  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-023940-0007-CO \n\nRes. Nº 2026031035\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .\n\n Recurso de amparo que se tramita en expediente número 26-023940-0007-CO, interpuesto por Nombre05, cédula de identidad CED01, a su favor y el de Nombre02, persona menor de edad, Nombre01, Nombre04, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA). \n\nRESULTANDO:\n\n 1.- Por escrito recibido en la Secretaría de la Sala a las 09:21 horas del 03 de julio de 2026, el recurrente interpone recurso de amparo contra el ICAA. Según la resolución de curso, manifiesta lo siguiente: \n\n \"Es vecino de la comunidad de Calle Picacho, Guatuso de Patarra, Desamparados, en la que residen aproximadamente cincuenta familias que dependen del servicio de agua potable brindado por el AyA. Señala que dicho servicio no se presta de manera continua, presentándose interrupciones de hasta diez días, con lapsos frecuentes de al menos cuatro días consecutivos sin suministro. Indica que, ante esta situación, el AyA únicamente distribuye agua por medio de cisternas los días lunes, miércoles y viernes, lo cual resulta insuficiente para cubrir las necesidades básicas de consumo humano, higiene y saneamiento de la comunidad. Manifiesta que se han presentado denuncias y reportes ante la Contraloría de Servicios del AyA, sin que a la fecha se haya brindado una solución efectiva y permanente a la problemática. Agrega que su núcleo familiar enfrenta una condición de particular vulnerabilidad frente a esta carencia, pues su esposa, Nombre04, fue diagnosticada hace aproximadamente cuatro meses con un tumor maligno de mama, por lo que permaneció internada por mes y medio en el Hospital de las Mujeres Adolfo Carit Eva y fue intervenida quirúrgicamente el 20 de mayo de 2026 en el Hospital San Juan de Dios, encontrándose actualmente en tratamiento de quimioterapia, sin poder retornar a su hogar para el cuidado de sus hijos, Nombre02, persona menor de edad, y Nombre01, quien presenta una discapacidad intelectual y se encuentra bajo control psiquiátrico. Señala que el Departamento de Trabajo Social del centro médico le ha indicado que su esposa no puede reintegrarse al hogar familiar mientras persista la condición de desabastecimiento continuo de agua potable. Considera que lo expuesto vulnera sus derechos fundamentales y los de los amparados a la salud, a la vida digna y al acceso al agua potable. Solicita que se declare con lugar el recurso y se ordene al AyA garantizar de forma inmediata, continua y suficiente el suministro de agua potable a las familias de la comunidad de Calle Picacho, Guatuso de Patarra, Desamparados\". (Sic). \n\n 2.- Informa bajo juramento Lourdes María Sáurez Barboza, en su condición de Presidenta Ejecutiva del ICAA, que mediante informe técnico No. UEN-PyDOCA-GAM-2026-00352 emitido por la Dirección de Operación y Control se informa las gestiones realizadas por parte del ICAA en relación con lo reclamado por el recurrente. En resumen, se informa de las particularidades del abastecimiento en la localidad de Dirección01, las cuales obedecen a variables climáticas de fuerza mayor, limitaciones técnicas de las fuentes del sector y actos de vandalismo en la red. Señala lo siguiente: \n\n“PRIMERO: El sector de Calle Picacho, Guatuso de Patarrá, Desamparados, pertenece a la Zona de Operación Calle Picacho. Este era un acueducto originalmente administrado por una ASADA que posteriormente pasó a la administración directa de AyA. El sistema toma su agua de la Naciente Olmos, desde la cual se distribuye directamente a la población tras el proceso de desinfección. Cabe destacar que, desde que la Institución asumió este acueducto, ha realizado mejoras sustanciales en la red de distribución para reducir al máximo posible las pérdidas de caudal y, debido a las condiciones operativas particulares del sector, a los usuarios de esta zona se les aplica actualmente una tarifa fija. SEGUNDO: La problemática actual de desabastecimiento en Calle Picacho se origina por una causa de fuerza mayor ajena al control del Instituto. La Naciente Olmos ha sufrido una reducción de su caudal de aproximadamente un 50%, producto del alargamiento de la época seca intensificada por los efectos del fenómeno climático El Niño, provocando que el agua extraída resulte insuficiente para cubrir la demanda continua de la población. Adicionalmente, este es un sistema hidrológicamente aislado al cual no es posible trasvasar agua desde otros sistemas de la GAM, sumado a que en dicho sector