  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-019412-0007-CO \n\nRes. Nº 2026029853\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del seis de agosto de dos mil veintiseis .\n\n \n\nRecurso de amparo que se tramita en expediente nro. 26-019412-0007-CO, interpuesto por Nombre01, cédula de identidad CED02, contra el CONSEJO NACIONAL DE VIALIDAD (CONAVI).\n\nResultando:\n\n1.- Por escrito recibido en la Secretaría de la Sala el 31 de mayo de 2026, la recurrente interpone recurso de amparo. Alega: “● PRIMERO: Hace aproximadamente un año presenté formal solicitud ante la Municipalidad de Desamparados para que se atendiera de manera urgente el grave deterioro y obstrucción de un alcantarillado ubicado sobre ruta nacional. ● SEGUNDO: Funcionarios municipales realizaron inspección en el sitio y determinaron expresamente que, por tratarse de infraestructura ubicada sobre ruta nacional, la competencia correspondía al Consejo Nacional de Vialidad (CONAVI). ● TERCERO: En virtud de dicha indicación, procedí a presentar formal gestión administrativa ante el CONAVI, la cual fue recibida y registrada bajo número de trámite administrativo. ● CUARTO: Transcurrido sobradamente el plazo legal y razonable para obtener respuesta, y pese a múltiples consultas realizadas incluso mediante correo electrónico, el CONAVI ha guardado absoluto silencio administrativo, sin emitir resolución alguna ni ejecutar intervención efectiva en el sitio denunciado. ● QUINTO: La problemática denunciada reviste extrema gravedad, pues el alcantarillado presenta obstrucciones severas, acumulación de aguas negras, malos olores y riesgo evidente de rebalse e inundación, situación que se agrava considerablemente durante la época lluviosa. ● SEXTO: A escasos metros del sitio existe además otro alcantarillado igualmente obstruido, lo cual incrementa significativamente el riesgo sanitario, ambiental y de seguridad vial para la comunidad. ● SÉTIMO: La zona afectada es altamente transitada por estudiantes, incluyendo menores de edad, quienes diariamente deben circular por el sitio para asistir a centros educativos y utilizar el transporte público. ● OCTAVO: Existe además una parada de autobús prácticamente frente al área afectada, circunstancia que expone directamente a peatones, estudiantes y usuarios del transporte público al peligro generado por el mal estado del alcantarillado. ● NOVENO: La omisión de la autoridad recurrida pone en riesgo la integridad física, la salud pública, el derecho a un ambiente sano y ecológicamente equilibrado, así como la seguridad vial de quienes transitan diariamente por el lugar. ● DÉCIMO: La conducta omisiva del CONAVI constituye además una violación flagrante al derecho constitucional de petición y pronta respuesta, reconocido ampliamente por la jurisprudencia reiterada de la Sala Constitucional. FUNDAMENTO JURÍDICO Y JURISPRUDENCIAL ● La actuación omisiva de la autoridad recurrida vulnera el artículo 27 de la Constitución Política, referente al derecho de petición y pronta respuesta. ● Asimismo, se lesionan derechos fundamentales relacionados con la salud pública, la integridad física, la seguridad de las personas menores de edad y el derecho a un ambiente sano y ecológicamente equilibrado. ● La Sala Constitucional ha reiterado en abundante jurisprudencia que la Administración Pública no puede permanecer inactiva frente a situaciones que comprometan derechos fundamentales de la colectividad ni frente a riesgos evidentes para la seguridad y salud de las personas. ● El voto número 14125-2006 de la Sala Constitucional estableció que toda autoridad pública tiene el deber de responder de manera pronta, formal y efectiva las solicitudes planteadas por los administrados. ● La jurisprudencia constitucional también ha señalado reiteradamente que el silencio administrativo constituye violación al derecho fundamental de petición cuando la Administración omite resolver dentro de un plazo razonable. ● La omisión administrativa denunciada adquiere especial gravedad al encontrarse comprometidos derechos fundamentales de personas menores de edad, cuya protección reforzada constituye obligación prioritaria del Estado costarricense. ● La conducta omisiva del CONAVI resulta además contraria a los principios constitucionales de eficiencia administrativa, continuidad del servicio público, prevención del daño y protección del interés superior de la persona menor de edad. PETITORIA ● Que se declare CON LUGAR el presente recurso de amparo. ● Que se ordene al CONSEJO NACIONAL DE VIALIDAD (CONAVI) brindar respuesta inmediata, formal y de fondo a las gestiones administrativas presentadas por el recurrente. ● Que se ordene la inspección técnica urgente del sitio denunciado. ● Que se ordene la intervención, reparación y desobstrucción inmediata de los alcantarillados denunciados. ● Que se dispongan medidas preventivas y de seguridad mientras se ejecutan las obras necesarias, con el fin de proteger la integridad física y la salud de estudiantes, peatones y usuarios del transporte público. ● Que se aperciba a la autoridad recurrida respecto del cumplimiento obligatorio e inmediato de lo ordenado por esta Sala. ● Que se condene al Estado al pago de costas, daños y perjuicios ocasionados por la omisión administrativa y la violación de derechos fundamentales”. \n\n 2.- Por resolución de las 12:14 horas del 11 de junio de 2026, la Presidencia de la Sala dio curso al amparo y solicitó informe al director ejecutivo y gerente de Conservación de Vías y Puentes, ambos del Consejo Nacional de Vialidad (CONAVI). \n\n3.- Por escrito incorporado al expediente electrónico el 17 de junio de 2026, el recurrente indica: “Que, habiendo vencido el plazo conferido a la autoridad recurrida para rendir su informe y persistiendo la situación denunciada en el presente recurso, solicito a este Honorable Tribunal resolver el asunto con base en los elementos que constan en el expediente y valorar la omisión administrativa que motivó esta acción constitucional. La problemática expuesta continúa representando un riesgo para la salud pública, el ambiente y la seguridad de los habitantes, estudiantes y peatones de la comunidad de San Juan de Dios de Desamparados. En consecuencia, respetuosamente reitero la petitoria formulada en el escrito inicial y solicito que se declare CON LUGAR el presente Recurso de Amparo en todos sus extremos, ordenando al CONSEJO NACIONAL DE VIALIDAD (CONAVI) adoptar de manera inmediata las medidas necesarias para brindar una solución efectiva y definitiva a la situación denunciada, así como la correspondiente condenatoria al pago de las costas, daños y perjuicios, conforme fue solicitado en el recurso inicial”. \n\n4.- Por escrito incorporado al expediente electrónico el 18 de junio de 2026, informa Mauricio Sojo Quesada en su condición de director ejecutivo a. i. del Consejo Nacional de Vialidad. Expone: “La resolución indicada, fue notificada al Consejo Nacional de Vialidad mediante correo electrónico, por lo que se procede a responder a los hechos ahí mencionados, en tiempo y forma de ley, según lo establecido en la Ley de Notificaciones y Citaciones Judiciales Art. 38 Cómputo del plazo para notificaciones vía correo electrónico. RESOLUCION DE TRASLADO: La resolución de las doce horas catorce minutos del once de junio de dos mil veintiséis indica en lo que interesa: “…que hace aproximadamente un año presentó formal solicitud ante la Municipalidad de Desamparados para que se atendiera de manera urgente el grave deterioro y obstrucción de un alcantarillado ubicado sobre ruta nacional (Dirección03, cercanías del Liceo Sotero González Barquero), mediante oficio No. FM-PUSC-050-2025. Señala que funcionarios municipales realizaron inspección en el sitio y determinaron expresamente que, por tratarse de infraestructura ubicada sobre ruta nacional, la competencia correspondía al Consejo Nacional de Vialidad (CONAVI). En virtud de dicha indicación, presentó formal gestión administrativa ante el CONAVI, mediante oficio CDSJD 005-2026, la cual fue recibida y registrada bajo número TS.02617.2026. Alega que sobradamente el plazo legal y razonable para obtener respuesta, y pese a múltiples consultas realizadas incluso mediante correo electrónico, el CONAVI ha guardado absoluto silencio administrativo, sin emitir resolución alguna ni ejecutar intervención efectiva en el sitio denunciado. Agrega que la problemática denunciada reviste extrema gravedad, pues el alcantarillado presenta obstrucciones severas, acumulación de aguas negras, malos olores y riesgo evidente de rebalse e inundación, situación que se agrava considerablemente durante la época lluviosa. Añade que a escasos metros del sitio existe además otro alcantarillado igualmente obstruido, lo cual incrementa significativamente el riesgo sanitario, ambiental y de seguridad vial para la comunidad …” ATENCION DEL RECURSO POR EL FONDO En relación con los hechos alegados por la parte recurrente, resulta necesario precisar que, si bien al momento de la interposición del recurso de amparo se alegaba una eventual ausencia de respuesta por parte de esta Administración, dicha situación fue debidamente atendida y subsanada durante la