  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-015288-0007-CO \n\nRes. Nº 2026030954\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .\n\n \n\nRecurso de amparo que se tramita en el expediente nro. 26-015288-0007-CO, interpuesto por Nombre03, cédula de identidad CED03, a favor de Nombre02, cédula de identidad CED04, contra el INSTITUTO DE DESARROLLO RURAL (INDER).\n\nResultando:\n\n \n\n1.-Por escrito incorporado al expediente el 29 de abril de 2026, el accionante interpone recurso de amparo. Manifiesta que la amparada es una persona adulta mayor de 92 años, quien reside en Paraíso de San Rafael de Palmar Norte, Puntarenas. Aduce que cuando su representada se trasladó a vivir a ese sitio, la zona no estaba declarada como territorio indígena, de modo que, en 1976, luego de ejercer una posesión pacifica, notoria e ininterrumpida, adquirió de buena fe y a título de dueña la propiedad en la que habita. Explica que dicha finca fue adquirida por la tutelada mediante un contrato de compraventa sin inscribir, celebrado en papel oficial nro. CED01 Indica que después de poseer la finca por tanto tiempo, el Gobierno de la república declaró esas tierras como terrero indigna y estableció que la finca de su defendida se encuentra ubicada dentro de la reserva indígena de Rey Curré. Arguye que partir de dicha declaratoria, el INDER y la Asociación de Desarrollo Integral Indígena Rey Curré indicaron a la amparada que debe abandonar la propiedad por ser una persona blanca no indígena. Expone que debido a lo anterior su patrocinada no puede disponer de la finca, se le limita la obtención de algún beneficio y tampoco puede venderla, lo anterior sin tomar en cuenta que cuando la tutelada la adquirió no existía la declaratoria del territorio indígena. Menciona que, en el 2003, la CONAI emitió el dictamen nro. C-395-2003 en el cual dispuso que, conforme al artículo 5 de la Ley Indígena, el INDER debe reubicar a los propietarios y poseedores de propiedades que se encuentre dentro territorios indígenas. Cuestiona que, a pesar de lo anterior, el INDER no ha coordinado lo pertinente con la CONAI ni ha hecho algo por atender la problemática de su representada, lo cual le ha causado grandes perjuicios y afectaciones en su salud. Señala que en múltiples ocasiones se ha gestionado ante el INDER la apertura de un proceso administrativo para atender el problema de la tutelada y se defina si tiene derecho a disponer de su finca. En este sentido, detalla las fecha y peticiones formuladas, a saber: “1) En la fecha del 04 de setiembre del 2024, se presentó oficio formal al Director Ejecutivo del INDER Osvaldo Artavia Caballo, en Oficinas Centrales del Instituto de Desarrollo Rural (INDER), solicitando abrir el proceso administrativo porque la señora Nombre02, está muy estresada y angustiada y ha tenido muchos quebrantos de salud, porque el INDER no define su derecho de posesión de su finca. A la fecha el INDER no ha dado respuesta concreta ni ha abierto el proceso administrativo para solucionar el problema de la señora Nombre02. 2) En la fecha del 07 de octubre del 2024, se presentó oficio formal al Director Ejecutivo del INDER Osvaldo Artavia Caballo, en Oficinas Centrales del Instituto de Desarrollo Rural (INDER), solicitando abrir el proceso administrativo porque la señora Nombre02, está muy delicada estresada y angustiada y ha tenido muchos quebrantos de salud, porque el INDER no define su derecho de posesión de su finca. A la fecha el INDER no ha dado respuesta concreta ni ha abierto el proceso administrativo para solucionar el problema de la señora Nombre02. 3) En fecha del 05 de febrero del 2025, se presentó oficio formal al Director Ejecutivo del INDER Juan Ignacio Rodríguez Araya, Oficinas Centrales del Instituto de Desarrollo Rural (INDER), solicitando abrir el proceso administrativo para definir y solucionar el derecho de posesión y el problema de la señora Nombre02 con su finca. A la fecha el INDER no ha dado respuesta concreta ni ha abierto el proceso administrativo para solucionar el problema de la señora Nombre02. 4) En fecha del 28 de enero del 2025, se presentó oficio formal a la Licda. Daniela Artavia Guerrero, Abogada de Información y Registro de tierras del INDER y al Ingeniero. Pablo Zamora Alfaro, Coordinador de Información y Registro de tierras del INDER, de Oficinas Centrales del (INDER), solicitando abrir el proceso administrativo porque la señora Nombre02, está muy estresada y angustiada y ha tenido muchos quebrantos de salud por estas situación, porque no se define su derecho de posesión de su finca. A la fecha el INDER no ha dado respuesta concreta ni ha abierto el proceso administrativo para solucionar el problema de la señora Nombre02. 5) En fecha del 02 de setiembre del 2025, se remitió oficio formal a la Licda. Daniela Artavia Guerrero, Abogada de Información y Registro de tierras del INDER y al Ingeniero. Pablo Zamora Alfaro, Coordinador de Información y Registro de tierras del INDER, de Oficinas Centrales del (INDER), solicitando abrir el proceso administrativo porque la señora Nombre02, está muy estresada y angustiada y ha tenido muchos quebrantos de salud por esta situación, porque no se define su derecho de posesión de su finca. A la fecha el INDER no ha dado respuesta concreta ni ha abierto el proceso administrativo para solucionar el problema de la señora Nombre02. 6) En fecha del 04 de setiembre del 2025, se remitió oficio formal al Director Ejecutivo del INDER Ricardo Quesada Salas, Oficinas Centrales del Instituto de Desarrollo Rural (INDER), solicitando abrir el proceso administrativo porque la señora Nombre02, está muy estresada y angustiada porque no se define su derecho de posesión de su finca. A la fecha el INDER no ha dado respuesta concreta ni ha abierto el proceso administrativo para solucionar el problema de la señora Nombre02. 7) En fecha del 04 de octubre del 2025, se presentó oficio formal a la Licda. Daniela Artavia Guerrero, Abogada de Información y Registro de tierras del INDER y al Ingeniero. Pablo Zamora Alfaro, Coordinador de Información y Registro de tierras del INDER, de Oficinas Centrales del (INDER), solicitando abrir el proceso administrativo porque la señora Nombre02, está muy estresada y angustiada y ha tenido mucho quebrantos de salud por estas situación, porque no se define su derecho de posesión de su finca.”. Reclama que, a la fecha de interposición de este recurso, dicha autoridad no ha emitido resolución alguna ni ha procedido con la apertura del procedimiento requerido para que la afectada pueda demostrar su derecho de posesión sobre dicha finca. Estima que lo expuesto conculca los derechos fundamentales de su defendida. Solicita que se declare con lugar el recurso.\n\n2.-Mediante resolución de las 10:01 horas de 20 de mayo de 2026, la Presidencia de la Sala le dio curso al proceso y le solicitó informe al director ejecutivo y al coordinador de Información y Registro de Tierras, ambos del INDER. \n\n3.- Por escrito incorporado al expediente el 26 de mayo de 2026, el accionante expone: “Señores Magistrados, no es de recibo que el INDER se digne a contestar mis escritos y correos, solo porque su Autoridad ordenó dar traslado al presente Recurso Amparo. Esto es inconcebible. Es importante que se tome en cuenta, que mi persona les ha hecho llegar al INDER, siete peticiones, solicitando abrir el proceso administrativo de la señora Nombre02, haciéndoles ver el aumento de los problemas de salud: ANGUSTIA, ESTRÉS, DEPRESIÓN, NO PODER DORMIR, que sufre esta adulta mayor, porque el INDER se ha negado abrir el proceso administrativo y en consecuencia NO SABE SI DEBE PERMANECER EN SU FINCA o debe salir, o bien si el INDER en cualquier momento la va a sacar de su finca ubicada en la Reserva de Rey Curre, ello, para darle su finca a las personas indígenas; finca en la cual, ha trabajado por tanto años, pero al INDER esto no le importa, como tampoco le importado los problemas de salud que sufre la señora Nombre02, producto de la angustia que la vayan a sacar de su finca que tanto le ha costado. Señores Magistrados, es significativo indicar que en este proceso ya llevamos casi cuatro años, solicitándole al INDER abrir el proceso administrativo y llevo más de tres años presentando oficios formales y correos solicitando abrir el proceso administrativo, pero el INDER, ni siquiera se digna a contestar mis correos y escritos y a dar una respuesta concreta. No obstante, con la notificación del presente Recurso de Amparo, el día de ayer 25 de mayo del 2026, el INDER por medio del Ing. Pablo C. Zamora Alfaro, de Coordinador Información y Registro de Tierras, mediante oficio INDER-GG-DRT-FT-IRT-OFI-0615-2026, del 25 de mayo de 2026, se dignó a dar respuesta a mis peticiones, con un resultado negativo, pues nuevamente se niega abrir el proceso administrativo, alegando que mi solicitud se encuentra en trámite y será atendida conforme a los procedimientos técnicos y administrativos correspondientes dentro del marco de ejecución del Plan RTI, tal y como se indica: “Por tanto, se reitera que, la solicitud presentada por su representada se encuentra actualmente en trámite y será atendida conforme a los procedimientos técnicos y administrativos correspondientes dentro del marco de ejecución del Plan RTI.” Esta respuesta no es de recibo, primero porque la señora Nombre02, es una adulta mayor, de 92 años de edad, que merece respecto por todo el trabajo realizado en su vida en esta finca y segundo porque este proceso leva ya casi cuatro años y no han resuelto nada, siendo esto un verdadero atropello para esta adulta mayor; lo que hacen en el INDER es pasar la bola de Departamento en Departamento para no resolver nada en concreto, tal y como lo demuestra el oficio INDER-GG-DRT-FT-IRT-OFI-0615-2026 y mientras tanto la señora Nombre02 es la más perjudicada porque no le resuelven nada sobre su situación. Consideramos que lo que pretende el INDER es que la señora Nombre02, fallezca para no tramitar su caso y no abrir ningún proceso administrativo, dado que no se puede pensar otra cosa, ello porque ya llevamos casi cuatro años solicitando abrir el proceso administrativo y lo que recibimos del INDER son respuestas negativas, que no va abrir ningún proceso dejando a la señora Nombre02 sin el derecho a saber si tiene derecho a permanecer en su finca. Esta mentalidad del INDER es mezquina, más y cuando la señora Nombre02, ha dado tanto a esta sociedad con su trabajo su esfuerzo, trasladarse cuando era joven de San José a la Zona Sur, Osa, todo un reto en su momento, trabajar la tierra con su familia y empezar a formar un hogar y ver crecer su familia, todo esto es digno de ser recompensado y esa recompensa es por lo menos que se ordene abrir el proceso administrativo para que la señora Nombre02 por lo menos el día de mañana si muere, por lo menos se lleve que puedo irse en paz y se resolvió su problema con esta finca. Es importante indicar, que por respecto a la señora Nombre02 y por el trabajo que ha realizado en esta finca y que fue una de las primeras personas que emigraron de San José a la Zona Sur, Osa y que fue una de las primeras personas que trabajo esta finca cuando no existía ninguna persona indígena y es más en esas fincas casi no vivía nadie, ergo, lo mínimo que debe hacer el INDER es abrir el proceso administrativo, para que la señora Nombre02 demuestre si tiene derecho o no a permanecer en estas tierras; denegarle el derecho sería como quitarle parte de su vida dado que toda la vida ha vivido y a poseído esta finca. Es substancial indicar, que oficio INDER-GG-DRT-FT-IRT-OFI-0615-2026, más bien viene hacer una falta de respecto para la señora Nombre02, indicarle que su petición está en trámite cuando ya han pasado casi cuatro años sin que se le resuelva nada, esto es una verdadera pesadilla y una falta de respecto para la señora Nombre02, con una verdadera violación de sus derechos fundamentales a tener una respuesta pronta que, a su edad, ya no puede esperar tanto tiempo.”.\n\n4.- Por escrito incorporado al expediente el 28 de mayo de 2026, Pablo César Zamora Alfaro, coordinador de la Unidad de Información y Registro de Tierras del INDER, informa: “El Instituto de Desarrollo Rural rechaza los hechos expuestos en el presente recurso de amparo en cuanto se interprete que existió abandono, negativa absoluta, desatención deliberada o inacción institucional respecto de las gestiones presentadas por la parte accionante, toda vez que esta Administración ha desarrollado actuaciones continuas relacionadas con la situación planteada por la señora Nombre02, dentro del marco de competencias institucionales y conforme a las etapas técnicas, administrativas y territoriales propias de la ejecución del Plan Nacional de Recuperación de Territorios Indígenas (Plan RTI). Asimismo, se rechaza cualquier interpretación tendiente a afirmar que el Instituto de Desarrollo Rural haya actuado de manera arbitraria, intempestiva o contraria a los derechos fundamentales de la parte accionante, por cuanto las actuaciones desarrolladas responden al cumplimiento del principio de legalidad y al respeto de los derechos colectivos de autodeterminación y gobernanza territorial reconocidos a los pueblos indígenas mediante normativa nacional e internacional vinculante para el Estado costarricense. PRIMERO: Sobre la condición de persona no indígena y adulta mayor de la señora Nombre02. Es cierto que la parte accionante manifiesta que la señora Nombre02 es una persona adulta mayor y que no pertenece a un pueblo indígena. Esta Administración es respetuosa de dicha condición y de la especial protección que el ordenamiento jurídico reconoce a las personas adultas mayores. No obstante, debe indicarse que, la sola afirmación de no pertenencia indígena no acredita por sí misma la procedencia inmediata de un procedimiento administrativo ordinario, ni la existencia de un derecho posesorio indemnizable. Dichos extremos requieren valoración técnica, social, jurídica, territorial y documental, dentro de las etapas correspondientes del Plan RTI. SEGUNDO: Sobre la supuesta adquisición de buena fe de una finca en el año 1976. Se rechaza que esta Administración pueda tener por acreditado, únicamente con las manifestaciones de la parte accionante, que la señora Nombre02 adquirió de buena fe una finca en el año 1976. La determinación de la buena fe, la existencia de ocupación efectiva, la antigüedad de la posesión, la validez o alcance de un documento privado sin inscribir y la eventual procedencia de indemnización son aspectos que requieren análisis técnico y jurídico dentro de las vías correspondientes. Por tanto, no corresponde tener dichos extremos como demostrados en sede constitucional, ni ordenar automáticamente la apertura de un procedimiento administrativo ordinario sin contar previamente con los insumos técnicos mínimos requeridos. TERCERO: Sobre la ubicación de la finca dentro del Territorio Indígena de Rey Curré. Se rechaza que, con la información aportada por la parte accionante, pueda tenerse por acreditado de forma definitiva que el inmueble descrito se encuentra dentro del Territorio Indígena de Rey Curré. Desde el oficio INDER-GG-DRT-FT-IRT-OFI-0923-2024 que se le remitió a la recurrente, esta Administración indicó que, no se contaba con plano catastrado, croquis, coordenadas ni elementos técnicos suficientes