  "body_es_text": "\n\nEXPEDIENTE N° 26-021676-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN Nº 2026029423\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del cuatro de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre02, cédula de identidad número CED01, en su condición de socio de Punta Leona Beach Club and Nature Resort Sociedad Anónima, contra la Municipalidad de Garabito.\n\nResultando:\n\n1.- Por escrito recibido mediante Gestión en Línea a las 13:12 horas del 16 de junio de 2026, el recurrente manifiesta lo siguiente: \n\n“(…) PRIMERO: Soy socio del Complejo Punta Leona, conforme consta en copia del carné que aporto en la documentación adjunta, ubicado en el cantón de Garabito, provincia de Puntarenas. \n\nSEGUNDO: Conforme consta en diversos medios noticiosos, la Municipalidad de Garabito recientemente removió de forma unilateral estructuras en el camino privado de los socios del complejo y que utilizamos para accesar a Playa Blanca. Adicionalmente, habilitó unilateralmente y sin proceso judicial previo, el acceso al público por medio de este camino privado. \n\nEn recientes declaraciones, el Alcalde de Garabito indica que abrió la aguja de Punta Leona en “ejecución a un cumplimiento que debíamos haber hecho hace 25 años. En octubre del 2001 se declara calle pública hasta Playa Blanca y por cuestiones que desconozco no se cumplió y el día de hoy, como habíamos venido intentando ejecutar, pero por una medida cautelar que solicitó Punta Leona o las personas que de alguna manera se beneficiaban de tener ese camino público privatizado, el martes de esta semana le dan de baja la medida cautelar y nos permite quitar los obstáculos que tenía la vía pública para llegar a Playa Blanca”. (Ver https://crhoy.com/nacionales/video-alcalde-de-garabito-explica-por-que-retiraron-agujas-en-punta-leona/) \n\nA todas luces es evidente que el Alcalde hace mención a la sentencia 291-P-01 dictada por el Juez Penal de Puntarenas el treinta y uno de octubre del dos mil uno, a menos que presente alguna sentencia que sea desconocida por todos. \n\nTERCERO: Esta actuación de la MUNICIPALIDAD DE GARABITO no sólo es contradictoria con los diversos expedientes de la Sala Constitucional sino que es ABSOLUTAMENTE violatoria del artículo 45 de la Constitución Política, en perjuicio de Punta Leona y de todos sus socios, grupo del cual formo parte en condición de socio. Esto por cuanto las actuaciones irregulares han invadido y violentado un terreno que es propiedad de todos los socios y de acceso exclusivo de dichos socios. \n\nCUARTO: Lo primero que llama la atención al suscrito es que la sentencia que el Alcalde señala fue objeto de ejecución por parte del Municipio, ya consta ejecutada desde hace más de 20 años. Al respecto: \n\nComo parte del expediente de recurso de amparo 02-008802-0007-CO, la misma Sala Constitucional señala: “b) El 9 de octubre del 2002, el Lic. G.M.A., Juez integrante del Tribunal Penal de Puntarenas, ejecutó la sentencia 291-P-91 y realizó la apertura del camino, con el auxilio de la autoridad de policía que actuó siempre bajo la dirección del L.M.A.. Se contó con la asesoría técnica del Ingeniero V.G.C., funcionario del Instituto Geográfico Nacional. Estuvieron presentes en la diligencia el Fiscal de Garabito, el Procurador Penal y el abogado Defensor de los imputados y su asesor técnico, entre otras personas (informe folio 185 y ss)”. \n\nComo parte del expediente de recurso de amparo 02-009640-0007-CO, la Sala Constitucional señala que el Juez del Tribunal de Puntarenas rindió en su informe que: “… Acepta que en la sentencia 291-P-01 no se indicó el ancho y el trazo del camino, sino que éste se identificó mediante una serie de señales externas, como se concluye de la lectura de los considerandos de la misma. (…) Sostiene que el acto de ejecución contó con el auxilio de la autoridad de policía, que garantizó la efectividad de la diligencia y la seguridad de todos los intervinientes. siempre bajo la dirección del licenciado M.A.. Refiere que la intervención policial se mantuvo dentro de los límites en que debe actuar un cuerpo de esa naturaleza y permitió el logro de los objetivos que pretendía el Tribunal. Establece que en la diligencia participaron el Fiscal de Garabito, el Procurador Penal, el Abogado Defensor de los imputados, un ingeniero, un socio de Punta Leona que se ofreció como asesor técnico y otras personas como socios y empleados de Punta Leona, pero no se permitió la presencia de público para preservar el orden. Agrega que en la diligencia se contó con la asesoría técnica del ingeniero, V.G.C.. funcionario del Instituto Geográfico Nacional y sus ayudantes, quienes partiendo de la sentencia y de la inspección judicial practicada durante el debate, determinaron con certeza el punto inicial, un punto intermedio y uno final de la senda. Igualmente manifiesta que el Procurador Penal, que había estado en la primera inspección, dio fe de que el camino abierto coincidía en el que había recorrido en dicha inspección. Resume que la apertura del camino fue el resultado de una amplia sustanciación en la que se respetó el derecho de defensa de las partes involucradas, se realizó con la presencia y en condiciones de absoluto respeto de los intervinientes y sus asesores, contó con la asesoría técnica idónea y con el control y la dirección de un juez que garantizó la total coincidencia entre el objeto real del litigio y el objeto de ejecución, todo ello dentro del marco de las competencias otorgadas por la ley al Tribunal.” \n\nComo parte del expediente de recurso de amparo 02-008897-0007-CO, la Sala Constitucional señala que el Juez Presidente del Tribunal de Puntarenas rindió en su informe que: “… Ese acto no fue más que la consecuencia natural de lo resuelto mediante la sentencia #291-P-01. Una vez que la sentencia adquiere firmeza, el Tribunal no podría hacer otra cosa más que ejecutarla. El decidir no ejecutarla sí que habría sido actuar en forma antojadiza y caprichosa. La apertura del camino tampoco fue arbitraria. La sentencia adquirió firmeza desde el 3 de mayo de 2002. Desde ese momento se debió proceder a la ejecución de lo resuelto. Sin embargo, ello no se hizo entonces \n\nporque se tuvieron que resolver múltiples gestiones, excepciones, recursos, amparos, recusaciones y acusaciones penales. Al ejecutar la apertura, todo lo que podía tener incidencia sobre la ejecución había sido resuelto. Puede afirmarse, entonces, que no se dejó de atender ningún reparo invocado por las partes procesales, aún cuando ninguno tendiente a suspender la ejecución haya prosperado. (…) El Procurador Penal, que había estado en la primera inspección, dio fe de que el camino abierto coincidía con el que había recorrido en dicha inspección. (…)” \n\nComo parte del expediente de recurso de amparo 02-010004-0007-CO, la Sala Constitucional señala que el Juez Presidente del Tribunal de Puntarenas rindió en su informe que: “…la ejecución practicada dentro del proceso 95-000838-427-CO, en ella se tomaron las medidas necesarias para no llegar a invadir terrenos de terceros; que no sólo se ingresó con miembros de la Guardia Civil y maquinaria pesada, sino también con un ingeniero del Instituto Geográfico Nacional y su grupo de ayudantes, a fin de garantizar técnicamente la correcta ejecución de lo ordenado en sentencia; que quienes estuvieron en la ejecución, saben que ello permitió evitar el paso por un camino privado del hotel, en una bifurcación a mitad del trayecto; que gracias a esa asesoría técnica, se evitó seguir un tramo final por el que se extendía el camino, ya que ingresa a la propiedad del hotel o sociedad Punta Leona; que la asesoría del experto resultó fundamental para no exceder en ninguna forma los términos de lo que había sido objeto de contradictorio y resuelto mediante la sentencia 291-P-01;que esa sentencia no indicó el ancho y el trazo del camino; (…) que en la diligencia se contó con la asesoría técnica de un ingeniero que es funcionario del Instituto Geográfico Nacional y de sus ayudantes, quienes partiendo de la sentencia y de la inspección judicial practicada durante el debate, determinaron con certeza un punto inicial, un punto intermedio y uno final de la senda; (…).” \n\nComo parte del expediente de recurso de amparo 12-002222-0007-CO, la Sala Constitucional señala: “IV.