geográfico no se han identificado otras fuentes de agua con características aptas para ser explotadas para consumo humano. TERCERO: Aunado a las limitaciones climáticas e hídricas expresadas, la distribución equitativa del agua se ha visto seriamente perjudicada por reiterados actos de vandalismo atribuidos a personas ajenas a la institución. Cuando el personal del AyA realiza maniobras operativas en las válvulas para distribuir de forma equitativa el recurso entre los pobladores, terceros no autorizados manipulan indebidamente el sistema una vez que los funcionarios se retiran, acaparando el recurso en beneficio de unos pocos y en perjuicio de los demás usuarios del sector. Para erradicar esta situación, el AyA se encuentra gestionando la construcción e instalación de una caja de control con tapa de seguridad que impida el acceso no autorizado y permita ejecutar las maniobras de distribución equitativa por horarios de forma efectiva. CUARTO: Contrario a lo afirmado por la parte recurrente, el Instituto no ha incurrido en una omisión administrativa ni en una falta de atención. Como medida paliativa inmediata para mitigar la afectación y salvaguardar los derechos a la salud e higiene de la comunidad, el AyA mantiene operativo el suministro de agua potable mediante camiones cisterna que recorren la zona para llenar los tanques de almacenamiento domiciliarios. Dicha labor de reparto consta debidamente documentada en las boletas operativas de atención (Anexo 1 del Informe Técnico). Asimismo, la Institución ha ejecutado el reemplazo de tuberías en el sector para eliminar fugas y optimizar la red existente. QUINTO: Como solución a mediano y largo plazo dentro del proceso de planificación sectorial, la Institución tiene registrada en su cartera de proyectos la iniciativa denominada \"Acueducto Calle Picacho, Alto Guatuso\" (asociada al sistema MEA11-Guatuso-Patarrá, código CEG-11-09-F13), la cual se encuentra ubicada en la posición 17 de un total de 166 iniciativas priorizadas por el AyA. Esta iniciativa busca la mejora integral del abastecimiento en favor de las comunidades de Calle Picacho y Guatuso de Patarrá, estando sujeta a la elaboración de las etapas de estudios (Perfil, Prefactibilidad y Factibilidad) conforme a las metodologías vigentes del MIDEPLAN. SEXTO. Mediante oficio No. JD-CS-2026-00693 suscrito por Nombre03 Contraloría de Servicios informa bajo fe de juramento, que se realizó una búsqueda detallada, tanto en el sistema de gestión y registro de la Contraloria de Servicios (CS), así como en el correo oficial de la CS, a saber ...01, no contamos con registros recientes, o gestiones realizadas de manera directa a nombre del Sr. Nombre02, por lo que no me es posible referirme a las manifestaciones expuestas en el recurso de amparo indicado en el asunto. Lo único que hay en registro de la Contraloría de Servicios, es copia de una nota que los vecinos de Calle Picacho tramitaron directamente ante la UEN de Producción y Distribución, en el año 2020, al ser una gestión presentada ante la UEN, no correspondía trámite adicional desde la Contraloría de Servicios. Sexto: Sobre la acción ejecutadas por AYA Los hechos acreditados mediante los informes técnicos permiten concluir que no existe una actuación arbitraria u omisiva atribuible al Instituto Costarricense de Acueductos y Alcantarillados. La afectación en la continuidad del servicio responde a un evento de fuerza mayor o caso fortuito, generado por la severa disminución de caudales derivada del fenómeno El Niño, así como a factores topográficos e imponderables como el vandalismo en las redes”. (El destacado es del original). \n\nCita el Reglamento para la Prestación de los Servicios del ICAA. Resalta que se ha actuado de manera diligente empleando camiones cisterna para garantizar el líquido vital a los amparados sustituyendo infraestructura dañada, proyectando obras de infraestructura de resguardo contra el vandalismo e integrando la solución definitiva dentro de la cartera priorizada de proyectos institucionales. Reitera que prestación del servicio en la zona donde se ubica la recurrente es afectada por una condición de fuerza o causa mayor, la cuales son atendidas con las condiciones técnicas establecidos por ente Regulador (ARESEP) así como las condiciones técnicas homologadas y reguladas por el ICAA en el Reglamento para la Prestación de los Servicios. Solicita que se declare sin lugar el recurso. \n\n3.- Informa bajo juramento Xiomara Zúñiga Barrientos, en su condición de Jefatura de la oficina de Desamparados del ICAA, en similares condiciones al informe rendido por la Presidenta Ejecutiva de la institución. \n\n4.