  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-012438-0007-CO \n\nRes. Nº 2026029810\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del seis de agosto de dos mil veintiseis .\n\n Recurso de amparo que se tramita en expediente número 26-012438-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPALIDAD DE GARABITO.\n\nRESULTANDO:\n\n1.- Por escrito presentado en la Secretaría de la Sala a las 18:03 horas del 10 de abril de 2026, la parte recurrente interpone recurso de amparo contra la Municipalidad de Garabito. Manifiesta que la municipalidad accionada realiza desde el mes de enero de 2026 una serie de trabajos en la zona de Playa Hermosa, frente a los restaurantes Bowies Point Bar, Vida Hermosa Beach Bar y Restaurant. Reclama que pese a lo anterior, los trabajos involucran la tala y desmonte de árboles, despalmar, retirar escombros, cortar y rellenar con tierra, entre otros, en un terreno que se ubica sobre la ruta Costanera Sur, en el que se encuentra gran variedad de flora y fauna. Alega que para tal efecto, el municipio no cuenta con los permisos respectivos para ejecutar dichos trabajos, lo que ocasiona daño ambiental y a la comunidad de Garabito. Solicita que se declare con lugar el recurso con las consecuencias de ley. \n\n2.- Por resolución de Presidencia de las 18:10 horas del 22 de junio de 2026, se dio curso al presente proceso y se le dio traslado al ALCALDE, al PRESIDENTE DEL CONCEJO Y al JEFE DEL DEPARTAMENTO DE PATENTES DE LA MUNICIPALIDAD DE GARABITO.\n\n3.- Por escrito incorporado al expediente digital a las 15:54 horas del 30 de junio de 2026, informa bajo juramento Francisco González Madrigal, en su condición de alcalde de Garabito, que es cierto que playa Hermosa de Jacó cuenta con un plan regulador parcial costero, en la distribución hay predios que le corresponden a la Municipalidad de Garabito para uso comunal, uno de ellos es al que se refieren al frente del local comercial Bowies Point. No son trabajos preliminares, lo que se trata es de una limpieza general al predio, un lote para uso comunal, los trabajos consistieron en limpiar basura no tradicional que los mismos vecinos y comerciantes colocaban ahí, remover la capa vegetal y maleza de menor tamaño, sí existen árboles la mayoría frutales, pero esos se dejaron ya que estos no generan peligro y son parte del entorno natural. Es un predio de uso comunal que por falta de mantenimiento creció la maleza y era utilizado de forma clandestina para disponer residuos no tradicionales o vegetales en el lugar. Ahora se logra evidenciar por medio de gráficas el antes y el después de la limpieza del tipo de vegetación que existía, además de los árboles frutales que se debían dejar por ser parte del entorno. Por ser un terreno municipal destinado para uso comunal y no ser un bosque, no es necesario tramitar permiso alguno, de ser así la Municipalidad de Garabito cuenta con un Regente Ambiental para tramitar lo correspondiente. Extraño es que se denuncie el acondicionamiento de lo comunal para ser utilizado como facilidades de los que ahí viven, no denunciando la contaminación que se presentaba en el lugar antes de que la municipalidad retomara las acciones que como gobierno local está obligada, se adjunta fotografías del antes y el después de la limpieza donde fácilmente se logra evidenciar la disposición clandestina de forma ilegal de residuos no tradicionales o vegetales por parte de los vecinos. Es un hecho reiterado, parte de los avances de las obras es darle una apariencia bonita el barrio Pochotal de Playa Hermosa de Jacó, área de alto interés turístico nacional e internacional, se realizan construcción de aceras, áreas recreativas, limpieza de contaminación visual, área de estacionamiento comunal, limpieza de áreas públicas, manejo adecuado de las aguas negras y residuales, entre otras, las cuales constituyen más bien restituir a lo natural (pro natura) las áreas afectadas por la contaminación inescrupulosa en el lugar, de esa manera darle una mejor calidad de vida a los lugareños y visitantes. Sin embargo, para eso no se tiene denuncias de los vecinos como el recurrente. Con fundamento en lo expuesto, se demuestra que no existió una afectación arbitraria al derecho constitucional a un ambiente sano, sino más bien una intervención de mantenimiento y limpieza de un bien municipal, dirigida a eliminar un foco de contaminación, sin tala indiscriminada de bosque, menos el desarrollo de una obra en construcción. Se removió de una capa vegetal tipo maleza y eliminación de un botadero clandestino de residuos sólidos, representaba un riesgo a la salud pública y al ambiente, no existió un cambio de uso de suelo más que facilidades comunales, donde este ayuntamiento lo que pretendía es el interés público mejorando las condiciones del sitio. Al ser las afirmaciones del recurrente subjetivas, no tiene respaldo técnico no logrando demostrar una lesión real al ambiente mucho menos a lesionar el ambiente sano y equilibrado de los vecinos, más bien se procura una intervención integral del pueblo altamente turístico. Se demostró que son tareas ordinarias de la administración municipal estando obligados a ejecutarlas el no realizarlas es desproteger constitucionalmente a los vecinos y además estamos obligados a recuperar los espacios públicos, siendo propiedad municipal. Es por cuanto no se considera un acto arbitrario, ilegal o afectación a la naturaleza que se le pueda atribuir a esta municipalidad que amerite la tutela por medio de un recurso de amparo, además el recurrente alega que los hechos se dieron en enero y presentó el recurso hasta abril de 2026, de esa manera se demuestra que el daño no es inmediato, inminente y de urgencia. Solicita a la Sala que declare sin lugar el recurso.