que permitieran ubicar con precisión el inmueble referido. Por ello, previo a cualquier determinación sobre la eventual apertura de un procedimiento administrativo ordinario, resulta necesario realizar verificaciones técnicas, territoriales, registrales y topográficas. CUARTO: Sobre la afirmación de que cuando adquirió la finca no existía reserva indígena ni personas indígenas en el sitio. Se rechaza que esta Administración pueda validar dicho extremo en los términos expuestos por la parte accionante. La determinación histórica sobre la creación, delimitación, modificación y vigencia de un territorio indígena, así como, la valoración de la presencia o no de población indígena en determinada época, requiere análisis técnico, jurídico, histórico. Dichos aspectos exceden la naturaleza sumaria del recurso de amparo y no pueden resolverse únicamente a partir de afirmaciones de parte. QUINTO: Sobre la afirmación de que el INDER “sacó” a un vecino colindante y que por ello la señora Nombre02 teme ser desalojada. Se rechaza que exista actuación administrativa emitida por el INDER mediante la cual se haya ordenado desalojar a la señora Nombre02 o sacarla de manera abrupta de la finca que indica ocupar. El procedimiento institucional dentro del Plan RTI no opera de la forma descrita por la parte recurrente. Cualquier actuación relacionada con ocupaciones dentro de territorios indígenas debe respetar el debido proceso, el derecho de defensa, la notificación correspondiente y la posibilidad de aportar prueba. Por tanto, no existe amenaza alguna de cualquier índole atribuible al INDER que justifique la estimación del presente recurso. SEXTO: Sobre los alegatos de afectación a la salud, estrés, ansiedad, insomnio y preocupación de la amparada. Esta Administración comprende y respeta la situación personal expuesta por la parte accionante respecto de la condición de adulta mayor de la señora Nombre02. No obstante, se rechaza que exista una actuación arbitraria, ilegítima u omisiva del INDER que haya provocado una vulneración directa a sus derechos fundamentales. Por el contrario, se han realizado gestiones adicionales orientadas a procurar acompañamiento interinstitucional a favor de la amparada. En ese sentido, mediante oficio INDER-GG-DRT-FT-IRT-OFI-0348-2026 de fecha 26 de marzo de 2026, se remitió el caso al Consejo Nacional de la Persona Adulta Mayor y al Instituto Mixto de Ayuda Social, a efectos de valorar su condición socioeconómica, estado de salud, red de apoyo familiar, acceso a pensión y eventual activación de medidas de protección social. Dicho oficio fue remitido a ambas instituciones el 27 de marzo de 2026. El IMAS acusó recibo ese mismo día y el CONAPAM respondió el 12 de mayo de 2026, indicando que el caso sería trasladado a las redes de cuido correspondientes de Osa y Buenos Aires para su valoración. SÉTIMO: Sobre la afirmación de que el INDER se ha negado a abrir el procedimiento administrativo. Se rechaza categóricamente que el INDER se haya negado de manera arbitraria o definitiva a tramitar la gestión presentada por la parte accionante. Lo que esta Administración ha indicado es que la eventual apertura de un procedimiento administrativo ordinario requiere previamente la realización de actividades técnicas preliminares, tales como: censo, verificación territorial, levantamiento topográfico, análisis registral, identificación de ocupación, coordinación con la Asociación de Desarrollo Integral Indígena correspondiente y conformación del expediente preliminar. En consecuencia, no existe negativa institucional, sino sujeción al procedimiento técnico y administrativo aplicable. OCTAVO: Sobre las solicitudes presentadas el 04 de septiembre de 2024 y 07 de octubre de 2024. Es cierto que la parte accionante presentó solicitudes relacionadas con la apertura de procedimiento administrativo los días 04 de septiembre de 2024 y 07 de octubre de 2024. Dichas gestiones fueron atendidas mediante oficio INDER-GG-DRTFT-IRT-OFI-0923-2024, notificado vía correo electrónico el día 07 de noviembre de 2024, en el cual se indicó la necesidad de contar con información técnica mínima para ubicar el inmueble y verificar la procedencia de las actuaciones correspondientes. Asimismo, dichas solicitudes ya fueron objeto de conocimiento por parte de la Sala Constitucional mediante expediente N.° 24-029619-0007-CO, recurso que fue resuelto por esa honorable Sala, teniéndose por acreditado que esta Administración sí había brindado respuesta formal. NOVENO: Sobre las solicitudes presentadas los días 28 de enero de 2025, 05 de febrero de 2025 y 02 de septiembre de 2025. Es cierto que la parte accionante presentó diversas gestiones administrativas los días 28 de enero de 2025, 05 de febrero de 2025 y 02 de septiembre de 2025, dirigidas tanto a esta Unidad como a la Presidencia Ejecutiva del Instituto de Desarrollo Rural, mediante las cuales reiteró sustancialmente los mismos planteamientos expuestos con anterioridad, relacionados con la solicitud de apertura urgente de un procedimiento administrativo ordinario a favor de la señora Nombre02, alegando su condición de persona adulta mayor, presunta poseedora de buena fe y la necesidad de una pronta atención institucional. En atención a dichas gestiones, esta Administración emitió el oficio INDER-GG-DRT-FTIRT-OFI-0615-2026 de fecha 25 de mayo de 2026, mediante el cual se brindó atención formal acumulada a los escritos supra citados, reiterándose expresamente que la gestión presentada por la señora Nombre02 no ha sido rechazada por esta Administración y que actualmente se encuentra en trámite dentro de las actividades desarrolladas en el marco del Plan Nacional de Recuperación de Territorios Indígenas (Plan RTI). Asimismo, mediante el citado oficio se reiteró que previamente esta Administración ya había brindado respuesta a las solicitudes planteadas mediante los oficios INDER-GG-DRT-FT-IRT-OFI-0923-2024 e INDER-GG-DRT-FT-IRT-OFI-1058- 2025, así como, que la gestión ya había sido objeto de conocimiento por parte de la Sala Constitucional dentro del expediente N.° 24-029619-0007-CO. Asimismo, se reiteró que la priorización de las ocupaciones a atender dentro del Plan RTI se desarrolla en coordinación con las Asociaciones de Desarrollo Integral Indígena, en su condición de gobiernos locales y representantes de los respectivos territorios indígenas, conforme al marco normativo aplicable y a los procesos de articulación y planificación territorial correspondientes. En consecuencia, no es cierto que exista abandono, negativa absoluta, desatención deliberada u omisión ilegítima atribuible al Instituto de Desarrollo Rural, por cuanto las gestiones señaladas por la parte accionante fueron formalmente atendidas mediante el oficio supra citado, manteniéndose actualmente el caso en trámite dentro del marco de ejecución del Plan RTI. DÉCIMO: Sobre la solicitud presentada el 06 de octubre de 2025 ante Presidencia Ejecutiva. Es cierto que en fecha 06 de octubre de 2025 —y no el 04 de octubre de 2025 como lo indica la parte accionante— el Lic. Nombre03 presentó ante la Presidencia Ejecutiva escrito mediante el cual solicitó que se ordenara la apertura urgente del procedimiento ordinario administrativo. Dicho escrito fue remitido a la Unidad de Información y Registro de Tierras el día 16 del mismo mes. En atención a esa gestión, esta Unidad emitió el oficio INDER-GG-DRT-FT-IRT-OFI-1058-2025 de fecha 20 de octubre de 2025, suscrito por el Ing. Pablo César Zamora Alfaro, mediante el cual se brindó respuesta formal a los planteamientos de la parte accionante. En dicho oficio se aclaró que, el INDER no se ha negado a iniciar procedimiento administrativo, sino que, la solicitud fue debidamente registrada y debe tramitarse conforme al orden de prioridad correspondiente dentro del Plan RTI. DÉCIMO PRIMERO: Sobre la afirmación de que el INDER “resuelve cuando quiere” o hace caso omiso a las gestiones. Se rechaza en los términos expuestos. No es cierto que, esta Administración haya hecho caso omiso a las solicitudes presentadas por la parte accionante. Las gestiones han sido recibidas, tramitadas, analizadas y respondidas dentro del marco de competencias institucionales. Lo que la parte accionante califica como inacción corresponde, en realidad, al cumplimiento de un procedimiento técnico, territorial y jurídico complejo, que no puede omitirse ni acelerarse de manera arbitraria sin afectar derechos colectivos de la comunidad indígena involucrada. DÉCIMO SEGUNDO: Sobre la priorización de ocupaciones dentro del Territorio Indígena de Rey Curré. Debe indicarse que, el Plan RTI ejecuta actuaciones en los veinticuatro territorios indígenas del país, por lo que la atención de ocupaciones debe realizarse conforme a planificación institucional, disponibilidad operativa y criterios de priorización territorial. La definición del orden de prioridad de las ocupaciones a atender dentro de cada territorio indígena corresponde a las Asociaciones de Desarrollo Integral Indígena, en su condición de gobiernos locales y representantes legales de las comunidades indígenas. Lo anterior encuentra fundamento en los artículos 4.1, 4.2, 6, 7.1 y 32 del Convenio 169 de la OIT, ratificado mediante Ley N.° 7316, el artículo 22 de la Ley sobre el Desarrollo de la Comunidad N.° 3859, el artículo 5 del Reglamento a la Ley Indígena N.° 6172 y el artículo 1 del Decreto Ejecutivo N.° 13568-C-G. En consecuencia, el INDER no puede alterar unilateralmente las prioridades territoriales definidas en coordinación con la Asociación de Desarrollo Integral Indígena correspondiente, pues ello implicaría desconocer el derecho de autodeterminación de los pueblos indígenas. DÉCIMO TERCERO: Sobre las coordinaciones y seguimientos realizados ante la Asociación de Desarrollo Integral Indígena de Rey Curré. Es cierto que, a partir de las gestiones realizadas por esta Administración para valorar la situación expuesta por la señora Nombre02, se desarrollaron diversos seguimientos y coordinaciones con la Asociación de Desarrollo Integral Indígena de Rey Curré, orientados a valorar la eventual priorización del caso dentro de los procesos de atención territorial del Plan RTI En ese sentido, mediante oficio INDER-GG-DRT-FT-IRT-OFI-0225-2026 del 2 de marzo de 2026, el Coordinador de Información y Registro de Tierras se dirigió formalmente a la Junta Directiva de la Asociación de Desarrollo Integral del Territorio Indígena de Rey Curré, solicitando que, por razones humanitarias y en atención a la condición de persona adulta mayor en estado de vulnerabilidad de la señora Nombre05 Figueroa, se valorara la posibilidad de otorgar un tratamiento excepcional y así incluir su caso dentro dela lista de prioridades de este Territorio. Los días 13 y 26 de marzo de 2026 se realizaron seguimientos ante la Asociación de Desarrollo Integral, reiterándose la condición de vulnerabilidad de la señora Nombre02 y la disposición institucional del Plan RTI de coordinar la atención prioritaria del caso, dentro de las posibilidades legales, operativas y territoriales correspondientes. Asimismo, en fecha 09 de abril de 2026, la Asociación de Desarrollo Integral Indígena de Rey Curré solicitó información adicional relacionada con el predio consultado, específicamente respecto al nombre del poseedor, ubicación, extensión y plano, con el fin de valorar técnicamente el grado de prioridad correspondiente. En atención a dicho requerimiento, mediante oficio INDER-GG-DRT-FT-IRT-OFI-0511- 2026 de fecha 29 de abril de 2026, esta Administración remitió a la Asociación de Desarrollo Integral toda la información disponible en los registros del Plan RTI relacionada con el caso de la señora Nombre02. Posteriormente, el día 15 de mayo de 2026, personal de esta Unidad sostuvo comunicación directa vía WhatsApp con el Presidente de la Asociación de Desarrollo Integral Indígena de Rey Curré, señor José Rigoberto Leiva, quien es presidente de la ADI, quien manifestó la anuencia de dicha Asociación para priorizar el caso de la señora Nombre02 y coordinar una visita al predio para completar la valoración correspondiente. De dicha conversación se dejó constancia escrita ese mismo día mediante correo electrónico dirigido a la Asociación de Desarrollo Integral, la cual confirmó recibido. Finalmente, el día 25 de mayo de 2026, con el visto bueno de la jefatura correspondiente, se trasladó la información al encargado de la cuadrilla de levantamiento topográfgico, solicitándose valorar la incorporación de una visita al predio dentro de la próxima gira de campo programada para el territorio. Lo anterior, evidencia que, el caso de la señora Nombre02 se encuentra actualmente en trámite y que esta Administración ha desarrollado actuaciones concretas, continuas y coordinadas orientadas a avanzar en la atención de la gestión planteada por la parte accionante. Asimismo, se acredita que, el caso se encuentra actualmente en trámite, que existen coordinaciones activas con la ADI Rey Curré y que se han realizado gestiones interinstitucionales para procurar acompañamiento social a la señora Nombre02. En consecuencia, considera esta representación que, existe carencia actual de objeto respecto del reclamo de falta de respuesta, o bien, que el recurso debe ser declarado sin lugar al no existir lesión actual atribuible al Instituto de Desarrollo Rural.”.\n\n5.