  "body_es_text": "Revisión del Documento\n\n\n\nEXPEDIENTE N° 26-025088-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN Nº 2026029158\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del treinta de julio de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre01, con cédula de identidad CED01, en su condición de presidenta de la ASOCIACIÓN ADMINISTRADORA DE ACUEDUCTO RURAL DE SONAFLUCA DE LA FORTUNA DE SAN CARLOS, a favor de Nombre02, cédula CED02; contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS Y LA MUNICIPALIDAD DE SAN CARLOS.\n\nResultando:\n\n 1.- Por escrito presentado en la Secretaría de la Sala el 13 de julio de 2026, la recurrente interpone recurso de amparo. Señala que entre la recurrente y la recurrida existe un proceso judicial en sede contencioso administrativa, expediente que se gestiona bajo el número 26- 002636-1027-CA, el objeto de dicho proceso es verificar la legalidad del proceso sumario que el Instituto Costarricense de Acueductos y Alcantarillados inició en contra de la ASADA SONAFLUCA, en donde se llegó al resultado de eliminar el convenio de administración que ostenta la ASADA como título habilitante para la administración y operación de los acueductos que suministran agua a la comunidad de Sonafluca. Con el objetivo de hacer eficaz la resolución adoptada por la Junta Directiva de la recurrida, se interpusieron unas medidas provisionalísimas con el objetivo de que la ASADA le hiciese entrega absoluta de la infraestructura y de todo instrumento necesario para la administración de la ASADA, esta medida cautelar provisionalísima fue rechazada y posteriormente aceptada, actualmente se encuentra en Casación de lo Contencioso Administrativo esperando resolución, de manera tal que se puede interpretar que no hay firmeza en dicha resolución. A pesar de que la ASADA y el Instituto Costarricense de Acueductos y Alcantarillados se encuentran en un proceso judicial con el objetivo de que un tercero imparcial tome la decisión sobre la base de la técnica, la ciencia y el ordenamiento jurídico costarricense, la recurrida ha venido desplegando una campaña de desacreditación en contra de la ASADA. Recientemente, tomó la decisión de comunicar a la municipalidad de San Carlos mediante carta No. SG-GSD-2026-00678, suscrita el 03 de junio del 2026, lo siguiente: “Reciba un atento saludo. En atención a las competencias legales del Instituto Costarricense de Acueductos y Alcantarillados, como ente rector técnico y titular del servicio público de abastecimiento de agua potable y saneamiento, de manera respetuosa, nos permitimos poner en conocimiento de su representada la actual situación jurídica y administrativa de la Asociación Administradora de Acueducto Rural de Sonafluca de La Fortuna de San Carlos, cédula jurídica N.° 3-002-243990. Mediante acuerdo AN-2026-0171 adoptado en la Sesión Ordinaria N.° 018-2026, celebrada el 13 de mayo de 2026, previa ejecución del debido proceso administrativo sumario, la Junta Directiva del AyA resolvió revocar la delegación y rescindir el convenio suscrito con la ASADA de Sonafluca. Asimismo, se ordenó a la Subgerencia de Gestión de Sistemas Periféricos asumir la prestación directa del servicio de acueducto en la comunidad de Sonafluca, dicho acuerdo fue comunicado a la ASADA de Sonafluca el pasado 14 de mayo de 2026 y es un acto administrativo firme. Esta determinación tiene una consecuencia directa e inmediata sobre la capacidad jurídica de la ASADA de Sonafluca para actuar como operador delegado, debido a que, al haberse revocado la delegación y rescindido el convenio respectivo, dicha Asociación no cuenta con la habilitación conferida por el AyA para prestar el servicio público de abastecimiento de agua potable. La referida falta de habilitación legal tiene una incidencia directa en cuanto a los actos administrativos propios de la prestación de los servicios públicos, dado que la ASADA de Sonafluca ya no se encuentra jurídicamente autorizada para emitir, constancias de disponibilidades de servicios (positivas ni negativas), constancias de capacidad hídrica, constancias de servicios existentes, certificaciones, vistos buenos y ningún documento equivalente relacionado con la prestación del servicio público de acueducto y saneamiento para la comunidad de Sonafluca. En consecuencia, respetuosamente se le solicita informar de esta situación a las distintas dependencias del Gobierno Local a efectos de que tengan en consideración que cualquier acto administrativo emitido por la ASADA de Sonafluca posterior al día 14 de mayo del 2026 carece de validez y eficacia para todos los efectos, incluyendo trámites municipales, permisos de construcción, visados, segregaciones, desarrollos