  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-020866-0007-CO \n\nRes. Nº 2026029863\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del seis de agosto de dos mil veintiseis .\n\nRecurso de amparo promovido por Nombre06, cédula de identidad CED02, a favor de Nombre03 y de Nombre04, cédula de identidad CED03, Nombre07, Nombre01, contra la MUNICIPALIDAD DE UPALA.\n\nResultando:\n\n1.- Por escrito incorporado al expediente digital el 10 de junio de 2026, la parte recurrente interpone recurso y manifiesta, según se consigna en el auto de curso, lo siguiente: \n\n“[Q]ue recibe el servicio de agua potable en una vivienda abastecida por el acueducto de la municipalidad de Upala. Aduce que el 10 de junio de 2026, funcionarios de la municipalidad de Upala se presentaron en su domicilio y, de forma sorpresiva y sin notificación previa ni aviso formal, procedieron a suspender el servicio de agua potable y retirar el medidor correspondiente. Menciona que dicha suspensión resulta arbitraria colocando a su núcleo familiar en una situación de extrema vulnerabilidad, en tanto en la vivienda habitan personas menores de edad de 10 meses y 12 años, quienes dependen del acceso al agua para su hidratación, alimentación e higiene básica. Refiere que el actuar de la autoridad recurrida se realizó sin otorgarle la posibilidad de ejercer el debido proceso, lesionando además el interés superior de las personas menores de edad y sus derechos fundamentales. Agrega que la falta de acceso al agua potable ha implicado que las personas menores permanezcan más de veinticuatro horas sin acceso a dicho servicio esencial, afectando directamente su salud. Menciona que, al acudir al acueducto municipal en busca de solución, se le indicó utilizar una paja de agua provisional ubicada frente a un basurero, en condiciones insalubres y de alto riesgo de contaminación, lo que agrava la situación sanitaria de su familia. Refiere que, al intentar gestionar la situación mediante contacto telefónico con la municipalidad de Upala, no recibió la atención adecuada, siendo trasladada su llamada entre distintas dependencias sin solución, y además una funcionaria le negó información relevante y dio por terminada la comunicación. Por lo expuesto, solicita la intervención de esta Sala”.\n\n2.- En resolución de las 10:06 horas del 12 de junio de 2026, se da curso al proceso y solicita informe al alcalde y al jefe del Departamento de Acueductos, ambos Municipalidad de Upala, sobre los hechos alegados por el recurrente. \n\n3.- Informa bajo juramento Aura Yamileth López Obregón, en su condición de alcaldesa de Upala, lo siguiente:\n\n“PRIMERO:\n\nEs cierto que mediante resolución dictada el doce de junio de dos mil veintiséis, esta Municipalidad fue notificada del presente recurso de amparo, el cual cuestiona la suspensión del servicio de agua potable realizada el 10 de junio de 2026.\n\nSEGUNDO:\n\nLa operación, administración y gestión técnica del servicio de agua potable municipal corresponde al Acueducto Municipal de Upala, conforme a las disposiciones del Reglamento para la Operación y Administración del Acueducto Municipal de Upala, publicado en La Gaceta N.° 156 del 11 de agosto de 2004.\n\nTERCERO:\n\nMediante oficio MU-ALM-OFIC-1162-2026 de fecha 19 de junio de 2026, esta Alcaldía solicitó al Administrador del Acueducto Municipal remitir la documentación relacionada con los hechos objeto del presente recurso.\n\nCUARTO:\n\nDe acuerdo con el informe rendido bajo fe de juramento por el señor Jorge Mike Zamora López, Administrador del Acueducto Municipal (Oficio MU-ACUE-OFICIO-0079-2026 de fecha 23 de junio de 2026), las personas recurrentes no registran servicio de agua potable a su nombre. El servicio afectado corresponde al NISE 1180, registrado a nombre de la señora Nombre02, cédula CED04, ubicado en Dirección02.\n\nQUINTO:\n\nEl servicio NISE 1180 presenta morosidad acumulada de DOCE (12) MESES, conforme consta en el Estado de Cuenta certificado de fecha 22 de junio de 2026 y en la Constancia de Estado Tributario de igual fecha. La señora Nombre02 se encuentra atrasada desde el 15 de julio de 2025 en servicios de agua.\n\nSEXTO:\n\nEl Administrador confirmó que conforme a los artículos 30, 31 y 32 del Reglamento del Acueducto Municipal, se procedió a suspender el servicio el día 10 de junio de 2026 por encontrarse en condición de morosidad que cumplía con las disposiciones reglamentarias para su suspensión.\n\nSÉTIMO:\n\nEl abonado fue advertido de la eventual suspensión mediante recibos mensuales emitidos durante los doce meses de atraso, en los cuales se indica expresamente que el servicio vence el día 15 de cada mes y que puede ser suspendido en caso de morosidad. Conforme al Reglamento (artículos 30 a 32), la notificación mediante recibos mensuales durante este período constituye procedimiento suficiente.\n\nOCTAVO:\n\nEl Administrador también informó que se realizó una campaña informativa de notificación a usuarios del sistema de agua municipal sobre vencimientos de pagos y consecuencias del no pago.\n\nNOVENO:\n\nEl Administrador informó que la Administración del Acueducto Municipal no mantiene registros sobre composición de núcleos familiares de los abonados, razón por la cual desconocía la presencia de personas menores de edad en el inmueble. \n\nDECIMO:\n\nUna vez que la Administración tuvo conocimiento de las circunstancias alegadas en el recurso, procedió de inmediato a adoptar medidas correctivas. El Administrador informó que dados los alegatos sobre las condiciones de la paja pública existente, 'se procede a instalar otra paja publica a escaso 15 metros de distancia'. La Administración reconoció la situación y procedió a instalar una segunda paja pública en mejor ubicación. Ambas pajas públicas se encuentran operativas para el abastecimiento de agua potable, conforme se acredita con fotografías adjuntas.\n\nUNDÉCIMO:\n\nEl Administrador informó que “la municipalidad puede realizar arreglos de pagos ante estas situaciones” y que “la municipalidad siempre está dispuesta a atender dicha situación, este trámite se realiza en la oficina de cobros de la municipalidad de Upala”. La Administración está disponible para evaluar arreglos de pago a través de cuotas mensuales que permitan la regularización de la obligación tributaria y el levantamiento inmediato de la suspensión. \n\nDUODÉCIMO:\n\nLa Municipalidad de Upala reitera su compromiso con el derecho humano al agua. Las actuaciones del Acueducto Municipal se ajustaron a la normativa reglamentaria vigente, procedimientos establecidos y notificación adecuada. Una vez conocidas las circunstancias particulares, la Administración adoptó medidas correctivas inmediatas (segunda paja \n\npublica) y se mantiene disponible para resolver la situación mediante arreglos de pago.