- SOBRE LA IMPOSIBILIDAD DE UTILIZAR EL CAMINO DE ADOQUINES. Paralelamente, Nombre01. aseguró que se le impide el paso por el camino de adoquines ubicado en Playa Blanca, con lo cual se irrespeta la sentencia No. 291-P-01, dictada por el Tribunal de Puntarenas, que lo declaró público. En este sentido, el recurrente debe tener claro que no corresponde a este Tribunal fiscalizar el cumplimiento o no de resoluciones dictadas en otras jurisdicciones. Cualquier disconformidad con la ejecución del fallo aludido debe formularla en el propio proceso, para que la autoridad competente tome las medidas necesarias.” \n\nCON BASE EN LO ANTERIOR, ESTA ABSOLUTAMENTE COMPROBADO, SIN ESPACIO PARA NINGUNA DUDA, QUE LA SENTENCIA PENAL FUE DEBIDAMENTE EJECUTADA DESDE EL 9 DE OCTUBRE DEL 2002 Y QUE CUALQUIER DISCONFORMIDAD CON LA EJECUCIÓN DEL FALLO ALUDIDO SE DEBE FORMULAR POR LAS VÍAS LEGALES APLICABLES. \n\nEn ese sentido, realizar una supuesta ejecución de un fallo ya ejecutado es un acto completamente contrario al principio de legalidad y violatorio del artículo 45 citado. \n\nQUINTO: El segundo aspecto que llama la atención al suscrito es que el Municipio procede a abrir arbitrariamente la calle privada y que señala abiertamente que es “pública”, cuando la misma \n\nMunicipalidad de Garabito, a través del anterior Alcalde, rindió informe a la Sala Constitucional en el 2023 indicando que el camino de Playa Blanca es privado. \n\nAl respecto, como parte del expediente de recurso de amparo 23-004285-0007-CO, la Sala Constitucional señala que el entonces Alcalde de Garabito rindió en su informe que: (…) Por su parte, para acceder a Playa Blanca existen dos formas, una a través de la Zona Pública desde Playa Mantas, atravesando el acantilado de rocas mencionado y finalmente accediendo a ésta, y la otra es por medio de calles privadas dentro de las fincas del Complejo Hotelero-Residencial Punta Leona, toda vez que no existen calles públicas que lleguen a Playa Blanca ya que todos los accesos se constituyeron desde la década de los años 30´s y 40´s del siglo anterior a través de propiedades PRIVADAS que se inscribieron con sujeción a la actual Ley de Zona Marítima Terrestre, lo que impide que haya un acceso por vía pública hasta dicha playa ya que obligatoriamente los únicos accesos que existen están DENTRO DE PROPIEDAD PRIVADA y se requiere ser socio del club para poder utilizar dichas calles y llegar a dicha playa.(…)”. \n\nIncluso en el informe rendido en dicho expediente, el Alcalde de Garabito aporta un croquis en donde claramente marca como privada esta calle. CONFORME EL AXIOMA JURÍDICO “A CONFESIÓN DE PARTE, RELEVO DE PRUEBAS”, ES UN HECHO INDUBITABLE QUE LA MUNICIPALIDAD DE GARABITO HA DECLARADO LA NATURALEZA PRIVADA DEL CAMINO QUE AHORA ABRE DE FORMA IRREGULAR.\n\nSEXTO: En relación a las actuaciones violatorias del artículo 45 constitucional, esta honorable Sala ha señalado: \n\nEn sentencia 2006-01797 de las catorce horas y cuarenta y seis minutos del quince de Febrero del dos mil seis, se señala: “Si bien a la Sala no es a la que le corresponde determinar el destino que dicha calle desempeñaba, y en consecuencia, si debía convertirse o no en pública, lo cierto es que la Municipalidad recurrida, nunca realizó los trámites de expropiación respectivos ni indemnizó previamente a las propietarias a pesar que su decisión vaciaba el contenido esencial de su derecho. Es evidente que toda limitación que vacíe de contenido el derecho de propiedad debe realizarse a través del trámite de expropiación respectivo, porque sino, nos encontraríamos frente a un apoderamiento puramente fáctico de un bien privado por parte de la Administración, lo cual ocurren en el caso concreto. Lo anterior, configura un apoderamiento por vía de hecho que lesiona de forma directa el patrimonio de las amparadas, por lo que debe restituírseles en el pleno goce de su derecho de propiedad, sin perjuicio que se realicen los trámites de expropiación respectivos.” \n\nEn sentencia 2006-015457 de las dieciséis horas y treinta y ocho minutos del veinticinco de octubre del dos mil seis, la Sala señala en lo que interesa lo siguiente: \n\nIII.- Sobre el derecho de propiedad. El artículo 45 de la Constitución Política establece que “La propiedad es inviolable; a nadie puede privarse de la suya si no es por interés público legalmente comprobado, previa indemnización conforme a la ley…” El concepto de propiedad que tutela la norma constitucional precitada debe concebirse como una afectación de un bien a favor de un administrado. Es decir, la imputación de un bien que se encuentra en el comercio de los hombres a un sujeto determinado le confiere a éste el poder jurídico de disposición sobre el mismo. Tal poder de disposición debe reputarse jurídico porque implica, para su titular, la posibilidad de hacerlo respetar coactivamente frente a los demás sujetos del ordenamiento, quienes tienen la obligación correlativa de abstenerse de vulnerar o perturbar ese disfrute. Por ello, el derecho de propiedad, en cuanto derecho real por antonomasia, reviste naturaleza “erga omnes”, sea que es oponible a toda comunidad. Bajo esta línea la propiedad constitucional comprende todos los intereses apreciables que un hombre puede poseer fuera de sí mismo, de su vida y de su libertad, con lo que todos los bienes susceptibles de valor económico o apreciable en dinero alcanzar nivel de derechos patrimoniales rotulados unitariamente como derecho constitucional de propiedad. Es de esta manera que esta Sala ha dicho que la inviolabilidad de la propiedad privada significa la prohibición para imponerle limitaciones al derecho de propiedad contra la voluntad de su titular, si los sacrificios o privaciones no le deparan algún beneficio. Por ello, el principio de inviolabilidad fija un límite más allá del cual el titular del derecho está constitucionalmente garantizado contra confiscaciones, requisitos y limitaciones a la propiedad. \n\nIV.- Sobre las limitaciones al derecho de propiedad como derecho fundamental. Para analizar la constitucionalidad de un límite impuesto a un derecho, debe estudiarse si dicho \n\nlímite quebranta o no el contenido esencial del derecho. El límite de los límites está inserto en la propia necesidad de justificación de éstos. Debe realizarse una relación entre la limitación y el bien cuya protección se persigue. De manera que, ha de realizarse el juicio de proporcionalidad (prohibición del límite arbitrario) y el juicio de razonabilidad (resistencia frente a una limitación injustificada). Es una especie de juicio económico donde ha de analizarse la relación: costo, beneficio y sacrificio del derecho fundamental. El contenido esencial o núcleo del derecho, es lo constitucionalmente garantizado, no así el resto del derecho. En el caso particular de la propiedad privada su limitación es condicionar su ejercicio a potestades administrativas o a deberes para subordinarla como institución a otra de más alto rango, por la importancia del interés que representa, en un episodio de conflicto entre ambas. Ello ocurre cuando el haz de potestades y facultades se constituye en amenazas para otros intereses distintos del que es propio de la propiedad privada. De esta manera, es como este Tribunal ha señalado que toda limitación que afecte el ejercicio y el contenido del derecho de propiedad es inconstitucional. Siendo que lo que se permite es delimitar, definir, atribuir las potestades y facultades del propietario, que sirven como medio para el cumplimiento del fin natural y normal de la propiedad; esta delimitación se puede producir desde el punto de vista jurídico, por dos vías diversas: a) a través de regulaciones propiamente normativas (ley o reglamento), o b) bien mediante actos administrativos individualizados, que pueden ser discrecionales en cuanto a motivo o contenido, tales actos deben respetar, asimismo, el contenido esencial del derecho de propiedad garantizado constitucionalmente. \n\nV.