tramitación del presente proceso. En efecto, consta que mediante oficio CARTA-CONAVI-CA-DIE-GCSV-DRC-1014-2026, de fecha 15 de junio de 2026, el Consejo Nacional de Vialidad emitió respuesta formal a la gestión planteada por el señor Nombre01, correspondiente al oficio N° CDSJD 005-2026, en relación con la problemática del alcantarillado pluvial ubicada en la Dirección01, cercanías del Liceo Sotero González Barquero. Dicha respuesta fue debidamente comunicada al administrado el mismo 15 de junio de 2026, mediante correo electrónico remitido al medio señalado por el propio interesado para efectos de notificaciones, adjuntándose el oficio respectivo, lo cual garantiza el efectivo conocimiento de la respuesta emitida por parte de este Consejo, subsanando así cualquier eventual omisión que hubiese existido al momento de la interposición del recurso. Adicionalmente, mediante oficio CARTA-CONAVI-CA-DIE-GCSV-DRC-1016-2026, de fecha 15 de junio de 2026, la Gerencia de Conservación de Vías y Puentes remitió a la Gerencia de Gestión de Asuntos Jurídicos el informe técnico correspondiente, así como la constancia de la respuesta brindada al administrado, acreditando de esta forma que el caso fue debidamente atendido por la Administración y cumpliendo así con el deber de respuesta. Bajo este contexto, es claro que ha cesado la conducta omisiva reclamada, por lo que el presente recurso de amparo ha perdido su objeto, en tanto la pretensión principal del recurrente —obtener una respuesta a su gestión— ya fue satisfecha por este Consejo. Ahora bien, en cuanto al contenido de la respuesta emitida, se informó al recurrente que esta Administración procedió a realizar una inspección técnica en el sitio señalado, a efectos de verificar las condiciones del sistema de alcantarillado pluvial. Como consecuencia de dicha inspección, se determinó la presencia de aguas negras, residuales y servidas vertidas dentro del sistema de alcantarillado pluvial, el cual se encuentra diseñado exclusivamente para la conducción de aguas pluviales, situación que provoca la saturación del sistema y afecta su capacidad hidráulica. Asimismo, se indicó que este tipo de vertidos constituye una práctica contraria a la normativa vigente, particularmente a lo dispuesto en el Reglamento de Vertido y Reuso de Aguas Residuales, así como en la Ley de Aguas y la Ley General de Salud, señalándose además que la regulación, control y fiscalización de estos vertidos corresponde a otras autoridades competentes, tales como el Ministerio de Salud y la Municipalidad respectiva. En ese sentido, se comunicó al administrado que el Consejo Nacional de Vialidad procedería a informar la situación a dichas autoridades, a efectos de que, dentro del ámbito de sus competencias, adopten las medidas correspondientes. De igual forma, se indicó que esta Administración procederá a programar labores de limpieza del sistema de alcantarillado, con el fin de mitigar la situación denunciada; no obstante, se advirtió que mientras persistan los vertidos ilegales, la problemática podría continuar presentándose. Adicionalmente, se hizo ver que el Consejo Nacional de Vialidad ha venido desarrollando acciones de mantenimiento y planificación en la Dirección01, incluyendo estudios y diseños orientados al mejoramiento integral de dicho corredor vial, lo cual evidencia una gestión activa en relación con la infraestructura vial en cuestión. De lo anterior se concluye que la Administración no ha permanecido inactiva frente a la situación descrita, sino que ha realizado las gestiones correspondientes dentro de su ámbito de competencia, atendiendo el caso y culminando con la emisión y notificación de una respuesta formal al administrado. Por ello, la inconformidad señalada en el recurso ha sido resuelta durante su tramitación, sin que actualmente se mantenga una afectación al derecho de petición y pronta respuesta. PETITORIA Por las razones de hecho y de derecho expuestas solicito a la honorable Sala Constitucional de la Corte Suprema de Justicia, se declare sin lugar el presente recurso de amparo y se absuelva al suscrito, en calidades indicadas, de toda responsabilidad”. \n\n5.- Por escrito incorporado al expediente electrónico el 18 de mayo de 2026, informa Jason Adrián Pérez Anchía en su condición de gerente de Conservación de Vías y Puentes del Consejo Nacional de Vialidad. Expone: “En relación con los hechos alegados por la parte recurrente, resulta necesario precisar que, si bien al momento de la interposición del recurso de amparo se alegaba una eventual ausencia de respuesta por parte de esta Administración, dicha situación fue debidamente atendida y subsanada durante la tramitación del presente proceso. En efecto, consta que mediante oficio CARTA-CONAVI-CA-DIE-GCSV-DRC-1014-2026, de fecha 15 de junio de 2026, el Consejo Nacional de Vialidad emitió respuesta formal a la gestión planteada por el señor Nombre01, correspondiente al oficio N° CDSJD 005-2026, en relación con la problemática del alcantarillado pluvial ubicada en la Dirección01, cercanías del Liceo Sotero González Barquero. Dicha respuesta fue debidamente comunicada al administrado el mismo 15 de junio de 2026, mediante correo electrónico remitido al medio señalado por el propio interesado para efectos de notificaciones, adjuntándose el oficio respectivo, lo cual garantiza el efectivo conocimiento de la respuesta emitida por parte de este Consejo, subsanando así cualquier eventual omisión que hubiese existido al momento de la interposición del recurso. Adicionalmente, mediante oficio CARTA-CONAVI-CA-DIE-GCSV-DRC-1016-2026, de fecha 15 de junio de 2026, la Gerencia de Conservación de Vías y Puentes remitió a la Gerencia de Gestión de Asuntos Jurídicos el informe técnico correspondiente, así como la constancia de la respuesta brindada al administrado, acreditando de esta forma que el caso fue debidamente atendido por la Administración y cumpliendo así con el deber de respuesta. Bajo este contexto, es claro que ha cesado la conducta omisiva reclamada, por lo que el presente recurso de amparo ha perdido su objeto, en tanto la pretensión principal del recurrente —obtener una respuesta a su gestión— ya fue satisfecha por este Consejo. Ahora bien, en cuanto al contenido de la respuesta emitida, se informó al recurrente que esta Administración procedió a realizar una inspección técnica en el sitio señalado, a efectos de verificar las condiciones del sistema de alcantarillado pluvial. Como consecuencia de dicha inspección, se determinó la presencia de aguas negras, residuales y servidas vertidas dentro del sistema de alcantarillado pluvial, el cual se encuentra diseñado exclusivamente para la conducción de aguas pluviales, situación que provoca la saturación del sistema y afecta su capacidad hidráulica. Asimismo, se indicó que este tipo de vertidos constituye una práctica contraria a la normativa vigente, particularmente a lo dispuesto en el Reglamento de Vertido y Reuso de Aguas Residuales, así como en la Ley de Aguas y la Ley General de Salud, señalándose además que la regulación, control y fiscalización de estos vertidos corresponde a otras autoridades competentes, tales como el Ministerio de Salud y la Municipalidad respectiva. En ese sentido, se comunicó al administrado que el Consejo Nacional de Vialidad procedería a informar la situación a dichas autoridades, a efectos de que, dentro del ámbito de sus competencias, adopten las medidas correspondientes. De igual forma, se indicó que esta Administración procederá a programar labores de limpieza del sistema de alcantarillado, con el fin de mitigar la situación denunciada; no obstante, se advirtió que mientras persistan los vertidos ilegales, la problemática podría continuar presentándose. Adicionalmente, se hizo ver que el Consejo Nacional de Vialidad ha venido desarrollando acciones de mantenimiento y planificación en la Dirección01, incluyendo estudios y diseños orientados al mejoramiento integral de dicho corredor vial, lo cual evidencia una gestión activa en relación con la infraestructura vial en cuestión. De lo anterior se concluye que la Administración no ha permanecido inactiva frente a la situación descrita, sino que ha realizado las gestiones correspondientes dentro de su ámbito de competencia, atendiendo el caso y culminando con la emisión y notificación de una respuesta formal al administrado. Por ello, la inconformidad señalada en el recurso ha sido resuelta durante su tramitación, sin que actualmente se mantenga una afectación al derecho de petición y pronta respuesta. PETITORIA Por las razones de hecho y de derecho expuestas solicito a la honorable Sala Constitucional de la Corte Suprema de Justicia, se declare sin lugar el presente recurso de amparo y se absuelva al suscrito, en calidades indicadas, de toda responsabilidad”. \n\n6.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Rueda Leal; y,\n\nConsiderando:\n\n I.