urbanísticos, licencias, autorizaciones o cualquier otro procedimiento administrativo que requiera acreditar disponibilidad o capacidad de abastecimiento de agua potable y/o saneamiento en la zona. No omitimos comentarle que, este Instituto no va a dejar desprotegidos a los terceros de buena fe y; por ende, a partir de la fecha indicada, aplicará lo dispuesto en el artículo 46 del Reglamento de Prestación de Servicios de AyA, siendo que todas las gestiones relacionadas el servicio público de acueducto y saneamiento en la comunidad de Sonafluca, deberán ser canalizadas por parte de los interesados ante el AyA. Esta comunicación se realiza con el propósito de prevenir la utilización de documentos emitidos por una organización que ya no cuenta con competencia legal para ello y de esta manera, ejercer una adecuada coordinación interadministrativa buscando asegurar que los trámites municipales relacionados con el servicio público de agua potable y saneamiento de los usuarios de la comunidad de Sonafluca, se sustenten en actos emitidos por la autoridad competente. Para los efectos correspondientes, se adjunta copia del Acuerdo de Junta Directiva del AyA N.° 2026-0171, Sesión Ordinaria N.° 018-2026, de fecha 13 de mayo de 2026, mediante el cual se resolvió la revocación de la delegación y la rescisión de su convenio de delegación con la ASADA de Sonafluca”. Sobre la base de esta comunicación, y a pesar de existir un proceso judicial en el cual se discute la legalidad de lo actuado por el recurrido Instituto Costarricense de Acueductos y Alcantarillados, este decidió comunicar a terceros que han perdido su legitimidad y que, por lo tanto, no hay que continuar relacionándose con la ASADA. La municipalidad de San Carlos se ha basado en dicha comunicación para negar todo permiso que de alguna forma requiera la intervención de la ASADA, como en el caso de don Nombre02, a quien se le negó un visado porque tenía una disponibilidad de agua de la ASADA SONAFLUCA. Refiere que la decisión adoptada por el AYA y su respectiva comunicación a la otra recurrida municipalidad de San Carlos ha hecho que esta última haya rechazado al señor Nombre02 los permisos municipales respectivos para acceder al servicio de agua potable a través de la ASADA Sonafluca, es decir, se ha violentado el acceso al agua potable, derecho humano y fundamental de todo habitante de la República, por una disposición del AYA, quien en teoría es garante del acceso a este recurso vital. Señala que la parte recurrente no tiene acceso a la solicitud presentada por el señor Nombre02 ante la municipalidad de San Carlos, ni tampoco a la resolución mediante la cual dicha corporación municipal resolvió esa gestión, por cuanto la ASADA Sonafluca no figura como parte dentro de ese procedimiento administrativo y, en consecuencia, carece de acceso al respectivo expediente. No obstante, esta representación tiene conocimiento de que la gestión promovida por el señor Nombre02 fue rechazada como consecuencia de la comunicación remitida por el Instituto Costarricense de Acueductos y Alcantarillados mediante oficio nro. SG-GSD-2026-00678, en la cual se instruyó a la municipalidad de San Carlos para que no otorgara validez a los documentos emitidos por la ASADA Sonafluca con posterioridad al 14 de mayo de 2026. Como quedó expuesto en el marco fáctico, la controversia existente entre el AyA y la ASADA Sonafluca respecto de la validez de la rescisión del convenio de delegación se encuentra sometida al conocimiento de la jurisdicción contencioso-administrativa. Es decir, actualmente existe un proceso judicial destinado a determinar si las actuaciones administrativas desplegadas por el Instituto Costarricense de Acueductos y Alcantarillados se ajustan o no al ordenamiento jurídico. Sin embargo, antes de que esa controversia fuese resuelta por el juez natural de la legalidad administrativa, el AyA decidió comunicar a la municipalidad de San Carlos que la ASADA Sonafluca carecía de competencia para emitir disponibilidades de agua y demás certificaciones relacionadas con la prestación del servicio público, solicitando expresamente que tales documentos dejaran de ser reconocidos por las distintas dependencias municipales. Esa actuación produjo un efecto jurídico inmediato que trasciende el conflicto institucional existente entre el AyA y la ASADA. Como consecuencia de dicha comunicación, la municipalidad de San Carlos rechazó la gestión promovida por el señor Nombre02 para acceder al servicio de agua potable, privándolo materialmente de la posibilidad de obtener el recurso indispensable para satisfacer sus necesidades básicas. En otras palabras, el conflicto dejó de ser exclusivamente administrativo para convertirse en una afectación concreta