  "body_es_text": "Revisión del Documento\n\n\n\nExp: 26-025059-0007-CO \n\nRes. Nº 2026031076\n\n \n\nSALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas treinta minutos del trece de agosto de dos mil veintiseis .\n\n \n\n Recurso de amparo que se tramita en expediente número 26-025059-0007-CO, interpuesto por Nombre01, cédula de identidad CED03, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS. \n\nResultando:\n\n 1.- Por escrito presentado en la Secretaría de la Sala y, agregado al expediente a las 14:20 horas del 13 de julio de 2026, el recurrente interpone recurso de amparo contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS. Manifiesta, en resumen, que desde hace más de ocho meses, en su hogar y en todo el barrio Pitahaya (distrito Merced, cantón y provincia de San José) se presenta persistentemente baja presión y bajo caudal el servicio de agua potable, situación que afecta a múltiples viviendas del sector. Indica que, durante varios meses ha comunicado la situación al centro de atención telefónica del Instituto Costarricense de Acueductos y Alcantarillados, sin obtener respuesta concreta ni solución efectiva. Refiere que, hace más de tres meses se presentaron personeros del Instituto recurrido a realizar inspecciones en varios medidores del barrio. Narra que, los técnicos concluyeron que existe baja presión y bajo caudal en el servicio. Agrega que, los personeros del recurrido indicaron que se realizaría un reporte y la búsqueda de una pronta solución y le proporcionaron el número de reporte por servicio de bombeo #54004007. Añade que, desde entonces ha vuelto a comunicarse con el centro de atención telefónica de la autoridad recurrida, y le han dicho que, escalarían el caso, pero tras múltiples llamadas no ha habido solución efectiva ni información oportuna sobre plazos ni medidas concretas. Acota que, los números de reporte de cada una de las llamadas son: L2639497, CED01 L2725602. Narra que adicionalmente, en las últimas noches, el servicio ha sido suspendido, con y sin avisos previos, alegando bajo nivel en los tanques, lo que agrava la privación del acceso continuo al agua potable. Agrega que, la situación descrita vulnera el derecho humano fundamental al acceso al agua potable en condiciones adecuadas y afecta otros derechos conexos tales como la salud, la dignidad humana y la higiene. Solicita se declare con lugar el recurso y se ordene al Instituto recurrido implementar, de forma inmediata, las medidas necesarias para restablecer y garantizar el servicio de agua potable con la presión y caudal adecuados en el barrio Pitahaya, distrito Merced.\n\n 2.- Por resolución de las 10:31 horas del 16 de julio de 2026, se da curso al recurso y solicita informe a la Presidencia Ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados. \n\n 3.- Informa bajo juramento Lourdes María Sáurez Barboza, en su condición de presidenta ejecutiva del Instituto Costarricense de Acueductos y Alcantarillados, que el barrio Pitahaya se abastece del sistema La Valencia, cuyo recurso se almacena en los Tanques del Sur. Señala que, la macro distribución del sistema funciona normalmente y que la zona de operación posee continuidad. Refiere que, al atenderse la orden de servicio n.° 54004007, el 20 de marzo de 2026, se registró una presión de 10 metros de columna de agua y que las mediciones efectuadas los días 17 y 20 de julio de 2026, arrojaron el mismo resultado. Afirma que, ese valor corresponde al mínimo exigido por el artículo 9, del Reglamento para la Prestación de los Servicios de AyA. Agrega que, se identifica una oportunidad de mejora para aumentar la presión mediante una interconexión en la tubería de PVC de 150 mm, ubicada en Dirección02, cuya ejecución se programa para el cuarto trimestre de 2026. Solicita que se declare sin lugar el recurso.\n\n4.- En los procedimientos seguidos se ha observado las prescripciones legales.\n\n Redacta el Magistrado Salazar Alvarado; y,\n\n \n\n Considerando:\n\n I.- Objeto del recurso. El recurrente alega que, durante más de ocho meses, el servicio de agua potable en su vivienda y en barrio Pitahaya es prestado con presión y caudal insuficientes; también sostuvo que ocurrieron suspensiones nocturnas, algunas sin aviso, y que sus gestiones telefónicas no produjeron una solución ni información oportuna. Considera lesionado los derechos protegidos por los artículos 21 y 50, de la Constitución Política, y del derecho al buen funcionamiento de los servicios públicos. \n\n II.- Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial: \n\na) El recurrente reside en barrio Pitahaya, distrito Merced, cantón y provincia de San José, y su servicio de agua potable estaba identificado con el NIS 3219992 (hecho no controvertido).\n\nb) El sector de barrio Pitahaya se abastece del sistema La Valencia, cuyo recurso se almacenaba en los Tanques del Sur (ver informe técnico G-GSGAM-MZOESTE-2026-00747).\n\nc) El 20 de marzo de 2026, el Instituto Costarricense de Acueductos y Alcantarillados atendió la orden de servicio N° CED02 registró una presión de 10 metros de columna de agua (ver informe técnico G-GSGAM-MZOESTE-2026-00747).\n\nd) Los días 17 y 20 de julio de 2026, la institución recurrida efectuó mediciones directamente en la casa del recurrente y registró una presión de diez metros de columna de agua, que corresponde al mínimo exigido por la normativa (ver informe técnico G-GSGAM-MZOESTE-2026-00747).\n\ne) El informe técnico institucional señaló que, al momento de su elaboración, el sistema La Valencia operaba normalmente a nivel de macro distribución y la zona de operación Tanques del Sur poseía continuidad en el servicio (ver informe técnico G-GSGAM-MZOESTE-2026-00747).\n\nf) La parte recurrida programó para el cuarto trimestre de 2026, una interconexión en la tubería de PVC de 150 mm ubicada en Dirección02, con el propósito de aumentar la presión del sector (ver informe técnico G-GSGAM-MZOESTE-2026-00747).\n\n III.- Hechos no probados. No se estiman demostrados los siguientes hechos de relevancia para esta resolución:\n\na) Que el caudal suministrado en el punto de conexión fuera insuficiente para cubrir las necesidades personales y domésticas básicas del recurrente.\n\nb) Que se hubieran producido interrupciones nocturnas con una frecuencia o duración que impidiera el acceso continuo y suficiente al agua potable, o que alguna de ellas se hubiera prolongado por más de seis horas naturales. \n\nc) Que la institución recurrida hubiera omitido comunicar una interrupción programada o no programada en los términos establecidos por la normativa técnica aplicable\n\nIV.- Sobre el servicio de agua potable. De la relación de los artículos 21 y 50, de la Constitución Política, se desprenden el derecho de las personas a la vida, la salud y a un medio ambiente sano y ecológicamente equilibrado, los cuales se encuentran íntimamente ligados, toda vez, que la vida como valor supremo de la constitución, implica una especial protección, pues sin vida, poca utilidad tendría la protección de los demás derechos fundamentales. Así las cosas, la vida debe ser protegida en todas sus vertientes, desde un aspecto físico, mental y de entorno, y es precisamente ahí donde surge la importancia en proteger el ambiente y los recursos naturales, a fin de procurar el bienestar de las personas. Ahora bien, entre otros aspectos, ese bienestar se logra, a través de la protección y conservación de la calidad y cantidad de los recursos hídricos, para que ésta sea potable para el consumo humano y de esta forma proteger la salud de las personas, ya que al tratarse de un recurso necesario para la higiene, alimento y bebida, su contaminación puede producir graves perjuicios en la salud pública. En ese sentido, la protección y conservación a la que se hace referencia, debe ser brindada por el Estado a través de los órganos que designe al efecto, los cuales deberán adoptar las medidas necesarias para garantizar el acceso de ese recurso a todas las personas, así como velar por el cumplimiento de éstas. Bajo esa tesitura, surge el derecho al agua, el cual puede ser protegido por este Tribunal Constitucional mediante la vía de amparo (Sentencia N° 2007-005482, de las 14:39 horas del 24 de abril del 2007, reiterada en múltiples ocasiones, entre ellas la N° 2007-005482, de las 09:20 horas del 31 de enero de 2025).\n\n V.