\n\n4.- En los procedimientos seguidos se han observado las prescripciones legales. \n\n Redacta el Magistrado Salazar Alvarado; y,\n\nCONSIDERANDO: \n\nI.- OBJETO DEL RECURSO. La parte recurrente indica que la municipalidad accionada realiza desde el mes de enero de 2026 una serie de trabajos en la zona de Playa Hermosa, frente a los restaurantes Bowies Point Bar, Vida Hermosa Beach Bar y Restaurant. Reclama que, pese a lo anterior, los trabajos involucran la tala y desmonte de árboles, despalmar, retirar escombros, cortar y rellenar con tierra, entre otros, en un terreno que se ubica sobre la ruta Costanera Sur, en el que se encuentra gran variedad de flora y fauna. Alega que, para tal efecto, el municipio no cuenta con los permisos respectivos para ejecutar dichos trabajos, lo que ocasiona daño ambiental y a la comunidad de Garabito. \n\nII.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial: \n\na) El cantón de Garabito cuenta con plan regulador parcial costero, siendo que en la distribución hay predios que le corresponden a la Municipalidad de Garabito para uso comunal, uno de ellos es al que se refieren en este amparo, ubicado al frente del local comercial Bowies Point (ver informe rendido bajo juramento). \n\nb) La municipalidad accionada está realizando trabajos de limpieza general al predio en mención, pues se trata de un lote para uso comunal (ver informe rendido bajo juramento).\n\nc) Los trabajos consistieron en limpiar basura no tradicional que los mismos vecinos y comerciantes colocaban ahí, remover la capa vegetal y maleza de menor tamaño, los árboles existentes (la mayoría frutales) se dejaron ya que estos no generan peligro y son parte del entorno natural (ver informe rendido bajo juramento).\n\nd) Por ser un terreno municipal destinado para uso comunal y no ser un bosque, no es necesario tramitar permiso alguno (ver informe rendido bajo juramento).\n\nIII.- SOBRE EL DERECHO A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO. En reiteradas ocasiones, la jurisprudencia de esta Sala ha reconocido que la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos tanto a nivel constitucional como a través de la normativa internacional. Se ha indicado que el ejercicio legítimo de ese derecho requiere que los recursos sean utilizados de manera racional, y que corresponde al Estado la protección del ambiente, según el principio precautorio que rige en materia ambiental. Este principio obliga al Estado a disponer todo lo que sea necesario, dentro del ámbito permitido por la ley, a efectos de impedir que se produzcan daños irreversibles al ambiente, para cuyo efecto es responsable de lograr las condiciones sociales propicias a fin de que cada persona pueda disfrutar de su salud, entendido este derecho como una situación de bienestar físico, psíquico (o mental) y social (véase Sentencia Nº 1998-180 de las 16:24 horas del 13 de enero de 1998). La obligación objetiva del Estado en materia de protección ambiental no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los organismos judiciales, que se tome una medida determinada, pero sí a que se adopten las que sean idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades públicas, o bien, de personas físicas y jurídicas. De este modo, el Estado adquiere la obligación de regular las áreas de la vida social de las cuales puedan surgir peligros para la existencia física de los habitantes de su territorio así como también aquellas que vulneren el ambiente, lo cual puede hacer a través de leyes, reglamentos, acuerdos u otras medidas relacionadas con la organización y los procedimientos administrativos. En consecuencia, la posibilidad de exigir judicialmente, a través del recurso de amparo, un tipo específico de actividad prestacional por parte del Estado en cumplimiento de su deber de protección a la vida, salud o derecho al ambiente en beneficio de sus habitantes, está restringida a la clara verificación de un peligro inminente contra esos derechos de las personas. De lo que se desprende que la injerencia de la jurisdicción constitucional solamente es viable ante la inercia comprobada del Estado, a través de sus órganos competentes, en atender las demandas que en ejercicio de sus derechos realicen los habitantes del país. Según lo establece nuestra Constitución Política en el numeral 169, la administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal. En ese sentido, este Tribunal ya ha dicho que el interés local se entiende como todo aquel de naturaleza pública que importa al cantón de manera directa e inmediata, de suerte tal que la municipalidad respectiva está, no solo facultada, sino también obligada a ocuparse de todo lo que favorezca a su cantón (ver Sentencia N° 2014-002127).