- Sobre el caso concreto. En el caso concreto se tiene por probado que la amparada Parque Industrial Guachipelín Sociedad Anónima es propietaria de los inmuebles inscritos (…). Bajo este supuesto, esta Sala observa que la adjudicación de la finca a Scotia Bank se dio por medio de la resolución de las catorce horas del cinco de junio del año dos mil, siendo que han transcurrido más de seis años en los que la Administración no ha ejercido acción alguna tendente a recuperar vía judicial lo que alegan es su derecho, no siendo diligente en el trámite de sus intereses, sin embargo sí emitió lo que consideran una medida cautelar limitado el ejercicio del derecho de propiedad, sin tener por ello que cargar el administrado con las consecuencias negativas que de la inercia de la Municipalidad se deriven. Lo importante de resaltar en este caso es que la Municipalidad de Vázquez de Coronado no puede bajo ningún supuesto dictar ninguna resolución o emitir ningún criterio que limite el ejercicio del derecho de propiedad, como lo hizo en el presente caso al establecer que no se aprobaría trámite alguno en relación con esa área en virtud de ser esta un bien de dominio público, sin que para ello medie denuncia interpuesta ante la autoridad judicial competente ni mucho menos un resolución que le otorgue tal derecho, vaciando el contenido de derecho de propiedad de la amparada al impedirle realizar construcciones o persuadir a terceros de la adquisición de la finca por un hecho futuro e incierto, pues la Municipalidad en seis años no ha procedido conforme según lo indica tiene tal derecho. Así las cosas es menester indicarle a la Municipalidad recurrida que si estima tener un mejor derecho frente a un bien inmueble, lo procedente es dilucidar la situación ante la autoridad judicial \n\ncompetente para conocer y resolver el caso, quienes a su vez serán los que tomen las medidas cautelares que el ordenamiento jurídico les habilite tomar; no tomar la justicia en sus propias manos decidiendo no aprobar trámite alguno sobre el bien, restringiendo el uso y disfrute de la propiedad, razón por la cual el amparo debe declararse con lugar con las consecuencias jurídicas que de ello se derive. \n\nSÉTIMO: En virtud de lo anterior, siendo absolutamente claro y demostrable que (i) la sentencia aludida por el Alcalde ha sido plenamente ejecutada, y (ii) la misma Municipalidad de Garabito hace escasos tres años declaró a esta honorable Sala que esa calle (ahora en disputa) es de naturaliza privada, lo procedente, según el voto antes citado, es que si la Municipalidad estima tener un mejor derecho frente a este bien inmueble, debe dilucidar la situación ante la autoridad judicial competente para conocer y resolver el caso, quienes a su vez serán los que tomen las medidas cautelares que el ordenamiento jurídico les habilite tomar y NO TOMAR LA JUSTICIA EN SUS PROPIAS MANOS. \n\nCon base en lo anterior, SOLICITO se declare con lugar el presente recurso y se ordene a la Municipalidad de Garabito no perturbar la propiedad privada de todos los socios del Complejo Punta Leona hasta tanto no se ordene lo contrario por medio de autoridad judicial competente. Asimismo, al haber recurrido a las vías de hecho contrarias al ordenamiento jurídico, solicito se condene al Municipio a las costas del proceso, así como a la obligación de reparar los daños y perjuicios ocasionados a las partes afectadas por dicho accionar. \n\nFUNDAMENTOS DE DERECHO: Fundamento todo lo anterior en la Constitución Política de Costa Rica, y cualquier otra normativa aplicable, con particularidad especial en los artículos 33 de la Ley de Jurisdicción Constitucional y 45 de la Constitución Política. (…)”.\n\n \n\n2.- Por escrito recibido mediante Gestión en Línea a las 18:09 horas del 16 de junio de 2026, el recurrente manifestó lo siguiente:\n\n“(…) deseo ampliar en lo siguiente: \n\nPRIMERO: Si bien se trata de un hecho público y notorio, los actos denunciados de violación a propiedad privada fueron realizados por la Municipalidad de Garabito de forma específica el día jueves 4 de junio del 2026 (https://crhoy.com/nacionales/municipalidad-de-garabito-derriba-aguja-en-punta-leona-estamos-abriendo-la-calle/) y lamentablemente se amplían el día de hoy 16 de junio del 2026 (https://crhoy.com/nacionales/fotos-y-video-municipalidad-derriba-caseta-de-seguridad-y-clausura-restaurante-en-punta-leona/) \n\nComo puede observarse, LAS ACTUACIONES ARBITRARIAS DE LA MUNICIPALIDAD DE GARABITO YA CONTEMPLAN NO SÓLO PELIGRO DE REINCIDENCIA, SINO QUE LO OCURRIDO EL DIA DE HOY DEMUESTRA LA CERTEZA DE REINCIDENCIA. Es por ello que la URGENTE atención de esta honorable Sala es aquí solicitada. \n\nSEGUNDO: La pretensión del suscrito se aclara en el sentido que SOLICITO se declare con lugar el presente recurso y se ordene a la Municipalidad de Garabito no perturbar la propiedad privada del Complejo Punta Leona, específicamente la calle de acceso a Playa Blanca que discurre por propiedad privada según el trazo que la misma municipalidad aportó en expediente 23-004285-0007-CO y sus terrenos privados aledaños, hasta tanto no se ordene lo contrario por medio de autoridad judicial competente. Asimismo, al haber recurrido a las vías de hecho contrarias al ordenamiento jurídico, solicito se condene al Municipio a las costas del proceso, así como a la obligación de reparar los daños y perjuicios ocasionados a las partes afectadas por dicho accionar. (…)”. \n\n \n\n3.- Por resolución de la Presidencia de esta Sala de las 15:17 horas del 25 de junio de 2026, se previno a la parte recurrente lo siguiente: “(…) De previo a resolver lo que proceda en el RECURSO DE AMPARO que se tramita en el expediente No. 26-021676-0007-CO, interpuesto por Nombre02, indique la parte recurrente, dentro del plazo de TRES DÍAS, contado a partir de la notificación de este pronunciamiento lo siguiente: • En forma clara y precisa si cuenta con el poder correspondiente otorgado por la entidad privada referida (Complejo Punta Leona), para actuar en defensa del derecho de propiedad; • De ser afirmativa la respuesta deberá aportar copia completa y legible del documento que así lo acredita; De igual modo, deberá aportar cualquier prueba adicional en la cual fundamente su dicho. (…)”.\n\n4.- Por escrito recibido a las 20:56 horas del 29 de junio de 2026 el recurrente manifestó lo siguiente:\n\n“(…) PRIMERO: LEGITIMACIÓN DEL SUSCRITO. \n\nAclaro que, de conformidad con el artículo 33 de la Ley de Jurisdicción Constitucional actúo en carácter personal y en cuenta propia como RECURRENTE, para lo cual interpongo este recurso EN FAVOR DE LOS AGRAVIADOS abajo indicados. Adicionalmente aclaro que el complejo Punta Leona (www.puntaleona.com) es propiedad de PUNTA LEONA BEACH CLUB AND NATURE RESORT SOCIEDAD ANONIMA, cédula jurídica 3-101-024566, entidad de la cual soy socio conforme consta en la prueba aportada en Anexo #1 del recurso inicial. En ese sentido, aclaro que las partes del recurso son: \n\nRECURRENTE: Nombre02 \n\nRECURRIDO: Municipalidad de Garabito \n\nAGRAVIADOS: Son (i) Punta Leona Beach Club and Nature Resort S.A., cédula jurídica 3-101-024566, (ii) el recurrente en su condición de socio, y (iii) todos los restantes socios de la entidad indicada. \n\nEn ese sentido, solicito se dé curso al presente recurso a haberse individualizado de forma clara y puntual las personas agraviadas con el actuar inconstitucional de la Municipalidad de Garabito. \n\nSEGUNDO: TRASGRESIONES CONSTITUCIONALES: \n\nEn resumen de mis escritos iniciales, considero que las actuaciones de la Municipalidad de Garabito resultan absolutamente violatorias de los siguientes derechos constitucionales de los AGRAVIADOS: \n\n• Principio de Inviolabilidad de la Propiedad Privada: Artículo 45 de la Constitución Política \n\n• Principio de Cosa juzgada: Artículos 41 y 42 de la Constitución Política \n\n• Adicionalmente, considerando que el presente recurso está en estudio de admisibilidad, deseo ampliar la violación del artículo 50 constitucional sobre el derecho a un ambiente sano y ecológicamente equilibrado, acto que se plantea en favor de la colectividad en general como derecho difuso. \n\n• Según expuesto en mis escritos iniciales, en fechas 4 de junio del 2026 y 16 de junio del 2026 la Municipalidad de Garabito destruyó una aguja de ingreso y una caseta de guarda, respectivamente, en la calle privada que comunica Playa Mantas con Playa Blanca. Adicionalmente, realiza declaraciones “de facto” asegurando la naturaleza pública de esa calle privada al señalar: “La posición del gobierno local es que la vía intervenida corresponde a una calle pública, por lo que no debería existir ninguna restricción para llegar hasta la playa”, conforme puede observarse en diario CRHOY en fecha 5 de junio del 2026 (https://crhoy.com/nacionales/ya-se-puede-entrar-a-playa-blanca-por-punta-leona-alcalde-aclara-dudas-sobre-acceso-y-parqueo/) . \n\nSegún el informe rendido por la misma municipalidad de Garabito hace escasos tres años en el expediente constitucional 23-004285-0007-CO, la Municipalidad declara a la Sala y reconoce que este camino es PRIVADO. Por lo que, en ausencia de un proceso judicial, esta nueva actuación de la Municipalidad es violatoria del Artículo 45 en perjuicio de los AGRAVIADOS.