\n\nPOR TANTO:\n\nSolicito respetuosamente se declare SIN LUGAR el presente recurso de amparo, al haberse actuado la Municipalidad de Upala conforme al ordenamiento jurídico vigente y haberse adoptado de inmediato medidas para garantizar el acceso al agua potable de las personas involucradas.\n\nDocumentos adjuntos: Estado de Cuenta NISE 1180 (22/06/2026), Constancia de Estado Tributario (22/06/2026), Reglamento Acueducto Municipal, último recibo con avisos de suspensión, campaña informativa masiva, fotografías de pajas públicas, Oficio MU-ALMOFIC-1162-2026, Informe del Administrador MU-ACUE-OFICIO-0079-2026”.\n\n4.- Informa bajo juramento Jorge Mike Zomora López, en su condición de administrador del Acueducto Municipal de Upala, lo siguiente:\n\n“Es cierto que, el 10 de junio de 2026, se procedió a suspender los servicios de agua potable que se encontraban en estado de morosidad y cumplían con las condiciones establecidas para su suspensión. Sin embargo, según nuestros registros, las señoras Nombre06, Nombre05, Nombre07 y Nombre01, no registran a su nombre ningún servicio de agua potable brindado por el Acueducto Municipal.\n\nNo obstante, de acuerdo con la descripción contenida en el recurso presentado, se tiene conocimiento de que el servicio de agua potable al que se hace referencia podría estar registrado a nombre de la señora Nombre02, cédula de identidad N.'’ CED04, correspondiente al servicio de agua NISE 1180, el cual presenta una morosidad de doce (12) meses.\n\nSobre la suspensión del servicio: asumiendo que es de Nombre02 cedula 05 0205 0157 Agua Nise 1 180 la cual presenta un estado de atraso de doce meses, es cierto que se suspendió el pasado 10 de junio del 2026.\n\nEl abonado es advertido de la suspensión de servicio de agua mediante los recibos mensuales emitidos por la Municipalidad, en los cuales se indica expresamente que el servicio vence el día 15 de cada mes y que podrá ser suspendido en caso de morosidad. también se le comunica vía mensaje de texto el vencimiento del recibo de agua. Se adjunta imagen de ultimo recibo cancelado que contiene el aviso de suspensión y se adjuntó mensaje masivo enviado a 15 433 usuarios.\n\nEl Reglamento para la Operación y Administración del Acueducto Municipal de Upala Publicado en la Gaceta N'’ 156 miércoles 11 de agosto del 2004. Capítulo IV De la Suspensión del servicio de agua potable, Cobro Administrativo y Judicial Artículos 301 31 y 32. Ha(n referencia a la suspensión del servicio mismo que también es adjuntado a este informe.\n\nSobre la presencia de personas menores de edad: La Administración del Acueducto Municipal no mantiene registros sobre la composición de los núcleos familiares de los abonados, por lo que no tenía conocimiento de la presencia de personas menores de edad en la vivienda al momento de la suspensión.\n\nSobre las alternativas de abastecimiento: Para este caso en específico asumiendo que se refiere al NISE 1180 Existe una paja publica a menos 20 metros de distancia, dados los alegatos de que esta por un basurero cerca y dándonos por enterado de las condiciones se procede a instalar otra paja publica a escaso 15 metros de distancia, mismas que se adjuntan fotografías de las pajas públicas para abastecimiento de agua potable.\n\nTambién es importante mencionar que la municipalidad puede realizar arreglos de pagos ante estas situaciones, el tema es qué solo el dueño registral es el que puede realizar dicho trámite, pero la municipalidad siempre está dispuesta a atender dicha situación, este trámite se realiza en la oficina de cobros de la municipalidad de Upala”.\n\n5.- En los procedimientos seguidos se ha observado las prescripciones legales.\n\n Redacta la Magistrada Garro Vargas; y,\n\n Considerando:\n\n I.- Objeto del recurso. La recurrente alega que la Municipalidad de Upala suspendió de forma arbitraria el servicio de agua potable y retiró el medidor de su vivienda sin notificación previa ni respeto al debido proceso, afectando el acceso a un servicio esencial para su núcleo familiar, integrado por personas menores de edad, con la consecuente vulneración de sus derechos fundamentales. Menciona que, al acudir al acueducto municipal en busca de solución, se le indicó utilizar una paja de agua provisional; sin embargo, esta se ubicada frente a un basurero, en condiciones insalubres y de alto riesgo de contaminación, lo que agrava la situación sanitaria de su familia.\n\nII.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:\n\na) El 10 de junio de 2026, el Acueducto Municipalidad de Upala suspendió el servicio de agua potable y retiró el medidor correspondiente al servicio NISE 1180 (véase informes de las autoridades recurridas). \n\nb) El servicio de agua potable NISE 1180 se encuentra registrado a nombre de la señora Nombre02 y no a nombre de la recurrente o amparados (véase informes de las autoridades recurridas). \n\nc) Al momento de la suspensión, el servicio NISE 1180 registraba una morosidad acumulada de doce meses, correspondiente al período comprendido desde el 15 de julio de 2025, circunstancia que motivó la suspensión del servicio conforme a los artículos 30, 31 y 32 del Reglamento para la Operación y Administración del Acueducto Municipal de Upala. Se instaló una fuente de agua pública a 20 metros de la vivienda de la recurrente (véase informes de las autoridades recurridas).\n\nd) La eventual suspensión del servicio por morosidad era advertida mediante los recibos mensuales emitidos por la Municipalidad, en los cuales se indicaba la fecha de vencimiento del servicio y la posibilidad de suspensión por falta de pago (véase informes de las autoridades recurridas).\n\ne) Una vez conocido el reclamo planteado en este recurso respecto de las condiciones de la fuente pública existente, la Municipalidad instaló una segunda fuente pública de abastecimiento de agua potable, ubicada aproximadamente a 15 metros de la vivienda, la cual permanece operativa, al igual que la fuente previamente existente (véase informes de las autoridades recurridas).\n\nIII.