"summary_en": "The Constitutional Chamber of the Supreme Court of Justice rejected the new application as a repetition of arguments in an earlier amparo concerning felled trees that had not been removed from a park in Goicoechea. In the earlier decision, the Chamber found the amparo inadmissible because this remedy protects fundamental rights and freedoms but is not a general request for the Court to intervene with the municipality; it indicated that the applicant could use the appropriate legality procedure. In this decision, it directed the applicant to abide by what had already been decided. The application also sought removal of the biomass and repair of fences and gates. The Chamber did not decide those requests anew on the merits.",

Nº 2026030791\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. Nº 2026030791\n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 11 August 2026.\n\nAmparo proceeding filed by Nombre01, identity card CED01, against THE MUNICIPALITY OF GOICOECHEA\n\nBACKGROUND:\n\n1.- By a filing added to the Chamber’s digital case file at 13:31 on 3 August 2026, the appellant files an amparo proceeding against the Municipality of Goicoechea and states that, by judgment No. 2025-026710, this Chamber granted an amparo proceeding against the respondent authority, in which the felling of some trees in poor condition was ordered. The appellant asserts that this was done, but the trees were not removed from the park or turned into sawdust, which prevents use of the multipurpose court, since it has deteriorated due to lack of cleaning. Accordingly, the appellant asks that the respondent authority be ordered to remove the tons of biomass still in the park, as well as repair the nets and gates.\n\n2.- Article 9 of the Constitutional Jurisdiction Act authorizes the Chamber to dismiss summarily or on the merits, at any time, including upon filing, any matter submitted to it that proves manifestly inadmissible, or when it considers that there is sufficient evidence to dismiss it, or that it is a simple reiteration or reproduction of an identical or similar prior matter that was dismissed.\n\nDrafted by Justice Castillo Víquez; and,\n\nREASONS:\n\nI.- ADMISSIBILITY OF THIS APPLICATION. In judgment No. 202602965, issued at 09:25 on 4 August 2026, this Chamber declared inadmissible an amparo proceeding filed by the appellant, based on the following considerations:\n\n“I.- SUBJECT OF THE AMPARO. The appellant challenges the actions of the Municipality of Goicoechea, because some trees were felled but not removed from the site. The appellant requests this Chamber’s intervention.\n\nII.- THE SPECIFIC CASE. The purpose of an amparo proceeding is to provide timely protection against violations or threats to fundamental rights and freedoms, not to serve as a general instrument for guaranteeing the principle of constitutional supremacy or the principle of legality, through which it would be possible to bring an action against any other kind of constitutional or legal breach. Thus, the filing submitted by the appellant is a request for assistance, made in the hope that this Court will intervene or lend its good offices to the respondent municipality so that the felled trees may be removed. The appellant may, if they so wish, turn to the appropriate legal avenue to file there whatever matters they consider pertinent so that the matter may be resolved as the law requires. Accordingly, the application is inadmissible.\n\nIII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The appellant is advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic or new-technology device, these must be collected from the court office within a maximum period of thirty business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, as provided in the “Regulations on the Electronic Case File before the Judiciary,” approved by the Full Court in Session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at Session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTHEREFORE:\n\nThe application is dismissed summarily.”\n\nFor the foregoing reasons, since the facts underlying this application have already been considered by this Chamber in the judgment partially transcribed above, it is inadmissible to address the same allegations, as they merely reiterate what was decided in the cited judgment. Accordingly, the appellant shall abide by what was decided in those judgments.\n\nII.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic or new-technology device, these must be collected from the court office within a maximum period of thirty business days from notification of this judgment. 43-12 held on 3 May 2012, Article LXXXI.\n\nTHEREFORE:\n\nThe appellant shall abide by what this Chamber decided in judgment No. 2026-029650, issued at 09:25 on 4 August 2026.\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