\n\nComo intento de “justificar” una actuación a todas luces inconstitucional e arbitraria, el Alcalde de Garabito declara a los medios que la apertura de esa aguja se hizo en “ejecución a un cumplimiento que debíamos haber hecho hace 25 años. En octubre del 2001 se declara calle pública hasta Playa Blanca y por cuestiones que desconozco no se cumplió y el día de hoy, como habíamos venido intentando ejecutar, pero por una medida cautelar que solicitó Punta Leona o las personas que de alguna manera se beneficiaban de tener ese camino público privatizado, el martes de esta semana le dan de baja la medida cautelar y nos permite quitar los obstáculos que tenía la vía pública para llegar a Playa Blanca”. (Ver https://crhoy.com/nacionales/video-alcalde-de-garabito-explica-por-que-retiraron-agujas-en-punta-leona/) Esto en clara alusión a la sentencia 291-P-01 dictada por el Juez Penal de Puntarenas el treinta y uno de octubre del dos mil uno, a menos que presente alguna sentencia que sea desconocida por todos. \n\nSin embargo, conforme consta en esta honorable Sala, bajo expedientes 02-008802-0007-CO, 02-009640-0007-CO, 02-008897-0007-CO, 02-010004-0007-CO, entre otros, dicha sentencia fue ABSOLUTAMENTE EJECUTADA desde el 9 DE OCTUBRE DEL 2002 por lo que existe una clara violación del PRINCIPIO DE COSA JUZGADA bajo Artículos 41 y 42 de la Constitución Política con el actuar municipal y su supuesta ejecución de una sentencia, al ser un fallo ya ejecutado. \n\nLas actuaciones de la Municipalidad han invadido y violentado un terreno que es propiedad de los AGRAVIADOS, violentando adicionalmente el principio de cosa juzgada. En virtud de lo anterior, siendo absolutamente claro y demostrable que (i) la sentencia aludida por el Alcalde ha sido plenamente ejecutada, y (ii) la misma Municipalidad de Garabito hace escasos tres años declaró a esta honorable Sala que esa calle (ahora en disputa) es de naturaliza privada, lo procedente, es que si la Municipalidad estima tener un mejor derecho frente a este bien inmueble, debe dilucidar la situación ante la autoridad judicial competente para conocer y resolver el caso, quienes a su vez serán los que tomen las medidas cautelares que el ordenamiento jurídico les habilite tomar y NO TOMAR LA JUSTICIA EN SUS PROPIAS MANOS. \n\nEN EL PRESENTE CASO, EN MI CRITERIO LO QUE SE OBSERVA ES UNA EXPROPIACIÓN INCONSTITUCIONAL, PURA Y SIMPLE, SIN NINGÚN PROCESO PREVIO NI FUNDAMENTO LEGAL EN PERJUICIO DE LOS AGRAVIADOS. \n\nTERCERO: ASPECTOS AMBIENTALES: \n\nEn adición al hecho que el actuar de la Municipalidad no tiene ningún asidero constitucional, según antes expuesto, existe también una clara violación al principio de ambiente sano y equilibrado que protege la Constitución Política. Lo anterior por cuanto: \n\n1. Playa Blanca es un ecosistema que ha tomado décadas construir y proteger. Es actualmente el único humedal marino en el Pacifico Central, distinción que le fue otorgada mediante Decreto Ejecutivo N° 23127.-MIRENEM de las diez horas del día siete del mes de abril de \n\n \n\n \n\nmil novecientos noventa y cuatro. Conforme al Considerando tercero de dicho decreto: “3°-Que los estudios preliminares llevados a cabo en la Playa Blanca, ubicada en la costa occidental del país, al SO de Punta Leona, en la provincia de Puntarenas (coordenadas geográficas CED02 Y CED03 han demostrado que la zona intermareal presenta una gran diversidad de organismos marinos como peces, moluscos, crustáceos y equinodermos que se hace necesario proteger”. \n\nAl abrir de forma abrupta una propiedad privada para el ingreso masivo, sin un acto administrativo previo, sin un estudio ambiental, sin un plan de contingencia, sin habilitar baños para el público o servicios básicos, es decir, sin ningún tipo de planificación, la Municipalidad de Garabito pone en alto riesgo este ecosistema. Ballenas Jorobadas, como puede observarse en https://delfino.cr/2024/09/ballenas-jorobadas-eligen-punta-leona-como-refugio-ideal-para-sus-crias \n\nTortuga Lora, como puede observarse en https://delfino.cr/2026/01/punta-leona-impulsa-conservacion-de-la-tortuga-lora-en-playa-blanca \n\nLapas rojas, según el esfuerzo internacionalmente reconocido de más de tres décadas de parte de Punta Leona https://lapasrojaspuntaleona.com/ \n\nEl turismo regenerativo que ha impulsado Punta Leona Beach Club and Nature Resort S.A se puede observar en la protección y frecuencia de: \n\nEl alcalde de Garabito, lejos de reconocer el esfuerzo ambiental, anunció el interés de realizar un concierto masivo en este humedal marino, nuevamente, sin un estudio previo, sin una planificación de impacto ambiental y claramente poniendo en riesgo ambiental décadas de esfuerzo de protección de la naturaleza. (…)”. \n\n \n\n5.- Por escrito recibido mediante Gestión en Línea a las 10:35 horas del 25 de julio de 2026, el recurrente manifestó lo siguiente: “(…) Atentamente solicito se dé curso al presente recurso a haberse individualizado de forma clara y puntual las personas agraviadas con el actuar inconstitucional de la Municipalidad de Garabito. (…)”. \n\n6.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y, \n\nConsiderando:\n\n I.- OBJETO DEL RECURSO. El recurrente indica que acude ante esta Sala en su condición de socio de Punta Leona Beach Club and Nature Resort S.A. Alega que la Municipalidad de Garabito recientemente removió de forma unilateral estructuras en el camino privado de los socios del complejo y que utilizan como acceso a Playa Blanca. Adicionalmente, habilitó unilateralmente y sin proceso judicial previo, el acceso al público por medio de este camino privado. Estima que esto es violatorio del artículo 45 de la Constitución Política, en perjuicio de Punta Leona y de todos sus socios. El recurrente aclara que su pretensión es la siguiente: “SOLICITO se declare con lugar el presente recurso y se ordene a la Municipalidad de Garabito no perturbar la propiedad privada del Complejo Punta Leona, específicamente la calle de acceso a Playa Blanca que discurre por propiedad privada según el trazo que la misma municipalidad aportó en expediente 23-004285-0007-CO y sus terrenos privados aledaños, hasta tanto no se ordene lo contrario por medio de autoridad judicial competente. Asimismo, al haber recurrido a las vías de hecho contrarias al ordenamiento jurídico, solicito se condene al Municipio a las costas del proceso, así como a la obligación de reparar los daños y perjuicios ocasionados a las partes afectadas por dicho accionar”. \n\nLuego, por escrito recibido el 29 de junio de 2026, el recurrente pretende ampliar sus alegatos por violación al derecho a un ambiente sano y ecológicamente equilibrado, toda vez que, en su criterio, al abrir el ingreso masivo hacia Playa Blanca, sin un estudio ambiental ni plan de contingencia, se pondría en riesgo este ecosistema y acusa el alcalde recurrido manifestó interés en realizar un concierto masivo en este sitio. \n\nII.- INADMISIBILIDAD DEL AMPARO. En el sub iudice, el recurrente acude ante esta Sala en su condición de socio de Punta Leona Beach Club and Nature Resort S.A., pues en su criterio la Municipalidad de Garabito lesiona el derecho a la propiedad consagrado en el artículo 45 constitucional. Por resolución de la Presidencia de esta Sala de las 15:17 horas del 25 de junio de 2026 se le previo aclarar si cuenta con el poder correspondiente otorgado por la entidad privada afectada para actuar en defensa de ese derecho. Al efecto, el recurrente aclaró que:\n\n“(…) de conformidad con el artículo 33 de la Ley de Jurisdicción Constitucional actúo en carácter personal y en cuenta propia como RECURRENTE, para lo cual interpongo este recurso EN FAVOR DE LOS AGRAVIADOS abajo indicados. Adicionalmente aclaro que el complejo Punta Leona (www.puntaleona.com) es propiedad de PUNTA LEONA BEACH CLUB AND NATURE RESORT SOCIEDAD ANONIMA, cédula jurídica 3-101-024566, entidad de la cual soy socio conforme consta en la prueba aportada en Anexo #1 del recurso inicial. En ese sentido, aclaro que las partes del recurso son: \n\nRECURRENTE: Nombre02 \n\nRECURRIDO: Municipalidad de Garabito \n\nAGRAVIADOS: Son (i) Punta Leona Beach Club and Nature Resort S.A., cédula jurídica 3-101-024566, (ii) el recurrente en su condición de socio, y (iii) todos los restantes socios de la entidad indicada. (…)”.\n\n \n\nEn virtud de lo anterior, este recurso deviene en improcedente, toda vez que el actor no cuenta con la representación requerida del titula del derecho de propiedad supuestamente lesionado para formular este recurso. Cabe aclarar que si bien el recurso de amparo se rige por la legitimación vicaria (artículo 33 de la Ley de la Jurisdicción Constitucional), lo cierto es que, en el fondo la pretensión del aquí recurrente es meramente patrimonial, sin demostrar que cuenta con la representación de la sociedad afectada -titular del derecho de propiedad- para plantear este recurso a su favor. Pese a que el recurrente amplió sus alegatos en el sentido de que se lesiona el derecho a un ambiente sano y ecológicamente equilibrado, en su argumentación no brinda elementos de juicio que permitan acreditar la existencia de actuaciones u omisiones de la municipalidad recurrida que amenacen o lesionen el ecosistema de Playa Blanca, más allá de suposiciones carentes de sustento fáctico. Con base en lo anterior, procede rechazar de plano este recurso, como en efecto se dispone. \n\nIII.-DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a la parte recurrente que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\nSe rechaza de plano el recurso. \n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo.   "body_en_text": "\n\nCASE FILE No. 26-021676-0007-CO\n\nPROCEEDING: AMPARO APPLICATION\n\nRULING No. 2026029423\n\nCONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 4 August 2026.\n\nAmparo application filed by Nombre02, identity card number CED01, in his capacity as a member of Punta Leona Beach Club and Nature Resort Sociedad Anónima, against the Municipality of Garabito.\n\nBackground:\n\n1.- In a document received through Gestión en Línea at 13:12 on 16 June 2026, the applicant states the following:\n\n“(…) FIRST: I am a member of the Punta Leona Complex, as shown by a copy of the membership card that I provide in the attached documentation, located in the canton of Garabito, province of Puntarenas.\n\nSECOND: As reported in various news media, the Municipality of Garabito recently unilaterally removed structures on the private road belonging to the members of the complex, which we use to access Playa Blanca. In addition, it unilaterally opened access to the public by means of this private road without prior judicial proceedings.\n\nIn recent statements, the Mayor of Garabito says that he opened the Punta Leona barrier gate in “execution of a compliance obligation that we should have fulfilled 25 years ago. In October 2001, the road to Playa Blanca was declared public, and for reasons I do not know, that was not carried out. Today, as we had been trying to carry it out, but because of a precautionary measure requested by Punta Leona or by the people who in some way benefited from having that public road privatized, on Tuesday of this week the precautionary measure was lifted, allowing us to remove the obstacles that the public road had on the way to Playa Blanca.” (See https://crhoy.com/nacionales/video-alcalde-de-garabito-explica-por-que-retiraron-agujas-en-punta-leona/)\n\nIt is plainly evident that the Mayor is referring to judgment 291-P-01 issued by the Puntarenas Criminal Judge on thirty-one October two thousand one, unless he presents some judgment unknown to everyone.\n\nTHIRD: This action by the MUNICIPALITY OF GARABITO is not only inconsistent with the various case files of the Constitutional Chamber but is ABSOLUTELY in violation of Article 45 of the Political Constitution, to the detriment of Punta Leona and all its members, of whom I am one. This is because the irregular actions have encroached upon and violated land owned by all the members and accessible exclusively to those members.\n\nFOURTH: The first thing that draws my attention is that the judgment the Mayor says was enforced by the Municipality had already been enforced more than 20 years ago. In this regard:\n\nAs part of amparo case file 02-008802-0007-CO, the Constitutional Chamber itself states: “b) On 9 October 2002, Lic. G.M.A., a judge serving on the Puntarenas Criminal Court, enforced judgment 291-P-91 and opened the road, with the assistance of the police authority, which acted at all times under the direction of L.M.A. Technical advice was provided by Engineer V.G.C., an employee of the National Geographic Institute. Those present at the proceeding included the Garabito Prosecutor, the Criminal Prosecutor, and the defense attorney for the accused and his technical adviser, among others (report, folio 185 et seq.).”\n\nAs part of amparo case file 02-009640-0007-CO, the Constitutional Chamber states that the judge of the Puntarenas Court reported: “… He accepts that judgment 291-P-01 did not specify the width or route of the road, but that it was identified by a series of external markers, as follows from reading its recitals. (…) He maintains that the enforcement act was assisted by the police authority, which ensured the effectiveness of the proceeding and the safety of all those involved, at all times under the direction of Lic. M.A. He states that the police intervention remained within the limits applicable to a body of that nature and enabled the Court to achieve its intended objectives. He reports that the proceeding was attended by the Garabito Prosecutor, the Criminal Prosecutor, the defense attorney for the accused, an engineer, a Punta Leona member who offered to serve as technical adviser, and other Punta Leona members and employees, but the public was not allowed to attend in order to preserve order. He adds that technical advice was provided during the proceeding by Engineer V.G.C., an employee of the National Geographic Institute, and his assistants, who, on the basis of the judgment and the judicial inspection conducted during the trial, determined with certainty the starting point, an intermediate point, and the endpoint of the path. He likewise states that the Criminal Prosecutor, who had attended the first inspection, attested that the road opened was the same one he had traversed during that inspection. He summarizes that the road was opened following extensive proceedings in which the right of defense of the parties involved was respected; it was done in the presence of, and under conditions of absolute respect for, those involved and their advisers; it had appropriate technical advice and the oversight and direction of a judge who ensured that the actual subject matter of the dispute and the subject matter of enforcement fully coincided; all of this was within the scope of the powers granted to the Court by law.”\n\nAs part of amparo case file 02-008897-0007-CO, the Constitutional Chamber states that the President Judge of the Puntarenas Court reported: “… That act was no more than the natural consequence of the decision in judgment #291-P-01. Once the judgment became final, the Court could do nothing other than enforce it. Choosing not to enforce it would indeed have been arbitrary and capricious conduct. Nor was the opening of the road arbitrary. The judgment became final on 3 May 2002. From that point on, what had been decided should have been enforced. However, that was not done then\n\nbecause multiple applications, exceptions, appeals, amparo applications, recusals, and criminal accusations had to be resolved. When the road was opened, everything that could affect enforcement had been resolved. It can therefore be said that no objection raised by the parties to the proceedings was left unaddressed, even though none of the objections seeking to suspend enforcement succeeded. (…) The Criminal Prosecutor, who had attended the first inspection, attested that the road opened was the same one he had traversed during that inspection. (…)”\n\nAs part of amparo case file 02-010004-0007-CO, the Constitutional Chamber states that the President Judge of the Puntarenas Court reported: “… the enforcement carried out in proceeding 95-000838-427-CO included the measures necessary to avoid encroaching on third parties’ land; not only were members of the Civil Guard and heavy machinery brought in, but also an engineer from the National Geographic Institute and his team of assistants, to technically ensure proper enforcement of what the judgment ordered; those present during enforcement know that this made it possible to avoid using a private road belonging to the hotel at a fork halfway along the route; thanks to that technical advice, proceeding along a final segment of the road was avoided because it enters the property of the hotel or Punta Leona company; the expert’s advice was essential to ensure that the terms of what had been contested and resolved by judgment 291-P-01 were not exceeded in any way; that judgment did not specify the width or route of the road; (…) technical advice was provided during the proceeding by an engineer employed by the National Geographic Institute and his assistants, who, on the basis of the judgment and the judicial inspection conducted during the trial, determined with certainty a starting point, an intermediate point, and an endpoint of the path; (…).”