- Informa bajo juramento Randall Campos Rojas, en su condición de Subgerente Gestión Sistemas GAM del ICAA, en similares condiciones al informe rendido por la Presidenta Ejecutiva de la institución. \n\n5.- En los procedimientos seguidos se ha observado las prescripciones legales.\n\nRedacta la Magistrada Garro Vargas; y,\n\nCONSIDERANDO:\n\n I.- OBJETO DEL RECURSO. El recurrente manifiesta que es vecino de la comunidad de Calle Picacho, Guatuso de Patarra, Desamparados, en la que residen aproximadamente cincuenta familias. Señala que el servicio de agua potable que brinda el ICAA no se presta de manera continua presentándose interrupciones de hasta diez días con lapsos frecuentes de al menos cuatro días consecutivos sin suministro. Ante esa situación, indica que la autoridad recurrida distribuye agua por medio de cisternas los días lunes, miércoles y viernes, lo cual resulta insuficiente para cubrir las necesidades básicas de consumo humano, higiene y saneamiento de la comunidad. Agrega que se han presentado denuncias y reportes ante la Contraloría de Servicios de la institución sin que a la fecha se haya brindado una solución efectiva y permanente a la problemática. Dice que su núcleo familiar enfrenta una condición de particular vulnerabilidad frente a esta carencia, pues la amparada fue diagnosticada con un tumor maligno de mama, encontrándose actualmente en tratamiento de quimioterapia. \n\nII.- HECHOS PROBADOS. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:\n\na) El recurrente y la parte amparada son vecinos de Dirección01, Guatuso de Patarrá, Desamparados (hecho no controvertido).\n\nb) El sector que habita el accionante pertenece a la Zona de Operación Calle Picacho, el cual era un acueducto originalmente administrado por una ASADA que pasó a la administración directa del ICAA y toma su agua de la Naciente Olmos que se distribuye directamente a la población tras el proceso de desinfección (véase el informe y la prueba adjunta). \n\nc) El desabastecimiento de agua potable en Calle Picacho se origina por una causa de fuerza mayor ajena al control del ICAA, ya que la Naciente Olmos ha sufrido una reducción de su caudal de aproximadamente un 50%, producto del alargamiento de la época seca intensificada por los efectos del fenómeno climático El Niño, provocando que el agua extraída resulte insuficiente para cubrir la demanda continua de la población (véase el informe y la prueba adjunta).\n\nd) La Naciente Olmos es un sistema hidrológicamente aislado que imposibilita trasvasar agua desde otros sistemas de la GAM. Además, en dicho sector geográfico no se han identificado otras fuentes de agua con características aptas para ser explotadas para consumo humano. Igualmente, la distribución equitativa del agua se ha visto seriamente perjudicada por reiterados actos de vandalismo atribuidos a personas ajenas a la institución, toda vez que cuando el personal del ICAA realiza maniobras operativas en las válvulas para distribuir de forma equitativa el recurso entre los pobladores terceros no autorizados manipulan indebidamente el sistema una vez que los funcionarios se retiran, acaparando el recurso en beneficio de unos pocos y en perjuicio de los demás usuarios del sector (véase el informe y la prueba adjunta).\n\ne) El ICAA se encuentra gestionando la construcción e instalación de una caja de control con tapa de seguridad que impida el acceso no autorizado de terceros y permita ejecutar las maniobras de distribución equitativa por horarios de forma efectiva (véase el informe y la prueba adjunta).\n\nf) Como medida paliativa inmediata para mitigar la afectación y salvaguardar los derechos a la salud e higiene de la comunidad, la institución accionada mantiene operativo el suministro de agua potable mediante camiones cisterna que recorren la zona para llenar los tanques de almacenamiento domiciliarios. Asimismo, se ha ejecutado el reemplazo de tuberías en el sector para eliminar fugas y optimizar la red existente (véase el informe y la prueba adjunta).\n\ng) Dentro del proceso de planificación sectorial, la institución tiene registrada en su cartera de proyectos la iniciativa denominada “Acueducto Calle Picacho, Alto Guatuso” (asociada al sistema MEA11-Guatuso-Patarrá, código CEG-11-09-F13), la cual se encuentra ubicada en la posición diecisiete de un total de ciento sesenta y seis iniciativas priorizadas por el ICAA, la cual busca la mejora integral del abastecimiento en favor de las comunidades de Dirección01 y Guatuso de Patarrá, estando sujeta a la elaboración de las etapas de estudios (perfil, prefactibilidad y factibilidad) conforme a las metodologías vigentes del MIDEPLAN (véase el informe y la prueba adjunta).