- Hechos no probados. No se estiman demostrados los siguientes hechos de relevancia para esta resolución: \n\na) Que la recurrente cancelara el último recibo vencido y se le denegara el restablecimiento del servicio.\n\nb) Antes de la interposición del presente recurso, la parte recurrente hubiera presentado una gestión formal ante la Municipalidad de Upala a fin de poner en conocimiento las condiciones de la fuente pública de abastecimiento o solicitando su reubicación o mejora.\n\nIV.- Sobre la suspensión del suministro de agua potable por morosidad. Respecto tema enunciado esta Sala se ha pronunciado en reiteradas oportunidades y en sentencia No. 2020-003446 de las 09:30 horas del 21 de febrero del 2020, indicó lo siguiente:\n\n“La posición de este Tribunal Constitucional en cuanto a recursos de amparo en los que se cuestiona la suspensión del suministro de agua potable, ha sido reiterada en el sentido de admitir que las instituciones administradoras de los acueductos públicos pueden suspender el servicio a sus abonados, siempre y cuando los usuarios se encuentren en mora en el pago de las tarifas establecidas, pues los requisitos legales y reglamentarios que debe reunir el posible consumidor no pueden soslayarse si son razonables. A pesar de lo anterior, este Tribunal ha establecido la necesidad de que, si va a proceder a cortar el suministro regular, el A y A o la Asociación Administradora deje a disposición del interesado una fuente pública a corta distancia, donde pueda abastecerse del vital líquido, pues al estar de por medio el derecho a la salud, derivado del artículo 21 de la Constitución Política, el servicio de agua potable debe de estar al alcance de toda persona” (el énfasis no corresponde al original).\n\nPor otra parte, también ha aclarado que la suspensión procede por la falta de pago del último importe mensual. En sentencia No. 2016-012075 de las 09:30 horas del 26 de agosto del 2016, lo indicó así en los siguientes términos:\n\n“Esta Sala también ha indicado, de forma reiterada, que la suspensión, únicamente, procede por la falta de pago oportuno del último importe mensual, por cuanto los meses anteriores que se adeuden deberán ser cobrados, separadamente, por la vía correspondiente. Así, por ejemplo, en sentencia número 2003-06565 de las 15:29 hrs. de 8 de julio de 2003, se indicó: “Este Tribunal se ha referido a otra condición para que la suspensión del servicio de agua sea constitucionalmente legítimo, indicando que no puede privarse al administrado de éste si se ha cancelado el último recibo vencido, toda vez que no procede por esa vía exigir la obligación total o parcial del monto adeudado” (el énfasis no corresponde al original).\n\nAhora, en el presente caso y después de analizar los elementos probatorios aportados y los informes rendidos bajo juramento por las autoridades recurridas, con oportuno apercibimiento de las consecuencias previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional, se tiene por acreditado que tiene por acreditado que el servicio de agua potable respecto del cual se plantea este recurso corresponde al NISE 1180, inscrito a nombre de una tercera persona, y que dicho servicio registraba una morosidad acumulada de doce meses al momento en que fue suspendido el 10 de junio de 2026. Asimismo, se acreditó que la suspensión se efectuó con fundamento en los artículos 30, 31 y 32 del Reglamento para la Operación y Administración del Acueducto Municipal de Upala, normativa que autoriza la suspensión del servicio en caso de mora, y que durante el período de incumplimiento se consignó en los recibos mensuales la advertencia sobre la posibilidad de suspender el suministro por falta de pago.\n\nAsí las cosas, en mérito de las consideraciones expuestas y al igual que en las sentencias de cita se estima que la desconexión del servicio se hizo basado en las potestades que tiene el municipio recurrido, en su momento por morosidad. Si bien existe un derecho fundamental de acceso al agua potable, este no es gratuito, por lo que la autoridad recurrida cuenta con la potestad de suspender el servicio, en caso de que los administrados no cancelen los montos que se adeuden por este concepto. Nótese que la parte recurrente no aduce que se cancelara el último recibo vencido y se le denegara el restablecimiento del servicio. \n\nV.- Sobre la fuente pública de agua. Se tiene acreditado que la fuente pública que se instaló con ocasión de la suspensión del servicio y fue instalada a una distancia de 20 metros de la vivienda. Al respecto, cabe señalar que este Tribunal, en la sentencia No. 2020-017717 de las 09:20 horas de 18 de setiembre de 2020, indicó lo siguiente: \n\n“(…) Bajo similares condiciones a los hechos aquí en estudio, esta Sala mediante resolución 2019021906, lo siguiente (sic):\n\n“Ahora, tomando en consideración el precedente de cita, si bien resulta razonable la suspensión del servicio de agua por la existencia de una deuda, tal hecho debe ir acompañado de la instalación de una fuente pública a no más de 50 metros; lo anterior para resguardar el derecho del tutelado del acceso al agua potable. Al respecto, la Sala, mediante sentencia n.º 2018-004812 de las 9:30 horas de 23 de marzo de 2018, resolvió:\n\n “V. Sin demérito de lo anterior, este Tribunal ha establecido la necesidad de que si va a proceder a suspender el suministro regular, la empresa o ente encargado debe dejar a disposición del interesado una fuente pública a 50 metros, donde pueda abastecerse del vital líquido, pues al estar de por medio el derecho a la Salud, derivado del artículo 21 de la Constitución Política, el servicio de agua potable debe de estar al alcance de toda persona (sentencia 2003-01185 de las nueve horas con cuarenta minutos del catorce de febrero del dos mil tres). En otras palabras, cuando por falta de pago se interrumpe el suministro de agua potable a consumidores domésticos, es necesario que el usuario tenga una fuente de aprovisionamiento gratuita, que es la fuente pública y accesible de manera que con una diligencia razonable de su parte, pueda aprovisionarse para sus actividades mínimas (en ese sentido véase la sentencia N° 2017-16420 de las 09:15 hrs. del 13 de octubre de 2017)” (…)” (el énfasis no corresponde al original).\n\nPosteriormente, esta Sala mediante sentencia No. 2022-004589 de las 09:15 horas del 25 de febrero de 2022, en lo conducente dispuso:\n\n“VII.