Nº 2026030818\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas veinticinco minutos del once de agosto de dos mil veintiseis .\n\n Recurso de amparo que se tramita en el expediente número 26-028142-0007-CO, interpuesto por Nombre01, cédula de identidad número CED01, a favor de Nombre02, cédula de identidad número CED02, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.\n\nResultando\n\n1. Por escrito incorporado al expediente electrónico el 4 de agosto de 2026, la parte recurrente interpone recurso de amparo contra el Instituto Costarricense de Acueductos y Alcantarillados. Manifiesta que la amparada presentó un recurso de revocatoria con apelación en subsidio contra el estudio técnico nro. UEN-SCZII-GAM-2025-00466, caso nro. ZII-25-CRM12141767, gestión IN.CS N 0311 2025 de la Contraloría de servicio del AyA, del 26 de junio de 2025, referente al servicio de agua, facturado con el NIS 3295116. Sin embargo, reclama que a la fecha de la interposición del presente amparo el recurso de apelación no había sido resuelto. Por lo expuesto, estima lesionados los derechos fundamentales de la parte amparada.\n\n2. El artículo 9 de la Ley de la Jurisdicción Constitucional faculta a la Sala a rechazar de plano o por el fondo, en cualquier momento, incluso desde su presentación, cualquier gestión que se presente a su conocimiento que resulte ser manifiestamente improcedente, o cuando considere que existen elementos de juicio suficientes para rechazarla, o que se trata de la simple reiteración o reproducción de una gestión anterior igual o similar rechazada.\n\n Redacta el Magistrado Castillo Víquez; y,\n\n Considerando:\n\n I. OBJETO DEL RECURSO. La parte recurrente expresa que la amparada presentó un recurso de revocatoria con apelación en subsidio contra el estudio técnico nro. UEN-SCZII-GAM-2025-00466, caso nro. ZII-25-CRM12141767, gestión IN.CS N 0311 2025 de la Contraloría de servicio del AyA, del 26 de junio de 2025, referente al servicio de agua, facturado con el NIS 3295116. Sin embargo, reclama que a la fecha de la interposición del presente amparo el recurso de apelación no había sido resuelto. Por lo expuesto, estima lesionados los derechos fundamentales de la parte amparada.\n\nII. INADMISIBILIDAD DEL RECURSO. En el escrito de interposición, la parte recurrente solicita a esta Sala que le ordene a la autoridad accionada que, resuelva un recurso de apelación contra el estudio técnico nro. UEN-SCZII-GAM-2025-00466. Ahora bien, se observa que esa gestión está amparada por el derecho a una justicia administrativa pronta y cumplida, garantizado según el artículo 41 de la Constitución y no por el derecho de petición. La Sala ha establecido que, salvo ciertas excepciones, este tipo de reclamos deben ser tratados mediante el “amparo de legalidad” en la vía contenciosa administrativa. Dado que el motivo invocado en este recurso no se encuentra dentro de las excepciones mencionadas, corresponde rechazar el recurso de plano, fundamentado en las consideraciones que se expondrán más adelante.\n\nIII.- NUEVA JUSTICIA ADMINISTRATIVA MECANISMO CÉLERE Y CUMPLIDO PARA LA PROTECCIÓN DE SITUACIONES JURÍDICAS SUSTANCIALES DE LOS ADMINISTRADOS. La Sala Constitucional, desde su fundación, ha utilizado criterios amplios de admisibilidad en vista de la ausencia de cauces procesales expeditos y céleres para la protección de las situaciones jurídicas sustanciales que tienen asidero en el ordenamiento jurídico infra-constitucional o parámetro de legalidad, que guardan conexión indirecta con los derechos fundamentales y el Derecho de la Constitución. Sobre el particular, no debe perderse de perspectiva que la Constitución por su supremacía, súper-legalidad y eficacia directa e inmediata da fundamento indirecto a cualquier situación jurídica sustancial imaginable de las personas. No obstante, bajo una mejor ponderación y ante la promulgación del Código Procesal Contencioso-Administrativo (Ley No. 8508 de 24 de abril de 2006) y su entrada en vigencia a partir del 1° de enero de 2008, ha quedado patente que ahora los justiciables cuentan con una jurisdicción contencioso-administrativa plenaria y universal, sumamente expedita y célere por los diversos mecanismos procesales que incorpora al ordenamiento jurídico esa legislación, tales como el acortamiento de los plazos para realizar los diversos actos procesales, la amplitud de la legitimación, las medidas cautelares, el numerus apertus de las pretensiones deducibles, la oralidad –y sus subprincipios concentración, inmediación y celeridad-, la única instancia con recurso de apelación en situaciones expresamente tasadas, la conciliación intra-procesal, el proceso unificado, el proceso de trámite preferente o “amparo de legalidad”, los procesos de puro derecho, las nuevas medidas de ejecución (multas coercitivas, ejecución sustitutiva o comisarial, embargo de bienes del dominio fiscal y algunos del dominio público), los