\n\nIII.- HECHO NO PROBADO. No se estima demostrado el siguiente hecho de relevancia para esta resolución:\n\nÚnico. Que el recurrente haya presentado alguna gestión ante la Contraloría de Servicios del ICAA.\n\n IV.- SOBRE EL SERVICIO DE AGUA POTABLE. De la relación de los artículos 21 y 50 de la Constitución Política, se desprenden el derecho de las personas a la vida, la salud y a un medio ambiente sano y ecológicamente equilibrado, los cuales se encuentran íntimamente ligados, toda vez, que la vida como valor supremo de la constitución, implica una especial protección, pues sin vida, poca utilidad tendría la protección de los demás derechos fundamentales. Así las cosas, la vida debe ser protegida en todas sus vertientes, desde un aspecto físico, mental y de entorno, y es precisamente ahí donde surge la importancia en proteger el ambiente y los recursos naturales, a fin de procurar el bienestar de las personas. Ahora bien, entre otros aspectos, ese bienestar se logra, a través de la protección y conservación de la calidad y cantidad de los recursos hídricos, para que ésta sea potable para el consumo humano y de esta forma proteger la salud de las personas, ya que al tratarse de un recurso necesario para la higiene, alimento y bebida, su contaminación puede producir graves perjuicios en la salud pública. En ese sentido, la protección y conservación a la que se hace referencia, debe ser brindada por el Estado a través de los órganos que designe al efecto, los cuales deberán adoptar las medidas necesarias para garantizar el acceso de ese recurso a todas las personas, así como velar por el cumplimiento de éstas. Bajo esa tesitura, surge el derecho al agua, el cual puede ser protegido por este Tribunal Constitucional mediante la vía de amparo (sentencia N° 2007-005482, de las 14:39 horas del 24 de abril del 2007, reiterada en múltiples ocasiones, entre ellas la N° 2007-005482, de las 09:20 horas del 31 de enero de 2025).\n\nV.- SOBRE EL FONDO. En el sub lite, de lo informado por parte de los representantes del ICAA, se descarta se hayan violado los derechos fundamentales del recurrente y de la parte amparada. Si bien se acredita que en el sector de Dirección01, Guatuso de Patarrá, Desamparados, existe una situación de carencia de agua potable, no menos cierto es que ello obedece a conductas ajenas a la institución recurrida —véase los hechos probados c y d—. De manera que la autoridad accionada se ha visto obligada a implementar una medida paliativa que consiste de suministrar agua potable en la vivienda que habita el accionante a través de camiones cisterna. Sobre este apartado, esta Sala ha estimado procedente adoptar determinadas medidas para distribuir lo obtenido y así garantizar el suministro posible a los usuarios ya existentes, pues dicha situación no resulta imputable a la institución recurrida (véase en este sentido las sentencias Nos. 2016-14465 de las 9:05 horas del 7 de octubre de 2016, 2014-9134 de las 14:05 horas del 19 de junio de 2014 y 2016-7240 de las 09:20 horas del 27 de mayo 2017, entre otras). En adición a lo anterior, se demostró que el ICAA ha ejecutado el reemplazo de tuberías en el sector para eliminar fugas y optimizar la red existente. Además, tiene registrada en su cartera de proyectos la iniciativa denominada “Acueducto Calle Picacho, Alto Guatuso” (asociada al sistema MEA11-Guatuso-Patarrá, código CEG-11-09-F13), la cual se encuentra ubicada en la posición diecisiete de un total de ciento sesenta y seis iniciativas priorizadas. Igualmente, se encuentra gestionando la construcción e instalación de una caja de control con tapa de seguridad que impida el acceso no autorizado de terceros a la Naciente Olmos y permita ejecutar las maniobras de distribución equitativa por horarios de forma efectiva. Bajo esta inteligencia, se constata que el problema de interrupción y/o disminución del servicio de agua planteado por el recurrente obedece a una condición que no puede ser reprochable al ICAA, puesto que la situación denunciada no es de carácter hidráulico (relacionada con la infraestructura) sino que tiene su origen en inconvenientes de fuerza mayor producto de variables climáticas, limitaciones técnicas de las fuentes del sector y actos de vandalismo en la red. Finalmente, no consta fehacientemente que el recurrente haya presentado alguna gestión ante la Contraloría de Servicios del ICAA. De lo expuesto no se constata violación alguna a los derechos fundamentales del recurrente y de la parte tutelada. San José, at nine thirty a.m. on 13 August 2026.