  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-020629-0007-CO \n\nRes. Nº 2026031966\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinte minutos del veinte de agosto de dos mil veintiseis .\n\n Recurso de amparo que se tramita en expediente número 26-020629-0007-CO, interpuesto por [Nombre 001], cédula de identidad [Valor 001], contra la MUNICIPALIDAD DE POÁS.\n\nResultando:\n\n1.- Por escrito incorporado al expediente el 9 de junio de 2026, la parte accionante interpone recurso de amparo. Indica que desde 2022 ha realizado diversas gestiones ante la Municipalidad de Poás para su vivienda y la obtención del servicio de agua potable. Señala que el 28 de abril de 2025 planteó una solicitud de permiso de construcción, la cual fue incorporada al sistema municipal bajo el trámite nro. 1219358; sin embargo, indica que transcurrió un plazo considerable sin que se emitiera una resolución de fondo dentro de los términos legales correspondientes. Indica que, el 3 de junio de 2025, se apersonó a la Municipalidad para conocer el estado de su trámite, siendo en esa ocasión se le notificó el rechazo de su solicitud, tras haber transcurrido un lapso mayor al previsto para este tipo de gestiones. Refiere que, ante dicha situación, presentó gestiones adicionales, incluyendo un recurso de revocatoria con apelación en subsidio, invocando normativa relativa al derecho de petición y a la simplificación de trámites administrativos; no obstante, señala que dichas gestiones no fueron debidamente tramitadas por la Administración. Añade que posteriormente continuó aportando la documentación requerida, y que la Municipalidad incluso solicitó una ampliación del plazo para resolver, la cual aceptó; sin embargo, una vez vencido dicho plazo, la Administración se ha limitado a indicar la necesidad de nuevos análisis técnicos, sin emitir una resolución definitiva. Manifiesta que, a la fecha, se encuentra habitando una vivienda terminada que carece del servicio de agua potable, lo cual afecta directamente sus condiciones de vida, salud e higiene, obligándolo a recurrir a soluciones alternativas para suplir una necesidad básica. Finalmente, indica que la autoridad recurrida no ha brindado una justificación suficiente ni razonable sobre la demora o negativa en atender su solicitud, manteniendo su situación en un estado de incertidumbre y afectación continúa.\n\n2.- Mediante resolución de la Presidencia de la Sala de las 11:30 horas del 17 de junio de 2026, se dio curso al amparo.\n\n3.- Informan Heibel Antonio Rodríguez Araya y Marian Lawrence Álvarez, cada uno en su condición de alcalde y coordinadora del Departamento de Gestión de Desarrollo Territorial, ambos de la Municipalidad de Poás. Exponen: “Es parcialmente cierto que el señor [Nombre 001] ha realizado diversas gestiones relacionadas con la construcción de una vivienda en el cantón de Poás. Sin embargo, se rechaza por inexacta cualquier afirmación tendiente a demostrar una actuación omisiva o arbitraria por parte de la Municipalidad de Poás, toda vez que la Administración ha brindado atención continua al trámite N.° 1219358, realizando múltiples revisiones técnicas, prevenciones y resoluciones de rechazo técnico debidamente fundamentadas. Hecho Segundo Es cierto que el administrado presentó solicitud de permiso de construcción bajo el trámite N.° 1219358. No obstante, dicho trámite ha presentado inconsistencias técnicas y documentales que han impedido su aprobación, razón por la cual la Administración ha emitido sucesivas prevenciones y observaciones técnicas para que sean subsanadas por el interesado y su profesional responsable. Hecho Tercero Se rechaza que haya existido silencio administrativo o ausencia de resolución. Del expediente administrativo se desprende que la Municipalidad emitió observaciones y rechazos técnicos en diversas fechas, entre ellas: 03 de junio de 2025. 16 de junio de 2025. 18 de agosto de 2025. 17 de febrero de 2026. 24 de junio de 2026. En todas estas actuaciones se detallaron los requisitos pendientes para continuar con el análisis del proyecto. Hecho Cuarto Se rechaza la afirmación de que el administrado haya cumplido con todos los requisitos exigidos por la normativa vigente. Consta en el expediente administrativo que persistió la necesidad de aportar el alineamiento emitido por el Ministerio de Obras Públicas y Transportes (MOPT), requisito indispensable para el análisis y eventual aprobación del proyecto. Asimismo, se determinó técnicamente la existencia de una plataforma construida sin contar con el permiso municipal correspondiente, circunstancia consignada en el informe de inspección MPO-INS-303-2025. (ver folio 091-094). Hecho Quinto Se rechaza que exista una negativa arbitraria de la Municipalidad de Poás. Las actuaciones realizadas obedecen estrictamente al cumplimiento de la Ley de Construcciones, la