- Por escrito incorporado al expediente el 1° de junio de 2026, el recurrente expone: “Previo a referirme a la contestación del INDER, se le hace ver a los señores Magistrados que este caso lleva más de 3 años, ya casi 4 años, solicitándole al INDER abrir el proceso administrativo para que la señora Nombre02 pueda demostrar su posesión de buena fe, Véase el oficio de fecha 04 de setiembre del 2024, que se le hizo llegar al señor Osvaldo Atavía Carballo, Director Ejecutivo del INDER, solicitándole abrir el proceso administrativo para que la señora Nombre02, pueda demostrar si tiene derecho a poseer su finca mediante prueba fehaciente o por el contrario si se determina que no diente derecho , Ergo, el INDER se ha negado abrir el proceso administrativo, rechazándole su derecho y violentándole el derecho a la defensa de la señora la señora Nombre05 Figueroa, de poder exponer sus argumento y de poder demostrar su posición de buena fe. La señora Nombre02, es una adulta mayor, de 92 años de edad, que requiere que le resuelvan ya, por su edad, pero que el INDER no quiere resolverle, seguro esperando que muera para archivar este caso y no resolver nada. Es importante indicar, que esperar casi 4 años para que resuelvan el caso de la señora Nombre02, es demasiado tiempo para esta adulta mayor, que lo que desea es paz y vivir tranquila, pero lamentablemente la señora Nombre06 no tiene paz porque vive la zozobra de que le pueden quitar su finca, en la que dejó toda su vida y esfuerzo y todo ello, porque el INDER no habré el proceso administrativo para demostrar si la señora Nombre05 tiene derecho o no a conservar su finca. Tómese en cuenta que la señora Nombre02, tiene 92 años de edad, que requiere que le resuelvan con urgencia. Respecto de la réplica a la contestación del INDER Primero: Sobre el hecho primero: Es evidente que en este caso hay una negativa absoluta de abrir el proceso administrativo, violentándose con ello, los derechos de la señora Nombre02. Es importante indicar, que llevamos ya casi 4 años solicitando abrir el proceso administrativo y el INDER le ha negado a la señora Nombre02, su derecho de demostrar con prueba que adquirió la propiedad de buena fe, pero lo más grave del asunto es que el INDER no tiene de fecha ni planes de abrir el proceso administrativo, esperando que la señora fallezca y archivar el proceso y así no resolver nada. Es importante indicar, que en este proceso no está pidiendo nada extraordinario ni tiene que ver nada con la gobernanza de los pueblos Indíquenas, lo único que se está pidiendo es que se le dé la posibilidad a la señora Nombre06 de demostrar que adquirió la propiedad de Buena fe…. es lo único que se pide? Segundo: Sobre el hecho segundo: Me opongo a lo indicado por el INDER, por cuanto no es coherente lo que indica, dado que por un lado dice: “que para determinar la buena fe es necesario tener más insumos” Pues eso es precisamente eso lo que se está solicitando al INDER, que se ordene abrir la apertura de un procedimiento administrativo, para demostrar mediante prueba documental y la prueba testimonial que efectivamente la señora Nombre02﻿, adquirió estas tierras desde el año 1976 y que las adquirió de buena fe, pero por otro lado el INDER se niega abrir el proceso administrativo. Además, véase que el título celebrado en papel oficial N° CED01 en la fecha del 09 de enero del año 1976, es un documento legal que se utilizaba para esa fecha, y en esa fecha era legal. Esta prueba es irrefutable, pues un documento de estos y escrito en esa fecha no es cualquier persona que lo tiene y este documento da DAR VALIDEZ A LOS TRASPASOS DE FINCAS, PORQUE EN ESA ÉPOCA NO HABÍA CASI NOTARIOS, con este documento es más que evidente la posesión. Tercero: Respecto del punto tercero: En cuanto al párrafo: “Además, se rechaza que el predio está en Rey Curre porque no se tiene una ubicación con coordenadas, las que aseguraría indicar donde se encuentra el predio”. ESTO NO ES DE RECIBO, que se indique; que no se abre el proceso administrativo porque no se presentó un croquis de ubicación, plano o coordenadas de la propiedad; es totalmente inaceptable, porqué para ello, se puede verificar la ubicación en contrato de compra-venta sin inscribir, celebrado en papel oficial N° CED01 en la fecha del 09 de enero del año 1976, el cual fue suscrito por la señora Nombre06, y la señora Nombre02 en el año 1976. Adicionalmente, NO ES DE RECIBO, que no se abra el proceso administrativo y que se atrase el proceso; cuando el Departamento denominado: Proyecto Territorio Indígenas (RTI), y el Área de Topografía del INDER, ya LEVANTARON EL PLANO de la finca y determinaron que la finca si está dentro de la reserva Indígena de Rey Curré. Cuarto: En cuanto al punto cuarto: Se le hace ver al INDER que con el proceso administrativo del caso de don Nombre04, quedó debidamente demostrado que cuando estás personas adquirieron estas tierras, no vivía y no había, en este sitio ninguna persona indígena, y estas tierras no estaban declaradas como tierras indígenas. Quinto y sexto: En cuanto el punto quinto y sexto. En efecto la señora Nombre02, está sufriendo de problemas de salud: ANGUSTIA, ESTRÉS, DEPRESIÓN, NO PODER DORMIR, Porque el INDER ya sacó a varios vecinos de estas tierras, incluyendo el don Nombre04, es por ello, que se pide se abra el proceso administrativo, para que mediante este proceso se defina de la señora Nombre06 tiene derecho a permanecer en su finca o no y así esta adulta mayor pueda tener tranquilidad. Es importante indicar, que el aumento de los problemas de salud que está sufriendo la señora Nombre02, son en mayor parte por culpa del INDER por no abrir el proceso administrativo y definir de una vez por todas la situación de la señora Nombre05. Séptimo: Sobre el punto séptimo: Señores Magistrados se ratifica que el INDER se ha negado abrir el proceso administrativo, este caso lleva más de 3 años, ya casi 4 años, solicitándole al INDER abrir el proceso administrativo para que la señora Nombre02 pueda demostrar su posesión de buena fe, Véase el oficio de fecha 04 de setiembre del 2024, que se le hizo llegar al señor Osvaldo Atavía Carballo, Director Ejecutivo del INDER, pero el INDER se ha negado abrir el proceso poniendo escusas para no abrir el proceso. Véase toda la prueba que se aportó al expediente. Octavo y noveno: Sobre el hecho octavo y noveno: Me opongo a lo indicado por el INDER. NO ES CIERTO que el INDER haya atendido nuestras petitorias, porque lo que pedimos es que se abra el proceso administrativo y el INDER se niega hacerlo, si fuera así como dice el INDER ya hubiera ordenado abrir el proceso administrativo y ya hubiera resuelto el caso de doña Nombre02, pero llevamos ya casi 4 años pidiendo al INDER abrir el proceso administrativo, pero el INDER lo que hace es poner escusas para no abrirlo, y mientras tanto esta adulta mayor sigue esperando por justicia. Décimo: Sobre el hecho décimo: Me opongo a lo indicado por el INDER, tal y como ya indiqué, estamos ante una violación de los derechos fundamentales, porque el INDER no quiere abrir al proceso administrativo para discutir el derecho de la señora Nombre02, que requiere que le resuelvan con urgencia. El oficio que el INDER menciona fue cuestionado, porque afecta gravemente la salud y la vida de mi representada. La falta de acción del INDER, y la tardanza en resolver este caso, agrava la salud de mi representada, que está toda estresada porque la van a desalojar, como ya se hizo con la finca que está a la par de la suya y que era del señor Nombre04, en ese orden, por su puesto, que le compete a la Sala Constitucional por el estado tan sensible de salud y por la edad de mi representada, y no a la vía Contenciosa, dado que duraría años y no se resolvería este caso, y mientras tanto seguiría la violación de los derechos a mí representada, hasta acabar con su vida. Importante indicar, que, a la edad de mi representada, ella tiene derecho a vivir una vida tranquila y sin problemas, y la situación de estas tierras la ESTÁ LLEVANDO LENTAMENTE A LA MUERTE, POQUE EL INDER SOLO DA RESPUESTAS PARA SALIR DEL PASO, PERO NO RESUELVE NADA EN CONCRETO. Décimo primero: Sobre el hecho décimo primero: Me opongo a lo indicado por el INDER. Claro que el INDER resuelve cuando quiere y en este caso lleva casi 4 años y aún no resuelve dada. Es un sinsentido, que el INDER indiqué que para demostrar la buena fe y la posesión de la señora Nombre02, se tiene que abrir el proceso administrativo, pero por otro lado, se niega abrir el proceso, ello, pese a que mi representada le ha solicitado en muchas ocasiones abrir el proceso administrativo y pesé a que ya hicieron los PLANOS de la finca, y aun así el INDER se niega abrir el proceso administrativo. Además, Nuevamente se señala que este caso, si es compete a la Sala Constitucional, y es aquí donde debe resolverse y ordenarse abrir el proceso administrativo y que no se le siga violentado los derechos fundamentales a la señora Nombre02, que ya está muy estresada con esta situación y que su vida se está desvaneciendo porque el INDER no resuelve en concreto su caso. De no ordenarse que se abra el proceso, solo continuaría los atropellos para mi representada y los problemas en la salud y el deterioro en la vida de mí representada, hasta acabar con su vida, por los problemas de estas tierras, que es merecido que las indemnice y de las devuelvan a las personas indígenas. Décimo segundo: Sobre el hecho décimo segundo: En este punto es importante indicar, que con abrir un proceso administrativo para ver si una persona tiene derecho o no, eso no quiere decir, que se altere unilateralmente las prioridades territoriales indígenas. Lo indicado por el INDER es una verdadera falacia, dado que con abrir un proceso no se va alterar de la firma de trabajar ni la metodología que utilizan el INDER ni las reservar indígenas. Por tanto, lo indicado por el INDER es una verdadera mentira dado que con abrir un proceso no se va alterar nada. Décimo tercero: Sobre el hecho décimo tercero: Se le hace ver a los señores Magistrado que este caso se milita únicamente a que el INDER ordene abrir el proceso administrativo para que la señora Nombre02 pueda ser escuchada dentro del proceso. Aquí no se está pidiendo ninguna ayuda ni nada y por lo tanto que metan a la señora en la lista de vulnerabilidad para que sea atendida por el IMAS, esta demás porque eso no es lo que se está pidiendo, lo que realmente se necesita para que la señora Nombre02 este bien es que se ordene abrir el proceso administrativo. Además, es realmente decepcionante que el INDER en casi 4 años no ha hecho nada en este caso y no se ha preocupado por resolver este caso y no fue hasta que la Sala le dio traslado este recurso de amparo que el INDER está pidiendo Por otra parte, se le hace ver a los señores Magistrados, que no es solo dar respuesta y contestar cualquier cosa para salir del paso y decirle a la Sala que ya contestó y que le está dando seguimiento; pues no se trata de eso, a la edad de 92 años que tiene la señora Nombre02, cédula CED02, requiere de una solución concreta a su problema. Requiere que el INDER ordene abrir el proceso administrativo, para que la señora Nombre02, pueda presentar dentro del proceso, toda la prueba documental y la prueba testimonial (todos los testigos que tiene, que pueden dar fe de la posesión de estas tierras y que la adquirió de buena fe, desde el año 1976). Si el INDER no abre el proceso administrativo, obviamente mi representada no va a poder demostrar su posesión y que la finca la adquirido de buena fe y sus derechos fundamentales a la edad de 92 años, se verían sumamente violentados al no tener una respuesta pronta y con deterioro de su salud y su vida, que a su edad es sumamente sensible.”.\n\n6.- Por constancia de 1° de junio de 2026, Mariane Castro Villalobos y Alejandro Cascante Herrera, por su orden, secretaria y técnico judicial, ambos de la Sala, consignan: “revisado, a las diez horas cincuenta y tres minutos del uno de junio de dos mil veintiséis, en el SISTEMA COSTARRICENSE DE GESTIÓN DE DESPACHOS JUDICIALES el CONTROL DE DOCUMENTOS RECIBIDOS Y ESTE EXPEDIENTE, no apareció que del 25/05/2026 al 27/05/2026, el DIRECTOR EJECUTIVO DEL INSTITUTO DE DESARROLLO RURAL (INDER) haya presentado escrito o documento alguno, a fin de rendir el informe que se le solicitó en la resolución dictada a las diez horas uno minutos del veinte de mayo de dos mil veintiséis, en el expediente número 26-015288- 0007-CO que es RECURSO DE AMPARO promovido por Nombre03.”.\n\n7.- Por escrito incorporado al expediente el 4 de junio de 2026, Ricardo José Quesada Salas, presidente ejecutivo del INDER, manifiesta: “PRIMERO: Que mi representada se adhiere a la respuesta brindada por el funcionario Ing. Pablo César Zamora Alfaro, Coordinador de la Unidad de Información y Registro de Tierras (IRT) del Instituto de Desarrollo Rural (INDER). Lo anterior es visible de imagen 145 a 153, de conformidad con el Expediente del amparo n° 26-015288-0007-CO. SEGUNDO: Se reitera que mi representada rechaza los hechos expuestos en el presente recurso de amparo en cuanto se interprete que existió abandono, negativa absoluta, desatención deliberada o inacción institucional respecto de las gestiones presentadas por la parte accionante, toda vez que esta Administración ha desarrollado actuaciones continuas relacionadas con la situación planteada por la señora Nombre02, dentro del marco de competencias institucionales y conforme a las etapas técnicas, administrativas y territoriales propias de la ejecución del Plan Nacional de Recuperación de Territorios Indígenas (Plan RTI). Asimismo, se rechaza cualquier interpretación tendiente a afirmar que el Instituto de Desarrollo Rural haya actuado de manera arbitraria, intempestiva o contraria a los derechos fundamentales de la parte accionante, por cuanto las actuaciones desarrolladas responden al cumplimiento del principio de legalidad y al respeto de los derechos colectivos de autodeterminación y gobernanza territorial reconocidos a los pueblos indígenas mediante normativa nacional e internacional vinculante para el Estado costarricense.”.\n\n8.- Por escrito incorporado al expediente el 5 de agosto de 2026, el recurrente expone: “Primero: Señores Magistrados, no me voy a referir a los argumentos esbozados, por el señor RICARDO JOSE QUESADA SALAS, actual PRESIDENTE EJECUTIVO del INSTITUTO DE DESARROLLO RURAL, porque es obvios que sus argumentos no tienen justificación alguna, carecen de sustento legal y son violatorios de los derechos fundamentales de la señora Nombre02, que es una adulta mayor. Como ya se explicó en este proceso, la señora Nombre02, lleva casi cuatro años (4 años), soltándole al INDER, que por favor ordene abrir el proceso administrativo para demostrar que adquirió su propiedad de buena fe; a lo que el INDER se ha negado hacerlo. Lo que esboza el INDER, es que el proceso está en trámite, pero ya llevamos casi cuatro años (4 años), y el proceso sigue en trámite, por lo que, esta tardanza no es de recibo, más y cuando estamos ante una adulta mayor que requiere que le resuelvan con prontitud; ergo, al ritmo que el INDER planea resolver este caso, de esta adulta mayor, se tardaría más de 20 años y así no resuelven este caso. Es sorprendente, que la señora Nombre02, tenga de 92 años de edad, y que el INDER no quiera resolverle, fijo están esperando que esta adulta mayor muera para archivar este caso y no resolver nada. Es menester indicar, que esperar casi 4 años para que resuelvan este caso y aún no se sabe si van abrir el proceso administrativo o no, es demasiado tiempo. Importante indicar que está adulta mayor, que lo que desea es que le resuelvan para tener paz y vivir tranquila. Es de intereses informarles a los señores Magistrados que la señora Nombre02, no tiene paz porque vive la zozobra de que le pueden quitar su finca, en la que dejó toda su vida y esfuerzo y todo ello, porque el INDER no habré el proceso administrativo para demostrar si la señora Nombre05 tiene derecho o no a conservar su finca.”.\n\n9.- En los procedimientos seguidos se han observado las prescripciones legales.\n\n Redacta el Magistrado Rueda Leal; y,\n\nConsiderando:\n\n \n\nI.- CUESTIÓN PREVIA. En vista de que el director ejecutivo del INDER omitió rendir el informe dentro del plazo fijado por este Tribunal en la resolución de curso del sub lite, se procede a resolver el recurso de acuerdo con el artículo 45 de la Ley de la Jurisdicción Constitucional y tomando en consideración los elementos probatorios que constan en los autos.\n\nII.-OBJETO DEL RECURSO. El accionante expone que su representada es una adulta mayor que ha ejercicio una posesión pacífica, notoria e ininterrumpida de una propiedad que adquirió de buena fe antes de la declaratoria de las tierras indígenas de la reserva Rey Curré. Menciona que, en el 2003, la CONAI emitió el dictamen nro. C-395-2003 en el cual dispuso que, conforme al artículo 5 de la ley Indígena, el INDER debe reubicar a los propietarios y poseedores de propiedades que se encuentre dentro territorios indígenas. Cuestiona que, a pesar de lo anterior, el INDER no ha coordinado lo pertinente con la CONAI ni ha hecho algo por atender la situación de la tutelada. En tal sentido, señala que en múltiples ocasiones le ha solicitado al INDER la apertura del respectivo procedimiento administrativo para que se defina si la amparada tiene derecho a disponer de su finca; empero, esto no se ha efectuado. Comenta que tales gestiones fueron planteadas el 4 de septiembre y el 7 de octubre de 2024; así como el 28 de enero, 5 de febrero, 2, de septiembre, 4 de septiembre, y 4 de octubre, todos de 2025. Solicita que se le ordene a la autoridad accionada la apertura y conclusión del procedimiento administrativo correspondiente. \n\nIII.-HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque la autoridad recurrida haya omitido referirse a ellos, según lo prevenido en el auto inicial:\n\na) La tutelada planteó gestiones ante el INDER para solicitar la apertura de un procedimiento administrativo para el “pago de derechos de posesión” de un inmueble en las siguientes fechas: 4 de septiembre y 7 de octubre de 2024; 28 de enero, 5 de febrero, 2 de septiembre, 4 de septiembre, y 4 de octubre, todos de 2025. (Hecho incontrovertido).\n\nb) La autoridad accionada fue notificada de la resolución de curso de este proceso el 22 de mayo de 2026. (Acta de notificación agregada al expediente).\n\nc) Mediante el oficio nro. INDER-GG-DRT-FT-IRT-OFI-0615-2026 de 25 de mayo de 2026, comunicado al accionante, la autoridad recurrida indicó: “Primeramente, mediante oficio INDER-GG-DRT-FT-IRT-OFI-0923-2024, notificado vía correo electrónico el día 07 de noviembre de 2024, esta unidad administrativa brindó respuesta a las solicitudes presentadas los días 04 de septiembre de 2024 y 07 de octubre de 2024, relacionadas con la apertura de procedimiento administrativo y sobre la solicitud de indemnización que realiza sobre los derechos de posesión de la señora Nombre02. Asimismo, posteriormente mediante oficio INDER-GG-DRT-FT-IRT-OFI-1058- 2025 de fecha 20 de octubre de 2025, se atendió nuevamente la solicitud reiterada presentada ante la Presidencia Ejecutiva del INDER, relacionada con la situación expuesta por su representada. Adicionalmente, resulta importante indicar que, la gestión presentada por su representada ya fue objeto de conocimiento por parte de la Sala Constitucional mediante el expediente N.° 24-029619-0007-CO, interpuesto contra el Instituto de Desarrollo Rural (INDER), recurso respecto del cual la Sala Constitucional emitió resolución, teniéndose por acreditado que esta Administración brindó respuesta a las solicitudes planteadas en ese momento. En ese sentido, se aclara que, la gestión presentada por su representada no ha sido rechazada por esta Administración y actualmente se encuentra en trámite dentro de las actividades desarrolladas en el marco del Plan Nacional de Recuperación de Territorios Indígenas (Plan RTI). Sobre el particular, resulta importante indicar que, el Plan RTI ejecuta sus actividades en los veinticuatro territorios indígenas del país, desarrollando distintas etapas técnicas, sociales, legales y administrativas para la atención de ocupaciones dentro de territorios indígenas. Dentro de dichas actividades se contempla la confección de expedientes preliminares, censos, levantamientos topográficos, análisis registrales y, eventualmente, la apertura de procedimientos administrativos ordinarios, cuando corresponda conforme a la planificación institucional y verificación de requisitos técnicos y legales. Asimismo, debe indicarse que, la priorización de las ocupaciones que serán atendidas dentro del Plan RTI se realiza en coordinación con las Asociaciones de Desarrollo Integral Indígena (ADI), en su condición de gobiernos locales y representantes de los respectivos territorios indígenas, conforme al marco normativo aplicable y a los procesos de articulación y planificación que se desarrollan para la ejecución del Plan RTI. En razón de lo anterior, actualmente esta Administración se encuentra realizando coordinaciones y articulaciones con la Asociación de Desarrollo Integral correspondiente, a efectos de valorar e incluir la ocupación consultada dentro de los procesos de atención y planificación que se desarrollan en el territorio indígena respectivo, conforme al orden de trabajo, disponibilidad operativa y criterios de priorización aplicables. Por tanto, se reitera que, la solicitud presentada por su representada se encuentra actualmente en trámite y será atendida conforme a los procedimientos técnicos y administrativos correspondientes dentro del marco de ejecución del Plan RTI.”. (Prueba documental).\n\nIV.- SOBRE EL CASO CONCRETO. En el sub lite, el accionante expone que su representada es una adulta mayor que ha ejercicio una posesión pacífica, notoria e ininterrumpida de una propiedad que adquirió de buena fe antes de la declaratoria de las tierras indígenas de la reserva Rey Curré. Menciona que, en el 2003, la CONAI emitió el dictamen nro. C-395-2003 en el cual dispuso que, conforme al artículo 5 de la ley Indígena, el INDER debe reubicar a los propietarios y poseedores de propiedades que se encuentre dentro territorios indígenas. Cuestiona que, a pesar de lo anterior, el INDER no ha coordinado lo pertinente con la CONAI ni ha hecho algo por atender la situación de la tutelada. En tal sentido, señala que en múltiples ocasiones le ha solicitado al INDER la apertura del respectivo procedimiento administrativo para que se defina si la amparada tiene derecho a disponer de su finca; empero, esto no se ha efectuado. Comenta que tales gestiones fueron planteadas el 4 de septiembre y el 7 de octubre de 2024; así como el 28 de enero, 5 de febrero, 2, de septiembre, 4 de septiembre, y 4 de octubre, todos de 2025. Solicita que se le ordene a la autoridad accionada la apertura y conclusión del procedimiento administrativo correspondiente. \n\nDel estudio de los autos se tiene por demostrado que, la tutelada planteó gestiones ante el INDER para solicitar la apertura de un procedimiento administrativo para el “pago de derechos de posesión” de un inmueble en las siguientes fechas: 4 de septiembre y 7 de octubre de 2024; 28 de enero, 5 de febrero, 2 de septiembre, 4 de septiembre, y 4 de octubre, todos de 2025. La autoridad accionada fue notificada de la resolución de curso de este proceso el 22 de mayo de 2026. Mediante el oficio nro. INDER-GG-DRT-FT-IRT-OFI-0615-2026 de 25 de mayo de 2026, comunicado al accionante, la autoridad recurrida indicó: “Primeramente, mediante oficio INDER-GG-DRT-FT-IRT-OFI-0923-2024, notificado vía correo electrónico el día 07 de noviembre de 2024, esta unidad administrativa brindó respuesta a las solicitudes presentadas los días 04 de septiembre de 2024 y 07 de octubre de 2024, relacionadas con la apertura de procedimiento administrativo y sobre la solicitud de indemnización que realiza sobre los derechos de posesión de la señora Nombre02. Asimismo, posteriormente mediante oficio INDER-GG-DRT-FT-IRT-OFI-1058- 2025 de fecha 20 de octubre de 2025, se atendió nuevamente la solicitud reiterada presentada ante la Presidencia Ejecutiva del INDER, relacionada con la situación expuesta por su representada. Adicionalmente, resulta importante indicar que, la gestión presentada por su representada ya fue objeto de conocimiento por parte de la Sala Constitucional mediante el expediente N.° 24-029619-0007-CO, interpuesto contra el Instituto de Desarrollo Rural (INDER), recurso respecto del cual la Sala Constitucional emitió resolución, teniéndose por acreditado que esta Administración brindó respuesta a las solicitudes planteadas en ese momento. Por tanto, se reitera que, la solicitud presentada por su representada se encuentra actualmente en trámite y será atendida conforme a los procedimientos técnicos y administrativos correspondientes dentro del marco de ejecución del Plan RTI.”. \n\nSobre el particular, interesa resaltar que esta Sala ya había resuelto un reclamo análogo planteado por la amparada. En ese sentido, en la sentencia nro. 2024036996 de las 9:30 horas de 13 de diciembre de 2024, esta Cámara resolvió: \n\n“I.- OBJETO DEL RECURSO. La persona adulta mayor que recurre acota que el 4 de setiembre de 2024, formuló una gestión ante el Instituto de Desarrollo Rural, requiriendo la apertura del procedimiento ordinario administrativo para el pago de los derechos de posesión que tiene sobre una finca que se ubica en el territorio indígena de Rey Curré, pero no ha obtenido respuesta alguna, pese a que, el pasado 7 de octubre de este mismo año, reiteró su gestión. Afirma que esa omisión vulnera sus derechos fundamentales.\n\nII.- HECHOS PROBADOS. De relevancia para la decisión del presente amparo se tienen por demostrados los siguientes: 1) El 4 de septiembre de 2024, la persona adulta mayor amparada, requirió la apertura de un procedimiento administrativo para el pago de los derechos de posesión que dice tener sobre un terreno que, según afirma, se ubica dentro del territorio indígena de Rey Curré (copia adjunta al libelo de interposición). 2) El 7 de octubre de 2024, la recurrente reiteró esa gestión (copia adjunta al libelo de interposición). 3) Mediante oficio INDER-GG-DRT-FT-IRT-OFI-923-2024 de 30 de octubre de 2024, se previno al apoderado de la amparada que, de previo a iniciar cualquier procedimiento administrativo ordinario, aportara la documentación correspondiente y contacto para notificaciones. Además, se indicó que, es necesario coordinar el censo y el levantamiento topográfico de la propiedad que ocupa, siempre y cuando se haya verificado y ratificado que en efecto se encuentra dentro de territorio indígena (copia adjunta al informe). 4) El 7 de noviembre de 2024, se notificó ese oficio a la amparada, a través del correo de su apoderado ...01 (informe rendido bajo juramento). 5) Por memorial presentado el 11 de noviembre de 2024, el recurrente aportó lo prevenido (copia adjunta al informe) 6) El 29 de noviembre de 2024, se notificó el auto de traslado a la autoridad recurrida (actas de notificación visibles en el Historial de Acontecimientos del expediente Electrónico). \n\nIII.- CASO CONCRETO. En la especie, la persona adulta mayor que recurre acota que el 4 de setiembre de 2024, formuló una gestión ante el Instituto de Desarrollo Rural, requiriendo la apertura del procedimiento ordinario administrativo para el pago de los derechos de posesión que tiene sobre una finca que se ubica en el territorio indígena de Rey Curré, pero no ha obtenido respuesta alguna, pese a que, el pasado 7 de octubre de este mismo año, reiteró su gestión. Afirma que esa omisión vulnera sus derechos fundamentales.\n\nAhora, atinente al reclamo acusado, cabe indicar que el caso de Nombre01 no se encuentra dentro de las excepciones contempladas al efecto, por lo que no le compete a la Sala pronunciarse al respecto. En ese sentido, se aclara que, aunque a partir del voto número 2008-02545 de las 8:55 horas de 22 de febrero de 2008, esta Sala ha remitido a la jurisdicción contencioso administrativa — con algunas excepciones — aquellos asuntos en los que se discute si la autoridad pública ha cumplido o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, a fin de resolver por acto final un procedimiento administrativo — incoado de oficio o a instancia de parte— o conocer de los recursos administrativos procedentes; en el caso en estudio, lo cierto es que la gestión no se relaciona directamente con la condición de la amparada de adulta mayor, pues lo que se procura es el pago por derechos de posesión. Así las cosas, descarta la Sala que exista el agravio reclamado. Bajo esta inteligencia, se impone desestimar el recurso, como en efecto se dispone.\n\nFinalmente, la discusión que se formula con respecto a la veracidad de lo informado es ajena a esta vía especializada. Ocurra la parte actora, si a bien lo tiene, a las vías de legalidad, a formulas las quejas o denuncias que estime pertinentes.”.\n\n \n\nAsí las cosas, véase que este Tribunal ya se había pronunciado sobre la mora atinente a las gestiones de 4 de septiembre y 7 de octubre de 2024, desestimando el recurso según los razonamientos expuestos. Ergo, en relación con estas gestiones en particular deberá la amparada estarse a lo resuelto en la sentencia nro. 2024036996 de las 9:30 horas de 13 de diciembre de 2024.\n\nV.- Ahora, si bien en el sub iudice el accionado alega que, luego del 4 de septiembre y 7 de octubre de 2024, la tutelada formuló nuevas gestiones en el mismo sentido y acusa que la autoridad accionada tampoco ha procedido según lo solicitado, cabe reiterar lo explicado en el precedente citado ut supra, en cuanto a que la mora acusada en la especie no se encuentra dentro de los supuestos de excepción establecidos por esta Cámara en lo atinente a una justicia pronta y cumplida (artículo 41 de la Constitución Política), razón por la cual el recurso resulta inadmisible en esta sede constitucional, y deberá ser objeto de discusión ante la jurisdicción contencioso-administrativa, de conformidad con las siguientes consideraciones.\n\nVI.- NUEVA JUSTICIA ADMINISTRATIVA, MECANISMO CÉLERE Y CUMPLIDO PARA LA PROTECCIÓN DE SITUACIONES JURÍDICAS SUSTANCIALES DE LOS ADMINISTRADOS. La Sala Constitucional, de su fundación, ha utilizado criterios amplios de admisibilidad en vista de la ausencia de cauces procesales expeditos y céleres para la protección de las situaciones jurídicas sustanciales que tienen asidero en el ordenamiento jurídico infra-constitucional o parámetro de legalidad, que guardan conexión indirecta con los derechos fundamentales y el Derecho de la Constitución. Sobre el particular, no debe perderse de perspectiva que la Constitución por su supremacía, súper-legalidad y eficacia directa e inmediata da fundamento indirecto a cualquier situación jurídica sustancial imaginable de las personas. No obstante, bajo una mejor ponderación y ante la promulgación del Código Procesal Contencioso-Administrativo (Ley No. 8508 de 24 de abril de 2006) y su entrada en vigencia a partir del 1° de enero de 2008, ha quedado patente que ahora los justiciables cuentan con una jurisdicción contencioso-administrativa plenaria y universal, sumamente expedita y célere por los diversos mecanismos procesales que incorpora al ordenamiento jurídico esa legislación, tales como el acortamiento de los plazos para realizar los diversos actos procesales, la amplitud de la legitimación, las medidas cautelares, el numerus apertus de las pretensiones deducibles, la oralidad –y sus subprincipios concentración, inmediación y celeridad-, la única instancia con recurso de apelación en situaciones expresamente tasadas, la conciliación intra-procesal, el proceso unificado, el proceso de trámite preferente o “amparo de legalidad”, los procesos de puro derecho, las nuevas medidas de ejecución (multas coercitivas, ejecución sustitutiva o comisarial, embargo de bienes del dominio fiscal y algunos del dominio público), los amplios poderes del cuerpo de jueces de ejecución, la extensión y adaptación de los efectos de la jurisprudencia a terceros y la flexibilidad del recurso de casación. Todos esos institutos procesales novedosos tienen por fin y propósito manifiesto alcanzar la economía procesal, la celeridad, la prontitud y la protección efectiva o cumplida de las situaciones jurídicas sustanciales de los administrados, todo con garantía de derechos fundamentales básicos como el debido proceso, la defensa y el contradictorio. En suma, la nueva jurisdicción contencioso-administrativa es un cauce idóneo, por sus nuevas características de simplicidad, celeridad y prontitud para el amparo y protección efectiva de las situaciones jurídicas sustanciales de los administrados en las que se requiera recabar prueba o definir algunas cuestiones de legalidad ordinaria.