- Sobre el fondo. Es importante señalar que, el Reglamento para la Prestación de los Servicios de AyA establece en el artículo 9, que la presión dinámica mínima que el prestador debe garantizar es de diez metros de columna de agua en el punto de conexión donde se ubicara el sistema de medición. Por su parte, el Reglamento Técnico “Prestación del suministro de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes (AR-RT-SUMAAH-2023)” ordena que el servicio se brinde, como regla, sin interrupción las veinticuatro horas del día y los trescientos sesenta y cinco días del año, con las condiciones de calidad y cantidad reglamentarias. También dispone que, las interrupciones programadas sean comunicadas con al menos cuarenta y ocho horas naturales de antelación y las no programadas dentro de las cuatro horas naturales posteriores a su detección o reporte. Si una interrupción diaria se prolongaba por más de seis horas naturales, el prestador debía garantizar un medio alternativo suficiente para cubrir las necesidades básicas (artículo 33). \n\n En el sub lite, es menester tener presente que el derecho humano al agua es el derecho de todos a disponer de agua suficiente, salubre, aceptable, accesible y asequible para el uso personal y doméstico. Del examen integral de los autos y del elenco de hechos probados se desprende, en primer término, que se registró una presión de 10 metros de columna de agua (m.c.a.) en el servicio que abastece la vivienda del recurrente. Tal resultado se obtuvo en tres mediciones realizadas los días 20 de marzo, 17 de julio y 20 de julio de 2026, y coincide, según en lo indicado en el informe técnico y lo manifestado bajo juramento por la autoridad recurrida, con el parámetro mínimo reglamentario exigido en el punto de conexión donde se ubica el sistema de medición. Si bien el recurrente afirma que, el servicio presenta baja presión, no consta en autos alguna medición contradictoria ni otro elemento técnico que permita concluir que este se presta por debajo del umbral establecido. En consecuencia, no corresponde a esta jurisdicción sustituir el criterio técnico objetivamente acreditado por una apreciación que carece de respaldo probatorio verificable. \n\n En segundo término, aunque el recurrente también acusa un bajo caudal, el expediente no contiene aforos, registros de consumo, informes técnicos ni otros elementos que permitan determinar que la cantidad de agua disponible en el punto de conexión resulta insuficiente para satisfacer sus necesidades personales y domésticas básicas. Ciertamente, la medición de la presión no equivale, por sí misma, a una medición del caudal; sin embargo, tampoco permite inferir automáticamente una insuficiencia cuantitativa, máxime cuando, según lo dicho bajo juramento por la autoridad recurrida, alcanzó el mínimo reglamentario. Nótese que, la determinación de eventuales pérdidas, obstrucciones o deficiencias en las instalaciones internas ubicadas después del sistema de medición requiere de una actividad probatoria técnica más amplia, propia de la vía de legalidad, salvo que de los autos se desprendiera una lesión manifiesta de derechos fundamentales, circunstancia que no se verifica en este asunto.\n\n En tercer término, en el informe rendido bajo juramento la autoridad recurrida señala que la macro distribución del sistema La Valencia opera normalmente y que la zona de operación de los Tanques del Sur mantiene continuidad en el servicio. Frente a ello, la referencia genérica del recurrente a suspensiones ocurridas “en las últimas noches” no precisa las fechas, la duración ni la frecuencia de tales interrupciones, ni identifica las viviendas concretamente afectadas ni tampoco aporta prueba que confirme su dicho. Por consiguiente, no se acredita una privación del servicio equiparable a los supuestos en los que esta Sala ha declarado con lugar recursos de amparo por cortes prolongados, disponibilidad diaria durante lapsos mínimos o ausencia de mecanismos alternativos de abastecimiento, como ocurrió en la sentencia N° 2024019561, de las 09:20 horas del 12 de julio de 2024. Por el contrario, el caso presenta mayor afinidad con el examinado en la Sentencia N° 2025-013762, de las 09:15 horas del 09 de mayo de 2025, en la que se descartó la lesión constitucional y afirmó que:\n\n “En primer lugar, de acuerdo con el criterio reiterado de la Sala Constitucional, el derecho humano al agua potable no implica la garantía de un suministro ininterrumpido en todo momento, sino el deber del Estado de asegurar un acceso razonable, seguro, suficiente y salubre al recurso hídrico, tomando en cuenta las limitaciones técnicas y naturales.” \n\n En efecto, al acreditarse que las mediciones de presión registran el mínimo reglamentario establecido en el artículo 09 del Reglamento para la Prestación de los Servicios de AyA, la Sala no constata que, ello haya lesionado los derechos fundamentales del tutelado\n\n Asimismo, la programación de una interconexión destinada a incrementar la presión durante el cuarto trimestre de 2026 no comporta, por sí sola, el reconocimiento de una infracción constitucional, ya que la institución recurrida califica esa intervención como una oportunidad de mejora y, según las mediciones incorporadas al expediente, el servicio ya alcanza el parámetro mínimo exigible. Por ello, el anuncio de esa obra de optimización no permite concluir que, al momento de interponerse el recurso, el suministro se prestara en condiciones contrarias al ordenamiento jurídico.