASADA) OF LA FLORIDA DE GUATUSO.\n\nBackground:\n\n1.- In a filing submitted through Gestión en Línea and added to the electronic case file at 12:41 p.m. on 6 July 2026, the applicant files an amparo application against the Association Administering the Water Supply and Sanitary Sewer System (ASADA) of La Florida de Guatuso. The applicant states that on 11 December 2025, they filed a formal request with the respondent ASADA for confirmation of water availability for the property registered in the name of the company Healing Waters Rio Celeste LLC SRL under real property folio number PRN01, located in the district of Katira, canton of Guatuso. The applicant alleges that, as a result of the request, the ASADA Board of Directors issued act N° 02-2026, approved at session N° 159 of 8 January 2026 and notified on the 15th of the same month, denying technical feasibility and service availability on the stated ground that hydraulic capacity was lacking because there were no distribution pipes in front of the property. The applicant also states that, as part of the proceeding, the ASADA plumber prepared a report on 17 December 2025, which could not be completed with geographic coordinates or photographs because other property owners prevented entry to the agricultural easement that provides access to the land. The applicant alleges that the denial was arbitrary and discriminatory because the ASADA did grant technical feasibility, connectivity, and installation of the water service to several adjoining property owners whose land is in identical technical conditions and is accessed by the same right-of-way easement. In this regard, the applicant cites administrative act N° 065-2025 ALF issued in favor of Nombre02 (property PRN02); the existence of active meter number 61790 in the name of Nombre01; and approval of service number 013-2025 ASADA of 25 November 2025 granted to the Association of Iglesias Las Sendas Antiguas de Costa Rica (property PRN03). The applicant maintains that the respondent authority’s decision lacks genuine technical criteria and violates the applicant’s fundamental rights to equality, to drinking water as an essential good for life, and to the proper and efficient functioning of public services. The applicant requests the intervention of this Chamber.\n\n2.- Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to reject outright or on the merits, at any time, including upon filing, any matter brought before it that proves manifestly inadmissible, or when it considers that there is sufficient evidence to reject it, or that it is merely a reiteration or reproduction of an identical or similar prior matter that was rejected.\n\nJustice Castillo Víquez drafts the decision; and,\n\nReasons:\n\nI.- SUBJECT OF THE APPLICATION. The applicant complains that the respondent ASADA arbitrarily denied water service on the stated ground that hydraulic capacity was lacking because there were no distribution pipes in front of the property. This, despite the fact that the respondent entity did grant technical feasibility, connectivity, and installation of water service to several adjoining property owners whose land is in identical technical conditions.\n\nII.- THE SPECIFIC CASE. Having reviewed the filing initiating this proceeding, the applicant is advised that, although this Court has recognized a fundamental right to drinking water, its exercise is not unrestricted. Accordingly, this Chamber’s position concerning installation of the relevant service is that the entities that provide it are not obligated to do so under any conditions or at any time. On the contrary, the Instituto Costarricense de Acueductos y Alcantarillados, associations administering water supply and sewer systems, and municipalities that also supply water may validly reject any request for the relevant installation if technical or legal reasons justify doing so. Thus, in judgment N° 2014-9134, issued at 2:05 p.m. on 19 June 2014, this Court ruled as follows:\n\n“(…) This Chamber has stated in repeated judgments on the subject that the supply of drinking water is considered under Costa Rican law to be a public service and that, as such, every public service provider—whether a public or private entity—is required to provide the service continuously and efficiently, on equal terms, and to adapt to technological changes (see judgment 2001-09676 of 11:25 a.m. on 26 September 2001 and judgment 2004-08161 of 10:53 a.m. on 23 July 2004). It is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the state entities responsible for providing the public drinking water service, is also required to provide that service continuously, adaptably, and efficiently, and equally to all inhabitants. However, this Constitutional Court’s case law has also stated that, in the face of legal impossibility (that is, failure to meet requirements established in the applicable regulations) or formal impossibility (that is, the absence of a Water Distribution Network), it is reasonable not to grant service requests (…)”\n\nLikewise, in ruling N° 2010-11815, issued at 9:15 a.m. on 9 July 2010, this Chamber held as follows:\n\n“(…) The applicant states that on 10 May of the current year the amparo beneficiary acquired the property registered under Real Property Folio number PRN04, which had been subject to a first-degree mortgage since 2007. The applicant indicates that, at that time, the lot did have a certificate of drinking-water availability. However, recently, when the applicant requested from Banco HSBC a change of debtor for that property, the bank delayed processing the request, stating that ‘The appraised land is a very poor-quality mortgage security until its water problem is resolved.’ The applicant adds that, upon requesting information from the regional water-system office in Sardinal, they were told that Acueductos y Alcantarillados lacked the financial resources to provide water and that the project situation would not be resolved until that institution indicated that water was available. Accordingly, the applicant complains that, when the mortgage was created over the property in question, water was available, but now it is not, which in the applicant’s view has violated their fundamental rights, because they intend to build their home there.\n\nII.- Since the applicant’s objection concerns the fact that, as of June of this year, the aforementioned lot does not have the corresponding certificate of drinking-water availability, which, according to the respondent Institute itself (see page 24 of the case file), is due to the basic studies and technical report contained in official letter OCS-INSP-2010-074, the matter is a dispute over ordinary legality that falls outside this Chamber’s jurisdiction. For that reason, this jurisdiction could not assess the technical or scientific aspects required to grant or deny the water availability in dispute, nor could it determine whether the challenged denial was proper. To that end, the applicant must submit any claims they consider appropriate to the respondent authorities themselves, so that the matter may be resolved as the law requires, and not before this Chamber. In light of the foregoing, the amparo application is inadmissible, as is hereby declared (…)”\n\nLastly, in ruling N° 2017-3922, issued at 2:30 p.m. on 14 March 2017, this Chamber held as follows:\n\n“(…) According to the applicant, the respondent authority denied availability of water service for a commercial premises they intend to build. Upon reviewing the case, it is concluded that two elements lead the Court to reject this application outright: first, this concerns a commercial premises that is to be built, so the health and access to drinking water needed for people’s basic needs are not at risk, taking the case outside the scope of fundamental health rights. Second, although there is a fundamental right to drinking water, it is not inconsistent with that right for the State and institutions to provide the service within their technical capacity and in accordance with general planning rules.