normativa urbanística vigente y el Reglamento de Construcciones de la Municipalidad de Poás. La Administración no puede otorgar permisos constructivos cuando persisten incumplimientos técnicos o requisitos legales pendientes. Hecho Sexto Se rechaza la afirmación relativa a una supuesta afectación derivada de la falta de servicio de agua potable atribuible a esta Municipalidad. Mediante oficio MPO-ACU-251-2026 de fecha 25 de junio de 2026, emitido por la Coordinadora del Acueducto Municipal, se certificó que no existe solicitud de servicio nuevo de agua potable ni expediente administrativo alguno presentado por el recurrente ante dicho Departamento. (ver folio 081). Por consiguiente, resulta improcedente atribuir a la Municipalidad una omisión de resolver un trámite que nunca fue formalmente presentado ante la dependencia competente”.\n\n4.- En los procedimientos seguidos se ha observado las prescripciones legales.\n\n Redacta la Magistrada Hess Herrera; y,\n\nConsiderando:\n\nI.- CUESTIÓN PRELIMINAR. Previo a analizar el fondo del asunto -por la presunta violación del derecho a un procedimiento pronto y cumplido- debe explicarse que a partir del voto nro. 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha estimado que deben remitirse a la jurisdicción contencioso administrativa -con algunas excepciones- aquellos asuntos en los que se discute si la Administración Pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo -incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite se plantea un supuesto de excepción, pues se está ante una solicitud relacionada con acceso al agua potable. Aclarado el punto, se entra a resolver, la situación concreta planteada en este amparo.\n\nII.- OBJETO DEL RECURSO. El recurrente manifiesta que desde 2022 ha realizado diversas gestiones ante la Municipalidad de Poás para su vivienda y la obtención del servicio de agua potable. Señala que el 28 de abril de 2025 planteó una solicitud de permiso de construcción, la cual fue incorporada al sistema municipal bajo el trámite nro. 1219358; sin embargo, indica que transcurrió un plazo considerable sin que se emitiera una resolución de fondo dentro de los términos legales correspondientes. Indica que, el 3 de junio de 2025, se apersonó a la Municipalidad para conocer el estado de su trámite, siendo que en esa ocasión se le notificó el rechazo de su solicitud, tras haber transcurrido un lapso mayor al previsto para este tipo de gestiones. Refiere que, ante dicha situación, presentó gestiones adicionales, incluyendo un recurso de revocatoria con apelación en subsidio, invocando normativa relativa al derecho de petición y a la simplificación de trámites administrativos; no obstante, señala que dichas gestiones no fueron debidamente tramitadas por la Administración. Añade que posteriormente continuó aportando la documentación requerida, y que la Municipalidad incluso solicitó una ampliación del plazo para resolver, la cual aceptó; sin embargo, una vez vencido dicho plazo, la Administración se ha limitado a indicar la necesidad de nuevos análisis técnicos, sin emitir una resolución definitiva. Manifiesta que, a la fecha de interposición de este proceso, se encuentra habitando una vivienda terminada que carece del servicio de agua potable, lo cual afecta directamente sus condiciones de vida, salud e higiene, obligándolo a recurrir a soluciones alternativas para suplir una necesidad básica. Finalmente, indica que la autoridad recurrida no ha brindado una justificación suficiente ni razonable sobre la demora o negativa en atender su solicitud, manteniendo su situación en un estado de incertidumbre y afectación continua.\n\nIII.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos: \n\nÚnico) Por oficio MPO-ACU-251-2026 del 25 de junio de 2026, la coordinadora del Acueducto Municipal de Poás señaló: “Por este medio hago constar que, una vez revisados los registros físicos y digitales que administra el Departamento de Acueducto de la Municipalidad de Poás, no se localiza solicitud de servicio nuevo de agua potable o cualquier otro trámite relacionado con la autorización de un nuevo servicio de agua potable presentado a nombre del señor [Nombre 001], cédula de identidad N.° [Valor 002]. En consecuencia, en este Departamento no consta expediente administrativo relacionado con una solicitud de servicio nuevo de agua potable presentada por el citado administrado. Se extiende la presente constancia a solicitud de la Asesoría Legal, para ser incorporada como insumo dentro de la respuesta al recurso de amparo que se tramita bajo el expediente N.° 26-020629-0007-CO, para los fines que correspondan”. (Ver prueba aportada e informe rendido).\n\nIV.