San José, a las nueve horas veinticinco minutos del once de agosto de dos mil veintiseis .\n\nGestión posterior formulada por Nombre01, cédula de identidad no. CED01. \n\nResultando:\n\n1.- Por escrito desglosado e incorporado al expediente digital a las 13:35 horas de 20 de julio de 2026, Rugeli Morales Rodríguez, en su condición de Alcalde de Talamanca, señala expresamente lo siguiente: “(…) 2. HECHOS DE INTERES PARA ESTA CONSULTA. a. En el expediente 25-028937-0007-CO. mediante resolución 2025035746 de las 9:30 del 31 de octubre de 2025, la honorable sala constitucional determinó que el plan maestro turístico del caribe promovido por el ICT era inconstitucional por haber incumplido con el requisito de llevar a cabo el proceso de consulta según el convenio 169 de la OIT y que de acuerdo con el decreto ejecutivo 43532-MP-MINAE-MCJ-MEP la representación de la población tribal Afrocostarncense la ostenta el Foro del pueblo tribal afrodescendiente (mismo que actualmente no se encuentra activo). 3. PETITORIA. Conforme a los antecedentes expuestos y el hecho indicado en el punto dos denominado “hechos”, se solicita de forma respetuosa a su autoridad con el único fin de evitar incurrir en errores se nos indque: a. Si es el Foro del pueblo tribal afrodescendiente la única instancia de consulta a la que se debe tomar en cuenta para la construcción de la herramienta de consulta conforme lo establece el convenio 169 de la OIT. b. De considerarse por parte de su autoridad que esta es la vía o instancia de consulta de forma respetuosa solictamos se ordene a quienes ostenten el poder de representación de esta se constituyan conforme los lineamientos establecidos en el decreto ejecutivo a fin de poder continuar con el proceso de la elaboración de la herramienta de consulta. c. En caso de que el criterio de la sala considere afirmativo que esa es la instancia de consulta, se le ordene al foro tribal afrodescendente que en plazo máximo de tres meses nos indique el o los medios por los cuales la municipalidad de Talamanca pueda llevar a cabo los contactos para poder iniciar las reuniones que permitan avanzar en el proceso”.\n\n2.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Araya García; y,\n\n Considerando:\n\nI.- De previo. La Ley de Jurisdicción Constitucional faculta a esta Sala para adicionar y aclarar sus sentencias en aquellos casos en que resulte procedente, al disponer:\n\n “Artículo 12.- Las sentencias que dicte la Sala podrán ser aclaradas o adicionadas, a petición de parte, si se solicitare dentro de tercero día, y de oficio en cualquier tiempo, incluso en los procedimientos de ejecución, en la medida en que sea necesario para dar cabal cumplimiento al contenido del fallo.”\n\n \n\nAsí, la adición de un pronunciamiento procede cuando un punto del planteamiento original del recurso no fue resuelto en el fallo y la aclaración cuando dicho fallo fue resuelto en términos oscuros o ambiguos, implicando de esta forma una difícil comprensión del mismo. La adición y la aclaración son, entonces, formas para complementar una sentencia o de explicar los alcances que tiene el fallo. \n\nII.- Sobre lo dispuesto por esta Sala. Mediante la sentencia no. 2025035746 de las 9:30 horas del 31 de octubre de 2025, este Tribunal dispuso lo siguiente:\n\n“POR TANTO:\n\nSe declara con lugar el recurso. Se le ordena a William Rodríguez López, en su condición de Presidente Ejecutivo del Instituto Costarricense de Turismo, designado como Ministro de Turismo, o a quien en su lugar ocupe dicho cargo, girar las órdenes que estén dentro del ámbito de sus competencias y coordinar lo necesario para que, dentro del plazo máximo de TRES MESES, contado a partir de la notificación de esta sentencia, se programe una consulta para el pueblo tribal afrodescendiente (representado por la Asociación de Desarrollo Integral de Cahuita), relacionado con el Plan Maestro Turístico del Sector Costero del Caribe de Costa Rica, en los términos del artículo 6 del Convenio 169 de la OIT. Lo anterior, bajo la advertencia de que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Instituto Costarricense de Turismo, al pago de las costas, daños y perjuicios ocasionados con los hechos que sirven de base a esta declaratoria, lo que se liquidaran en ejecución de sentencia de lo contencioso administrativo. Comuníquese esta sentencia, para lo de su cargo, a la Ministra de Planificación Nacional y Política Económica (MIDEPLAN)”.-\n\n \n\nLa anterior sentencia le fue notificada a las autoridades recurridas el 4 de noviembre de 2025.\n\nIII.- Tocante a la gestión formulada por el Alcalde de Talamanca. Al respecto, el 3 de julio de 2026, el Alcalde de la Municipalidad de Talamanca acude a esta Sala y presenta lo que denomina una gestión de aclaración de lo dispuesto por esta Sala en el voto no. 2025035746. Expresamente dicha autoridad sostuvo que:\n\n“2. HECHOS DE INTERES PARA ESTA CONSULTA. a. En el expediente 25-028937-0007-CO. mediante resolución 2025035746 de las 9:30 del 31 de octubre de 2025, la honorable sala constitucional determinó que el plan maestro turístico del caribe promovido por el ICT era inconstitucional por haber incumplido con el requisito de llevar a cabo el proceso de consulta según el convenio 169 de la OIT y que de acuerdo con el decreto ejecutivo 43532-MP-MINAE-MCJ-MEP la representación de la población tribal Afrocostarncense la ostenta el Foro del pueblo tribal afrodescendiente (mismo que actualmente no se encuentra activo)”.