\n\n Finalmente, las referencias a las llamadas telefónicas y a los números de reporte tampoco permiten tener por demostrada una lesión al derecho a una justicia pronta y cumplida, ya que la orden de servicio n.° 54004007, fue atendida mediante una inspección y la correspondiente medición de presión. La disconformidad del interesado con la solución técnica adoptada no equivale, por sí sola, a una omisión de resolución del trámite susceptible de tutela en esta vía.\n\n Así las cosas, no se acredita una actuación u omisión arbitraria atribuible al Instituto Costarricense de Acueductos y Alcantarillados que haya vulnerado los derechos fundamentales del amparado, por lo que procede declarar sin lugar el recurso. Lo anterior se entiende sin perjuicio del deber permanente de la institución recurrida de mantener el servicio dentro de los parámetros reglamentarios de presión y cantidad, garantizar su continuidad, comunicar oportunamente cualquier interrupción y proporcionar medios alternativos de abastecimiento cuando se configuren los supuestos previstos en el “Reglamento Técnico Prestación del suministro de los Servicios de Acueducto, Alcantarillado Sanitario e Hidrantes (AR-RT-SUMAAH-2023)”.\n\n VI.- DOCUMENTACIÓN APORTADA AL EXPEDIENTE. Se previene a las partes que, de haber aportado algún documento en papel, así como objetos o pruebas contenidas en algún dispositivo adicional de carácter electrónico, informático, magnético, óptico, telemático o producido por nuevas tecnologías, estos deberán ser retirados del despacho en un plazo máximo de treinta días hábiles, contados a partir de la notificación de esta sentencia. De lo contrario, será destruido todo aquel material que no sea retirado dentro de este plazo, según lo dispuesto en el \"Reglamento sobre Expediente Electrónico ante el Poder Judicial\", aprobado por la Corte Plena en Sesión N° 27-11, del 22 de agosto del 2011, artículo XXVI y publicado en el Boletín Judicial N° 19, del 26 de enero del 2012, así como en el acuerdo aprobado por el Consejo Superior del Poder Judicial, en la Sesión N° 43-12, celebrada el 3 de mayo del 2012, artículo LXXXI. \n\nPor tanto:\n\n Se declara sin lugar el recurso.-\n\n \n\n \n\n \n\nFernando Castillo V.\n\nPresidente\n\n \n\nFernando Cruz C.\n\n \n\nPaul Rueda L.\n\nLuis Fdo.   "body_en_text": "Review of the Document\n\n\n\nExp: 26-025059-0007-CO\n\nRes. Nº 2026031076\n\n\nCONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at 9:30 a.m. on 13 August 2026.\n\nAmparo proceeding filed in case file number 26-025059-0007-CO, brought by Nombre01, identity card CED03, against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS.\n\nBackground:\n\n1.- In a brief submitted to the Chamber’s Secretariat and added to the case file at 14:20 on 13 July 2026, the petitioner files an amparo proceeding against the COSTA RICAN INSTITUTE OF AQUEDUCTS AND SEWERS. In summary, the petitioner states that for more than eight months, their home and the entire Pitahaya neighborhood (Merced district, canton and province of San José) have persistently experienced low pressure and low flow in the drinking-water service, affecting multiple homes in the area. The petitioner indicates that for several months they have reported the situation to the Costa Rican Institute of Aqueducts and Sewers’ telephone service center without receiving a concrete response or effective solution. The petitioner says that more than three months ago, personnel from the respondent Institute came to inspect several meters in the neighborhood. The petitioner recounts that the technicians concluded that the service had low pressure and low flow. The petitioner adds that the respondent’s personnel said a report would be prepared and a prompt solution sought, and provided report number #54004007 for the pumping service. The petitioner further states that since then they have again contacted the respondent authority’s telephone service center and have been told the case would be escalated, but despite multiple calls there has been no effective solution or timely information