- SOBRE EL CASO CONCRETO. RESPECTO AL AGUA POTABLE. En la especie, el recurrente manifiesta que desde 2022 ha realizado diversas gestiones ante la Municipalidad de Poás para su vivienda y la obtención del servicio de agua potable. Señala que el 28 de abril de 2025 planteó una solicitud de permiso de construcción, la cual fue incorporada al sistema municipal bajo el trámite nro. 1219358; sin embargo, indica que transcurrió un plazo considerable sin que se emitiera una resolución de fondo dentro de los términos legales correspondientes. Indica que, el 3 de junio de 2025, se apersonó a la Municipalidad para conocer el estado de su trámite, siendo en esa ocasión se le notificó el rechazo de su solicitud, tras haber transcurrido un lapso mayor al previsto para este tipo de gestiones. Refiere que, ante dicha situación, presentó gestiones adicionales, incluyendo un recurso de revocatoria con apelación en subsidio, invocando normativa relativa al derecho de petición y a la simplificación de trámites administrativos; no obstante, señala que dichas gestiones no fueron debidamente tramitadas por la Administración. Añade que posteriormente continuó aportando la documentación requerida, y que la Municipalidad incluso solicitó una ampliación del plazo para resolver, la cual aceptó; sin embargo, una vez vencido dicho plazo, la Administración se ha limitado a indicar la necesidad de nuevos análisis técnicos, sin emitir una resolución definitiva. Manifiesta que, a la fecha, se encuentra habitando una vivienda terminada que carece del servicio de agua potable, lo cual afecta directamente sus condiciones de vida, salud e higiene, obligándolo a recurrir a soluciones alternativas para suplir una necesidad básica. Finalmente, indica que la autoridad recurrida no ha brindado una justificación suficiente ni razonable sobre la demora o negativa en atender su solicitud, manteniendo su situación en un estado de incertidumbre y afectación continua.\n\nAl respecto, de los autos se desprende que, por oficio MPO-ACU-251-2026 del 25 de junio de 2026, la coordinadora del Acueducto Municipal de Poás señaló: “Por este medio hago constar que, una vez revisados los registros físicos y digitales que administra el Departamento de Acueducto de la Municipalidad de Poás, no se localiza solicitud de servicio nuevo de agua potable o cualquier otro trámite relacionado con la autorización de un nuevo servicio de agua potable presentado a nombre del señor [Nombre 001], cédula de identidad N.° [Valor 002]. En consecuencia, en este Departamento no consta expediente administrativo relacionado con una solicitud de servicio nuevo de agua potable presentada por el citado administrado. Se extiende la presente constancia a solicitud de la Asesoría Legal, para ser incorporada como insumo dentro de la respuesta al recurso de amparo que se tramita bajo el expediente N.° 26-020629-0007-CO, para los fines que correspondan”.\n\nEn consecuencia, al no verificarse gestión alguna respecto al acceso de agua potable pendiente de resolver, lo correspondiente es declarar sin lugar el amparo.\n\nV.- SOBRE EL PERMISO DE CONSTRUCCIÓN. Por otra parte, se reclama la falta de resolución de un permiso de construcción. Al respecto, la gestión cuya falta de respuesta acusa la amparada no se encuentra dentro de los supuestos de excepción establecidos en lo atinente a una justicia pronta y cumplida. Por el contrario, la acusada dilación constituiría, de ser el caso, una violación al artículo 41 de la Constitución Política, motivo por el cual el amparo resulta inadmisible, de conformidad con las siguientes consideraciones.\n\nVI.- NUEVA JUSTICIA ADMINISTRATIVA MECANISMO CÉLERE Y CUMPLIDO PARA LA PROTECCIÓN DE SITUACIONES JURÍDICAS SUSTANCIALES DE LOS ADMINISTRADOS. La Sala Constitucional, desde su fundación, ha utilizado criterios amplios de admisibilidad en vista de la ausencia de cauces procesales expeditos y céleres para la protección de las situaciones jurídicas sustanciales que tienen asidero en el ordenamiento jurídico infra-constitucional o parámetro de legalidad, que guardan conexión indirecta con los derechos fundamentales y el Derecho de la Constitución. Sobre el particular, no debe perderse de perspectiva que la Constitución por su supremacía, súper-legalidad y eficacia directa e inmediata da fundamento indirecto a cualquier situación jurídica sustancial imaginable de las personas. No obstante, bajo una mejor ponderación y ante la promulgación del Código Procesal Contencioso-Administrativo (Ley No. 8508 de 24 de abril de 2006) y su entrada en vigencia a partir del 1° de enero de 2008, ha quedado patente que ahora los justiciables cuentan con una jurisdicción contencioso-administrativa plenaria y universal, sumamente expedita y célere por los diversos mecanismos procesales que incorpora al ordenamiento jurídico esa legislación, tales como el acortamiento de los plazos para realizar los diversos actos procesales, la amplitud de la legitimación, las medidas cautelares, el numerus apertus de las pretensiones deducibles, la