de un derecho fundamental. Destaca que el señor Nombre02 no forma parte del proceso contencioso-administrativo que actualmente enfrenta al AyA y a la ASADA Sonafluca. Tampoco intervino en el procedimiento administrativo sumario que culminó con la rescisión del convenio de delegación. Se trata de un tercero completamente ajeno a esa controversia jurídica. No obstante, terminó soportando directamente las consecuencias de un conflicto institucional cuya resolución corresponde exclusivamente a los tribunales de justicia. La Administración Pública puede sostener controversias respecto de la legalidad de sus propios actos; puede incluso discutir judicialmente la validez de convenios administrativos o la competencia de los distintos operadores del servicio público. Lo que constitucionalmente no resulta admisible es trasladar las consecuencias de ese conflicto a los habitantes, restringiendo el acceso efectivo a un derecho humano fundamental cuya protección corresponde precisamente a las instituciones recurridas. La Sala Constitucional ha sostenido de manera constante que el acceso al agua potable constituye un derecho preferente que debe prevalecer frente a obstáculos administrativos, conflictos de competencia o controversias entre entidades públicas, especialmente cuando tales situaciones terminan afectando directamente a las personas usuarias del servicio. En el caso concreto, ni el AyA ni la municipalidad de San Carlos realizaron una valoración acerca del impacto que sus decisiones producirían sobre el ejercicio efectivo del derecho al agua por parte del administrado. La actuación administrativa se limitó a ejecutar las consecuencias derivadas de un conflicto institucional, sin ponderar que ello supondría impedir a un ciudadano acceder al servicio público de abastecimiento de agua potable. Tal omisión resulta incompatible con el contenido esencial de los artículos 21 y 50 de la Constitución Política. Las instituciones públicas no solamente deben actuar dentro del marco de la legalidad, sino hacerlo de manera compatible con los derechos fundamentales. Cuando una interpretación administrativa admite varias alternativas posibles, el principio de supremacía constitucional obliga a escoger aquella que mejor proteja los derechos humanos y que menos afecte a los administrados. En el presente caso ocurrió exactamente lo contrario. La interpretación asumida por las autoridades recurridas fue la más gravosa para el ejercicio del derecho al agua potable, pues produjo como consecuencia inmediata la negativa de acceso al servicio por parte de un ciudadano, sin que existiera una resolución judicial firme que hubiese determinado definitivamente la situación jurídica de la ASADA Sonafluca. Por ello, la actuación conjunta del Instituto Costarricense de Acueductos y Alcantarillados y de la municipalidad de San Carlos vulneró directamente los artículos 21 y 50 de la Constitución Política, al anteponer los efectos de una controversia administrativa sobre el ejercicio efectivo de un derecho humano cuya protección constituye uno de los mandatos más importantes del orden constitucional costarricense. Solicita que se ordene a la municipalidad de San Carlos remitir a esta honorable Sala copia íntegra del expediente administrativo correspondiente a la gestión presentada por el señor Nombre02, incluyendo la solicitud formulada, la resolución recaída sobre ella, los fundamentos de hecho y de derecho que motivaron la decisión adoptada y toda la documentación que sirvió de sustento para resolver dicha gestión, por constituir prueba esencial para la resolución del presente recurso. Por las razones de hecho y de derecho expuestas, solicita a esta Sala Constitucional: 1- Que se declare con lugar el presente recurso de amparo por haberse acreditado la violación del derecho humano fundamental de acceso al agua potable, reconocido en los artículos 21 y 50 de la Constitución Política, así como en los instrumentos internacionales que integran el bloque de constitucionalidad. 2- Que se declare que las actuaciones desplegadas por el Instituto Costarricense de Acueductos y Alcantarillados y por la municipalidad de San Carlos, descritas en el presente recurso, lesionan el derecho fundamental de acceso al agua potable al impedir que los administrados puedan acceder efectivamente a dicho servicio como consecuencia de un conflicto administrativo cuya legalidad se encuentra actualmente sometida al conocimiento de la jurisdicción contencioso-administrativa. 