\n\nAmparo proceeding processed in case file number 26-023940-0007-CO, filed by Nombre05, identity card CED01, on their own behalf and on behalf of Nombre02, a minor, Nombre01, and Nombre04, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS (ICAA).\n\nBACKGROUND:\n\n1.- In a written submission received by the Chamber Secretariat at 09:21 on 03 July 2026, the petitioner files an amparo proceeding against the ICAA. According to the order admitting the proceeding, the petitioner states as follows:\n\n“I am a resident of the community of Calle Picacho, Guatuso de Patarrá, Desamparados, where approximately fifty families live and depend on the drinking water service provided by AyA. The petitioner states that the service is not provided continuously, with interruptions of up to ten days and frequent periods of at least four consecutive days without supply. The petitioner indicates that, in response to this situation, AyA distributes water only by tanker trucks on Mondays, Wednesdays, and Fridays, which is insufficient to meet the community’s basic needs for human consumption, hygiene, and sanitation. The petitioner states that complaints and reports have been submitted to AyA’s Service Comptroller’s Office, but to date no effective and lasting solution to the problem has been provided. The petitioner adds that the petitioner’s family faces particular vulnerability due to this shortage, because the petitioner’s wife, Nombre04, was diagnosed approximately four months ago with a malignant breast tumor. She was hospitalized for a month and a half at Hospital de las Mujeres Adolfo Carit Eva and underwent surgery on 20 May 2026 at Hospital San Juan de Dios. She is currently receiving chemotherapy and is unable to return home to care for her children, Nombre02, a minor, and Nombre01, who has an intellectual disability and is under psychiatric care. The petitioner states that the medical center’s Social Work Department has indicated that the petitioner’s wife cannot return to the family home while the continuous shortage of drinking water persists. The petitioner considers that these circumstances violate the fundamental rights of the petitioner and the persons protected by the amparo to health, a dignified life, and access to drinking water. The petitioner asks that the amparo be upheld and that AyA be ordered to immediately guarantee a continuous and sufficient supply of drinking water to the families of the community of Calle Picacho, Guatuso de Patarrá, Desamparados.” (Sic).\n\n2.- Lourdes María Sáurez Barboza, in her capacity as Executive President of the ICAA, reports under oath that, through technical report No. UEN-PyDOCA-GAM-2026-00352 issued by the Operations and Control Directorate, the actions taken by the ICAA in relation to the petitioner’s claim are reported. In summary, the report describes the particularities of water supply in the locality of Dirección01, which arise from climatic variables constituting force majeure, technical limitations of the area’s water sources, and acts of vandalism against the network. She states as follows:\n\n“FIRST: The Calle Picacho, Guatuso de Patarrá, Desamparados sector belongs to the Calle Picacho Operations Zone. This was originally an aqueduct administered by an ASADA, which later came under the direct administration of AyA. The system draws its water from Naciente Olmos, from which it is distributed directly to the population after disinfection. It should be noted that, since assuming responsibility for this aqueduct, the Institution has made substantial improvements to the distribution network to reduce flow losses as much as possible and, due to the sector’s particular operating conditions, users in this area are currently charged a fixed rate. SECOND: The current shortage in Calle Picacho is caused by force majeure beyond the Institute’s control. Naciente Olmos has suffered an approximately 50% reduction in its flow, as a result of the lengthening of the dry season, intensified by the effects of the El Niño climate phenomenon, causing the extracted water to be insufficient to meet the population’s continuous demand. In addition, this is a hydrologically isolated system to which water cannot be transferred from other systems in the GAM. Also, no other water sources with characteristics suitable for human consumption have been identified