— Judgment 2016-5326 stated:\n\n'IV.- On the right to water and the requirements applicable to water-service applications. The Chamber’s case law repeatedly recognizes the so-called fundamental right to water, which requires that all persons be afforded the possibility of equal access to drinking-water services, since water is essential to human life and health. Nevertheless, this fundamental-right status does not entail unrestricted access to water services, because the administration may validly establish general requirements that each applicant must meet in order to assess their particular request. Thus, in judgment number 2006-1898, of 9:53 a.m. on 17 February 2006—reiterated, among others, in judgments numbers 2007-13310, of 10:57 a.m. on 14 September 2007, and 2008-16311, of 5:30 p.m. on 30 October 2008—the Chamber held that:\n\n'The applicant alleges (…) that despite the requests and efforts made, the respondent Institute has refused to provide them with drinking-water service on the ground that this is an informal settlement and its residents do not have a subdivision plan establishing that they own the properties. In this regard, the record establishes, based on the report submitted under oath by the respondent authority, that there is an impossibility of installing household drinking-water services in the community where the applicant lives for two specific reasons: the lack of adequate infrastructure and the interested parties’ failure to submit applications that meet the legal requirements (...). In judgment No. 2004-12185 of 1:31 p.m. on 29 October 2004, this Chamber stated in a similar case that it was not possible to compel the Instituto Costarricense de Acueductos y Alcantarillados to evade the provisions of its Regulation on the Provision of Services to Customers or the General Drinking Water Act. Accordingly, insofar as the amparo beneficiary does not meet the conditions and requirements established therein, although drinking-water service must be available to everyone because it is an essential service, it cannot be provided on a regular basis. Given the existence of those two objective reasons why regular drinking-water service cannot be supplied to the applicant—failure to meet the requirements for connecting a new service, beginning with submitting an application, and the existence of adequate infrastructure in the area—there is no basis to conclude that the respondent Institute denied regular service because the amparo beneficiary and neighbors lack ownership documents for the properties they occupy. To this it should be added that, under Article 33 of the aforementioned Regulation, lack of a deed of ownership does not appear to be an obstacle to requesting connection of a new drinking-water service, provided the requirements set out in that provision are met. In any event, the record also establishes that, although regular drinking-water service has not been supplied, the applicant and other neighbors have access to a public water source installed by the Institute to meet their basic needs. Accordingly, this Court considers that it was the applicant and local residents’ own omission—their failure to show that they had submitted applications to install a new drinking-water service in the community where they live—that prevented their circumstances from being assessed to determine whether, by meeting in particular the requirements of Article 33 of the Regulation on the Provision of Services to Customers, the infrastructure limitations could be overcome in their case and regular drinking-water service could be provided to them.'\n\nIt follows, then, that although there is a fundamental right to water that may be asserted against the relevant administration, provision of the service may be subject to meeting the requirements for its grant and to the existence of a material possibility of supply—that is, there must be no technical circumstances that prevent or counsel against the administration providing drinking-water service. This means that the administration is not obligated to provide drinking-water service where technical reasons counsel against or prevent it, and it must adequately inform the applicant of the reasons why the request cannot be granted.\n\n(…) It follows from the foregoing that, if, as the applicant states, the Municipality fully explained the reasons of severe scarcity that prevent it from offering the requested service, there is no violation of the fundamental rights to commerce and business because the denial is not arbitrary but is validly justified precisely on that technical basis. Accordingly, the Chamber cannot rule as the amparo beneficiary requests, and the proper course is to reject the application, as is hereby done (…)”\n\nIn this regard, emphasis is placed on the fact that verifying compliance with the legal or technical requirements for obtaining water service is a task for the competent administrative authorities, and this Chamber cannot enter into that matter because it concerns ordinary legality outside its scope of action. Thus, with respect to this specific case, having considered the applicant’s claims, it must be stated that, even though the applicant alleges a purported violation of the right to enjoy public services, the applicant is in fact asking this Chamber to analyze the legality and technical propriety of the ASADA’s decision to deny the applicant’s request for water availability. The applicant’s submission therefore amounts to a mere disagreement with that assessment. Addressing the merits of this amparo would mean redirecting to the amparo procedure a dispute concerning ordinary legality, which is not directly related to any alleged violation of a fundamental right, since the Chamber cannot act as an appellate body in the matter described and review whether the challenged decision conforms to the facts, the applicable technical criteria, and the legislation in force. In addition, regarding the assertion that the ASADA did grant technical feasibility, connectivity, and installation of drinking-water service to several adjoining property owners whose land is in identical technical conditions, a violation of the principle of equality cannot be alleged because it has not been established that approval for service was granted in response to requests filed at the same time as the applicant’s and under identical technical conditions. Accordingly, the applicant must pursue the appropriate legality proceedings and submit there any applications they consider pertinent so that the matter may be resolved as the law requires. Consequently, the application is inadmissible, as is hereby declared.\n\nIII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that if they submitted any paper documents, or objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve them from the office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, all material not retrieved within that period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by Corte Plena at session N° 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo application is rejected outright.\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