- Cuestión previa. Antes de analizar el fondo del asunto debe aclararse que, a partir de la sentencia nro. 2008002545 de las 8:55 horas del 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa –con algunas excepciones aquellos asuntos en los que se discute si la administración pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –instruido de oficio o a instancia de parte– o conocer de los recursos administrativos procedentes. Precisamente, en el sub lite, se plantea un supuesto de excepción, pues se está ante una denuncia ambiental la cual se acusa que no ha sido resuelta dentro de un plazo razonable. Aclarado el punto, se entra a resolver la situación concreta reclamada en este amparo. \n\nII.- Objeto del recurso. El recurrente alega que el 27 de febrero de 2026 envió oficio CDSJD 005-2026 en el que denunció ante CONAVI la situación de deterioro y obstrucción del alcantarillado que se encuentra en la Dirección03, Desamparados, cercanías del Liceo Sotero González Barquero, el cual acumula aguas negras, malos olores y riesgo evidente de rebalse e inundación. Reclama que, a la fecha en la que acude en amparo, no ha recibido respuesta a su solicitud. Solicita la intervención de la Sala. \n\nIII.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:\n\na) El 27 de febrero de 2026, el recurrente envió el oficio CDSJD 005-2026 por medio de “ventanilla única”, en el que indicó: “El suscrito, Nombre01, mayor, vecino de San Juan de Dios, Desamparados, portador de la cédula CED01, en mi condición de Síndico de Distrito, solicita su intervención inmediata en la Dirección01, debido a dos puntos críticos de obstrucción que están afectando gravemente la zona: -Cercanía del Colegio: A unos 20 metros al norte de la institución, donde una alcantarilla obstruida provoca el desborde de lo que aparentan ser aguas negras y pluviales sobre la carretera, obligando a los estudiantes a transitar por el foco de contaminación e incluso a la carretera al no contar con aceras. -Frente al Bar Loras: Unos 20 metros arriba del liceo, se presenta una segunda obstrucción que también genera estancamiento y representa un riesgo epidemiológico adicional para la población. Esta situación constituye un grave peligro para la salud pública. Se adjuntan oficios de la Municipalidad de Desamparados, donde se hace constar que el mantenimiento y reconstrucción de estos tramos es responsabilidad del CONAVI. Solicitamos el destaqueo, limpieza o reconstrucción de estas alcantarillas a la brevedad posible” (véase prueba aportada). \n\nb) La resolución de curso del amparo fue notificada a las autoridades recurridas el 11 de junio de 2026 (véanse actas de notificación).\n\nc) Por oficio CARTA-CONAVI-CA-DIE-GCSV-DRC-1014-2026 del 15 de junio de 2026 remitido al recurrente al correo electrónico ...01 en esa misma fecha, las autoridades de la Gerencia de Conservación de Vías y Puentes del CONAVI contestaron al petente: “En atención al oficio N° CDSJD 005-2026, relacionado con la situación del alcantarillado pluvial ubicado en la Dirección01, cercanías del Liceo Sotero González Barquero, se procede a indicar lo siguiente: Ubicación (…) Imagen No.1: Ubicación de la zona afectada ubicada en la Dirección01, Sección de Control: Dirección02). verificar las condiciones del alcantarillado pluvial y determinar la naturaleza de la situación presentada. Durante la inspección realizada se procedió a realizar un recorrido por el lugar y por el punto de estudio, por lo que se constató la presencia de aguas negras, aguas residuales y aguas servidas en el sistema de alcantarillado pluvial, el cual está diseñado única y exclusivamente para el manejo y conducción de las aguas pluviales de la ruta, por lo cual el vertido ilegal de dichos líquidos, no solo resta capacidad hidráulica al sistema, sino que también sedimenta el mismo, razón por la cual se satura el sistema, tal como se evidencia en las siguientes fotografías N° 1 y N° 2: (…) Fotografía N° 1 y N° 2: Muestra la presencia de aguas negras y jabonosas vertida en el alcantarillado pluvial Consecuentemente con lo anterior descrito, el Reglamento de Vertido y Reuso de Aguas Residuales (Decreto Ejecutivo N.º 33601-MINAE-S) y a la Ley de Aguas N.º 276, prohíbe el vertido de aguas negras y residuales en sistemas de alcantarillado pluvial, dado que ello genera riesgos sanitarios, ambientales y de seguridad pública. Asimismo, se debe considerar lo correspondiente a regulaciones de disposiciones de aguas, de las cuales las responsabilidades en materia de vertidos de aguas servidas, aguas negras o cualquier desfogue diferente a aguas de tipo pluvial es responsabilidad de los municipios, así como las autoridades de salud correspondientes, según las disposiciones establecidas en la Ley N° 5395, “Ley General de Salud” en sus artículos N°288, N°289, N°291, N°292. (Subrayados y resaltados no son del original). En función de lo anterior descrito y las competencias señaladas dentro del marco legal se concluye que, el tema de afectación de sistemas de drenaje de servidumbres o entradas a propiedades privadas fuera del derecho de vía de la Ruta Nacional, no es competencia del Consejo Nacional de Vialidad, además de que el sistema de drenaje pluvial es para uso exclusivo de la Dirección01, la cual se encuentra afectada por conexiones ilegales de aguas sanitarias o servidas, así como por aguas pluviales provenientes de desfogues ilegales, afectando su estado y capacidad para el manejo y control de las aguas pluviales provenientes de la Dirección01. Adicionalmente, no se omite señalar que existe la Licitación No. 2016LA-000032-0006000001 “MEJORAMIENTO DE LA RUTA NACIONAL No. 217, SECCIÓN: Dirección01 (San Rafael Abajo de Desamparados) – Límite Cantonal Aserrí–Desamparados (Río Poás)”, en la cual ya fueron concluidos los estudios y diseños para el mejoramiento integral del corredor vial descrito. El inicio del proyecto coincide con el inicio de la Ruta Nacional N°. 217, en el entronque con la Ruta Nacional N°. 214, y concluye en el bastión derecho del puente existente sobre el río Poás (ubicado en el límite cantonal entre Aserrí y Alajuelita), tramo que forma parte del proyecto. Este antecedente evidencia que el CONAVI ha venido desarrollando planificación técnica y estudios de diseño para atender integralmente la Dirección01, lo cual permitirá una solución estructural y definitiva a las problemáticas denunciadas. Así las cosas y consecuentemente con lo anterior descrito, se informa que se procederá a informar al Ministerio de Salud del caso en función de que pueda gestionar lo correspondiente dentro de sus competencias, así como copiar a la Municipalidad correspondiente en función de que tome las acciones dentro de sus obligaciones de legislación y verificación de permisos de construcción dentro del cual esta los desfogues de cada propiedad privada. Asimismo, dada la situación de riesgo expuesta, se procederá a programar la limpieza de las alcantarillas a fin de mitigar el caso, no obstante, es importante señalar que mientras persista el vertido ilegal de aguas negras y jabonosas, la situación de sedimentación y saturación continuará presentándose, por lo que se requiere que las autoridades competentes dentro de sus competencias atiendan el caso de vertido ilegal. Es importante mencionar que el CONAVI, realiza el mantenimiento de la ruta, mediante las figuras contractuales con las que ha contado a lo largo del tiempo, toda vez que, dicha labor continúa realizándose hasta la fecha, de forma proactiva y diligente” (véase informe rendido bajo juramento).\n\nIV.- Sobre el caso concreto. En el sub lite, el recurrente alega que el 27 de febrero de 2026 envió oficio CDSJD 005-2026 en el que denunció ante CONAVI la situación de deterioro y obstrucción del alcantarillado que se encuentra en la Dirección03, Desamparados, cercanías del Liceo Sotero González Barquero, el cual acumula aguas negras, malos olores y riesgo evidente de rebalse e inundación. Reclama que, a la fecha en la que acude en amparo, no ha recibido respuesta a su gestión. Solicita la intervención de la Sala.\n\nAl respecto, de la relación de hechos probados se desprende que el 27 de febrero de 2026, el recurrente envió el oficio CDSJD 005-2026 por medio de “ventanilla única”, en el que indicó: “El suscrito, Nombre01, mayor, vecino de San Juan de Dios, Desamparados, portador de la cédula CED01, en mi condición de Síndico de Distrito, solicita su intervención inmediata en la Dirección01, debido a dos puntos críticos de obstrucción que están afectando gravemente la zona: -Cercanía del Colegio: A unos 20 metros al norte de la institución, donde una alcantarilla obstruida provoca el desborde de lo que aparentan ser aguas negras y pluviales sobre la carretera, obligando a los estudiantes a transitar por el foco de contaminación e incluso a la carretera al no contar con aceras. -Frente al Bar Loras: Unos 20 metros arriba del liceo, se presenta una segunda obstrucción que también genera estancamiento y representa un riesgo epidemiológico adicional para la población. Esta situación constituye un grave peligro para la salud pública. Se adjuntan oficios de la Municipalidad de Desamparados, donde se hace constar que el mantenimiento y reconstrucción de estos tramos es responsabilidad del CONAVI. Solicitamos el destaqueo, limpieza o reconstrucción de estas alcantarillas a la brevedad posible”. La resolución de curso del amparo fue notificada a las autoridades recurridas el 11 de junio de 2026. Por oficio