in that geographic area. THIRD: In addition to the climatic and water-related limitations described above, the equitable distribution of water has been seriously hindered by repeated acts of vandalism attributed to persons outside the institution. When AyA personnel operate the valves to distribute the resource equitably among residents, unauthorized third parties improperly manipulate the system after the employees leave, hoarding the resource for the benefit of a few and to the detriment of the area’s other users. To eliminate this situation, AyA is arranging the construction and installation of a control box with a security cover that will prevent unauthorized access and allow effective implementation of scheduled, equitable distribution. FOURTH: Contrary to the petitioner’s assertions, the Institute has not committed an administrative omission or failed to provide attention. As an immediate mitigating measure to lessen the impact and safeguard the community’s rights to health and hygiene, AyA continues to supply drinking water using tanker trucks that travel through the area to fill household storage tanks. This distribution work is duly documented in the service operation forms (Annex 1 of the Technical Report). The Institution has also replaced pipes in the area to eliminate leaks and optimize the existing network. FIFTH: As a medium- and long-term solution within the sectoral planning process, the Institution has recorded in its project portfolio the initiative called ‘Acueducto Calle Picacho, Alto Guatuso’ (associated with the MEA11-Guatuso-Patarrá system, code CEG-11-09-F13), which is ranked 17th among a total of 166 initiatives prioritized by AyA. This initiative seeks to comprehensively improve water supply for the communities of Calle Picacho and Guatuso de Patarrá and is subject to the preparation of the study stages (Profile, Pre-feasibility, and Feasibility) in accordance with MIDEPLAN’s current methodologies. SIXTH. By official letter No. JD-CS-2026-00693, signed by Nombre03, the Service Comptroller’s Office reports under oath that a detailed search was conducted both in the Service Comptroller’s Office (CS) management and records system and in the CS’s official email, namely ...01. We have no recent records or actions taken directly in the name of Mr. Nombre02, so I cannot address the statements made in the amparo proceeding identified in the subject line. The only item on record with the Service Comptroller’s Office is a copy of a letter that residents of Calle Picacho submitted directly to the Production and Distribution UEN in 2020. Since this matter was submitted to the UEN, no additional action by the Service Comptroller’s Office was warranted. Sixth: Regarding the actions carried out by AYA, the facts established through the technical reports support the conclusion that there has been no arbitrary action or omission attributable to the Costa Rican Institute of Aqueducts and Sewers. The interruption of service results from an event of force majeure or fortuitous event, caused by the severe decrease in flow resulting from the El Niño phenomenon, as well as topographical factors and unforeseeable circumstances such as vandalism against the networks.” (Emphasis in the original).\n\nShe cites the ICAA Regulation on the Provision of Services. She emphasizes that the Institution has acted diligently by using tanker trucks to ensure that the persons protected by the amparo receive this vital resource, replacing damaged infrastructure, planning infrastructure works to protect against vandalism, and including the definitive solution in the institution’s prioritized project portfolio. She reiterates that service provision in the area where the petitioner resides is affected by force majeure or a cause of force majeure, which is addressed under the technical conditions established by the Regulatory Authority (ARESEP), as well as the technical conditions standardized and regulated by the ICAA in the Regulation on the Provision of Services. She asks that the amparo be dismissed.\n\n3.- Xiomara Zúñiga Barrientos, in her capacity as Head of the ICAA’s Desamparados office, reports under oath on terms similar to those in the report submitted by the institution’s Executive President.\n\n4.- Randall Campos Rojas, in his capacity as Deputy Manager of GAM Systems Management at the ICAA, reports under oath on terms similar to those in the report submitted by the institution’s Executive President.\n\n5.- The legal requirements have been observed in the proceedings.