about deadlines or specific measures. The petitioner notes that the report numbers for the calls are: L2639497, CED01 L2725602. The petitioner recounts that, in addition, in recent nights the service has been suspended, with and without prior notice, on the grounds that tank levels were low, worsening the deprivation of continuous access to drinking water. The petitioner adds that the situation described violates the fundamental human right to access drinking water under adequate conditions and affects related rights such as health, human dignity, and hygiene. The petitioner asks that the amparo application be granted and that the respondent Institute be ordered to immediately implement the measures needed to restore and ensure drinking-water service at adequate pressure and flow in Pitahaya neighborhood, Merced district.\n\n2.- By order issued at 10:31 on 16 July 2026, the proceeding was admitted and a report was requested from the Executive Presidency of the Costa Rican Institute of Aqueducts and Sewers.\n\n3.- Lourdes María Sáurez Barboza, in her capacity as Executive President of the Costa Rican Institute of Aqueducts and Sewers, reports under oath that Pitahaya neighborhood is supplied by the La Valencia system, whose water resource is stored in the Tanques del Sur. She states that the system’s macro-distribution operates normally and that the operating area has continuity of service. She reports that when service order No. 54004007 was handled on 20 March 2026, a pressure of 10 meters of water column was recorded, and measurements taken on 17 and 20 July 2026 yielded the same result. She asserts that this value corresponds to the minimum required under Article 9 of the Regulations for the Provision of AyA Services. She adds that an opportunity for improvement has been identified to increase pressure through an interconnection in the 150 mm PVC pipe located at Dirección02, scheduled for implementation in the fourth quarter of 2026. She asks that the amparo application be denied.\n\n4.- The legal requirements have been observed in the proceedings.\n\nJustice Salazar Alvarado drafts the decision; and,\n\nReasons:\n\nI.- Subject of the amparo application. The petitioner alleges that for more than eight months, drinking-water service at their home and in Pitahaya neighborhood has been provided at insufficient pressure and flow; the petitioner also maintained that nighttime suspensions occurred, some without notice, and that telephone inquiries produced neither a solution nor timely information. The petitioner considers the rights protected by Articles 21 and 50 of the Political Constitution, and the right to the proper functioning of public services, to have been violated.\n\nII.- Facts proven. The following facts relevant to deciding this matter are deemed duly established, either because they have been substantiated or because the respondent failed to address them as required by the initial order:\n\na) The petitioner resides in Pitahaya neighborhood, Merced district, canton and province of San José, and their drinking-water service was identified by NIS 3219992 (undisputed fact).\n\nb) The Pitahaya neighborhood area is supplied by the La Valencia system, whose water resource was stored in the Tanques del Sur (see technical report G-GSGAM-MZOESTE-2026-00747).\n\nc) On 20 March 2026, the Costa Rican Institute of Aqueducts and Sewers handled service order No. CED02 and recorded a pressure of 10 meters of water column (see technical report G-GSGAM-MZOESTE-2026-00747).\n\nd) On 17 and 20 July 2026, the respondent institution took measurements directly at the petitioner’s home and recorded a pressure of 10 meters of water column, which corresponds to the minimum required by the regulations (see technical report G-GSGAM-MZOESTE-2026-00747).\n\ne) The institutional technical report stated that, when it was prepared, the La Valencia system was operating normally at the macro-distribution level and the Tanques del Sur operating area had continuity of service (see technical report G-GSGAM-MZOESTE-2026-00747).\n\nf) The respondent party scheduled, for the fourth quarter of 2026, an interconnection in the 150 mm PVC pipe located at Dirección02, for the purpose of increasing pressure in the area (see technical report G-GSGAM-MZOESTE-2026-00747).\n\nIII.- Facts not proven. The following facts relevant to this decision are not deemed established:\n\na) That the flow supplied at the connection point was insufficient to meet the petitioner’s basic personal and domestic needs.