amplios poderes del cuerpo de jueces de ejecución, la extensión y adaptación de los efectos de la jurisprudencia a terceros y la flexibilidad del recurso de casación. Todos esos institutos procesales novedosos tienen por fin y propósito manifiesto alcanzar la economía procesal, la celeridad, la prontitud y la protección efectiva o cumplida de las situaciones jurídicas sustanciales de los administrados, todo con garantía de derechos fundamentales básicos como el debido proceso, la defensa y el contradictorio. En suma, la nueva jurisdicción contencioso-administrativa es un cauce idóneo, por sus nuevas características de simplicidad, celeridad y prontitud para el amparo y protección efectiva de las situaciones jurídicas sustanciales de los administrados en las que se requiera recabar prueba o definir algunas cuestiones de legalidad ordinaria.\n\nIV.- VERIFICACIÓN DE LOS PLAZOS PAUTADOS POR LEY PARA RESOLVER LOS PROCEDIMIENTOS ADMINISTRATIVOS: CUESTIÓN EVIDENTE DE LEGALIDAD ORDINARIA. Es evidente que determinar si la administración pública cumple o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes, es una evidente cuestión de legalidad ordinaria que, en adelante, puede ser discutida y resuelta ante la jurisdicción contencioso-administrativa con la aplicación de los principios que nutren la jurisdicción constitucional, tales como los de la legitimación vicaria, la posibilidad de la defensa material –esto es de comparecer sin patrocinio letrado- y de gratuidad para la parte recurrente. Consecuentemente, se impone el rechazo de plano e indicarle a la parte accionante que si a bien lo tiene puede acudir a la jurisdicción contencioso-administrativa.\n\nV. EL MAGISTRADO CASTILLO VÍQUEZ PONE NOTA. He apoyado la tesis de este Tribunal, de que cuando el justiciable alega una vulneración al derecho a una justicia pronta y cumplida en sede administrativa, quienes deben conocer la controversia jurídica son los Tribunales de lo Contencioso-Administrativo y no esta Sala. Ahora bien, con la reciente promulgación de la Ley n.° 9097, Ley de Regulación del Derecho de Petición, se ha establecido que ese derecho es susceptible de tutela judicial por medio del recurso de amparo establecido por el artículo 32 de la Ley de la Jurisdicción Constitucional, en relación con el artículo 27 de la Constitución Política de la República de Costa Rica, en aquellos casos en que el peticionario considere que las actuaciones materiales de la Administración, sus actos administrativos o su respuesta le estén afectando sus derechos fundamentales. A mi modo de ver, la normativa recién promulgada no implica que este Tribunal deba modificar su línea jurisprudencial, quien, con base en el numeral 7 de su Ley, le corresponde definir exclusivamente su propia competencia, pues las controversias jurídico-constitucionales que atañen a menores de edad, al ambiente, pago de salario, al pago de las prestaciones cuando la persona se jubila, a las pensiones del régimen no contributivo y los casos de parálisis cerebral profunda, discapacitados, extranjeros que se encuentran fuera del país, servicio de agua potable, adultos mayores cuando no se refiere a cuestiones de su pensión, denuncias de corrupción, derecho de los indígenas, reclamos por la falta de aseguramiento ante la Caja Costarricense de Seguro Social y de licencias de maternidad son de conocimiento de esta jurisdicción a través del proceso constitucional de garantía del amparo. En los demás casos, y por las razones que se dan en esta sentencia, los competentes son los Jueces de la jurisdicción de lo contencioso-administrativo, todo lo cual es conforme al numeral 25 de la Convención Americana sobre Derechos Humanos, el Derecho de la Constitución (valores, principios y normas) y las normas legales correspondientes con base en una interpretación lógica, sistémica y teleológica del ordenamiento jurídico. \n\nVI. VOTO SALVADO DEL MAGISTRADO CRUZ CASTRO. Si bien en el pasado he sostenido el criterio de mayoría del Tribunal, bajo una mejor ponderación de los derechos fundamentales que se reclaman, estimo que la mora administrativa constituye una lesión a una garantía procesal fundamental, razón por la que cambio el criterio que había expuesto, admitiendo la posible infracción al derecho a una justicia administrativa pronta y cumplida, separándome de la visión de la mayoría del Tribunal, en el sentido que –salvo contadas excepciones- este tipo de reproches deben resolverse en la jurisdicción contenciosa administrativa. Por el contrario, estimo que uno de los derechos que esta jurisdicción se encuentra llamada a tutelar es el de la justicia pronta y cumplida, expresamente consagrado en el artículo 41 constitucional. Ello conforme al ámbito de competencia asignado a este Tribunal en materia de protección a derechos fundamentales, en atención a lo dispuesto en los artículos 10 y 48 de la Constitución Política. Si bien, entiendo la importancia de las reformas de la jurisdicción contencioso administrativa a partir de la vigencia de la Ley 8508 del veinticuatro de abril de dos mil seis, lo cierto es que dicha situación no justifica la remisión a dicha instancia de los asuntos que versan sobre materia que es competencia de esta Sala, la cual ha demostrado a lo largo de los años que es un medio célere y efectivo para la tutela de los derechos fundamentales de los habitantes del país.