CARTA-CONAVI-CA-DIE-GCSV-DRC-1014-2026 del 15 de junio de 2026 remitido al recurrente al correo electrónico ...01 en esa misma fecha, las autoridades de la Gerencia de Conservación de Vías y Puentes del CONAVI contestaron al petente: “En atención al oficio N° CDSJD 005-2026, relacionado con la situación del alcantarillado pluvial ubicado en la Dirección01, cercanías del Liceo Sotero González Barquero, se procede a indicar lo siguiente: Ubicación (…) Imagen No.1: Ubicación de la zona afectada ubicada en la Dirección01, Sección de Control: Dirección02). verificar las condiciones del alcantarillado pluvial y determinar la naturaleza de la situación presentada. Durante la inspección realizada se procedió a realizar un recorrido por el lugar y por el punto de estudio, por lo que se constató la presencia de aguas negras, aguas residuales y aguas servidas en el sistema de alcantarillado pluvial, el cual está diseñado única y exclusivamente para el manejo y conducción de las aguas pluviales de la ruta, por lo cual el vertido ilegal de dichos líquidos, no solo resta capacidad hidráulica al sistema, sino que también sedimenta el mismo, razón por la cual se satura el sistema, tal como se evidencia en las siguientes fotografías N° 1 y N° 2: (…) Fotografía N° 1 y N° 2: Muestra la presencia de aguas negras y jabonosas vertida en el alcantarillado pluvial Consecuentemente con lo anterior descrito, el Reglamento de Vertido y Reuso de Aguas Residuales (Decreto Ejecutivo N.º 33601-MINAE-S) y a la Ley de Aguas N.º 276, prohíbe el vertido de aguas negras y residuales en sistemas de alcantarillado pluvial, dado que ello genera riesgos sanitarios, ambientales y de seguridad pública. Asimismo, se debe considerar lo correspondiente a regulaciones de disposiciones de aguas, de las cuales las responsabilidades en materia de vertidos de aguas servidas, aguas negras o cualquier desfogue diferente a aguas de tipo pluvial es responsabilidad de los municipios, así como las autoridades de salud correspondientes, según las disposiciones establecidas en la Ley N° 5395, “Ley General de Salud” en sus artículos N°288, N°289, N°291, N°292. (Subrayados y resaltados no son del original). En función de lo anterior descrito y las competencias señaladas dentro del marco legal se concluye que, el tema de afectación de sistemas de drenaje de servidumbres o entradas a propiedades privadas fuera del derecho de vía de la Ruta Nacional, no es competencia del Consejo Nacional de Vialidad, además de que el sistema de drenaje pluvial es para uso exclusivo de la Dirección01, la cual se encuentra afectada por conexiones ilegales de aguas sanitarias o servidas, así como por aguas pluviales provenientes de desfogues ilegales, afectando su estado y capacidad para el manejo y control de las aguas pluviales provenientes de la Dirección01. Adicionalmente, no se omite señalar que existe la Licitación No. 2016LA-000032-0006000001 “MEJORAMIENTO DE LA RUTA NACIONAL No. 217, SECCIÓN: Dirección01 (San Rafael Abajo de Desamparados) – Límite Cantonal Aserrí–Desamparados (Río Poás)”, en la cual ya fueron concluidos los estudios y diseños para el mejoramiento integral del corredor vial descrito. El inicio del proyecto coincide con el inicio de la Ruta Nacional N°. 217, en el entronque con la Ruta Nacional N°. 214, y concluye en el bastión derecho del puente existente sobre el río Poás (ubicado en el límite cantonal entre Aserrí y Alajuelita), tramo que forma parte del proyecto. Este antecedente evidencia que el CONAVI ha venido desarrollando planificación técnica y estudios de diseño para atender integralmente la Dirección01, lo cual permitirá una solución estructural y definitiva a las problemáticas denunciadas. Así las cosas y consecuentemente con lo anterior descrito, se informa que se procederá a informar al Ministerio de Salud del caso en función de que pueda gestionar lo correspondiente dentro de sus competencias, así como copiar a la Municipalidad correspondiente en función de que tome las acciones dentro de sus obligaciones de legislación y verificación de permisos de construcción dentro del cual esta los desfogues de cada propiedad privada. Asimismo, dada la situación de riesgo expuesta, se procederá a programar la limpieza de las alcantarillas a fin de mitigar el caso, no obstante, es importante señalar que mientras persista el vertido ilegal de aguas negras y jabonosas, la situación de sedimentación y saturación continuará presentándose, por lo que se requiere que las autoridades competentes dentro de sus competencias atiendan el caso de vertido ilegal. Es importante mencionar que el CONAVI, realiza el mantenimiento de la ruta, mediante las figuras contractuales con las que ha contado a lo largo del tiempo, toda vez que, dicha labor continúa realizándose hasta la fecha, de forma proactiva y diligente”.\n\nAsí las cosas, queda en evidencia la demora de la autoridad recurrida en atender la gestión bajo estudio, toda vez que, pese a que fue formulada desde el 27 de febrero de 2026, no fue sino hasta el 15 de junio de 2026 -con ocasión de la interposición del amparo- cuando se le dio respuesta a su denuncia. \n\nEn ese sentido, al recurrente se le indicó que se realizó una inspección técnica en el tramo señalado y se constató la presencia de aguas negras, aguas residuales y aguas servidas en el sistema de alcantarillado pluvial, el cual está diseñado única y exclusivamente para el manejo y conducción de las aguas pluviales de la ruta. Por ello, determinaron que: “se procederá a informar al Ministerio de Salud del caso en función de que pueda gestionar lo correspondiente dentro de sus competencias, así como copiar a la Municipalidad correspondiente en función de que tome las acciones dentro de sus obligaciones de legislación y verificación de permisos de construcción dentro del cual esta los desfogues de cada propiedad privada. Asimismo, dada la situación de riesgo expuesta, se procederá a programar la limpieza de las alcantarillas a fin de mitigar el caso”. Además, se le explicó al petente que el tramo se encuentra incluido dentro del proyecto Licitación No. 2016LA-000032-0006000001 “MEJORAMIENTO DE LA RUTA NACIONAL No. 217, SECCIÓN: Dirección01 (San Rafael Abajo de Desamparados) – Límite Cantonal Aserrí–Desamparados (Río Poás)”, en la cual ya fueron concluidos los estudios y diseños para el mejoramiento integral del corredor vial descrito, lo que evidencia que el CONAVI ha desarrollado planificación técnica y estudios de diseño para atender integralmente la ruta mencionada y brindar una solución estructural y definitiva a la problemática denunciada.\n\nEn consecuencia, dado que la situación reclamada fue corregida durante la tramitación de este proceso, en tanto se dio respuesta a la denuncia del recurrente y se determinó y comunicó el plan de manejo por seguir para atender la problemática descrita, lo procedente es estimar el recurso de acuerdo con lo establecido en el ordinal 52 de la Ley de la Jurisdicción Constitucional.\n\nV.- Sobre la condenatoria en costas, daños y perjuicios de conformidad con el artículo 52 de la ley de la jurisdicción constitucional. Bajo una mejor ponderación, la mayoría de la Sala considera que, en el sub examine, de conformidad con lo dispuesto en el párrafo 1° del artículo 52 de la Ley de la Jurisdicción Constitucional (“Si, estando en curso el amparo, se dictare resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, se declarará con lugar el recurso únicamente para efectos de indemnización y de costas, si fueren procedentes”), la estimatoria debe serlo sin especial condenatoria en costas, daños y perjuicios, con base en las siguientes consideraciones. Si bien hay un texto expreso en la ley que obliga a que la parte dispositiva del fallo indique que se declara con lugar el recurso, cuando estando en curso del amparo se resuelva el agravio, no menos cierto es que ese mismo párrafo in fine refiere que la estimatoria se dicta “únicamente para efectos de indemnización y de costas, si fueren procedentes”. Se subraya que la Ley indica “si fueren procedentes”, lo cual significa que la procedencia o improcedencia de la indemnización y costas depende de una valoración, apreciación o ponderación del Tribunal. En casos como este, el contenido de la pretensión de la persona amparada y la conducta de la autoridad recurrida de reconocer aquella, sugieren que los menoscabos, lesiones o alteraciones alegados no están referidos de modo directo a una repercusión en un derecho constitucional de evidente naturaleza patrimonial (como sí ocurriría, por ejemplo, con una afectación al derecho al salario). Para disipar cualquier duda al respecto, es importante destacar lo dispuesto en el artículo 51 de la misma Ley de la Jurisdicción Constitucional, cuando dispone que: “toda resolución que acoja el recurso condenará en abstracto a la indemnización de los daños y perjuicios causados y al pago de las costas del recurso, y se reservará su liquidación para la ejecución de sentencia”, donde no se prevé la posibilidad de valorar si procede o no lo concerniente a indemnización y costas. Los principios del Derecho Constitucional, los del Público y Procesal General o, en su caso, los del Derecho Internacional o Comunitario y, además, por su orden, la Ley General de la Administración Pública y el Código Procesal Contencioso Administrativo y los demás códigos procesales, son fuente supletoria para la aplicación e interpretación de las normas de la Ley de la Jurisdicción Constitucional -cfr. artículo 14-. Para la jurisdicción contencioso-administrativa, el legislador estableció un precepto plenamente aplicable al caso por analogía, en el artículo 197 del Código Procesal Contencioso Administrativo, que responde a la lógica procesal en cualquier materia. En todo caso, la parte afectada del sub lite preserva la posibilidad de acudir, si a bien lo tiene, a un proceso de conocimiento a fin de demostrar que ha sufrido algún tipo de menoscabo. Con base en lo anterior, es criterio de mayoría resolver este recurso sin condenatoria en costas, daños y perjuicios.