\n\nIV.- SOBRE EL CASO CONCRETO. En el sub examine, la parte recurrente aduce que la municipalidad accionada realiza desde el mes de enero de 2026 una serie de trabajos en la zona de Playa Hermosa, frente a los restaurantes Bowies Point Bar, Vida Hermosa Beach Bar y Restaurant. Reclama que, pese a lo anterior, los trabajos involucran la tala y desmonte de árboles, despalmar, retirar escombros, cortar y rellenar con tierra, entre otros, en un terreno que se ubica sobre la ruta Costanera Sur, en el que se encuentra gran variedad de flora y fauna. Alega que, para tal efecto, el municipio no cuenta con los permisos respectivos para ejecutar dichos trabajos, lo que ocasiona daño ambiental y a la comunidad de Garabito. Al respecto, la Sala tiene por demostrado que el cantón de Garabito cuenta con plan regulador parcial costero, siendo que en la distribución hay predios que le corresponden a la Municipalidad de Garabito para uso comunal, uno de ellos es al que se refieren en este amparo, ubicado al frente del local comercial Bowies Point. La municipalidad accionada está realizando trabajos de limpieza general al predio en mención, pues se trata de un lote para uso comunal. Los trabajos consistieron en limpiar basura no tradicional que los mismos vecinos y comerciantes colocaban ahí, remover la capa vegetal y maleza de menor tamaño, los árboles existentes (la mayoría frutales) se dejaron ya que estos no generan peligro y son parte del entorno natural. Por ser un terreno municipal destinado para uso comunal y no ser un bosque, no es necesario tramitar permiso alguno. Ante este panorama, estima la Sala que se debe declarar sin lugar el recurso. Contrario a lo acusado por la parte recurrente, no se trata de una situación que esté afectando el derecho a un ambiente sano y ecológicamente equilibrado, sino que más bien en dicho lugar existía un depósito de basura no tradicional, de manera clandestina, que se utilizaba por parte de algunas personas y que estaba generando problemas ambientales que debían ser atendidos por la municipalidad, al tratarse de un predio de uso comunal. Inclusive, en la prueba fotográfica aportada por el municipio, la Sala logra verificar la situación ambiental en la que se encontraba el lugar. De este modo, no estima este Tribunal que con los hechos mencionados se haya infringido el ordinal 50, de la Carta Política, motivo por el cual procede la desestimatoria del amparo.\n\nV.- NOTA DEL MAGISTRADO SALAZAR ALVARADO. En asuntos ambientales, es también criterio del suscrito, de que si ya ha habido intervención de la Administración Pública, considero que su conocimiento y resolución corresponde a la jurisdicción contenciosa administrativa. No obstante, sí entro a conocer el fondo del asunto cuando están de por medio otros derechos de las personas afectadas por el foco de contaminación, entre ellos, la salud, la calidad de vida y el derecho a gozar de un ambiente sano y libre de contaminación (artículo 50, de la Constitución Política), tal y como sucede en este caso, en el que la parte recurrente acusa que la municipalidad accionada realiza desde el mes de enero de 2026 una serie de trabajos en la zona de Playa Hermosa, frente a los restaurantes Bowies Point Bar, Vida Hermosa Beach Bar y Restaurant. Reclama que, pese a lo anterior, los trabajos involucran la tala y desmonte de árboles, despalmar, retirar escombros, cortar y rellenar con tierra, entre otros, en un terreno que se ubica sobre la ruta Costanera Sur, en el que se encuentra gran variedad de flora y fauna. Alega que, para tal efecto, el municipio no cuenta con los permisos respectivos para ejecutar dichos trabajos, lo que ocasiona daño ambiental y a la comunidad de Garabito, en detrimento de un ambiente sano y ecológicamente equilibrado y de un nivel digno de calidad de vida.\n\nVI.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Debe prevenir esta Sala a las partes que, de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo de treinta días hábiles después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión N°27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial N°19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N°43-12 celebrada el 03 de mayo del 2012, artículo LXXXI. \n\nPOR TANTO: \n\nSe declara sin lugar el recurso. San José, at nine hours and thirty minutes on the sixth of August, two thousand twenty-six.\n\nWrit of amparo (recurso de amparo) filed under case number 26-012438-0007-CO, brought by [Nombre 001], national identity card (cédula de identidad) number [Valor 001], against the MUNICIPALIDAD DE GARABITO.\n\nRECITALS:\n\n1.