- Ahora bien, en lo atinente a la fuente pública, el 21 de enero de 2022 se instaló una fuente pública a la par de la vivienda donde reside la amparada. Posteriormente, el 28 de enero de 2022, funcionarios de la Municipalidad de Oreamuno efectuaron una inspección, y determinaron la existencia de una toma ilegal, por lo que se retiró la conexión de agua y se reubicó la fuente pública a 76 metros de distancia. Contrario a lo afirmado por la recurrente, en un inicio se instaló la fuente pública a la par del inmueble donde reside, y luego de reubicó a 76 metros de distancia. Aunque no hay elementos de juicio que permitan concluir que los hechos ocurrieron como la amparada adujo, lo cierto es que la fuente pública fue reubicada en claro incumplimiento con la regla jurisprudencial de este Tribunal en la materia: la fuente pública debe ubicarse a no más de 50 metros de distancia. Así las cosas, en cuanto a este punto en particular, también debe intervenir esta Sala Constitucional” (el énfasis no corresponde al original).\n\nLuego, mediante resolución No. 2022-005659 de las 09:20 horas del 11 de marzo de 2022, este Tribunal resolvió lo siguiente: \n\n“[S]e verifica que el servicio de agua potable de la recurrente fue suspendido a las 9:54 horas del 14 de febrero del 2022, debido a la falta de pago de la factura del mes de enero de 2022. Que desde el 15 de enero de 2022 los recurridos procedieron, como corresponde, a instalar una fuente pública en el NIS CED01 una distancia de 50 metros al Sur y 15 metros al Oeste de la propiedad de la recurrente. En este sentido, el Instituto recurrido procedió conforme la normativa cuando suspendió el servicio por falta de pago del mes anterior; sin embargo, la fuente pública fue instalada a más de 50 metros de la propiedad, con lo que se lesionan sus derechos fundamentales. En virtud de lo anterior, corresponde la estimatoria de este recurso de amparo” (el énfasis no corresponde al original). \n\nTales consideraciones son plenamente aplicables al caso en estudio, dado que este Tribunal no encuentra razones para variar el criterio vertido en las sentencias parcialmente transcritas, ni motivos que conduzcan a valorar de manera distinta la situación planteada. En el sub examine, de los informes rendidos bajo juramento se tiene por acreditado que, una vez que la autoridad recurrida conoció los alegatos de la parte amparada en torno a las condiciones de la fuente pública inicialmente disponible, procedió a instalar una segunda fuente pública de abastecimiento, ubicada aproximadamente a 15 metros de la vivienda.\n\nAsimismo, si bien la recurrente afirma que la fuente pública inicialmente disponible se encontraba frente a un basurero, en condiciones que estimaba insalubres y de riesgo para la salud, lo cierto es que no consta en el expediente que hubiera planteado una gestión formal ante la Municipalidad de Upala solicitando la reubicación de dicha fuente o denunciando las condiciones en que se encontraba, a fin de que la Administración pudiera valorar la situación y adoptar las medidas que en derecho correspondieran. Si bien la promovente señala que realizó una llamada telefónica a la municipalidad, de sus propias manifestaciones se desprende que esta comunicación se limitó a un contacto telefónico en el que no obtuvo la atención esperada; sin embargo, ello no equivale a la formulación de una gestión administrativa formal mediante la cual se pusiera en conocimiento de la autoridad competente la situación específica que ahora reclama. Por el contrario, fue a partir de la notificación del presente recurso de amparo que la Administración tuvo conocimiento de tales alegatos y, de manera inmediata, procedió a instalar una segunda fuente pública en una mejor ubicación, manteniendo ambas operativas para el abastecimiento de agua potable.\n\nEn esas condiciones, no se advierte una actitud omisiva o renuente por parte de la autoridad recurrida frente a una situación que le hubiera sido previamente sometida a su conocimiento, sino que, una vez informada de las circunstancias particulares del caso, adoptó las medidas correctivas correspondientes. En consecuencia, no se acredita respecto a la obligación de garantizar una fuente pública accesible durante la suspensión del servicio, ni una lesión al derecho fundamental de acceso al agua por este motivo, razón por la cual este extremo del recurso también debe ser desestimado.\n\nVI.- VOTO SALVADO PARCIAL DEL MAGISTRADO RUEDA LEAL. En el sub lite, uno de los reclamos de la recurrente obedece a que la Municipalidad de Upala suspendió de forma arbitraria el servicio de agua potable y retiró el medidor de su vivienda sin notificación previa ni respeto al debido proceso, situación que impide el acceso a ese servicio esencial a su familia, incluyendo personas menores de edad.\n\nAl respecto, adviértase que, según el artículo 50 de la Carta Magna, “toda persona tiene el derecho humano, básico e irrenunciable de acceso al agua potable, como bien esencial para la vida. El agua es un bien de la nación, indispensable para proteger tal derecho humano.” También impone que su uso, protección, sostenibilidad, conservación y explotación se regirá por lo que establezca la ley que se creará para estos efectos, así como que tendrá prioridad el abastecimiento de agua potable para consumo de las personas y las poblaciones.\n\nAdicionalmente, esta Sala ha sostenido reiteradamente que la desconexión del suministro por morosidad únicamente procede por la falta del pago oportuno del último importe mensual vencido, de modo tal que los montos acumulados correspondientes a periodos anteriores constituyen deudas exigibles por las vías legales ordinarias de cobro, pero no autorizan, por sí solos, a privar a la persona del servicio esencial del suministro de agua potable.\n\nPrecisamente, en el hecho probado c) de esta sentencia se indica que: “Al momento de la suspensión, el servicio NISE 1180 registraba una morosidad acumulada de doce meses, correspondiente al período comprendido desde el 15 de julio de 2025, circunstancia que motivó la suspensión del servicio conforme a los artículos 30, 31 y 32 del Reglamento para la Operación y Administración del Acueducto Municipal de Upala”. Así las cosas, la autoridad recurrida no acredita con precisión que la suspensión realizada el 10 de junio de 2026 obedeciera estrictamente al impago del último recibo mensual correspondiente al servicio de agua potable. Tampoco demuestra que la reconexión del servicio dependa exclusivamente de la cancelación de ese último importe vencido. Antes bien, de la secuencia fáctica se infiere razonablemente que el restablecimiento se encuentra condicionado al pago de la deuda histórica acumulada, lo cual resulta incompatible con la doctrina constitucional vigente. Subrayo que la Administración no puede utilizar la suspensión del agua potable como mecanismo indirecto de presión para el cobro de obligaciones pretéritas o de otros tributos ajenos al último recibo exigible (en similar sentido véanse las sentencias nros. 2026015401 de las 9:20 horas del 30 de abril de 2026 y 2025000986 de las 9;45 horas del 14 de enero de 2025).