\n\nVI.- Nota del magistrado Castillo Víquez, en cuanto a la justicia administrativa pronta y cumplida. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia. Por ende, salvo aquellas controversias jurídico-constitucionales que han sido reconocidas por esta misma Sala como supuestos de excepción, que sí proceden ser conocidas en esta jurisdicción a través del proceso constitucional de garantía del amparo, en los demás casos, y por las razones que ha dado este Tribunal (sentencia N° 2008-02545 de las 8:55 horas de 22 de febrero de 2008), los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25, de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento.\n\nVII.- Nota del magistrado Salazar Alvarado. En tesis de principio, considero que los casos relacionados con la actividad o inactividad de la Administración Pública en la reparación, construcción, modificación o demolición de cualquier obra de infraestructura, deben ser desestimados, por constituir, esa omisión, un tema de legalidad, cuya discusión corresponde a la jurisdicción ordinaria, ante la cual la persona interesada puede debatir, con mayor amplitud, sus disconformidades. Sin embargo, cuando de aquella conducta administrativa (omisiva o no) se derive alguna violación a otros derechos fundamentales tutelados en esta jurisdicción constitucional, o se afecten grupos considerados vulnerables, sí entro a conocer el fondo del asunto, por constituir esta situación una excepción a mi posición en esta materia, tal y como sucede en este caso, en que la parte recurrente acusa que el 27 de febrero de 2026 envió oficio CDSJD 005-2026 en el que denunció ante CONAVI la situación de deterioro y obstrucción del alcantarillado que se encuentra en la Dirección03, Desamparados, cercanías del Liceo Sotero González Barquero, el cual acumula aguas negras, malos olores y riesgo evidente de rebalse e inundación.\n\nVIII.- Voto salvado de la magistrada Garro Vargas respecto a la parte dispositiva de esta sentencia. Dice el artículo 52 de la Ley de la Jurisdicción Constitucional (LJC): \"Si, estando en curso el amparo, se dictare resolución, administrativa o judicial, que revoque, detenga o suspenda la actuación impugnada, se declarará con lugar el recurso únicamente para efectos de indemnización y de costas, si fueren procedentes\".\n\nMi interpretación sobre esa norma es la siguiente: Esa \"resolución\" es todo acto válido y eficaz por el cual la autoridad competente restituye en el goce del derecho conculcado. La frase \"si fueren procedentes\" se refiere a las costas. Es más, el artículo 197 del Código Procesal Contencioso Administrativo, citado por la mayoría, sobre la base del artículo 14 de la LJC, justamente se refiere sólo a estas: a las costas. \n\nCiertamente, a tenor del artículo 48 de la Constitución Política (CP), el contenido esencial del derecho al recurso de amparo no es indemnizatorio sino restitutorio; sin embargo, el artículo 51 de la LJC señala: \"Toda resolución que acoja el recurso condenará en abstracto a la indemnización de los daños y perjuicios causados y al pago de las costas del recurso, y se reservará su liquidación para la ejecución de sentencia\". \n\nSi el derecho ha sido violado y la Sala así lo constata, aún en caso de que haya sido restituido, podrían haber surgido daños y perjuicios. Por tal motivo, cabe la condenatoria en abstracto de éstos. Si no se hiciera así, si no. se diera tal condenatoria, en el caso de que si se hubieren dado, no habría título -derivado de este proceso- para reclamarlos, con lo que se podría violar el artículo 41 de la CP. Si a pesar de que se haya condenatoria en abstracto, no se han dado los daños y perjuicios, el juez en la vía ordinaria así lo declarará, pues sólo a él corresponde tener por probado la existencia real y la magnitud de los mismos. Con la tesis defendida por la mayoría estimo que, contrario a lo que se busca, se estaría incentivando que la Administración respete los derechos sólo ante la existencia de un recurso de amparo. Resta decir que el artículo 52 de la LJC prevé la posibilidad de que, si se estima que es lo justo, la Sala condene en costas, aún cuando el derecho haya sido restituido. \n\nEn razón de lo anterior, salvo parcialmente el voto respecto de la parte dispositiva y ordeno la condenatoria en daños y perjuicios, pero no la condenatoria en costas. \n\nIX.- Documentación aportada al expediente. San José, at 9:30 a.m. on 6 August 2026.\n\nAmparo proceeding filed in case no. 26-019412-0007-CO by Nombre01, identity card CED02, against the NATIONAL ROAD COUNCIL (CONAVI).\n\nBackground:\n\n1.- By written submission received by the Chamber’s Secretariat on 31 May 2026, the applicant files an amparo application. She alleges: “● FIRST: Approximately one year ago, I submitted a formal request to the Municipality of Desamparados for urgent attention to the serious deterioration and blockage of a culvert located on a national road. ● SECOND: Municipal officials inspected the site and expressly determined that, because the infrastructure is located on a national road, jurisdiction lay with the National Road Council (CONAVI). ● THIRD: Following that indication, I submitted a formal administrative request to CONAVI, which was received and registered under an administrative tracking number. ● FOURTH: The legal and reasonable period for obtaining a response has long since elapsed, and despite multiple inquiries, including by email, CONAVI has remained completely silent, issuing no decision and taking no effective action at the reported site. ● FIFTH: The reported problem is extremely serious because the culvert is severely blocked, with an accumulation of sewage, foul odors, and an evident risk of overflow and flooding, a situation that worsens considerably during the rainy season. ● SIXTH: There is also another equally blocked culvert just a few meters from the site, significantly increasing the health, environmental, and road-safety risks for the community. ● SEVENTH: The affected area is heavily used by students, including minors, who must pass through the site every day to attend educational institutions and use public transportation. ● EIGHTH: There is also a bus stop practically opposite the affected area, exposing pedestrians, students, and public-transport users directly to the danger caused by the culvert’s poor condition. ● NINTH: The omission by the authority against which this application is brought puts at risk the physical integrity and health of the public, the right to a healthy and ecologically balanced environment, and the road safety of those who travel through the area daily. ● TENTH: CONAVI’s omission also constitutes a flagrant violation of the constitutional right to petition and to a prompt response, widely recognized in the Constitutional Chamber’s repeated case law. LEGAL AND CASE-LAW BASIS ● The omission by the authority against which this application is brought violates Article 27 of the Political Constitution, concerning the right to petition and to a prompt response. ● Fundamental rights relating to public health, physical integrity, the safety of minors, and the right to a healthy and ecologically balanced environment are also infringed. ● The Constitutional Chamber has repeatedly held in extensive case law that the Public Administration may not remain inactive in the face of situations that compromise the fundamental rights of the community or evident risks to people’s safety and health. ● Constitutional Chamber ruling number 14125-2006 established that every public authority has a duty to respond promptly, formally, and effectively to requests submitted by members of the public. ● Constitutional case law has also repeatedly held that administrative silence violates the fundamental right to petition when the Administration fails to decide within a reasonable period. ● The reported administrative omission is especially serious because the fundamental rights of minors are at stake, and their enhanced protection is a priority obligation of the Costa Rican State. ● CONAVI’s omission is also contrary to the constitutional principles of administrative efficiency, continuity of public service, prevention of harm, and protection of the best interests of the minor. RELIEF REQUESTED ● That this amparo proceeding be declared WELL-FOUNDED. ● That the NATIONAL ROAD COUNCIL (CONAVI) be ordered to provide an immediate, formal, and substantive response to the administrative requests submitted by the applicant. ● That an urgent technical inspection of the reported site be ordered. ● That immediate action be ordered to repair and clear the reported culverts. ● That preventive and safety measures be put in place while the necessary work is carried out, in order to protect the physical integrity and health of students, pedestrians, and public-transport users. ● That the authority against which this application is brought be warned that it must immediately comply with the orders issued by this Chamber. ● That the State be ordered to pay the costs and the damages caused by the administrative omission and the violation of fundamental rights.”