\n\nVII. DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Debe prevenir esta Sala a las partes que de haber aportado algún documentos en papel, así como objetos o pruebas respaldadas por medio de cualquier dispositivo adicional, o por medio de soporte electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho, en un plazo de 30 días hábiles, después de recibida la notificación de esta sentencia, de lo contrario todo ello será destruido de conformidad con lo establecido en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión No. 27-11 del 22 de agosto del 2011, artículo XXVI y publicado en Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión No. 43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\nSe rechaza de plano el recurso. SUBJECT OF THE AMPARO. The claimant states that the amparo applicant filed a motion for reconsideration with an appeal in the alternative against technical study no. UEN-SCZII-GAM-2025-00466, case no. ZII-25-CRM12141767, submission IN.CS N 0311 2025 to the AyA Service Comptroller, dated 26 June 2025, concerning the water service billed under NIS 3295116. In the filing initiating the proceeding, the claimant asks this Chamber to order the respondent authority to resolve an appeal against technical study no. UEN-SCZII-GAM-2025-00466. However, it is apparent that this matter is protected by the right to prompt and effective administrative justice, guaranteed under Article 41 of the Constitution, and not by the right of petition. The Chamber has held that, subject to certain exceptions, claims of this kind must be pursued through an “amparo de legalidad” (legality amparo) in the administrative-litigation jurisdiction. Since the ground invoked in this amparo does not fall within the stated exceptions, the amparo must be summarily dismissed, based on the considerations set out below.\n\nIII. NEW ADMINISTRATIVE JUSTICE: A SPEEDY AND EFFECTIVE MECHANISM FOR THE PROTECTION OF THE SUBSTANTIVE LEGAL POSITIONS OF ADMINISTRATIVE PERSONS. Since its establishment, the Constitutional Chamber has applied broad admissibility criteria in view of the absence of expeditious and speedy procedural channels for protecting substantive legal positions grounded in the infra-constitutional legal system or legality framework, which are indirectly connected to fundamental rights and the Law of the Constitution. In this regard, it must be borne in mind that the Constitution, by virtue of its supremacy, super-legality, and direct and immediate effect, indirectly provides a basis for any conceivable substantive legal position of individuals. Nevertheless, upon better weighing of the matter and following the enactment of the Código Procesal Contencioso-Administrativo (Law No. 8508 of 24 April 2006) and its entry into force on 1 January 2008, it has become clear that litigants now have access to a plenary and universal administrative-litigation jurisdiction that is highly expeditious and speedy, owing to the various procedural mechanisms that this legislation incorporates into the legal system, such as shorter time limits for carrying out the various procedural acts, broad standing, interim measures, an open-ended range of claims that may be brought, oral proceedings—and their subsidiary principles of concentration, immediacy, and expedition—the single instance with an appeal in expressly specified situations, in-proceeding conciliation, the unified proceeding, the proceeding with preferential processing or “amparo de legalidad,” proceedings involving only questions of law, new enforcement measures (coercive fines, substitute or commissionary enforcement, attachment of assets in the fiscal domain and certain assets in the public domain), the broad powers of the enforcement judges, the extension and adaptation of the effects of case law to third parties, and the flexibility of the cassation appeal. All these novel procedural institutions are expressly intended to achieve procedural economy, expedition, promptness, and effective protection of the substantive legal positions of administrative persons, while guaranteeing basic fundamental rights such as due process, the right of defense, and adversarial proceedings. In short, the new administrative-litigation jurisdiction, with its new features of simplicity, expedition, and promptness, is a suitable channel for the effective protection of the substantive legal positions of administrative persons where evidence must be gathered or ordinary questions of legality must be decided.