\n\n \n\nY peticionó a este Tribunal lo siguiente: \n\n“3. PETITORIA. Esto, por los siguientes motivos puntuales: \n\nPrimero, por cuanto la gestión se presentó meses después de dictado el citado voto no. 2025035746 (y no dentro del tercer día al que hace referencia el ordinal 12 de la Ley de la Jurisdicción Constitucional).\n\nSegundo, dado que la referida solicitud se presentó por una autoridad (Alcalde de la Municipalidad de Talamanca) que ni siquiera formó parte del presente proceso de amparo. Se recuerda que la orden consignada en la sentencia no. 2025035746 se giró específicamente al Presidente Ejecutivo del Instituto Costarricense de Turismo, designado como Ministro de Turismo.\n\nTercero, habida cuenta que, en todo caso, resulta menester indicarle al referido Alcalde que el desarrollo de la sentencia no fue omisa en ningún aspecto reclamado, sino que dentro de la misma se abordaron los temas de forma completa y de manera contextualizada, siendo que en el voto supra transcrito, este Tribunal señaló claramente los motivos por los cuales se dio la desestimatoria. \n\nAsimismo, una lectura de dicha sentencia permite demostrar que no existe ningún punto oscuro o confuso que merezca ser aclarado por esta jurisdicción constitucional. Cualquier duda sobreviniente que tenga la parte recurrida debe plantearla y ser resuelta en las vías ordinarias de legalidad creadas especialmente al efecto.\n\nIV.- Conclusión. Bajo este orden de circunstancias la gestión deviene improcedente, y así debe declararse.\n\nV.- Documentación aportada al expediente. Se previene a las partes que de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el “Reglamento sobre Expediente Electrónico ante el Poder Judicial”, aprobado por la Corte Plena en sesión no. 27-11 del 22 de agosto de 2011, artículo XXVI y publicado en el Boletín Judicial no. 19 del 26 de enero de 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión no. 43-12 celebrada el 3 de mayo de 2012, artículo LXXXI .\n\nPor tanto:\n\nNo ha lugar a la gestión formulada.-\n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo. San José, at 9:25 a.m. on 11 August 2026.\n\nPost-judgment request submitted by Nombre01, identity card no. CED01.\n\nBackground:\n\n1.- In a written submission separated out and incorporated into the digital case file at 13:35 on 20 July 2026, Rugeli Morales Rodríguez, in his capacity as Mayor of Talamanca, expressly states the following: “(…) 2. FACTS OF INTEREST FOR THIS REQUEST. a. In case file 25-028937-0007-CO, by ruling 2025035746 at 9:30 on 31 October 2025, the honorable Constitutional Chamber determined that the Caribbean tourism master plan promoted by the ICT was unconstitutional because it failed to meet the requirement to carry out the consultation process under Convention 169 of the ILO and because, under executive decree 43532-MP-MINAE-MCJ-MEP, the Afro-Costa Rican tribal population is represented by the Afro-descendant Tribal People’s Forum (which is currently inactive). 3. REQUEST. In light of the foregoing and the fact stated in point two, entitled “Facts,” we respectfully ask this authority, solely to avoid making mistakes, to inform us: a. Whether the Afro-descendant Tribal People’s Forum is the only consultation body that must be taken into account in developing the consultation tool, as established by Convention 169 of the ILO. b. If this authority considers that to be the channel or body for consultation, we respectfully ask that it order those holding the Forum’s representative authority to constitute themselves in accordance with the guidelines established in the executive decree, so that we may continue developing the consultation tool. c. If the Chamber’s view is that this is the consultation body, that it order the Afro-descendant Tribal Forum to inform us, within a maximum period of three months, of the means by which the Municipality of Talamanca may make contact to begin the meetings that will allow the process to advance.”\n\n2.- The legal requirements have been observed in these proceedings.\n\nJustice Araya García drafts; and,\n\nReasons:\n\nI.- Preliminary matter. The Constitutional Jurisdiction Act authorizes this Chamber to supplement and clarify its judgments where appropriate, providing:\n\n“Article 12.- The Chamber’s judgments may be clarified or supplemented, at a party’s request if requested within the third day, and on the Chamber’s own initiative at any time, including in enforcement proceedings, insofar as necessary to give full effect to the judgment.”\n\nThus, a judgment may be supplemented when a point raised in the original application was not resolved in the judgment, and clarified when the judgment was decided in unclear or ambiguous terms, making it difficult to understand. Supplementation and clarification are therefore ways to complete a judgment or explain the scope of its ruling.\n\nII.