\n\nEn consecuencia, salvo el voto, declaro con lugar este extremo del recurso y ordeno que se le permita a la recurrente el pago del último importe mensual por concepto del servicio de agua potable sin condicionamiento del pago de todos los recibos atrasados.\n\nVII.- Documentación aportada al expediente. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en Sesión No. 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial No. 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión No. 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\nSe declara sin lugar el recurso. El magistrado Rueda Leal salva el voto y declara parcialmente con lugar el recurso, solo en cuanto al cobro de la deuda histórica acumulada por concepto de agua potable. San José, at nine thirty on 6 August 2026.\n\nAmparo proceeding filed by Nombre06, identity card CED02, in favor of Nombre03 and Nombre04, identity card CED03, Nombre07, Nombre01, against the MUNICIPALITY OF UPALA.\n\nBackground:\n\n1.- In a submission entered into the digital case file on 10 June 2026, the applicant filed this proceeding and stated, as recorded in the order admitting it for processing, the following:\n\n“[T]hat she receives drinking water service at a home supplied by the Upala municipal water system. She alleges that on 10 June 2026, officials from the Municipality of Upala arrived at her home and, unexpectedly and without prior notice or formal warning, proceeded to suspend the drinking water service and remove the corresponding meter. She states that this suspension is arbitrary and places her family unit in a situation of extreme vulnerability, since minors aged 10 months and 12 years live in the home and depend on access to water for hydration, food, and basic hygiene. She reports that the conduct of the respondent authority took place without giving her the opportunity to exercise due process, also violating the best interests of minors and their fundamental rights. She adds that the lack of access to drinking water has meant that the minors have remained without access to this essential service for more than twenty-four hours, directly affecting their health. She states that, when she went to the municipal water system seeking a solution, she was told to use a provisional water tap located in front of a garbage dump, in unsanitary conditions and at high risk of contamination, aggravating her family’s health situation. She reports that, when she tried to address the situation by contacting the Municipality of Upala by telephone, she did not receive proper assistance; her call was transferred among different departments without a solution, and a staff member also denied her relevant information and ended the call. For these reasons, she requests the intervention of this Chamber.”\n\n2.- By resolution at 10:06 on 12 June 2026, the proceeding was admitted and the mayor and head of the Water Systems Department, both of the Municipality of Upala, were asked to report on the facts alleged by the applicant.\n\n3.- Aura Yamileth López Obregón, in her capacity as mayor of Upala, reports under oath as follows:\n\n“FIRST:\n\nIt is true that, by resolution issued on 12 June 2026, this Municipality was notified of this amparo proceeding, which challenges the suspension of the drinking water service carried out on 10 June 2026.\n\nSECOND:\n\nThe operation, administration, and technical management of the municipal drinking water service fall under the Upala Municipal Water System, pursuant to the provisions of the Regulations for the Operation and Administration of the Upala Municipal Water System, published in La Gaceta No. 156 on 11 August 2004.\n\nTHIRD:\n\nBy official letter MU-ALM-OFIC-1162-2026 dated 19 June 2026, this Mayor’s Office asked the Administrator of the Municipal Water System to provide the documentation related to the facts at issue in this proceeding.\n\nFOURTH:\n\nAccording to the report sworn to by Mr. Jorge Mike Zamora López, Administrator of the Municipal Water System (Official Letter MU-ACUE-OFICIO-0079-2026 dated 23 June 2026), the applicants have no drinking water service registered in their names. The affected service is NISE 1180, registered in the name of Ms. Nombre02, identity card CED04, located at Dirección02.\n\nFIFTH:\n\nService NISE 1180 has accumulated arrears of TWELVE (12) MONTHS, as shown in the certified Account Statement dated 22 June 2026 and in the Tax Status Certificate of the same date. Ms. Nombre02 has been behind on water service payments since 15 July 2025.\n\nSIXTH:\n\nThe Administrator confirmed that, pursuant to Articles 30, 31, and 32 of the Municipal Water System Regulations, the service was suspended on 10 June 2026 because it was in arrears and met the regulatory requirements for suspension.\n\nSEVENTH:\n\nThe subscriber was warned of the possible suspension through monthly bills issued during the twelve months of arrears. These expressly state that payment for the service is due on the 15th of each month and that service may be suspended in case of arrears. Under the Regulations (Articles 30 to 32), notice through monthly bills during this period constitutes sufficient procedure.\n\nEIGHTH:\n\nThe Administrator also reported that an information campaign had been conducted to notify users of the municipal water system about payment due dates and the consequences of nonpayment.\n\nNINTH:\n\nThe Administrator reported that the Municipal Water System Administration does not keep records of subscribers’ family composition and therefore was unaware that minors were present at the property.\n\nTENTH:\n\nOnce the Administration learned of the circumstances alleged in the proceeding, it immediately took corrective measures. The Administrator reported that, given the allegations about the conditions of the existing public water tap, ‘another public water tap is being installed just 15 meters away.’ The Administration acknowledged the situation and installed a second public water tap in a better location. Both public water taps are operational for the supply of drinking water, as shown by the attached photographs.\n\nELEVENTH:\n\nThe Administrator reported that ‘the Municipality can make payment arrangements in these situations’ and that ‘the Municipality is always willing to address this situation; this process is handled at the collections office of the Municipality of Upala.’ The Administration is available to consider payment arrangements through monthly installments that would allow the tax obligation to be brought up to date and the suspension to be lifted immediately.\n\nTWELFTH:\n\nThe Municipality of Upala reiterates its commitment to the human right to water. The Municipal Water System’s actions complied with the regulations in force, the established procedures, and the applicable notice requirements. Once the particular circumstances became known, the Administration took immediate corrective measures (a second public water tap) and remains available to resolve the situation through payment arrangements.\n\nTHEREFORE:\n\nI respectfully request that this amparo proceeding be dismissed, as the Municipality of Upala acted in accordance with the legal order in force and immediately adopted measures to guarantee the persons involved access to drinking water.\n\nAttached documents: Account Statement for NISE 1180 (22/06/2026), Tax Status Certificate (22/06/2026), Municipal Water System Regulations, latest bill with suspension notices, mass information campaign, photographs of public water taps, Official Letter MU-ALMOFIC-1162-2026, Administrator’s Report MU-ACUE-OFICIO-0079-2026.”\n\n4.- Jorge Mike Zomora López, in his capacity as administrator of the Upala Municipal Water System, reports under oath as follows:\n\n“It is true that, on 10 June 2026, drinking water services that were in arrears and met the conditions for suspension were suspended. However, according to our records, Ms. Nombre06, Nombre05, Nombre07, and Nombre01 have no drinking water service provided by the Municipal Water System registered in their names.\n\nNevertheless, according to the description in the filing, it is understood that the drinking water service referred to may be registered in the name of Ms. Nombre02, identity card No. CED04, corresponding to water service NISE 1180, which has twelve (12) months of arrears.\n\nRegarding the suspension of the service: assuming it belongs to Nombre02, identity card 05 0205 0157, Water NISE 1 180, which has been overdue for twelve months, it is true that it was suspended on 10 June 2026.\n\nThe subscriber is warned of suspension of the water service through monthly bills issued by the Municipality, which expressly state that payment for the service is due on the 15th of each month and that it may be suspended in case of arrears. The subscriber is also notified by text message when the water bill is due. Attached is an image of the latest paid bill containing the suspension warning, as well as a mass message sent to 15 433 users.\n\nThe Regulations for the Operation and Administration of the Upala Municipal Water System, published in La Gaceta No. 156, Wednesday, 11 August 2004. Chapter IV, Suspension of Drinking Water Service, Administrative and Judicial Collection, Articles 301, 31, and 32. These refer to suspension of the service, and are also attached to this report.\n\nRegarding the presence of minors: The Municipal Water System Administration does not keep records of subscribers’ family composition, so it was unaware that minors were present in the home at the time of suspension.\n\nRegarding alternative water supplies: In this specific case, assuming the reference is to NISE 1180, there is a public water tap less than 20 meters away. Given the allegations that it is near a garbage dump, and having been informed of the conditions, another public water tap is being installed just 15 meters away. Photographs of the public water taps for the supply of drinking water are attached.\n\nIt is also important to mention that the Municipality can make payment arrangements in these situations. Only the registered owner can make such arrangements, but the Municipality is always willing to address the situation. This process is handled at the collections office of the Municipality of Upala.”\n\n5.- The legal requirements have been observed in the proceedings.\n\nDrafted by Justice Garro Vargas; and,\n\nReasons:\n\nI.- Subject of the proceeding. The applicant alleges that the Municipality of Upala arbitrarily suspended the drinking water service and removed the meter from her home without prior notice or respect for due process, affecting her family unit’s access to an essential service. The family unit includes minors, and she alleges that their fundamental rights were consequently violated. She states that, when she went to the municipal water system seeking a solution, she was told to use a provisional water tap; however, it was located in front of a garbage dump, in unsanitary conditions and at high risk of contamination, aggravating her family’s health situation.\n\nII.- Facts found. The following facts, relevant to deciding this matter, are deemed duly proven, either because they were established or because the respondent failed to address them, as required by the initial order:\n\na) On 10 June 2026, the Upala Municipal Water System suspended the drinking water service and removed the meter corresponding to service NISE 1180 (see reports from the respondent authorities).\n\nb) Drinking water service NISE 1180 is registered in the name of Ms. Nombre02 and not in the name of the applicant or the beneficiaries (see reports from the respondent authorities).\n\nc) At the time of suspension, service NISE 1180 had accumulated twelve months of arrears, for the period beginning on 15 July 2025. This circumstance prompted suspension of the service pursuant to Articles 30, 31, and 32 of the Regulations for the Operation and Administration of the Upala Municipal Water System. A public water source was installed 20 meters from the applicant’s home (see reports from the respondent authorities).\n\nd) The possible suspension of service for arrears was indicated in the monthly bills issued by the Municipality, which stated the service’s due date and the possibility of suspension for nonpayment (see reports from the respondent authorities).