  "body_es_text": "Revisión del Documento\n\n\n\nEXPEDIENTE N° 26-024506-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN Nº 2026027681\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del veintiuno de julio de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre01, a favor de MUNDO VEGETAL SRL, cédula jurídica CED01, contra el MINISTERIO DE AMBIENTE Y ENERGÍA y el MINISTERIO DE HACIENDA.\n\nResultando:\n\n 1.- Por escrito agregado al Sistema de Gestión de Despachos Judiciales de esta Sala a las 14:05 horas del 08 de julio de 2026, la parte recurrente interpone recurso de amparo contra el MINISTERIO DE AMBIENTE Y ENERGÍA y el MINISTERIO DE HACIENDA, a favor de MUNDO VEGETAL SRL y manifiesta que: “(…) PRIMERO: Mi representada, la empresa Mundo Vegetal SRL, se encuentra actualmente en su fase preoperativa, de planificación y de estructuración estratégica de sus negocios internacionales proyectando como actividad principal la importación, distribución y comercialización masiva de productos de bioplásticos biobasados (biodegradables y compostables) desintegrables, certificados bajo estrictas normas técnicas internacionales de tercera parte imparcial (tales como TÜV Austria OK Compost Home o OK Compost Industrial. Al encontrarse dicha actividad comercial futura directamente regulada y tutelada por los mandatos ambientales de las Leyes de la República N° 8839 (Ley para la Gestión Integral de Residuos) y N° 9786 (Ley para combatir la contaminación por plásticos), la definición clara del marco normativo es un requisito indispensable y crítico para la viabilidad de nuestras inversiones y operaciones planificadas. SEGUNDO: Ante la severa inseguridad jurídica reinante en el mercado y la falta de unificación de criterios técnicos manejados en las diferentes Proveedurías Estatales en la compra de plásticos convencionales sin hacer diferencia entre los plásticos convencionales vs los bioplásticos biobasados (biodegradables y compostables) y reflejado en la publicación de los carteles licitatorios en el Sistema Digital Unificado de Compras Públicas (SICOP), mi representada formuló en fecha 03 de junio de 2026 una consulta formal ante la Dirección de Contratación Pública del Ministerio de Hacienda, en su condición de Órgano Rector técnico y normativo de la contratación estatal. El objeto central era definir la viabilidad operativa de utilizar normas internacionales y certificaciones acreditadas de tercera parte ante la carencia de reglamentación técnica de etiquetado local, y la necesidad de una directriz unificada que se reflejase en los carteles licitatorios de compra en la plataforma tecnológica unificada de compras del Estado, para evitar la competencia desleal (greenwashing). TERCERO: Paralelamente, mi representada realizó las gestiones correspondientes ante el Ministerio de Ambiente y Energía (MINAE) (MV-DIRG-10-26 con fecha 13 de mayo 2026) en su condición de rector sectorial ambiental. Mediante oficio DIGECA-236-2026 (02 de junio 2026), el MINAE declinó responder el fondo de la viabilidad de la estandarización para las proveedurías estatales en los carteles licitatorios elevados y publicados en SICOP, afirmando textualmente que dicha competencia técnica, operativa y de lineamientos en materia de compras públicas correspondía con exclusividad al Ministerio de Hacienda. CUARTO: Que al momento de interponer y reiterar la consulta ante la Dirección de Contratación Pública de Nombre02 mediante el oficio MV-DIRG-11-2026 (03 junio del 2026) (y la posterior solicitud de intervención de la Contraloría de Servicios), mi representada adjuntó explícitamente como antecedente primordial copia fiel del referido oficio del MINAE, advirtiéndole a Nombre02 que el órgano ambiental ya había declinado la competencia en su favor y que se requería una definición conjunta para evitar un limbo jurídico. QUINTO: El 1 de julio de 2026, Nombre02 emitió el oficio MH-DCoP-OF-0395-2026 evacuando la consulta de forma genérica y ambigua. Ante esto, mi representada presentó en esa misma fecha (1 de julio) una Solicitud de Aclaración y Adición (Oficio MV-DIRG-12- 2026) planteando preguntas cerradas (A, B y C) para operativizar el criterio. SEXTO: En fecha 6 de julio de 2026, la Dirección de Contratación Pública de Nombre02 notificó el oficio MH-DCOP-OF-0406-2026 (Respuesta a solicitud de aclaración y adición). En dicho acto, la autoridad recurrida consumó