\n\nAs part of amparo case file 12-002222-0007-CO, the Constitutional Chamber states: “IV.- ON THE IMPOSSIBILITY OF USING THE COBBLESTONE ROAD. In parallel, Nombre01 asserted that he was being prevented from passing along the cobblestone road located at Playa Blanca, thereby disregarding judgment No. 291-P-01, issued by the Puntarenas Court, which declared it public. In this regard, the applicant must understand that it is not for this Court to monitor whether decisions issued in other jurisdictions have been complied with. Any disagreement with enforcement of the aforementioned judgment must be raised in that proceeding so that the competent authority may take the necessary measures.”\n\nON THE BASIS OF THE FOREGOING, IT IS ABSOLUTELY PROVEN, BEYOND ANY DOUBT, THAT THE CRIMINAL JUDGMENT WAS DULY ENFORCED ON 9 OCTOBER 2002 AND THAT ANY DISAGREEMENT WITH ENFORCEMENT OF THE AFOREMENTIONED JUDGMENT MUST BE RAISED THROUGH THE APPLICABLE LEGAL CHANNELS.\n\nIn that regard, purporting to enforce a judgment that has already been enforced is an act wholly contrary to the principle of legality and in violation of the cited Article 45.\n\nFIFTH: The second matter that draws my attention is that the Municipality proceeded to arbitrarily open the private road while openly asserting that it is “public,” even though the Municipality of Garabito itself, through the former Mayor, reported to the Constitutional Chamber in 2023 that the Playa Blanca road is private.\n\nIn this regard, as part of amparo case file 23-004285-0007-CO, the Constitutional Chamber states that the then Mayor of Garabito reported: (…) As for reaching Playa Blanca, there are two ways: one through the Public Zone from Playa Mantas, crossing the aforementioned rocky cliff and then reaching it; the other is by private roads within the properties of the Punta Leona Hotel-Residential Complex. There are no public roads that reach Playa Blanca, since all access routes were established in the 1930s and 1940s of the preceding century across PRIVATE properties registered subject to the current Maritime Terrestrial Zone Law, which prevents access by public road to that beach, because the only existing access routes are necessarily WITHIN PRIVATE PROPERTY, and one must be a member of the club to use those roads and reach that beach. (…)”\n\nIndeed, in the report submitted in that case file, the Mayor of Garabito provided a sketch clearly marking this road as private. UNDER THE LEGAL MAXIM “A PARTY’S ADMISSION DISPENSES WITH PROOF,” IT IS AN UNDOUBTED FACT THAT THE MUNICIPALITY OF GARABITO HAS DECLARED THE PRIVATE NATURE OF THE ROAD IT IS NOW IRREGULARLY OPENING.\n\nSIXTH: Regarding actions that violate Article 45 of the Constitution, this Honorable Chamber has stated:\n\nIn judgment 2006-01797, issued at 14:46 on 15 February 2006, it states: “Although it is not for the Chamber to determine the purpose served by that road and, consequently, whether it should or should not become public, the fact is that the respondent Municipality never carried out the relevant expropriation procedures or previously compensated the owners, despite its decision emptying their right of its essential content. It is evident that any restriction that empties the right of property of its content must be imposed through the relevant expropriation procedure; otherwise, we would be faced with a purely factual taking of private property by the Administration, which is what occurred in this case. This constitutes a de facto taking that directly harms the assets of the amparo applicants, and they must therefore be restored to the full enjoyment of their property right, without prejudice to carrying out the relevant expropriation procedures.”\n\nIn judgment 2006-015457, issued at 16:38 on 25 October 2006, the Chamber states, insofar as relevant:\n\nIII.- On the right to property. Article 45 of the Political Constitution provides that “Property is inviolable; no one may be deprived of their property except in the public interest, legally established, and with prior compensation in accordance with law…” The concept of property protected by the aforementioned constitutional provision must be understood as the allocation of an asset to an individual. In other words, assigning to a particular person an asset that is commercially transferable confers on that person the legal power to dispose of it. That power of disposal must be considered legal because it entails the possibility for its holder to have it enforced against other persons within the legal system, who have a corresponding duty to refrain from violating or disturbing that enjoyment. Thus, the right to property, as the quintessential real right, is “erga omnes” in nature, meaning it may be asserted against the entire community. Along these lines, constitutional property encompasses all valuable interests a person may possess apart from themselves, their life, and their freedom, such that all assets capable of economic value or monetary appraisal attain the status of patrimonial rights, collectively designated as the constitutional right to property. Accordingly, this Chamber has said that the inviolability of private property means prohibiting the imposition of restrictions on the right to property against the holder’s will where the resulting sacrifices or deprivations provide no benefit. The principle of inviolability therefore establishes a limit beyond which the right-holder is constitutionally protected against confiscations, requirements, and restrictions on property.\n\nIV.- On restrictions on the right to property as a fundamental right. To analyze whether a restriction imposed on a right is constitutional, it must be examined whether that restriction breaches the essential content of the right. The limit on limits is inherent in the need to justify them. A relationship must be established between the restriction and the interest it seeks to protect. Accordingly, a proportionality assessment (prohibition of arbitrary restrictions) and a reasonableness assessment (resistance to unjustified restrictions) must be carried out. This is a kind of economic assessment in which the relationship between the cost, benefit, and sacrifice of the fundamental right must be analyzed. The essential content or core of the right is what is constitutionally guaranteed, but not the rest of the right. In the particular case of private property, restricting it means conditioning its exercise on administrative powers or duties in order to subordinate the institution to another of higher rank because of the importance of the interest represented, in a conflict between the two. This occurs when the set of powers and faculties becomes a threat to interests other than those inherent in private property. Accordingly, this Court has stated that any restriction affecting the exercise and content of the right to property is unconstitutional. What is permitted is to delimit, define, and attribute the owner’s powers and faculties that serve as a means of fulfilling property’s natural and normal purpose. This delimitation may occur from a legal standpoint in two different ways: a) through regulatory provisions proper (a law or regulation), or b) through individualized administrative acts, which may be discretionary as to their grounds or content; such acts must likewise respect the essential content of the constitutionally guaranteed right to property.\n\nV.- On the specific case. In this case, it is established that the amparo applicant Parque Industrial Guachipelín Sociedad Anónima owns the registered properties (…). In these circumstances, this Chamber observes that the property was awarded to Scotia Bank by a decision issued at 14:00 on 5 June 2000, and more than six years have passed during which the Administration has taken no action to recover through judicial proceedings what it claims is its right, having failed to act diligently in pursuing its interests. It did, however, issue what it considers a precautionary measure limiting the exercise of the right to property, without the individual having to bear the negative consequences resulting from the Municipality’s inaction. The important point in this case is that the Municipality of Vázquez de Coronado may under no circumstances issue a resolution or opinion limiting the exercise of the right to property, as it did in this case by stating that no application concerning that area would be approved because it was public domain property, without a complaint having been filed before the competent judicial authority, much less a resolution granting it that right. This emptied the amparo applicant’s right to property of its content by preventing construction or dissuading third parties from acquiring the property based on a future and uncertain event, since the Municipality had not acted in accordance with what it says is its right during six years. Accordingly, the respondent Municipality must be told that if it believes it has a superior right to the real property, the appropriate course is to resolve the matter before the judicial authority competent to hear and decide the case, which in turn will take whatever precautionary measures the legal system authorizes it to take; it must not take the law into its own hands by deciding not to approve any application concerning the property and restricting its use and enjoyment. For that reason, the amparo must be granted, with the resulting legal consequences.