oralidad –y sus subprincipios concentración, inmediación y celeridad-, la única instancia con recurso de apelación en situaciones expresamente tasadas, la conciliación intra-procesal, el proceso unificado, el proceso de trámite preferente o “amparo de legalidad”, los procesos de puro derecho, las nuevas medidas de ejecución (multas coercitivas, ejecución sustitutiva o comisarial, embargo de bienes del dominio fiscal y algunos del dominio público), los amplios poderes del cuerpo de jueces de ejecución, la extensión y adaptación de los efectos de la jurisprudencia a terceros y la flexibilidad del recurso de casación. Todos esos institutos procesales novedosos tienen por fin y propósito manifiesto alcanzar la economía procesal, la celeridad, la prontitud y la protección efectiva o cumplida de las situaciones jurídicas sustanciales de los administrados, todo con garantía de derechos fundamentales básicos como el debido proceso, la defensa y el contradictorio. En suma, la nueva jurisdicción contencioso-administrativa es un cauce idóneo, por sus nuevas características de simplicidad, celeridad y prontitud para el amparo y protección efectiva de las situaciones jurídicas sustanciales de los administrados en las que se requiera recabar prueba o definir algunas cuestiones de legalidad ordinaria.\n\nVII.- VERIFICACIÓN DE LOS PLAZOS PAUTADOS POR LEY PARA RESOLVER LOS PROCEDIMIENTOS ADMINISTRATIVOS: CUESTIÓN EVIDENTE DE LEGALIDAD ORDINARIA. Es evidente que determinar si la administración pública cumple o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes, es una evidente cuestión de legalidad ordinaria que, en adelante, puede ser discutida y resuelta ante la jurisdicción contencioso-administrativa con la aplicación de los principios que nutren la jurisdicción constitucional, tales como los de la legitimación vicaria, la posibilidad de la defensa material –esto es de comparecer sin patrocinio letrado- y de gratuidad para la recurrente. Consecuentemente, se impone el rechazo de plano e indicarle a la parte gestionante que si a bien lo tiene puede acudir a la jurisdicción contencioso-administrativa.\n\nVIII.- NOTA DEL MAGISTRADO CASTILLO VÍQUEZ, EN CUANTO A LA JUSTICIA ADMINISTRATIVA PRONTA Y CUMPLIDA. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico.\n\nIX.- VOTO SALVADO DEL MAGISTRADO CRUZ CASTRO. Si bien en el pasado he sostenido el criterio de mayoría del Tribunal, bajo una mejor ponderación de los derechos fundamentales que se reclaman, estimo que la mora administrativa constituye una lesión a una garantía procesal fundamental, razón por la que cambio el criterio que había expuesto, admitiendo la posible infracción al derecho a una justicia administrativa pronta y cumplida, separándome de la visión de la mayoría del Tribunal, en el sentido que –salvo contadas excepciones- este tipo de reproches deben resolverse en la jurisdicción contenciosa administrativa. Por el contrario, estimo que uno de los derechos que esta jurisdicción se encuentra llamada a tutelar es el de la justicia pronta y cumplida, expresamente consagrado en el artículo 41 constitucional. Ello conforme al ámbito de competencia asignado a este Tribunal en materia de protección a derechos fundamentales, en atención a lo dispuesto en los artículos 10 y 48 de la Constitución Política. Si bien, entiendo la importancia de las reformas de la jurisdicción contencioso administrativa a partir de la vigencia de la Ley 8508 del veinticuatro de abril de dos mil seis, lo cierto es que dicha situación no justifica la remisión a dicha instancia de los asuntos que versan sobre materia que es competencia de esta Sala, la cual ha demostrado a lo largo de los años que es un medio célere y efectivo para la tutela de los derechos fundamentales de los habitantes del país. \n\nX.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Debe prevenir esta Sala a la parte recurrente que de haber aportado algún documento, ya sea en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI .\n\nPor tanto:\n\n Se declara sin lugar el recurso. San José, at 9:20 a.m. on 20 August 2026.\n\nAmparo proceeding filed in case number 26-020629-0007-CO by [Nombre 001], identity card [Valor 001], against the MUNICIPALITY OF POÁS.\n\nBackground:\n\n1.