\n\nVII.- VERIFICACIÓN DE LOS PLAZOS PAUTADOS POR LEY PARA RESOLVER LOS PROCEDIMIENTOS ADMINISTRATIVOS: CUESTIÓN EVIDENTE DE LEGALIDAD ORDINARIA. Es evidente que determinar si la administración pública cumple o no los plazos pautados por la Ley General de la Administración Pública (artículos 261 y 325) o las leyes sectoriales para los procedimientos administrativos especiales, para resolver por acto final un procedimiento administrativo –incoado de oficio o a instancia de parte- o conocer de los recursos administrativos procedentes, es una evidente cuestión de legalidad ordinaria que, en adelante, puede ser discutida y resuelta ante la jurisdicción contencioso-administrativa con la aplicación de los principios que nutren la jurisdicción constitucional, tales como los de la legitimación vicaria, la posibilidad de la defensa material –esto es de comparecer sin patrocinio letrado- y de gratuidad para la recurrente. Consecuentemente, se impone el rechazo de plano e indicarle a la parte gestionante que si a bien lo tiene puede acudir a la jurisdicción contencioso-administrativa.\n\nVIII.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, éstos deberán ser retirados del despacho en un plazo máximo de 30 días hábiles contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en sesión N°27-11 del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial número 19 del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la sesión N°43-12 celebrada el 3 de mayo del 2012, artículo LXXXI.\n\nPor tanto:\n\n \n\nEn cuanto a la mora acusada respecto de las gestiones de 4 de septiembre y 7 de octubre de 2024, estese a lo resuelto en la sentencia nro. 2024036996 de las 9:30 horas de 13 de diciembre de 2024. San José, at 9:30 a.m. on 13 August 2026.\n\nAmparo proceeding filed in case no. 26-015288-0007-CO by Nombre03, identity card CED03, on behalf of Nombre02, identity card CED04, against the RURAL DEVELOPMENT INSTITUTE (INDER).\n\nBackground:\n\n1.—By a filing entered into the case record on 29 April 2026, the amparo applicant files an amparo application. He states that the protected person is a 92-year-old older adult who lives in Paraíso de San Rafael de Palmar Norte, Puntarenas. He alleges that when his client moved to that place, the area had not been declared Indigenous territory, and that in 1976, after exercising peaceful, open, and uninterrupted possession, she acquired in good faith and as owner the property where she lives. He explains that the protected person acquired the property through an unregistered sale contract executed on official paper no. CED01. He indicates that after she had possessed the property for so long, the Government of the Republic declared those lands Indigenous territory and established that the property of his client is located within the Rey Curré Indigenous Reserve. He argues that, following that declaration, INDER and the Rey Curré Indigenous Integral Development Association told the protected person that she must leave the property because she is a non-Indigenous white person. He explains that, as a result, his client cannot dispose of the property, is limited in obtaining any benefit from it, and also cannot sell it, without taking into account that when the protected person acquired it, there was no declaration of Indigenous territory. He mentions that in 2003, CONAI issued opinion no. C-395-2003, which provided that, pursuant to Article 5 of the Indigenous Law, INDER must relocate owners and possessors of properties located within Indigenous territories. He challenges the fact that, despite the foregoing, INDER has not coordinated what is necessary with CONAI or done anything to address his client’s problem, causing her great harm and affecting her health. He states that, on multiple occasions, a request has been made to INDER to open an administrative proceeding to address the protected person’s problem and determine whether she has the right to dispose of her property. In this regard, he gives the dates and requests submitted, as follows: “1) On 4 September 2024, a formal letter was submitted to INDER Executive Director Osvaldo Artavia Caballo at the Central Offices of the Rural Development Institute (INDER), requesting that an administrative proceeding be opened because Ms. Nombre02 is very stressed and distressed and has suffered many health problems because INDER has not determined her right to possess her property. To date, INDER has not given a concrete response or opened the administrative proceeding to resolve Ms. Nombre02’s problem. 2) On 7 October 2024, a formal letter was submitted to INDER Executive Director Osvaldo Artavia Caballo at the Central Offices of the Rural Development Institute (INDER), requesting that an administrative proceeding be opened because Ms. Nombre02 is very unwell, stressed, and distressed and has suffered many health problems because INDER has not determined her right to possess her property. To date, INDER has not given a concrete response or opened the administrative proceeding to resolve Ms. Nombre02’s problem. 3) On 5 February 2025, a formal letter was submitted to INDER Executive Director Juan Ignacio Rodríguez Araya at the Central Offices of the Rural Development Institute (INDER), requesting that an administrative proceeding be opened to determine and resolve Ms. Nombre02’s right to possession and her problem concerning her property. To date, INDER has not given a concrete response or opened the administrative proceeding to resolve Ms. Nombre02’s problem. 4) On 28 January 2025, a formal letter was submitted to Licda. Daniela Artavia Guerrero, INDER’s Attorney for Land Information and Registration, and to Engineer Pablo Zamora Alfaro, INDER’s Coordinator of Land Information and Registration, at the Central Offices of INDER, requesting that an administrative proceeding be opened because Ms. Nombre02 is very stressed and distressed and has suffered many health problems because of this situation, since her right to possess her property has not been determined. To date, INDER has not given a concrete response or opened the administrative proceeding to resolve Ms. Nombre02’s problem. 5) On 2 September 2025, a formal letter was sent to Licda. Daniela Artavia Guerrero, INDER’s Attorney for Land Information and Registration, and to Engineer Pablo Zamora Alfaro, INDER’s Coordinator of Land Information and Registration, at the Central Offices of INDER, requesting that an administrative proceeding be opened because Ms. Nombre02 is very stressed and distressed and has suffered many health problems because of this situation, since her right to possess her property has not been determined. To date, INDER has not given a concrete response or opened the administrative proceeding to resolve Ms. Nombre02’s problem. 6) On 4 September 2025, a formal letter was sent to INDER Executive Director Ricardo Quesada Salas at the Central Offices of the Rural Development Institute (INDER), requesting that an administrative proceeding be opened because Ms. Nombre02 is very stressed and distressed since her right to possess her property has not been determined. To date, INDER has not given a concrete response or opened the administrative proceeding to resolve Ms. Nombre02’s problem. 7) On 4 October 2025, a formal letter was submitted to Licda. Daniela Artavia Guerrero, INDER’s Attorney for Land Information and Registration, and to Engineer Pablo Zamora Alfaro, INDER’s Coordinator of Land Information and Registration, at the Central Offices of INDER, requesting that an administrative proceeding be opened because Ms. Nombre02 is very stressed and distressed and has suffered many health problems because of this situation, since her right to possess her property has not been determined.” He claims that, as of the filing of this amparo application, that authority has issued no decision and has not opened the requested proceeding so that the affected person may prove her right to possess the property. He considers that the foregoing violates his client’s fundamental rights. He requests that the amparo application be granted.\n\n2.—By resolution issued at 10:01 a.m. on 20 May 2026, the Presidency of the Chamber admitted the proceeding and requested a report from INDER’s executive director and Coordinator of Land Information and Registration.\n\n3.—By a filing entered into the case record on 26 May 2026, the amparo applicant states: “Justices, it is unacceptable that INDER deigns to answer my filings and emails only because your Authority ordered that the present amparo application be served. This is inconceivable. It is important to take into account that I have sent INDER seven requests asking it to open Ms. Nombre02’s administrative proceeding, pointing out the increase in her health problems: DISTRESS, STRESS, DEPRESSION, INABILITY TO SLEEP, which this older adult suffers because INDER has refused to open the administrative proceeding and, consequently, SHE DOES NOT KNOW WHETHER SHE MUST REMAIN ON HER PROPERTY or leave, or whether INDER will remove her from her property, located in the Rey Curré Reserve, at any moment, in order to give her property to Indigenous people; she has worked that property for so many years, but INDER does not care about that, nor does it care about the health problems Ms. Nombre02 suffers because of the distress that they will remove her from the property she has worked so hard for. Justices, it is significant to state that we have been in this proceeding for almost four years, asking INDER to open the administrative proceeding, and I have spent more than three years submitting formal letters and emails asking for it to be opened, but INDER does not even deign to answer my emails and filings or provide a concrete response. Nevertheless, upon service of this amparo application yesterday, 25 May 2026, INDER, through Engineer Pablo C. Zamora Alfaro, Coordinator of Land Information and Registration, in letter INDER-GG-DRT-FT-IRT-OFI-0615-2026 dated 25 May 2026, deigned to answer my requests, with a negative result, since it again refuses to open the administrative proceeding, claiming that my client’s request is being processed and will be addressed in accordance with the corresponding technical and administrative procedures under the framework for implementing Plan RTI, as stated: ‘Therefore, we reiterate that the request submitted by your client is currently being processed and will be addressed in accordance with the corresponding technical and administrative procedures under the framework for implementing Plan RTI.’ This response is unacceptable, first because Ms. Nombre02 is a 92-year-old older adult who deserves respect for all the work she has done on this property throughout her life, and second because this proceeding has gone on for almost four years and nothing has been resolved, which is a true abuse against this older adult. What they do at INDER is pass the buck from one Department to another so as to resolve nothing concrete, as letter INDER-GG-DRT-FT-IRT-OFI-0615-2026 shows, and meanwhile Ms. Nombre02 is the one most harmed because nothing is resolved about her situation. We believe INDER intends to wait for Ms. Nombre02 to die so that it will not process her case or open any administrative proceeding, since one can think of no other explanation: we have spent almost four years asking for the administrative proceeding to be opened, and what we receive from INDER are negative responses, saying it will not open any proceeding and leaving Ms. Nombre02 without the right to know whether she has the right to remain on her property. INDER’s attitude is mean-spirited, all the more so when Ms. Nombre02 has given so much to this society through her work and effort, moving when she was young from San José to the Southern Zone, Osa—a real challenge at the time—working the land with her family, starting to build a home, and watching her family grow. All this deserves to be rewarded, and that reward is at least for an order to open the administrative proceeding so that Ms. Nombre02 can at least, if she dies tomorrow, leave in peace knowing that her problem with this property has been resolved. It is important to state that, out of respect for Ms. Nombre02 and for the work she has done on this property, and because she was one of the first people to move from San José to the Southern Zone, Osa, and one of the first people to work this property when no Indigenous people lived there—in fact, hardly anyone lived on those properties—the least INDER must do is open the administrative proceeding so that Ms. Nombre02 can show whether or not she has the right to remain on these lands. Denying her that right would be like taking away part of her life, since she has lived on and possessed this property all her life. It is important to state that letter INDER-GG-DRT-FT-IRT-OFI-0615-2026 actually amounts to disrespect toward Ms. Nombre02: telling her that her request is being processed when almost four years have passed without anything being resolved for her is a real nightmare and a lack of respect toward Ms. Nombre02, as well as a true violation of her fundamental rights to receive a prompt response, which at her age she can no longer wait so long for.”\n\n4.—By a filing entered into the case record on 28 May 2026, Pablo César Zamora Alfaro, Coordinator of INDER’s Land Information and Registration Unit, reports: “The Rural Development Institute rejects the facts set out in this amparo application insofar as they are interpreted to mean that there was abandonment, an absolute refusal, deliberate neglect, or institutional inaction regarding the requests submitted by the amparo applicant, since this Administration has taken ongoing action related to the situation raised by Ms. Nombre02, within the scope of its institutional powers and in accordance with the technical, administrative, and territorial stages involved in implementing the National Plan for the Recovery of Indigenous Territories (Plan RTI). Likewise, we reject any interpretation that the Rural Development Institute acted arbitrarily, abruptly, or contrary to the fundamental rights of the amparo applicant, since the actions taken reflect compliance with the principle of legality and respect for the collective rights of self-determination and territorial governance recognized for Indigenous peoples under national and international regulations binding on the Costa Rican State.\n\nFIRST: Regarding Ms. Nombre02’s status as a non-Indigenous older adult. It is true that the amparo applicant states that Ms. Nombre02 is an older adult and does not belong to an Indigenous people. This Administration respects that status and the special protection that the legal system recognizes for older adults. Nevertheless, it must be stated that the mere assertion that she does not belong to an Indigenous people does not, by itself, establish that an ordinary administrative proceeding should be opened immediately or that an indemnifiable possessory right exists. Those matters require technical, social, legal, territorial, and documentary assessment within the corresponding stages of Plan RTI.