\n\ne) Once it learned of the complaint in this proceeding concerning the conditions of the existing public water source, the Municipality installed a second public drinking water source approximately 15 meters from the home. It remains operational, as does the previously existing source (see reports from the respondent authorities).\n\nIII.- Facts not proven. The following facts relevant to this resolution are not deemed proven:\n\na) That the applicant paid the latest bill that had fallen due and was denied restoration of the service.\n\nb) That, before filing this proceeding, the applicant had submitted a formal request to the Municipality of Upala to inform it of the conditions of the public water source or to request that it be relocated or improved.\n\nIV.- On suspension of drinking water supply for arrears. This Chamber has ruled on the stated issue on numerous occasions. In judgment No. 2020-003446, at 09:30 on 21 February 2020, it stated the following:\n\n“This Constitutional Court’s position on amparo proceedings challenging suspension of drinking water supply has consistently been that public water system administrators may suspend service to their subscribers, provided that the users are in arrears on the established rates, since reasonable legal and regulatory requirements that a potential consumer must meet cannot be disregarded. Despite the foregoing, this Court has established that, if regular supply is to be cut off, AyA or the administering association must make a public source available to the person concerned nearby, where they can obtain this vital liquid. Since the right to health, derived from Article 21 of the Political Constitution, is at stake, drinking water service must be accessible to everyone” (emphasis not in the original).\n\nIt has also clarified that suspension is permitted for failure to pay the latest monthly amount. In judgment No. 2016-012075, at 09:30 on 26 August 2016, it stated as follows:\n\n“This Chamber has also repeatedly held that suspension is permitted only for failure to pay the latest monthly amount on time, since earlier unpaid months must be collected separately through the appropriate procedure. For example, judgment No. 2003-06565, at 15:29 on 8 July 2003, stated: ‘This Court has referred to another condition for suspension of water service to be constitutionally legitimate, holding that an administrator may not be deprived of that service if the latest bill that fell due has been paid, since that route may not be used to demand payment of all or part of the amount owed’” (emphasis not in the original).\n\nIn the present case, after analyzing the evidence submitted and the reports sworn to by the respondent authorities, following due warning of the consequences provided in Article 44 of the Constitutional Jurisdiction Act, it is established that the drinking water service at issue is NISE 1180, registered in the name of a third party, and that it had accumulated twelve months of arrears when it was suspended on 10 June 2026. It is also established that the suspension was carried out pursuant to Articles 30, 31, and 32 of the Regulations for the Operation and Administration of the Upala Municipal Water System. Those regulations authorize suspension in case of arrears, and the monthly bills issued during the period of nonpayment warned that supply could be suspended for failure to pay.\n\nAccordingly, in light of the foregoing and as in the cited judgments, the disconnection is deemed to have been based on the powers held by the respondent Municipality, owing to arrears at the time. Although there is a fundamental right of access to drinking water, that service is not free; therefore, the respondent authority has the power to suspend it if the persons subject to its administration fail to pay the amounts owed for that service. Note that the applicant does not allege that she paid the latest bill that fell due and was denied restoration of the service.\n\nV.- On the public water source. It is established that the public source installed in connection with the suspension of service was located 20 meters from the home. In this regard, this Court stated the following in judgment No. 2020-017717, at 09:20 on 18 September 2020:\n\n“(…) Under circumstances similar to those of the facts under review here, this Chamber, by resolution 2019021906, stated the following (sic):\n\n“Now, taking into consideration the cited precedent, although suspending water service because of a debt is reasonable, that measure must be accompanied by the installation of a public source no more than 50 meters away, in order to safeguard the beneficiary’s right of access to drinking water. In this regard, the Chamber ruled in judgment No. 2018-004812, at 9:30 on 23 March 2018:\n\n“V. Without prejudice to the foregoing, this Court has established that, if regular supply is to be suspended, the company or entity in charge must make a public source available to the person concerned within 50 meters, where they can obtain this vital liquid. Since the right to health, derived from Article 21 of the Political Constitution, is at stake, drinking water service must be accessible to everyone (judgment 2003-01185, at nine forty on 14 February 2003). In other words, when drinking water supply to domestic consumers is interrupted for nonpayment, the user must have a free source of supply—namely, a public source—accessible in such a way that, with reasonable effort, the user can obtain water for their minimum needs (see judgment No. 2017-16420, at 09:15 on 13 October 2017)” (…)” (emphasis not in the original).\n\nSubsequently, this Chamber held in judgment No. 2022-004589, at 09:15 on 25 February 2022, in relevant part:\n\n“VII.- As for the public source, a public source was installed next to the home where the beneficiary resides on 21 January 2022. Later, on 28 January 2022, officials from the Municipality of Oreamuno carried out an inspection and found an illegal connection, so the water connection was removed and the public source was relocated to a distance of 76 meters. Contrary to the applicant’s assertion, the public source was initially installed next to the property where she resides and was then relocated to a distance of 76 meters. Although there is no evidence from which to conclude that the events occurred as the beneficiary alleged, the public source was in fact relocated in clear breach of this Court’s case law in this area: the public source must be located no more than 50 meters away. Accordingly, this Chamber must also intervene on this particular point” (emphasis not in the original).