\n\nIV. VERIFICATION OF THE TIME LIMITS ESTABLISHED BY LAW FOR RESOLVING ADMINISTRATIVE PROCEDURES: AN OBVIOUS QUESTION OF ORDINARY LEGALITY. It is evident that determining whether the public administration complies with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws for special administrative procedures, whether to issue a final decision in an administrative procedure—initiated ex officio or at the request of a party—or to hear the available administrative appeals, is an obvious question of ordinary legality that may henceforth be disputed and resolved before the administrative-litigation jurisdiction, applying the principles that inform constitutional jurisdiction, such as representative standing, the possibility of self-representation—that is, appearing without legal counsel—and the exemption of the claimant from costs. Accordingly, the amparo must be summarily dismissed, and the claimant must be advised that they may, if they so wish, bring the matter before the administrative-litigation jurisdiction.\n\nV. JUSTICE CASTILLO VÍQUEZ ADDS A SEPARATE NOTE. I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in the administrative forum, the legal dispute must be heard by the Administrative-Litigation Courts and not by this Chamber. However, with the recent enactment of Law No. 9097, Ley de Regulación del Derecho de Petición, it has been established that this right is subject to judicial protection through the amparo proceeding provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases where the petitioner considers that the Administration’s conduct, its administrative acts, or its response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to change its line of case law, since, under section 7 of its Law, this Court alone is responsible for defining its own jurisdiction. Legal-constitutional disputes concerning minors, the environment, salary payments, payment of benefits upon a person’s retirement, pensions under the non-contributory scheme, and cases involving profound cerebral palsy, persons with disabilities, foreigners who are outside the country, drinking-water service, older adults when pension matters are not at issue, corruption complaints, the rights of Indigenous peoples, claims concerning the failure to provide insurance through the Caja Costarricense de Seguro Social, and maternity leave fall within this jurisdiction and are heard through the constitutional amparo proceeding. In all other cases, for the reasons set out in this judgment, jurisdiction lies with the judges of the administrative-litigation jurisdiction. This is consistent with section 25 of the American Convention on Human Rights, the Law of the Constitution (values, principles, and rules), and the applicable statutory provisions, based on a logical, systemic, and teleological interpretation of the legal system.\n\nVI. DISSENTING OPINION OF JUSTICE CRUZ CASTRO. Although I previously held the Court’s majority position, upon better weighing of the fundamental rights asserted, I consider that administrative delay violates a fundamental procedural guarantee. For that reason, I am changing the position I had expressed and recognize the possible infringement of the right to prompt and effective administrative justice, departing from the Court majority’s view that—save for a few exceptions—this kind of complaint must be resolved in the administrative-litigation jurisdiction. On the contrary, I consider that one of the rights this jurisdiction is called upon to protect is the right to prompt and effective justice, expressly enshrined in Article 41 of the Constitution. This follows from the jurisdiction assigned to this Court in matters concerning the protection of fundamental rights, in accordance with Articles 10 and 48 of the Political Constitution. Although I understand the importance of the reforms to the administrative-litigation jurisdiction following the entry into force of Law 8508 of 24 April 2006, that circumstance does not justify referring to that forum matters concerning subject matter within this Chamber’s jurisdiction, which has demonstrated over the years that it is a speedy and effective means of protecting the fundamental rights of the country’s inhabitants.\n\nVII. DOCUMENTATION SUBMITTED TO THE EXPEDIENTE. This Chamber must advise the parties that if they have submitted any paper documents, as well as objects or evidence stored on any additional device or in electronic, computer, magnetic, optical, telematic, or new-technology format, they must be collected from the court office within 30 business days after receiving notice of this judgment. Otherwise, all such materials will be destroyed in accordance with the provisions of the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 on 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 on 26 January 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo is summarily dismissed.
