  "body_es_text": "Revisión del Documento\n\n\n\nEXPEDIENTE N° 26-025571-0007-CO \n\nPROCESO: RECURSO DE AMPARO\n\nRESOLUCIÓN Nº 2026030093\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del seis de agosto de dos mil veintiseis .\n\n Recurso de amparo interpuesto por Nombre01, cédula de identidad CED01, a favor de Nombre02, cédula de identidad CED02; contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADO.\n\nResultando:\n\n 1.- Por escrito recibido en la secretaría de esta Sala el 16 de julio de 2026, la parte recurrente interpone recurso de amparo contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, y manifiesta que su abuelo, junto con su núcleo familiar, habitó de forma continua e ininterrumpida desde 1997 hasta 2020 dos casas de habitación en la comunidad de Hatillo, San José. Agrega que, en 2020, con ocasión de la emergencia sanitaria por COVID-19, debieron desocupar temporalmente ambas viviendas, por lo cual gestionó el tutelado ante el recurrido la suspensión de ambos servicios bajo el entendido, de que se contaba con un plazo de 10 años para solicitar la reconexión, sin que en ningún momento se les informara que la suspensión implicaría la pérdida definitiva del derecho al servicio de agua potable. Actualmente, el amparado, quien es persona adulta mayor, desea regresar a habitar su propiedad familiar, por lo que el 20 de marzo de 2026 se apersonó ante el instituto accionado para solicitar la reconexión del servicio de ambos inmuebles. No obstante, mediante resolución número SIGDD-202600006812-1-2NS del 10 de abril de 2026, el recurrido le negó la disponibilidad de agua potable, fundamentando que el sistema ME-A-17 La Valencia se encuentra en condición deficitaria con un superávit de 1.4/s según el informe UEN-OS-GAM-2025-00592 del 04 de diciembre de 2025. Pese a que esta resolución se basó en una solicitud de servicio para un proyecto nuevo y no en una reconexión del servicio como se solicitó en los formularios entregados. Por lo anterior, interpuso recurso de revocatoria, el cual fue rechazado por resolución número UEN-SCMED-GAM-2026-00957 del 25 de mayo de 2026, ratificando la negativa de disponibilidad de agua potable. Aduce que, la negativa del servicio afecta de forma directa y desproporcionada a una persona adulta mayor de 90 años, impidiéndole retornar a su vivienda familiar por carecer del recurso hídrico en flagrante contradicción con la protección reforzada que el ordenamiento jurídico costarricense le otorga. Por lo expuesto, considera lesionados los derechos fundamentales del tutelado. Solicita que se declare con lugar el recurso y se proceda con la reconexión del servicio de agua potable de su interés. \n\n 2.- El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada. \n\n Redacta el Magistrado Castillo Víquez; y, \n\nConsiderando:\n\ni.- OBJETO DEL AMPARO. La parte recurrente señala que se encuentra disconforme con negativa de reconexión del servicio de agua potable, solicitado. Solicita la intervención de esta Sala.\n\nII.- SOBRE EL CASO CONCRETO. En reiteradas ocasiones, esta Sala ha sostenido que, si bien se reconoce el derecho fundamental al agua y su acceso en igualdad de condiciones, por cuanto se trata de un servicio esencial para la vida y la salud; también, ha indicado que este derecho no implica un acceso irrestricto al agua, toda vez que, la Administración puede válidamente, establecer condiciones y requisitos generales para acceder a este servicio. Asimismo, resulta válido que las entidades -públicas o privadas- que administren el servicio, puedan rechazar las solicitudes de agua, o bien, de la carta de disponibilidad de agua, cuando el interesado no cumple los requisitos o cuando existen razones técnicas o legales que los justifiquen. Así, por ejemplo, en sentencia número 2016-006027 de las 09:05 horas del 6 de mayo de 2016, esta Sala consideró lo siguiente:\n\n“Este Tribunal Constitucional en la sentencia 2014-9134 de las 14:05 horas del 19 de junio de 2014, que abordó una cuestión muy similar a la expuesta en el presente recurso, dispuso: '(...) Esta Sala ha indicado en reiteradas sentencias sobre el tema que el suministro de agua potable es considerado dentro del ordenamiento jurídico costarricense como un servicio público, y que como tal, todo prestador de servicios públicos -sea sujeto público o sujeto privado está obligado a prestar el servicio de forma continua, eficiente, en condiciones de igualdad y debiendo adaptarse a los cambios tecnológicos (véase al respecto la sentencia 2001-09676 de las once horas veinticinco minutos del veintiséis de setiembre del dos mil uno y la sentencia 2004-08161 de las diez horas con cincuenta y tres minutos del veintitrés de julio del dos mil cuatro).