\n\n2.- By resolution issued at 12:14 p.m. on 11 June 2026, the Chamber’s Presidency admitted the amparo application for processing and requested a report from the executive director and the manager of the Road and Bridge Maintenance Department, both of the National Road Council (CONAVI).\n\n3.- By written submission entered in the electronic case file on 17 June 2026, the applicant states: “Because the period granted to the authority against which this application is brought to submit its report has expired, and the situation reported in this proceeding persists, I ask this Honorable Tribunal to decide the matter based on the materials in the case file and to assess the administrative omission that gave rise to this constitutional action. The stated problem continues to pose a risk to public health, the environment, and the safety of the residents, students, and pedestrians of the community of San Juan de Dios de Desamparados. Accordingly, I respectfully reiterate the relief requested in the initial submission and ask that this Amparo Application be declared WELL-FOUNDED in all respects, ordering the NATIONAL ROAD COUNCIL (CONAVI) to take the necessary measures immediately to provide an effective and definitive solution to the reported situation, and also ordering it to pay the costs and damages, as requested in the initial application.”\n\n4.- By written submission entered in the electronic case file on 18 June 2026, Mauricio Sojo Quesada, in his capacity as acting executive director of the National Road Council, reports. He states: “The specified resolution was notified to the National Road Council by email. We therefore proceed to answer the facts mentioned therein, within the time and in the form prescribed by law, as established in the Judicial Notifications and Summons Act, Art. 38, Calculation of the period for notifications by email. ORDER ADMITTING THE APPLICATION: The resolution issued at 12:14 p.m. on 11 June 2026 states, insofar as relevant: ‘…that approximately one year ago, a formal request was submitted to the Municipality of Desamparados for urgent attention to the serious deterioration and blockage of a culvert located on a national road (Dirección03, near Liceo Sotero González Barquero), by official letter No. FM-PUSC-050-2025. It states that municipal officials inspected the site and expressly determined that, because the infrastructure is located on a national road, jurisdiction lay with the National Road Council (CONAVI). Following that indication, a formal administrative request was submitted to CONAVI by official letter CDSJD 005-2026, which was received and registered under number TS.02617.2026. It alleges that the legal and reasonable period for obtaining a response has long since elapsed, and despite multiple inquiries, including by email, CONAVI has remained completely silent, issuing no decision and taking no effective action at the reported site. It adds that the reported problem is extremely serious because the culvert is severely blocked, with an accumulation of sewage, foul odors, and an evident risk of overflow and flooding, a situation that worsens considerably during the rainy season. It further states that there is another equally blocked culvert just a few meters from the site, significantly increasing the health, environmental, and road-safety risks for the community …’ SUBSTANTIVE RESPONSE TO THE APPLICATION In relation to the facts alleged by the applicant, it must be clarified that, although at the time the amparo application was filed an alleged lack of response by this Administration was asserted, that situation was duly addressed and remedied during these proceedings. Indeed, the record shows that, by official letter CARTA-CONAVI-CA-DIE-GCSV-DRC-1014-2026 dated 15 June 2026, the National Road Council issued a formal response to the request submitted by Mr. Nombre01, corresponding to official letter No. CDSJD 005-2026, concerning the problem with the storm-drain system located at Dirección01, near Liceo Sotero González Barquero. That response was duly communicated to the member of the public on 15 June 2026, by email sent to the address designated by the interested party for notification purposes, with the relevant official letter attached. This ensured that the Council’s response came to his attention, thereby remedying any omission that may have existed when the application was filed. In addition, by official letter CARTA-CONAVI-CA-DIE-GCSV-DRC-1016-2026 dated 15 June 2026, the Road and Bridge Maintenance Department sent the corresponding technical report, along with proof of the response provided to the member of the public, to the Legal Affairs Management Department, thereby establishing that the Administration duly addressed the case and fulfilled its duty to respond. In this context, the omission complained of has clearly ceased, and the amparo proceeding has therefore become moot, since the applicant’s principal request—to obtain a response to his submission—has already been satisfied by this Council. As for the content of the response, the applicant was informed that this Administration had conducted a technical inspection at the specified site to verify the condition of the storm-drain system. The inspection found sewage, wastewater, and waste water discharged into the storm-drain system, which is designed exclusively to carry stormwater. This causes the system to become saturated and impairs its hydraulic capacity. It was also stated that this type of discharge is contrary to current regulations, particularly the provisions of the Wastewater Discharge and Reuse Regulation, the Water Act, and the General Health Act. It was further noted that regulation, control, and oversight of these discharges fall to other competent authorities, such as the Ministry of Health and the respective Municipality. In that regard, the member of the public was informed that the National Road Council would report the situation to those authorities so that they could take the appropriate measures within their areas of competence. It was also stated that this Administration would schedule cleaning of the drain system to mitigate the reported situation; however, it was warned that the problem could continue as long as the illegal discharges persist. In addition, it was noted that the National Road Council has been carrying out maintenance and planning work at Dirección01, including studies and designs aimed at the comprehensive improvement of that road corridor, which demonstrates active management of the road infrastructure in question. It follows from the above that the Administration has not remained inactive in the face of the situation described, but has taken the corresponding steps within its area of competence, addressed the case, and concluded by issuing and notifying a formal response to the member of the public. The grievance raised in the application was therefore resolved during these proceedings, and there is currently no ongoing infringement of the right to petition and to a prompt response. RELIEF REQUESTED For the factual and legal reasons set out above, I ask the Honorable Constitutional Chamber of the Supreme Court of Justice to declare this amparo proceeding unfounded and to absolve me, in the capacities indicated, of all liability.”\n\n5.- By written submission entered in the electronic case file on 18 May 2026, Jason Adrián Pérez Anchía, in his capacity as manager of the Road and Bridge Maintenance Department of the National Road Council, reports. He states: “In relation to the facts alleged by the applicant, it must be clarified that, although at the time the amparo application was filed an alleged lack of response by this Administration was asserted, that situation was duly addressed and remedied during these proceedings. RELIEF REQUESTED For the factual and legal reasons set out above, I ask the Honorable Constitutional Chamber of the Supreme Court of Justice to declare this amparo proceeding unfounded and to absolve me, in the capacities indicated, of all liability.”\n\n6.- The legal requirements have been observed in these proceedings.\n\nDrafted by Justice Rueda Leal; and,\n\nReasons:\n\nI.