\n\nSEVENTH: In light of the foregoing, it is absolutely clear and demonstrable that (i) the judgment invoked by the Mayor has been fully enforced, and (ii) the Municipality of Garabito itself stated to this Honorable Chamber only three years ago that the road now in dispute is private in nature. Accordingly, under the aforementioned ruling, if the Municipality believes it has a superior right to this real property, it must resolve the matter before the judicial authority competent to hear and decide the case, which in turn will take whatever precautionary measures the legal system authorizes it to take, and MUST NOT TAKE THE LAW INTO ITS OWN HANDS.\n\nOn the basis of the foregoing, I REQUEST that this amparo application be granted and that the Municipality of Garabito be ordered not to disturb the private property of all members of the Punta Leona Complex unless and until a competent judicial authority orders otherwise. Likewise, because the Municipality resorted to de facto measures contrary to the legal system, I request that it be ordered to pay the costs of the proceedings and to repair the damages caused to the parties affected by that conduct.\n\nLEGAL GROUNDS: I base all of the foregoing on the Political Constitution of Costa Rica and any other applicable provisions, particularly Articles 33 of the Constitutional Jurisdiction Law and 45 of the Political Constitution. (…)”\n\n2.- In a document received through Gestión en Línea at 18:09 on 16 June 2026, the applicant stated the following:\n\n“(…) I wish to add the following:\n\nFIRST: Although it is a public and notorious fact, the acts denounced as violating private property were carried out by the Municipality of Garabito specifically on Thursday, 4 June 2026 (https://crhoy.com/nacionales/municipalidad-de-garabito-derriba-agujas-en-punta-leona-estamos-abriendo-la-calle/) and, regrettably, were expanded today, 16 June 2026 (https://crhoy.com/nacionales/fotos-y-video-municipalidad-derriba-caseta-de-seguridad-y-clausura-restaurante-en-punta-leona/).\n\nAs can be seen, THE ARBITRARY ACTIONS OF THE MUNICIPALITY OF GARABITO NOW ENTAIL NOT ONLY A RISK OF RECURRENCE, BUT WHAT HAPPENED TODAY DEMONSTRATES THAT RECURRENCE IS CERTAIN. That is why the URGENT attention of this Honorable Chamber is requested here.\n\nSECOND: My request is clarified as follows: I REQUEST that this amparo application be granted and that the Municipality of Garabito be ordered not to disturb the private property of the Punta Leona Complex, specifically the access road to Playa Blanca that runs across private property according to the route the Municipality itself provided in case file 23-004285-0007-CO, and its adjacent private lands, unless and until a competent judicial authority orders otherwise. Likewise, because the Municipality resorted to de facto measures contrary to the legal system, I request that it be ordered to pay the costs of the proceedings and to repair the damages caused to the parties affected by that conduct. (…)”\n\n3.- By order of the Presidency of this Chamber issued at 15:17 on 25 June 2026, the applicant was asked to do the following: “(…) Before deciding what is appropriate in the AMPARO APPLICATION being processed in case file No. 26-021676-0007-CO, filed by Nombre02, the applicant must state clearly and precisely, within THREE DAYS from notification of this order, the following: • Whether the applicant has the corresponding power of attorney granted by the private entity mentioned (Punta Leona Complex) to act in defense of the right to property; • If the answer is affirmative, the applicant must provide a complete and legible copy of the document proving this; The applicant must likewise provide any additional evidence supporting the applicant’s statements. (…)”\n\n4.- In a document received at 20:56 on 29 June 2026, the applicant stated the following:\n\n“(…) FIRST: THE APPLICANT’S STANDING.\n\nI clarify that, pursuant to Article 33 of the Constitutional Jurisdiction Law, I am acting in my personal capacity and on my own behalf as the APPLICANT, and in that capacity I file this amparo application ON BEHALF OF THE INJURED PARTIES listed below. I further clarify that the Punta Leona Complex (www.puntaleona.com) is owned by PUNTA LEONA BEACH CLUB AND NATURE RESORT SOCIEDAD ANONIMA, corporate identification number 3-101-024566, of which I am a member, as shown by the evidence provided in Annex #1 to the initial application. Accordingly, the parties to the application are:\n\nAPPLICANT: Nombre02\n\nRESPONDENT: Municipality of Garabito\n\nINJURED PARTIES: (i) Punta Leona Beach Club and Nature Resort S.A., corporate identification number 3-101-024566; (ii) the applicant in his capacity as a member; and (iii) all the remaining members of the aforementioned entity.\n\nAccordingly, I request that this amparo application be processed, since the persons injured by the unconstitutional conduct of the Municipality of Garabito have been clearly and specifically identified.\n\nSECOND: CONSTITUTIONAL VIOLATIONS:\n\nTo summarize my initial submissions, I consider that the actions of the Municipality of Garabito absolutely violate the following constitutional rights of the INJURED PARTIES:\n\n• The principle of inviolability of private property: Article 45 of the Political Constitution\n\n• The principle of res judicata: Articles 41 and 42 of the Political Constitution\n\n• In addition, since this application is under review for admissibility, I wish to expand on the violation of Article 50 of the Constitution concerning the right to a healthy and ecologically balanced environment. This claim is made on behalf of the public at large as a diffuse right.\n\n• As stated in my initial submissions, on 4 June 2026 and 16 June 2026, respectively, the Municipality of Garabito destroyed an entrance barrier gate and a guard booth on the private road connecting Playa Mantas and Playa Blanca. In addition, it made de facto statements asserting that the private road is public, stating: “The local government’s position is that the road in question is a public road, so there should be no restriction on reaching the beach,” as can be seen in the newspaper CRHOY on 5 June 2026 (https://crhoy.com/nacionales/ya-se-puede-entrar-a-playa-blanca-por-punta-leona-alcalde-aclara-dudas-sobre-acceso-y-parqueo/).\n\nAccording to the report submitted by the Municipality of Garabito itself only three years ago in constitutional case file 23-004285-0007-CO, the Municipality told the Chamber and acknowledged that this road is PRIVATE. Therefore, in the absence of judicial proceedings, this new action by the Municipality violates Article 45 to the detriment of the INJURED PARTIES.\n\nIn an attempt to “justify” conduct that is plainly unconstitutional and arbitrary, the Mayor of Garabito told the media that the barrier gate was opened in “execution of a compliance obligation that we should have fulfilled 25 years ago. In October 2001, the road to Playa Blanca was declared public, and for reasons I do not know, that was not carried out. Today, as we had been trying to carry it out, but because of a precautionary measure requested by Punta Leona or by the people who in some way benefited from having that public road privatized, on Tuesday of this week the precautionary measure was lifted, allowing us to remove the obstacles that the public road had on the way to Playa Blanca.” (See https://crhoy.com/nacionales/video-alcalde-de-garabito-explica-por-que-retiraron-agujas-en-punta-leona/) This is a clear reference to judgment 291-P-01 issued by the Puntarenas Criminal Judge on thirty-one October two thousand one, unless he presents some judgment unknown to everyone.