\n\nb) That nighttime interruptions occurred with a frequency or duration that prevented continuous and sufficient access to drinking water, or that any of them lasted more than six natural hours.\n\nc) That the respondent institution failed to communicate a scheduled or unscheduled interruption in the manner established by the applicable technical regulations.\n\nIV.- Drinking-water service. Articles 21 and 50 of the Political Constitution, read together, give rise to the rights to life, health, and a healthy and ecologically balanced environment, which are closely linked, since life, as the Constitution’s supreme value, requires special protection; without life, protection of the other fundamental rights would have little use. Accordingly, life must be protected in all its dimensions—physical, mental, and environmental—and this is precisely where the importance of protecting the environment and natural resources arises, in order to promote people’s well-being. Among other things, that well-being is achieved by protecting and conserving the quality and quantity of water resources so that the water is potable for human consumption and people’s health is thereby protected. Because water is necessary for hygiene, food, and drink, its contamination can cause serious harm to public health. In this regard, the State must provide the protection and conservation mentioned above through the bodies it designates for that purpose, which must adopt the measures necessary to guarantee everyone access to this resource and ensure compliance with those measures. On that basis, the right to water arises, and this Constitutional Court may protect it through an amparo proceeding (Judgment No. 2007-005482, issued at 14:39 on 24 April 2007, reiterated on multiple occasions, including No. 2007-005482, issued at 09:20 on 31 January 2025).\n\nV.- Merits. It is important to note that Article 9 of the Regulations for the Provision of AyA Services establishes that the minimum dynamic pressure the service provider must ensure is 10 meters of water column at the connection point where the metering system is located. For its part, the Technical Regulation “Provision of Water Supply, Sanitary Sewerage, and Hydrant Services (AR-RT-SUMAAH-2023)” requires that, as a rule, service be provided without interruption 24 hours a day and 365 days a year, under the prescribed quality and quantity conditions. It also provides that scheduled interruptions be communicated at least 48 natural hours in advance, and unscheduled interruptions within four natural hours after they are detected or reported. If a daily interruption lasted more than six natural hours, the provider had to ensure a sufficient alternative means of meeting basic needs (Article 33).\n\nIn the present case, it must be borne in mind that the human right to water is the right of everyone to have sufficient, safe, acceptable, accessible, and affordable water for personal and domestic use. A comprehensive review of the case file and the proven facts shows, first, that a pressure of 10 meters of water column (m.c.a.) was recorded for the service supplying the petitioner’s home. This result was obtained in three measurements taken on 20 March, 17 July, and 20 July 2026, and, according to the technical report and the respondent authority’s sworn statement, matches the minimum regulatory standard required at the connection point where the metering system is located. Although the petitioner asserts that the service has low pressure, the case file contains no contradictory measurement or other technical evidence supporting a conclusion that service is provided below the established threshold. Accordingly, this jurisdiction cannot substitute an objectively substantiated technical assessment with an opinion lacking verifiable evidentiary support.\n\nSecond, although the petitioner also alleges low flow, the case file contains no flow measurements, consumption records, technical reports, or other evidence that would establish that the quantity of water available at the connection point is insufficient to meet the petitioner’s basic personal and domestic needs. Certainly, a pressure measurement is not, in itself, a flow measurement; however, neither does it automatically allow an inference of quantitative insufficiency, particularly when, according to the respondent authority’s sworn statement, it reached the regulatory minimum. Note that determining any losses, obstructions, or deficiencies in internal installations located downstream of the metering system requires broader technical evidentiary proceedings, which belong in the administrative-litigation jurisdiction, unless the case file showed a manifest violation of fundamental rights, a circumstance not present here.