una flagrante denegación de justicia e indefensión material al afirmar categóricamente que aspectos como compras públicas sostenibles, certificaciones ambientales y requisitos técnicos corresponden con exclusividad al MINAE en ejercicio de su rectoría sectorial, añadiendo que no corresponde a Nombre02 emitir por medio de lineamientos regulatorios destinados a reconocer o priorizar certificaciones, evadiendo dar respuesta a las preguntas formuladas. SÉPTIMO: OMISIÓN ARBITRARIA Y ABSOLUTA DE PRUEBA: Al emitir el oficio MH-DCOPOF-0406-2026, la Dirección de Contratación Pública del Ministerio de Nombre02 obvió por completo y omitió valorar de forma deliberada el oficio previo del MINAE que mi representada le había adjuntado. Nombre02 ignoró el antecedente directo de que el MINAE ya se había declarado incompetente limitándose a \"lavarse las manos\" y enviar de regreso al administrado hacia un órgano que explícitamente ya había declinado la competencia. En el Oficio DIGECA-236-2026, MINAE copia textual: … “La determinación concreta de la admisibilidad de un sello, certificación o mecanismo de verificación corresponde a la Administración contratante dentro del respectivo procedimiento, bajo el marco de la Ley N° 9986, su Reglamento y los lineamientos que emita el Ministerio de Hacienda, por medio de las instancias competentes en materia de contratación pública.” OCTAVO: Con la conducta de ambas autoridades recurrentes, mi representada se encuentra atrapada en un conflicto negativo de competencias (\"ping-pong\" institucional). El MINAE afirma que le toca a Hacienda, y Nombre02 afirma formalmente que le toca al MINAE. Ninguna de las dos instituciones del mismo Poder Ejecutivo asume la responsabilidad de resolver, paralizando la aplicación de las Compras Públicas Estratégicas y dejando a Mundo Vegetal SRL en un estado absoluto de indefensión jurídica y comercial”. Considera violentados los derechos fundamentales de la empresa tutelada. Solicita que se declare con lugar el recurso con las consecuencias de ley y que se les ordene a las autoridades recurridas resolver de manera coordinada lo planteado por la parte recurrente. \n\n 2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada. \n\n Redacta el Magistrado Castillo Víquez; y, \n\nConsiderando:\n\n \n\n I.- OBJETO DEL RECURSO. El recurrente señala que, Ante la severa inseguridad jurídica reinante en el mercado y la falta de unificación de criterios técnicos manejados en las diferentes Proveedurías Estatales en la compra de plásticos convencionales sin hacer diferencia entre “los plásticos convencionales vs los bioplásticos biobasados (biodegradables y compostables)” y reflejado en la publicación de los carteles licitatorios en el Sistema Digital Unificado de Compras Públicas (SICOP), el 03 de junio de 2026, su representada formuló en fecha una consulta formal ante la Dirección de Contratación Pública del Ministerio de Hacienda, en su condición de Órgano Rector técnico y normativo de la contratación estatal, con el fin de definir la viabilidad operativa al utilizar normas internacionales y certificaciones acreditadas de tercera parte ante la carencia de reglamentación técnica de etiquetado local, y la necesidad de una directriz unificada que se reflejase en los carteles licitatorios de compra en la plataforma tecnológica unificada de compras del Estado, para evitar la competencia desleal. Indica que, paralelamente, su representada realizó las gestiones correspondientes ante el Ministerio de Ambiente y Energía (MINAE) (MV-DIRG-10-26 con fecha 13 de mayo 2026) en su condición de rector sectorial ambiental. Sin embargo, ninguna de las autoridades recurridas asume la responsabilidad de resolver lo gestionado, con lo cual paraliza la aplicación de las compras públicas y estratégicas dejando a la amparada en un estado absoluto de indefensión jurídica y comercial. Situación por la cual solicita la intervención de esta sede constitucional. \n\nII.- CASO CONCRETO. Del escrito de interposición y de la prueba aportada, se observa que, la disconformidad de la parte recurrente con la falta de resolución definitiva a las gestiones planteadas ante las autoridades recurridas, no se enmarca en el derecho de petición, acceso a la información ni se encuentra dentro de los supuestos de excepción establecidos en lo atinente a una justicia pronta y cumplida. Por el contrario, la acusada dilación en resolverse la gestión planteada constituiría, de ser el caso, una violación a lo dispuesto en el artículo 41 de la Constitución Política, motivo por el cual el amparo resulta inadmisible, de conformidad con las siguientes consideraciones. \n\nIII.