- By written submission filed with the Secretariat of the Chamber at 18:03 hours on April 10, 2026, the petitioner files a writ of amparo against the Municipalidad de Garabito. The petitioner states that the respondent municipality has been carrying out, since January 2026, a series of works in the Playa Hermosa area, in front of the restaurants Bowies Point Bar, Vida Hermosa Beach Bar and Restaurant. The petitioner claims that, notwithstanding the foregoing, the works involve the felling and clearing (tala y desmonte) of trees, removal of palm cover (despalmar), removal of rubble, cutting and backfilling with earth, among other activities, on a parcel (predio) located along the Costanera Sur route, where a wide variety of flora and fauna is found. The petitioner alleges that, to that end, the municipality does not hold the requisite permits to carry out said works, which is causing environmental harm and harm to the community of Garabito. The petitioner requests that the writ be granted with the legal consequences thereof.\n\n2.- By Presidential Order issued at 18:10 hours on June 22, 2026, the present proceeding was admitted and the case was referred to the MAYOR (ALCALDE), the PRESIDENT OF THE MUNICIPAL COUNCIL (PRESIDENTE DEL CONCEJO), and the HEAD OF THE BUSINESS LICENSING DEPARTMENT (JEFE DEL DEPARTAMENTO DE PATENTES) OF THE MUNICIPALIDAD DE GARABITO.\n\n3.- By written submission incorporated into the digital case file at 15:54 hours on June 30, 2026, Francisco González Madrigal, in his capacity as mayor of Garabito, provides a sworn statement reporting that it is true that Playa Hermosa de Jacó has a partial coastal zoning plan (plan regulador parcial costero), and that under the land distribution there are parcels assigned to the Municipalidad de Garabito for communal use (uso comunal), one of which is the parcel referred to in this case, located in front of the commercial establishment Bowies Point. These are not preliminary works; rather, this involves a general cleanup of the parcel, a lot designated for communal use. The works consisted of removing non-traditional waste (basura no tradicional) that the neighboring residents and business owners themselves had placed there, removing the vegetation layer (capa vegetal) and smaller undergrowth (maleza). There are trees, the majority of which are fruit trees, but these were left in place since they do not pose a danger and are part of the natural surroundings. It is a parcel designated for communal use that, due to lack of maintenance, had become overgrown with undergrowth and was being clandestinely used for the disposal of non-traditional or vegetative waste. Photographic evidence now makes it possible to see, through before-and-after images, the condition of the vegetation that existed there, as well as the fruit trees that were to be left as part of the surroundings. Since the land is municipal property (bien municipal) designated for communal use and does not constitute a forest (bosque), no permit of any kind is required; if that were the case, the Municipalidad de Garabito has an Environmental Compliance Officer (Regente Ambiental) to process the corresponding paperwork. It is strange that the cleanup of a communal space for the benefit of local residents should be reported, while no complaint is made about the contamination that existed at the site before the municipality resumed the actions that, as the local government, it is obligated to carry out; before-and-after photographs are attached, which clearly evidence the clandestine and illegal disposal of non-traditional or vegetative waste by neighboring residents. This is a recurring situation; part of the progress of the works is to give the barrio Pochotal of Playa Hermosa de Jacó—an area of high national and international tourist interest—an attractive appearance. Construction of sidewalks, recreational areas, elimination of visual blight, a communal parking area, cleanup of public areas, and proper management of sewage and wastewater are being carried out, among other activities, all of which constitute, rather, a restoration to a natural state (pro natura) of the areas affected by unscrupulous contamination in the locality, thereby providing a better quality of life for local residents and visitors. Yet there are no complaints from neighbors such as the petitioner about these improvements. Based on the foregoing, it is demonstrated that there was no arbitrary interference with the constitutional right to a healthy environment; rather, this was a maintenance and cleanup intervention on municipal property, aimed at eliminating a source of contamination, without indiscriminate felling of forest, and certainly without the development of a construction project. The vegetation layer of undergrowth was removed and an illegal dump (botadero clandestino) of solid waste (residuos sólidos) was eliminated; it posed a risk to public health and the environment. There was no land-use change (cambio de uso del suelo) beyond the provision of communal facilities, and the aim of this municipal government (ayuntamiento) was to serve the public interest by improving conditions at the site. Since the petitioner's assertions are subjective and lack technical support, the petitioner has failed to demonstrate any actual harm to the environment, much less harm to the neighbors' right to a healthy and balanced