- In a written submission entered in the case file on 9 June 2026, the claimant files an amparo application. The claimant states that, since 2022, they have made various requests to the Municipality of Poás concerning their home and obtaining drinking-water service. They state that on 28 April 2025 they submitted an application for a construction permit, which was entered into the municipal system under proceeding No. 1219358; however, they indicate that a considerable period elapsed without a decision on the merits being issued within the applicable legal time limits. They state that on 3 June 2025 they appeared at the Municipality to learn the status of their proceeding, and on that occasion were notified that their application had been rejected, after a period longer than that prescribed for this type of request had elapsed. They report that, in response, they submitted additional requests, including a motion for reconsideration with an appeal in the alternative, invoking rules concerning the right to petition and the simplification of administrative procedures; nevertheless, they state that the Administration did not duly process those requests. They add that they subsequently continued to provide the required documentation, and that the Municipality even requested an extension of the time to decide, which they accepted; however, once that period expired, the Administration has limited itself to indicating that new technical analyses are needed, without issuing a final decision. They state that, as of the present date, they are living in a completed home that lacks drinking-water service, directly affecting their living conditions, health, and hygiene and forcing them to resort to alternative solutions to meet a basic need. Finally, they state that the respondent authority has not provided a sufficient or reasonable explanation for the delay or refusal to address their application, leaving them in a state of uncertainty and ongoing harm.\n\n2.- By order of the President of the Chamber, issued at 11:30 a.m. on 17 June 2026, the amparo was admitted for processing.\n\n3.- Heibel Antonio Rodríguez Araya and Marian Lawrence Álvarez, each in their capacity as mayor and coordinator of the Territorial Development Management Department, respectively, both of the Municipality of Poás, report as follows: “It is partially true that Mr. [Nombre 001] has made various requests related to the construction of a home in the canton of Poás. However, any assertion intended to show an omission or arbitrary conduct by the Municipality of Poás is rejected as inaccurate, since the Administration has continuously addressed proceeding No. 1219358, carrying out multiple technical reviews, issuing requests to remedy deficiencies, and issuing duly substantiated technical rejection decisions. Second Fact It is true that the applicant submitted an application for a construction permit under proceeding No. 1219358. However, that proceeding has presented technical and documentary inconsistencies that have prevented its approval, and for that reason the Administration has issued successive requests to remedy deficiencies and technical observations for the interested party and their responsible professional to address. Third Fact It is denied that there was administrative silence or an absence of a decision. The administrative case file shows that the Municipality issued technical observations and rejections on various dates, including: 03 June 2025. 16 June 2025. 18 August 2025. 17 February 2026. 24 June 2026. In all of these actions, the outstanding requirements for continuing the project review were specified. Fourth Fact It is denied that the applicant fulfilled all requirements under the regulations in force. The administrative case file shows that it remained necessary to provide the alignment certificate issued by the Ministry of Public Works and Transport (MOPT), an essential requirement for reviewing and potentially approving the project. In addition, the technical findings established that a platform had been built without the corresponding municipal permit, a circumstance recorded in inspection report MPO-INS-303-2025. (see folios 091-094). Fifth Fact It is denied that the Municipality of Poás acted arbitrarily in refusing the application. The actions taken strictly comply with the Construction Law, the urban planning regulations in force, and the Building Regulations of the Municipality of Poás. The Administration cannot issue construction permits while technical violations or outstanding legal requirements remain. Sixth Fact The assertion concerning alleged harm resulting from the lack of drinking-water service attributable to this Municipality is denied. By official letter MPO-ACU-251-2026 dated 25 June 2026, issued by the Municipal Aqueduct Coordinator, it was certified that the applicant had submitted neither an application for new drinking-water service nor any administrative case file to that Department. (see folio 081). Accordingly, it is improper to attribute to the Municipality an omission to decide a proceeding that was never formally filed with the competent department.”\n\n4.- The legal requirements have been observed in the proceedings.\n\nDrafted by Justice Hess Herrera; and,\n\nReasons:\n\nI.