\n\nJustice Garro Vargas writes; and,\n\nREASONS:\n\nI.- SUBJECT OF THE AMPARO. The petitioner states that the petitioner is a resident of the community of Calle Picacho, Guatuso de Patarrá, Desamparados, where approximately fifty families live. The petitioner states that the drinking water service provided by the ICAA is not continuous, with interruptions of up to ten days and frequent periods of at least four consecutive days without supply. In response to this situation, the petitioner indicates that the respondent authority distributes water by tanker trucks on Mondays, Wednesdays, and Fridays, which is insufficient to meet the community’s basic needs for human consumption, hygiene, and sanitation. The petitioner adds that complaints and reports have been submitted to the institution’s Service Comptroller’s Office, but to date no effective and lasting solution to the problem has been provided. The petitioner states that the petitioner’s family faces particular vulnerability due to this shortage because the person protected by the amparo was diagnosed with a malignant breast tumor and is currently receiving chemotherapy.\n\nII.- FACTS FOUND. The following facts relevant to deciding this matter are deemed duly established, either because they have been substantiated or because the respondent failed to address them as required by the initial order:\n\na) The petitioner and the persons protected by the amparo are residents of Dirección01, Guatuso de Patarrá, Desamparados (undisputed fact).\n\nb) The sector where the petitioner resides belongs to the Calle Picacho Operations Zone. It was an aqueduct originally administered by an ASADA that came under the ICAA’s direct administration, and it draws its water from Naciente Olmos, from which the water is distributed directly to the population after disinfection (see report and supporting evidence).\n\nc) The shortage of drinking water in Calle Picacho is caused by force majeure beyond the ICAA’s control, since Naciente Olmos has suffered an approximately 50% reduction in its flow as a result of the lengthening of the dry season, intensified by the effects of the El Niño climate phenomenon, causing the extracted water to be insufficient to meet the population’s continuous demand (see report and supporting evidence).\n\nd) Naciente Olmos is a hydrologically isolated system, making it impossible to transfer water from other systems in the GAM. In addition, no other water sources with characteristics suitable for human consumption have been identified in that geographic area. The equitable distribution of water has also been seriously hindered by repeated acts of vandalism attributed to persons outside the institution. When ICAA personnel operate the valves to distribute the resource equitably among residents, unauthorized third parties improperly manipulate the system after the employees leave, hoarding the resource for the benefit of a few and to the detriment of the area’s other users (see report and supporting evidence).\n\ne) The ICAA is arranging the construction and installation of a control box with a security cover that will prevent unauthorized access by third parties and allow effective implementation of scheduled, equitable distribution (see report and supporting evidence).\n\nf) As an immediate mitigating measure to lessen the impact and safeguard the community’s rights to health and hygiene, the respondent institution continues to supply drinking water using tanker trucks that travel through the area to fill household storage tanks. Pipes have also been replaced in the area to eliminate leaks and optimize the existing network (see report and supporting evidence).\n\ng) Within the sectoral planning process, the institution has recorded in its project portfolio the initiative called “Acueducto Calle Picacho, Alto Guatuso” (associated with the MEA11-Guatuso-Patarrá system, code CEG-11-09-F13), which is ranked seventeenth among a total of one hundred sixty-six initiatives prioritized by the ICAA. The initiative seeks to comprehensively improve water supply for the communities of Dirección01 and Guatuso de Patarrá and is subject to the preparation of the study stages (Profile, Pre-feasibility, and Feasibility) in accordance with MIDEPLAN’s current methodologies (see report and supporting evidence).\n\nIII.- FACT NOT PROVEN. The following fact relevant to this decision is not deemed established:\n\nSole fact: That the petitioner submitted any action to the ICAA’s Service Comptroller’s Office.\n\nIV.