- NUEVA JUSTICIA ADMINISTRATIVA MECANISMO CÉLERE Y CUMPLIDO PARA LA PROTECCIÓN DE SITUACIONES JURÍDICAS SUSTANCIALES DE LOS ADMINISTRADOS. La Sala Constitucional, desde su fundación, ha utilizado criterios amplios de admisibilidad en vista de la ausencia de cauces procesales expeditos y céleres para la protección de las situaciones jurídicas sustanciales que tienen asidero en el ordenamiento jurídico infraconstitucional o parámetro de legalidad, que guardan conexión indirecta con los derechos fundamentales y el Derecho de la Constitución. Sobre el particular, no debe perderse de perspectiva que la Constitución por su supremacía, súperlegalidad y eficacia directa e inmediata da fundamento indirecto a cualquier situación jurídica sustancial imaginable de las personas. No obstante, bajo una mejor ponderación y ante la promulgación del Código Procesal Contencioso-Administrativo (Ley No. 8508 de 24 de abril de 2006) y su entrada en vigencia a partir del 1° de enero de 2008, ha quedado patente que ahora los justiciables cuentan con una jurisdicción contencioso-administrativa plenaria y universal, sumamente expedita y célere por los diversos mecanismos procesales que incorpora al ordenamiento jurídico esa legislación, tales como el acortamiento de los plazos para realizar los diversos actos procesales, la amplitud de la legitimación, las medidas cautelares, el numerus apertus de las pretensiones deducibles, la oralidad -y sus subprincipios concentración, inmediación y celeridad-, la única instancia con recurso de apelación en situaciones expresamente tasadas, la conciliación intra-procesal, el proceso unificado, el proceso de trámite preferente o \"amparo de legalidad\", los procesos de puro derecho, las nuevas medidas de ejecución (multas coercitivas, ejecución sustitutiva o comisarial, embargo de bienes del dominio fiscal y algunos del dominio público), los amplios poderes del cuerpo de jueces de ejecución, la extensión y adaptación de los efectos de la jurisprudencia a terceros y la flexibilidad del recurso de casación. Todos esos institutos procesales novedosos tienen por fin y propósito manifiesto alcanzar la economía procesal, la celeridad, la prontitud y la protección efectiva o cumplida de las situaciones jurídicas sustanciales de los administrados, todo con garantía de derechos fundamentales básicos como el debido proceso, la defensa y el contradictorio. En suma, la nueva jurisdicción contencioso-administrativa es un cauce idóneo, por sus nuevas características de simplicidad, celeridad y prontitud para el amparo y protección efectiva de las situaciones jurídicas sustanciales de los administrados en las que se requiera recabar prueba o definir algunas cuestiones de legalidad ordinaria.\n\n IV.- VERIFICACIÓN DE LOS PLAZOS PAUTADOS POR LEY PARA RESOLVER LOS PROCEDIMIENTOS ADMINISTRATIVOS: CUESTIÓN EVIDENTE DE LEGALIDAD ORDINARIA. Es evidente que determinar si la administración pública cumple o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes, es una evidente cuestión de legalidad ordinaria que, en adelante, puede ser discutida y resuelta ante la jurisdicción contencioso-administrativa con la aplicación de los principios que nutren la jurisdicción constitucional, tales como los de la legitimación vicaria, la posibilidad de la defensa material -esto es de comparecer sin patrocinio letrado- y de gratuidad para los recurrentes. Consecuentemente, se impone el rechazo de plano e indicarle a las partes gestionantes que si a bien lo tienen pueden acudir a la jurisdicción contencioso-administrativa. \n\n V.- NOTA SEPARADA DEL MAGISTRADO CASTILLO VÍQUEZ. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.\n\n VI.