3- Que se ordene al Instituto Costarricense de Acueductos y Alcantarillados y a la municipalidad de San Carlos cesar de inmediato las actuaciones que dieron origen a la presente violación constitucional y abstenerse, en lo sucesivo, de ejecutar actos u omisiones que tengan como efecto impedir, obstaculizar o restringir el acceso al agua potable de los habitantes de la comunidad de Sonafluca con fundamento en el oficio nro. SG-GSD-2026-00678 o en cualquier otra actuación administrativa derivada de la controversia judicial actualmente pendiente. 4- Que, en caso de oposición de las recurridas, se condene solidariamente a las autoridades recurridas al pago de las costas, daños y perjuicios ocasionados por la violación de los derechos fundamentales aquí denunciada, los cuales se liquidarán en la etapa de ejecución de sentencia, de conformidad con lo dispuesto por la Ley de la Jurisdicción Constitucional.\n\n 2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada. \n\n Redacta el Magistrado Castillo Víquez; y, \n\nConsiderando:\n\nI.- OBJETO DEL RECURSO. La recurrente como representante de la ASADA SONAFLUCA considera arbitrario que las recurridas desconozcan los actos que emitió como administradora del servicio de agua potable, a partir del 14 de mayo de 2026, tal como la validez de la constancia de disponibilidad de servicios que le emitió al amparado el 25 de mayo de 2026, por 12 meses, pues tiene planteado un proceso contencioso administrativo contra el ICAA por la revocatoria del convenio de delegación.\n\nII.- INADMISIBILIDAD DEL AMPARO. A partir de lo alegado, este Tribunal considera que, determinar si la constancia de disponibilidad de servicios emitida por la recurrente tiene validez, a pesar de haber sido expedida luego de ser revocado el convenio de delegación por parte del ICAA, constituye una discusión de mera legalidad. Tampoco le compete a esta jurisdicción señalar si la mera presentación del proceso contencioso tiene como efecto suspender o no los efectos de revocación del convenio en cuestión, a fin de reconocerle validez a los actos emitidos por esa ASADA, luego del 14 de mayo de 2026, pues tal determinación debe ser adoptada en ese mismo proceso y no en este como pretende la recurrente. En ese sentido, lo pertinente es que acuda el tutelado ante el ICAA o a la vía de legalidad que corresponda a discutir lo aquí pretendido. En lo que respecta a esta jurisdicción, el amparo debe ser rechazado por inadmisible. \n\nIII.- VOTO SALVADO DE LOS MAGISTRADOS CRUZ CASTRO Y RUEDA LEAL, CON REDACCIÓN DEL PRIMERO. Disentimos del criterio de mayoría. En el presente caso, se valida la negativa de la parte recurrida de brindar un servicio esencial, con base en consideraciones técnicas relativas a la insuficiencia de la infraestructura o capacudad hídrica; sin embargo, se omite ponderar adecuadamente que el acceso al agua potable constituye un derecho fundamental, indispensable para la vida, la salud y la dignidad humana.\n\nEl artículo 21 de la Constitución Política protege la vida humana, y este Tribunal ha reconocido que el acceso al agua para consumo humano es un presupuesto material de ese derecho. Asimismo, el artículo 50 constitucional impone al Estado el deber de garantizar el bienestar de todos los habitantes, lo cual incluye necesariamente el acceso efectivo, suficiente y continuo al agua potable. En el ámbito internacional, instrumentos como el Pacto Internacional de Derechos Económicos, Sociales y Culturales –interpretado por el Comité DESC en su Observación General No. 15– reconocen el derecho humano al agua, obligando a los Estados a adoptar medidas positivas para su plena realización. Hay una obligación reforzada impuesta al Estado en un estado social y democrático de derecho, por esta razón el suministro de agua, es una obligación prioritaria de los poderes públicos.\n\nDesde esta perspectiva, la invocación de limitaciones técnicas no puede erigirse en una justificación absoluta para desatender una necesidad básica de subsistencia. Quien administre el suministro de agua no puede limitarse a constatar la insuficiencia del sistema; tiene el deber jurídico de planificar, prever y ejecutar las acciones necesarias para garantizar progresivamente el acceso al servicio al agua, especialmente cuando se trata de consumo humano.\n\nEl enfoque mayoritario normaliza una omisión estructural: acepta que la falta de infraestructura exonera al Estado de su obligación, cuando precisamente esa carencia evidencia un incumplimiento de su deber de previsión. No se trata de obligar a lo imposible, sino de exigir que se adopten medidas razonables, alternativas o progresivas para no dejar en desprotección a las personas.\n\nEl agua no es un servicio cualquiera, es un derecho humano esencial, por ello, la autoridad accionada no puede desentenderse de su deber de garantizarlo, escudándose en limitaciones técnicas sin ofrecer soluciones efectivas.