\n\nSECOND: Regarding the alleged good-faith acquisition of a property in 1976. We reject that this Administration may consider it established, solely on the basis of the amparo applicant’s statements, that Ms. Nombre02 acquired a property in good faith in 1976. Determining good faith, whether there was actual occupation, the duration of possession, the validity or scope of an unregistered private document, and whether indemnification may be warranted are matters that require technical and legal analysis through the applicable channels. Therefore, those matters cannot be considered proven in constitutional proceedings, nor can an ordinary administrative proceeding be ordered to open automatically without first having the minimum technical information required.\n\nTHIRD: Regarding the property’s location within the Rey Curré Indigenous Territory. We reject that the information provided by the amparo applicant establishes definitively that the property described is within the Rey Curré Indigenous Territory. In letter INDER-GG-DRT-FT-IRT-OFI-0923-2024, which was sent to the amparo applicant, this Administration stated that it did not have a cadastral survey, sketch, coordinates, or sufficient technical information to locate the property precisely. Accordingly, before any determination on the possible opening of an ordinary administrative proceeding, technical, territorial, registry, and topographic checks must be carried out.\n\nFOURTH: Regarding the claim that when she acquired the property there was no Indigenous reserve or Indigenous people at the site. We reject that this Administration may confirm that point in the terms stated by the amparo applicant. Historical determination of the creation, delimitation, modification, and validity of an Indigenous territory, as well as assessment of whether there was an Indigenous population at a particular time, requires technical, legal, and historical analysis. Those matters exceed the summary nature of an amparo proceeding and cannot be resolved solely on the basis of a party’s assertions.\n\nFIFTH: Regarding the claim that INDER ‘removed’ a neighboring property holder and that Ms. Nombre02 therefore fears eviction. We reject that INDER issued any administrative action ordering Ms. Nombre02 to be evicted or abruptly removed from the property she says she occupies. The institutional procedure under Plan RTI does not operate as the amparo applicant describes. Any action relating to occupations within Indigenous territories must respect due process, the right to a defense, the corresponding notice, and the opportunity to submit evidence. Therefore, there is no threat of any kind attributable to INDER that would justify granting this amparo application.\n\nSIXTH: Regarding the allegations of harm to the protected person’s health, stress, anxiety, insomnia, and worry. This Administration understands and respects the personal situation described by the amparo applicant concerning Ms. Nombre02’s status as an older adult. Nevertheless, we reject that any arbitrary, illegitimate, or omissive action by INDER directly violated her fundamental rights. To the contrary, additional steps have been taken to seek interinstitutional support for the protected person. In that regard, by letter INDER-GG-DRT-FT-IRT-OFI-0348-2026 dated 26 March 2026, the case was referred to the National Council for Older Adults and the Joint Social Assistance Institute so that they could assess her socioeconomic circumstances, health, family support network, access to a pension, and the possible activation of social protection measures. That letter was sent to both institutions on 27 March 2026. IMAS acknowledged receipt that same day, and CONAPAM responded on 12 May 2026, indicating that the case would be referred to the corresponding care networks in Osa and Buenos Aires for assessment.\n\nSEVENTH: Regarding the claim that INDER has refused to open the administrative proceeding. We categorically reject that INDER has arbitrarily or definitively refused to process the request submitted by the amparo applicant. This Administration has stated that the possible opening of an ordinary administrative proceeding first requires preliminary technical activities, such as a census, territorial verification, topographic survey, registry analysis, identification of the occupation, coordination with the corresponding Indigenous Integral Development Association, and preparation of a preliminary case file. Consequently, there is no institutional refusal, but rather compliance with the applicable technical and administrative procedure.\n\nEIGHTH: Regarding the requests submitted on 4 September 2024 and 7 October 2024. It is true that the amparo applicant submitted requests related to opening an administrative proceeding on 4 September 2024 and 7 October 2024. Those requests were addressed by letter INDER-GG-DRTFT-IRT-OFI-0923-2024, served by email on 7 November 2024, which stated that minimum technical information was needed to locate the property and determine whether the corresponding actions were warranted. Likewise, those requests had already been considered by the Constitutional Chamber in case no. 24-029619-0007-CO, which that Honorable Chamber decided, finding it established that this Administration had provided a formal response.\n\nNINTH: Regarding the requests submitted on 28 January 2025, 5 February 2025, and 2 September 2025. It is true that the amparo applicant submitted various administrative requests on 28 January 2025, 5 February 2025, and 2 September 2025, addressed both to this Unit and to the Executive Presidency of the Rural Development Institute. In them, he substantially reiterated the same arguments previously presented, relating to the request for the urgent opening of an ordinary administrative proceeding for Ms. Nombre02, citing her status as an older adult, her alleged good-faith possession, and the need for prompt institutional attention. In response to those requests, this Administration issued letter INDER-GG-DRT-FTIRT-OFI-0615-2026 dated 25 May 2026, providing a consolidated formal response to the above-mentioned filings and expressly reiterating that this Administration has not rejected Ms. Nombre02’s request and that it is currently being processed as part of the activities carried out under the National Plan for the Recovery of Indigenous Territories (Plan RTI). The cited letter also reiterated that this Administration had previously responded to the requests in letters INDER-GG-DRT-FT-IRT-OFI-0923-2024 and INDER-GG-DRT-FT-IRT-OFI-1058-2025, and that the request had already been considered by the Constitutional Chamber in case no. 24-029619-0007-CO. It further reiterated that the prioritization of occupations to be addressed under Plan RTI is carried out in coordination with the Indigenous Integral Development Associations, in their capacity as local governments and representatives of the respective Indigenous territories, in accordance with the applicable regulatory framework and the corresponding territorial coordination and planning processes. Consequently, it is not true that there has been abandonment, an absolute refusal, deliberate neglect, or unlawful omission attributable to the Rural Development Institute, since the requests identified by the amparo applicant were formally addressed by the above-mentioned letter, and the case is currently being processed under the framework for implementing Plan RTI.\n\nTENTH: Regarding the request submitted to the Executive Presidency on 6 October 2025. It is true that on 6 October 2025—and not 4 October 2025, as the amparo applicant states—Lic. Nombre03 submitted a filing to the Executive Presidency requesting an order to open the ordinary administrative proceeding urgently. That filing was referred to the Land Information and Registration Unit on the 16th of the same month. In response, this Unit issued letter INDER-GG-DRT-FT-IRT-OFI-1058-2025 dated 20 October 2025, signed by Engineer Pablo César Zamora Alfaro, which provided a formal response to the amparo applicant’s arguments. That letter clarified that INDER has not refused to initiate an administrative proceeding; rather, the request was duly registered and must be processed according to the applicable order of priority under Plan RTI.\n\nELEVENTH: Regarding the claim that INDER ‘decides whenever it wants’ or ignores requests. We reject that claim as stated. It is not true that this Administration ignored the requests submitted by the amparo applicant. The requests were received, processed, analyzed, and answered within the scope of the institution’s powers. What the amparo applicant characterizes as inaction is, in fact, compliance with a complex technical, territorial, and legal procedure that cannot be omitted or arbitrarily expedited without affecting the collective rights of the Indigenous community involved.\n\nTWELFTH: Regarding the prioritization of occupations within the Rey Curré Indigenous Territory. It must be stated that Plan RTI carries out actions in the country’s twenty-four Indigenous territories, and therefore occupations must be addressed in accordance with institutional planning, operational availability, and territorial prioritization criteria. The order of priority for occupations to be addressed within each Indigenous territory is determined by the Indigenous Integral Development Associations, in their capacity as local governments and legal representatives of the Indigenous communities. This is based on Articles 4.1, 4.2, 6, 7.1, and 32 of ILO Convention 169, ratified by Law No. 7316, Article 22 of the Community Development Law No. 3859, Article 5 of the Regulations to the Indigenous Law No. 6172, and Article 1 of Executive Decree No. 13568-C-G. Consequently, INDER cannot unilaterally alter the territorial priorities defined in coordination with the corresponding Indigenous Integral Development Association, as doing so would disregard the Indigenous peoples’ right to self-determination.\n\nTHIRTEENTH: Regarding coordination and follow-up carried out with the Rey Curré Indigenous Integral Development Association. It is true that, based on the steps taken by this Administration to assess the situation raised by Ms. Nombre02, various follow-ups and coordination efforts were carried out with the Rey Curré Indigenous Integral Development Association, aimed at assessing whether the case could be prioritized within Plan RTI’s territorial response processes. In that regard, by letter INDER-GG-DRT-FT-IRT-OFI-0225-2026 dated 2 March 2026, the Coordinator of Land Information and Registration formally wrote to the Board of Directors of the Association for the Integral Development of the Rey Curré Indigenous Territory, requesting that, for humanitarian reasons and in light of Ms. Nombre05 Figueroa’s vulnerability as an older adult, it consider granting exceptional treatment and including her case on the priority list for this Territory. Follow-ups with the Integral Development Association were conducted on 13 and 26 March 2026, reiterating Ms. Nombre02’s vulnerable circumstances and Plan RTI’s institutional willingness to coordinate priority attention for the case within the applicable legal, operational, and territorial possibilities. Likewise, on 9 April 2026, the Rey Curré Indigenous Integral Development Association requested additional information relating to the property in question, specifically the possessor’s name, location, area, and survey, in order to assess the corresponding level of priority technically. In response, by letter INDER-GG-DRT-FT-IRT-OFI-0511-2026 dated 29 April 2026, this Administration sent the Integral Development Association all information available in Plan RTI’s records concerning Ms. Nombre02’s case. Subsequently, on 15 May 2026, personnel from this Unit communicated directly via WhatsApp with the President of the Rey Curré Indigenous Integral Development Association, José Rigoberto Leiva, who is president of the ADI. He stated that the Association was willing to prioritize Ms. Nombre02’s case and coordinate a visit to the property to complete the corresponding assessment. Written confirmation of that conversation was made that same day by email to the Integral Development Association, which acknowledged receipt. Finally, on 25 May 2026, with the approval of the relevant supervisor, the information was forwarded to the head of the topographic survey crew, who was asked to consider including a visit to the property in the next field trip scheduled for the territory. This shows that Ms. Nombre02’s case is currently being processed and that this Administration has taken concrete, ongoing, and coordinated action to advance its response to the request submitted by the amparo applicant. It also establishes that the case is currently being processed, that active coordination with the Rey Curré ADI is underway, and that interinstitutional steps have been taken to seek social support for Ms. Nombre02. Consequently, this representative considers that the claim of failure to respond has become moot, or, alternatively, that the amparo application should be denied because there is no current violation attributable to the Rural Development Institute.”\n\n5.- In a submission entered in the case file on 1 June 2026, the amparo applicant states: “Before addressing INDER’s response, I would have the justices note that this case has been ongoing for more than 3 years, almost 4, during which we have been asking INDER to open the administrative proceeding so that Ms. Nombre02 can prove her good-faith possession. See the letter dated 04 September 2024, which was delivered to Mr. Osvaldo Atavía Carballo, Executive Director of INDER, asking that he open the administrative proceeding so Ms. Nombre02 can prove, through conclusive evidence, whether she has the right to possess her property or, on the contrary, whether it is determined that she has no right. Therefore, INDER has refused to open the administrative proceeding, denying her right and violating Ms. Nombre05 Figueroa’s right to a defense and to present her arguments and prove her good-faith position. Ms. Nombre02 is an older adult, 92 years of age, who needs a decision now because of her age, but INDER does not want to decide her case, surely waiting for her to die so it can close the case without deciding anything. It is important to state that waiting almost 4 years for a decision in Ms. Nombre02’s case is far too long for this older adult, whose only wish is to have peace and live in tranquility. Unfortunately, Ms. Nombre06 has no peace because she lives in fear that her property may be taken from her—the property to which she devoted her entire life and effort—all because INDER does not open the administrative proceeding to determine whether Ms. Nombre05 has the right to keep her property. Please take into account that Ms. Nombre02 is 92 years of age and needs an urgent decision. Regarding the reply to INDER’s response. First: Regarding fact one: It is clear that in this case there has been an absolute refusal to open the administrative proceeding, thereby violating Ms. Nombre02’s rights. It is important to state that we have been asking for almost 4 years to open the administrative proceeding, and INDER has denied Ms. Nombre02 the right to prove with evidence that she acquired the property in good faith. More seriously, INDER has neither a date nor plans to open the administrative proceeding, waiting for her to die and then close the case without deciding anything. It is important to state that this proceeding is not asking for anything extraordinary, nor does it have anything to do with the governance of Indigenous peoples. The only thing being requested is that Ms. Nombre06 be given the opportunity to prove that she acquired the property in good faith… that is all that is being requested. Second: Regarding fact two: I oppose what INDER has stated because it is inconsistent. On the one hand it says, ‘that more information is needed to determine good faith.’ Well, that is precisely what we are asking INDER to do: order the opening of an administrative proceeding so that documentary and testimonial evidence can show that Ms. Nombre02 in fact acquired these lands in 1976 and acquired them in good faith. Yet on the other hand, INDER refuses to open the administrative proceeding. Also, note that the title executed on official paper N° CED01 on 09 de enero del año 1976 is a legal document that was used at that time, and it was legal at that time. This evidence is irrefutable, because not just anyone has a document of this kind, written on that date, and this document CONFERS VALIDITY ON PROPERTY TRANSFERS, BECAUSE AT THAT TIME THERE WERE ALMOST NO NOTARIES. This document makes possession more than evident. Third: Regarding point three: As for the paragraph: ‘Moreover, it is denied that the parcel is in Rey Curre because there is no location with coordinates that would ensure where the parcel is.’ THIS IS UNACCEPTABLE: to say that the administrative proceeding is not opened because a location sketch, survey plan, or property coordinates were not submitted is wholly unacceptable, because the location can be verified in the unregistered purchase-and-sale contract executed on official paper N° CED01 on 09 de enero del año 1976, signed by Ms. Nombre06 and Ms. Nombre02 in 1976. Additionally, IT IS UNACCEPTABLE that the administrative proceeding not be opened and that the process be delayed when the department called Proyecto Territorio Indígenas (RTI) and INDER’s Topography Area have already PREPARED THE SURVEY PLAN of the property and determined that it is indeed within the Rey Curré Indigenous Reserve. Fourth: Regarding point four: INDER is hereby advised that the administrative proceeding in the case of Mr. Nombre04 duly demonstrated that when these people acquired these lands, no Indigenous person lived at this site and there were none there, and these lands had not been declared Indigenous lands. Fifth and sixth: Regarding points five and six. Indeed, Ms. Nombre02 is suffering health problems: ANXIETY, STRESS, DEPRESSION, AND INABILITY TO SLEEP, because INDER has already removed several neighbors from these lands, including Mr. Nombre04. That is why we ask that the administrative proceeding be opened, so that it may determine whether Ms. Nombre06 has the right to remain on her property, allowing this older adult to have peace of mind. It is important to state that the increase in Ms. Nombre02’s health problems is largely INDER’s fault because it has not opened the administrative proceeding and definitively resolved Ms. Nombre05’s situation. Seventh: Regarding point seven: Justices, it is reaffirmed that INDER has refused to open the administrative proceeding. This case has been ongoing for more than 3 years, almost 4, during which we have been asking INDER to open the administrative proceeding so Ms. Nombre02 can prove her good-faith possession. See the letter dated 04 September 2024, which was delivered to Mr. Osvaldo Atavía Carballo, Executive Director of INDER, but INDER has refused to open the proceeding, making excuses to avoid doing so. See all the evidence submitted to the case file. Eighth and ninth: Regarding facts eight and nine: I oppose what INDER has stated. IT IS NOT TRUE that INDER has addressed our requests, because what we are asking is for the administrative proceeding to be opened, and INDER refuses to do so. If what INDER says were true, it would already have ordered the administrative proceeding opened and would already have resolved Ms. Nombre02’s case. But we have been asking INDER to open the administrative proceeding for almost 4 years, and all INDER does is make excuses to avoid opening it, while this older adult continues to wait for justice. Tenth: Regarding fact ten: I oppose what INDER has stated. As I have already indicated, this is a violation of fundamental rights because INDER does not want to open the administrative proceeding to discuss Ms. Nombre02’s right, and she needs an urgent decision. The letter INDER refers to was challenged because it seriously affects my client’s health and life. INDER’s inaction and delay in resolving this case worsen my client’s health; she is completely stressed because she is going to be evicted, as already happened with the property next to hers, which belonged to Mr. Nombre04. Accordingly, of course this matter falls within the competence of the Constitutional Chamber, given my client’s very sensitive health condition and age, and not within the administrative-litigation jurisdiction, since that would take years and this case would not be resolved. Meanwhile, the violation of my client’s rights would continue until it takes her life. It is important to state that, at my client’s age, she has the right to live a peaceful life free of problems, and the situation with these lands IS SLOWLY LEADING HER TO HER DEATH, BECAUSE INDER ONLY GIVES RESPONSES TO GET BY, BUT DOES NOT RESOLVE ANYTHING CONCRETE. Eleventh: Regarding fact eleven: I oppose what INDER has stated. Of course INDER decides when it wants to, and in this case almost 4 years have passed and it still has not decided anything. It makes no sense for INDER to say that the administrative proceeding must be opened to prove Ms. Nombre02’s good faith and possession, while at the same time refusing to open it, despite my client having asked many times that it be opened and despite the fact that they have already prepared the SURVEY PLANS of the property. Even so, INDER refuses to open the administrative proceeding. In addition, it is again asserted that this case does fall within the competence of the Constitutional Chamber, and it is there that the case should be resolved and the opening of the administrative proceeding ordered, so that Ms. Nombre02’s fundamental rights are not further violated. She is already highly stressed by this situation, and her life is fading away because INDER has not concretely resolved her case. If the opening of the proceeding is not ordered, the abuses against my client and the health problems and deterioration in her life would continue until they take her life because of these lands, which should rightfully be compensated for and returned to the Indigenous people. Twelfth: Regarding fact twelve: It is important to state that opening an administrative proceeding to determine whether a person has a right or not does not mean that Indigenous territorial priorities are unilaterally altered. What INDER has stated is a complete fallacy, because opening a proceeding will not alter the way INDER or the Indigenous reserves work or their methodology. Therefore, what INDER has stated is a complete lie, since opening a proceeding will not change anything. Thirteenth: Regarding fact thirteen: The justices are hereby advised that this case is limited solely to having INDER order the opening of the administrative proceeding so Ms. Nombre02 can be heard in the proceeding. No assistance or anything else is being requested here; therefore, putting the woman on the vulnerability list so that IMAS will assist her is beside the point, because that is not what is being requested. What Ms. Nombre02 really needs in order to be well is an order to open the administrative proceeding. Moreover, it is truly disappointing that INDER has done nothing in this case in almost 4 years and has not been concerned with resolving it; it was only after the Chamber served this amparo application on it that INDER is asking… On the other hand, the justices are hereby advised that it is not enough to give a response, answer anything just to get by, and tell the Chamber that it has answered and is following up; that is not the point. At 92 years of age, Ms. Nombre02, identity card CED02, needs a concrete solution to her problem. She needs INDER to order the opening of the administrative proceeding so Ms. Nombre02 can present all her documentary and testimonial evidence in that proceeding (all the witnesses she has, who can attest to possession of these lands and that she acquired them in good faith in 1976). If INDER does not open the administrative proceeding, obviously my client will not be able to prove her possession or that she acquired the property in good faith, and her fundamental rights at 92 years of age would be seriously violated because she would not receive a prompt response and her health and life would deteriorate, which are extremely precarious at her age.”\n\n6.- In a certification dated 1 June 2026, Mariane Castro Villalobos and Alejandro Cascante Herrera, respectively secretary and judicial technician, both of the Chamber, record: “having reviewed, at ten hours fifty-three minutes on the first day of June two thousand twenty-six, the CONTROL DE DOCUMENTOS RECIBIDOS Y ESTE EXPEDIENTE in the SISTEMA COSTARRICENSE DE GESTIÓN DE DESPACHOS JUDICIALES, no record appeared showing that, from 25/05/2026 to 27/05/2026, the EXECUTIVE DIRECTOR OF THE INSTITUTO DE DESARROLLO RURAL (INDER) had submitted any filing or document in order to provide the report requested in the order issued at ten hours one minute on the twentieth day of May two thousand twenty-six, in expediente number 26-015288- 0007-CO, which is an AMPARO PROCEEDING brought by Nombre03.”\n\n7.- In a submission entered in the case file on 4 June 2026, Ricardo José Quesada Salas, executive president of INDER, states: “FIRST: My represented institution joins in the response provided by official Ing. Pablo César Zamora Alfaro, Coordinator of the Land Information and Registry Unit (IRT) of the Instituto de Desarrollo Rural (INDER). This can be seen in images 145 through 153, in accordance with the amparo expediente no. 26-015288-0007-CO. SECOND: It is reiterated that my represented institution rejects the facts set out in this amparo application insofar as they are interpreted to mean that there was abandonment, an absolute refusal, deliberate neglect, or institutional inaction concerning the steps submitted by the applicant party, since this Administration has carried out ongoing actions related to the situation raised by Ms. Nombre02, within the scope of its institutional powers and in accordance with the technical, administrative, and territorial stages involved in implementing the National Plan for the Recovery of Indigenous Territories (Plan RTI). Likewise, any interpretation tending to assert that the Instituto de Desarrollo Rural acted arbitrarily, precipitously, or contrary to the applicant party’s fundamental rights is rejected, since the actions taken respond to compliance with the principle of legality and respect for the collective rights of self-determination and territorial governance recognized to Indigenous peoples under national and international rules binding on the Costa Rican State.”\n\n8.- In a submission entered in the case file on 5 August 2026, the amparo applicant states: “First: Justices, I will not address the arguments put forward by Mr. RICARDO JOSE QUESADA SALAS, current EXECUTIVE PRESIDENT of the INSTITUTO DE DESARROLLO RURAL, because it is obvious that his arguments are unjustified, lack legal support, and violate the fundamental rights of Ms. Nombre02, who is an older adult. As already explained in this proceeding, Ms. Nombre02 has spent almost four years (4 years) asking INDER to please order the opening of the administrative proceeding to prove that she acquired her property in good faith; INDER has refused to do so. INDER claims that the proceeding is underway, but we have already been at it for almost four years (4 years), and it remains underway. This delay is unacceptable, especially because this is an older adult who needs a prompt decision; at the rate INDER plans to resolve this older adult’s case, it would take more than 20 years, and the case would still not be resolved. It is astonishing that Ms. Nombre02 is 92 years old and INDER does not want to resolve her case; they are surely waiting for this older adult to die so they can close the case without deciding anything. It must be stated that waiting almost 4 years for this case to be resolved, when it is still unknown whether the administrative proceeding will be opened, is far too long. It is important to state that this older adult only wants a decision so she can have peace and live in tranquility. It is in the interest of informing the justices that Ms. Nombre02 has no peace because she lives in fear that her property may be taken from her—the property to which she devoted her entire life and effort—all because INDER does not open the administrative proceeding to determine whether Ms. Nombre05 has the right to keep her property.”\n\n9.- The legal requirements governing these proceedings have been observed.\n\nJustice Rueda Leal drafts the decision; and,\n\nReasons:\n\nI.- PRELIMINARY MATTER. Since INDER’s executive director failed to submit the report within the period set by this Court in the order commencing this matter, the application is decided pursuant to Article 45 of the Ley de la Jurisdicción Constitucional, taking into consideration the evidence in the record.\n\nII.- SUBJECT OF THE APPLICATION. The applicant states that his client is an older adult who has exercised peaceful, notorious, and uninterrupted possession of a property that she acquired in good faith before the Rey Curré reserve was declared Indigenous land. He mentions that, in 2003, CONAI issued opinion no. C-395-2003, which stated that, pursuant to Article 5 of the Indigenous Law, INDER must relocate owners and possessors of properties located within Indigenous territories. He challenges the fact that, despite the foregoing, INDER has neither coordinated the relevant matters with CONAI nor done anything to address the protected person’s situation. In that regard, he states that on multiple occasions he has asked INDER to open the corresponding administrative proceeding to determine whether the protected person has the right to dispose of her property; however, this has not been done. He says these requests were submitted on 4 September and 7 October 2024, as well as on 28 January, 5 February, 2, 4 September, and 4 October, all in 2025. He asks that the respondent authority be ordered to open and conclude the corresponding administrative proceeding.\n\nIII.- FACTS FOUND. The following facts relevant to deciding this matter are deemed duly established, either because they have been proven or because the respondent authority failed to address them, as provided in the initial order:\n\na) The protected person submitted requests to INDER seeking the opening of an administrative proceeding for “payment of possession rights” in respect of a property on the following dates: 4 September and 7 October 2024; 28 January, 5 February, 2 September, 4 September, and 4 October, all in 2025. (Undisputed fact).