- VOTO SALVADO DEL MAGISTRADO CRUZ CASTRO. Si bien en el pasado he sostenido el criterio de mayoría del Tribunal, bajo una mejor ponderación de los derechos fundamentales que se reclaman, estimo que la mora administrativa constituye una lesión a una garantía procesal fundamental, razón por la que cambio el criterio que había expuesto, admitiendo la posible infracción al derecho a una justicia administrativa pronta y cumplida, separándome de la visión de la mayoría del Tribunal, en el sentido que -salvo contadas excepciones- este tipo de reproches deben resolverse en la jurisdicción contenciosa administrativa. Por el contrario, estimo que uno de los derechos que esta jurisdicción se encuentra llamada a tutelar es el de la justicia pronta y cumplida, expresamente consagrado en el artículo 41 constitucional. Ello conforme al ámbito de competencia asignado a este Tribunal en materia de protección a derechos fundamentales, en atención a lo dispuesto en los artículos 10 y 48 de la Constitución Política. Si bien, entiendo la importancia de las reformas de la jurisdicción contencioso administrativa a partir de la vigencia de la Ley 8508 del veinticuatro de abril de dos mil seis, lo cierto es que dicha situación no justifica la remisión a dicha instancia de los asuntos que versan sobre materia que es competencia de esta Sala, la cual ha demostrado a lo largo de los años que es un medio célere y efectivo para la tutela de los derechos fundamentales de los habitantes del país.\n\n VII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia.   "body_en_text": "EXPEDIENTE N° 26-024506-0007-CO\n\nPROCEEDING: WRIT OF AMPARO (RECURSO DE AMPARO)\n\nRESOLUTION Nº 2026027681\n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, at nine hours and twenty-five minutes on the twenty-first of July, two thousand and twenty-six.\n\nConstitutional amparo writ filed by Nombre01, on behalf of MUNDO VEGETAL SRL, legal entity registration number (cédula jurídica) CED01, against the MINISTERIO DE AMBIENTE Y ENERGÍA and the MINISTERIO DE HACIENDA.\n\nResultando:\n\n1.- By written submission entered into the Judicial Case Management System of this Sala Constitucional at 14:05 hours on July 8, 2026, the petitioning party files an amparo writ against the MINISTERIO DE AMBIENTE Y ENERGÍA and the MINISTERIO DE HACIENDA, on behalf of MUNDO VEGETAL SRL, and states that: \"(…) FIRST: My client, the company Mundo Vegetal SRL, is currently in its pre-operational phase, engaged in the planning and strategic structuring of its international business activities, projecting as its principal activity the importation, distribution, and mass commercialization of bio-based bioplastic (bioplásticos biobasados) products—biodegradable, compostable, and disintegrable—certified under strict international technical standards by impartial third parties (such as TÜV Austria OK Compost Home or OK Compost Industrial). Since this future commercial activity is directly regulated and protected by the environmental mandates of Laws of the Republic N° 8839 (Law for the Comprehensive Management of Waste) and N° 9786 (Law to Combat Plastic Pollution), a clear definition of the regulatory framework is an indispensable and critical requirement for the viability of our planned investments and operations. SECOND: Given the severe legal uncertainty prevailing in the market and the lack of unified technical criteria applied in the various State Procurement Offices (Proveedurías Estatales) in the purchase of conventional plastics—without distinguishing between conventional plastics and bio-based bioplastics (biodegradable and compostable)—as reflected in the publication of tender notices (carteles licitatorios) on the Unified Digital Public Procurement System (SICOP), my client filed on June 3, 2026, a formal inquiry with the Dirección de Contratación Pública of the MINISTERIO DE HACIENDA, in its capacity as the technical and regulatory governing body (Órgano Rector) of state contracting. The central purpose was to define the operational viability of using international standards and accredited third-party certifications in the absence of local technical labeling regulations, and the need for a unified directive to be reflected in the procurement tender notices on the unified state technology procurement platform, in order to prevent unfair competition (greenwashing). THIRD: In parallel, my client carried out the corresponding steps before MINAE (MV-DIRG-10-26, dated May 13, 2026) in its capacity as the sectoral environmental governing body. By official communication DIGECA-236-2026 (June 2, 2026), MINAE declined to address the substantive merits of the viability of standardization for State Procurement Offices in the tender notices posted and published on SICOP, expressly asserting that the technical, operational, and policy-making competence in the area of public