\n\nPor estas razones, estimamos que el recurso debió admitirse, al menos para ordenar la adopción de medidas concretas y progresivas que garantice, en un plazo razonable, el acceso efectivo al agua potable de la parte amparada. El agua es un bien y un derecho fundamental cuya vigencia debe asegurarse efectivamente, es un deber ineludible.\n\n IV.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE.   "body_en_text": "Document Review\n\n\n\nCASE FILE No. 26-025088-0007-CO\n\nPROCEEDING: AMPARO PROCEEDING\n\nRULING No. 2026029158\n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 30 July 2026.\n\nAmparo proceeding filed by Nombre01, holder of identity card CED01, in her capacity as president of the ASOCIACIÓN ADMINISTRADORA DE ACUEDUCTO RURAL DE SONAFLUCA DE LA FORTUNA DE SAN CARLOS, on behalf of Nombre02, holder of identity card CED02; against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS and the MUNICIPALIDAD DE SAN CARLOS.\n\nBackground:\n\n1.- By a brief filed with the Chamber’s Secretariat on 13 July 2026, the applicant files an amparo proceeding. She states that there is an ongoing judicial proceeding in the administrative-litigation jurisdiction between the applicant and the respondent, under case file number 26- 002636-1027-CA. The purpose of that proceeding is to review the legality of the summary proceeding initiated by the Instituto Costarricense de Acueductos y Alcantarillados against ASADA SONAFLUCA, which resulted in the termination of the administration agreement held by the ASADA as authorization to administer and operate the aqueducts supplying water to the community of Sonafluca. To give effect to the decision adopted by the respondent’s Board of Directors, certain extremely provisional measures were filed seeking to require the ASADA to deliver all infrastructure and every instrument necessary for its administration. This extremely provisional precautionary measure was denied and later granted; the matter is currently before the Administrative Litigation Cassation Court awaiting a ruling, so it may be understood that the decision is not final. Although the ASADA and the Instituto Costarricense de Acueductos y Alcantarillados are engaged in a judicial proceeding so that an impartial third party can decide on the basis of technical and scientific evidence and Costa Rican law, the respondent has been carrying out a campaign to discredit the ASADA. Recently, it decided to inform the Municipalidad de San Carlos by letter No. SG-GSD-2026-00678, signed on 03 June 2026, as follows: “Greetings. In view of the legal powers of the Instituto Costarricense de Acueductos y Alcantarillados, as the technical governing body and holder of the public drinking-water supply and sanitation service, we respectfully wish to inform your institution of the current legal and administrative situation of the Asociación Administradora de Acueducto Rural de Sonafluca de La Fortuna de San Carlos, legal identification No. 3-002-243990. By resolution AN-2026-0171 adopted at Ordinary Session No. 018-2026, held on 13 May 2026, following completion of the summary administrative due process, the AyA Board of Directors resolved to revoke the delegation and terminate the agreement entered into with the ASADA de Sonafluca. It also ordered the Subgerencia de Gestión de Sistemas Periféricos to assume direct provision of the aqueduct service in the community of Sonafluca. That resolution was communicated to the ASADA de Sonafluca on 14 May 2026 and is a final administrative act. This determination directly and immediately affects the legal capacity of the ASADA de Sonafluca to act as a delegated operator, because, following revocation of the delegation and termination of the relevant agreement, that Association no longer holds authorization granted by the AyA to provide the public drinking-water supply service. This lack of legal authorization directly affects administrative acts associated with the provision of public services, since the ASADA de Sonafluca is no longer legally authorized to issue statements of service availability (whether positive or negative), statements of water capacity, statements of existing services, certifications, approvals, or any equivalent document related to the provision of the public aqueduct and sanitation service for the community of Sonafluca. Accordingly, we respectfully ask that you inform the various departments of the Local Government of this situation so that they take into account that any administrative act issued by the ASADA de Sonafluca after 14 May 2026 lacks validity and effect for all purposes, including municipal procedures, construction permits, approvals, segregations, urban developments, licenses, authorizations, or any other administrative procedure requiring