- PRELIMINARY ISSUE. Before analyzing the merits of the matter—concerning the alleged violation of the right to a prompt and duly completed procedure—it must be explained that, beginning with vote No. 2008-02545, issued at 8:55 a.m. on 22 February 2008, this Chamber has held that matters in which it is disputed whether the Public Administration has complied with the time limits set by the General Law of Public Administration (Articles 261 and 325), or by sector-specific laws governing special administrative procedures, to issue a final decision in an administrative proceeding—initiated on the Administration’s own motion or at a party’s request—or to hear the applicable administrative remedies, must be referred to the administrative-litigation jurisdiction, subject to certain exceptions. This case presents an exception, since it concerns an application related to access to drinking water. That point clarified, the specific situation raised in this amparo will now be resolved.\n\nII.- SUBJECT OF THE AMPARO. The claimant states that, since 2022, they have made various requests to the Municipality of Poás concerning their home and obtaining drinking-water service. The following fact is deemed duly established and relevant to the decision in this matter:\n\nSole) By official letter MPO-ACU-251-2026 dated 25 June 2026, the coordinator of the Municipal Aqueduct of Poás stated: “I hereby certify that, after reviewing the physical and digital records maintained by the Aqueduct Department of the Municipality of Poás, no application for new drinking-water service, or any other procedure related to authorization of a new drinking-water service, submitted in the name of Mr. [Nombre 001], identity card No. [Valor 002], can be found. Consequently, this Department has no administrative case file relating to an application for new drinking-water service submitted by the aforementioned applicant. This certificate is issued at the request of the Legal Counsel’s Office, to be included as supporting material in the response to the amparo proceeding filed under case No. 26-020629-0007-CO, for the appropriate purposes.” (See evidence submitted and report filed).\n\nIV.- THE SPECIFIC CASE. A failure to decide on a construction permit is also alleged. In this regard, the request for which the amparo applicant alleges no response does not fall within the exceptions established with respect to the right to prompt and duly completed justice. Rather, the alleged delay would, if established, constitute a violation of Article 41 of the Political Constitution, and for that reason the amparo is inadmissible, in accordance with the following considerations.\n\nVI.- NEW ADMINISTRATIVE JUSTICE: AN EXPEDITIOUS AND DULY COMPLETED MECHANISM FOR PROTECTING THE SUBSTANTIVE LEGAL POSITIONS OF ADMINISTRATIVE PARTIES. Since its establishment, the Constitutional Chamber has applied broad admissibility criteria in view of the absence of expeditious and prompt procedural channels to protect substantive legal positions grounded in the infra-constitutional legal order or the standard of legality, which are indirectly connected to fundamental rights and the Law of the Constitution. In this regard, it should be kept in mind that, by virtue of its supremacy, super-legality, and direct and immediate effect, the Constitution indirectly provides a basis for any conceivable substantive legal position of individuals. Nevertheless, upon further consideration and following the enactment of the Administrative Litigation Procedure Code (Law No. 8508 of 24 April 2006), which entered into force on 1 January 2008, it has become clear that litigants now have access to a plenary and universal administrative-litigation jurisdiction that is highly expeditious and prompt because of the various procedural mechanisms that legislation introduces into the legal order. These include shorter time limits for carrying out the various procedural acts; broad standing; interim measures; an open-ended range of claims that may be brought; oral proceedings—and their subprinciples of concentration, immediacy, and promptness; a single instance with an appeal in expressly specified situations; settlement during proceedings; unified proceedings; proceedings with preferential processing or “amparo of legality”; proceedings involving only questions of law; new enforcement measures (coercive fines, substitute or commissarial enforcement, seizure of assets in the fiscal domain and some in the public domain); the broad powers of the body of enforcement judges; the extension and adaptation of the effects of case law to third parties; and the flexibility of the appeal in cassation. All these novel procedural institutions are expressly intended to achieve procedural economy, promptness, expeditiousness, and effective or duly completed protection of the substantive legal positions of administrative parties, while safeguarding basic fundamental rights such as due process, the right of defense, and adversarial proceedings. In short, the new administrative-litigation jurisdiction provides a suitable channel, given its new features of simplicity, expeditiousness, and promptness, for the effective protection of the substantive legal positions of administrative parties where evidence must be gathered or ordinary questions of legality must be determined.