  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-026195-0007-CO \n\nRes. Nº 2026029627\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del cuatro de agosto de dos mil veintiseis .\n\n Recurso de amparo que se tramita en el expediente número 26-026195-0007-CO, interpuesto por Nombre01, cédula de identidad número CED01, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.\n\nResultando\n\n1. Por escrito incorporado al expediente electrónico el 21 de julio de 2026, la parte recurrente interpone recurso de amparo contra el Instituto Costarricense de Acueductos y Alcantarillados. Manifiesta que el 14 de enero de 2026 solicitó ante la autoridad accionada la disponibilidad de servicios de agua potable y alcantarillado sanitario, el primero le fue aprobado mientras que el segundo fue rechazado. Posteriormente, presentó el recurso respectivo en cuanto a la negatoria, el cual se declaró con lugar y ordenó emitir una nueva constancia de disponibilidad. Agrega que durante dicho trámite la autoridad accionada le previno sobre la presentación de nuevos requerimientos. Sin embargo, el municipio recurrido archivó su caso, toda vez, que lo solicitado no se aportó dentro del plazo establecido, pese presentar una solicitud de prorroga la misma fue negada. Por lo expuesto, estima lesionados sus derechos fundamentales. \n\n2. El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y,\n\n Considerando:\n\n I. OBJETO DEL RECURSO. La parte recurrente expresa que el 14 de enero de 2026 solicitó ante la autoridad accionada la disponibilidad de servicios de agua potable y alcantarillado sanitario, el primero le fue aprobado mientras que el segundo fue rechazado. Posteriormente, presentó el recurso respectivo en cuanto a la negatoria, el cual se declaró con lugar y ordenó emitir una nueva constancia de disponibilidad. Agrega que durante dicho trámite la autoridad accionada le previno sobre la presentación de nuevos requerimientos. Sin embargo, el municipio recurrido archivó su caso, toda vez, que lo solicitado no se aportó dentro del plazo establecido, pese presentar una solicitud de prorroga la misma fue negada. Por lo expuesto, estima lesionados sus derechos fundamentales. \n\nII. INADMISIBILIDAD DEL RECURSO. Vistos los alegatos y pretensiones de la parte recurrente, se le hace saber que esta Sala no es un contralor de la legalidad de las actuaciones o resoluciones que emita el Instituto Costarricense de Acueductos y Alcantarillados, por lo que no le corresponde funcionar como una instancia más o un tribunal de alzada con el procedimiento que aquí se cuestiona, a efecto de revisar si lo resuelto por la autoridad recurrida, en relación con la disposición de archivar el trámite presentado por la parte recurrente en cuanto a la solicitud de disponibilidad de agua potable y alcantarillado sanitario, por el incumplimiento de la prevención en el plazo establecido, se ajusta a Derecho, ni el mérito de las razones que justificaron esa decisión, mucho menos dejar sin efecto lo ahí dispuesto, por cuanto ello es una labor propia de la Administración cuyos diferendos deben ser dirimidos en la vía común, administrativa o jurisdiccional ordinaria. \n\nAsí las cosas, el recurso resulta inadmisible, por lo que procede su rechazo de plano, tal y como se indica en la parte dispositiva de esta resolución. \n\nIII. VOTO SALVADO DE LOS MAGISTRADOS CRUZ CASTRO Y RUEDA LEAL, CON REDACCIÓN DEL SEGUNDO. En el sub examine, la parte recurrente reclama que el Instituto Costarricense de Acueductos y Alcantarillados archivó el trámite relacionado con la disponibilidad del servicio de alcantarillado sanitario, pese a que había solicitado una prórroga para cumplir la prevención formulada. \n\nTomando en consideración que la gestión se encuentra vinculada con la prestación de los servicios de agua potable y saneamiento, así como con el derecho humano, básico e irrenunciable de acceso al agua potable reconocido en el artículo 50 de la Constitución Política, estimamos necesario contar con mayores elementos de juicio que permitan conocer las circunstancias en que se archivó el trámite y acreditar o descartar una lesión de rango constitucional. Por lo anterior, salvamos el voto y disponemos cursar el amparo.\n\nIV. DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Debe prevenir esta Sala a las partes que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\nSe rechaza de plano el recurso. San José, at 9:25 a.m. on 4 August 2026.\n\nAmparo proceeding filed in case number 26-026195-0007-CO by Nombre01, identity card number CED01, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.\n\nBackground\n\n1. In a brief entered into the electronic case file on 21 July 2026, the applicant filed an amparo proceeding against the Costa Rican Institute of Aqueducts and Sewers. The applicant states that on 14 January 2026, they requested the availability of drinking-water and sanitary-sewer services from the respondent authority. The first was approved, while the second was denied. Subsequently, the applicant filed the respective remedy concerning the denial, which was granted and ordered the issuance of a new availability certificate. The applicant adds that during that process, the respondent authority required the submission of additional requirements. However, the respondent municipality archived the case because the requested information was not provided within the established time limit. Although the applicant submitted a request for an extension, it was denied. For these reasons, the applicant considers their fundamental rights to have been violated.\n\n2. Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to summarily reject, or reject on the merits, at any time, including upon filing, any application submitted for its consideration that is manifestly inadmissible, or when it considers that there is sufficient evidence to reject it, or that it is merely a repetition or reproduction of an identical or similar prior application that was rejected.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\nI. SUBJECT OF THE APPLICATION. The applicant states that on 14 January 2026, they requested the availability of drinking-water and sanitary-sewer services from the respondent authority. Subsequently, the applicant filed the respective remedy concerning the denial, which was granted and ordered the issuance of a new availability certificate. That work falls within the Administration’s remit, and any disputes must be resolved through the ordinary administrative or judicial channels.\n\nAccordingly, the application is inadmissible and must be summarily rejected, as indicated in the operative part of this decision.\n\nIII. DISSENTING OPINION OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, DRAFTED BY THE LATTER. In the case under review, the applicant claims that the Costa Rican Institute of Aqueducts and Sewers archived the proceeding concerning availability of sanitary-sewer service, despite the applicant having requested an extension to comply with the requirement.\n\nConsidering that the application concerns the provision of drinking-water and sanitation services, as well as the basic and inalienable human right of access to drinking water recognized in Article 50 of the Political Constitution, we consider it necessary to obtain further evidence to understand the circumstances in which the proceeding was archived and to establish or rule out a violation of constitutional standing. For the foregoing reasons, we dissent and order that the amparo proceeding be processed.\n\nIV. DOCUMENTATION SUBMITTED TO THE CASE FILE. The Chamber must inform the parties that any paper documents they may have submitted, as well as objects or evidence stored on any additional device or in electronic, computer, magnetic, optical, telematic, or new-technology format, must be collected from the court office within 30 business days after notice of this judgment is received. Otherwise, all such materials will be destroyed in accordance with the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe application is summarily rejected.