proof of the availability or capacity of the drinking-water supply and/or sanitation in the area. We would also like to inform you that this Institute will not leave third parties acting in good faith unprotected and, therefore, as of the indicated date, it will apply the provisions of Article 46 of the AyA Service Provision Regulations, with all matters related to the public aqueduct and sanitation service in the community of Sonafluca to be handled by interested parties through the AyA. This communication is intended to prevent the use of documents issued by an organization that no longer has legal authority to issue them and, in this way, to ensure proper inter-administrative coordination and that municipal procedures related to the public drinking-water and sanitation service for users in the community of Sonafluca are based on acts issued by the competent authority. For the relevant purposes, attached is a copy of the AyA Board of Directors Resolution No. 2026-0171, Ordinary Session No. 018-2026, dated 13 May 2026, by which it resolved to revoke the delegation and terminate its delegation agreement with the ASADA de Sonafluca.”\n\nOn the basis of this communication, and despite the existence of a judicial proceeding in which the legality of the actions taken by the respondent Instituto Costarricense de Acueductos y Alcantarillados is being disputed, it decided to inform third parties that the ASADA had lost its legitimacy and that, therefore, they should no longer deal with it. The Municipalidad de San Carlos relied on that communication to deny every permit that in some way required the ASADA’s involvement, as in the case of Mr. Nombre02, whose approval was denied because he had a water-availability statement from ASADA SONAFLUCA. She states that the decision adopted by the AYA and its communication to the other respondent, the Municipalidad de San Carlos, caused the latter to deny Mr. Nombre02 the relevant municipal permits to obtain drinking-water service through the ASADA Sonafluca; in other words, access to drinking water—a human and fundamental right of every resident of the Republic—was violated by an AYA directive, even though the AYA is theoretically responsible for guaranteeing access to this vital resource. She states that the applicant does not have access to the application submitted by Mr. Nombre02 to the Municipalidad de San Carlos or to the ruling by which that municipal corporation decided the matter, because the ASADA Sonafluca is not a party to that administrative proceeding and, consequently, has no access to the relevant case file. Nevertheless, this representative knows that Mr. Nombre02’s application was denied as a result of the communication sent by the Instituto Costarricense de Acueductos y Alcantarillados in official letter No. SG-GSD-2026-00678, instructing the Municipalidad de San Carlos not to recognize as valid documents issued by the ASADA Sonafluca after 14 May 2026.\n\nAs set out in the factual background, the dispute between the AyA and the ASADA Sonafluca concerning the validity of the termination of the delegation agreement is before the administrative-litigation jurisdiction. That is, judicial proceedings are currently underway to determine whether the administrative actions taken by the Instituto Costarricense de Acueductos y Alcantarillados comply with the legal system. However, before that dispute was resolved by the ordinary judge responsible for administrative legality, the AyA decided to inform the Municipalidad de San Carlos that the ASADA Sonafluca lacked authority to issue statements of water availability and other certifications related to public-service provision, expressly asking that those documents no longer be recognized by the various municipal departments. That action had an immediate legal effect extending beyond the institutional dispute between the AyA and the ASADA. As a result of that communication, the Municipalidad de San Carlos denied Mr. Nombre02’s application to obtain drinking-water service, materially depriving him of the possibility of obtaining the resource essential to meeting his basic needs. In other words, the dispute ceased to be exclusively administrative and became a concrete impairment of a fundamental right.\n\nShe emphasizes that Mr. Nombre02 is not a party to the administrative-litigation proceeding currently involving the AyA and the ASADA Sonafluca. Nor did he participate in the summary administrative proceeding that ended with termination of the delegation agreement. He is a third party wholly unrelated to that legal dispute. Nevertheless, he directly bore the consequences of an institutional conflict whose resolution falls exclusively to the courts. The Public Administration may have disputes concerning the legality of its own acts; it may even litigate the validity of administrative agreements or the authority of different public-service operators. What is constitutionally impermissible is to transfer the consequences of that conflict to residents by restricting effective access to a fundamental human right whose protection is precisely the responsibility of the respondent institutions.