\n\nVII.- VERIFICATION OF THE TIME LIMITS SET BY LAW FOR DECIDING ADMINISTRATIVE PROCEEDINGS: AN EVIDENT QUESTION OF ORDINARY LEGALITY. It is evident that determining whether the Public Administration complies with the time limits set by the General Law of Public Administration (Articles 261 and 325), or by sector-specific laws governing special administrative procedures, to issue a final decision in an administrative proceeding—initiated on the Administration’s own motion or at a party’s request—or to hear the applicable administrative remedies, is plainly a question of ordinary legality that may henceforth be raised and resolved before the administrative-litigation jurisdiction, applying the principles that inform constitutional jurisdiction, such as derivative standing, the possibility of self-representation—that is, appearing without counsel—and the right of the claimant to proceed free of charge. Consequently, the amparo must be rejected outright, and the applicant must be advised that they may, if they so wish, apply to the administrative-litigation jurisdiction.\n\nVIII.- NOTE BY JUSTICE CASTILLO VÍQUEZ REGARDING PROMPT AND DULY COMPLETED ADMINISTRATIVE JUSTICE. I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and duly completed justice in the administrative forum, the dispute must be heard by the Administrative Litigation Courts and not by this Chamber. However, with the recent enactment of Law No. 9097, Law Regulating the Right to Petition, it has been established that this right is subject to judicial protection by means of the amparo established in Article 32 of the Constitutional Jurisdiction Law, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material actions, its administrative acts, or its response are affecting their fundamental rights. In my view, the recently enacted legislation does not require this Court to change its line of case law, since under Article 7 of its Law this Court alone has authority to define its own jurisdiction. Therefore, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo proceeding, in all other cases the competent judges are those of the administrative-litigation jurisdiction, for the reasons this Court has given (judgment No. 2008-02545, issued at 8:55 a.m. on 22 February 2008). This accords with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the relevant legal provisions, based on a logical, systemic, and teleological interpretation of the legal order.\n\nIX.- DISSENTING OPINION OF JUSTICE CRUZ CASTRO. Although in the past I have endorsed the Court majority’s position, upon further consideration of the fundamental rights at issue, I believe that administrative delay constitutes an infringement of a fundamental procedural guarantee. For that reason, I change the position I previously expressed and accept the possibility that the right to prompt and duly completed administrative justice has been violated, departing from the Court majority’s view that—except in a limited number of cases—this type of complaint must be resolved in the administrative-litigation jurisdiction. On the contrary, I believe that one of the rights this jurisdiction is called upon to protect is the right to prompt and duly completed justice, expressly enshrined in Article 41 of the Constitution. This follows from the jurisdiction assigned to this Court in matters concerning the protection of fundamental rights, under Articles 10 and 48 of the Political Constitution. Although I understand the importance of the reforms to the administrative-litigation jurisdiction that took effect under Law 8508 of 24 April 2006, that circumstance does not justify referring to that forum matters concerning subjects within this Chamber’s jurisdiction, which has shown over the years that it is an expeditious and effective means of protecting the fundamental rights of the country’s inhabitants.\n\nX.- DOCUMENTS SUBMITTED IN THE CASE FILE. This Chamber must advise the claimant that any documents submitted, whether on paper, as objects or evidence stored on any additional device, or through electronic, computer, magnetic, optical, telematic, or new-technology media, must be collected from the court office within 30 business days after notification of this judgment is received. Otherwise, all such materials will be destroyed in accordance with the “Regulation on Electronic Case Files in the Judiciary,” approved by the Full Court at session No. 27-11 on 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 on 26 January 2012, as well as the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo is dismissed.