environment; rather, the municipality is pursuing a comprehensive intervention in a highly touristic community. It has been demonstrated that these are ordinary administrative tasks of the municipal administration, which is obligated to carry them out—failure to do so would leave neighboring residents constitutionally unprotected—and furthermore the municipality is obligated to reclaim public spaces, which are municipal property. For these reasons, the municipality does not consider this to be an arbitrary or illegal act, or an act affecting nature, attributable to it that would merit protection through a writ of amparo; furthermore, the petitioner alleges that the facts occurred in January and did not file the writ until April 2026, which demonstrates that the harm is not immediate, imminent, or urgent. The respondent requests that the Chamber deny the writ.\n\n4.- In the proceedings conducted, the applicable legal requirements have been observed.\n\nThis opinion is authored by Magistrate Salazar Alvarado; and,\n\nCONSIDERING:\n\nI.- SUBJECT MATTER OF THE WRIT. The petitioner alleges that, to that end, the municipality does not hold the requisite permits to carry out said works, which is causing environmental harm and harm to the community of Garabito.\n\nII.- PROVEN FACTS. For the purposes of deciding this matter, the following facts are deemed duly established, either because they have been evidenced or because the respondent failed to address them as required in the initial order:\n\na) The canton (cantón) of Garabito has a partial coastal zoning plan, and under the land distribution there are parcels assigned to the Municipalidad de Garabito for communal use, one of which is the parcel referred to in this writ of amparo, located in front of the commercial establishment Bowies Point (see sworn statement on record).\n\nb) The respondent municipality is carrying out general cleanup works on the aforementioned parcel, which is a lot designated for communal use (see sworn statement on record).\n\nc) The works consisted of removing non-traditional waste that neighboring residents and business owners themselves had placed there, removing the vegetation layer and smaller undergrowth; the existing trees (the majority fruit trees) were left in place since they do not pose a danger and are part of the natural surroundings (see sworn statement on record).\n\nd) Since the land is municipal property designated for communal use and does not constitute a forest, no permit of any kind is required (see sworn statement on record).\n\nIII.- ON THE RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT. On repeated occasions, the jurisprudence of this Chamber has recognized that public health and the right to a healthy and ecologically balanced environment are protected both at the constitutional level and through international law. It has been held that the legitimate exercise of this right requires that resources be used in a rational manner, and that the State bears responsibility for protecting the environment pursuant to the precautionary principle (principio precautorio) that governs environmental matters. This principle obliges the State to take all necessary measures, within the limits permitted by law, to prevent the occurrence of irreversible harm to the environment, and the State is accordingly responsible for creating the favorable social conditions that allow each person to enjoy good health, understood as a state of physical, psychological (or mental), and social well-being (see Ruling No. 1998-180 of 16:24 hours of January 13, 1998). The State's objective obligation in the area of environmental protection does not necessarily entail a subjective right on the part of individuals to demand, through the courts, that a specific measure be taken, but it does entail the right to have appropriate measures adopted to protect that right, in the face of overtly negligent conduct by public authorities or by natural or legal persons. In this way, the State acquires the obligation to regulate those areas of social life from which dangers to the physical existence of the inhabitants of its territory may arise, as well as those that may harm the environment, which it may do through laws, regulations, agreements, or other measures related to the organization and administrative procedures. Consequently, the possibility of judicially demanding, through a writ of amparo, a specific type of affirmative action by the State in fulfillment of its duty to protect the life, health, or right to a healthy environment of its inhabitants is restricted to the clear verification of an imminent danger to those rights. It follows that the intervention of constitutional jurisdiction is viable only upon demonstrated inaction by the State, through its competent bodies, in addressing demands made by the country's inhabitants in the exercise of their rights. As established by our Carta Política in Article 169, the administration of local interests and services in each canton shall be the responsibility of the Municipal Government. In this regard, this Tribunal has already held that local interest is understood as any matter of a public nature that concerns the canton directly and immediately, such that the respective municipality is not only empowered, but also obligated, to attend to everything that benefits its canton (see Ruling No. 2014-002127).