\n\nThird, in its sworn report, the respondent authority states that the La Valencia system’s macro-distribution operates normally and that the Tanques del Sur operating area maintains continuity of service. In response, the petitioner’s general reference to suspensions occurring “in recent nights” does not specify their dates, duration, or frequency, identify the particular homes affected, or provide evidence confirming the petitioner’s account. Consequently, a deprivation of service comparable to the cases in which this Chamber has granted amparo applications because of prolonged cuts, daily availability limited to brief periods, or the absence of alternative supply mechanisms has not been established, as occurred in Judgment No. 2024019561, issued at 09:20 on 12 July 2024. Rather, this case more closely resembles the one examined in Judgment No. 2025-013762, issued at 09:15 on 09 May 2025, in which a constitutional violation was rejected and the following was stated:\n\n“First, according to the Constitutional Chamber’s repeated position, the human right to drinking water does not guarantee uninterrupted supply at all times; rather, it requires the State to ensure reasonable, safe, sufficient, and sanitary access to the water resource, taking technical and natural limitations into account.”\n\nIndeed, given that the pressure measurements record the regulatory minimum established in Article 09 of the Regulations for the Provision of AyA Services, the Chamber does not find that this has violated the protected person’s fundamental rights.\n\nLikewise, the scheduling of an interconnection intended to increase pressure during the fourth quarter of 2026 does not, by itself, amount to recognition of a constitutional violation, since the respondent institution describes the work as an opportunity for improvement and, according to the measurements included in the case file, the service already meets the required minimum standard. Therefore, the announcement of this optimization work does not support a conclusion that, when the amparo application was filed, the supply was being provided under conditions contrary to the legal system.\n\nFinally, the references to telephone calls and report numbers also do not establish a violation of the right to prompt and effective justice, since service order No. 54004007 was handled through an inspection and the corresponding pressure measurement. The interested party’s disagreement with the technical solution adopted does not, by itself, amount to a failure to resolve the matter that may be remedied through this proceeding.\n\nAccordingly, no arbitrary act or omission attributable to the Costa Rican Institute of Aqueducts and Sewers that violated the fundamental rights of the amparo applicant has been established; the amparo application must therefore be denied. This is without prejudice to the respondent institution’s ongoing duty to maintain service within the regulatory pressure and quantity parameters, ensure its continuity, timely communicate any interruption, and provide alternative supply when the circumstances set out in the “Technical Regulation on the Provision of Water Supply, Sanitary Sewerage, and Hydrant Services (AR-RT-SUMAAH-2023)” apply.\n\nVI.- DOCUMENTATION SUBMITTED TO THE CASE FILE. The parties are advised that if they submitted any paper document, as well as any objects or evidence contained in an additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve them from the office within a maximum period of 30 business days from notification of this judgment. Otherwise, all material not retrieved within that period will be destroyed, as provided in the “Regulations on Electronic Case Files before the Judiciary,” approved by the Full Court at Session No. 27-11, on 22 August 2011, Article XXVI, and published in Judicial Bulletin No. 19 on 26 January 2012, as well as in the agreement approved by the Superior Council of the Judiciary at Session No. 43-12, held on 3 May 2012, Article LXXXI.\n\nTherefore:\n\nThe amparo application is denied.-\n\n\nFernando Castillo V.\n\nPresident\n\n\nFernando Cruz C.\n\n\nPaul Rueda L.\n\nLuis Fdo.