- THE DRINKING WATER SERVICE. Articles 21 and 50 of the Political Constitution, read together, give rise to people’s rights to life, health, and a healthy and ecologically balanced environment. These rights are closely linked, since life, as the Constitution’s supreme value, requires special protection; without life, protection of the other fundamental rights would have little utility. Accordingly, life must be protected in all its aspects, including physical and mental well-being and a person’s surroundings. This is where the importance of protecting the environment and natural resources arises, in order to promote people’s well-being. Among other things, such well-being is achieved by protecting and preserving the quality and quantity of water resources so that water is potable for human consumption and people’s health is thereby protected. Since water is necessary for hygiene, food, and drink, its contamination can cause serious harm to public health. In this regard, the State must provide the protection and conservation referred to above through the bodies it designates for that purpose. Those bodies must adopt the measures necessary to guarantee everyone access to this resource and ensure compliance with those measures. On that basis, the right to water arises, and this Constitutional Court may protect it by means of an amparo (judgment No. 2007-005482, at 14:39 on 24 April 2007, reiterated on many occasions, including No. 2007-005482, at 09:20 on 31 January 2025).\n\nV.- ON THE MERITS. In this case, the information provided by the ICAA’s representatives rules out a violation of the fundamental rights of the petitioner and the persons protected by the amparo. Although it has been established that there is a shortage of drinking water in the area of Dirección01, Guatuso de Patarrá, Desamparados, it is also true that this results from conduct beyond the respondent institution’s control—see facts found c and d. The respondent authority has therefore been required to implement a mitigating measure consisting of supplying drinking water to the residence where the petitioner lives by means of tanker trucks. On this point, this Chamber has considered it appropriate to adopt certain measures for distributing the water available and thus guaranteeing the possible supply to existing users, since this situation is not attributable to the respondent institution (see, in this regard, judgments Nos. 2016-14465 at 9:05 on 7 October 2016, 2014-9134 at 14:05 on 19 June 2014, and 2016-7240 at 09:20 on 27 May 2017, among others). In addition, it was established that the ICAA has replaced pipes in the area to eliminate leaks and optimize the existing network. It has also recorded in its project portfolio the initiative called “Acueducto Calle Picacho, Alto Guatuso” (associated with the MEA11-Guatuso-Patarrá system, code CEG-11-09-F13), which is ranked seventeenth among a total of one hundred sixty-six prioritized initiatives. It is also arranging the construction and installation of a control box with a security cover that will prevent unauthorized access by third parties to Naciente Olmos and allow effective implementation of scheduled, equitable distribution. On this basis, it is found that the problem of interruption and/or reduction of the water service raised by the petitioner is due to a condition that cannot be attributed to the ICAA, since the reported situation is not hydraulic in nature (related to infrastructure), but originates in force majeure difficulties resulting from climatic variables, technical limitations of the area’s water sources, and vandalism against the network. Finally, there is no reliable evidence that the petitioner submitted any action to the ICAA’s Service Comptroller’s Office. In view of the foregoing, no violation of the fundamental rights of the petitioner or the persons protected by the amparo is established. Therefore, the amparo must be dismissed.\n\nVI.- DOCUMENTS SUBMITTED TO THE CASE FILE. The parties are advised that if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must collect it from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, any material not collected within that period will be destroyed, as provided in the “Regulation on Electronic Case Files before the Judiciary,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 of 26 January 2012, as well as in the agreement approved by the Superior Council of the Judiciary at session No. 43-12 held on 3 May 2012, Article LXXXI.\n\nTHEREFORE:\n\nThe amparo is dismissed.\n\nFernando Castillo V.\n\nPresident\n\nFernando Cruz C.\n\nPaul Rueda L.\n\nLuis Fdo.