\n\nThen, by resolution No. 2022-005659, at 09:20 on 11 March 2022, this Court ruled as follows:\n\n“[I]t is verified that the applicant’s drinking water service was suspended at 9:54 on 14 February 2022 because the January 2022 bill had not been paid. On 15 January 2022, the respondents duly installed a public source at NIS CED01, a distance of 50 meters south and 15 meters west of the applicant’s property. In this respect, the respondent Institute acted in accordance with the regulations when it suspended service for failure to pay the previous month’s bill. However, the public source was installed more than 50 meters from the property, thereby violating the applicant’s fundamental rights. In view of the foregoing, this amparo proceeding must be granted” (emphasis not in the original).\n\nThese considerations apply fully to the case under review, as this Court finds no reason to depart from the position stated in the judgments partially transcribed above, or grounds for assessing the situation differently. In this case, the sworn reports establish that, once the respondent authority learned of the beneficiary’s allegations about the conditions of the initially available public source, it installed a second public drinking water source approximately 15 meters from the home.\n\nAlthough the applicant states that the initially available public source was in front of a garbage dump, in conditions she considered unsanitary and hazardous to health, the case file contains no record that she submitted a formal request to the Municipality of Upala seeking relocation of the source or reporting its conditions, so that the Administration could assess the situation and adopt the measures called for by law. Although the applicant states that she called the Municipality, her own statements show that this was limited to a telephone contact during which she did not receive the assistance she expected. That does not amount to filing a formal administrative request to inform the competent authority of the specific situation she now complains of. Rather, the Administration learned of these allegations through notification of this amparo proceeding and immediately installed a second public source in a better location, keeping both operational for the supply of drinking water.\n\nIn these circumstances, there is no evidence of an omission or unwillingness by the respondent authority in response to a situation previously brought to its attention. Once informed of the particular circumstances of the case, it adopted the corresponding corrective measures. Consequently, no breach of the obligation to guarantee an accessible public source during suspension of service, or violation of the fundamental right of access to water on that basis, has been established. This part of the proceeding must therefore also be dismissed.\n\nVI.- PARTIAL DISSENTING VOTE OF JUSTICE RUEDA LEAL. In this case, one of the applicant’s claims is that the Municipality of Upala arbitrarily suspended the drinking water service and removed the meter from her home without prior notice or respect for due process, thereby preventing her family, including minors, from accessing this essential service.\n\nIn this regard, note that Article 50 of the Constitution provides that “every person has the basic, non-waivable human right of access to drinking water, as an essential good for life. Water is a good of the Nation, indispensable to protecting that human right.” It also provides that water’s use, protection, sustainability, conservation, and exploitation shall be governed by the law to be enacted for those purposes, and that the supply of drinking water for consumption by individuals and communities shall have priority.\n\nAdditionally, this Chamber has repeatedly held that disconnection of supply for arrears is permitted only for failure to pay the latest monthly amount due on time. Accumulated amounts from earlier periods are debts enforceable through ordinary legal collection procedures, but do not, by themselves, authorize depriving a person of the essential drinking water service.\n\nSpecifically, proven fact c) of this judgment states: “At the time of suspension, service NISE 1180 had accumulated twelve months of arrears, for the period beginning on 15 July 2025. This circumstance prompted suspension of the service pursuant to Articles 30, 31, and 32 of the Regulations for the Operation and Administration of the Upala Municipal Water System.” Accordingly, the respondent authority does not establish precisely that the suspension carried out on 10 June 2026 was based strictly on nonpayment of the latest monthly bill for drinking water service. Nor does it show that restoration of the service depends exclusively on payment of that latest amount due. Rather, the sequence of events reasonably suggests that restoration is conditioned on payment of the accumulated historical debt, which is incompatible with current constitutional doctrine. I emphasize that the Administration may not use suspension of drinking water as an indirect means of pressure to collect past obligations or other taxes unrelated to the latest bill due (see, similarly, judgments Nos. 2026015401, at 9:20 on 30 April 2026, and 2025000986, at 9;45 on 14 January 2025).\n\nConsequently, I dissent and would grant this part of the proceeding, ordering that the applicant be allowed to pay the latest monthly amount for drinking water service without conditioning it on payment of all overdue bills.\n\nVII.- Documents submitted to the case file. The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, these must be retrieved from the office within a maximum period of thirty business days from notification of this judgment. Otherwise, any material not retrieved within this period will be destroyed, pursuant to the “Regulations on the Electronic Case File before the Judiciary,” approved by the Full Court at Session No. 27-11, on 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 on 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at Session No. 43-12, held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe proceeding is dismissed. Justice Rueda Leal dissents and would grant the proceeding in part, solely as to collection of the accumulated historical debt for drinking water service.