\n\nResulta claro entonces concluir que el Instituto Costarricense de Acueductos y Alcantarillados, al ser uno de los entes estatales encargados de la prestación del servicio público de agua potable, está obligado también a prestar este servicio de forma continua, adaptable, eficiente y por igual a todos los habitantes. Ahora bien, también la jurisprudencia de este Tribunal Constitucional ha indicado que, frente a la imposibilidad jurídica (que es la falta de cumplimiento de requisitos establecidos en la reglamentación respectiva) o frente a la imposibilidad formal (que es la falta de una Red de Distribución de Aguas), es razonable no atender las solicitudes de servicio o solicitar que el interesado asuma los costos de instalación cuando no exista red de distribución de agua potable y se necesite la construcción de infraestructura. Así, en estos casos se ha tenido claro que no es que se trate de una negativa al acceso al servicio de agua potable, sino de la imposibilidad para brindarlo o de la necesaria participación del interesado en el levantamiento de una imposibilidad técnica, cual es, la falta de infraestructura. En otras palabras, siempre que la falta de dotación del servicio de agua potable no sea una actuación antojadiza, arbitraria o sin fundamento, sino que esté justificada en la imposibilidad jurídica o material no estamos frente a la violación de derechos fundamentales. En el caso concreto, de la prueba aportada y del informe rendido bajo juramento, se corrobora que el AyA no ha rechazado arbitrariamente la solicitud planteada por la recurrente, sino por la falta del cumplimiento de la totalidad de los requisitos técnico-legales que existe el Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados para aprobar nuevos servicios”. (Véanse en similar sentido las sentencias número 2019-005700 de las 09:45 horas del 29 de marzo de 2019; número 2021- 008690 de las 09:15 horas del 30 de abril de 2021; número 2022-030504 de las 09:15 horas del 23 de diciembre de 2022 y la número 2023-003878 de las 09:20 horas del 17 de febrero de 2023).\n\nTales argumentos resultan plenamente aplicables al caso concreto, en el cual, a la parte recurrente, se le denegó la disponibilidad del servicio de agua, por cuanto, según el estudio técnico emitido, no se cuenta con la suficiente capacidad hídrica en su comunidad. (Véase en igual sentido la sentencia número 2026013422 de las 09:20 horas del 21 de abril de 2026). De esta forma, la inconformidad de la parte petente con la decisión del instituto recurrido para no entregar la carta de disponibilidad de agua de su interés no son cuestiones que deban discutirse en esta Jurisdicción, por tratarse de un conflicto de legalidad ordinaria ajeno al ámbito de competencia de esta Sala. Tampoco, puede este Tribunal fungir como mediador ante una determinada persona física o jurídica -ya sea esta última de derecho público o privado-, para interceder por una tercera persona a fin de que se le conceda lo que pretende. Por ello, deberá la parte recurrente, a bien lo tiene, plantear sus inconformidades o reclamos ante las autoridades recurridas o en la vía jurisdiccional competente, vías en las cuales podrá, en forma amplia, discutir el fondo del asunto y hacer valer sus pretensiones. En mérito de lo expuesto, el recurso es inadmisible.\n\n III.- VOTO SALVADO DE LOS MAGISTRADOS CRUZ CASTRO Y RUEDA LEAL, CON REDACCIÓN DEL PRIMERO. Disentimos del criterio de mayoría. En el presente caso, se valida la negativa de la parte recurrida de brindar un servicio esencial, con base en consideraciones técnicas relativas a la insuficiencia de la infraestructura o capacidad hídrica; sin embargo, se omite ponderar adecuadamente que el acceso al agua potable constituye un derecho fundamental, indispensable para la vida, la salud y la dignidad humana.\n\n El artículo 21 de la Constitución Política protege la vida humana, y este Tribunal ha reconocido que el acceso al agua para consumo humano es un presupuesto material de ese derecho. Asimismo, el artículo 50 constitucional impone al Estado el deber de garantizar el bienestar de todos los habitantes, lo cual incluye necesariamente el acceso efectivo, suficiente y continuo al agua potable. En el ámbito internacional, instrumentos como el Pacto Internacional de Derechos Económicos, Sociales y Culturales –interpretado por el Comité DESC en su Observación General No. 15– reconocen el derecho humano al agua, obligando a los Estados a adoptar medidas positivas para su plena realización. Hay una obligación reforzada impuesta al Estado en un estado social y democrático de derecho, por esta razón el suministro de agua, es una obligación prioritaria de los poderes públicos.\n\n Desde esta perspectiva, la invocación de limitaciones técnicas no puede erigirse en una justificación absoluta para desatender una necesidad básica de subsistencia. Quien administre el suministro de agua no puede limitarse a constatar la insuficiencia del sistema; tiene el deber jurídico de planificar, prever y ejecutar las acciones necesarias para garantizar progresivamente el acceso al servicio al agua, especialmente cuando se trata de consumo humano.\n\n El enfoque mayoritario normaliza una omisión estructural: acepta que la falta de infraestructura exonera al Estado de su obligación, cuando precisamente esa carencia evidencia un incumplimiento de su deber de previsión. No se trata de obligar a lo imposible, sino de exigir que se adopten medidas razonables, alternativas o progresivas para no dejar en desprotección a las personas.\n\n El agua no es un servicio cualquiera, es un derecho humano esencial, por ello, la autoridad accionada no puede desentenderse de su deber de garantizarlo, escudándose en limitaciones técnicas sin ofrecer soluciones efectivas.\n\nPor estas razones, estimamos que el recurso debió admitirse, al menos para ordenar la adopción de medidas concretas y progresivas que garantice, en un plazo razonable, el acceso efectivo al agua potable de la parte amparada. El agua es un bien y un derecho fundamental cuya vigencia debe asegurarse efectivamente, es un deber ineludible.\n\n \n\n IV.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N° 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N° 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI\n\nPor tanto:\n\n Se rechaza de plano el recurso. San José, at 9:30 a.m. on 6 August 2026.