\n\nThe Constitutional Chamber (Sala Constitucional) has consistently held that access to drinking water is a preferred right that must prevail over administrative obstacles, jurisdictional disputes, or controversies between public entities, especially when such situations directly affect service users. In this case, neither the AyA nor the Municipalidad de San Carlos assessed the impact their decisions would have on the administrator’s effective exercise of the right to water. The administrative action was limited to implementing the consequences of an institutional dispute, without considering that this would prevent a citizen from accessing the public drinking-water supply service. That omission is incompatible with the essential content of Articles 21 and 50 of the Constitution.\n\nPublic institutions must not only act within the law; they must act in a manner compatible with fundamental rights. When an administrative interpretation allows several possible alternatives, the principle of constitutional supremacy requires choosing the one that best protects human rights and least affects those subject to administration. The opposite occurred in this case. The interpretation adopted by the respondent authorities was the most burdensome for the exercise of the right to drinking water, since it immediately resulted in a citizen being denied access to the service, without a final judicial ruling having definitively determined the legal situation of the ASADA Sonafluca. Accordingly, the joint action of the Instituto Costarricense de Acueductos y Alcantarillados and the Municipalidad de San Carlos directly violated Articles 21 and 50 of the Constitution by placing the effects of an administrative dispute ahead of the effective exercise of a human right whose protection is among the most important mandates of Costa Rica’s constitutional order.\n\nShe asks that the Municipalidad de San Carlos be ordered to send this Honorable Chamber a complete copy of the administrative case file concerning the application submitted by Mr. Nombre02, including the application, the ruling issued on it, the factual and legal grounds for the decision, and all documentation supporting the resolution of that matter, as this constitutes essential evidence for deciding this amparo proceeding. For the factual and legal reasons set out, she asks this Constitutional Chamber: 1- To grant this amparo proceeding, as the violation of the fundamental human right of access to drinking water, recognized in Articles 21 and 50 of the Constitution and in the international instruments forming part of the constitutional block, has been established. 2- To declare that the actions taken by the Instituto Costarricense de Acueductos y Alcantarillados and the Municipalidad de San Carlos, as described in this application, violate the fundamental right of access to drinking water by preventing those subject to administration from effectively accessing that service as a consequence of an administrative dispute whose legality is currently before the administrative-litigation jurisdiction. 3- To order the Instituto Costarricense de Acueductos y Alcantarillados and the Municipalidad de San Carlos to immediately cease the actions that gave rise to this constitutional violation and to refrain in the future from carrying out acts or omissions that have the effect of preventing, obstructing, or restricting residents of the community of Sonafluca from accessing drinking water on the basis of official letter No. SG-GSD-2026-00678 or any other administrative action arising from the pending judicial dispute. 4- If the respondents oppose the application, to order the respondent authorities jointly and severally to pay the costs, damages, and losses caused by the alleged violation of the fundamental rights herein reported, to be assessed at the judgment enforcement stage, in accordance with the provisions of the Ley de la Jurisdicción Constitucional.\n\n2.- Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to summarily reject, either outright or on the merits and at any time, including upon filing, any application brought before it that is manifestly inadmissible, or when it considers that there is sufficient evidence to reject it, or that it is merely a reiteration or reproduction of an earlier identical or similar application that was rejected.