\n\nb) The respondent authority was served with the order commencing this proceeding on 22 May 2026. (Notice of service added to the case file).\n\nc) By letter no. INDER-GG-DRT-FT-IRT-OFI-0615-2026 of 25 May 2026, communicated to the applicant, the respondent authority stated: “First, by letter INDER-GG-DRT-FT-IRT-OFI-0923-2024, notified by email on 07 November 2024, this administrative unit responded to the requests submitted on 04 September 2024 and 07 October 2024 concerning the opening of an administrative proceeding and the request for compensation for Ms. Nombre02’s possession rights. Subsequently, by letter INDER-GG-DRT-FT-IRT-OFI-1058- 2025 dated 20 October 2025, the renewed request submitted to INDER’s Executive Presidency concerning the situation raised by your client was addressed again. Additionally, it is important to state that the request submitted by your client was already considered by the Constitutional Chamber in expediente No. 24-029619-0007-CO, brought against the Instituto de Desarrollo Rural (INDER), in which the Constitutional Chamber issued a decision, finding it established that this Administration had responded to the requests made at that time. In that regard, it is clarified that this Administration has not rejected the request submitted by your client and it is currently being processed as part of the activities carried out under the National Plan for the Recovery of Indigenous Territories (Plan RTI). In this regard, it is important to state that the Plan RTI carries out its activities in the country’s twenty-four Indigenous territories, developing various technical, social, legal, and administrative stages to address occupations within Indigenous territories. These activities include preparing preliminary case files, censuses, topographic surveys, registry analyses and, eventually, opening ordinary administrative proceedings when appropriate under institutional planning and verification of technical and legal requirements. It should also be stated that prioritization of the occupations to be addressed under the Plan RTI is carried out in coordination with the Indigenous Comprehensive Development Associations (ADI), in their capacity as local governments and representatives of the respective Indigenous territories, in accordance with the applicable regulatory framework and the coordination and planning processes undertaken to implement the Plan RTI. Accordingly, this Administration is currently coordinating and working with the relevant Comprehensive Development Association to assess and include the occupation in question in the service and planning processes being carried out in the respective Indigenous territory, in accordance with the work schedule, operational availability, and applicable prioritization criteria. Therefore, it is reiterated that the request submitted by your client is currently being processed and will be addressed in accordance with the corresponding technical and administrative procedures within the framework of implementing the Plan RTI.” (Documentary evidence).\n\nIV.- THE PARTICULAR CASE. In this matter, the applicant states that his client is an older adult who has exercised peaceful, notorious, and uninterrupted possession of a property that she acquired in good faith before the Rey Curré reserve was declared Indigenous land. The respondent authority was served with the order commencing this proceeding on 22 May 2026. By letter no. INDER-GG-DRT-FT-IRT-OFI-0615-2026 of 25 May 2026, communicated to the applicant, the respondent authority stated: “First, by letter INDER-GG-DRT-FT-IRT-OFI-0923-2024, notified by email on 07 November 2024, this administrative unit responded to the requests submitted on 04 September 2024 and 07 October 2024 concerning the opening of an administrative proceeding and the request for compensation for Ms. Nombre02’s possession rights. Subsequently, by letter INDER-GG-DRT-FT-IRT-OFI-1058- 2025 dated 20 October 2025, the renewed request submitted to INDER’s Executive Presidency concerning the situation raised by your client was addressed again. Additionally, it is important to state that the request submitted by your client was already considered by the Constitutional Chamber in expediente No. 24-029619-0007-CO, brought against the Instituto de Desarrollo Rural (INDER), in which the Constitutional Chamber issued a decision, finding it established that this Administration had responded to the requests made at that time. These activities include preparing preliminary case files, censuses, topographic surveys, registry analyses and, eventually, opening ordinary administrative proceedings when appropriate under institutional planning and verification of technical and legal requirements. It should also be stated that prioritization of the occupations to be addressed under the Plan RTI is carried out in coordination with the Indigenous Comprehensive Development Associations (ADI), in their capacity as local governments and representatives of the respective Indigenous territories, in accordance with the applicable regulatory framework and the coordination and planning processes undertaken to implement the Plan RTI. Accordingly, this Administration is currently coordinating and working with the relevant Comprehensive Development Association to assess and include the occupation in question in the service and planning processes being carried out in the respective Indigenous territory, in accordance with the work schedule, operational availability, and applicable prioritization criteria. Therefore, it is reiterated that the request submitted by your client is currently being processed and will be addressed in accordance with the corresponding technical and administrative procedures within the framework of implementing the Plan RTI.”\n\nIn this regard, it is relevant to point out that this Chamber had already decided a similar claim brought by the protected person. In that connection, in judgment no. 2024036996 at 9:30 a.m. on 13 December 2024, this Chamber ruled:\n\n“I.- SUBJECT OF THE APPLICATION. The older adult bringing the application states that on 4 September 2024 she submitted a request to the Instituto de Desarrollo Rural, seeking the opening of an ordinary administrative proceeding for payment of the possession rights she has over a property located in the Rey Curré Indigenous territory, but received no response, even though she renewed her request on 7 October of that same year. She maintains that this omission violates her fundamental rights.\n\nII.- FACTS FOUND. The following facts relevant to deciding this amparo application are deemed established: 1) On 4 September 2024, the protected older adult requested the opening of an administrative proceeding for payment of the possession rights she claims to have over land that, according to her, is located within the Rey Curré Indigenous territory (copy attached to the application). 2) On 7 October 2024, the amparo applicant renewed that request (copy attached to the application). 3) By letter INDER-GG-DRT-FT-IRT-OFI-923-2024 of 30 October 2024, the protected person’s representative was instructed, before any ordinary administrative proceeding could be initiated, to provide the relevant documentation and contact information for notifications. It was also stated that it was necessary to coordinate the census and topographic survey of the property she occupies, provided it had been verified and confirmed that the property was in fact within Indigenous territory (copy attached to the report). 4) On 7 November 2024, that letter was served on the protected person through her representative’s email ...01 (report submitted under oath). 5) By written submission filed on 11 November 2024, the amparo applicant provided the requested material (copy attached to the report). 6) On 29 November 2024, the order transferring the matter to the respondent authority was served (service records visible in the Events History of the electronic case file).\n\nIII.- THE PARTICULAR CASE. In this matter, the older adult bringing the application states that on 4 September 2024 she submitted a request to the Instituto de Desarrollo Rural, seeking the opening of an ordinary administrative proceeding for payment of the possession rights she has over a property located in the Rey Curré Indigenous territory, but received no response, even though she renewed her request on 7 October of that same year. She maintains that this omission violates her fundamental rights.\n\nAs to the alleged harm, it should be stated that Nombre01’s case does not fall within the exceptions established for this purpose, and therefore it is not for the Chamber to rule on it. In that regard, it is clarified that although, beginning with decision number 2008-02545 at 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction—with some exceptions—matters concerning whether a public authority has complied with the periods established by the General Law of Public Administration (Articles 261 and 325) or sector-specific laws governing special administrative proceedings, either to issue a final decision in an administrative proceeding—initiated on the authority’s own motion or at a party’s request—or to consider the applicable administrative remedies, in the present case the request is not directly related to the protected person’s status as an older adult, since what is sought is payment for possession rights. Accordingly, the Chamber finds no harm as alleged. On this basis, the application must be denied, as is hereby ordered.\n\nFinally, the dispute over the truthfulness of the information provided is outside the scope of this specialized procedure. The applicant party may, if it so wishes, resort to the avenues for legal review to file any complaints or reports it deems appropriate.”\n\nAccordingly, note that this Court had already ruled on the alleged delay concerning the requests of 4 September and 7 October 2024, denying the application for the reasons stated. Therefore, as to those requests in particular, the protected person must abide by what was decided in judgment no. 2024036996 at 9:30 a.m. on 13 December 2024.\n\nV.- Although in this matter the respondent alleges that, after 4 September and 7 October 2024, the protected person submitted further requests to the same effect and asserts that the respondent authority likewise has not acted as requested, it bears repeating what was explained in the precedent cited above: the alleged delay in this case is not among the exceptions established by this Chamber regarding prompt and fulfilled justice (Article 41 of the Political Constitution). For that reason, the application is inadmissible in this constitutional forum and must be addressed before the administrative-litigation jurisdiction, for the following reasons.\n\nVI.- NEW ADMINISTRATIVE JUSTICE: AN EXPEDITIOUS AND EFFECTIVE MECHANISM FOR THE PROTECTION OF SUBSTANTIVE LEGAL SITUATIONS OF THE ADMINISTERED. Since its establishment, the Constitutional Chamber has applied broad admissibility criteria in view of the absence of expeditious and swift procedural avenues for protecting substantive legal situations grounded in the subconstitutional legal order or legality framework, which are indirectly connected to fundamental rights and Constitutional Law. In this regard, it must be borne in mind that, by virtue of its supremacy, superlegality, and direct and immediate effect, the Constitution provides an indirect basis for any conceivable substantive legal situation of individuals. Nevertheless, upon better consideration and following the enactment of the Code of Administrative Litigation Procedure (Law No. 8508 of 24 April 2006) and its entry into force on 1 January 2008, it has become clear that litigants now have access to a plenary and universal administrative-litigation jurisdiction that is highly expeditious and swift because of the various procedural mechanisms that legislation incorporates into the legal order. These include shortened periods for carrying out the various procedural acts; broad standing; interim measures; an open-ended range of claims that may be brought; oral proceedings—and their subsidiary principles of concentration, immediacy, and expedition; a single level of jurisdiction, with a right of appeal in expressly specified circumstances; settlement within the proceeding; unified proceedings; proceedings given preferential treatment or “amparo de legalidad”; proceedings on the merits; new enforcement measures (coercive fines, substitute or commissarial enforcement, attachment of fiscal-domain property and some public-domain property); the broad powers of the enforcement judges; the extension and adaptation of the effects of case law to third parties; and flexibility in cassation appeals. All these new procedural mechanisms are expressly intended to achieve procedural economy, expedition, promptness, and effective or fulfilled protection of the substantive legal situations of the administered, while safeguarding basic fundamental rights such as due process, the right to a defense, and the right to present opposing arguments. In sum, owing to its new features of simplicity, expedition, and promptness, the new administrative-litigation jurisdiction is a suitable avenue for the effective protection of substantive legal situations of the administered where evidence must be gathered or ordinary legality issues must be decided.\n\nVII.- VERIFYING STATUTORY PERIODS FOR DECIDING ADMINISTRATIVE PROCEEDINGS: A CLEAR QUESTION OF ORDINARY LEGALITY. It is clear that determining whether the public administration has complied with the periods established by the General Law of Public Administration (Articles 261 and 325) or sector-specific laws governing special administrative proceedings, either to issue a final decision in an administrative proceeding—initiated on the authority’s own motion or at a party’s request—or to consider the applicable administrative remedies, is plainly a question of ordinary legality that may henceforth be raised and decided before the administrative-litigation jurisdiction, applying principles that inform constitutional jurisdiction, such as substitute standing, the possibility of a personal defense—that is, appearing without legal counsel—and exemption from costs for the applicant. Consequently, the application must be summarily dismissed, and the applicant party should be advised that, if it so wishes, it may turn to the administrative-litigation jurisdiction.\n\nVIII.- DOCUMENTS SUBMITTED TO THE CASE FILE. The parties are advised that, if they submitted any paper documents or objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must collect them from the court office within a maximum period of 30 working days from service of this judgment. Otherwise, all material not collected within that period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as in the resolution approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nAs to the alleged delay concerning the requests of 4 September and 7 October 2024, the protected person shall abide by what was decided in judgment no. 2024036996 at 9:30 a.m. on 13 December 2024.