\n\nAmparo application filed by Nombre01, identity card CED01, on behalf of Nombre02, identity card CED02, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADO (Costa Rican Institute of Aqueducts and Sewerage).\n\nBackground:\n\n1.- In a brief received by the clerk’s office of this Chamber on 16 July 2026, the amparo applicant files an amparo application against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS and states that their grandfather, together with his family, continuously and without interruption lived in two homes in the community of Hatillo, San José, from 1997 to 2020. The applicant adds that, in 2020, due to the COVID-19 public health emergency, they had to vacate both homes temporarily. The person whose rights are protected therefore arranged with the respondent for both services to be suspended, on the understanding that there was a 10-year period in which to request reconnection, and that they were never informed that suspension would entail permanent loss of the right to water service. The person protected by the amparo, who is an older adult, now wishes to return to the family home. Accordingly, on 20 March 2026, they appeared before the respondent institute to request reconnection of service to both properties. However, by resolution No. SIGDD-202600006812-1-2NS dated 10 April 2026, the respondent denied water availability, stating that the ME-A-17 La Valencia system is in a deficit condition, with a surplus of 1.4/s, according to report UEN-OS-GAM-2025-00592 dated 04 December 2025. This resolution was based on a service request for a new project, even though the forms submitted requested reconnection of service. For these reasons, the applicant filed a motion for reconsideration, which was rejected by resolution No. UEN-SCMED-GAM-2026-00957 dated 25 May 2026, upholding the denial of water availability. The applicant alleges that the denial of service directly and disproportionately affects an older adult aged 90, preventing them from returning to the family home because they lack water, in flagrant contradiction of the enhanced protection granted to them by Costa Rican law. For the foregoing reasons, the applicant considers the protected person’s fundamental rights to have been violated. The applicant asks that the amparo application be granted and that the requested water service be reconnected.\n\n2.- Article 9 of the Ley de la Jurisdicción Constitucional (Constitutional Jurisdiction Act) authorizes the Chamber to summarily dismiss or dismiss on the merits, at any time, including upon filing, any submission brought before it that is manifestly inadmissible, or when it considers that there is sufficient evidence to dismiss it, or that it is simply a reiteration or reproduction of an identical or similar prior submission that was dismissed.\n\nDrafted by Justice Castillo Víquez; and,\n\nReasons:\n\ni.- SUBJECT OF THE AMPARO. The amparo applicant states that they disagree with the denial of the requested reconnection of water service. They request the intervention of this Chamber.\n\nII.- THE SPECIFIC CASE. On repeated occasions, this Chamber has held that, although the fundamental right to water and equal access to it are recognized because it is an essential service for life and health, that right does not entail unrestricted access to water, since the Administration may validly establish general conditions and requirements for access to this service. It is also valid for entities—public or private—that administer the service to reject water requests, or requests for a water-availability letter, when the interested party does not meet the requirements or when technical or legal grounds justify rejection. For example, in judgment No. 2016-006027, issued at 09:05 on 6 May 2016, this Chamber held as follows:\n\n“This Constitutional Court, in judgment 2014-9134, issued at 14:05 on 19 June 2014, which addressed an issue very similar to the one raised in this amparo application, held: ‘(...) In repeated judgments on this subject, this Chamber has indicated that the supply of drinking water is considered a public service under Costa Rican law, and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously and efficiently, on equal terms, and in a manner that adapts to technological changes (see, in this regard, judgment 2001-09676, issued at 11:25 on 26 September 2001, and judgment 2004-08161, issued at 10:53 on 23 July 2004).\n\nIt is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the state entities responsible for providing the public drinking-water service, is also required to provide that service continuously, adaptably, efficiently, and equally to all residents. However, this Constitutional Court’s case law has also indicated that, in the face of legal impossibility (that is, failure to meet requirements established in the applicable regulations) or formal impossibility (that is, the absence of a water-distribution network), it is reasonable not to grant service requests or to require the interested party to bear installation costs when no drinking-water distribution network exists and infrastructure must be built. In such cases, it is clear that this is not a denial of access to drinking-water service, but rather an inability to provide it or the interested party’s necessary participation in overcoming a technical impossibility, namely, the lack of infrastructure. In other words, whenever the failure to provide drinking-water service is not capricious, arbitrary, or without grounds, but is justified by legal or material impossibility, there is no violation of fundamental rights. In this specific case, the evidence submitted and the report provided under oath confirm that AyA did not arbitrarily reject the request filed by the applicant, but did so because all the technical and legal requirements established in the Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados (Regulations for Providing Services to Customers of the Costa Rican Institute of Aqueducts and Sewerage) for approving new services had not been met.’ (See, to similar effect, judgments No. 2019-005700, issued at 09:45 on 29 March 2019; No. 2021- 008690, issued at 09:15 on 30 April 2021; No. 2022-030504, issued at 09:15 on 23 December 2022; and No. 2023-003878, issued at 09:20 on 17 February 2023.)\n\nThose arguments fully apply to this specific case, in which the amparo applicant was denied water-service availability because, according to the technical study issued, the community does not have sufficient water capacity. (See, to the same effect, judgment No. 2026013422, issued at 09:20 on 21 April 2026.) Accordingly, the petitioner’s disagreement with the respondent institute’s decision not to issue the requested water-availability letter is not a matter to be heard in this jurisdiction, since it concerns an ordinary legality dispute outside this Chamber’s jurisdiction. Nor may this Court act as a mediator with a particular natural or legal person—whether the latter is governed by public or private law—to intercede on behalf of a third party so that the person may obtain what they seek. Therefore, the amparo applicant may, if they so choose, bring their objections or claims before the respondent authorities or in the competent judicial forum, where they may fully argue the merits of the matter and assert their claims. In view of the foregoing, the amparo application is inadmissible.\n\nIII.- DISSENTING OPINION OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, DRAFTED BY THE FORMER. We disagree with the majority’s position. In this case, the respondent’s denial of an essential service is upheld on the basis of technical considerations concerning insufficient infrastructure or water capacity. However, the ruling fails to give due weight to the fact that access to drinking water is a fundamental right, indispensable to life, health, and human dignity.\n\nArticle 21 of the Political Constitution protects human life, and this Court has recognized that access to water for human consumption is a material prerequisite for that right. Article 50 of the Constitution also imposes on the State the duty to ensure the well-being of all residents, which necessarily includes effective, sufficient, and continuous access to drinking water. At the international level, instruments such as the International Covenant on Economic, Social and Cultural Rights—as interpreted by the Committee on Economic, Social and Cultural Rights in its General Comment No. 15—recognize the human right to water and require States to take positive measures for its full realization. In a social and democratic state governed by the rule of law, the State bears an enhanced obligation; for this reason, the supply of water is a priority obligation of public authorities.\n\nFrom this perspective, invoking technical limitations cannot serve as an absolute justification for disregarding a basic subsistence need. Whoever administers the water supply cannot simply note that the system is insufficient; they have a legal duty to plan, anticipate, and carry out the actions necessary to progressively guarantee access to water service, especially when it is for human consumption.\n\nThe majority’s approach normalizes a structural omission: it accepts that a lack of infrastructure releases the State from its obligation, when that very deficiency demonstrates a failure to fulfill its duty to plan ahead. This is not about requiring the impossible, but about requiring reasonable, alternative, or progressive measures so that people are not left without protection.\n\nWater is not just any service; it is an essential human right. The respondent authority therefore cannot shirk its duty to guarantee it by sheltering behind technical limitations without offering effective solutions.\n\nFor these reasons, we consider that the amparo application should have been admitted, at least to order the adoption of concrete and progressive measures to guarantee the amparo-protected person effective access to drinking water within a reasonable period. Water is a good and a fundamental right whose exercise must be effectively ensured; this is an inescapable duty.\n\nIV.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that if they submitted any paper documents, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must be collected from the office within a maximum period of 30 business days counted from notification of this judgment. Otherwise, any such material not collected within that period will be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial” (Regulations on Electronic Case Files before the Judiciary), approved by the Corte Plena in session No. 27-11 on 22 August 2011, Article XXVI, and published in Boletín Judicial No. 19 on 26 January 2012, as well as in the agreement approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo application is summarily dismissed.