\n\nIV.- ON THE SPECIFIC CASE. In the case at hand, the petitioner alleges that the respondent municipality has been carrying out, since January 2026, a series of works in the Playa Hermosa area, in front of the restaurants Bowies Point Bar, Vida Hermosa Beach Bar and Restaurant. The petitioner claims that, notwithstanding the foregoing, the works involve the felling and clearing of trees, removal of palm cover, removal of rubble, cutting and backfilling with earth, among other activities, on a parcel located along the Costanera Sur route, where a wide variety of flora and fauna is found. The petitioner alleges that, to that end, the municipality does not hold the requisite permits to carry out said works, which is causing environmental harm and harm to the community of Garabito. In this regard, the Chamber finds it established that the canton of Garabito has a partial coastal zoning plan, and that under the land distribution there are parcels assigned to the Municipalidad de Garabito for communal use, one of which is the parcel referred to in this writ of amparo, located in front of the commercial establishment Bowies Point. The respondent municipality is carrying out general cleanup works on the aforementioned parcel, which is a lot designated for communal use. The works consisted of removing non-traditional waste that neighboring residents and business owners themselves had placed there, removing the vegetation layer and smaller undergrowth; the existing trees (the majority fruit trees) were left in place since they do not pose a danger and are part of the natural surroundings. Since the land is municipal property designated for communal use and does not constitute a forest, no permit of any kind is required. In view of this situation, the Chamber finds that the writ must be denied. Contrary to what the petitioner alleges, this is not a situation affecting the right to a healthy and ecologically balanced environment; rather, the site contained an illegal dump of non-traditional waste, used clandestinely by certain individuals, which was generating environmental problems that the municipality was obligated to address, given that the parcel is designated for communal use. Indeed, in the photographic evidence submitted by the municipality, the Chamber was able to verify the environmental condition in which the site was found. Accordingly, this Tribunal does not find that the acts described constitute a violation of Article 50 of the Carta Política, and the writ must therefore be denied.\n\nV.- NOTE BY MAGISTRATE SALAZAR ALVARADO. In environmental matters, it is also the undersigned's position that where the Public Administration has already intervened, jurisdiction and resolution of the matter belongs to the administrative contentious jurisdiction (jurisdicción contenciosa administrativa). Nevertheless, I do proceed to examine the merits of the matter when other rights of the individuals affected by the source of contamination are at stake, including the right to health, quality of life, and the right to enjoy a healthy and pollution-free environment (Article 50 of the Carta Política), as is the case here, where the petitioner alleges that the respondent municipality has been carrying out, since January 2026, a series of works in the Playa Hermosa area, in front of the restaurants Bowies Point Bar, Vida Hermosa Beach Bar and Restaurant. The petitioner claims that, notwithstanding the foregoing, the works involve the felling and clearing of trees, removal of palm cover, removal of rubble, cutting and backfilling with earth, among other activities, on a parcel located along the Costanera Sur route, where a wide variety of flora and fauna is found. The petitioner alleges that, to that end, the municipality does not hold the requisite permits to carry out said works, which is causing environmental harm and harm to the community of Garabito, to the detriment of a healthy and ecologically balanced environment and a dignified quality of life.\n\nVI.- DOCUMENTATION SUBMITTED TO THE CASE FILE. This Chamber must advise the parties that, should any paper documents, objects, evidence stored on any additional device, or electronic, computer-based, magnetic, optical, telematic, or new-technology media have been submitted, these must be retrieved from the office within thirty business days of receipt of notification of this decision; otherwise, all such items will be destroyed in accordance with the provisions of the \"Reglamento sobre Expediente Electrónico ante el Poder Judicial,\" approved by the Corte Plena at Session No. 27-11 of August 22, 2011, Article XXVI, and published in Boletín Judicial No. 19 of January 26, 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at Session No. 43-12 held on May 3, 2012, Article LXXXI.\n\nTHEREFORE:\n\nThe writ is denied.