- Preliminary issue. Before examining the merits of the matter, it must be clarified that, beginning with judgment no. 2008002545, issued at 8:55 a.m. on 22 February 2008, this Chamber has referred matters to the administrative-litigation jurisdiction—with some exceptions—when they concern whether the public administration has complied with the time limits established by the General Public Administration Act (Articles 261 and 325) or by sector-specific laws governing special administrative procedures, either to issue a final decision in an administrative procedure—initiated on the authority’s own initiative or at a party’s request—or to hear the applicable administrative appeals. The present case is precisely an exception, because it concerns an environmental complaint alleged not to have been resolved within a reasonable period. That point clarified, the Chamber will now decide the specific situation complained of in this amparo proceeding.\n\nII.- Subject of the application. The applicant alleges that on 27 February 2026 he sent official letter CDSJD 005-2026, in which he reported to CONAVI the deterioration and blockage of the culvert located at Dirección03, Desamparados, near Liceo Sotero González Barquero, where sewage accumulates, causing foul odors and an evident risk of overflow and flooding. He complains that, by the time he filed for amparo, he had received no response to his request. He asks the Chamber to intervene.\n\nIII.- Proven facts. The following facts are deemed duly established and are relevant to deciding this matter:\n\na) On 27 February 2026, the applicant sent official letter CDSJD 005-2026 through the “single service window,” stating: “I, Nombre01, an adult resident of San Juan de Dios, Desamparados, holder of identity card CED01, in my capacity as District Trustee, request your immediate intervention at Dirección01, due to two critical blockage points that are seriously affecting the area: -Near the school: About 20 meters north of the institution, where a blocked culvert causes what appears to be sewage and stormwater to overflow onto the road, forcing students to pass through the source of contamination and even onto the road because there are no sidewalks. -In front of Bar Loras: About 20 meters uphill from the high school, there is a second blockage that also causes standing water and poses an additional epidemiological risk to the population. This situation presents a serious danger to public health. Attached are official letters from the Municipality of Desamparados stating that maintenance and reconstruction of these stretches are CONAVI’s responsibility. We request that these culverts be cleared, cleaned, or rebuilt as soon as possible” (see evidence submitted).\n\nb) The resolution admitting the amparo application for processing was notified to the respondent authorities on 11 June 2026 (see notification records).\n\nc) By official letter CARTA-CONAVI-CA-DIE-GCSV-DRC-1014-2026 dated 15 June 2026, sent to the applicant at email address ...01 on the same date, the authorities of CONAVI’s Road and Bridge Maintenance Department replied to the petitioner: “In response to official letter No. CDSJD 005-2026, concerning the storm-drain system located at Dirección01, near Liceo Sotero González Barquero, we state the following: Location (…) Image No. 1: Location of the affected area at Dirección01, Control Section: Dirección02). [We proceeded to] verify the condition of the storm-drain system and determine the nature of the situation. During the inspection, the area and the point under review were surveyed, and the presence of sewage, wastewater, and waste water in the storm-drain system was confirmed. The system is designed exclusively to handle and carry the route’s stormwater. The illegal discharge of those liquids therefore not only reduces the system’s hydraulic capacity but also causes sediment to accumulate in it, which is why the system becomes saturated, as shown in the following photographs Nos. 1 and 2: (…) Photograph Nos. 1 and 2: Show the presence of sewage and soapy water discharged into the storm-drain system. Consistent with the foregoing, the Wastewater Discharge and Reuse Regulation (Executive Decree No. 33601-MINAE-S) and the Water Act No. 276 prohibit the discharge of sewage and wastewater into storm-drain systems, given the resulting health, environmental, and public-safety risks. The applicable regulations on water discharges must also be considered. Responsibility for discharging waste water, sewage, or any outfall other than stormwater rests with the municipalities and the relevant health authorities, in accordance with the provisions of Act No. 5395, ‘General Health Act,’ Articles Nos. 288, 289, 291, and 292. (Underlining and emphasis are not in the original.) In view of the foregoing and the areas of competence established in the legal framework, it is concluded that impacts on drainage systems serving easements or entrances to private properties outside the right-of-way of the National Road do not fall within the competence of the National Road Council. In addition, the storm-drain system is for the exclusive use of Dirección01 and is affected by illegal connections carrying sanitary or waste water, as well as stormwater from illegal outfalls, which affect its condition and its capacity to handle and control stormwater from Dirección01. It should also be noted that there is Tender No. 2016LA-000032-0006000001, ‘IMPROVEMENT OF NATIONAL ROAD No. 217, SECTION: Dirección01 (San Rafael Abajo de Desamparados) – Aserrí–Desamparados Cantonal Boundary (Río Poás),’ for which the studies and designs for the comprehensive improvement of the road corridor described have already been completed. The project begins at the start of National Road No. 217, where it meets National Road No. 214, and ends at the right abutment of the existing bridge over the Río Poás (located on the cantonal boundary between Aserrí and Alajuelita); this stretch is part of the project. This history shows that CONAVI has been developing technical plans and design studies to address Dirección01 comprehensively, which will make it possible to provide a structural and definitive solution to the reported problems. Accordingly, and consistent with the foregoing, we advise that the case will be reported to the Ministry of Health so that it may take the appropriate steps within its area of competence, and that a copy will be sent to the respective Municipality so that it may take action within its statutory duties, including verifying construction permits, among them those for outfalls from private properties. In view of the reported risk, we will also schedule cleaning of the culverts to mitigate the problem. However, it is important to note that while the illegal discharge of sewage and soapy water continues, sedimentation and saturation will also continue; the competent authorities must therefore address the illegal discharges within their areas of competence. It is important to mention that CONAVI maintains the road through the contractual arrangements available to it over time, and this work continues to the present day in a proactive and diligent manner” (see report submitted under oath).\n\nIV.- The specific case. In this case, the applicant alleges that on 27 February 2026 he sent official letter CDSJD 005-2026, in which he reported to CONAVI the deterioration and blockage of the culvert located at Dirección03, Desamparados, near Liceo Sotero González Barquero, where sewage accumulates, causing foul odors and an evident risk of overflow and flooding. He complains that, by the time he filed for amparo, he had received no response to his request. It is important to mention that CONAVI maintains the road through the contractual arrangements available to it over time, and this work continues to the present day in a proactive and diligent manner.”\n\nThus, the delay by the respondent authority in addressing the request is evident: although it was submitted on 27 February 2026, the complaint was not answered until 15 June 2026, after the amparo application was filed.\n\nIn that regard, the applicant was told that a technical inspection had been conducted on the specified stretch and that sewage, wastewater, and waste water had been found in the storm-drain system, which is designed exclusively to handle and carry the route’s stormwater. The authorities therefore determined that: “the case will be reported to the Ministry of Health so that it may take the appropriate steps within its area of competence, and a copy will be sent to the respective Municipality so that it may take action within its statutory duties, including verifying construction permits, among them those for outfalls from private properties. In view of the reported risk, we will also schedule cleaning of the culverts to mitigate the problem.” The petitioner was also told that the stretch is included in Tender No. 2016LA-000032-0006000001, “IMPROVEMENT OF NATIONAL ROAD No. 217, SECTION: Dirección01 (San Rafael Abajo de Desamparados) – Aserrí–Desamparados Cantonal Boundary (Río Poás),” for which the studies and designs for the comprehensive improvement of the road corridor described have already been completed. This shows that CONAVI has developed technical plans and design studies to address the mentioned road comprehensively and provide a structural and definitive solution to the reported problem.