procurement belonged exclusively to the MINISTERIO DE HACIENDA. FOURTH: When filing and reiterating the inquiry with the Dirección de Contratación Pública of Nombre02 by means of official communication MV-DIRG-11-2026 (June 3, 2026) (and the subsequent request for intervention of the Contraloría de Servicios), my client explicitly attached as a primary precedent a certified true copy of the aforementioned MINAE communication, advising Nombre02 that the environmental body had already declined jurisdiction in its favor and that a joint determination was required to avoid a legal limbo. FIFTH: On July 1, 2026, Nombre02 issued official communication MH-DCoP-OF-0395-2026, responding to the inquiry in a generic and ambiguous manner. In response, my client submitted on that same date (July 1) a Request for Clarification and Addition (Official Communication MV-DIRG-12-2026) posing closed-form questions (A, B, and C) to make the stated position operational. SIXTH: On July 6, 2026, the Dirección de Contratación Pública of Nombre02 notified official communication MH-DCOP-OF-0406-2026 (Response to the request for clarification and addition). In that act, the respondent authority committed a flagrant denial of justice and material defenselessness (indefensión) by categorically asserting that matters such as sustainable public procurement, environmental certifications, and technical requirements fall exclusively within MINAE's sectoral authority, adding that it does not fall within Nombre02's purview to issue regulatory guidelines aimed at recognizing or prioritizing certifications, thus evading the specific questions posed. SEVENTH: ARBITRARY AND ABSOLUTE OMISSION OF EVIDENCE: In issuing official communication MH-DCOP-OF-0406-2026, the Dirección de Contratación Pública of the Ministerio de Nombre02 completely overlooked and deliberately failed to consider the prior MINAE communication that my client had attached. Nombre02 ignored the direct precedent that MINAE had already declared itself incompetent, limiting itself to \"washing its hands\" of the matter and redirecting the party before the administration (administrado) back to a body that had explicitly already declined jurisdiction. In Official Communication DIGECA-236-2026, MINAE states, verbatim: … \"The specific determination of the admissibility of a seal, certification, or verification mechanism falls to the contracting Administration within the respective procedure, under the framework of Law N° 9986, its Regulations, and the guidelines issued by the MINISTERIO DE HACIENDA, through the competent bodies in the area of public procurement.\" EIGHTH: Through the conduct of both respondent authorities, my client finds itself trapped in a negative jurisdictional conflict (an institutional \"ping-pong\"). MINAE asserts that the matter falls to Hacienda, and Nombre02 formally asserts that it falls to MINAE. Neither of the two institutions of the same Executive Branch (Poder Ejecutivo) assumes the responsibility of resolving the matter, thereby paralyzing the application of Strategic Public Procurement and leaving Mundo Vegetal SRL in a state of absolute legal and commercial defenselessness.\" The petitioner considers that the fundamental rights of the protected company have been violated. The petitioner requests that the writ be declared well-founded with the applicable legal consequences, and that the respondent authorities be ordered to jointly resolve the matter raised by the petitioning party.\n\n2.- Article 9 of the Law of Constitutional Jurisdiction authorizes the Sala Constitucional to summarily reject, on the merits or otherwise, at any time—including at the moment of filing—any petition brought before it that is manifestly inadmissible, or when it considers that there are sufficient elements of judgment to reject it, or when the petition is a mere reiteration or reproduction of a prior identical or similar rejected petition.\n\nThe opinion is drafted by Justice Castillo Víquez; and,\n\nConsiderando:\n\nI.- SUBJECT MATTER OF THE PETITION. However, neither of the respondent authorities assumes responsibility for resolving the matter raised, thereby paralyzing the application of strategic public procurement and leaving the protected party in a state of absolute legal and commercial defenselessness. For these reasons, the petitioner requests the intervention of this constitutional forum (sede constitucional).