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- SUBJECT OF THE APPLICATION. As representative of the ASADA SONAFLUCA, the applicant considers it arbitrary for the respondents to refuse to recognize acts it issued as administrator of the drinking-water service from 14 May 2026 onward, such as the validity of the statement of service availability it issued to the amparo beneficiary on 25 May 2026, valid for 12 months, because she has brought administrative-litigation proceedings against the ICAA concerning revocation of the delegation agreement.\n\nII.- INADMISSIBILITY OF THE AMPARO. In light of the allegations, this Court considers that determining whether the statement of service availability issued by the applicant is valid despite being issued after the ICAA revoked the delegation agreement is a matter of ordinary legality. Nor is it within the remit of this jurisdiction to determine whether the mere filing of administrative-litigation proceedings has the effect of suspending the effects of revocation of the agreement in question, so as to recognize the validity of acts issued by that ASADA after 14 May 2026. That determination must be made in those same proceedings, and not here as the applicant seeks. Accordingly, the protected party should pursue the matter before the ICAA or through the appropriate legality proceedings. As far as this jurisdiction is concerned, the amparo must be rejected as inadmissible.\n\nIII.- DISSENTING OPINION OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, DRAFTED BY THE FORMER. We dissent from the majority’s position. In this case, the respondent’s refusal to provide an essential service is upheld on the basis of technical considerations concerning the insufficiency of the infrastructure or water capacity; however, there is no adequate weighing of the fact that access to drinking water is a fundamental right, indispensable to life, health, and human dignity.\n\nArticle 21 of the Constitution protects human life, and this Court has recognized that access to water for human consumption is a material prerequisite for that right. Article 50 of the Constitution also imposes on the State the duty to ensure the well-being of all residents, which necessarily includes effective, sufficient, and continuous access to drinking water. In the international sphere, instruments such as the International Covenant on Economic, Social and Cultural Rights—interpreted by the Committee on Economic, Social and Cultural Rights in its General Comment No. 15—recognize the human right to water and require States to take positive measures for its full realization. The State is subject to a heightened obligation in a social and democratic state governed by the rule of law; for this reason, the supply of water is a priority obligation of the public authorities.\n\nFrom this perspective, invoking technical limitations cannot serve as an absolute justification for disregarding a basic need for subsistence. Whoever administers the water supply cannot merely note the system’s insufficiency; there is a legal duty to plan, anticipate, and carry out the actions necessary to progressively guarantee access to the water service, especially for human consumption.\n\nThe majority’s approach normalizes a structural omission: it accepts that a lack of infrastructure exempts the State from its obligation, when that very deficiency demonstrates a failure to fulfill its duty to plan ahead. This does not mean requiring the impossible, but rather requiring the adoption of reasonable, alternative, or progressive measures so that people are not left unprotected.\n\nWater is not an ordinary service; it is an essential human right. Therefore, the respondent authority cannot shirk its duty to guarantee it by sheltering behind technical limitations without offering effective solutions.\n\nFor these reasons, we consider that the amparo should have been admitted, at least to order the adoption of concrete and progressive measures that ensure the amparo beneficiary effective access to drinking water within a reasonable time. Water is an asset and a fundamental right whose effective exercise must be ensured; this is an unavoidable duty.\n\nIV.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be collected from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, any such material not collected within that period will be destroyed, as provided in the “Regulations on the Electronic Case File before the Judiciary,” approved by the Full Court at Session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at Session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo proceeding is summarily rejected.