\n\nConsequently, since the situation complained of was corrected during these proceedings, in that the applicant’s complaint was answered and the plan to be followed for addressing the reported problem was identified and communicated, the proper course is to uphold the amparo in accordance with Article 52 of the Constitutional Jurisdiction Act.\n\nV.- Award of costs and damages pursuant to Article 52 of the Constitutional Jurisdiction Act. On further consideration, the Chamber majority considers that, in this case, under paragraph 1 of Article 52 of the Constitutional Jurisdiction Act (“If, while the amparo is pending, an administrative or judicial decision is issued that revokes, halts, or suspends the challenged action, the application shall be declared well-founded solely for purposes of compensation and costs, if appropriate”), the application should be upheld without a specific award of costs or damages, for the following reasons. Although the Act expressly requires the operative part of the judgment to state that the application is declared well-founded when the grievance is resolved while the amparo is pending, the final clause of that same paragraph also provides that the application is upheld “solely for purposes of compensation and costs, if appropriate.” The Act says “if appropriate,” which means that whether compensation and costs are appropriate depends on the Tribunal’s assessment, evaluation, or weighing of the circumstances. In cases such as this one, the substance of the protected person’s request and the respondent authority’s conduct in acknowledging it suggest that the alleged detriments, infringements, or alterations do not directly concern an impact on a constitutional right of an evidently pecuniary nature (as would be the case, for example, with an infringement of the right to a salary). To dispel any doubt on this point, it is important to highlight Article 51 of the same Constitutional Jurisdiction Act, which provides that “every decision granting the application shall award, in the abstract, compensation for damages caused and payment of the costs of the application, reserving their calculation for enforcement of the judgment”; it does not provide for the possibility of assessing whether compensation and costs are appropriate. The principles of Constitutional Law, Public Law and General Procedural Law or, where applicable, International or Community Law, and, in addition, in that order, the General Public Administration Act, the Administrative Litigation Procedure Code, and the other procedural codes, are supplementary sources for applying and interpreting the provisions of the Constitutional Jurisdiction Act—cf. Article 14. For the administrative-litigation jurisdiction, the legislature established a provision that applies fully to this case by analogy, in Article 197 of the Administrative Litigation Procedure Code, consistent with procedural logic in any field. In any event, the affected party in this case retains the option, should he so wish, of bringing proceedings on the merits to prove that he has suffered some form of detriment. On the foregoing basis, the majority considers that this application should be decided without an award of costs or damages.\n\nVI.- Note by Justice Castillo Víquez regarding prompt and effective administrative justice. I have supported this Tribunal’s position that when a litigant alleges an infringement of the right to prompt and effective justice in the administrative forum, the legal dispute must be heard by the Administrative Litigation Courts and not by this Chamber. However, with the recent enactment of Act No. 9097, the Petition Rights Regulation Act, it has been established that this right may be protected judicially through the amparo proceeding established by Article 32 of the Constitutional Jurisdiction Act, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s material conduct, administrative acts, or response is affecting the petitioner’s fundamental rights. In my view, the recently enacted law does not mean that this Tribunal must change its line of case law; under section 7 of its Act, this Tribunal has exclusive authority to define its own jurisdiction. Therefore, except for those constitutional legal disputes that this Chamber itself has recognized as exceptional cases that may be heard in this jurisdiction through the constitutional amparo remedy, the competent bodies in all other cases, for the reasons this Tribunal has given (judgment No. 2008-02545, issued at 8:55 a.m. on 22 February 2008), are the Judges of the administrative-litigation jurisdiction. This is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the relevant statutory provisions, based on a logical, systemic, and teleological interpretation of the legal system.\n\nVII.- Note of Justice Salazar Alvarado. As a general principle, I consider that cases relating to the activity or inactivity of the Public Administration in repairing, constructing, modifying, or demolishing any infrastructure work must be dismissed, because that omission concerns a matter of legality whose discussion belongs before the ordinary courts, where the interested person may debate their objections more fully. However, when that administrative conduct, whether by action or omission, gives rise to a violation of other fundamental rights protected in this constitutional jurisdiction, or affects groups considered vulnerable, I do consider the merits of the matter. That situation is an exception to my position on this subject, as in this case, where the amparo applicant alleges that on 27 February 2026 they sent letter CDSJD 005-2026, reporting to CONAVI the deterioration and obstruction of the sewer system at Dirección03, Desamparados, near Liceo Sotero González Barquero, which is accumulating sewage and causing bad odors, with an evident risk of overflow and flooding.\n\nVIII.- Dissenting opinion of Justice Garro Vargas regarding the operative part of this judgment. Article 52 of the Constitutional Jurisdiction Act (LJC) provides: “If, while the amparo proceeding is pending, an administrative or judicial decision is issued that revokes, halts, or suspends the challenged conduct, the application shall be granted solely for purposes of compensation and costs, if appropriate.”\n\nMy interpretation of that provision is as follows: That “decision” is any valid and effective act by which the competent authority restores the enjoyment of the right that was violated. The phrase “if appropriate” refers to costs. Indeed, Article 197 of the Administrative Litigation Procedure Code, cited by the majority on the basis of Article 14 of the LJC, refers precisely and only to costs.\n\nCertainly, under Article 48 of the Political Constitution (CP), the essential content of the right to an amparo application is restorative, not compensatory; however, Article 51 of the LJC states: “Every decision granting the application shall order, in the abstract, compensation for the damages caused and payment of the costs of the application, and shall reserve their quantification for enforcement of the judgment.”\n\nIf the right has been violated and the Chamber so finds, damages may have arisen even if the right has been restored. For that reason, an abstract order for damages is appropriate. If this were not done—if no such order were made—then, if damages had in fact arisen, there would be no title arising from this proceeding on which to base a claim for them, which could violate Article 41 of the CP. If, despite an abstract order, no damages have arisen, the judge in the ordinary courts will so declare, since only that judge may find the actual existence and extent of those damages to have been proven. I consider that the position defended by the majority would, contrary to its aim, encourage the Administration to respect rights only when an amparo application has been filed. It remains to say that Article 52 of the LJC provides for the possibility that, if the Chamber considers it just, it may order payment of costs even when the right has been restored.\n\nFor the foregoing reasons, I partially dissent from the operative part and order compensation for damages, but not an award of costs.\n\nIX.- Documents submitted to the case file. The parties are advised that any paper documents, objects, or evidence contained on any additional electronic, computing, magnetic, optical, telematic, or new-technology device that they may have submitted must be collected within a maximum period of 30 business days from notification of this judgment. Any material not collected within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary” (approved by the Full Court in Article XXVI of session No. 27-11 of 22 August 2011 and published in Judicial Bulletin No. 19 of 26 January 2012) and Article LXXXI of session No. 43-12 of the Superior Council of the Judiciary of 3 May 2012.\n\nTherefore:\n\nThe application is granted, with no special order as to costs or damages. Justice Castillo Víquez records a note. Justice Salazar Alvarado records a note. Justice Garro Vargas partially dissents and orders compensation for damages, but not costs.