\n\nII.- SPECIFIC CASE. From the petition and the evidence submitted, it is apparent that the petitioning party's disagreement with the absence of a definitive resolution to the steps taken before the respondent authorities does not fall within the scope of the right of petition (derecho de petición), access to information, or any of the exceptional circumstances established with respect to timely and effective justice (justicia pronta y cumplida). On the contrary, the alleged delay in resolving the matter raised would constitute, if applicable, a violation of the provisions of Article 41 of the Constitución Política, for which reason the amparo is inadmissible, in accordance with the following considerations.\n\nIII.- THE NEW ADMINISTRATIVE JUSTICE: A SWIFT AND EFFECTIVE MECHANISM FOR THE PROTECTION OF PARTIES' SUBSTANTIVE LEGAL INTERESTS. The Sala Constitucional, since its founding, has applied broad admissibility criteria in view of the absence of expeditious and swift procedural channels for the protection of substantive legal interests rooted in the infra-constitutional legal order, or legality parameter (parámetro de legalidad), which bear an indirect connection to fundamental rights and Constitutional Law. In this regard, it must not be lost from sight that the Constitution, by virtue of its supremacy, supra-legality, and direct and immediate efficacy, provides indirect foundation for any conceivable substantive legal interest of individuals. However, upon better consideration and following the enactment of the Código Procesal Contencioso-Administrativo (Ley No. 8508 of April 24, 2006) and its entry into force as of January 1, 2008, it has become evident that parties now have access to a plenary and universal administrative contentious jurisdiction (jurisdicción contencioso-administrativa), which is highly expeditious and swift by virtue of the various procedural mechanisms that this legislation incorporates into the legal order, such as: the shortening of deadlines for carrying out the various procedural acts, broad standing to sue, precautionary measures, the numerus apertus of cognizable claims, oral proceedings—and its sub-principles of concentration, immediacy, and expedition—a single instance with a right of appeal in expressly enumerated situations, intra-procedural conciliation, the unified proceeding, the preferential-track proceeding or \"amparo of legality,\" proceedings on pure questions of law, new enforcement measures (coercive fines, substitutive or commissarial enforcement, attachment of assets of the fiscal domain and certain assets of the public domain), the broad powers of the panel of enforcement judges, the extension and adaptation of the effects of case law to third parties, and the flexibility of the cassation appeal. All of these novel procedural institutions have the evident purpose and aim of achieving procedural economy, speed, promptness, and effective protection of the substantive legal interests of the parties, all with a guarantee of basic fundamental rights such as due process, the right of defense, and the adversarial principle. In sum, the new administrative contentious jurisdiction is a suitable channel—given its new characteristics of simplicity, speed, and promptness—for the effective protection and safeguarding of the substantive legal interests of the parties in cases where it is necessary to gather evidence or resolve certain questions of ordinary legality (legalidad ordinaria).\n\nIV.- VERIFICATION OF STATUTORY DEADLINES FOR RESOLVING ADMINISTRATIVE PROCEEDINGS: A CLEAR QUESTION OF ORDINARY LEGALITY. It is evident that determining whether the public administration complies with the deadlines established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws for special administrative proceedings—for resolving by means of a final administrative act (acto final) an administrative proceeding initiated ex officio or at the request of a party, or for ruling on applicable administrative appeals—is a clear question of ordinary legality that, going forward, may be discussed and resolved before the administrative contentious jurisdiction by applying the principles that inform the constitutional jurisdiction, such as vicarious standing (legitimación vicaria), the possibility of substantive self-representation (defensa material)—that is, of appearing without legal counsel—and the principle of cost-free access for petitioners. Consequently, summary rejection is warranted, and the parties are advised that, if they deem it appropriate, they may resort to the administrative contentious jurisdiction.