- As to what this Chamber ordered. By judgment no. 2025035746 at 9:30 a.m. on 31 October 2025, this Court ordered as follows:\n\n“THEREFORE:\n\nThe amparo application is granted. William Rodríguez López, in his capacity as Executive President of the Costa Rican Tourism Institute, appointed Minister of Tourism, or whoever occupies that position in his place, is ordered to issue such directives as fall within the scope of his powers and coordinate what is necessary so that, within a maximum period of THREE MONTHS from notification of this judgment, a consultation is scheduled for the Afro-descendant tribal people (represented by the Cahuita Integral Development Association) concerning the Master Tourism Plan for the Coastal Sector of Costa Rica’s Caribbean, under Article 6 of Convention 169 of the ILO. This is subject to the warning that, in accordance with Article 71 of the Constitutional Jurisdiction Act, anyone who receives an order that they must comply with or ensure is complied with, issued in an amparo proceeding, and fails to comply with it or ensure compliance, shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty days, provided the offense is not subject to a more severe penalty. The Costa Rican Tourism Institute is ordered to pay the costs, damages, and losses caused by the acts underlying this declaration; those amounts shall be assessed in enforcement proceedings in the administrative-litigation jurisdiction. This judgment shall be communicated, for the appropriate action, to the Minister of National Planning and Economic Policy (MIDEPLAN).”\n\nThe foregoing judgment was served on the respondent authorities on 4 November 2025.\n\nIII.- Regarding the request submitted by the Mayor of Talamanca. On 3 July 2026, the Mayor of the Municipality of Talamanca appeared before this Chamber and submitted what he calls a request for clarification of what this Chamber ordered in ruling no. 2025035746. That authority expressly stated:\n\n“2. FACTS OF INTEREST FOR THIS REQUEST. a. In case file 25-028937-0007-CO, by ruling 2025035746 at 9:30 on 31 October 2025, the honorable Constitutional Chamber determined that the Caribbean tourism master plan promoted by the ICT was unconstitutional because it failed to meet the requirement to carry out the consultation process under Convention 169 of the ILO and because, under executive decree 43532-MP-MINAE-MCJ-MEP, the Afro-Costa Rican tribal population is represented by the Afro-descendant Tribal People’s Forum (which is currently inactive).”\n\nAnd he petitioned this Court as follows:\n\n“3. REQUEST. In light of the foregoing and the fact stated in point two, entitled “Facts,” we respectfully ask this authority, solely to avoid making mistakes, to inform us: a. Whether the Afro-descendant Tribal People’s Forum is the only consultation body that must be taken into account in developing the consultation tool, as established by Convention 169 of the ILO. b. If the Chamber’s view is that this is the consultation body, that it order the Afro-descendant Tribal Forum to inform us, within a maximum period of three months, of the means by which the Municipality of Talamanca may make contact to begin the meetings that will allow the process to advance.”\n\nHaving analyzed all the foregoing, this Constitutional Court considers that there is no basis to address the merits of this request for clarification, for the following specific reasons:\n\nFirst, because the request was submitted months after ruling no. 2025035746 was issued (and not within the third day referred to in Article 12 of the Constitutional Jurisdiction Act).\n\nSecond, because the aforementioned request was submitted by an authority (the Mayor of the Municipality of Talamanca) that was not even a party to this amparo proceeding. It is recalled that the order set out in judgment no. 2025035746 was specifically issued to the Executive President of the Costa Rican Tourism Institute, appointed Minister of Tourism.\n\nThird, in any event, it is necessary to inform the aforementioned Mayor that the judgment’s reasoning omitted no aspect raised in the request; rather, the issues were addressed completely and in context, and in the ruling transcribed above this Court clearly stated the reasons for dismissing the application.\n\nFurthermore, a reading of that judgment shows that there is no unclear or confusing point warranting clarification by this constitutional jurisdiction. Any subsequent question the respondent party may have must be raised and resolved through the ordinary legality procedures established specifically for that purpose.\n\nIV.- Conclusion. In these circumstances, the request is inadmissible, and must be declared so.\n\nV.- Documents submitted to the case file. The parties are advised that if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must collect them from the office within a maximum of 30 business days from notification of this judgment. Otherwise, all material not collected within that period will be destroyed, pursuant to the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session no. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin no. 19 of 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at its session no. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe request submitted is denied.\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