\n\nHowever, as shown in the records of this Honorable Chamber, in case files 02-008802-0007-CO, 02-009640-0007-CO, 02-008897-0007-CO, 02-010004-0007-CO, among others, that judgment was FULLY ENFORCED as of 9 OCTOBER 2002. Thus, the Municipality’s conduct and its purported enforcement of a judgment that has already been enforced clearly violate the PRINCIPLE OF RES JUDICATA under Articles 41 and 42 of the Political Constitution.\n\nThe Municipality’s actions have encroached upon and violated land owned by the INJURED PARTIES, additionally violating the principle of res judicata. In light of the foregoing, it is absolutely clear and demonstrable that (i) the judgment invoked by the Mayor has been fully enforced, and (ii) the Municipality of Garabito itself told this Honorable Chamber only three years ago that the road now in dispute is private in nature. Accordingly, if the Municipality believes it has a superior right to this real property, it must resolve the matter before the judicial authority competent to hear and decide the case, which in turn will take whatever precautionary measures the legal system authorizes it to take, and MUST NOT TAKE THE LAW INTO ITS OWN HANDS.\n\nIN THIS CASE, IN MY VIEW, WHAT WE SEE IS A PURE AND SIMPLE UNCONSTITUTIONAL EXPROPRIATION, WITHOUT ANY PRIOR PROCEEDINGS OR LEGAL BASIS, TO THE DETRIMENT OF THE INJURED PARTIES.\n\nTHIRD: ENVIRONMENTAL MATTERS:\n\nIn addition to the fact that the Municipality’s conduct has no constitutional basis, as stated above, there is also a clear violation of the principle of a healthy and balanced environment protected by the Political Constitution. This is because:\n\n1. Playa Blanca is an ecosystem that has taken decades to build and protect. It is currently the only marine wetland in the Central Pacific, a designation granted by Decreto Ejecutivo N° 23127.-MIRENEM, at ten o’clock on the seventh day of the month of April of\n\nnineteen ninety-four. According to Recital three of that decree: “3°-Whereas preliminary studies carried out at Playa Blanca, on the country’s western coast, southwest of Punta Leona, in the province of Puntarenas (geographic coordinates CED02 and CED03) have shown that the intertidal zone contains a great diversity of marine organisms, such as fish, mollusks, crustaceans, and echinoderms, which need to be protected.”\n\nBy abruptly opening private property to mass entry, without a prior administrative act, an environmental study, a contingency plan, public restrooms, or basic services—in other words, without any kind of planning—the Municipality of Garabito places this ecosystem at high risk. Humpback whales, as can be seen at https://delfino.cr/2024/09/ballenas-jorobadas-eligen-punta-leona-como-refugio-ideal-para-sus-crias\n\nOlive ridley turtles, as can be seen at https://delfino.cr/2026/01/punta-leona-impulsa-conservacion-de-la-tortuga-lora-en-playa-blanca\n\nScarlet macaws, as shown by Punta Leona’s internationally recognized effort of more than three decades https://lapasrojaspuntaleona.com/\n\nThe regenerative tourism promoted by Punta Leona Beach Club and Nature Resort S.A. can be seen in the protection and frequency of:\n\nThe Mayor of Garabito, far from recognizing the environmental effort, announced an interest in holding a mass concert in this marine wetland, again without a prior study, environmental impact planning, and clearly placing decades of nature-conservation work at environmental risk. (…)”\n\n5.- In a document received through Gestión en Línea at 10:35 on 25 July 2026, the applicant stated: “(…) I respectfully request that this amparo application be processed, since the persons injured by the unconstitutional conduct of the Municipality of Garabito have been clearly and specifically identified. (…)”\n\n6.- Article 9 of the Constitutional Jurisdiction Law authorizes the Chamber to summarily reject, or reject on the merits, at any time, including upon filing, any application submitted for its consideration that is manifestly inadmissible, or when it considers that there is sufficient evidence to reject it, or that it is simply a reiteration or reproduction of an identical or similar earlier application that was rejected.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI.- SUBJECT OF THE AMPARO APPLICATION. The applicant states that he comes before this Chamber in his capacity as a member of Punta Leona Beach Club and Nature Resort S.A. He alleges that the Municipality of Garabito recently unilaterally removed structures from the private road belonging to the complex’s members, which they use to access Playa Blanca. In addition, it unilaterally opened access to the public by means of this private road without prior judicial proceedings. He considers this to violate Article 45 of the Political Constitution, to the detriment of Punta Leona and all its members. The applicant clarifies that his request is as follows: “I REQUEST that this amparo application be granted and that the Municipality of Garabito be ordered not to disturb the private property of the Punta Leona Complex, specifically the access road to Playa Blanca that runs across private property according to the route the Municipality itself provided in case file 23-004285-0007-CO, and its adjacent private lands, unless and until a competent judicial authority orders otherwise. Likewise, because the Municipality resorted to de facto measures contrary to the legal system, I request that it be ordered to pay the costs of the proceedings and to repair the damages caused to the parties affected by that conduct.”\n\nThen, in a document received on 29 June 2026, the applicant sought to expand his allegations to include a violation of the right to a healthy and ecologically balanced environment, since, in his view, opening the way to mass entry to Playa Blanca without an environmental study or contingency plan would put this ecosystem at risk. He also alleges that the respondent Mayor expressed interest in holding a mass concert at this site.\n\nII.- INADMISSIBILITY OF THE AMPARO. In the case at hand, the applicant comes before this Chamber in his capacity as a member of Punta Leona Beach Club and Nature Resort S.A., because in his view the Municipality of Garabito violates the right to property enshrined in Article 45 of the Constitution. By order of the Presidency of this Chamber issued at 15:17 on 25 June 2026, he was asked to clarify whether he had the corresponding power of attorney granted by the affected private entity to act in defense of that right. In response, the applicant clarified that:\n\n“(…) pursuant to Article 33 of the Constitutional Jurisdiction Law, I am acting in my personal capacity and on my own behalf as the APPLICANT, and in that capacity I file this amparo application ON BEHALF OF THE INJURED PARTIES listed below. I further clarify that the Punta Leona Complex (www.puntaleona.com) is owned by PUNTA LEONA BEACH CLUB AND NATURE RESORT SOCIEDAD ANONIMA, corporate identification number 3-101-024566, of which I am a member, as shown by the evidence provided in Annex #1 to the initial application. Accordingly, the parties to the application are:\n\nAPPLICANT: Nombre02\n\nRESPONDENT: Municipality of Garabito\n\nINJURED PARTIES: (i) Punta Leona Beach Club and Nature Resort S.A., corporate identification number 3-101-024566; (ii) the applicant in his capacity as a member; and (iii) all the remaining members of the aforementioned entity. (…)”\n\nIn light of the foregoing, this application is inadmissible because the applicant does not have the representation required from the holder of the allegedly violated property right in order to file it. It should be clarified that although amparo is governed by substitute standing (Article 33 of the Constitutional Jurisdiction Law), the fact is that the applicant’s claim is purely patrimonial in substance, and he has not shown that he represents the affected company—the holder of the property right—in filing this application on its behalf. Although the applicant expanded his allegations to claim a violation of the right to a healthy and ecologically balanced environment, his arguments provide no evidence permitting a finding that acts or omissions by the respondent Municipality threaten or harm the Playa Blanca ecosystem, beyond unsupported assumptions. On the basis of the foregoing, this application must be summarily rejected, as is hereby ordered.\n\nIII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The applicant is advised that if any paper documents, objects, or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device have been submitted, they must be collected from the office within a maximum period of 30 business days from notification of this judgment.