\n\nV.- SEPARATE NOTE (NOTA SEPARADA) BY JUSTICE CASTILLO VÍQUEZ. I have supported this Tribunal's position that when a party before the administration alleges a violation of the right to timely and effective justice in the administrative forum, it is the Administrative Contentious Courts—and not this Sala—that must hear the legal dispute. However, with the recent enactment of Law n.° 9097, Law Regulating the Right of Petition, it has been established that this right is subject to judicial protection by means of the amparo writ established by Article 32 of the Law of Constitutional Jurisdiction, in relation to Article 27 of the Constitución Política of the Republic of Costa Rica, in cases where the petitioner considers that the material actions of the Administration, its administrative acts, or its response are affecting his or her fundamental rights. In my view, the newly enacted legislation does not imply that this Tribunal must modify its line of case law; it falls to this Tribunal, pursuant to Article 7 of its Law, to define exclusively its own jurisdiction. Therefore, except for those constitutional-legal disputes that have been recognized by this same Sala as exceptional cases that may indeed be heard in this jurisdiction through the constitutional amparo proceeding, in all other cases, and for the reasons set forth by this Tribunal (Sentencia N° 2008-02545 of 8:55 hours of February 22, 2008), the competent courts are those of the administrative contentious jurisdiction, all of which is consistent with Article 25 of the Convención Americana sobre Derechos Humanos, Constitutional Law (values, principles, and norms), and the corresponding statutory provisions, based on a logical, systemic, and teleological interpretation of the legal order.\n\nVI.- DISSENTING VOTE (VOTO SALVADO) OF JUSTICE CRUZ CASTRO. While in the past I have upheld the majority position of the Tribunal, upon better weighing of the fundamental rights invoked, I consider that administrative delay (mora administrativa) constitutes an injury to a fundamental procedural guarantee, for which reason I change the position I had previously held, admitting the possible violation of the right to timely and effective justice in the administrative forum, and dissenting from the majority's view that—save for a few exceptions—this type of complaint must be resolved in the administrative contentious jurisdiction. On the contrary, I consider that one of the rights that this jurisdiction is called upon to protect is that of timely and effective justice, expressly enshrined in Article 41 of the Constitution. This is in keeping with the scope of jurisdiction assigned to this Tribunal in the area of protection of fundamental rights, pursuant to the provisions of Articles 10 and 48 of the Constitución Política. While I understand the importance of the reforms to the administrative contentious jurisdiction following the entry into force of Ley 8508 of April 24, 2006, the fact remains that this circumstance does not justify referring to that forum those matters that concern subject matter falling within this Sala's jurisdiction, which has demonstrated over the years that it is a swift and effective means for the protection of the fundamental rights of the country's inhabitants.\n\nVII.- DOCUMENTATION SUBMITTED TO THE FILE. The parties are hereby advised that any document submitted in paper form, as well as any objects or evidence contained in any additional device of an electronic, computer-based, magnetic, optical, telematic, or new-technology nature, must be retrieved from the office within a maximum period of 30 business days counted from the notification of this judgment. Otherwise, all material not retrieved within this period shall be destroyed, pursuant to the provisions of the \"Reglamento sobre Expediente Electrónico ante el Poder Judicial,\" approved by the Corte Plena in session N° 27-11 of August 22, 2011, Article XXVI, and published in the Boletín Judicial number 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial in session N° 43-12 held on May 3, 2012, Article LXXXI.\n\nPor tanto:\n\nThe petition is summarily rejected.
